The purpose of this paper is to describe how judges engage in constitutional design, irrespective of legal tradition. I examine in great detail the role of the judge: as a conflict solver, as a member of an institution, as part of the political system and as a human being, for those are factors that intervene in the activities he makes. I later analyze the dynamics that a Constitution can have: the change in their structure conceptualized as interpretation, mutation and resistance (...) and their relation. Interpretation is the determination of the scope of a norm, mutation is the change of meaning without amendment and resistance is a concept that bridges the first two, which is the capacity of the constitutional rule to adapt to the political game and to assume mutations. Finally, these concepts are intertwined in order to show how judges by means of their function, (re)design the Constitution by means of adjudication and policymaking (rule issuance by the stating of precedent). Given the conceptual gap in the global justice debate today (where most of the talk is about the duties of the rich, but little is said about what the poor may do for themselves), in this article I reintroduce the idea of a right of necessity. I first delineate a normative framework for such a right, inspired by these historical accounts. I then offer a contemporary case where the exercise of the right of necessity would be morally legitimate according to (...) that framework – even though illegal and probably condemned by the standard moral norms. The case is that of a small group of Paraguayan campesinos (small farmers) suffering from the effects of a severe drought. In the third part, I introduce the concept of noncivil disobedience: I call an act of noncivil disobedience a conscientious, public, illegal and forcible act whose performance, while not necessarily intended directly as a means to bring about social and/or political change, may help to trigger these changes indirectly. In the fourth part, I suggest that certain instances where the right of necessity is overtly exercised – as in the case of the famine-struck Paraguayan campesinos – may also be interpreted in terms of noncivil disobedience, insofar as they serve a double function: as a means of satisfying immediate need, and as a marker of discontent in a society where the equal rights of individuals are a nominal ideal which remains unfulfilled in practice. I then address two objections that may be raised against resurrecting the idea of a right of necessity and identifying it in certain instances with noncivil disobedience. I conclude by suggesting that, at the point of convergence between the two, a basic right like the right of necessity recovers its value as an active, (rather than passive) entitlement of its holders, while the use of force enters the picture as a legitimate means that – at least under certain circumstances – may be resorted to within the limits of civil society. he territorial impacts of climate change will affect millions. This will happen not only as a direct consequence of climate change, but also because of policies for mitigating it—for example, through the installation of large wind and solar farms, the conservation of land in its role as carbon sink, and the extraction of materials needed for renewable energy technologies. In this article, we offer an overview of the justice-related issues that these impacts create. The literature on climate justice and territory (...) is vast and spans a range of disciplines, so we limit our discussion to a specific understanding of territory and a specific understanding of injustice that arises from its loss. We understand territory as a normative concept that describes a place under some agent's jurisdiction, where the agent is a politically organized collective and where the jurisdictional rights over that place secure a relevant degree of self-determination for that collective. Accordingly, we consider that the main injustice connected to the loss of territory due to climate change is the loss or undermining of the ability to exercise the collective right to self-determination, which requires some control over the place. This can happen if a territorial agent literally loses the ground where to stand as a direct effect of climate change, raising issues of justice in relocation; or if their place changes due to mitigation policies, affecting their use and understanding of territory, raising issues of justice in energy transition. A wide family of many-valued logics—for instance, those based on the weak Kleene algebra—includes a non-classical truth-value that is ‘contaminating’ in the sense that whenever the value is assigned to a formula φ⁠, any complex formula in which φ appears is assigned that value as well. In such systems, the contaminating value enjoys a wide range of interpretations, suggesting scenarios in which more than one of these interpretations are called for. This calls for an evaluation of systems with multiple contaminating (...) values. In this paper, we consider the countably infinite family of multiple-conclusion consequence relations in which classical logic is enriched with one or more contaminating values whose behavior is determined by a linear ordering between them. We consider some motivations and applications for such systems and provide general characterizations for all consequence relations in this family. Finally, we provide sequent calculi for a pair of four-valued logics including two linearly ordered contaminating values before defining two-sided sequent calculi corresponding to each of the infinite family of many-valued logics studied in this paper. This is a position article summarizing our approach to the philosophy of space and spatial representation. Our concern is mostly methodological: above all, we argue that a number of philosophical puzzles that arise in this field—puzzles concerning the nature of spatial entities, their material and mereological constitution, their relationship with the space that they occupy—stem from a confusion between semantic issues and true metaphysical concerns.

According to the brain drain argument, there are good reasons for states to limit the exit of their skilled workers (more specifically, healthcare workers), because of the negative impacts this type of migration has for other members of the community from which they migrate. Some theorists criticise this argument as illiberal, while others support it and ground a duty to stay of the skilled workers on rather vague concepts like patriotic virtue, or the legitimate expectations of their state and co-citizens. (...) In this article, on the contrary, we suggest that the liberal conception of states’ legitimate political authority demands, and not just permits, that developing states from which migration of skilled workers occurs set up contractual mechanisms. These mechanisms will ensure that state-funded training in the health sector is provided against a commitment on the part of future professionals to reciprocate with their services for the benefits obtained. If one of the conditions for the state to maintain legitimate political authority is to provide basic services such as healthcare to its subjects (while respecting at the same time their autonomy and freedom), then this is what developing states affected by the brain drain ought to do. What we call the authority-based approach to the brain drain also helps to clarify the obligations that other states have not to interfere with these contractual mechanisms when they exist, and not to profit from their absence. Inspired by FIFA’s legal instruments of training compensation and solidarity mechanism for the transfer of players, we conclude by suggesting a plausible global policy to complement this authority-based approach. This paper presents a semantical analysis of the Weak Kleene Logics Kw3 and PWK from the tradition of Bochvar and Halldén. These are three-valued logics in which a formula takes the third value if at least one of its components does. The paper establishes two main results: a characterisation result for the relation of logical con- sequence in PWK – that is, we individuate necessary and sufficient conditions for a set.

The book is divided into three parts. The first, containing three papers, focuses on the characterization of the central tenets of previii sentism (by Neil McKinnon) and eternalism (by Samuel Baron and Kristie Miller), and on the ‘sceptical stance’ (by Ulrich Meyer), a view to the effect that there is no substantial difference between presentism and eternalism. The second and main section of the book contains three pairs of papers that bring the main problems with presentism to the fore and (...) outlines its defence strategy. Each pair of papers in this section can be read as a discussion between presentists and eternalists, wherein each directly responds to the arguments and objections offered by the other. This is a discussion that is sometimes absent in the literature, or which is at best carried out in a fragmented way. The first two papers of the section deal with the problem of the compatibility of Special Relativity Theory (SRT) and presentism. SRT is often considered to be a theory that contradicts the main tenet of presentism, thereby rendering presentism at odds with one of our most solid scientific theories. Christian Wüthrich’s paper presents arguments for the incompatibility of the two theories (SRT and presentism) within a new framework that includes a discussion of further complications arising from the theory of Qauantum Mechanics. Jonathan Lowe’s paper, by contrast, develops new general arguments against the incompatibility thesis and replies to Wüthrich’s paper. The second pair of papers focuses on the problem that presentists face, in providing grounds for past tensed truths. In the first (by Matthew Davidson), new arguments are provided to defend the idea that the presentist cannot adequately explain how what is now true about the past is grounded, since for the presentist the past is completely devoid of ontological ground. The second paper (by Brian Kierland) takes up the challenge of developing a presentist explanation of past truths, beginning by outlining some existing views in the literature before advancing an original proposal. Ordinary reasoning about space—we argue—is first and foremost reasoning about things or events located in space. Accordingly, any theory concerned with the construction of a general model of our spatial competence must be grounded on a general account of the sort of entities that may enter into the scope of the theory. Moreover, on the methodological side the emphasis on spatial entities (as opposed to purely geometrical items such as points or regions) calls for a reexamination of the conceptual categories (...) required for this task. Building on material presented in an earlier paper, in this work we offer some examples of what this amounts to, of the difficulties involved, and of the main directions along which spatial theories should be developed so as to combine formal sophistication with some affinity with common sense. Logics based on weak Kleene algebra (WKA) and related structures have been recently proposed as a tool for reasoning about flaws in computer programs. The key element of this proposal is the presence, in WKA and related structures, of a non-classical truth-value that is “contaminating” in the sense that whenever the value is assigned to a formula ϕ, any complex formula in which ϕ appears is assigned that value as well. Under such interpretations, the contaminating states represent occurrences of a (...) flaw. However, since different programs and machines can interact with (or be nested into) one another, we need to account for different kind of errors, and this calls for an evaluation of systems with multiple contaminating values. In this paper, we make steps toward these evaluation systems by considering two logics, HYB1 and HYB2, whose semantic interpretations account for two contaminating values beside classical values 0 and 1. In particular, we provide two main formal contributions. First, we give a characterization of their relations of (multiple-conclusion) logical consequence—that is, necessary and sufficient conditions for a set Δ of formulas to logically follow from a set Γ of formulas in HYB1 or HYB2 . Second, we provide sound and complete sequent calculi for the two logics. (shrink)

This paper proposes a methodological strategy to investigate the question of the individuation of the senses both from a commonsensical and a scientific point of view. We start by discussing some traditional and recent criteria for distinguishing the senses and argue that none of them taken in isolation seems to be able to handle both points of views. We then pay close attention to the faculty of hearing which offers promising examples of the strategy we pursue of combining commonsense and (...) science. In particular, we argue in favour of a distinction between two kinds of modes of presentation associated with sound perception: a mechanical mode of presentation that makes sounds perceptible by other modalities than audition such as touch and a tonal mode of presentation that makes people conceive of sounds as the proper objects of auditory perception. This essay aims to expose the metaphysical underpinnings of enactivism. While enactivism relies heavily on rejecting the traditional mind-body problem by excluding the familiar thought experiments that favor phenomenal dualism, the crucial point that is overlooked is instead the brain-body problem, specifically the crucial interaction between the brain and the bodily limbs in their embodied activities of perception and cognition. If enactivism is correct, differences in sensory experience necessarily entail differences in embodied activity—this is the metaphysical core of enactivism, which (...) we think is entirely wrong. We will argue that a physical or biological body ("Körper") is configured or shaped into a perceptually living body ("Leib") by brain patterns and not by embodied activity or by the so-called sensorimotor contingencies. Undoubtedly, embodied actions influence sensory perception. However, since variations in embodied actions do not necessarily lead to variations in sensory experience, they are not metaphysically constitutive of these experiences (supervenience claim). This paper discusses three relevant logics that obey Component Homogeneity - a principle that Goddard and Routley introduce in their project of a logic of significance. The paper establishes two main results. First, it establishes a general characterization result for two families of logic that obey Component Homogeneity - that is, we provide a set of necessary and sufficient conditions for their consequence relations. From this, we derive characterization results for S*fde, dS*fde, crossS*fde. Second, the paper establishes complete sequent calculi (...) for S*fde, dS*fde, crossS*fde. Among the other accomplishments of the paper, we generalize the semantics from Bochvar, Hallden, Deutsch and Daniels, we provide a general recipe to define containment logics, we explore the single-premise/single-conclusion fragment of S*fde, dS*fde, crossS*fdeand the connections between crossS*fde and the logic Eq of equality by Epstein. Also, we present S*fde as a relevant logic of meaninglessness that follows the main philosophical tenets of Goddard and Routley, and we briefly examine three further systems that are closely related to our main logics. Finally, we discuss Routley's criticism to containment logic in light of our results, and overview some open issues. (shrink)

In this paper, we extend the expressive power of the logics K3, LP and FDE with anormality operator, which is able to express whether a for-mula is assigned a classical truth value or not. We then establish classical recapture theorems for the resulting logics. Finally, we compare the approach via normality operator with the classical collapse approach devisedby Jc Beall.

ABSTRACT The philosophical tradition approaches to morals have their grounds predominantly on metaphysical and theological concepts and theories. Among the traditional ethics concepts, the most prominent is the Divine Command Theory (DCT). As per the DCT, God gives moral foundations to the humankind by its creation and through Revelation. Morality and Divinity are inseparable since the most remote civilization. These concepts submerge in a theological framework and are largely accepted by most followers of the three Abrahamic traditions: Judaism, Christianity, and (...) Islam: the greatest part of the human population. Holding faith and Revelation for its grounds, the Divine Command Theories are not strictly subject to the demonstration. The opponents to the Divine Command conception of morals, grounded in the impossibility of demonstration of its metaphysical and religious assumptions, have tried for many centuries (albeit unsuccessfully) to devalue its importance. They held the argument that it does not show material evidence and logical coherence and, for this reason, cannot be taken into account for scientific nor philosophical purposes. It is just a belief and, as so, should be understood. Besides these extreme oppositions, many other concepts contravene the Divine Command theories, in one or another way, in part or in full. Many philosophers and social scientists, from the classic Greek philosophy up to the present date, for instance, sustain that morality is only a construct, and thus culturally relative and culturally determined. However, this brings many other discussions and imposes the challenge to determine what is the meaning of culture, which elements of culture are morally determinant, and finally, what are the boundaries of such relativity. Moral determinists claim that everything related to human behavior, including morality, is determined, once free will does not exist. More recently, modern thinkers argued that there is a strict science of morality. However, the scientific method alone, despite explaining several facts and evidence, cannot enlighten the entire content and full meaning of ethics. Morals’ understanding requires a broader perception, and an agreement among philosophers, which they have never achieved. All of these questions have many different configurations depending on each philosophical strand, and start complex analysis and endless debates, as long as many of them are reciprocally conflictive. The universe and the atmosphere involving this thesis are the dominions of all these conceptual conflicts, observed from an objective and evolutionary standpoint. Irrespective of this circumstance and its intrinsic importance, however, these questions are far distant from the methodological approach of an analytical discussion on objective morals, what is, indeed, the aim and scope of this work. We should briefly revisit these prominent traditional theories because this thesis shelters a comparative study, and its assumptions at least differ profoundly from all traditional theories. Therefore, it becomes necessary offering direct and specific elements of comparison to the reader, for the right criticism, dispensing interruptive researches. However, even revisiting the traditional theories, for this comparative and critical exposure purpose, they will be kept by the side of our main concerns, as “aliena materia.” Irrespective of the validity of any or all of the elements of this discussion, and their meaning as the philosophical universe of this thesis, the purpose of this work is demonstrating and justifying the existence and meaning of prehistoric moral archetypes arisen directly from the very first social needs and efforts for survival. These archetypes are the definition of the essential foundation of ethics, its aggregation to the collective unconscious and corresponding logic organization and transmission to evolutionary stages of the human genome and different relations space-time, irrespective of any contemporary experience of the individuals. The system defined by these archetypes composes an evolutionary human social model. Is this a metaethical position? Yes, it is. Moreover, as in any metaethical reasoning, we should look carefully for the best and coherent routes, as the Analytical Philosophy offers them. Thus, this work should reasonably demonstrate that morals are not a cultural product of the civilized men or modern societies and that despite being subject to several cultural relative aggregations and subtractions, its essential foundations are archetypal and have never structurally changed. This reasoning induces that morality is an original attribute of the “homo sapiens”; it is not a property and nor an accident: it integrates the human essence and belongs to the realm of the ontological human identity. The human phenomena is a continuing process, playing its role between random determination and free will, and we need to question how morality began and how did it come to us in the present. From the end of the twelfth century until the middle of the eighteenth century, the concept of a right of necessity –i.e. the moral prerogative of an agent, given certain conditions, to use or take someone else’s property in order to get out of his plight– was common among moral and political philosophers, who took it to be a valid exception to the standard moral and legal rules. In this essay, I analyze Samuel Pufendorf’s account of such a right, founded (...) on the basic instinct of self-preservation and on the notion that, in civil society, we have certain minimal duties of humanity towards each other. I review Pufendorf’s secularized account of natural law, his conception of the civil state, and the function of private property. I then turn to his criticism of Grotius’s understanding of the right of necessity as a retreat to the pre-civil right of common use, and defend his account against some recent criticisms. Finally, I examine the conditions deemed necessary and jointly sufficient for this right to be claimable, and conclude by pointing to the main strengths of this account. In this paper, we approach the problem of classical recapture for LP and K3 by using normality operators. These generalize the consistency and determinedness operators from Logics of Formal Inconsistency and Underterminedness, by expressing, in any many-valued logic, that a given formula has a classical truth value (0 or 1). In particular, in the rst part of the paper we introduce the logics LPe and Ke3 , which extends LP and K3 with normality operators, and we establish a classical recapture (...) result based on the two logics. In the second part of the paper, we compare the approach in terms of normality operators with an established approach to classical recapture, namely minimal inconsistency. Finally, we discuss technical issues connecting LPe and Ke3 to the tradition of Logics of Formal Inconsistency and Underterminedness. (shrink)

There are two main ways in which the notion of mereological fusion is usually defined in the current literature in mereology which have been labelled ‘Leśniewski fusion’ and ‘Goodman fusion’. It is well-known that, with Minimal Mereology as the background theory, every Leśniewski fusion also qualifies as a Goodman fusion. However, the converse does not hold unless stronger mereological principles are assumed. In this paper I will discuss how the gap between the two notions can be filled, focussing in particular (...) on two specific sets of principles that appear to be of particular philosophical interest. The first way to make the two notions equivalent can be used to shed some interesting light on the kind of intuition both notions seem to articulate. The second shows the importance of a little-known mereological principle which I will call ‘Mild Supplementation’. As I will show, the mereology obtained by adding Mild Supplementation to Minimal Mereology occupies an interesting position in the landscape of theories that are stronger than Minimal Mereology but weaker than what Achille Varzi and Roberto Casati have labelled ‘Extensional Mereology’. By giving sympathy a central role, Adam Smith’s Theory of Moral Sentiments (1759) can be regarded as one of the ‘enlightened’ moral theories of the Enlightenment, insofar as it widened the scope of moral consideration beyond the traditionally restricted boundary of human beings. This, although the author himself does not seem to have been aware of this fact. In this paper, I want to focus on two aspects which I think lead to this conclusion. First, by making sentience the requisite (...) to be taken into moral consideration, nonhuman animals in Smith’s moral theory can count as moral patients towards whom we should exercise the virtue of beneficence (if not justice). Secondly, Smith’s idea of morality as working in concentric circles –generating more stringent duties towards those closer to us– could explain and perhaps also justify our caring for some nonhuman animals, especially pets. How does one know the phenomenal character of one’s own experience? I aim to present and defend a new view of the epistemology of qualia that addresses this issue. My view results from a reworking of Dretske’s displaced perception model. The guiding line is the key Wittgensteinian insight of his Private Language Argument, namely the claim that no inner perception of qualia can justify our corresponding qualia beliefs. My reworking of the original model starts with the rejection of Dretske’s representationalism, (...) as well as any other metaphysical views about the ultimate nature of qualia. The reworking of the displaced perception model I am proposing is supposed to be compatible with any available metaphysical view on qualia. The second step consists of rejecting the epistemological misgivings of the original model, namely the view that knowing qualia requires “connecting beliefs” along with “meta-representations.” Yet, Dretske’s crucial mistake has been to force knowledge of qualia into the “belief-box.” As a matter of fact, there is only one belief involved in introspecting qualia, namely the qualia-belief itself. The third final step is this. Assuming the key Wittgensteinian insight, I argue that introspection of qualia is a process that is both epis- temically reliable and automatic. It is reliable because it dispenses with justification of any beliefs whatsoever. Moreover, it is automatic because it also dispenses with reflexive connecting beliefs. For example, it takes nonconceptual awareness of the color blue as an input and automatically yields the belief that phenomenal blue is the conscious character of my experience of the sky as an output just by employing the concept BLUE. Narrowly understood, veganism is the practice of excluding all animal products from one’s diet, with the exception of human milk. More broadly, veganism is not only a food ethics, but it encompasses all other areas of life. As defined by the Vegan Society when it became an established charity in the UK in 1979, veganism is best understood as “a philosophy and way of living which seeks to exclude – as far as is possible and practicable – all forms of (...) exploitation of, and cruelty to, animals for food, clothing or any other purpose; and by extension, promotes the development and use of animal-free alternatives for the benefit of humans, animals and the environment”. There are two main moral justifications for veganism, both of which rely on a common assumption: that sentience, i.e., the capacity to feel pleasure and pain, is the necessary and sufficient trait to be morally considerable. In what follows, I present these two justifications and a third one which, although less popular, captures some core intuitions among vegans. I then present a challenge faced by veganism and two arguments that reject it as discriminatory, and briefly conclude. (shrink)

From the second half of the last century, there has been a widespread view in the Anglophone world that Kant’s transcendental deduction (aka TD) aims to vindicate our common-sense view of the world as composed of public and objective particulars against some unqualified forms of skepticism. This widespread assumption has raised serious doubt not only about the success of TD but also about the very nature of its argument in both editions of the Critique. Yet, if there is a connection (...) between TD and global skepticism, the intriguing question is: Who is this skeptic? According to Strawson, “the skeptic” is a hypothesis of a purely sense-datum experience. In contrast, the fact that TD turns on the key notion of self-consciousness has induced several other scholars to assume that the skeptic is no none but a Cartesian external-world skeptic. None of those readings find textual support or are compatible with the very structure of the first Critique. The question is: Does this mean that TD aims only to undermine empiricism, as Guyer suggests? I do not believe so. I am pretty convinced that TD addresses a peculiar form of global skepticism, namely “Hume’s challenge to reason.” Assuming that we cognize (erkennen) and experience (erfahren) appearances as objects as a requirement of Newtonian physics, TD aims to provide a justification of the principle that nature is uniform that is superior to Hume’s justification. We introduce and discuss a knowledge-driven distillation approach to explaining black-box models by means of two kinds of interpretable models. The first is perceptron (or threshold) connectives, which enrich knowledge representation languages such as Description Logics with linear operators that serve as a bridge between statistical learning and logical reasoning. The second is Trepan Reloaded, an ap- proach that builds post-hoc explanations of black-box classifiers in the form of decision trees enhanced by domain knowledge. Our aim is, firstly, to target (...) a model-agnostic distillation approach exemplified with these two frameworks, secondly, to study how these two frameworks interact on a theoretical level, and, thirdly, to investigate use-cases in ML and AI in a comparative manner. Specifically, we envision that user-studies will help determine human understandability of explanations generated using these two frameworks. (shrink)

The aim of this paper has been to present a new reconstruction of Kant’s Refutation of Idealism. I have considered several different targets of the Refutation, five of them mentioned by Kant himself. I believe that I have shown that the Refutation of Idealism is best considered only as a sound argument against Mendelssohnian subjectivist idealism, against Mendelssohnian immaterialism, and against Mendelssohnian realist idealism. First, Kant’s Refutation is a sound argument in favor of the claim that the outer things represented (...) in our minds are real rather than ideal; that is, they exist mind-independently as noumena. And second, Kant’s refutation is a sound argument for a fundamental ontology of noumena: the ultimate nature of reality and of our minds is neither material nor mental but made up of things in themselves. Este artículo pretende ofrecer una visión alternativa tanto de la lectura conceptualista tradicional de Kant como de la nueva lectura no conceptualista. En contra de las lecturas conceptualistas tradicionales sostengo que confunden las condiciones para la representación sensible de los objetos (tesis de la intencionalidad) con las condiciones para el reconocimiento (Erkenntnis) de que representamos objetos mediante intuiciones sensibles (tesis del reconocimiento). En contra de las lecturas no conceptualistas sostengo que no distinguen el no conceptualismo -propio de la filosofía contemporánea (...) de la mente- de las tesis antiintelectualistas de Kant. Tales lecturas fracasan porque se equivocan al atribuir un contenido representacional a las intuiciones sensibles de Kant. This article aims to analyze the functioning of thought experiments in ethics. We will demonstrate that although many thought experiments in ethics can be reconstructed as arguments, according to the thesis defended by John Norton, its reconstructed version does not have the same epistemic force. We will argue that the reconstructed versions are not capable of bringing the same type of understanding in relation to thought experiments, which have an explanatory advantage that arguments do not have. Therefore, arguments are not (...) a sufficient condition for solving problems within ethics and also within thought experiments in this area. We will argue that emotions can be one of the non-argumentative factors that can produce negative and positive interference on thought experimenters and thought experiment, which cannot be demonstrated accurately in the reconstructed version. In this way, the reconstructed version is not able to convey an adequate understanding of emotions and other influences. Finally, we will elaborate on two thought experiments that demonstrate the need to use emotions in moral actions based on the criticism produced by Flávio Williges against traditional moral theories. These thought experiments can be reconstructed as arguments, but without giving us the same understanding that thought experiments are capable of. (shrink)

Content nonconceptualism and State conceptualism are motivated by different readings of what I want to call here Bermúdez’s conditions on content-attribution (2007). In one read- ing, what is required is a neo-Fregean content to solve problems of cognitive significance at the nonconceptual level (Toribio, 2008; Duhau, 2011). In the other reading, what is required is a neo-Russellian or possible-world content to account for how conspecifics join attention and cooperate, contemplating the same things from different perspectives in the same perceptual field. The solution to this apparent contradiction is the rejection of the real content view and the adherence to what I call here Content-pragmatism: there is no such thing as the content of experience. According to content pragmatism, “proposition” is not as real as a mental state, but rather, it is a term of art that semanticists use, as a matter of theoretical convenience, to classify mental states. What follows from Content-pragmatism is Content- pluralism: there are so many contents that are required to meet Bermúdez’s condition on content attribution. Because both criticism and the defense of State conceptualism overlook the real scope of Bermúdez’s condition on content attribution, they are ineffective. In this paper, I will argue that the opposition between State and Content nonconceptualism is a real one, but only a relative one, that is, relative to the opposite constraints to be met. If we want to solve the problems of cognitive significance, the best we can do is to let the content of experience be modeled as neo-Fregean content, namely, a compound of nonconceptual modes of presentation of objects and properties. In this case, Content-nonconceptualism prevails. In contrast, if we want to account for how conspecifics join attention to the same entities in the same perceptual field from different perspectives, the best we can do is let the content of experience be modeled either as a structured Russellian proposition or as a function from possible worlds to truth-values. At the basis of modern natural law theories, the concept of the suum, or what belongs to the person (in Latin, his, her, its, their own), has received little scholarly attention despite its importance both in explaining and justifying not only the genealogy of property, but also that of morality and war.1 In this paper I examine Hugo Grotius's what it is, what things it includes, what rights it gives rise to and how it is extended in the transition from (...) the state of nature to civil society. I then briefly point out how bringing this concept back to the fore could help to illuminate the current discussion on the foundations of basic human rights, and to evaluate cases where these seem to clash with property rights. Axiom weakening is a technique that allows for a fine-grained repair of inconsistent ontologies. Its main advantage is that it repairs on- tologies by making axioms less restrictive rather than by deleting them, employing the use of refinement operators. In this paper, we build on pre- viously introduced axiom weakening for ALC, and make it much more irresistible by extending its definitions to deal with SROIQ, the expressive and decidable description logic underlying OWL 2 DL. We extend the definitions of (...) refinement operator to deal with SROIQ constructs, in particular with role hierarchies, cardinality constraints and nominals, and illustrate its application. Finally, we discuss the problem of termi- nation of an iterated weakening procedure. (shrink)

In this paper I will present three arguments (based on the notions of constitution, metaphysical reality, and truth, respectively) with the aim of shedding some new light on the structure of Fine’s (2005, 2006) ‘McTaggartian’ arguments against the reality of tense. Along the way, I will also (i) draw a novel map of the main realist positions about tense, (ii) unearth a previously unnoticed but potentially interesting form of external relativism (which I will label ‘hyper-presentism’) and (iii) sketch a novel (...) interpretation of Fine’s fragmentalism (which I contrast with Lipman’s 2015, 2016b, forthcoming). This paper is concerned with certain ontological issues in the foundations of geographic representation. It sets out what these basic issues are, describes the tools needed to deal with them, and draws some implications for a general theory of spatial representation. Our approach has ramifications in the domains of mereology, topology, and the theory of location, and the question of the interaction of these three domains within a unified spatial representation theory is addressed. In the final part we also consider (...) the idea of non-standard geographies, which may be associated with geography under a classical conception in the same sense in which non-standard logics are associated with classical logic. The methodological anarchy that characterizes much recent research in artificial intelligence and other cognitive sciences has brought into existence (sometimes resumed) a large variety of entities from a correspondingly large variety of (sometimes dubious) ontological categories. Recent work in spatial representation and reasoning is particularly indicative of this trend. Our aim in this paper is to suggest some ways of reconciling such a luxurious proliferation of entities with the sheer sobriety of good philosophy.

Events are center stage in several fields of psychological research. There is a long tradition in the study of event perception, event recognition, event memory, event conceptualization and segmentation. There are studies devoted to the description of events in language and to their representation in the brain. There are also metapsychological studies aimed at assessing the nature of mental events or the grounding of intentional action. Outside psychology, the notion of an event plays a prominent role in various areas of (...) philosophy as well as in such diverse disciplines as linguistics, probability theory, artifical intelligence, physics, and�of course� history. This plethora of concerns and applications is indicative of the prima facie centrality of the notion of an event in our conceptual scheme, but it also gives rise to some important methodological questions. Can we identify a core notion that is preserved across disciplines? Does this notion, or some such notion, correspond to the pre-theoretical conception countenanced by common sense? According to Composition is Identity, a whole is literally identical to the plurality of its parts. According to Mereological Nihilism, nothing has proper parts. In this note, it is argued that Composition is Identity can be shown to entail Mereological Nihilism in a much more simple and direct way than the one recently proposed by Claudio Calosi.

What is the relation between parts taken together and the whole that they compose? The recent literature appears to be dominated by two different answers to this question, which are normally thought of as being incompatible. According to the first, parts taken together are identical to the whole that they compose. According to the second, the whole is grounded in its parts. Grounding contingentism is the doctrine according to which grounds are not guaranteed to necessitate what they ground. In this paper I will argue that the most plausible version of contingentism is incompatible with the idea that the grounding relation is transitive, unless either ‘priority monism’ or ‘contrastivism’ are assumed.

Since the second half of the XXth century, researchers in cybernetics and AI, neural nets and connectionism, Artificial Life and new robotics have endeavoured to build different machines that could simulate functions of living organisms, such as adaptation and development, problem solving and learning. In this book these research programs are discussed, particularly as regard the epistemological issues of the behaviour modelling. One of the main novelty of this book consists of the fact that certain projects involving the building of (...) simulative machine models before the advent of cybernetics are been investigated for the first time, on the basis of little known, and sometimes completely forgotten or unpublished, texts and figures. Fine (2005, 2006) has presented a ‘trilemma’ concerning the tense-realist idea that reality is constituted by tensed facts. According to Fine, there are only three ways out of the trilemma, consisting in what he takes to be the three main families of tense-realism: ‘presentism’, ‘(external) relativism’, and ‘fragmentalism’. Importantly, although Fine characterises tense-realism as the thesis that reality is constituted (at least in part) by tensed facts, he explicitly claims that tense realists are not committed to their fundamental existence. Recently, (...) Correia and Rosenkranz (2011, 2012) have claimed that Fine’s tripartite map of tense realism is incomplete as it misses a fourth position they call ‘dynamic absolutism’. In this paper, I will argue that dynamic absolutists are committed to the irreducible existence of tensed facts and that, for this reason, they face a similar trilemma concerning the notion of fact-content. I will thus conclude that a generalised version of Fine’s trilemma, concerning both fact-constitution and fact-content, is indeed inescapable. (shrink)

I argue that my non-dual epistemic-phenomenalist view is the one that best harmonises my interpretation of the Fourth Paralogism with the widely shared reading of the Refutation of Idealism that I sketched and defended above. The bottom line of my view is a clear distinction between the metaphysical and epistemological sides of Kantian idealism. Again, according to my non-dual-epistemic-phenomenalism, the mundus sensibilis and mundus intelligibilis are epistemologically distinct ways of considering the metaphysically identical outside world. Appearances are nothing but the (...) way the things in themselves appear or exist inside our sensible minds as mere representations. In this sense, I reject both the two-world view, the two-aspect view, and Allais’s deflationary anti- phenomenalist reading. (shrink)

Um dos principais problemas epistemológicos que podem ser encontrados no estudo dos experimentos mentais diz respeito ao critério de escolha entre casos que produzam resultados contraditórios. Que justificação possuímos para escolher entre C e ~C? James Roberto Brown argumenta a favor de um critério de probabilidade, onde se atribui probabilidade aos dois fenômenos e o mais provável de ser verdadeiro é o que aceitamos. John Norton argumenta que experimentos mentais são argumentos, por isso eles podem ser reconstruídos como argumentos. (...) Através desse processo podemos encontrar as falhas na argumentação do experimento e decidir, através de justificação lógica, qual é a conclusão correta. A abordagem de Brown se mostra muito infrutífera por não apresentar como o cálculo de probabilidade deve funcionar, nem como é possível atribuir probabilidades a verdade dos resultados dos experimentos mentais. Por outro lado, para aceitar a resposta de Norton, necessitamos aceitar que experimentos mentais realmente façam uso de argumentos e que isso seja tudo o que podemos dizer sobre eles. Essa estruturação não permite nenhuma outra fonte epistêmica para justificar os resultados dos experimentos metais. (shrink)

ABSTRACTThe ability of providing an adequate supervenience base for tensed truths may seem to be one of the main theoretical advantages of both the growing-block and the moving-spotlight theory of time over presentism. However, in this paper I will argue that some propositions appear to be as problematic for growing-block theorists as past-directed propositions are for presentists, namely propositions stating that nothing will be the case in the future. Furthermore, I will show that the moving-spotlight theory can adequately address all (...) the main supervenience challenges that can be levelled against A-theories of time. I will, thus, conclude that, at least as far as the supervenience principle is concerned, the moving-spotlight theory should be preferred over both presentism and the growing-block theory. (shrink)

This paper is a new defense of type-B materialism against Jackson’s knowledge argument (1982) inspired by the Kantian main opposition between concepts and sensible intuitions. Like all materialists of type B, I argue that on her release from her black-and-white room, Mary makes cognitive progress. However, contrary to the so-called phenomenal concept strategy (henceforth PCS), I do not think that such progress can be accounted for in terms of the acquisition of new concepts. I also reject Tye’s recent account of (...) Mary’s cognitive progress as the acquisition of a “thing-knowledge.” What is crucial is not the Russellian opposition between knowing things and knowing truths but rather the Kantian opposition between conceptual and nonconceptual representations of the same thing (property). Mary’s phenomenal knowledge is here accounted for as the result of the cooperation of her newly acquired nonconceptual representation of the same phenomenal redness (the same thing) she had a conceptual representation before. As that new nonconceptual representation carries information about the same physical property she already represented but is now coded in analog rather than in digital form (Dretske, 1981), that nonconceptual representation can be accounted for in physical terms as Chalmers’s Master argument requires. Nevertheless, that representation can account for Mary’s cognitive progress since it carries information coded in analog form, something that the imprisoned she could never possess. (shrink)

My account of the causal role of consciousness in a physical world is modeled on Dretske’s celebrated explanation of the causal role of beliefs (something that Dretske himself never offered). First, behavior must be understood as a (broadly individuated) process that begins with some external stimulus causing some neurological event C, and ends with causing a bodily movement M (e.g., the Kennedy assassination is a process that begins with Oswald pulling the trigger at 12:30pm CST on November 23 in 1963 (...) in Dallas, Texas, but only ends half an hour later when Kennedy is pronounced dead at 1 pm CST). The internal neurological event C causes bodily movement M, but only by virtue of being recruited by natural selection to represent the instantiation of some external property F when properly stimulated under normal circumstances. But the reason why C causes M lies in the fact that C represents the instantiation of the external property F. I withdraw my hand from a hot surface because the activation of nociceptive specific neurons in my parietal lobe (together with the activation of neuronal patterns in my motor cortices) was recruited by natural selection to represent the tissue damage in my hand. The activation of nociceptive specific neurons causes my hand to withdraw but for the reason that it represents tissue data at the time that I felt pain in my hand. (shrink)

We set forth what one may call a “constitutional reading” in opposition to the traditional widespread “constructivist reading” of the object of cognition. In the light of the so-called one-object view reading of Transcendental idealism, the object of cognition is nothing but the object that exists in itself insofar as it appears to our cognitive apparatus. The object exists mind-independently, while our cognition of the same object must be mind-independent. The constructivist reading mistakes the epistemological problem of how we come (...) to cognize mind-dependently that what we represent (“the constitutional view”) are mind-independent objects with the Berkelian ontological problem of how we construct objects out of an undifferentiated, unstructured manifold (the constructivist view) My diagnosis is as follows. The first reason is the traditional “two-worlds view” reading of Kant’s idealism. If we take what exists in itself and the object of cognition as distinct things, then we must conclude that the object of cognition is a mind-dependent construction. Constructivist readers mistake the mind-dependent nature of our human cognition of objects for the putative mind-dependent nature of the known object. The second reason is overintellectualization. Constructivist readers mistake the objectifying syntheses of the imagination, below the threshold of self-consciousness, for cognitive conceptual operations by means of which we cognize (erkennen) the objects of cognition, or so I shall argue.
