This work is about current theories concerning the application of the constitutional rules, on the approach of the efficacy and effectiveness of the fundamental rights. It also suggests an alternative way of logical analysis of the problem, mainly taking in account the phenomena of the application-efficacy-effectiveness of the rules. Therefore, it discusses the dogmatic rules and proposes the logical separation between its applicability and its effectiveness, considering the effectiveness as the potential power to realize the fundamental rights.

El debate que se gestó alrededor del concepto de existencia en manos de Willard Van Orman Quine y Rudolf Carnap, dio al siglo XX un cúmulo de aportes significativos a la ontología. La postura realista, con algunas variantes, de Quine y el criterio anti-realista de Carnap, otorga insumos para pensar de mejor forma cómo se intenta dar descripciones acerca del inmobiliario del mundo. Conocer este debate es importante, ya que, se expone los alcances y limitaciones que implican las explicaciones ontológicas (...) acerca de la realidad que deben ser tenidas en cuenta en la actualidad. The study investigated the effect of cognitive restructuring on junior secondary school mathematics test anxiety in Oshimili south L.G.A of Delta State. Two research questions and two hypotheses tested at 0.05 level of significance guided the study. Quasi-experimental research design was adopted for this study. The population for this study was a total of 1224 students. These comprised of all the JSS 2 students from Oshimili South Local Government Area of Delta State. Research sample consisted of 120 JSS 2 students (...) with high level of mathematics test anxiety selected through purposive sampling technique. The instrument adopted for this study was Maths anxiety rating scale-R. Data collected from the study were analyzed using mean and ANCOVA. Results obtained from the study indicated that Cognitive restructuring therapy (CRT) was effective on mathematics test anxiety of junior secondary school students. The results equally showed that Cognitive restructuring therapy was more effective on the female students’ mathematics anxiety than their male counterparts. Furthermore, the results indicated a significant difference in the post-test mathematics test anxiety mean scores of students treated with CRT and those in the control group. Also, there was significant difference in the post-test mathematics test anxiety mean scores of male and female students treated with CRT. Based on the findings of this study, some recommendations were noted. The researcher recommended, among others that Schools’ Guidance Counselors should be empowered to make good use of the cognitive restructuring technique, in counseling students who find it difficult to comprehend mathematics skills. Background: Educated women tend to have a greater awareness of the existence of ANC services, more aware of health problems, know more about the availability of health care services, and utilize the information more effectively than non-educated women. Moreover, higher levels of education tend to positively affect healthseeking behaviors, and education may increase a woman’s control over her pregnancy and expose women to more health education messages and campaigns, enabling them to recognize danger signs and complications and take appropriate action. (...) In this study, we tried to analyze to what level the maternal education can influence the antenatal care services and childcare. Methods: A community-based cross-sectional study was conducted on 93 randomly selected mothers who have children less than 7 years by using a pre-tested structured questionnaire for data collection at various tribal villages, at an average 25 kms away from Adilabad town from April-October 2019. Analysis was done using SPSS for windows version 16, Microsoft excel and Open epi website. Results: Out of 93 study subjects, 19.3% (18) of the study subjects were not registered for the antenatal services. Higher the maternal education higher the age at pregnancy (p<0.05), was associated with more preference for deliveries by doctors (p<0.05). More the frequency of exclusive breast feeding, long lasting breast feeding was associated more than a year (p<0.05), a smaller number of children with wasting (p<0.05). Conclusion: This study revealed that utilization of ANC services was relatively better for the mother’s educated higher than secondary school, but they are still low. Educational status is important in having more health seeking behavior. In this study, it proves that health education is more important than the mere school education which can help to improve knowledge on ANC. (shrink)

Through the lens of feminist speech act theory, this paper argues that artificial intelligence romance systems objectify and subordinate nonvirtual women. AI romance systems treat their users as consumers, offering them relational invulnerability and control over their (usually feminized) digital romantic partner. This paper argues that, though the output of AI chatbots may not generally constitute speech, the framework offered by an AI romance system communicates an unjust perspective on intimate relationships. Through normalizing controlling one’s intimate partner, these systems operate (...) as speakers that rank women as non-player characters and license their oppression, which is unjust even in the absence of empirical harms. Understanding AI romance systems as speakers has implications for policymakers. First, this account helps close the so-called responsibility gap in the operation of an AI system. Second, it places these systems under the purview of institutions’ policies regarding hate speech, suggesting one avenue for arguing that these systems may violate extant policies. Finally, it provides support for the pursuit of empirical research into AI romance systems’ effects on users. (shrink)

The COVID-19 pandemic revealed numerous weaknesses in pandemic preparedness and response, including underfunding, inadequate surveillance, and inequitable distribution of countermeasures. To overcome these weaknesses for future pandemics, WHO released a zero draft of a pandemic treaty in February, 2023, and subsequently a revised bureau's text in May, 2023. COVID-19 made clear that pandemic prevention, preparedness, and response reflect choices and value judgements. These decisions are therefore not a purely scientific or technical exercise, but are fundamentally grounded in ethics. The latest (...) treaty draft reflects these ethical considerations by including a section entitled Guiding Principles and Approaches. Most of these principles are ethical—they establish core values that undergird the treaty. Unfortunately, the treaty draft's set of principles are numerous, overlapping, and show inadequate coherence and consistency. We propose two improvements to this section of the draft pandemic treaty. First, key guiding ethical principles should be clearer and more precise than they currently are. Second, the link between ethical principles and policy implementation should be clearly established and define boundaries on acceptable interpretation, ensuring that signatories abide by these principles. By considering the movies in the Marvel Cinematic Universe as a case study, I bring Tolkien’s explication of mythopoesis in “On Fairy Stories” to bear on the current popularity of superhero films to argue that such works qualify as cinematic examples of Tolkienesque fantasy tales. After summarizing Tolkien’s criteria for the genre in Nietzschean aesthetic terms, I both demonstrate how the builders of the MCU have crafted a sub-created fictional world and defend the existence of fairy stories in visual media (...) from Tolkien’s own criticism of such a possibility. Within the philosophy of language, contextualists typically hold (and semantic minimalists deny) that pragmatic elements of an utterance can affect its semantic content. This paper concretizes this debate by analogizing both positions to different kinds of time-travel stories: contextualism is akin to Ludovician narratives that deny the possibility of temporal editing (or “the changing of past events”) while semantic minimalism is aligned with stories that allow the past to be literally altered. By focusing particularly on Denis Villeneuve’s 2016 film Arrival, (...) which portrays a Ludovician model of temporality that firmly denies the possibility of temporal editing, this paper defends the strength of the contextualist position. Although Disney films are sometimes denigrated as popular or “low” art forms, this article argues that they often engage deeply with, and thereby communicate, significant moral truths. The capitalistic enterprise of contemporary modern cinema demands that cinematic moral pedagogy be sublimated into non-partisan forms, often by substituting secular proxies for otherwise divine or spiritual components. By adapting Søren Kierkegaard’s tripartite existential anthropology of the self, I analyze the subjective experiences of the protagonists in three recent animated fairy tales—Disney’s Frozen, Moana, (...) and Tangled—to demonstrate how these princess movies bridge the imaginative gap between the mundane and the divine. In 1906, Henry Stephens Salt published a short collection of essays that presented several rhetorically powerful, if formally deficient arguments for the vegetarian position. By interpreting Salt as a moral sentimentalist with ties to Aristotelian virtue ethics, I propose that his aesthetic argument deserves contemporary consideration. First, I connect ethics and aesthetics with the Greek concepts of kalon and kalokagathia that depend equally on beauty and morality before presenting Salt’s assertion: slaughterhouses are disgusting, therefore they should not be promoted. I (...) suggest three areas of development since Salt’s death that could be fruitfully plumbed to rebuild this assertion into a contemporary argument: an updated analysis of factory farm conditions, insights from moral psychologists on the adaptive socio-biological benefits of disgust as a source of cognitive information, and hermeneutical considerations about the role of the audience that allow blameworthiness for slaughterhouse atrocities to be laid upon the meat-eater. Bernard Williams argues that human mortality is a good thing because living forever would necessarily be intolerably boring. His argument is often attacked for unfoundedly proposing asymmetrical requirements on the desirability of living for mortal and immortal lives. My first aim in this paper is to advance a new interpretation of Williams' argument that avoids these objections, drawing in part on some of his other writings to contextualize it. My second aim is to show how even the best version of (...) his argument only supports a somewhat weaker thesis: it may be possible for some people with certain special psychological features to enjoy an immortal life, but no one has good reason to bet on being such a person. According to Thomas Aquinas, what distinguishes the theological from the cardinal virtues is the nature of their object: the latter aim at the natural excellence of humans, while the former direct us beyond ourselves to focus on the Divine. This paper considers the cinematic work of Drew Goddard — in particular, his 2018 film _Bad Times at the El Royale_ — as a post-religious response to Aquinas, insofar as it retains and re-presents Faith, Hope, and Love as valuable elements of (...) the human experience itself, even in the absence of a supernatural vector of their application. After the fashion of Caputo’s Derrida, I offer a religionless interpretation of each of the three theological virtues and show how _Bad Times_ itself deconstructs the roles of ‘god’ and ‘human,’ interchanging them in a way that manifests a “religionless religion” wherein the theological virtues can remain vibrant, even without the theological structure that might be expected to undergird them. In short: _Bad Times at the El Royale_ demonstrates how even if God is dead, Faith, Hope, and Love are not. (shrink)

ABSTRACT Objectives There is little research on moral uncertainties and distress of palliative and hospice care providers (PHCPs) working in jurisdictions anticipating legalising voluntary assisted dying (VAD). This study examines the perception and anticipated concerns of PHCPs in providing VAD in the State of Queensland, Australia prior to legalisation of the practice in 2021. The findings help inform strategies to facilitate training and support the health and well-being of healthcare workers involved in VAD. Design The study used a qualitative approach (...) to examine and analyse the perception and anticipated concerns of PHCPs regarding challenges of providing assisted dying in Queensland. Fourteen PHCPs were recruited using a purposive sampling strategy to obtain a broad representation of perspectives including work roles, geographical locations and workplace characteristics. Data were collected via one in-depth interview per participant. The transcripts were coded for patterns and themes using an inductive analysis approach following the tradition of Grounded Theory. Setting The study was conducted in hospital, hospice, community and residential aged care settings in Queensland, Australia. These included public and private facilities, secular and faith-based facilities, and regional/rural and urban facilities. Participants Interviews were conducted with fourteen PHCPs: 10 nurses and 4 physicians; 11 female and 3 male. The median number of years of palliative care practice was 17, ranging from 2 to 36 years. For inclusion, participants had to be practising palliative and hospice care providers. Results PHCPs are divided on whether VAD should be considered part of palliative care. Expectations of moral distress and uncertainty about practising VAD were identified in five areas: handling requests, assessing patient capacity, arranging patient transfers and logistical issues, managing unsuccessful attempts, and dealing with team conflicts and stigma. Conclusions The possibility of having to practise VAD causes moral distress and uncertainty for some PHCPs. Procedural clarity can address some uncertainties; moral and psychological distress, however, remains a source of tension that needs support to ensure ongoing care of both patients and PHCPs. The introduction of VAD post-legalisation may present an occasion for further moral education and development of PHCPs. (shrink)

This paper assesses the aesthetic components of the experience of forgiveness to develop a procedural model of the phenomenological process that negotiates cognitive judgments and understanding with emotional affective states. By bringing the Greek concepts of kalokagathia and eudaimonia into conversation with Ricoeur’s “solicitude,” I suggest that the impetus for engaging in the process of forgiveness is best understood narratively as the pursuit of a life well lived (in terms of beauty). It is commonly assumed that personalization technologies used by Google for the purpose of tailoring search results for individual users create filter bubbles, which reinforce users’ political views. Surprisingly, empirical evidence for a personalization-induced filter bubble has not been forthcoming. Here, we investigate whether filter bubbles may result instead from a searcher’s choice of search queries. In the first experiment, participants rated the left-right leaning of 48 queries (search strings), 6 for each of 8 topics (abortion, benefits, climate change, sex (...) equality, immigration, nuclear family, Islam, and taxation). An independent sample of participants were then asked to select one of these queries for each of the 8 topics. With the exception of the topic of Islam, participants were significantly more likely to select a query corresponding to their own political leaning, compared to other queries, explaining between 12% and 39% of the variance. A second experiment investigated the effect of the political leaning of the same queries on the overall political leaning of Search Engine Result Pages (SERPs) in Google Search. The top six results of each SERP were rated collectively by a third group of participants, explaining 36.3% of the variance across all 48 search terms (p < .00001). That is, (1) participants in our experiments tended to select own-side search queries, and (2) using those queries tended to yield own-side search results when using the Google search engine. Our results are consistent with the notion of a self-imposed filter bubble in which query selection plays a salient role. (shrink)

IPCC SPECIAL REPORT ON CLIMATE CHANGE AND LAND (SRCCL) -/- Chapter 3: Climate Change and Land: An IPCC special report on climate change, desertification, land degradation, sustainable land management, food security, and greenhouse gas fluxes in terrestrial ecosystems.

The paper proposes an anthropocentric argument for veganism based on a speciesistic premise that most carnists likely affirm: human flourishing should be promoted. I highlight four areas of human suffering promoted by a carnistic diet: (1) health dangers to workers (both physical and psychological), (2) economic dangers to workers, (3) physical dangers to communities around slaughterhouses, and (4) environmental dangers to communities-at-large. Consequently, one could ignore the well-being of non-human animals and nevertheless recognize significant moral failings in the current standard (...) system of meat production. (shrink)

I argue that a comprehensive ontological assessment of the beatific vision suggests that an individual’s experience of God’s face is not merely dependent on a revelation of the divine energies, but that it requires a particular mode of reception on the part of the blessed individual grounded in the reality of their faith; lacking faith, what would otherwise be experienced as the blessed vision of God is instead received as a torturous punishment. Therefore, I contend that the beatific vision is (...) one of two possible phenomena resultant from seeing God’s face; the other is more commonly labeled “hellfire.” Consequently, the often-assumed bifurcated landscape of the Afterlife (into a Heaven suffused with God’s presence and a Hell deprived of it) must be reassessed. Skepticism is one of the most enduring and profound of philosophical problems. With its roots in Plato and the Sceptics to Descartes, Hume, Kant and Wittgenstein, skepticism presents a challenge that every philosopher must reckon with. Purpose Prescription stimulant use as “cognitive enhancers” has been described among undergraduate college students. However, the use of prescription stimulants among future health care professionals is not well characterized. This study was designed to determine the prevalence of prescription stimulant misuse among students at an academic health sciences center. -/- Method Electronic surveys were e-mailed to 621 medical, pharmacy, and respiratory therapy students at East Tennessee State University for four consecutive weeks in fall 2011. Completing the survey was voluntary and (...) anonymous. Surveys asked about reasons for, frequency of, and side effects of nonprescription misuse of prescription stimulants. Given the sensitive material, an opportunity to win one of ten $50 gift cards was used as an incentive. -/- Results Three hundred seventy-two (59.9%) students completed the survey from three disciplines (47.6% medical, 70.5% pharmacy, and 57.6% respiratory therapy). Overall, 11.3% of responders admitted to misusing prescription stimulants. There was more misuse by respiratory therapy students, although this was not statistically significant (10.9% medicine, 9.7% pharmacy, 26.3% respiratory therapy; P = .087). Reasons for prescription stimulant misuse included to enhance alertness/ energy (65.9%), to improve academic performance (56.7%), to experiment (18.2%), and to use recreationally/get high (4.5%). -/- Conclusions Prescription stimulant misuse was prevalent among participating students, but further research is needed to describe prevalence among future health care workers more generally. The implications and consequences of such misuse require further study across professions with emphasis on investigating issues of academic dishonesty (e.g., “cognitive enhancement”), educational quality, and patient safety or health care quality. Much recent academic literature on the afterlife has been focused on the justice of eternity and whether a good God could allow a person to experience eternal suffering in Hell. Two primary escapes are typically suggested to justify never-ending punishment for sinners: the traditional view focuses the blame for an individual’s condemnation away from God onto the sinner’s freely chosen actions; the universalist position denies the eternality of the punishment on the grounds that God’s inescapable love and eventual victory over (...) evil will bring all souls into His presence. I propose a third option that hinges on the possibility of Heaven itself being experienced as eternal punishment to demonstrate that if God’s presence is both the blessedness of Heaven for some and the agony of Hell for others, then the biblical affirmation of the universal restoration of all with the eternal punishment of some need not remain paradoxical. Smell 'sensations' are among the most mysterious of conscious experiences, and have been cited in defense of the thesis that the character of perceptual experience is independent of the physical events that seem to give rise to it. Here we review the scientific literature on olfaction, and we argue that olfaction has a distinctive profile in relation to the other modalities, on four counts: in the physical nature of the stimulus, in the sensorimotor interactions that characterize its use, in the (...) structure of its intramodal distinctions and in the functional role that it plays in people's behaviour. We present two thought experiments in which we detail what would be involved in transforming sounds into smells, and also smells into colours. Through these thought-experiments, we argue that the experiential character of smell derives precisely from the structural features of olfaction, and that an embodied account of olfactory phenomenology is called for. This chapter summarizes Augustine’s often-neglected aesthetic theodicy that balances his metaphysical definitions of evil and human agency against the ultimately beautiful story Augustine sees God, as the author of all Creation, writing. First, Augustine’s neo-Platonic conception of evil as the “privation of goodness” is explained which effectively eliminates much of the apparent evil in the world under the guise of a preeminent God’s loving care of the Creation which He fashions as good, but is later corrupted. Secondly, Augustine’s conception of (...) the nature of this corruption at the hands of free agents is laid out with a particular sensitivity to the apparent shifts in Augustine’s thought as he aged. Finally, Augustine’s foundational aesthetic themes of contrast and universal harmony (in Greek, pankalia) are explained to demonstrate precisely why, in Augustine’s words, God might “judge it better to bring good out of evil than to allow nothing evil to exist.”. The National Center for Biomedical Ontology is now in its seventh year. The goals of this National Center for Biomedical Computing are to: create and maintain a repository of biomedical ontologies and terminologies; build tools and web services to enable the use of ontologies and terminologies in clinical and translational research; educate their trainees and the scientific community broadly about biomedical ontology and ontology-based technology and best practices; and collaborate with a variety of groups who develop and use ontologies and (...) terminologies in biomedicine. The centerpiece of the National Center for Biomedical Ontology is a web-based resource known as BioPortal. BioPortal makes available for research in computationally useful forms more than 270 of the world's biomedical ontologies and terminologies, and supports a wide range of web services that enable investigators to use the ontologies to annotate and retrieve data, to generate value sets and special-purpose lexicons, and to perform advanced analytics on a wide range of biomedical data. In this paper we focus our attention on tableau methods for propositional interval temporal logics. These logics provide a natural framework for representing and reasoning about temporal properties in several areas of computer science. However, while various tableau methods have been developed for linear and branching time point-based temporal logics, not much work has been done on tableau methods for interval-based ones. We develop a general tableau method for Venema's \cdt\ logic interpreted over partial orders (\nsbcdt\ for short). It combines (...) features of the classical tableau method for first-order logic with those of explicit tableau methods for modal logics with constraint label management, and it can be easily tailored to most propositional interval temporal logics proposed in the literature. We prove its soundness and completeness, and we show how it has been implemented. (shrink)

During the Winter of 2011 I visited SADAF and gave a series of talks based on the central chapters of my manuscript on the Yablo paradox. The following year, I visited again, and was pleased and honored to find out that Eduardo Barrio and six of his students had written ‘responses’ that addressed the claims and arguments found in the manuscript, as well as explored new directions in which to take the ideas and themes found there. These comments reflect my (...) thoughts on these responses (also collected in this issue), as well as my thoughts on further issues that arose during the symposium that was based on the papers and during the many hours I spent talking and working with Eduardo and his students. Durante el invierno de 2011, visité SADAF y dí una serie de conferencias sobre los capítulos centrales de mi manuscrito sobre la paradoja de Yablo. El año siguiente, visité Buenos aires nuevamente y tuve el placer y el honor de descubrir que Eduardo Barrio y seis de sus estudiantes habían escrito respuestas que abordan las afirmaciones y argumentos de mi manuscrito, además de explorar nuevas direcciones en las cuales considerar las ideas y temas encontrados allí. Habermas emphasizes the importance for critical thinking of ideas of truth and moral validity that are at once context-transcending and immanent to human practices. in a recent review, Peter Dews queries his distinction between metaphysically construed transcendence and transcendence from within, asking provocatively in what sense Habermas does not believe in God. I answer that his conception of “God” is resolutely postmetaphysical, a god that is constructed by way of human linguistic practices. I then give three reasons for why it (...) should not be embraced by contemporary critical social theory. First, in the domain of practical reason, this conception of transcendence excludes by fiat any “Other” to communicative reason, blocking possibilities for mutual learning. Second, due to the same exclusion, it risks reproducing an undesirable social order. Third, it is inadequate for the purposes of a critical theory of social institutions. (shrink)

There is broad agreement that child labor is wrong and should be eliminated. This chapter examines the three main moral objections to child labor and considers their limitations: harm-based objections, objections from failing to benefit children, and objections from exploitation. Harm-based objections struggle with baselines for comparison and difficulties with Non-Identity problems. Even if child labor is not harmful, it may be wrong because it prevents children from enjoying other benefits, such as schooling. However, is schooling necessarily more beneficial for (...) children than work? Some kinds of child labor may not be harmful, and may benefit children, but they may still be wrong because they are exploitative. I consider some ways to address exploitative child labor, inspired by campaigns led by child workers. The chapter ends with a surprising conclusion that challenges the broad consensus with which we began: we may have duties to promote child labor. (shrink)

The educational setting has changed when pandemic forced everyone to take a reset. The change also known as transition from one modality to another paves the way to surface different stressors and tensions among the teachers and learners. In the literature, little attention was given to the teachers who experienced transition from the change of modality as more research studies focused on the learners’ academic performance. This study used a Heideggerian Phenomenology research design in explicating the lived experiences of the (...) teachers exposed in the transition from modular instruction to face-to-face classes. Interpretative Phenomenological Analysis (IPA) popularized by Moustakas and modified by Van Kaam was used in analyzing the authentic experiences of the participants. There were 8 participants in this study when the data saturation was reached. Semi-structured questionnaire was utilized in conducting the interview. There are four emerging themes generated – The Defect, The Struggles, Pedagogical Challenges, and the Inevitable Stressors. These themes are clear manifestations of how teachers are surviving and thriving in these trying times. It is expedient to create management plans that can alleviate the teachers’ circumstances which can make them ready in transitioning to any mode of teaching.The educational setting has changed when pandemic forced everyone to take a reset. The change also known as transition from one modality to another paves the way to surface different stressors and tensions among the teachers and learners. In the literature, little attention was given to the teachers who experienced transition from the change of modality as more research studies focused on the learners’ academic performance. This study used a Heideggerian Phenomenology research design in explicating the lived experiences of the teachers exposed in the transition from modular instruction to face-to-face classes. For Martin, the right to free higher education may be claimed only by those ready and willing pursue autonomy supporting higher education. The unready and unwilling, among whom may be counted carers, disabled, and devout, are excluded. This is unjust. I argue that this injustice follows from a tension between three elements of Martin’s argument: (1) a universal right to autonomy supporting higher education; (2) qualifications on entitlements to access this right in order to preserve the value of higher educational (...) goods; (3) luck egalitarian motivations in Martin’s distributive ethics. I consider options for avoiding such injustices and their implications for Martin’s argument. (shrink)

Beginning with a study of the way in which meaning is mediated in television commercials, the book concludes with in-depth readings of Disney's Fantasia, Madonna's video Material Girl, and Armide (Godard's sequence from the collaborative film Aria). Williams, Elster and Pears hold that an effort to induce in oneself a belief in the truth of some proposition that one believes to be false can succeed only if one manages, somewhere along the way, to forget that one is engaged in such an effort. Although this view has strong intuitive appeal, it is false, and in this paper it is shown to be false by example.

Recreational Drugs European Network (ReDNet) project aims to use the Psychonaut Web Mapping Project database (Psychonaut Web Mapping Group, 2009) containing novel psychoactive compounds usually not mentioned in the scientific literature and thus unknown to clinicians as a unique source of information. The database will be used to develop an integrated ICT prevention approach targeted at vulnerable individuals and focused on novel synthetic and herbal compounds and combinations. Particular care will be taken in keeping the health professionals working directly with (...) young people showing problematic behaviors regularly updated in terms of novel compounds and combinations as well. A user-friendly project website will be developed aimed primarily at delivering the information/prevention approaches, but will also be a way of communicating with project partners and relevant stakeholders (e.g. thematic forum facilities, instant messages, blogs, video chat, wikiblog, newsletters distributed via mailing list). The website will support various ICT prevention tools, including an SMS alert service. Different areas and sections will be aimed specifically at the different target groups. -/- . (shrink)

Driven by technological innovations, newborn screening (NBS) panels have been expanded and the development of genomic NBS pilot programs is rapidly progressing. Decisions on disease selection for NBS are still based on the Wilson and Jungner (WJ) criteria published in 1968. Despite this uniform reference, interpretation of the WJ criteria and actual disease selection for NBS programs are highly variable. A systematic literature search [PubMED search “Wilson” AND “Jungner”; last search 16.07.22] was performed to evaluate the applicability of the WJ (...) criteria for current and future NBS programs and the need for adaptation. By at least two reviewers, 105 publications (systematic literature search, N = 77; manual search, N = 28) were screened for relevant content and, finally, 38 publications were evaluated. Limited by the study design of qualitative text analysis, no statistical evaluation was performed, but a structured collection of reported aspects of criticism and proposed improvements was instead collated. This revealed a set of general limitations of the WJ criteria, such as imprecise terminology, lack of measurability and objectivity, missing pediatric focus, and absent guidance on program management. Furthermore, it unraveled specific aspects of criticism on clinical, diagnostic, therapeutic, and economical aspects. A major obstacle was found to be the incompletely understood natural history and phenotypic diversity of rare diseases prior to NBS implementation, resulting in uncertainty about case definition, risk stratification, and indications for treatment. This gap could be closed through the systematic collection and evaluation of real-world evidence on the quality, safety, and (cost-)effectiveness of NBS, as well as the long-term benefits experienced by screened individuals. An integrated NBS public health program that is designed to continuously learn would fulfil these requirements, and a multi-dimensional framework for future NBS programs integrating medical, ethical, legal, and societal perspectives is overdue. Misinformation can have significant societal consequences. For example, misinformation about climate change has confused the public and stalled support for mitigation policies. When people lack the expertise and skill to evaluate the science behind a claim, they typically rely on heuristics such as substituting judgment about something complex (i.e. climate science) with judgment about something simple (i.e. the character of people who speak about climate science) and are therefore vulnerable to misleading information. Inoculation theory offers one approach to effectively neutralize (...) the influence of misinformation. Typically, inoculations convey resistance by providing people with information that counters misinformation. In contrast, we propose inoculating against misinformation by explaining the fallacious reasoning within misleading denialist claims. We offer a strategy based on critical thinking methods to analyse and detect poor reasoning within denialist claims. This strategy includes detailing argument structure, determining the truth of the premises, and checking for validity, hidden premises, or ambiguous language. Focusing on argument structure also facilitates the identification of reasoning fallacies by locating them in the reasoning process. Because this reason-based form of inoculation is based on general critical thinking methods, it offers the distinct advantage of being accessible to those who lack expertise in climate science. We applied this approach to 42 common denialist claims and find that they all demonstrate fallacious reasoning and fail to refute the scientific consensus regarding anthropogenic global warming. This comprehensive deconstruction and refutation of the most common denialist claims about climate change is designed to act as a resource for communicators and educators who teach climate science and/or critical thinking. We analyse Peirce's original idea concerning abduction from the perspective of a critical philosophy, the same philosophy in Peirce's background. Peirce's realism is directly related to reason and experience and has ties with the idea of abstraction. We show how the philosophical environment of science abruptly changed, specially for physics, in the last period of the XIX century and the initial period of the XX century, when science was divided in disciplines and set free from the control of philosophy. The (...) phenotype of the physicist changed from abstract into imaginative thinker. Further, abstraction was linked to metaphysics and attacked as such. Elements of phantasy and dogmatism entered the scene in place of abstraction alongside ideas taken from the observable world. We provide evidence that the scientists of the newer kind had problems understanding those of the older school. As a consequence of the problems arisen in conciliating the idea of science grounded in experience and reason with the science actually practised, the former conceptualisation was abandoned. Abduction was then expelled from science. In the late part of the XX century and the early part of our century abduction re-emerged but without its scientific attributes. -/- Influenced by a constructivist, Piagetian, perspective of science, we propose and discuss a small number of conditions that we identify as characteristics of rational abduction: rules for the rational construction of theories. We show how a classical example of belief that satisfies today's most common definition of abduction does not match the standards of scientific retroduction. We further show how the same rules indicate the detachment of Special Relativity from the observable world, a fact actually known to Einstein. Finally, the same rules indicate the initial point in the path to re-conciliate Electromagnetism with the classical view of spatial relations, a matter not possible for the imaginative scientist but not extremely difficult for the abstract scientist. We close arguing that there is an urgent need to develop a critical epistemology, and to give room in science for the abstract scientist. (shrink)

There is growing interest in the use of technology to enhance the tracking and quality of clinical information available for patients in disaster settings. This paper describes the design and evaluation of the Wireless Internet Information System for Medical Response in Disasters (WIISARD).

Impulse and momentum are basic concepts of mechanics introduced in the K to 12 curricula. Despite its basic concepts, students still have difficulties understanding the topic, especially when they are out of school due to the pandemic. After reopening the gates for face–to–face classes in the Philippines, the researchers found a significant reason to conduct a lesson study to improve teaching strategies on the topic. Lesson study is a development process wherein teachers work collaboratively to improve teachers teaching capacity. This (...) study was conducted at Plaridel National High School with 23 participants from Grade 9 Newton (Set A and B). The research was conducted in two cycles using a four – phase lesson study. The research lesson was implemented using a 4A Model lesson plan and the results were taken from the analysis of the lesson study observation sheets, along with the class proficiency level. The researchers used the following strategies to improve teaching, namely; (1) showing mastery of subject matter, (2) reviewing basic mathematical operations, (3) contextualizing the lesson, (4) allowing students to answer questions in mother tongue, (5) using collaborative activities, (6) giving rewards, and (7) applying proper time management. However, the findings still showed that both sets of students achieved beginning proficiency level. Despite the implementation of these strategies, the students still lack basic knowledge of the topic and mathematical operations, and they struggle to understand it. Thus, it is recommended to plan the lesson effectively, utilize other research instruments, and collect feedback from the students. (shrink)

Cardiotocography data uncertainty is a critical task for the classification in biomedical field. Constructing good and efficient classifier via machine learning algorithms is necessary to help doctors in diagnosing the state of fetus heart rate. *e proposed neutrosophic diagnostic system is an Interval Neutrosophic Rough Neural Network framework based on the backpropagation algorithm. It benefits from the advantages of neutrosophic set theory not only to improve the performance of rough neural networks but also to achieve a better performance than the (...) other algorithms. *e experimental results visualize the data using the boxplot for better understanding of attribute distribution. *e performance measurement of the confusion matrix for the proposed framework is 95.1, 94.95, 95.2, and 95.1 concerning accuracy rate, precision, recall, and F1-score, respectively. WEKA application is used to analyse cardiotocography data performance measurement of different algorithms, e.g., neural network, decision table, the nearest neighbor, and rough neural network. *e comparison with other algorithms shows that the proposed framework is both feasible and efficient classifier. Additionally, the receiver operation characteristic curve displays the proposed framework classifications of the pathologic, normal, and suspicious states by 0.93, 0.90, and 0.85 areas that are considered high and acceptable under the curve, respectively. Improving the performance measurements of the proposed framework by removing ineffective attributes via feature selection would be suitable advancement in the future. Moreover, the proposed framework can also be used in various real-life problems such as classification of coronavirus, social media, and satellite image. (shrink)

‘Feminist logic’ may sound like an impossible, incoherent, or irrelevant project, but it is none of these. We begin by delineating three categories into which projects in feminist logic might fall: philosophical logic, philosophy of logic, and pedagogy. We then defuse two distinct objections to the very idea of feminist logic: the irrelevance argument and the independence argument. Having done so, we turn to a particular kind of project in feminist philosophy of logic: Valerie Plumwood's feminist argument for a relevance (...) logic. Plumwood's work serves as our primary case study as we turn to the project of considering three different ways we might understand her argument and revisionist arguments like it: as a priori theorizing, as ameliorative conceptual engineering, or as instances of anti-exceptionalist approaches to logic. After arguing that the anti-exceptionalist approach seems to provide the most promising means of understanding the kind of project undertaken in a feminist challenge to classical logic, we briefly address the consequences that this might have for logic instruction. Here, we argue for the perhaps unexpected conclusion that feminist programs ought to offer more, not less, instruction in logic for those who take interest. (shrink)

It is usually accepted that whether or not indirect discrimination is a form of immoral discrimination, it appears to be structurally different from direct discrimination. First, it seems that either one involves the agent focusing on different things while making a decision. Second, it seems that the victim’s group membership is relevant to the outcomes of either sort of action in different ways. In virtue of these two facts, it is usually concluded that indirect discrimination is structurally different from direct (...) discrimination. I argue against the notion that indirect discrimination and direct discrimination have significantly different structures. I first argue that both kinds of discrimination involve similar decision-making processes. Second, I analyze how being in a social group affects personal identity, and from there argue that indirect discrimination and direct discrimination are about group membership similarly. In virtue of these two arguments, I conclude that direct and indirect discrimination are structurally similar. (shrink)

If a problem is the collision between a system and a fact, Spinozism and German idealism’s greatest problem is the corpse. Life’s end is problematic for the denial of death’s qualitative difference from life and the affirmation of nature’s infinite purposiveness. In particular, German idealism exemplifies immortalism – the view that life is the unconditioned condition of all experience, including death. If idealism cannot explain the corpse, death is not grounded on life, which invites mortalism – the view that death (...) is the unconditioned condition of experience. In “Philosophical Letters,” Schelling critiques idealism, arguing that death symbolizes the regulative ideal of a philosophical system’s derivation, our striving for which unifies our rational activity. I interpret Schelling’s critique as explaining how death puts philosophy into question, an idea he develops in the Freedom essay and Berlin lectures. Death is not a problem to be solved by a system, but represents philosophy’s highest yet unrealizable end. (shrink)

This paper asks what Spinoza could have meant -- and what his landlady would have thought he meant. She was asking about salvation of a certain kind -- a kind that Spinoza did not in fact believe to be possible. When he talks about salvation in his writings, he has in mind a different kind of salvation -- one that his landlady will (...) certainly not achieve "in her faith." So, when he assured her that she could be saved in her faith was he simply lying to her? This question is explored against the background of the controversies regarding Spinoza's sincerity in the Tractatus Theologico-politicus. (shrink)

O valor nutritivo do leite de ovelha é superior quando comparado aos leites caprino e bovino, apresentando maior teor proteico, lipídico, minerais e vitaminas. Os humanos evoluíram em estreito contato com a natureza, sendo o leite a primeira fonte de alimento desta espécie ao nascer. Durante milhares de anos, o leite rico em nutrientes, como fonte de alimento, era unicamente materno e só veio a ser consumido pelo homem após idade de amamentação com a domesticação dos animais, primeiramente às ovelhas (...) e as cabras há aproximadamente 13 mil anos, seguido da domesticação das vacas quatro mil anos depois. Desde então o leite tornou-se um alimento indispensável para o homem. O valor nutritivo do leite de ovelha é superior quando comparado aos leites caprino e bovino, apresentando maior teor proteico, lipídico, minerais e vitaminas essenciais para a saúde humana. Este leite apresenta três vezes mais proteínas em relação ao leite de cabra e de vaca, sendo aquelas consideradas proteínas de alto valor biológico contribuindo para uma melhor digestibilidade. Outra característica é a conformação estrutural e a quantidade de micelas de caseína e suas subunidades, que são assim como o leite caprino, menores que as do leite bovino, proporcionando menor sensibilização às pessoas alérgicas. Estudos sugerem que o leite de ovelha pode ser considerado o substituto ideal do leite bovino para pessoas alérgicas ao leite bovino devido ao elevado teor dos principais componentes do leite e minerais. Entretanto, foi verificado que anticorpos IgE de pessoas alérgicas reconhecem as αS1-caseína, αS2-caseína e β-caseína de leite ovino e caprino, mas caseínas do leite bovino são raramente ou não reconhecidas. Além disso, os polimorfismos genéticos das proteínas do leite estão associados com os parâmetros quantitativos e qualitativos e desempenham um papel importante na indução de diferentes graus de reação alérgica. A coloração do leite de ovelha é intensamente branca e homogênea, o que o difere do leite de vaca, pois essa característica está associada à ausência de β-caroteno pigmento precursor do retinol (vitamina A) impedindo que o leite tenha coloração amarelada como no caso do leite bovino. No leite ovino, o β-caroteno apresenta-se na forma convertida da vitamina A que não possui coloração amarelada e essa característica possibilita a produção de diferentes variedades de queijo. A caseína no leite de ovelha compõe 80% do total de proteínas do leite dos ruminantes, enquanto que está presente em 50% da composição proteica do leite equino e em menor porcentagem no leite humano. A caseína do leite de ruminantes difere com relação às características de tamanho, hidratação e mineralização. As micelas de caseína do leite de ovelha possuem maior mineralização e menor hidratação, sendo mais estáveis ao aquecimento quando comparadas à micela de caseína do leite de vaca. Outra importante característica refere-se à conformação molecular e sequencial de aminoácidos com impacto sobre sua digestibilidade, qualidade nutricional e termoestabilidade proteica. As proteínas do leite de ovelha consistem em elevada quantidade de caseínas (resistente ao calor) e proteínas do soro (sensível ao calor) responsáveis pela textura e viscosidade de iogurtes. Tecnologicamente, elas têm propriedades únicas que permitem a fácil conversão do leite em iogurte e queijos, não sendo necessária a adição de sólidos na produção do iogurte, como leite em pó, ou concentração dos sólidos do leite por tecnologia de membrana. Estudos com variantes da caseína do leite ovino representam uma abordagem eficaz para identificar a associação de características de importância econômica e melhorar raças para a produção de proteína do leite específica. As características da caseína no leite de ovelha são particularmente interessantes devido ao número elevado de polimorfismo, alterando a expressão de genes e influenciando o processamento de queijos. Em adição, enzimas presente no leite de ovelha possui atividade proteolítica e lipolítica (quebra de proteínas e lipídios). Elas auxiliam na maturação de queijos - resultando em compostos de aroma e sabor típicos, tornando-os únicos em suas características. O sabor e o aroma do leite de ovelha são suaves e adocicados além de possuir uma textura cremosa devido aos pequenos glóbulos de gordura que apresentam tamanhos menores que 3,5 µm. Esta peculiaridade no tamanho dos glóbulos gordurosos do leite ovino propicia que esse seja digerido mais facilmente. O leite ovino apresenta também altas concentrações de ácidos graxos poli-insaturados com benefícios à saúde como isômeros de ácido linoleico conjugado (CLA) presentes em maior concentração nesta matriz comparado ao leite bovino que são o cis-9 trans-11 e o trans-10 cis-12, responsáveis por ações anticarcinogênica, antiaterogênico e antiobesidade. Ainda com relação aos lipídios do leite de ovelha, as lipases têm um papel importante na produção de leite na glândula mamária. As lipases naturais do leite catalisam e hidrolisam os triglicerídeos, produzindo ácidos graxos livres (AGL). A atividade das lipases, em leite ovino, é cerca de um décimo das do leite bovino. Além disso, o padrão de hidrólise da gordura de leite por ovinos apresenta maior taxa em relação aos triglicerídeos - contendo ácidos graxos de cadeia média em relação aos ácidos graxos de cadeia longa. Os níveis de AGL em queijos de leite ovino são o resultado do processo lipolítico que ocorre durante o período de maturação. Alguns produtos lácteos derivados usando como matéria-prima o leite de ovelha - como iogurte grego e queijos - foram descritos como possuindo peptídeos inibidores da enzima conversora da angiotensina (ECA), sendo a maioria derivada da subunidade β-caseína. Também, alguns peptídeos derivados da κ-caseína, resultante da hidrólise de leite ovino pela pepsina, tripsina e quimotripsina, exercem atividade antioxidante. Em queijos tradicionais derivados de ovelha, como o Scamorza, foram verificados diversos peptídeos com ação inibidora da ECA e ação antibacteriana. Nesse contexto, o leite de ovelha é uma rica fonte de nutrientes e seu principal uso é na produção de queijos devido ao elevado conteúdo de extrato seco total, que contribui com alto rendimento da massa. Todavia, esta matéria-prima permanece inexplorada pela indústria de laticínios com uma visão de alimento funcional, visto que o leite e seus derivados são reconhecidamente ótimos carreadores de fibras prebióticas e bactérias probióticas - que trazem benefícios ao consumidor favorecendo saúde e bem-estar. Nesse contexto, o leite de ovelha apresenta-se como um alimento de grande potencial e uma valiosa alternativa para a indústria de laticínios - que pode aumentar a diversidade de produtos oferecidos ao consumidor. "No, your honor. I didn't know who or what he was when I first came across the book -- they don't exactly love him in the synagogue, if you've read the story of his life. I found it in a junkyard in a nearby town, paid a kopek, and left cursing myself for wasting money hard to come by. Later I read through a few pages and kept on going as though there were a whirlwind at my back. As I (...) say, I didn't understand every word but when you're dealing with such ideas you feel as though you were taking a witch's ride. After that I wasn't the same man. That's in a manner of speaking, of course, because I've changed little since my youth.". The speaker is Yakov Bok, the unlikely hero of Bernard Malamud's The Fixer. At this point, early in the novel, Yakov speaks truthfully when he says that he has changed little since his youth. But over the next two and a half years (the time-period covered in the novel), he will undergo profound change and impressive moral growth. He suffers; he learns; he grows. Spinoza's name and ideas appear again and again at crucial moments in the course of the hero's moral development. Yakov Bok's verbal account of Spinoza's ideas is often comically primitive, but his understanding far outstrips his ability to articulate. By the end of the novel, his sufferings have led him to a deep grasp of certain of Spinoza's ethical and political doctrines. (shrink)

We sley Salmon, in his influential and detailed book, Four Decades of Scientific Explanation, argues that the pragmatic approach to scientific explanation, “construed as the claim that scientific explanation can be explicated entirely in pragmatic terms” (1989, 185) is inadequate. The specific inadequacy ascribed to a pragmatic account is that objective relevance relations cannot be incorporated into such an account. Salmon relies on the arguments given in Kitcher and Salmon (1987) to ground this objection. He also suggests that Peter Railton’s (...) concepts of the ideal explanatory text and explanatory information (Railton 1981) can provide what the pragmatic approach lacks. This suggestion is not a conclusion of course; we read it as the promotion of part of a research program aimed at forging a greater consensus on scientific explanation-an admirable goal. However, we do not see the pragmatic approach as inadequate. We will show that a synthetic account inspired by Salmon’s adaptation of Railton would be equivalent to van Fraassen’s pragmatic account in three respects: accepting or rejecting requests for explanation; the practice of giving scientific explanations; and the evaluation of the goodness of explanations. We include all three under the general rubric of explanatory “practice.” Admittedly these are not the only three features by which an account of explanation might be evaluated. Roughly, we mean to show that a synthetic account cannot do a better job of accounting for the scientific practices which are of importance to the constructive empiricist, and therefore no argument can be presented to the constructive empiricist to convince her that by her own standards the synthetic account is superior.
