El presente estudio ofrece una interpretación de naturaleza ontológica a uno de los fenómenos más divulgados recientemente por los medios informativos de comunicación: la displicencia de los sujetos al seguimiento de normas sociales. El trabajo se centra, especialmente, en los casos en los que se asume que la indiferencia a las normas tiene como causa la condición del privilegiado social. Argumenta que la inobservancia a las normas, más que ser un asunto de desigualdad social, es la sintomatología de importantes hendiduras (...) en la ontología de la realidad social. Así, tres partes conforman este trabajo. En la primera se describen algunos casos que, desde los medios de comunicación, se presentan como representativos en la inobservancia a las normas sociales, especialmente, aquellos que son interpretados como un asunto de abuso de privilegio social. En la segunda parte, a partir de algunos trabajos de John Austin, Ulises Moulines y Gottlob Frege, se presenta una concepción de normas sociales, y su valor para la construcción de la ontología social. En la tercera parte, desde la propuesta del filósofo John Searle, se describen algunos rasgos esenciales de la ontología de la realidad social. Se concluye que el no seguimiento de las normas sociales socava los modos de existencia de la realidad social, y que los casos interpretados por los medios de comunicación como asunto de desigualdad social, requieren una interpretación que tenga en cuenta la estructura de la realidad social. La investigación buscó la relación entre la variable visitante de una institución museística, y otras variables explicativas, como son la valoración del acervo, costos operativos, apertura horaria, entre otras, logrando probar que la variable relacionada a la captación de visitantes, para la muestra analizada, es la variable Difusión. -/- Se trata de un estudio correlacional, dado que el mismo tiene como propósito medir el grado de relación que existe entre dos o más conceptos o variables y el diseño de la (...) investigación es no experimental, ya que no existe manipulación activa de alguna variable. Además, se trata de un diseño transeccional transversal, ya que se busca establecer la relación de variables medidas en un único momento del tiempo. En una primera etapa se trabajó con los datos recabados en el marco del Primer Censo Nacional de Museos del MEC. En una segunda etapa, se procedió a realizar una encuesta a todos los museos que formaron parte del Censo. La variable clave que se consideró fue la variable difusión. (shrink)

In this text, I consider two examples in the history of emancipation and manumission of enslaved, Black populations in the Caribbean and South America in order to theorize a colonial mode of conceiving of freedom at play in the first half of the nineteenth century. This mode is marked by the figure of the promise, enacting a notion of freedom as a constantly deferred, external compensation. Indeed, instead of an immediate decision deeming the practice of enslavement and trade of human (...) beings unacceptable, and an effective liberation of the enslaved Black populations in these different emancipation proclamations, the various histories of manumission in Latin America and the Caribbean show a long series of political and legal attempts to reduce and limit the extent of the slave trade that deferred the process of liberation for decades. Moreover, in many of these territories the practice did not end with the official proclamation of emancipation but was continued by illegal practices and mutations into legal forms of exploitation and oppression that are still operative today. After outlining this first trajectory, reconstructing the promise of manumission in the historical examples of Martinique (as read by Édouard Glissant) and La Gran Colombia and the Republic of Nueva Granada (contemporary Panamá, Colombia, Venezuela, and Ecuador), I analyze a second mode of investigation in examples of individual and collective strategies of liberation coming from the enslaved themselves, as reconstructed by contemporary feminist scholars in South America. These strategies appropriate liberation not as a promise, but as a negotiation and calculation that begins with the enslaved’s resistance to their oppressive conditions and that ultimately depends on the external concession by juridical authorities. In the third section of the chapter, I read these practices not as marronage, as they are sometimes approached, but as a different mode of turning back to these glimpses of freedom that more effectively challenge the narrative of emancipation and, with it, the promise of manumission in our present. -/- . Los estudiantes de la Facultad de Ciencias Económicas y de Administración de la Universidad de la República deben realizar, como trabajo final de carrera, una investigación o ensayo monográfico en un área de su interés, tutorados por un docente universitario o un investigador de reconocida trayectoria. Un gran número de estos trabajos monográficos han hecho un aporte valioso al conocimiento pero, lamentablemente, la poca difusión de éstos hace que ese conocimiento termine olvidado en los fondos de la biblioteca de la (...) Facultad, entre cientos de producciones monográficas. Se pretende en este libro, mostrar los aportes que se han generado en el área tanto de Economía de la Cultura como de Gestión de Organizaciones Culturales. Varias de las monografías fueron realizadas en la línea de investigación Costos y Gestión de Organizaciones Culturales, la cual coordino. Otros fueron realizados con antelación, como los trabajos tutorados por el referente de la Economía de la Cultura en Uruguay, el hoy fallecido Luis Stolovich. También se incluyen dos trabajos monográficos tutorados por el Dr Gustavo Buquet, quien siempre está presente a la hora de crear investigación de calidad en Economía de la Cultura. Como cada trabajo supera el centenar de páginas, no es posible publicarlos completamente, por lo que para este libro se hicieron resúmenes de esos trabajos, intentando adecuar la terminología y quitándoles el formato estrictamente científico –poco amigable para un no especialista-, de forma tal que su lectura sea accesible al público en general. Se resumieron ocho, clasificados en tres capítulos: Patrimonio, Artes Escénicas e Industria Cultural. El capítulo de Patrimonio comienza con un trabajo realizado por las Economistas Fernanda Arezo y Verónica Pereyra, titulado “Museos y Ciudadanos, el comportamiento del consumidor”, tutorado por Raúl Ramírez y por mí. Este estudio tuvo como centro explicar la modalidad de conducta de consumo del visitante montevideano hacia tres importantes instituciones museísticas como lo son el Museo del Cabildo, el Museo del Carnaval y el Museo de Historia del Arte. El objetivo del trabajo es estimar la demanda y obtener un indicador de la propensión a pagar por el consumo de dichos museos. El segundo trabajo, titulado “Disposición a pagar por la restauración de la Puerta de la Ciudadela”, fue realizado por las Contadoras Beatriz Torres, María Elena Olarán y María Carolina Duarte, y tutorado en forma conjunta por el Phd. Juan José Goyeneche y quien les escribe. En este trabajo se realiza una valoración contingente para medir la disposición a pagar por la restauración de la “Puerta de la Ciudadela”, un monumento fundamental de identidad montevideana. El capítulo de Patrimonio finaliza con un trabajo realizado por las Economistas Malena Rodríguez y María de la Paz Besada y tutorado por el Ec. Luis Stolovich. El mismo se denomina “El arte uruguayo: un estudio sobre el mercado y la pintura como alternativa de inversión” y explora el mercado de arte uruguayo, analizando la rentabilidad de la inversión en pintura uruguaya. Tratan la rentabilidad de la inversión para tres casos específicos: las obras vendidas por el Banco Comercial en su proceso de recuperación de activos, un portafolio de obras de Pedro Figari y otro de Joaquín Torres García. En cuanto al segundo capítulo, Artes Escénicas, comienza con un trabajo realizado para la obtención del título de Contador Público realizado por Pamela Cambeiro, Martín Cami e Ignacio Mouradián. Se denomina “La gestión de teatros. Caso de estudio: Aplicación del Cuadro de Mando Integral al Teatro Solís” y trata sobre la identificación de indicadores que faciliten las tareas de gestión para la dirección del Teatro. Luego se presenta un trabajo realizado por las Economistas Tania Cruz y Natalia Nollenberger titulado “Análisis económico del teatro independiente en Montevideo: una aproximación al problema de la fatalidad de los costos”. Este trabajo, también tutorado por el Ec. Luis Stolovich, muestra un exhaustivo análisis del teatro independiente montevideano identificando los problemas económicos que afectan al sector. El capítulo de Industria Cultural incluye tres trabajos. El primero, fue realizado por el Economista Diego Traverso y tutorado por el Dr. Gustavo Buquet, y su título es “Análisis de competitividad del sector exportador de Productoras Audiovisuales Publicitarias en Uruguay”. El sector audiovisual publicitario es un sector dinámico que se ha internacionalizado tempranamente y que generó divisas para el país del orden de los US$ 24 millones durante el año 2005 por concepto de exportaciones. En este trabajo se caracteriza al sector audiovisual publicitario en Uruguay y se analiza las ventajas competitivas que posee frente a sus principales competidores extranjeros. El segundo trabajo fue realizado por las Contadoras Natalia Rivera, Antonella Triay y María Eugenia Triay y se denomina “Gestión aplicada a las empresas radiales”. En este se identifican el sector radial, su proceso productivo y la complejidad al definir al “cliente”. Se proponen una serie de indicadores con el doble objetivo de medir el desempeño de la empresa y proveer incentivos a su organización. Finalmente, el último trabajo monográfico, fue una investigación interdisciplinaria, que sirvió simultáneamente para obtener el título de Licenciado en Economía a Ernesto Pienika y el de Licenciado en Administración a Nicolás Cohnheim y a Damián Geinsinger. Este trabajo, tutorado por el Dr. Gustavo Buquet y el Cr. Cecilio García de título “Impactos de las nuevas tecnologías en la .industria musical”, muestra cuáles son los principales impactos en esa industria que las nuevas tecnologías han provocado y cuáles son las posibles estrategias para adaptarse a estos cambios, así como los nuevos modelos de negocio. Espero que este libro sea el primero de una larga lista. Las áreas de Economía de la Cultura y Gestión de Organizaciones Culturales son disciplinas jóvenes que necesitan seguir creciendo. La investigación realizada por trabajos monográficos de fin de carrera en estas áreas, será siempre bienvenida. (shrink)

This paper makes two essential claims about the nature of shame and shame punishment. I argue that, if we properly understand the nature of shame, that it is sometimes justifiable to shame others in the context of a pluralistic multicultural society. I begin by assessing the accounts of shame provided by Cheshire Calhoun (2004) and Julien Deonna, Raffaele Rodogno, & Fabrice Teroni (2012). I argue that both views have problems. I defend a theory of shame and embarrassment that connects both (...) emotions to “whole-self” properties. Shame and embarrassment, I claim, are products of the same underlying emotion. I distinguish between moralized and nonmoralized shame in order to show when, and how, moral and non-moral shame may be justly deployed. Shame is appropriate, I argue, if and only if it targets malleable moral or non-moral normative imperfections of a person’s ‘whole-self.’ Shame is unjustifiable when it targets durable aspects of a person’s “whole-self.” I conclude by distinguishing shame punishments from guilt punishments and show that my account can explain why it is wrong to shame individuals on account of their race, sex, gender, or body while permitting us to sometimes levy shame and shame punishment against others, even those otherwise immune to moral reasons. Imagine that we are on a train playing with some mechanical systems. Why can’t we detect any differences in their behavior when the train is parked versus when it is moving uniformly? The standard answer is that boosts are symmetries of Newtonian systems. In this paper, I use the case of a spring to argue that this answer is problematic because symmetries are neither sufficient nor necessary for preserving its behavior. I also develop a new answer according to which boosts (...) preserve the relational properties on which the behavior of a system depends, even when they are not symmetries. (shrink)

It is widely acknowledged that the Galilean Relativity Principle, according to which the laws of classical systems are the same in all inertial frames in relative motion, has played an important role in the development of modern physics. It is also commonly believed that this principle holds the key to answering why, for example, we do not notice the orbital velocity of the Earth as we go about our day. And yet, I argue in this paper that the precise content (...) of this principle is ambiguous: standard presentations, in both physics and philosophy, fail to distinguish between two principles that are ultimately inequivalent, the “External Galilean Relativity Principle” (EGRP) and the “Internal Galilean Relativity Principle” (IGRP). I demonstrate that EGRP and IGRP play distinct roles in physics practice (e.g., EGRP is connected to the concept of Galilean invariance, but IGRP is not) and that many classical systems that satisfy IGRP fail to satisfy EGRP. I further show that the Relativity Principle introduced by Einstein in 1905—which is not restricted to classical systems—also leads to two inequivalent principles, an external one analogous to EGRP, and an internal one analogous to IGRP. I conclude by noting that the phenomenon originally captured by Galileo’s famous ship passage is much more general than contemporary discussions in the philosophy of symmetries suggest. (shrink)

The purpose of this essay is to look at whether Aquinas teaches in De veritate [DV], q. 1, a. 4, that truth is a form inherent in things. I take up this investigation because I am examining Lawrence Dewan's account of Aquinas's teaching on truth.1 On Dewan's account, a significant development occurs in Aquinas's teaching as regards truth as it is found in things. Before the Summa theologiae [ST], Aquinas thought that in addition to truth being in the intellect, it (...) was also in things. In ST, most explicitly in I, q. 16, a. 6, Aquinas no longer thinks that it is in things, but only in the mind. When Dewan says that before the ST truth is "in things" and in the ST it is not "in things," in both cases, by "in things," Dewan means "as a form inherent in things." What exactly this means for Dewan will be gradually brought out as I examine the text Dewan thinks most clearly teaches that truth is a form inherent in things: DV, q. 1, a. 4. (shrink)

El fenómeno de la corrupción es un cáncer que afecta a nuestro país y que es necesario erradicar; éste diluye las oportunidades de desarrollo económico y social, privilegiando la sola conjunción de intereses particulares, de actores políticos en acuerdos no legales en beneficio propio, los cuales derivan en actos de corrupción. Estudios recientes señalan que el nivel de corrupción presente en un sistema político está directamente relacionado con el tipo de estructura institucional que lo defina (Boehm y Lambsdorff, 2009), así (...) como de la ineficacia de los organismos de control (Casar, 2015; Cárdenas, 2010; Rojas, 2010; Carbonell, 2009; Restrepo, 2004), por lo que se requiere de la acción ciudadana para combatir la corrupción (Sandoval, 2010; Villanueva, 2006). Este trabajo, centra nuestra atención en la administración pública federal, presentando como propuesta para empoderar la acción ciudadana en el combate de la corrupción y en el Sistema Nacional Anticorrupción; la figura de Whistleblowers o generador de alerta ciudadana, desde dos principios fundamentales: i) reconociendo la obligación del ciudadano de informar sobre actos de corrupción y ii) el otorgamiento por parte de la autoridad de la protección de testigos. Estas dos acciones derivarán en dos resultados importantes: i) Consolidar la denuncia ciudadana para informar a la sociedad sobre actos de corrupción y ii) y el ejercicio de la libertad de la información a fin de que la sociedad este en posibilidades de ser informada sobre actos de corrupción. Estas acciones permitirán promover y consolidar una cultura de la denuncia de actos de corrupción que pueden ser constitutivos de delito como pilar fundamental en el Sistema Nacional Anticorrupción en México. El presente trabajo aborda el estudio de la ética de la responsabilidad en la función legislativa de la Cámara de Diputados del H. Congreso de la Unión, desde la perspectiva de la evaluación del trabajo de los diputados federales, y busca dar respuesta a la siguiente interrogante: ¿Es eficiente el trabajo de los Diputados Federales en la Cámara de Diputados? El propósito es ¿cómo medir y evaluar la actuación en la función legislativa de los Diputados Federales? y con ello, aproximarnos (...) a identificar si ¿es eficiente y ético el trabajo desempeñado por estos representantes públicos? El trabajo se integra en tres partes. En la primera se ubica el concepto de la ética de la responsabilidad y en la función legislativa. En la segunda sección se presenta la propuesta de un indicador para medir la eficiencia legislativa y se analiza el caso de los diputados federales de la LXI Legislatura que representan al Estado de Veracruz de Ignacio de la Llave. Finalmente, en la tercera parte se presenta una propuesta de acción ciudadana a partir de la información de la eficiencia legislativa y de la necesidad de exigir cumplimiento de la responsabilidad ética en la función legislativa. Como conclusiones importantes de la evaluación de la eficiencia legislativa de los diputados federales de la LXI Legislatura, nos muestra al menos dos resultados importantes: i) El índice de efectividad legislativa (IEL) muestra niveles muy bajos, tanto a nivel del pleno de la Cámara de Diputados, como a nivel del grupo de estudio de los diputados federales representantes del Estado de Veracruz. ii) En ambos casos, muestran un índice de rezago legislativo muy alto. Una alternativa es la exigencia ciudadana del cumplimiento ético de responsabilidad en la función legislativa al conocer la evaluación de resultados, misma que sirve como referencia para identificar escenarios de elección política basados en resultados. It is widely held that there is a distinctive norm of assertion. A plausible idea is that there is an analogous, perhaps weaker, norm for indirect communication via implicatures. I argue against this type of proposal. My claim is that the norm of assertion is a social norm governing public updates to the conversational record. Off the record implicatures are not subject to social norms of this type. I grant that, as happens in general with intentional actions, off the record (...) communicative acts may be subject to normative assessments on different levels (for instance, regarding their moral or prudential appropriateness). However, such assessments do not generate distinctive norms that apply to all cases of implicature. (shrink)

In popular culture psychopaths are inaccurately portrayed as serial killers or homicidal maniacs. Most real-world psychopaths are neither killers nor maniacs. Psychologists currently understand psychopathy as an affective disorder that leads to repeated criminal and antisocial behavior. Counter to this prevailing view, I claim that psychopathy is not necessarily linked with criminal behavior. Successful psychopaths, an intriguing new category of psychopathic agent, support this conception of psychopathy. I then consider reactive attitude theories of moral responsibility. Within this tradition, psychopaths are (...) thought to be blameless as a result of their pronounced affective deficits. Psychopaths are considered morally blind because they lack the moral emotions that make us sensitive to moral reasons. I argue that, even if they are morally blind, psychopaths remain open to forms of blame stemming from non-moral reactive attitudes. These reactive attitudes remain appropriate because psychopaths can express hateful, disgusting, or contemptible non-moral values in their judgments. (shrink)

Recent studies have shown that the indigenous population has been subject to social exclusion (Medel, 2016; Tetreault,2012; Rionda,2010; Del Popolo et al.,2009; World Bank,2004; Uquillas et al.,2003; Appasamy,1996). However, in the case of Mexico, there is no indicator to measure the degree of social exclusion. This article presents a methodology for estimating social exclusion index (IES) by estimating main components. Our proposal is to incorporate the index of social exclusion as a factor that can explain the current status of poverty (...) in the localities that have a high concentration of indigenous population and high economic marginalization in the state of Veracruz, and thus analyze the scope social policy to combat poverty, as the case Development Program Priority Areas (PDZP). Special issue: "Henri Bergson. Creative Evolution and Philosophy of Life." -/- I read the genealogy of the concept of energy through Bergson's Creative Evolution to argue that, historically, energy and its proto-concepts are grounded in spatialized notions of time. Bergson's work not only demands that we rethink energy and its relation to time, it also allows us to see that the concept of energy as we know it depicts time and materiality as a numerical multiplicity, which effaces the differences in (...) kind which are characteristic of energy transformations and real duration. To make this case, I first provide an analysis of Bergson’s concept of the cinematographical mechanism of thought, which splits duration into a composition of distinct states strung together by the idea of an impersonal becoming. Bergson claimed that this is the epistemological model for both ancient philosophy and modern science, meaning that it is also the epistemological ground within which energy concepts in western philosophy and science have been theorized. I then show how Bergson offers a way to overcome this model of theorizing through his method of intuition, and how these conclusions might be extended to future energy concepts. Thus, I argue that 1) Bergson’s work on duration allow us to interpret the genealogy of energy as the history of attempts to provide an account of change in terms of spatialized notions of time; 2) that his work offers a way of incorporating historicity into our understanding of energy; and 3) that thinking energy in the context of duration offers the possibility of conceptualizing energy as change. Jesse Prinz's The Emotional Construction of Morals is an ambitious and intriguing contribution to the debate about the nature and role of emotion within moral psychology. I review Prinz's recent claims surrounding the nature of emotional concepts as ?embodied representations of concern? and survey his later arguments meant to establish a form of cultural relativism. Although I suggest that other theories of emotional representation (i.e. prototype views) would better serve Prinz's aims, the underlying meta-ethical relativism that results is well defended (...) and represents a significant advance for constructivist Sentimentalists. Boghossian’s (2003) proposal to conditionalize concepts as a way to secure their legitimacy in disputable cases applies well, not just to pejoratives – on whose account Boghossian first proposed it – but also to thick ethical concepts. It actually has important advantages when dealing with some worries raised by the application of thick ethical terms, and the truth and facticity of corresponding statements. In this paper, I will try to show, however, that thick ethical concepts present a specific case, whose (...) analysis requires a somewhat different reconstruction from that which Boghossian offers. A proper account of thick ethical concepts should be able to explain how ‘evaluated’ and ‘evaluation’ are connected. (shrink)

This paper aspires to meet a philosophical challenge posed to the author to give treatment to what was seen as a particularly nice Meinongian case1; namely the case of Galician Meigas. However, through the playful footpaths of enchanted Galician Meigas, I rehabilitate some relevant discussion on the justification of belief formation and come to some poignant philosophical insights regarding the understanding of possibilities. I hope both the leading promoter of the challenge and, of course, other philosophical readers are satisfied with (...) the outcome. (shrink)

In this paper I argue that some human reproductive genome editing interventions can be therapeutic in nature, and thus that it is false that all such interventions just create healthy individuals. I do this by showing that the conditions established by a therapy definition are met by certain reproductive genome editing interventions. I then defend this position against two objections: (a) reproductive genome editing interventions do not attain one of the two conditions for something to be a therapy, and (b) (...) some reproductive genome editing interventions are therapeutic but in a nonstandard way. In the Conclusion I call for a more nuanced discussion of the nature of reproductive genome editing interventions. (shrink)

In this paper, we assess the impact of extended reality technologies as they relate to sexual forms of harassment. We begin with a brief history of the nature of sexual harassment itself. We then offer an account of extended reality technologies focusing specifically on psychological and hardware elements most likely to comprise what has been referred to as “the metaverse”. Although different forms of virtual spaces exist (i.e., private, semi-private, and public), we focus on public social metaverse spaces. We do (...) this to better explain how the concept of sexual harassment must be adjusted to such spaces and how approaches aimed at mitigating harassment must be sensitive to the type of metaverse spaces users utilize. We then offer a typology of sexual harassment for the metaverse focusing on three distinct forms of sexual harassment: (1) invariant (2) mixed variance or modified and (3) unique or metaverse specific. Although existing normative and legal frameworks may function well with respect to the first and, possibly, second forms of harassment, we argue such frameworks will not helpfully address metaverse-specific harassment. Ultimately, the changing nature of privately owned public spaces (POPS) which metaverses are likely to represent pose distinct ethical and regulatory challenges. (shrink)

This paper attempts to be a contribution to the epistemological project of explaining complex conceptual structures departing from more basic ones. The central thesis of the paper is that there are what I call “functionally structured concepts”, these are non-harmonic concepts in Dummett’s sense that might be legitimized if there is a function that justifies the tie between the inferential connection the concept allows us to trace. Proving this requires enhancing the russellian existential analysis of definite descriptions to apply to (...) functions and using this in proving the legitimacy of such concepts. The utility of the proposal is shown for the case of thick ethical terms and an attempt is made to use it in explaining the development of natural numbers. Winds of change, from the political perspective in Mexico, invite us to reformulate the methodological vision for the direction of public policy in the field of social development, directing their actions towards the construction of a methodological proposal that allows us to direct ourselves towards achieving higher levels of Well-being Social in our country, as a desirable objective of public policy and which is expected to be inclusive, participatory and democratic. -/- In this sense, it is important to recognize that (...) the current debate, in the academic and political sphere, questions what is being well? What is the life that is worth living? And that, additionally, the recognition of the satisfaction of life goals, at an individual and collective level, which invites us to reflect, if the current economic and social policy and strategy has produced results in what we envision as social welfare? Is a new approach necessary to solve the problem? What strategy should it be to consider the new methodological approach that seeks social welfare? And what components should be considered in the measurement of social welfare? This document is an invitation to review the concept of social welfare, as a proposal whose purpose is to correct the deficiencies or historical deficiencies suffered by the population, in the elemental enjoyment of social rights, a situation that causes social backwardness, marginalization, and that it is aimed at the impossibility of participating in the social decisions of the community and in collective decisions, such as: speaking, proposing, being heard and demanding compliance with fundamental human rights such as: health, food, housing, employment and security, among others. These deficiencies in the enjoyment of social and human rights are seen in the presence of social exclusion, and that together these social deficiencies explain the degree of multidimensional poverty suffered by the population in rural and urban areas. It is here that he invites us to reflect: what is the problem that social welfare seeks to solve? Multidimensional poverty, social exclusion, social backwardness or social inequality? And consequently, how to define the components to identify social welfare? -/- The document is made up of three sections: i) Social welfare: A retrospective look; ii) Social Welfare, an integrative view: The contribution of Sen, Naussbam, Rawls, Actis Di Pasquale and Keyes; and iii) Social Welfare: The recognition of limits in economic development -/- The first section presents a review of the proposals, which in the area of economic development have been presented since 1968 in the Human Condition Project, until the 2015 proposal of Sustainable Development Goals. -/- In the second section, the contributions of (Rawls, 1995), (Sen, 1982), (Nussbaum, 2011), (Keyes, 1998) , (Actis Di Pasquale, 2015) and (Actis Di Pasquale, 2017) are presented in order to present an integrative approach to the concept of social welfare. The following paper puts the history of race and colonialism in conversation with the history of the concept of energy. The objective is to understand what a critical decolonial perspective can teach us about the central role that energy plays in western culture, materially and epistemologically. I am interested in how this approach to political, epistemological, and ontological questions demands that we reconceptualize energy to account for the historical particularity of the concept and the phenomena of history and intersubjectivity, which (...) are eschewed in a purely materialistic and quantitative conception of energy. We will see how energy has been complicit in the racialization of black and indigenous bodies, and how the privileged place that the concept of energy has occupied in the canon of western physics has served to obscure the theological, metaphysical, and cultural assumptions that constitute it. In a recent paper in this Journal San Pedro I formulated a conjecture relating Measurement Independence and Parameter Independence, in the context of common cause explanations of EPR correlations. My conjecture suggested that a violation of Measurement Independence would entail a violation of Parameter Independence as well. Leszek Wroński has shown that conjecture to be false. In this note, I review Wroński’s arguments and agree with him on the fate of the conjecture. I argue that what is interesting about (...) the conjecture, however, is not whether it is true or false in itself, but the reasons for the actual verdict, and their implications regarding locality. I argue that deep brain stimulation (DBS) is a bad approach for incarcerated psychopaths for two reasons. First, given what we know about psychopathy, empathy, and DBS, it is unlikely to function as an effective treatment for the moral problems that characterize psychopathy. Second, considerations of neurodiversity speak against seeing psychopathy as a mental illness in the first place.

In debates concerning the consequence argument, it has long been claimed that [McKay, T. J., and D. Johnson. 1996. “A Reconsideration of an Argument Against Compatibilism.” Philosophical Topics 24 (2): 113–122] demonstrated the invalidity of rule (β). Here, I argue that their result is not as robust as we might like to think. First, I argue that McKay and Johnson's counterexample is successful if one adopts a certain interpretation of ‘no choice about’ and if one is willing to deny the (...) conditional excluded middle principle. In order to make this point I demonstrate that (β) is valid on Stalnaker's theory of counterfactuals. This result is important and should not be neglected, I argue, because there is a particular line of objection to the revised formulations of the consequence argument that does not succeed against the original version. What do we mean when we describe the history of the Caribbean as traumatic? Is it possible to use the term ‘trauma’ here in a more technical sense, or should we give it the less strict connotation of an extreme form of an event in which the past no longer stays just in the past and the future never ceases to demand something from the present? In this paper I analyze the image of the abyss, used by Édouard Glissant to (...) evoke poetically one of the beginnings of the Caribbean, as leading to a paradox on the attitude toward history: Caribbean communities have been burdened with a non-history that feels, at the same time, like too much history. I show that this image resembles the paradoxical structure of trauma developed in the works of Cathy Caruth, according to whom trauma is a paradoxical structure of experience in which the subject (or a community) is painfully possessed by an image that they have barely perceived and that is so minimal that it cannot be controlled. However, I argue, there are limits to this resemblance. I focus on the question whether the (traumatic) paradox is escapable in this region of the world, that is, whether Caribbean communities can be de-traumatized, and what are the connections of this possibility with the question, central to Glissant, of decolonization. In order to answer these questions, I analyze a central feature of the Caribbean history according to Glissant, transversality, to show in what way the paradox of history can be loosened. (shrink)

Typically, existentialist analyses of “America” have been limited to North America (more specifically, the United States). I argue that developing an adequate framework for existentially analyzing America requires a turn to Mexican existentialism. In Emilio Uranga’s and Jorge Portilla’s writings, we discover new conceptual tools for understanding Americanness as such. These thinkers help us imagine an account of American being that does not restrict itself to the United States by using the concepts of existentialism to describe the crises their neighbors (...) to the north as well as they themselves face. American existence has been historically characterized by a convergence (oftentimes clash) of disparate races, ethnicities, languages, cultures, religions, and identities. As history unfolded, this convergence led to various existential crises across the Americas. Whereas the US American way of life is marred by a blustering, naïve, and purposeless misuse of freedom that disregards the other, the existential crisis the Mexican lives is characterized by “accidentality” and “zozobra.” Despite these important differences, all existentialists, and the Mexican existentialists of the Hyperion Group especially, remind us that there is a common way to overcome the various existential crises plaguing the Americas, and that is to exercise freedom in a purposeful, communally conscious manner. The methodological differences of understanding, versus explaining, have been at the centre of a century-long methodenstreit debate (and disagreement) among philosophers and scientists. Karl Jaspers managed to import this discussion to the realm of psychiatry and psychopathology in a significant, but unresolved, manner. Side-tracked by the advent of various changes in psychiatry during the 20th century, phenomenology and philosophy of psychiatry have made a comeback in the last decades and, since then, developed new contributions to this subject. Quite similarly, the (...) study of time experience, standing on the shoulders of notorious philosophers, has too witnessed a similar renaissance, with groundbreaking developments across several conditions, including depression. The present essay is essentially exploratory, but during its development, after addressing the concepts of the methodenstreit debate, and tackling both meaningful and causal connections behind time dysperception in depression, I argue that understanding, at least in this context and at present time, is not entirely reducible to causal explanations, for some things are only gained in understanding, such as the feeling of being understood and the implications it carries for a therapeutic relationship and the treatment plan. The phenomenon of corruption is a cancer that affects our country and that it is necessary to eradicate; This dilutes the opportunities for economic and social development, privileging the single conjunction of particular interests, political actors in non-legal agreements for their own benefit, which lead to acts of corruption. Recent studies indicate that the level of corruption present in a political system is directly related to the type of institutional structure that defines it (Boehm and Lambsdorff, 2009), as well as (...) the ineffectiveness of the control organisms (Casar, 2015; Cárdenas, 2010, Rojas, 2010, Carbonell, 2009, Restrepo, 2004), which requires citizen action to combat corruption (Sandoval, 2010, Villanueva, 2006). This work, focuses our attention on the federal public administration, presenting as a proposal to empower the citizen action in the fight against corruption and in the National Anticorruption System; the figure of Whistleblowers or generator of citizen alert, based on two fundamental principles: i) recognizing the citizen's obligation to report acts of corruption and ii) the granting by the authority of witness protection. These two actions will result in two important results: i) Consolidate the citizen's complaint to inform society about acts of corruption and ii) and the exercise of freedom of information so that society is able to be informed about acts of corruption. These actions will allow promoting and consolidating a culture of reporting acts of corruption that may constitute a crime as a fundamental pillar in the National Anticorruption System in Mexico. Abstracts The aim of the paper is to propose an alternative model to realist and non-cognitive explanations of the rule-guided use of thick ethical concepts and to examine the implications that may be drawn from this and similar cases for our general understanding of rule-following and the relation between criteria of application, truth and correctness. It addresses McDowell’s non-cognitivism critique and challenges his defence of the entanglement thesis for thick ethical concepts. Contrary to non-cognitivists, however, I propose to view the (...) relation between the two terms of the entanglement as resulting from the satisfaction of a previously applied moral function. What effect has finding the Archimedean point in ourselves had on how we look at ethics? The modern era of philosophy began with Descartes finding within himself an unshakable point from which to pursue knowledge of the world and himself. This intellectual alienation from the world into the universal mathematical structures of the human mind has led to a reversal where, henceforth, production, rather than contemplation, of knowledge became epistemologically superior. Guided by Hannah Arendt’s discussion of the Archimedean point and (...) Earth alienation in the Human Condition, I will argue that this scientific form of thinking made its way into ethical investigation in the age of modern philosophy. Furthermore, I will provide an analysis of Kant’s categorical imperative and John Stuart Mill’s utilitarianism to show that despite modern science’s success in elucidating universal laws of nature, a scientific approach to ethics has not universalized our judgments of good and evil. Este es un ensayo homenaje a Ernesto Sábato, quien además de un connotado novelista fue un acérrimo crítico de la ciencia moderna y contemporánea, al plantear que reducir toda la realidad a las matemáticas ha favorecido la deshumanización y maquinización de la naturaleza y del hombre. Sin embargo, la tesis que se defiende aquí es que Sábato no fue igualmente perspicaz previendo de qué forma la Inteligencia Artificial clásica podría representar el pináculo de la deshumanización del hombre, pues esta considera (...) que la mente y la inteligencia de este como funciones de una simple máquina programada, i.e., como un producto de engranajes sintáctico-matemáticos cuya implementación material es ajena a los contextos. En efecto, la etapa final de la deshumanización denunciada por Sábato no podría haber ocurrido sin que se hubiese considerado que la propia mente no es más que una computadora, es decir, una máquina programada. Philosophers and psychologists often claim that moral agency is connected with the ability to feel, understand, and deploy moral emotions. In this chapter, I investigate the nature of these emotions and their connection with moral agency. First, I examine the degree to which these emotional capacities are innate and/or ‘basic’ in a philosophically important sense. I examine three senses in which an emotion might be basic: developmental, compositional, and phylogenetic. After considering the evidence for basic emotion, I conclude that emotions (...) are not basic in a philosophically important sense. Emotions, I argue, are best understood as socially constructed concepts. I then investigate whether these emotions are necessary for moral agency. In order to do this I examine the philosophical and psychological literature on psychopathy and autism (two conditions defined in terms of empathic and emotional deficits). Persons with psychopathy appear incapable of distinguishing moral from non-moral norms. Additionally, while persons with autism often struggle to develop their empathic capacities, they are capable of understanding and deploying moral emotions like guilt and shame. I conclude that, in line with the conceptual act theories of emotion, that only contagion-based empathy is necessary for the acquisition of moral concepts. (shrink)

This thesis focuses on the evolution of human social norm psychology. More precisely, I want to show how the emergence of our distinctive capacity to follow social norms and make social normative judgments is connected to the lineage explanation of our capacity to form shared intentions, and how such capacity is related to a diverse cluster of prototypical moral judgments. I argue that in explaining the evolution of this form of normative cognition we also require an understanding of the developmental (...) trajectory of this capacity. For this purpose, the thesis is organized as follow. In the first chapter, I make some methodological remarks and provide the general overview and plan for the dissertation. In the second chapter, I explain what my explanatory target is and why it matters. On the view I am defending, shared intentional psychology gives rise to a special form of psychology that enables us to engage in social normative thinking. These norms are represented as shared intentional states. Moral psychology, in contrast, is more diverse. For moral judgments define a quite heterogeneous class of mental states—although some moral judgments may involve the representation and execution of norms, certainly not all of them do. I show that although much of our distinctive social norm psychology can be explained within the framework of shared intentionality, moral judgments cannot be unified in the same way. In the third chapter, I provide the baseline of social-cognitive capacities that serve as starting point for my lineage explanation. I argue that hominin social cognition was for a very long period of our evolutionary history essentially a matter of low-level cognitive and motivational processes. On this picture, bottom-up affective processes regulated the social lives of early hominins without requiring any special top-down mechanism of normative thinking such as a capacity for understanding and representing social norms. In the fourth chapter, I argue that human-like social norm psychology evolved as a result of the selective pressures that gave rise to shared intentionality, especially the demands that came from collective hunting. Yet collective hunting was not the whole story of the evolution of shared intentionality, for our capacity to form shared intentional mental states emerged from the interplay between the selective pressures that led to cooperative breeding in humans as well as organized, goal-oriented, collective hunting. Thus, I propose an evo-devo account of shared intentionality and its normative dimension since I argue that explaining the evolution of this particular form of normative thinking crucially depends on information about the developmental trajectory of this capacity. Finally, in the fifth chapter, I focus on how social norms are acquired and how the way we learn them gives rise to some prototypical cluster of moral judgments. Thus, this chapter returns to some of themes and arguments of the first chapter by explaining how the distinction between moral judgments and nonmoral judgments can be culturally transmitted. In a recent publication Tom Douglas and Katrien Devolder have proposed a new account of genetic parenthood, building on the work of Heidi Mertes. Douglas and Devolder’s account aims to solve, among other things, the question of who are the genetic parents of an individual created through somatic cell nuclear transfer (i.e. cloning): (a) the nuclear DNA provider or (b) the progenitors of the nuclear DNA provider. Such a question cannot be answered by simply appealing to the folk account of (...) genetic parenthood, according to which the genetic parents of an individual are those individuals who produced the egg and sperm, respectively, which fused to create the embryo. It cannot be so as in cloning there is no fertilization as such. In this article I critically examine Douglas and Devolder’s new account of genetic parenthood and demonstrate that it is vulnerable to counterexamples that exploit the lack of a condition specifying that genetic parents should cause a child’s coming into existence. According to Kemp Smith, Descartes believed that animals were devoid of feelings and sensations. This is the so-called ‘monstrous thesis,’ which I explore here in light of two Cartesian approaches to animals. Firstly, I examine their original treatment in function of Descartes’ early metaphysical approach, i.e., all natural phenomena are to be elucidated in terms of mental scrutiny. As pain would only exist in the understanding, and animals have neither understanding nor souls, Descartes held that they did not suffer. Secondly, (...) I look at the Cartesian late naturalism; specifically, at how animals are subsequently regarded as machines that may suffer. Lastly, I conclude that the ‘monstrous thesis’ is not Cartesian because animals are machines with feelings and sensations. However, Descartes’ surprising indulgence towards humans who kill and eat animals supposes that empathy for beings who may suffer is not necessary. This may raise doubts as to another ‘monstrous thesis.'. (shrink)

Dado este contexto, procedo a examinar las críticas de Hegel a a la filosofía de Kant, principalmente en la“introducción a la Fenomenología del espíritu . El artículo concluye evaluando la adecuación de la elucidación deltratamiento hegeliano del problema (...) del límite mostrando como esta noción funciona en la interpretación del tratamiento hegeliano de la certeza sensorial en la fenomenología. -/- The problem of limit according to Hegel. In this paper I focus Hegelian conception of limit trying to clarify its main features. I begin locating Hegel’s philosophy in the broader philosophical context of German Idealism, understanding it as the intellectual movementconcerned with the project of providing a transcendental deduction of the Absolute. Having this as a background, Iexamine Hegelian critique of Kantian philosophy, mainly in the “Introduction” of Phenomenology of Spirit, and I conclude the paper testing the way I elucidated the problem of limit in this paper showing how this notion can beused to interpret the treatment of “sense certainty” in Hegel’s Phenomenology of Spirit. In this article, I argue that, contrary to scholarly consensus, Antonio Caso draws inspiration from important principles and ideas from Kant’s philosophy in his critique of positivism. I first examine the prima facie textual reasons why someone might believe that Caso and Kant are philosophical enemies. To contradict this notion, I proceed by noting and developing three core ideas that the two share in common. First, Caso and Kant are both ardent critics of dogmatic philosophizing. Second, both Caso and Kant (...) carve out special room for intuition in their respective accounts of cognition, resisting the idea that the understanding has a more prominent role in the formation of knowledge. Third, Kant’s doctrine of aesthetic judgment paves the way for Caso’s de-intellectualized aesthetics. In the end, we see that Kant and Caso are closer to being philosophical friends than enemies. Political theorists have recently sought to replace the liberal, contractual theory of the firm with a political view that models the authority relation of employee to firm, and its appropriate regulation, on that of subject to state. This view is liable to serious difficulties, however, given existing discontinuities between corporate and civil authority as to their coerciveness, entry and exit conditions, scope, legal standing, and efficiency constraints. I here inspect these, and argue that, albeit in some cases significant, such discontinuities (...) fail to undermine the firm/state analogy, either because they are not significant enough to do so or because the particular trait on which they hinge is not decisive for how authority, in the state and in the firm, should be regulated to be legitimate. A pro tanto requirement exists, I thus argue, that corporate authority be held to regulatory norms comparable to those legitimate states abide by, including civil liberties, rule-of-law constraints, and accountability to subjects. Human eggs for basic, fertility and stem-cell research are in short supply. Many experiments that require their use cannot be carried out at present, and, therefore, the benefits that could emerge from these are either delayed or never materialise. This state of affairs is problematic for scientists and patients worldwide, and it is a matter that needs our attention. Recent advances in chimera research have opened the possibility of creating human/non-human animal chimeras intended for human gamete production (chimeras-IHGP). In this (...) paper, I examine four arguments against the creation of such chimeras and prove that all of them are found wanting. I conclude by showing that there is a strong moral reason for scientists to pursue this research avenue. (shrink)

Abstract. Following the tracks of Ryle and based upon the theory of complex systems, we shall develop a characterization of action-based consciousness as an embodied, embedded, selforganized process in which action and dispositions occupy a special place. From this perspective, consciousness is not a unique prerogative of humans, but it is spread all around, throughout the evolution of life. We argue that artificial systems such as robots currently lack the genuine embodied embeddedness that allows the type of self-organization that is (...) relevant to consciousness. -/- Sommario. Seguendo la linea tracciata da Ryle e basata sulla teorie dei sistemi complessi, svilupperemo una caratterizzazione della coscienza basata sull’azione come un processo incarnato, situato e auto organizzante nel quale le azioni e le disposizioni occupano un ruolo decisivo. Da questo punto di vista, la coscienza non è una prerogativa esclusiva degli esseri umani, ma è diffusa nel mondo naturale grazie ai processi evolutivi. Noi sosteniamo che i sistemi artificiali come i robot attualmente sono carenti del tipo di relazione con la corporeità e con l’ambiente che consente quel tipo di auto-organizzazione indispensabile per l’emergenza della coscienza. The “received view” on Kantian ethics holds that perfect duties enjoy absolute priority over imperfect duties. More recently, several Kantian scholars have reassessed this situation, arguing that imperfect duties may remain binding even if they imply breaching a perfect duty. In this article, I argue that both positions rely on a misunderstanding of the bindingness of Kantian duties. Genuine Kantian duties, I claim, remain binding even when they cannot be fulfilled. We must always strive for a total completion of our (...) duties; what it means for us to strive for it, however, will vary depending on our peculiar situation. (shrink)

El acto de “decidirse a filosofar” y la noción de totalidad exhibirán, al final del camino, el sentido circular del “discurso del método hegeliano”.

In this paper, I challenge the widespread view that Measurement Independence adequately represents the requirement that EPR experimenters have free will. Measurement Independence is most commonly taken as a necessary condition for free will. A number of implicit assumptions can be identified in this regard, all of which can be challenged on their own grounds. As a result, I conclude that Measurement Independence-type conditions are not to be justified by appealing to the preservation of the EPR experimenters’ free will.

The paper analyses in some depth the distinction by Paul Humphreys between "epistemic opacity" —which I refer to as "weak epistemic opacity" here— and "essential epistemic opacity", and defends the idea that epistemic opacity in general can be made sense as coming in degrees. The idea of degrees of epistemic opacity is then exploited to show, in the context of computer simulations, the tight relation between the concept of epistemic opacity and actual scientific (modelling and simulation) practices. As a consequence, (...) interesting questions arise in connection with the role of agents dealing with epistemically opaque processes such as computer simulations. (shrink)

The status of art in Plato's philosophy has always been a difficult problem. As a matter of fact, he even threw the poets out from his ideal state, a passage that has led some interpreters to assess that Plato did not develop a proper philosophy of art. Nevertheless, R. G. Collingwood, wrote an article titled “Plato's Philosophy of Art”. How can it be? What could lead one of the most important aesthetic scholars of the first half of the twentieth century (...) to make this thesis about Plato? To understand Collingwood's position at that time, I will review it in a new light: his own philosophy of art at that moment as it was propounded in Outlines of a Philosophy of Art, a work he published that same year. I will also examine how Collingwood's position changed when he returned to the same subject in 1938, on the publication of The Principles of Art. Finally, I will end this article defending the correctness of Collingwood's earlier interpretation of Plato's position on art. (shrink)

Higher‐order evidence can make an agent doubt the reliability of her reasoning. When this happens, it seems rational for the agent to adopt a cautious attitude towards her original conclusion, even in cases where the higher‐order evidence is misleading and the agent's original reasons were actually perfectly good. One may think that recoiling to a cautious attitude in the face of misleading self‐doubt involves a failure to properly respond to one's reasons. My aim is to show that this is not (...) so. My proposal is that (misleading) higher‐order evidence can undermine the agent's possession of her first‐order reasons, constituting what I call a dispossessing defeater. After acquiring the higher‐order evidence, the agent is no longer in a position to rely competently on the relevant first‐order considerations as reasons for her original conclusion, so that such reasons stop being available to her (even if they remain as strong as in the absence of the higher‐order evidence). In this way, an agent with misleading higher‐order evidence can adopt a cautious stance towards her original conclusion, while properly responding to the set of reasons that she possesses–a set that is reduced due to the acquisition of higher‐order dispossessing defeaters. My aim is to discuss the impact of higher-order evidence on aesthetic appreciation. I suggest that this impact is different with respect to aesthetic beliefs and to aesthetic affective attitudes (such as enjoyment). More specifically, I defend the view that higher-order evidence questioning the reliability of one’s aesthetic beliefs can make it reasonable for one to revise those beliefs. Conversely, in line with a plausible account of emotions, aesthetic affective attitudes are not directly sensitive to this type of higher-order evidence; (...) they are sensitive only to those features of objects that make such attitudes (un)fitting. Thus, I argue, there are cases of non-defective recalcitrant aesthetic attitudes where the subject has both a non-defective, fitting aesthetic affective attitude and a reasonable belief questioning the fittingness of this attitude. I further discuss whether, in this type of case, the subject has decisive reasons to try to change her recalcitrant attitudes—say by trying to modify her aesthetic affective dispositions. My answer is negative. Even granting that subjects always have aesthetic reasons to try to avoid aesthetically unfitting attitudes, these can be outweighed by further reasons not to do so—perhaps including aesthetic reasons related to the construction of valuable aesthetic identities or to the value of aesthetic engagement. En el presente trabajo reflexionamos en torno a una serie de textos en los que Michel Foucault se pregunta por estatuto de la crítica. La cuestión nos parece volverse reflexivamente sobre el propio Foucualt y por ello intentaremos evaluar de qué manera, con sus propios recursos conceptuales, se puede determinar el estatuto de su propio discurso. Para ello recorreremos dos caminos: (i) su rechazo de la noción de ideología que lo pone en tensión con algunas de las tradiciones mayores del (...) pensamiento crítico. La cuestión es aquí: ¿cómo es posible la crítica sin la ideología y sin la verdad?; (ii) la recuperación foucaultiana de la actitud crítica (en los textos sobre Kant y la pregunta Was ist Aufklärung?). A partir de allí Foucault recupera la problemática de la modernidad en términos de una “ontología histórica del presente”. Ambos caminos se cruzan, ya que las observaciones sobre una “política de la verdad” (lo otro de la crítica de la ideología comprometida con una verdad aséptica) se refuerzan con las de la cuestión del gobierno en términos de una “inservidumbre voluntaria”. En ambos casos, la práctica de la crítica, que subjetiviza desujetando, plantea la cuestión de la libertad. -/- We analyze Michel Foucault’s question for the status of critique and its reflexive return over Foucault himself: How Foucault’s discourse, qua critique, should be understood? We will drive two paths: (i) the refusal of the notion of ideology, where the question is: How to think of critique without ideology and truth?; (ii) the Foucauldian recovery of the “critical attitude” (in the texts on Kant’s answer to the question Was ist Aufklärung?) and of the problem of modernity, along the lines of a “historical ontology of the present”. There is a crossroad of (i) and (ii), since the remarks on a “politics of truth” (as opposite to an “ideology critique” committed with an aseptic truth) reinforces mutually with the problem of the government, faced along the lines of an art of the “voluntary inservitude”. In both cases, practice of criticism that subjectifies desubjugating, poses the question of liberty. (shrink)
