This paper argues for a Husserlian account of phenomenal intentionality. Experience is intentional insofar as it presents a mind-independent, objective world. Its doing so is a matter of the way it hangs together, its having a certain structure. But in order for the intentionality in question to be properly understood as phenomenal intentionality, this structure must inhere in experience as a phenomenal feature. Husserl’s concept of horizon designates this intentionality-bestowing experiential structure, while his concept of motivation designates the unique (...) phenomenal character of this structure as it is experientially lived through. The use of modular construction technology has emerged as a promising solution to the challenges of the construction industry all over the world. This paper examines the new horizons and opportunities that modular construction technology offers not only in the Albanian context but also in some European countries. The paper provides an overview of the status of Albania's construction market and emphasizes the advantages of modular construction technology, including quicker construction, lower costs, and better quality control. Unfortunately, prefabricated constructions are (...) not very present Albanian construction industry, and it is not given the proper attention due to lack of infrastructure, organizational purposes, and lack of proper experience. The paper also examines the challenges associated with the implementation of modular construction technology in Albania, exploring the history of prefabricated constructions, also including regulatory barriers, lack of awareness, and the need for skilled labor. Finally, the paper concludes by suggesting strategies to overcome these challenges and promote the adoption of modular construction technology in Albania, such as targeted government policies, education and training programs, and partnerships between industry stakeholders. Abstract: How is it that we can visually experience complete three-dimensional objects despite being limited, in any given perceptual moment, to perceiving the sides facing us from a specific spatial perspective? To make sense of this, such visual experiences must refer to occluded or presently unseen back-sides which are not sense-perceptually given, and which cannot be sense- perceptually given while the subject is occupying the spatial perspective on the object that they currently are – I call this the horizonality of (...) visual experience. Existing accounts of these horizonal references are unsatisfactory. In providing a satisfactory account, this paper argues that the content and structure of the visual experience of complete three-dimensional objects is as follows: the object is presented as being perceptible from yet-to-be-determined alternative points of view. As part of the content of visual experience, this motivates non-propositional attitudes of anticipation. Explicating this proposal is the central positive aim of this paper. (shrink)

In this paper I develop a novel account of the phenomenality of language by focusing on characteristics of perceived speech. I explore the extent to which the spoken word can be said to have a horizonal structure similar to that of spatiotemporal objects: our perception of each is informed by habitual associations and expectations formed through past experiences of the object or word and other associated objects and experiences. Specifically, the horizonal structure of speech in use can fruitfully be compared (...) to that of a tool in use. The comparison suggests an account of our linguistic faculty as continuous with more foundational faculties of perception and action. I provide empirical corroboration of this account by drawing on recent neuroimaging studies of the multimodal, sensorimotor bases of speech comprehension. I then discuss how such an understanding of our linguistic ability helps advocates of embodied, non-representationalist accounts of cognition respond to a common objection. Critics grant that embodied approaches may be adequate to account for lower-level, online modes of cognition, such as perception and action, which directly engage their object. But they question whether such approaches can “scale up” to higher modes of cognition, such as imagination, memory, thought, and language, which can entertain absent, non-existent, or abstract objects. By providing a plausible account of the continuity of lower cognition and language-involving cognition, my approach responds to this objection, at least where language is concerned. (shrink)

ABSTRACTRecent debate over the semantics and pragmatics of epistemic modals has focused on intuitions about cross-contextual truth-value assessments. In this paper, we advocate a different approach to evaluating theories of epistemic modals. Our strategy focuses on judgments of the incompatibility of two different epistemic possibility claims, or two different truth value assessments of a single epistemic possibility claim. We subject the predictions of existing theories to empirical scrutiny, and argue that existing contextualist and relativist theories are unable to account for (...) the full pattern of observed judgments. As a way of illustrating the theoretical upshot of these results, we conclude by developing a novel theory of epistemic modals that is able to predict the results. (shrink)

In the paper, in addition to an extensive philosophical discussion with St. Augustine, Henri Bergson and Sigmund Freud, Straus elaborates on his idea of a unified view of temporal experience, comprising both the personal and the impersonal dimensions of time. The manuscript also contains an interview with a psychotic patient, which is supposed to exemplify Straus' core idea on the psychotic temporal experience, according to which the break of (...) the invisible bond between immanent or personal, and clock or impersonal time leads to a loss of a sense of reality. Surface presentism is the combination of a general relativistic physics with a presentist metaphysics. In this paper, we provide an argument against this combination based on black holes. The problem focuses on the notion of an event horizon. We argue that the present locations of event horizons are ontologically dependent on future black hole regions, and that this dependence is incompatible with presentism. We consider five responses to the problem available to the surface presentist, and argue that none succeed. (...) By moving beyond the overly emphasized image of a “fusion of horizons” and focusing on Gadamer’s concept of “play,” this paper aims to rehabilitate the dynamic and multi-vocal character of understanding as Gadamer conceives it, and to argue that “difference” is the life-blood of understanding against the recurring charge that Gadamer’s hermeneutics is fundamentally antagonistic to otherness.

This paper explores a case example of qualitative research that applied productive hermeneutics and the central concept, fusion of horizons. Interpretation of meaning is a fusing of the researchers’ and subjects’ perspectives and serves to expand understanding. The purpose is to illustrate an exemplar of qualitative research without establishing a rigid recipe of methodology. The illustration is based on in-depth observational and textual data from an applied anthropological study conducted in western Alaska with Yup’ik hunters and fishers and government agency (...) employees as they worked towards collaborative management. The metaphor of the hermeneutical circle is showcased to help the reader understand the philosophical underpinnings and the analytical processes used to realize a meaningful interpretation. A series of organizing systems for the interpretation is described, culminating in a final organizing system to communicate a fully realized understanding of collaborative management at the time. This article delves into the concept of "Egocloism," a term that amalgamates an inflated sense of self-importance ("ego") with a disposition towards isolation and resistance to external influences ("cloister"). It explores how this mindset manifests not only in individuals but also at the communal level, leading to insularity and a reluctance to embrace diversity and progress. Drawing inspiration from Anton Chekhov's narrative of "The Man in a Case," the article introduces the metaphor of "The Race in a Case" to critique (...) communities entrenched in their historical narratives and cultural identities to the detriment of inclusivity and growth. Through historical examples such as the Spanish Inquisition, the Tokugawa Shogunate’s Sakoku Policy, the Ottoman Empire’s late reforms, and the fall of the Qing Dynasty, the article illustrates the adverse effects of Egocloism. It concludes with strategies for individuals and communities to overcome this mindset, advocating for a shift towards an open horizon that embraces diversity, inclusivity, and global interconnectedness. Culture as a dynamic system of meaningful relations can naturally accommodate a hermeneutic analysis. In this essay, the notion of Gadamer’s hermeneutics as involving interpretable meaning throughout experiential reality permits a natural concordance with an understanding of culture as meaningful. The Gadamerian idea that prejudices inform the horizons that make our experiences intelligible is applied to the view that culture is both a self-enclosed structure that is given by one’s horizon and one that continuously points past this horizon (...) in genuine dialogue. Nevertheless, in seeing culture as a coherent system that transcends itself, we are consequently faced with a dilemma regarding the evolution of one’s cultural horizons: whether past horizons can survive the creation of novel ones through dialogue. However, this may be resolved through Gadamer’s understanding of the functions of sameness and difference within horizonal evolution, and how these functions feature in the distinction between a shared ontological ground and the horizons through which the ground is interpreted. Ultimately, we showcase how it is noncontradictory to suppose that culture is both self- and other-referential. (shrink)

This article is devoted to the analysis of the socio-semiotic theory of M.Foucault, which allows clarifying the phenomenal horizon in the socio-political space. Social semiotics is viewed as a grammar of a separate sign system that describes the area of a specific communicative phenomenon controlled by a system of meanings. Power, using semiotic techniques, marking space, creates a disciplined body, a disciplined person, and a disciplined consciousness. The means of coercion reveal those on whom they influence but also manifest (...) the very place of Power. At the same time, Power, functioning as a draft mechanism, attracts and extracts both the norm and deviations, which it tirelessly monitors. Specific ways of speaking, pronouncing, and certain constructions of signs and symbols that shape the social space reveal the space for the manifestation of Power. Through the use of the technique of signs that permeates the entire social space, Power is economically and efficiently distributed throughout the body of society, codifies all possible behavior, and therefore reduces the indefinite area of all possible actions. All human gestures and actions can be interpreted as semantic units that can be rationally explained and systematized. (shrink)

By identifying the formal role of light in relativity theory with the formal role of text in Gadamer’s theory of hermeneutics, the two theories are brought into relationship. Through this fusion, the privileging of “space” in physics and the privileging of “time” in hermeneutics are reciprocally interrogated as horizons of truth.

The 2010s were a golden age of information privacy research, but its policy accomplishments tell a mixed story. Despite significant progress on the development of privacy theory and compelling demonstrations of the need for privacy in practice, real achievements in privacy law and policy have been, at best, uneven. In this chapter, I outline three broad shifts in the way scholars (and, to some degree, advocates and policy makers) are approaching privacy and social media. First, a change in emphasis from (...) individual to structural approaches. Second, increasing attention to the political economy of privacy—especially the business models of information companies, such as social media platforms. Process philosophies tend to emphasise the value of continuous creation as the core of their discourse. For Bergson, Whitehead, Deleuze, and others the real is ultimately a creative becoming. Critics have argued that there is an irreducible element of (almost religious) belief in this re-evaluation of immanent creation. While I don’t think belief is necessarily a sign of philosophical and existential weakness, in this paper I will examine the possibility for the concept of universal creation to be a political and (...) ethical axiom, the result of a global social contract rather than of a new spirituality. I argue here that a coherent way to fight against potentially totalitarian absolutes is to replace them with a virtual absolute that cannot territorialise without deterritorialising at the same time: the Creal principle. Desire satisfaction theorists and attitudinal-happiness theorists of well-being are committed to correcting the psychological attitudes upon which their theories are built. However, it is not often recognized that some of the attitudes in need of correction are evaluative attitudes. Moreover, it is hard to know how to correct for poor evaluative attitudes in ways that respect the traditional commitment to the authority of the individual subject's evaluative perspective. L. W. Sumner has proposed an autonomy-as-authenticity requirement to perform this task, but (...) this article argues that it cannot do the job. Sumner's proposal focuses on the social origins of our values and overlooks the deep psychological roots of other evaluative attitudes that are just as problematic for welfare. If subjective theories of welfare are to be at all plausible they may need to abandon or modify their traditional commitment to the authority of the individual subject. (shrink)

Most students of Tocqueville know of his remark, “There are three men with whom I live a little every day; they are Pascal, Montesquieu, and Rousseau.” In this paper I trace out the contours of Pascal’s influence upon Tocqueville’s understanding of the human condition and our appropriate response to it. Similar temperaments lead both Tocqueville and Pascal to emphasize human limitations and contingency, as Peter Lawler rightly emphasizes. Tocqueville and Pascal both emphasize mortality, ignorance of the most important subjects, the (...) effects of historical contingency on what we take to be human nature, and both represent the complex internal dynamic of human nature in terms of the interplay of “angel” and “brute.” The most important difference between them concerns their relative estimates of human power and the significance of human action. Whereas the motif of human weakness is fundamental for Pascal, Tocqueville repeatedly affirms that, under the right conditions, human beings are “powerful and free.” Beginning from Pascalian premises, and endeavoring to be more faithful to some of those premises than Pascal himself was, Tocqueville aims to illuminate the possibility of an amelioration of the human condition through a “new political science” that redeems the political realm without divinizing it. -/- . It appeared that the constitution of the novel's meaning was modified and continued during the discussion and, therefore, that the meaning of the novel was not available before the discussion happened. Then, to understand what happened (...) before the discussion, the inquiry relies on P. Bayard's theoretical elaborations, which state that the solitary experience of reading itself involves previous readings: the subjectivity of the reader is haunted by a plurality of texts, virtually involved in the process of reading of the novel. Therefore, the article intends to explore the notion of potential space, coined by Winnicott, and to define it as an intersubjective space, made of virtual subjectivities. Ultimately, to describe the way a new meaning has arisen between the participants, the study relies on M. Richir's phenomenology. The point, here, is to question the actual but unconscious interweaving of the subjectivities in the discussion. Thus, the study provides a deeper understanding of the creativity of the act of reading, by assuming that creativity cannot happen without a plurality of subjectivities, existing or virtual. Solidarity has been a key topic for feminist thinkers of different times, schools and places. More than other disciplines, feminist theorists have dwelled upon the role of theory in the achievement of political and social goals. Calls for global sisterhood have incited proliferating debates as to the basis for solidarity between women and feminists. Theoretical disputes arising from the spread of deconstructionist ideas since the 1990s have led to a practical perplexity as to how to set feminist political goals if (...) the category of woman is no longer straightforward. This article looks at how expectations for practical usefulness have resonated in feminist debates on solidarity and, drawing on Paul Ricoeur’s ideas of textuality and interpretation, reflects on the process of interaction between feminist theory and feminism as a social movement. It argues that in spite of the apparent lack of unanimity, or even outright hostility, that theoretical controversies might seem to indicate, the multiplicity of viewpoints and positions that various feminist theories collectively entail is a necessary vehicle for creating more solidarity between women in and outside academia in the contemporary world. Looking towards the future of feminist theory, the article invokes the metaphor of a sisterhood of letters to reflect on the value of shared intellectual endeavour in building solidarities between women of different social, racial, religious and cultural backgrounds. In this paper we argue that the current paradigm for AGN and quasars is essentially incomplete and a rivision is needed. Remind that the current paradigm for AGN and quasars is that their radio emission is explained by synchrotron radiation from relativistic electrons that are Doppler boosted through bulk motion. In this model, the intrinsic brightness temperatures cannot exceed 1011 to 1012 K. Typical Doppler boosting is expected to be able to raise this temperature by a factor of 10. The (...) observed brightness temperature of the most compact structures in BL Lac, constrained by baselines longer than 5.3Gλ, must indeed exceed 2×1013K and can reach as high as ˜ 3 × 1014K. This is difficult to reconcile with current incoherent synchrotron emission models from relativistic electrons, requiring alternative models such as emission from relativistic protons. However the proton, as we know, is 1836 times heavier than an electron and absolutely huge energy is required to accelerated it to sublight speed. These alternative models such as emission from relativistic protons can be suported by semiclassical gravity effect finds its roots in the singular behavior of quantum fields on curved distributional space- times presented by rotating gravitational singularities. The article examines the following interpretive hypothesis: from the formulation of the concept of “precariousness” in Precarious Life (2004), Judith Butler's thought undergoes a inflection towards a ethical-political foundation normatively understood and previously rejected by the author as evidenced in her debate with Nancy Fraser and Seyla Benhabib in the 1990s. It is therefore a matter of questioning the impact of this theoretical mutation on the notions of universal and subject that are embedded in the argumentative lines of the author’s (...) texts, thus establishing “precariousness” and “co-dependence” as ethical-political conditions that should guide political guidelines aimed at making life possible and viable. The article is divided into three moments: 1) the universal denied in form and content; 2) The universal affirmed in its form, but denied in its content; 3) the universal materially and formally affirmed. It is often supposed one can draw a distinction, among the assumptions on which an inference rests, between certain background assumptions and certain more salient, or foregrounded, assumptions. Yet what may such a fore-v-background structure, or such structures, consist it? In particular, how do they relate to consciousness? According to a ‘Boring View’, such structures can be captured by specifying, for the various assumptions of the inference, whether they are phenomenally conscious, or access conscious, or else how easily available they (...) are to such consciousness. According to an ‘Interesting View’, there are fore-v-background structures over and above such classifications. The chapter gestures at reasons for thinking that an Interesting View at least merits exploration. The paper discusses some recent contributions to such a view in analytical philosophy; some remarks in Husserl on what he dubbed the horizonal dimension of acts of consciousness; and psychological work on the role of gist or schema representations in perception and memory. It is proposed that background assumptions can figure in consciousness by being as it were condensed into a consciously, though inattentively, entertained notion of their overall thematic gist, where this thematic gist gives the drift of a possible elucidation of how or why such-and-such salient grounds mean that so-and-so conclusion holds. The sameness and difference of entities depend on context or horizon and these horizons may be either synchronous or diachronic. Money and qualia are examples of identity within synchronic contexts. Music, biological functions, and cultural roles are defined by their diachronic horizons. The diachronic cultural and narrative contexts of selves are what makes them distinctively different.

We reflect on a decade of Responsible Research and Innovation (RRI) as a discourse emerging from the European Commission (EC) 10 years ago. We discuss the foundations for RRI, its emergence during the Seventh Framework programme and its subsequent evolution during Horizon 2020. We discuss how an original vision for RRI became framed around five so-called ‘keys’: gender, open access, science communication, ethics and public engagement. We consider the prospects for RRI within the context of the EC’s Open Science (...) agenda and Horizon Europe programme, before closing with some reflections on the contribution RRI has made to debates concerning the relationship between science, innovation and society over the last decade. In recent decades, phenomenology has been utilized not only as a conceptual framework from which to understand medical encounters in healthcare settings, but also to guide medical professionals in providing care. In the realm of physical therapy, phenomenology has been touted as a philosophically-based avenue to aid in helping to understand what it means to be a patient. The works of Edmund Husserl and Martin Heidegger have been utilized as paths to approach phenomenologically-informed care in physical therapy. However, to our (...) knowledge, no significant connection has been made in regard to the work of Hans-Georg Gadamer’s phenomenology and hermeneutics in the realm of physical therapy. The authors aim to close that gap by showing the ways in which Gadamer’s philosophy can help physical therapists provide phenomenologically-informed patient care. They begin by outlining some of the touchpoints between phenomenology and healthcare and then introduce Gadamer as a figure who deserves attention in the question of how to apply phenomenology to healthcare settings. Upon analyzing Gadamer’s account of what it means to experience an altered body, they outline Gadamer’s understanding of tact, practical knowledge, and good sense in order to show how to understand at a conceptual level what it means to empathize with patients on the path to building therapeutic alliance, that is, a cooperative working relationship. They then look closely at Gadamer’s hermeneutics and particularly his comments on how to cultivate a fusion of horizons in order to attempt to help guide physical therapists in theoretically understanding how to empathize with their patients. Ultimately, they argue that physical therapists who practice phenomenologically-informed care, which they call “hermeneutical healing,” are positioned well to form strong working relationships with their patients. The singularities from the general relativity resulting by solving Einstein's equations were and still are the subject of many scientific debates: Are there singularities in spacetime, or not? Big Bang was an initial singularity? If singularities exist, what is their ontology? Is the general theory of relativity a theory that has shown its limits in this case? In this essay I argue that there are singularities, and the general theory of relativity, as any other scientific theory at present, is not (...) valid for singularities. But that does not mean, as some scientists think, that it must be regarded as being obsolete. After a brief presentation of the specific aspects of Newtonian classical theory and the special theory of relativity, and a brief presentation of the general theory of relativity, the chapter Ontology of General Relativity presents the ontological aspects of general relativity. The next chapter, Singularities, is dedicated to the presentation of the singularities resulting in general relativity, the specific aspects of the black holes and the event horizon, including the Big Bang debate as original singularity, and arguments for the existence of the singularities. In Singularity Ontology, I am talking about the possibilities of ontological framing of singularities in general and black holes in particular, about the hole argument highlighted by Einstein, and the arguments presented by scientists that there are no singularities and therefore that the general theory of relativity is in deadlock. In the following paper, pursuing a lead from Heidegger’s 1937 reading of Nietzsche’s Also Sprach Zarathustra (ASZ), I first claim that the Nietzschean emphasis on awakening the thought and the thinker of eternal return should be read as analogous to Heidegger’s own call to awaken a fundamental attunement in the 1929/30 lecture course, Die Grundbegriffe der Metaphysik (GDM). I bolster this claim by insisting on a Nietzschean inspiration in the very call to awaken a fundamental attunement, which can be identified (...) on both implicit and explicit levels of the text. Initially exploring these levels, I argue that their commonality announces in part Heidegger’s effort to digest a debt of gratitude to the Nietzschean concept of horizon, and the task of the paper becomes to locate and articulate the connection between Nietzschean horizonality and the Heideggerian phenomenon of attunement. This is achieved through the dynamics of sleep and awakening as Heidegger contends with them thematically in GDM. By enumerating key steps of Heidegger’s argument, I show how attunement demonstrates the force of the problem of horizon and with it, the extent to which Heidegger’s thinking can be said to be intimate with that of Nietzsche. [In French]Both Patočka and Merleau-Ponty conceive the world not just as an Object, but rather as a field of an irreducible phenomenal and ontological depth. Patočka’s concept of movement and Merleau-Ponty’s concept of flesh are two concrete figures of this depth, and as such they are understood by the respective authors as that what stands at the origin of every singular being so far as it detaches itself on the ground of the world as an open totality. Nevertheless, the position (...) of the two concepts seems to be quite different in relation to the traditional categories of the metaphysics. We argue that Patočka’s concept of movement is profoundly rooted in, and dependent on, the classical oppositions, whereas Merleau-Ponty’s flesh makes it possible to understand them rather as abstractions produced by segregation from the original field of presence. In order to establish these points, we propose an interpretation of Patočka’s and Merleau-Ponty’s understanding of the concepts of horizon and world, and of course of those of movement and flesh. The history of the interpretation of Psalm 46 has been articulated around the search for its context. Some commentators have sought to pin its historical circumstance to certain events in Israel's past, such as the siege of Sennacherib's army over Judah or a major geological event such as an earthquake. Others have asserted that the author of the Psalm did not have in mind a past event, but a future one, namely, a time of peace and cessation of wars. But (...) is this search for the context of the author's day really essential for the modern reader? Shouldn't the diligent reading of any text culminate in merging the past with the present?And, finally, shouldn't the reader's horizons be called into question when interpreting a text? This research will seek to analyze these questions from the dialogue with authors such as Franz Delitzsch, Hermann Gunkel, Hans Georg Gadamer, G. In this paper I examine the relationship between phenomenology and metaphysics by reassessing the relationship between phenomenological and metaphysical transcendence. More specifically, I examine the notion of phenomenological transcendence in Husserl and the early Heidegger: Husserl defines transcendence primarily as the mode of givenness of phenomena that do not appear all at once, but must be given in partial profiles; Heidegger defines transcendence primarily as Dasein’s capacity to go beyond entities toward being. I argue that these divergent understandings of phenomenological (...) transcendence have resulted in a significant difference in reception among French phenomenologists of religion. These thinkers assert that phenomenology, when properly conceived and utilized, can make room for the divine and its revelation, i.e., for a metaphysical transcendence. I further argue that these thinkers prefer Heidegger’s phenomenology to Husserl’s because they understand Heidegger’s transcendence as the subject’s openness to being, while they understand Husserl’s transcendence as a limit, as the inability to capture worldly objects. I take up Jean-Luc Marion’s phenomenology of givenness as a “case study” to illustrate this point. Finally, I argue that this preference for Heidegger over Husserl is misplaced and should be reversed. A close reading of Heidegger’s Phenomenology of Religious Life shows that Dasein is confined to its own possibilities and cannot be open to a relationship with the divine. By contrast, Husserl’s phenomenology provides the radical openness necessary to welcome revelation. While Husserl cannot envision a “worldly God,” the structures of horizonality and temporality characterize a subject capable of an authentic openness to revelation. (shrink)

This paper dealing with extension of the Einstein eld equations using apparatus of contemporary generalization of the classical Lorentzian geometry named in literature Colombeau distributional geometry, see for example [1], [2], [3], [4], [5], [6], [7] and [32]. The regularizations of singularities presented in some solutions of the Einstein equations is an important part of this approach. Any singularities present in some solutions of the Einstein equations recognized only in the sense of Colombeau generalized functions [1], [2] and not classically. (...) In this paper essentially new class Colombeau solutions to Einstein eld equations is obtained. The vacuum energy density of free scalar quantum field  with a distributional background spacetime also is considered. It has been widely believed that, except in very extreme situations, the influence of gravity on quantum fields should amount to just small, sub-dominant contributions. Here we argue that this belief is false by showing that there exist well-behaved spacetime evolutions where the vacuum energy density of free quantum fields is forced, by the very same background distributional spacetime such distributional BHs, to become dominant over any classical energy density component. This semiclassical gravity effect finds its roots in the singular behavior of quantum fields on curved spacetimes. In particular we obtain that the vacuum fluctuations have a singular behavior on BHs horizon. (shrink)

The literature on epistemic injustice has thus far confined the concept of testimonial injustice to speech expressions such as inquiring, discussing, deliberating, and, above all, telling. I propose that it is time to broaden the horizons of testimonial injustice to include a wider range of expressions. Controversially, the form of communication I have in mind is non-verbal expression. Non-verbal expression is a vital, though often overlooked, form of communication, particularly for people who have certain neurocognitive disorders. Dependency upon non-verbal expression (...) is a common feature of some forms of neurocognitive disorders such as ‘intellectual disabilities’, autism and late-stage dementia. According to the narrow definition of testimonial injustice currently championed in the literature, people who express non-verbally are exempt from testimonial injustice. However, when we consider cases where meaningful communications from non-verbal people are dismissed or ignored in virtue of identity prejudice, there seems to be a distinct testimonial harm at play. Using late-stage dementia as a case study, I argue that the definition of testimonial injustice should be expanded to include all communicative practices, whether verbal or non-verbal, to encompass the epistemic harms inflicted upon some of the most marginalised in our society. This paper draws on the phenomenological-hermeneutical approaches to philosophy of science to develop realist perspectivism, an integration of experimental realism and perspectivism. Specifically, the paper employs the distinction between “manifestation” and “phenomenon” and it advances the view that the evidence of a real entity is “explorable” in order to argue that instrumentally-mediated robust evidence indicates real entities. Furthermore, it underpins the phenomenological notion of the horizonal nature of scientific observation with perspectivism, so accounting for scientific pluralism even in the cases (...) of inconsistent models. Overall, realist perspectivism is proposed as the way to go for (phenomenologically-hermeneutically minded) philosophers of science. (shrink)

The view that phenomenally conscious robots are on the horizon often rests on a certain philosophical view about consciousness, one we call “nomological behaviorism.” The view entails that, as a matter of nomological necessity, if a robot had exactly the same patterns of dispositions to peripheral behavior as a phenomenally conscious being, then the robot would be phenomenally conscious; indeed it would have all and only the states of phenomenal consciousness that the phenomenally conscious being in question has. We (...) experimentally investigate whether the folk think that certain (hypothetical) robots made of silicon and steel would have the same conscious states as certain familiar biological beings with the same patterns of dispositions to peripheral behavior as the robots. Our findings provide evidence that the folk largely reject the view that silicon-based robots would have the sensations that they, the folk, attribute to the biological beings in question. (shrink)

Hegel, Husserl and the Phenomenology of Historical Worlds by Tanja Staehler is an effort of integration between the phenomenological thinking of two of the most influential philosophers in the contemporary tradition: G.W.F. Hegel and Edmund Husserl. The author main intention is the radicalisation of Hegel's phenomenology by the overcoming of a prescribed teleology with a more open and horizonally constituted historical development.

The application of artificial intelligence (AI) to judicial decision-making has already begun in many jurisdictions around the world. While AI seems to promise greater fairness, access to justice, and legal certainty, issues of discrimination and transparency have emerged and put liberal democratic principles under pressure, most notably in the context of bail decisions. Despite this, there has been no systematic analysis of the risks to liberal democratic values from implementing AI into judicial decision-making. This article sets out to fill this (...) void by identifying and engaging with challenges arising from artificial judicial decision-making, focusing on three pillars of liberal democracy, namely equal treatment of citizens, transparency, and judicial independence. Methodologically, the work takes a comparative perspective between human and artificial decision-making, using the former as a normative benchmark to evaluate the latter. -/- The chapter first argues that AI that would improve on equal treatment of citizens has already been developed, but not yet adopted. Second, while the lack of transparency in AI decision-making poses severe risks which ought to be addressed, AI can also increase the transparency of options and trade-offs that policy makers face when considering the consequences of artificial judicial decision-making. Such transparency of options offers tremendous benefits from a democratic perspective. Third, the overall shift of power from human intuition to advanced AI may threaten judicial independence, and with it the separation of powers. While improvements regarding discrimination and transparency are available or on the horizon, it remains unclear how judicial independence can be protected, especially with the potential development of advanced artificial judicial intelligence (AAJI). Working out the political and legal infrastructure to reap the fruits of artificial judicial intelligence in a safe and stable manner should become a priority of future research in this area. (shrink)
