In dit hoofdstuk presenteer ik de belangrijkste bevindingen en uitspraken uit mijn diepte-interviews met de respondenten. Ik geef hiermee antwoord op de deelvragen ‘Wat voor beeld wordt er gevormd in Nederlandse kranten over geweldpleging door de Staat in Nederlands-Indië?’, ‘Welk beeld in Nederlandse kranten is exemplarisch voor positieve of negatieve berichtgeving over geweldpleging door de Staat in Nederlands-Indië?’, ‘Wat zijn de belangrijkste reacties geweest van media, Staat of andere betrokkenen op de berichtgeving in kranten over Nederlandse (...) oorlogsmisdaden in Indië?’ en ‘Hoe kijken representatoren voor media, Staat, betrokkenen en/of nabestaanden zelf aan tegen de beeldvorming over de misdragingen in Nederlands-Indië?’ De vijf geïnterviewde experts hebben zich uiteraard uitgelaten over beeldvorming in Nederlandse kranten over verschillende perioden. Worker well-being is a hot topic in organizations, consultancy and academia. However, too often, the buzz about worker well-being, enthusiasm for new programs to promote it and interest to research it, have not been accompanied by universal enthusiasm for scientific measurement. Aim to bridge this gap, we address three questions. To address the question ‘What is worker well-being?’, we explain that worker well-being is a multi-facetted concept and that it can be operationalized in a variety of constructs. We propose a (...) four-dimensional taxonomy of worker well-being constructs to illustrate the concept’s complexity and classify ten constructs within this taxonomy. To answer the question ‘How can worker well-being constructs be measured?’, we present two aspects of measures: measure obtrusiveness (i.e., the extent to which obtaining a measure interferes with workers’ experiences) and measure type (i.e., closed question survey, word, behavioral and physiological). We illustrate the diversity of measures across our taxonomy and uncover some hitherto under-appreciated avenues for measuring worker well-being. Finally, we address the question ‘How should a worker well-being measure be selected?’ by discussing conceptual, methodological, practical and ethical considerations when selecting a measure. We summarize these considerations in a short checklist. It is our hope that with this study researchers – working in organizations, in academia or both – will feel more competent to find effective strategies for the measurement worker well-being and eventually make policies and choices with a better understanding of what drives worker well-being. An overview of 20 years of environmental philosophy in the Netherlands.

Iemand die uiteindelijk voor de PhD-positie wordt gekozen, moet in staat zijn om alle vakjes aan te kruisen. Maar één ding is vrijwel zeker: van een promovendus die de functie aanvaardt, wordt zelden verwacht dat zij het basisidee voor het onderzoek, de opzet, de methodologie of iets anders heeft bedacht. Men hoeft alleen maar trainable te zijn. Tijdens de jaren "onder contract" zal de kandidaat immers waarschijnlijk niet worden aangemoedigd om een eigen intellectueel pad te ontwikkelen, of om een nieuwe (...) en interessante richting in het onderzoeksveld uit te stippelen. In plaats daarvan zal van de kandidaat naar alle waarschijnlijkheid worden verwacht dat zij de ideeën van de promotor napraat en vaak zelfs volledig overneemt. (shrink)

In Nederland worden al geruime tijd zowel op landelijk als op lokaal niveau en zowel vanuit het beleid als door bezorgde ouders uiteenlopende inspanningen geleverd om onderwijssegregatie tegen te gaan. In dit artikel wordt betoogd dat we desondanks voor een zware opgave staan, aangezien het uitoefenen van individuele vrijheid en het streven naar sociale gelijkheid voor spanningen kan zorgen. In het artikel wordt de stelling uitgewerkt dat sociale integratie in het onderwijs via gemengde scholen niet per se de enige en (...) beste manier is om het ideaal van gelijke kansen te realiseren. Verder stellen we dat een onderscheid moet worden gemaakt tussen vrijwillige en onvrijwillige vormen van onderwijssegregatie. Als alternatief voor integratie worden daarom de mogelijkheden voor vrijwillige separatie geëxploreerd. (shrink)

Milieufilosofisch Nederland wordt momenteel verdeeld door een controverse naar aanleiding vanrecente publicaties van de Wageningse filosofen Keulartz en Korthals. In dit artikel wil ik - aande hand van een analyse van het gebruik van het natuurbegrip bij Wim Zweers - laten zien dat Keulartz op een tot nu toe onderbelicht probleem wijst: het probleem van de veelheid vannatuurbeelden. Tegelijkertijd wil ik echter aantonen dat Keulartz' eigen, 'post-naturalistische' positie op een tegenspraak berust. Tenslotte geef ik aan hoe deze controverses zijn terug (...) tevoeren op een onvermijdelijke spanning in onze morele omgang met de natuur, en zoek ik naar een manier waarop deze spanning binnen de milieu-ethiek vruchtbaar kan worden gemaakt. I propose a relevance-based independence axiom on how to aggregate individual yes/no judgments on given propositions into collective judgments: the collective judgment on a proposition depends only on people’s judgments on propositions which are relevant to that proposition. This axiom contrasts with the classical independence axiom: the collective judgment on a proposition depends only on people’s judgments on the same proposition. I generalize the premise-based rule and the sequential-priority rule to an arbitrary priority order of the propositions, instead of a (...) dichotomous premise/conclusion order resp. a linear priority order. I prove four impossibility theorems on relevance-based aggregation. One theorem simultaneously generalizes Arrow’s Theorem (in its general and indifference-free versions) and the well-known Arrow-like theorem in judgment aggregation. (shrink)

Two strong arguments have been given in favor of the claim that no selection process can play a role in explaining adaptations. According to the first argument, selection is a negative force; it may explain why the eliminated individuals are eliminated, but it does not explain why the ones that survived (or their offspring) have the traits they have. The second argument points out that the explanandum and the explanans are phenomena at different levels: selection is a population-level phenomenon, whereas (...) adaptation occurs on the individual level. Thus, selection can explain why individuals in a certain population have a certain trait, but it cannot explain why a certain indi- vidual has this trait. After pointing out that both arguments ignore the significance of the limitation of environmental resources, I will construe a positive argument for the claim that cumulative selection processes can, indeed, play a role in explaining adaptations. PHILOSOPHY OF HUMAN RIGHTS: HUMAN RIGHTS IN LIGHT OF THEIR INTERNATIONAL PROTECTION Summary The book consists of two main parts: in the first, on the basis of an analysis of international law, elements of the contemporary conception of human rights and its positive legal protection are identified; in the second - in light of the first part -a philosophical theory of law based on the tradition leading from Plato, Aristotle, and St. Thomas Aquinas is constructed. The conclusion contains an application (...) of the results of the analysis conducted in the second part. The first part comprises four chapters. The first aims at revealing characteristics of human rights on the basis of an analysis of historical conditioning of the inter-national law of human rights and its development. The historical context displays the practical, vindicative, and critical character of the positive legal protection of human rights. Moreover, the process of change of positive human rights law is distinguished from the process of change of human rights as such. In the second chapter the content of human rights - a topic which is only auxiliary to the conducted analysis - is discussed. Basic typology and catalogues of rights proclaimed in the Universal Declaration of Human Rights and protected in the International Covenants of Human Rights are presented. The review of the content of rights aims at a more precise limitation of the field of research. The examination shows a diversity of rights which poses a serious challenge to the coherence of every philosophical theory of human rights. In the third chapter, central in the first part, international law is analyzed with regard to the characteristics of rights and the foundations of them. The analysis of documents shows a number of solutions referring to the anthropological foundations of rights. The inherent dignity of the human person is the source of all human rights. Each human being is recognized as free, and endowed with both reason and conscience. In the propounded conception of man individuals are not rivals but create a community which is a condition for their development. International law characterizes the rights as universal, inherent, inalienable and inviolable. The reconstructed conception also comprises the following basic elements: on the level of the structure of rights, a recognition of their equality, interdependence, and comprehensiveness; in the grounding of these rights, a recognition of the anthropological foundations of law; in the conception of positive law, a recognition of the secondariness of the positive law of human rights to human rights themselves, and a recognition of human rights and justice as the basis for legal order; in the conception of state, a recognition of the well-being of the individual as the fundamental aim of actions undertaken by political institutions, and recogni¬tion of rights which form an impassable boundary to the power of the state, includ¬ing its legislative actions. The characterization of the international legal paradigm serving for the under¬standing of human rights is supplemented by analyses of the structure of their posi¬tive legal protection. Various meanings of the terms "right" and "freedom" are distinguished. Subjective right, as basic structure of the positive legal protection of human rights, is understood as a complex relation formed by various legal situations of the subject of a right which create a functional whole in respect of the subordi-nation of human person to its good. Subordinating person to a good proper for it, expressed usually in a proclamatory norm, is the central element of particular rights around which further elements aiming at the realization of this good are built. In the second part of the book a philosophical theory is developed which allows for the location of a coherent foundation for the presented characterization of human rights and their positive legal protection. This part consists of two chapters. The first includes a review of some - not entirely satisfactory - means of founding of human rights; the second presents philosophical conceptions of law and man which may form a basis for the constructed theory. The review of arguments contained in the first chapter does not aim at a detailed analysis of various specific ways of argumentation encountered in works on this subject but rather at a concise presentation of the main possible lines of argumentation. These analyses also serve to emphasize the positive solutions which are pro¬posed later and to underscore the explanatory power of the elaborated theory. This theory, retaining accurate intuitions contained in the presented types of argumenta¬tion, helps in avoiding their consequences which are difficult to reconcile with the reconstructed paradigm of human rights. Efforts to base human rights on the norms of international law rightly take into account the necessity of determining the content of the rights and their positive legal protection as a means for the realization of man's good. These attempts, how¬ever, do not properly take into account the inherent character of human rights, which are independent of positive law and provide grounds for applying specific legislative measures and not others. Founding human rights on freedom accurately points at the freedom of an indi¬vidual as a constitutive element of some rights; however, absolutization of freedom leads, to a loss of an important element of the contemporary paradigm of under¬standing human rights. This foundation undermines recognition of the fact that human rights may set limits to both the freedom of others and the freedom of the subject of rights itself. Additionally, attempts at the so-called axiological justification of human rights are discussed. This type of justification has a few variants depending on the as¬sumed conception of value. Subjectivistic conceptions have similar advantages and disadvantages to the conceptions basing human rights on freedom; objectivistic conceptions while providing for the universality of human rights place, the fundamental aim of human rights protection beyond the individual human being - in the idealistically existing world of values; finally, conceptions rooting values and human rights in culture, while accurately noting that human rights are learned through the medium of culture, place the source of human rights beyond a concrete individual - in culture and processes which take place in it - which leads to difficulties in finding a basis for the universality of rights. Furthermore, attempts to ground human rights in specific characteristics of the human being are presented. This type of approach points to an important problem of dependence of the content of rights on what man is. However, recognition of specific characteristics of a human being as an ontic foundation of the existence of rights poses a danger to their universality since one has to accept that it is not enough to be a man to be a subject of rights, but a man possessing specific charac¬teristics. The second chapter aims at outlining solutions worked out by Saint Thomas Aquinas. For a fuller understanding of his propositions selected elements of Plato's and Aristotle's philosophy are presented. It was them who formulated the founda¬tions for reflection on law and justice in the ontological context. A qualification is made that Stoicism is not be analysed in depth. Although Thomas' concept of law was undoubtedly developed under the influence of the Stoic doctrine as well, it is not in this that one should look for the tools to understand the ontic foundations of human rights and law in general since the Stoic moral philosophy and philosophy of law were developed in the context of a theory of being which assumed monistic and pantheistic premises as foundations, leading to the recognition of a total subor¬dination of the human individual to a larger unity of which man is only a part. The analysis of Plato's and Aristotle's texts concentrates on problems of justice. Plato seems to be the first philosopher who reflected on the formula basic in the history of European thought: to render to each his due. It appears that justice as both a characteristic of man and his acts is understood in the perspective of that which is just, that which is a good for another man - the recipient of the act. The basis for determining what is just is the relation of correspondence between some¬one and something. While in the case of Plato this relation is based on something beyond its terms, namely on ideas, in the case of Aristotle the relation occurs on account of the elements of the relation itself. Something is just when it contributes to the develop¬ment of the recipient of an act realizing that which is just. At the same time, the realization of that which is just is a good for the agent. In the analysis of the just two types of relation are revealed: the relation of due-to-recipient occurring on account of the compatibility of that which is due, with the recipient of the act; and - a "superstructure" - a relation of obligation-of-subject occurring on account of the compatibility of the acting subject with the thing which should be done. The basis for being that which is due is formed by various potentialities of development of man - the recipient of agency; the basis of being that which is an obligation is the possibility of development of the subject of action. Aristotle distinguishes various types of freedom and points to the necessity of taking them into account in the discussion of justice. Among other things, as the core of man's freedom, he considers life for its own sake, which can be seen as his expression of the basic indices of the autotelic character of man - which is funda¬mental for later conceptions of dignity. The freedom which is described by him is not, however, inherent and inalienable; being free is conditioned by a factual possi¬bility of undertaking actions, which are not solely means to the realization of aims set by others. Thomas Aquinas takes over the Aristotelian research perspective both in his conception of man and of law. At the same time, however, he significantly enriches it. In anthropology he develops a conception of personal being. Drawing upon his distinction between existence ("that something is") and essence ("what something is"), he sees the basis for being a person in the dignity of personal being which is a certain way of existence of a rational being more perfect than that of non-personal beings. The person is a being which, by virtue of its act of existence, is individual¬ized in a specific way. It is an aim in itself. Expressing it in a negative way, one may say that it does not exist as a means for the realization of the aims of others and, in this sense, that it is free. As distinct from Aristotelian conclusions, being a person is not conditioned by the specific actions of a being. Dignity is inherent, based on that which is the foundation of the factual existence of every rational being. Although freedom requires that a being is rational, dignity still encompasses all being, all its properties and potentialities. Thus an act conforming with dignity has to take into account a whole human being. Among different types of that which is just, ius, the first place, from the point of view of understanding law, falls to "the just thing itself ("ipsa res justa"), which is right in the full meaning of the word. On the one hand, it is that which is due; on the other hand, it determines the way of acting in the utmost degree, since the course of every act is determined in the fullest extent by its aim. The content of ius may be determined both by elements independent of free decisions - ius naturale - and by free decisions taking into account the state of things - ius positivum. Recognition of the objective structure of being as the basis of law does not entail that it is possible or desirable to determine unequivocally "the only right" patterns of conduct. This concept is very well justified within the system proposed by Saint Thomas. Individualization of being is a significant element of the develop¬ment of a person as a person. It is attained by the realization of individual aims which are not unequivocally determined by circumstances and the nature common to all people. By virtue of free choices made in the sphere of that which is not by its nature unjust, the object of action becomes ius. Since in the realization of the person the individualization of human being is central, Aquinas clearly sees the need for the protection of the sphere of "dominion of will". This sphere itself constitutes ius naturale, something which is due to man independently of the acts of will. Therefore "law should forbid nothing which is not unjust" ("nihil debet lege prohiberi quod licite fieri potest", In 3 Sent., dist. 40, q. I, a. 1, 3). Besides the relation of due-to-recipient, ius also includes the relation of obligation-of-subject which is superimposed on the relation of due-to-recipient. As far as the ontic foundations of obligation are concerned, in explaining why man is subordinated to realization of the good of others, Aquinas generally follows Aristotle in accepting that this basis is the subordination to moral good - to actions conforming with the learned truth about reality. Aquinas' systemic solutions allow, however, to reach deeper and understand why moral development is also a development of the whole human being. This was difficult within Aristotle's system, since he was reluc¬tant to decide whether precedence should be given to intellectual or moral develop¬ment. The inclination to realise good of another appears to be a transcendental characteristic of being, based on its very existence. Morality understood as rational and free subordination to realize the good of another is a specifically personal way of the realization of this inclination. Thus just actions contribute to the actualization of being in the aspect of its existence and therefore to the actualization of being as a whole. Thomas' conception of natural law (lex naturalis) as participation in eternal law (lex aeterna), offers possibilities for grasping that which is just as something which is basically accessible cognition, independently of Revelation and independently of faith in God, and at the same time as something based in eternal law, understood as a design of God's wisdom. Eternal law, embracing all particular actions, is not, from the human perspective, accessible cognition directly. It is enacted in the struc-ture of the created being and - in case of human beings - in free choices taking this structure into account. In the concluding remarks, the results obtained earlier are applied directly to the contemporary conception of human rights. Human rights are understood in the first place as "just things" - concrete goods of man; as that which is due because of subordination, based on dignity, to the personal development of man. That which is just is understood as a relational - actual or potential - state of things, which exists by virtue of existing relations. Evaluations referring to that which is right are true when respective relations of due-to-recipient take place; norms of conduct are true when respective relations of obligation-of-subject take place. Examples of the application of the sketched theory outside the field of human rights are also presented. Procedural consequences of the developed theory are shown, such as the discrimination of two types of legislative procedures which differ significantly in the structure of argumentation: the first aims at recognition of that which is just independently of the will of the legislator, and the second, at making individual or collective "projects" of development compatible. Finally the possibilities of applying the theory to the increasingly important problems of the protection of the environment and the "rights" of animals are mentioned. The central issue is a philosophical conception of man and his freedom and a conception of law. It is also indispensable to turn to a general theory of being. The search for a comprehensive theory of human rights requires attention to the Abso¬lute Being - God - as well. This is important for at least two reasons. First, a conception of the Absolute Being is integral to philosophy of the systemic type -of which the present book is a piece. A conception of the Absolute Being is signifi¬cant for understanding all being, including, first of all, man as a personal being. Second, every theory of human rights which does not comprise the problem of the Absolute may be questioned as to whether solutions adopted in it do not lead, in consequence, to eliminating God from the perspective of the understanding of law. It is desirable that a philosophical theory should deal with this problem directly. A theory which eliminates God from the perspective of the understanding of rights will be unacceptable for all those who, for philosophical reasons or relying on faith, consider God as the author of inherent rights. Nevertheless, a theoretical approach to rights from the perspective of the Absolute Being should only be a possible extension of a philosophical approach which bases rights on something which is cognizable independently of the acceptance of the existence of God so that the theory is also acceptable for those who reject the existence of God or suspend their judgment on this subject. The pursued theory should therefore contain, on the one hand, reference to natural, faith-independent foundations of human rights, but on the other hand, point to a possible extension accounting for the Absolute Being. The analyses contained in this chapter have undoubtedly some historical value since they are based on source texts. Nevertheless, the use of these texts and not critical works was dictated, first of all, by a conviction that analyses embrace a given theory in the aspect selected by the interests of the researcher. Therefore to find out what past thinkers say on the subject characterized in the first part it is simpler to reach to the sources than to adopt the existing critical works. The pre¬sented reconstruction of Aquinas' views on philosophy of law incorporates proposi¬tions of supplementing and developing some of the ideas undertaken by him. Obligation to act in this and not an other way arises because human actions are subordinated to the conformity, on the one hand, of aims realized by these actions and, on the one hand, the order of being determining that which is favourable to man or destroys him. The content of the order of being is, on the one hand, determined by the structure of being independent from man's will and, on the other, by free decisions of man. (shrink)

Many epistemologists treat rationality and justification as the same thing. Those who don’t lack detailed accounts of the difference, leading their opponents to suspect that the distinction is an ad hoc attempt to safeguard their theories of justification. In this paper, I offer a new and detailed account of the distinction. The account is inspired by no particular views in epistemology, but rather by insights from the literature on reasons and rationality outside of epistemology. Specifically, it turns on a version (...) of the familiar distinction in meta-ethics between possessing apparent normative reasons (which may be merely apparent) and possessing objective normative reasons. The paper proceeds as follows. In §1, I discuss the history of indifference to the distinction between rationality and justification in epistemology and the striking contrast with meta-ethics. I introduced the distinction between apparent reasons and possessed objective reasons in §2 and provide a deeper basis for it in §3. I explain how the ideas extend to epistemology in §4 and explore the upshots for some central issues in §5. (shrink)

One of the currently most discussed themes in the philosophy of action is whether there is some kind of collective intention that explains what groups do independent of what the indi-viduals who make up the group intend and do. One of the main obstacles to solve this prob-lem is that on the one hand collective intentionality is no simple summation, aggregate, or dis-tributive pattern of individual intentionality (the Irreducibility Claim), while on the other hand collective intentionality is in the heads (...) of the participating individuals, so to speak, and so it is owned by each of the separate individuals who make up the group (the Individual Ownership Claim). The claims are contradictory and until now no satisfactory solution how to reconcile them has been found. In this article I argue that the constitution view, like the one developed by Lynne R. Baker, can provide a way to sidestep the contradiction. Just as a statue as such is constituted by the marble it is made of but has characteristics that are different from the mar-ble (a statue has a head and legs, while the marble hasn’t; while the marble is stony and the statue as such isn’t), I argue that a group is constituted by its members and that a group on the one hand and its members on the other hand have different characteristics. This is possible be-cause group and members are on different levels. Then there is no longer a contradiction be-tween the Irreducibility Claim and the Individual Ownership Claim, for the former claim con-cerns the group level and the latter claim concerns the level of the group members. This ex-plains that a group can have intentions that are no simple summation, aggregate, or distributive patterns of the intentions of its members and that group intentions can be different from if not contradictory to what the individual members taken together intend. Een veelgehoorde kritiek op islamitische scholen is dat kinderen er worden geïndoctrineerd en dat dit in strijd is met het doel van onderwijs in een democratische samenleving. Dit artikel onderzoekt de principiële vraag of ouders ervoor zouden kunnen kiezen om hun kind naar een school te sturen waar hij of zij geïndoctrineerd wordt, bijvoorbeeld omdat zij denken dat het kind op een religieuze school minder kans loopt te worden gestigmatiseerd. Daarnaast wordt bekeken of het waarschijnlijk is dat kinderen op islamitische (...) scholen in Nederland daadwerkelijk geïndoctrineerd worden. (shrink)

This paper aims to highlight the articulation of skin memory with trans-Caribbean aesthetics by exploring the diasporic works of female diasporic artists born in the West Indies who emigrated to the United States. We intend to show how these contemporary female artists rewrite the codification and reception of the skin-related memory by connecting their artwork to a genealogy of traumas and healing practices that call for the empowerment of the Caribbean skin ego.

The social reality of contemporary Muslims is characterized by the dominance of the social system of capitalism. As a reality, this system forces every individual or group of Muslims to live on the mechanisms of capitalism. The events of September 11, 2001, identified as being carried out by certain Islamist movements, are a tangible product of the mechanism, along with the response of other Islamic movements to Islamism itself. The social system of capitalism has contrasted the dynamics of Islamic movements, (...) both radical, moderate, and liberal. The dominance of the social system of capitalism and the dynamics of the Islamic movement are problems as well as triggers for the existence of Progressive Islam. These problems are the basis for the author to assume that Tan Malaka's Islamic thought has a Progressive Islamic character. In addition, Tan Malaka's Islamic thinking is also by progressive Islamic agendas, namely, formulating reality-based thinking methods, reconceptualizing tawhid, creating social justice, upholding Human Rights (HAM), gender equality, pluralism, and reviving the unity of the people. To prove this assumption, the author formulates two main problems, namely, what is the external reality of Tan Malaka Progressive Islam? What is the process of objectivization and internalization of Tan Malaka's Islamic ideas? This is answered using two theories, namely, the Progressive Islamic theory and the sociology of knowledge theory. The first theory is used to target Tan Malaka's Islamic ideas. While the second theory functions as an analytical approach (externalization, objectivization, and internalization). The conclusions of this study are: First, Tan Malaka's progressive Islamic externalities are the social system of capitalism, the dynamics of Modern Political Islam, and Marxism. Second, Tan Malaka's progressive Islamic objectivization process took place within the government institutions of the Dutch East Indies, the Indonesian Communist Party (PKI), the Communist International (Comintern), and the United Struggle (PP). Third, Tan Malaka's progressive Islamization is MADILOG as a method of Progressive Islamic thought, tawhid as the foundation of social justice, social justice as the foundation of Human Rights (HAM), gender equality, pluralism, and the unity of the people. Internationale vergelijkingen vormen een waardvolle bron van inzicht bij het analyseren van maatschappelijke problemen en het beoordelen van beleidsmatige antwoorden op die problemen. Vergelijkend onderzoek levert vaak interessante of nuttige informatie op doordat er verschillen én overeenkomsten worden geconstrueerd, bijvoorbeeld: hoe ‘leefbaar’ is Toronto vergeleken met Berlijn? Zelfs wanneer de definities verschillen en de gebruikte meeteenheden enigszins onnauwkeurig kunnen zijn – bijvoorbeeld “leefbaar voor wie en ten opzichte van wat?” – zijn vergelijkingen leerrijk en aanleiding voor verdere reflectie. Demokratyzacja, rozumiana jako proces zmierzający do przekształcenia rządów autorytarnych w ustrój demokratyczny, przebiega od początku lat 90. XX wieku w państwach Afryki Subsaharyjskiej w sposób niezwykle skomplikowany, a niekiedy wręcz dramatyczny. Źródła problemów procesu demokratyzacji w Afryce Subsaharyjskiej mogą przynajmniej po części leżeć w niewłaściwej organizacji politycznej wieloetnicznych społeczeństw państw afrykańskich. Organizacja ta zwykle nie zapewnia reprezentantom części grup etnicznych udziału w podejmowaniu decyzji politycznych, zwłaszcza na szczeblu władzy centralnej, i w konsekwencji często nie daje tym grupom możliwości obrony swoich (...) interesów. Wielu współczesnych afrykańskich myślicieli politycznych uważa, że podziały etniczne istniejące w państwach Afryki powinny znaleźć swoje odzwierciedlenie w konstrukcji ich systemów politycznych, co z kolei mogłoby usprawnić proces implementacji demokracji. Ważnych, ogólnych wskazówek przydatnych dla projektowania modeli demokracji odpowiednich dla państw afrykańskich można szukać w rozwiązaniach istniejących w wieloetnicznych Indiach, choć, co warto podkreślić, ani indyjska myśl polityczna ani indyjskie rozwiązania ustrojowe nie wydają się stanowić inspiracji dla współczesnych intelektualistów afrykańskich. Edukacyjny dla państw Afryki Subsaharyjskiej walor kazusu indyjskiego systemu politycznego sugerują jednak rozważania wybitnego politologa Arenda Lijpharta na temat elementów współrządzenia (power-sharing) w systemie politycznym niepodległych Indii. In the novel "Het Been" by the Flemish writer Willem Elsschot. In the novel, a businessman becomes obsessive over the fact that a victim of his unscrupulous business practices refuses to forgive him. This raises the following questions: Why does one find it upsetting when the victim of one's wrongdoing refuses to accept our apologies? Why does one find it upsetting when the victim is unwilling to grant us the forgiveness that we are asking for?

This paper investigates the possibilities of ordinary people to estabish a moral authority in a subclass of everyday scenarios in the public domain that are characterised by an underdetermination of the obtaining norms and regulations. The paper offers a strategy based on hospitality to challenge the all too common practice of ignoring one’s responsibility as a moral agent and to hide in one’s shell, hoping that others (police power!) will solve one’s problem. The paper begins with a description of a (...) few scenarios in which it is less or more complicated for people to intervene as authorities. The tendency in such scenarios to retreat from one’s responsibility is analysed in terms of a distinction between power and authority, the latter enabling interventions based on a framework of justifying reasons. It is argued that a lack of confidence in the availability of such a framework of justifying reasons might explain the popularity of the current defensive tendency, especially against the background belief that interventions based on power are by default unjustified. An analysis is provided of trust as an attitude that complements authority. No authority, and no framework of justifying reasons, without trust. But a crucial feature of trust is the courage to accept one’s own vulnerability. This insight is used as the stepping stone for the alternative stategey based on hospitality. A sketch is provided of how this might work, involving five steps, the crucial ones being (1) an invitation to the other people in the scenario to compose a plural subject and (2) an offer to take up the responsibility to host this plural subject acknowledging one’s vulnerabilty to the independence of one’s guests. Ideological diversity has been on the research agenda in the social sciences for a couple of years. Yet in philosophy, the topic has not attracted much interest. This article tries to start filling this gap. We discuss a number of possible causes for the underrepresentation of right-wing and conservative philosophers in the academic profession. We also argue why this should be an important concern, not only morally, but also and primarily epistemically. Lastly, we explore whether the situation in philosophy is (...) more problematic than the situation in other fields, and what kind of ideological diversity would be desirable for academic philosophy. English: In this paper I indicate why I consider 'experimental philosophy' to be good news, though not as good as it could be, and not as all that new. I'll argue that there is no need to restrict experimental philosophy to eliciting intuitions through questionnaires. I'll indicate that good examples of experimental philosophy already exist in Artificial Intelligence and Cognitive Neuroscience. [Title: A phenomenological account of the habitual and active character of ignorance] -/- A number of critical social epistemologists have argued that a form of ignorance makes up the epistemic dimension of existing relations of oppression based on racial and/or gender identity. Recent phenomenological accounts of the habitual nature of perception can be understood as describing the bodily, tacit, and affective character of this form of ignorance. At the same time, as I aim to show in this article, more could (...) be phenomenologically said and made of both the active and pervasive character of said ignorance. Drawing on the phenomenological concept of receptivity, I propose a way to further understand the active character of ignorance both in and beyond perception. By doing so, we also get a better view on what it would take to overcome this kind of ignorance. (shrink)

This paper assesses both the practical and the epistemic value of Pyrrhonism as this stance is described in Sextus Empiricus’s extant writings. It first explores whether the Pyrrhonist’s suspension of judgment and undisturbedness make us behave in a moral or immoral way, and whether they allow us to attain those goals that would make it possible to live well. It then examines whether the Pyrrhonist’s suspension of judgment makes it possible to reach the epistemic goals of attaining truth and avoiding (...) error. It finally considers whether the results of the previous analyses show that Pyrrhonism is of no philosophical interest to a contemporary audience. (shrink)

The double subjectivity of conscience and the need to test conscientious objections -/- Abstract In spite of the collapse of the traditional objective concept of conscience and the subsequent subjectivation of conscience, conscientious objections are still often considered as a valid ground for exemption from legal and professional obligations. Conscientious objections are seen as more serious than ordinary moral objections. It is not evident why this is so. I argue, with Niklas Luhmann, that the function of conscience is to protect (...) the moral core of a person’s identity. Overruling conscientious objections threatens this core. Claims of conscience are usually founded on the right of freedom of conscience. This right is not absolute. I discuss the view of Richard Arneson who rejects the right of freedom of conscience and defends the right against conscience. I agree with Arneson that, at the one hand, conscientious objectors may constitute a threat to the social and legal order when their objections are not recognised and, at the other hand, too easy giving in to conscientious objections may also threaten the viability of social and legal order. That is why it is needed to determine when conscientious objections cannot be taken at face value, but should be subjected to a series of tests. The aim of these tests is to contain the number of objectors. I discuss 6 criteria for determining whether conscientious objections ground an exemption to legal and professional obligations. At the end of the article I discuss the conscientious objections of medical doctors. (shrink)

This article paradoxically tries to come closer to an idea of justice with the help of the destructive — anything but nihilistic — criticism thereof by Hans Kelsen. It argues that his relativistic approach, in which this idea undergoes a metamorphosis to become a realisable value of a social order, brings us closer to an obvious and objective form of justice that is almost taken for granted. Just in our liberal and plural democracy this approach might prove to be of (...) more value than a transcendental theory that passes speculative judgements on the essence of absolute justice, about which we are unable to come to an agreement. Although some claim that the term cyber war is merely metaphorical, there are good reasons to see cyber war as a form of warfare ‐ even if it is not war as we have hitherto known it. This poses the question whether the principles of the Just War Tradition, which claims to offer an alternative for pacifism and realism, apply to this specific kind of war too. This article argues that the jus in bello principles of discrimination and proportionality are (...) applicable, and that actually applying them would limit the harm cyber-attacks currently cause. Most cyber-attacks of recent years wrongly target civilians, and this amounts to a serious breach of these principles. The final part of this article looks at those who actually conduct the cyber-attacks, the cyber soldiers ‐ how do they fit into the military profession, and to what extent can we expect them to uphold the principles of Just War? Cognitive scientists typically explain cognitive processes in groups from the study of the individual. Even researchers who recognize that our cognition is inherently situated and cannot be understood without placing it in a social context take the individual as the starting point for looking at group processes. It is reason for Robert Wilson (2004) to argue for 'group minds'. With this he creates room for the idea that certain group processes cannot solely be explained as the sum of the individual (...) cognitive participants. Marc Slors does not go that far in his article on group identification and cognition. Yet his writing takes important steps toward better understanding group cognition. Broadly speaking, I can agree with the reasoning of the article and agree with the conclusion. But there is an important point missing that must be elaborated if the article is not to fall prey to a fundamental critique. Slors' writing integrates an assumption that is under discussion in ecological psychology, namely that information perception for cultural affordances need not be specific and precise. I am skeptical of this assumption and explain why in what follows. As a helping hand, I also take a stab at reinforcing Slors' narrative. (shrink)

This paper was published in an issue of the ANTW, Dutch General Journal of Philosophy, dedicated to the work of Paul Churchland. It criticizes Churchland for neglecting the relationships of animals to their environments and their innate subjectivity, which guides them through their environment. The concept of an emotional a priori is introduced, 'the innate structures of experience', analogue to Kant's cognitive a priori. Subjectivity is an evolved property which enables organisms to adapt their genetic interests to a particular environment.

There is still too little attention for unique status of evolutionary explanations within philosophy, one hundred and fifty years after Darwin's 'Descent of Man' (1871). Evolutionary explanations clarify characteristics of organisms without getting stuck in genetic, physiological or mechanical details. You don't need to know exactly how the colors of a peacock’s tail originate to know why she has so many eyes: females see how healthy and strong males are. In the same way, an evolutionary explanation of consciousness is possible (...) without fully understanding the responsible neural networks. In this way we can better understand the role of consciousness in the formation of behavior and we do not fall into the trap of seeing it only as a side effect. Moreover, an evolutionary explanation sheds light on the role of emotions in consciousness and on their different manifestations in humans and other animals. (shrink)

Evolutionary epistemology explains knowledge as an adaptation (or series of adaptations) which enables animals to behave adaptively in their environment. The aim of knowledge, then, is to act. Our knowledge-apparatus was never designed to understand the nature of the universe.

Synthesis of different models about the origin of morality with a discussion about possible normative consequences.

One hundred years ago, Roy Wood Sellars' "Evolutionary Naturalism" (1922) was published, a somewhat forgotten milestone in the development of a non-reductionist naturalism. Sellars did not yet speak of emergence but of "novelty", but saw the importance of systemic properties. He underestimated Darwin and the importance of studying animal behaviour, so some of his insights seem outdated. On the other hand, he was ahead of his time with ideas that are still valuable today. He therefore deserves a place in the (...) development of evolutionary naturalism and in the history of philosophy in general. (shrink)

A philosophical analysis of the future of art must explicate art’s nature, as well as discuss the historical nature of art practice. Only so can one explain those contemporary developments in art which have led many people to doubt whether art even has a future. Arguably, art practice as we know it started with the installing of the modern system of the fine arts. I explain the pragmatics of art so understood, and suggest that we can define art, internally. We (...) need not resort to a nominalist approach that claims that something is a work of art if some representative of the art world says it is. Instead of such empty proceduralism, I explain how all art’s focal objects, persons and activities are mutually adjusted and can only be understood in light of the whole. Within that whole of art practice, the contemporary samples of art’s alleged failure can be assessed. Now the modern system treats the arts as aesthetic, and prescribes that to judge a work one has to experience it for oneself. Why this should be so, I explain in terms of the perceivability of the artist in the work. Next, art develops as a whole rather than in a piecemeal manner. Particular contemporary works may alienate the audience from art practice, yet once they are recognisably in a procedure which has clear artistic potency they can be incorporated fruitfully in the modern system as explained. In all, the future of art is the future of the modern system, unless the system as a whole goes. We see this happen with the Taliban, but do not ourselves seem to be vulnerable to such onslaught. Yet, our culture may be in the process of eliminating the human mind from the objective reality, and if nothing stops us, art too will come to an end. Luckily, by then we will not be such as to lament that demise. (shrink)

Aesthics: Art and moral attuning. Art can help us understand everyday moral deliberation. Better perhaps than ethics. People don’t just act randomly in moral situations nor do they argue internally about which ethical principle to follow before deciding what to do. We built our moral sensitivity whilst living our lives, adhering to aesthetic norms of interaction. Regular engagement with works of art educates our moral sensitivity.

This paper critically discusses Hacker’s reading of nonsense in Wittgenstein’s Tractatus in terms of his notion of misuse, which is taken to consist in the violation of rules of logical syntax. I argue that Hacker’s reading relies on an equivocation between sign and symbol: what is ‘misused’ is a mere sign, but the verdict of nonsensicality relies on seeing it as a symbol. Although Hacker seeks to distance himself from resolute readings – according to which nonsense always consists in nothing (...) but a failure to assign meaning to one’s sentences – I argue that his own verdicts of nonsensicality have their ultimate grounds in exactly the same sort of assessment, i.e. whether meaning has been assigned to a sentence. The rules of logical syntax, contrary to his own intentions, do no real work in determining whether a sentence is nonsensical or not. (shrink)

In dit artikel betwist ik het gangbare idee dat de rede ontoereikend is voor morele motivatie, met name in relatie tot universele ethische kwesties. Door een uitgebreide verkenning van de Dual-Process Theory (DPT) stel ik dat onze morele intuïties zowel trainbaar zijn als een inherente neiging hebben naar universalistische overwegingen. Ik betoog dat sociale rechtvaardiging en de drang naar rationele argumentatie een cruciale rol spelen in het vormen en veranderen van onze morele standpunten. Concluderend pleit ik voor een herwaardering van (...) klassiek moreel redeneren en stel ik dat een universele ethiek psychologisch realistischer is dan eerder werd aangenomen. (shrink)

How Galileo Galilei discovered the law of fall, and the difference that this makes Galileo’s law of fall is one of the crucial building blocks of classical mechanics. The question how this law was discovered has often been a topic of debate. This article offers a reconstruction of the developments within Galileo’s research that led to the discovery of the law. This reconstruction is offered to make a philosophical point regarding the epistemic status of experimental results: Galileo’s experiments can offer (...) sufficient justification for the acceptance of the law of fall only because of their place in a broad research programme. In dit artikel wordt de dominante metafysische oriëntatie in de hedendaagse meta-ethiek kritisch onder de loep genomen. Het hedendaagse debat, dat zich voornamelijk richt op de vraag hoe moraliteit metafysisch gezien 'in de werkelijkheid past', wordt gekenmerkt door een reeks complexe en soms esoterische discussies die, zo wordt betoogd, weinig bijdragen aan ons filosofische begrip van ethiek. Deze focus op metafysische grondslagen heeft geleid tot een tunnelvisie, waarin het debat gevangen zit tussen steeds ingewikkeldere vormen van non-cognitivisme, herconceptualisaties van 'objectiviteit' (...) en metafysische acrobatiek. Als alternatief wordt voorgesteld de aandacht in de meta-ethiek te verleggen naar het domein van praktisch redeneren. Door ons te concentreren op de patronen van geldige praktische argumentatie en het soort overwegingen dat mensen daadwerkelijk overtuigt, kunnen we wellicht een beter inzicht krijgen in de aard van ethische normativiteit en de rol ervan in ons leven. Het artikel pleit voor een meer pragmatische en minder metafysisch beladen benadering van de meta-ethiek, die zich richt op de daadwerkelijke praktijken van moreel redeneren en argumenteren. Iconic photographs are visual arguments depicting an, often dramatic, particular situation showing victims of disasters. Spectators watching the photo of the particular situation, empathise with it, and project the feelings evoked onto the events that form the context for the scene in the picture. This mobilises them into political action. In the process, however, the depicted personal misery is perused to exemplify the larger events. The tragedy of iconic photographs is analysed not as the misery experienced by the depicted persons, (...) but as the breach of their right to shame which is required for the photo to acquire iconicity. Examples are addressed, as well as the contrast classes of the self-portrait and Byzantine icons. (shrink)

How do the pictures Wittgenstein and his relatives took during his life relate to his philosophical work? The exhibition at the Leopold Museum in Vienna in 2021 demonstrated a complex network of resemblances, overlaps, and cross-references between Wittgenstein’s way of working and the pictures he collected. In this essay, the network is used as an example to argue that a combination of philosophy and artistic sensibility might be a fruitful enrichment for a philosophical practise.

The point of Wittgenstein’s remarks on colour concerns, not so much colours as such, as well as our ability to see [that implies both seeing ánd thinking] and our capacity to imagine something. This can be seen from the fact that Wittgenstein relates the notion of ‘seeing aspects’ on the one hand to the colour octahedron in PB, and on the other hand to the colour puzzles as discussed in ROC. This connection between Wittgenstein’s remarks on colour, on seeing aspects (...) and on certainty makes clear that these investigations of Wittgenstein direct us towards a reflective dynamics of his ideas.
