This paper is an essay in counterfactual epistemology. What if experience have high-level contents, to the effect that something is a lemon or that someone is sad? I survey the consequences for epistemology of such a scenario, and conclude that many of the striking consequences could be reached even if our experiences don't have high-level contents.

If our experiences are cognitively penetrable, they can be influenced by our antecedent expectations, beliefs, or other cognitive states. Theorists such as Churchland, Fodor, Macpherson, and Siegel have debated whether and how our cognitive states might influence our perceptual experiences, as well as how any such influences might affect the ability of our experiences to justify our beliefs about the external world. This article surveys views about the nature of cognitive penetration, the epistemological consequences of denying cognitive penetration, and the (...) epistemological consequences of affirming cognitive penetration. According to Fumerton in his "How Does Perception Justify Belief?", it is misleading or wrong to say that perception is a source of justification for beliefs about the external world. Moreover, reliability does not have an essential role to play here either. I agree, and I explain why in section 1, using novel considerations about evil demon scenarios in which we are radically deceived. According to Fumerton, when it comes to how sensations or experiences supply justification, they do not do (...) so on their own, and instead only do so only in conjunction with support for background beliefs about how the sensations or experiences are best explained. Here I disagree. In section 2, I first clarify the question of whether sensations or experiences provide justification on their own. I then respond to Fumerton’s arguments that use considerations about concept-possession and about how to close possible gaps between experience and truth. In section 3, I develop my main concern about his positive view, where that concern also brings out some of the merits of the view that experiences do justify beliefs about the external world on their own. My focus will be on two questions about Moore’s justification to believe the premises and the conclusion of the argument above. At stake is what makes it possible for our experiences to justify our beliefs, and what makes it possible for us to be justified in disbelieving skeptical..

Suppose our visual experiences immediately justify some of our beliefs about the external world — that is, justify them in a way that does not rely on our having independent reason to hold any background belief. A key question now arises: Which of our beliefs about the external world can be immediately justified by experiences? I address this question in epistemology by doing some philosophy of mind. In particular, I evaluate the following proposal: if your experience e immediately justifies you (...) in believing that p , then (i) e has the content that p , and (ii) e ’s having the content that p is fixed by what it is like to have e . I start by clarifying this proposal and surveying the case in its favour. I then argue against the proposal and develop an alternative. The discussion shows what role visual consciousness plays and does not play in the justification of perceptual beliefs. (shrink)

I set out the standard view about alleged examples of failure of transmission of warrant, respond to two cases for the view, and argue that the view is false. The first argument for the view neglects the distinction between believing a proposition on the basis of a justification and merely having a justification to believe a proposition. The second argument for the view neglects the position that one's justification for believing a conclusion can be one's premise for the conclusion, rather (...) than simply one's justification for the premise. Finally, the view is false since it is inconsistent with the closure of knowledge as closure is properly understood. (shrink)

Animal ethics has often been criticized for an overreliance on “ideal” or even “utopian” theorizing. In this article, I recognize this problem, but argue that the “nonideal theory” which critics have offered in response is still insufficient to make animal ethics action-guiding. I argue that in order for animal ethics to be action-guiding, it must consider agent-centered theories of change detailing how an ideally just human-animal coexistence can and should be brought about. I lay out desiderata that such a theory (...) of change should suffice so as to be helpful in guiding action. Specifically, a theory of change should determine (1) who needs to do what in order for ideal justice to be achieved in the long run, (2) who should be expected to refuse compliance and how they should be moved to comply, and (3) why specific intermediate steps are necessary. I show how previous “nonideal” contributions, though helpful in other ways, are insufficiently determinate on these points and I sketch a (still somewhat utopian) theory of change for one specific context. This brings animal ethics a crucial step closer to being action-guiding in the real world. (shrink)

An overview of the epistemology of perception, covering the nature of justification, immediate justification, the relationship between the metaphysics of perceptual experience and its rational role, the rational role of attention, and cognitive penetrability. The published version will contain a smaller bibliography, due to space constraints in the volume.

We discuss the rational role of highly inattentive experiences, and argue that they can provide rational support for beliefs.

This paper examines how new evil demon problems could arise for our access to the internal world of our own minds. I start by arguing that the internalist/externalist debate in epistemology has been widely misconstrued---we need to reconfigure the debate in order to see how it can arise about our access to the internal world. I then argue for the coherence of scenarios of radical deception about our own minds, and I use them to defend a properly formulated internalist view (...) about our access to our minds. The overarching lesson is that general epistemology and the specialized epistemology of introspection need to talk---each has much to learn from each other. (shrink)

This open access book revises Kant’s ethical thought in one of its most notorious respects: its exclusion of animals from moral consideration. The book gives readers in animal ethics an accessible introduction to Kant’s views on our duties to others, and his view that we have only ‘indirect’ duties regarding animals. It then investigates how one would have to depart from Kant in order to recognise that animals matter morally for their own sake. Particular attention is paid to Kant’s ‘Formula (...) of Humanity,' the role of autonomy and the moral law, as well as Kant’s notions of practical reason and animal instinct. The result is a deliberately amended version of Kantianism which nevertheless remains faithful to central aspects of Kant’s thought. The book’s final part illustrates the framework’s use in applied contexts, addressing the issues of using animals as mere means, the ethics of veganism and vegetarianism, and environmental protection. Nico Dario Müller shows how, when furnished with duties to animals, Kant's moral philosophy can be a powerful resource for animal ethicists. (shrink)

This paper evaluates the prospects of harnessing “anti-individualism” about the contents of perceptual states to give an account of the epistemology of perception, making special reference to Tyler Burge’s ( 2003 ) paper, “Perceptual Entitlement”. I start by clarifying what kind of warrant is provided by perceptual experience, and I go on to survey different ways one might explain the warrant provided by perceptual experience in terms of anti-individualist views about the individuation of perceptual states. In this paper I develop the idea that, by answering the question whether p, you can answer the question whether you believe that p. In particular, I argue that judging that p is a fallible yet basic guide to whether one believes that p. I go on to defend my view from an important skeptical challenge, according to which my view would make it too easy to reject skeptical hypotheses about our access to our minds. I close by responding to (...) the opposing view on which our beliefs themselves constitute our only source of first-person access to our beliefs. (shrink)

The article aims at contrasting the autopoietic understanding of an individual and her or his actions as described by Niklas Luhmann with Paul Ricoeur’s notion of narrative identity, focusing on people as legal subjects. The article assumes that when legal subjects necessitate ethical engagement and evaluation, the law could cease to deal with problems in a mere legalistic fashion but is allowed the freedom to appeal to norms of justice external to itself as in other natural law theories. Through narrative (...) identity the deeds of role players are to be understood in greater complexity than what a self-referential legal system is comfortable in dealing with. (shrink)

Building on her previous work (2004, 2012, 2013), Christine Korsgaard’s recent book Fellow Creatures (2018) has provided the most highly developed Kantian account of duties towards animals. I raise two issues with the results of this account. First, the duties that Korsgaard accounts for are duties “towards” animals in name only. Since Korsgaard does not reject the Kantian conception in which direct duties towards others require mutual moral constraint, what she calls duties “towards” animals are merely Kantian duties regarding animals, (...) verbally repackaged. Hence, Korsgaard’s account is best understood as an expansion (albeit a substantial one) of Kant’s own view of an indirect duty regarding animals. Second, the expansion does not take us quite as far as Korsgaard hopes. She aims for a conception in which our duties towards animals and humans are equally important, but her argument does not support this conclusion. I point out the potential for a more radical revision of Kant’s anthropocentrism that rejects his underlying assumption that duties towards others are based on mutual constraint. (shrink)

In part one, I clarify the crucial notion of “introspection”, and give novel cases for the coherence of scenarios of local and global deception about how we access our own minds, drawing on empirical work. In part two, I evaluate a series of skeptical arguments based on such scenarios of error, and in each case explain why the skeptical argument fails. The first main upshot is that we should not over-estimate what it takes to introspect: introspection need not be accurate, (...) or non-inferential, or exclusive of perception, or even exclusive of confabulation. The second main upshot is that, while skeptical challenges by figures such as Carruthers, Doris, and Schwitzgebel are rich and empirically informed, these skeptical challenges founder on how they are epistemologically under-informed. Psychologists and neuroscientists have delivered a lot of bad news about the inner workings of our minds, raising challenging questions about the extent to which we are rational in important domains of our judgments. I will focus on a central case of an unsettling effect on our perception, and primarily aim to establish that there actually is no impact from it on the rationality of our perceptual beliefs. To reach my goal, I will start with a rough review of different (...) ways bad news about our minds might negatively affect our rationality. I’ll then propose a test for when negative consequences would follow from the truth of some bad news about our minds, and I will argue that the test is not passed in a paradigmatic case of influence of bias on perception. I will then close by looking at potential wider implications of the psychological bad news for debates about internalism vs. externalism in epistemology. (shrink)

The following article was written to honour Johan Buitendag’s contribution to the discipline of eco-theology. Assuming an interdisciplinary stance, eco-theology in general and his work, in particular, is observed from the position of legal theory and sociology. As such, eco-theology is not assessed on theological grounds but is treated interdisciplinary through comparison with environmental law. More specifically, the project of eco-theology is shown to share certain characteristics with the nascent subdiscipline of Earth systems law within environmental law. It is argued (...) that one of the most important of these is the use of norms as an ecological strategy. This is understandable as both the religious and legal systems rely on the norm form to a lesser or greater extent. However, in the legal sociology of systems theory, the shortcomings of norms have been eloquently argued. This article thus posits the limits of norms to eco-theology and Earth systems law as a challenge deserving attention. However, social systems theory has its shortcomings, and a preliminary line of flight away from this challenge is suggested in the shape of Agamben’s description of the monastic form-of-life, where life and norm overlap so intensely that suggestions of a new worldview gain plausibility. The theoretical underpinnings of public international law have taken the sovereign status of the nation-state for granted since the beginning of the modern era. After centuries of evolution in legal and political thought, the state's definition as a bounded territorial unit has been strictly codified. The legal development of the nation-state was an ideological project informed by extra-legal considerations. Additionally, the ever-narrowing scope of the juridical idea of sovereignty functioned as a boundary mechanism instrumental in colonising Africa and other regions. (...) While international law claims universal liberalism today, the current system based on sovereign nation-states represents not social inclusion but fierce and dangerous exclusion. -/- The central thesis of this book is that the development of legal sovereignty was, rather than part of the modernist progress narrative, a historically contingent evolutionary regression. While other social systems such as economics and science became globalised, politics and law counterintuitively became more territorialised. It is argued that the nation-state today is not only anachronistic but is dangerously ill-equipped for facing international problems such as the climate crisis or global pandemics. Finally, it also leaves African states and many other formerly-colonised territories at a particular disadvantage by regulating their political practices into a predefined mould. (shrink)

We offer a framework for assessing what the structure of episodic memory might be, if one accepts the Buddhist denial of persisting selves. This paper is a response to Jonardon Ganeri's paper "Mental time travel and attention", which explores Buddhaghosa's ideas about memory. (It will eventually be published with a reply by Ganeri).

Criticism of big data has focused on showing that more is not necessarily better, in the sense that data may lose their value when taken out of context and aggregated together. The next step is to incorporate an awareness of pitfalls for aggregation into the design of data infrastructure and institutions. A common strategy minimizes aggregation errors by increasing the precision of our conventions for identifying and classifying data. As a counterpoint, we argue that there are pragmatic trade-offs between precision (...) and ambiguity that are key to designing effective solutions for generating big data about biodiversity. We focus on the importance of theory-dependence as a source of ambiguity in taxonomic nomenclature and hence a persistent challenge for implementing a single, long-term solution to storing and accessing meaningful sets of biological specimens. We argue that ambiguity does have a positive role to play in scientific progress as a tool for efficiently symbolizing multiple aspects of taxa and mediating between conflicting hypotheses about their nature. Pursuing a deeper understanding of the trade-offs and synthesis of precision and ambiguity as virtues of scientific language and communication systems then offers a productive next step for realizing sound, big biodiversity data services. According to Jim Pryor’s dogmatism, when you have an experience with content p, you often have prima facie justification for believing p that doesn’t rest on your independent justification for believing any proposition. Although dogmatism has an intuitive appeal and seems to have an antisceptical bite, it has been targeted by various objections. This paper principally aims to answer the objections by Roger White according to which dogmatism is inconsistent with the Bayesian account of how evidence affects our rational credences. (...) If this were true, the rational acceptability of dogmatism would be seriously questionable. I respond that these objections don’t get off the ground because they assume that our experiences and our introspective beliefs that we have experiences have the same evidential force, whereas the dogmatist is uncommitted to this assumption. I also consider the question whether dogmatism has an antisceptical bite. I suggest that the answer turns on whether or not the Bayesian can determine the priors of hypotheses and conjectures on the grounds of their extra-empirical virtues. If the Bayesian can do so, the thesis that dogmatism has an antisceptical bite is probably false. (shrink)

O objetivo dessa dissertação é discutir alguns conceitos que dizem respeito ao estatuto da eudaimonía, tendo como pressuposto que o texto da Ética a Nicômaco possa por si só esclarecer como ela é entendida por Aristóteles. Na minha hipótese, as discussões metodológicas estabelecidas no livro I servem como orientações suficientes para esclarecer a relação entre a realização da eudaimonía e o exercício das virtudes da alma, sem com isso haver a necessidade de que recorramos a outras obras de Aristóteles. Em (...) conseqüência dessa orientação, priorizei nessa pesquisa entender a afirmativa de Aristóteles de que a eudaimonía é um bem realizável pela ação do homem virtuoso, sendo um bem de caráter prático que consisti no exercício de um érgon, que é exclusivo ao homem; privilegiei então os conceitos relacionados à vida prática para o esclarecimento do que seja a eudaimonía, a relação entre as arētaí ēthikaí, a phrónesis e a sophía na sua realização, objetivando também, através dessa relação, entender as conexões entre lógos, práxis e páthos na realização do bem supremo do homem. Meu objetivo é pensar as relações entre a eudaimonía e as virtudes morais e intelectuais na Ética a Nicômaco; em conseqüência, compreender o lugar da vida prática e da vida teórica na realização da vida plena. In The Innocent Eye, Nico Orlandi argues that vision is not a cognitive process. In particular, she argues that forming subject-level visual representations that are available for reasoning should not itself be understood as a process of inference. This comes to the claim that vision (properly so-called) is a process that produces representations but is not best understood as a process that uses representations.

At the time of the disintegration of “actually existing socialism” in the 1990s, it appeared that the inexorable flux of globalization was going to consume the nation-state. However, recent years have witnessed the increasing role of the states in both the Global North and South. The relationship between the state and capital is a frequently traversed subject, but what needs further illumination is the persistence of “many states” and its relation to capitalism as both a national and global formation. While (...) globalization of capital suggests a movement from multiplicity toward a dehistoricized abstraction, a global state has never been actualized. This implies that, unlike capital, the state cannot be dehistoricized or dedifferentiated; therefore, the only way to think about the state is to observe concrete, multiple states. In view of this difference and drawing on Nicos Poulantzas’s and Kōjin Karatani’s inquiries into the states system, this article examines the multi-state system as an internal and external limit to Marxist thought. In this paper, I focus on the Armchair Access Problem for E=K as presented by Nicholas Silins (2005), and I argue, contra Silins, that it does not represent a real threat to E=K. More precisely, I put forward two lines of response, both of which put pressure on the main assumption of the argument, namely, the Armchair Access thesis. The first line of response focuses on its scope, while the second line of response focuses on its nature. The (...) second line of response is the most interesting one, for it represents the framework within which I develop a novel account of second-order knowledge, one that involves evaluation of counterfactual conditionals and the employment of our imaginative capacities, i.e., an imagination-based account of second-order knowledge. The two lines of response are shown to be jointly compatible and mutually supportive. I then conclude that the Armchair Access Problem is not a challenge for E=K, yet it relies on the ambiguity of the notion of armchair knowledge underpinning the Armchair Access thesis. (shrink)

This paper reassesses the case against Evidential Externalism, the thesis that one's evidence fails to supervene on one's non-factive mental states, focusing on two objections to Externalism due by Nicholas Silins: the armchair access argument and the supervenience argument. It also examines Silins's attempt to undermine the force of one major source of motivation for Externalism, namely that the rival Internalist picture of evidence is implicated in some central arguments for scepticism. While Silins concludes that the case (...) against Evidential Externalism is surprisingly strong, reassessing the arguments supports the opposite conclusion; the objections to Externalism are weak, and for all Silins has shown it may well have unmatched advantages when it comes to resisting scepticism. This essay defends the claim that endogenous attention is necessary for the justification of perceptual beliefs. I criticize the so-called phenomenal approach, according to which perceptual experiences provide justification in virtue of being phenomenally conscious. I specifically target Siegel and Silins’ (2014 ; 2019) version of the phenomenal approach. As against their view, I claim that perceptual justification cannot be understood without reference to the cognitive mechanisms which underlie the mobilization of reasons in support of propositional attitudes – attention (...) being instrumental to those very mechanisms. Relying on the distinction between propositional and doxastic justification, I first criticize the alleged cases of justification in the absence of attention before elaborating a two-stage argument in favor of the necessity of attention for perceptual justification. In the first stage, I contend that the functional role of endogenous attention makes it a necessary condition for doxastic justification. In the second stage, by relying on Turri’s (2010) analysis, I establish that propositional justification itself necessitates attention. (shrink)

Relying on aesthetic testimony seems problematic. For instance, it seems problematic for me to simply believe or assert that The Velvet Underground's debut album The Velvet Underground and Nico (1964) is amazing solely because you have told me so, even though I know you to be an honest and competent music critic. But why? After all, there do not seem to be similar reservations regarding testimony from many other domains. In this paper, I will argue that relying on aesthetic (...) testimony seems problematic because we are attached to an ideal of aesthetic authenticity and feel that living up to this ideal is anathema to simply relying on aesthetic testimony. The term 'fascism' continues to be very much in currency in Philippines society. To the Filipino people, its meaning is often drawn from pained memory of wholesale deprivation of democratic rights and large-scale human rights abuses. Yet, to many, the fear of fascism has still to give way to a deeper understanding of this menace. This may hold true even among those belonging to the progressive movement. One Marxist philosopher and theoretician who gave extended treatment of the issues surrounding the (...) character and conditions giving rise to fascism was Nicos Poulantzas, whose theory is employed here to interrogate the debates about fascism in the post-Marcos Philippines context. Examina-se o conhecimento científico e a aquisição dos primeiros princípios em Aristóteles partindo da dificuldade suscitada pelo argumento pla- tônico, apresentado em Mênon (80e). Parece que, em Aristóteles, o problema não é que não se possa conhecer, como sugere a dificuldade apresentada em Mênon. Através das sensações obtidas dos particulares e que se tornam expe- riência, engendram-se a arte e a ciência. O conhecimento prévio é suficiente para que se possa prosseguir na investigação e chegar a um conhecimento de um (...) nível maior de abstração. (shrink)
