En los últimos tiempos el derecho ambiental ha ganado un puesto importante en el ámbito jurídico, hecho que refleja la preocupación que hoy se tiene por la relación del hombre con su entorno. Desde hace quince años, la Universidad Colegio Mayor de Nuestra señora del Rosario, por intermedio de su Facultad de Jurisprudencia y concretamente de la Especialización y la línea de investigación en Derecho Ambiental, ha propuesto a través de diversos proyectos avanzar en el conocimiento y análisis del ordenamiento (...) jurídico ambiental, aportando así al desarrollo, estructura y consolidación de esta rama jurídica. Bajo estos parámetros, el objetivo de esta publicación es hacer algunas reflexiones en torno a distintos temas que dentro del derecho público impactan o influyen al derecho ambiental y responder a los enormes desafíos que se presentan en la materia. Por tanto, el programa quiere contribuir desde la academia al diálogo crítico y propositivo que permita dar solución a los problemas encontrados en la aplicación del derecho ambiental. En el primer capítulo, Gloria Amparo Rodriguez describe los ordenamientos jurídicos constitucionales de Colombia, Ecuador y Bolivia a fin de analizar la forma en que cada uno de ellos consagra el derecho a un ambiente sano. A continuación, Martha Ovalle y Zelba Nidia Castro de Perez realizan un estudio de los principios de precaución y prevención, exponiendo su alcance, su fundamento desde el derecho internacional y cómo vienen siendo entendidos por nuestro ordenamiento jurídico, tanto jurisprudencial como legal. Luis Adolfo Diazgranados se ocupa de la responsabilidad de los funcionarios públicos en materia ambiental, para lo cual realiza un análisis de los deberes consagrados en la normatividad vigente. Continuando con esta temática, el profesor Jorge Agudo Gonzalez, de la Universidad Autónoma de Madrid, explora la incidencia del ambiente y los recursos naturales en los procesos contractuales, a fin de mostrar cómo estas materias se han constituido en variable fundamental en el devenir de la formación, celebración y ejecución de los contratos, desde un punto de vista crítico, los aspectos importantes del proceso sancionatorio ambiental, evidenciando las falencias y vacios del a Ley 1333 de 2009. Jairo Cabrera plantea algunas reflexiones sobre la responsabilidad, valiéndose de la doctrina internacional, sobre la problemática de la reparación por daño ambiental. Por su parte, Leonardo Güiza Suárez explica el régimen general de la responsabilidad ambiental en el ordenamiento jurídico a partir del daño de los bosques naturales y su incidencia sobre los derechos humanos. Andres Gomez Rey, desde la teoría del acto administrativo, desarrolla el análisis crítico del régimen jurídico de las aguas superficiales en el derecho ambiental. Giovani J. Herrera Carrascal realiza una disertación sobre los recursos naturales y el ambiente como elementos del espacio público que a su vez constituye en un componente del medio ambiente urbano a partir de la jurisprudencia y de las competencias respectivas. Por último, Marybell Ochoa Miranda trate el tema de los residuos hospitalarios en Colombia, exponiendo su régimen jurídico, las competencias de las autoridades ambientales, los deberes que en estos asuntos tienen los ciudadanos, proponiendo lineamientos para avanzar en la consolidación de la gestión integral de residuos hospitalarios y similares. Higher‐order evidence can make an agent doubt the reliability of her reasoning. When this happens, it seems rational for the agent to adopt a cautious attitude towards her original conclusion, even in cases where the higher‐order evidence is misleading and the agent's original reasons were actually perfectly good. One may think that recoiling to a cautious attitude in the face of misleading self‐doubt involves a failure to properly respond to one's reasons. My aim is to show that this is not (...) so. My proposal is that (misleading) higher‐order evidence can undermine the agent's possession of her first‐order reasons, constituting what I call a dispossessing defeater. After acquiring the higher‐order evidence, the agent is no longer in a position to rely competently on the relevant first‐order considerations as reasons for her original conclusion, so that such reasons stop being available to her (even if they remain as strong as in the absence of the higher‐order evidence). In this way, an agent with misleading higher‐order evidence can adopt a cautious stance towards her original conclusion, while properly responding to the set of reasons that she possesses–a set that is reduced due to the acquisition of higher‐order dispossessing defeaters. Recent breakthroughs in stem cell differentiation and reprogramming suggest that functional human gametes could soon be created in vitro. While the ethical debate on the uses of in vitro generated gametes (IVG) was originally constrained by the fact that they could be derived only from embryonic stem cell lines, the advent of somatic cell reprogramming, with the possibility to easily derive human induced pluripotent stem cells from any individual, affords now a major leap in the feasibility of IVG derivation and (...) in the scope of their potential applications. In this paper we develop an ethical framework, rooted in recent scientific evidence, to support a robust experimental pipeline that could enable the first-in-human use of IVG. We then apply this framework to the following objectives: (1) a clarification of the genetic parenting options afforded by IVG, along with their ethical underpinnings; (2) a defence of the use of IVG to remedy infertility, broadening their scope to same-sex couples; (3) an assessment of the most far-reaching implications of IVG for multiplex parenting. These include, first, the liberation of parenting roles from the constraints of biological generations in vivo, allowing multiple individuals to engage in genetic parenting together, thus blurring the distinction between biological and social generations. Second, we discuss the conflation of IVG with sequencing technology and its implications for the possibility that prospective parents may choose among a hitherto unprecedented number of potential children. In view of these perspectives, we argue that, contrary to the exhausted paradigm according to which society lags behind science, IVG may represent instead a salient and most visible instance where biotechnological ingenuity could be used in pursuit of social experimentation. In this paper I argue that some human reproductive genome editing interventions can be therapeutic in nature, and thus that it is false that all such interventions just create healthy individuals. I do this by showing that the conditions established by a therapy definition are met by certain reproductive genome editing interventions. I then defend this position against two objections: (a) reproductive genome editing interventions do not attain one of the two conditions for something to be a therapy, and (b) (...) some reproductive genome editing interventions are therapeutic but in a nonstandard way. In the Conclusion I call for a more nuanced discussion of the nature of reproductive genome editing interventions. (shrink)

It is widely held that there is a distinctive norm of assertion. A plausible idea is that there is an analogous, perhaps weaker, norm for indirect communication via implicatures. I argue against this type of proposal. My claim is that the norm of assertion is a social norm governing public updates to the conversational record. Off the record implicatures are not subject to social norms of this type. I grant that, as happens in general with intentional actions, off the record (...) communicative acts may be subject to normative assessments on different levels (for instance, regarding their moral or prudential appropriateness). However, such assessments do not generate distinctive norms that apply to all cases of implicature. (shrink)

Home-based biology experiments are activities that utilize household materials that have been adapted for the remote learning environment and are aligned to standard learning competencies. Recognizingthe households and kitchens as extensions of laboratories, HBEs can be used to deliver authentic learning experiences for the students at home. Furthermore, there are several attributes of HBEs that should be considered before the implementation of the activity. These attributes are, it is ethical and safe to perform, it produces tangible products, encourages students to (...) reflect, promotes collaboration, materials are easy-to-find and affordable and lastly, home-based biology experiments are modifiable. Also, HBE encourages students to work independently under the supervision of their parents and teachers. Parents and guardians, as collaborators, should ensure students'safety, monitor their child’s progress, provide a safe environment and conducive work area, and should report all cases of accidents and problems to the subject teacher. In conclusion, home-based biology experiments are one of the emerging teaching tools for remote authentic learning in the new normal. Moreover, HBEs could also be used to address the problem of the lack of hands-on activity in remote learning. Further studies should be conducted on the effectiveness of HBEs in different topics in biology. (shrink)

The “received view” on Kantian ethics holds that perfect duties enjoy absolute priority over imperfect duties. More recently, several Kantian scholars have reassessed this situation, arguing that imperfect duties may remain binding even if they imply breaching a perfect duty. In this article, I argue that both positions rely on a misunderstanding of the bindingness of Kantian duties. Genuine Kantian duties, I claim, remain binding even when they cannot be fulfilled. We must always strive for a total completion of our (...) duties; what it means for us to strive for it, however, will vary depending on our peculiar situation. (shrink)

News about the first baby born after a mitochondrial replacement technique (MRT; specifically maternal spindle transfer) broke on September 27, 2016 and, in a matter of hours, went global. Of special interest was the fact that the mitochondrial replacement procedure happened in Mexico. One of the scientists behind this world first was quoted as having said that he and his team went to Mexico to carry out the procedure because, in Mexico, there are no rules. In this paper, we explore (...) Mexico's rule of law in relation to mitochondrial replacement techniques and show that, in fact, certain instances of MRTs are prohibited at the federal level and others are prohibited at the state level. According to our interpretation of the law, the scientists behind this first successful MRT procedure broke federal regulations regarding assisted fertilization research. (shrink)

This article proposes a teleological ethical approach for the analysis of the conflict between the right to the city and the right to tourism. Unlike the understanding of this conflict through a deontological lens, which is based on universal and unconditioned moral duties, a teleological perspective allows us to observe much more underlying and intricate problems that can arise in any cultural and socio-historical context of each tourist city. By taking the teleological model of the philosopher Alasdair MacIntyre as a (...) starting point, the article suggests the basis of a framework for an ethical understanding of the complexity of teleological conflicts that can appear in the pursuit of situated internal goods —sought cooperatively— and external goods —sought competitively— within and between social practices related to both rights. In response to the COVID‐19 pandemic philosophers and governments have proposed scarce resource allocation guidelines. Their purpose is to advise healthcare professionals on how to ethically allocate scarce medical resources. One challenging feature of the pandemic has been the large numbers of patients needing mechanical ventilatory support. Guidelines have paradigmatically focused on the question of what doctors should do if they have fewer ventilators than patients who need respiratory support: which patient should get the ventilator? There is, however, an important (...) higher level allocation problem. Namely, how are we to ethically distribute newly obtained ventilators across hospitals: which hospital should get the ventilator(s)? In this paper, we identify a set of principles for allocating newly obtained ventilators across hospitals. We focus particularly on low and middle income countries, who frequently have limited pre‐existing intensive care capacity, and have needed to source additional ventilators. We first provide some background. Second, we argue that the main population healthcare aim during the COVID‐19 pandemic should be to save the most lives. Next, we assess a series of potential heuristics or principles that could be used to guide allocation: allocation to the most densely populated cities, random allocation, allocation based on the ratio of patients to ICU personnel, prioritisation in terms of intrahospital mortality, prioritisation of younger populations, and prioritisation in terms of population mortality. We conclude by providing a plausible ranking of the principles, while noting a number of epistemological challenges, in terms of how they best further the aim of increasing the probability of saving the most lives. In a recent publication Tom Douglas and Katrien Devolder have proposed a new account of genetic parenthood, building on the work of Heidi Mertes. Douglas and Devolder’s account aims to solve, among other things, the question of who are the genetic parents of an individual created through somatic cell nuclear transfer (i.e. cloning): (a) the nuclear DNA provider or (b) the progenitors of the nuclear DNA provider. Such a question cannot be answered by simply appealing to the folk account of (...) genetic parenthood, according to which the genetic parents of an individual are those individuals who produced the egg and sperm, respectively, which fused to create the embryo. It cannot be so as in cloning there is no fertilization as such. In this article I critically examine Douglas and Devolder’s new account of genetic parenthood and demonstrate that it is vulnerable to counterexamples that exploit the lack of a condition specifying that genetic parents should cause a child’s coming into existence. Seen from the point of view of evaluation conditions, a usual way to obtain a connexive logic is to take a well-known negation, for example, Boolean negation or de Morgan negation, and then assign special properties to the conditional to validate Aristotle’s and Boethius’ Theses. Nonetheless, another theoretical possibility is to have the extensional or the material conditional and then assign special properties to the negation to validate the theses. In this paper we examine that possibility, not sufficiently explored in (...) the connexive literature yet.We offer a characterization of connexive negation disentangled from the cancellation account of negation, a previous attempt to define connexivity on top of a distinctive negation. We also discuss an ancient view on connexive logics, according to which a valid implication is one where the negation of the consequent is incompatible with the antecedent, and discuss the role of our idea of connexive negation for this kind of view. En este artículo argumento que, pese al llamado “escepticismo cartesiano”, el significado y alcance de la refutación cartesiana del escéptico y del ateo pueden comprenderse a la luz de tres hitos metafísicos. En la primera sección examino de qué forma este filósofo emplea argumentos escépticos como método, no como fin. Tal como enfatizo, el cogito es el punto en que la duda hiperbólica debe detenerse. Luego, en la segunda sección, discuto por qué Descartes es contrario al fideísmo. Debido a que (...) este se relaciona con el escepticismo, y con la imposibilidad de probar la existencia de Dios, Descartes prueba que Él existe. Sostengo, en la sección final, que Dios es garante de la certeza epistemológica, incluso en el caso de las ideas claras y distintas, cuya confiabilidad pareciera en peligro debido a la hipótesis escéptica del genio maligno. Según el francés, entonces, probar que Dios existe es necesario para garantizar el conocimiento cierto, y es base para inferir la existencia del mundo externo. Los tres hitos, entonces, parecen suficientes para delimitar el sentido y alcance del llamado escepticismo cartesiano. (shrink)

Several European countries are approving legislative reforms moving to a presumed consent system in order to increase organ donation rates. Nevertheless, irrespective of the consent system in force, family's decisional capacity probably causes a greater impact on such rates. In this contribution we have developed a systematic methodology in order to analyse and compare European organ procurement laws, and we clarify the weight given by each European law to relatives' decisional capacity over individual's preferences (expressed or not while alive) regarding (...) the destination of his or her organs after death. In this sense, the results constitute the first comprehensive and comparative legislative mapping on European transplantation laws. (shrink)

This paper examines the link between political liberties and social equality, and contends that the former are constitutive of, i.e. necessary to secure, the latter. Although this constitutive link is often assumed in the literature on political liberties, the reasons why it holds true remain largely unexplored. Three such reasons are examined here. First, political liberties are constitutive of social equality because they bestow political power on their holders, leaving disenfranchised individuals excluded from decisions that are particularly pervasive, coercively enforced, (...) hard to avoid, monopolistic, and final. Second, they are constitutive of social equality due to their positional value, such that those who are denied such liberties are socially downgraded because and to the extent that others enjoy them. Third, they are constitutive of social equality due to their expressive value, in the sense that, by disenfranchising some individuals, the state publicly fails to recognize their equal moral agency. While unpacking these reasons, we address some criticisms of this constitutive link recently raised by Steven Wall and Jason Brennan. (shrink)

La educación tradicional concebida en compartimientos estancos que coquetean en torno al árbol de la ciencia, ha formado a un individuo descontextualizado, sin capacidad de respuesta para enfrentar la complejidad del mundo actual. La Multiversidad Mundo Real “Edgar Morin” asume la misión de una enseñanza educativa basada en los postulados del Pensamiento Complejo de Edgar Morin; pero aún quedan pendientes nuevas definiciones que rompan con los esquemas de la educación basada en el paradigma simplificador. La meta es emprender el gran (...) viraje que haga posible que la reforma paradigmática implique también una reforma de las mentes y del lenguaje, porque nombrar lo nuevo con la palabra vieja dificulta a nivel inconsciente detonar el cambio. Superar los bloqueos propios y los adquiridos por la educación que nos ha conducido a ser individuos desarticulados del contexto, ese es el gran reto de la Multiversidad. (shrink)

Este ensayo examina un experimento mental clásico de John Searle en filosofía de la mente, cuyo argumento ha sido descalificado por Dennett y Hofstadter como una bomba de intuiciones no confiable. Lo que se defiende aquí es que este experimento mental tiene un sesgo cartesiano, pero ello no obsta a que no sea confiable. En efecto, la característica principal de la Pieza China es depender de un agente cognitivo consciente que realiza el experimento, y en particular, de quien no se (...) puede prescindir para saber si ocurre o no entendimiento lingüístico luego del procesamiento de símbolos. En efecto, el punto de vista de la 1ª persona de quien lleva a cabo el experimento es, al igual que en otras instancias, lo que permite el testeo de una hipótesis sobre la naturaleza de lo mental. Human eggs for basic, fertility and stem-cell research are in short supply. Many experiments that require their use cannot be carried out at present, and, therefore, the benefits that could emerge from these are either delayed or never materialise. This state of affairs is problematic for scientists and patients worldwide, and it is a matter that needs our attention. Recent advances in chimera research have opened the possibility of creating human/non-human animal chimeras intended for human gamete production (chimeras-IHGP). In this (...) paper, I examine four arguments against the creation of such chimeras and prove that all of them are found wanting. I conclude by showing that there is a strong moral reason for scientists to pursue this research avenue. (shrink)

Según la versión estándar del juego de la imitación, la determinación del sexo de los participantes no desempeña ningún papel en el testeo de la inteligencia de máquina. Desafortunadamente, tal simplificación soslaya la teoría de la mente que fundamenta dicho juego. Teniendo en consideración este problema, en este ensayo argumento en contra de la simplificación del Test de Turing. En efecto, tal como sostengo, la determinación del sexo de los participantes no debe obviarse: la mente de una mujer y su (...) inteligencia son imitables y no dependen de realización física específica. Esto ocurre porque el funcionalismo de Turing supone un vínculo entre imitación, engaño y aprendizaje, tres claves para que el proyecto de la Inteligencia Artificial tenga éxito. (shrink)

Some Comments on de Melo-Martin and Harris.

Este trabajo tiene como objetivo examinar cómo el legado kantiano de la razón crítica sigue vigente, pues se sostiene en un imperativo teórico fundado en la autonomía. Tal como argumento, este imperativo «categórico-teórico» se estructura gracias a la primacía de la razón práctica por sobre la razón teórica. El ensayo está estructurado en tres secciones. En la primera discuto brevemente el compromiso con la verdad propio de la ética de Sócrates y Platón, quienes inauguran el racionalismo crítico, según Popper. Luego, (...) en la segunda sección examino la filosofía kantiana y su propuesta, la cual ciertamente influye en el «Tratado contra el Método» de Paul Feyerabend. Finalmente, en la tercera sección, analizo la conexión entre razón crítica y razón teórica. En particular, muestro que la primera gobierna la segunda, y que la autonomía es parte de la naturaleza racional humana. Dicha naturaleza ciertamente explica por qué la razón crítica sigue vigente en la época contemporánea. (shrink)

El objetivo de este trabajo es esbozar las bases de un análisis crítico a través de la neuroética y la teoría social que permita señalar las implicaciones que pueden derivarse del uso de neurotecnologías para fomentar el placer en el contexto turístico. Con este propósito, el trabajo revisará los objetivos que proponen las investigaciones neuroturísticas. Para subrayar los riesgos que conllevan tanto para la autonomía de los turistas como para la configuración de los servicios turísticos y la elección de los (...) destinos, se recurrirá a la neuroética. Los trabajos aportados permitirán esbozar una problematización del alcance ético que puede conllevar configurar el turismo en torno a bases emocionales, dada la predisposición «natural» con la que, según estas inves- tigaciones, los sujetos hacemos elecciones en base a patrones emocionales. Se trata de un escenario que, finalmente, será considerado a la luz de las teorías sociales del turismo en un contexto de aceleración social, de modo que puedan vislumbrarse algunos de los riesgos que puede conllevar la utilización de técnicas neuroturísticas para el desarrollo del turismo. A través de este enfoque pretende sugerirse que, en diálogo con otras disciplinas, la ética, entendida como filosofía moral, puede contribuir a la crítica del desarrollo actual del turismo y, en última instancia, a los debates que giran en torno a la orientación del turismo hacia una actividad responsable con los destinos y servicios turísticos. The paper discusses the structure, applications, and plausibility of the much-used parallel-case argument for workplace democracy. The argument rests on an analogy between firms and states according to which the justification of democracy in the state implies its justification in the workplace. The contribution of the paper is threefold. First, the argument is illustrated by applying it to two usual objections to workplace democracy, namely, that employees lack the expertise required to run a firm and that only capital suppliers should (...) have a say over the governance of the firm. Second, the structure of the argument is unfolded. Third, two salient similarities between firms and states regarding their internal and external effects and the standing of their members are addressed in order to asses the potential and limits of the argument, as well as three relevant differences regarding the voluntariness of their membership, the narrowness of their goals, and the stiffness of the competition they face. After considering these similarities and differences, the paper contends that the the parallel-case argument provides a sound reason in favor of democracy in the workplace—a reason, however, that needs to be importantly qualified and that is only pro tanto. Este es un ensayo homenaje a Ernesto Sábato, quien además de un connotado novelista fue un acérrimo crítico de la ciencia moderna y contemporánea, al plantear que reducir toda la realidad a las matemáticas ha favorecido la deshumanización y maquinización de la naturaleza y del hombre. Sin embargo, la tesis que se defiende aquí es que Sábato no fue igualmente perspicaz previendo de qué forma la Inteligencia Artificial clásica podría representar el pináculo de la deshumanización del hombre, pues esta considera (...) que la mente y la inteligencia de este como funciones de una simple máquina programada, i.e., como un producto de engranajes sintáctico-matemáticos cuya implementación material es ajena a los contextos. En efecto, la etapa final de la deshumanización denunciada por Sábato no podría haber ocurrido sin que se hubiese considerado que la propia mente no es más que una computadora, es decir, una máquina programada. En el marco de los estándares profesionalizantes de la academia, con sus “rankings” y productividad científica, las humanidades subsisten. Una explicación de este fenómeno es que, según la ontología social, las razones para la acción independiente de deseos son piezas clave en la educación. Por ello, dichas razones, que constituyen obligaciones, también serían claves para el desarrollo de las humanidades. Aquí examino de qué forma el individualismo y la competencia tensionan la dinámica entre deseos y obligaciones. Ciertamente, el mercado valora (...) más la satisfacción de deseos que la teorización sobre la intencionalidad colectiva y su producto: la civilización humana. (shrink)

In this article, I argue that, contrary to scholarly consensus, Antonio Caso draws inspiration from important principles and ideas from Kant’s philosophy in his critique of positivism. I first examine the prima facie textual reasons why someone might believe that Caso and Kant are philosophical enemies. To contradict this notion, I proceed by noting and developing three core ideas that the two share in common. First, Caso and Kant are both ardent critics of dogmatic philosophizing. Second, both Caso and Kant (...) carve out special room for intuition in their respective accounts of cognition, resisting the idea that the understanding has a more prominent role in the formation of knowledge. Third, Kant’s doctrine of aesthetic judgment paves the way for Caso’s de-intellectualized aesthetics. In the end, we see that Kant and Caso are closer to being philosophical friends than enemies. En The paradox of Addition and its dissolution (1969), Mario Bunge presenta algunos argumentos para mostrar que la Regla de Adición puede ocasionar paradojas o problemas semánticos. Posteriormente, Margáin (1972) y Robles (1976) mostraron que las afirmaciones de Bunge son insostenibles, al menos desde el punto de vista de la lógica clásica. Aunque estamos de acuerdo con las críticas de Margáin y Robles, no estamos de acuerdo en el diagnóstico del origen del problema y tampoco con la manera en la (...) que se proponen solucionarlo. Reliabilism, one ofthe most significant naturalized epistemological theories, is an an attempt to justify knowledge on the basis of causal reliable procedures. This theory also seems to be the solution for the skeptic claims. However, as this paper suggests, this theory involves many problems; among others, how experiments could cause justified but false beliefs. This difficulty may reveal that naturalized epistemology cannot answer the radical question of skepticism, because it is not a scientific issue. As Quine thought, it implies a (...) metaphysical puzzle. Thus, every philosopher should face a practical decision: to admit it or to discard it as a non-sense question. (shrink)

En este artículo se examina de qué forma los investigadores de la Inteligencia Artificial han asumido un desafío propuesto por Descartes: la imposibilidad de construir máquinas programadas que, al entender lenguaje, evidencien que son pensantes. Tal desafío, que se enmarca en la filosofía metafísica cartesiana, distingue entre cosa pensante y extensa, siendo imposible la existencia de pensamiento en esta última. El lenguaje evidencia la imposibilidad de la inteligencia de máquina, de hecho. Como se examina, al enfrentar el desafío cartesiano, dichos (...) investigadores han debido suponer como verdadera parte de la teoría cartesiana, a saber, que el uso flexible de lenguaje implica la existencia de pensamiento. Por ello califico de ambivalente la relación que tiene la Inteligencia Artificial con el filósofo francés: por una parte, rechazan la imposibilidad en principio de la inteligencia de máquina; por otra, están de acuerdo con Descartes en que el uso flexible de lenguaje es suficiente para mostrar que alguien piensa. Si bien el carácter ambivalente entre la IA y Descartes parece anecdótico, no lo es. El hecho de que aún se considere el Test de Turing como una evaluación adecuada de la inteligencia corrobora la compleja relación entre la IA y el pensamiento cartesiano. (shrink)

Este trabajo examina la educación pública chilena desde la perspectiva de la ontología social. En primer lugar, se exponen brevemente elementos de la teoría de la realidad social para dar sentido a la tesis que se defiende: la educación pública es institución para instituciones. En la segunda parte se muestra de qué forma la educación pública es una instancia preparatoria para navegar en la realidad social. Y lo es porque enseña a posponer deseos personales en aras del servicio, tal como (...) acontece en la Educación pública chilena: constituye la esencia de la racionalidad institucional. En la última parte del ensayo se examina una experiencia histórico-paradigmática de dicha educación, la del Instituto Nacional. La formación en dicho liceo de numerosos presidentes, ministros de Estado, además de profesionales, científicos y humanistas, confirma que la educación pública es institución para instituciones. En este trabajo examinamos el tópico de la responsabilidad en el derecho penal internacional a la luz de la filosofía de John Searle, y del fallo dictado por la Corte Penal Internacional en el caso de Thomas Lubanga. En el primer acápite analizamos la declaración de responsabilidad penal en función de la teoría de actos de habla de Austin y de Searle, tratándola como un acto ilocucionario cuyo significado es dependiente de un marco institucional específico. Luego, en el segundo acápite, (...) mostramos de qué forma tal marco puede reconstruirse como un ejemplo paradigmático de la realidad social construida descrita por Searle, especialmente en virtud del nexo entre mente, lenguaje y sociedad. A nuestro juicio, los conceptos de intencionalidad colectiva, atribución de funciones de estatus y poderes deónticos son fundamentales para entender tal nexo. En efecto, tal como argumentamos en la tercera sección, los sistemas de poderes deónticos asociados al derecho internacional no solo explican la aparición de Tribunales penales internacionales, como la Corte Penal Internacional, sino además el carácter imprescriptible de los crímenes de lesa humanidad. Los acuerdos internacionales que promueven y protegen los derechos humanos, y que tratan la imprescriptibilidad de aquellos crímenes, son objeto de análisis en la sección final, en donde exponemos algunas reflexiones finales a partir del caso Lubanga. En este artículo examino dos criterios para la existencia de estados mentales, el de Descartes y el de Turing. Mientras que el primero plantea que las máquinas no pueden pensar en principio, el segundo defiende la inteligencia de máquina. Pese a esto, ambos parecen coincidir en que la decisión sobre la presencia de estados mentales es tomada por alguien que juzga internamente la misma. Si bien ello es esperable del racionalismo cartesiano, en el funcionalismo de Turing es sorprendente. En efecto, (...) ningún comentarista de su Juego de la Imitación repara en el hecho de que los interrogadores son una instancia que no parece reemplazable y, además, que dichos interrogadores aplican un criterio internalista para decidir si están frente a una mente o un computador. Tal aproximación internalista a la mente, argumento, representa una dificultad para que una máquina pase el Test de Turing. Por este motivo concluyo que dicho test no solo no reemplaza la pregunta ¿pueden pensar las máquinas?; adicionalmente traslada de modo dramático el foco del debate a la filosofía de la mente. Responsible research and innovation imposes normative requirements on research and innovation processes resembling three successive steps, each more ambitious than its predecessor, with distinct features. For the research dimension the distinct features reflect the normative requirements of, first, credible research ; second, responsive research ; and third, responsible research. Equally distinct features reflect the requirements of credible innovation, responsive innovation, and responsible innovation.

In support of Descartes’ epistemology, Lex Newman advances the ‘Non-atheistic-knowledge- thesis’, i.e., indefeasible knowledge cannot be gained unless the existence of God is proved. Here I expound the ‘non-atheistic-thesis-of-Cartesian-metaphysics’, which, unlike Newman’s, refers to how four Cartesian metaphysical conclusions require the existence of God. To test whether such conclusions need divine existence, we may ask what would happen if God did not play any decisive role in the Meditations. As I argue, four unpalatable consequences would follow for Cartesian metaphysics, which (...) would ruin Descartes’ plan to refute the skeptic and the atheist alike. (shrink)

For the sake of universalism and against totalitarianism, discursive ethics has shown with Jürgen Habermas a practical deficit by denying moral philosophy the possibility of reflecting on the alienating conditions for dialogue through a specific ethos. This article examines how Hartmut Rosa's theory of resonance can revitalise the debate on the conditions that can undermine the basis for dialogue in accelerated societies, based not on the concept of ethos, but on the concept of mode of world-relationship [Modus der Weltbeziehung].

Political theorists have recently sought to replace the liberal, contractual theory of the firm with a political view that models the authority relation of employee to firm, and its appropriate regulation, on that of subject to state. This view is liable to serious difficulties, however, given existing discontinuities between corporate and civil authority as to their coerciveness, entry and exit conditions, scope, legal standing, and efficiency constraints. I here inspect these, and argue that, albeit in some cases significant, such discontinuities (...) fail to undermine the firm/state analogy, either because they are not significant enough to do so or because the particular trait on which they hinge is not decisive for how authority, in the state and in the firm, should be regulated to be legitimate. A pro tanto requirement exists, I thus argue, that corporate authority be held to regulatory norms comparable to those legitimate states abide by, including civil liberties, rule-of-law constraints, and accountability to subjects. This paper examines the legitimacy conditions of constitutionalism by examining one particular type of constitutional provision: provisions aimed at advancing future generations’ interests. After covering the main forms that such provisions can adopt; it first considers three legitimacy gains of constitutionalising them. It then explores two legitimacy concerns that so doing raises. Given that constitutions are difficult to amend; constitutionalisation may threaten future generations’ sovereignty. And it may also make the constitution’s content impossible to adapt to changing circumstances and interests. (...) Finally; the paper examines the ways in which such concerns may be addressed at the adoption; formulation; and amendment stages. Se le llama ‘psiquiatría biológica’ a la vertiente de la investigación psiquiátrica que busca establecer asociaciones estables entre condiciones psiquiátricas y factores biológicos específicos. La búsqueda de tales asociaciones está motivada por lo que llamo el “compromiso causal” de la psiquiatría biológica, que es la presunción de que factores biológicos específicos son las causas principales de las condiciones psiquiátricas. En este artículo argüiré que dicho compromiso es una presunción implausible sobre esas condiciones, pues la mejor evidencia psiquiátrico-biológica disponible no lo (...) respalda y es dudoso que la evidencia futura lo hará. This thesis focuses on the evolution of human social norm psychology. More precisely, I want to show how the emergence of our distinctive capacity to follow social norms and make social normative judgments is connected to the lineage explanation of our capacity to form shared intentions, and how such capacity is related to a diverse cluster of prototypical moral judgments. I argue that in explaining the evolution of this form of normative cognition we also require an understanding of the developmental (...) trajectory of this capacity. For this purpose, the thesis is organized as follow. In the first chapter, I make some methodological remarks and provide the general overview and plan for the dissertation. In the second chapter, I explain what my explanatory target is and why it matters. On the view I am defending, shared intentional psychology gives rise to a special form of psychology that enables us to engage in social normative thinking. These norms are represented as shared intentional states. Moral psychology, in contrast, is more diverse. For moral judgments define a quite heterogeneous class of mental states—although some moral judgments may involve the representation and execution of norms, certainly not all of them do. I show that although much of our distinctive social norm psychology can be explained within the framework of shared intentionality, moral judgments cannot be unified in the same way. In the third chapter, I provide the baseline of social-cognitive capacities that serve as starting point for my lineage explanation. I argue that hominin social cognition was for a very long period of our evolutionary history essentially a matter of low-level cognitive and motivational processes. On this picture, bottom-up affective processes regulated the social lives of early hominins without requiring any special top-down mechanism of normative thinking such as a capacity for understanding and representing social norms. In the fourth chapter, I argue that human-like social norm psychology evolved as a result of the selective pressures that gave rise to shared intentionality, especially the demands that came from collective hunting. Yet collective hunting was not the whole story of the evolution of shared intentionality, for our capacity to form shared intentional mental states emerged from the interplay between the selective pressures that led to cooperative breeding in humans as well as organized, goal-oriented, collective hunting. Thus, I propose an evo-devo account of shared intentionality and its normative dimension since I argue that explaining the evolution of this particular form of normative thinking crucially depends on information about the developmental trajectory of this capacity. Finally, in the fifth chapter, I focus on how social norms are acquired and how the way we learn them gives rise to some prototypical cluster of moral judgments. Thus, this chapter returns to some of themes and arguments of the first chapter by explaining how the distinction between moral judgments and nonmoral judgments can be culturally transmitted. El trabajo desarrollado por las kellys o camareras de piso se caracteriza por encontrarse dentro de lo que se podría denominar como «trabajo de cuidados», aunque se inscribe de lleno en el campo productivo y es una parte vital del sector turístico. Su caso es un claro ejemplo de la intersección entre la precariedad y la invisibilidad de unas tareas que han sido histórica y culturalmente asignadas a las mujeres y condenadas al menosprecio social. En un contexto como el actual, (...) cabe preguntarse sobre las condiciones sociales que subyacen a este colectivo y las implicaciones que se derivan de su situación de invisibilidad en un sector tan precario como el turístico dentro del Estado español, así como sobre el papel de Las Kellys –como asociación– en la reivindicación de los derechos laborales de las trabajadoras. Analizaremos su caso como una muestra de movimiento político y social que lucha por la visibilización de las tareas de cuidados y que contribuye a la repolitización de dichos trabajos en el ámbito público. The work done by the Kellys, or apartment waitresses/cleaners, is characterised by it lying in what could be called “care work”, despite being completely undertaken in the production field and forming a vital part of the tourism sector. Their case is a clear example of the intersection between precarious work and the invisibility of some tasks that have been historically and culturally appointed to women and condemned to social scorn. In today’s context, it is worth considering the social conditions underlying this group of workers and the implications that stem from their situation of invisibility in such a precarious sector as the tourism one in the Spanish State, and the role played by the Kellys, as an association, to claim these female workers’ employment rights. We will analyse their particular case as a clear example of the socio-political movement that struggles to make their care work visible and contributes to the repoliticisation of their work in the public domain. Este artículo analiza el modo en que la teoría de la resonancia formulada por Hartmut Rosa permite revitalizar el debate sobre las condiciones que pueden minar las bases para el diálogo en las sociedades aceleradas sin apoyarse en el concepto de (...) ethos, sino en el de modo de relacionarse con el mundo [Modus der Weltbeziehung]. En el presente ensayo hago una revisión del término “bomba de intuición”, mostrando la evolución que ha tenido el mismo. En efecto, parece existir un importante cambio de posición, al menos en el pensamiento de Dennett, el cual originalmente trata a algunos experimentos mentales como carentes de virtud epistémica. De hecho, que el término “bomba de intuición” haya sido acuñado por él y Hofstadter una vez aparecido el argumento de la Habitación China de Searle, lleva a pensar que el problema (...) con estas herramientas epistemológicas no es inherente a ellas, sino más bien derivado del problema mente-cuerpo. Pero, esta tesis requiere de algunas precisiones. Dennett ha hecho modificaciones a su tratamiento de las bombas de intuiciones, y ha encontrado para ellas una serie de ventajas para el razonamiento, la imaginación, la argumentación, etc. En consecuencia, en este ensayo muestro la evolución de su tratamiento de las bombas de intuiciones, y enfatizo de qué forma han pasado de ser elementos negativos a positivos en la epistemología de los experimentos mentales. According to Kemp Smith, Descartes believed that animals were devoid of feelings and sensations. This is the so-called ‘monstrous thesis,’ which I explore here in light of two Cartesian approaches to animals. Firstly, I examine their original treatment in function of Descartes’ early metaphysical approach, i.e., all natural phenomena are to be elucidated in terms of mental scrutiny. As pain would only exist in the understanding, and animals have neither understanding nor souls, Descartes held that they did not suffer. Secondly, (...) I look at the Cartesian late naturalism; specifically, at how animals are subsequently regarded as machines that may suffer. Lastly, I conclude that the ‘monstrous thesis’ is not Cartesian because animals are machines with feelings and sensations. However, Descartes’ surprising indulgence towards humans who kill and eat animals supposes that empathy for beings who may suffer is not necessary. This may raise doubts as to another ‘monstrous thesis.'. (shrink)

The republican case for workplace democracy is presented and defended from two alternative means of ensuring freedom from arbitrary interference in the firm—namely, the right to freely exit the firm and workplace regulation. This paper shows, respectively, that costless exit is neither possible nor desirable in either perfect or imperfect labor markets, and that managerial discretion is both desirable and inevitable due to the incompleteness of employment contracts and labor legislation. The paper then shows that WD is necessary, from a (...) republican standpoint, if workers’ interests are to be adequately tracked in the exercise of managerial authority. Three important objections are finally addressed— that WD is redundant, that it is unnecessary provided that litigation and unionism can produce similar outcomes, and that it falls short of ensuring republican freedom compared to self-employment. Muy pronto uno de nosotros se destacó por su capacidad creadora y su curiosidad filosófica: era Juan Larreta. Es así que, a pesar de haber iniciado tarde su formación, descolló como filósofo de mérito tanto en la Argentina como en el exterior. Presidente de la Sociedad Argentina de Análisis (...) Filosófico (SADAF) durante dos períodos, obtuvo el Diploma al M érito en Filosofía de la Fundación Konex en el 2006 y fue nombrado miembro honorario de la Sociedad Española de Filosofía Analítica (SEFA) en 2010. Organizó seminarios y dictó conferencias en centros de estudios filosóficos y en universidades argentinas y extranjeras, en cuyas publicaciones escribió numerosos artículos de singular valía, todos ellos caracterizados por su originalidad, su irreverente desafío al sentido común y sus ingeniosos experimentos mentales (thought experiments). Esta despedida dolorosa se empeña en acercar a la memoria recuerdos queridos de circunstancias compartidas con este amigo excepcional. fue nuestro centro: en su casa organizó, durante muchos años, seminarios de filosofía, de economía y, junto con María Elisa, esas reuniones cinéfilas de divertidas, sorprendentes y variadas interpretaciones... The 'critical turn' in tourism studies is defined as a research perspective that explores social transfor- mation in and through tourism by facing the negative impact of strategic-instrumental rationality on this activity. This work explores the features of discourse ethics that may normatively support tourism transformation, a gap that has not been thoroughly discussed in tourism research. For this purpose, the study combines the use of critical and ethical theory with an analysis of discourse ethics in tourism literature to demonstrate (...) that the use of Habermasian discourse ethics needs to be complemented with the Apelian approach. Through these steps the work reveals the theoretical bases of discourse ethics to discuss whether understandings between stakeholders guided by strategic-instrumental rationality can be reached not only in the political sphere —Habermas—, but also in the ethical field —Apel.
