The genetic modification of pigs as a source of transplantable organs is one of several possible solutions to the chronic organ shortage. This paper describes existing ethical tensions in xenotransplantation (XTx) that argue against pursuing it. Recommendations for lifelong infectious disease surveillance and notification of close contacts of recipients are in tension with the rights of human research subjects. Parental/guardian consent for pediatric xenograft recipients is in tension with a child’s right to an open future. Individual consent to transplant is (...) in tension with public health threats that include zoonotic diseases. XTx amplifies concerns about justice in organ transplantation and could exacerbate existing inequities. The prevention of infectious disease in source animals is in tension with the best practices of animal care and animal welfare, requiring isolation, ethologically inappropriate housing, and invasive reproductive procedures that would severely impact the well-being of intelligent social creatures like pigs. This discussion revises and extends Jonny Anomaly's ‘public goods’ account of public health ethics in light of recent criticism from Richard Dees. Public goods are goods that are both non-rival and non-excludable. What is significant about such goods is that they are not always provided efficiently by the market. Indeed, the state can sometimes realize efficiency gains either by supplying such goods directly or by compelling private purchase. But public goods are not the only goods that the market may fail (...) to provide efficiently. This point to a way of broadening the public goods account of public health to accommodate Dees' counterexamples, without abandoning its distinctive appeal. On the market failures approach to public health ethics, the role of public health is to correct public health-related market failures of all kinds, so far as possible. The underlying moral commitment is to economic efficiency in the sense of Pareto: if we can re-allocate resources in the economy so as to raise the welfare of some without lowering the welfare of any other, we ought to do so. However, due to its often dogmatic interpretation, it is more and more orthodoxical. An increasing number of scientists have come to criticise Darwinism and go beyond it with a systemic approach and an expanded vision of the evolutionary process. As a matter of fact, the discovery of natural genetic engineering mechanisms shows that living cells are able to rewrite (...) their own genetic material at the genomic level, thus leading to evolutionary innovations. Galileo’s Error is a superlative work of public philosophy, particularly as a way of introducing modern academic panpsychism to a broader audience. In this commentary, I reflect on an issue that is prominent, though often with different background concerns, in both academic and popular discourse: what it means to be ‘scientific’ or ‘unscientific’. Panpsychism is not itself a scientific hypothesis, but neither is it (as critics sometimes claim) in conflict with science. Indeed, Goff argues, and I agree, that panpsychism is (...) an eminently scientific worldview, in the sense of a way of viewing reality that accords with and embraces what science reveals. But what exactly it means to ‘accord with and embrace’ science is disputed; this paper tries to untangle some of the threads. (shrink)

Theorists of the welfare state increasingly recognize that social insurance programs are not well-justified by distributive egalitarianism—meaning concern for equality considered as a pattern in the distribution of some good. However, recent work by several relational egalitarian theorists suggests that these programs may be justified on relational egalitarian grounds. Relational egalitarians hold that the proper object of egalitarian concern is the way that citizens relate to one another. In this paper, I review the problems facing a distributive egalitarian justification for (...) social insurance before considering and rejecting three relational egalitarian justifications. I close by offering a justification for these programs grounded in efficiency, not equality. (shrink)

Politics, Philosophy & Economics, Volume 21, Issue 2, Page 165-189, May 2022. It is generally acknowledged that a certain amount of state intervention in health and health care is needed to address the significant market failures in these sectors; however, it is also thought that the primary rationale for state involvement in health must lie elsewhere, for example in an egalitarian commitment to equalizing access to health care for all citizens. This paper argues that a complete theory of justice in (...) health can be derived from a commitment to correcting market failure, or in other words promoting Pareto-efficiency, in the domain of health. This approach can address familiar problems around access to care, as well as problems related to resource allocation and rationing, the control of health care costs, and the foundations of public health. Egalitarian theories of justice in health cannot make sense of the depth and pervasiveness of state involvement in health and health care; only a theory rooted in the need to correct market failure can. Is the virtue of the good citizen the same as the virtue of the good man? Aristotle addresses this in Politics 3.4. His answer is twofold. On the one hand, (the account for Difference) they are not the same both because what the citizen’s virtue is depends on the constitution, on what preserves it, and on the role the citizen plays in it, and because the good citizens in the best constitution cannot all be good men, whereas the good man’s (...) virtue is uniform. On the other hand, (the account for Identity) the two virtues are identical in the good men in the best constitution, in which all are good citizens, each possessing the ability for ruling and for being ruled. This nuanced answer can be seen as Aristotle’s synthesis of a Periclean view (contribution to state blots out personal wrongs) and a Socratic view (no good citizen is without justice). Its nuances reflect the extent to which Aristotle’s conceptions of good citizenship and the best constitution accommodate deviations of what is probable from the human ideal set out in his ethical writings. In the present chapter, I will first address three puzzles regarding the nuances of Aristotle’s answer. Second, I will consider one question about its implication: Does Aristotle’s account for Difference turn out to entail something ultra-Periclean: that no one can simultaneously be a good man and a good citizen in any constitution other than the best? (2) Schon zu Goethes Lebzeiten habe sich die Fachwissenschaft mit überwältigender Mehrheit gegen den Dichter ausgesprochen. Beide Behauptungen sind falsch. ad (1): Der bedeutende Physiker und Chemiker Johann Ritter hat zwischen 1800 und 1801 eng mit Goethe kooperiert, dieselbe Forschungsmethode eingesetzt wie Goethe und aufgrund dieser Kooperation das UV-Licht entdeckt. Bis (...) zu seinem Lebensende war er der Ansicht, dass die newtonische Theorie durch Fortführung der Experimente Goethes unterminiert werden könne. ad (2): Wie sich bei einer Kampfabstimmung unter den MINT-Forschern der Goethe-Zeit ergibt (bei der sämtliche veröffentlichte Voten von 1810 bis 1832 gezählt werden), stimmten gegen Goethe die Hälfte der Naturwissenschaftler, für ihn ein Drittel, bei 15 Prozent Stimmenthaltungen. It seems natural to choose whether to have a child by reflecting on what it would be like to actually have a child. I argue that this natural approach fails. If you choose to become a parent, and your choice is based on projections about what you think it would be like for you to have a child, your choice is not rational. If you choose to remain childless, and your choice is based upon projections about what you think it (...) would be like for you to have a child, your choice is not rational. This suggests we should reject our ordinary conception of how to make this life-changing decision, and raises general questions about how to rationally approach important life choices. (shrink)

Hate speech, understood broadly, is any form of expression intended to arouse hatred or contempt toward members of a particular social group. When university administrators have reason to believe that a planned speaking event on campus may feature hate speech (at least in the eyes of some), how should they respond? In this paper I address this question as it arises for Canadian universities. I argue that, where the regulation of campus speech is concerned, the right course of action for (...) university administrators is nearly always to do absolutely nothing. They will have reason to become actively involved only in order to ensure that a speaking event proceeds safely, or when it threatens to disrupt the functioning of the university, or when it is itself threatened with disruption by protesting groups. In those instances the justification for intervention will be to protect and facilitate speech, not to shut it down. (shrink)

Citizens in wealthy liberal democracies are typically expected to see to basic needs like food, clothing, and shelter out of their own income, and those without the means to do so usually receive assistance in the form of cash transfers. Things are different with health care. Most liberal societies provide their citizens with health care or health care insurance in kind, either directly from the state or through private insurance companies that are regulated like public utilities. Except perhaps for small (...) co-pays or deductibles, citizens are not expected to see to their health needs out-of-pocket, at least for some basic level of care. The question I want to explore is whether experience supports an antireductionist ontology of time, that is, whether we should take it to support an ontology that includes a primitive, monadic property of nowness responsible for the special feel of events in the present, and a relation of passage that events instantiate in virtue of literally passing from the future, to the present, and then into the past.

Goethes Protest gegen Newtons Theorie des Lichts und der Farben ist besser, als man gemeinhin denkt. Man kann diesem Protest in den wichtigsten Elementen folgen, ohne Newton in der physikalischen Sache unrecht zu geben. Laut meiner Interpretation hat Goethe in Newtons wissenschaftsphilosophischer Selbsteinschätzung eine entscheidende Schwäche aufgedeckt: Newton glaubte, mithilfe prismatischer Experimente beweisen zu können, dass das Licht der Sonne aus Lichtstrahlen verschiedener Farben zusammengesetzt sei. Goethe zeigt, dass dieser Übergang vom Beobachtbaren zur Theorie problematischer ist, als Newton wahrhaben wollte. (...) Wenn Goethe darauf beharrt, dass uns der Übergang zur Theorie nicht von den Phänomenen aufgezwungen wird, dann kommt dadurch unser eigener, freier und kreativer Beitrag zur Theorie-Bildung ans Tageslicht. Und diese Einsicht Goethes gewinnt eine überraschende Schärfe, weil Goethe plausibel machen kann, dass sich alle entscheidenden prismatischen Experimente Newtons aus der geometrischen Optik ebenso gut mit einer alternativen Theorie vereinbaren lassen. Wenn ich recht sehe, war Goethe der erste Wissenschaftsphilosoph, der mindestens eine empirisch äquivalente Alternative zu einer wohletablierten physikalischen Theorie gesehen und daraus weitreichende wissenschaftstheoretische Schlüsse gezogen hat: Damit war Goethe seiner Zeit um ein gutes Jahrhundert voraus. Issues surrounding pregnancy loss are rarely addressed in Christian philosophy. Yet a modest estimate based on the empirical and medical literature places the rate of pregnancy loss between fertilization and term at somewhere between 40–60%. If miscarriage really is as common as the research gives us to believe, then it would seem a pressing topic for a Christian philosophy of the future to address. This paper attempts to begin this work by showing how thinking more closely about pregnancy loss understood (...) as a grievable event can have a profound impact on the way we think about particular theoretical debates in Christian philosophy and provide opportunities for the discipline to put its skills to use in the development of helpful conceptual and hermeneutical resources for those grieving such losses. However, this will require seeking out and taking seriously the testimony of those who have undergone pregnancy loss, as well as getting clearer on how best to conceptualize pregnancy and its loss in the first place. Als Goethe in seiner monumentalen Farbenlehre einen Angriff auf Newtons Theorie des Lichts und der Farben lancierte, setzte er eine Methode ein, die er als Vermannigfachung der Erfahrungen bezeichnete: Er variierte verschiedene Parameter der newtonischen Experimente, um neuen Spielraum für Alternativen zur Theorie Newtons zu gewinnen. Dabei erzielte er durchaus Erfolge. U.a. entdeckte er das Komplement zum newtonischen Spektrum (das aussieht wie dessen Farbnegativ und durch Vertauschung der Rollen von Licht und Finsternis entsteht). Kürzlich hat der Wiener Maler Ingo Nussbaumer (...) Goethes Methode kongenial fortgeführt. Dabei hat er sechs weitere Farbspektren entdeckt. Sie entstehen, wenn man anstelle des Hell/Dunkel-Kontrasts (in Newtons und Goethes Experimenten) mit Paaren bunter Komplementärfarben arbeitet. Die neuen Farbspektren sehen genauso differenziert aus wie Newtons und Goethes Spektrum; doch anders als diese enthalten sie die unbunten "Farben" Schwarz und Weiß. Die vielfältigen Ordnungsbeziehungen und Symmetrien, die Ingo Nussbaumer in der Farbenwelt der insgesamt acht Spektren ausgemacht hat, verhelfen uns vielleicht zu einem tieferen Verständnis der Prinzipien menschlicher Farbwahrnehmung. Und sie tauchen die überkommenen Prinzipien der additiven und der subtraktiven Farbmischung in neues Licht. (shrink)

Was wissen Sie über Kosovo? Nicht genug. Nicht genug jedenfalls über objektive, wertfrei vorgegebene Fakten, mit deren Hilfe man verantwortungsethische Bewertungen des NATO-Angriffs begründen könnte. Trotzdem halte ich drei wertende Aussagen über den Kosovo-Konflikt für vernünftig. Sie lauten (in alphabetischer Reihenfolge): Der bewaffnete Kampf der Albaner im Kosovo war moralisch falsch. Die Militäreinsätze der Serben im Kosovo waren moralisch falsch (schon vor Beginn der NATO-Bombardements und erst recht danach). Und schliesslich: Die Luftschläge des Westens gegen Serbien waren moralisch falsch. Insbesondere (...) diese letzte Behauptung ist der Zielpunkt des Aufsatzes. Mein Plädoyer für diese Behauptung verläuft auf einem dritten Weg zwischen der gesinnungsethischen Position pazifistischer Rigoristen und der verantwortungsethischen Position ihrer Kontrahenten. Die grundlegende Richtlinie für meine Untersuchung besteht darin, keine Behauptungen als objektiv auszugeben, die in Wirklichkeit auf Wertungen beruhen. Schon beim Blick auf die Vorkriegs- und Kriegsgeschehnisse im Kosovo kommen wir nicht ohne die Hilfe von Werten aus; und ich plädiere dafür, diese Geschehnisse im Lichte einer verzweifelten Menschenliebe anzusehen: Daraus ergibt sich eine neue Form von Pazifismus. Two problems are considered here. One relates to who has moral status, and the other relates to who has moral responsibility. The criteria for mattering morally have long been disputed, and many humans and nonhuman animals have been considered “marginal cases,” on the contested edges of moral considerability and concern. The marginalization of humans and other species is frequently the pretext for denying their rights, including the rights to health care, to reproductive freedom, and to bodily autonomy. There is broad (...) agreement across cultural and philosophical traditions about the capacities and responsibilities of moral agents. I propose an inclusive and expansive way of thinking about moral status, situating it not in the characteristics or capacities of individuals, but in the responsibilities and obligations of moral agents. Moral agents, under this view, are not privileged or entitled to special treatment but rather have responsibilities. I approach this by considering some African communitarian conceptions of moral status and moral agency. I propose that moral agency can also be more expansive and include not just individual moral agents but collective entities that have some of the traits of moral agents: power, freedom, and the capacity to recognize and act on the demands of morality and acknowledge and respect the rights of others. Expanding who and what is a moral agent correspondingly extends moral responsibility for respecting rights and fostering the conditions for the health and well-being of humans and animals onto the collective entities who uniquely have the capacity to attend to global-scale health threats such as pandemics and human-caused climate change. I defend a one category ontology: an ontology that denies that we need more than one fundamental category to support the ontological structure of the world. Categorical fundamentality is understood in terms of the metaphysically prior, as that in which everything else in the world consists. One category ontologies are deeply appealing, because their ontological simplicity gives them an unmatched elegance and spareness. I’m a fan of a one category ontology that collapses the distinction between particular and property, replacing it (...) with a single fundamental category of intrinsic characters or qualities. We may describe the qualities as qualitative charactersor as modes, perhaps on the model of Aristotelian qualitative (nonsubstantial) kinds, and I will use the term “properties” interchangeably with “qualities”. The qualities are repeatable and reasonably sparse, although, as I discuss in section 2.6, there are empirical reasons that may suggest, depending on one’s preferred fundamental physical theory, that they include irreducibly intensive qualities. There are no uninstantiated qualities. I also assume that the fundamental qualitative natures are intrinsic, although physics may ultimately suggest that some of them are extrinsic. On my view, matter, concrete objects, abstract objects, and perhaps even spacetime are constructed from mereological fusions of qualities, so the world is simply a vast mixture of qualities, including polyadic properties (i.e., relations). This means that everything there is, including concrete objects like persons or stars, is a quality, a qualitative fusion, or a portion of the extended qualitative fusion that is the worldwhole. In this paper, I distinguish two conceptions of solidarity, which I call solidarity as beneficence and solidarity as mutual advantage. I argue that only the latter is capable of providing a complete foundation for national universal health care programs. On the mutual advantage account, the rationale for universal insurance is parallel to the rationale for a labor union’s “closed shop” policy. In both cases, mandatory participation is necessary in order to stop individuals free-riding on an ongoing system of mutually advantageous (...) cooperation. (shrink)

Philosophers of experiment have acknowledged that experiments are often more than mere hypothesis-tests, once thought to be an experiment's exclusive calling. Drawing on examples from contemporary biology, I make an additional amendment to our understanding of experiment by examining the way that `wide' instrumentation can, for reasons of efficiency, lead scientists away from traditional hypothesis-directed methods of experimentation and towards exploratory methods.

Many spectacular claims about psychopaths are circulated. This contribution aims at providing the reader with the more complex reality of the phenomenon (or phenomena), and to point to issues of particular interest to philosophers working in moral psychology and moral theory. I first discuss the current evidence regarding psychopaths’ deficient empathy and decision-making skills. I then explore what difference it makes to our thinking whether we regard their deficit dimensionally (as involving abilities that are on or off) and whether we (...) focus on primary or secondary psychopathy. My conclusion is that most grand claims about psychopathy settling long-standing debates in moral philosophy and psychology are overblown, but there is much to be learnt from this disorder when it comes to formulating modern theories of moral psychology. Ich möchte philosophische Ideen von Hilary Putnam, Crispin Wright, Donald Davidson und George Eduard Moore zusammenbringen, um hieb- und stichfest zu beweisen, dass die beste skeptische Hypothese (gegen unser Wissen um die Beschaffenheit der Aussenwelt) nicht zutreffen kann. Putnams Externalismus, Wrights zusätzlicher Appell an Disquotationsprinzipien, Davidsons wahrheitskonditionale Semantik und Moores Verweis auf seine eigenen Hände lassen sich zu einem vierzeiligen Beweis verschmelzen, dessen Konklusion besagt, dass wir nicht von Anbeginn Gehirne im Tank sein können.

Wie sich das Licht blauer und roter Leuchtdioden additiv mischt und Purpur liefert, demonstrierte die Lichtinstallation "Farb-Licht-Nebel" von Bachmann und Pericin auf der Tagung Farbe als Experiment des Deutschen Farbenzentrums (Wuppertal, 25.-26.9.2014). Die Künstler nutzten eine Technik der Farbdarstellung, die Goethe in seiner Farbenlehre (1810) für seinen Angriff auf Newtons Opticks (1704) publik gemacht hatte. Während die Künstler sich mit ihrem Blick auf grünes Licht stark von Goethe absetzten und stattdessen der von Newton geprägten Orthodoxie folgten, passt ihre Purpur-Darstellung gut (...) zu Goethes Farbenlehre. Wer humanitäre Kriege moralisch beurteilen will, muss sich in einem chaotischen Meer der Möglichkeiten auskennen; er muss (z.B. in der Rückschau) wissen, was geschehen wäre, hätten sich die Akteure anders entschieden. Solche Fragen betreffen keine Fakten, sondern Kontrafakten; mit kühlem Realitätssinn alleine ist diesen Fragen nicht beizukommen. Im Herzstück dieses Aufsatzes steht eine erkenntnistheoretische Analyse kontrafaktischer Sätze (VI-XIII). Wenn ich recht liege, müssen wir uns bei der Beurteilung solcher Sätze nicht nur an die harten Fakten halten; zusätzlich brauchen wir weichere (...) Beurteilungskriterien wie Einfühlungsvermögen, narrative Intelligenz, Phantasie – und Werthaltungen. Dass eine bestimmte Form von Pazifismus im Lichte dieser erkenntnistheoretischen These an Plausibilität gewinnt, versuche ich in den Schlussabschnitten anhand des Kosovo-Kriegs plausibel zu machen. Der Aufsatz beginnt mit ausserrationalen Betrachtungen zugunsten des Pazifismus und versucht insgesamt, allerlei angeblich vernünftigen Gegenargumenten den Wind aus den Segeln zu nehmen. (shrink)

Spätestens seit es in der Kunst außer Mode kam, das Wort Schönheit einzusetzen, begannen die Physiker, ihre Arbeitsergebnisse schön zu nennen. Sie sagen z.B.: Wenn eine Theorie schön ist, so spricht das für die Wahrheit der Theorie. Und sie streben nach schönen Experimenten. Was ist damit gemeint? Definieren lässt sich dieser Begriff genauso wenig wie für Kunstwerke. Daher erläutere ich ihn anhand optischer Experimente Newtons, Goethes und aus neuerer Zeit. Man kann z.B. zeigen, dass die Weißsynthese des Desaguliers schöner ist (...) als Newtons Weißsynthese und dass den vielfältigen Farbsynthesen des Wiener Malers und Farbexperimentators Ingo Nussbaumer noch höherer ästhetischer Wert zukommt. Aus alledem ergibt sich eine tentative Liste von Kriterien (die sich freilich nicht in einen idiotensicheren Bewertungs-Algorithmus einspeisen lassen, sondern Urteilskraft verlangen): Sauberkeit, Einfachheit, intellektuelle Klarheit und Symmetrie sind Merkmale schöner Experimente – und diese Merkmale sind z.B. auch bei der ästhetischen Beurteilung mancher (wenn auch nicht aller) Musikstücke relevant. Daher liegt es nahe zu vermuten, dass sich unsere ästhetische Urteilskraft – in so verschiedenen Bereichen wie Optik und Musik – verwandter begrifflicher Werkzeuge bedient. (shrink)

Die Frage des Weiterlebens nach dem Tod ist sinnvoll, selbst im Lichte des strengen Sinnkriteriums der logischen Empiristen. Schlick schlägt folgende Verifikationsmethode fürs postmortale Weiterleben vor: "Warte, bis Du stirbst". Da Schlick diesen Gedanken nicht ausgearbeitet hat, spiele ich verschiedene Versionen der vorgeschlagenen Verifikation durch: Weiterleben mit einem fremden Körper und körperloses Weiterleben. Um die Identität des Weiterlebenden zu sichern, braucht der Weiterlebende Erinnerungen, intellektuelle Aktivität, Willensentscheidungen und kontinuierliche Erlebnisse ohne Bruch. Ob diese Aspekte unseres mentalen Lebens allesamt für Schlicks (...) Zwecke erforderlich sind, werde ich nicht entscheiden; doch Schlicks Chancen steigen, je mehr Aspekte des mentalen Lebens auch nach dem körperlichen Tod im Spiel bleiben – sicher ist sicher. Pazifisten und deren Gegner streiten sich meist nicht bloss über moralische, sondern auch über faktisch-deskriptive Fragen. Zum Beispiel sind beide Seiten bei der Kosovo-Krise (1998/9) zu völlig entgegengesetzten Beschreibungen gekommen. Laut meiner Rekonstruktion des Pazifismus ist das keine Überraschung, weil der Pazifist die Fakten legitimerweise im Lichte seines Systems von Werten betrachtet. Seine Gegnerin betrachtet die Fakten dagegen im Lichte eines alternativen Wertsystems, und der Streit zwischen den beiden Parteien, der sich angeblich auf wertfrei deskriptivem Boden bewegt, kommt zu keinem (...) Ende, weil es keine objektiven Tatsachen aus dem betreffenden Krieg gibt, die den Streit für die eine oder die andere Seite eindeutig entscheiden könnten. Wenn ich recht habe, lässt sich die wertbeladene Weltsicht des Pazifisten als eine Befolgung dreier epistemischer Imperative verstehen: Erstens befolgt er den epistemischen Imperativ zur Natur des Menschen ("Wehre Dich gegen Dämonisierungen der Gegenseite; versuche immer, den Fall aus der Sicht der Gegenseite zu verstehen"). Zweitens befolgt er den epistemischen Imperativ zugunsten friedfertiger Alternativen ("Suche immer nach friedfertigen Alternativen zum geplanten Militäreinsatz"). Und drittens befolgt er den epistemischen Imperativ bezüglich unkontrollierbarer Eskalation ("Schärfe deinen Blick für unkontrollierbare, irreversible Nebenfolgen des militärischen Einsatzes, und achte besonders auf die Gefahr, dass ein weiterer Weltkrieg ausbrechen könnte"). Nicht die objektive Realität entscheidet darüber, wie weit man bei der Befolgung dieser Imperative gehen sollte. Die Entscheidung hängt vielmehr von uns selbst ab – so ähnlich wie im Fall einer Naturwissenschaftlerin, die sich dafür entscheidet, hinter dem Chaos des Mannigfaltigen noch nach einer gemeinsamen Tiefenstruktur zu suchen. Diese Parallele hat eine überraschende Konsequenz. Die epistemischen Imperative des Pazifisten können mit Kants regulativen Prinzipien verglichen werden, die laut Kant notwendig sind, um unseren naturwissenschaftlichen Untersuchungen eine Orientierung zu geben. Und wenn sich also die Erkenntnismethode des Pazifisten in entscheidender Hinsicht nicht von der naturwissenschaftlichen Erkenntnismethode unterscheidet, dann verdienen die Pazifisten einen Vorwurf ganz sicher nicht: den Vorwurf, auf irrationale Weise blind zu sein für die harten Wirklichkeiten. Selbst wer den Pazifismus ablehnt, sollte ihm nicht den intellektuellen Respekt verweigern. Dass der Pazifismus in der Tat eine attraktive Position darstellt, werde ich am Ende meiner Überlegungen plausibel zu machen versuchen. (shrink)

It is common for philosophers to argue that psychopaths are not morally responsible because they lack some of the essential capacities for morality. In legal terms, they are criminally insane. Typically, however, the insanity defense is not available to psychopaths. The primary reason is that they appear to have the knowledge and understanding required under the M’Naghten Rules. However, it has been argued that what is required for moral and legal responsibility is ‘deep’ moral understanding, something that psychopaths do not (...) have either due to their lacking empathy or practical reason. In the first part of the paper, I argue that psychopaths do not lack the abilities required for deep moral understanding, although they have deficits in those areas. According the M’Naghten Rules, therefore, psychopaths are not insane. Under a less strict formulation of the insanity plea, like the Model Penal Code, however, there is a good case to be made for their lacking substantial capacity. I argue that because psychopathy is an essentially moral disorder, and because of the nature of psychopathic violence, psychopaths should not be excused under the insanity plea. It would be tantamount to excusing someone for committing a crime because they are bad. Arguably, this contravenes the entire system of law. (shrink)

In The Souls of Black Folk, W.E.B. Du Bois introduces double consciousness as a result of racial prejudice and oppression. Explained as a state of confliction felt by black Americans, Du Bois presents double consciousness as integral to understanding the black experience. Later philosophers question the importance of double consciousness to current race discussions, but this paper contends that double consciousness provides valuable insights into black and white relations. To do this, I will utilize the modern slang term, “Oreo,” to (...) highlight how a perceived incompatibility between blacks and whites could prevent America from achieving a greater unity. (shrink)

Despite the recent backlash against epistemic consequentialism, an explicit systematic alternative has yet to emerge. This paper articulates and defends a novel alternative, Epistemic Kantianism, which rests on a requirement of respect for the truth. §1 tackles some preliminaries concerning the proper formulation of the epistemic consequentialism / non-consequentialism divide, explains where Epistemic Kantianism falls in the dialectical landscape, and shows how it can capture what seems attractive about epistemic consequentialism while yielding predictions that are harder for the latter to (...) secure in a principled way. §2 presents Epistemic Kantianism. §3 argues that it is uniquely poised to satisfy the desiderata set out in §1 on an ideal theory of epistemic justification. §4 gives three further arguments, suggesting that it (i) best explains the objective normative significance of the subject's perspective in epistemology, (ii) follows from the kind of axiology needed to solve the swamping problem together with modest assumptions about the relation between the evaluative and the deontic, and (iii) illuminates certain asymmetries in epistemic value and obligation. §5 takes stock and reassesses the score in the debate. 'A Differential Play of Forces' is a study of transcendental empiricism in musical contexts. It presents a reading of Gilles Deleuze and Félix Guattari’s philosophical apparatus and explores how music can be thought of as functioning in the operation Deleuze terms transcendental empiricism. Central to transcendental empiricism is the idea of an encounter with intensive difference and the consequent experience of intensive and virtual forces. The thesis sets out to explore this idea in three interwoven steps. First, it develops transcendental (...) empiricism as a philosophical framework, expounding central notions related to time and aesthetic experience. In the context of this philosophical apparatus, music is then discussed as an encounter with intensity and what this may entail for our understanding of musical experience and its potential. The third part of the thesis explores the idea of experiencing intensive forces through music in the thinking and poietic of three composers of the twentieth century: Arnold Schönberg, Olivier Messiaen and Giacinto Scelsi. The thesis develops three ‘images of thought’ corresponding, respectively, to the composers’ expressed theoretical ideas, identifying central concepts from Deleuze and Guattari’s philosophy. A mutual illumination of ideas about music and transcendental empiricism is thus presented, pointing towards a possible convergence between theory and practice, thinking and aesthetic experience as a differential play of intensive forces. The tripartite account of propositional, fallibilist knowledge that p as justified true belief can become adequate only if it can solve the Gettier Problem. However, the latter can be solved only if the problem of a successful coordination of the resources (at least truth and justification) necessary and sufficient to deliver propositional, fallibilist knowledge that p can be solved. In this paper, the coordination problem is proved to be insolvable by showing that it is equivalent to the ''''coordinated attack'''' problem, (...) which is demonstrably insolvable in epistemic logic. It follows that the tripartite account is not merely inadequate as it stands, as proved by Gettier-type counterexamples, but demonstrably irreparable in principle, so that efforts to improve it can never succeed. The dissertation traces the development of what I call “the problem of partiality” through the work of certain key figures in the British Moralist tradition: John Locke, Catharine Trotter Cockburn, Anthony Ashley Cooper (the Third Earl of Shaftesbury), Francis Hutcheson, John Gay, David Hume, Joseph Butler, and Adam Smith. On the one hand, we are committed to impartiality as a constitutive norm of moral judgment and conduct. On the other hand, we are committed to the idea that it is permissible, (...) or even obligatory, to expend disproportionate resources promoting the good of our loved ones over the good of strangers. However, these two commitments conflict with one another. This problem challenges us to provide an account of the scope and limits of reasonable partiality that does justice to both commitments. I argue that confronting this tension is a central project of early modern ethics. I offer a rereading of the British Moralist tradition, centered on debates about partiality, and thereby shift discussion of the tradition away from concerns about meta-ethics and moral epistemology, to issues of practical ethics. The topic of partiality remains central in contemporary ethics, as is evident in ongoing debates about the place of empathy in moral judgment, and the role of love in shaping our moral commitments. Though the aim of the dissertation is not to settle questions about the scope and limits of reasonable partiality, the focus here remains fixed on how the concept of partiality was problematized in our ethical thought, and how it informs our discussions in normative ethics and moral psychology. Alongside building a bridge between early modern scholarship and recent work in ethics, the dissertation casts light on two understudied figures in the British Moralist tradition – Cockburn and Gay – who contributed greatly to debates about partiality. By examining their contributions, I reconsider their place in the history of modern ethics and therefore provide a more contextualized account of philosophical thought in the period. (shrink)

Philosophical discussions of species have focused on multicellular, sexual animals and have often neglected to consider unicellular organisms like bacteria. This article begins to fill this gap by considering what species concepts, if any, apply neatly to the bacterial world. First, I argue that the biological species concept cannot be applied to bacteria because of the variable rates of genetic transfer between populations, depending in part on which gene type is prioritized. Second, I present a critique of phylogenetic bacterial species, (...) arguing that phylogenetic bacterial classification requires a questionable metaphysical commitment to the existence of essential genes. I conclude by considering how microbiologists have dealt with these biological complexities by using more pragmatic and not exclusively evolutionary accounts of species. I argue that this pragmatism is not borne of laziness but rather of the substantial conceptual problems in classifying bacteria based on any evolutionary standard. (shrink)
