Whenever we communicate, we inevitably have to say one thing before another. This means introducing particularly subtle patterns of salience into our language. In this paper, I introduce ‘order-based salience patterns,’ referring to the ordering of syntactic contents where that ordering, pretheoretically, does not appear to be of consequence. For instance, if one is to describe a colourful scarf, it wouldn’t seem to matter if one were to say it is ‘orange and blue’ or ‘blue and orange.’ Despite their apparent (...) triviality, I argue that order-based salience patterns tend to make the content positioned first more salient – in the sense of attention-grabbing – in a way that can have surprising normative implications. Giving relative salience to gender differences over similarities, for instance, can result in the activation of cognitively accessible beliefs about gender differences. Where those beliefs are epistemically and/or ethically flawed, we can critique the salience pattern that led to them, providing an instrumental way of evaluating those patterns. I suggest that order-based salience patterns can also be evaluated on constitutive grounds; talking about gender differences before similarities might constitute a subtle form of bias. Finally, I reflect on how the apparent triviality of order-based salience patterns in language gives them an insidious strength. (shrink)

Optimism and pessimism are two diametrically opposed views about the value of existence. Optimists maintain that existence is better than non-existence, while pessimists hold that it is worse. Arthur Schopenhauer put forward a variety of arguments against optimism and for pessimism. I will offer a synoptic reading of these arguments, which aims to show that while Schopenhauer’s case against optimism primarily focuses on the value or disvalue of life’s contents, his case for pessimism focuses on the ways in which life (...) as a whole is structurally defective. Consider a terrible situation that too many women find themselves in: 85,000 women are raped in England and Wales alone every year. Many of these women do not bring their cases to trial. There are multiple reasons that they might not want to testify in the courts. The incredibly low conviction rate is one. Another reason, however, might be that these women do not want the fact that they were raped to become the most salient thing about them. More specifically, (...) they do not want it to be the thing that others attend to the most—that others find most noticeable and memorable. In this paper, I introduce the notion of ‘harmful salience perspectives’ to help to explain this and related phenomena. This refers either to attention on things that should not be salient, or not enough attention on things that deserve to be made salient. Following ideas within the feminist literature on objectification, I argue that we can be harmed when aspects of our identity that do not reflect our personhood—our agency, rationality, personality, and so on—are more prominent in the minds of others than aspects that do reflect our personhood. Crucially, these ways of attending do not need to implicate false beliefs and harmful ideologies to be harmful, but can be harmful in their own right. (shrink)

Ontological pluralism is the view that there are different fundamental ways of being. Trenton Merricks has recently raised three objections to combining pluralism with a generic way of being enjoyed by absolutely everything there is: first, that the resulting view contradicts the pluralist’s core intuition; second, that it is especially vulnerable to the charge—due to Peter van Inwagen—that it posits a difference in being where there is simply a difference in kind; and, third, that it is in tension with various (...) historically influential motivations for pluralism. I reply to each of these objections in turn. My replies will help to bring out the true nature of the pluralist’s basic commitments. (shrink)

The distinction between qualitative and non-qualitative properties should be familiar from discussions of the principle of the identity of indiscernibles: two otherwise exactly similar individuals, Castor and Pollux, might share all their qualitative properties yet differ with respect to their non-qualitative properties—for while Castor has the property being identical to Castor, Pollux does not. But while this distinction is familiar, there has not been much critical attention devoted to spelling out its precise nature. I argue that the class of non-qualitative (...) properties is broader than it is often taken to be. When properly construed, it will not only include properties such as being identical to Castor, which somehow make reference to particular individuals, it will also include more general properties such as identity, composition, set membership, as well as various peculiarly ontological properties. Given that some of these more general properties help to explain objective similarity, we have reason to believe that there are fundamental non-qualitative properties. (shrink)

Pessimism is, roughly, the view that life is not worth living. In chapter 46 of the second volume of The World as Will and Representation, Arthur Schopenhauer provides an oft-neglected argument for this view. The argument is that a life is worth living only if it does not contain any uncompensated evils; but since all our lives happen to contain such evils, none of them are worth living. The now standard interpretation of this argument (endorsed by Kuno Fischer and Christopher (...) Janaway) proceeds from the claim that the value—or rather valuelessness—of life’s goods makes compensation impossible. But this interpretation is neither philosophically attractive nor faithful to the text. In this paper, I develop and defend an alternative interpretation (suggested by Wilhelm Windelband and Mark Migotti) according to which it is instead the actual temporal arrangement of life’s goods and evils that makes compensation impossible. Are embryos deserving of moral consideration in our actions? A standard view suggests that embryos are considerable only if they have interests. One argument for embryonic interests contends that embryos are harmed by death because they are deprived of valuable future lives as adult persons. Some have challenged this argument on the grounds that embryos aren’t identical to adults: either due to the potential for embryos to twin or because we do not exist until the fetus develops consciousness. These arguments (...) fail to show that embryos do not have future adult lives. There is a better reason to think that embryos cannot have interests; namely, because they are not capable of having desires. Others have held this view but have not sufficiently justified it. The justification lies in the fact that the capacity for desires is necessary to make sense of the normativity of interests. (shrink)

Learning to adapt to the new set of conditions that confound behavioral standards was made possible by the pandemic-driven change in the school system. Due to these conditions and the COVID-19 pandemic, students may experience behaviors like social media addiction and social anxiety that may affect their well-being or happiness. Thus, this study aims to investigate the effects of social media addiction and social anxiety on the happiness of tertiary students amidst the COVID-19 pandemic. The study was conducted on 316 (...) first-year college students utilizing Google forms to disseminate questionnaires. After utilizing Bergen Social Media Addiction Scale, Social Anxiety Scale, and Oxford Happiness Questionnaire, it was found that social media addiction (β = -0.30, p<.00) and social anxiety (β = -0.003, p<.00) has a significant negative effect on happiness. Therefore, the study recommended and designed a student wellness program that provides a range of recreational, healthimproving, self-esteem-boosting, and relationship-strengthening activities for students in order to mitigate the negative effects of problematic social media usage and social anxiety that negatively effect their happiness. We argue that at least some corvids morally ought to be granted a right to bodily liberty in the US legal system and relevantly similar systems. This right would grant immunity to frivolous captivity and extermination. Implementing this right will require new legislation or the expansion of existing legislation including the elimination of various "pest" clauses. This paper proceeds in three parts. First, we survey accounts of the moral grounds of legal rights. Second, to establish an overlapping consensus supporting corvid (...) bodily liberty rights, we survey the empirical literature on corvid cognition. Third, we illustrate what a corvid right to bodily liberty might look like, by looking to recent developments in animal law, as well as previous advocacy on behalf of primates and cetaceans. This book is a defense of the view that the distinctive feature of a normative statement is the expression of an attitude. Moral statements are a sub-class of normative statements: (roughly) those that express both an attitude AND the proposition that this attitude is of a certain type (related to such things as kindness, compassion and honesty). Much attention is devoted to the 'Frege/Geach problem', and an 'inferentialist' approach is developed to deal with this. As far as the truth and (...) falsity of normative statements is concerned, it is argued that they may be regarded as truth-apt in a broad sense, but not (always) in a narrower sense, pertaining to 'mind-to-world fit'. The book considers alternatives to the expressivist theory, but finds them all wanting. It also considers how we should view the practice of attempting to develop moral theories in light of the truth of expressivism. The concluding chapter looks at such issues as the nature of normative disagreement and the relevance of expressivism to belief in God. (shrink)

One notable component to look at in the teaching-learning process is the way the subject is taught because one way or another, students are greatly affected by it. Viewing students’ perspectives on the use of the different teaching methods, this study determined the frequency of use of these teaching methods and their level of satisfaction. Through a systematic investigation, the findings from a critical questionnaire administered to first-year BS Hospitality Management college students at Ifugao State University were analyzed and summarized. (...) The frequency of use of the indicated instructional strategies was shown to have a significant relationship with student satisfaction in this study. Furthermore, the data reveal a substantial difference in student satisfaction with instructional approaches utilized before and during the pandemic. Ontological pluralism is the view that there are different fundamental ways of being. Recent defenders of this view—such as Kris McDaniel and Jason Turner—have taken these ways of being to be best captured by semantically primitive quantifier expressions ranging over different domains. They have thus endorsed, what I shall call, quantificational pluralism. I argue that this focus on quantification is a mistake. For, on this view, a quantificational structure—or a quantifier for short—will be whatever part or aspect of reality’s structure (...) that a quantifier expression carves out and reflects. But if quantificational pluralism is true, then a quantifier should be more natural than its corresponding domain; and since it does not appear to be the case that a quantifier is more natural than its corresponding domain, quantificational pluralism does not appear to be true. Thus, I claim, an ontological pluralist should not be a quantificational pluralist. (shrink)

In her book, Moral Status, Mary Anne Warren defends a comprehensive theory of the moral status of various entities. Under this theory, she argues that animals may have some moral rights but that their rights are much weaker in strength than the rights of humans, who have rights in the fullest, strongest sense. Subsequently, Warren believes that our duties to animals are far weaker than our duties to other humans. This weakness is especially evident from the fact that Warren believes (...) that it is frequently permissible for humans to kill animals for food. Warren’s argument for her view consists primarily in the belief that we have inevitable practical conflicts with animals that make it impossible to grant them equal rights without sacrificing basic human interests. However, her arguments fail to justify her conclusions. In particular, Warren fails to justify her beliefs that animals do not have an equal right to life and that it is permissible for humans to kill animals for food. (shrink)

I consider a familiar argument for two-boxing in Newcomb's Problem and find it defective because it involves a type of divergence from standard Baysian reasoning, which, though sometimes justified, conflicts with the stipulations of the Newcomb scenario. In an appendix, I also find fault with a different argument for two-boxing that has been presented by Graham Priest.

My subject is the theory of blame recently propounded by George Sher in his book, In Praise of Blame. I argue that although Sher has succeeded in capturing a number of genuine features of the concept of blame, there is an important element that he has omitted, which is the fact that necessarily, when A blames B for something and expresses this to B, A will realise that B is likely to find this unpleasant. The inclusion of the latter element (...) renders the question of whether any agent ever deserves blame a more open one than Sher allows. (shrink)

Though academic debate over gender-inclusive God-talk seems to have fizzled, the issue is a pressing one within many Christiandenominations today—both within and outside the Church—and for that reason deserves to be briefly revisited. Accordingly, althoughin this essay we approach the issue as professional philosophers, our focus is on the life of the Church—more specifically, those no doubt sizable segments of the Church for which a personal God and Satan exist and evangelism matters. Running an elimination argument, we contend that if (...) a certain sort of feminist concern about traditional God-talk is well-directed, the best response is to speak of not only God but also Satan in both masculine and feminine terms. Police officers are vital to maintaining security and the continuity of national functions. Thus, Police officers are more exposed to different kinds of psychological concerns. However, a female in this kind of profession, based on various studies, experienced higher levels of stress because of other factors. Further, the primary goal of this study is to investigate the psychological well-being, lived experiences, challenges, and coping mechanisms of female police officers. Employing the Interpretative Phenomenological Analysis, the findings of this study were: (1) (...) Female police officers had conceptualized themselves as brave, flexible, and adaptive. And they cope with stress with positive thinking that results in healthy psychological well-being. (2) Female police officers showed dedication and engagement to serve the people. They even used their resources for the public and sacrificed most of their time in the office. (3) Female police officers' primary motivation to continue their careers is their families, and serving the public brings joy to them. (4) However, female police officers experience disrespect while working in the field, and they always have fear in their life as police officers. Moreover, they need more time to spend with their families. Furthermore, it is highly suggested to provide opportunities for enhancing quality time with their family, specifically with their children. (shrink)

Background Men with antisocial personality disorder show lifelong abnormalities in adaptive decision making guided by the weighing up of reward and punishment information. Among men with antisocial personality disorder, modifi cation of the behaviour of those with additional diagnoses of psychopathy seems particularly resistant to punishment. Methods We did a case-control functional MRI (fMRI) study in 50 men, of whom 12 were violent off enders with antisocial personality disorder and psychopathy, 20 were violent off enders with antisocial personality disorder but (...) not psychopathy, and 18 were healthy non-off enders. We used fMRI to measure brain activation associated with the representation of punishment or reward information during an event-related probabilistic response-reversal task, assessed with standard general linear-model-based analysis. Findings Offenders with antisocial personality disorder and psychopathy displayed discrete regions of increased activation in the posterior cingulate cortex and anterior insula in response to punished errors during the task reversal phase, and decreased activation to all correct rewarded responses in the superior temporal cortex. This finding was in contrast to results for off enders without psychopathy and healthy non-off enders. Interpretation Punishment prediction error signalling in off enders with antisocial personality disorder and psychopathy was highly atypical. This finding challenges the widely held view that such men are simply characterised by diminished neural sensitivity to punishment. Instead, this fi nding indicates altered organisation of the information processing system responsible for reinforcement learning and appropriate decision making. This difference between violent offenders with antisocial personality disorder with and without psychopathy has implications for the causes of these disorders and for treatment approaches. (shrink)

Parental involvement is one of the primary factors that affect children’s development and individuality. However, its effect on the academic motivation and self-concept of college students is not well understood, especially in the Philippines. The present study used the Ecological systems theory by Bronfenbrenner to investigate the effect of varying parental involvement on the academic motivation and self-concept of college students at Dr. Carlos S. Lanting College. Purposive sampling was used among 198 college students from Dr. Carlos S. Lanting College (...) who were identified using a purposive sampling technique. Statistical instruments including descriptive, correlation, and regression analysis were used to examine the data collected and investigate the link between the variables. Based on the regression analysis, it was found that parental involvement only has a significant relationship with academic motivation and not with self-concept. In conclusion, college students have a sense of independence and their self-concept is not affected by parental involvement; nonetheless, parents providing essential support influence their academic motivation. -/- . Existing ethical guidelines that aim to guide the development of mental health apps tend to overemphasize the role of Western conceptual frameworks. While such frameworks have proved to be a useful first step in introducing ethics to a previously unregulated industry, the rapid global uptake of mental health apps requires thinking more deeply about the diverse populations these apps seek to serve. One way to do this is to introduce more intercultural ethical perspectives into app design and the guidelines that (...) aim to encourage best practices. In addition to this, existing ethical guidelines can also benefit from the ethical scholarship from the feminist and disability traditions, both of which highlight specific ethical considerations for vulnerable users. Rethinking the ethical responsibilities of mental health app designers through the prisms of feminism, disability studies, and intercultural philosophy leads us to a more global and inclusive set of ethical considerations in app design. This white paper explores what existing guidelines for the regulation of mental health apps are missing. It also explores how these guidelines could be improved for users who inhabit an increasingly diverse and globalized world. (shrink)

Complex systems are difficult to manage, operate and maintain. This is why we see teams of highly specialised engineers in industries such as aerospace, nuclear and subsurface. Condition based monitoring is also employed to maximise the efficiency of extensive maintenance programmes instead of using periodic maintenance. A level of automation is often required in such complex engineering platforms in order to effectively and safely manage them. Advances in Artificial Intelligence related technologies have offered greater levels of automation but this potentially (...) pivots the weight of decision making away from the operator to the machine. Implementing AI or complex algorithms into a platform can mean that the Operators’ control over the system is diminished or removed altogether. For example, in the Boeing 737 Air Max Disaster, AI had been added to a platform and removed the operators’ control of the system. This meant that the operator could not then move outside the extremely reserved, algorithm defined, “envelope” of operation. This paper analyses the challenges of AI driven condition based monitoring where there is a potential to see similar consequences to those seen in control engineering. As the future of society becomes more about algorithm driven technology, it is prudent to ask, not only whether we should implement AI into complex systems, but how this can be achieved ethically and safely in order to reduce risk to life. Socioeconomic status refers to the family's social and economic standing in society. It is measured by combining an individual or group's economic and social position, which is often based on income, education, and occupation. It significantly affects academic performance and even one's health status. The pandemic changed the educational system, causing a huge transition from traditional learning methods to online learning. This shift resulted in confusion, burden, and difficulty among students from different walks of life. This study was conducted to (...) determine the academic stress on online learning among nursing students in relation to their economic status and their ability to access technology. The study utilized a quantitative-correlational method aided by a standard questionnaire. Two hundred thirty-six University of Bohol nursing students enrolled in the second semester of SY 2021–2022 were included in the study by random selection. Data revealed a significant correlation between economic status and the level of stress related to academic expectations and a significant correlation between economic status and access to technology after being subjected to the Spearman rho test of correlation. However, no significant correlation was found between access to technology and the respondents' level of academic stress. (shrink)

Impulse and momentum are basic concepts of mechanics introduced in the K to 12 curricula. Despite its basic concepts, students still have difficulties understanding the topic, especially when they are out of school due to the pandemic. After reopening the gates for face–to–face classes in the Philippines, the researchers found a significant reason to conduct a lesson study to improve teaching strategies on the topic. Lesson study is a development process wherein teachers work collaboratively to improve teachers teaching capacity. This (...) study was conducted at Plaridel National High School with 23 participants from Grade 9 Newton (Set A and B). The research was conducted in two cycles using a four – phase lesson study. The research lesson was implemented using a 4A Model lesson plan and the results were taken from the analysis of the lesson study observation sheets, along with the class proficiency level. The researchers used the following strategies to improve teaching, namely; (1) showing mastery of subject matter, (2) reviewing basic mathematical operations, (3) contextualizing the lesson, (4) allowing students to answer questions in mother tongue, (5) using collaborative activities, (6) giving rewards, and (7) applying proper time management. However, the findings still showed that both sets of students achieved beginning proficiency level. Despite the implementation of these strategies, the students still lack basic knowledge of the topic and mathematical operations, and they struggle to understand it. Thus, it is recommended to plan the lesson effectively, utilize other research instruments, and collect feedback from the students. (shrink)

Among the most popular strategies for justifying political obligations are those that appeal to the principle of fairness. These theories face the challenge, canonically articulated by Robert Nozick, of explaining how it is that persons are obligated to schemes when they receive goods that they do not ask for but cannot reject. John Simmons offers one defense of the principle of fairness, arguing that people could be bound by obligations of fairness if they voluntarily accept goods produced by a (...) cooperative scheme. Simmons, however, thinks that such a theory will do little work in justifying political obligations, since virtually no one voluntarily accepts state goods. This paper attempts to advance just such a theory by arguing that states are in fact genuine cooperative schemes and that Simmons is overly pessimistic in his appraisal of whether the majority of citizens accept the goods provided by their states. The two justificatory roles of the social contract are establishing whether or not a state is legitimate simpliciter and establishing whether any particular individual is politically obligated to obey the dictates of its governing institutions. Rawls's theory is obviously designed to address the first role but less obviously the other. Rawls does offer a duty-based theory of political obligation that has been criticized by neo-Lockean A. John Simmons. I assess Simmons's criticisms and the possible responses that could be (...) made to them, including those offered by Samuel Freeman. I conclude they rest on a Rawlsian equivocation and ultimately fail. (shrink)

Rawls's theory of political obligation attempts to avoid the obvious flaws of a Lockean consent model. Rawls rejects a requirement of consent for two reasons: First, the consent requirement of Locke’s theory was intended to ensure that the liberty and equality of the contractors was respected, but this end is better achieved by the principles chosen in the original position, which order the basic structure of a society into which citizens are born. Second, "basing our political ties upon a principle (...) of obligation would complicate the assurance problem." Instead, Rawls offers a duty-based account, whereby we are duty-bound to support and comply with just institutions that apply to us. A. John Simmons argues that Rawls cannot meet the particularity requirement of establishing political obligation to only one state. I assess the response that this requirement can be met by the political constructivist element of Rawls's theory. I conclude that there are fatal flaws in this response. (shrink)

Over the years a few authors have argued that Rawls’s ideal theory of justice is useless for the real world. This criticism has been largely ignored by Rawlsians, but in the light of a recent accumulation of such criticisms, some authors (in particular Holly Lawford-Smith, A. John Simmons, Zofia Stemplowska and Laura Valentini) have tried to defend ideal theory. In this article I will recapitulate the precise problem with Rawls’s ideal theory, argue that some of Rawls’s defenders misconceive it, (...) and show that recent attempts to rescue Rawls’s ideal theory from the charge of being useless fail. While there are useful kinds of ideal theory, Rawls’s is not one of them. In addition, Rawls’s very tentative suggestions for some kind of bridge between ideal and non-ideal theory are contradictory insofar as they implicitly presuppose the non-existence of the problem they are meant to solve. Thus, Rawls’s “non-ideal theory” too, is useless, and not so much a theory at all but a set of ad hoc stipulations. Finally, I will show that certain attempts within the global justice debate to use some variation of the original position to directly derive guidelines for the real world are misguided and yield no useful results. What Bar-On and Simmons call 'Conceptual Deflationism' is the thesis that truth is a 'thin' concept in the sense that it is not suited to play any explanatory role in our scientific theorizing. One obvious place it might play such a role is in semantics, so disquotationalists have been widely concerned to argued that 'compositional principles', such as -/- (C) A conjunction is true iff its conjuncts are true -/- are ultimately quite trivial and, more generally, that semantic theorists (...) have misconceived the relation between truth, meaning, and logic. This paper argues, to the contrary, that even such simple compositional principles as (C) have substantial content that cannot be captured by deflationist 'proofs' of them. The key thought is that (C) is supposed, among other things, to affirm the truth-functionality of conjunction and that disquotationalists cannot, ultimately, make sense of truth-functionality. -/- This paper is something of a companion to "The Logical Strength of Compositional Principles". Marta Suria writes *Ella soy yo* as part of her response to the irruption of the memories of the sexual aggressions she had suffered since childhood. She is convinced that the way she narrates her experience will transform and liberate her. How is it at all possible that a certain kind of narrative may transform and li- berate us? In this paper, we will first describe the conception of the relationship between language and experience that lies behind this perplexity (...) and, secondly, we will sketch an alternative conception that will hopefully allow us to account for the transformative power of certain kinds of narratives. This alternative conception will hinge on the idea of expression and on the concept of aspect perception. For this purpose, we will firstly argue that language can be used not only to describe or evaluate our experience, but also to express it; we will, then, defend the view that linguistic or gestural expressions of our experiences not only announce or manifest them, but contribute to shaping and modulating them; finally, we will highlight the transformative, humanizing power of certain expressive uses of language. According to Schopenhauer’s compensation argument for pessimism, the non-existence of the world is preferable to its existence because no goods can ever compensate for the mere existence of evil. Standard interpretations take this argument to be based on Schopenhauer’s thesis that all goods are merely the negation of evils, from which they assume it follows that the apparent goods in life are in fact empty and without value. This article develops a non-standard variant of the standard interpretation, which accepts the (...) relevance of the negativity thesis but rejects that the argument assumes that life’s goods are all empty and valueless. Instead, it argues that whatever value negative goods might possess, they do not have the kind of value to compensate for positive evils. This involves additional development of the negativity thesis and a defence of it against objections from Byron Simmons (2021). (shrink)

Malebranche holds that visual experience represents the size of objects relative to the perceiver's body and does not represent objects as having intrinsic or nonrelational spatial magnitudes. I argue that Malebranche's case for this body-relative thesis is more sophisticated than other commentators—most notably, Atherton and Simmons —have presented it. Malebranche's central argument relies on the possibility of perceptual variation with respect to size. He uses two thought experiments to show that perceivers of different sizes—namely, miniature people, giants, and typical (...) human beings—can experience the very same objects as having radically different sizes. Malebranche argues that there is no principled reason to privilege one of these ways of experiencing size over the others and, more specifically, that all three kinds of perceivers experience size veridically. From the possibility of this kind of veridical perceptual variation, Malebranche infers that visual experience represents only body-relative size. (shrink)

The ontological analysis of concrete particulars deals with the relationship between concrete object and their attributes. Both Peter Simons' Nuclear Theory and Aristotelian Substance Theory may present an acceptable explanation for the following three problems: Identity of Indiscernible, Excessive Necessitism and Change. In spite of the superiority of these two theories over the other theories, each has problems need to be addressed. Aristotelian theory does not seem to be very successful in showing that the spices (kinds) are unchangeable or at (...) least does not explain it. Simmons's theory also returns to Aristotelian theory. While outlining the challenges to any theory, the final suggestion of the paper is that with inspiration of Simmons' theory and introducing a relation between the generalities (universal Whatness), create a modification in Aristotelian theory to overcome the challenge of the irreductive challenge of Species (kinds) Simons' theory, in some sense, collapses back to Aristotelian Theory. Its notoriety derives not only from the band’s otherworldly costumes (except for of course during the unmasked period), the fact that they were inducted into the Rock and Roll Hall of Fame, their numerous hit records or the amazing stage theatrics and pyrotechnics of their live shows. It’s also related to the band’s constantly changing makeup (and I don’t mean the kind on their faces!). Of the four members, only Paul Stanley and Gene (...) Simmons were fixtures. With so many changes to the band’s composition, has KISS always remained the same band? Some see this head-scratcher as roughly similar to a conundrum in philosophical metaphysics (that’s the area of philosophy addressing problems of existence): the puzzle of Theseus’s ship. (shrink)

Contemporary debates on obedience and consent, such as those between Thomas Senor and A. John Simmons, suggest that either political obligation must exist as a concept or there must be natural duty of justice accessible to us through reason. Without one or the other, de facto political institutions would lack the requisite moral framework to engage in legitimate coercion. This essay suggests that both are unnecessary in order to provide a conceptual framework in which obedience to coercive political institutions (...) can be understood. By providing a novel reading of Hobbes’s Leviathan, this article argues that both political obligation and a natural duty to justice are unnecessary to ground the ability of political institutions to engage in legitimate coercion. This essay takes issue with common readings of Hobbes which assume consent is necessary to generate obedience on the part of citizens, and furthermore that political obligation is critical for the success of political institutions. While the failure of the traditional Hobbesian narrative of a consenting individual would seem to suggest the Leviathan is indefensible as a project, this paper argues that the right of war in the state of nature was more central for Hob- bes’s understanding of political institutions than obligation. Furthermore, Hobbes provides an adequate defense of political institutions even if his arguments about consent, obligation and punishment are only rhetorical. In this way Hobbesian law is best understood as a set of practical requirements to avoid war, and not as moral requirements that individuals are bound to comply with. Thus Hobbesian political institutions are not vulnerable to contemporary philosophical anarchist criticisms about political obligation and political institutions as such. To develop this reading, I focus primarily on the Leviathan, including interpretations by Skinner, Kateb, Flathman, and Oakeshott. Ultimately, this argument provides insight into contem- porary political institutions of the state, citizenship, criminality, and the law in a world where political obligation has not been adequately justified. Musical works change. Bruckner revised his Eighth Symphony. Ella Fitzgerald and many other artists have made it acceptable to sing the jazz standard “All the Things You Are” without its original verse. If we accept that musical works genuinely change in these ways, a puzzle arises: why can’t I change Bruckner’s Eighth Symphony? More generally, why are some individuals in a privileged position when it comes to changing musical works and other artifacts, such as novels, films, and games? I (...) give a view of musical works that helps to answer these questions. Musical works, on this view, are created abstract objects with no parts. The paradigmatic changes that musical works undergo are socially determined normative changes in how they should be performed. Due to contingent social practices, Bruckner, but not I, can change how his symphony should be performed. Were social practices radically different, I would be able to change his symphony. This view extends to abstract artifacts beyond music, including novels, films, words, games, and corporations. (shrink)

En la obra de Hegel la filosofía de lo bello es eminentemente filosofía del espíritu. Uno de los temas insoslayables acerca de la belleza es su presencia en la naturaleza y en el arte. En las Lecciones de Estética la belleza del arte se pondera como la más excelente. En este punto la postura hegeliana diverge llamativamente de la de Schelling; quien trató explícitamente de la relación de las artes plásticas con la naturaleza, como consta en el texto que lleva (...) este tema por título (generalmente llamado “discurso de la academia”). Su propuesta es clara: la superioridad de la naturaleza frente a las artes plásticas. Lo más interesante de esta disputa no es el desacuerdo en sí mismo, sino las argumentaciones que uno y otro autor alegan a favor de sus tesis respectivas. (cuánto se parece y cuánto divergen) A través de ellas se pueden ver los diversos matices en torno a los conceptos de belleza y de espíritu. A esta cuestión es a lo que se dedicará esta comunicación: a analizar brevemente algunos argumentos de ambos autores acerca de la belleza en la naturaleza y en el arte. A lo largo de este artículo se lleva a cabo una comparación de textos, de algunas discrepancias concretas: en todas ellas lo llamativo es cómo son a la vez tan cercanos y tan contrarios. Tanto para Schelling como para Hegel, la belleza es del espíritu: lo más bello es lo que está penetrado de espíritu y es vivificado por él. Pero más allá de estos principios comunes hay mil matices que acaban desembocando en dos posturas contrapuestas. (shrink)

Hay dos supuestos sobre el valor epistémico que guían las discusiones más recientes sobre éste. El primero es que hay algo bueno con respecto a la creencia verdadera. El segundo supuesto es que es posible que dos creencias difieran en su valor incluso si ambas creencias son igualmente correctas. El veritista tiene fácil explicar el primer supuesto, pero tiene más difícil explicar el segundo. Para explicarlo, el veritista tiene que mostrar que las creencias verdaderas pueden diferir en su valor porque (...) encarnan diferentes valores de bienes derivativos. El veritista tiene que proporcionarnos una historia de cómo es posible que pares de creencias verdaderas difieran en su valor epistémico no-instrumental. La forma más prometedora que una explicación de este tipo puede tomar, en mi opinión, apela al trabajo de Sosa (2007) sobre el valor epistémico y la naturaleza del conocimiento. Según la postura de Sosa, el conocimiento es un tipo de logro, un tipo de éxito que es atribuible al sujeto y a sus habilidades. Estos logros, nos sugiere, son más valiosos que un caso de éxito atribuible a la suerte y que no constituye un logro. Presentaré algunas dificultades potenciales para su postura y consideraré si tiene los recursos para lidiar con ellas. Voy a delinear los detalles de una postura alternativa que evade estas dificultades. Tal postura retiene el análisis del conocimiento de Sosa, pero requiere que revisemos algunas propuestas veritistas sobre el valor epistémico. La postura revisada nos proporciona algunas herramientas que serán útiles al tratar de ofrecer una teoría de la creencia racional o diestra. (shrink)

Die Ausbildung der Transzendentalphilosophie verband sich auch bei Fichte mit der Vertiefung der ihr immanenten historischen Tendenz. Basierend auf dem Gedanken der Einheit des Bewusstseins stellte sich die Aufgabe, die verschiedenen Erscheinungen in ihrem inneren Zusammenhang wie auch ihrer geschichtlichen Erscheinungsweise zu erklären. Hierzu erfuhr das transzendentale Subjekt eine tiefgreifende Historisierung durch den Versuch, eine Phänomenalogie des Geistes zu erarbeiten. Im Artikel wird weiterhin insbesondere das methodische Vorgehen Fichtes und dessen Dogmatismuskritik analysiert. For Fichte, too, the development of transcendental philosophy (...) was combined with the deepening of the historical tendency inherent in it. Based on the idea of the unity of consciousness, the task was to explain the various phenomena in their inner context as well as their historical appearance. To this end, the transcendental subject experienced a profound historicization through the attempt to develop a phenomenology of spirit. The article continues to analyze in particular Fichte's methodological approach and his criticism of dogmatism. И для Фихте развитие трансцендентальной философии сочеталось с углублением присущей ей исторической тенденции. На основе идеи единства сознания возникла задача объяснения различных явлений как в их внутреннем контексте, так и в их историческом облике. С этой целью трансцендентальный субъект претерпел глубокую историзацию посредством попытки разработать феноменологию духа. В статье продолжается анализ, в частности, методологического подхода Фихте и его критики догматизма. También para Fichte, el desarrollo de la filosofía trascendental se combinó con la profundización de la tendencia histórica inherente a ella. Partiendo de la idea de la unidad de la conciencia, se planteó la tarea de explicar los diversos fenómenos en su contexto interno así como su fisonomía histórica. Para ello, el sujeto trascendental experimentó una profunda historización a través del intento de desarrollar una fenomenología del espíritu. El artículo continúa analizando en particular el enfoque metodológico de Fichte y su crítica al dogmatismo. (shrink)

El artículo presenta un análisis de cuatro temas centrales de Sen: su visión sobre el ser humano, la libertad individual, la evaluación moral y los derechos, y la igualdad. Con esto quiero mostrar que estas ideas no sólo son consistentes, sino que explican muchas de las reflexiones sobre temas sociales y económicos que lo han convertido en un referente en estas áreas. En las conclusiones presentaré una síntesis e interpretación de estas ideas fundamentales, mostrando cómo constituyen un núcleo filosófico y (...) qué relaciones mantienen entre ellas. Mi objetivo no es encasillarlo en algunas de las corrientes de filosofía actuales, sino destacar la solidez y pertinencia de su aporte filosófico, algo sumamente útil en un tiempo como el nuestro, deseoso de ideas frescas para los acuciantes problemas de siempre. Este artículo explora la relación entre la filosofía del límite de Eugenio Trías y el sufismo de Ibn ʿArabī. En primer lugar, pretende explicar la función de la filosofía de la religión en el sistema triasiano y por qué el maestro andalusí ocupa un lugar privilegiado en ella. Segundo, se ocupa de algunos aspectos esenciales de la doctrina akbarí que la filosofía del límite obtura, como la declaración de la unidad del Ser (tawḥīd), la conjugación de lo exotérico y (...) lo esotérico, la superación de la propia creencia, el camino de la servidumbre (ʿubūdiyya), el tránsito de la pasión súbita de amor (hawā) al amor espiritual (ḥubb), la caballería espiritual (futuwwa) y la morada de la no-morada (maqām lā maqām), los cuales comparten un nexo común: el trascendimiento de lo egoico y el interés en el otro en tanto otro. Finalmente, se defenderá que la obturación triasiana se debe tanto al influjo de Henry Corbin, como sobre todo, a las propias limitaciones de su proyecto filosófico, para el que el Ibn ʿArabī ausente constituye una suerte de sombra. La meta de este trabajo estriba en sacar a la luz el subsuelo ontológico que sostiene el abordaje y el tratamiento de la interexistencialidad en el capítulo IV de la primera sección de Ser y Tiempo. Primero, esclarecemos conceptualmente las indicaciones sobre la cotidianidad y la “absorción” en el mundo que aparecen en la introducción general del capítulo mencionado, lo que despeja el camino para demostrar que la interexistencialidad de ninguna forma está enso-gada necesariamente con la impropiedad. Segundo, mostramos que (...) el (primer) subsuelo ontológico es la “diferencia radical” entre la existencia y el ser-dado-delante [Vorhandenheit] en sentido amplio como “objetualidad”; sobre ella sostiene la necesidad de plantear la pregunta por el quién del Dasein en una forma que corresponda al dinamismo ínsito al “sí mismo”, el cual puede concretarse en un yo-mismo apropiado o un uno-mismo impropio que se pierde en los “otros”. Tercero, se patentiza que el desarrollo de la interexistencialidad entronca en el (segundo) subsuelo ontológico de la “variedad del ser”, argumentando que los tres aspectos fun-damentales de la interexistencialidad, a saber, el ser-con, el mundo compartido y la latente comprensión preontológica de los otros Dasein, solo son visibles y comprensibles al amparo de la interpretación ontológica del Dasein propio y del ajeno en cuanto existencias, distinguiendo especialmente a este último de determinaciones ontológicas que no le pertenece originariamente a su “ser”. Este artículo pretende reivindicar la defensa de la pericia a la luz de la filosofía experimental del libre albedrío. Mi argumento central es que la estrategia de analogía entre la filosofía y otros dominios es defendible, al menos en el debate sobre el libre albedrío, porque la formación filosófica contribuye a la formación de la intuición filosófica al permitir a los filósofos expertos comprender correctamente las cuestiones filosóficas y tener intuiciones filosóficas sobre ellas. Este artículo comenzará derivando dos requisitos para (...) la defensa de la pericia a partir de las principales críticas a la misma. En primer lugar, es preciso explicar con precisión cómo contribuye la formación filosófica a la creación de intuiciones filosóficas (Contribución); en segundo lugar, debe explicarse cómo la formación filosófica inmuniza a las intuiciones filosóficas frente a factores distorsionadores (Inmunidad). Argumentaré que el requisito de Contribución es crucial para la defensa de la pericia y que este requisito puede satisfacerse al menos en el dominio del libre albedrío: investigaciones recientes muestran que la mayoría de las personas inexpertas son incapaces de entender correctamente el determinismo, lo que sugiere que tener intuiciones sobre el determinismo requiere pericia filosófica. A continuación, discuto cómo esta propuesta puede aplicarse a otras disciplinas filosóficas. (shrink)

Ninguna madre burguesa tendría de qué quejarse: la señora Beauvoir tiene una blusa cuidadosamente planchada; está fresca como una rosa, su rostro es terso y limpio, de ella emana un discreto perfume, es verdaderamente perfecta. Su rebelión contra su familia y su entorno, tan bien descrita en las Memorias de una joven formal, no se muestra en los detalles de la vestimenta. No, (...) definitivamente, Simone de Beauvoir no tiene la agresividad "amazónica" al límite. (shrink)

La literatura sobre razonamiento probatorio busca incidir en la determinación de los hechos en los procesos judiciales. Para alcanzar dicho propósito, no basta con dirigir la mirada hacia disciplinas extrajurídicas exitosas e integrar lo que de ellas pueda extraerse a las teorías jurídicas de la prueba y a la práctica judicial. Es necesario, además, considerar el tipo de hechos a probar, los roles de las reglas jurídicas aplicables, y asumir que litigantes y jueces, actuando en un contexto institucional, podrán ser (...) más o menos agudos en la discusión fáctica, entre otras cosas. Minimizar la influencia de tales factores expone a los estudios probatorios a tener un bajo rendimiento práctico. Algo de esto ha ocurrido con la llamada concepción racionalista de la prueba. Su innegable aporte al debate académico en español no ha ido a la par de su impacto judicial. Para explicar esta brecha entre teoría y práctica, identificamos tres creencias-obstáculo que afectan a su discurso sobre la prueba y que deben ser sorteadas si lo que se busca es influir en la forma en que se juzgan los hechos en un sistema judicial realmente existente. La modernidad se caracteriza por una epistemología que ha conducido a la separación de los saberes. Como consecuencia, tanto la teología protestante como la católica han sufrido la falta de una perspectiva unitaria en su razonar sobre Dios. La cultura postmoderna, aceptando la fragmentariedad, presenta una nueva sensibilidad epistemológica que abre posibilidades prometedoras para el redescubrimiento de la trascendencia. Entre ellas, la dialogicidad intrínseca de la Creación apunta a la vía de la belleza como camino privilegiado que la teología ha (...) de explorar en un sentido descendente y, especialmente, ascendente. O renascimento do pragmatismo foi acompanhado por uma série de filósofas feministas que se esforçaram para resgatar do esquecimento as pensadoras que fizeram parte do movimento pragmatista clássico do final do século XIX e primeira metade do século XX. O presente trabalho visa introduzir aos leitores de língua portuguesa esse trabalho a partir de uma breve exposição das pensadoras Jane Addams, Mary Parker Follet, Charlotte Perkins Gilman, Mary Whiton Calkins e Ella Flagg Young.
