By giving sympathy a central role, Adam Smith’s Theory of Moral Sentiments (1759) can be regarded as one of the ‘enlightened’ moral theories of the Enlightenment, insofar as it widened the scope of moral consideration beyond the traditionally restricted boundary of human beings. This, although the author himself does not seem to have been aware of this fact. In this paper, I want to focus on two aspects which I think lead to this conclusion. First, by making sentience the requisite (...) to be taken into moral consideration, nonhuman animals in Smith’s moral theory can count as moral patients towards whom we should exercise the virtue of beneficence (if not justice). Secondly, Smith’s idea of morality as working in concentric circles –generating more stringent duties towards those closer to us– could explain and perhaps also justify our caring for some nonhuman animals, especially pets. At the basis of modern natural law theories, the concept of the suum, or what belongs to the person (in Latin, his, her, its, their own), has received little scholarly attention despite its importance both in explaining and justifying not only the genealogy of property, but also that of morality and war.1 In this paper I examine Hugo Grotius's what it is, what things it includes, what rights it gives rise to and how it is extended in the transition from (...) the state of nature to civil society. I then briefly point out how bringing this concept back to the fore could help to illuminate the current discussion on the foundations of basic human rights, and to evaluate cases where these seem to clash with property rights. he territorial impacts of climate change will affect millions. This will happen not only as a direct consequence of climate change, but also because of policies for mitigating it—for example, through the installation of large wind and solar farms, the conservation of land in its role as carbon sink, and the extraction of materials needed for renewable energy technologies. In this article, we offer an overview of the justice-related issues that these impacts create. The literature on climate justice and territory (...) is vast and spans a range of disciplines, so we limit our discussion to a specific understanding of territory and a specific understanding of injustice that arises from its loss. We understand territory as a normative concept that describes a place under some agent's jurisdiction, where the agent is a politically organized collective and where the jurisdictional rights over that place secure a relevant degree of self-determination for that collective. Accordingly, we consider that the main injustice connected to the loss of territory due to climate change is the loss or undermining of the ability to exercise the collective right to self-determination, which requires some control over the place. This can happen if a territorial agent literally loses the ground where to stand as a direct effect of climate change, raising issues of justice in relocation; or if their place changes due to mitigation policies, affecting their use and understanding of territory, raising issues of justice in energy transition. People have disagreed on the significance of Libet-style experiments for discussions about free will. In what specifically concerns free will in a libertarian sense, some argue that Libet-style experiments pose a threat to its existence by providing support to the claim that decisions are determined by unconscious brain events. Others disagree by claiming that determinism, in a sense that conflicts with libertarian free will, cannot be established by sciences other than fundamental physics. This paper rejects both positions. First, it is (...) argued that neuroscience and psychology could in principle provide support for milder deterministic claims that would also conflict with libertarian free will. Second, it is argued that Libet-style experiments—due to some of their peculiar features, ones that need not be shared by neuroscience as a whole—currently do not support such less demanding deterministic claims. Abstract: According to Hegel, comprehension proper is the ostensible self-determination of thinking with the determinations that spontaneously present themselves as independent objects. By positing objective determinations as the own determinations of thought, comprehension reveals thinking as an activity that is practical. For Hegel, comprehending allegedly extrinsic objects, and free willing of the own determinations of the thinking and willing subject, are in essence the same activity: only subjects who can choose between the determinations that determine them can comprehend objects. To (...) elucidate: only subjects who are able to actively determine themselves with the determinations that spontaneously determine them are able to analyse and comprehend the objects of their knowing activity. This bulletin contains a summary of the main topics of discussion in truthmaker theory, namely: the definition of truthmakers, problems with Truthmaker Necessitarianism and Truthmaker Maximalism, the ontological burden of truthmakers and the recalcitrant topic of truthmakers for negative truths.

Given the conceptual gap in the global justice debate today (where most of the talk is about the duties of the rich, but little is said about what the poor may do for themselves), in this article I reintroduce the idea of a right of necessity. I first delineate a normative framework for such a right, inspired by these historical accounts. I then offer a contemporary case where the exercise of the right of necessity would be morally legitimate according to (...) that framework – even though illegal and probably condemned by the standard moral norms. The case is that of a small group of Paraguayan campesinos (small farmers) suffering from the effects of a severe drought. In the third part, I introduce the concept of noncivil disobedience: I call an act of noncivil disobedience a conscientious, public, illegal and forcible act whose performance, while not necessarily intended directly as a means to bring about social and/or political change, may help to trigger these changes indirectly. In the fourth part, I suggest that certain instances where the right of necessity is overtly exercised – as in the case of the famine-struck Paraguayan campesinos – may also be interpreted in terms of noncivil disobedience, insofar as they serve a double function: as a means of satisfying immediate need, and as a marker of discontent in a society where the equal rights of individuals are a nominal ideal which remains unfulfilled in practice. I then address two objections that may be raised against resurrecting the idea of a right of necessity and identifying it in certain instances with noncivil disobedience. I conclude by suggesting that, at the point of convergence between the two, a basic right like the right of necessity recovers its value as an active, (rather than passive) entitlement of its holders, while the use of force enters the picture as a legitimate means that – at least under certain circumstances – may be resorted to within the limits of civil society. Im gesprochenen und geschriebenen Sprachzeichen kehrt der Geist zur Anschauung eines äußeren Objektes zurück, dessen Bestimmtheit aber die Vorstellung der Bedeutung des Sprachzeichens ist bzw. sein soll. Als Gedächtnis wiederholt dann der Geist den Subjektivierungs- und Idealisierungsprozeß - den Prozeß des Vorstellens - an dieser besonderen Art Anschauung. Nun, wenn das Subjekt ein Wort hört oder liest, das es noch nicht assimiliert hat, versteht es nicht, was es bedeutet; in dem Fall ist die Verknüpfung des Gehörten oder Gelesenen mit seiner (...) Bedeutung im Sprachzeichen dem Subjekt so äußerlich wie das gehörte oder gelesene Wort selbst. Wenn der Geist sich zum Stadium der Sprache erhoben hat, zeigt sich somit der abstrakte Charakter seiner vorstellenden Tätigkeit weiter im verbleibenden Unterschied der Bedeutungen der Wörter zu den sie ausdrückenden Anschauungen. Das Gedächtnis soll eben diesen Unterschied aufheben - nicht den bereits aufgehobenen Unterschied des angeschauten äußeren Objekts zur Subjektivität. Im Gegensatz zu dem, was auf der Ebene des Vorstellens der anfänglichen Anschauungen geschieht, ist also nicht die Subjektivierung der Objektivität der Kern, um den sich nunmehr der theoretische Prozeß dreht, sondern das Verhältnis der an sich idealisierten Objektivität der Wortzeichen zu deren Bedeutung. Hegels Einordnung dieses neuen Idealisierungsprozesses bzw. des Gedächtnisses in das System des theoretischen Geistes erweist sich aber als höchst problematisch. Consider a certain red rose. The proposition that the rose is red is true because the rose is red. One might say as well that the proposition that the rose is red is made true by the rose’s being red. This, it has been thought, does not commit one to a truthmaker of the proposition that the rose is red. For there is no entity that makes the proposition true. What makes it true is how the rose is, and how (...) the rose is is not an entity over and above the rose. It is against this view that I shall argue in this paper. I shall argue that a significant class of true propositions, including inessential predications like the proposition that the rose is red, are made true by entities. "No truthmaking without truthmakers" is my slogan. Although I have my view about what kinds of entities are truthmakers, I shall not argue for or presuppose that view here. All I shall argue for here is that if a proposition is made true by something, it is made true by some thing, but my argument will leave it open what kind of thing that thing is: it could be a fact or state of affairs, a trope, or any other sort of entity. From the end of the twelfth century until the middle of the eighteenth century, the concept of a right of necessity –i.e. the moral prerogative of an agent, given certain conditions, to use or take someone else’s property in order to get out of his plight– was common among moral and political philosophers, who took it to be a valid exception to the standard moral and legal rules. In this essay, I analyze Samuel Pufendorf’s account of such a right, founded (...) on the basic instinct of self-preservation and on the notion that, in civil society, we have certain minimal duties of humanity towards each other. I review Pufendorf’s secularized account of natural law, his conception of the civil state, and the function of private property. I then turn to his criticism of Grotius’s understanding of the right of necessity as a retreat to the pre-civil right of common use, and defend his account against some recent criticisms. Finally, I examine the conditions deemed necessary and jointly sufficient for this right to be claimable, and conclude by pointing to the main strengths of this account. In a previous paper, I argued that neuroscience and psychology could in principle undermine libertarian free will by providing support for a subset of what I called “statements of local determination.” I also argued that Libet-style experiments have not so far supported statements of that sort. In a commentary to the paper, Adina Roskies and Eddy Nahmias accept the claim about Libet-style experiments, but reject the claim about the possibilities of neuroscience. Peter Milne has tried to refure Truthmaker Maximalism. the thesis that every truth has a truthmaker, by producing a simple and direct counterexample to it, the sentence M: This sentence has no truthmaker. I argue that, contrary to what Milne argues, on Truthmaker Maximalism M is equivalent to the Liar, which gives the truthmaker maximalist a way to defend his position from Milne's counterexample: to argue that M expresses no proposition.

Free will skepticism is the view that people never truly deserve to be praised, blamed, or punished for what they do. One challenge free will skeptics face is to explain how criminality could be dealt with given their skepticism. This paper critically examines the prospects of implementing legal changes concerning crime and punishment derived from the free will skeptical views developed by Derk Pereboom and Gregg Caruso. One central aspect of the changes their views require is a concern for reducing (...) the severity of current forms of punishment. The paper considers two strategies for pursuing such a reduction. By taking into account evidence from the psychology of belief in free will and desire to punish, it is argued that a strategy aiming at a reduction of people’s natural desire to punish criminals can be successful if capable of providing alternatives to current forms of punishment satisfying three properties: they must be less harmful than current forms of punishment, more effective in preventing crime, and incompatible with current forms of punishment. Liberados el romanticismo y el idealismo del lastre secular de su vínculo imaginario con la “catástrofe alemana” deviene una vez más posible recurrir a ellos para repensar los problemas teóricos y prácticos del presente y localizar nuevos instrumentos conceptuales para su solución. En este contexto recobran interés numerosos temas que fueron objetos privilegiados de reflexión por parte de los pensadores románticos e idealistas. El romanticismo exaltó la Revolución Francesa como un acontecimiento epocal de reivindicación de los derechos de los individuos (...) contra la opresión de las formas anquilosadas de la religión y la organización estatal. Los pensadores románticos se rebelaron contra el orden burgués en todas sus formas, contra la pauta ubicua de la razón económico-instrumental. Para Kant, lo que es útil e intercambiable no posee dignidad, sino precio. El rechazo romántico de la exhaustiva reducción del mundo a mercancía conduce a la recuperación del valor infinito de la naturaleza, en esa medida, a su “reencantamiento”. En una misma línea, el romanticismo preconiza tendencialmente todos los fenómenos no cuantificables, aquéllos que no permiten ser calculados en términos mercantiles: la corporeidad, el erotismo, la pasión, la imaginación y la fantasía, el arte y la poesía, lo telúrico, la diversidad individual y cultural. El idealismo, por su parte, busca una síntesis entre la concepción ilustrada del mundo material y la visión pre-moderna del mismo. El resultado de esa mediación es la explicitación de las estructuras del propio espíritu humano presentes en su comprensión del mundo, toda vez que para el idealismo el mundo es siempre la teoría de la mente humana sobre el mundo. El pensamiento ilustrado pudo por ello confundir la filosofía de la naturaleza de los idealistas con una visión de lo material viciada de antropomorfismo, más próxima a la mística y a los bestiarios medievales que a las ciencias naturales de la Edad Moderna. El idealismo, por el contrario, encuentra en esta suerte de principio antrópico de toda teoría un factor de liberación moral y política. La toma de conciencia de que es el sujeto el que crea sistemas de sentido y que, por tanto, éstos deben reflejar en sí mismos su origen humano, implica el corolario de que con las teorías –sea cual sea el ámbito de la realidad que ellas busquen explicar– se trata en verdad de dispositivos de ordenamiento para el conocimiento y la acción construidas por la propia subjetividad humana; en esta medida, en su origen no se encuentran datos brutos de un supuesto orden natural que debe, por tanto, ser respetado sacralmente, sino la propia comunidad de sujetos vivientes. Aunque haya dejado tras de sí y olvidado el proceso de mediaciones que le dio origen, aunque se presente, pues, como replegado sobre sí mismo y, en esa medida, como la suma de re-presentaciones de un orden encontrado en el mundo, cada sistema de ideas contiene el conjunto de prácticas subjetivas inferenciales que lo constituyeron y que fueron realizadas por múltiples sujetos en plexos históricos concretos. El idealismo consiste en explicitar a la subjetividad actuando en el objeto y, con ello, en conminar el peligro de la mutación de las teorías en ideologías. El fundamento último de la libertad descansa para el idealismo menos en el orden determinado que funciona como condición de posibilidad del ejercicio de la libertad que en el modo de autoconcepción de la propia subjetividad. A partir del mundo de las autoconcepciones del sujeto –para Hegel se trata del ámbito específico del sujeto que ha devenido por ello mismo absoluto– derivan luego, como sus corolarios prácticos, las formas concretas de ordenamiento social y político. Si bien asume en sí numerosos motivos románticos, el idealismo aspira también a una mediación de esos elementos con las contribuciones teóricas de la Ilustración, con la que guarda entonces una relación menos crítica que el romanticismo. Fruto de este espíritu más ecuménico y menos orientado a la ruptura, defiende una concepción más pacífica de la racionalidad capitalista y el mundo burgués. Hegel reivindica así el rol positivo del mercado con su división social del trabajo y una concepción menos revolucionaria y más reformista de la vida política. El neoliberalismo contemporáneo se concibe a sí mismo como el sistema que resulta naturalmente del principio de la libertad negativa. Una tesis central del idealismo alemán es que para que sea posible el ejercicio de la capacidad de decidirse autónomamente por diferentes metas es necesario el marco efectivo de la libertad positiva. Sin la presencia de un orden racional con poder coercitivo sobre los miembros de la sociedad para regular su conducta, la libertad negativa de esos miembros, a primera vista disminuida y parcialmente cercenada por aquel orden, no es en la práctica posible. Narrowly understood, veganism is the practice of excluding all animal products from one’s diet, with the exception of human milk. More broadly, veganism is not only a food ethics, but it encompasses all other areas of life. As defined by the Vegan Society when it became an established charity in the UK in 1979, veganism is best understood as “a philosophy and way of living which seeks to exclude – as far as is possible and practicable – all forms of (...) exploitation of, and cruelty to, animals for food, clothing or any other purpose; and by extension, promotes the development and use of animal-free alternatives for the benefit of humans, animals and the environment”. There are two main moral justifications for veganism, both of which rely on a common assumption: that sentience, i.e., the capacity to feel pleasure and pain, is the necessary and sufficient trait to be morally considerable. In what follows, I present these two justifications and a third one which, although less popular, captures some core intuitions among vegans. I then present a challenge faced by veganism and two arguments that reject it as discriminatory, and briefly conclude. (shrink)

En la exposición de la filosofía del espíritu subjetivo teórico, la filosofía del Espíritu Absoluto no parece a primera vista jugar ningún rol. Sin embargo, las formas del Espíritu Absoluto son en el Sistema de Hegel la explicitación de los contenidos implicados por las formas cognitivas de la inteligencia. En este sentido, la filosofía del Espíritu Absoluto es la realización de las formas del espíritu subjetivo teórico; en el contexto del Espíritu Absoluto, pues, Hegel presupone en forma directa la primera (...) forma general de su Psicología y, consecuentemente, la exposición precedente de la misma en el contexto de la filosofía del espíritu subjetivo. Pero a diferencia de su proceder en el caso de la Estética enciclopédica y las lecciones correspondientes así como en el de los capítulos de la Enciclopedia dedicados a la Filosofía y en las lecciones sobre la Historia de la Filosofía, en el caso de la Filosofía de la Religión –o, más precisamente, en el de las Lecciones sobre Filosofía de la Religión– Hegel expone nuevamente en forma cuasi-sistemática y en un grado considerable de extensión y detalle la entera filosofía del espíritu subjetivo teórico. A pesar de las numerosas modificaciones de estructura general y en parte de contenido de las diferentes lecciones sobre filosofía de la religión, en todas ellas Hegel mantiene la división de la misma en tres partes, a saber: "Concepto de religión", "Religión determinada" y "Religión consumada"; es en el contexto de la primera de estas partes, esto es, en la dedicada al Concepto de religión, donde Hegel retoma y desarrolla la teoría de las diferentes formas del espíritu subjetivo teórico. En este nuevo contexto, Hegel no se limita a recordar las tesis que había presentado en la Psicología propiamente dicha, sino que en algunos puntos precisa y complementa dichas tesis con valiosas observaciones y comentarios. En esta medida, a pesar de que han pasado inadvertidas en los estudios sobre la filosofía del espíritu subjetivo teórico de Hegel, las Lecciones sobre Filosofía de la Religión ofrecen una base textual ulterior para la reconstrucción de esa disciplina central del Sistema hegeliano. El presente trabajo tiene por objeto exponer la teoría de los actos teóricos del sujeto tal como Hegel la desarrolla en la lección sobre filosofía de la religión de 1827, toda vez que es en esta lección donde, en su etapa madura, Hegel ofrece los desarrollos más detallados y sistemáticos sobre el espíritu subjetivo teórico fuera del contexto específico de la filosofía del espíritu subjetivo. El concepto de libertad suele identificarse con el de la capacidad de elección, es decir, con el libre albedrío. La doctrina de la libertad queda con esto básicamente reducida a la discusión de la cuestión de si en un mundo que se presenta como un entramado de procesos causales al infinito el hombre es capaz de causar algo por sí mismo, esto es, en otros términos, de si el acto de elección puede ser un acontecimiento independiente de aquel entramado, en (...) el que de todos modos está cuando más no fuera a través de sus efectos integrado de hecho. Precisamente en la época en que se consolidaba la visión mecanicista del mundo, Kant explicitó las dificultades que plantea de suyo la noción de una causa que no sea a su vez efecto de otra causa y, sobre esta base, el problema que plantea el acto de elección entendido como una causa espontánea, es decir, como una causa capaz de iniciar absolutamente a partir de sí misma una serie de efectos sin ser en ese acto fundacional efecto de otra causa. El modo como Kant busca resolver la aparente incompatibilidad entre libertad y necesidad es remitiendo a una y a otra s a esferas diferentes de validez, de modo que no entren realmente en contacto y se invaliden con ello mutuamente. Por el contrario, para Hegel, si acaso hay una verdadera solución al conflicto que plantea la libertad humana en un mundo dominado por la necesidad, ella no podría consistir sino en mostrar que como tales libertad y necesidad no son propiamente determinaciones contradictorias. Hegel ve en la tesis del Cogito la formulación germinal de dos tesis centrales de su propio Sistema, a saber: a) la de la unidad del ser y el pensar, y b) la del carácter absoluto de la subjetividad, es decir, en otros términos, la del carácter omniabarcador de la racionalidad humana. La lectura que Hegel hace del Cogito cartesiano se ubica desde el primer momento más allá de la cuestión particular de la exactitud exegética. Hegel no pretende erigirse en (...) este caso -ni, por lo demás, en ninguno de los casos en los que interpreta a los filósofos que lo precedieron- en un historiador de la filosofía. Su Historia de la Filosofía se entiende a sí misma en todo momento como una filosofía de la Historia de la Filosofía. En la línea del dictum de Dilthey de que “el objetivo final del proceso de interpretación es entender al autor mejor que lo que él se entendió a sí mismo” , la lectura hegeliana del Cogito se nos ofrece como una posibilidad hermeneútica de asombrosa originalidad desde donde integrar el pensamiento de Descartes en el marco general de la Filosofía entendida como la actividad de autocomprensión de la racionalidad humana. Tomás de Aquino diferencia como dos principios metafísicos diferentes la suma de de-terminaciones que especifican como tal a un ente y el hecho de que dicho ente efecti-vamente exista en la realidad. Ahora bien, al definirse como lo otro de la esencia el ser tiende a devenir él mismo una especie de esencia que requiere, al igual que la esencia propiamente dicha, ser puesto a su vez en la existencia. Este corolario fue derivado de la tesis de la distinción real (...) ya en tiempos del propio Tomás por pensadores como Egidio Romano y recogido luego a lo largo de la Edad Media hasta los tiempos de Francisco Suárez. El neotomismo del siglo XX intentó eludir ese corolario echando mano del ar-gumento de la causalidad recíproca entre el ser y la esencia: el ser pondría a la esencia en la existencia y con el ser así recibido la esencia limitaría correlativamente al ser. No obstante, la distinción real del ser y la esencia parecería no poder evitar que el ser se convierta como tal en un ente sui generis que consecuentemente reproduce en su propio interior la estructura doble de esencia y ser. El presente trabajo tiene por objeto analizar en detalle las dificultades que plantea la tesis de la causalidad recíproca para fundamen-tar la tesis de la limitación del ser por la esencia. (shrink)

Bajo la forma de la tercera antinomia de la razón pura, Kant asume y reformula la tradicional contraposición entre necesidad natural y libertad humana: si el universo de las cosas sensibles está exhaustivamente regido por la causalidad, no hay lugar allí para la libertad humana entendida como auto-determinación. Kant intenta evitar este corolario sustentando la posibilidad de la libertad a nivel de la cosa en sí. Hegel critica la esterilidad de esta solución y propone en su lugar una particular concepción (...) del vínculo causa-efecto y una teoría ontológica de la subjetividad humana sobre las que busca fundar la compatibilidad de la libertad interna de la voluntad con el determinismo de las causas naturales así como la de la libertad individual con la existencia del Estado, la ley y la autoridad. El presente trabajo tiene por objeto reconstruir la crítica de Hegel a la tercera antinomia kantiana así como reconocer y exponer los fundamentos últimos de su teoría de la libertad. (shrink)

1. The Bundle Theory I shall discuss is a theory about the nature of substances or concrete particulars, like apples, chairs, atoms, stars and people. The point of the Bundle Theory is to avoid undesirable entities like substrata that allegedly constitute particulars. The version of the Bundle Theory I shall discuss takes particulars to be entirely constituted by the universals they instantiate.' Thus particulars are said to be just bundles of universals. Together with the claim that it is necessary that (...) particulars have constituents, the fundamental claim of the Bundle Theory is: (BT) Necessarily, for every particular x and every entity y, y constitutes x if and only ify is a universal and x instantiates y. 2 The standard and supposedly devastating objection to the Bundle Theory is that it entails or is committed to a false version of the Principle of Identity of Indiscernibles (Armstrong 1978: 91, Loux 1998: 107), namely: (Pll) Necessarily, for all particulars x and y and every universal z, if z is instantiated by x if and only if z is instantiated byy, then x is numerically identical with y. The most famous counterexample to the Identity of Indiscernibles is that put forward by Max Black, consisting of a world where there are only two iron spheres two miles apart from each other, having the same diameter, temperature, colour, shape, size, etc (Black 1952: 156). Let us from now on think of the properties of the spheres in this world as universals. The possibility of this world, which I shall hereafter refer to as 'Black's world', makes (Pll) false.' And according to common philosophical opinion this means that the Bundle Theory is false.. (shrink)

Las relaciones que entre mística y filosofía contemporánea establecieron algunos filósofos de la Escuela de Madrid, fueron expuestas a colación del cuarto centenario de San Juan de la Cruz celebrado en México (1942), las cuales -y según la visión de José Gaos en su breve pero denso Filosofía y mística aquí y ahora- tuvieron fuertes concomitancias entre sí, y su estela permanece en forma de “vasos comunicantes” con autores contemporáneos como Fernando Rielo (1923-2004), quien también nos ofreció su visión (1992) (...) sobre la mística y la Escuela. From Gadamer's Habilitation thesis, “Plato’s dialectical ethics. Phenomenological Interpretations Relating to the Philebus” (1928), this article seeks to highlight the fundamental lines of Plato’s image, outlined in that author’s first philosophical publication (1931). The confrontation with the themes of ethics and dialectic, in the current state of Platonic studies, indicates that in Plato’s image drawn in the early confrontation with the Philebus, clearly influenced by the phenomenological notion of Dasein, one already finds the fundamental features of what will become Gadamer's (...) philosophical hermeneutics, fully emancipated from Heideggerian tutelage. The purpose of this paper is to describe how judges engage in constitutional design, irrespective of legal tradition. I examine in great detail the role of the judge: as a conflict solver, as a member of an institution, as part of the political system and as a human being, for those are factors that intervene in the activities he makes. I later analyze the dynamics that a Constitution can have: the change in their structure conceptualized as interpretation, mutation and resistance (...) and their relation. Interpretation is the determination of the scope of a norm, mutation is the change of meaning without amendment and resistance is a concept that bridges the first two, which is the capacity of the constitutional rule to adapt to the political game and to assume mutations. Finally, these concepts are intertwined in order to show how judges by means of their function, (re)design the Constitution by means of adjudication and policymaking (rule issuance by the stating of precedent). Para Hegel, Asia señala el comienzo de la historia universal, mientras que Europa señala su consumación y final. La América precolombina, al igual que la África negra, están para Hegel fuera de la historia universal; en cuanto a la historia de América tras su descubrimiento por los europeos, Hegel sostiene que lo que ha sucedido desde entonces en el continente americano proviene, en rigor, del “principio de Europa”. Hegel contrapone a su vez la historia de América Latina a la de (...) los actuales Estados Unidos en términos del respectivo desarrollo económico y social. Hegel atribuye la brecha de desarrollo entre las dos Américas, por un lado, a que América Latina es católica y Estados Unidos es mayoritariamente protestante, y, por el otro, a que América Latina fue “conquistada”, mientras que Estados Unidos fue “colonizado”. Sobre la base del análisis de los textos pertinentes de la obra de Hegel, se reconstruirá su teoría sobre el desigual nivel de desarrollo socio-económico de América Latina y Estados Unidos y se evaluará la plausibilidad, actualidad y eventual deficiencia de la misma. El cambio suele ser, según una larga tradición filosófica, concebido como incompatible con la noción de ser en cuanto tal. Dicho de otro modo: si acaso existe un ser que sea en un sentido más propio y auténtico que las cosas de este mundo, el mismo deberá necesariamente excluir de sí toda forma de cambio y movimiento. Ser y devenir serían en cuanto tales nociones contradictorias y mutuamente excluyentes. Así, por ejemplo, Parménides elimina del Ser el movimiento y el cambio, (...) Platón concibe a las Ideas como inmutables, Aristóteles a su Primer Motor como inmóvil, la Escolástica concibe a Dios como Acto Puro, exento de potencia, y Kant, finalmente, opone lo incausado a lo causado y lo necesario a lo contingente como términos antinómicos. Hegel, en cambio, se remite a Heráclito y considera con él que el devenir constituye la sustancia misma del ser. Según Hegel, las nociones de ser y devenir no se excluyen mutuamente; por el contrario, el concepto de lo que es en sentido auténtico no sólo no excluye de sí el devenir, sino que en la medida en que deba ser algo real y no una mera abstracción mental, será por eso mismo algo concreto y determinado que como tal deberá contener el movimiento y el cambio como una de sus características esenciales. La crítica de Hegel a la clásica contraposición de ser y devenir se inscribe, en último análisis, en su proyecto general de crítica a las categorías del entendimiento abstractivo como categorías inadecuadas para pensar y comprender correctamente lo real. Multialgebras have been much studied in mathematics and in computer science. In 2016 Carnielli and Coniglio introduced a class of multialgebras called swap structures, as a semantic framework for dealing with several Logics of Formal Inconsistency that cannot be semantically characterized by a single finite matrix. In particular, these LFIs are not algebraizable by the standard tools of abstract algebraic logic. In this paper, the first steps towards a theory of non-deterministic algebraization of logics by swap structures are given. Specifically, (...) a formal study of swap structures for LFIs is developed, by adapting concepts of universal algebra to multialgebras in a suitable way. A decomposition theorem similar to Birkhoff’s representation theorem is obtained for each class of swap structures. Moreover, when applied to the 3-valued algebraizable logics J3 and Ciore, their classes of algebraic models are retrieved, and the swap structures semantics become twist structures semantics. This fact, together with the existence of a functor from the category of Boolean algebras to the category of swap structures for each LFI, suggests that swap structures can be seen as non-deterministic twist structures. This opens new avenues for dealing with non-algebraizable logics by the more general methodology of multialgebraic semantics. (shrink)

Bertrand Russell argued that any attempt to get rid of universals in favor of resemblances fails. He argued that no resemblance theory could avoid postulating a universal of resemblance without falling prey to a vicious infinite regress. He added that admitting such a universal of resemblance made it pointless to avoid other universals. In this paper I defend resemblance nominalism from both of Russell's points by arguing that (a) resemblance nominalism can avoid the postulation of a universal of resemblance without (...) falling into a vicious infinite regress, and (b) even if resemblance nominalism had to admit a universal of resemblance, this would not make it pointless to avoid postulating other universals. Según una historia estándar, devenida habitual especialmente por influencia del pensamiento heideggeriano, la filosofía occidental se encuentra atrapada en la trampa de la metafísica. La trampa de la metafísica centra la crítica a la metafísica en torno a la tesis según la cual el esencialismo y una concepción de la verdad condicionada por él determinan qué significa “ser” o “existencia”. Detrás de la realidad se supone un fundamento que bajo la forma de un “trasmundo” (Hinterwelt) produce una manifestación cuasi-causal, a (...) saber: el “mundo” (Welt), el cual se deja con ello concebir como la aparición del ser que se ha retraído en sí mismo. La diferencia entre ser y apariencia mantiene al pensamiento metafísico atrapado, en la medida en que éste no es capaz de reconocer esa diferencia misma como una apariencia. En Siete ensayos sobre la muerte de la metafísica, Héctor Ferreiro ofrece frente a esta historia estándar una convincente contrahistoria. Esta contrahistoria tiene su punto de partida en Hegel, quien intenta, de modo opuesto a la lectura propuesta por Heidegger, superar a la metafísica con sus propios medios y sepultarla a partir de su propia dinámica interna. Precisamente a esta superación está dedicado el debate y discusión de Hegel con el argumento ontológico. Como Kant, Hegel ve en el argumento ontológico uno de los centros operacionales de la metafísica clásica. La cuestión es, pues, cómo abordar el argumento ontológico del modo correcto desde un punto de vista crítico a la metafísica. La estrategia que ofrece Hegel consiste, como lo expone Ferreiro, en desenmascarar la distinción misma entre el ser y la apariencia producida por él como una operación de tipo conceptual. Según Hegel, la metafísica ha sido desde siempre el intento por desarrollar una teoría de la totalidad. Pero una teoría de la totalidad que coloca al ser de un lado y a su aparición del otro lado de un límite no advierte su propia operación, dado que el trazado de un límite pertenece él mismo a la teoría de la totalidad. De lo que se trata, pues, es de examinar los trazados de límite constitutivos de la metafísica para reconocerlos como productos de la reflexión y no como hechos dados que el pensamiento tan sólo debe reflejar. El movimiento de autosuperación de la metafísica que culmina en la discusión de Kant y Hegel con el argumento ontológico pertenece ya, sin embargo, a la tradición de la metafísica. Como lo muestra Ferreiro, la metafísica está a más tardar a partir de la distinción medieval entre esencia y existencia en proceso de superarse a sí misma, pues ya Tomás de Aquino logra reconocer en dicha distinción la verdadera fuente de la producción del mundo. Tomás persiste aún, sin embargo, en una concepción sustancialista, en la medida en que considera a la distinción entre esencia y existencia como un hecho in-dependiente de la teoría y del sujeto. Sin embargo, esa distinción es una operación conceptual y no un objeto que se encuentra en el mundo. En esta medida, la tesis de la distinción de razón entre ambas categorías se presenta como un indicador de la reflexión de la metafísica sobre sí misma. Ferreiro demuestra que el célebre comienzo de la Cien-cia de la Lógica de Hegel significa precisamente una profundización y radicalización de esa autorreflexión. Ahora bien, a ojos de Hegel el ser del comienzo de la Lógica es en sí mismo como tal el resultado del argumento ontológico; en su formulación clásica, sin embargo, el argumento ontológico sólo aspira a probar que hay algo (Dios), pero el argumento mismo no es como tal capaz de determinar ulteriormente ese algo –esto constituye justamente la tarea de la ontología en el sentido de Hegel, es decir, la tarea de la Lógica. Así, lo que podría denominarse en Hegel una “metafísica” es expresamente una crítica a la metafísica tradicional. En efecto, la ontología que Hegel propone en modo alguno significa una recaída en la metafísica anterior a Kant; por el contrario, en la filosofía de Hegel metafísica y crítica a la metafísica se vinculan íntimamente y con ello se cierra un círculo que se había abierto en la metafísica teológica de la Edad Media: precisamente que este movimiento estaba contenido ya programáticamente en la ontología de la distinción entre esencia y existencia es algo que Ferreiro analiza en forma clara y meticulosa. En cuanto disciplina, la ontología está hoy nuevamente en el centro de la atención de la reflexión filosófica a nivel mundial. Siete ensayos sobre la muerte de la metafísica no sólo ofrece en este respecto un análisis de índole histórica; es también una importante contribución teórica al actual retorno a la ontología. The dissertation has two parts, each dealing with a problem, namely: 1) What is the most adequate account of fuzziness -the so-called phenomenon of vagueness?, and 2) what is the most plausible solution to the sorites, or heap paradox? I will try to show that fuzzy properties are those which are gradual, amenable to be possessed in a greater or smaller extent. Acknowledgement of degrees in the instantiation of a property allows for a gradual transition from one opposite to the (...) other, each intermediate stage constituting an overlap in certain proportion of both contraries. Hence, degrees in the possession of a property give rise to simple contradictions. The reason why I have chosen those two questions is that they provide the main philosophical motivation for a particular brand of an infinite valued and paraconsistent logic. I will claim that Classical logic (CL) is not adequate to handle fuzzy situations, and, being deficient, is in need of being expanded to make room for degrees of truth and weak contradictions. One can hardly deny the importance of the debate, since what is ultimately at stake is what the limits of truth, rationality, intelligibility and possibility are. The main disciplines within which the research moves are the philosophy of language, philosophy of logic, and ontology. (shrink)

According to the brain drain argument, there are good reasons for states to limit the exit of their skilled workers (more specifically, healthcare workers), because of the negative impacts this type of migration has for other members of the community from which they migrate. Some theorists criticise this argument as illiberal, while others support it and ground a duty to stay of the skilled workers on rather vague concepts like patriotic virtue, or the legitimate expectations of their state and co-citizens. (...) In this article, on the contrary, we suggest that the liberal conception of states’ legitimate political authority demands, and not just permits, that developing states from which migration of skilled workers occurs set up contractual mechanisms. These mechanisms will ensure that state-funded training in the health sector is provided against a commitment on the part of future professionals to reciprocate with their services for the benefits obtained. If one of the conditions for the state to maintain legitimate political authority is to provide basic services such as healthcare to its subjects (while respecting at the same time their autonomy and freedom), then this is what developing states affected by the brain drain ought to do. What we call the authority-based approach to the brain drain also helps to clarify the obligations that other states have not to interfere with these contractual mechanisms when they exist, and not to profit from their absence. Inspired by FIFA’s legal instruments of training compensation and solidarity mechanism for the transfer of players, we conclude by suggesting a plausible global policy to complement this authority-based approach. The subtraction argument, originally put forward by Thomas Baldwin (1996), is intended to establish Metaphysical Nihilism, the thesis that there could have been no concrete objects. Some modified versions of the argument have been proposed in order to avoid some difficulties faced by the original argument. In this paper I shall concentrate on two of those versions, the so-called subtraction argument* (presented and defended in Rodriguez-Pereyra 1997, 2000, 2002), and Efird and Stoneham’s recent version of the argument (Efird and Stoneham (...) 2005). I shall defend the subtraction argument* from Alexander Paseau’s (2006) objection that because a crucial premise of the subtraction argument* may have no plausibility independent from Metaphysical Nihilism, the subtraction argument* is not suasive. Although Paseau focuses on the subtraction argument*, I shall point out that Efird and Stoneham could reply to Paseau’s objection in the same way. Thus there are (at least) two suasive versions of the subtraction argument that establish Metaphysical Nihilism. But are those two arguments equally good? I shall argue that the subtraction argument* is preferable to Efird and Stoneham’s argument. (shrink)

Hegel ofrece dos formas -en su filosofía en último análisis complementarias- de caracterizar al idealismo: La primera es próxima a la concepción habitual de idealismo previa a Kant, a saber: como una posición que considera que aquello que conocemos es una modificación de la propia conciencia. La segunda descansa en la tesis de la nulidad de lo finito; según esto, ?idealista? es la filosofía que considera que lo finito no tiene en cuanto tal realidad; ?realista?, a la inversa, es la (...) filosofía que toma el ser de las cosas determinadas como algo fijo y definitivo. Hegel denomina a este idealismo ?absoluto?.El idealismo absoluto es el modelo teórico que interrelaciona la tesis del carácter intrínsecamente ideal de los objetos de conocimiento y la tesis de que las cosas singulares que constituyen el mundo real surgen como una autodeterminación del ser. La premisa que permite tal vínculo es la tesis defendida por Hegel de que ser y pensar nunca se han separado y que su separación es el resultado de una concepción posterior errónea de la mente humana sobre la naturaleza de su actividad cognitiva. La hipostasiación de la disociación que la forma cognitiva de la representación introduce en la unidad indiferenciada de ser y pensar de la que parte la actividad de conocimiento en el sentimiento y la intuición sensibles es para Hegel la que provoca la ilusión retroactiva de que ambos -ser y pensar, mundo conocido y mente que conoce- se diferencian y contraponen. Por el contrario, desde el momento que la sensación es también ella misma un modo particular de la actividad continua e ininterrumpida del pensamiento, en el itinerario que va de la percepción sensible a la comprensión del objeto no hay para Hegel un punto en donde pueda introducirse una fractura que disuelva la unidad primigenia entre el ser y el pensar. En esta precisa medida, el momento final de la actividad de conocimiento, es decir, la actividad de comprender el mundo, es a un tiempo la singularización de los contenidos universales que constituyen la teoría del sujeto sobre el mundo y la autodeterminación de la unidad ser-pensar de la que parte y en todo momento permanece el sujeto que elabora esa teoría. Arribados al punto de vista del concepto, la dicotomía realismo-idealismo queda develada como un corolario de la autoconcepción representacionalista de la subjetividad cognoscente. Esta concepción define al paradigma general del realismo, el cual incluye para Hegel como el anverso y reverso de un mismo modelo teórico tanto lo que tradicionalmente ha sido entendido como realismo como al idealismo que resulta de una universalización de la idealidad de la conciencia singular, ya sea en la variante propuesta por Berkeley, ya sea en la del idealismo trascendental de Kant. A ojos de Hegel, por el contrario, el idealismo no puede ser sino absoluto, es decir, debe incluir en sí mismo el momento del ser y, con él, la realidad de las cosas que el sujeto conoce: la tarea esencial de la filosofía no consiste para Hegel más que en tomar conciencia de la co-pertenencia y unidad intrínseca de ambos. Judging a person as morally responsible involves believing that certain responses (such as punishment, reward, or expressions of blame or praise) can be justifiably directed at the person. This paper develops an account of the evolution of moral responsibility judgment that adopts Michael Tomasello’s two-step theory of the evolution of morality and borrows also from Christopher Boehm’s work. The main hypothesis defended is that moral responsibility judgment originally evolved as an adaptation that enabled groups of cooperative individuals to hold free (...) riders responsible more safely by acting in a coordinated way. Ao analisar a teoria da memória mecânica de Hegel, a maioria dos intérpretes considerou apenas dois aspectos da memorização mecânica: o desaparecimento do significado nas palavras mecânicamente memorizadas ou a internalização totalmente abstrata da mente que as memoriza. No primeiro caso, a interpretação concentrou-se na relação entre o significante e o significado das palavras; no segundo caso, concentrou-se na relação entre o signo linguístico como um todo e a mente. Entretanto, a posição específica da memória mecânica na sistematização das atividades (...) cognitivas de Hegel não se baseia nessas duas relações, mas na relação entre o significado de cada palavra e o significado das outras palavras. Ao memorizar de cor fileiras de palavras que não estão conectadas umas às outras por seus significados, mas apenas pela força da mente que decide memorizá-las juntas, a mente se liberta de qualquer conteúdo dado externamente e sublima a referência linear do conteúdo representacional de cada significado à intuição em sua origem. A atualização do poder da mente de interconectar conteúdos de acordo com as próprias regras lógicas da mente realiza, para Hegel, a transição para o pensamento propriamente dito. (shrink)

Theoretical and practical activity have traditionally been understood as complementary activities: through theoretical activity the subject would internalize the external world, while through practical activity she would externalize her internal goals. Hegel scholars have often attempted to interpret the difference and relation between subjective and objective spirit on the basis of that way of understanding theoretical and practical activity. Such approach, however, raises serious exegetical and conceptual problems about the meaning and formal structure of Hegel´s entire philosophy of spirit. Indeed, (...) if what primarily characterizes subjective spirit is the activity of knowing considered as the process of idealization and internalization of the external world and what characterizes, in turn, objective spirit is the externalization of the goals of the will, how should we conceive within such explanatory framework the specificity of the acts of absolute spirit, that is to say, of the human behavior in art, religion, and philosophy? I will first attempt to clarify what exactly defines, according to Hegel, theoretical and practical activity, in order to develop on that basis an exegetical model that can satisfactorily account for Hegel´s peculiar periodization of the different forms of human activity. La exterioridad de una cosa o de un estado de cosas configurados por el ser humano no implica para Hegel que esa cosa o ese estado de cosas deban ya por ello ser considerados como formas del espíritu objetivo, mientras que en contrapartida las formas del espíritu absoluto estarían entonces conformadas por contenidos ideales del pensamiento. La diferencia entre espíritu objetivo y espíritu absoluto no radica en la diferencia entre lo que el espíritu humano “hace” y lo que “conoce”. En (...) efecto, las obras de arte, es decir, configuraciones exteriores hechas por el ser humano utilizando, por ejemplo, piedras, metales, colores o sonidos, son para Hegel instancias del espíritu absoluto, mientras que, por su parte, realidades que en cuanto tales no son intuibles, como, por ejemplo, los contratos o la organización estatal, son instancias del espíritu objetivo. Que Hegel considere al arte como una forma del espíritu absoluto pone de manifiesto que, a sus ojos, las cosas que intuimos en el universo son, en rigor, productos del propio sujeto que las conoce. Espontáneamente el sujeto cognoscente piensa que lo que intuye es algo que recibe desde un mundo externo; sostener que el arte es una forma de conocimiento es justamente el modo como Hegel está expresando que lo intuido es en todos los casos un contenido producido por el propio espíritu, que es, por así decirlo, una obra de arte humano. En el arte mismo, sin embargo, la producción de la cosa intuible es insuficiente, dado que el material que el espíritu utiliza para sus configuraciones conserva en mayor o menor medida, según el caso, una determinidad propia que resiste a la determinidad que el espíritu busca conferirle. Por esta razón, las obras de arte se presentan inicialmente como productos arbitrarios. Recién cuando integra sus intuiciones en la actividad de comprensión -actividad cognitiva con la que opera la filosofía- y media con ello completamente la determinidad de los contenidos intuidos, el espíritu configura finalmente un universo que le es propio y específico. El objetivo de mi ponencia es reconstruir desde el marco teórico recién expuesto el sentido y función que Hegel le atribuye al arte en su teoría del conocimiento. (shrink)

Abstract: The Pull Bayesian Significance Test (FBST) for precise hy- potheses is applied to a Multivariate Normal Structure (MNS) model. In the FBST we compute the evidence against the precise hypothesis. This evi- dence is the probability of the Highest Relative Surprise Set (HRSS) tangent to the sub-manifold (of the parameter space) that defines the null hypothesis. The MNS model we present appears when testing equivalence conditions for genetic expression measurements, using micro-array technology.

By treating America as a «new» continent «by virtue of its wholly peculiar character in both physical and political respects» Hegel reiterates the increasingly dominant image of America in the Europe of his time. This image crystallized in the context of the consolidation of the colonization process. According to Europeans, the inhabitants of the colonized lands were far less civilized than the inhabitants of Western Europe. Not a few thinkers found the explanation for that cultural difference in the natural differences (...) between the respective geographies, climates and races. In this general framework, Hegel considered the American Indians as people without history; as for the history of America after its conquest and colonization, it is in his eyes nothing other than an episode of the history of Europe itself. Insofar as it is through Europe´s history that human beings have attained self-consciousness of their essence, namely, freedom as autonomy and self-determination, Europe seems to be a non plus ultra of the ideological development of humanity. However, as seen from the perspective of the 21st century, the intellectual and political history of Europe can hardly be identified with the full awareness of the value and dignity of each human being as such. Since the countries of the American continent rely on the principle of civic nationalism and not on that of ethnic na-tionalism, which is typical for Europe, they signify, in this respect, a step forward with regard to the «principle of the European mind». O presente trabalho procura se debruçar sobre a dimensão ontológica do homem animal-político-social em Aristóteles. Logo, desde já nos cabe ressaltar que a verificação do homem enquanto animal político-social abarcará um caráter metafísico para a efetivação no e do físico-material-natural, ou seja, o ser biopsicossocial. Refletindo, construindo e interligando o ser físico e “espiritual”. Portanto, o objeto principal será o que diz respeito ao homem como um animal político-social, no sentido ontológico do ser sensível em Aristóteles. Para tanto, a proposta (...) abarcará a Teoria das Quatro Causas de Aristóteles. Isso para demonstrar certa ontologia de uma suposta essência da ou na substancia no e do ser humano. Ou seja, quem é o “homem-ser-ente” coberto por sua estrutura física e sensível no sentido ontológico no corporal? São os seres humanos animais essencialmente políticos? E se forem são seres políticos do e ou no “espiritual”, “almático” e metafísico ou no físico-corporal? (shrink)

In the current debate in political philosophy, the so-called communitarian thinkers intend to offer an alternative to the dominant liberal thought. The ideal of ethicalcommunity as way of life in society in which intersubjective relationships are ruled by laws conceived as public laws, reintroduces the question of virtue in the scope of social and political life, with the requirement of an ethical style of doing politics.

Metaphysics relies on the presupposition of the non-being of the world: since the world has once not existed it is necessary to postulate a cause for its existence, i.e. an extrinsic principle to explain the absolute beginning of the causal series of all things that constitute the world. After the critique of theologizing metaphysics by authors like Kant, Hegel and Nietzsche, the notion of an absolute beginning still persists though in a field in which it often goes as such unnoticed, (...) while it factually enjoys wide acceptance, namely in epistemology. It sounds as a truism that knowledge begins: personal inexistence (birth-death cycle) and the phenomenon of unconsciousness (sleep-wake cycle) seem to endorse the obviousness of that statement. Now, to link the beginning of the phenomenal series of subjective acts of knowledge with the existence of an external world that causes the specific content of our temporary cognitive acts relies, however, on two presuppositions, namely on the thesis of a complete non-being or nothingness of knowledge and, intrinsically related to this first presupposition, on the thesis of an absolute beginning of cognitive activity. If knowledge begins from its own nothingness, there must be a cause that is external to the totality of acts of knowledge, a cause that it doesn´t belong to the series of cognitive acts and, therefore, that it is not caused by any of them: this uncaused cause of contentful knowledge is supposed to be the real world external to the knowing subject. In my paper I make explicit the relation between realist-empiricist approachs to epistemology and the double presupposition of the nothingness and absolute beginning of knowledge, I explain the difficulties implied by these two presuppositions and, finally, I propose as a plausible solution to those difficulties some key theoretical claims of absolute idealism. Resumo: Em décadas recentes, a investigação filosófica sobre a responsabilidade moral e o livre-arbítrio, que por muito tempo foi vista como um empreendimento principalmente teórico, passou a também incluir preocupações de tipo mais prático. Essa mudança é bem ilustrada pela proposta cética desenvolvida por autores como Derk Pereboom e Gregg Caruso. Seus trabalhos não apenas negam que sejamos agentes livres e moralmente responsáveis (em um sentido específico dos termos em questão), mas também defendem reformas na maneira como a responsabilização é (...) efetivada em nossas relações interpessoais e, especialmente, no sistema penal. Este artigo examina as implicações práticas do ceticismo de Pereboom e Caruso, principalmente no que diz respeito à sua implementabilidade. Argumento que o núcleo propriamente cético da proposta é inviável para seres humanos com a psicologia moral que temos, mas que, apesar disso, alguns elementos da proposta são compatíveis com uma proposta não-cética focada no aperfeiçoamento das práticas punitivas. Abstract: In recent decades, the philosophical investigation of moral responsibility and free will, which for a long time was seen as a mostly theoretical enterprise, became also the place of more practically oriented concerns. The skeptical view developed by Derk Pereboom and Gregg Caruso is a good illustration of the change. In their work, they not just deny that we are free and morally responsible agents (in a specific sense of the relevant terms) but also propose the reform of responsibility practices as they figure in our interpersonal relations and, especially, in the criminal justice system. This paper examines the practical implications of Pereboom and Caruso’s skepticism, particularly in what concerns its likelihood of being implemented. I argue that the strictly skeptical core of their proposal is not viable for human beings with a moral psychology like ours, but that some elements are nonetheless consistent with a non-skeptical view focused on the improvement of punitive practices. La doctrina del choque (Anstoß), que Fichte desarrolla ante todo en el Fundamento de toda la Doctrina de la Ciencia, pero también en otros escritos de la época de Jena, ha sido desde antaño objeto de crítica tanto por los admiradores como por los detractores de la filosofía fichteana. Existen al menos dos modos específicamente diferentes y aparentemente contrapuestos de comprender su sentido: según una lectura, el choque sería una autoafección del propio Yo; según otra, un residuo realista, en última (...) instancia incompatible con los compromisos idealistas del pensamiento de Fichte. La tensión entre ambos modos de comprender la tesis del choque pueden reeconcontrarse en la confrontación entre las interpretaciones así llamadas epistemológica y ontológica de la tesis de la “cosa en sí” en la filosofía de Kant –tesis con la que de hecho suele asociarse la tesis fichteana del choque. En este contexto, Hegel parecería a primera vista presentarse –por ejemplo, si se considera el escrito de la Diferencia entre los sistemas de filosofía de Fichte y Schelling– como partidario de una interpretación robusta, ontológica, de la tesis del choque; sin embargo, si se analiza el corpus hegeliano en su conjunto la posición de Hegel resulta ser más matizada y próxima a una interpretación por así llamarla epistemológica de dicha tesis. Con todo, aun así la postura de Hegel sobre el sentido de la tesis fichteana del choque en el contexto de una filosofía idealista continúa siendo crítica. (shrink)

Este artigo reconstrói os argumentos de Donald Davidson (1970) em favor de sua teoria do monismo anômalo e revisa as principais críticas que recebeu. Essa teoria é amplamente rejeitada atualmente e, dadas as inúmeras críticas recebidas, é razoável concluir que qualquer tentativa de reabilitação tem um longo caminho pela frente. A diversidade dessas críticas sugere que não há consenso sobre por que exatamente o monismo anômalo fracassa, embora as dificuldades pareçam convergir sobre a justificação e possibilidade da tese monista, e (...) não sobre a anomalia do mental. Kant claims that existence is not a real predicate that can be added to the concept of a thing, but that it is the mere positing of the thing. Kant considers this thesis to be evident for itself and therefore thinks that its rejection is the result of an " over-subtle argumentation ". In this paper I will show that the claim that existence is the positing of the content of mental concepts, far from being evident, rests on numerous philosophical (...) presuppositions. In this regard, I will defend the claim that the thought experiment of the nothingness of the existing world is what leads Kant to conceive existence as absolute positing. Furthermore, I will try to show that it is possible to accept the claim that existence is not a real predicate, without having to accept at the same time that it is the positing of the concept. With this purpose in view, I will focus specifically on Hegel´s claim that, in the general frame of a radically antiempiricist and coherentist epistemology, being resolves and dissolves into the determinate concept of the objects of knowledge.
