The Cassiciacum dialogues mark an important point in St. Augustine’s spiritual journey from teacher of rhetoric to bishop of Hippo, and present Augustine as a Christian who had very recently found God, but was still unwilling to break off with the Greco-Roman philosophical tradition. Thus, Augustine designed his early philosophical writings in the old, classical manner. Although there is a vast body of scholarship on the Cassiciacum dialogues, only limited attention has been paid to the question of how significant a (...) role Augustine’s mother Monica plays in them. In this paper I argue that the term philosophical-contemplative companionship, borrowed from a new form of philosophical practice, can be applied to the participation of St. Monica in the De beata vita, and most likely to the Cassiciacum dialogues as a whole. The study sought to investigate the effects of using cooperative learning on female teacher trainees of the Colleges of Education in learning some selected topics in Integrated Science. The investigation also sought to determine whether the Cooperative Learning Approach enhances the attitude and motivation of the trainees towards learning of Integrated Science. The study was carried out at the St. Monica’s College of Education in the Mampong Municipality of the Ashanti Region. In all, 80 teacher trainees consisting of 40 (...) each from control and experimental groups were purposively sampled to participate in the study. The teacher trainees in the experimental group were exposed to the Cooperative Learning Approach and the trainees in the control group were lectured during the period of the study. The results of the study showed that the cooperative learning strategy was very relevant and beneficial in helping the teacher trainees of the St. Monica’s College of Education to improve on their performance in, and attitudes towards, the teaching and learning of Integrated Science. It was therefore recommended among other things that the science teachers should endeavour to integrate cooperative learning into their routine methods of instruction in the teaching and learning of Integrated Science. Given that mitigating climate change is a large-scale global issue, what obligations do individuals have to lower their personal carbon emissions? I survey recent suggestions by Walter Sinnott-Armstrong and Dale Jamieson and offer models for thinking about their respective approaches. I then present a third model based on the notion of structural violence. While the three models are not mutually incompatible, each one suggests a different focus for mitigating climate change. In the end, I agree with Sinnott-Armstrong that people have (...) limited moral obligations to directly lower personal emissions, but I offer different reasons for this conclusion, namely that the structural arrangements of our lives place a limit on how much individuals can restrict their own emissions. Thus, individuals should focus their efforts on changing the systems instead (e.g., the design of cities, laws and regulation, etc.), which will lead to lower emissions on a larger scale. (shrink)

By moving beyond the overly emphasized image of a “fusion of horizons” and focusing on Gadamer’s concept of “play,” this paper aims to rehabilitate the dynamic and multi-vocal character of understanding as Gadamer conceives it, and to argue that “difference” is the life-blood of understanding against the recurring charge that Gadamer’s hermeneutics is fundamentally antagonistic to otherness.

In this article I argue that the notion of truth is so closely linked to the notion of justification that it is not possible to access the truth, even with the best reasons upon which a justification is supported. -/- I’ll show that the notions of truth and reality can only be inferred from our experience of the world, in which our social practices can be verified or disproved, and if our hypotheses are accepted or refuted. I maintain that we (...) can only access realities which we constitute in relation to one of several possible conceptual frameworks. These conceptual frameworks are not transcendental entities nor are they established definitively, they are social constructs. This means that the conceptual frameworks are constituted by the social practices of the subjects. We understand that social practices are institutionalized groups of actions undertaken by members of a community and directed toward the consecution of an end. These actions presuppose that the beliefs, norms and values are shared by members of an epistemic community. Olivé (1999: 135-42). -/- This article begins by presenting Rorty’s counter-proposal for the notion of truth, in relation to which I put forward the principal theses of onto-epistemological pluralism. Subsequently, I develop the idea of inter-subjective contextual justification and I show that this posture, although it does depend on specific conditions for justification, is not arbitrary. -/- I demonstrate the relevance of onto-epistemological pluralism and the need to adequately substantiate our beliefs and decision making, by presenting the case of parents guided by a notion of ´post-truth´ who decide not to vaccinate their children against measles based on insufficiently justified subjective reasons. This text, commissioned by the OSUN Global Observatory of Academic Freedom, discusses how the concept of academic freedom is codified in Colombian Law and regulations of public and private higher education institutions. It also explores common conceptions of academic freedom among Colombian scholars, as well as commonly observed threats to it.

Inside the family, all individuals define their identity in relation to previous generations, the present ones, and the future ones. This intergenerational exchange plays important educational roles: it fosters a sense of belonging and identification, promotes dialogue, and guarantees the passing down of ethical orientations. In addition to feelings of security and reliance on others, family memory creates a matrix that gives people a placement in the world, a sort of existential code through which to be located in existence. Fostering (...) the habit of memory-making becomes therefore a major educational imperative, which however is not without challenges. The present contribution will consider those phenomena which can give rise to a weakening of bonds between generations and a growing exclusion of the ethical value of family heritage. There has been a recent resurgence of what Betsy Hartmann dubbed “the greening of hate” (blaming immigrants for environmental issues in the US). When immigrants move to the U.S., the argument goes, their CO2 emissions increase, thereby making climate change worse. Using migration from the Lower 48 to Alaska as a model, I illustrate how this anti-immigration argument has more traction than it is generally given credit for, and might be more convincing in a different situation. Nonetheless, it is not (...) convincing given the current pattern of climate emissions and prevailing justice considerations. Climate matters; how we treat each other matters, too. (shrink)

By Focusing on Hans-Georg Gadamer’s magnum opus Truth and Method, this paper aims to show how understanding itself — including the understanding of artworks, texts, tradition, and living speech — can be understood as a kind of game or dialogical play-process which requires crucial ethical conditions to be met if it is going to succeed. Success, in terms of the communication of meaning, requires that the players (or interlocutors) commit to a genuine participation with each other in which they “open” (...) themselves to each other’s “claims to truth,” take each other seriously, listen, respond and question, and stand prepared to risk their old prejudices, learn from each other, and be transformed in the process. Cheryl Hall has argued that framing of climate change must acknowledge the sacrifices needed to reach a sustainable future. This paper builds on that argument. Although it is important to acknowledge the value of what must be sacrificed, this paper argues that current frames about the environment falsely portray humans and the environment as in a zero-sum game, and in doing so ask people to give up the wrong things. This could undermine the public’s trust in environmentalism, and might even (...) create a backlash against action on climate change. I propose we need alternative framing that portrays humans as a keystone species, and highlights positive human activity. (shrink)

From the epistemological posture that we present in this work we sustain the following thesis:-That as subjects we constitute the world we live in through one of the possible conceptual frameworks.-Our cognitive and social practices construct the world in a certain manner, which makes us responsible for the way this world is constituted.

In this paper, I defend an epistemological pluralism that moves away from universal and absolute rationality, as well as from a radical and arbitrary relativism, where any criterion is valid for decision making. Such epistemological pluralism maintains that subjects know the world in which they live according to different conceptual schemes. We posit a notion of truth linked to the justification process and practical effectiveness. Then we present the importance of traditional knowledge in the socio-ecological field and relative to complex (...) systems. Finally, we explain the relevance of epistemic equity between traditional and scientific knowledges in order to anticipate consequences and to make decisions less uncertain. (shrink)

ABSTRACTThe distinction between ‘context of discovery’ and ‘context of justification’ in philosophy of science appears simple at first but contains interesting complexities. Paul Hoyningen-Huene has catalogued some of these complexities and suggested that the core usefulness of the ‘context distinction’ is in distinguishing between descriptive and normative perspectives. Here, I expand on Hoyningen-Huene’s project by tracing the label ‘context of discovery and context of justification’ to its origin. I argue that, contrary to initial appearances, Hans Reichenbach’s initial context distinction from (...) 1938 does not easily map onto Hoyningen-Huene’s distinction between descriptive and normative perspectives on science. However, this is not a reason to reject Hoyningen-Huene’s simplified context distinction, nor do I recommend returning to Reichenbach’s initial proposal. It is, however, further reason to believe that the context distinction does not have a single, easily understood meaning. Along the way, I revisit Reichenbach’s version of ‘rational reconstruction’ and highlight its usefulness as a tool for philosophy in general. (shrink)

From the refusal of some parents to apply some vaccines to their children, in this work we will show that to act properly it is not enough with a good intellectual justification to validate a belief as accurate, it will be necessary to take into account also the systematic actions in relation to which we are constituted, as well as the feelings that accompany those actions. We begin by exposing the notion of belief that Villoro presents from authors such as (...) Braithwaite and Bain. Next, we briefly explain the topic of the justification of beliefs and then articulate it with some of the controversies related to the application of vaccines. Later, we turned to Hume to show the role of imagination in relation to pleasure and pain in decision making. Finally, we present an outline of the discussion about paternalism in the application of vaccines. (shrink)

In this paper we discuss whether the thesis of Nietzsche’s perspectivism, from an interpretation, could be read in keys of onto-epistemological pluralism. For this, we begin by exposing Nietzsche’s questioning of the notion of rational truth, as well as the universalist and transcendental positions linked to this concept. In the second section we expose some of the main theses of American pragmatism and show that perspectivism is not close to this current of thought. Finally, we present the proposal of ontological (...) and epistemological pluralism and we refer to why Nietzsche’s perspectivism could be articulated with this position and why not. (shrink)

Cette étude cherche à rendre compte d’un trait particulier et pratiquement inobservé dans la fondation gadamérienne de l’herméneutique philosophique. Si l’on connaît bien le rôle du platonisme — et plus spécifiquement du dialogue platonicien — parmi les sources au sein desquelles Gadamer a puisé pour formuler le caractère dialogique du comprendre, on a rarement noté que la phénoménologie du dialogue sur laquelle s’appuie une telle fondation s’inscrivait en faux par rapport à son modèle sur un point bien précis : l’ironie, (...) qu’elle soit socratique ou platonicienne. This book assembles recent research on memory and learning in plants. Organisms that share a capability to store information about experiences in the past have an actively generated background resource on which they can compare and evaluate coming experiences in order to react faster or even better. This is an essential tool for all adaptation purposes. Such memory/learning skills can be found from bacteria up to fungi, animals and plants, although until recently it had been mentioned only as capabilities of (...) higher animals. With the rise of epigenetics the context dependent marking of experiences on the genetic level is an essential perspective to understand memory and learning in organisms. -/- Plants are highly sensitive organisms that actively compete for environmental resources. They assess their surroundings, estimate how much energy they need for particular goals, and then realize the optimum variant. They take measures to control certain environmental resources. They perceive themselves and can distinguish between ‘self’ and ‘non-self’. They process and evaluate information and then modify their behavior accordingly. -/- The book will guide scientists in further investigations on these skills of plant behavior and on how plants mediate signaling processes between themselves and the environment in memory and learning processes. The U.S. FDA has issued emergency use authorizations for monoclonal antibodies for non-hospitalized patients with mild or moderate COVID-19 disease and for individuals exposed to COVID-19 as post-exposure prophylaxis. One EUA for an oral antiviral drug, molnupiravir, has also been recommended by FDA’s Antimicrobial Drugs Advisory Committee, and others appear likely in the near future. Due to increased demand because of the Delta variant, the federal government resumed control over the supply and asked states to ration doses. As future variants (...) with increased infectivity and/or severity emerge, further rationing may be required. We identify relevant ethical principles and priority groups for access to therapies based on an integrated approach to population health and medical factors. Using priority categories to allocate scarce therapies effectively operationalizes important ethical values. This strategy is preferable to the current approach of categorical rules based on vaccination, immunocompromise status, or older age, or the ad hoc consideration of clinical risk factors. (shrink)

In this article, I will explore how the underlying research values of ‘openness’ and ‘mutual responsiveness’, which are central to open science practices, can be integrated into a new ethos of science. Firstly, I will revisit Robert Merton's early contribution to this issue, examining whether the ethos of science should be understood as a set of norms for scientists to practice ‘good’ science or as a set of research values as a functional requirement of the scientific system to produce knowledge, (...) irrespective of individual adherence to these norms. Secondly, I will analyse the recent codification of scientific practice in terms of ‘scientific integrity’, a framework that Merton did not pursue. Based on this analysis, and illustrated on the case of COVID-19 as a case in which the institution of science was challenged to deliver urgently on societal desirable outcomes, I will argue that promoting open science and its core norms of collaboration and openness requires broader governance of the institution of science in its relationship with society at large, rather than relying solely on self-governance within the scientific community through a new ethos of science. This conclusion has implications for re-evaluating research assessments, suggesting that the evaluation of the scientific system should take precedence over evaluating individual researchers, and that incentives should be provided to encourage specific research behaviour rather than solely focusing on individual research outputs. This article reports the findings of AI4People, an Atomium—EISMD initiative designed to lay the foundations for a “Good AI Society”. We introduce the core opportunities and risks of AI for society; present a synthesis of five ethical principles that should undergird its development and adoption; and offer 20 concrete recommendations—to assess, to develop, to incentivise, and to support good AI—which in some cases may be undertaken directly by national or supranational policy makers, while in others may be led by other (...) stakeholders. If adopted, these recommendations would serve as a firm foundation for the establishment of a Good AI Society. (shrink)

Michelle’s thesis explores the extent to which a researcher could contribute to change by engaging leaders in conversations that might intensify commitment to or the direction of their actions around socio-environmental decline in Bermuda as a country historically organised in the tradition of an entrepreneurial for-profit enterprise. The framing of a space to reflect on highlighted the significance of time that led to the bricolage design of a heuristic device called a moon gate. Time, the keystone of the moon gate, (...) created a prism lighting up the twists and turns of kaleidoscopic images of the chaos of the markets and the creative diversity of human and nonhuman participants. She undertook a philosophical approach with her study of the contested space of time around sensitivity to maintaining a fulcrum point based on the wellbeing of people and planet. (shrink)

We work with a large spatialized array of individuals in an environment of drifting food sources and predators. The behavior of each individual is generated by its simple neural net; individuals are capable of making one of two sounds and are capable of responding to sounds from their immediate neighbors by opening their mouths or hiding. An individual whose mouth is open in the presence of food is “fed” and gains points; an individual who fails to hide when a predator (...) is present is “hurt” by losing points. Opening mouths, hiding, and making sounds each exact an energy cost. There is no direct evolutionary gain for acts of cooperation or “successful communication” per se. In such an environment we start with a spatialized array of neural nets with randomized weights. Using standard learning algorithms, our individuals “train up” on the behavior of successful neighbors at regular intervals. Given that simple setup, will a community of neural nets evolve a simple language for signaling the presence of food and predators? With important qualifications, the answer is “yes.” In a simple spatial environment, pursuing individualistic gains and using partial training on successful neighbors, randomized neural nets can learn to communicate. Several quantitative studies (e.g. Kidd & Castano, 2013a; Djikic et al., 2013) have shown a positive correlation between literary reading and empathy. However, the literary nature of the stimuli used in these studies has not been defined at a more detailed, stylistic level. In order to explore the stylistic underpinnings of the hypothesized link between literariness and empathy, we conducted a qualitative experiment in which the degree of stylistic foregrounding was manipulated. Subjects (N = 37) read versions of Katherine Mansfield's (...) 'The Fly', a short story rich in foregrounding, while marking striking and evocative passages of their choosing. Afterwards, they were asked to select three markings and elaborate on their experiences in writing. One group read the original story, while the other read a 'non-literary' version, produced by an established author of suspense fiction for young adults, where stylistic foregrounding was reduced. We found that the non-literary version elicited significantly more (p < 0.05) explicitly empathic responses than the original story. This finding stands in contradiction to widely accepted assumptions in recent research, but can be assimilated in alternative models of literariness and affect in literary reading (e.g. Cupchik et al., 1998). We present an analysis of the data with a view to offering more than one interpretation of the observed effects of stylistic foregrounding. (shrink)

The starting point of our study is the awareness that currently we are in a phase of epochal change of the epistemological paradigm. As for the passage from oral to writing culture, now we can see, with the technological diffusion, a further transition to digital culture. Our aim is to make psychotherapists, researchers, and educators aware that the new phenomena emerging in relation to this technological diffusion bring on a necessary change. Nous suggérons que la spécificité dramatique de la pièce ainsi que son schéma narratif expriment cette philosophie. D’une part, l’histoire racontée par la plume de Shakespeare peut montrer d’abord un éloignement de la nature pour laisser suivre une redécouverte et une renaissance de la nature – d’abord par son acception simple, brute, puis dans la compréhension téléologique de celle-ci. D’autre part, la (...) succession de la tragédie, la comédie et la romance illustre ces trois étapes. Le triomphe de la romance indique le triomphe d’une philosophie de la nature dont les causes les plus importantes sont d’ordres téléologique. -/- Abstract -/- This article aims to explain how Shakespeare shows a philosophy of nature in The Winter’s Tale. We suggest that both the dramatic and narrative specificities of the play express this philosophy. On one hand, the story told by Shakespeare’s writing can show a remoteness from nature which is to be followed by a rediscovery and a rebirth of nature – first with its rawest meaning and finally in its teleological understanding. On the other hand, the succession of tragedy, comedy and romance illustrates those three steps. The triumph of romance indicates the triumph of a philosophy of nature in which the most important causes are the teleological ones. (shrink)

This contribution pays special attention to the Italian legal framework concerning the collaborative and sharing economy, with a focus on those economic initiatives which are platform mediated. This choice is due to the importance of the concept of “platform” in the definitions of the CSE provided at both the Italian and the European levels. As highlighted in some studies, most actors of the CSE can be considered not only economic disruptors but also policy disruptors. Thus, the chapter tries to shed (...) light on the difficulties Italian regulators had while dealing with the emergence of these actors, especially in sectors such as food, accommodation, delivery, and transport. Italian policymakers were not able to design new regulatory frameworks to cope with the challenges of CSE, privileging bans or almost total deregulation over the elaboration of innovative rules. Regarding the issue of digital labour, the Italian legislator adopted a partial solution, creating a framework that dualizes the labour market, maybe with the aim of satisfying both digital workers and platforms. Overall, it seems that the Italian ecosystem of the CSE is bound to evolve, especially after the appearance of the health crisis related to the COVID-19. (shrink)

Job burnout, organizational commitment, and work environment continue to be important areas of research to be studied in the realm of company employment and employee retention. Job burnout is the state of physical and emotional exhaustion and perceiving one’s profession as dull or overwhelming. Meanwhile, organizational commitment refers to the company’s attitude towards the organization and their employees, encompassing loyalty, moral responsibility, and their willingness to work. And lastly, work environment provides opportunities for employees to establish connections, develop skills, and (...) maximize their full potential in performing tasks. For the current study, researchers utilized descriptive-correlational research design to investigate the influence of Work Environment towards the job burnout and organizational commitment of BPO agents in selected companies in Bulacan, Philippines. Hence, Danish Psychosocial Work Environment Questionnaire (DPQ), Maslach Burnout Inventory - General Survey (MBI-GS), and the Three-Dimensional Model of Organizational Commitment Scale (ACS, NCS, CCS) were employed to properly assess the study's objectives. Multiple Linear Regression Analysis was performed to analyze the collected data. Based on the analysis, findings show that work environment has no significant influence on the job burnout and organizational commitment of BPO Agents. Furthermore, the results of this study were thoroughly evaluated, leading to an in-depth discussion. Based on the findings, recommendations were made to benefit the stakeholders of the study and contributeto the existing body of knowledge. (shrink)

In the intersection between eugenics past and present, disability has never been far beneath the surface. Perceived and ascribed disabilities of body and mind were one of the core sets of eugenics traits that provided the basis for institutionalized and sterilization on eugenic grounds for the first 75 years of the 20th-century. Since that time, the eugenic preoccupation with the character of future generations has seeped into what have become everyday practices in the realm of reproductive choice. As Marsha Saxton (...) (2000) and Adrienne Asch (2000, 2003) have forcefully argued, the use of prenatal screening technologies to facilitate the selective abortion of fetuses with features that signify disabling traits—the paradigm here being trisomy 21 in a fetus indicating Down Syndrome in the child—express a negative view of such disabilities sufficient to warrant terminating an otherwise wanted pregnancy. The eliminative structure of what Rosemary Garland Thompson (2012) has called eugenic logic persists in contemporary practices governing reproductive choice, social inclusion, and democratic participation and their relationship to disability. The tie between eugenics and contemporary disability studies suggests that eugenics and reflection on its history can also play a more positive role in disability politics. After focusing on eugenics in the first half of the paper, we will shift in the second half of the paper to eugenic resonances in contemporary thought and practice, concluding with some thoughts about ongoing practices of silencing and the very idea of eradicating disability. The voices of children and young people have been largely neglected in discussions of the extent to which the internet takes into account their needs and concerns. This paper aims to highlight young people’s lived experiences of being online.

The computational genomics community has come increasingly to rely on the methodology of creating annotations of scientific literature using terms from controlled structured vocabularies such as the Gene Ontology (GO). We here address the question of what such annotations signify and of how they are created by working biologists. Our goal is to promote a better understanding of how the results of experiments are captured in annotations in the hope that this will lead to better representations of biological reality through (...) both the annotation process and ontology development, and in more informed use of the GO resources by experimental scientists. Formal systems are standardly envisaged in terms of a grammar specifying well-formed formulae together with a set of axioms and rules. Derivations are ordered lists of formulae each of which is either an axiom or is generated from earlier items on the list by means of the rules of the system; the theorems of a formal system are simply those formulae for which there are derivations. Here we outline a set of alternative and explicitly visual ways of envisaging and analyzing (...) at least simple formal systems using fractal patterns of infinite depth. Progressively deeper dimensions of such a fractal can be used to map increasingly complex wffs or increasingly complex 'value spaces', with tautologies, contradictions, and various forms of contingency coded in terms of color. This and related approaches, it turns out, offer not only visually immediate and geometrically intriguing representations of formal systems as a whole but also promising formal links (1) between standard systems and classical patterns in fractal geometry, (2) between quite different kinds of value spaces in classical and infinite-valued logics, and (3) between cellular automata and logic. It is hoped that pattern analysis of this kind may open possibilities for a geometrical approach to further questions within logic and metalogic. (shrink)

Knowledge brokers are among the main channels of communication between scientists and the public and a key element to establishing a relation of trust between the two. But translating knowledge from the scientific community to a wider audience presents several difficulties, which can be accentuated in times of crisis. In this paper we study some of the problems that knowledge brokers face when communicating in times of crisis. During the first wave of the COVID-19 pandemic, we collected interviews with Italian (...) experts that played a major role as knowledge brokers in the local media. We asked them questions about five main topics: the features and role of science communicators; the use of language in communicating science; the importance of the relation of trust with the public; the peculiarity of communicating in a context of emergency; the problem of disagreement among experts, and its public perception and communication. The goal of this paper is to understand, through the words of knowledge brokers themselves, what they consider as best practices (and obstacles) to create trust between scientists and the public. Our empirical work can inform normative accounts of what knowledge brokering should be about. (shrink)

The aim of the Validation Theory (VT) as a meta-empirical construct is to introduce a new vista in the reorganization of the neuroscience, in its role of a science of the Mind-and-Brain unification. The present study focuses on existing discrepancies and contradictions between the methods of basic neurosciences and those prescribed by the psychological science. Our view is that these discrepancies are based on a high penetration of traditional neuroscience methods into the biological processes, coupled with low extrapolation (experimenting with (...) animal models) and vice versa for the psychological and psychopathological methods. A novel epistemological model for integrating psychological and neuroscientific knowledge is proposed. It is represented as a simultaneous investigation of the brain activity with penetrating high resolution functional Magnetic Resonance Imaging and in extenso application of set of psychological tests for exploring correspondence (cross-validation) between their compounds. The proposed approach leads to a revision of the neuroscientific and psychological terms, methods and data, followed by a revision of their relative interplay. This would make possible a practical exchange of expensive but objective fMRI with the lower costing psychological instruments (effect of "minimization"). The approaches proceeding from VT will infiltrate diagnostics and prevention in psychiatry. On a further stage the pharmaco-psychological monitoring will uncover new opportunities. This proofs' based research and practice represents an integral counterpart of the values-based mental health care. In conclusion VT is an evolutionary corner stone in order to traverse the stage of a Brain-Brain paradigm and to reach the point of development of the Mind-Brain paradigm. (shrink)

The logical-pragmatic perspective on the psychiatric diagnosis, presented by Rodriguez and Banzato contributes to and develops the existing conventional taxonomic framework. The latter is regarded as grounded on the epistemological prerequisites proponed by Carl Gustav Hempel in the late 1960s, adopted by the DSM task force of R. Spitzer in 1973.

The goal of philosophy of information is to understand what information is, how it operates, and how to put it to work. But unlike ‘information’ in the technical sense of information theory, what we are interested in is meaningful information. To understand the nature and dynamics of information in this sense we have to understand meaning. What we offer here are simple computational models that show emergence of meaning and information transfer in randomized arrays of neural nets. These we take (...) to be formal instantiations of a tradition of theories of meaning as use. What they offer, we propose, is a glimpse into the origin and dynamics of at least simple forms of meaning and information transfer as properties inherent in behavioral coordination across a community. El presente libro busca aportar desde la academia algunas visiones sobre los debates vigentes de la donación y trasplante de órganos. Esto, por medio del estudio juicioso de la normatividad y la jurisprudencia, así como de la solución de controversias que no están legisladas y les corresponde a los administradores de justicia resolverlas. Asimismo, señala la necesidad de regular los aspectos aquí planteados que, por los vacíos normativos, dificultan la realización del procedimiento médico de trasplante y donación de órganos.

An increasing number of European research projects return, or plan to return, individual genomic research results (IRR) to participants. While data access is a data subject’s right under the General Data Protection Regulation (GDPR), and many legal and ethical guidelines allow or require participants to receive personal data generated in research, the practice of returning results is not straightforward and raises several practical and ethical issues. Existing guidelines focusing on return of IRR are mostly project-specific, only discuss which results to (...) return, or were developed outside Europe. To address this gap, we analysed existing normative documents identified online using inductive content analysis. We used this analysis to develop a checklist of steps to assist European researchers considering whether to return IRR to participants. We then sought feedback on the checklist from an interdisciplinary panel of European experts (clinicians, clinical researchers, population-based researchers, biobank managers, ethicists, lawyers and policy makers) to refine the checklist. The checklist outlines seven major components researchers should consider when determining whether, and how, to return results to adult research participants: 1) Decide which results to return; 2) Develop a plan for return of results; 3) Obtain participant informed consent; 4) Collect and analyse data; 5) Confirm results; 6) Disclose research results; 7) Follow-up and monitor. Our checklist provides a clear outline of the steps European researchers can follow to develop ethical and sustainable result return pathways within their own research projects. Further legal analysis is required to ensure this checklist complies with relevant domestic laws. (shrink)

This article addresses the fiduciary issues raised by the current practice of plan fiduciaries of not only disclaiming any fiduciary responsibility for brokerage window investments, but also abdicating any role (fiduciary or otherwise) in assessing even the general suitability of those investments for a retirement plan, and concludes that the practice is in plain and notorious violation of what ERISA requires of fiduciaries.

The principle of Anteriority says that prospects that are identical from the perspective of every possible person’s welfare are equally good overall. The principle enjoys prima facie plausibility, and has been employed for various theoretical purposes. Here it is shown using an analogue of the St Petersburg Paradox that Anteriority is inconsistent with central principles of axiology.

This is a Hindu reading of St. Ignatius of Loyola's Spiritual Exercises for passing an examination. This is not the final dissertation but only a draft which underwent many changes. It is unpublished.

Throughout his works, St. Augustine offers at least nine distinct views on the nature of time, at least three of which have remained almost unnoticed in the secondary literature. I first examine each these nine descriptions of time and attempt to diffuse common misinterpretations, especially of the views which seek to identify Augustinian time as consisting of an un-extended point or a distentio animi . Second, I argue that Augustine's primary understanding of time, like that of later medieval scholastics, is (...) that of an accident connected to the changes of created substances. Finally, I show how this interpretation has the benefit of rendering intelligible Augustine's contention that, at the resurrection, motion will still be able to occur, but not time. (shrink)

Early modern philosophers, such as Descartes and Spinoza, appeal to a theory of modes in their metaphysics. Recent commentators have argued that such a theory of modes has Francesco Suárez as its primary source. In this paper, I explore one explicit source for Suárez’s view: Durand of St.-Pourçain, an early fourteenth-century philosopher. My aim will be mainly expository: I will put forward Durand’s theory of modes, thus correcting the persistent belief that there was no well-defined theory of modes prior to (...) Suárez. First, I will sketch out the historical and theological context in which Durand developed his theory, briefly canvassing some of the items that he treats as modes as well. Second, I will go over the distinctive features that Durand thinks modes have. Finally, I will close with some reflection on why we should countenance modes in our ontology. Along the way, I will correct a few misconceptions about Durand’s theory of modes. (shrink)
