This book examines the legal and moral theory behind the law of evidence and proof, arguing that only by exploring the nature of responsibility in fact-finding can the role and purpose of much of the law be fully understood. Ho argues that the court must not only find the truth to do justice, it must do justice in finding the truth.

In recent decades, the intertwining ideas of self-determination and well-being have received tremendous support in bioethics. Discussions regarding self-determination, or autonomy, often focus on two dimensions—the capacity of the patient and the freedom from external coercion. The practice of obtaining informed consent, for example, has become a standard procedure in therapeutic and research medicine. On the surface, it appears that patients now have more opportunities to exercise their self-determination than ever. Nonetheless, discussions of patient autonomy in the bioethics literature, which (...) focus on individual patients making particular decisions, neglect the social structure within which health-care decisions are made. Looking through the lens of disability and informed by the feminist conception of relational autonomy, this essay argues that the issue of autonomy is much more complex than the individualist model suggests. The social system and the ableist ideology impose various forms of pressure or oppressive power that can affect people’s ability to choose according to their value system. Even if such powers are not directly coercive, they influence potential parents’ decisions indirectly—they structure their alternatives in such a way that certain options are never considered as viable and other decisions must be made. This paper argues that, instead of only focusing on the individual act of decision-making, we need to pay attention to the social structure that frames people’s decision. (shrink)

Since J. McTaggart’s paper on “The Unreality of Time” the opposition of “A-theorists” and “B-theorists” establishes a focal point in the modern debate on the metaphysics of time: While “A-theorists” claim the existence of an objective present, moving along time positions, “B-theorists” maintain that time is just a set of ontologically equivalent coordinates, “now” being merely the indexical of the speaker’s position. Contemporary attempts to resolve the issue by resorting to the analysis of language or to the theory of science (...) seem to deliver no definite results. By contrast, practical and existential aspects of the two models promise to be more univocal guides in deciding between them. Particularly, C. D. Broad’s hybrid conception of a “growing block theory” attains special attractiveness in this regard. (shrink)

Artificial intelligence (AI) has transformed the way people engage with politics around the world: how citizens consume news, how they view the institutions and norms, how civic groups mobilize public interests, how data-driven campaigns are shaping elections, and so on (Ho & Vuong, 2024). Placing people at the center of the increasingly AI-mediated political landscape has become an urgent matter that transcends all forms of institutions. In this essay, we argue that, in this era, it is necessary to look beyond (...) certain limited notions of democracy and broaden our views of what it means to put people at the heart of political governance. Thus, we introduce some key features of a very, if not the most important concept, in East Asian political culture, ‘people as roots (of the state)’ or (dân bản in Vietnamese and 民本 in Chinese) . We propose that a more culturally sensitive analysis, which takes into account the diverse interpretations of people-centeredness within different political cultures, can provide valuable insights for researchers and leaders worldwide. Indeed, as the sociologist Shmuel Eisenstadt succinctly puts, modernity does not and should not correspond to Westernization. (shrink)

Tuy nhiên, trong khoảng 10 năm trở lại đây, thế giới đã thường xuyên ghi nhận những vụ bê bối về đạo đức nghiên cứu tại Nhật Bản. Xem xét kĩ lưỡng nội dung chi tiết (...) các vụ bê bối có thể thấy Nhật Bản đang gặp phải những thách thức nan giải trong việc ngăn chặn và kiểm soát vi phạm đạo đức nghiên cứu. Một phần quan trọng của thách thức này là sự xung đột giữa một bên là những yếu tố có tính lịch sử và văn hóa, và bên kia là sự phát triển của công nghệ thông tin và xu hướng hợp tác quốc tế mở rộng. Nghiên cứu trường hợp của Nhật Bản có thể mang lại những bài học quan trọng trong việc xây dựng khả năng đào tạo và quản lí đạo đức nghiên cứu tại một nền khoa học mới hội nhập như Việt Nam. This article synthesizes the current theoretical attempts to understand human-machine interactions and introduces seven premises to understand our emerging dynamics with increasingly competent, pervasive, and instantly accessible algorithms. The hope that these seven premises can build toward a social theory of human-AI cocreation. The focus on human-AI cocreation is intended to emphasize two factors. First, is the fact that our machine learning systems are socialized. Second, is the coevolving nature of human mind and AI systems as smart devices form an (...) indispensable part of our cognitive scaffolds, thus, shaping how we perceive the world and ourselves. The seven premises include: primacy of social structures; human’s desire for freedom and autonomy; AI systems will form inseparable parts of our cognitive/affective scaffolds and can change our self-understanding; philosophy and humanistic foundations on human flourishing as a guide to human-AI interaction; mindsponge information-filtering process; acculturative process of how values change and emerge from human-AI interaction; overlapping Venn diagram of the human-human, human-nature, and human-machine interactions. This article concludes with a discussion on human agency in our entanglements with socialized machines and the illusoriness of the Cartesian agent view of the mind. (shrink)

The prospective introduction of autonomous cars into public traffic raises the question of how such systems should behave when an accident is inevitable. Due to concerns with self-interest and liberal legitimacy that have become paramount in the emerging debate, a contractarian framework seems to provide a particularly attractive means of approaching this problem. We examine one such attempt, which derives a harm minimisation rule from the assumptions of rational self-interest and ignorance of one’s position in a future accident. We contend, (...) however, that both contractarian approaches and harm minimisation standards are flawed, due to a failure to account for the fundamental difference between those ‘involved’ and ‘uninvolved’ in an impending crash. Drawing from classical works on the trolley problem, we show how this notion can be substantiated by reference to either the distinction between negative and positive rights, or to differences in people’s claims. By supplementing harm minimisation with corresponding constraints, we can develop crash algorithms for autonomous cars which are both ethically adequate and promise to overcome certain significant practical barriers to implementation. Recent developments in neuroscience have inspired proposals to perform deep brain stimulation on psychopathic detainees. We contend that these proposals cannot meet important ethical requirements that hold for both medical research and therapy. After providing a rough overview of key aspects of psychopathy and the prospects of tackling this condition via deep brain stimulation, we proceed to an ethical assessment of such measures, referring closely to the distinctive features of psychopathic personality, particularly the absence of subjective suffering and a lack (...) of moral motivation. Scrutiny of these factors reveals that two essential bioethical criteria, individual medical benefit and voluntary informed consent, cannot be met in performing neurosurgical experiments or treatments on psychopathic inmates. The hypergrowth and hyperconnectivity of networks of artificial intelligence (AI) systems and algorithms increasingly cause our interactions with the world, socially and environmentally, more technologically mediated. AI systems start interfering with our choices or making decisions on our behalf: what we see, what we buy, which contents or foods we consume, where we travel to, who we hire, etc. It is imperative to understand the dynamics of human-computer interaction in the age of progressively more competent AI. This paper defends the strong thesis of ethical egoism, the view that self-interest is the exclusive standard of morally right action. The method of defense is that of reflective equilibrium, viz., back and forth reflection on intuitive judgments in particular cases and the principles that seem to explain our judgments, with the goal of aligning the two. The defense proceeds in three steps. First, I define what selfishness is and characterize what selfishness looks like in real life; an accurate depiction (...) of selfishness will show that selfishness, at least generally, is morally attractive. Second, I defend the view that helping others and not helping others is morally right when and because doing so serves one’s self-interest. This essay seeks to understand what it means for the human collective when AI technologies have become a predominant force in each of our lives through identifying three moral dilemmas (i.e., tragedy of the commons, tragedy of commonsense morality, tragedy of apathy) that shape human choices. In the first part, we articulate AI-driven versions of the three moral dilemmas. Then, in the second part, drawing from evolutionary psychology, existentialism, and East Asian philosophies, we argue that a deep appreciation of three (...) shades of human finitude can help us mitigate harmful effects of the AI-driven versions of the three tragedies and even transcend them. According to the neo-Aristotelian moral tradition, every living thing has an ultimate end: To flourish as a member of its species. This view of the ultimate end shapes inquiry into what is the ultimate end of human living things. In this paper, I develop an alternative view of the ultimate end of a living thing: The ultimate end is only to survive, not as a member of a species, but as a living thing. There are four steps to my development. (...) First, I criticize the prevailing species-based view of the ultimate end. Second, I argue that other-regarding behavior is not normative for living things; only survival is. Third, I elucidate a new and what I take to be correcting understanding of survival. Fourth, I programmatically develop the idea that inquiry into human well-being and into morality (for human beings) should be understood as aspects of inquiry into human survival. (shrink)

This paper defends the view that intrinsic benefit to a human being consists exclusively in survival. It takes as its point of departure the neo-Aristotelian view that inquiry into intrinsic benefit to a human being should take place within a wider theory of intrinsic benefit to living things, generally. The paper first argues that the neo-Aristotelian view that intrinsic benefit to a living thing consists in flourishing as a member of its species, is mistaken. Rather, intrinsic benefit to a living (...) thing consists in survival, and not survival as a member of its species, but survival simpliciter. A refined understanding of survival is developed in the paper. The paper then applies this Survivalist account of intrinsic benefit to human beings: The things we take to be good for human beings—e.g., pleasure, desire-fulfillment, etc.—are good to the extent and because they promote the one intrinsic benefit of survival. A number of traditional philosophers and religious thinkers advocated an ineffability thesis to the effect that the ultimate reality cannot be expressed as it truly is by human concepts and words. However, if X is ineffable, the question arises as to how words can be used to gesture toward it. We can't even say that X is unsayable, because in doing so, we would have made it sayable. In this article, I examine the solution offered by the fifth-century Indian grammarian-philosopher (...) Bhartrhari and develop it into a linguistic strategy based on the imposition-cum-negation method. The purpose is to show how we can non-contradictorily say, or rather indicate, the unsayable. Mahayana Buddhist philosophers’ attitude toward language is notoriously negative. The transcendental reality is often said to be ineffable. One’s obsession to apprehend the truth through words is an intellectual disease to be cured Attachment to verbal and conceptual proliferation enslaves oneself in the afflictive circle of life and death. Nevertheless, no Buddhist can afford to overlook the significance of language in preaching Buddhist dharmas as well as in day-to-day transactions. The point is not that of keeping silence. Rather, one should (...) understand and use language in such a way that one alludes to the unsayable reality and somehow escapes the bewitchment of language. Perhaps with this realization in mind, Mahayana Buddhist metaphysicians had fostered the penchant for using, at the sentential level, denials, negations and paradoxes to couch their views. In a similar vein but mainly at the word level, Dignaga (ca. 480-540 CE) the Yogacara epistemologist’ offered us a theory of language known as apoha doctrine in his landmark work Pramiinasamuccaya (henceforth PS). Satirical cartooning in Vietnam is subject to a complex dynamic: an increasingly liberalised and internationalised economy, and the rise of social media in a one-party state. This article examines what state-sanctioned satirical cartoons can reveal about the representation and management of political criticism in such a context. We find a growing trend of depicting corruption as a systemic problem, which is present in 45 per cent of the sample and in 70 per cent of the 20 most-viral cartoons in one (...) of Vietnam’s most popular magazines, Tuoi Tre Cuoi (Youth Humour). This trend can be interpreted as a change in the sensibility of audiences and a shift toward a more tolerant media landscape. The trend, however, may also be a worrying sign of the dual dangers of cynicism in Vietnamese politics: the development of apathy among audiences and the cynical use of art by authorities. Despite these concerns, we argue, political cartoons in Vietnam provide an important public avenue for collective political reflection and everyday social solidarity. (shrink)

This paper endeavors to understand the research landscape of finance research in Vietnam during the period 2008 to 2020 and predict the key defining future research directions. Using the comprehensive database of Vietnam’s international publications in social sciences and humanities, we extract a dataset of 314 papers on finance topics in Vietnam from 2008 to 2020. Then, we apply a systematic approach to analyze four important themes: Structural issues, Banking system, Firm issues, and Financial psychology and behavior. Overall, there have (...) been three noticeable trends within finance research in Vietnam: (1) assessment of financial policies or financial regulation, (2) deciphering the correlates of firms’ financial performances, and (3) opportunities and challenges in adopting innovations and ideas from foreign financial market systems. Our analysis identifies several fertile areas for future research, including financial market analysis in the post-COVID-19 eras, fintech, and green finance. (shrink)

The placebo effect has puzzled scientists for centuries. Philosopher Dien Ho argues that we now know how it works, and that this should transform our understanding of the relationship between mind and body. We must stop thinking of improvements in health due to placebo as somehow less real than those due to other medicines: there can no longer be a clean distinction between ill-health that’s “all in the head” and ill-health that involves a malfunctioning body. Ho argues that our improved (...) understanding of placebos means that doctors should now harness their power in treatment, especially since research shows that they can be effective even when patients are told that they’re taking a placebo. John Rawls’ “reflective equilibrium” ranges amongst the most popular conceptions in contemporary ethics when it comes to the basic methodological question of how to justify and trade off different normative positions and attitudes. Even where Rawls’ specific contractualist account is not adhered to, “reflective equilibrium” is readily adopted as the guiding idea of coherentist approaches, seeking moral justification not in a purely deductive or inductive manner, but in some balancing procedure that will eventually procure a stable adjustment of relevant doctrines (...) and standpoints. However, it appears that the widespread use of this idea has led to some considerable deviations from its meaning within Rawls’ original framework and to a critical loss of conceptual cogency as an ethico-hermeneutical tool. This contribution identifies three kinds of “balancing” constellations that are frequently, but inadequately brought forth under the heading of Rawlsian “reflective equilibrium”: (a) balancing theoretical accounts against intuitive convictions; (b) balancing general principles against particular judgements; (c) balancing opposite ethical conceptions or divergent moral statements, respectively. It is argued that each of these applications departs from Rawls’ original construction of “reflective equilibrium” and also deprives the idea of its reliability in clarifying and weighing moral stances. For Bhartrhari, a fifth-century Indian grammarian-philosopher, all conscious beings—beasts, birds and humans—are capable of what he called pratibha, a flash of indescribable intuitive understanding such that one knows what the present object “means” and what to do with it. Such an understanding, if correct, amounts to a mode of knowing that may best be termed knowing-what, to distinguish it from both knowing-that and knowing-how. This paper attempts to expound Bhartrhari’s conception of pratibha in relation to the notions of meaning, understanding, (...) and knowing. First, I touch briefly on Bhartrhari’s views of consciousness and language, and examine at some length his indescribability thesis concerning the intuitive meaning of a sentence. Then, I delineate the general features of pratibha as intuitive understanding and discuss its probable range in relation to expert intuition and sense perception. Thereafter, I relate pratibha to the notion of knowing-what and show why these two notions are to be differentiated from knowing-that and knowing-how. The paper concludes with some remarks on the contemporary relevance of Bhartrhari’s conception of pratibha. (shrink)

如果機器人的發展要能如科幻想像一般，在沒有人類監督下自動地工作，就必須確定機器人不會做出道德上錯誤的行為。 根據行為主義式的道德主體觀，若就外顯行為來看，機器人在道德上的表現跟人類一般，機器人就可被視為道德主體。從這很自然地引伸出機器人的道德擬人主義：凡適用於人類的道德規則就適用於機器人。我反對道德擬人主義 ，藉由史特勞森對於人際關係與反應態度的洞見，並以家長主義行為為例，我論述由於機器人缺乏人格性，無法參與人際關係，因此在關於家長主義行為上，機器人應該比人類受到更嚴格的限制。.

Natürlichkeitsargumente haben allgemein in der Bioethik und speziell in der Debatte um Enhancement und Anthropotechnik keinen guten Ruf. Neben dem formalen Vorwurf, einen naturalistischen Fehlschluss zu begehen, werden sie mit dem inhaltli-chen Einwand konfrontiert, eine falsche Auffassung von menschlicher Natur zugrunde zu legen: Recht verstanden definiere sich diese menschliche Natur nicht durch eine biologische Substanz, die durch biotechnische Eingriffe korrumpiert werden könnte, sondern durch kulturelle Vollzüge, zu denen gerade auch der Einsatz biotechnischer Verfahren zähle und die daher durch biotechnische Manipulationen (...) am Menschen keineswegs beeinträchtigt, sondern eher noch bestätigt würden. Der vorliegende Beitrag unterzieht diese Argumentation einer kritischen Prüfung. Dabei zeigt sich, dass der Ansatz, den Menschen von seiner ‚Kultürlichkeit‘ statt von seiner ‚Natürlichkeit‘ her zu begreifen, tatsächlich keine glaubhafte Rechtfertigung von Anthropotechniken liefert, sondern im Gegenteil ein neues Argument gegen sie begründet: Anthropotechniken untergraben bei genauerem Hinsehen auch und gerade den Status des Menschen als Kulturwesen. In this essay, I am going to explain how my moral intuitions are engaged with my beloved fictions: The Lifecyle of software objects (Ted Chiang, 2010); Wild Wise Weird: The Kingfisher stories collection (Vuong, 2024), The three-body problem (Liu Cixin, 2014). Indeed, stories move us and deepen our understanding of what it means to be human, and great story-tellers achieve what even the greatest philosophers aspire to: making us reflect on our shared humanity.

The concept of power is not restricted to the usual idea of domination, as mainly implemented in the governmental structures of society. Rather, power also occurs at other places of a com-munity, adopting highly divergent forms. This plurality often impedes its reliable identification and precise labeling. However, the classical concepts of power, potestas and auctoritas, can be widened to more comprehensive perspectives that eventually promise to embrace modern societal places of power such as the market or the media in their (...) respective peculiarities. A number of contemporary philosophers think that the unqualified statement “X is unspeakable” faces the danger of self-referential absurdity: if this statement is true, it must simultaneously be false, given that X is speakable by the predicate word “unspeakable.” This predicament is in this chapter formulated as an argument that I term the “ineffability paradox.” After examining the Buddhist semantic theory of apoha (exclusion) and an apoha solution to the issue, I resort to a few Chinese Buddhist and Hindu philosophical (...) materials to rationally reconstruct a strategy for resolving the paradox. By introducing the mode of expression termed “indication,” together with the relevant notions of superimposition and of gesturing beyond the horizon, I show that expressing the ineffable does not necessarily involve irresoluble contradiction. It is also suggested that philosophers may need to acknowledge the relevance of the notion of ineffability for contemporary philosophizing. (shrink)

Every year, the Vietnamese people reportedly burned about 50,000 tons of joss papers, which took the form of not only bank notes, but iPhones, cars, clothes, even housekeepers, in hope of pleasing the dead. The practice was mistakenly attributed to traditional Buddhist teachings but originated in fact from China, which most Vietnamese were not aware of. In other aspects of life, there were many similar examples of Vietnamese so ready and comfortable with adding new norms, values, and beliefs, even contradictory (...) ones, to their culture. This phenomenon, dubbed “cultural additivity”, prompted us to study the co-existence, interaction, and influences among core values and norms of the Three Teachings –Confucianism, Buddhism, and Taoism–as shown through Vietnamese folktales. By applying Bayesian logistic regression, we evaluated the possibility of whether the key message of a story was dominated by a religion (dependent variables), as affected by the appearance of values and anti-values pertaining to the Three Teachings in the story (independent variables). Our main findings included the existence of the cultural additivity of Confucian and Taoist values. More specifically, empirical results showed that the interaction or addition of the values of Taoism and Confucianism in folktales together helped predict whether the key message of a story was about Confucianism, β{VT ⋅ VC} = 0.86. Meanwhile, there was no such statistical tendency for Buddhism. The results lead to a number of important implications. First, this showed the dominance of Confucianism because the fact that Confucian and Taoist values appeared together in a story led to the story’s key message dominated by Confucianism. Thus, it presented the evidence of Confucian dominance and against liberal interpretations of the concept of the Common Roots of Three Religions (“tam giáo đồng nguyên”) as religious unification or unicity. Second, the concept of “cultural additivity” could help explain many interesting socio-cultural phenomena, namely the absence of religious intolerance and extremism in the Vietnamese society, outrageous cases of sophistry in education, the low productivity in creative endeavors like science and technology, the misleading branding strategy in business. We are aware that our results are only preliminary and more studies, both theoretical and empirical, must be carried out to give a full account of the explanatory reach of “cultural additivity”. This essay analyzes the rise of Large Language Models (LLMs) such as GPT-4 or Gemini, which are now incorporated in a wide range of products and services in everyday life. Importantly, it considers some of their hidden human costs. First, is the question of who is left behind by the further infusion of LLMs in society. Second, is the issue of social inequalities between lingua franca and those which are not. Third, LLMs will help disseminate scientific concepts, but their meanings' (...) dissemination is at risk. Fourth, is the issue of information security and how nations and individuals might adapt. Fifth, is the issue of the environmental cost of LLMs for future generations. At the dawn of the conversational AI era, it would be wise to ponder what inequalities and empowerments will be co-created with LLMs. (shrink)

A number of analytical philosophers have recently endorsed the view that the world itself is indeterminate in some respect. Intriguingly, ideas similar to the view are expressed by thinkers from Chinese Madhyamaka Buddhism, which may shed light on the current discussion of worldly indeterminacy. Using as a basis Chinese Madhyamaka thought, together with Jessica Wilson’s account of indeterminacy, I develop an ontological conception of indeterminacy, termed ontic indeterminacy, which centres on two complementary ideas—conclusive indeterminability and provisional determinability. In recent years, with the advances in machine learning and neuroscience, the abundances of sensors and emotion data, computer engineers have started to endow machines with ability to detect, classify, and interact with human emotions. Emotional artificial intelligence (AI), also known as a more technical term in affective computing, is increasingly more prevalent in our daily life as it is embedded in many applications in our mobile devices as well as in physical spaces. Critically, emotional AI systems have not only (...) the ability to not passively read and classify emotions, but most also have an ability to predict and ‘nudge’ users to certain desired emotional states. Drawing from Piredda (2020)’s account on affective artifacts and other recent accounts, we've examined various emerging emotion-sensing technologies such as recommender algorithms, personal AI assistants, work-related emotion trackers, and emotional AI toys and robots through the lens of affective artifacts. We show how these technologies fulfill the criteria of being affective artifacts: they are artifactual, multifunctional, semi-agentive, and semi-interpesonal. Emotional AI systems as affective artifacts can influence the affective states of the users (e.g., help regulate emotions of ourselves and others), and importantly, our manipulation of these algorithms can intersect with the maintenance and construction of our sense of self and identity. Chinese Chan or Zen Buddhism is renowned for its improvisational, atypical, and perplexing use of words. In particular, the tradition’s encounter dialogues, which took place between Chan masters and their interlocutors, abound in puzzling, astonishing, and paradoxical ways of speaking. In this chapter, we are concerned with Chan’s use of paradoxical language. In philosophical parlance, a linguistic paradox comprises the confluence of opposite or incongruent concepts in a way that runs counter to our common sense and ordinary rational thinking. One (...) naturally wonders about Chan masters’ rationales for their use of paradox. There are also concerns about whether the use violates the logical principle of noncontradiction to the effect that nothing can be both P and not-P all over in the same way at the same time. Chan became a viable Chinese Buddhist tradition during the Tang dynasty (618−907) and continued to develop for several centuries. The tradition had produced a huge literature; consequently, our investigation of its use of paradox cannot but be limited and selective. In the second section, I first sketch key ideas of Chan that are pertinent to our investigation and then examine the use of paradox in the sermons associated with certain Tang masters of the southern Chan. In the third section, I analyze the presence of paradoxical language in post-Tang encounter dialogues. The fourth section concludes. (shrink)

For Jizang (549−623), a prominent philosophical exponent of Chinese Madhyamaka, all things are empty of determinate form or nature. Given anything X, no linguistic item can truly and conclusively be applied to X in the sense of positing a determinate form or nature therein. This philosophy of ontic indeterminacy is connected closely with his notion of the Way (dao), which seems to indicate a kind of ineffable principle of reality. However, Jizang also equates the Way with nonacquisition as a conscious (...) state of freedom from any attachment and definite understanding whatsoever. The issue then becomes pressing as to how we are to understand Jizang's notion of the Way. Does it indicate some metaphysical principle or reality? Is it actually a skilful expedient to lead one to the consummate state of complete spiritual freedom? How is this issue related to Jizang's conception of ontic indeterminacy? In this book chapter, I examine Jizang's key writings in an attempt to clarify his ontological position. (shrink)

Especially over the past twenty years, a number of analytic philosophers have embraced the idea that the world itself is vague or indeterminate in one or more respects. The issue then arises as to whether it can be the case that the world itself is indeterminate in all respects. Using as a basis Chinese Madhyamaka Buddhist thought, I offer two reasons for the coherence and intelligibility of the thesis that all concrete things are themselves indeterminate with respect to the ways (...) they are. The first reason draws on a notion reminiscent of the picture of reality as an amorphous lump, while the second reason makes use of the relativity of conceptual perspectives and determinations. Assuming that the world is the mere totality of all concrete things, I show that there is a genuine metaphysical possibility of the world’s being indeterminate in all respects. (shrink)
