Cet article est consacré au problème du rapport entre l’entrelacement des genres (συμπλοκὴ τῶν εἰδῶν) et le logos dans le Sophiste. Après avoir brièvement présenté le problème, je discute, dans la première partie, différentes solutions proposées par les commentateurs. Je cherche à montrer qu’aucune de ces solutions n’est pleinement satisfaisante. Dans la deuxième partie, je propose une nouvelle solution au problème de la συμπλοκὴ τῶν εἰδῶν fondée sur une distinction entre deux types de logos, le logos dialectique et le logos (...) doxique. Dans la troisième partie, je cherche à justifier textuellement cette solution en recourant à la fois au texte du Sophiste lui-même et à la dernière partie du Théétète. Dans ma conclusion, je suggère que la distinction entre logos dialectique et logos doxique correspond à une différence qui traverse toute l’œuvre de Platon, à savoir la différence entre connaissance et opinion. / This paper deals with the problem of the συμπλοκὴ τῶν εἰδῶν in the Sophist. In the first part, after a brief presentation of this problem, I discuss different solutions which have been proposed in the recent literature. I try to show that none of them is entirely satisfying. In the second part, I propose and explain a new solution based on a distinction between two types of logos : dialectical logos and doxastic logos. In the third part, I try to justify this solution on the basis of some passages of the Sophist and of the final part of the Theaetetus. To conclude, I suggest that the distinction between dialectical logos and doxasticlogos matches the difference between knowledge and belief made by Plato in his dialogues. (shrink)

With an extensive amount of research on the social lives of primates, Frans de Waal has been a pioneering advocate for the continuity of human and non-human minds, putting forward the idea that these creatures exhibit rudimentary political and moral behaviors. One of the traits which de Waal focuses on is animal normativity, a set of behaviors functionally defined as adherence to social standards. Recently, some philosophers have endorsed this position, holding that animals show a psychological capacity called normative cognition (...) underlying those and other social behaviors. In this paper, I assess whether advocacy for animal normativity is an exercise of theory construction in comparative cognition. To that end, I present three features of this kind of theory construction. First, the explanatory goal of building functional analyses of cognitive capacities. Second, the conceptual aid of comparative thinking for theory construction. Third, the heuristic value of theory in specifying possible roads of inquiry. Taking these features into account, I assess whether the claims advocates make regarding animal normativity consider them. My answer is negative. First, since some advocates focus on behavioral traits and not on psychological capacities, they are not producing theory in comparative cognition, although, as I argue, they should. Second, there is a disregard for hypothesis testing and no evolutionary considerations to support their views. Finally, the claim that non-human animals exhibit normativity does not seem to have heuristic value. (shrink)

A constitutive theory of representation must address two challenges. The content determination challenge requires specifying why a particular state has a given content. The job description challenge requires spelling out the explanatory role that representational notions play in that theory. Recently, Nicholas Shea has advanced *varitel semantics* as a hybrid approach to representation to answer those challenges, supplementing teleosemantics with non-historical features –namely, exploitable relations and robustness. In this paper, I critically assess the hybrid theory’s answers to both challenges, arguing (...) that their hybrid nature undermines their merits. In each case, I will show that it is hard to establish how the alleged complementariness of the hybrid account components works. I will conclude that internal problems beset Shea’s theory of representation. (shrink)

In this brief introduction, I shall rather reflect, from a biographer’s viewpoint, on the significance of Discretion for our understanding of the trajectory of Hart’s ideas and on the significance of his year at Harvard. I shall then move on to consider the intriguing question of why Hart did not subsequently publish or build on some of the key insights in the paper itself. Here I highlight the fact that, almost uniquely in Hart’s work, Discretion features a notable emphasis on (...) the significance of institutional factors in our understanding of the nature of legal decisionmaking; and I argue that Hart’s failure fully to develop this insight in the essay, or to build on it in his subsequent work, derives from the fact that such a development would have necessitated a diversion from the philosophical issues that were his core intellectual concern, and moreover would have presented certain dangers to his conception of legal positivism. I shall conclude by considering what contribution the essay makes to our overall interpretation and evaluation of Hart’s legal philosophy. (shrink)

This paper demonstrates the central role of the Socratic elenchus in the Sophist. In the first part, I defend the position that the Stranger describes the Socratic elenchus in the sixth division of the Sophist. In the second part, I show that the Socratic elenchus is actually used when the Stranger scrutinizes the accounts of being put forward by his predecessors. In the final part, I explain the function of the Socratic elenchus in the argument of the dialogue. By contrast (...) with standard scholarly interpretations, this way of reading the text provides all the puzzles about being (241c4–251a4) with a definite function in the dialogue. It also reveals that Plato’s methodology includes a plurality of method and is more continuous than what is often believed. (shrink)

There seems to be an inconsistency at the heart of Aristotle’s Metaphysics: a differentia is said both to presuppose its genus (in vii 12) and to be logically independent from it (in x 7). I argue that the relation of analogy resolves this inconsistency, restores the coherence of the concepts of differentia and species, and gives x 7 its rightful place in the development of the Metaphysics.

The picture of moral development defended by followers of Aristotle takes moral cultivation to be like playing a harp; one gets to be good by actually spending time playing a real instrument. On this view, we cultivate a virtue by doing the actions associated with that virtue. I argue that this picture is inadequate and must be supplemented by imaginative techniques. One can, and sometimes must, cultivate virtue without actually performing the associated actions. Drawing on strands in Buddhist philosophy, I (...) explain several methods of moral development that rely on imagination and visualization rather than overt action. These techniques are essential in cases where cultivating virtue the way one practices the harp is impossible. Întrebarea de bază este, ce este o pseudoştiinţă? Una din cele mai disputate delimitări ale ştiinţei. Mulţi savanţi de renume mondial, unanim recunoscuţi (ca de ex. Charles Darwin) au cochetat de-a lungul timpului cu diverse aspecte ale pseudoştiinţei considerându-le, cu bună credinţă, drept ştiinţă. Şi multe domenii ale pseudoştiinţei actuale au fost, la vremea lor, considerate drept domenii onorabile ale ştiinţei. Chiar şi în prezent, practicanţii pseudoştiinţelor nu recunosc valabilitatea etichetei puse domeniului lor de activitate. Oamenii de ştiinţă au tendinţa (...) să claseze pe loc un domeniu de activitate, în funcţie de cunoştinţele şi cultura lor, drept ştiinţă sau pseudoştiinţă. Dar graniţa dintre ştiinţă şi pseudoştiinţă este în multe cazuri foarte vagă. Într-un fel, această problemă seamănă cu problema filozofică a stabilirii a ce e bine şi ce e rău. Filosofii ştiinţei, cum ar fi Paul Feyerabend, au susţinut că nu este nici posibil, nici de dorit, o distincţie între ştiinţă şi non-ştiinţă. Printre problemele care pot face distincţia dificilă este viteza variabilă de evoluţie între teoriile şi metodologiile ştiinţei ca răspuns la noile date. În plus, standardele specifice aplicabile unui domeniu al ştiinţei ar putea să nu fie aplicabile în alte domenii. După cum se spune în diferite cursuri despre introducerea în ştiinţe, pseudoştiinţa este oricare subiect care pare a fi ştiinţific la prima vedere, sau ai cărui susţinători susţin că este ştiinţific, dar care contravine condiţiilor de testare sau deviază mult de la alte aspecte fundamentale ale metodelor ştiinţifice. Pseudoştiinţa este caracterizată de folosirea unor afirmaţii vagi, exagerate sau care nu se pot testa, supralicitarea confirmării în detrimentul argumentării, lipsa transparenţei pentru teste realizate de alţi experţi, şi o stagnare în dezvoltarea teoriei. In this article, I show that the semantics one adopts for mass terms constrains the metaphysical claims one can make about mixtures. I first expose why mixtures challenge a singularist approach based on mereological sums. After discussing an alternative, non-singularist approach, I take chemistry into account and explain how it changes our perspective on these issues.

This article defends a relational account of personhood. I argue that the structure of personhood consists of dyadic relations between persons who can wrong or be wronged by one another, even if some of them lack moral competence. I draw on recent work on directed duties to outline the structure of moral communities of persons. The upshot is that we can construct an inclusive theory of personhood that can accommodate nonhuman persons based on shared community membership. Întregul corp de lucrări al lui Platon a supraviețuit intact până în zilele noastre, influențând decisiv cultura occidentală. Pentru Platon, dialogul este singurul instrument capabil să evidențieze caracterul de cercetare al filosofiei, elementul cheie al gândirii sale. Cu siguranță cuvântul scris este mai precis și mai aprofundat decât cel oral, dar discursul oral permite un schimb imediat de opinii asupra subiectului în discuție. Protagonistul principal al dialogurilor este Socrate, cu excepția ultimelor dialoguri unde acestuia i se atribuie un rol secundar, (...) dispărând complet cu totul în Legi și Epinomis. Dialogurile platonice au fost grupate de foarte mulți comentatori în diferite clasificări. It is usual to identify initial conditions of classical dynamical systems with mathematical real numbers. However, almost all real numbers contain an infinite amount of information. I argue that a finite volume of space can’t contain more than a finite amount of information, hence that the mathematical real numbers are not physically relevant. Moreover, a better terminology for the so-called real numbers is “random numbers”, as their series of bits are truly random. I propose an alternative classical mechanics, which is (...) empirically equivalent to classical mechanics, but uses only finite-information numbers. This alternative classical mechanics is non-deterministic, despite the use of deterministic equations, in a way similar to quantum theory. Interestingly, both alternative classical mechanics and quantum theories can be supplemented by additional variables in such a way that the supplemented theory is deterministic. Most physicists straightforwardly supplement classical theory with real numbers to which they attribute physical existence, while most physicists reject Bohmian mechanics as supplemented quantum theory, arguing that Bohmian positions have no physical reality. It’s natural to think of acts of solidarity as being public acts that aim at good outcomes, particularly at social change. I argue that not all acts of solidarity fit this mold - acts of what I call ‘private solidarity’ are not public and do not aim at producing social change. After describing paradigmatic cases of private solidarity, I defend an account of why such acts are themselves morally virtuous and what role they can have in moral development.

Is suffering really bad? The late Derek Parfit argued that we all have reasons to want to avoid future agony and that suffering is in itself bad both for the one who suffers and impersonally. Nietzsche denied that suffering was intrinsically bad and that its value could even be impersonal. This paper has two aims. It argues against what I call ‘Realism about the Value of Suffering’ by drawing from a broadly Nietzschean debunking of our evaluative attitudes, showing that a (...) recently influential response to the debunking challenge (the appeal to phenomenal introspection) fails. It also argues that a Nietzschean approach is well suited to support the challenge and is bolstered by the empirical literature. Despite intensive exegetical work, Plato’s description of dialectic in the Sophist still raises many questions. Through a close reading of this passage that contextualizes it in the general organisation of the Sophist, this paper provides answers to these questions. After presenting the difficult text, I contend that the “vowel-kinds” are necessary conditions for the blending of kinds. Then, I interpret the “cause of divisions” mentioned by the Stranger as the kinds responsible of the dichotomous division in the first half of (...) the dialogue. In the next part, I show that 235d5-e2 does not describe a procedure of “meta-divison” as some commentators have it, but that it describes the method of division itself. Animals who live in cities must coexist with us. They are, as a result, entitled to the conditions of their flourishing. This article argues that, as the boundaries of cities and urban areas expand, the boundaries of our conception of captivity should expand too. Urbanization can undermine animals’ freedoms, hence their ability to live good lives. I draw the implications of an account of “pervasive captivity” against the background of the Capabilities Approach. I construe captivity, including that of urban animals, (...) as affecting a range of animal capabilities, understood as freedoms, and I address some tensions within Nussbaum’s treatment of human-animal conflicts. Using the Capabilities Approach as a guide, I will attempt to motivate a convergence between habitat preservation in urbanized environments, urban design guided by justice, and the individual freedoms of animals. The singularities from the general relativity resulting by solving Einstein's equations were and still are the subject of many scientific debates: Are there singularities in spacetime, or not? Big Bang was an initial singularity? If singularities exist, what is their ontology? Is the general theory of relativity a theory that has shown its limits in this case? In this essay I argue that there are singularities, and the general theory of relativity, as any other scientific theory at present, is not (...) valid for singularities. But that does not mean, as some scientists think, that it must be regarded as being obsolete. After a brief presentation of the specific aspects of Newtonian classical theory and the special theory of relativity, and a brief presentation of the general theory of relativity, the chapter Ontology of General Relativity presents the ontological aspects of general relativity. The next chapter, Singularities, is dedicated to the presentation of the singularities resulting in general relativity, the specific aspects of the black holes and the event horizon, including the Big Bang debate as original singularity, and arguments for the existence of the singularities. In Singularity Ontology, I am talking about the possibilities of ontological framing of singularities in general and black holes in particular, about the hole argument highlighted by Einstein, and the arguments presented by scientists that there are no singularities and therefore that the general theory of relativity is in deadlock. Cunoașterea și informațiile (abordate în ansamblu sau în componentele lor distincte) sunt o preocupare majoră pentru tehnologia informației, sisteme de informații, știința informației și activitatea de informații în general. Procesul obţinerii, prelucrării şi analizei informaţiilor este o preocupare majoră pentru societatea actuală. În acest scop se folosesc procedee şi tehnici specifice pentru culegerea sau generarea de informaţii, prelucrarea acestora prin analiză şi sinteză, generarea de predicţii şi strategii, transmisia şi prezentarea informaţiilor factorilor de decizie, şi stocarea lor. Analiza informațiilor poate (...) fi caracterizată ca o intreprindere epistemologică, care urmărește să dezvolte o înțelegere clară a produselor cunoașterii. Perspectiva lui Polanyi despre cunoaștere servește unor considerații epistemologice fundamentale privind cunoașterea ca produs. Conceptul acesta de cunoaștere personală contribuie la o înțelegere mai profundă a cunoașterii. Perspectiva inversează ierarhia tradițională epistemologică. Cea mai mare provocare ar putea fi aceea de a convinge analiștii, conducerea și clienții lor de avantajele metodelor analitice structurale. O introducere treptată și naturală a acestor metode în fluxul obișnuit de procese și produse de informații ar putea fi mai eficientă decât realinierea la scară largă a gândirii. "Spațiul" activităților de informații s-a extins de la guverne ca actori statali la actori non-statali precum ONG-uri, instituții transnaționale și corporații, firme private și grupuri de interese și presiuni reprezentând comunități, concepte și ideologii diverse. Procesul de luare a deciziilor a devenit dispersat și granular. Actuala "democratizare" a serviciilor de informații are un impact major asupra colectării și analizei informațiilor, și a procesului decizional, determinând serviciile de informații să devină mai transparente, să ia în considerație dezbaterile publice a acțiunilor lor și să fie nevoite, uneori, să le justifice public. Una din cele mai disputate controverse privind prioritatea unor descoperiri științifice este cea privind legea gravitației universale, între Isaac Newton și Robert Hooke. În acest eseu extind o lucrare mai veche pe aceeași temă, ”Isaac Newton vs. Robert Hooke în legea gravitației universale”. Hooke l-a acuzat pe Newton de plagiat, preluându-i ideile exprimate în lucrările anterioare. În această lucrare încerc să arăt, pe baza unor analize anterioare, că ambii oameni de știință au greșit: Robert Hooke pentru că teoria sa nu (...) era în fond decât idei care nu s-ar fi materializat niciodată fără suportul matematic al lui Isaac Newton; iar acesta din urmă a greșit nerecunoscând niciun merit al lui Hooke în elaborarea teoriei gravitației. Mai mult, după moartea lui Hooke și preluarea prezidenției Societății Regale, Newton a înlăturat orice urmă din instituție a fostului președinte, Robert Hooke. De asemenea, La negarea contribuției lui Hooke a contribuit și statutul său social ”inferior”, fiind poreclit de contemporani ”mecanicul”, spre deosebire de Sir Isaac Newton cel nobil. Pentru aceasta detaliez acuzațiile și argumentele fiecăreia dintre părți, și cum a fost percepută această dispută de către contemporanii celor doi. The method of the transcendental reduction, which takes place as a return revealing the subjectivity to itself, makes possible to grasp the link connecting the worldly reality and the egological dimension, i.e. the world’s becoming in the ways of the originally subjective constitution. The legitimate aim of the psychological experience to understand the basic structures of the life-consciousness can find in the conceptual figure of the phenomenological reduction both a valid methodological approach and a useful terms of comparison.

Testimony is of epistemic and practical significance. It is of epistemic significance because majority of what we know and believe comes from being told. It is of practical significance because our agency can be undermined, bypassed, or overridden owing to systemic prejudices sustained by oppressive social or cultural practices and subsequently our routes to knowledge are either hindered or distorted. Things get more complicated when we introduce and examine how groups and other collectives testify and are recipients of testimony. For (...) instance, group speakers are typically said to represent and reflect the view of the group they are speaking on behalf of. But sometimes because of these oppressive practices, a group speaker’s assertion may deprive or impair its members’ ability to perform certain actions through speech. This dissertation examines the intersection between testimony, collective phenomena, and epistemic harms. One aim is to argue for a view on the nature of testimony that can accommodate various ways collectives testify and are recipients of testimony. In particular, I argue and present a view of testimony as a norm-governed joint activity involving individual or collective participants that commit themselves to a common aim of collaboration. Another aim is to present an epistemology of testimony that tracks our ordinary testimonial practices. In this regard, I argue for a norm view where we have reason to believe what we’re told because of the rules or norms that govern our communicative exchanges. A final aim is to explore the mechanism by which collective speech ensues in an epistemic harm driven by social identity prejudices. I argue for a form of silencing that is distinctive of groups insofar as the silencing occurs because of group dynamics. I call the mechanism underlying this form of silencing “representational impairment”. This dissertation, I hope, will motivate and inspire others to pursue philosophical projects at these intersections and in this spirit, I end by offering suggestions on areas of further development and future direction. In a recent work, Walter Carnielli and Abilio Rodrigues present an epistemically motivated interpretation of paraconsistent logic. In their view, when there is conflicting evidence with regard to a proposition A (i.e. when there is both evidence in favor of A and evidence in favor of ￢A) both A and ￢A should be accepted without thereby accepting any proposition B whatsoever. Hence, reasoning within their system intends to mirror, and thus, should be constrained by, the way in which we reason (...) about evidence. In this article we will thoroughly discuss their position and suggest some ways in which this project can be further developed. The aim of the paper is twofold. On the one hand, we will present some philosophical critiques to the specific epistemic interpretation of paraconsistent logic proposed by Carnielli & Rodrigues. First, we will contend that Carnielli & Rodrigues’s interpretation implies a thesis about what evidence rationally justifies to accept or believe, called Extreme Permissivism, which is controversial among epistemologists. Second, we will argue that what agents should do, from an epistemic point of view, when faced with conflicting evidence, is to suspend judgment. On the other hand, despite these criticisms we do not believe that the epistemological motivation put forward by Carnielli & Rodrigues is entirely wrong. In the last section, we offer an alternative way in which one might account for the epistemic rationality of accepting contradictions and, thus, for an epistemic understanding of paraconsistency, which leads us to discuss the notion of diachronic epistemic rationality. About the analogy between the epistemological and methodological aspects of the activity of intelligence agencies and some scientific disciplines, advocating for a more scientific approach to the process of collecting and analyzing information within the intelligence cycle. I assert that the theoretical, ontological and epistemological aspects of the activity of many intelligence agencies are underestimated, leading to incomplete understanding of current phenomena and confusion in inter-institutional collaboration. After a brief Introduction, which includes a history of the evolution of the intelligence (...) concept after World War II, Intelligence Activity defines the objectives and organization of intelligence agencies, the core model of these organizations (the intelligence cycle), and the relevant aspects of the intelligence gathering and intelligence analysis. In the Ontology section, I highlight the ontological aspects and the entities that threaten and are threatened. The Epistemology section includes aspects specific to intelligence activity, with the analysis of the traditional (Singer) model, and a possible epistemological approach through the concept of tacit knowledge developed by scientist Michael Polanyi. In the Methodology section there are various methodological theories with an emphasis on structural analytical techniques, and some analogies with science, archeology, business and medicine. Mental representations remain the central posits of psychology after many decades of scrutiny. However, there is no consensus about the representational format(s) of biological cognition. This paper provides a survey of evidence from computational cognitive psychology, perceptual psychology, developmental psychology, comparative psychology, and social psychology, and concludes that one type of format that routinely crops up is the language-of-thought (LoT). We outline six core properties of LoTs: (i) discrete constituents; (ii) role-filler independence; (iii) predicate–argument structure; (iv) logical operators; (v) inferential (...) promiscuity; and (vi) abstract content. These properties cluster together throughout cognitive science. Bayesian computational modeling, compositional features of object perception, complex infant and animal reasoning, and automatic, intuitive cognition in adults all implicate LoT-like structures. Instead of regarding LoT as a relic of the previous century, researchers in cognitive science and philosophy-of-mind must take seriously the explanatory breadth of LoT-based architectures. We grant that the mind may harbor many formats and architectures, including iconic and associative structures as well as deep-neural-network-like architectures. However, as computational/representational approaches to the mind continue to advance, classical compositional symbolic structures – that is, LoTs – only prove more flexible and well-supported over time. What can be more fascinating than experimental metaphysics, to quote one of Abner Shimony’s enlightening expressions? Bell inequalities are at the heart of the study of nonlocality. I present a list of open questions, organised in three categories: fundamental; linked to experiments; and exploring nonlocality as a resource. New families of inequalities for binary outcomes are presented.

This study draws on deontic justice theory to examine an unexplored socioemotional micro-foundation of corporate social responsibility (CSR), namely anticipated guilt, in an effort to improve our understanding of employees’ moral reactions to their organization’s CSR. We empirically investigate whether environmental CSR induces anticipated guilt (i.e., concerns about future guilt for not contributing to organizational CSR) leading to organizational environmental citizenship behavior. We also consider two boundary conditions related to the social nature of anticipated guilt: line manager support for the (...) environment and negative environmental group norms. To test our hypotheses, we analyzed data from a convenience sample of 503 managers working in Mexican organizations, using Latent Moderated Structural equation modeling. Overall, our results support the deontic argument that employees care about CSR because CSR embodies moral concerns. Specifically, our findings show that efforts to avoid a guilty conscience increase when the line manager provides increased resources and control to act for the environment, and when group members do not care for the environment, suggesting that employees feel they have to compensate for their group’s moral failure. During the Covid-19 pandemic, a considerable amount of people seem to have been lured into believing in conspiracy theories. These people deliberately disregard expert advice by virologists and physicians concerning social behaviour that is aimed at reducing the number of new infections. Disregarding traditional experts and their advice is just one example of what, in the philosophy of science, is referred to as a crisis of expertise – the phenomenon whereby people seem to have lost their trust in traditional expert (...) advice and are looking for alternatives. In the following paper, the trend to use Internet technology as an epistemic alternative will be analysed in detail by investigating the question of whether the Internet really allows people to become epistemically more autonomous. The focus will be on the epistemic and moral vulnerability of people resorting to new media tools instead of relying on traditional expert opinion. It will be shown that some important presuppositions about the Internet and, in particular, social media tools as alternative ways to collect information and find emotional support in a group of like-minded people cannot be maintained. This Article draws attention to a conceptual point that has been overlooked in recent discussions about the theoretical foundations of contract law. I argue that, rather than enforcing the obligations of promises, contract law concerns complaints against promissory wrongs. This conceptual distinction is easy to miss. If one assumes that complaints arise whenever an obligation has been violated, then the distinction does not seem meaningful. I show, however, that an obligation can be breached without giving rise to a valid complaint. (...) This Article illustrates the importance of this conceptual distinction by focusing first on the doctrine of substantive unconscionability. I claim that the doctrine can be best explained by the way in which a party who engages in exploitative behavior may lose her moral standing to complain. It is because such a party has lost her moral standing to complain that the law, through unconscionability doctrine, bars her from bringing a legal complaint. This explanation avoids the oft-issued charge of paternalism and it also offers benefits over an alternative state-oriented account developed recently by Seana Shiffrin. Using the conceptual distinction behind this account of unconscionability, this Article further argues that recent theoretical debates about the relationship between contract law and morality have been largely misconceived. Those debates have focused on whether contract law and morality impose parallel obligations. Once one appreciates the difference between imposing obligations and recognizing complaints, the comparison looks quite different. Contract law recognizes valid complaints against broken promises, much as morality recognizes moral complaints. (shrink)

In the third edition of ‘Practical Ethics’ (2011), Peter Singer reexamines the so-called “replaceability argument,” according to which merely sentient beings, as opposed to persons (self-conscious and with a robust sense of time), are replaceable—it is in principle permissible to kill them provided that they live pleasant lives that they would not have had otherwise and that they be replaced by equally happy beings. On this view, existence is a benefit and death is not a harm. Singer’s challenge is to (...) avoid (i) the replaceability of persons while preserving the replaceability of merely sentient beings, (ii) the implication that parents are morally required to procreate if they can have happy children, and (iii) to do avoid these implications without having the proposed solution (the “debit view” of preferences) imply negative utilitarianism, or the conclusion that a nonsentient universe is better than any sentient universe. I review Singer’s changing views since 1975 and I argue that his attempt to avoid the replaceability of persons fails: either both non-persons and persons are replaceable or neither are. Singer can only avoid this conclusion by appealing to controversial metaethical claims (attitude-independent moral objectivism) and/or giving up on essential features of utilitarianism. (shrink)

This paper challenges a widespread, if tacit, assumption of animal ethics, namely, that the only properties of entities that matter to their moral status are intrinsic, cross‐specific properties—typically psychological capacities. According to moral individualism (Rachels 1990; McMahan 2002; 2005), the moral status of an individual, and how to treat him or her, should only be a function of his or her individual properties. I focus on the fundamental assumption of moral individualism, which I call intrinsicalism. On the challenged view, pigs, (...) puppies and babies, insofar as they are intrinsically similar in morally relevant respects are equally deserving of having their interests satisfied (Norcross 2004). Moreover, relationships—merely agent-relative—are assumed to be irrelevant to moral status. I argue that, while some intrinsic properties are indeed fundamentally relevant, the principled exclusion of extrinsic properties (in virtue of extrinsicness) is unwarranted. From uncontroversial assumptions about supervenience, final value, and moral status, I argue for the relevance of extrinsic properties to moral status based on vulnerability and “reasonable partiality”, as illustrated by pet-keeping. The διακριτικὴ τέχνη (the art of separating or discriminating), from which the sixth definition of theSophiststarts (226b1–231b9), is puzzling.Prima faciethe art of separating does not fit the initial division of art between ποιητικὴ τέχνη (production) and κτητικὴ τέχνη (acquisition) at 219a8–c9. Therefore, scholars generally agree that, although mutually exclusive, ποιητική and κτητική are not exhaustive and leave room for a third species of art, διακριτικὴ τέχνη, on a par with ποιητική and κτητική. However, I argue that textual evidence suggests otherwise.

I examine the two-level utilitarian case for humane animal agriculture (by R. M. Hare and Gary Varner) and argue that it fails on its own terms. The case states that, at the ‘intuitive level’ of moral thinking, we can justify raising and killing animals for food, regarding them as replaceable, while treating them with respect. I show that two-level utilitarianism supports, instead, alternatives to animal agriculture. First, the case for humane animal agriculture does not follow from a commitment to two-level (...) utilitarianism combined with a commitment to respecting animal lives. Secondly, the two-level utilitarian case falls prey to a compartmentalization problem and cannot uphold both respect and replaceability. What I call ‘humane lives’ are not appropriately valued by the lights of two-level utilitarianism itself. (shrink)

This Article describes a jurisprudential puzzle—what I call the puzzle of the beneficiary’s bargain—and contends that adequately resolving this puzzle will require significant revisions to basic premises of contract law. The puzzle arises when one party enters into two contracts requiring the same performance, and the promisee of the second contract is the third-party beneficiary of the first. For example, a taxi driver contracts with a woman to transport her parents from the airport next week, and then the driver separately (...) enters a contract with the parents to transport them when the time comes. Is the second contract valid and enforceable, or does it fail for lack of consideration? This specific question—on which courts have split—implicates several important contract law doctrines. Moreover, it highlights a deep tension in our modern understanding of contractual obligation. This Article argues that adequately resolving the puzzle necessitates a general reconsideration of the relationship between rights and liability in contract law. Surprisingly, the best solution requires abandoning the foundational understanding that contract liability arises out of breach of a promisee’s right to performance. The puzzle thus offers a lens through which to examine—and even revise—the central concepts of modern contract law. (shrink)

Despite the criticism of Karl Popper's falsifiability theory for the demarcation between science and non-science, mainly pseudo-science, this criterion is still very useful, and perfectly valid after it was perfected by Popper and his followers. Moreover, even in his original version, considered by Lakatos as "dogmatic", Popper did not assert that this methodology is an absolute demarcation criterion: a single counter-example is not enough to falsify a theory; a theory can legitimately be saved from falsification by introducing an auxiliary hypothesis. (...) Compared to Kuhn's theory of revolutions, which he himself later dissociated from it transforming it into a theory of "micro-revolutions," I consider that Popper's demarcation methodology, along with the subsequent development proposed by him, including the corroboration and the verisimilitude, though imperfect, is not only valid today, but it is still the best demarcation methodology. For argumentation, I used the main works of Popper dealing with this issue, and his main critics and supporters. After a brief presentation of Karl Popper, and an introduction to the demarcation problem and the falsification methodology, I review the main criticisms and the arguments of his supporters, emphasizing the idea that Popper has never put the sign of equality between falsification and rejection. Finally, I present my own conclusions on this issue. The distinction between personal and subpersonal levels of psychological explanation has proved useful in order to differentiate ways of understanding human behavior. Yet little has been discussed about how these kinds of explanations would work in making sense non-animals’ intelligent behavior. In this paper I assess the main characterizations of personal and subpersonal explanations and how they could be applied in interpreting animal behavior in a scientific setting. Specifically, my claim is that personal level explanation is especially relevant to explain (...) human actions as singular events. Through this, I will argue that instances of animal behavior can potentially be taken as singular events in the same way in which we take human action to be. Thus, personal level explanation plays an important role in behavioral sciences of non-human animals. -/- La distinción entre los niveles personal y subpersonal de explicación psicológica ha resultado de gran utilidad para diferenciar distintos modos de comprender el comportamiento humano. La discusión teórica en torno a la distinción se ha enfocado particularmente en torno a cómo caracterizar el nivel personal. Sin embargo, poco se ha dicho sobre cómo estas explicaciones operarían a la hora de hacer inteligible el comportamiento inteligente de animales no humanos. En este trabajo analizo las principales caracterizaciones que se han dado de las explicaciones de nivel personal y cómo éstas aplicarían a la interpretación del comportamiento animal en contextos científicos. Específicamente, defenderé que las explicaciones de nivel personal son especialmente relevantes para explicar las acciones humanas en tanto eventos singulares. A partir de esto, argumentaré que también los comportamientos animales pueden potencialmente ser eventos singulares como lo son las acciones humanas. Así, las explicaciones de nivel personal juegan un rol importante en las ciencias del comportamiento animal. (shrink)

Commentary on Shawn Thompson's "Supporting Ape Rights". My response to Wise’s and Thompson’s strategy is two-fold: 1) personhood is neither strictly deter-mined by cognitive facts nor fruitfully construed in Kantian terms, and 2) personhood is not what matters when it comes to animal protection. To conclude, 3) I hint at an alternative, or complementary, avenue for change.

This thesis explores the role and nature of intuition in philosophical inquiry. Appeals to intuition have either been used as evidence for or against philosophical theories or as constitutive features of judgement. I attempt to understand our uses of intuition by appealing to tacit knowledge. The hope is to elicit a picture of intuition as being practical and explanatory. Our reliance on intuition is warranted if we understand it as an expression of tacit knowledge.

Starting from the typical case of utilitarianism, I distinguish three ways a moral theory may be deemed (over-)demanding: practical, epistemic, and cognitive. I focus on the latter, whose specific nature has been overlooked. Taking animal ethics as a case study, I argue that knowledge of human cognition is critical to spelling out moral theories (including their implications) that are accessible and acceptable to the greatest number of agents. In a nutshell: knowing more about our cognitive apparatus with a view to (...) play better with it. This meta-theoretical suggestion, however, differs from a classical objection drawn from the intuition that a given theory demands too much. -/- //// A partir du cas typique de l’utilitarisme, je distingue trois façons dont une théorie morale pourrait être jugée (trop) exigeante : pratique, épistémique et cognitive. This article outlines a “descriptive animal ethics” based on the study of people’s intuitions about particular cases, in order to determine which moral theories best comport with those intuitions. I suggest that the latter need not be unreliable since they may be endorsed as considered judgments, and that even if they were, knowing them would still provide relevant information for a complete moral theory concerned with what moral agents can do. I describe a survey in descriptive ethics, discuss the results, (...) and introduce prospective experiments. I then set forth hypotheses and propose a dual model of moral status attribution in terms of both intrinsic and extrinsic properties. I rely on recent empirical research in psychology and experimental philosophy, which I confront with the above results, to support my hypotheses. The model predicts that attributions vary depending on the capacities of entities, their context (including relationships), and the context of the attributor. These facts of descriptive ethics, I conclude, are directly relevant to normative ethics insofar as our cognitive apparatus constrains our ability to act morally. Within the phenomenological perspective the reductive method, as proceeding through the path (µετα-οδός), allows the subject to refer to its own living structure. It is crucial to bring outthe aware character of this relationship, because such consciousness is achieved by an unawaresubjectivity. Since the subject arises ab initio in a hyletic-temporal field, it has to carry out itsmethodological procedure according to definite modes, that is the time-consciousness’ modes. The method of reduction, which aims to uncover what is not thematic, constitutes (...) the radicalaction, which permits the subject to represent the way of being of its inner structure. In thissense, the reduction is the highest act of representation ( Vergegenwärtigung ), because its proce-dure takes place by a thematizing return of the subject to itself. To carry out the reductivemethod, i.e. to perform a self-unveiling, the subject has to follow the patterns of a pre-existentlife, which are already temporal and to which it always is related. One of the most disputed controversy over the priority of scientific discoveries is that of the law of universal gravitation, between Isaac Newton and Robert Hooke. Hooke accused Newton of plagiarism, of taking over his ideas expressed in previous works. In this paper I try to show, on the basis of previous analysis, that both scientists were wrong: Robert Hooke because his theory was basically only ideas that would never have materialized without Isaac Newton's mathematical support; and the latter was (...) wrong by not recognizing Hooke's ideas in drawing up the theory of gravity. Moreover, after Hooke's death and taking over the Royal Society presidency, Newton removed from the institution any trace of the former president Robert Hooke. For this, I detail the accusations and arguments of each of the parts, and how this dispute was perceived by the contemporaries of the two scientists.
