Much of the time, human beings seem to rely on habits. Habits are learned behaviours directly elicited by context cues, and insensitive to short-term changes in goals: therefore they are sometimes irrational. But even where habitual responses are rational, it can seem as if they are nevertheless not done for reasons. For, on a common understanding of habitual behaviour, agents’ intentions do not play any role in the coming about of such responses. This paper discusses under what conditions we can (...) say that habitual responses are, after all, done for reasons. We show how the idea that habitual behaviour cannot be understood as ‘acting for reasons’ stems from a widely but often implicitly held theoretical framework: the causal theory of action. We then propose an alternative, Anscombean understanding of intentional action, which can account for habitual responses being done for reasons. (shrink)

According to Oude Maatman (2020), our recent suggestion (Borsboom et al., 2019) that symptom networks are irreducible because they rely on folk psychological descriptions, threatens to undermine the main achievements of the network approach. In this article, we take up Oude Maatman’s challenge and develop an argument showing in what sense folk psychological concepts describe features of reality, and what it means to say that folk psychology is a causal language.

The problem of time involves an overlap between physics, philosophy, psychology and neuroscience. My talk will discuss the role of time in physics but also emphasize that physics may need to expand to address issues usually regarded as being in the other domains. I will first review the mainstream physics view of time, as it arises in Newtonian theory, relativity theory and quantum theory. I will then discuss the various arrows of time, the most fundamental of which is the passage (...) of time associated with consciousness. I will argue that this goes beyond both relativity theory and quantum theory, so that one needs some new physical paradigm to accommodate it. A new paradigm is required anyway to describe quantum gravity and this may elucidate the nature of both time and consciousness. (shrink)

Ian Stevenson's achievements lay not only in the corpus of his written works but also in the influence he had on colleagues whom he exhorted to take an interest in the subject from other fields. One of them is Bernard Carr. Stevenson showed much enthusiasm talking about Carr's two experiments with the Cambridge University Society for Psychical Research, one involving an attempt to detect the telepathic transmission of emotion using hypnotized subjects and psychogalvanic skin response and the other (...) was an investigation of the relative roles of telepathy and clairvoyance in extrasensory perception. Stevenson meticulously read and commented on his work and even invited him to visit his group with the intention of preparing reports for publication. Carr was grateful for the passion he instilled in him for psychical research as a result of these experiences. (shrink)

It is argued that physics must eventually expand to accommodate mind and consciousness but that this will require a new paradigm. The paradigm required will impinge on two problems on the borders of physics and philosophy: the relationship between physical space and perceptual space and the nature of the passage of time. It is argued that the resolution of both these problems may involve a 5-dimensional model, with the 5th dimension being associated with mental time, and this proposal may relate (...) to recent developments in brane cosmology. A description of consciousness must also entail a proper understanding of the specious present, the minimum timescale of conscious experience, this possibly being associated with a compactified extra dimension. J. N. (Jitendra Nath) Mohanty (1928–2023). -/- Professor J. N. Mohanty has characterized his life and philosophy as being both “inside” and “outside” East and West, i.e., inside and outside traditions of India and those of the West, living in both India and United States: geographically, culturally, and philosophically; while also traveling the world: Melbourne to Moscow. Most of his academic time was spent teaching at the University of Oklahoma, The New School Graduate Faculty, and finally Temple University. Yet his (...) preeminent work in Husserlian phenomenology developed alongside his eminent work in Indian philosophy: describing his interests as “a fusion of disparate horizons.” -/- J. N. Mohanty was born September 26, 1928, in Cuttack (Odisha, East India). After graduating from high school, he went on to study both Indian and Western philosophy in Calcutta, earning bachelor’s and master’s degrees. There he read Whitehead and Kant’s First Critique; although he wanted to include mathematics in his curriculum, he was led instead to include Indian philosophy and Sanskrit. On the shelves of his teacher, Ras Vihar Das, he came upon a copy of the English translation (Ideas I, 1931) of Edmund Husserl’s classic Ideen I (1913), which presented Husserl’s ground-breaking conception of phenomenology. In 1952–1954 he left India for the first time, reaching Göttingen to study mathematics and philosophy, which earned him a doctorate in mathematics and “philosophy of mathematical sciences” (in his own words). In Göttingen, Mohanty found the powerful mathematical world that Husserl himself had earlier interacted with, where several Husserl students had formed the Göttingen school of phenomenology. During these years Mohanty studied primarily mathematics, alongside Kant and also Vedic Sanskrit. From his friend Günter Patzig, interpreter of Aristotle and Frege, Mohanty was drawn to Frege in relation to mathematical logic. He attended lectures of Heidegger, intrigued by his ontological thinking. Yet, despite the Husserlian legacy, Mohanty was completely self-taught in his studies of Husserl (as he has reported). With a doctorate in mathematics, and ideas from Kant and Frege in his philosophical background, Mohanty set about crafting his own conception of philosophy grounded in phenomenology, drawing on Husserl’s extensive work, critically sifting through Husserl’s texts and their emerging concepts of intentionality, meaning, subject, intersubjectivity, and world. In between he wrote his first book-length study: on phenomenological insights in Nicolai Hartmann and A. N. Whitehead (1958). -/- Over many decades Mohanty formulated and argued, in analytical detail, for a conception of phenomenology and its place in philosophy, later presented in a clear and concise book titled Transcendental Phenomenology: An Analytic Account (1989). Over these very decades the same scholar explored classical and recent Indian philosophy, thinking through kindred ideas of consciousness, self, and knowledge drawn from the Indian philosophical contexts. While writing on Nyāya theory of truth, he also pondered whether the world and finite individual are illusory or real, and whether Marx, Arendt, Gandhi (whom he heard speak in Calcutta), or Vinoba Bhave (with whom he marched across India for the land-grant movement) could best navigate post-Independent India’s social and svarāj or self-rule reforms. The two Mohantys, thinking through a vision of self and world, turned out to be “non-different” or “non-dual” as they each practiced critical phenomenology from both inside and outside the respective philosophical and cultural traditions. Numerous students, fellows, and colleagues or collaborators have benefited immensely from this infusion and unified approach to diversity in philosophical thought. In the 2000s, moving into retirement, Mohanty wrote two long books devoted to his understanding of Husserl and phenomenology and the calling of philosophy itself. This two-volume study shows Mohanty himself thinking through Husserl, critically, in The Philosophy of Edmund Husserl: A Historical Introduction (2008), and Edmund Husserl’s Freiburg Years: 1916–1938. As Mohanty worked on Husserl, he carefully indicated where he agreed and where he rejected or changed ideas, all part of his practice in phenomenology of “description and interpretation.” It was the same pattern he used in addressing the thought of Husserl vis-à-vis Kant or Frege or even Quine. -/- As Mohanty developed his understanding of phenomenology over the years, he wrote books on theory of meaning and the concept of intentionality, developing a model of ideal meaning and its foundation in intentionality, drawing on Husserl’s results. He followed these with the book Husserl and Frege (1982), linking the thought of those foundational figures for the “continental” and “analytic” traditions, respectively, in twentieth-century Western philosophy. Over his long career Mohanty addressed both traditions in his clear and accessible writing style. While developing his views on phenomenology, Mohanty regularly looked to “Husserl and his others,” evaluating views in Heidegger, Sartre, Merleau-Ponty, Ricoeur, and then Derrida and others in the wake of Husserl. With his background in Kant, Mohanty also looked toward Heidegger and Hegel in relation to Husserl’s later work in the Crisis (1935–38). Similarly, he looked to contemporary analytic philosophers, adjudicating his own, oft-wise Husserlian views in relation to Frege, Nagel, and others. Amid his active scholarly career, Mohanty co-founded the journal Husserl Studies, and was editorial advisor to Philosophy & Phenomenological Research, Philosophy East & West, Journal of Indian Philosophy, Sophia, among others. -/- Yet all this while Mohanty was also thinking and writing about Indian philosophy and its relation to phenomenology. In his own retrospective, Indian philosophy is “the permanent background” of his Husserlian thinking, while Kant is the recurrent Western background of his Husserlian phenomenology. Mohanty’s form of “transcendental phenomenology” evolved, in his own perspective, against the background of his studies of Navya-Nyāya on logic and Vedānta on consciousness, in Indian philosophy, and against the background of Kant’s First Critique on the transcendental, in Western philosophy. Accordingly, Mohanty’s study of logical form and of the intentionality of consciousness seeks a fusion of East and West in the conception of transcendental phenomenology. (Cf. Mohanty’s apt response to critics in The Empirical and the Transcendental (2000).) Even in the context of North American Husserl scholarship, Mohanty has exercised an earnest fusion of East and West. For the so-called East Coast and West Coast interpretations of Husserl’s crucial notion of noema both find a sympathetic spirit in J. N. Mohanty’s careful and nuanced interpretation of Husserlian transcendental phenomenology. Parapsychology will only be accepted as part of mainstream science if physics can be extended to accommodate at least some so-called psychic phenomena. This paper disagrees with the argument of Reber and Alcock that these phenomena can be excluded a priori because they are incompatible with physics. On the other hand, it agrees with their claim that the phenomena cannot be explained in terms of current physics (eg. relativity theory and quantum theory). Rather one needs an extension of physics which (...) amalgamates these theories, this being an aim of mainstream physics anyway, with the new theory also linking to consciousness if this is regarded as a fundamental rather than incidental feature of the universe. One possible extension involves the idea that perceptual space and physical space are amalgamated as part of a 5-dimensional reality structure, the extra dimension being associated with mental (rather than physical) time. Such a model may be required to accommodate even normal mind and incorporating further dimensions might then allow some paranormal phenomena. In this paper we examine how the use of robots in caring for elders can impact the meaningfulness of elders’ lives. We present a framework for understanding ‘meaningfulness in life’, and then apply that framework in discussing ways in which the use of robots to assist in activities of daily living can preserve, enhance or undermine the meaningfulness of elders’ lives. We conclude with a discussion of if and how having false beliefs about companion robots can affect meaningfulness in the (...) life of the person having those false beliefs. (shrink)

Autonomous e-coaching systems offer their users suggestions for action, thereby affecting the user's decision-making process. More specifically, the suggestions that these systems make influence the options for action that people actually consider. Surprisingly though, options and the corresponding process of option generation --- a decision-making stage preceding intention formation and action selection --- has received very little attention in the various disciplines studying decision making. We argue that this neglect is unjustified and that it is important, particularly for designers of (...) autonomous e-coaching systems, to understand how human option generation works. The aims of this paper are threefold. The first aim is to generate awareness with designers of autonomous e-coaching systems that these systems do in fact influence their users' options. The second is to show that understanding the interplay between a person's options and the e-coaching system's suggestions is important for improving the effectiveness of the system. The third is that the very same interplay is also crucial for designing e-coaching systems that respect people's autonomy. (shrink)

Husserl’s philosophy, by the usual account, evolved through three stages: 1. development of an anti-psychologistic, objective foundation of logic and mathematics, rooted in Brentanian descriptive psychology; 2. development of a new discipline of "phenomenology" founded on a metaphysical position dubbed "transcendental idealism"; transformation of phenomenology from a form of methodological solipsism into a phenomenology of intersubjectivity and ultimately (in his Crisis of 1936) into an ontology of the life-world, embracing the social worlds of culture and history. We show that this (...) story of three revolutions can provide at best a preliminary orientation, and that Husserl was constantly expanding and revising his philosophical system, integrating views in phenomenology, ontology, epistemology and logic with views on the nature and tasks of philosophy and science as well as on the nature of culture and the world in ways that reveal more common elements than violent shifts of direction. We argue further that Husserl is a seminal figure in the evolution from traditional philosophy to the characteristic philosophical concerns of the late twentieth century: concerns with representation and intentionality and with problems at the borderlines of the philosophy of mind, ontology, and cognitive science. In Beyond Physicalism, an interdisciplinary group of physical scientists, behavioral and social scientists, and humanists from the Esalen Institute’s Center for Theory and Research argue that physicalism must be replaced by an expanded scientific naturalism that accommodates something spiritual at the heart of nature.

Sören Halldén’s logic of nonsense is one of the most well-known many-valued logics available in the literature. In this paper, we discuss Peter Woodruff’s as yet rather unexplored attempt to advance a version of such a logic built on the top of a constructive logical basis. We start by recalling the basics of Woodruff’s system and by bringing to light some of its notable features. We then go on to elaborate on some of the difficulties attached to it; (...) on our way to offer a possible solution to such difficulties, we discuss the relation between Woodruff’s system and two-dimensional semantics for many-valued logics, as developed by Hans Herzberger. This article discusses the implications of the symbology of Kali from a different and fresh perspective and positions the worship of Kali in the bigger picture of the divinisation of everything in Sanatana Dharma. It also discusses the needless marginalisation of so-called 'ugly' and 'terrible' and how these prejudices have to be overcome to realise the Divinity innate in all.

An interpretation of Kali and the explanation of the absence of a Devil in Hinduism or Sanatana Dharma. This paper shows how there is no 'dichotomy of divinity' in Hinduism. The social, cultural, and spiritual implication of the iconography of Kali is also discussed in the light of women and gender studies.

This article briefly analyses why Sri Ramakrishna was so happy that Swami Vivekananda had accepted Kali and tries to show that the worship of Kali is the ultimate step in accepting everything as divine.

The world of artificial intelligence appears to be in rapid transition, and claims that artificial general intelligence is impossible are competing with concerns that we may soon be seeing Artificial Godlike Intelligence and that we should be very afraid of this prospect. This article discusses the issues from a psychological and social perspective and suggests that with the advent of Generative Artificial Intelligence, something that looks to humans like Artificial General Intelligence has become a distinct possibility as is the idea (...) of making it semi-autonomous: not just responding to discrete external inputs or performing specific tasks but able to prompt itself to create an ongoing stream of cognition that can possess something akin to a ‘purpose’. Add to that the ability of computers to be connected in vast networks, and we can envisage intelligences with staggering amounts of knowledge and reasoning capability, engaging with humans to anticipate and grant wishes. Such Semi-Autonomous Godlike Artificial Intelligences (SAGAIs—meaning ‘engagements’ in Hindi) could end up like Kali, wreaking death and destruction on our species or like Thor, acting as a saviour and protector of humanity. Which of these our SAGAIs most resemble could depend on whose wishes it is designed to serve: a rich oligarchy seeking ever greater wealth and power whatever the cost to others, or a populace that has compassion for each other and for life on the planet. Bounded rationality gets a bad rap in epistemology. It is argued that theories of bounded rationality are overly context‐sensitive; conventionalist; or dependent on ordinary language (Carr, 2022; Pasnau, 2013). In this paper, I have three aims. The first is to set out and motivate an approach to bounded rationality in epistemology inspired by traditional theories of bounded rationality in cognitive science. My second aim is to show how this approach can answer recent challenges raised for theories of bounded rationality. (...) One of the important ramifications of these questioning of the reflective subject is to do with the phenomenological doctrine of intentionality of consciousness. Recently, David Carr, himself a phenomenologist, has advanced a serious objection to the phenomenological approach to social reality. Altruisme pada makhluk sosial, selain manusia, selalu menjadi topik yang menarik. Satu dari contoh tipikalnya adalah semut pekerja – semut mandul yang bekerja tanpa kenal lelah demi ratu mereka. Bisa dibilang, evaluasi menurut asas biaya-manfaat dalam sistem koloni semut sedang berlangsung di tingkat kolektif dan bukan tingkat individu. Perlu dicatat bahwa hal ini secara biologis lebih merupakan batasan yang “keras” daripada pilihan yang bersifat “pribadi”. Perilaku altruistik yang dipilih secara alami pada hewan bermanfaat bagi kelangsungan hidup dan reproduksi spesies yang (...) membawa biaya individu (pengorbanan). Secara keseluruhan, perilaku seperti ini disebut altruisme biologis [1]. Niat dan perilaku manusia sering kali merupakan gabungan yang jauh lebih rumit dari naluri biologis dan kognisi tingkat lanjut. Perilaku altruistik pada manusia yang banyak ditemukan telah dikaitkan secara positif dengan kebahagiaan, kesehatan mental yang lebih baik, dan kesehatan fisik yang lebih baik, yang disarankan selaras dengan prinsip biologis dan evolusioner alam [2]. Dalam novel klasik Crime and Punishment, Fyodor Mikhailovich Dostoevsky secara artistik dan dengan sengaja menggambarkan penderitaan mental dan dilema moral Rodion Romanovich Raskolnikov, seorang mantan mahasiswa hukum muda yang intelek dan simpatik yang tinggal di daerah kumuh Saint Petersburg [1]. Konflik batin Raskolnikov muncul demi kepentingan kemanusiaannya ketika melihat kehidupan yang menyedihkan di sekelilingnya, mengarah pada sikap utilitarian-altruistik terkait pembenaran atas kejahatannya [2]: “Mengapa tidak membunuh rentenir tua yang malang, rakus, dan “tidak berguna” lalu menggunakan dananya untuk meringankan penderitaan manusia?” (...) Dengan pemikiran itu di dalam pikirannya, Raskolnikov bertekad untuk melakukan pembunuhan tetapi ia segera kewalahan oleh rasa bersalahnya. Sudah lebih dari satu abad sejak novel ini pertama kali diterbitkan. Namun, masih banyak orang yang memiliki penderitaan mental dan dilema moral seperti yang dihadapi Raskolnikov. Sebagai manusia, penyakit merupakan sebuah kenyataan yang tidak bisa dihindari namun ingin dihindari oleh semua orang, terutama penyakit yang bersifat fatal seperti kanker, penyakit jantung, infeksi pernafasan, dll. Beberapa diantaranya dapat disembuhkan, dan beberapa tidak. Namun, bagi masyarakat yang mengalami kemiskinan, uang adalah alasan utama yang membuat sebagian besar penyakit serius menjadi “tidak dapat disembuhkan”. Kenyataan pahitnya adalah semakin serius sebuah penyakit, semakin mahal pula biaya pengobatannya. Baik pasien dengan penyakit serius maupun keluarga mereka perlu melakukan pengorbanan yang signifikan untuk membiayai tingginya biaya pengobatan dan perawatan, yang dapat mendorong mereka ke dalam kemiskinan. Jika perawatan medis tidak lagi terjangkau, maka rumah sakit kemungkinan akan “memulangkan” pasiennya ke rumah sehingga mereka dapat menghabiskan saat-saat terakhir hidup mereka dekat dengan orang yang mereka cintai. Pasien non-lokal, miskin, dan tidak memiliki asuransi memiliki sekitar 70% kemungkinan untuk menjadi miskin akibat menjangkau layanan kesehatan [3]. (shrink)

Ruang biru adalah istilah yang menunjukkan permukaan luar ruangan yang alami (atau terkadang semi alami). perairan secara umum, termasuk lautan, sungai, danau, kanal, dll. Penelitian menunjukkan bahwa, seperti ruang hijau, ruang biru juga bermanfaat bagi kesehatan mental dan kesejahteraan psiko-sosial manusia [1]. This article explains and defends reverence as a cardinal ethical value in the Western philosophical tradition, which was considered an underpinning value in ancient society, and it then gradually declined over time. Many contemporary Western philosophers embark on respect rather than reverence. Reverence and respect are not the same. Reverence is all-inclusive, while respect is limited. Reverence values the genuine person, while respect may flatter a powerful arrogant person. Reverence is a cardinal moral and political value necessary for decent politics, (...) education, law, economics, and religion. Reverence is not only essential for becoming a perfect human person but also for instituting a good society. To expound the notion of reverence in the Western tradition, I select four significant Western intellectuals: Johann Wolfgang von Goethe, Bertrand Russell, Albert Schweitzer, and Paul Woodruff. Goethe posits a tripartite account of reverence: reverence for God, Earth, and human beings. Russell argues for reverence in politics and education. Schweitzer not only developed his account of reverence but also lived his life according to it. Schweitzer declares that his life is his argument, which is reverence for life, life in all its forms. Woodruff intends to revive the notion of reverence in global politics and ethics. So, the article examines the accounts of reverence posited by Goethe, Russell, Schweitzer, and Woodruff and defends its role as a cardinal moral and political value vital for politics, education, and religion for acquiring the common good in the world. According to a widely held view of the matter, whenever we assess beliefs as ‘rational’ or ‘justified’, we are making normative judgements about those beliefs. In this discussion, I shall simply assume, for the sake of argument, that this view is correct. My goal here is to explore a particular approach to understanding the basic principles that explain which of these normative judgements are true. Specifically, this approach is based on the assumption that all such normative principles are grounded in (...) facts about values, and the normative principles that apply to beliefs in particular are grounded in facts about alethic value––a kind of value that is exemplified by believing what is true and not believing what is false. In this chapter, I shall explain what I regard as the best way of interpreting this approach. In doing so, I shall also show how this interpretation can solve some problems that have recently been raised for approaches of this kind by Selim Berker, Jennifer Carr, Michael Caie, and Hilary Greaves. This is the lightly revised text of my commentary/response to David Carr’s keynote address, “Phenomenology of Crisis,” at the 2024 meeting of the Husserl Circle.

In 1911, Bergson visited Britain for a number of lectures which led to his increasing popularity. Russell personally encountered Bergson during his lecture at University College London on the 28th of October, and on the 30th of October Bergson attended one of Russell’s lectures. Russell went on to write a number of critical articles on Bergson, contributing to the hundreds of publications on Bergson which ensued following these lectures. Russell’s critical writings have been seen as part of a history of (...) controversies between so-called ‘Continental’ and ‘Analytic’ philosophers in the twentieth century. Yet Russell’s engagement with Bergson’s thought comes as a response to a particular British form of Bergsonism and is involved with the wider phenomenon of the British import of Bergsonism (by figures connected in different ways to Russell, such as Hulme, Wildon Carr or Eliot). Though this may challenge the view of Russell and Bergson as enacting an early version of the ‘Analytic’-‘Continental’ divide, there are however some particular characterisations of Bergson by Russell which contribute to the subsequent formation of the ‘rotten scene’ (Glendinning 2006: 69) of the divide in the second half of the twentieth century. In 2018, the Art Gallery of Ontario retitled a painting by Emily Carr which contained an offensive word. Controversy ensued, with some arguing that unsanctioned changes to a work’s title infringe upon artists’ moral and free speech rights. Others argued that such a change serves to whitewash legacies of racism and cultural genocide. In this paper, I show that these concerns are unfounded. The first concern is not supported by law or the history of our titling practices; and the (...) second concern misses the mark by ignoring the gallery’s substantial efforts to avoid just such an outcome. Picking up on a suggestion from Loretta Todd, I argue that we can use Aboriginal Title as a model for thinking about the harms perpetuated by cultural appropriation, and the practices we should adopt to mitigate them. This chapter examines Bertrand Russell’s various confrontations with Bergson’s work. Russell’s meetings with Bergson during 1911 would be followed in 1912 by the publication of Russell’s earliest polemical pieces. His 1912 review of Bergson’s Laughter ridicules the effort to develop a philosophical account of humour on the basis of some formula. In his 1912 “The Philosophy of Bergson”, Russell develops a series of objections against Bergson’s accounts of number, space, and duration. Bergson’s position is defended against Russell’s onslaught by H. (...) W. Carr (1913) and Karin Costelloe-Stephen (1914), though Russell only replies to the former. By contrast to Bergson’s silence in the face of Russell’s criticisms, Russell would continue responding to Bergson’s views in multiple works during the 1910s and 1920s. As this chapter shows, Russell not only develops further objections against specific theses upheld by Bergson, but also comments upon the political implications of Bergson’s philosophy, as well as its positioning within the history of French philosophy. I examine two explanatory models of choking: the representationalist model and the anti-representationalist model. The representationalist model is based largely on Anderson's ACT model of procedural knowledge and is developed by Masters, Beilock and Carr. The antirepresentationalist model is based on dynamical models of cognition and embodied action and is developed by Dreyfus who employs an antirepresentational view of know-how. I identify the models' similarities and differences. I then suggest that Dreyfus is wrong to believe representational activity requires reflection (...) and attention. I also argue that the representationalist model of choking is preferable, since some embodied actions require appeals to representations, something not available to Dreyfus's anti-representational model. It is now over twenty years since Premack and Woodruff posed the question, ‘Does the chimpanzee have a theory of mind?’—‘by which we meant’, explained Premack in a later reappraisal, ‘does the ape do what humans do: attribute states of mind to the other one, and use these states to predict and explain the behaviour of the other one? For example, does the ape wonder, while looking quizzically at another individual, What does he reallywant?What does hebelieve?What are hisintentions?'.

Sentencing outcomes turn on moral and evaluative determinations. For example, a finding of “irreparable corruption” is generally a precondition for juvenile life without parole. A finding that the “aggravating factors outweigh the mitigating factors” determines whether a defendant receives the death penalty. Should such moral determinations that expose defendants to extraordinary penalties be subject to a standard of proof? A broad range of federal and state courts have purported to decide this issue “in the abstract and without reference to our (...) sentencing case law,” as the Supreme Court recently put it. Kansas v. Carr, 577 U.S. 108, 119 (2016). According to these courts, “it would mean nothing” to ask whether the defendant “deserves mercy beyond a reasonable doubt” or “more-likely-than-not deserves it” because moral questions are not “factual.” Instead, moral determinations are highly subjective “value calls” to which concepts of doubt and certainty do not intelligibly apply. -/- Implicit in these rulings is a controversial view of the nature of moral judgment. This Article traces the contours of the view and argues that it is out of step with the way the broader public thinks about morality and fails to address the issues defendants have raised. Courts should avoid wading into such controversial waters for two reasons. First, the judiciary has historically maintained neutrality on issues of significant public concern. Second, even if moral determinations are not factual, applying a standard of proof to at least some moral decisions at sentencing would change the outcome of the sentencer’s deliberations, and improve the legitimacy of the legal system. For the reasonableness of doubt depends on context; and moral questions—"are you certain the defendant deserves death?”—make salient the stakes relative to which a person should decide what to believe about ordinary empirical matters. On the resulting view, reasonable doubt in the final moral analysis is not just intelligible, but essential for correcting a bias in the structure of the bifurcated criminal trial that systematically disadvantages defendants: the tendency for de-contextualized "factual findings” in the guilt phase to control outcomes at sentencing. In lieu of an abstract, here is a brief excerpt of the content:Scrutinizing the Art of TheaterAaron Meskin (bio)IntroductionIn his 1992 address to the American Society for Aesthetics, Peter Kivy suggested that philosophers of art might do best by giving up on “grand theorizing” (that is, pursuing the definition of art).1 In its place he proposed that they pursue the “careful and imaginative philosophical scrutiny of the individual arts and their individual problems.”2 Of course John Passmore and others had said (...) similar things at earlier points,3 but philosophical aesthetics has, it seems to me, finally and robustly taken the turn toward the philosophies of the arts. Much of the best work in philosophical aesthetics over the last fifteen years or so has pursued the route Kivy suggested. James Hamilton’s The Art of Theater is part of this turn—it is careful and imaginative scrutiny of the art of theater done at the very highest level, and I am delighted to have this opportunity to comment on it.4In what follows I shall address a number of issues raised by Hamilton’s work: the definition of theatrical enactment; the place of pretending and imagining in theatrical performance; the nature of Hamilton’s “ingredients model” and its relation to more traditional accounts of the work/performance relation; the account of theatrical style on offer; and the question of what we have learned from experimental theater.But before I move on to address those aspects of the book’s content in detail, let me say something about the pedagogical significance of this work. Although there are a number of legitimate ways to teach introductory courses on aesthetics and the philosophy of art (for example, by following a historical progression or by structuring it around certain key issues), one increasingly attractive option is to teach a course that focuses on those aforementioned individual arts and their individual problems. So, for example, I used to regularly teach graduate seminars in aesthetics to students enrolled [End Page 51] in a fine arts doctoral program. These students studied music, art education, the visual arts, theater, and dance; the seminars were designed to provide them with a broad foundation in philosophical aesthetics. Since they typically had no background in philosophy, I made the effort to assign readings and topics relevant to their own artistic practices and interests. Providing them with contemporary cutting-edge philosophical material on music and the visual arts was not hard. Kivy’s work, as well as that by Jerrold Levinson, Arthur Danto, Richard Wollheim, and others, makes that fairly easy. And intriguingly—since philosophers are commonly said to have ignored the art of dance—there’s even a decent amount of recent philosophical work on that art form by such authors as Graham McFee, Frances Sparshott, and Noël Carroll and Sally Banes.5 But where to turn to for the theater students? I would often read some of Aristotle’s Poetics with them, but I have to admit that the serious students of the theater that I encountered in those seminars typically knew that text much better than I did. (Still, I hope I challenged their breezy assumptions about catharsis!) We would read Hume on tragedy together—fun, but not really so much about the theater—and sometimes a bit of Nietzsche. But there was never much to give them from contemporary philosophers on the subject—a few articles here and there, of course, but nothing that clearly laid out the big and distinctive issues that the art form of theater raises. Nothing, to put the point a bit differently, that would provide any evidence that there really was a lively and extant philosophy of theater out there, as there are lively and extant philosophies of film, music, literature, and photography. In short, for those attracted to the prospect of teaching aesthetics as the philosophies of arts, the dearth of good work on theater by contemporary philosophers has been a significant source of frustration and even a bit of an embarrassment.The book in question is not the only recent philosophical work on theater. JKR est tout aussi désemparé sur elle-même et le monde que la plupart des gens, mais environ200 fois plus destructeur que l’Américain moyen et environ 800 fois plus que le Chinois moyen. Elle a été responsable de (...) la destruction de peut-être 30.000 hectares de forêt pour produire ces romans trash et toute l’érosion qui s’ensuit (pas trivial car il est au moins 6 et peut-être 12 tonnes / an de sol dans l’océan pour tout le monde sur terre ou peut-être 100 tonnes par Américain, et donc environ 5000 tonnes par an pour les livres de Rowling et films et ses 3 enfants). La terre perd au moins 1% de sa terre maximale chaque année, de sorte qu’il approche de 2100, la plupart de sa capacité de culture alimentaire aura disparu. Ensuite, il ya l’énorme quantité de carburant brûlé et les déchets faits pour faire et distribuer les livres et les films, poupées en plastique, etc. Elle montre son manque de responsabilité sociale en produisant des enfants plutôt que d’utiliser ses millions pour encourager la planification familiale ou acheter la forêt tropicale, et en promouvant la stupidité libérale conventionnelle de la suprématie du 3e monde qui détruit la Grande-Bretagne, l’Amérique, le monde et l’avenir de son descendant. Ils manquent d’une combinaison d’intelligence, d’éducation, d’expérience et de santé mentale nécessaires pour extrapoler les assauts quotidiens sur les ressources et le fonctionnement de la société à l’effondrement éventuel de la civilisation industrielle. Chaque repas, chaque voyage en voiture ou en bus, chaque paire de chaussures est un autre clou dans le cercueil de la terre. Il n’a probablement jamais traversé son esprit qu’un siège dans un avion de Londres à San Francisco produit environ une tonne de carbone qui fond environ 3 mètres carrés de glace de mer et comme l’un des surprivileged, elle a probablement volé des centaines de ces vols. Non seulement les riches et les célèbres, mais presque n’importe quelle personnalité publique du tout, y compris pratiquement tous les enseignants, sont poussés à être politiquement corrects, ce qui dans les démocraties occidentales, signifie maintenant social-démocrate (néomarxiste, c’est-à-dire communiste dilué) suprémacistes du tiers monde travaillant pour la destruction de leurs propres sociétés et de leurs propres descendants. Ainsi, ceux dont le manque d’éducation, d’expérience, d’intelligence (et de bon sens de base), qui devrait leur interdire de faire des déclarations publiques du tout, domine totalement tous les médias, créant l’impression que l’intelligent et civilisé doit favoriser la démocratie, la diversité et l’égalité, alors que la vérité est que ce sont les problèmes et non les solutions, et qu’ils sont eux-mêmes les principaux ennemis de la civilisation. The animal mindreading debate is coined with theoretical and practical problems which have lead some to believe that it has reached a stalemate. Since Premack and Woodruff have asked whether the chimpanzee has a theory of mind over 30 years ago, the question is still on the table. Even though a lot of evidence has been brought forward by both sides, proponents and opponents of the view that animals can be mindreaders, nothing is definitive. The essential problems remain unresolved.

This book is co-written in a lively, engaging form by Karen Carr, from the discipline of religious studies and Philip Ivanhoe, whose background is in the disciplines of religious studies and Asian languages and philosophy. Unlike typical co-authorship, these two authors write separate pieces about Zhuangzi and Soren Kierkegaard and then together offer a combined vision. Refreshingly, the emphasis is on contrast of exemplars of two different and irreconcilable ways instead of comparison between similar thinkers. The two authors are (...) to be congratulated for this in-depth interchange both with each other and with these two iconoclastic thinkers. It is hoped that this innovative genre-a study of contrasts that partially crosses disciplines, maintains the integrity of each coauthor, and yet attempts a comprehensive vision-will provide inspiration for comparative studies in the future. This chapter is particularly concerned with the status of history, dance history especially, within Dance Studies. It asks what has befallen the more recent status of history, once an epistemological support at a critical stage in Dance Studies’s early development, now that Dance Studies is better established, relatively speaking, within the academy. Is history so much scaffolding which, having fulfilled its purpose in enabling the disciplinary plant to take root, is to be dismantled and, if not actually discarded, at least (...) demoted? Three factors will be identified and proposed as having particular significance in this connection, imbuing this chapter with a tri-partite structure. The first concerns the already noted strong imprint of Cultural Studies on Dance Studies and the possible bearing of this imprint on dance history’s status within Dance Studies. For the particular manner in which Dance Studies has construed Cultural Studies may, this chapter will suggest, have impacted upon dance history’s standing within communities of dance scholarship. The second factor has to do with the implications, for dance history, of a particular critique based in a branch of dance scholarship, that perceives phenomenology, which it deems a good fit for dance inquiry, as inherently antithetical to history. In particular, this critique takes the work of Michel Foucault - which it identifies closely with, and as, historical practice - as incompatible with dance enquiry. Incompatibility is staked on the twin grounds of Foucault’s break with, and supposed resulting and enduring antipathy towards, phenomenology; and his perceived embrace of history which is, itself, also understood to result from such a break. In effect, then, this critique questions the very suitability, for dance research, of approaches based in history-focussed inquiry. The ability to call this critique into question, in the ways that the present discussion, in seeking to rehabilitate Foucault, and so history, needs to demonstrate, constitutes the third factor. This final factor makes two particular, further demands of this chapter. Namely that the interrelated questions of Foucault, phenomenology, and dance; and of the position which phenomenology has itself adopted in relation to history, be re-visited and re-evaluated to the extent that space reasonably allows. Fortunately, these interrelated questions are ones which have - relatively recently - preoccupied scholarship on Foucault, and on phenomenology, respectively. This preoccupation may in and of itself be one possible indicator that there is indeed more at stake, and so to consider, regarding both questions, than the lines drawn by the aforementioned critique might suggest.
