I here defend historical entitlement theories of property rights against a popular charge. This is the objection that such theories fail because no convincing account of original appropriation exists. I argue that this argument assumes a certain reading of historical entitlement theory and I spell out an alternative reading against which it misfires. On this reading, the role of acts of original appropriation is not to justify but to individuate people’s holdings. I argue that we can identify which acts count (...)

This article asks whether states have a right to close their borders because of their right to self-determination, as proposed recently by Christopher Wellman, Michael Walzer, and others. It asks the fundamental question whether self-determination can, in even its most unrestricted form, support the exclusion of immigrants. I argue that the answer is no. To show this, I construct three different ways in which one might use the idea of self-determination to justify immigration restrictions and show that each of these (...)

State legitimacy is often said to have two aspects: an internal and an external one. Internally, a legitimate state has the right to rule over its subjects. Externally, it has a right that outsiders not interfere with its domestic governance. But what is the relation between these two aspects? In this paper, I defend a conception of legitimacy according to which these two aspects are related in an importantly asymmetrical manner. In particular, a legitimate state’s external right to rule affords (...)

Most treatments of territorial rights include a discussion (and rejection) of Locke. There is a remarkable consensus about what Locke’s views were. For him, states obtain territorial rights as the result of partial transfers of people’s property rights. In this article, I reject this reading. I argue that (a) for Locke, transfers of property rights were neither necessary nor sufficient for territorial rights and that (b) Locke in fact held a two-part theory of territorial rights. I support this reading by (...)

The idea that law claims authority (LCA) has recently been forcefully criticized by a number of authors. These authors present a new and intriguing objection, arguing that law cannot be said to claim authority if such a claim is not justified. That is, these authors argue that the view that law does not have authority viciously conflicts with the view that law claims authority. I will call this the normative critique of LCA. In this article, I assess the normative critique (...)

When the natural philosopher turns to the world, he also conceives of its events as ordered in time—or lately, in space-time. Interrogating the parallels to be found in their problems and methods, I shall argue that in both cases the definiteness of the (...)

In this paper I respond to Bernd Krehoff’s article ‘Legitimate Political Authority and Sovereignty: Why States Cannot Be the Whole Story’. I criticize Krehoff’s use of Raz’s theory of authority to evaluate the legitimacy of our political institutions. Why-questions and how-possibly-questions are two common forms of explanation request. Answers to the former ones require factual assertions, but the latter ones can be answered by displaying a representation of the targeted phenomenon. However, in an extreme case, a representation could come accompanied by the assertion that it displays the only possible way a phenomenon could develop. Using several historical controversies concerning statistical modeling, it is argued that such cases must inevitably involve tacit or explicit empirical assumptions.

Does it require any sort of belief in relation to scientific theories and, if so, what sort? Is it rather typified by a certain understanding of the rationality of such beliefs? In the following dialogue we explore these questions in hopes of clarifying some convictions about what scientific realism is, and what it could or should be. En route, we (...)

I identify two versions of the scientific anti-realist’s selectionist explanation for the success of science: Bas van Fraassen’s original and K. Brad Wray’s newer interpretation. In Wray’s version, psycho-social factors internal to the scientific community – viz. scientists’ interests, goals, and preferences – explain the theory-selection practices that explain theory-success. I argue that, if Wray’s version were correct, then science should resemble art. In art, the artwork-selection practices that explain artwork-success appear faddish. They are prone to radical change over time. (...)

Bas van Fraassen’s Constructive Empiricism (CE) has been much discussed. There is, however, a curious feature of van Fraassen’s writings that has been overlooked up until now. This is that he sometimes capitalises certain key terms, notably “Induction”. This is done to differentiate a pragmatic small ‘i’ induction (which has epistemic import) from a rule-bound capital ‘I’ induction (which does not). In this paper, I argue that van Fraassen’s small letter/capital letter distinction reveals an underlying dualism, one that is reminiscent (...)

In this paper, I examine whether Chakravartty’s stance pluralism can exclude epistemic stances that licence pseudo-scientific practices like those found in Scientology. I argue that it cannot. Chakravartty’s stance pluralism is therefore prone to a form of debilitating relativism. I consequently argue that we need (1) some ground or constraint in relation to which epistemic stances can be (...)

It is argued that, contrary to prevailing opinion, Bas van Fraassen nowhere uses the argument from underdetermination in his argument for constructive empiricism. It is explained that van Fraassen’s use of the notion of empirical equivalence in The Scientific Image has been widely misunderstood. A reconstruction of the main arguments for constructive empiricism is offered, showing how the passages that have been taken to be part of an appeal to the argument from underdetermination should actually be interpreted.

  44. The Coincidentalist Reply to the No-Miracles Argument.Kenneth Boyce - 2018 - Erkenntnis 83 (5):929-946.
Proponents of the no-miracles argument contend that scientific realism is “the only philosophy that doesn’t make the success of science a miracle.” Bas van Fraassen argued, however, that the success of our best theories can be explained in Darwinian terms—by the fact they are survivors of a winnowing process in which unsuccessful theories are rejected. Critics of this selectionist explanation complain that while it may account for the fact we have chosen successful theories, it does not explain why any particular (...)

  45. Constructive Empiricism: Normative or Descriptive?Moti Mizrahi - 2014 - International Journal of Philosophical Studies 22 (4):604-616.
In this paper, I argue that Constructive Empiricism (CE) is ambiguous between two interpretations: CE as a normative epistemology of science and CE as a descriptive philosophy of science. When they present CE, constructive empiricists write as if CE is supposed to be more than a normative epistemology of science and that it is meant to be responsible to actual scientific practices. However, when they respond to objections, constructive empiricists fall back on a strictly normative interpretation of CE. This ambiguity (...)

  46. (1 other version)Expanding the Empirical Realm: Constructive Empiricism and Augmented Observation.Finnur Dellsén - forthcoming - In Michael Frauchiger (ed.), Themes from van Fraassen (Lauener Library of Analytical Philosophy). De Gruyter.
Manifestationalism holds that science aims only to give us theories that are correct about what has been observed thus far. Several philosophers, including Bas van Fraassen, have argued that manifestationalism cannot make sense of the scientific impetus to make new observations, since such observations only risk turning manifestationally adequate theories into inadequate ones. This paper argues that a strikingly similar objection applies to van Fraassen’s own constructive empiricism, the view that science aims only to find theories that are empirically adequate. (...)

  47. The Bayesian and the Abductivist.Mattias Skipper & Olav Benjamin Vassend - forthcoming - Noûs.
A major open question in the borderlands between epistemology and philosophy of science concerns whether Bayesian updating and abductive inference are compatible. Some philosophers—most influentially Bas van Fraassen—have argued that they are not. Others have disagreed, arguing that abduction, properly understood, is indeed compatible with Bayesianism. Here we present two formal results that allow us to tackle this question from a new angle. We start by formulating what we take to be a minimal version of the claim that abduction is (...)

In May 2010, philosophers, family and friends gathered at the University of Notre Dame to celebrate the career and retirement of Alvin Plantinga, widely recognized as one of the world's leading figures in metaphysics, epistemology, and the philosophy of religion. Plantinga has earned particular respect within the community of Christian philosophers for the pivotal role that he played in the recent renewal and development of philosophy of religion and philosophical theology. Each of the essays in this volume engages with some (...)

  49. Maps and Models.Rasmus Grønfeldt Winther - forthcoming - In Routledge Handbook of Philosophy of Scientific Modeling. London, UK:
Maps and mapping raise questions about models and modeling and in science. This chapter archives map discourse in the founding generation of philosophers of science (e.g., Rudolf Carnap, Nelson Goodman, Thomas Kuhn, and Stephen Toulmin) and in the subsequent generation (e.g., Philip Kitcher, Helen Longino, and Bas van Fraassen). In focusing on these two original framing generations of philosophy of science, I intend to remove us from the heat of contemporary discussions of abstraction, representation, and practice of science and thereby (...)

How far, if at all, do our intrapersonal and our interpersonal epistemic obligations run in parallel? This paper treats the question as addressing the stability of doxastic commitment in the two dimensions. In the background lies an analogy between doxastic and practical commitment. We’ll pursue the question of doxastic stability by coining a doxastic analogue of Gregory Kavka’s much-discussed toxin case. In this new case, you foresee that you will rationally abandon a doxastic commitment by undergoing a shift in the (...)
