In this paper we offer a new argument for the existence of God. We contend that the laws of logic are metaphysically dependent on the existence of God, understood as a necessarily existent, personal, spiritual being; thus anyone who grants that there are laws of logic should also accept that there is a God. We argue that if our most natural intuitions about them are correct, and if they are to play the role in our intellectual activities that we take (...) them to play, then the laws of logic are best construed as necessarily existent thoughts -- more specifically, as divine thoughts about divine thoughts. We conclude by highlighting some implications for both theistic arguments and antitheistic arguments. (shrink)

The idea that fictions may educate us is an old one, as is the view that they distort the truth and mislead us. While there is a long tradition of passionate assertion in this debate, systematic arguments are a recent development, and the idea of empirically testing is particularly novel. Our aim in this chapter is to provide clarity about what is at stake in this debate, what the options are, and how empirical work does or might bear on its (...) resolution. We distinguish between merely influencing people’s opinions and providing genuine learning, where the latter requires that the source of the change in opinion should be reliable. Other important ideas here are the extent to which authors of fiction may be considered to provide testimony, or something like it, and the possibility of recognizing an unstated purpose in the project of the fictional work. We ask whether fictions can furnish us not merely with ideas but with reasons for believing them, perhaps by constituting thought experiments. We consider whether the focus should be on understanding rather than on knowledge, and whether fictions can inform us about the qualities of another’s experiences. We briefly describe some experimental work of recent decades and suggest that the evidence for learning from fiction is currently meagre. (shrink)

We present a new frame semantics for positive relevant and substructural propositional logics. This frame semantics is both a generalisation of Routley–Meyer ternary frames and a simplification of them. The key innovation of this semantics is the use of a single accessibility relation to relate collections of points to points. Different logics are modeled by varying the kinds of collections used: they can be sets, multisets, lists or trees. We show that collection frames on trees are sound and complete for (...) the basic positive distributive substructural logic $\mathsf {B}^+$, that collection frames on multisets are sound and complete for $\mathsf {RW}^+$ (the relevant logic $\mathsf {R}^+$, without contraction, or equivalently, positive multiplicative and additive linear logic with distribution for the additive connectives), and that collection frames on sets are sound for the positive relevant logic $\mathsf {R}^+$. The completeness of set frames for $\mathsf {R}^+$ is, currently, an open question. (shrink)

David Chalmers argues that consciousness -- authentic, first-person, conscious consciousness -- cannot be reduced to brain events or to any physical event, and that efforts to find a workable mind-body identity theory are, therefore, doomed in principle. But for Chalmers and non-reductionist in general consciousness consists exclusively, or at least paradigmatically, of phenomenal or qualia-consciousness. This results in a seriously inadequate understanding both of consciousness and of the “hard problem.” I describe other, higher-order cognitional events which must be conscious if (...) the “hard problem” is to be solved -- in any sense of ‘solve’ which would make us any the wiser about it -- but whose consciousness is quite different from the qualia and phenomena usually inventoried. In an attempt to determine the epistemic status of computer simulation results, philosophers of science have recently explored the similarities and differences between computer simulations and experiments. One question that arises is whether and, if so, when, simulation results constitute novel empirical data. It is often supposed that computer simulation results could never be empirical or novel because simulations never interact with their targets, and cannot go beyond their programming. This paper argues against this position by examining whether, and under (...) what conditions, the features of empiricality and novelty could be displayed by computer simulation data. I show that, to the extent that certain familiar measurement results have these features, so can some computer simulation results. (shrink)

In recent decades, interest in non-monogamous intimate relationships has grown rapidly. Polyamory, relationship anarchy, consensual or ethical non-monogamy, and more have become popular in academic and public discourse. These practices destabilize the privileging of heterosexual nuclear families and the assumption that romantic coupledom is the ultimate form of love. Non-monogamous approaches flout cultural norms of exclusivity by avowing that intimacy is compatible with multiple dyadic and/or multi-party relationships. In this paper I introduce a sequent system for the propositional modal logic S5. Derivations of valid sequents in the system are shown to correspond to proofs in a novel natural deduction system of circuit proofs (reminiscient of proofnets in linear logic, or multiple-conclusion calculi for classical logic). -/- The sequent derivations and proofnets are both simple extensions of sequents and proofnets for classical propositional logic, in which the new machinery—to take account of the modal vocabulary—is directly motivated in terms (...) of the simple, universal Kripke semantics for S5. William Lane Craig’s God over All argues against the kind of “divine conceptualism” about abstract objects which I defend. In this conference presentation I note several points of agreement with and appreciation for Craig’s important work. I then turn to five points of critique and response pertaining to: the sovereignty-aseity intuition, the reality of false propositions, God’s having “inappropriate” thoughts, propositions being purely private and incommunicable, and a consistent view of God’s own ontological commitments. I conclude by summarizing our two (...) key differences, indicating that we may have much more in common than first appears. (shrink)

The two principal models of design in methodological circles in architecture—analysis/synthesis and conjecture/analysis—have their roots in philosophy of science, in different conceptions of scientific method. This paper explores the philosophical origins of these models and the reasons for rejecting analysis/synthesis in favour of conjecture/analysis, the latter being derived from Karl Popper’s view of scientific method. I discuss a fundamental problem with Popper’s view, however, and indicate a framework for conjecture/analysis to avoid this problem.

In recent years, feminist scholarship on emotional labor has proliferated. I identify a related but distinct form of care labor, hermeneutic labor. Hermeneutic labor is the burdensome activity of: understanding and coherently expressing one’s own feelings, desires, intentions, and movitations; discerning those of others; and inventing solutions for relational issues arising from interpersonal tensions. I argue that hermeneutic labor disproportionately falls on women’s shoulders in heteropatriachal societies, especially in intimate relationships between women and men. I also suggest that some of (...) the gendered burdens of emotional labor that feminist scholars point out would better be described as hermeneutic labor. Drawing on feminist philosophy as well as findings from social psychology and sociology, I argue that the exploitation of women’s hermeneutic labor is a pervasive element of what Sandra Bartky calls the ‘micropolitics’ of intimate relationships. The widespread expectation that women are relationship maintenance experts, as well as the prevalence of a gendered demand-withdraw pattern of communication, leads an exploitative situation to appear natural or even desirable, even as it leads to women’s dissatisfaction. This situation may be considered misogynistic in Kate Manne’s sense, where misogyny is a property of social environments rather than a worldview. (shrink)

Science fiction fandoms tend to contain significant numbers of fans who feel angry and resentful about the handling of the franchise they are fans of, because of the stories the franchises owners have told. The paper addresses the question of when, if ever, such anger and resentment are justified. Special attention will be paid to Star Trek fandom, but other fandoms will be considered, including those for Star Wars and Doctor Who. Various proposed justifications for anger and resentment will be (...) considered, including that franchise owners have misled fans about the stories they would tell, have wasted opportunities to produce good art, have reduced the value of older art, have engaged in a form of cultural appropriation by repurposing old characters, have caused needless offense of a sort akin to the offense of religious sensibilities, have offended against the principle of utility, and have taken advantage of unjust copyright laws. The paper does not champion a conclusion about when, if ever, fan anger and resentment are justified. However, it is concluded that, contrary to what is often assumed, it is not obvious that fan anger and resentment are always unjustified, and so fan anger and resentment cannot always be dismissed out of hand. The function or intended use of a device such as a fire escape is escape from fire, whether or not it is ever actually used as such or it acquires other uses. Biological function, on the other hand, depends, in one way or another, on actual use. Philosophical attempts to explain artifact function by analogy with biological function or to build a unified theory of function are nonetheless common. What such attempts routinely overlook, however, is the role of forethought in (...) intentional function. I defend the traditional intended use view of function, emphasize the role of forethought and argue that design intentions are rationally grounded in a design brief, for which there is no obvious natural analogue. We present and defend the Australian Plan semantics for negation. This is a comprehensive account, suitable for a variety of different logics. It is based on two ideas. The first is that negation is an exclusion-expressing device: we utter negations to express incompatibilities. The second is that, because incompatibility is modal, negation is a modal operator as well. It can, then, be modelled as a quantifier over points in frames, restricted by accessibility relations representing compatibilities and incompatibilities between such points. (...) We defuse a number of objections to this Plan, raised by supporters of the American Plan for negation, in which negation is handled via a many-valued semantics. The paper is an examination and critique of the philosophy of science fiction horror of seminal American horror, science fiction and fantasy writer H.P. Lovecraft (1890-1937). Lovecraft never directly offers a philosophy of science fiction horror. However, at different points in his essays and letters, he addresses genres he labels “interplanetary fiction”, “horror”, “supernatural horror”, and “weird fiction”, the last being a broad heading covering both supernatural fiction and science fiction. Taken together, a philosophy of science fiction horror emerges. Central (...) to this philosophy is the juxtaposition of the mysterious, unnatural and alien against a realistic background, in order to produce the emotion that Lovecraft calls “cosmic fear”. This background must not only be scientifically accurate, but must accurately portray human psychology, particularly when humans are faced with the weird and alien. It will be argued that Lovecraft’s prescriptions are overly restrictive and would rule out many legitimate works of science fiction horror art. However, he provides useful insights into the genre. Philosophers expend considerable effort on the analysis of concepts, but the value of such work is not widely appreciated. This paper principally analyses some arguments, beliefs, and presuppositions about the nature of design and the relations between design and science common in the literature to illustrate this point, and to contribute to the foundations of design theory.

Louis Charland has argued that the Cluster B personality disorders, including borderline personality disorder, are primarily moral rather than clinical conditions. Part of his argument stems from reflections on effective treatment of borderline personality disorder. In the argument from treatment, he claims that successful treatment of all Cluster B personality disorders requires a positive change in a patient’s moral character. Based on this claim, he concludes (1) that these disorders are, at root, deficits in moral character, and (2) that effective (...) treatment of these disorders requires a sort of moral education rather than clinical intervention. In this paper, I evaluate the argument from treatment through a critical analysis of two psychotherapeutic interventions that have shown recent effectiveness against borderline personality disorder. I suggest that both Dialectical Behaviour Therapy and Mentalization-Based Treatment indicate that borderline personality disorder is, at root, a deficit in non-moral cognitive and emotional capacities. I suggest that these non-moral deficits obscure the expression of an otherwise intact moral character. In light of this, I conclude that effective treatment of borderline personality disorder requires primarily clinical intervention rather than moral edification. (shrink)

Opponents of genetic enhancement technologies often argue that the pursuit of these technologies will lead to self-defeating collective outcomes, massive social inequalities, or other forms of collective harm. They assume that these harms will outweigh individual benefits. Defenders of genetic enhancement technologies counter that individual benefits will outweigh collective harms and there will be no conflict between individual and collective interests. The present contribution tries to advance the debate by providing a more detailed discussion of the conditions under which individual (...) and collective interests may conflict.It presents a simple model that clarifies the conditions in which the use of genetic enhancement technologies may lead to self-defeating collective outcomes and social inequalities. It argues that given current inequalities, these conditions might indeed obtain as new genetic knowledge leads to a transition in population health. If they do, then genetic enhancement will steepen the social gradient in health. Thus, regulating access to enhancement technologies should be a matter of social justice. (shrink)

In the Foundations of Mathematics, Ramsey attempted to amend Principia Mathematica’s logicism to meet serious objections raised against it. While Ramsey’s paper is well known, some questions concerning Ramsey’s motivations to write it and its reception still remain. This paper considers these questions afresh. First, an account is provided for why Ramsey decided to work on his paper instead of simply accepting Wittgenstein’s account of mathematics as presented in the Tractatus. Secondly, evidence is given supporting that Wittgenstein was not moved (...) by Ramsey’s objection against the Tractarian account of arithmetic, and a suggestion is made to explain why Wittgenstein reconsidered Ramsey’s account in the early thirties on several occasions. Finally, a reading is formulated to understand the basis on which Wittgenstein argues against Ramsey’s definition of identity in his 1927 letter to Ramsey. (shrink)

The essay has been written to contribute to the debate on Dooyeweerd’s social philosophy. The goal is to argue that the central focus of his social philosophy is the “problem of order,” not communitarian issues. This article emphasizes that Dooyeweerd’s social theory was not oriented by communitarian concerns, but in comprehending the relation between creational order and social order.

Bernard Lonergan has argued for a theory of cognition that is transcendentally secure, that is, one such that any plausible attempt to refute it must presuppose its correctness, and one that also grounds a correct metaphysics and ontology. His proposal combines an identity theory of knowledge with an intentional relation between knower and known. It depends in a crucial way upon an appropriation of one’s own cognitional motives and acts, that is, upon “knowing one’s own knowing.” I argue that because (...) of conflicts between the identity and intentionality components of the theory, rational self-appropriation cannot, as Lonergan claims, be an iteration of just the same acts by which we acquire other sorts of knowledge. I propose an amended theory in which the relation between intending-subject and intended-object of first-level cognition becomes, in RSA, a numerical identity of knower and known and of the epistemic and the ontological. Community has been both celebrated and demonized as a fortress that shelters and defends its members from being exposed to difference. Instead of abandoning community as an antiquated model of relationships that is ill suited for our globalized world, this book turns to the writings of Giorgio Agamben, Roberto Esposito, and Jean-Luc Nancy in search for ways to rethink community in an open and inclusive manner. Greg Bird argues that a central piece of this task is found in how (...) each philosopher rearticulates community not as something that is proper to those who belong and improper to those who are excluded or where inclusion is based on one’s share in common property. We must return to the forgotten dimension of sharing, not as a sharing of things that we can contain and own, but as a process that divides us up and shares us out in community with one another. This book traces this problem through a wide array of fields ranging from biopolitics, communitarianism, existentialism, phenomenology, political economy, radical philosophy, and social theory. This note calls attention to the fact that efficient causes – the sort of cause that changes something or makes something happen – can play no constitutive role in the immediate, cognitively conscious relation between cognitive subject and a cognit-ive object. It notes that: (1) it is a necessary condition for an efficient causal relation that it alter its relata; and (2) it is a necessary condition for a conscious cognitive relat-ion that it does not alter its relata. O quarto volume da obra "Ordem e História" de Eric Voegelin, intitulado de "A Era Ecumênica", marca a última mudança no pensamento do filósofo alemão. Voegelin rejeita uma concepção linear da história e sugere que as "irrupções espirituais" das civilizações se tornem o objeto de análise para identificar a "ordem da história". A partir disso, Voegelin rejeita os sistemas imanentistas da modernidade, notadamente, ideologias, como "revoltas egofânicas" que trazem desequilíbrio no Intermédio ou "metaxia" entre o cosmos e o além. O (...) objetivo do presente artigo é identificar a concepção de história e a crítica às ideologias modernas na obra "A Era Ecumênica" de Eric Voegelin. Adota-se metodologia exploratória e abordagem qualitativa na investigação do objetivo proposto. O trabalho conclui que, apesar da importante crítica voegiliniana à perda de fundamento transcendente da política moderna, a filosofia política do "último Voegelin" de "A Era Ecumênica" tem pouco a dizer sobre a política concreta, revelando-se uma filosofia da consciência apolítica em sentido normativo. In the distribution of resources, persons must be respected, or so many philosophers contend. Unfortunately, they often leave it unclear why a certain allocation would respect persons, while another would not. In this paper, we explore what it means to respect persons in the distribution of scarce, life-saving resources. We begin by presenting two kinds of cases. In different age cases, we have a drug that we must use either to save a young person who would live for many more (...) years or an old person who would only live for a few. In different numbers cases, we must save either one person or many persons from certain death. We argue that two familiar accounts of respect for persons―an equal worth account, suggested by Jeff McMahan, and a Kantian account, inspired by the Formula of Humanity―have implausible implications in such cases. We develop a new, “three-tiered” account: one that, we claim, generates results in such cases that accord better with many people’s considered judgments than those produced by its rivals. (shrink)

Espera-se que o texto contribua na apresentação dos principais argumentos do debate entre MacIntyre e o emotivismo moral, a fim de servir de orientação para outras discussões na área da metaética. O objetivo do presente artigo é comparar as perspectivas de Friedrich von Hayek e Hannah Arendt sobre a relação entre liberdade e política. A perspectiva de Hayek é chamada de liberdade da política devido a seu pessimismo quanto à capacidade da ação política estatal ampliar a liberdade individual. E a perspectiva de Arendt é chamada de liberdade na política devido a sua aceitação positiva do espaço político enquanto campo para o exercício da ação e da liberdade dos indivíduos. A conclusão (...) é que a liberdade na política pressupõe alguma liberdade da política, mas não se contenta com a liberdade negativa. Popper's account of refutation is the linchpin of his famous view that the method of science is the method of conjecture and refutation. This thesis critically examines his account of refutation, and in particular the practice he deprecates as avoiding a refutation. I try to explain how he comes to hold the views that he does about these matters; how he seeks to make them plausible; how he has influenced others to accept his mistakes, and how some of the ideas (...) or responses to Popper of such people are thus similarly mistaken. I draw some distinctions necessary to the provision of an adequate account of the so-called practice of avoiding a refutation, and try to rid the debate about this practice of at least one red herring. I analyse one case of 'avoiding' a refutation in detail to show how the rationality of scientific practice eludes both Popper and many of his commentators. Popper's skepticism about contingent knowledge prevents him from providing an acceptable account of contingent refutation, and so his method is really the method of conjecture and conjecture. He cannot do without the concepts of knowledge and refutation, however, if his account of science is to be plausible or persuasive, and so he equivocates between, amongst other things, refutation as disproof and refutation as the weaker notion of discorroboration. I criticise David Stove's account of this matter, in particular to show how he misses this point. An additional advantage Popper would secure from this equivocation is that if refutations were mere discorroborations they would be easier to achieve, and hence more common in science, than is the case. On Popper's weak notion of refutation, it would be possible to refute true theories since corroboration does not entail truth. There are two other related doctrines Popper holds about refutation which, if accepted, make some refutations seem easier to obtain than is the case. I call these doctrines 'Strong Popperian Falsificationism' (SPF) and 'Weak Popperian Falsificationism' (WPF). SPF is the false doctrine that if a prediction from some theory is refuted then that theory is refuted. Popper does not always endorse SPF. In particular, when confronted with a counterexample to it, he retreats to WPF, which is the false doctrine that if a prediction from some theory is refuted then that theory is prima facie refuted. WPF , or even SPF, can seem plausible if one has in mind predictions derived from theories in strong or conclusive tests of those theories, which I suggest Popper characteristically does. v Popper is disposed to describe any such case of predictive failure which does not lead to the refutation of the theory concerned as one in which that refutation has been avoided. To reinforce his portrayal of the refutation, or the attempted refutation, of major scientific theories as the rational core of scientific practice, Popper treats the so-called practice of avoiding a refutation as untypical of science, and much so-called avoidance he dismisses as unscientific or pseudo-scientific. I argue that his notion of avoiding a refutation is incoherent. Popper is further driven to believe that such avoidance is possible, however, because he conflates sentences with propositions and propositions with propositional beliefs. Also, he wishes to avoid being saddled with the relativisim that is a consequence of his weak account of refutation as discorroboration. Popper believes that ad hoc hypotheses are the most important of the unscientific means of avoiding a refutation. I argue that his account of such hypotheses is also incoherent, and that several hypotheses thought to be ad hoc in his sense are not. Such hypotheses appear to be so largely because of Popper's use of rhetoric and partly because these hypotheses are unacceptable for other reasons. I conclude that to know that a hypothesis is ad hoc in Popper's sense does not illuminate scientific practice. Popper has also attempted to explicate ad hocness in terms of some undesirable, or allegedly undesirable, properties of hypotheses or the explanations they would provide. The first such property is circularity, which is undesirable; the second such property is reduction in empirical content, which is not. In the former case I argue that non-circularity is clearly preferable to non-ad hocness as a criterion for a satisfactory explanation or explanans, as the case may be, and in the latter case that Popper is barking up the wrong tree. Some cases of so-called avoidance are obviously not unscientific. The discovery of Neptune from a prediction based on the reasonable belief that there were residual perturbations in the motion of Uranus is an important case in point, and one that is much discussed in the literature. The manifest failure of astronomers to account for Uranus's motion did not lead to the refutation of Newton's law of gravitiation, yet significant scientific progress obviously did result. Retreating to WPF, Popper claims that Newton's law was prima facie refuted. In general, astronomers have never shared this view, and they are correct in not doing so. I argue that the law of gravitation would have been prima facie refuted only if there had been good reason at the time to believe as false what is true, namely, that an unknown trans-Uranian planet was the cause of those Uranian residuals. Knowledge of the trans-Uranian region was then so slight that it was merely a convenient assumption, one which there was little reason to believe was false, that the known influences on Uranus's motion were the only such influences. I conclude that in believing vi or supposing that it was this assumption that was false, rather than the law of gravitation, Leverrier and Adams, the co-predictors of Neptune, were acting rationally and intelligently. Popper's commentators offer a variety of accounts of the alleged practice of avoiding a refutation, and of this case in particular. I analyse a sample of their accounts to show how common is the acceptance of some of Popper's basic mistakes, even amongst those who claim to reject his falsificationism, and to display the effects on their accounts of this acceptance of his mistakes. Many commentators recognize that anomalies are typically dealt with by changes in the boundary conditions or in other of the auxiliary propositions employed. Where many still go wrong, however, is in retaining the presupposition of WPF which encouraged Popper to hold the contradictory view about anomalies in the first place. Thus Imre Lakatos and others, for example, have developed a 'siege mentality' about major scientific theories; they see them as under continual threat of refutation from anomalies, and so come to believe that dogmatism is essential in science if such theories are to survive as they do. I examine various such doomed attempts to reconcile Popper with the history of science. It is a common failure in this literature to conflate or to fail to see the need to distinguish a belief from a supposition, and an epistemic reason from a pragmatic reason. I argue that only if one does draw these distinctions can one give an adequate account of how anomalies are rationally dealt with in science. The other important strand in Popper's thinking about 'avoidance' of refutation which has seriously misled some of his commentators is his unfounded belief in the dangers of ad hoc hypotheses. I examine the accounts that a sample of such commentators provide of the trans-Uranian planet hypotheses of Leverrier and Adams. These commentators imply or assert what Popper only hints at, namely, that there is something fishy about this hypothesis. I provide a further defence of the rationality of entertaining this hypothesis at the time. I conclude with a few remarks about Popper's dilemma in respect of scientific practice and his long standing emphasis on refutations. (shrink)

Richard Watson maintains that deep ecology suffers from an internal contradiction and should therefore be rejected. Watson contends that deep ecology claims to be non-anthropocentric while at the same time is committed to setting humans apart from nature, which is inherently anthropocentric. I argue that Watson’s objection arises out of a fundamental misunderstanding of how deep ecologist’s conceive of the ‘Self.’ Drawing on resources from Buddhism, I offer an understanding of the ‘Self’ that is fully consistent with deep ecology, and (...) does not lead to the anthropocentric contradiction that Watson identifies. The paper will proceed as follows: First, I articulate Watson’s objection, and briefly discuss the traditional deep ecology position. Next, I turn to a discussion of the ‘Self’ and show that there are conceptions of human nature that are not separate from ‘Nature.’ It will thus be shown that deep ecology is not inconsistent and need not be rejected. In this paper I argue that Bonjour’s claim that empirical beliefs can only be justified by other empirical beliefs and his use of non-normative “spontaneous empirical beliefs” and the “The Doxastic Preumption” fail to solve the problems of coherence theory. I propose a justification of empirical (and other beliefs) based on the work of B. Lonergan.

Against the standard view that the Republic’s division of goods distinguishes between intrinsic and instrumental value, a growing number of scholars have correctly argued that goods possess value δι᾽ αὑτό in virtue of some of their causal effects. We respond to Stephen T. Davis’ criticism of our earlier essay, “Assessing the Resurrection Hypothesis.” We argue that the Standard Model of physics is relevant and decisive in establishing the implausibility and low explanatory power of the Resurrection hypothesis. We also argue that the laws of physics have entailments regarding God and the supernatural and, against Alvin Plantinga, that these same laws lack the proviso “no agent supernaturally interferes.” Finally, we offer Bayesian arguments for the Legend hypothesis and against the (...) A história da filosofia é a história das ideias. Porém, para Herman Dooyeweerd, a história da filosofia imanentista é a história de antíteses teóricas radicadas em dialéticas religiosas insolúveis. O objetivo do presente artigo é apresentar o conceito de “motivos básicos religiosos” no pensamento de Herman Dooyeweerd. Em primeiro lugar, será apresentado a concepção de religião em Dooyeweerd e, em seguida, serão apresentados o conceito e o desenvolvimento dos “motivos básicos religiosos” no pensamento ocidental. As conclusões do texto são que (...) esse conceito contribui em demonstrar que há uma dimensão tácita e comunitária na reflexão filosófica e que a impossibilidade de síntese teórica entre polos de “motivos básicos religiosos” imanentistas diz respeito à “dialética religiosa”. This study of Ralph Pred’s Onflow (MIT Press, 2005) expands on Pred’s arguments and raises doubts about the viability of phenomenology. Showing that Pred’s method is indeed phenomenological, I validate his interpretations of William James as phenomenologist and his critique of John Searle in light of James, which documents the extent to which the role of habit in the constitution of experience is neglected by philosophers. In explaining habit, however, Pred himself reverts to non-phenomenological models drawn from James’ postulate of (...) psycho-physical parallelism. Habit, like causation, poses an unmet challenge to phenomenological methods. In his critique of Gerald Edelman, Pred notes that Edelman falls prey to a metaphysical bias inherent in modern Indo-European languages. But Pred’s acuity in exposing a latent linguistic bias in phenomenological data is a two-edged sword. Revealing an invisible dependence of appearance on language, it casts doubt on the project of getting beyond language to "appearances-in-themselves.". (shrink)

In the literature on assertion, there is a common assumption that having the knowledge that p is a sufficient condition for having the epistemic right to assert that p—call this the Knowledge is Sufficient for Assertion Principle, or KSA. Jennifer Lackey has challenged KSA based on several counterexamples that all, roughly, involve isolated secondhand knowledge. In this article, I argue that Lackey’s counterexamples fail to be convincing because her intuition that the agent in her counterexamples both has knowledge and do (...) not have the epistemic right to assert is wrong. The article will progress as follows: In section 2, I present Lackey’s argument. In section 3, I suggest some more general reasons for doubting that the agent in her counterexamples actually has knowledge. I then show that from a virtue theoretic and Edward Craig’s practical explication of knowledge perspectives the agent in Lackey’ s counterexamples does not know. Since the agent in Lackey’s counterexamples does not have knowledge, she has failed to convincingly prove that KSA is false. In section 4, I conclude by suggesting that, at most, what Lackey’s counterexamples demonstrate is a problem with a simplistic evidentialist and/or process reliabilist epistemology. (shrink)

Objetiva-se expor o pensamento de Herman Dooyeweerd (1894-1977), prolífico jusfilósofo holandês, no que diz respeito à maneira como destaca o aspecto jurídico da realidade e formula sua concepção de enciclopédia da ciência do Direito. Problematiza-se em que medida a teoria dooyeweerdiana permite o desenvolvimento de um conceito de Direito relevante para a teoria da decisão judicial. Neste afã, após exposição sintética das bases de seu pensamento, verticaliza-se o estudo do aspecto jurídico da realidade e da noção-base de sua Enciclopédia da (...) Ciência do Direito. Explora-se a original perspectiva filosófica dooyeweerdiana sobre a positivação do direito e a interpretação jurídica, ambas limitadas seja pelo inafastável núcleo distintivo do aspecto jurídico (a retribuição), seja pelo dever de considerar o todo dos aspectos da experiência humana e das esferas sociais envolvidas. Conclui-se que o conceito de enciclopédia jurídica em Dooyeweerd, à luz de uma densa e intrigante filosofia cosmonômica, enriquece sobremaneira a clássica discussão jusfilosófica que envolve o papel do direito positivo e os limites da interpretação jurídica, na medida em que oferece valioso prisma integrativo do aspecto jurídico frente aos demais aspectos da experiência humana, colaborando para uma visão jurídica não reducionista, preservadora da irredutibilidade do Direito e conferidora de limites mais claros à decisão judicial. A pesquisa é qualitativa, eminentemente bibliográfica, tendo sido utilizado o método hipotético dedutivo. (shrink)

Several prominent theorists have recently advocated reconceptualizing rape as “nonconsensual sex,” omitting the traditional “force” element of the crime. I argue that such a conceptualization fails to capture what is distinctively problematic about rape for women and why rape is pivotal in supporting women’s gender oppression. I argue that conceptualizing rape as coerced sex can replace both the force and nonconsent elements and thereby remedies some of the main difficulties with extant definitions, especially in recognizing “acquaintance” rape as such. In this paper I call attention to the fact that Lonergan gives two radically opposed accounts of how sense perception relates us to the external world and of how we know that this relation exists. I argue that the position that Lonergan characteristically adopts is not the one implied by what is most fundamental in his theory of cognition. I describe the initial epistemic position with regard to the problem of skepticism about the external material world that is in fact (...) implied by his theory of cognition, and I sort out some confusion about various forms of direct and representative perceptual realism. The paper concludes with a critique of Lonergan’s theory of description and explanation in empirical science that makes evident the difficulties into which he is led by lack of clarity in his theory of perception. Este artículo provee tales criterios. El análisis de los confusos argumentos contra la ciencia cargada de valores revela el criterio fundamental de la orientación ilegítima: cuando los juicios de valor operan orientando la investigación a una conclusión predeterminada. I argue that a certain type of naturalist should not accept a prominent version of the no-miracles argument (NMA). First, scientists (usually) do not accept explanations whose explanans-statements neither generate novel predictions nor unify apparently disparate established claims. Second, scientific realism (as it appears in the NMA) is an explanans that makes no new predictions and fails to unify disparate established claims. Third, many proponents of the NMA explicitly adopt a naturalism that forbids philosophy of science from using any methods (...) not employed by science itself. Therefore, such naturalistic philosophers of science should not accept the version of scientific realism that appears in the NMA. (shrink)

Pressuring someone into having sex would seem to differ in significant ways from pressuring someone into investing in one’s business or buying an expensive bauble. In affirming this claim, I take issue with a recent essay by Sarah Conly (‘Seduction, Rape, and Coercion’, Ethics, October 2004), who thinks that pressuring into sex can be helpfully evaluated by analogy to these other instances of using pressure. Drawing upon work by Alan Wertheimer, the leading theorist of coercion, she argues that so long (...) as pressuring does not amount to coercing someone into having sex, her consent to sex answers the important ethical questions about it. In this essay, I argue that to understand the real significance of pressuring into sex, we need to appeal to background considerations, especially the male-dominant gender hierarchy, which renders sexual pressuring different from its non-sexual analogues. Treating pressure to have sex like any other sort of interpersonal pressure obscures the role such sexual pressure might play in supporting gender hierarchy, and fails to explain why pressure by men against women is more problematic than pressure by women against men. I suggest that men pressuring women to have sex differs from the reverse case because of at least two factors: (1) gendered social institutions which add to the pressures against women, and (2) the greater likelihood that men, not women, will use violence if denied, and the lesser ability of women compared to men to resist such violence without harm.
