Shedding light on the political power and oppressive potential of language, theories of illocutionary silencing and discursive injustice show how gender, class and race can shape the pragmatics of speech, limiting in some circumstances the speaker’s ability to do things with her words. This article takes a close look at discursive injustice in trials for gender-based violence in connection with the phenomenon of misogyny. It argues that in the courtroom the testimony of the complainant is sometimes silenced by a sexist (...) ideology used in service of misogynistic ends. In particular, it argues that sexist social meanings can sometimes be enacted by the judge and accommodated by prosecutors, figuring as a component of the score in the language game of the trial and thus 1) determining what counts as sexual violence and 2) preventing complainants from making the moves they intend to make. De uma perspectiva comportamentalista radical, o eu é um repertório verbal complexo, que, como tal, tem uma gênese social. O reconhecimento da origem social do “eu” abre caminho para uma análise política, incluindo uma discussão do pa- pel das relações de poder na constituição do eu. Entretanto, uma concepção radicalmente social do “eu”, como a proposta pelo comportamentalismo, suscita um problema político: se o eu é integralmente produto do ambiente social, de onde viria uma eventual “vontade” de romper com esse (...) sistema? Parece que para reconhecer a possibilidade de ação política transformadora seria preciso preservar uma noção descontextualizada de “eu”. Considerando essa dificuldade, o objetivo deste artigo é propor uma interpretação política da constituição do “eu” no âmbito do comportamentalismo radical, mantendo no horizonte a possibilidade de uma ação política transformadora. Para tanto, destacamos como “eus” oprimidos são tornados submissos, mas também como de certas contingências podem emergir “eus” subversivos, que se opõem a um sistema social opressivo. Esse “eu” subversivo é caracterizado por um repertório de autoconhecimento mais amplo, que inclui a discriminação do papel das relações de poder e do controle promovido por instituições. Recently, the concept of "gender identity" has enjoyed a great deal of attention in gender metaphysics. This seems to be motivated by the goal of creating trans-inclusive theory, by explaining trans people's genders. In this paper, we aim to unmotivate this project. Notions of "gender identity" serve important pragmatic purposes for trans people, such as satisfying the curiosity of non-trans people, and, relatedly, securing our access to important goods like legal rights and medical care. However, we argue that this does (...) not mean that "gender identity" is a metaphysically substantial thing that deserves extensive theoretical attention. There are reasons to be skeptical of such a concept. We trace the history of "gender identity," primarily to identify its roots in trans-antagonistic medical theory and its connections to the problematic "wrong-body" model--a legacy that has pathologized and flattened trans experience. Moreover, we argue that trans people primarily use "gender identity" to explain ourselves to non-trans people, rather than to discuss ourselves among ourselves. Thus, we urge theorists to resist the urge to substantiate gender identity. Instead, we encourage the development of new and better concepts, ones that attend to the lived realities of trans community and the flourishing gender terms and practices that are constructed there. If these lived realities are taken seriously, there is no need to “explain” trans people’s genders; we can simply see them as they are. (shrink)

Conceptualism is the view that at least some perceptual representation is conceptual. This paper considers a prominent recent argument against Conceptualism due to Ned Block. Block’s argument appeals to patterns of color representation in infants, alleging that infants exhibit categorical perception of color while failing to deploy concepts of color categories. Accordingly, the perceptual representation of color categories in infancy must be non-conceptual. This argument is distinctive insofar as it threatens not only the view that all perception is conceptual, but (...) also views that restrict the Conceptualist thesis to perceptual categorization. However, I contend that it fails at two stages. Block’s arguments for the perceptual representation of color categories in infancy, and against color concept deployment in infancy, are unpersuasive. Thus, Block has not vanquished Conceptualism. I draw out implications for debates about the perception-cognition border and for the question of whether explicit categorization occurs in perception. This essay examine Samuel Beckett's *Trilogy to specify the conditions under which we could make sense of practical necessity. Among other things, I will show how Ajax' must is connected to Mol/oy's attempt to visit his mother and to the need to keep talking that both Molloy and the Unnamable share. I will conclude that their dislocated pursuit of certainty reveal - among other things - how the conditions under which practical necessity can be properly experienced have been extirpated from (...) our social and cultural context. Still, the fact that its vestiges nevertheless subsist provide some reason to regard practical necessity as a constitutive aspect of our agency. This will provide a particular sense in which the Unnamable may coherently claim: "I don't know, I'll never know, in the silence you don't know, you must go on, I can't go on, I will go on.". It is widely thought that there are limits to how things can perceptually appear to us. For instance, nothing can appear both square and circular, or both pure red and pure blue. Adam Pautz has dubbed such constraints “laws of appearance.” But if the laws of appearance obtain, then what explains them? Here I examine the prospects for an empirical explanation of the laws of appearance. First, I challenge extant empirical explanations that appeal purely to the format of perceptual representation. I then develop a hybrid approach, on which the laws are explained not merely by format, but by two further factors: ecological constraints imposed by our environments, and computational constraints embodied by our perceptual systems. While the hybrid approach implies that the laws of appearance are contingent, I argue that this implication is empirically defensible, since even some of the most intuitively compelling laws have real-world counterexamples. Para isto, será útil como bibliografia principal do filósofo sua obra De libero arbitrio, um livro em forma de diálogo onde o pensador esclarece suas posições acerca do livre-arbítrio e da presciência divina.

A prominent view holds that perception and memory are distinguished at least partly by their temporal orientation: Perception functions to represent the present, while memory functions to represent the past. Call this view perceptual presentism. This chapter critically examines perceptual presentism in light of contemporary perception science. I adduce evidence for three forms of perceptual sensitivity to the past: (i) shaping perception by past stimulus exposure, (ii) recruitment of mnemonic representations in perceptual processing, and (iii) perceptual representation of present objects (...) as possessing past properties. I argue that forms (i) and (ii) are consistent with perceptual presentism, while form (iii) poses a genuine threat to the view. While the empirical case for form (iii) remains inconclusive, I suggest that the most serious challenges to perceptual presentism derive from representations that integrate mnemonic and present-tensed elements in the performance of canonical perceptual functions, such as perceiving object continuity over time. Richard Rorty’s conception of literature has been criticised more than acclaimed. While Rorty certainly has impacted literary studies, a comprehensive account of his understanding of literature is still lacking. Moreover, while literature is seen as significant to his later work, the philosophical role this plays in Rortyan thought is underexamined and underappreciated. This paper aims to provide an account of the role of literature and the “literary” in Rorty’s philosophy and the functions he assigns to literature and poetry – in (...) a broad and narrow sense – in democratic cultures. Beginning with an account of Rorty’s conceptions of metaphor and “unfamiliar” language, it draws on this to explain Rorty’s parallel view of literature in the “narrower sense” as playing the same role in culture as metaphors do in language. “Stimulating” literature unsettles settled selves and beliefs and expands human imagination. Using Rorty’s readings of Lolita and 1984 as examples, it shows that to him, literature not only plays a part in increasing empathy and solidarity but has a distinct therapeutic epistemological task: it helps individuals and societies adopt a more pluralist, ironist, post-metaphysical outlook. Both are important democratic functions. For these reasons, Rorty recommends that we work to realise a “literary” culture that rejects any ontologically inflected distinctions between kinds of texts, where philosophy becomes comparative “literary” criticism, and we see literature in the “narrower sense” as equally necessary material for making selves, communities and just institutions as any philosophical or political treatise. We argue that the trend toward providing users with feasible and actionable explanations of AI decisions—known as recourse explanations—comes with ethical downsides. Specifically, we argue that recourse explanations face several conceptual pitfalls and can lead to problematic explanation hacking, which undermines their ethical status. As an alternative, we advocate that explanations of AI decisions should aim at understanding.

Wittgenstein’s concepts shed light on the phenomenon of schizophrenia in at least three different ways: with a view to empathy, scientific explanation, or philosophical clarification. I consider two different “positive” wittgensteinian accounts―Campbell’s idea that delusions involve a mechanism of which different framework propositions are parts, Sass’ proposal that the schizophrenic patient can be described as a solipsist, and a Rhodes’ and Gipp’s account, where epistemic aspects of schizophrenia are explained as failures in the ordinary background of certainties. I argue that (...) none of them amounts to empathic-phenomenological understanding, but they provide examples of how philosophical concepts can contribute to scientific explanation, and to philosophical clarification respectively. Black holes are arguably the most extraordinary physical objects we know in the universe. Despite our thorough knowledge of black hole dynamics and our ability to solve Einstein’s equations in situations of ever increasing complexity, the deeper implications of the very existence of black holes for our understanding of space, time, causality, information, and many other things remain poorly understood. In this paper I survey some of these problems. If something is going to be clear from my presentation, I hope (...) it will be that around black holes science and metaphysics become more interwoven than anywhere else in the universe. (shrink)

With increased visibility of trans people comes increased philosophical interest in gendered language. This chapter aims to look at the research on gendered language in analytic philosophy of language so far, which has focused on two concerns: (1) determining how to define gender terms like ‘man’ and ‘woman’ such that they are trans inclusive and (2) if, or to what extent, we should use gendered language at all. We argue that the literature has focused too heavily on how gendered language (...) can harm trans people, and has not considered how trans people use gendered language to create meaning and joy for ourselves. Pulling from the literature in sociolinguistics, we look at examples of how trans people use language to make their lives better by gaining recognition, playing with gendered language, finding joy in gendered language, and taking control of definitional power, concluding that debates about gendered language need to consider not only how such language harms trans people but also how trans people use it for our own liberation. Os minerais possuem uma influência direta em diversos processos fisiológicos no organismo animal e, mesmo com tamanha importância, por vezes são negligenciados pelos produtores para seu fornecimento para os animais. Este estudo teve como objetivo avaliar o desempenho reprodutivo de rebanhos de bovinos, caprinos e ovinos em 8 propriedades rurais nas cidades de Sanharó, Pesqueira, Arcoverde, Belo Jardim e São Bento do Una através da adição de suplemento mineral e mistura múltipla aos animais de forma a atender suas necessidades básicas (...) para mantença e reprodução. Foram avaliados os desempenhos de 4 touros e 25 vacas, 3 bodes e 50 cabras e 4 carneiros e 48 ovelhas em diferentes propriedades, avaliando como a adição de um suplemento mineral específico da espécie impacta de forma positiva nos índices reprodutivos avaliados que foram taxa de cio, taxa de serviço, taxa de concepção, taxa de fertilidade, taxa de prenhez, taxa de perdas gestacionais, taxa de natalidade e taxa de mortalidade. O experimento teve duração de 2 anos e pôde-se avaliar cerca de 2 partos nas vacas e, mais ou menos, 3 partos em cabras e ovelhas. Os dados foram computados e avaliados estatisticamente no Excel para conferir se os índices reprodutivos melhoraram em função da adição de minerais na ração dos animais. Conferiu-se que houve diferença significativa entre todos os índices avaliados, ou seja, a adição de minerais na ração dos animais melhora a eficiência reprodutiva de machos e fêmeas de animais ruminantes, sendo de suma importância sua disponibilização de forma correta para alcançar bons índices reprodutivos na fazenda na busca pela obtenção de neonatos que poderão ser comercializados. -/- REFERÊNCIAS BIBLIOGRÁFICAS ASTRO, G. The aim of the paper is to analyze the expressive power of the square operator of Łukasiewicz logic: ∗x=x⊙x⁠, where ⊙ is the strong Łukasiewicz conjunction. In particular, we aim at understanding and characterizing those cases in which the square operator is enough to construct a finite MV-chain from a finite totally ordered set endowed with an involutive negation. The first of our main results shows that, indeed, the whole structure of MV-chain can be reconstructed from the involution and the (...) Łukasiewicz square operator if and only if the obtained structure has only trivial subalgebras and, equivalently, if and only if the cardinality of the starting chain is of the form n+1 where n belongs to a class of prime numbers that we fully characterize. Secondly, we axiomatize the algebraizable matrix logic whose semantics is given by the variety generated by a finite totally ordered set endowed with an involutive negation and Łukasiewicz square operator. Finally, we propose an alternative way to account for Łukasiewicz square operator on involutive Gödel chains. In this setting, we show that such an operator can be captured by a rather intuitive set of equations. (shrink)

In his recent article Philosophy Inside Out, Philip Kitcher presents a metaphilosophical outlook that aims at nothing less than a renewal of philosophy. His idea is to draw philosophers’ attention away from “timeless questions” in the so-called “core areas” of philosophy. Instead, philosophers should address questions that matter to human lives. The aim of this paper is twofold: first, to reconstruct Kitcher’s view of how philosophy should be renewed; second, to point out some difficulties relating to his position. These difficulties (...) concern the integration of his naturalism into the pragmatic vision of philosophy, the role of putative philosophical experts, and the ideal status of the program of well-ordered inquiry. O presente artigo pretende abordar o conceito de trágico, entendido como elemento principal ou elemento orquestrador do projecto nietzschiano em busca de uma determinação para uma nova forma de existência estética. Objectivo do autor é, pois, em primeiro lugar, explicitar o sentido da nova existência estética tal como Nietzsche, pela mão de Zaratustra, imputa à figura do Übermensch, o qual estabelece um projecto de justificação estética; em segundo lugar, trata-se de mostrar que o conceito de 'trágico'está estreitamente relacionado com o (...) conceito metafísico de 'eterno retorno'de tal modo que isso pretende, por um lado, ultrapassar a dimensão determinada da vida humana em algo maior ou melhor, e, por outro, visa a completa realização da vida humana que pode ser repetida, salientando que este movimento de repetição afirma o retorno dionisíaco do trágico. Objectivo do autor do artigo é, assim, provar que o projecto nietzschiano anuncia o Übermensch como uma nova forma de existência estética, ao mesmo tempo que recupera os conceitos de 'trágico' e 'dionisíaco', conceitos estes que animam a obra Die Geburt der Tragödie. Consequentemente, trata-se de ver até que ponto o Übermensch está afirmado como objectivo necessário e primário neste projecto, o qual permanece, contudo, uma herança enigmática em que nos deixa a filosofia de Nietzsche. /// The present article presents a brief approach to the concept of the 'tragic' understood as a main element or a conducting element in the Nietzschean project that searches for a determination of a new form of aesthetic existence. The author aims, thus, at two things: first, to explicit the meaning of this new aesthetic existence that Nietzsche, by the hand of Zarathustra, imputes to the figure of the Übermensch, which establishes a project of aesthetic justification; secondly, to show that the concept of the 'tragic' is closely related to the metaphysical concept of the 'eternal return' in such a way that it purposes, on the one hand, to surpass a determined dimension of human life into something bigger or better, and, on the other, to bring about a complete realisation of human life that can be repeated, so that the movement of repetition qffirms the dionysiac return of the tragic. The goal of the article is, moreover, to prove that the Nietzschean project announces the Übermensch as a new form of aesthetic existence while recovering the main concepts of 'tragic' and 'dionysiac', concepts that animate the book Die Geburt der Tragödie. There are many explanations for the value of money, but they all seem to depend on things like "trust," "shared fiction," "agreement" or even potentially circular logic like that money's value is based on its usefulness as money. But there is a full process by which money, the desire we feel for it, and even how we end up trading it, can emerge naturally from the dynamics of natural selection and human interaction, with a basis in real value, and happening (...) repeatedly and reliably, even if a group of people all agree that money or precious metals are worthless. Resumo: A crise na União Europeia e os programas de austeridade subsequentes fizeram emergir uma miríade de movimentos sociais, diversos na sua natureza e nos seus propósitos. O que se pretende aferir neste artigo é a relação e a conexão existentes entre o Estado, o poder económico, a sociedade civil e os movimentos sociais neste contexto específico de crise. Procuraremos, nesta breve abordagem, explanar alguns elementos de originalidade intrínsecos aos movimentos sociais hodiernos, patentes na sua forma de participação e organização, (...) assim como aplicar estas questões teóricas relevantes ao contexto português. A parte empírica, dada a escassez de estudos de caso existentes, será apoiada no último inquérito do European Social Survey, de 2012. Analisando um conjunto de perguntas aí explícitas, podemos compreender, de forma indirecta, algumas das dinâmicas que caracterizam estes movimentos. Abstract: The crisis in the European Union and the subsequent austerity programs have unleashed a myriad of social movements, diverse in its nature and purpose. The purpose of this paper is to assess the relationship and connection between the State, economic power, civil society and social movements in this specific context of crisis. We will try, in this brief approach, to explain some elements of originality intrinsic to modern social movements, evident in their form of participation and organization, as well as to apply these theoretical questions relevant to the Portuguese context. The empirical part, given the paucity of existing case studies, will be supported in the last survey of the European Social Survey of 2012. In this paper the class of Fidel-structures for the paraconsistent logic mbC is studied from the point of view of Model Theory and Category Theory. The basic point is that Fidel-structures for mbC (or mbC-structures) can be seen as first-order structures over the signature of Boolean algebras expanded by two binary predicate symbols N (for negation) and O (for the consistency connective) satisfying certain Horn sentences. This perspective allows us to consider notions and results from Model Theory in order to (...) analyze the class of mbC-structures. Thus, substructures, union of chains, direct products, direct limits, congruences and quotient structures can be analyzed under this perspective. In particular, a Birkhoff-like representation theorem for mbC-structures as subdirect poducts in terms of subdirectly irreducible mbC-structures is obtained by adapting a general result for first-order structures due to Caicedo. Moreover, a characterization of all the subdirectly irreducible mbC-structures is also given. An alternative decomposition theorem is obtained by using the notions of weak substructure and weak isomorphism considered by Fidel for Cn-structures. (shrink)

This article develops a view of shape representation both in visual experience and in subpersonal visual processing. The view is that, in both cases, shape is represented in a ‘layered’ manner: an object is represented as having multiple shape properties, and these properties have varying degrees of abstraction. I argue that this view is supported both by the facts about visual phenomenology and by a large collection of evidence in perceptual psychology. Such evidence is provided by studies of shape discriminability, (...) apparent motion, multiple-object tracking, and structure-from-motion. Recent neuroscientific work has also corroborated this psychophysical evidence. In this article, I examine the moral dimensions of gender affirmation. I argue that the moral value of gender affirmation is rooted in what Iris Murdoch called loving attention. Loving attention is central to the moral value of gender affirmation because such affirmation is otherwise too fragile or insincere to have such value. Moral reasons to engage in acts that gender affirm derive from the commitment to give and express loving attention to trans people as a way of challenging their (...) marginalization. In the latter part of the paper, I will discuss how my arguments bear on recent arguments by Robin Dembroff and Daniel Wodak (2018) on the use of gender-neutral language. They argue that we have a duty not to use gender-specific pronouns for anyone. Their conclusion turns, in part, on a rejection of gender affirmation as a moral duty. The value of gender affirmation, rooted in our moral perception of trans people, should make us skeptical of this conclusion, in favor of a more nuanced and pluralistic approach to the ethics of gendering. There are several types of truths. In this paper I focus on semantic truths, and within these on factual truths. These truths are attributed to statements. I review the theory of the truth proposed by Bunge and discuss some problems that it presents. I suggest that a theory of truth of factual statements should be complemented by a theory of relevance, and propose the basic tenets of it. Dating and hookup apps (DHAs) are now widely used and may be transforming our intimate relationships. The apps are beneficial in fostering intimate connections among those who are lonely, who are members of minority or marginalized groups, or who live nomadic lifestyles because of work or recreational travel. However, the wider social and relational changes that DHAs portend are merely beginning to be seriously discussed by academics (Arias et al., 2017). In this chapter, we employ concepts from the philosophy of (...) technology that inform our analysis of these changes. We also collate some of the morally significant impacts of DHAs and present some of the elements of the architecture of DHAs that facilitate them. Although there are many reasons to be concerned about DHAs, we argue that there is room for cautious optimism that DHAs may be vehicles of positive social and moral change. (shrink)

The nature and consequences of readers’ affective engagement with literature has, in recent years, captured the attention of experimental psychologists and philosophers alike. Psychological studies have focused principally on the causal mechanisms explaining our affective interactions with fictions, prescinding from questions concerning their rational justifiability. Transportation Theory, for instance, has sought to map out the mechanisms the reader tracks the narrative experientially, mirroring its descriptions through first-personal perceptual imaginings, affective and motor responses and even evaluative beliefs. Analytical philosophers, by contrast, (...) have largely focussed on the problems fiction poses for traditional theories of rationality (as in the ‘Paradox of Fiction), challenging fiction’s wider epistemic value. The result has been a theoretical impasse in which the power of fiction to affectively ‘transport’ a reader is at once often lauded (by psychologists) as a privileged route to interpersonal understanding, and condemned (by philosophers) as an abdication of the authority of reason. This chapter surveys some of the central claims on both sides, tracing the source of the debate to competing conceptions of rationality. (shrink)

Causal closure arguments against interactionist dualism are currently popular amongst physicalists. Such an argument appeals to some principles of the causal closure of the physical, together with certain other premises, to conclude that at least some mental events are identical with physical events. However, it is crucial to the success of any such argument that the physical causal closure principle to which it appeals is neither too strong nor too weak by certain standards. In this paper, it is argued that (...) various forms of naturalistic dualism, of an emergentist character, are consistent with the strongest physical causal closure principles that can plausibly be advocated. The ability to perceive the shapes of things as enduring through changes in how they stimulate our sense organs is vital to our sense of stability in the world. But what sort of capacity is shape constancy, and how is it reflected in perceptual experience? This paper defends a pluralist account of shape constancy: There are multiple kinds of shape constancy centered on geometrical properties at various levels of abstraction, and properties at these various levels feature in the content of (...) perceptual experience, governing patterns of apparent shape similarity. I propose that the varieties of shape constancy are subserved by the syntactic complexity of perceptual shape representations. By assigning discrete constituents to various abstract shape parameters, these representations attune us to the preservation of certain abstract shape properties through changes in more determinate shape properties. Finally, I draw broader lessons concerning the nature and function of perceptual constancy. (shrink)

Unity of science was once a very popular idea among both philosophers and scientists. But it has fallen out of fashion, largely because of its association with reductionism and the challenge from multiple realisation. Pluralism and the disunity of science are the new norm, and higher-level natural kinds and special science laws are considered to have an important role in scientific practice. What kind of reductionism does multiple realisability challenge? What does it take to reduce one phenomenon to another? How (...) do we determine which kinds are natural? What is the ontological basis of unity? In this Element, Tuomas Tahko examines these questions from a contemporary perspective, after a historical overview. The upshot is that there is still value in the idea of a unity of science. Marino & Merskin’s review shows that sheep are intelligent and highly social but their methodology has some shortcomings. I describe five problems with reviewing only the academic and scientific literature and suggest how one might provide an even more compelling case for the complexity of sheep minds.

Abstract. In this article we developed scientific and applied foundations of commercialization of the nature-resource potential of anthropogenic objects, on the example of exhausted mines. It is determined that the category of “anthropogenic object” can be considered in a narrow-applied sense, as specific anthropogenic objects to ensure the target needs, and in a broad theoretical sense, meaning everything that is created and changed by human influence, that is the objects of both artificial and natural origin. It was determined that problems (...) of commercialization of the natural-resource potential of anthropogenic objects are most often considered by researchers for specific objects, without having complex methodological coverage from the point of view of combining environmental, technical, economic and managerial components. When studying the substantiation of the scientific base, the authors confirmed the feasibility of the commercialization of natural-resource potential of anthropogenic objects on the example of a number of theoretical scientific studies in reclamation, reconstruction, recreation, remediation, restoration of biological productivity and economic value of land disturbed by economic activity. The considered examples of exhausted mines in the 21st century in the USA, Canada, Germany, Romania, and Poland indicate a wide range of opportunities for their commercialization. The study of the potential for commercialization of exhausted mines in the post-Soviet countries testified to the underused reserves for the commercialization of their nature-resource potential and their high potential for further development. The authors proposed the identification of anthropogenic objects on the basic livelihood spheres of society. There were identified the main system (natural, biological, technical, economic, social, managerial) and structural (subjects, trends, threats, risks, problems, challenges) factors of diagnosing the state of an anthropogenic object. A set of measures has been developed for commercialization of an anthropogenic object in functional and production activities, product policy, financial and investment spheres, pricing and sales policies, promotion, management and determination of property rights. Recommendations were provided on optimizing the management decision-making process based on a set of positivistic development principles, methods, and management functions. The study allows international organizations, state and local authorities, territorial communities, owners and potential investors to see new opportunities and make mutually beneficial decisions on the rational use of the nature-resource potential of anthropogenic objects. Contrary to what he expected, Primo Levi didn’t experience his life after being released from Auschwitz as cheerful and light-hearted. He – like many other survivors – was haunted by an obscure and solid anguish. It took some effort for him to discern the object or source of this anguish. He finally identified it as springing from a sense of shame or guilt in front of the drowned, that is, of those who were exterminated in the Lager. He could not (...) determine, however, whether his shame or guilt was at all rational. In this paper l examine Levi’s shame in light of what I regard as the dominant conception of practical deliberation, according to which principles and emotional detachment are central to our ability to deliberate appropriately. This conception underlies the role that John Rawls ascribes to the original position in the determination of the fundamental principles of justice. Deliberation in the original position is supposed to abstract away from any particular moral situations that one may actually have faced, since these are purely circumstantial elements to be discarded as both irrelevant and misleading for a proper deliberation on the principles of justice. In this paper, I intend both to make a case against the conception of practical deliberation on which Rawls’ original position relies and to vindicate the rationality of Levi’s shame, once some well-entrenched assumptions are brought to light and challenged. Any effort to specify identity conditions for corporations faces significant challenges. Corporations are amorphous. Nature draws no hard lines defining where they start or stop, whether in space or time. Corporations are also frustratingly dynamic. They often change the most basic aspects of their composition by exchanging parts, splitting and merging, changing ownership, and reworking fundamental internal operations. -/- Even so, we apply corporate identity conditions all the time. Both law and common intuition recognize that corporations do things—like pollute environments (...) or mislabel addictive medications—that call for judgment. Imposing judgment on corporations presupposes some implicit view of corporate identity that allows us to say, “This corporation that we now judge is the same one that misbehaved.” -/- This chapter draws on evidence from court decisions and experimental philosophy to unpack the fundamentally different visions of corporate identity implicitly encoded in law and in common intuition. The discrepancies suggest important lessons for lawmakers and corporate managers. (shrink)

In abstract algebraic logic, many systems, such as those paraconsistent logics taking inspiration from da Costa's hierarchy, are not algebraizable by even the broadest standard methodologies, as that of Blok and Pigozzi. However, these logics can be semantically characterized by means of non-deterministic algebraic structures such as Nmatrices, RNmatrices and swap structures. These structures are based on multialgebras, which generalize algebras by allowing the result of an operation to assume a non-empty set of values. This leads to an interest in (...) exploring the foundations of multialgebras applied to the study of logic systems. -/- It is well known from universal algebra that, for every signature Sigma, there exist algebras over Sigma which are absolutely free, meaning that they do not satisfy any identities or, alternatively, satisfy the universal mapping property for the class of Sigma-algebras. Furthermore, once we fix a cardinality of the generating set, they are, up to isomorphisms, unique, and equal to algebras of terms (or propositional formulas, in the context of logic). Equivalently, the forgetful functor, from the category of Sigma-algebras to Set, has a left adjoint. This result does not extend to multialgebras. Not only multialgebras satisfying the universal mapping property do not exist, but the forgetful functor U, from the category of Sigma-multialgebras to Set, does not have a left adjoint. -/- In this paper we generalize, in a natural way, algebras of terms to multialgebras of terms, whose family of submultialgebras enjoys many properties of the former. One example is that, to every pair consisting of a function, from a submultialgebra of a multialgebra of terms to another multialgebra, and a collection of choices (which selects how a homomorphism approaches indeterminacies), there corresponds a unique homomorphism, what resembles the universal mapping property. Another example is that the multialgebras of terms are generated by a set that may be viewed as a strong basis, which we call the ground of the multialgebra. Submultialgebras of multialgebras of terms are what we call weakly free multialgebras. Finally, with these definitions at hand, we offer a simple proof that multialgebras with the universal mapping property for the class of all multialgebras do not exist and that U does not have a left adjoint. To what extent can Nietzsche's idea of the Overman be used in connection with transhumanist notions of highly advanced humans and even posthumans?

We propose the use of discussion structures as tools for analyzing policy debates in a way that enables the increased participation of lay stakeholders. Discussion structures are argumentation-theoretical tools that can be employed to tackle three barriers that separate lay stakeholders from policy debates: difficulty, magnitude, and complexity. We exemplify the use of these tools on a debate in research policy on the question of responsibility. By making use of discussion structures, we focus on the argumentative moves performed by the (...) parties involved in this debate. We conclude by discussing advantages and limitations of discussion structures and we trace several opportunities for further research on these instruments. (shrink)

R&D collaborations between industry, government, civil society, and research (also known as ‘quadruple helix collaborations’ (QHCs)) have recently gained attention from R&D theorists and practitioners. In aiming to come to grips with their complexity, past models have generally taken a stakeholder-analytical approach based on stakeholder types. Yet stakeholder types are difficult to operationalise. We therefore argue that a processual model is more suited for studying the interaction in QHCs because it eschews matters of titles and identities. We develop such a (...) model in which the QHC is represented as a process of generating four types of value: research value, market value, political value, and societal value. We then apply this processual model in analysing reallife cases of friction in QHCs. Friction is seen, not as an interpersonal clash, but as a discrepancy between two or more value-creation processes that compete for limited resources (some overperforming while others under-performing). Because corporate social responsibility can be beneficial to both companies and its stakeholders, interest in factors that support CSR performance has grown in recent years. A thorough integration of CSR in core business processes is particularly important for achieving effective long-term CSR practices. Here, we explored the individual CSR-related competencies that support CSR implementation in a corporate context. First, a systematic literature review was performed in which relevant scientific articles were identified and analyzed. Next, 28 CSR directors and managers were (...) interviewed. The literature review complemented with interview data resulted in the following eight distinct CSR-related competencies: Anticipating CSR challenges; Understanding CSR-relevant systems and subsystems; Understanding CSR-relevant standards; CSR management competencies, including Leading CSR programs, Managing CSR programs, and Identifying and realizing CSR-related business opportunities; Realizing CSR-supportive interpersonal processes; Employing CSR-supportive personal characteristics and attitudes; Personal value-driven competencies, including Ethical normative competencies, Balancing personal ethical values and business objectives, and Realizing self-regulated CSR-related behaviors and active involvement; and Reflecting on personal CSR views and experiences.
