En la literatura jurídica existe un acuerdo generalizado en que los topes máximos de la pena establecidos la legislación son un límite infranqueable por los jueces. Sin embargo, al abordar el límite mínimo los desacuerdos comienzan a surgir. El objetivo del presente trabajo será el de defender que los mínimos penales, si bien son vinculantes para los jueces, pueden ser dejados de lado cuando las circunstancias particulares del caso lo ameriten. El método empleado será análisis conceptual, más precisamente, al contructivismo (...) interpretativista propuesto por Ronald Dworkin, aplicado al estudio de la jurisprudencia y la doctrina argentina. El resultado final será una justificación – apoyada en la concepción comunicativa del castigo – según la cual los límites mínimos pueden ser dejados de lado en casos concretos y excepcionales, como cuando la culpabilidad del acusado o la lesividad de su conducta se muestran desproporcionadas con el límite mínimo. De esta manera se busca dar respuesta a un problema que se encuentra presente en la práctica jurídica y, sobre todo, brindar herramientas argumentativas para que los operadores judiciales puedan resolver aquellos casos donde este límite se encuentre en discusión. This paper aims at providing an epistemic defense of democracy based on John Dewey’s idea that democracies do not only find problems and provide solutions to them but they also articulate problems. According to this view, when citizens inquire about collective issues, they also partially shape them. This view contrasts with the standard account of democracy’s epistemic defense, according to which democracy’s is good at tracking and finding solutions that are independent of political will-formation and decision-making. It is also less (...) vulnerable to the criticisms that have been raised against the standard account. To show this, the paper develops a theory of expressive domination and argues that problem-articulation works best when it is inclusive and domination-free. It also shows that democratic conflict represents a fundamental element for problem-articulation. (shrink)

In this paper, we identify some key features of what makes something a disease, and consider whether these apply to pregnancy. We argue that there are some compelling grounds for regarding pregnancy as a disease. Like a disease, pregnancy affects the health of the pregnant person, causing a range of symptoms from discomfort to death. Like a disease, pregnancy can be treated medically. Like a disease, pregnancy is caused by a pathogen, an external organism invading the host’s body. Like a (...) disease, the risk of getting pregnant can be reduced by using prophylactic measures. We address the question of whether the ‘normality’ of pregnancy, its current necessity for human survival, or the value often attached to it are reasons to reject the view that pregnancy is a disease. We point out that applying theories of disease to the case of pregnancy, can in many cases illuminate inconsistencies and problems within these theories. Finally, we show that it is difficult to find one theory of disease that captures all paradigm cases of diseases, while convincingly excluding pregnancy. We conclude that there are both normative and pragmatic reasons to consider pregnancy a disease. (shrink)

La doctrina establecida por la Corte Suprema de Justicia de la Argentina en relación a los crímenes de lesa humanidad cometidos durante la última dictadura militar, expresamente declaraba la obligación del Estado de investigar y juzgar a los responsables de su comisión. La Corte no sólo caracterizó dichos delitos, sino que también estableció que no eran susceptibles de amnistía, indulto, ni prescripción. Pero, en el año 2017 dictó el fallo “Muiña” donde, por voto mayoritario, decidió otorgarle el beneficio del “2 (...) por 1” a un condenado por dichos delitos. La consecuencia fue su inmediata libertad por el vencimiento de la condena. La respuesta de la sociedad fue clara. Con diversas manifestaciones, la sociedad civil, las instituciones y las personalidades públicas se declararon en contra de la sentencia. Más aún, del voto de los mismos jueces se observan expresiones que denotan un gran pesar a la hora de tomar la decisión. Más precisamente, sostenían estar ante un dilema. En este trabajo, lejos de realizar un análisis de la interpretación jurídica que se efectuó en la sentencia, se propone trabajar sobre el concepto de dilema y la posibilidad de aplicación en el presente caso. La finalidad concreta es indagar si se está ante un dilema y en su caso si los jueces utilizan este concepto como un arma argumentativa para lograr adhesión o compasión de la opinión pública. En este sentido, se comenzará relatando el marco jurídico del fallo, donde se describirá la historia judicial de Muiña y los argumentos dados por el voto mayoritario y el minoritario de la Corte. Luego, se realizará un análisis del concepto de dilema, para reconstruirlo sobre la base de dos grandes posturas: Una lógica conceptual y otra fenomenológica. Posteriormente, se realizará un examen de la dimensión institucional del derecho y la moralidad judicial, para - finalmente - poder intentar responder si se está efectivamente ante un dilema. Malem Seña in “¿Puede las malas personas ser buenos jueces?” analyzed the judicial morality. At first time from a historical analysis, the judges were not required to base their judgments, because they were the mirror of legitimacy and morality of their decisions. With the advent of rationalism and modern State, the sentences should be the foundation. The situation that put the judge person in the background. In this situation, the answer to the question posed in the job would be: "Yes, (...) bad people can be good judges", answer hardly accepted by all. Malem Seña, far from giving a definite answer, ends his work with the insinuation that judges should maintain an image of morality, rather than being morally unimpeachable agents. This situation raises questions about different dimensions of analysis that have been shelved, and in particular try to analyze why this importance takes the image of morality. To do this, from the perspective of the concepts of Slavoj Žižek‘s ideology and fantasy, it will attempt to reach some responses or generate argumentative lines about the importance of the image of morality on morality itself. There is a close relationship between education and citizenship. Liberal political theorists tend to spend much of their work justifying the role of educational institutions in political communities. However, the development of these proposals is usually thought for subjects who do not have disabilities, arbitrarily excluding a significant proportion of society. This not only happens at an educational level, it is replicated in various areas of social life. In this sense, in the present work I am going to propose that (...) the adequacy approach proposed by Debra Satz is extremely valuable to think about the educational equity of people with disabilities. The choice is not accidental or arbitrary. Satz is a renowned philosopher whose interest in education and its importance in forming citizens for diverse and plural societies. To do this, I will begin by presenting three possible models of special education: the special school, integration and inclusion. Then the two paradigms that prevail in the characterization of disability will be addressed: the social model and the medical model. Instead, I will reconstruct the third proposal elaborated by Satz in order to evaluate with which inclusive education model and disability paradigm it is compatible and why it is presented as a valuable proposal in this field. Este artículo estudia la justificación normativa de la adopción de los ensayos clínicos aleatorizados por parte de las autoridades sanitarias británicas como estándar metodológico en 1946. A partir de un análisis de los distintos intereses de los participantes en el proceso (pacientes, médicos, farmacéuticas y el propio Estado) argumentamos que la aleatorización se adoptó como mecanismo de asignación imparcial de tratamientos, aunque sus propiedades estadísticas no fueran bien comprendidas. Tal justificación permanece aún vigente.

El trabajo consiste en una elucidación de los elementos que conforman el concepto de pena natural (poena naturalis) en el Derecho penal. Se puede caracterizar la pena natural como el daño o sufrimiento que recae sobre el autor de un delito, producto de la comisión del mismo, que debe ser descontado de la pena legal que ha de aplicársele. Si bien existe un mínimo acuerdo sobre esto, tanto en la jurisprudencia como en la doctrina penal se observan serios desacuerdos acerca (...) de los requisitos que se deben cumplir para reconocer que se está frente a una pena natural. Para elucidar los elementos, se utilizará el constructivismo conceptual de Ronald Dworkin, a fin de describir el desacuerdo y sus implicancias, reconocer los elementos principales de la pena natural y justificarlos bajo su mejor luz moral. ABSTRACT This study focuses on the clarification of the conceptual elements of poena naturalis in criminal law settings. The poena naturalis is the damage or suffering that falls on the convict for its commission. This damage must be deducted from the poena forensis to be applied. Although there is a minimum agreement about the concept of poena naturalis, in the jurisprudence and among legal scholars, there are serious disagreements about the elements of poena naturalis. To elucidate the elements, I will adopt Ronald Dworkin’s conceptual constructivism to describe the disagreement and its implications. La mal llamada “Conquista del Desierto” constituyó una serie de campañas militares ocurridas en el actual territorio patagónico argentino entre los años 1878 y 1885 cuyo resultado fue el asesinato, la violación y sometimiento a la esclavitud de diversos pueblos y comunidades indígenas. Este no fue un caso aislado, sino que se suma a una serie de ataques sistemáticos que han sufrido los indígenas en la Argentina. En los últimos años, a raíz del reclamo y las luchas de los pueblos (...) y comunidades indígenas, así como también de las organizaciones de derechos humanos, se han comenzado a juzgar algunos de estos hechos. En particular, la Masacre de Napalpí (1924) y la Masacre de La Bomba (1947) fueron los primeros que lograron respuestas judiciales favorables. En ambos se determinó que el accionar estatal era constitutivo de un genocidio y, por lo tanto, se debía resarcir a las comunidades actuales. Ahora bien, la Campaña del Desierto, al día de hoy, no tiene respuesta por parte del Estado. Teniendo presente este panorama, nuestro objetivo en este trabajo es reconstruir los diferentes problemas que enfrenta la posibilidad del reclamo judicial. Para ello, comenzaremos describiendo en qué consistió la Campaña del Desierto. Luego, explicaremos la noción de genocidio aplicado a hechos de injusticias históricas. Como tercer paso, reconstruiremos los casos jurisprudenciales que se han preocupado por genocidios indígenas ocurridos en el pasado. Con este panorama revelado, nos enfocaremos en los diferentes problemas jurídicos y políticos que surgen en los reclamos de justicia. (shrink)

It is commonly held that our intuitive judgements about imaginary problem cases are justified a priori, if and when they are justified at all. In this paper I defend this view — ‘rationalism’ — against a recent objection by Timothy Williamson. I argue that his objection fails on multiple grounds, but the reasons why it fails are instructive. Williamson argues from a claim about the semantics of intuitive judgements, to a claim about their psychological underpinnings, to the denial of rationalism. (...) I argue that the psychological claim — that a capacity for mental simulation explains our intuitive judgements — does not, even if true, provide reasons to reject rationalism. (More generally, a simulation hypothesis, about any category of judgements, is very limited in its epistemological implications: it is pitched at a level of explanation that is insensitive to central epistemic distinctions.) I also argue that Williamson’s semantic claim — that intuitive judgements are judgements of counterfactuals — is mistaken; rather, I propose, they are a certain kind of metaphysical possibility judgement. In the present work I am interested in addressing a specific aspect within the conceptual problem that poena naturalis implies. In other words, here I will answer the question about what is the poena naturalis. We can be recognized three theories: one that affirms that the poena naturalis is a compensation for culpability, another according to which the poena naturalis is the product of clemency or compassion, and the last that defends that the principles of legality, proportionality and rationality allow (...) justifying the poena naturalis. I will stop at each one of them in order to carry out a critical examination that will allow me to conclude which is the conception that best supports natural punishment. (shrink)

Ways of Scope Taking is concerned with syntactic, semantic and computational aspects of scope. Its starting point is the well-known but often neglected fact that different types of quantifiers interact differently with each other and other operators. The theoretical examination of significant bodies of data, both old and novel, leads to two central claims. (1) Scope is a by-product of a set of distinct Logical Form processes; each quantifier participates in those that suit its particular features. (2) Scope interaction is (...) further constrained by the semantics of the interacting operators. The arguments are developed using Minimalist syntax, Generalized Quantify theory, Discourse Representation Theory, and algebraic semantics. The contributors (Beghelli, Ben-Shalom, Doetjes, Farkas, Gutiérrez Rexach, Honcoop, Stabler, Stowell, Szabolcsi and Zwarts) make tightly related theoretical assumptions and focus on related empirical phenomena, which include the direct and inverse scope of quantifiers, distributivity, negation, modal and intensional contexts, weak islands, event-related readings, interrogatives, wh/quantifier interactions, and Hungarian syntax. An introduction to the formal semantics background is provided. Do the new sciences of well-being provide knowledge that respects the nature of well-being? This book written from the perspective of philosophy of science articulates how this field can speak to well-being proper and can do so in a way that respects the demands of objectivity and measurement.

In many languages, the same particles that form quantifier words also serve as connectives, additive and scalar particles, question markers, roots of existential verbs, and so on. Do these have a unified semantics, or do they merely bear a family resemblance? Are they aided by silent operators in their varied roles―if yes, what operators? I dub the particles “quantifier particles” and refer to them generically with capitalized versions of the Japanese morphemes. I argue that both MO and KA can be (...) assigned a stable semantics across their various roles. The specific analysis I offer is motivated by the fact that MO and KA often combine with just one argument; I propose that this is their characteristic behavior. Their role is to impose semantic requirements that are satisfied when the immediately larger context is interpreted as the meet/join of their host’s semantic contribution with something else. They do not perform meet/join themselves. The obligatory vs. optional appearance of the particles depends on whether the meet/join interpretations arise by default in the given constellation. I explicate the proposal using the toolkit of basic Inquisitive Semantics. (shrink)

La renta básica se nos presenta en la obra de Philippe van Parijs como una propuesta política filosóficamente argumentada, de modo tal que convencerá tanto al teórico de la justicia como al ciudadano que votará su implantación. En este artículo analizamos la argumentación de van Parijs mostrando cómo la efectividad política de sus tesis sólo se sostiene a costa de reducir el debate sobre la renta básica a los términos de su propia concepción de la ética. Ponemos en duda, por (...) nuestra parte, el alcance de esta reducción sobre un doble plano: diluye por completo la dimensión prudencial de toda argumentación política, y no deja más alternativa que la educación sentimental para quienes no se dejen convencer por el equilibrio reflexivo. ‘The Union of Cause and Effect in Aristotle : Physics III 3’, Oxford Studies in Ancient Philosophy, 32, pp. 205-232, May 2007.: I argue that Aristotle introduced a unique realist account of causation, which has not hitherto been appreciated in the history of philosophy: causal realism without a causal relation. In his account, cause and effect are unified by the ectopic actualization of the agent’s potentiality in the patient. His solution consists in the introduction of a property that belongs to (...) one subject but is realized in another subject on whose state this realization depends. I identify and analyze the multiple ontological dependencies between the causal state of the agent and that of the patient during their causal activity. (shrink)

The (dis)continuism debate—the debate over whether remembering is a form of imagining—is a prominent one in contemporary philosophy of memory. In recent work, Langland-Hassan (2021) has argued that this debate is best understood as a dispute over whether remembering is a form of constructive imagining. In this paper, I argue that remembering is not a form of constructive imagining because constructive processes in remembering and imagining are constrained, and hence controlled, in different ways at the level of consciousness. More specifically, (...) I argue that remembering and imagining differ in terms of the interventions we can make on the constructive processes as they unfold. If this is correct, then a form of discontinuism is vindicated: remembering and imagining are, on this view, processes of different kinds. (shrink)

Enjoying great popularity in decision theory, epistemology, and philosophy of science, Bayesianism as understood here is fundamentally concerned with epistemically ideal rationality. It assumes a tight connection between evidential probability and ideally rational credence, and usually interprets evidential probability in terms of such credence. Timothy Williamson challenges Bayesianism by arguing that evidential probabilities cannot be adequately interpreted as the credences of an ideal agent. From this and his assumption that evidential probabilities cannot be interpreted as the actual credences of human (...) agents either, he concludes that no interpretation of evidential probabilities in terms of credence is adequate. I argue to the contrary. My overarching aim is to show on behalf of Bayesians how one can still interpret evidential probabilities in terms of ideally rational credence and how one can maintain a tight connection between evidential probabilities and ideally rational credence even if the former cannot be interpreted in terms of the latter. By achieving this aim I illuminate the limits and prospects of Bayesianism. (shrink)

The Reflection Principle can be defended with a Diachronic Dutch Book Argument (DBA), but it is also defeated by numerous compelling counter-examples. It seems then that Diachronic DBAs can lead us astray. Should we reject them en masse—including Lewis’s Diachronic DBA for Conditionalization? Rachael Briggs’s “suppositional test” is supposed to differentiate between Diachronic DBAs that we can safely ignore (including the DBA for Reflection) and Diachronic DBAs that we should find compelling (including the DBA for Conditionalization). I argue that Brigg’s (...) suppositional test is wrong: it sets the bar for coherence too high and places certain cases of self-doubt on the wrong side of the divide. Given that the suppositional test is unsatisfactory, we are left without any justification for discriminating between Diachronic DBAs and ought to reject them all—including the DBA for Conditionalization. To comprehend, justify, and enhance our practices of trusting, utilising, and depending on experts' judgments, it is crucial to clarify the characteristics of experts and the means of identifying those who exemplify them. Consequently, this entry examines and evaluates accounts of the main characteristics of experts. Furthermore, it discusses indicators of experts that help recognise experts and considers to what extent they are accessible to other experts and laypersons.

Combinatory logic (Curry and Feys 1958) is a “variable-free” alternative to the lambda calculus. The two have the same expressive power but build their expressions differently. “Variable-free” semantics is, more precisely, “free of variable binding”: it has no operation like abstraction that turns a free variable into a bound one; it uses combinators—operations on functions—instead. For the general linguistic motivation of this approach, see the works of Steedman, Szabolcsi, and Jacobson, among others. The standard view in linguistics is that reflexive (...) and personal pronouns are free variables that get bound by an antecedent through some coindexing mechanism. In variable free semantics the same task is performed by some combinator that identifies two arguments of the function it operates on (a duplicator). This combinator may be built into the lexical semantics of the pronoun, into that of the antecedent, or it may be a free-floating operation applicable to predicates or larger chunks of texts, i.e. a typeshifter. This note is concerned with the case of cross-sentential anaphora. It adopts Hepple’s and Jacobson’s interpretation of pronouns as identity maps and asks how this can be extended to the cross-sentential case, assuming the dynamic semantic view of anaphora. It first outlines the possibility of interpreting indefinites that antecede non-ccommanded pronouns as existential quantifiers enriched with a duplicator. Then it argues that it is preferable to use the duplicator as a type-shifter that applies “on the fly”. The proposal has consequences for two central ingredients of the classical dynamic semantic treatment: it does away with abstraction over assignments and with treating indefinites as inherently existentially quantified. However, cross-sentential anaphora remains a matter of binding, and the idea of propositions as context change potentials is retained. (shrink)

This paper proposes a novel account of the contents of memory. By drawing on insights from the philosophy of perception, I propose a hybrid account of the contents of memory designed to preserve important aspects of representationalist and relationalist views. The hybrid view I propose also contributes to two ongoing debates in philosophy of memory. First, I argue that, in opposition to eternalist views, the hybrid view offers a less metaphysically-charged solution to the co-temporality problem. Second, I show how the (...) hybrid view conceives of the relationship between episodic memory and other forms of episodic thinking. I conclude by considering some disanalogies between perception and memory and by replying to objections. I argue that, despite there being important differences between memory and perception, those differences do not harm my project. (shrink)

Dutch book and accuracy arguments are used to justify certain rationality constraints on credence functions. Underlying these Dutch book and accuracy arguments are associated theorems, and I show that the interpretation of these theorems can vary along a range of dimensions. Given that the theorems can be interpreted in a variety of different ways, what is the status of the associated arguments? I consider three possibilities: we could aggregate the results of the differently interpreted theorems in some way, and motivate (...) rationality constraints based on this aggregation; we could be permissive, and accept the conclusions of the Dutch book and accuracy arguments under all interpretations of the associated theorems; or we could select one uniquely correct interpretation of the Dutch book or accuracy theorem, and use that to justify certain rationality constraints. I show that each possibility faces problems, and conclude that Dutch book and accuracy theorems cannot be used to justify any principle of rationality. (shrink)

Introspective knowledge by acquaintance is knowledge we have by being directly aware of our phenomenally conscious states. In this paper, I argue that introspective knowledge by acquaintance is a sui generis kind of knowledge: it is irreducible to any sort of propositional knowledge and is wholly constituted by a relationship of introspective acquaintance. My main argument is that this is the best explanation of some epistemic facts about phenomenal consciousness and introspection. In particular, it best explains the epistemic asymmetry between (...) a subject who has never had a certain phenomenal state and one who has. I also consider two theoretical objections to my claim: an objection from disunity and an objection from mysteriousness. I show that these objections can be answered and that introspective knowledge by acquaintance being sui generis remains a live option on the table. (shrink)

The psychological reality of an inner awareness built into conscious experience has traditionally been a central element of philosophy of consciousness, from Aristotle, to Descartes, Brentano, the phenomenological tradition, and early and contemporary analytic philosophy. Its existence, however, has recently been called into question, especially by defenders of so-called transparency of experience and first-order representationalists about phenomenal consciousness. In this paper, I put forward a defense of inner awareness based on an argument from memory. Roughly, the idea is that since (...) we can only recall something if we were aware of it at the time of its occurrence, and since we can recall our own experiences, we must be aware of our own experiences at the time of their occurrence. The argument is far from new: it goes back to the Buddhist tradition and has been revived more recently in Buddhist Scholarship but also in contemporary analytic philosophy of mind, in particular by Uriah Kriegel. However, I believe that, since it is the best extant argument for inner awareness, it deserves more extensive treatment. My goal is to strengthen the memory argument by making some conceptual distinctions as to the exact thesis about inner awareness that the argument is supposed to support, considering different ways the argument may be reconstructed depending on the exact thesis to be supported, and defending the argument from a new objection, raised very recently by Daniel Stoljar. Relational approaches are gaining more and more importance in philosophy of tech-nology. This brings up the critical question of how they can be implemented in applied ethics, law, and practice. In “Extremely Relational Robots: Implications for Law and Ethics”, Nancy S. Jecker (2024) comments on my article “Not Relational Enough? Towards an Eco-Relational Approach in Robot Ethics” (Puzio, 2024), in which I present a deep relational, “eco-relational approach”. In this reply, I address two of Jecker’s criticisms: in section. 3, I (...) deal with the connection of personhood and human identity with relationality, and in section. 4, I discuss the consequences of relational approaches for practical ethics and law. Unlike Jecker, I am strongly convinced that relational approaches can and should be implemented in applied ethics and law. (shrink)

Since science does not have a monopoly on value judgments, what is responsible research involving such concepts? Using measurement of wellbeing as an example, we first present the options open to researchers wishing to study phenomena denoted by such concepts. We argue that while it is possible to treat these concepts as technical terms, or to make the relevant value judgment in-house, the responsible thing to (...) do, especially in the context of public policy, is to make this value judgment through a legitimate political process that includes all the stakeholders of this research. We then develop a participatory model of measurement based on the ideal of co-production. To show that this model is feasible and realistic, we illustrate it with a case study of co-production of a concept of thriving conducted by the authors in collaboration with a UK anti-poverty charity Turn2us. Positive polarity items (PPIs) are generally thought to have the boring property that they cannot scope below negation. The starting point of the paper is the observation that their distribution is significantly more complex; specifically, someone/something-type PPIs share properties with negative polarity items (NPIs). First, these PPIs are disallowed in the same environments that license yet type NPIs; second, adding any NPI-licenser rescues the illegitimate constellation. This leads to the conclusion that these PPIs have the combined properties of yet-type and (...) ever-type NPIs: what appears to be a prohibition is nothing but “halfway licensing”. The paper goes on to propose a unification of the analyses of rescuable PPIs, NPIs, and negative concord, and questions the grounding of polarity sensitivity in the scalar or the referential semantics of the items involved. The scalar approach to negative polarity item (NPI) licensing assumes that NPIs are allowable in contexts in which the introduction of the NPI leads to proposition strengthening (e.g., Kadmon & Landman 1993, Krifka 1995, Lahiri 1997, Chierchia 2006). A straightforward processing prediction from such a theory is that NPI’s facilitate inference verification from sets to subsets. Three experiments are reported that test this proposal. In each experiment, participants evaluated whether inferences from sets to subsets were valid. Crucially, we manipulated whether (...) the premises contained an NPI. In Experiment 1, participants completed a metalinguistic reasoning task, and Experiments 2 and 3 tested reading times using a self-paced reading task. Contrary to expectations, no facilitation was observed when the NPI was present in the premise compared to when it was absent. In fact, the NPI significantly slowed down reading times in the inference region. Our results therefore favor those scalar theories that predict that the NPI is costly to process (Chierchia 2006), or other, nonscalar theories (Giannakidou 1998, Ladusaw 1992, Postal 2005, Szabolcsi 2004) that likewise predict NPI processing cost but, unlike Chierchia (2006), expect the magnitude of the processing cost to vary with the actual pragmatics of the NPI. In this paper, I develop a new version of the acquaintance view of the nature of introspection of phenomenal states. On the acquaintance view, when one introspects a current phenomenal state of one's, one bears to it the relation of introspective acquaintance. Extant versions of the acquaintance view neglect what I call the phenomenal modification problem. The problem, articulated by Franz Brentano in his Psychology from an Empirical Standpoint, is that drawing introspective attention to one's current conscious experience may modify (...) its phenomenology. Failing to take phenomenal modification into account affects the adequacy of extant versions of the acquaintance view. The purpose of this paper is to develop a better version, the integration account, that meets the phenomenal modification challenge while preserving the merits of other versions. (shrink)

Phenomenal beliefs are beliefs about the phenomenal properties of one's concurrent conscious states. It is an article of common sense that such beliefs tend to be justified. Philosophers have been less convinced. It is sometimes claimed that phenomenal beliefs are not on the whole justified, on the grounds that they are typically based on introspection and introspection is often unreliable. Here we argue that such reasoning must guard against a potential conflation between two distinct introspective phenomena, which we call fact-introspection (...) and thing -introspection; arguments for the unreliability of introspection typically target only the former, leaving the reliability of the latter untouched. In addition, we propose a theoretical framework for understanding thing -introspection that may have a surprising consequence: thing -introspection is not only reliable, but outright infallible. This points at a potential line of defense of phenomenal-belief justification, which here we only sketch very roughly. (shrink)

Modifying the descriptive and theoretical generalizations of Relativized Minimality, we argue that a significant subset of weak island violations arise when an extracted phrase should scope over some intervener but is unable to. Harmless interveners seem harmless because they can support an alternative reading. This paper focuses on why certain wh-phrases are poor wide scope takers, and offers an algebraic perspective on scope interaction. Each scopal element SE is associated with certain operations (e.g., not with complements). When a wh-phrase scopes (...) over some SE, the operations associated with that SE are performed in its denotation domain. The requisite operations may or may not be available in a domain, however. We present an empirical analysis of a variety of wh-phrases. It is argued that the wh-phrases that escape all weak islands (i.e., can scope over any intervener) are those that range over individuals, the reason being that all Boolean operations are defined for their domain. Collectives, manners, amounts, numbers, etc. all denote in domains with fewer operations and are thus selectively sensitive to scopal interveners—a “semantic relativized minimality effect”. (shrink)

Social media has transformed how individuals handle their illnesses. While many patients increasingly use these online platforms to understand embodied information surrounding their conditions, healthcare professionals often frame these practices as negative and do not consider the expertise that patients generate through social media. Through a combination of insights from social epistemology and ignorance studies, this paper problematizes the distinctive understandings of social media between patients and healthcare professionals from a different perspective. A total of four ideas are introduced: (1) (...) healthcare professionals see embodied knowledge that arises from patients’ social media practices as uncomfortable knowledge; (2) healthcare professionals engage in several behaviours to preserve their authority and power in front of embodied knowledge created through these online platforms; (3) failing to consider embodied knowledge can have consequences not only in terms of trust between patients and healthcare professionals but also in connection with epistemological populism and the transition towards patient-centred care; and (4) media and digital health literacy could help healthcare professionals enhance the uses of social media in healthcare. Adopting this framework allows not only to offer valuable insights into how healthcare professionals manage patients’ social media practices, but also opens new avenues to improve healthcare digitisation. In this Introduction we introduce the central themes of the Evaluative Perception volume. After identifying historical and recent contemporary work on this topic, we discuss some central questions under three headings: (1) Questions about the Existence and Nature of Evaluative Perception: Are there perceptual experiences of values? If so, what is their nature? Are experiences of values sui generis? Are values necessary for certain kinds of experience? (2) Questions about the Epistemology of Evaluative Perception: Can evaluative experiences ever justify evaluative (...) judgments? Are experiences of values necessary for certain kinds of justified evaluative judgments? (3) Questions about Value Theory and Evaluative Perception: Is the existence of evaluative experience supported or undermined by particular views in value theory? Richard Bradley and others endorse Reverse Bayesianism as the way to model awareness growth. I raise a problem for Reverse Bayesianism—at least for the general version that Bradley endorses—and argue that there is no plausible way to restrict the principle that will give us the right results. To get the right results, we need to pay attention to the attitudes that agents have towards propositions of which they are unaware. This raises more general questions about how awareness growth should be (...) modelled. (shrink)

Difficulty is often treated as blame-mitigating, and even exculpating. But on some occasions difficulty seems to have little or no bearing on our assessments of moral responsibility, and can even exacerbate it. In this paper, I argue that the relevance (and irrelevance) of difficulty with regard to assessments of moral responsibility is best understood via Quality of Will accounts. I look at various ways of characterising difficulty – including via sacrifice, effort, skill and ‘trying’ – and set out to demonstrate (...) that these factors are only blame-mitigating where, and to the extent that, they complicate ascriptions of insufficient concern. Matters become more complex, however, when we turn to difficult circumstances that seem to generate such objectionable attitudes. This is arguably the case with epistemic difficulty and certain instances of moral ignorance. Here I argue that certain difficult circumstances diminish the sense in which false moral beliefs are genuinely revelatory of the agents who hold them. In particular, I draw on the distinction between difficulty that generates objectionable attitudes, and objectionable attitudes that generate difficulty. I argue that the former, but not the latter, can plausibly be viewed as blame mitigating, and that this would apply to (limited) cases of moral ignorance. (shrink)

Most recent philosophical theories of consciousness account for it in terms of representation, the bulk of the debate revolving around whether (suitably) representing something is sufficient for consciousness (as per first-order representationalism) or some further (meta-)representation is needed (as per higher-order representationalism and self-representationalism). In this paper, I explore an alternative theory of consciousness, one that aims to explain consciousness not in terms of representation but in terms of the epistemically and metaphysically direct relation of acquaintance. I call this the (...) Inner Acquaintance Theory of consciousness (IAT). Roughly, on IAT, what makes a mental state conscious is its subject being acquainted with it. Though not wholly unprecedented, IAT is still at the fringe of consciousness debates and remains largely underexplored. The main goal of this paper is to take some steps toward developing the details of IAT, illustrate its potential explanatory power, and put it forward as a plausible alternative to representational theories, with the hope that this will contribute to shifting IAT closer to the center of the debate. Here is how I proceed. In §2 I introduce a notion—inner awareness—that is crucial both to contextualize and to understand IAT. In §3 I provide some preliminary motivation for exploring IAT. In §4 I explain the notion of acquaintance and illustrate some of the features that are typically attributed to it in the literature. The details of IAT are then shaped through four main decision points. I address them in §§5-8, where I suggest a particular choice at each decision point, thereby progressively building up a view that I consider particularly promising. (shrink)

In this paper I present a new way of understanding Dutch Book Arguments: the idea is that an agent is shown to be incoherent iff he would accept as fair a set of bets that would result in a loss under any interpretation of the claims involved. This draws on a standard definition of logical inconsistency. On this new understanding, the Dutch Book Arguments for the probability axioms go through, but the Dutch Book Argument for Reflection fails. In this article, we investigate how Big Tech companies have used the novel coronavirus disease (COVID-19) pandemic to increase their social, political, infrastructural, and epistemic power. We focus on four companies that were outspoken in their efforts to combat the virus: Alphabet (also known as Google), Apple, Facebook, and Amazon (GAFA). During the crisis, these companies evolved as adaptive entities that responded to the state of emergency by promptly rolling out various technological solutions, exemplifying what we call ‘pandemic solutionism’, that (...) is, the belief in the potential to solve the complex virological crisis of COVID-19 through the integration of digital tools. We identify the activities of GAFA in pandemic solutionism in five key areas that can be defined as the dominant realms of Big Tech’s involvement: (1) mapping COVID-19, (2) researching COVID-19, (3) tracing COVID-19, (4) treating COVID-19, and (5) managing COVID-19. In this context, we provide the first comprehensive overview of Big Tech’s multifaceted engagement in researching COVID-19 based on wearable technologies, which have been actively promoted as potentially beneficial tools for detecting the coronavirus since the beginning of the crisis. Additionally, through a critical mapping of the multiple activities of selected Big Tech players during the pandemic, it becomes evident how unexpected societal disruptions can lead to the increased dominance by these players. As we demonstrate, Big Tech companies have been able to present themselves as saviours capable of acting more promptly than the state, pushing pandemic solutionism and taking up tasks without being burdened by democratic deliberations. In doing so, they have manifested their infrastructural power, which frequently (such as with contact tracing) establishes the normative framework in which political and social actions take place. Our purpose is to describe the application of legitimate defense in so-called non-confrontational situations. To do this, we will conceptualize gender violence as that which against women, due to their condition as such, and we will describe the absence by the courts in the identification of this problem. Second, we will analyze the reception of Argentine and international legislation on the treatment of gender violence and the recommendations and criteria to take into account when interpreting and applying criminal law. Finally, (...) we will present the treatment of legitimate defense in contexts of gender violence, analyzing each of its elements. Our conclusions will focus on the need to address situations of gender violence based on international regulations for the application of legitimate defense in non-confrontational situations. (shrink)
