In spite of his post-World War II works on international law, which seems more purely juridical, Hans Kelsen continues to put forward in his vast body of work an implicit – and sometimes even explicit – juridical objectivism and pacifism. Especially before and during the second World War he makes – by means of many moral-political writings – an effort for a more effective assurance of international peace. The fact that Kelsen regards the law as the pre-eminent means to achieve (...)

This interdisciplinary exploration synthesizes the philosophical reflections of Adam Kaiser with empirical insights from popular science to unravel the intricate dynamics of nostalgia, morality, and mass entertainment in a modern world increasingly disconnected from traditional values. Examining the psychological, neurobiological, and cultural aspects, the essay investigates how nostalgia serves as a potent coping mechanism, offering temporary relief from the moral complexities and existential questions of contemporary life. This paper starts from first principles of moral nihilism and determinism and arrives at a basis for morality and government which, unlike Human Rights, addresses the moral status of other species. It suggests a moral system that abandons the assumptions of objectivity, moral agency, and free will, and goes on to explore the implications of such a theory in the areas of criminal justice and government. As with any moral philosophy, it endeavors to provide a structure of principles that both (...)

  9. Much Ado About Nothing: Unmotivating "Gender Identity".E. M. Hernandez & Rowan Bell - forthcoming - Ergo: An Open Access Journal of Philosophy.
Recently, the concept of "gender identity" has enjoyed a great deal of attention in gender metaphysics. This seems to be motivated by the goal of creating trans-inclusive theory, by explaining trans people's genders. In this paper, we aim to unmotivate this project. Notions of "gender identity" serve important pragmatic purposes for trans people, such as satisfying the curiosity of non-trans people, and, relatedly, securing our access to important goods like legal rights and medical care. However, we argue that this does (...)

In this article, I examine the moral dimensions of gender affirmation. I argue that the moral value of gender affirmation is rooted in what Iris Murdoch called loving attention. Loving attention is central to the moral value of gender affirmation because such affirmation is otherwise too fragile or insincere to have such value. Moral reasons to engage in acts that gender affirm derive from the commitment to give and express loving attention to trans people as a way of challenging their (...)

Applications and devices of artificial intelligence are increasingly common in the healthcare field. Robots fulfilling some caregiving functions are not a distant future. In this scenario, we must ask ourselves if it is possible for machines to care to the extent of completely replacing human care and if such replacement, if possible, is desirable. In this paper, I argue that caregiving requires know-how permeated by affectivity that is far from being achieved by currently available machines. I also maintain that the (...)

Abstract. Following the tracks of Ryle and based upon the theory of complex systems, we shall develop a characterization of action-based consciousness as an embodied, embedded, selforganized process in which action and dispositions occupy a special place. From this perspective, consciousness is not a unique prerogative of humans, but it is spread all around, throughout the evolution of life. We argue that artificial systems such as robots currently lack the genuine embodied embeddedness that allows the type of self-organization that is (...)

  15. Arrogance Under Oppression.E. M. Hernandez - manuscript
There is a curious phenomenon where people from marginalized populations are taken to be arrogant when they show no signs of superiority. In effect, their actions are misconstrued, and their attitudes are rendered unintelligible. Given that arrogance is standardly taken to be a flaw in one’s moral character, understanding such misattributions should give us insight into the affective marginalization many people face. This talk aims to give a thorough exploration of arrogance under oppression. I argue that arrogance is a kind (...)

The concept of agency is of crucial importance in cognitive science and artificial intelligence, and it is often used as an intuitive and rather uncontroversial term, in contrast to more abstract and theoretically heavy-weighted terms like “intentionality”, “rationality” or “mind”. However, most of the available definitions of agency are either too loose or unspecific to allow for a progressive scientific program. They implicitly and unproblematically assume the features that characterize agents, thus obscuring the full potential and challenge of modeling agency. (...)

In 2035 global egg demand will have risen 50% from 1985. Because we are not able to tell in the egg whether it will become a male or female chick, billons of one day-old male chicks will be killed. International research initiatives are underway in this area, and governments encourage the development of an alternative with the goal of eliminating the culling of day-old male chicks. The Netherlands holds an exceptional position in the European egg trade, but is also the (...)

Shortages of new therapeutics to treat coronavirus disease (COVID-19) have forced clinicians, public health officials, and health systems to grapple with difficult questions about how to fairly allocate potentially life-saving treatments when there are not enough for all patients in need (1). Shortages have occurred with remdesivir, tocilizumab, monoclonal antibodies, and the oral antiviral Paxlovid (2) -/- Ensuring equitable allocation is especially important in light of the disproportionate burden experienced during the COVID-19 pandemic by disadvantaged groups, including Black, Hispanic/Latino and (...)
