  1. Prioritized Imperatives and Normative Conflicts.Fengkui Ju & Fenrong Liu - 2011 - European Journal of Analytic Philosophy 7 (2):35-58.
Imperatives occur ubiquitously in natural languages. They produce forces which change the addressee’s cognitive state and regulate her actions accordingly. In real life we often receive conflicting orders, typically, issued by various authorities with different ranks. A new update semantics is proposed in this paper to formalize this idea. The general properties of this semantics, as well as its background ideas are discussed extensively. In addition, we compare our framework with other approaches of deontic logics in the context of normative (...)

Many healthcare practices expose people to risks of harmful outcomes. However, the major theories of moral philosophy struggle to assess whether, when and why it is ethically justifiable to expose individuals to risks, as opposed to actually harming them. Sven Ove Hansson has proposed an approach to the ethical assessment of risk imposition that encourages attention to factors including questions of justice in the distribution of advantage and risk, people’s acceptance or otherwise of risks, and the scope individuals have to (...)

Informal political representation can be a political lifeline, particularly for oppressed and marginalized groups. Such representation can give these groups some say, however mediate, partial, and imperfect, in how things go for them. Coeval with the political goods such representation offers these groups are its particular dangers to them. Mindful of these dangers, skeptics challenge the practice for being, inter alia, unaccountable, unauthorized, inegalitarian, and oppressive. These challenges provide strong pro tanto reasons to think the practice morally impermissible. This paper (...)

Intellectual property law tends to be viewed as the only (or most significant) mechanism for achieving policy goals relating to innovation assets. Yet more creative and effective solutions are often available. When analysed from a transdisciplinary perspective, relying on the cooperative efforts of researchers from fields other than law, innovation governance is characterized not simply as the product of legal rules, but as a function of the interaction of legal rules, practices and institutions. When policy-makers seek to identify conditions under (...)

In this article, I introduce and examine the novel concept of bench representation. Jurists and scholars have extensively examined whether judges are or ought to be considered symbolic representatives of abstract concepts (for instance, the law, equality, or justice), representatives of society as a whole, or descriptive representatives of the social groups from which they hail. However, little attention has been paid to the question whether judges act as representatives for the parties before them through their everyday work on the (...)

An underexamined insight of W. E. B. Du Bois’s John Brown is that John Brown worked for much of his life to cultivate democratic relationships with the Black Americans with and for whom he worked. Brown did so through practicing deference and deliberation, and by seeking authorization. However, Brown’s commitment to these practices faltered at a crucial moment in decision making: when he raided Harpers Ferry absent widespread support. Examining this aspect of John Brown brings into relief an overlooked tragic (...)

Objective We reviewed human–robot interaction (HRI) participatory design (PD) research with older adults. The goal was to identify methods used, determine their value for design of robots with older adults, and provide guidance for best practices. Background Assistive robots may promote aging-in-place and quality of life for older adults. However, the robots must be designed to meet older adults’ specific needs and preferences. PD and other user-centered methods may be used to engage older adults in the robot development process to (...)

On the PR view, data are representations that are the product of a process of inquiry, and they should be evaluated in terms of their adequacy or fitness for particular purposes. Some important implications of the PR view for data assessment, related to misrepresentation, context-sensitivity, and complementary use, are highlighted. We provide an overview and critical examination of three leading proposals: the unified approach, the hierarchy approach and the pluralist approach. The unified approach calls for an accelerated development of high-resolution models within a seamless prediction framework. The hierarchy approach calls for more attention to the development and systematic study of hierarchies of related models, with the (...)

We provide a brief, non-technical overview of several of these issues – related to theorizing about climates, climate change, internal variability and more – and attempt to make preliminary progress in addressing some of them. In doing so, we hope to open a new thread of discussion in the emerging area of philosophy of climate science, focused on theoretical foundations.

  42. Border Sovereignty.Alistair Welchman - 2014 - In Politics of Religion/Religions of Politics. Dordrecht: Springer. pp. 51-68.
n Part I of this essay I take a canonical case of political theology, Schmitt’s theory of sovereignty (1985; 1922), and show how Agamben derives his account of sovereignty from an interpretation of Schmitt that relies on the interesting theological premise of an atemporal act or decision, one that is traditionally attributed to god’s act of creation, and that is only ambiguously secularized in the transcendental moment of German Idealism. In Part II I show how this reading of Schmitt can (...)

  43. The individual in the gig society: is the gig economy exploitative of the informal economy, or a means of empowerment? (2nd edition).Danelle Fourie - 2023 - Acta Academica 55 (2):154-169.
This article argues that the gig economy is an exploitative extension of the informal economy. With its decentralised promise of individual entrepreneurship, I will argue that it places undue burdens on the worker as an ‘independent contractor’ that would otherwise be upheld by the employer. I will do so by applying a Marcusian analysis of the gig economy, highlighting two primary concerns. First, Marcuse’s critique of ‘industrial rationality’ explains how industrial rationality creates the framework for – and justification of – (...)

  44. Vulnerable due to hope: aspiration paradox as a cross-cultural concern.Eric Palmer - 2014 - Conference Publication, International Development Ethics Association 10th Conference: Development Ethics Contributions for a Socially Sustainable Future.
(Conference proceedings 2014) This presentation (International Development Ethics Association, July 2014) considers economic vulnerability, exploring the risk of deprivation of necessary resources due to a complex and rarely discussed vulnerability that arises from hope. Pierre Bourdieu’s sociological account of French petit-bourgeois aspiration in The Social Structures of the Economy has recently inspired Wendy Olsen to introduce the term “aspiration paradox” to characterize cases wherein “a borrower's status aspirations may contribute to a situation in which their borrowings exceed their capacity (...)

This long essay was published in Vital Beauty, a collection including Wendy Steiner and Tim Ingold, which investigates the possibility of new ways toward beauty. This is my first encounter with Hartshorne’s Diagram of Aesthetic Values, a mandala-like structure explaining the relations between aesthetic experiences. The essay looks into the awkward history of the diagram in Hartshorne’s philosophy, its connection to Max Dessoir’s work, to Whitehead’s chapter on beauty in Adventures of Ideas and the notion of creativity in Schelling.

  48. Klasifikácia definícií.Marián Zouhar - 2014 - Teorie Vědy / Theory of Science 36 (3):337-357.
Cieľom state je navrhnúť systematickú a vyčerpávajúcu klasifikáciu definícií. Táto klasifikácia vychádza z typológie, ktorú vypracoval Richard Robinson vo svojej knihe o definíciách, no v rôznych aspektoch ju ďalej dopracováva. Nová klasifikácia je založená na dvoch kritériách, a to kritériu predmetnosti a kritériu ilokučnej sily. Podľa kritéria predmetnosti možno definovať výrazy, pojmy, resp. objekty ; podľa kritéria ilokučnej sily možno zase rozlíšiť definície, ktoré opisujú existujúci systém, a definície, ktoré transformujú daný systém na nový systém. Napokon sa podľa týchto dvoch (...)

The author underlines that Stirner makes a distinction between personal and private property. Die Einzige claims the property of person, not private property: this seems to sidestep Marx’s plethoric attack to him. To private property corresponds the private citizen, who is, first of all, de-prived of his person; he his an individual, not a person; he is “a phantom” – Individuum est ineffabile. Ju¨nger is not alien to such an outcome, provided that the proprietor may prevail on the egoist. The (...)

The major research universities in the United States had been investigated for the doctoral ranking of 2022 College Factual. The investigation had been performed as best as possible for the accuracy of data, but never be perfect nor exhaustive about the search terms. Suggestion and advice are truly welcome (Kiyoung Kim, Professor of Law and Public Policy, College of Law and Social Studies, Chosun University, Gwang-ju, South Korea). I plan that the data would be used for the next research publication.
