Mental causation, though a forceful intuition embedded in our commonsense psychology, is difficult to square with the rest of commitments of physicalism about the mind. Advocates of mental causation have found solace in the causal inheritance principle, according to which the mental properties of mental statesshare the causal powers of their physical counterparts. In this paper, I present a variety of counterarguments to causal inheritance and conclude that the conditions for causal inheritance are stricter than what standing versions of said (...) principle imply. In line with this, physicalism may be destined to epiphenomenalism unless multiple realizability turns out false. (shrink)

Despite pervasive variation in the content of laws, legal theorists and anthropologists have argued that laws share certain abstract features and even speculated that law may be a human universal. In the present report, we evaluate this thesis through an experiment administered in 11 different countries. Are there cross‐cultural principles of law? In a between‐subjects design, participants (N = 3,054) were asked whether there could be laws that violate certain procedural principles (e.g., laws applied retrospectively or unintelligible laws), and also (...) whether there are any such laws. Confirming our preregistered prediction, people reported that such laws cannot exist, but also (paradoxically) that there are such laws. These results document cross‐culturally and –linguistically robust beliefs about the concept of law which defy people's grasp of how legal systems function in practice. (shrink)

The experimental turn in philosophy has reached several sub-fields including ethics, epistemology, and metaphysics. This paper is among the first to apply experimental techniques to questions in the philosophy of law. Specifically, we examine Lon Fuller's procedural natural law theory. Fuller famously claimed that legal systems necessarily observe eight principles he called "the inner morality of law." We evaluate Fuller's claim by surveying both ordinary people and legal experts about their intuitions about legal systems. According to the so-called Classical Theory, concepts are mentally represented by individually necessary and jointly sufficient application conditions. One of the principal empirical objections against this view stems from evidence that people judge some instances of a concept to be more typical than others. In this paper we present and discuss four empirical studies that investigate the extent to which this ‘typicality effect’ holds for the concept of basic needs. Through multiple operationalizations of typicality, our studies yielded evidence for a (...) strong effect of this kind: Participants tended to recall the same core examples of the concept in a free-listing task. They judged some basic needs to be more typical than others. The items that were judged to be more typical were listed more frequently in the free-listing task. These items were listed earlier on in the free-listing task. Typical basic needs, as well as non needs, were classified faster than atypical basic needs in a reaction time study. These findings suggest that the concept of basic needs may have a non-classical structure. If so, the quest for a simple and robust intensional analysis of the concept may be futile. (shrink)

The Welfare-Funded Sex Doula Programme is a proposed sexual needs service that advances the sexual citizenship of disabled people by providing specially trained ‘sex doulas’ to meet the various, often complex, sexual needs of disabled people. Conceived as providing disabled individuals with practical sexual support services, the role of the sex doula includes advocacy, counselling, therapy, and practical relief from sexual tension. The programme constitutes a robust, comprehensive, and theoretically cohesive welfare service that seeks to provision access to sexual citizenship (...) for disabled people. -/- Grounded in Aristotelian concepts of flourishing, the programme identifies sexual citizenship as a fundamental basic need and seeks to ensure that disabled people have the opportunity to achieve the same level of sexuality as able-bodied people. Work advancing the programme includes both philosophical and theoretical arguments showing how the programme is justified under several moral frameworks, and claims made therein have resulted in velitation in the literature regarding the potential of such a programme to violate individuals’ negative rights. In the remainder of this article, we will disarm an important motivation for epistemic contextualism and interest-relative invariantism. We will accomplish this by presenting a stringent test of whether there is a stakes effect on ordinary knowledge ascription. Having shown that, even on a stringent way of testing, stakes fail to impact ordinary knowledge ascription, we will conclude that we should take another look at classical invariantism. Here is how we will proceed. Section 1 lays out some limitations of previous (...) research on stakes. Section 2 presents our study and concludes that there is little evidence for a substantial stakes effect. Section 3 responds to objections. The conclusion clears the way for classical invariantism. Following the publication of his magnum opus L’être et l’événement (Being and Event) in 1988, Alain Badiou has been acclaimed as one of France’s greatest living philosophers. This paper explores an emerging sub-field of both empirical bioethics and experimental philosophy, which has been called “experimental philosophical bioethics” (bioxphi). As an empirical discipline, bioxphi adopts the methods of experimental moral psychology and cognitive science; it does so to make sense of the eliciting factors and underlying cognitive processes that shape people’s moral judgments, particularly about real-world matters of bioethical concern. Yet, as a normative discipline situated within the broader field of bioethics, it also aims to contribute to substantive (...) ethical questions about what should be done in a given context. What are some of the ways in which this aim has been pursued? In this paper, we employ a case study approach to examine and critically evaluate four strategies from the recent literature by which scholars in bioxphi have leveraged empirical data in the service of normative arguments. In this thesis, I argue for a realistic account of what conceptual engineering can hope to achieve when engineering concepts. I criticize conceptual engineers for not taking the implementation challenge, and problems with the feasibility of their proposals, into account when proposing to change concepts, threatening to trivialize conceptual engineering. In addition, conceptual engineers have had a tendency to expect too much from concepts, and suggest extensive changes to the meaning to all uses of a concept. As a solution, I (...) suggest Fabianism, which is to have apparent goals, and realistic tactics to achieve those goals. Specifically, I suggest three remedies, which is to (a) view concepts as embedded in frameworks, and (b) make less extensive changes to the meaning of (c) only some (or one) uses of concepts. Essentially, I argue that we should engineer conceptual frameworks, and not individual concepts. In the second part of the thesis, I explore an implication of Fabianism on the way that conceptual engineers assess concepts, concluding that we should assess concepts by the functions they perform in a conceptual framework, which has not been the predominant view of concept assessment in conceptual engineering. At the height of the Covid-19 pandemic, frontline medical professionals at intensive care units around the world faced gruesome decisions about how to ration life-saving medical resources. These events provided a unique lens through which to understand how the public reasons about real-world dilemmas involving trade-offs between human lives. In three studies (total N = 2298), we examined people’s moral attitudes toward the triage of acute coronavirus patients, and found elevated support for utilitarian triage policies. These utilitarian tendencies did not (...) stem from period change in moral attitudes relative to pre-pandemic levels–but rather, from the heightened realism of triage dilemmas. Participants favoured utilitarian resolutions of critical care dilemmas when compared to structurally analogous, non-medical dilemmas–and such support was rooted in prosocial dispositions, including empathy and impartial beneficence. Finally, despite abundant evidence of political polarisation surrounding Covid-19, moral views about critical care triage differed modestly, if at all, between liberals and conservatives. Taken together, our findings highlight people’s robust support for utilitarian measures in the face of a global public health threat, and illustrate how the dominant methods in moral psychology (e.g. trolley cases) may deliver insights that do not generalise to real-world moral dilemmas. Rawls’ realistic utopia has been subject to much criticism. The Realist claims Rawls’ realistic utopia to be too utopian. The Cosmopolitan, on the other hand, claims Rawls’ realistic utopia to be insufficiently utopian. In this essay, I argue that the criticism can be circumvented by means of clarifying an ambiguity in the concept of utopia. I argue that the Realist is not criticizing Rawls for being utopian, but unrealistic, impractical and idealistic (quixotic). The Cosmopolitan might be right in criticizing Rawls (...) for not being utopian enough. The orthodox understanding of utopia, adopted by the Cosmopolitan is, however, in itself quixotic. Drawing on Le Guin’s The Dispossessed, I propose a novel understanding of how utopia ought to be understood. Once the Rawlsian adopts this conception of utopia, it alleviates the objections raised by the Realist and the Cosmopolitan. (shrink)

Does the Ship of Theseus present a genuine puzzle about persistence due to conflicting intuitions based on “continuity of form” and “continuity of matter” pulling in opposite directions? Philosophers are divided. Some claim that it presents a genuine puzzle but disagree over whether there is a solution. Others claim that there is no puzzle at all since the case has an obvious solution. To assess these proposals, we conducted a cross-cultural study involving nearly 3,000 people across twenty-two countries, speaking eighteen (...) different languages. Our results speak against the proposal that there is no puzzle at all and against the proposal that there is a puzzle but one that has no solution. Our results suggest that there are two criteria—“continuity of form” and “continuity of matter”— that constitute our concept of persistence and these two criteria receive different weightings in settling matters concerning persistence. In the thick of the global plague, Richard, Justin and Valery agreed to hold a conversation on the topic of poetics, self-understanding, and health. An analysis and discussion of this trinity requires love of poetry and philosophy. Both supreme human practices take common root in mythology and religion, and also share a notorious categorical divide, that of reason against affect. Is this Platonic divide indeed categorical, given both practices rely on language and creativity to compose their meaning? Interestingly, the practice (...) of poetics does not have the reputation for boosting one's health, in the mainstream understanding of that concept. If anything, poetic practice gained notoriety for corrupting one's mind and, possibly, life. Like philosophy? We touched on these and other classical aporia, on the political struggles in American and Australian poetry. Background Consent policies for post-mortem organ procurement (OP) vary throughout Europe, and yet no studies have empirically evaluated the ethical implications of contrasting consent models. To fill this gap, we introduce a novel indicator of governance quality based on the ideal of informed support, and examine national differences on this measure through a quantitative survey of OP policy informedness and preferences in seven European countries. -/- Methods Between 2017–2019, we conducted a convenience sample survey of students (n = 2006) in (...) Austria (AT), Belgium (BE), Denmark (DK), Germany (DE), Greece (GR), Slovenia (SI) and Spain (ES), asking participants about their donation preferences, as well as their beliefs and views about the policy in place. From these measures, we computed indices of informedness, policy support, and fulfilment of unexpressed preferences, which we compared across countries and consent systems. -/- Results Our study introduces a tool for analyzing policy governance in the context of OP. Wide variation in policy awareness was observed: Most respondents in DK, DE, AT and BE correctly identified the policy in place, while those in SI, GR and ES did not. Respondents in opt-out countries (AT, BE, ES and GR) tended to support the policy in place (with one exception, i.e., SI), whereas those in opt-in countries (DE and DK) overwhelmingly opposed it. These results reveal stark differences in governance quality across countries and consent policies: We found a preponderance of informed opposition in opt-in countries and a general tendency towards support–either informed or uninformed–in opt-out countries. We also found informed divergence in opt-in countries and a tendency for convergence–either informed or uninformed–among opt-out countries. -/- Conclusion Our study offers a novel tool for analyzing governance quality and illustrates, in the context of OP, how the strengths and weaknesses of different policy implementations can be estimated and compared using quantitative survey data. Given India’s vibrant religious landscape, there is a somewhat surprising paucity of depart‐ ments, centres or even programs for the academic study of religion. This article discusses this issue based on the preliminary results of an interview study conducted at Banaras Hindu University (BHU), Varanasi, India, in 2014 and 20 Its focus is on the views of university teachers and researchers concerning the place, role and function of religion and religious stud‐ ies at BHU. Twenty‐eight semi‐structured interviews were conducted. In (...) the course of their analysis, six themes emerged: 1) the place and role of religion in society; 2) religion as ‘religi‐ osity/spirituality’ or sanatana dharma vs. political ideology/communitarianism; 3) religion vs. dharma; 4) secularization; 5) religion in education in general; and, 6) religion in the education at BHU. The informants agreed on the increasing importance of religion in India, and most of them viewed the meaning of secularization as being ‘equal respect for all religions’. Moreover, a majority distinguished between ‘religion’, in the Western sense, and the Indian conception of dharma, considering it regrettable that the latter, described as the common ground of all reli‐ gions, is not taught more extensively at BHU. They also considered the original ideal of BHU’s founder, Madan Mohan Malaviya, to be of signi cant importance. That ideal involved not only teaching students the knowledge and skill sets found in a standard modern university, but also equipping them with a value‐based education, grounded upon sanatana‐dharma. As our project progresses, further understanding of this turn toward dharma education is something we intend to pursue through the lens of multiple modernities, developed by Marian Burchardt et al. as multiple secularities. There has been considerable debate in legal philosophy about how to attribute purposes to rules. Separately, within cognitive science, there has been a growing body of research concerned with questions about how people ordinarily attribute purposes. Here, we argue that these two separate fields might be connected by experimental jurisprudence. Across four studies, we find evidence for the claim that people use the same criteria to attribute purposes to physical objects and to rules. In both cases, purpose attributions appear to (...) be governed not so much by original intention or by moral value as by current practice. We argue that these findings in the cognitive science of purpose attribution have implications for jurisprudential questions involving purposivist legal interpretation. (shrink)

The 20th century was full of epoch-making events that left their mark on it. From the outbreak of the First World War and the fall of The German Empire, through numerous political and social shake-ups, until the outbreak of the Second World War, that became the event without precedent in the history of mankind. The First World War meant in many cases not only the end of some form of rule – the monarchy, but also, and maybe first of all, (...) it originated the increase of xenophobia and anti-Semitism. The post-war years were identified with economic problems on a large scale that had influence on every aspect of life. Revolutions and an attempt to create the first democratic country in the history of Germany influenced the outlook of the world and beliefs of all people that lived at that time. The German people were under the influence of ideas and ideals of the educated social class, but also of Catholic child rearing or Protestant values. In that social and political situation wrote Clemens Graf von Galen in 1932 the treatise on Die Pest des Laizismus und ihre Erscheinungsformen, in which he carried out a critical analysis of all occurrences of social, political, religious-morals and economical life that took place in the falling Weimar Republic. Not in a direct way he also took a stand on growing in strength of the National Socialist German Workers’ Party. The under mentioned article is aimed at presenting a profile of Clemens August Graf von Galen, later the Bishop of Münster, cardinal and the Blessed of the Roman Catholic Church, the origins of his beliefs that were reflected in his treatise Die Pest des Laizismus und ihre Erscheinungsformen. Among the few publications which consider the Scholastic roots of Brentano’s thinking, an article by Dieter Münch stands out. In it, he claims that the Aristotelian studies of Brentano and his whole philosophical project are inspired by the German Neo-Scholastic movement. Münch presents the Neo-Scholastic tendency as an ultra-conservative and reactionary program against modernity. Now, such a description makes almost inexplicable the fact that Brentano, who was educated in this context, could have developed a wholly personal and independent philosophy. To (...) approach this framework objectively, I propose to pay attention to F.J. Clemens, a Neo-Scholastic who influenced Brentano’s way of thinking. It is true that Clemens puts faith above reason and affirms that any conclusion obtained through the power of reason must be discarded when it contradicts faith. However, this is not an ultramontane innovation but simply the traditional theological point of view. He also argues that St. Thomas should be followed as a guide to orient oneself in the process of rational inquiry. Nevertheless, he doesn’t want to understand philosophy as a repetition of Aquinas’ claims; on the contrary, he rather proposes an intelligent use of tradition, which allows us to delve deeper into philosophical truth. For this very reason, he does not discard modernity or condemn it altogether. This perspective is also reflected in the early writings of Brentano, where he showed discontinuity from the Neo-Scholastic school of thought. (shrink)

Sometimes two expressions in a discourse can be about the same thing in a way that makes that very fact evident to the participants. Consider, for example, 'he' and 'John' in 'John went to the store and he bought some milk'. Let us call this 'de jure' coreference. Other times, coreference is 'de facto' as with 'Mark Twain' and 'Samuel Clemens' in a sincere use of 'Mark Twain is not Samuel Clemens'. Here, agents can understand the speech without (...) knowing that the names refer to the same person. After surveying many available linguistic and pragmatic tools (intentions to corefer, presuppositions, meanings, indexing, discourse referents, binding etc.) I conclude that we must posit a new semantic primitive to account for de jure coreference. Theorien von Gerechtigkeit als einer ethischen Tugend spielen eine große Rolle in der protestantischen Ethik vor dem Dreißigjährigen Krieg. Eines der hervorstechenden Merkmale dieser Theorien ist ihr eklektischer Charakter: Sie verbinden Elemente aus verschiedenen Traditionen der antiken Tugendethik, vor allem der platonischen, aristotelischen und stoischen. Die Gerechtigkeitstheorien von protestantischen Philosophen wie Rudolph Goclenius, Clemens Timpler und Bartholomäus Keckermann illustrieren gut dokumentierte Merkmale des frühneuzeitlichen Eklektizismus wie die Rolle der Reinterpretation von ausgewählten Lehrstücken und die konziliatorische Strategie, scheinbare Widersprüche zwischen (...) verschiedenen Traditionen aufzulösen. Darüber hinaus illustrieren sie aber auch ein weniger gut dokumentiertes Merkmal des frühneuzeitlichen Eklektizismus, nämlich seine Funktion als philosophische Problemlösungsstrategie. There can be no doubt that discrimination based on sex, race, ethnicity, religion or beliefs should not be tolerated in academia. Surprisingly, however, in recent years, policies of Diversity, Inclusion and Equity(DIE), officially introduced to counteract discrimination, have increasingly led to quite the opposite result: the exclusion of individuals who do not share a radical 'woke' ideology on identity politics (feminism, other gender activisms, critical race theory, etc.), and to the suppression of the academic freedom to discuss such dogmas. This (...) subversion of academia ― disguised Trojan-horse style as universal human rights advocacy ― is unacceptable because academia must be politically neutral and protect freedom of speech, a cornerstone of professional scholarly activity without which universities as we know them will slowly but surely suffocate. -/- Our purpose here is to put together some particularly illustrative cases of such repression in a single book, testifying to a ubiquitous trend within western culture, irreducible to a few isolated complaints. Millianism is reasonable; that is, it is reasonable to think that all there is to the semantic value of a proper name is its referent. But Millianism appears to be undermined by the falsehood of Substitutivity, the principle that interchanging coreferential proper names in an intentional context cannot change the truth value of the resulting belief report. Mary might be perfectly rational in assenting to ‘Twain was a great writer’ as well as ‘Clemens was not a great writer’. Her (...) confusion does not seem to preclude her from assenting to those sentences in a normal, understanding manner. That is, Assent-for-Mary is true: Mary can knowingly assent to ‘Twain was a great writer’ and ‘Clemens was not a great writer’. By Disquotation—the rough principle that if in ordinary circumstances one assents to “P”, then one believes that P—Mary believes that Twain was a great writer and she believes that it’s not the case that Clemens was a great writer. If Substitutivity were true, then since ‘Mary believes that Twain was a great writer’ is true, ‘Mary believes that Clemens was a great writer’ would have to be true too. But then Mary would amount to a refutation of the plausible principle Consistency that, roughly put, no rational adult can have occurrently held and reflectively considered and compared contradictory beliefs. In some ways that have been largely ignored, ethnic-group names might be similar to names of other kinds. If they are, for instance, analogous to proper names, then a correct semantic account of the latter could throw some light on how the meaning of ethnic-group names should be construed. Of course, proper names, together with definite descriptions, belong to the class of singular terms, and an influential view on the semantics of such terms was developed, at the turn of the (...) nineteenth century, from discussion of a puzzle about some differences in the cognitive value of certain statements of identity. Clearly, that a = a (e.g., that Mark Twain was Mark Twain) is trivial, and its truth could be known a priori, just by thinking. On the other hand, that a = b (e.g., that Mark Twain was Samuel Clemens) is of course informative and knowable only by empirical investigation. To solve this puzzle, Frege famously proposed that those variations in the cognitive value of statements of identity “can arise only if the difference between the signs corresponds to a difference in the mode of presentation of that which is designated.” On his view, although in the above statements of identity, the singular terms, ‘a,’ and, ‘b,’ may designate the same thing, they do so with different senses, or under different modes of presentation of that object. When the puzzling statements involving ‘a’ and ‘b’ are true, they may then be said to have exactly the same reference. But since those singular terms pick out the object of reference differently (i.e., under different senses or modes of presentation), therefore the cognitive value of these statements also varies significantly. On this account, then, the reference of a non-vacuous proper name is secured by the name’s sense, or mode of presentation, which constitutes its semantic content. And given that Fregeans (here under the influence of Russell) cash out that sense as consisting in whatever concept (or cluster of concepts) could be uniquely associated with that name, they might hold, for example, that the property of being the author of Huckleberry Finn, and that of being an American who lived his early life in Hannibal, Missouri, and later became a famous writer, amount to the senses of ‘Mark Twain,’ and ‘Samuel Clemens,’ respectively.. Like '&', '=' is no term; it represents no extrasentential property. It marks an atomic, nonpredicative, declarative structure, sentences true solely by codesignation. Identity (its necessity and total reflexivity, its substitution rule, its metaphysical vacuity) is the objectual face of codesignation. The syntax demands pure reference, without predicative import for the asserted fact. 'Twain is Clemens' is about Twain, but nothing is predicated of him. Its informational value is in its 'metailed' semantic content: the fact of codesignation (that 'Twain' (...) names Clemens) that explains what fact it asserts and why it is necessary. In 1804, when asked by the aspiring writer Clemens Brentano why she had chosen to publish her work, Karoline von Günderrode wrote that she longed “mein Leben in einer bleibenden Form auszusprechen, in einer Gestalt, die würdig sei, zu den Vortreflichsten hinzutreten, sie zu grüssen und Gemeinschaft mit ihnen zu haben.” In light of this kind of statement, it is perhaps not surprising if, despite some exceptions, much of the still relatively scant literature on Günderrode reads her works largely (...) in terms of how they articulate and manifest Günderrode’s desires, frustrations, and character, for the most part ignoring their imaginary, creative, and intellectual aspects. This interpretation of the author’s works as biography is, in Günderrode’s case, often accompanied by an interpretation of her biography, particularly her suicide, as literary work. This paper is not the first to question the conflation of Günderrode’s life, death, and writing, but it is one of only a handful that aim to address the autopoietic element of Günderrode’s work in a way that does not reduce her writings to biographical and psychological expressions, or Günderrode herself to an image – or a legend – encapsulated by her writings and her relationship to them. This paper argues that Günderrode’s own position on what the self is has been largely neglected as a result of this conflation, and that taking this position into account changes how we understand Günderrode’s articulations of self in her writings. Thus this paper has two goals: to address difficulties in articulating and even constituting oneself sincerely when one’s efforts are unrecognized, belittled, censored, and forced to conform to the conventions of a society in which one is marginalized; and to unearth a neglected and potentially rich account of the modern self. Aestheticians in the tradition of Critical Theory have claimed that the or a purpose of musical interpretation is somehow to save or salvage or rescue ("retten") the musical work. What sense, if any, can be made of this claim? The notion of salvage or rescue presupposes the concept of danger. Threats to works of art emerge from two sources: from outside and from inside. Whilst the former problem is only touched upon, the latter is discussed in some detail, using the (...) example of Brahms' Alto Rhapsody op. 53. Kathleen Ferrier's and Clemens Krauss' interpretation of 1947 deals with rather than ignores the composer's crumbly attempt at fusing art and religion. Salvage as their attitude vis-a-vis the work is distinguished from cover-up on the one hand and exposure on the other hand. (shrink)

The catalogue of an exhibition of the Clemens-Sels-Museum in Neuss presents a selection of the museum's collection of drawings and watercolours from the late 18th century to the middle of the 19th century; with biographies of the artists as well as comments and interpretations of their works.

This review focuses on the Ogdoas scholastica by Jacob Lorhard, published in 1606. The importance of this document turns on the fact that it contains what is almost certainly the first published occurrence of the term “ontology.” The body of the work consists in a series of diagrams called “diagraphs.” Relevant features of this compendium of diagraphs are: 1. that it does not in fact contain the word “ontology,” and 2. that Lorhard himself was not responsible for its content.

The influence of Brentano on the emergence of Husserl's notion of intentionality has been usually perceived as the key of understanding the history of intentionality, since Brentano was credited with the discovery of intentionality, and Husserl was his discipline. This much debated question is to be revisited in the present essay by incorporating recent advances in Brentano scholarship and by focusing on Husserl's very first work, his habilitation essay (Über den Begriff der Zahl), which followed immediately after his study years (...) at Brentano, and also on manuscript notes from the same period. It is to be shown that (i) although Brentano failed to enact a direct influence on Husserl's notion of intentionality (much in line with K. Schuhmann's claim), (ii) yet the core of Brentano's notion remained operative in Husserl's theory of relations, which is seemingly influenced by John Stuart Mill and Hermann Lotze. This investigation is intended as a contribution towards the proper understanding of the complexities of Husserl's early philosophy. (shrink)

Are the natures of matter and energy, their compositions and relationships with each other the fundamental key to the understanding of everything or is it something else? As a researcher I decided to conduct an independent investigation and audit of Creation and this can be thought of as my report. Some thoughts on the true nature of the realm (...) we really inhabit with some basic mathematical description of the relationship between the finite and the absolute as we are capable of understanding it. -/- If anyone should think that by this work I am in any way attacking or denigrating the Almighty, let me just say to them that the result of this work would tend to confirm how very Real and Important a matter God is in relation to all of us in our daily lives and experiences from an objective and impartial standpoint.
