Two experiments with undergraduates as subjects were carried out with the aim of replicating and extending previous results showing that the implication of the behavioral life-cycle hypothesis (H. M. Shefrin & R. H. Thaler, 1988) that people classify assets in different mental accounts (current income, current assets, and future income) may explain how consumption choices are influenced by temporary income changes. In both experiments subjects made fictitious choices between paying for a good in cash or according to a more expensive (...) installment plan after they had received an income which was either less, the same, or larger than usual. In Experiment 1 subjects were supposed to have savings so that the total assets were equal, whereas in Experiment 2 the total assets varied. The results of both experiments supported the role of mental accounts in demonstrating that subjects were unwilling to pay in cash after an income decrease even though they had access to saved money. Thus, in effect they chose to pay more for the good than they had to. Indicating a need for further refinement of the concept of mental account, choices to pay in cash after an income decrease tended to be more frequent when the consumption and savings motives were compatible than when they were incompatible. Furthermore, increasing the total assets made subjects more willing to pay in cash after an income decrease. (shrink)

Two experiments with undergraduates as subjects tested explanations of how a prior temporary income change influences choices between buying and deferred buying. In Experiment 1 predictions from the behavioral life-cycle theory (Shefrin & Thaler, 1988), the renewable resources model (Linville & Fischer, 1991) and the loss-sensitivity principle (Garling & Romanus, 1997) were contrasted. The results are inconsistent with the latter two explanations since the framing of buying as positive (buying a new model of a product) or negative (replacing a broken (...) product) did not interact with the income change. Congruent with the behavioral life-cycle theory, willingness to buy was greater when subjects received a temporary income increase than when they received a temporary income decrease although total assets were equal. Further support for the behavioral life-cycle theory is obtained in Experiment 2 where four income-change conditions and durable and nondurable goods are compared. (shrink)

Does Normative Behaviourism Offer an Alternative Methodology in Political Theory?

The life-cycle theory of saving behavior (Modigliani, 1988) suggests that humans strive towards an equal intertemporal distribution of wealth. However, behavioral life-cycle theory (Shefrin & Thaler, 1988) proposes that people use self-control heuristics to postpone wealth until later in life. According to this theory, people use a system of cognitive budgeting known as mental accounting. In the present study it was found that mental accounts were used differently depending on if the income change was positive or negative. This was shown (...) both in a representative nationwide sample of households and in a student sample. Respondents were more willing to cut down on their propensity to consume when faced with an income decrease than to raise it when the income increased. Furthermore, contrary to the predictions of behavioral life-cycle theory, it was found that the respondents adjusted their propensity to consume the most when the income increases or decreases took place immediately. Hence, it is suggested that theories of intertemporal choice (e.g., Loewenstein, 1988; Loewenstein & Prelec, 1992) provide a better account of the data than does the behavioral lifecycle theory. What is to be learned from the chaotic downfall of the Weimar Republic and the erosion of European liberal statehood in the interwar period vis-a-vis the ongoing European crisis? This book analyses and explains the recurrent emergence of crises in European societies. It asks how previous crises can inform our understanding of the present crisis. The particular perspective advanced is that these crises not only are economic and social crises, but must also be understood as crises of public power, order (...) and authority. In other words, it argues that substantial challenges to the functional and normative setup of democracy and the rule of law were central to the emergence and the unfolding of these crises. The book draws on and adds to the rich ’crises literature’ developed within the critical theory tradition to outline a conceptual framework for understanding what societal crises are. The central idea is that societal crises represent a discrepancy between the unfolding of social processes and the institutional frameworks that have been established to normatively stabilize such processes. The crises at issue emerged in periods characterized by strong social, economic and technological transformations as well as situations of political upheaval. As such, the crises represented moments where the existing functional and normative grid of society, as embodied in notions of public order and authority, were severely challenged and in many instances undermined. Intertemporal choice is the study of how people make choices about what and how much to do at various points in time, when choices at one time influence the possibilities available at other points in time. These choices are influenced by the relative value people assign to two or more payoffs at different points in time. Most choices require decision-makers to trade off costs and benefits at different points in time. These decisions may be about savings, work effort, education, nutrition, (...) exercise, health care and so forth. Since early in the twentieth century, economists have analyzed intertemporal decisions using the discounted utility model, which assumes that people evaluate the pleasures and pains resulting from a decision in much the same way that financial markets evaluate losses and gains, exponentially 'discounting' the value of outcomes according to how delayed they are in time. Discounted utility has been used to describe how people actually make intertemporal choices and it has been used as a tool for public policy. Policy decisions about how much to spend on research and development, health and education all depend on the discount rate used to analyze the decision. (shrink)

Mental accounting is a concept associated with the work of Richard Thaler. According to Thaler, people think of value in relative rather than absolute terms. They derive pleasure not just from an object’s value, but also the quality of the deal – its transaction utility (Thaler, 1985). In addition, humans often fail to fully consider opportunity costs (tradeoffs) and are susceptible to the sunk cost fallacy. Why are people willing to spend more when they pay with a credit card than (...) cash (Prelec & Simester, 2001)? Why would more individuals spend $10 on a theater ticket if they had just lost a $10 bill than if they had to replace a lost ticket worth $10 (Kahneman & Tversky, 1984)? Why are people more likely to spend a small inheritance and invest a large one (Thaler, 1985)? According to the theory of mental accounting, people treat money differently, depending on factors such as the money’s origin and intended use, rather than thinking of it in terms of the “bottom line” as in formal accounting (Thaler, 1999). An important term underlying the theory is fungibility, the fact that all money is interchangable and has no labels. In mental accounting, people treat assets as less fungible than they really are. Even seasoned investors are susceptible to this bias when they view recent gains as disposable “house money” (Thaler & Johnson, 1990) that can be used in high-risk investments. Priority setting in health care is ubiquitous and health authorities are increasingly recognising the need for priority setting guidelines to ensure efficient, fair, and equitable resource allocation. While cost-effectiveness concerns seem to dominate many policies, the tension between utilitarian and deontological concerns is salient to many, and various severity criteria appear to fill this gap. Severity, then, must be subjected to rigorous ethical and philosophical analysis. Here we first give a brief history of the path to today’s severity criteria in (...) Norway and Sweden. The Scandinavian perspective on severity might be conducive to the international discussion, given its long-standing use as a priority setting criterion, despite having reached rather different conclusions so far. We then argue that severity can be viewed as a multidimensional concept, drawing on accounts of need, urgency, fairness, duty to save lives, and human dignity. Such concerns will often be relative to local mores, and the weighting placed on the various dimensions cannot be expected to be fixed. Thirdly, we present what we think are the most pertinent questions to answer about severity in order to facilitate decision making in the coming years of increased scarcity, and to further the understanding of underlying assumptions and values that go into these decisions. We conclude that severity is poorly understood, and that the topic needs substantial further inquiry; thus we hope this article may set a challenging and important research agenda. (shrink)

In his paper “Palladium of the People – A Kantian Right to Internet Access”, Christopher Buckman argues for internet access as a universal right. He bases his argumentation on the potential of social media, which has clearly proven itself to be a wrong assumption. This paper builds on his argumentation, but uses the concept of the Fediverse – a decentralized alternative to closed social media platforms – instead of traditional social media to argue for universal internet access, by this completing (...) his argument and additionally, leading to a Kantian right to Fediverse access and three follow-up questions: What are reasonable ways to achieve universal Fediverse Access? How can we act morally in the Fediverse? How can the Fediverse itself become and stay moral – and implicitly through this: how could the Fediverse contribute to a moral world? (shrink)

Uncertainty, insufficient information or information of poor quality, limited cognitive capacity and time, along with value conflicts and ethical considerations, are all aspects thatmake risk managementand riskcommunication difficult. This paper provides a review of different risk concepts and describes how these influence risk management, communication and planning in relation to forest ecosystem services. Based on the review and results of empirical studies, we suggest that personal assessment of risk is decisive in the management of forest ecosystem services. The results are (...) used together with a reviewof different principles of the distribution of risk to propose an approach to risk communication that is effective aswell as ethically sound. Knowledge of heuristics and mutual information on both beliefs and desires are important in the proposed risk communication approach. Such knowledge provides an opportunity for relevant information exchange, so that gaps in personal knowledge maps can be filled in and effective risk communication can be promoted. (shrink)

During the 19th and the 20th century the concept of system undergoes significant transformations. The interplay of biology and sociology gives rise to an olistic definition of the concept, in order to understand society by means of schemes developed in the field of theoris of organisms. It is possible to follow this development from Pareto and Henderson, to Parsons, and finally to Luhmann, by examining the various biological models to which they refer.

Der Artikel diskutiert Niklas Luhmanns Konzeption von Kommunikation als emergentem Phänomen. Erstens soll gezeigt werden, dass sich Luhmann, entgegen jüngster Einwände, in der Tat als sozialer Emergentist rekonstruieren und als solcher in die aktuelle Debatte um Reduktion und Emergenz des Sozialen einordnen lässt. Zweitens soll dadurch Licht auf die generellen Probleme und Voraussetzungen einer emergentistischen Soziologie geworfen werden. Um diese Ziele zu erreichen, wird zunächst geklärt, welche Positionen sich in der Soziologie grundsätzlich gegenüber stehen und auf welcher Grundlage Luhmann (...) als Emergentist einzuordnen ist. Anschließend soll die Emergenz der Kommunikation als eigenständiges soziales Phänomen erläutert und ins Verhältnis zum Individuum gesetzt werden. Schließlich wird Luhmanns Konzeption mit Hilfe einiger Adäquatheitsbedingungen aus der allgemeinen Wissenschaftsphilosophie als unzureichend kritisiert. Ziel ist dabei auch die Klärung der Bedingungen für eine plausible Emergenztheorie innerhalb der Soziologie. Nach einer abschließenden Zusammenfassung der wesentlichen Ergebnisse soll ein Ausblick auf eine aussichtsreiche soziologische Emergenzkonzeption geboten werden. (shrink)

O anseio deste artigo acadêmico é introduzir os conceitos gerais da teoria de sistemas de Niklas Luhmann. Para atingir seus objetivos, esta teoria é hermética e filosófica, com uma ampla gama de definições e busca apresentar um conjunto de conceitos que proporcionem um suporte adequado para a sociedade como um todo. Luhmann abordou a questão da complexidade em vários estudos e desenvolveu uma metodologia baseada em uma noção de sistemas autopoiéticos, funcionalmente fechados e distintos. A observação de segunda ordem (...) é um dos conceitos centrais da teoria de sistemas de Luhmann, assim como a comunicação é elemento importante na formação dos sistemas sociais e na sua distinção de outros sistemas existentes. O método utilizado na presente pesquisa foi uma revisão qualitativa de literatura acadêmica sobre o assunto. (shrink)

The article aims at contrasting the autopoietic understanding of an individual and her or his actions as described by Niklas Luhmann with Paul Ricoeur’s notion of narrative identity, focusing on people as legal subjects. The article assumes that when legal subjects necessitate ethical engagement and evaluation, the law could cease to deal with problems in a mere legalistic fashion but is allowed the freedom to appeal to norms of justice external to itself as in other natural law theories. Eva Erman and Niklas Möller have recently presented a trenchant critique of my (2015) argument that ideal normative theories are uninformative for certain practical purposes. Their criticisms are largely correct. In this note, I develop the ideas behind my earlier argument in a way that circumvents their critique and explains more clearly why ideal theory is uninformative for certain purposes while leaving open the possibility that it might be informative for other purposes.

Aslına bakılırsa gündelik yaşam mücadelesi içinde hemen herkes anbean gündelik dilin mantıksızlığıyla da mücadele halindedir. Bu halin göstergesi olan tavır ve tutumlara odaklandığımızda ortak değerler üzerinden bir mücadele için, kendimize ve başkalarına yapabilirlikler yaratan alıştırmalar önerebiliyor muyuz? Başkalarının önerdiği yaratıcı ve yapabilirlikler belirleyen alıştırmaların farkına varabiliyor muyuz?

Bu çalışmada bilginin kazandığı doğru nitelemesi ve bilimsel bilgide doğrunun bir dogma haline gelmesi, kökenleriyle birlikte tartışılacaktır. Bu hususta Karl Popper'ın yanlışlamacı bilim imgesinin anlatıldığı bu çalışmada ikili bir yol izlenecektir. İlki; Popper'ın neye, neden karşı çıktığı üzerine, ikincisi ise bu karşı çıkış sonucunda açılan boşluğun nasıl doldurulduğudur. Dolayısıyla birinci aşama Popper açısından geleneksel imgeye yapılan bir kritik niteliğinde olurken, ikinci aşama ise Poppercı bilim imgesinin serimlendiği bölümü oluşturacaktır. Nihayetinde Popper yenilikleriyle bilimsel düşünüşe yeni bir soluk getirirken, son bölümde sisteminin (...) ne gibi eksiklikler barındırdığı tartışılacaktır. Bu eksiklikler ise Ayer ve Duhem-Quine tezi ile sırasıyla yanlışlamanın mantıksal olarak imkânsızlığı ve kuramın yanlışlanmasında holistik yaklaşımın gerekliliğini kapsayacaktır. (shrink)

Ölümcül Hastalık Umutsuzluk adlı eserinde umutsuzluğu, ben’in bir hastalığı ve kendine yönelen bir ilişkinin sonucu olarak ele alan Danimarkalı filozof Søren Aabye Kierkegaard, bu hastalığın kişide üç farklı şekilde görülebileceğini öne sürmüştür: “(a) bir ben’i olduğunun farkında olmayan umutsuz kişi, (b) kendisi olmak isteyen umutsuz kişi ve (c) kendisi olmak istemeyen umutsuz kişi.” Kierkegaard’a göre kendi ben’ininden kurtulmak isteyen kişi, “olmak istediği ben” hâline gelemediği için olduğu ben’ine katlanamamakta ve bu nedenle umutsuzluk yaşamaktadır. Bu çalışma kapsamında Kierkegaard’ın benlik ve umutsuzluk (...) ilişkisi üzerine yaptığı bu tespitin, sosyal psikoloji alanının önde gelen araştırmacılarından biri olan Edward Tory Higgins’ın Benlik Uyuşmazlıkları Kuramı üzerinden okunabileceği öngörülmektedir. Higgins, geliştirdiği kuramda çoklu bir benlik ayrımına gitmekte ve benliği gerçek benlik, ideal benlik ve olması gereken benlik olmak üzere üç alana ayırmaktadır. Bu ayrıma göre gerçek benlik, kişinin sahip olduğunu düşündüğü özelliklerin; ideal benlik, kişinin kendisi olmak için idealde sahip olmayı arzu ettiği özelliklerin; olması gereken benlik ise kişinin taşımak zorunda olduğunu düşündüğü özelliklerin bir bütününü temsil etmektedir. Söz konusu özellikler, kişinin kendi kişisel bakış açısına dayalı olabileceği gibi başkalarının bakış açısından da kaynaklanabilmektedir. Higgins’a göre ikili benlik durumları arasındaki uyuşmazlık (örneğin gerçek benlik-ideal benlik ya da gerçek benlik-olması gereken benlik) kişide, kendi beklentilerini ya da başkalarının beklentilerini karşılamada yetersiz kaldığı yönünde negatif duyuşlar yaratmaktadır. Bu duyuşlar arasında depresyonun bir parçası olan umutsuzluk da yer almaktadır. Şimdiki çalışma Kierkegaard’ın tasvir ettiği “olmak istediği ben hâline gelemediği için olduğu ben’ine katlanamayıp umutsuzluğa yakalanan” kişinin içinde bulunduğu durumu, Higgins’ın öne sürdüğü “gerçek benlik-ideal benlik uyuşmazlığının depresyonla (dolayısıyla umutsuzlukla) ilişkili olabileceği” argümanıyla ilişkili bir biçimde ele almayı ve bu yolla benlik ve umutsuzluk ilişkisini felsefe ve psikoloji disiplinlerinin kesişiminde incelemeyi amaçlamaktadır. İlk kez derli toplu bir biçimde Aydınlanma Çağının en önemli ve etkili filozofu İmmanuel Kant’ın dillendirdiği evrensel ahlâk yasası uyarınca insan öyle eylemelidir ki, davranışıyla insanı araç haline getirmesin. Kültürden, toplumun koşullarından, geleneklerden ve dinsel etkilerden arındırılmış bu ilkenin buyurganlığı herhangi bir koşul ya da sınır tanımamasıyla ünlüdür. Oysa insanlar, hem bireysel hem de toplumsal gerekçelerle bu formel ilkeyle kendilerini her zaman bir çekişme içinde bulurlar. Kant’ın ahlâk anlayışı açısından etik değerlerin herhangi bir kültürel, toplumsal ya da siyasal baskı ya (...) da ilgi içerisinde anlaşılmaması gerekir. Bu ilke(ler) evrenseldir; ulusal ya da yerel çerçeveyle sınırlı görülemezler. Oysa özellikle ulusal sınırlarla belirlenmiş topraklarda yaşayan toplumlann kendi kültürlerinden geleneklerinden süzülerek gelen değerler her zaman bu evrensel ilkelerle uyum içinde değildirler. Aralarında gerilim arttığında genellikle evrensel ilkeler lehinde çözüme gidilmek istenir. Yani yerel değerler yeniden anlamlandırılır. Toplumlann örgütlenmesinde rol oynayan faktörlerin pek çoğunun devredışı bırakılmasının nedeni bunlann, sorunlan çözmekten ziyade artırdığının apaçık olmasıdır. Söz gelişi Ortaçağ boyunca Avrupa’da yaşanmış mezhep çatışmalan, ahlâk ilkelerininin dinsel değerler tarafından tanımlanmasının önündeki en büyük engeldir. Kant’m ahlâk felsefesinin Hıristiyanlık idealleri üzerine kurulmadığı apaçıktır, lyi’nin kökeninde günah/sevap ya da kutsal metinlerin buyurganlığı yoktur. Bunun böyle olmasının bir nedeni de ortaçağlar boyunca Avrupa’da yaşanmış olduğunu gözlemlediğimiz dinsel çatışmalann ahlâk ilkelerinin evrenselleşmesini önlemesidir. İyi ya da doğrunun belirli bir inanç sisteminin önceliklerine terk edilmesi fanatizmi azaltacağına güçlendirmiştir. Yani iyi bir Hıristiyan olmak iyi ahlâklı bir insan olmaktan önce gelmesi eleştirilmektedir. Kısacası ahlâkın temeline dinsel bir dayanak yerleştirmektense, aklı koyan bir yaklaşım söz konusudur. Dinsel çatışmalar bu tercihin yapılmasını kolaylaştırmıştır. Bu noktada ulusal değerler çok daha büyük güçlükler doğurmaktadır; çünkü tarihin kaydettiği olaylar, homojen bir değerler bütünlüğü olmadığım düşündürmektedir. Sonuç olarak, evrensel bir ahlâk ilkesine duyulan ihtiyaç ile içinde yaşadığımız çağın gerçekleri arasındaki makasın açılması tepeden dayatma tehlikesini artırırken, makasın kapanması toplumsal ilerlemenin ve gelişmenin meşruluğuna katkıda bulunmaktadır. Bu bildiride evrensel ilkelerin yerel değerleri anlamlandırmasının olanaklılığı, Kant’ın ahlâk felsefesi model alınarak sorgulanacaktır. (shrink)

Mantık, yirminci yüzyıldaki gelişimi bakımından ele alındığında, matematik, bilgisayar bilimi, dilbilim ve felsefe gibi alanlarla sıkı kavramsal bağlantılar kuran bir disiplin haline gelmiştir. Tüm bu alanların gündelik dilde izi sürülen anlamalar, anlaşmalar, anlatmalar vb. edimler için birşeyler söyleyebileceğini ya da yapabileceğini varsayabiliriz. Ancak bu varsayım gündelik dilin mantığıyla ya da mantıksızlıklarıyla doğrudan başedebilecek bir anlama yetisi kazanmanın kolay bir yolu olduğu anlamına gelmez. Modern mantık matematikseldir ve gündelik dilde bir kolaylık sağlamaz; aksine işleri olduğundan da karmaşık hale getirir.

Sinizm, Antik Yunan’a dayanan bir kavramdır ancak son yıllarda farklı disiplinlere konu olmaya başlamıştır. Dünyevi her şeyin, mutluluğun önündeki engel olduğuna ve erdemin mutluluğa giden en yüksek ve en biricik değer olduğuna inanan Kinik Okulu ile ortaya çıkmış bu felsefi görüş, zamanla bağlamından uzaklaşmıştır. Günümüzde sinizm, kötümser ve güvensiz bireyleri tanımlayan bir anlam kazanmıştır (Dhar, 2009). Tüketici sinizmi ise bu bakış açısının işletmelere yansıyan şeklidir. İşletmelerin kendi çıkarları doğrultusunda hareket ettiğine, tüketicilerin istek ve ihtiyaçlarını önemsemediklerine ve hatta hilekâr olduklarına yönelik (...) bu inanç, doğal olarak bu tüketicilerin tüketim davranışlarına da yansımaktadır. Referans gruplarının etkili gücü ise dijital ortamların sunduğu imkânlarla güçlenerek tüketici sinizminin yayılmasını kolaylaştırmaktadır. Bu nedenle tüketici sinizmi, işletmelerin ve araştırmacıların titizlikle üzerinde durmaları gereken bir konu haline gelmiştir. Eski bir tarihi olmasına rağmen son yıllarda fark edilen bu kavram pazarlama dünyasında da yeni yeni yerini bulmaktadır. (shrink)

Hristiyan inancı içerisinde merkezi konuma sahip olan mevzulardan birisi de, İsa’nın ölümünden üç gün sonra diriltildiğine yönelik olan inançtır. Hristiyan eskatolojisinin de dayanak noktasını oluşturan bu mevzu, dinler tarihi ya da teoloji gibi disiplinlerin içerisinde tartışıldığı gibi, çeşitli Hristiyan düşünürlerce, din felsefesi disiplini içerisinde de tartışılmıştır. Din felsefesi açısından bakıldığında, konunun merkezi konumda olması, bu mevzunun rasyonel bir zeminde tartışılıp tartışılamayacağını da beraberinde getirmektedir. Bu bağlamda, özellikle din felsefesi içerisinde birçok Hristiyan düşünür tarafından konu ele alınmış ve farklı çevrelerce de (...) mevzuya yönelik karşı itirazlar dile getirilmiştir. Bu noktada yapılan tartışmaların içeriğine baktığımızda, mucize kavramı önem taşımakla birlikte, Hristiyan düşünürlerin argüman haline getirdikleri ve bir delil olarak öne sürdükleri “Boş mezar” ve “Tanıklıklar gibi birçok farklı husususun din felsefesi açısından tartışıldığını söyleyebiliriz. Ayrıca bazı ateist düşünürlerin bu delillere yönelik itirazları olmakla birlikte, bazı Hristiyan tarihçilerinde konuya ilişkin ciddi itirazları bulunmaktadır. Biz de bu makalemizde, İsa’nın ölümünden sonra dirilişinin rasyonel bir şekilde izahının nasıl olabileceği sorusunu merkeze alıp, konuyu Hristiyan düşünürlerin bakış açısından değerlendirmeye çalıştık. Bu noktada İslam gibi farklı dinlerde ve farklı anlatılarda karşımıza çıkan Hz. İsa figürünü konumuzun dışında tuttuğumuzu ayrıca belirtelim. Çünkü bizim yazımızın konusunu oluşturan kişi Hristiyan inancındaki İsa ve bu din içerisinde önem taşıyan kutsal metinler ve bu metinlerde geçen anlatılar oldu. Bu açıdan bakıldığında yazımız içerisinde, konuya ilişkin doğrudan bir teoloji ya da dinler tarihi çerçevesinde değerlendirme yapmaktan çok, din felsefesi içerisinde bize sunulan tartışmalardan yola çıkarak eleştirilerimizi ve tahlillerimizi dile getirmeye çalıştığımızı ifade edebiliriz. Quine’s “Epistemology Naturalized” is the locus classicus of naturalism in epistemology. Many traditional epistemologists criticized the naturalization of epistemology specifically targeting this article. The critics argue that Quine abolishes the normativity of epistemology. For he proposes epistemology as a chapter of psychology. Laudan, like Quine, believes that epistemology should be naturalized. However, he criticizes Quine’s project of naturalization for similar reasons as Quine’s critics. Instead, he proposes a new project that he calls “normative naturalism”. In this work, I will first (...) argue against the critics of Quine and then argue that both Quine’s and Laudan’s naturalized epistemologies are hypothetically normative. -/- Quine’ın “Epistemology Naturalized” başlıklı makalesi epistemolojide doğallaştırma düşüncesinin klasik yapıtıdır. Pek çok geleneksel bilgi kuramcısı özellikle bu makaleyi hedef alarak epistemolojinin doğallaştırılmasını eleştirmiştir. Eleştirilerin odağında Quine’ın, psikolojinin bir alt bölümü haline getirerek, epistemolojinin normatifliğini ortadan kaldırdığı savı yer almaktadır. Laudan epistemolojide doğallaştırmanın gerekli olduğunu savunmasına karşın Quine’a yöneltilen bu eleştiriye katılmakta ve “normatif doğalcılık” adını verdiği yeni bir epistemolojik yaklaşım önermektedir. “1950’li yıllarda dönemin büyük felsefecileri arasında dinsel inancı savunan bir kişi bile yoktu. 1990’lı yıllarda Yale’den UCLA’ya, Oxford’dan Heidelberg’e kadar birçok yerde insanın manevi yanını savunan ve geliştiren yüzlerce kitap yazılacak, sel olup akacaktı. Aradaki 40 yıllık süre zarfındaysa sadece ve sadece Alvin Plantinga vardı.” Kelly James Clark Tanrı’nın veya tanrıların varlığı sorusu felsefenin ezeli sorularından biri olagelmişse de Nietzsche’nin Tanrı’nın ölümünü ilan ettiği günden bu yana onu doğrularcasına yaşanan acılar, savaşlar, kötülükler bu konudaki tartışmaların sesini uzun süre bastırdı. Ama (...) özellikle yüzyılın ikinci yarısından sonra palazlanan analitik felsefede meydana gelen “metafiziğe dönüş”, dine yakınlık duyan, en azından dinle ilgilenen filozofların tekrar Yahudi-Hıristiyan ve İslam geleneklerinde anlaşıldığı şekliyle Tanrı’nın varlığına duyulan inancın gerekçelerini yeniden değerlendirmelerine, konuya yeni bir bakış ve araçlarla bakmalarına vesile oldu. Alvin Plantinga’nın bu kitabı, yayımlandığı tarihten itibaren “analitik din felsefesi” alanının da en önemli ve sarsıcı eserlerinden biri hâline geldi ve Tanrı’nın ölmediğini ilan etti. Anselmus’tan Hume’a, Kant ve pozitivistlerden John Mackie gibi modern ateologlara kadar felsefe geleneğiyle hesaplaşan Plantinga, bu abidevi çalışmasında ontolojik, kozmolojik ve teleolojik tanrı kanıtlamalarının eski ve yeni biçimlerinin çıkmazlarını, meziyetlerini ve sunduğu imkânları değerlendiriyor. After the death of Mevlana Celaleddin-i Rumi (d.1273), the cult of Mevlevi continued its structuring. Rumi's son Sultan Veled (d.1312) and his grandson Ulu Arif Çelebi (d.1320) contributed greatly to this structuring. Sultan Veled tried to turn the lodge he took over from his father into a systematic sect around Rumi's mystical thought and Mevlevi disciples. Ulu Arif Çelebi, on the other hand, is a very effective name in organizing Mevleviism as a cult. With his systematic studies and travels, he (...) made Mevlevi's spread in lodges and madrasahs, and he made efforts to teach Masnavi, the work of his grandfather Mevlana Celaleddin Rumi, in madrasahs. In addition, Ulu Arif Çelebi asked Ahmet Eflakî to write a book called Ariflerin Menkıbeleri about Rumi’s life, in order to keep his grandfather's memory alive. The entry of Mevlevi into the Ottoman State was through marriage. Mutahhare Hatun, daughter of Sultan Veled, was married to Süleyman Şah, the Germiyanoğulları leader. Süleyman Şah married the daughter of this marriage, Devlet Hatun, to Yıldırım Beyazıt, and left as a dowry Kütahya, Tavsanlı, Simav and Eğrigöz to Ottoman Empire. Yıldırım Bayezıd was appointed as the governor of Kütahya. Mehmet Çelebi was born from this marriage. The title of Çelebi is a title given to the descendants of Rumi, and Mehmet Çelebi, one of the sultans of the Fetret Period (A period of great depression), was one of the grandchildren of Rumi. The children of Mehmet Çelebi are remembered with the title of 'Çelebi'. Through this marriage, Mevlevi began to spread to the Ottoman Empire. Thus, Mevleviism would prevail in the Ottoman Empire, where Ahilik organization and Ahi culture prevailed, and Mevlevihane and Asitane would be established in many parts of the country with the support of the Ottoman State. Mevlana Celaleddin-i Rumi’nin (ö.1273) ölümünden sonra Mevlevilik bir tarikat olarak yapılanmasını sürdürmüştür. Mevlana’nın oğlu Sultan Veled’in (ö.1312) ve torunu Ulu Arif Çelebi’nin (ö.1320) bu yapılanmada katkısı oldukça büyüktür. Sultan Veled babasından devraldığı dergâhı, Mevlana’nın mistik düşüncesi çerçevesinde ve Mevlevi müritler etrafında sistemli bir tarikat haline getirmeye çalışmıştır. Ulu Arif Çelebi ise Mevleviliği bir tarikat olarak örgütlemede oldukça etkili bir isimdir. O sistematik olarak yaptığı çalışmalar ve seyahatlerle Mevleviliğin tekke, zaviye ve medreselerde yayılmasını sağladığı gibi dedesi Mevlana Celaleddin ’in eseri Mesnevi’nin medreselerde okutulması için de çaba sarf etmiştir. Ayrıca Ulu Arif Çelebi, dedesinin hatırasını canlı tutabilmek Ahmet Eflaki adındaki bir yazıcıya Mevlana’nın hayatını yazdırmıştır. (Ariflerin Menkıbeleri kitabı) Mevleviliğin Osmanlı Devleti’ne girişi evlilik yoluyla olmuştur. Sultan Veled’in kızı Mutahhare Hatun, Germiyanoğulları Beyi Süleyman Şah ile evlidir. Süleyman Şah bu evlilikten olan kızı Devlet Hatun’u Osmanlı Devleti’nin o dönem şehzadesi olan Yıldırım Beyazıt ile evlendirmiş ve çeyiz olarak Kütahya, Tavşanlı, Simav ve Eğrigöz dolaylarını Osmanlılara bırakmıştır. Yıldırım Bayezıd ise Kütahya valiliğine getirilmiştir. Bu evlilikten Mehmet Çelebi dünyaya gelmiştir. Çelebi unvanı Mevlana’nın soyundan gelenlere verilen bir unvandır ve Fetret Dönemi padişahlarından olan Mehmet Çelebi, Mevlana’nın torunlarındandır. Mehmet Çelebi’nin çocukları ‘çelebi’ unvanıyla anılmaktadır. Bu evlilik yoluyla Mevlevilik Osmanlı’da yayılmaya başlamıştır. Böylece daha önce Ahilik teşkilatı ve Ahi kültürünün hâkim olduğu Osmanlı Devleti’ne Mevlevilik hâkim olacak ve Osmanlı Devleti’nin desteğiyle ülkenin birçok yerinde Mevlevihane ve Asitane kurulacaktır. Can transformative law become an ambitious program for rethinking the theoretical basis for our understanding of law and its position in society? A program which explicitly goes beyond emotion and ideology. One way of dealing with both emotion and the devotion to ideology is, as also argued by Karl Mannheim back in 1926, to deploy an analytical lens, i.e. to substitute emotion and ideology with sophisticated theorizing. A form of theorizing which only is possible if deployed while maintaining proper analytical (...) distance to the object matter. On this background one might distinguish between three models of transformative law: Instrumentalization, Political Programming or Normative Selection, with the latter providing a third way between the two hitherto dominant approaches. The double subjectivity of conscience and the need to test conscientious objections -/- Abstract In spite of the collapse of the traditional objective concept of conscience and the subsequent subjectivation of conscience, conscientious objections are still often considered as a valid ground for exemption from legal and professional obligations. Conscientious objections are seen as more serious than ordinary moral objections. It is not evident why this is so. I argue, with Niklas Luhmann, that the function of conscience is to (...) protect the moral core of a person’s identity. Overruling conscientious objections threatens this core. Claims of conscience are usually founded on the right of freedom of conscience. This right is not absolute. I discuss the view of Richard Arneson who rejects the right of freedom of conscience and defends the right against conscience. I agree with Arneson that, at the one hand, conscientious objectors may constitute a threat to the social and legal order when their objections are not recognised and, at the other hand, too easy giving in to conscientious objections may also threaten the viability of social and legal order. That is why it is needed to determine when conscientious objections cannot be taken at face value, but should be subjected to a series of tests. The aim of these tests is to contain the number of objectors. I discuss 6 criteria for determining whether conscientious objections ground an exemption to legal and professional obligations. At the end of the article I discuss the conscientious objections of medical doctors. (shrink)

Science is, if not the most, at least one of the most important human activities which has an undeniable impact on our lives. However, it is a matter of debate that science and its various applications have many negative effects besides their numerous positive contributions. As the negative effects of the science and its applications have become more visible, the science-value relation has regained popularity in the philosophy of science. Precautionary principle is one of the central concepts of the late (...) science-value debates. We first scrutinize the science-value relation, especially whether the science is value-free or value-laden activity, from the perspective of history and philosophy of science, and argue that sciences involve both epistemic and non-epistemic values. Then we introduce the precautionary principle and discuss the possible causes and outcomes of having it as a methodological component of scientific research. Finally, we argue that, if the science-value relation can be reestablished on ethical grounds, as the precautionary principle demands, the negative effects of science and its applications on human health and environment might be minimized and science could contribute more to human happiness. -/- Bilim yaşamımızı biçimlendiren en önemli insan etkinliklerinden birisi, belki de en önemlisidir. Ancak bilimlerin ve onun çeşitli uygulamalarının insan yaşamına olumlu katkılarının yanında insan ve çevre sağlığı üzerinde pek çok olumsuz etkilerinin de olduğu tartışılmaktadır. Bilim ve uygulamalarının insan sağlığı ve çevre üzerindeki olumsuz etkilerinin her geçen gün daha çok görünür hâle gelmesi, bilim-değer ilişkisini yeniden önemli bir tartışma başlığı hâline getirmiştir. İhtiyat ilkesi bilim-değer ilişkisi üzerine yapılan tartışmaların odağında yer alan kavramlardan biridir. Biz çalışmamızda önce bilim-değer ilişkisini, bilimin değerden bağımsız bir etkinlik olup olmadığını bilim tarihi ve felsefesi perspektifinden ele alıyor ve bilimlerin hem epistemik hem de epistemik olmayan değerler içerdiğini savunuyoruz. Daha sonra ihtiyat ilkesini ele alıyor ve onun bilimsel araştırmaların yöntembilimsel bir bileşeni hâline getirilmesinin olası nedenleri ve sonuçları üzerinde duruyoruz. Son olarak, bilim-değer ilişkisinin, ihtiyat ilkesi örneğinde olduğu gibi etik temelli kurulması durumunda bilim ve uygulamalarının insan sağlığı ve çevre üzerindeki olumsuz etkilerinin azaltılabileceğini ve bilimin insan mutluluğuna daha çok katkı sağlayabileceğini tartışıyoruz. ¿Què se avizora para el ser humano cuando se piensa en un tema tan existencial como lo es el de sus derechos? ¿Predomina la incertidumbre, la desazòn, los diagnòsticos interminables sobre los males por los cuales la especie humana agonizarà inexorablemente? ¿O por el contrario, se vislumbra con optimismo un futuro de posibilidades siempre abiertas? La cuestiòn de los derechos humanos remite a reflexiones muy profundas en torno a la Identidad y a la Alteridad. Ambas nociones aparecen como supuestos implicitos (...) o explicitos en las diversas estrategias empleadas para el abordaje de un tema tan complejo. El fondo cultural desde el que emergen acompaña las perspectivas teòricas de interpretaciòn y las politicas que las ponen en pràctica. En ambos planos surge con frecuencia la palabra tolerancia aunque en occasiones es utilizada con un significado muy ambiguo. La tolerancia requiere de seres razonables para alcanzar sociedades autènticamente democràticas. La razonabilidad a su vez se logra en la medida en que se estimule el desarrollo del pensamento critico. En este contexto, los aportes de la epistemologia de la complejidad de Edgar Morin, (la cual surgiò como alternativa frente a las epistemologias cerradas), posee una especial relevancia para la reflexiòn de los derechos humanos en el contexto històrico-cultural latinoamericano. En esa misma linea se ubica la teoria general de los sistemas sociales de Niklas Luhmann y las reflexiones sobre la identidad del sociòlogo polaco Zygmunt Baumann. En esta ponencia se busca mostrar la estrecha interrelaciòn entre esos autores con respecto al modo de interpretar la identidad y la alteridad, bases ineludibles para la construcciòn del respeto por los derechos del otro en cuanto tal. Den moralske virkelighed er en filosofisk undersøgelse af moral og etik i videst mulige forstand, der bunder i en frustration over oplevelser med den filosofiske etik. Den filosofiske etik skal vejlede os moralsk i vore handlinger, men det synes som om den hverken kan hjælpe os med det eller redegøre for moralen. Moral er et samfundsmæssigt fænomen, men det gør den filosofiske etik typisk ikke meget ud af. I en situation, hvor etikken er i krise, er det derfor værd at (...) se på, hvad moralsociologien kan berige etikken med. Pointen er ikke, at sociologien skal afløse eller begrunde etikken. Idéen er, at udvikle en filosfisk etik, der er sociologisk informeret. I det perspektiv analyseres Émile Durkheim, Niklas Luhmann og Zygmundt Bauman, ligesom det afslutningsvist skitseres, hvordan en sociologisk informeret etisk refleksion kunne se ud. (shrink)

MS IV. yüzyılda yaşayan Decimus Magnus Ausonius, Roma İmparatorluğu'nun özellikle batı yakasını yakından tanıyan önemli bir alim ve devlet adamıydı. Onu mühim biri haline getiren en önemli husus; çeşitli bilimler özelindeki bilgi birikiminin derinliği yanında başarılı bir eğitmen olmasıydı. Ayrıca, son derece stratejik mevkilere erişebilmiş bir devlet adamıydı. Yaşamının son yıllarında kaleme aldığı şiirlerinden olan Ordo Urbium Nobilium, Geç Antikçağ dünyasına dair önemli veriler içermektedir. Bu kapsamda, söz konusu çalışma kendisinin özellikle coğrafya, tarih, filoloji ve Latin edebiyatı-kültürü gibi çeşitli alanlarda (...) Geç Antikçağ eğitim kurumlarının ders içeriğine dâhil edilmiş şiirini konu edinmektedir. Öyle ki, Ortaçağdan günümüze değin Ausonius’un neredeyse her eseri hakkında yüzlerce çalışma gerçekleştirilmiş ve bunların birçoğu da ya yayımlanmış ya da yayımlanmayı bekler niteliktedir. Bu makalenin kurgusu da; Ausonius'un Ordo Urbium Nobilium başlıklı şiirinin içeriğinin ve kapsamının değerlendirilmesine odaklanmaktadır. Bu değerlendirme bağlamında öncelikle şiirde bahsi geçen kentler, şiir içerisinde aktarılan özellikleriyle incelenmekte, ayrıca Ausonius'un bu yerleşim birimleriyle şahsi ve resmi münasabetlerinin eserindeki yansıması irdelenecektir. The paper is an intervention in the dispute about the moralism of the recent realist trend in political philosophy. It is particularly focused on analysing the debate on this subject between Niklas Erman and Eva Möller (2015a; 2015b) and Robert Jubb and Enzo Rossi (2015a; 2015b). Examining the main arguments of both parties, I argue that realists (i.e., Jubb and Rossi) lost the debate, that realism is, in fact, moralism in disguise, and that its main methodological request – giving (...) up „pre-political” moral principles and values in political philosophy – is „unrealistic” (i.e., unfeasible). Usually regarded as a 1970s phenomenon, this article demonstrates that the debate between Jürgen Habermas and Niklas Luhmann continued until Luhmann’s death in 1998, and that the development of the two theorists’ positions during the 1980s and 1990s was characterised by convergence rather than by divergence. In the realm of legal theory, the article suggests, convergence advanced to the extent that Habermas’ discourse theory may be characterised as a normative superstructure to Luhmann’s descriptive theory of society. It is further (...) shown that the debate’s result was an almost complete absorption of Habermas’ theory by Luhmann’s systems theoretical complex – an outcome facilitated by Luhmann’s deliberate translation of central Habermasian concepts into systems theoretical concepts. The article argues that both the debate and Habermas’ conversion were made possible because not only Habermas’ but also Luhmann’s work can be considered a further development of the German idealist tradition. What Luhmann did not acknowledge was that this manoeuvre permitted the achievement of Habermas’ normative objectives; nor did he notice that it could eradicate a central flaw in the system theoretical construction, by allowing the context within which distinctions are drawn to be mapped – an issue of pivotal importance for grasping relationships between different social systems, and coordinating them, via the deployment of legal instruments. E-mails: [email protected] e [email protected] WhatsApp: (82)98143-8399. -/- PREMISSA -/- Se até a década de 1960 podia-se falar em uma Sociologia dividida por países, após essa época, tendo em vista um processo significativo de circulação de informações pelos mais variados meios de comunicação, pode-se dizer que os (...) principais cientistas sociais se tornaram globalizados, assim como a literatura sociológica. As questões sociais, que até então podiam estar localizadas em países ou em blocos de países, também se tornaram mundializadas, e vários pensadores passaram a refletir sobre temas chamados de pós-modernos, hipermodernos ou simplesmente contemporâneos, e que afetam um país, uma região ou todo o mundo. A Sociologia contemporânea, porém, mantém uma relação significativa com as grandes vertentes da Sociologia anterior: • a marxista ou histórico-estrutural, com suas variações; • a durkheimiana ou funcionalista, com o desenvolvimento de um neofuncionalismo; • a weberiana ou compreensiva, com o desenvolvimento da fenomenologia e da hermenêutica; • a teórica e pragmática estadunidense, com variadas linhas. Além dessas vertentes, pensadores como Jean-Gabriel de Tarde e Georg Simmel, que estavam um tanto esquecidos, pelo menos no Brasil, em razão da ênfase em Émile Durkheim, num caso, e em Max Weber, em outro, retomaram seus lugares de destaque. Essas vertentes inspiraram outros tantos pensadores, que – refletindo sobre a realidade em que vivem, mesclando ou não contribuições de diferentes linhas teóricas e formulando uma série de conceitos – demonstram as possibilidades e a diversidade do pensamento sociológico e fazem a Sociologia avançar muito no processo de compreensão da realidade contemporânea. A combinação de diversas vertentes teóricas torna difícil fazer qualquer enquadramento ou mesmo tentar classificar determinados autores. Muitos analistas veem nisso uma crise de paradigmas na Sociologia contemporânea. Essa “crise” poderia ser entendida do ponto de vista epistemológico; entretanto, sempre houve diversidade de epistemologias na Sociologia. Acreditamos que essa diversidade epistemológica, de teorias, de objetos e de métodos, concorrentes ou não, na explicação de fenômenos sociais deve ser vista como indicativo de vigor, e não de decadência. Dans le domaine de la théorie du droit, suggère cet article, la convergence a progressé dans la mesure où la théorie de la discussion (Diskursetheorie) d’Habermas peut se (...) caractériser comme une superstructure normative au regard de la théorie descriptive de la société formulée par Luhmann. De plus, le résultat du débat a été une absorption presque complète de la théorie habermassienne par le complexe de la théorie des systèmes de Luhmann – issue facilitée par le fait que ce dernier a délibérément traduit les concepts habermassiens centraux dans les concepts de la théorie des systèmes. Le débat et la conversion d’Habermas ont été possibles parce que le travail de celui-ci mais aussi celui de Luhmann peuvent être considérés comme un fruit de la tradition idéaliste allemande. Luhmann n’a pas vu que cette manœuvre permettait la réalisation des objectifs normatifs d’Habermas ; pas plus qu’il n’a perçu qu’il pouvait éradiquer une faille centrale de la construction de la théorie des systèmes en permettant de cartographier le contexte dans lequel les distinctions sont tracées – problème d’importance cruciale pour saisir les relations entre les différents systèmes sociaux et les coordonner via le déploiement d’instruments juridiques. The outline of the development of Performance Art features happenings in New York and Vienna in the sixties as well as body art and performances with closed circuits in the seventies (among others). Action Art, Environmental Theater and Intermedia are the terms defining the main characteristics of the works discussed. The research method is mainly based on Intertextuality (Mikhail Mikhailovich Bakhtin) and Systems Theory (Niklas Luhmann).

This book is a PhD dissertation and a very personal book at the same time. It asks the question whether society can and should be a point of orientation ("Bezugspunkt") for the human individual. Please note, that this cannot be a scientific book: If sociology is defined as society observed by society (or by sociologists, who are the agents of society), society observed by a single person (and for the aim of this single person) cannot be scientific. This is also (...) true if the researcher adheres to reason and scientific methodology: observations and understanding created by the human individual for its own private purposes simply are not scientific because they lack universality. "Bezugspunkt Gesellschaft" studies a number of different strains of sociology (and their scientific representatives, e.g. Pierre Bourdieu, Niklas Luhmann, Ralf Dahrendorf, Norbert Elias, Berger/Luckmann) in order to find out what it is that sociology studies? Is sociology the study of a society of human beings? Or is it true that society does not consist of human beings, but, as Luhmann claims, of acts of communication? Or is it true, as Bourdieu claims, that society consists of the instances of freedom abandoned half willingly, half out of habitude, by human individuals like in the case of a coffeehouse waiter who over time has just given up the idea that he could be anything else than a coffeehouse waiter. This book was inspired by a deconstructivist method of analysis in the field of literary theory where researchers state that it is of no interest what the author of a book wanted to say. Instead we should treat the work of literature as if the society of the author's epoch had written it. This theoretical "murder" of the human being in the form of the authors of works of literature in literary theory might have its analogy in sociology: Maybe sociology is also, like literary theory, not about people? However, if sociology is not about people - what can sociology teach us, us people? The book looks at different concepts of society throughout history, starting from the ancient concept that society is community, or that it is a circle of friendships, to more modern and dystopian concepts like that society is some kind of unhuman society. The book ends with the "Balzac machine", representing the incredibly talented and prolific French author Honoré de Balzac as a person who was an expert in the study of society and entirely blind to the phenomenon of society at the same time. The paradox of Balzac manifested itself in the fact that he literally worked himself to death in an attempt to gain society's recognition. (shrink)

The following article was written to honour Johan Buitendag’s contribution to the discipline of eco-theology. Assuming an interdisciplinary stance, eco-theology in general and his work, in particular, is observed from the position of legal theory and sociology. As such, eco-theology is not assessed on theological grounds but is treated interdisciplinary through comparison with environmental law. More specifically, the project of eco-theology is shown to share certain characteristics with the nascent subdiscipline of Earth systems law within environmental law. It is argued (...) that one of the most important of these is the use of norms as an ecological strategy. This is understandable as both the religious and legal systems rely on the norm form to a lesser or greater extent. However, in the legal sociology of systems theory, the shortcomings of norms have been eloquently argued. This article thus posits the limits of norms to eco-theology and Earth systems law as a challenge deserving attention. However, social systems theory has its shortcomings, and a preliminary line of flight away from this challenge is suggested in the shape of Agamben’s description of the monastic form-of-life, where life and norm overlap so intensely that suggestions of a new worldview gain plausibility. Global law settings are characterized by a structural pre-eminence of connectivity norms, a type of norm which differs from coherency or possibility norms. The centrality of connectivity norms emerges from the function of global law, which is to increase the probability of transfers of condensed social components, such as economic capital and products, religious doctrines, and scientific knowledge, from one legally structured context to another within world society. This was the case from colonialism and colonial law to contemporary global supply (...) chains and human rights. Both colonial law and human rights can be understood as serving a constitutionalizing function aimed at stabiliz- ing and facilitating connectivity. This allows for an understanding of colonialism and contemporary global governance as functional, but not as normative, equivalents. (shrink)

Arthura Kaufmanna filozofia prawa wyrasta przede wszystkim z neokantyzmu aksjologicznego reprezentowanego przez „późnego” Gustava Radbrucha, którego uważał on za najważniejszego ze swych nauczycieli, oraz z hermeneutyki filozoficznej Hansa-Georga Gadamera. W późniejszym okresie znaczący wpływ na Kaufmanna wywarł Charles S. Peirce, którego pracami posiłkował się opracowując problematykę analogii (wiążąc ją z opracowanym przez Pierca zagadnieniem abdukcji) oraz ontologii relacji. Niektóre wątki poglądów Kaufmanna nawiązują do egzystencjalizmu Karla Jaspersa oraz antropologii Karla Löwitha. Obecne są także inspiracje tomistyczne i arystotelesowskie. Jest to filozofia (...) prawa o charakterze maksymalistycznym. Kaufmann wpisuje się w sięgającą starożytności tradycję uprawiania filozofii, w której stawia się pytania o całość; filozofia pyta o to, co to jest "byt w ogóle", byt "w całości"; filozofia prawa stawia pytania o to, co to jest prawo "w całości", prawo "w ogóle" . Podejmuje wprost fundamentalne zagadnienia należące do zasadniczych dziedzin filozoficznych – epistemologiczne, ontologiczne, etyczne, nie stroniąc także od zagadnień z zakresu logiki. Uprawiana przez niego filozofia ma charakter systemowy, co sprawia, że jej zrozumienie zakłada ujęcie całości propozycji. Sam Kaufmann uważa, że systemy filozofii prawa należą już do historii, jednak ta uwaga jest o tyle jedynie trafna w odniesieniu do niego samego, że jego filozofia prawa – w zgodzie z jego deklaracjami – nie zmierza do „gotowych rozwiązań” konkretnych kwestii prawnych, ale zmierza do ukształtowania pewnego sposobu refleksji nad prawem. Jego koncepcja jest ważnym głosem w sporze klasycznego pozytywizmu z koncepcjami niepozytywistycznymi. Za prawo w pełnym tego słowa znaczeniu uznaje konkretne rozstrzygnięcie, co niewątpliwie łączy jego podejście z amerykańskim realizmem prawnym. Rekonstruowana przez Kaufmanna struktura procesu „urzeczywistniania” prawa, dokonywana w kontekście i na użytek kultury prawnej typu kodeksowego, kontynentalnego, uwyraźnia obecność elementów typowych dla kultury prawa precedensowego –wnioskowanie od przypadku do przypadku. Jednocześnie za istotny problem każdego porządku normatywnego uznaje uogólnienie. Jest to znamienny teoretyczny wyraz narastającej świadomości współwystępowania obok siebie zasadniczych elementów każdego z tych typów kultur prawnych. Kaufmann trafnie dostrzega, że w konkretnym rozstrzygnięciu są obecne elementy normatywne wykraczające poza to, co jest zawarte w aktach normatywnych. Podobnie jak Ronald Dworkin, Kaufmann wskazuje, że dokonujący rozstrzygnięcia, czy tego chce, czy nie, „stosuje” szereg elementów normatywnych spoza aktów normatywnych. Analizy prowadzą do wniosku, że propozycja Kaufmanna zawodzi, gdy przechodzi on do ontologicznych uogólnień, przede wszystkim przez brak uwzględnienia w swych podstawach takich punktów odniesienia, które są zewnętrzne wobec badanego procesu „urzeczywistniania” prawa. To, czym jest osoba, determinowane jest systemem prawnym i kulturą, w której prawo funkcjonuje. Przy takim ujęciu Kaufmann nie osiąga jednego z ważnych celów, do którego zmierzał, nie wskazuje kryteriów pozwalających stwierdzić, czy stopniowa – dokonywana zgodnie z odkrytymi przez hermeneutykę filozoficzną wymaganiami poprawnego rozumienia – zmiana normatywnego sensu systemu prawnego zmierza ku „ustawowemu bezprawiu”, czy też nie.
