Feminist analyses of gender concepts must avoid the inclusion problem, the fault of marginalizing or excluding some prima facie women. Sally Haslanger’s ‘ameliorative’ analysis of gender concepts seeks to do so by defining woman by reference to subordination. I argue that Haslanger’s analysis problematically marginalizes trans women, thereby failing to avoid the inclusion problem. I propose an improved ameliorative analysis that ensures the inclusion of trans women. This analysis yields ‘twin’ target concepts of woman, one concerning gender as class and (...) the other concerning gender as identity, both of which I hold to be equally necessary for feminist aims. I distinguish between two senses in which feminists have argued that the knower is social: 1. situated or socially positioned and 2. interdependent. I argue that these two aspects of the knower work in cooperation with each other in a way that can produce willful hermeneutical ignorance, a type of epistemic injustice absent from Miranda Fricker's Epistemic Injustice. Analyzing the limitations of Fricker's analysis of the trial of Tom Robinson in Harper Lee's To Kill a Mockingbird with attention to the (...) way in which situatedness and interdependence work in tandem, I develop an understanding of willful hermeneutical ignorance, which occurs when dominantly situated knowers refuse to acknowledge epistemic tools developed from the experienced world of those situated marginally. Such refusals allow dominantly situated knowers to misunderstand, misinterpret, and/or ignore whole parts of the world. (shrink)

Miranda Fricker's important study of epistemic injustice is focussed primarily on testimonial injustice and hermeneutic injustice. It explores how agents' capacities to make assertions and provide testimony can be impaired in ways that can involve forms of distinctively epistemic injustice. My paper identifies a wider range of forms of epistemic injustice that do not all involve the ability to make assertions or offer testimony. This article argues that rape myths and domestic abuse myths constitute hermeneutical injustices. Drawing on empirical research, I show that the prevalence of these myths makes victims of rape and of domestic abuse less likely to apply those terms to their experiences. Using Sally Haslanger's distinction between manifest and operative concepts, I argue that in these cases, myths mean that victims hold a problematic operative concept, or working understanding, which prevents them from identifying their experience as one of rape or (...) of domestic abuse. Since victims in this situation lack the conceptual resources needed to render their experience sufficiently intelligible, they are suffering a form of hermeneutical injustice. Attending to this distinctive case sheds new light not only on the functioning of social myths of this kind but on the nature of hermeneutical injustice itself, since the case of the victim who accepts myths is importantly different from other cases of hermeneutical injustice discussed in the literature to date. In practical terms, this analysis supports calls for juries in rape trials to be warned about rape myths at the start of the trial, and may have implications for calls for statutory Sex and Relationships Education in schools. Miranda Fricker claims that a “gap” in collective hermeneutical resources with respect to the social experiences of marginalized groups prevents members of those groups from understanding their own experiences (Fricker 2007). I argue that because Fricker misdescribes dominant hermeneutical resources as collective, she fails to locate the ethically bad epistemic practices that maintain gaps in dominant hermeneutical resources even while alternative interpretations are in fact offered by non-dominant discourses. Fricker's analysis of hermeneutical injustice does not account for the possibility that (...) marginalized groups can be silenced relative to dominant discourses without being prevented from understanding or expressing their own social experiences. I suggest that a gap in dominant hermeneutical resources is ambiguous between two kinds of unknowing: hermeneutical injustice suffered by members of marginalized groups, and epistemically and ethically blameworthy ignorance perpetrated by members of dominant groups. According to Miranda Fricker, a hermeneutical injustice occurs when there is a deficit in our shared tools of social interpretation, such that marginalized social groups are at a disadvantage in making sense of their distinctive and important experiences. Critics have claimed that Fricker's account ignores or precludes a phenomenon I call hermeneutical dissent, where marginalized groups have produced their own interpretive tools for making sense of those experiences. I clarify the nature of hermeneutical injustice to make room for hermeneutical dissent, (...) clearing up the structure of the collective hermeneutical resource and the fundamental harm of hermeneutical injustice. I then provide a more nuanced account of the hermeneutical resources in play in instances of hermeneutical injustice, enabling six species of the injustice to be distinguished. Finally, I reflect on the corrective virtue of hermeneutical justice in light of hermeneutical dissent. (shrink)

The lack of gender parity in philosophy has garnered serious attention recently. Previous empirical work that aims to quantify what has come to be called “the gender gap” in philosophy focuses mainly on the absence of women in philosophy faculty and graduate programs. Our study looks at gender representation in philosophy among undergraduate students, undergraduate majors, graduate students, and faculty. Our findings are consistent with what other studies have found about women faculty in philosophy, but we were able to add (...) two pieces of new information. First, the biggest drop in the proportion of women in philosophy occurs between students enrolled in introductory philosophy classes and philosophy majors. Second, this drop is mitigated by the presence of more women philosophy faculty. (shrink)

Just as testimony is affected by unjust social relations, so too is intellectual self-trust. I defend an account of intellectual self-trust that explains both why it is properly thought of as trust and why it is directed at the self, and explore its relationship to social power. Intellectual self-trust is neither a matter of having dispositions to rely on one?s epistemic methods and mechanisms, nor having a set of beliefs about which ones are reliable. Instead, it is a stance that (...) an agent takes towards her own cognitive methods and mechanisms, comprising both cognitive and affective elements. Our intellectual self-trust is created and sustained socially and is thus porous to social power. Unjust social relations cause epistemic injustice, which undermines self-trust among the underprivileged; unjust social relations cause excessive self-trust among the privileged, which perpetuates epistemic injustice, which further undermines the self-trust of the disadvantaged in a vicious feedback loop. I conclude by exploring ways in which socially distorted intellectual self-trust can become better calibrated. (shrink)

In this paper I draw attention to a shortcoming in Miranda Fricker's 2007 account of hermeneutical injustice: that the only hermeneutical resource she acknowledges is a shared conceptual framework. Consequently, Fricker creates the impression that hermeneutical injustice manifests itself almost exclusively in the form of a conceptual lacuna. Considering the negative hermeneutical impact of certain societal taboos, however, suggests that there can be cases of hermeneutical injustice even when an agent's conceptual repertoire is perfectly adequate. I argue that this observation (...) highlights the need to expand Fricker's account to accommodate a wider range of hermeneutical resources and, in turn, a broader taxonomy of hermeneutical injustice. Specifically, my central case of a societal taboo presses the need to recognize as a valuable hermeneutical resource an expressively free environment, in which individuals can put their conceptual-interpretative resources to good hermeneutical effect. What exactly is rape? And how is it embedded in society? -/- Hilkje Charlotte Hänel offers a philosophical exploration of the often misrepresented concept of rape in everyday life, systematically mapping out and elucidating this atrocious phenomenon. Hänel proposes a theory of rape as a social practice facilitated by ubiquitous sexist ideologies. Arguing for a normative cluster model for the concept of rape, this timely intervention improves our understanding of lived experiences of sexual violence and social relations within sexist ideologies.

This paper defends a novel view of hermeneutical epistemic injustice. To this effect, it starts by arguing that Miranda Fricker’s account is too restrictive: hermeneutical epistemic injustice is more ubiquitous than her account allows. That is because, contra Fricker, conceptual ignorance is not necessary for HEI: hermeneutical epistemic injustice essentially involves a failure in concept application rather than in concept possession. Further on, I unpack hermeneutical epistemic injustice as unjustly brought about basing failure. Last, I show that, if this view (...) right, HEI is a form of distributive injustice, and affords the corresponding traditional normative theorising. (shrink)

When people respond to chants of “Black lives matter” with “All lives matter” or excoriate Colin Kaepernick for being “anti-military” or “anti-American” when he sits or kneels during the playing of the national anthem, there appears to be a break in understanding. BLM protestors and Kaepernick understand their actions and messages in one way, detractors in quite a different way. This presents an interpretive challenge. In this essay, I aim to explore the nature of this interpretive challenge by illuminating the (...) various obstacles that leave us without understanding. I will refer to such breaks in understanding as hermeneutical impasses. First, I sketch a taxonomy of hermeneutical impasses. I then discuss various ways of describing the notion of ‘understanding’ that may be at issue in impasses. Next, I discuss the relation between power and hermeneutical impasses, showing some of the ways power relations constrain our discursive practices. I conclude by arguing the structures of our environment make hermeneutical impasses difficult to avoid, if not inevitable. (shrink)

ABSTRACT The present essay concurs with R. Beehler's recent contribution to this journal 1991) in deeming the concept of negative liberty fully adequate for political discourse. Thus, section 1 indicates a plausible line of reasoning by which the negative concept can be defended against some standard objections. However, sections 2 and 3 argue that, nevertheless, Beehler's traditional conception of negative liberty is inadequate. It does not account correctly for various paradigmatic cases of ‘unfreedom’, for instance, the curtailment of the liberty (...) of the poor by their lack of economic resources. More precisely, Beehler's account will in many such cases fail to identify the correct constraining agents. The present essay suggests how Beehler's aim may be achieved on the basis of a different conception of negative liberty: the ‘responsibility view’. (shrink)
