We discuss models that attempt to provide an explanation for the violation of Bell inequalities at a distance in terms of hidden influences. These models reproduce the quantum correlations in most situations, but are restricted to produce local correlations in some configurations. The argument presented in (Bancal et al. Nat Phys 8:867, 2012) applies to all of these models, which can thus be proved to allow for faster-than-light communication. In other words, the signalling character of these models cannot remain hidden.

The paper is focused on the criticisms that theorists of political constitutionalism raise against legal constitutionalism, especially with regard to the idea of representation and political sovereignty. At the same time, the intention is to reconstruct the debate between legal and political constitutionalism in contemporary liberalism, starting from the so-called counter-majoritarian difficulty. This debate concerns two different approaches: the political one rejects the idea of judicial review by the Supreme Court because it may establish a possible rule of the judges (...) (Michelman; Dworkin). It defends the role of Parliament in constitutional matters, in contrast with the role of the Supreme Court, inasmuch as – according to them – it is not open to political participation. Parliament is considered the only place in which we can exercise our constitutional power and in which our rights could be adequately protected (Bellamy; Waldron; Tushnet; Goldoni). On the other hand, legal constitutionalism upholds the idea of judicial review, defending the role of the Supreme Court as “exemplar of public reason” (Rawls 1993). This article tries to answer to three fundamental questions about constitutional democracy under the banner of political liberalism: 1. What do we mean by counter-majoritarian difficulty? 2. What is the answer that legal and political model of constitutionalism give to this question? 3. What is the role of constitutional courts in democratic regimes and what is their authority within the State? (shrink)

This contribution pays special attention to the Italian legal framework concerning the collaborative and sharing economy, with a focus on those economic initiatives which are platform mediated. This choice is due to the importance of the concept of “platform” in the definitions of the CSE provided at both the Italian and the European levels. As highlighted in some studies, most actors of the CSE can be considered not only economic disruptors but also policy disruptors. Thus, the chapter tries to shed (...) light on the difficulties Italian regulators had while dealing with the emergence of these actors, especially in sectors such as food, accommodation, delivery, and transport. Italian policymakers were not able to design new regulatory frameworks to cope with the challenges of CSE, privileging bans or almost total deregulation over the elaboration of innovative rules. Regarding the issue of digital labour, the Italian legislator adopted a partial solution, creating a framework that dualizes the labour market, maybe with the aim of satisfying both digital workers and platforms. Overall, it seems that the Italian ecosystem of the CSE is bound to evolve, especially after the appearance of the health crisis related to the COVID-19. (shrink)

During emerging public health crises, both policymakers and members of the public are looking to scientific experts to provide guidance. Even in cases where there are significant uncertainties, there is pressure for experts to “speak with one voice” to avoid confusion, allow officials to make evidence-based decisions rapidly, and encourage public support for such decisions. This can lead experts to engage in masking of information about the state of the science or regarding assumptions involved in policy recommendations. Although experts might (...) have good reasons for masking disagreements, uncertainties, or assumptions when offering policy advice, we argue that this strategy can result in epistemic harms. Using the case of the COVID-19 pandemic, we show that public health authorities masked two types of information necessary for laypersons to evaluate public health recommendations: (1) experts’ disagreements about the scientific evidence and (2) the role of values in making inferences from the science to policy positions. We contend that this resulted in epistemic harms against laypeople that provide a pro tanto case against masking information. We further argue that when the science is in flux and policies need to be implemented despite significant uncertainties, there is an all-things-considered case against masking the types of information discussed. This special issue on what some regard as a crisis of replicability in cognitive science (i.e. the observation that a worryingly large proportion of experimental results across a number of areas cannot be reliably replicated) is informed by three recent developments. -/- First, philosophers of mind and cognitive science rely increasingly on empirical research, mainly in the psychological sciences, to back up their claims. This trend has been noticeable since the 1960s (see Knobe, 2015). This development has allowed philosophers to (...) draw on a wider range of relevant resources, but it also makes them vulnerable to relying on claims that may not survive further scrutiny. If we have reasons to believe that a large proportion of findings in the psychological sciences cannot be reliably replicated, this would be a problem for philosophers who use such findings in their work. Second, philosophers are increasingly designing and carrying out their own experiments to back up claims, or to test claims earlier made from the armchair, for example, on the perceived permissibility of diverting trolleys or on the nature of free will. This growing field of experimental philosophy has diversified the intellectual field in philosophy, but may also be vulnerable to issues of replicability that philosophers did not face before. -/- Third, the recent evidence of apparently widespread non-replicability in the social sciences (and other fields) has forced philosophers of science to grapple with long standing questions from their field from a new perspective. To what extent does replicability matter for theory construction? How do the notions of replicability and scientific progress interact? How can normative insights from philosophy of science be used in order to improve scientific practice? -/- It is with these three developments in mind—the increasing importance of empirically-informed philosophy, of experimental philosophy, and of philosophy of science around replicability—that this special issue has been conceived. Fragmentalism allows incompatible facts to constitute reality in an absolute manner, provided that they fail to obtain together. In recent years, the view has been extensively discussed, with a focus on its formalisation in model-theoretic terms. This paper focuses on three formalisations: Lipman’s approach, the subvaluationist interpretation, and a novel view that has been so far overlooked. The aim of the paper is to explore the application of these formalisations to the alethic modal case. This logical exploration will allow us (...) to study (i) cases of metaphysical incompatibility between modal facts and (ii) cases of modal dialetheias. In turn, this will enrich our understanding of the role of impossibility in the fragmentalist framework. (shrink)

Tyler Burge is famous for defending primitivist naturalism about mental representations, according to which mental representations are primitive natural states. Primitivist naturalism contrasts with semantic reductionism, according to which mental representations are reducible to more fundamental natural states. Burge developed the most compelling and influential attack on semantic reductionism from a primitivist naturalist point of view. My goal in this paper is to defend semantic reduc- tionism from Burge’s attack. I assess and refute his objection to the motivations for semantic (...) reductionism and his objection to the semantic reductionist theory that he takes to be the most promising one, namely, teleosemantics. I argue that in spite of the ingenuity of Burge’s objections, they fail to show that there is no motivation for taking representational states as reducible to more fundamental natural states or that the core thesis of teleosemantics is flawed. In this paper, we focus on the moral responsibility of organized groups in light of historicism. Historicism is the view that any morally responsible agent must satisfy certain historical conditions, such as not having been manipulated. We set out four examples involving morally responsible organized groups that pose problems for existing accounts of historicism. We then pose a trilemma: one can reject group responsibility, reject historicism, or revise historicism. We pursue the third option. We formulate a Manipulation Condition and a (...) Guarding Condition as addendums to historicism that are necessary to accommodate our cases of group responsibility. (shrink)

Standard arguments for Bayesian conditionalizing rely on assumptions that many epistemologists have criticized as being too strong: (i) that conditionalizers must be logically infallible, which rules out the possibility of rational logical learning, and (ii) that what is learned with certainty must be true (factivity). In this paper, we give a new factivity-free argument for the superconditionalization norm in a personal possibility framework that allows agents to learn empirical and logical falsehoods. We then discuss how the resulting framework should be (...) interpreted. Does it still model norms of rationality, or something else, or nothing useful at all? We discuss five ways of interpreting our results, three that embrace them and two that reject them. We find one of each kind wanting, and leave readers to choose among the remaining three. (shrink)

This study investigates how e-business capabilities and digital marketing strategies jointly influence business performance in the e-commerce industry, which has experienced unprecedented growth driven by technological advancements and changing consumer behavior. E-business capabilities encompass the use of technology and digital infrastructure, while digital marketing strategies are employed to attract and retain online customers. The study examines the effect of e-business capabilities through digital marketing strategies on the customer satisfaction and loyalty of UAE e-commerce industry. The research is descriptive and explanatory, (...) and uses a structured 5-scale Likert questionnaire to collect data from the HR managers of 135 e-commerce companies based in UAE. The statistical analysis is performed using structural equation modeling. The findings highlight the significant relationship of the study variables. Consequently, the results of this study provide valuable insights for e-commerce businesses, elucidating the need to invest in robust e-business capabilities to support effective digital marketing efforts. Additionally, the research underscores the significance of tailoring digital marketing strategies to align with specific business objectives and customer segments. The study also contributes to the literature on digital transformation, by demonstrating how e-business capabilities and digital marketing strategies can enable e-commerce firms to adapt and thrive in the dynamic and competitive digital environment. This essay aims to expose the metaphysical underpinnings of enactivism. While enactivism relies heavily on rejecting the traditional mind-body problem by excluding the familiar thought experiments that favor phenomenal dualism, the crucial point that is overlooked is instead the brain-body problem, specifically the crucial interaction between the brain and the bodily limbs in their embodied activities of perception and cognition. If enactivism is correct, differences in sensory experience necessarily entail differences in embodied activity—this is the metaphysical core of enactivism, which (...) we think is entirely wrong. We will argue that a physical or biological body ("Körper") is configured or shaped into a perceptually living body ("Leib") by brain patterns and not by embodied activity or by the so-called sensorimotor contingencies. Undoubtedly, embodied actions influence sensory perception. However, since variations in embodied actions do not necessarily lead to variations in sensory experience, they are not metaphysically constitutive of these experiences (supervenience claim). A growing body of work in free speech theory is interested in the nature of counterspeech, i.e. speech that aims to counteract the effects of harmful speech. Counterspeech is usually defined in opposition to legal responses to harmful speech, which try to prevent such speech from occurring in the first place. In this paper we challenge this way of carving up the conceptual terrain. Instead, we argue that our main classificatory division, in theorising responses to harmful speech, should be between (...) pro-discursive and anti-discursive responses. Some legal responses to harmful speech, so we argue, make a positive discursive contribution in their own right. That is, legal restrictions on harmful speech can have a function that is importantly similar to speech that aims at countering the effects of harmful speech. (shrink)

In identifying intrinsic molecular chance and extrinsic adaptive pressures as the only causally relevant factors in the process of evolution, the theoretical perspective of the Modern Synthesis had a major impact on the perceived tenability of an ontology of dispositional properties. However, since the late 1970s, an increasing number of evolutionary biologists have challenged the descriptive and explanatory adequacy of this “chance alone, extrinsic only” understanding of evolutionary change. Because morphological studies of homology, convergence, and teratology have revealed a space (...) of possible forms and phylogenetic trajectories that is considerably more restricted than expected, evo-devo has focused on the causal contribution of intrinsic developmental processes to the course of evolution. Evo-devo’s investigation into the developmental structure of the modality of morphology – including both the possibility and impossibility of organismal form – has led to the utilisation of a number of dispositional concepts that emphasise the tendency of the evolutionary process to change along certain routes. In this sense, and in contrast to the perspective of the Modern Synthesis, evo-devo can be described as a “science of dispositions.” This chapter discusses the recent philosophical literature on dispositional properties in evo-devo, exploring debates about both the metaphysical and epistemological aspects of the central dispositional concepts utilised in contemporary evo-devo and addressing the epistemological question of how dispositional properties challenge existing explanatory models in evolutionary biology. The article introduces a special issue on “Rethinking Liberal Multiculturalism: Foundations, Practices and Methodologies.” The contributions presented in this special issue were discussed during the conference « Multicultural Citizenship 25 Years Later », held in Paris in November 2021. Their aim is to take stock of the legacy of Kymlicka’s contribution and to highlight new developments in theories of liberal multiculturalism and minority rights. The contributions do not purport to challenge the legitimacy of theories of multiculturalism and minority rights, they (...) rather aim at deepening our understanding of the foundations of liberal multiculturalism and of its practical implementation, sensitive to social scientific dynamics of diverse societies. Without abandoning the general idea that cultural minorities should be granted special minority rights, the essays presented raise new questions about three dimensions central to liberal multiculturalism: its normative foundations, its practical categories of minorities or groups, and its fact-sensitive methodology. Taken together they shed light on the renewed variety of theories of liberal multiculturalism highlighting their complexity and internal disagreements. To introduce these articles, the article first draws a brief historical overview of the debates on multiculturalism since the 1990s (section 1). It then highlights the distinctive aspects of Kymlicka’s contribution (section 2) and identifies recent research trends (section 3). Doing so, it explains how the articles gathered here both expand on those distinctive aspects and explore those new research avenues. The section 4 summarizes the contributions. (shrink)

I argue that my non-dual epistemic-phenomenalist view is the one that best harmonises my interpretation of the Fourth Paralogism with the widely shared reading of the Refutation of Idealism that I sketched and defended above. The bottom line of my view is a clear distinction between the metaphysical and epistemological sides of Kantian idealism. Again, according to my non-dual-epistemic-phenomenalism, the mundus sensibilis and mundus intelligibilis are epistemologically distinct ways of considering the metaphysically identical outside world. Appearances are nothing but the (...) way the things in themselves appear or exist inside our sensible minds as mere representations. In this sense, I reject both the two-world view, the two-aspect view, and Allais’s deflationary anti- phenomenalist reading. (shrink)

Children continue to be overlooked as a topic of concern in discussions around the ethical use of people’s data and information. Where children are the subject of such discussions, the focus is often primarily on privacy concerns and consent relating to the use of their data. This paper highlights the unique challenges children face when it comes to online interferences with their decision-making, primarily due to their vulnerability, impressionability, the increased likelihood of disclosing personal information online, and their developmental capacities. (...) These traits allow for practices such as hypernudging to be executed on them more accurately and with more serious consequences, specifically by potentially undermining their autonomy. We argue that children are autonomous agents in the making and thus require additional special protections to ensure that the development of their autonomy is safeguarded. This means that measures should be taken to prohibit most forms of hypernudging children and thus ensure that they are protected from this powerful technique of digital manipulation. (shrink)

Mechanisms for QoS provisioning in communication networks range from flow-based resource reservation schemes, providing QoS guarantees, through QoS differentiation based on reservation aggregation techniques to adaptation of applications, compensating for incomplete reservations. Scalable, aggregation-based reservations can also be combined with adaptations for a more flexible and robust overall QoS provisioning. Adaptation is particularly important in wireless networks, where reservations schemes are more difficult to realize. It is widely accepted that usability of Cellular or Mobile IP can be largely improved if (...) adaptation is incorporated. Adaptation, in turn, depends on coding techniques involved and on user requirements. Those impose certain preferences and ordering relations on QoS hierarchies or degradation paths to be followed along when adaptation is performed. With the advent of MPEG4 coding techniques, more sophisticated adaptation schemes are more likely to be supported in the future. (shrink)

This paper presents a new cognitivist account for the old puzzle of self-consciousness or knowing self-reference. Knowing self-reference does not rely on reflection on some putative pre-existent pre-reflexive self-consciousness, nor is it the result of a process of identification of oneself as the employer of the relevant token of “I” according to the token-reflexive rule of the first-person pronoun. Rather, it relies on the architecture of the cognitive system. By exploiting the acquaintance relation that every brain has to one’s own (...) body, a “mental file” is opened in a subliminal way to house information about oneself gained through the appropriate proprioceptors. Knowing self-reference based on self-files dispenses with self-identification because the opening of the file in the same brain/body is not a deed of the cognitive system but rather something that takes place sub-personally. The aim of this paper has been to present a new reconstruction of Kant’s Refutation of Idealism. I have considered several different targets of the Refutation, five of them mentioned by Kant himself. I believe that I have shown that the Refutation of Idealism is best considered only as a sound argument against Mendelssohnian subjectivist idealism, against Mendelssohnian immaterialism, and against Mendelssohnian realist idealism. First, Kant’s Refutation is a sound argument in favor of the claim that the outer things represented (...) in our minds are real rather than ideal; that is, they exist mind-independently as noumena. And second, Kant’s refutation is a sound argument for a fundamental ontology of noumena: the ultimate nature of reality and of our minds is neither material nor mental but made up of things in themselves. In this critical review of Robert Hanna's ingenious book (2006), I aim to support Hanna‟s main insightful reading of Kant, namely what he calls “a priori truth with a human face," without appealing to Kant's divide between a priori and a posteriori and analytic and synthetic truths. My suggestion is that transcendental propositions are necessary neither in the usual epistemological sense that analytic propositions are, let alone in the metaphysical sense that some empirical propositions are. Instead, they are necessary in (...) the theoretical domain in the weak alternative sense that they make possible the empirical recognition of appearances as an object as an indispensable condition of our self-consciousness experience, and they are a priori in the practical domain in the sense that their truth is vital for our self-comprehension as human beings. This paper is a new non-descriptivist defense of non- conceptualism, based on a new interpretation of Kant’s metaphysics of concepts. We advance the following claim: What distinguishes non-conceptual from conceptual singular representations is the way partial representations of the object’s features are integrated into the whole representation of the object: while at the non-conceptual level this integration takes the form of images of the object’s features that are stored and projected, at the conceptual level this integration takes the form of (...) the recognition that those features are properties of a same object, what Kant calls “synthetic unity of Aperception”. This paper is divided in four parts. In the first part we introduce the method of internal critique of philosophical theories by examination of their external consistency with scientific theories. In the second part two metaphysical and one epistemological postulate of Wittgenstein's Tractatus are made explicit and formally expressed. In the third part we examine whether Tractarian metaphysical and epistemological postulates (the independence of simple states of affairs, the unique mode of their composition, possibility of complete empirical knowledge) are externally (...) consistent with the theory of quantum mechanics. The result of the inquiry is negative: Tractarian postulates ought to be be revised. Relying on the result we approach the question of the empirical character of logic in the fourth part. The description of theoretical transformations of the notion of disjunction, in its ontological, epistemological, and logical sense, is a common element of in all parts of the text. The conjecture on the existence of different types of disjunctive connectives in the language of quantum mechanics concludes the paper. (shrink)

What does Cyberpunk and AI Ethics have to do with each other? Cyberpunk is a sub-genre of science fiction that explores the post-human relationships between human experience and technology. One similarity between AI Ethics and Cyberpunk literature is that both seek a dialogue in which the reader may inquire about the future and the ethical and social problems that our technological advance may bring upon society. In recent years, an increasing number of ethical matters involving AI have been pointed and (...) debated, and several ethical principles and guides have been suggested as governance policies for the tech industry. However, would this be the role of AI Ethics? To serve as a soft and ambiguous version of the law? I would like to promote in this article a more Cyberpunk way of doing AI Ethics, whit a more anarchic way of governance. In this study, I will seek to expose some of the deficits of the underlying power structures of our society, and suggest that AI governance be subject to public opinion, so that ‘good AI’ can become ‘good AI for all’. Este ensaio celebra as cinco décadas da publicação do livro A ordem do discurso de Michel Foucault, realizando uma reflexão acerca de sua repercussão entre as ciências sociais e sobre seus usos, principalmente, no campo da linguagem na parte relacionada à análise do discurso de linha francesa. Portanto, trata-se de uma retrospectiva crítica cuja análise começa com a entrevista que Foucault concedeu algumas semanas antes de proferir esta aula aos brasileiros Sergio Paulo Rouanet e José Guilherme Merquior. Em seguida, o (...) presente trabalho faz uma breve história da entrada de Foucault ao Collège de France e, por fim, lida com a microfísica do discurso que se encontra nesta aula, sobretudo, da rarefação do sujeito, além dos seus usos nas ciências humanas e sociais mais o campo da linguagem em torno da pragmática e das análises de discurso. Today’s societies place challenging demands on individuals, who are confronted with complexity in many aspects of their lives. Individuals need to acquire a wide range of competencies in order to overcome the complex challenges of today’s world. Using real-world problems is important not only to hone students’ mathematical thinking and competency but also to prepare them in making well-grounded decisions that involve logical and mathematical reasoning. Thus, this study explored the competence of the students in applying mathematics in real world (...) problems and determined the predictors using the selected profile variables. Regression analysis was used to identify if there are predictors that determine the results of the assessment. The main tool of the study was the Programme for International Student Assessment (PISA) test in mathematics. Findings revealed that the predictors include confidence level, repeated kinder, mother work status and highest level of education to complete. This study could be a guide for determining the strengths and weaknesses of students in applying mathematics in the real world as framework in helping them handle the rigors of connecting math with their lives. How can someone reconcile the desire to eat meat, and a tendency toward vegetarian ideals? How should we reconcile contradictory moral values? How can we aggregate different moral theories? How individual preferences can be fairly aggregated to represent a will, norm, or social decision? Conflict resolution and preference aggregation are tasks that intrigue philosophers, economists, sociologists, decision theorists, and many other scholars, being a rich interdisciplinary area for research. When trying to solve questions about moral uncertainty a meta understanding of (...) the concept of normativity can help us to develop strategies to deal with norms themselves. 2nd-order normativity, or norms about norms, is a hierarchical way to think about how to combine many different normative structures and preferences into a single coherent decision. That is what metanormativity is all about, a way to answer: what should we do when we don’t know what to do? In this study, we will review a decision-making strategy dealing with moral uncertainty, Maximization of Expected Choice-Worthiness. This strategy, proposed by William MacAskill, allows for the aggregation and inter-theoretical comparison of different normative structures, cardinal theories, and ordinal theories. In this study, we will exemplify the metanormative methods proposed by MacAskill, using has an example, a series of vegetarian dilemmas. Given the similarity to this metanormative strategy to expected utility theory, we will also show that it is possible to integrate both models to address decision-making problems in situations of empirical and moral uncertainty. We believe that this kind of ethical-mathematical formalism can be useful to help develop strategies to better aggregate moral preferences and solve conflicts. (shrink)

Este artigo busca adentrar pelas questões relacionadas à biopolítica do corpo, sobretudo, daquelas ligadas à estatização do biológico e do racismo do Estado, que aparecem nos trabalhos de Michel Foucault e que aqui evocamos para analisar o corpo enquanto objeto discursivo analisável dessa biopolítica em duas produções francesas de horror, - Frontière(s) e em À l’interieur – que exibem imagens dos tumultos de Outubro de 2005, acontecimento marcado pelos protestos contra a política de perseguição aos sans-papiers que vitimou três jovens (...) de origem africana. É a partir daí que retomaremos a discussão do “quem somos nós”, em Foucault, para refletir sobre o sujeito, a menoridade e a liberdade na estatização do corpo, um lugar da memória nacional. (shrink)

This essay aims to appreciate the influence of the use of aesthetics on the process of confectioning the ἦθος (éthos: “character”) in the civilizations of the Ancient Mediterranean. An anthropological approach of the premeditated use of different types of arts or techniques, aiming to provide to the individual an ideal image to be emulated allows the keys to the analytical comprehension of how those societies discovered that the several faculties of the human condition interact with its sensitivity. Printing symbols of (...) the ψυχή (psyché) on the image technically elaborated – the so-called technical virtuosity, being plastically or virtually, as happens in the poets’ action – consists in a normative use of these arts, with the pedagogical intention that virtuous examples can be assimilated by the process of μίμησις (mímesis: “emulation”). The formative potential of these arts is felt indefinitely in time, provoking the same process in individuals which are inside cultural and temporal contexts entirely different from those who conceived them. Este estudio se ocupa del control social del cuerpo y de la reconfiguración de la memoria popular en películas de horror a través de la perspectiva genealógica de Foucault, presentada en su libro Vigilar y Castigar, publicado hace 40 años. Por lo tanto, tomaremos, À l’interieur e Frontière (s), dos producciones de horror cinematográfico hechas por directores franceses, ambos publicados en 2007. La hipótesis principal es que las películas de terror se muestran como una nueva forma de vigilancia y control (...) social del cuerpo. Este trabalho apresenta algumas considerações a respeito da Base Nacional Comum Curricular (BNCC), no referente às questões ligadas ao ensino da língua portuguesa no Brasil, à territorialidade e ao pertencimento racial, processos históricos, que envolvem, no campo da educação, a formação docente e a construção da cidadania dos educandos e das educandas nestes tempos de reafirmação do Estado democrático de direito e da vaga decolonial. Portanto, trata-se de uma abordagem política em termos do pensamento de Paulo Freire, patrono da educação (...) brasileira, que considerava político o ato de educar (FREIRE, 1980; 1983; 1989; 1996). É com base nesta perspectiva que a BNCC será abordada, mas sob o aporte teórico da análise pragmática do discurso, tributária da análise discursivo-desconstrutiva (cf. ARAÚJO, 2020). (shrink)

A presente investigação tem por objetivo responder à questão título considerando os argumentos apresentados, de um lado, pelos desenvolvimentistas e, de outro, pelos ambientalistas. Entendemos que os argumentos apresentados refletem um conflito de valores mais profundo que, se abordado por uma metodologia de solução de conflitos adequada, pode contribuir para elucidação da questão. A metodologia proposta é o personalismo ético de Scheler. A hierarquia de valores a ser aplicada na solução de conflitos traz (i) o valor pessoa como o mais (...) elevado, seguido dos (ii) valores espirituais, como a justiça, (iii) os vitais, como o bem estar e o útil, e (iv) os sensíveis. Através das ações de preferir e postergar, é possível encontrar pontos de equilíbrio numa permanente atitude crítica. O objetivo é contribuir para que as ações ocorram com a devida diligência para com os direitos humanos. A hipótese inicial é que, identificando os valores em conflito e aplicando a metodologia descrita, a solução de conflitos neste caso concreto permite pensar numa transição energética que concilie o desenvolvimento e o meio ambiente. Compreendemos que ambos têm como fim proteger o valor pessoa. Portanto, o que está em conflito de fato, sem com isso assumir uma postura ingênua, são os valores espirituais e vitais de cada uma das partes. Neste sentido, defendemos que, diante da inevitável demanda por energia da sociedade contemporânea e do alto custo da transição energética, é preciso conciliar o desenvolvimento com o meio ambiente a partir de uma programada transição energética financiada pela exploração do petróleo e gás, mas com metas definidas comprometidas com a neutralidade da emissão de GEE em 2050. Para tanto, é necessário regulamentação, monitoramento e fiscalização por parte do Estado e do governo federal com a finalidade de garantir a substituição dos combustíveis fósseis por fontes energéticas limpas. Este trabalho trata do conceito Exu Diaspórico, o qual foi forjado para lidar com as pesquisas empíricas situadas dentro do quadro teórico da vaga decolonial. Sua concepção está ligada às tradições iorubanas diaspóricas nessa parte do Atlântico Sul onde emergiram outros sistemas resultantes, quer seja de fragmentos e vestígios de narrativas em gestos de memória e resistência, quer seja da tradução realizada pelo outro, muitas vezes, por meio de um processo de carnavalização cultural, que, por sua vez, se deu pela (...) convivência com os bantu, com os povos autóctones e com o colonizador europeu. Este conceito se articula com o conceito de língua-linguagem como encruzilhada apresentado por Araújo (2021a), mas pode ser tomado, ainda, de forma independente. Portanto, trata-se de uma discussão conceitual que visa contribuir com as reflexões e pesquisas decoloniais. O conceito também está a cargo de noções como negritude e Baianidade. Contudo, ele aparece para reunir todas as representações de Exu que resultaram da diáspora negra em meio a um processo de carnavalização das tradições iorubanas em contato com outras culturas e cosmologias. A partir de dados brasileiros e espanhóis, este artigo aborda aspectos relevantes da doação e transplantes de órgãos, como a relação entre oferta e demanda, legislação vigente, custos e possíveis estratégias para aumentar taxas de doação e melhorar de forma geral o processo de transplantes. O objetivo deste artigo é apresentar dados empíricos atuais que incrementem o conhecimento relevante para a avaliação bioética. Os dois países se destacam: o Brasil por ter o maior sistema público de transplantes de órgãos do (...) mundo, e a Espanha por manter há décadas o maior índice de doadores efetivos por milhão de pessoas. Análise inicial dos dados sugere a necessidade de lidar mais abertamente com os interesses dos afetados e a opinião pública, criando articulação sistêmica entre legislação, políticas públicas baseadas em evidências e pesquisa. As Leis de Platão apresentam-se como uma coleção de comandos jurídicos detalhados que trata sobre diversos temas, entre eles a composição do Estado ideal em uma cidade utópica chamada Magnésia e a imprescindibilidade na crença nas divindades. A preocupação de Platão com as crenças religiosas está associada à necessidade de manutenção da ordem moral e política. Para o filósofo, uma cidade em que seus habitantes duvidam da existência de seressuperiores capazes de punir os ímpios será sempre vítima do caos moral. (...) Acrença nos deuses foi então defendida como elemento fundamental para o bemda pólis e a excelência dos cidadãos e, neste sentido, Platão tentou articular asdimensões humana e divina. (shrink)

Este trabalho apresenta uma discussão que tem como objetivo principal propor um novo risco ao contorno da noção de intericonicidade que aparece em Courtine, precisamente, em 2003. Aí encontramos uma abertura que nos permite traçar outras curvaturas em sua noção. É justamente por este interstício que vamos propor a inclusão de dois elementos que, a nosso ver, estão na ordem da constituição das imagens: as utopias e heterotopias, conforme discussões iniciadas anteriormente por Araújo (2014a, 2014b). Para tanto, tomamos como pano (...) de fundo as imagens em movimento de duas produções francesas de horror e as imagens fotográficas da prisão de Abou Ghraib que serão analisadas à luz da discussão realizada por Foucault em Le corps utopique, les heterotopies e em Outros Espaços, juntamente com as discussões de Courtine e de Milanez acerca da intericonicidade (cf. COURTINE, 2005; 2011; 2013; MILANEZ, 2011a; 2011b; 2013a, 2013b). Os Elementos de Semiologia e A escrita do acontecimento de Barthes também fazem parte da discussão, já que este autor aparece desde cedo no trabalho de Courtine, precisamente, quando buscava apresentar a noção de intericonicidade. Este trabalho reflete sobre o modo como nossos ancestrais negros resistiram à necropolítica colonial mobilizando saberes para recriar no Brasil outros espaços religiosos sob o nome de terreiros de candomblé. Mas o objetivo principal da discussão é tratar sobre as noções de sincretismo religioso, desconstruindo-a teoricamente conforme a decolonialidade aplica tal conceito derridiano. O termo necropolítica é usado aqui conforme Achille Mbembe o emprega. Como uma forma de contribuir com o debate em voga e, ao mesmo tempo, fazer o diagnóstico (...) do presente, a discussão se justifica também porque a questão do sincretismo religioso tem sido alvo de muitos questionamentos por parte dos movimentos negros e por parte dos teóricos da decolonialidade. Resumen: Husserl propone una teoría sobre la intersubjetividad que parte de la conciencia trascendental como inserta en el mundo de la vida donde están los otros y donde la comunidad se construye bajo una estructura de esencias que garantiza la comunalidad. El mundo de la vida es dado y compartido por todas las conciencias intencionales y trascendentales, es condición para intuiciones empíricas y eidéticas, la epoché y las reducciones eidética y trascendental. Cada momento del método fenomenológico se basa en la (...) existencia de un mundo de la vida independiente de la subjetividad. En este mundo, hay objetos reales y, entre estos, los otros, reconocidos por analogía a través de la empatía. Desde una perspectiva metodológico-epistemológico, el yo es anterior al mundo y a los otros yos. El yo constituye, en sentido fenomenológico, la realidad. La conciencia es el lugar de evidenciación de la realidad. No obstante, en la perspectiva ontológica, es lo contrario. El mundo de la vida es anterior a la conciencia individual. El mundo de la vida está ahí, disponible, existente, independiente del sujeto, funcionando con su propio orden, con sus leyes y reglas. Es el yo el que esta insertado en el mundo de la vida y que se esfuerza por desvendarlo. La realidad se impone y el yo es, sobre todo, miembro de una comunidad de otros yos. Aun así, ¿cómo compartir las experiencias? Las vivencias pueden ser diferentes, pero hay un límite en las variaciones, un límite dado por la esencia del objeto vivido y por las leyes que rigen las relaciones de tal objeto. Así, la constitución del mundo y de sus objetos está permanentemente en progreso. Es posible donarles nuevos sentidos, en los límites de su esencia. Para Husserl, la constitución comunal del mundo es la condición de posibilidad para la existencia de sujetos separados unos de los otros, y este entendimiento recíproco solo es posible a través de la constitución trascendental de la objetividad. Así, no hay una separación entre la intersubjetividad y la constitución del mundo, es la comunidad de yos la que dona sentidos a las objetividades. En el mundo de la vida con los otros en comunidad. -/- Abstract: Husserl proposes a theory on intersubjectivity that starts from transcendental consciousness as inserted in the lifeworld where the others and where the community are built under a structure of essences that guarantees communality. The lifeworld is given and shared by all intentional and transcendental consciousnesses, it is a condition for empirical and eidetic intuitions, the epoché and the eidetic and transcendental reductions. Every moment of the phenomenological method is based on the existence of a lifeworld independent of subjectivity. In this world, there are real objects and, among these, the others, recognized by analogy through empathy. From a methodologicalepistemological perspective, the self is prior to the world and the other selves. The self constitutes, in a phenomenological sense, reality. Consciousness is the locus of evidence of reality. However, from the ontological perspective, it is the opposite. The lifeworld is prior to individual consciousness. The lifeworld is there, available, existing, independent of subjectivity, functioning with its own order, with its laws and rules. It is the self that is inserted in the lifeworld and that strives to unveil it. Reality prevails and the self is, above all, a member of a community of other selves. Even so, how to share the experiences? The experiences can be different, but there is a limit in variations, a limit given by the essence of the lived object and by the laws that govern the relation of the object. Thus, the constitution of the world and its objects is permanently in progress. It is possible to give them new meanings, within the limits of their essence. For Husserl, the communal constitution of the world is the condition of possibility for the existence of subjects separated from each other, and this reciprocal understanding is only possible through the transcendental constitution of objectivity. therefore, there is no separation between intersubjectivity and the constitution of the world, it is the community of selves that gives meaning to objectivities.
