Abstract: This working paper focuses on the question whether there is a therapeutic imperative that, in specific situations, would oblige us to perform genome editing at the germline level in the context of assisted reproduction. The answer to this central question is discussed primarily with reference to specific scenarios where preimplantation genetic diagnosis (PGD) does not represent an acceptable alternative to germline genome editing based on either medical, or ethical, or – from the perspective of the potential parents – moral (...) or religious grounds. This article deals with four different types of case constellations that result from these possible reasons against PGD as well as from the necessity or dispensability of a subsequent “control PGD.” These cases are discussed based on hypotheses concerning contextual factors and theoretical assumptions. In conclusion, we point out that if our assumptions are correct, there is probably no therapeutic imperative for genome editing at the germline level. We draw this rationale from the fact that germline interventions are likely not person-affecting. Cet article traite de quatre constellations différentes de cas résultant des raisons mises en avant pour s'opposer au DPI ainsi que de la nécessité ou de l’inutilité d’un ultérieur « DPI de contrôle » Ces cas sont discutés sur la base d’hypothèses portant sur les facteurs contextuels et sur les présupposés théoriques. Excerpt: 1. Introduction This chapter provides insight into the diverse ethical debates on genetics and epigenetics. Much controversy surrounds debates about intervening into the germline genome of human embryos, with catchwords such as genome editing, designer baby, and CRISPR/Cas. The idea that it is possible to design a child according to one’s personal preferences is, however, a quite distorted view of what is actually possible with new gene technologies and gene therapies. These are much more limited than the editing and (...) design metaphors suggest. Such metaphors are therefore highly problematic phrases in the context of new gene technologies, for two reasons. On one hand, to design a child of choice by modifying the genome would require modifying any gene of choice, which is more than can be done with current gene technologies, such as CRISPR/Cas. On the other hand, a modification of genes would need to be enough to create any characteristic of choice in the future child. The latter presupposes the assumption of genetic determinism. Moreover, the CRISPR/Cas technology can not only be used in a potentially therapeutic manner at the germline level. In addition, there is the (more likely) scenario of a future clinical therapeutic use of these new gene technologies for modifying the DNA sequence of other cells of the body (somatic genome editing). There is also the option of modifying the epigenome, that is, the spatial configuration of DNA (epigenome editing) (see table 1). Like genetics and genome editing, epigenetics has been at the center of recent popular scientific and ethical discourse as well as scientific debates. The concept of epigenetics has given rise to very different notions of inheritability and responsibility for health, which, however, are oftentimes based on scientifically controversial basic assumptions. That there continues to be covert genetic determinism in the form of epigenetic determinism (see table 2) in debates about epigenetics has been pointed out in ethical analyses of epigenetics. Neither genetic determinism nor epigenetic determinism has been confirmed scientifically. It is therefore important to recognize the concepts that are discussed (and sometimes harshly criticized) in debates about genome editing and epigenetics—for example, concepts about the causal role of DNA for our own life course. This importance is based on the fact that if we understand such controversial concepts, we will be able to remain critical when evaluating scientific knowledge and ethical arguments about genome editing and epigenetics. This chapter, therefore, explains some of these concepts. For an ethical analysis of epigenetics as well as of genome editing, it is necessary to understand and critically reflect upon the underlying concepts of genetic determinism and other, related -isms. The following section offers a detailed introduction to these -isms (section 2; see also table 2). Section 3 provides an ethical analysis of genome editing and epigenetics based on the explanations in section 2. Section 3 focuses on inheritability and responsibility, justice, safety, the problem of consent, and the effects of genome editing and epigenetics on embryos and future generations. This section does not discuss in detail further points that can be found in ethical debates about epigenetics as well as in ethical debates about genome editing. These points include (among others): • fear that the findings of epigenetics and that the methods of genome editing are misused—this also with respect to eugenics and enhancement; • naturalness—an issue we mention in passing a few times in the following analysis; • a possible connection between the genome/epigenome and the concept of human dignity, and the derived danger of instrumentalization and infringement of autonomy when intervening in the genome or epigenome. Since current discourse about ethical issues associated with genome editing focuses mainly on germline interventions, which are, for instance, interventions into a human embryo’s genome, we mainly focus on germline interventions when comparing the debates on genome editing and on epigenetics in section 3. This chapter examines whether high prices for gene therapies are justified and whether the problems associated with high prices can be solved by the "pay for performance" (P4P) reimbursement model. To this end, we first describe how prices for new drugs, including gene therapies, are set in Germany (section 2.). P4P is then presented as an example of a reimbursement model (section 3.). The subsequent ethical analysis (section 4.) first examines whether P4P models can sustainably guarantee the right to health (...) and healthcare for all people (section 4.1; cf. on the "sustainable right to health" already Alex, 2021). It is then shown that cost-benefit analyses for setting prices for new gene therapies must be viewed critically from an ethical perspective and pose a problem for equity of access and thus also for the sustainable guarantee of a right to health (section 4.2). While Immanuel Kant is an epochal figure in a variety of fields, he has not figured prominently in the study of rhetoric and communication. This book represents the most detailed examination available into Kant's uneasy but often misunderstood relationship with rhetoric. By explicating Kant's complex understanding of rhetoric, this book advances the thesis that communicative practices play an important role in Kant's account of how we become better humans and how we create morally cultivating communities.

Analisa a forma com a qual o selo postal brasileiro contribuiu para a construção de representações da religião católica em relação a outras práticas religiosas. Foi considerado, para isso, a concepção deste artefato enquanto media, texto semiótico e sua estreita relação com o discurso religioso. O corpus é composto por selos postais comemorativos brasileiros emitidos durante o século XX. A sua identificação e análise foi feita a partir do catálogo RHM. Entre o ano de 1900 e 2000, os Correios emitiram (...) 2354 selos postais do tipo comemorativo. A partir da observação e identificação de recorrências religiosas foram compilados 222 selos postais comemorativos. O estudo correlacionou a recorrente temática religiosa com o contexto histórico brasileiro, considerando o declínio do catolicismo como maioria religiosa no país e às representações das práticas religiosas nas mídias. A conclusão indica a influência da Conferência Nacional dos Bispos do Brasil, junto ao Ministério das Comunicações e dos Correios do Brasil, consagrando e enaltecendo a visibilidade de personalidades, eventos e a práxis católica, como um discurso único e superior às demais práticas religiosas. Financial literacy is becoming a pivotal skill in navigating the marketplaces within the predominant rising digital branches of trading domains; however, there remains a concerning gap in the purchasing behavior of adolescents, who are its primary users. With this in mind, the main objective of our research is to determine whether there is a relationship between a student's level of financial literacy and their online purchase decision-making. The researchers employed an explanatory mixed approach and purposive sampling to identify respondents from (...) Immaculate Conception College of Balayan, Inc. A 5-point Likert scale survey was utilized to collect data from 66 respondents, followed by semi-structured interviews with 10 selected participants. The results showed a moderately positive correlation between a student's financial literacy and online purchase decisions, as determined by the Pearson correlation coefficient. Thus, the thematic analysis revealed that respondents generally have good financial literacy, emphasizing factors like pricing, online reviews, and product ratings when making digital marketplace decisions. However, there are notable gaps in their understanding of basic financial concepts and their ability to apply them in real-life situations. To effectively enhance students’ financial literacy and online purchasing decisions, a holistic approach is necessary, including targeted interventions, practical applications, and continuous adaptation to evolving consumer behaviors. Educational institutions, policymakers, and stakeholders should work together to create comprehensive programs that provide students with the knowledge, skills, and attitudes needed to negotiate real-world financial situations and make sound judgments in the digital commerce ecosystem. By emphasizing practical learning, key financial concepts, and trustbuilding approaches, educators may empower students to become responsible consumers capable of managing their resources successfully and ethically. Socioeconomic status refers to the family's social and economic standing in society. It is measured by combining an individual or group's economic and social position, which is often based on income, education, and occupation. It significantly affects academic performance and even one's health status. The pandemic changed the educational system, causing a huge transition from traditional learning methods to online learning. This shift resulted in confusion, burden, and difficulty among students from different walks of life. This study was conducted to (...) determine the academic stress on online learning among nursing students in relation to their economic status and their ability to access technology. The study utilized a quantitative-correlational method aided by a standard questionnaire. Two hundred thirty-six University of Bohol nursing students enrolled in the second semester of SY 2021–2022 were included in the study by random selection. Data revealed a significant correlation between economic status and the level of stress related to academic expectations and a significant correlation between economic status and access to technology after being subjected to the Spearman rho test of correlation. However, no significant correlation was found between access to technology and the respondents' level of academic stress. (shrink)

Is ruling out the possibility that one is dreaming a requirement for a knowledge claim? In “Philosophical Scepticism and Everyday Life” (1984), Barry Stroud defends that it is. In “Others Minds” (1970), John Austin says it is not. In his defense, Stroud appeals to a conception of objectivity deeply rooted in us and with which our concept of knowledge is intertwined. Austin appeals to a detailed account of our scientific and everyday practices of knowledge attribution. Stroud responds (...) that what Austin says about those practices is correct in relation to the appropriateness of making knowledge claims, but that the skeptic is interested in the truth of those claims. In this paper, we argue that Stroud’s defense of the alleged requirement smuggles in a commitment to a kind of internalism, which asserts that the perceptual justification available to us can be characterized independently of the circumstances in which we find ourselves. In our reading of Austin, especially of Sense & Sensibilia, he rejects that kind of internalism by an implicit commitment to what is called today a “disjunctive” view of perception. Austin says that objectivity is an aspect of knowledge, and his disjunctivism is part of an explanation of why the alleged requirement is not necessary for a knowledge claim. Since both Stroud and Austin are committed to the objectivity of knowledge, Stroud may ask which view of perceptual knowledge is correct, whether the internalist or the disjunctive. We argue that by paying closer attention to what Austin says about our practices of knowledge attribution, one can see more clearly that it is grounded not only on a conception of objectivity, but also on a conception of ourselves as information agents, a conception that is as deeply rooted as that of the objectivity of knowledge. This gives us moral and practical reasons to favor the disjunctive view of perception. (shrink)

This paper presents an original, ambitious, truth-directed transcendental argument for the existence of an ‘external world’. It begins with a double-headed starting-point: Stroud’s own remarks on the necessary conditions of language in general, and Hegel’s critique of the “fear of error.” The paper argues that the sceptical challenge requires a particular critical concept of thought as that which may diverge from reality, and that (...) this concept is possible only through reflection on situations of error, in which how things are thought to be diverges from how things really are with independent items in an objective world. The existence of such a world is therefore a necessary condition of the possibility of scepticism: such scepticism is therefore false. I defend the argument against objections from Stroud’s sceptic and others. Drawing on Heidegger, the paper concludes by indicating that the chain of necessary conditions includes practical engagement with the world. (shrink)

I argue that Stroud's nonreductionism about meaning is insufficiently motivated. First, given that he rejects the assumption that grasp of an expression's meaning guides or instructs us in its use, he has no reason to accept Kripke's arguments against dispositionalism or related reductive views. Second, his argument that reductive views are impossible because they attempt to explain language “from outside” rests on an equivocation between two senses in which an explanation of language can be from outside language. I offer (...) a partially reductive account of meaning which appeals both to speakers’ dispositions to produce and respond to utterances in naturalistically specifiable ways, and to the normative attitudes they adopt, in so doing, to their own behavior. This account is supported, I argue, by Stroud's early treatment of Wittgenstein's rule-following considerations and in particular of the agreement in primitive judgments or reactions which Wittgenstein takes to be required for linguistic communication. In his final monograph, Barry Stroud argues that certain fundamental concepts, like the concept of causation, are not only indispensable to any thought of an objective, independent world, but that they are also, therefore, invulnerable to skeptical attack. Given some assumptions about thought and objectivity, this leads him into the following metaphysical aporia: We can neither metaphysically establish that the objective, independent world is as we must think of it nor that it is not that way. I will argue (...) that the source of this aporia is a notion of objectivity in terms of the complete independence from any relation to thought whatsoever. This is a notion never explicitly argued for, as Stroud does not identify its origin. I then argue that a Kantian notion of objectivity can both be justified by tracing it to its origin in what we understand thinking and perceiving to be and dissolve Stroud’s aporia. If there is a way we must think of the world, and if we conceive of this world as completely independent of any relation to thought, then it is indeed hard to see why the world would agree with the fundamental form of thought. But if the objective, independent world is instead conceived of in relation to thought rather than independently of it and in terms of the independence from subjects and acts of thinking and perceiving, then it becomes intelligible how the world in relation to thought can agree with our fundamental concepts, while the world independent of any relation to thought might not. In “The Constraints of Hume’s Naturalism” Barry Stroud takes on the task of looking at Hume’s negative and positive accounts of induction in conjunction. Stroud goes about doing this so that we might walk away with “a more general lesson about naturalism, at least when it is indulged in for philosophical purposes”. Given the boldness of Stroud’s quote from above there should be some explicit talk of this general lesson about naturalism outside of Hume’s, but there is (...) none that is readily apparent. If a more general and philosophically motivated lesson about naturalism is to be gleaned from Stroud’s investigation of Hume, then we should take this to be a lesson implicit in Stroud and not Hume. Hence I shall argue that Stroud tacitly endorses the skeptical conclusions of David Hume about naturalism in general when indulged for philosophical purposes. (shrink)

In this paper I introduce the transcendental argument for Christian theism in the context of Reformed theologian and philosopher Cornelius Van Til’s thought. I then present the critique proffered by Barry Stroud against ambitious transcendental arguments, and survey various formulations of transcendental arguments in the literature, seeking how the objection bears upon them. I argue that Adrian Bardon’s (2005) interpretation is the most helpful in understanding the Stroudian objection. From this interpretation, two types of possible rebuttals are deduced. Proceeding (...) to survey the responses offered by Van Tillians to this objection in the recent literature, I discern two general strategies pursued in these responses, which map onto the previously deduced types of rebuttals: the Biblical justification strategy and the objection-undermining strategy. I argue that all the specific attempts to answer Stroud which I examine here (those of Butler, Bosserman, and Fluhrer) are inadequate and that these two strategies, in general, face serious problems. I conclude with considering the options before the proponent of the transcendental argument for Christian theism and with offering a new objection to the argument, which focuses on its inconsistency with the implications of Christian theism itself. Karl Jaspers’ Post-Neo-Kantian project of metaphysics. -/- In this paper I propose an interpretation of Karl Jaspers’ project of metaphysics as a form of Post-Neo-Kantianism. Jaspers makes Kantian philosophy one of the most important starting points of his own philosophical thinking. But, like Nicolai Hartmann and Martin Heidegger, he rejects the Neo-Kantian epistemological interpretation of Kant’s philosophy. Neo-Kantians claimed that Kant rejected metaphysics and wished to set up the theory of cognition as a new philosophia prima. In opposition to this, (...) Jaspers emphasizes the metaphysical sense of Kant’s philosophy. Moreover, in his project of the philosophy of the Umgreifenden he gives a positive meaning to transcendental physiology, the part of metaphysics which, according to the common reading of Kant, was definitely rejected by him. Publications in the Kant-Studien have a dual focus: firstly contributions to the interpretation, history and editorial questions of Kant’s philosophy, and secondly systematic debates on transcendental philosophy. In addition, there are investigations on Kant’s precursors and on the effects of his philosophy. The journal also contains a documentation section, in which the current state of research is indicated by means of a continually updated bibliography with reviews and references.

Stroud has argued for many years that skepticism is conditionally correct. We cannot, he claims, both undergo a Cartesian-style examination of the extent of our knowledge as well as avoid skepticism. One reason Stroud's position appears quite plausible is the so-called "totality condition" imposed for this kind of examination: as inquiring philosophers we are called upon to assess all of our knowledge, all at once. However, in this paper I argue that Stroud's apparent understanding of the totality (...) condition is mistaken. Evidently, Stroud thinks that honoring the totality condition amounts to imposing the strong requirement that we initially assume that we don't know anything about external reality. However, there is a weaker requirement available: that we initially not assume that we know anything about external reality. I argue i) that the weaker conception of the totality condition is most suitable for the kind of philosophical examination that Stroud seems to have in mind; and ii) that according to this same conception skepticism is not conditionally correct. Simon Keller and Sarah Stroud have both argued that the demands of being a good friend can conflict with the demands of standard epistemic norms. Intuitively, good friends will tend to seek favorable interpretations of their friends’ behaviors, interpretations that they would not apply to strangers; as such they seem prone to form unjustified beliefs. I argue that there is no such clash of norms. In particular, I argue that friendship does not require us to form beliefs about our (...) friends in the biased fashion suggested by Stroud and Keller. I further argue that while some slight bias in belief-formation might be permitted by friendship, any such bias would fall within the bounds of epistemic propriety. (shrink)

We begin by considering two common ways of conceiving critical metaphysics. According to the first (and polemical) conception, critical metaphysics analyzes nothing more than the form of thought and thereby misses the proper point of metaphysics, namely to investigate the form of reality. According to the second (and affirmative) conception, critical metaphysics starts from the supposed insight that the form of reality cannot be other than the form of thought and is thus not required to analyze anything but that form. (...) We argue that the first conception is too weak while the second is too strong. Then we sketch an alternative conception of critical metaphysics, a conception we find expressed both in Kant’s B-Deduction and in the way Barry Stroud has recently investigated the possibility of metaphysics. According to such a conception, a properly critical metaphysics needs to proceed in two steps: first, it needs to analyze the most general and necessary form of any thought that is about an objective reality at all; second, it needs to investigate how that form of thought relates to the reality it purports to represent. But unlike Kant, Stroud remains sceptical regarding the possibility of a satisfying transition from thought to reality in metaphysics. We argue that this dissatisfaction can be traced back to a notion of objectivity and reality in terms of complete mind-independence. Then we sketch an alternative notion of objectivity and reality in terms of distinctness from subjects and acts of thinking, and argue that it is that notion that allows Kant, with his Transcendental Idealism, to make the transition required for any satisfying metaphysics, namely that from the form of thought to reality. This paper’s main thesis is that in virtue of being believable, a believable novel makes an indirect transcendental argument telling us something about the real world of human psychology, action, and society. Three related objections are addressed. First, the Stroud-type objection would be that from believability, the only conclusion that could be licensed concerns how we must think or conceive of the real world. Second, Currie holds that such notions are probably false: the empirical evidence “is all against this (...) idea…that readers’ emotional responses track the real causal relations between things.” Third, responding with a full range of emotions to a novel surely requires that it be believable. Yet since we know the novel is fiction, we do not believe it. So in what does its believability consist? (shrink)

How should we understand the relationship between the contents of our color, causal, modal, and evaluative beliefs, on the one hand, and color, causal, modal, and evaluative properties, on the other? According to Barry Stroud (2011), because of the nature of the contents of those types of beliefs, we should also think that what he calls a “negative metaphysical verdict” on the latter is not one that we could consistently maintain. The metaphysical project aims to arrive at an improved (...) conception of ourselves and our relation the world, no matter if that conception is positive or negative. But if Stroud is right that we cannot consistently arrive at the view that all of our causal, modal, and evaluative beliefs are systematically false, we will see that we cannot consistently reach the negative verdict. But failure to reach the negative verdict doesn’t mean that we have reached the positive verdict. Stroud calls this philosophical failure “metaphysical dissatisfaction”. In this paper, I argue that we can appropriate a metaepistemological response to the problem of the external world which shares its core features with Stroud’s (2000, 2011) arguments, but which nevertheless leaves us with a distinctive kind of epistemological dissatisfaction. This article aims to investigate the extent to which Abel’s insertion in the debate on scepticism and naturalism in the Anglophone philosophical tradition, especially in the historical Strawson-Stroud debate on the success of transcendental arguments in response to the sceptical challenge, allows the creation of a conceptual scheme which refuses both the conventionalist and the naturalist position in regard to our conceptual schemas, while at the same time seeking to differentiate itself from the apriorism of the Kantian tradition. Although (...) I acknowledge that interpretationism offers a new solution to the issues involved in this debate, I argue that this solution is unable to deliver everything it promises. This new conceptual space is not determined enough to pacify scepticism. I conclude by suggesting that the attempt to reconcile Nietzsche and Wittgenstein introduces instability in Abel’s interpretation. The reformist impulse of Nietzsche’s philosophy rests on the results of a preliminary naturalistic stage (genealogical inquiry) which neither Wittgenstein nor Abel seems willing to incorporate into their philosophies. Fumerton’s distinctive brand of metaepistemological scepticism is compared and contrasted with the related position outlined by Stroud. It is argued that there are at least three interesting points of contact between Fumerton and Stroud’s metaepistemology. The first point of contact is that both Fumerton and Stroud think that (1) externalist theories of justification permit a kind of non-inferential, perceptual justification for our beliefs about non-psychological reality, but it’s not sufficient for philosophical assurance. However, Fumerton claims, while (...) class='Hi'>Stroud denies, that (2) direct acquaintance with facts is sufficient for philosophical assurance. And this is important because Stroud thinks that (3) we have direct perceptual access or acquaintance with facts about the external world, while Fumerton denies this. (shrink)

Epistemological disjunctivism (ED) has been thought to solve the conditionality problem for epistemic externalism. This problem arises from externalists’ characterization of our epistemic standings as conditional on the obtaining of worldly facts which we lack any reflective access to. ED is meant to avoid the conditionality problem by explicating subjects’ perceptual knowledge in paradigmatic cases of perceptual knowledge via their possession of perceptual reasons that are both factive and reflectively accessible. I argue that ED’s account of reflectively accessible factive perceptual (...) reasons is also prey to the conditionality problem. After that, I submit that Stroud’s influential formulation of the conditionality problem relies on a methodological requirement that is potentially dissociable from ED. So, it is possible to put ED in the service of a more modest anti-skeptical strategy. I close by suggesting that this modest anti-skeptical strategy successfully undercuts the underdetermination-based skeptical paradox. Nevertheless, it does not have substantial advantages over some forms of epistemic externalism. (shrink)

Many authors have argued that epistemic rationality sometimes comes into conflict with our relationships. Although Sarah Stroud and Simon Keller argue that friendships sometimes require bad epistemic agency, their proposals do not go far enough. I argue here for a more radical claim—romantic love sometimes requires we form beliefs that are false. Lovers stand in a special position with one another; they owe things to one another that they do not owe to others. Such demands hold for beliefs as (...) well. Two facets of love ground what I call the false belief requirement , or the demand to form false beliefs when it is for the good of the beloved: the demand to love for the right reasons and the demand to refrain from doxastic wronging. Since truth is indispensable to epistemic rationality, the requirement to believe falsely, consequently, undermines truth norms. I demonstrate that, when the false belief requirement obtains, there is an irreconcilable conflict between love and truth norms of epistemic rationality: we must forsake one, at least at the time, for the other. W późniejszym okresie znaczący wpływ na Kaufmanna wywarł Charles S. Peirce, którego pracami posiłkował się opracowując problematykę analogii (wiążąc ją z opracowanym przez Pierca zagadnieniem abdukcji) oraz ontologii relacji. Niektóre wątki poglądów Kaufmanna nawiązują do egzystencjalizmu Karla Jaspersa oraz antropologii Karla Löwitha. Obecne są także inspiracje tomistyczne i arystotelesowskie. Jest (...) to filozofia prawa o charakterze maksymalistycznym. Kaufmann wpisuje się w sięgającą starożytności tradycję uprawiania filozofii, w której stawia się pytania o całość; filozofia pyta o to, co to jest "byt w ogóle", byt "w całości"; filozofia prawa stawia pytania o to, co to jest prawo "w całości", prawo "w ogóle" . Podejmuje wprost fundamentalne zagadnienia należące do zasadniczych dziedzin filozoficznych – epistemologiczne, ontologiczne, etyczne, nie stroniąc także od zagadnień z zakresu logiki. Uprawiana przez niego filozofia ma charakter systemowy, co sprawia, że jej zrozumienie zakłada ujęcie całości propozycji. Sam Kaufmann uważa, że systemy filozofii prawa należą już do historii, jednak ta uwaga jest o tyle jedynie trafna w odniesieniu do niego samego, że jego filozofia prawa – w zgodzie z jego deklaracjami – nie zmierza do „gotowych rozwiązań” konkretnych kwestii prawnych, ale zmierza do ukształtowania pewnego sposobu refleksji nad prawem. Jego koncepcja jest ważnym głosem w sporze klasycznego pozytywizmu z koncepcjami niepozytywistycznymi. Za prawo w pełnym tego słowa znaczeniu uznaje konkretne rozstrzygnięcie, co niewątpliwie łączy jego podejście z amerykańskim realizmem prawnym. Rekonstruowana przez Kaufmanna struktura procesu „urzeczywistniania” prawa, dokonywana w kontekście i na użytek kultury prawnej typu kodeksowego, kontynentalnego, uwyraźnia obecność elementów typowych dla kultury prawa precedensowego –wnioskowanie od przypadku do przypadku. Analizy prowadzą do wniosku, że propozycja Kaufmanna zawodzi, gdy przechodzi on do ontologicznych uogólnień, przede wszystkim przez brak uwzględnienia w swych podstawach takich punktów odniesienia, które są zewnętrzne wobec badanego procesu „urzeczywistniania” prawa. To, czym jest osoba, determinowane jest systemem prawnym i kulturą, w której prawo funkcjonuje. Przy takim ujęciu Kaufmann nie osiąga jednego z ważnych celów, do którego zmierzał, nie wskazuje kryteriów pozwalających stwierdzić, czy stopniowa – dokonywana zgodnie z odkrytymi przez hermeneutykę filozoficzną wymaganiami poprawnego rozumienia – zmiana normatywnego sensu systemu prawnego zmierza ku „ustawowemu bezprawiu”, czy też nie. In chapter 3 of Wittgenstein on Rules and Private Language, Kripke’s Wittgenstein offers a “sceptical solution" to the sceptical paradox about meaning developed in chapter 2 (according to which there are no facts in virtue of which ascriptions of meaning such as “Jones means addition by ‘+’” can be true). Although many commentators have taken the sceptical solution to be broadly analogous to non-factualist theories in other domains, such as non-cognitivism or expressivism in metaethics, the nature of the sceptical solution (...) has not been well-understood. The main aim of this paper is to advance our understanding of the nature of the non-factualism about meaning proposed in the sceptical solution. It attempts to outline some desiderata that should be respected by interpretations of the sceptical solution and considers two objections raised against it in Barry Stroud’s paper “Wittgenstein on Meaning, Understanding and Community". It attempts to correct misconstruals of the sceptical solution that have been promulgated by Davidson and some of his followers and suggests that the sceptical solution developed by Kripke’s Wittgenstein is best viewed as a form of quasi-realism about meaning. It ends by outlining what it takes to be the most pressing challenges facing the sceptical solution. (shrink)

A parcialidade epistêmica na amizade (PE) é a tese segundo a qual ser um bom amigo de alguém envolve tratar essa pessoa de forma diferente, em um sentido epistêmico. Sarah Stroud (2006) e Simon Keller (2004) defenderam essa tese e argumentaram que ela está em tensão direta com demandas de racionalidade epistêmica. A posição deles é que quando nossos amigos estão envolvidos em algum assunto ao qual temos que dar nossa avaliação (sobre os fatos, suas ações ou seu caráter), (...) tendemos a dar à questão um tratamento epistêmico diferencial, não reservado a não-amigos. Neste artigo, quero tratar de duas possíveis formas de responder à PE. Primeiro, quero discutir a rejeição de Sandy Goldberg (2018, 2020) a essa tese e à tensão que ela supostamente cria com as exigências da racionalidade epistêmica. Em sua proposta, Goldberg defende o comportamento epistêmico diferencial que a PE pressupõe, mas também argumenta que tal comportamento não configura um tipo de PE, e que tampouco está em tensão com as exigências da racionalidade epistêmica. Irei sugerir que a posição de Goldberg não capta uma distinção importante entre nossas atitudes epistêmicas diante do testemunho de um amigo e diante de relatos de terceiros sobre um amigo. Particularmente, o que eu argumentarei é que o caminho que leva da valorização da amizade às razões epistêmicas em apoio aos resultados doxásticos diferenciais quando nossos amigos estão envolvidos é, na melhor das hipóteses, frágil, já que envolve o que eu vejo como um movimento não autorizado de nosso desejo de preservar uma amizade para uma reação doxástica diferencial quando alguém testemunha negativamente sobre nossos amigos. Em segundo lugar, defenderei também que não devemos aceitar a prescrição da PE tão rapidamente. Argumentarei que, ao avaliar injustamente as credenciais epistêmicas de nossos amigos – algo que parece estar acontecendo em alguns casos de parcialidade epistêmica, podemos estar contribuindo para degradar as condições de trocas epistêmicas justas em uma comunidade. Se esse for o caso, teremos uma razão pragmática para rejeitar a PE. Na primeira seção do artigo, apresentarei a tese da parcialidade epistêmica na amizade, focalizando principalmente na forma como Stroud a articula. Depois disso, na seção II, tratarei da rejeição da PE por Goldberg e apresentarei uma crítica à sua posição. Na terceira e última seção, defenderei o que vejo como uma preocupação importante se aceitarmos a PE e oferecerei uma razão pragmática para questioná-la. (shrink)

Tato studie se zabývá dvěma spřízněnými jevy odehrávajícími se ve vědeckém prostředí. Jedná se o fenomén frustrace ve vědecké praxi a s ním spojenou touhu po rozpoznání vlastního výzkumu vědeckou komunitou a následně o otázku uznání od akademického společenství. Zmíněné fenomény jsou přitom úzce propojeny s ústředním tématem filosofie a sociologie vědy: kdo rozhoduje, co bude předmětem vědeckého bádání? Předkládaná studie nejprve představuje Mertonův mýtus o okamžitém rozpoznání vědeckého objevu a následně prostřednictvím exkurzu do oblasti ekonomie a na příkladech z (...) vědecké praxe poukazuje na jeho neplatnost. V závěru textu jsou společně s jejich dekonstrukcí navrhnuta možná řešení popsaných problémů. Text je také kritickým návratem ke dvěma studiím Josepha Agassiho, žáka Karla R. Poppera a tvrdošíjného zastánce kritického racionalismu, neboť právě Agassi ve svých dílech rozebírá dopady vědeckého vyloučení a neochoty naslouchat. (shrink)

The ancient theory of substance and accident is supposed to make sense of complex unities in a way that respects both their unity and their complexity. On Hume’s view such complex unities are only fictitiously unities. This result follows from his thoroughgoing critique of the theory of substance. I will characterize the theory Hume is critiquing as it is presented in Locke, presupposing what Bennett calls the “Leibnizian interpretation.” Locke uses the word ‘substance’ in two senses. Call substance in the (...) first sense “individual substance” and in the second sense “pure substance.” I will discuss the seven main parts of Hume’s view: (I) that we have no idea of pure substance, (II) that there is no complex individual substance, except in a loose sense, (III) that the fiction of complex individual substance arises in a way parallel to that of the fiction of identity through time, and (IV) results in the fiction of pure substance, (V) that simple qualities and perceptions satisfy the definition of individual substance, (VI) that there is no such thing as inherence, and (VII) that there is no such thing as pure substance. Hume’s views on substance are often mentioned without being discussed in detail. Kemp Smith, Stroud, and Garrett, for example, mostly summarize various claims of Hume in the course of expounding on his theory of the idea of personal identity. In contrast, I will attempt to present a systematic treatment of Hume on substance as a refutation of Locke. (shrink)

We revisit an important exchange on the problem of radical skepticism between Richard Rorty and Michael Williams. In his contribution to this exchange, Rorty defended the kind of transcendental approach to radical skepticism that is offered by Donald Davidson, in contrast to Williams’s Wittgenstein-inspired view. It is argued that the key to evaluating this debate is to understand the particular conception of the radical skeptical problem that is offered in influential work by Barry Stroud, a conception of the skeptical (...) problem which generates metaepistemological ramifications for anti-skeptical theories. In particular, we argue that, contra Williams, Rorty’s view that Davidson was offering a theoretical diagnosis of radical skepticism can be consistently maintained with his transcendental approach. In this issue of Studies in Transcendental Philosophy five scholars enquire about the theoretical aspects of Kant’s transcendental philosophy related to the notions of subject, self-consciousness, and self-knowledge. Andrew Brook examines Kant’s views on transcendental apperception at the end of the Critical Period, focusing on Opus Postumum which contains some of Kant’s most important reflections on the subjective dimension. As is known, the self-conscious act designated by the proposition ‘I think’ is an act of spontaneity, and this spontaneity is the (...) reason that the subject calls itself an intelligence. In his article Addison Ellis examines the theoretical and practical dimension of spontaneity, calling into question the distinction between a merely ‘relative’ spontaneity and one that is ‘absolute’. Luca Forgione points to two forms of self-consciousness introduced by Kant: inner sense, based on a sensory form of self-awareness, and transcendental apperception. Through the notion of inner sense, Kant also allows for an introspective account of self-awareness; nonetheless, Kant holds an utterly sophisticated notion of basic self-consciousness provided for by the notion of transcendental apperception. Roberto Horácio de Sá Pereira’s article presents a systematic and a historical approach, linking the contemporary debate on transcendental argument to Kant’s philosophy. It addresses both Stroud’s objection and Strawson’s perspective on transcendental argument and introduces a new reconstruction of Kant’s Refutation as successful truth-directed transcendental argument. In contrast to the contemporary movement of transhumanism and its claims that creatures like us can exist independently of our bodies, Robert Hanna develops a generalist perspective on the subjective dimension, according to which all rational human creature are synthetic a priori necessarily, essentially embodied Kantian selves. Jedynie widziadłem sprawiedliwości jest zatem to, że każdy ma się zajmować czymś jednym, że "człowiek, który jest szewcem z natury, najlepiej zrobi, jeżeli zostanie przy swoim kopycie i nic innego nie będzie próbował"; jedynie widziadłem jest także to, że jednostka jest dla państwa a nie państwo dla jednostki. Argumentuje się, że - zdaniem Platona - jeden i ten (...) sam człowiek sprawiedliwy, zatem człowiek doskonały, zajmuje się w swoim życiu nie tylko polityką (rządzeniem państwem, filozofią), ale i ćwiczeniem ciała, aby być zdolnym do walki, i zdobywaniem majątku. This paper explores a fundamental issue in epistemology, namely, that the world is completely different in general from the way our sensory impacts and our internal makeup lead us to believe (Stroud 1994). Three hypotheses are considered: first, that there is something like an independent external reality; second, that the epistemic relationship occurring between this reality and the knowing subject is somehow such as not to allow the latter to know the intrinsic nature of the former; and finally, that (...) the human knower has a spontaneous desire to know what the intrinsic nature of external reality is. This essay is an inquiry into John McDowell’s thinking on ‘subjectivity.’ The project consists in two parts. On the one hand, I will discuss how McDowell understands and responds to the various issues he is tackling; on the other, I will approach relevant issues concerning subjectivity by considering different aspects of it: a subject as a perceiver, knower, thinker, speaker, agent, person and (self-) conscious being in the world. The inquiry begins by identifying and resolving a tension generated by the (...) very idea of ‘rational animal’: human beings are at the same time natural and rational. Later the inquiry proceeds by considering how McDowell’s notion of ‘second nature’ enables us to be human subjects with many faces. By going through the diagnoses and responses of McDowell, two central problems in modern and contemporary philosophy – the narrow conception of nature and the Cartesian inner space model – are identified and repelled. In Episode N I first urge that we should leave room for a certain notion of ‘world.’ I further argue that mentality has many aspects, and to understand those aspects is to understand the many faces of human subject. In Episode Ⅰ the Aristotelian notion of ‘second nature’ is discussed in order to resolve the tension in the very idea of ‘rational animal.’ Later I reply to some worries about this maneuver, including the objection from Crispin Wright. Hans-Georg Gadamer’s distinction between world and environment is introduced and related to McDowell’s thinking. Episode Ⅱ discusses perception and knowledge; McDowell’s main target – the Cartesian inner space – is introduced and criticized. Barry Stroud’s and Simon Blackburn’s positions are evaluated. Later I connect the main theme of Mind and World to the present context; in particular, I discuss McDowell’s invocation of Donald Davidson and Immanuel Kant. And then I discuss a common accusation of idealism, and Robert Brandom’s accusation of ‘residual individualism.’ Episode Ⅲ concentrates on Saul Kripke’s Wittgenstein, arguing that the master thesis behind the rule-following paradox is a version of the inner space model, and that Kripke’s Wittgenstein is not Wittgenstein. Martin Kusch’s objections are answered; Michael Dummett’s demand of reductionism is rebutted. After this, I turn to Davidson’s ‘no language’ claim, and discuss to what extent McDowell agrees with him. In Episode Ⅳ I evaluate objections from Hubert Dreyfus concerning action and agency. I discuss how Dreyfus and Maurice Merleau-Ponty commit ‘the Myth of the Disembodied Intellect’ identified by McDowell. I answer Michael Ayer’s charge of intellectualism in passing. Later I bring in McDowell’s objections to Derek Parfit on personhood and to Davidson on the mind-body relation. In Episode Ⅴ I focus on consciousness and self-consciousness. McDowell applies his argument against Parfit to Kant, but Maximilian de Gaynesford dissents. I reply to his objections on McDowell’s behalf. I further connect this to McDowell’s attacks on the dualism of scheme and content. This leads to my McDowellian rejection to the existence of qualia, and further brings me to the debate between intentionalism and disjunctivism in the context of the argument from illusion. I argue against Tim Crane’s ways of conceiving issues about intentionalism and the argument from illusion. Varieties of disjunctivism are also discussed. In my Epilogue, I express my worry about McDowell’s notion of ‘self-determining subjectivity.’ According to McDowell, human freedom consists in causations in the space of reason, but as Richard Gaskin points out, a satisfying story of it is yet to be provided. I close this essay with some rough ideas about how to fill in the details of the McDowellian picture. (shrink)

I have developed transcendental arguments to refute several versions of Nick Bostrom’s simulation hypothesis. I called some of these arguments the SIM-style argument. In this paper, I have four main aims. First, I employ the SIM-style argument to remedy a defect in Hilary Putnam’s Brain-in-vat argument. Second, I show that the most radical skepticism, which Tim Button called the nightmarish Cartesian skepticism, can be refuted by the SIM-style argument or by another transcendental argument I develop here. Third, I compare my (...) approach to radical skepticisms with Donald Davidson’s, as it is often regarded as an exemplar of transcendental arguments. Fourth, I explain how the prominent objections, mainly developed by Barry Stroud, to transcendental arguments can incur two undesirable results: psychologism and Kantian skepticism. (shrink)

Intentaremos reconstruir la controversia acerca de la posibilidad de un lenguaje privado. Analizamos primero las posiciones “epistemológicas” (Malcolm y Fogelin), mostrando sus fallos. Luego analizamos la versión “semántica” (Kenny y Tugendhat) encontrándolas igualmente fallidas. La crítica de Barry Stroud a los argumentos trascendentales como argumentos antiescépticos nos permite discernir el presupuesto común que debilita las posiciones anteriores. Asimismo, la reconstrucción permite apreciar mejor la manera en la que la versión de Kripke evita comprometerse con este presupueto. Argumentamos que esta (...) versión es la única versión consistente del argumento. Esta afirmación obliga afrontar algunas de las objeciones corrientes dirigidas a la propuesta de Kripke: el problema de la objetividad de la regla, ¿puede un individuo estar acertado en contra de la opinión comunitaria consensuada?; y el problema de las relaciones internas entre reglas y casos, presuntamente violentada por el rol que la noción de acuerdo comunitario desempeña en la misma. Sostenemos que nuestra reconstrucción de la controversia permite encontrar razones para mostrar por qué las objeciones mencionadas no se le aplican. -/- This paper tries to reconstruct the controversy on the possibility of private language. First, we analyse “epistemological” trends in the argument (Malcolm, Fogelin) showing their failures. Then, we analyse “semantic” versions (Kenny, Tugendhat) finding they are also failed. Barry Stroud’s criticism of transcendental arguments as refutations of scepticism allows us to discern the common presupposition that weakens the versions of the argument considered. Moreover, this reconstruction allows us to see how Kripke’s deals with the problem of the previous discussion in order to avoid committing himself with this presupposition. We consider Kripke’s version to be the only consistent version of the argument. Such a statement obliges us to consider two of the most important criticisms directed against Kripke’s Wittgenstein: The problem of objectivity of the rule: Can a single individual be right in contradicting communal assent?; and the problem of internal relationships between rules and their applications, allegedly violated because of the role played by communal agreement. We claim that our reconstruction of the controversy provides good reasons to show that the above-mentioned objections don’t apply to Kripke’s Wittgenstein version. (shrink)

David Hume fancied himself the Newton of the mind, aiming to reinvent the study of human mental life in the same way that Newton had revolutionized physics. And it was his view that the novel account of belief he proposed in his Treatise of Human Nature was one of that work’s central philosophical contributions. From the earliest responses to the Treatise forward, however, there was deep pessimism about the prospects for his account. It is easy to understand the source of (...) this pessimism: The constraints he employed in theorizing stem from his Newtonian ambitions. Constraints such as his copy principle and his decision to rely only on variations in “force and vivacity” for differentiating types of mental states severely limit his available explanatory resources. However, it is one thing to regard an account as untenable, and quite another to understand where it fails. In this paper, I focus on one long-standing objection to Hume’s account — the objection that Hume cannot offer an account of negative belief or denial — as presented by Hume’s contemporary Thomas Reid, as well as more recently by Barry Stroud, and defend Hume from this objection. I argue that Hume both should and does endorse an account of negative belief based in relations of contrariety between contents, rather than between mental activities, and survey the different options available to Hume for spelling out an account of contrary contents. Today we find philosophical naturalists and Christian theists both expressing an interest in virtue epistemology, while starting out from vastly different assumptions. What can be done to increase fruitful dialogue among these divergent groups of virtue-theoretic thinkers? The primary aim of this paper is to uncover more substantial common ground for dialogue by wielding a double-edged critique of certain assumptions shared by `scientific' and `theistic' externalisms, assumptions that undermine proper attention to epistemic agency and responsibility. I employ a responsibilist virtue (...) epistemology to this end, utilizing it most extensively in critique of Alvin Plantinga’s Warranted Christian Belief (2000). Epistemological externalism presages, I also argue, a new demarcation problem, but a secondary aim of the paper is to suggest reasons to think that `responsibilist externalism,' especially as glossed in virtue-theoretic terms, provides its proponents with the ability to adequately address this problem as we find it represented in a potent thought-experiment developed by Barry Stroud. Wydane w latach 1782-1786 Niemieckie baśnie ludowe Johanna Karla Augusta Musausa, znanego oświeceniowej publiczności autora poczytnych Podróży fizjognomicznych, przyjęto początkowo entuzjastycznie, uznając je za wyjątkowo udaną formę literaryzacji elementów baśniowej tradycji ustnej i pisanej oraz podkreślając walory "dowcipnej" narracji. W wieku XVIII pojęcie "baśni" (Miirchen) miało szerokie znaczenie. Słowniki i leksykony wskazują na to, iż pojęcia: "bajka" (Fabel), "baśń" (Mcirchen), "podanie" (Sage) i "legenda"(Legende) mogły być używane zamiennie. Musaus definiuje we wstępie do swego zbioru zatytułowanym Słowo wstępne do pana (...) Dawida Runkela, będącym humorystyczną autoprezentacją pisarza i jego baśni, pojęcie "baśni" jako "poetę cudowną" (wunderbare Dichtung), przemawiającą w sposób szczególny do wyobraźni czytelnika. Taka definicja baśni pozwoliła zebrać Musausowi w swym zbiorze teksty, które według dzisiejszych kryteriów określono by w większości jako podania. Ukazanie się w roku 1812 pierwszego tomu Baśni dziecięcych i domowych braci Jakuba i Wilhelma Grimmów było wydarzeniem epokowym w historii baśni. Baśnie braci Grimmów na długo stały się normą o uniwersalnym znaczeniu, według której oceniano baśniowość tego typu utworów. Podług romantycznej miary Grimmów oceniano również oświeceniowe baśnie Musausa, a ocena ta najczęściej nie wypadała pozytywnie. Artykuł przedstawia recepcję Niemieckich baśni ludowych Musausa u braci Grimmów, Ludwika Tiecka, Achima von Arnima i u nawiązującego bezpośrednio do romantycznych koncepcji Grimmów Ludwika Bechsteina, uwypuklając na ich przykładzie różnicę w ujęciu fenomenu baśniowości w oświeceniu i romantyzmie. Niniejszy artykuł poświęcony jest porównaniu teorii Karla Bühlera i Johna Searle’a w aspekcie pragmalingwistycznym, a konkretnie – w aspekcie działania językowego. Bühler traktuje język jako „organon” (narzędzie), który wykorzystywany jest do uzyskania określonych celów w procesie komunikacji. Jego nauka jest często uważana za fundament zapoczątkowanej przez Johna Austina i rozwiniętej przez Searle’a teorii aktów mowy, ponieważ zgodnie z koncepcją Searle’a formułowanie wypowiedzi językowej jest rodzajem intencjonalnego działania, a więc aktem podporządkowanym uzyskaniu określonego efektu w rzeczywistości pozajęzykowej. W pierwszej części (...) artykułu autor podejmuje próbę nakreślenia różnic i podobieństw pomiędzy stosowanymi przez Bühlera pojęciami Sprechakt i Sprechhandlung a kategorią speech act, zajmującą główne miejsce w modelu Searle’owskim. Drugim polem porównawczym są funkcje języka. Model znaku językowego, zaproponowany przez Bühlera, determinuje istnienie triady: Darstellungsfunktion, Appellfunktion i Ausdrucksfunktion. Funkcje komunikacyjne u Searle’a to funkcje illokucyjne, reprezentowane przez pięć różnych typów aktów mowy, wydzielonych przede wszystkim na podstawie tzw. illocutionary point. Konfrontując obydwa modele, autor wskazuje na heterogenność klasyfikacji funkcji Bühlerowskich i jednorodność taksonomii aktów illokucyjnych Searle’a. (shrink)

Hume argues that whenever we seem to be motivated by reason, there are unnoticed calm passions that play this role instead, a move is that is often criticised as ad hoc (e.g. Stroud 1977 and Cohon 2008). In response, some commentators propose a conceptual rather than empirical reading of Hume’s conativist thesis, either as a departure from Hume (Stroud 1977), or as an interpretation or rational reconstruction (Bricke 1996). -/- I argue that conceptual accounts face a dilemma: either (...) they render the conativist thesis trivial, or they violate Hume's thesis that 'a priori, any thing may produce any thing'. I defend an empirical construal of Hume’s conativist thesis. I provide two theoretical frameworks within which Hume’s appeal to the calm passions may be justified: first, by the framework of theoretical virtues, and secondly, by lights of his own ‘rules by which to judge of causes and effects’ (THN 1.3.15).
