Drawing on recent developments in dialogic approaches to learning and teaching, I examine the roots of dialogic meaning-making as a concept in classroom practices. Developments in the field of dialogic pedagogy are reviewed and the case for dialogic engagement as an approach to classroom interaction is considered. The implications of dialogic classroom approaches are discussed in the context of educational research and classroom practice. Dialogic practice is contrasted with monologic practices as evidenced by the resilient of the IRF as the (...) default discourse structure in classrooms. Recent evidence suggests the IRF is resistant to attempts to introduce interactive approaches to whole class teaching. Discussion of dialogic practice as a vehicle for increasing pupil engagement at a deep level and raising the quality of classroom interaction is illustrated through a consideration of Philosophy for Children, which is identified as a dialogic approach to classroom practice which has transformative potential for children's learning. Philosophy for Children offers an approach to pedagogy which enables teachers to value pupil voice and promote reflective learning. As such it has much to offer the current debate on dialogic teaching and learning. Research evidence suggests it will promote improved pupil outcomes on a range of assessments. (shrink)

Relationships with international students can be beneficial to higher education in terms of financial and human resources. For this reason, establishing and maintaining such relationships are usually pre-eminent concerns. In this study, we extended the application of the disconfirmation expectation model by incorporating components from subjective task value to predict the loyalty of international students toward their host countries. On a sample of 410 Vietnamese students enrolled in establishments of higher education in over 15 countries across the globe, we employed (...) structural equation model to construct the conceptual model. Our empirical findings revealed that while the roles of satisfaction and disconfirmation are still important as direct and indirect antecedents of international student loyalty, its most powerful predictors are the three components of subjective task value: attainment, utility and intrinsic. These insights result in a number of implications for actors on the higher ducation scene, such as heads of institutions and policy makers. (shrink)

The Philosophy for Children in Schools Project is an ongoing research project to explore the impact of philosophy for children (P4C) on classroom practice. this paper responds on the responses of head teachers, teachers and local educational authority (LA) officers in South Wales, UK, to the initial training programme in P4C carried out by the University School of Education. Achieving change in schools through the embedding of new practices is an important challenge for head teacher.s Interviews and qualitative questionnaires were (...) used to explore perceptions of and attitudes towards the dialogic practice of P4C and the related challenged for school leaders. The results provide an insight into how head teachers planned to embed the new practice of P4C in their schools. Results from the interviews and questionnaires have been subject to iterative analysis and categories derived under which to discuss the findings. There are many similarities in the the ways in which different head teachers go about planning change in their schools as well as differences. The results provide insight into the role of initial continuing professional development (CPD) in school development and the processes by which individual heads plan to embed change in practice across the whole school. We submit this brief in support of the Nonhuman Rights Project’s efforts to secure habeas corpus relief for the elephant named Happy. The Supreme Court, Bronx County, declined to grant habeas corpus relief and order Happy’s transfer to an elephant sanctuary, relying, in part, on previous decisions that denied habeas relief for the NhRP’s chimpanzee clients, Kiko and Tommy. Those decisions use incompatible conceptions of ‘person’ which, when properly understood, are either philosophically inadequate or, in fact, compatible with Happy’s personhood.

This research focuses on Schizophrenia and Clairaudience that is part of doctoral research for a Doctorate of Metaphysical Sciences at the University of Metaphysics. The mental illness known as Schizophrenia has been known for centuries. There are various symptoms associated with this mental illness upon which a diagnosis is based. The exact causes of the mental illness Schizophrenia remain unknown, as does the actual part of the individual which is effect by the illness. The most prominent and definable symptom of (...) Schizophrenia remains to be auditory hallucinations. Another explanation for individual's being able to hear voices, is that of clairaudience, a psychic ability. Clairaudient ability has a positive connotation upon the ability to hear voices, whereas the diagnosis of Schizophrenia is most commonly treated with pharmaceutical drugs to reduce or eliminate symptoms. This paper involves information about Schizophrenia, how it is perceived and treated. It also discusses various views of clairaudience, and how it is effective and manageable. In December 2013, the Nonhuman Rights Project (NhRP) filed a petition for a common law writ of habeas corpus in the New York State Supreme Court on behalf of Tommy, a chimpanzee living alone in a cage in a shed in rural New York (Barlow, 2017). Under animal welfare laws, Tommy’s owners, the Laverys, were doing nothing illegal by keeping him in those conditions. Nonetheless, the NhRP argued that given the cognitive, social, and emotional capacities of chimpanzees, Tommy’s confinement constituted (...) a profound wrong that demanded remedy by the courts. Soon thereafter, the NhRP filed habeas corpus petitions on behalf of Kiko, another chimpanzee housed alone in Niagara Falls, and Hercules and Leo, two chimpanzees held in research facilities at Stony Brook University. Thus began the legal struggle to move these chimpanzees from captivity to a sanctuary, an effort that has led the NhRP to argue in multiple courts before multiple judges. The central point of contention has been whether Tommy, Kiko, Hercules, and Leo have legal rights. To date, no judge has been willing to issue a writ of habeas corpus on their behalf. Such a ruling would mean that these chimpanzees have rights that confinement might violate. Instead, the judges have argued that chimpanzees cannot be bearers of legal rights because they are not, and cannot be persons. In this book we argue that chimpanzees are persons because they are autonomous. (shrink)

This is a critical examination of Zizek's concept of ideology in his work on the Sublime of Ideology. His account on this connotes that people are basing only in the conscious state without considering the unconscious "I." This framework in psychology has led Zizek to relate it in the process of economics which is greatly manifested in the contradictory poles of the oppressor and the oppressed and its relationship to the process of commodities. Looking into this orientation, this leaves the (...) author to incorporate the ideological character of Zizek through the lens of Anti-Terrorism Law which is not seen in the naked eye. (shrink)

In this brief, we argue that there is a diversity of ways in which humans (Homo sapiens) are ‘persons’ and there are no non-arbitrary conceptions of ‘personhood’ that can include all humans and exclude all nonhuman animals. To do so we describe and assess the four most prominent conceptions of ‘personhood’ that can be found in the rulings concerning Kiko and Tommy, with particular focus on the most recent decision, Nonhuman Rights Project, Inc v Lavery.

La sincronicità, è “la simultaneità di un certo stato psichico con uno o più eventi esterni che paiono paralleli significativi della condizione momentaneamente soggettiva” (Jung, 1952). C.G.Jung e il fisico quantistico premio Nobel, W. Pauli, ci introducono con tale concettualizzazione in un mondo, nel quale ciò che è interno e ciò che è esterno a noi non è così nettamente definito, mondo nel quale le “coincidenze” non sono più tali, ma rivestono un significato ed un’importanza per la nostra psiche, per (...) la nostra vita. Se un bambino mentre gioca sulla riva di un fiume, vi cade e rischia di venire trascinato dalla corrente, e nello stesso momento sua madre dall’altra parte della città è preda di un’angoscia che l’attanaglia e grida: “il mio bambino!”, siamo in presenza di un evento sincronistico, nel senso della definizione di Jung sopracitata. Noi crediamo, sulla scia di Jung e Pauli che la sincronicità possa essere un possibile principio esplicativo della realtà da affiancare alla causalità, per Pauli vi sono nella realtà sia elementi razionali sia irrazionali ed è quindi impossibile per la fisica dire l’ultima parola sulla realtà, visto che quest’ultima è così complessa. L’attuazione dei fenomeni sincronistici è fuori dalla portata di qualsiasi tipo di previsione razionale, l’evento sincronistico non è riproducibile ed è in qualche modo l’emblema dell’aspetto non razionale della realtà, e come detto, insieme alla più consueta logica causalistica, (ad esempio, una mela su un albero quando è matura può anche cadere), danno una visione più completa della realtà. E questa visione più completa era l’intento di Jung nell’approcciare questi fenomeni: “Cercare di aprire una via verso “l’animazione della materia” a partire dall’assunzione che “ciò che esiste sia dotato di senso”…” ( Pauli e Jung 1992, lettera n.59 di Jung, p. 100). The aim of this essay is to provide an overview of New Realism in its opposition and reaction to Postmodernism. An analysis of the implications of both philosophical approaches in diverse fields will be offered, from epistemology, to politics, to ethics. Ethical new realism is presented as particularly promising and important to the future of philosophy.

The article argues for the variant ‘tractabimus’ in Book 8, ch. 1 of Augustine’s De Trinitate as opposed to the reading ‘tractavimus’ adopted in the Corpus Christianorum edition, and explains the implications of this variant for the understanding of the overall structure of the work.

Paolo Barbò da Soncino conosciuto anche come il „Soncinas" (Soncinate) fu un domenicano italiano, filosofo e teologo tomista. Visse durante il periodo del rinascimento italiano nel XV secolo tra Bologna e Milano, morto a Cremona nel 1495. La suo apiù importante opera è proprio il commento alla Metafisica di Aristotele (Acutissimae quaestiones metaphysicales, 1 ed. Venezia 1498) che rappresenta una particolare sintesi del commentatore arabo Averrè, Tommaso d'Aquino, Erveo Natale († 1323) e Giovanni Capreolo († 1444). L'opera filosofica del Soncinate (...) era spesso discusso tra il XVI e XVII secolo. Il libro offre la prima biografia scientifica dell'autore in italiano, e l'edizione critica del suo commento al IV libro della Metafica di Aristotele in latino. -/- Paolo Barbò da Soncino called "Soncinas" was an Italian Dominican, Thomist philosopher and theologian. His life and work fall within the ambit of Italian Renaissance Thomism of the fifteenth century, between Bologna and Milano, died in 1495 in Cremona. His principal work, the exposition of Aristotle's Metaphysics, (Acutissimae quaestiones metaphysicales 1 ed. Venice 1498) proceeds from a particular synthesis of the Arabic commentator Averroes, Thomas Aquinas, Hervaeus Natalis (d. 1323), and John Capreolus (d. 1444). Soncinas' work and position were frequently discussed from the sixteenth to the seventeenth century. This study offers the first scientific biography, description and analysis of the method, sources and doctrine of Soncinas, in particular the critical Latin edition of the 4th book of his Acutissimae Quaestiones Metaphysicales (the exposition of Aristotle's Metaphysics). He also argues that Martin Heidegger's philosophy and panpsychism can confirm the possibility offered by Jung - with his alchemical - archetypical description of human nature - to achieve a deeper and more authentic awareness of our existence.

Karl Llewellyn’s critique of the canons of statutory interpretation led to a decline in their use for several decades. His critique, however, faced sustained resistance from some corners of the academy and the judiciary. Although this resistance has had only a selective uptake, it animated a gradual revival of the canons and brought the state of scholarship to an impasse that is for the most part partisan. In this article, I examine the semantic canons from a deeper level and (...) argue that a universal assumption about them is false. Said assumption is that, although not dispositive, the semantic canons at least offer some reasons in favour of or against a candidate interpretation. Inclinations to rely on the semantic canons are also based on this assumption, although it is an assumption that the critics of the canons also share. I argue that this assumption is false because the semantic canons are a class of rules that are by nature not reason-giving. This provides a new ground against giving the semantic canons deliberative weight in questions of statutory interpretation. (shrink)

In his last book, Le complexe des trois singes. Essai sur l’animalité humaine (2017), the French philosopher Étienne Bimbenet accuses “sensocentric” (« pathocentristes ») animal ethics of committing a performative contradiction: according to Bimbenet, these theories of animal rights — among which he focuses on the case of Zoopolis (2011) by Sue Donaldson and Will Kymlicka — would undermine themselves by means of declaring reason a “non-essential” feature of human beings, while at the same time those theories themselves can only (...) be understood as a highly rational human endeavour. As we will try to point out, the alleged performative contradiction does not actually take place. First of all, Donaldson and Kymlicka only describe reason as “non essential” when it comes to describing moral patients, not moral agents, and particularly not moral theoreticians. In the second place, Zoopolis presents itself explicitly as an effort in “articulating moral reasons” — not as a renouncement of reason as such. (shrink)

Misconceived Consent: Miguel has stage IV lung cancer. He has nearly exhausted his treatment options when his oncologist, Dr. Llewellyn, tells him about an experimental vaccine trial that may boost his immune response to kill cancer cells. Dr. Llewellyn provides Miguel with a consent form that explains why the study is being conducted, what procedures he will undergo, what the various risks and benefits are, alternative sources of treatment, and so forth. She even sits down with him, carefully (...) talks through the most important points, and gives him time to ask questions. Though it is a Phase 1 study and the chance that he will benefit is very low, Miguel happily agrees to take part. A week later, after the first experimental injection, she asks him if he is worried about the risks. “Risks?” he asks. “I’m sure this is safe—you’re a doctor, after all!”. (shrink)

In order to handle presuppositions in the scope of attitude verbs, the binding theory allows presuppositions triggered in a subject's beliefs to be bound at the matrix level; and it allows presuppositions triggered in non-doxastic attitudes to be bound in the subject's beliefs (Geurts, 1999; Maier, 2015). However, we argue that this leads to serious overgeneration, for example it predicts that the unacceptable `Sue will come to the party, but Bill is sure that she won't and that only Sue will (...) come to the party' should be equivalent to the acceptable `Sue will come to the party, but Bill is sure that nobody will come to the party'. This is because the presupposition triggered by `only Sue will come to the party' should be able to be bound at the matrix level. We discuss some responses to this problem, but argue that they all have shortcomings. (shrink)

Genocide remembrance is a complex epistemological/ethical achievement, whereby survivors and descendants give meaning to the past in the quest for both personal-historical and social-historical truth. This paper offers an argument of epistemic injustice specifically as it occurs in relation to practices of (individual and collective) genocide remembrance. In particular, I argue that under conditions of genocide denialism, understood as collective genocide misremembrance and memory distortion, genocide survivors and descendants are confronted with hermeneutical oppression. Drawing on Sue Campbell’s relational, reconstructive account (...) of remembering, I argue that genocide denialism involves disrespectful challenges to memory, which systematically misrecognize rememberers. Adopting the case of Turkey’s denialism of the Armenian genocide, I discuss two interrelated mechanisms through which this can happen: i) through the systematic portrayal of survivors and descendants as vicious rememberers, and ii) through distortions of the very concept of ‘genocide’. Based on this, I show how hermeneutical and testimonial injustice are crucially interrelated when it comes to “contested” memories of historical injustice and the biographical testimony it gives rise to. Per tali ragioni, oltre che per le parole non italiane e quando è specificato altrimenti, mi servirò del corsivo tutte le volte che riferisco un concetto originale del filosofo francese. Ciò non solo (...) per mantenermi il più possibile fedele alla lettera dei suoi scritti ma anche e soprattutto per rendere l’intenzione locutoria, ovvero l’enfasi e a tratti la ‘drammaticità’ del suo discorso. Per tutte le citazioni, non solo di Morin, uso le virgolette doppie e tra parentesi quadre inserisco eventuali miei interventi. Le virgolette singole intendono il senso lato di un termine. Quando invece impiego concetti scientifici o filosofici nel significato tecnico che hanno acquisito all’interno del loro orizzonte disciplinare (quindi non nell’interpretazione di Morin, per intenderci), mi servo dei caporali. Una precisazione ulteriore merita il concetto di complessità organizzazionale che rientra tra quelli che hanno guadagnato a Morin la critica di abusare di neologismi. Tale concetto si propone di mettere in rilievo il carattere attivo e creativo della complessità. In francese questa differenza emerge chiaramente perché egli cambia organisation con organisaction. In italiano essa può rendersi per iscritto con organizz-azione ma nel parlato si può apprezzare meglio nell’attributo appunto organizzazionale. La messe di note a corredo del testo si propone, oltre che fornire ulteriori approfondimenti, confronti e una puntuale fonte bibliografica, di mettere in rilievo la coerenza che au fonde il «sistema» di idee elaborato da Morin mantiene al suo interno e, forse a dispetto delle sue stesse intenzioni, con il pensiero filosofico occidentale (fin dalla sua denominazione come metodo). Microaggressions are seemingly negligible slights that can cause significant damage to frequently targeted members of marginalized groups. Recently, Scott O. Lilienfeld challenged a key platform of the microaggression research project: what’s aggressive about microaggressions? To answer this challenge, Derald Wing Sue, the psychologist who has spearheaded the research on microaggressions, needs to theorize a spectrum of aggression that ranges from intentional assault to unintentional microaggressions. I suggest turning to Bonnie Mann’s “Creepers, Flirts, Heroes and Allies” for inspiration. Building from Mann’s (...) richer theoretical framework will allow Sue to answer Lilienfeld’s objection and defend the legitimacy of the concept, ‘microaggression’. (shrink)

This article investigates the original meaning of dependent arising in the Buddha’s teaching, by focussing on the imasmi" sati formula. Modern scholars such as the Rhys Davidses, K.N. Jayatilleke and Paul Williams have interpreted it as a princi- ple of causation, comparable to a scientific conception of causation. I argue instead that this formula implies that the Buddha held that causation is nothing more than the correlation of causes and effects, and that it commits the Buddha to a Humean regularity (...) thesis about causation. I draw a distinction between the Buddhist and scientific concepts of causation, and then summarise an alternative approach made by more recent scholars such as Sue Hamilton, Noa Ronkin and Eviatar Shulman, who present dependent arising in terms of conditionality in the causal structure of subjective experience. I conclude by presenting the argument that the imasmi" sati formula does not express a principle of causation but is rather a formula for the method of discovering and presenting causation as conditionality in experience. Domesticated animals need to be treated as fellow citizens: only if we conceive of domesticated animals as full members of our political communities can we do justice to their moral standing—or so Sue Donaldson and Will Kymlicka argue in their widely discussed book Zoopolis. In this contribution, we pursue two objectives. Firstly, we reject Donaldson and Kymlicka’s appeal for animal citizenship. We do so by submitting that instead of paying due heed to their moral status, regarding animals as citizens misinterprets (...) their moral qualities and thus risks treating them unjustly. Secondly, we suggest that Donaldson and Kymlicka’s reinforced focus on membership should draw our attention to the moral standing of a further ‘species’, namely robots. Developments within artificial intelligence have advanced rapidly in recent years. With robots’ gaining ever greater capacities and abilities, we need to ask urgent questions about the moral ramifications of these technical advances. (shrink)

In quanto tale, non ci forniscedirettamente una descrizione della realtà. Una descrizione della realtà, cioè un’ ontologia , dovrebbedirci che cosa c’è nel mondo e come si comporta, quali sono i processi che si realizzano a livellomicroscopico e, di conseguenza, fornirci una spiegazione del formalismo quantistico. ITA: Quello del “buon europeo” è in Nietzsche un tema significativo, che si presenta originariamente connesso alle riflessioni di Nietzsche sulla cultura europea, arricchendosi col tempo di una portata filosofica che si lega agli obiettivi del suo pensiero maturo. Scopo del presente articolo è di mostrare la genesi e l’evoluzione di tale concetto, a partire dalle sue prime occorrenze in Umano, troppo umano I fino al suo compiuto sviluppo negli scritti del 1885-87. Tale studio permetterà di evidenziare il particolare valore (...) che Nietzsche attribuisce ai “buoni europei”, in quanto promotori dello sviluppo spirituale conseguente alla compiuta liberazione della morale cristiana. ENG: The “good European” is a rich and important topic in Nietzsche. It is first related to Nietzsche’s early reflections on European culture, and during the 1880’s it gains philosophical value, being strictly connected with the purposes of Nietzsche’s mature thought. The aim of this paper is to track the genesis and development of the notion of “good European”, from Human, all too Human I to Nietzsche’s writings from the years 1885-1887. That investigation shall particularly show the meaning and value that Nietzsche attributes to the good Europeans; as for him, they are in fact the leaders of the spiritual development that follows the overcoming of Christian morality. My main aim is to clarify what we mean by ‘look’ sentences such as (1) below – ones that we use to talk about visual experience: -/- (1) The ball looked red to Sue -/- This is to help better understand a part of natural language that has so far resisted treatment, and also to help better understand the nature of visual experience. -/- By appealing to general linguistic principles I argue for the following account. First, we use (1) to (...) talk about an event. Second, we use the verb ‘look’ to specify the kind of event about which we are talking – it is a looking event. Third, we use the subject ‘the ball’ to specify a stimulus of the event – something that looks some way in the event. Fourth, we use the adjunct ‘to Sue’ to specify an experiencer of the event – someone to whom things look some way in the event. Finally, we use the complement ‘red’ to specify a way of the event – a way in which the event occurs (I take ways of occurring to be properties of events). Which way do we use ‘red’ in (1) to specify? I argue: the maximally specific way w such that the following is generically true: looking events whose stimulus is red occur in way w (it is important that this is understood generically: this is what does much of the work in explaining our use of (1) and other ‘look’ sentences). Putting this together, what we mean by (1) is: there was a looking event whose stimulus was the ball, whose experiencer was Sue, and which occurred in the maximally specific way that looking events occur when their stimulus is red. -/- This account of how we use ‘red’ in (1) is one of the most interesting aspects of my thesis. It extends to an account of how we use ‘proud’ in ‘John walks proud’, ‘as if he is American’ in ‘John talks as if he is American’, ‘like a duck’ in ‘John sounds like a duck’, and so on. In each case we use the expression in question to specify a way: the maximally specific way proud people walk, the maximally specific way American people talk, and so on. So the study of ‘look’ sentences has much to tell us about the functioning of many other English language constructions, and suggests that ways have a significant role to play in the semantics of natural language – a fact that has not yet been sufficiently recognised by linguists or philosophers of language. -/- My thesis also has implications for the philosophy of perception. One of the central questions about perception is: What is the nature of visual experience? What is it, for example, for a ball to look red to Sue? My thesis offers an answer: What it is for the ball to look red to Sue is for whatever it is that we mean by ‘The ball looks red to Sue’ to be the case, and what we mean by ‘The ball looks red to Sue’ is that there is a looking event whose stimulus is the ball, whose experiencer is Sue, and which is occurring in a certain way. It thus delivers an adverbial account of visual experience, one that has the resources to better deal with problems that are traditionally thought to be decisive against adverbial accounts. (shrink)

Thinking the Visual, Visualizing the Thought.A perceptual and Political Model of VisionMerleau-Ponty’s program of perceptivizing thought has depoliticizing effects that, though he does not recognize them, undermine his understanding of politics. These anti-political consequences, moreover, bring out the internal difficulties of his anti-intellectualist starting point. There are three areas in which Merleau-Ponty gave a thorough application, though with unequal success, of his perception-based model: the presentation of his own thought, in which his program of picturalization had a striking success; the (...) explanation of the historical process, in which his visualization model was only partly effective; and access to other people’s thought, in which his perceptivist views encountered an undeniable failure. Merleau-Ponty’s successive approaches to other people’s thought show, by two distinct paths, and beyond his own intentions, an unforeseen political defect. His perceptive model proves incompatible with his political ideas when it is applied in depth, and it thus breaks apart the cohesion of his thought. From a larger perspective, it disrupts reflective approaches to politics since it damages their conceptual bases. This article shows successively that Merleau-Ponty laid out a perceptive model of universal scope; that he applied it to several areas, including politics; that this model proves politically deficient when it serves to remove the autochthonous sources of sense; that these depoliticizing effects become more acute when Merleau-Ponty employs the perceptive model to elucidate other people’s thought; and that its frustration in this area not only devalues his political reflections, but also signals that the perceptive model simply prevents a “thinking of the political.”Pensare il visuale, visualizzare il pensiero.Un modello percettivo e politico della visioneIl programma di percettivizzazione del pensiero intrapreso da Merleau-Ponty comporta effetti spoliticizzanti che sconfessano nascostamente la sua comprensione della politica. Tali conseguenze antipolitiche mettono altresì in rilievo le difficoltà intrinseche alla sua posizione anti-intellettualista. Vi sono tre ambiti nei quali Merleau-Ponty, con diverso successo, ha applicato il suo modello percettivo : la presentazione del suo stesso pensiero, nella quale questo programma di pittoricizzazione incontra un successo trionfale; la chiarificazione del processo storico, dove tale modello “visualeˮ non è efficace che in parte; infine l’accesso al pensiero di altri autori, terreno sul quale questa prospettiva percettivista subisce uno scacco innegabile. Molti tentativi merleaupontiani di approcciare il pensiero di altri autori attestano in vario modo un imprevisto deficit politico. Il modello percettivo di Merleau-Ponty si rivela in altri termini incompatibile con le sue idee politiche, nel momento in cui viene applicato in profondità, e in ultima analisi mette a dura prova la coerenza del suo pensiero. In una prospettiva più ampia, esso ostacola un approccio riflessivo alla politica poiché ne degrada le stesse basi concettuali. Il nostro articolo mostra quindi che Merleau-Ponty ha articolato un modello percettivo di portata universale; che l’ha applicato a svariati ambiti d’indagine, tra cui la politica; che quel modello si rivela deficitario quando viene utilizzato per attingere a specifiche fonti di senso; che tali effetti spoliticizzanti si acuiscono nel momento in cui Merleau-Ponty adotta il modello percettivo per illuminare il pensiero di altri autori; che, per concludere, la sua incongruenza con questo peculiare ambito di riflessione non solo impoverisce le sue riflessioni politiche, ma attesta che in linea generale il modello percettivo sbarra la strada a un qualsiasi «pensiero del politico». Ernst Mach (1838-1916) è stato una figura di riferimento per la cultura scientifica e filosofica tardo-ottocentesca e dei primi decenni del Novecento. Le sue ricerche in fisica e psicologia, così come il lavoro epistemologico che emerge dalle pagine di opere quali La meccanica nel suo sviluppo storico-critico e Conoscenza ed errore, hanno influito notevolmente su molti autori a lui contemporanei. In questi testi, Mach delinea una concezione antimetafisica del pensiero scientifico e una concezione biologico-evolutiva della conoscenza umana che si ritrovano (...) elaborate in vario modo nella teoria della relatività di A. Einstein, nell’epistemologia evoluzionistica di K. Popper e D. Campbell, nel pragmatismo di W. James e, più in generale, nelle idee che animarono il primo Circolo di Vienna. I saggi raccolti nel presente volume si propongono di commemorarne la figura e l’opera, guardando a Mach come figura di confine tra prospettive di indagine che la storia della filosofia dell’ultimo secolo ha spesso visto contrapposte. L’articolo, dopo una breve introduzione sul rapporto tra gli Stoici e la poesia, approfondisce la figura di Crisippo e in particolar modo perché lo stoico si sia servito cospicuamente di testi poetici e di versi di autori differenti nelle sue trattazioni filosofiche. Tale problema verrà chiarito con l’esempio della citazione dei versi 1078-1079 della Medea di Euripide, citazione di cui Crisippo si serve per spiegare il concetto di ἀκρασία.

Il presente volume raccoglie – con dovute modifiche e opportuni aggiornamenti – testi, appunti, note e osservazioni composti in occasione del corso di lezioni e seminari dedicati, alcuni anni fa, al pensiero di Max Scheler. L’obiettivo è offrire una guida alla lettura di alcune sue opere fondamentali e individuare una chiave di lettura che renda possibile intravedere un filo conduttore che attraversa l’itinerario speculativo scheleriano. Implicitamente, una domanda attraversa le pagine del testo: Scheler è ancora attuale in un contesto culturale (...) profondamente mutato come quello odierno? Se si considera il complesso della sua ricerca e ci si interroga sul significato, è difficile non riconoscere che siamo di fronte a un pensatore che – nonostante le complessità e i limiti – merita ancora di essere riproposto, studiato e compreso, poiché ha ancora molto da insegnare. I discuss Sue Campbell's view of the interpretation of emotion in light of the political significance of emotional dismissal, in response, 1 suggest that feminist contentions of interpretation developed within dialogical communities are best suited to providing resources for expressing, interpreting, defining, and reflecting on our emotions.

This commentary is devoted to offer a rejoinder to an argument by Schiffer against semantic accounts of vagueness (typically relying on supervaluationist techniques) based on indirect discourse. A short sketch of the argument can be found on pp. 246-48 of ‘Vagueness and Partial Belief’ ; a more elaborated presentation occurs in “TWOIs sues of Vagueness”.

Il pensiero di Hans Jonas è comunemente inteso nel segno di una netta reazione all’interpretazione gnostica del sé e del mondo. Egli si dedicò allo studio della gnosi dalla metà degli anni venti fino al secondo dopoguerra, e il frutto delle sue ricerche è raccolto nei due volumi di Gnosi e spirito tardoantico (1934, 1964). Questa lettura polemica della sua filosofia è davvero in grado di rendere conto dei rapporti che la proposta jonasiana, come filosofia della biologia e etica della (...) responsabilità, intrattiene con le strutture caratteristiche del mito gnostico? Attraverso una approfondita analisi de Il concetto di Dio dopo Auschwitz, momento nel quale l’approccio unitario della filosofia jonasiana è più evidente, possono essere ritrovati i segni di un confronto positivo con la gnosi. Anche i caratteri del pensiero gnostico, dunque, concorrono a guidare la ricerca di Hans Jonas verso i temi propri della sua riflessione matura. (shrink)

A fine Settecento, quando l’ingresso della musica nel «sistema delle arti» era un evento ancora recente, il fondatore della Allgemeine Musikalische Zeitung, Friedrich Rochlitz, individuava il motivo della maggiore discrepanza nei giudizi in materia musica le rispetto alle altre arti nel fatto che essa sarebbe priva di punti di riferimento visibili. «La musica», egli affermava, «nulla ha divisibile (Sichtbares) cui si possano confrontare le sue opere, o da cui possa scaturire una qualche concordanza nelle valutazioni». Mentre per esempio possiamo valutare (...) la differenza di valore tra due raffigurazioni di una rosa perché abbiamo visto la rosa reale, nella musica, argomentava Rochlitz, dobbiamo affidarci alla nostra sensibilità introspettiva, il che rende il compito del giudizio assai difficile. Non intendo qui commentare questo argomento. Piuttosto mi interessa mettere in discussione l’idea che la musica non abbia a che fare con la dimensione del visibile. Anche dando per scontata l’idea che la musica sia un’arte, o un campo di pratiche, legato in modo fondamentale ai suoni e all’ascolto, non è inutile interrogarsi sul contributo della dimensione visiva all’esperienza musicale. Questo articolo presenterà quindi alcune considerazioni circa gli aspetti visivi della produzione e della ricezione della musica. La prima parte concerne la possibilità di visualizzare l’opera intesa come tipo ideale strutturale. La seconda parte discute il ruolo della visione nell’esecuzione delle opere musicali. La terza parte si sofferma brevemente sul ruolo della visualizzazione immaginativa e del vedere performativo nelle pratiche dell’improvvisazione. La conclusione propone un rapido riferimento all’iconologia musicale. (shrink)

Gianni Vattimo ha elaborato l’estetica e la teoria dell’arte del «pensiero debole» soprattutto in alcuni articoli pubblicati nella «Rivista di Estetica» (della quale è stato direttore). Parte di questi saggi è stata poi raccolta nella seconda sezione di una delle sue opere centrali, La fine della modernità, sezione intitolata, significativamente, La verità dell’arte. Le diverse questioni discusse da Vattimo sono infatti attraversate dal filo conduttore del problema della verità dell’arte, nell’epoca del nichilismo, della fine della storia e del mondo estetizzato (...) dei mass media. Attraverso una lettura teoreticamente produttiva di M. Heidegger e F. Nietzsche, ma anche – come si vedrà – di certe pagine kantiane, e al contempo “indebolendo” l’ermeneutica di H.-G. Gadamer (ma anche quella di L. Pareyson),Vattimo affronta la questione dell’arte, della sua verità, del suo significato, del suo statuto ontologico, mettendo anzitutto in questione la domanda “che cos’è l’arte?” che molti studiosi, sia in ambito “analitico”, sia in ambito “continentale”, pongono al centro della riflessione estetica. Ha infatti senso, oggi, chiedersi «che cos’è l’arte?», cercando di fornire una definizione che restituisca l’ontos on, l’essenza dell’arte? O è proprio il fatto di presumere la possibilità di offrire una definizione a costituire il vero problema, in quanto tale assunzione presuppone già un determinato modo di pensare il mondo, modo di pensare che, storicamente, si è costituito come la metafisica occidentale? E se nel post-moderno la metafisica occidentale viene decostruita da un pensiero e da prassi vitali che ne mettono in crisi le griglie concettuali, ne sovvertono gli ordini e le tassonomie, esibendone così l’infondatezza, com’è possibile definire, pensare e praticare l’arte e l’estetica, che sono categorie impiantate solidamente nelle strutture della metafisica? Catharine Trotter Cockburn (1679- 1749) fu poetessa, drammaturga e filosofa. La vivacità intellettuale e la forte determinazione le permisero di aggirare il pregiudizio di genere e di sottrarsi alle dinamiche di marginalizzazione femminile tipiche dell’età moderna. Pur celandosi dietro l’anonimato, Cockburn prese parte attiva al dibattito filosofico del tempo, intervenendo soprattutto in materia di morale. Le sue opere filosofiche, scritte in difesa di Locke o di Clarke, custodiscono, nonostante il dichiarato intento apologetico, tratti di originalità e indipendenza, particolarmente evidenti nella (...) teoria dell’obbligo morale, nell’interpretazione modale della dottrina lockeana d’identità personale, nell’ipotesi di una natura ontologica dello spazio. Nella sua straordinaria opera scientifica, Franco Selleri si è sempre opposto alla rinuncia alla comprensione della struttura della realtà e della natura degli oggetti fisici, che egli considera come l’elemento caratterizzante delle principali teorie della fisica del Novecento e che è stata stigmatizzata da Karl Popper come tesi della “fine della strada in fisica”. Sin dalla fine degli anni ’60, egli ha sviluppato quella riflessione critica nei confronti delle teorie fondamentali della fisica moderna, in particolar modo della teoria delle particelle (...) elementari e della meccanica quantistica, e in un secondo tempo delle teorie relativistiche, che contraddistingue il suo programma di ricerca. Nel corso della sua intensa e infaticabile attività scientifica, Selleri è entrato in proficuo contatto con molti grandi fisici e filosofi della scienza, instaurando un intenso dialogo critico con Louis de Broglie, John Bell e Karl Popper. Le sue originali e non convenzionali ricerche lo hanno portato a risultati significativi non solo nell’ambito dei fondamenti della fisica, ma anche della storia e della filosofia della fisica. Per questo abbiamo voluto dedicare un numero speciale di Isonomia al nostro impareggiabile amico e collega, sia per la sua passione instancabile e la sua profonda conoscenza dei fondamenti formali, concettuali e filosofici delle teorie della fisica contemporanea, sia e forse ancor più come maestro di una prospettiva perennemente critica che egli ha sempre seguito e proposto con particolare rigore ed estrema determinazione. Il saggio intende ricollocare gli studi di Jürgen Habermas sui mutamenti di struttura della sfera pubblica politica nel campo disciplinare della political communication research al fine di indicare operativamente quali elementi fattuali potrebbero confermare la validità del modello normativo deliberativo. Dopo aver introdotto gli esigenti principi pragmatici che improntano l’approccio funzionalista dello studioso tedesco, vengono si-stematizzate le sue riflessioni sull’indipendenza dei media dai sotto-sistemi economici e politico-amministrativi e sugli effetti della comunicazione mediale sul pubblico, considerando la struttura delle relazioni e (...) la qualità dell’informazione. Da ultimo, verrà presentata la tesi – oggi divenuta ancor più controversa – che la concezione deliberativa sia in grado di mantenere una “grandezza controfattuale” grazie al ruolo-guida della “stampa di qualità” e all’impegno degli intellettuali “veri”. In questo saggio traccio un profilo del pensiero di Bernard Williams, concentrandomi su temi relativi alla filosofia morale e, più nello specifico, ricostruendo la sua disamina dell’idea di oggettività in questa disciplina. Dopo aver esaminato le sue critiche all’idea di teoria etica normativa, offro un inquadramento metaetico della sua posizione e concludo mostrando le sue affinità con la riflessione etica degli antichi Greci e, in particolar modo, di Aristotele.

The twentieth century in legal education began with Dean Roscoe Pound of Harvard Law School demanding that law take broader perspectives. The time had arrived for sweeping changes in how judges judged, law professors taught, and lawyers practiced. For thirty years Roscoe Pound labored tirelessly in the design of a "Sociological Jurisprudence." Toward the end of Pound's twenty years as Dean of Harvard Law School, Karl Llewellyn of Columbia Law School crafted a second perspective on law, which he called (...) "Legal Realism". Pound retired from his role as Dean in 1936. In 1935 the German Scholar Ludwig Fleck published a work which studied the nature of science, and articulated important precepts and maxims about how the structure of science precluded innovation and creative design. By 1963 Thomas Kuhn published a sequel to Fleck's work titled "The Structure of Scientific Revolutions." Kuhn endeavored to set the contours of science which could be identified as constraints to the formation of new knowledge. ;Roscoe Pound and Karl Llewellyn set out to bring the American legal process forward by monumental steps in how law was taught and practiced. American legal education up to the late nineteenth century was a system of apprenticeships. Young men paid law firms to gain experience in the law. Their time was sold for more than they were paid, and law firms enjoyed the benefits of the apprenticeship system. Today, law schools approved by the American Bar Association prepare and graduate candidates for licensing exams. Thirty percent of those are not prepared to be examined, and fail the state bar exams. ;This thesis explores the process used by Pound to create his "Sociological Jurisprudence," examines Pound's biographical and personal history, studies his design process, then articulates qualitative design questions and policy recommendations for improvements in the construction of new legal paradigms and academic policy for law school graduates. By comprehending how difficult change is in design though understanding Fleck and Kuhn's constructions of paradigmatic constraints, a path is carved to forward new scholarship representative of Pound and Llewellyn's skills and abilities. This paper examines whether American parents legally violate their children’s privacy rights when they share embarrassing images of their children on social media without their children’s consent. My inquiry is motivated by recent reports that French authorities have warned French parents that they could face fines and imprisonment for such conduct, if their children sue them once their children turn 18. Where French privacy law is grounded in respect for dignity, thereby explaining the French concerns for parental “over-sharing,” I show (...) that there are three major legal roadblocks for such a case to succeed in US law. First, US privacy tort law largely only protects a person’s image where the person has a commercial interest in his or her image. Secondly, privacy tort laws are subject to constitutional constraints respecting the freedom of speech and press. Third, American courts are reluctant to erode parental authority, except in cases where extraordinary threats to children’s welfare exist. I argue that while existing privacy law in the US is inadequate to offer children legal remedy if their parents share their embarrassing images of them without their consent, the dignity-based concerns of the French should not be neglected. I consider a recent proposal to protect children’s privacy by extending to them the “right to be forgotten” online, but I identify problems in this proposal, and argue it is not a panacea to the over-sharing problem. I conclude by emphasizing our shared social responsibilities to protect children by teaching them about the importance of respecting one another’s privacy and dignity in the online context, and by setting examples as responsible users of internet technologies. Negli ultimi anni, il richiamo al concetto di emergenza si è fatto sempre più diffuso in molte aree della filosofia e della scienza. Il termine viene usato per riferirsi alla circostanza in cui un sistema (fisico, chimico, biologico, ma anche sociale) manifesta delle proprietà e dei comportamenti che sembrano nuovi rispetto a quelli delle sue parti più semplici. Questo libro si propone di chiarire questo fenomeno, tenendo conto, da un lato, che le discipline coinvolte nel dibattito sono molte, quindi un (...) approccio univoco all'emergenza potrebbe non bastare e, dall'altro, che per comprendere cosa sia l'emergenza è necessario delinearne le relazioni con altre questioni filosofiche di primaria importanza come quelle che coinvolgono la fondamentalità, la complessità e la causalità. L'etica, secondo Wittgenstein, ha a che fare con la mostrazione di un modo di vivere, inteso vuoi come disposizione complessiva del soggetto, vuoi come "habitus". In questo libro, Marta Cassina ripercorre le forme di questa mostrazione nell'opera del filosofo, argomentando, in primo luogo, che il modo di vivere indicato nel "Tractatus" come il contrassegno indicibile della vita giusta e felice debba essere compreso, man mano che il pensiero di Wittgenstein matura, come un "fare" e un uso condiviso della vita; che (...) questo uso, inoltre, possa essere letto nelle sue implicazioni teoretiche e nella maniera della sua genesi attraverso le "lenti" della credenza religiosa e della grammatica del voto di fede. Il 2021 segna gli ottant’anni dalla nascita di Mario Perniola, uno dei massimi filosofi italiani del secondo dopoguerra. Questo volume raccoglie interventi che esplorano la sua opera mostrandone la fertilità e sottolineando al tempo stesso la prossimità delle sue idee con le principali sfide del nostro tempo. Dall’Italia al Brasile, passando per gli Stati Uniti, l’Irlanda, la Francia, il Belgio, il Messico e la Cina, gli autori si soffermano su temi che comprendono l’estetica, la politica, la teoria della comunicazione, i (...) queer studies, il pensiero rituale e religioso, la sessualità e la letteratura, restituendo la plurivocità e l’originalità di un filosofo di respiro internazionale e più che mai attuale. Il presente contributo muove dalle osservazioni sul linguaggio che Nietzsche svolge in Umano, troppo umano, I, § 11, con lo scopo di riflettere sulla posizione anti-realista che Nietzsche sostiene in quell’aforisma e di evidenziare il ruolo che essa svolge nelle sue più tarde considerazioni relative alla cultura occidentale e alla sua antropologia. Come si avrà modo di mostrare, la critica nietzscheana al realismo del senso comune è in linea con alcune epistemologie pragmatiste sorte tra Otto- e Novecento. Questo elemento di (...) “attualità” non mina però l’originalità della riflessione di Nietzsche su quell’argomento. Piuttosto, è possibile sostenere che l’idea che il pensiero filosofico intervenga in una correzione dell’impegno metafisico proprio del senso comune sia lo strumento teoretico che permette a Nietzsche di operare sullo sviluppo della cultura e società europee. I diversi numeri sull'asse delle ordinate, quindi, rappresenteranno diverse possibili risposte ad una certa domanda. Un punto, con le sue due coordinate, rappresenta una certa risposta ad una certa domanda. Una religione può allora essere rappresentata come un insieme di punti. Diverse religioni potrebbero entrare in contrasto dando risposte diverse ad una stessa domanda; potrebbero però anche (...) rispondere a domande diverse, o dare le stesse risposte alle medesime domande. Supponiamo che una religione sia caratterizzata dai punti {a, b, c}, e un'altra dai punti {b, d, e}: cosa impedisce ad un credete di sposare entrambe le religioni, credendo nel sistema {a, b, c, d, e}? In effetti, nulla. Nel presente articolo, sottolineo le somiglianze tra diverse religioni, suggerendo che gli approcci mistici (anziché quelli dogmatici) spingono ad una naturale unità. (shrink)

In the 1980s and 1990s, a series of attempts were made to put into U.S. law a civil rights ordinance that would make it possible to sue the makers and distributors of pornography for doing so (under certain conditions). One defence of such legislation has come to be called "the free speech argument against pornography." Philosophers Rae Langton, Jennifer Hornsby and Caroline West have supposed that this defence of the legislation can function as a liberal defence of the legislation: in (...) particular, a defence of the legislation based on the value of women's liberty. This would be somewhat unexpected given MacKinnon's own antipathy toward liberalism. In this paper, I argue that the free speech argument against pornography cannot be used as a liberal defence of the ordinances. The legislation is, to some extent, self-defeating insofar as it understood in terms acceptable to a fairly standard kind of liberal. This becomes apparent when we consider the value pornography can have for women, which we can see if we consider what female makers, distributors and consumers of pornography have to say about why they make, distribute and consume it.
