Background Consent policies for post-mortem organ procurement (OP) vary throughout Europe, and yet no studies have empirically evaluated the ethical implications of contrasting consent models. To fill this gap, we introduce a novel indicator of governance quality based on the ideal of informed support, and examine national differences on this measure through a quantitative survey of OP policy informedness and preferences in seven European countries. -/- Methods Between 2017–2019, we conducted a convenience sample survey of students (n = 2006) in (...) Austria (AT), Belgium (BE), Denmark (DK), Germany (DE), Greece (GR), Slovenia (SI) and Spain (ES), asking participants about their donation preferences, as well as their beliefs and views about the policy in place. From these measures, we computed indices of informedness, policy support, and fulfilment of unexpressed preferences, which we compared across countries and consent systems. -/- Results Our study introduces a tool for analyzing policy governance in the context of OP. Wide variation in policy awareness was observed: Most respondents in DK, DE, AT and BE correctly identified the policy in place, while those in SI, GR and ES did not. Respondents in opt-out countries (AT, BE, ES and GR) tended to support the policy in place (with one exception, i.e., SI), whereas those in opt-in countries (DE and DK) overwhelmingly opposed it. These results reveal stark differences in governance quality across countries and consent policies: We found a preponderance of informed opposition in opt-in countries and a general tendency towards support–either informed or uninformed–in opt-out countries. We also found informed divergence in opt-in countries and a tendency for convergence–either informed or uninformed–among opt-out countries. -/- Conclusion Our study offers a novel tool for analyzing governance quality and illustrates, in the context of OP, how the strengths and weaknesses of different policy implementations can be estimated and compared using quantitative survey data. El objetivo de este artículo es realizar una historización del sistema sanitario de Neuquén, concretamente atendiendo a los programas de salud aplicados en esta provincia desde su surgimiento hasta el año 2020. En este marco, en primer lugar, me enfocaré en los lineamientos políticos que definieron las bases ideológicas de las políticas públicas llevadas a cabo en la atención sanitaria neuquina, y, en segundo lugar, examinaré las variables estadísticas publicadas por el sistema de salud provincial referidas a las condiciones materiales (...) de atención médica de la población en general, y de las mujeres indígenas mapuce en particular. The paper argues that grounding is neither irreflexive, nor asymmetric, nor transitive. In arguing for that conclusion the paper also arguesthat truthmaking is neither irreflexive, nor asymmetric, nor transitive.

Consider a certain red rose. The proposition that the rose is red is true because the rose is red. One might say as well that the proposition that the rose is red is made true by the rose’s being red. This, it has been thought, does not commit one to a truthmaker of the proposition that the rose is red. For there is no entity that makes the proposition true. What makes it true is how the rose is, and how (...) the rose is is not an entity over and above the rose. It is against this view that I shall argue in this paper. I shall argue that a significant class of true propositions, including inessential predications like the proposition that the rose is red, are made true by entities. "No truthmaking without truthmakers" is my slogan. Although I have my view about what kinds of entities are truthmakers, I shall not argue for or presuppose that view here. All I shall argue for here is that if a proposition is made true by something, it is made true by some thing, but my argument will leave it open what kind of thing that thing is: it could be a fact or state of affairs, a trope, or any other sort of entity. This bulletin contains a summary of the main topics of discussion in truthmaker theory, namely: the definition of truthmakers, problems with Truthmaker Necessitarianism and Truthmaker Maximalism, the ontological burden of truthmakers and the recalcitrant topic of truthmakers for negative truths.

1. The Bundle Theory I shall discuss is a theory about the nature of substances or concrete particulars, like apples, chairs, atoms, stars and people. The point of the Bundle Theory is to avoid undesirable entities like substrata that allegedly constitute particulars. The version of the Bundle Theory I shall discuss takes particulars to be entirely constituted by the universals they instantiate.' Thus particulars are said to be just bundles of universals. Together with the claim that it is necessary that (...) particulars have constituents, the fundamental claim of the Bundle Theory is: (BT) Necessarily, for every particular x and every entity y, y constitutes x if and only ify is a universal and x instantiates y. 2 The standard and supposedly devastating objection to the Bundle Theory is that it entails or is committed to a false version of the Principle of Identity of Indiscernibles (Armstrong 1978: 91, Loux 1998: 107), namely: (Pll) Necessarily, for all particulars x and y and every universal z, if z is instantiated by x if and only if z is instantiated byy, then x is numerically identical with y. The most famous counterexample to the Identity of Indiscernibles is that put forward by Max Black, consisting of a world where there are only two iron spheres two miles apart from each other, having the same diameter, temperature, colour, shape, size, etc (Black 1952: 156). Let us from now on think of the properties of the spheres in this world as universals. The possibility of this world, which I shall hereafter refer to as 'Black's world', makes (Pll) false.' At a crucial juncture in Plato’s Sophist, when the interlocutors have reached their deepest confusion about being and not-being, the Eleatic Visitor proclaims that there is yet hope. Insofar as they clarify one, he maintains, they will equally clarify the other. But what justifies the Visitor’s seemingly oracular prediction? A new interpretation explains how the Visitor’s hope is in fact warranted by the peculiar aporia they find themselves in. In this chapter I shall reply to a pair of articles in which the main contention of my “Why truthmakers” – namely, that an important class of synthetic true propositions have entities as truth-makers – is rejected. In §§1–5 I reply to Jennifer Hornsby’s “Truth without Truthmaking Entities” (2005) and in §§6–7 I reply to Julian Dodd’s “Negative Truths and Truthmaker Principles” (2007).

According to one of Leibniz's theories of contingency a proposition is contingent if and only if it cannot be proved in a finite number of steps. It has been argued that this faces the Problem of Lucky Proof , namely that we could begin by analysing the concept ‘Peter’ by saying that ‘Peter is a denier of Christ and …’, thereby having proved the proposition ‘Peter denies Christ’ in a finite number of steps. It also faces a more general but (...) related problem that we dub the Problem of Guaranteed Proof . We argue that Leibniz has an answer to these problems since for him one has not proved that ‘Peter denies Christ’ unless one has also proved that ‘Peter’ is a consistent concept, an impossible task since it requires the full decomposition of the infinite concept ‘Peter’. We defend this view from objections found in the literature and maintain that for Leibniz all truths about created individual beings are contingent. (shrink)

The goal of this piece is to put some pressure on Brian O’Shaughnessy’s claim that perceptual experiences are necessarily mental processes. The author targets two motivations behind the development of that view. First, O’Shaughnessy resorts to pure conceptual analysis to argue that perceptual experiences are processes. The author argues that this line of reasoning is inconclusive. Secondly, he repeatedly invokes a thought experiment concerning the total freeze of a subject’s experiential life. Even if this case is coherent, however, it does (...) not show that perceptual experiences are processes. (shrink)

Peter van Inwagen has given an answer to the question ‘Why is there something rather than nothing?’. His answer is: Because there being nothing is as improbable as anything can be: it has probability 0. Here I shall examine his argument for this answer and I shall argue that it does not work because no good reasons have been given for two of the argument’s premises and that the conclusion of the argument does not constitute an answer to the question (...) van Inwagen wanted to answer. Peter Milne has tried to refure Truthmaker Maximalism. the thesis that every truth has a truthmaker, by producing a simple and direct counterexample to it, the sentence M: This sentence has no truthmaker. I argue that, contrary to what Milne argues, on Truthmaker Maximalism M is equivalent to the Liar, which gives the truthmaker maximalist a way to defend his position from Milne's counterexample: to argue that M expresses no proposition.

Raymond Geuss asserts that there are fragmented views on what human rights are and that there is no unifying principle underlying such notion. I think that this view has its merits. It conveys the particularity of our perspectives, attitudes, desires and selfunderstandings. It rejects abstractness and is committed to a thick, perspectivist, historical understanding of personhood. To understand who we are, is to understand how we arrive at being who we are. By contrast, the notion of human rights deploys abstractness, (...) unification of agency, necessity and a thin view of personhood. In this paper, I attempt to bring into focus these two aspects of the notion of human rights. I will first analyse the genealogical method advocated by Geuss and argue that it has the merit of elucidating our historical contingencies; however, it is argued that any view in favour of the genealogical method relies on the idea that evaluative or normative concepts cannot be defined in terms of a common denominator. We reconstruct the Aristotelian idea of ‘focal meaning’ as core-resemblance and show that there is a unifying concept of human rights. We conclude that the perspectivist spirit of genealogy is not far from the Aristotelian tradition. Aristotle’s inquiry into a concept that could grasp different perspectives and contingencies as opposed to a Platonic understanding of abstract and universal forms shows that genealogical worries are germane to the tradition. Plato’s Parmenides and Lysis have a surprising amount in common from a methodological standpoint. Both systematically employ a method that I call ‘exploring both sides’, a philosophical method for encouraging further inquiry and comprehensively understanding the truth. Both have also been held in suspicion by interpreters for containing what looks uncomfortably similar to sophistic methodology. I argue that the methodological connections across these and other dialogues relieve those suspicions and push back against a standard developmentalist story about Plato’s method. Bertrand Russell argued that any attempt to get rid of universals in favor of resemblances fails. He argued that no resemblance theory could avoid postulating a universal of resemblance without falling prey to a vicious infinite regress. He added that admitting such a universal of resemblance made it pointless to avoid other universals. In this paper I defend resemblance nominalism from both of Russell's points by arguing that (a) resemblance nominalism can avoid the postulation of a universal of resemblance without (...) falling into a vicious infinite regress, and (b) even if resemblance nominalism had to admit a universal of resemblance, this would not make it pointless to avoid postulating other universals. The Parmenides has been unduly overlooked in discussions of hypothesis in Plato. It contains a unique method for testing first principles, a method I call ‘exploring both sides’. The dialogue recommends exploring the consequences of both a hypothesis and its contradictory and thematizes this structure throughout. I challenge the view of Plato’s so-called ‘method of hypothesis’ as an isolated stage in Plato’s development; instead, the evidence of the Parmenides suggests a family of distinct hypothetical methods, each with its own peculiar (...) aim. Sacrificial dilemmas such as the trolley problem play an important role in experimental philosophy (x-phi). But it is increasingly argued that, since we are not likely to encounter runaway trolleys in our daily life, the usefulness of such thought experiments for understanding moral judgments in more ecologically valid contexts may be limited. However, similar sacrificial dilemmas are experienced in real life by animal research decision makers. As part of their job, they must make decisions about the suffering, and often the (...) death, of many non-human animals. For this reason, a context-specific investigation of so-called “3R dilemmas” (i.e., dilemmas where there is a conflict between the principles of replacement, reduction, and refinement of the use of animals in research) is essential to improve the situation of both non-human animals and human stakeholders. An approach well suited for such investigation is experimental philosophical bioethics (“bioxphi”), which draws on methods similar to x-phi to probe more realistic, practical scenarios with an eye to informing normative debates and ethical policy. In this article, we argue for a need to investigate 3R dilemmas among professional decision-makers using the tools of bioxphi. In a first step, we define 3R dilemmas and discuss previous investigations of professionals’ attitudes in such cases. In a second step, we show how bioxphi is a promising method to investigate the whys and hows of professional decision-making in 3R dilemmas. In a last step, we provide a bioxphi template for 3R dilemmas, give recommendations on its use, explore the normative relevance of data collected by such means, and discuss important limitations. Llamaré extensiva a la interpretación que sostiene la obligación de ser veraces en todas las declaraciones y mostraré que es causa de inconsistencias con la Doctrina del Derecho. Las inconsistencias se resuelven con una interpretación restrictiva (...) de este deber: la obligación de veracidad es aplicable solo a las comunicaciones públicas. Si mi interpretación es correcta, todas las comunicaciones públicas, ya sean hechas por ciudadanos o funcionarios, tienen la obligación de ser veraces, pero no en las privadas. In this issue of the Report, James L. Bernat proposes an innovative and sophisticated distinction to justify the introduction of permanent cessation as a valid substitute standard for irreversible cessation in death determination. He differentiates two approaches to conceptualizing and determining death: the biological concept and the prevailing medical practice standard. While irreversibility is required by the biological concept, the weaker criterion of permanence, he claims, has always sufficed in the accepted standard medical practice to declare death. Bernat argues that (...) the medical practice standard may be acceptable on the ground that proving circulatory or brain permanence is sufficient to assure complete accuracy for death diagnosis. -/- The topic requires public deliberation: processes to survey people's opinions and mechanisms to channel their opinions into policy-making. What is at stake is the nature of our society. Nuestro objetivo consiste en caracterizar la ontología corporal de las mujeres indígenas mapuce desde el esquema epistemológico sujeto-sujeto, propio de las teorías decoloniales. En este aspecto, nos interesa desnaturalizar ciertos mecanismos de subalternización, en tanto huellas de la colonialidad, que siguen operando no solo en la construcción de sentidos, sino también como reproductores de la opresión interseccional que experimentan estas mujeres. Preliminarmente, para este planteo, nos enfocaremos en la delimitación del concepto de interseccionalidad. Luego, intentaremos articular, desde un planteo feminista (...) decolonial, diversas narrativas de estas mujeres mapuce, vinculadas a la precarización de sus vidas y su salud, como parte de las violencias instituidas por la cultura hegemónica. Finalmente, nos resulta fundamental poner de relieve la resiliencia de las culturas subalternizadas, como forma horizontalizada de narrativizar un sentir decolonial desde la memoria performativa del cuerpo, contra ciertos dispositivos de subalternización, a partir de la clara referencia a las luchas y re-existencias de las mujeres indígenas mapuce, en el marco de una perspectiva situada en la decolonización, la emancipación y la liberación de los pueblos oprimidos. En este artículo se plantean las bases del marco ético-normativo que intervienen en la atención sanitaria de las mujeres en general, y de las mujeres mapuce, en particular. Posteriormente, se realiza un abordaje de las mujeres indígenas analizando su situación concreta, a partir de considerar de manera crítica la confluencia intersectorial de distintos sistemas opresivos que articulan las relaciones de género, clase y etnia. Para ello, el planteo se centrará en el estudio de esta problemática desde la perspectiva feminista latinoamericana, (...) que será, seguidamente, retomada y contrastada desde la voz propia de mujeres que se autoidentifican como mapuce. El objetivo del artículo se centra en poner de manifiesto las múltiples dificultades que presentan las mujeres indígenas en el acceso a la salud, con el propósito de justificar la necesidad de articular políticas públicas que promuevan la democratización del acceso sanitario, en tanto derecho humano. Para ello, realizaremos un abordaje teórico-normativo que ponga en evidencia las responsabilidades éticas y políticas del Estado, como ente garante del acceso a la salud de sus ciudadanos, en particular de los más vulnerados, como lo son las mujeres de comunidades indígenas en nuestro país. Para ello, analizaremos la propuesta bidimensional de la filósofa estadounidense Nancy Fraser. En efecto, plantearemos la necesidad de reflexionar sobre las implicancias de este planteo en el plano de las injusticias de género. Resemblance Nominalism is the view that denies universals and tropes and claims that what makes F-things F is their resemblances. A famous argument against Resemblance Nominalism is Russell's regress of resemblances, according to which the resemblance nominalist falls into a vicious infinite regress. Aristocratic Resemblance Nominalism, as opposed to Egalitarian Resemblance Nominalism, is the version of Resemblance Nominalism that claims that what makes F-things F is that they resemble the F-paradigms. In this paper I attempt to show that a recently (...) advocated strategy to stop Russell's regress by using paradigms does not succeed. (shrink)

In most domains of human life, we are willing to accept that there are experts with greater knowledge and competencies that distinguish them from non-experts or laypeople. Despite this fact, the very recognition of expertise curiously becomes more controversial in the case of “moral experts”. Do moral experts exist? And, if they indeed do, are there ethical reasons for us to follow their advice? Likewise, can emerging technological developments broaden our very concept of moral expertise? In this article, we begin (...) by arguing that the objections that have tried to deny the existence (and convenience) of moral expertise are unsatisfactory. After that, we show that people have ethical reasons to ask for a piece of moral advice in daily life situations. Then, we argue that some Artificial Intelligence (AI) systems can play an increasing role in human morality by becoming moral experts. Some AI-based moral assistants can qualify as artificial moral experts and we would have good ethical reasons to use them. (shrink)

The subtraction argument, originally put forward by Thomas Baldwin (1996), is intended to establish Metaphysical Nihilism, the thesis that there could have been no concrete objects. Some modified versions of the argument have been proposed in order to avoid some difficulties faced by the original argument. In this paper I shall concentrate on two of those versions, the so-called subtraction argument* (presented and defended in Rodriguez-Pereyra 1997, 2000, 2002), and Efird and Stoneham’s recent version of the argument (Efird and (...) Stoneham 2005). I shall defend the subtraction argument* from Alexander Paseau’s (2006) objection that because a crucial premise of the subtraction argument* may have no plausibility independent from Metaphysical Nihilism, the subtraction argument* is not suasive. Although Paseau focuses on the subtraction argument*, I shall point out that Efird and Stoneham could reply to Paseau’s objection in the same way. Thus there are (at least) two suasive versions of the subtraction argument that establish Metaphysical Nihilism. But are those two arguments equally good? I shall argue that the subtraction argument* is preferable to Efird and Stoneham’s argument. (shrink)

Desde un esquema epistemológico sujeto-sujeto y desde un planteo feminista decolonial, nos acercará narrativas de mujeres mapuce que versan sobre la precarización de sus vidas y salud como parte de las violencias instituidas por la cultura hegemónica, poniendo sobre relieve la resiliencia de las culturas subalternizadas a partir de la lucha y re-existencia de estas mujeres.

En el presente artículo se abordarán los aportes realizados por Gramsci en la construcción de la figura del intelectual. Para ello, se caracterizarán los rasgos distintivos del determinismo histórico marxista, para luego enfocarnos en el pensamiento gramsciano. A partir de allí nos centraremos de manera expresa en los argumentos desplegados por Gramsci al procurarle una función activa a la figura del intelectual, en tanto intelectual colectivo que se va conformando encarnado en el partido revolucionario de la clase obrera. De esta (...) manera, plantearemos que esta disposición del intelectual colectivo se enlaza con los problemas de la vida social en la búsqueda de unificar teoría y praxis, y pretende crear así una nueva hegemonía, puesto que admite la indeterminabilidad de la historia según leyes. Causation was an important topic of philosophical reflection during the Seventeenth Century. This reflection centred around certain particular problems about causation, one of which was the problem of causation between mind and body. The doctrine of the pre-established harmony is Leibniz's response to the problem of causation between mind and body. In this chapter I shall (a) explain the problem of mind-body causation; (b) explain Leibniz's pre-established harmony; and (c) assess his case for it.

Aunque no es posible ofrecer aquí un análisis detallado de las diferentes cues tionesimplicadas en la teoría de las representaciones en la Modernidad, sí pode mos atender auno de sus aspectos más relevantes, presente en la exposición de Leibniz, Wolff,Baumgarten y Kant, a saber: el reconocimiento progresivo y la vin dicación de unconocimiento específicamente sensible como un tipo específico de conocimiento en lafilosofía escolar alemana del siglo XVIII. A pesar de que Leibniz atribuye al conocimiento claro y confuso el grado (...) más bajo en su esquema de los niveles del conocimiento, tambiénes cierto que su exposición apunta ya a la irre ductibilidad de este ámbito en unconocimiento finito como el humano. Por lo demás, lo confuso aquí adquiere sentido en elsistema del saber en la medida en que Leibniz considera que todos los conocimientos obre cuestiones de hecho, si bien falibles, se encuentran en conexión con la verdad en lamedida en que parti cipan de la misma, al expresar el fundamento último de lo real y sersusceptibles de perfectibilidad en el seno de una subjetividad dinámica que comienza aser entendida como unidad vital. En Wolff y Baumgarten se profundiza en la vía que esabierta ya por Leibniz: la exposición de los niveles de conocimiento en el marco de unaimbricación de la lógica de la representación con una psicología vitalista, en la que sereconocerá la experiencia del sentimiento como expresión subjetiva de la perfectibilidaddel conocimiento humano. Aunque la filosofía de Kant supondrá una ruptura con laexposición escolar de esta teoría de los niveles de conocimiento o los tipos derepresentación, lo cierto es que el nacimiento de su teoría de la sensi bilidad tiene lugar enel marco histórico de esta concepción tradicional. Los intereses contrapuestos en relación con el manejo, uso, utilización y aprovechamiento de los recursos naturales de los territorios indígenas, generan conflictos ambientales en donde uno de los escenarios privilegiados de expresión de los mismos es el de la consulta previa: cuando se adelanta o por el contrario, cuando aunque sea obligatoria, no se impulsa o se hace de manera inadecuada, es decir, sin el cumplimiento de los requisitos mínimos establecidos.

This paper is a response to replies by Dan López de Sa and Mark Jago to my ‘Truthmaking, Entailment, and the Conjuction Thesis’. In that paper, my main aim was to argue against the Entailment Principle by arguing against the Conjunction Thesis, which is entailed by the Entailment Principle. In the course of so doing, although not essential for my project in that paper, I defended the Disjunction Thesis. López de Sa has objected both to my defence of the Disjunction (...) Thesis and my case against the Conjunction Thesis. I shall show that his objections are unfounded and based on serious misunderstandings of my position, what the relevant debate is, and some fundamental notions of Truthmaker Theory. Jago argues that accepting the Disjunction Thesis and rejecting the Conjunction Thesis is hard to maintain. But I show that Jago has not shown that accepting the Disjunction Thesis while rejecting the Conjunction Thesis is impossible or even hard to maintain. Jago believes that, to accept the Disjunction Thesis while rejecting the Conjunction Thesis, one needs to reject his axiom (T3), which says that all the truthmakers for <P&P> are truthmakers for <P>. I argue that there are reasons to reject such a principle, and the version of it that says that what makes <P&P> true makes <P> true. (shrink)

Gorgias’ On Not-Being survives only in two divergent summaries. Diels–Kranz's classic edition prints the better-preserved version that appears in Sextus’ Aduersus Mathematicos. Yet, in recent years there has been rising interest in a second summary that survives as part of the anonymous De Melisso, Xenophane, Gorgia. The text of MXG is more difficult; it contains substantial lacunae that often make it much harder to make grammatical let alone philosophical sense of. As Alexander Mourelatos reports, one manuscript has a scribal note (...) that reads: "The original contains many errors; no one should blame me; I just copy what I see.". The treatise's state of preservation has aptly prompted Michael Gagarin to liken it to a black hole: "something we cannot see directly but know must exist because of certain effects it has on other objects.". In the 1750s Optimism, the Leibnizian doctrine that the actual world is the best possible world, popularised by Pope in 1733 in his Essay on Man, was a hot topic. In 1759 Kant wrote and published a brief essay defending Optimism, Attempt at some Reflections on Optimism. Kant’s aim in this essay is to establish that there is one and only one best possible world. In particular, he argues against the claim that, for every possible world, there is a possible (...) world better than it and against the claim that there are two or more equally good possible worlds that are better than all the rest. Although it is not clear why, Kant was later dissatisfied with his essay. In this article I shall reconstruct, discuss, and evaluate Kant’s arguments. My evaluation will be negative, and so I think Kant had reasons to be dissatisfied with his essay. (shrink)

Leibniz was a philosopher of principles: the principles of Contradiction, of Sufficient Reason, of Identity of Indiscernibles, of Plenitude, of the Best, and of Continuity are among the most famous Leibnizian principles. In this article I shall focus on the first three principles; I shall discuss various formulations of the principles (sect. 1), what it means for these theses to have the status of principles or axioms in Leibniz’s philosophy (sect. 2), the fundamental character of the Principles of Contradiction and (...) Sufficient Reason (sect. 3), some attempts to demonstrate the Principles of Contradiction and Sufficient Reason (sect. 4), and one attempt to demonstrate the Principle of Identity of Indiscernibles (sect. 5). Background: Several countries have recently changed their model of consent for organ donation from opt-in to opt-out. We undertook a systematic review to determine public knowledge and attitudes towards these models in Europe. Methods: Six databases were explored between 1 January 2008 and 15 December 2017. We selected empirical studies addressing either knowledge or attitudes towards the systems of consent for deceased organ donation by lay people in Europe, including students. Study selection, data extraction, and quality assessment were conducted by (...) two or more reviewers independently. Findings: Awareness of the consent model was lower in opt-out countries than in opt-in countries. A majority of the public agrees with opt-in, regardless of the law in their own country. There are ambivalent attitudes regarding the opt-out system. The public tend to prefer opt-in and mandatory choice over opt-out when several options are offered. Interpretation: The assumption that people in opt-out countries are aware of the legal requirements to be excluded from the pool of potential donors is not supported by the results of this review. This is a concern, since ignorance hinders people's autonomy regarding organ donation decision-making. Higher awareness of consent model in opt-in countries may reflect greater efforts to inform the public through campaigns to motivate donation. Legal moves towards opt-out are at odds with people's expressed preferences. Main limitations of this review are the lack of data from some countries, study population heterogeneity, and methodological shortcomings. (shrink)

The object of this paper is to provide a solution to Nelson Goodman’s Imperfect Community difficulty as it arises for Resemblance Nominalism, the view that properties are classes of resembling particulars. The Imperfect Community difficulty consists in that every two members of a class resembling each other is not sufficient for it to be a class such that there is some property common to all their members, even if ‘x resembles y’ is understood as ‘x and y share some property’. (...) In the paper I explain and criticise several solutions to the difficulty. Then I develop my own solution, which is not subject to the objections I make to the other solutions, and which accords completely with the basic tenets of Resemblance Nominalism. (shrink)

Since 1968, the irreversible loss of functioning of the whole brain, called brain death, is assimilated to individual’s death. The almost universal acceptance of this neurological criterion of death had decisive consequences for the contemporary medicine, such as the withdrawal of mechanical ventilation in these patients and organ retrieval for transplantation. The new criterion was successfully accepted in part because the assimilation of brain death state to death was presented by medicine --and acritically assumed by most of societies-- as a (...) scientific and objective fact. Nevertheless, many people do not think that the patients suffering brain death are actually dead. We show here that those people are not necessarily wrong. It can be argued that, in fact, the justification of the neurological criterion is not scientific but moral. We outline the thesis that the problem surrounding the vital status of brain dead patients is due to a confusion between factual and normative questions. Furthermore, we claim that the donation of organs and the withdrawal of life-support could be ethically acceptable even if the patients suffering brain death are considered as alive. As an alternative to the dead donor rule, we propose a justification for organ donation of brain-dead patients based on the (moral) concepts of harm and consent : what truly justifies the procurement of organs on those patients is not that they are dead, but that they wish to donate their organs and that, since they have irreversibly lost their brain, they cannot be harmed. Con el objetivo de reflexionar sobre la potencialidad filosófica y política que tienen los afectos “negativos”, me interesa repensar el rol social de estos afectos a partir de abordar los efectos, en términos de agencialidad, que pueden propiciar en el ámbito político. Para ello, comenzaré con una breve caracterización sobre las implicancias del concepto de “olas” del feminismo, para entender a grandes rasgos los cambios históricos conquistados por las luchas feministas y los activismos. En este sentido, me situaré en la (...) “cuarta ola” del feminismo para abordar las nociones vinculadas al giro afectivo, a partir del fuerte cuestionamiento que esta matriz teórica le realiza a la noción de temporalidad lineal. Finalmente, analizaré la potencialidad que portan los afectos “negativos” en la escena política, a partir de resaltar el fuerte tono revolucionario que estas emociones, en tanto expresiones de la visceralidad, pueden tener en la transformación de la sociedad cuando irrumpen en el orden público. En el presente artículo se abordarán los aportes de Nietzsche, Freud y Marx, como fundadores de discurso, desde la perspectiva foucaultiana. Para ello, se trabajará con la ponencia "Nietzsche, Freud y Marx" realizada por Foucault en 1964. Foucault condensa en esta ponencia una obra que resulta muy rica, debido a que sintetiza de manera clara los aportes realizados por los "maestros de la sospecha". La riqueza de la obra radica en que expone un giro en las técnicas de la interpretación (...) que permite comprender a la hermenéutica, lejos del descifrado oculto de signos, como una estrategia de producción de nuevos símbolos, en la creación de nuevos imaginarios que construyen diversos y variados sentidos (Grüner, 1995: 11). De esta manera, en el presente escrito se planteará un acercamiento al empleo de las técnicas interpretativas que han llevado a cabo Nietzsche, Freud y Marx, como una forma de acceder a la hermenéutica de la sospecha propuesta por este trío. Para el desarrollo de esta propuesta partiremos de la caracterización general de los tres fundadores de discurso, para puntualizar en la impronta propia de la hermenéutica de cada uno. (shrink)

Whether Nietzsche’s genealogical critique of morality is best understood as an internal or as an external critique remains a matter of controversy. On the internalist interpretation (Ridley, Owen, Merrick ), the genealogical enterprise takes as its starting point the perspective being criticized, gradually revealing it to be untenable ‘from within.’ On the externalist interpretation (Leiter, and arguably Geuss, Williams, and Janaway ), this constraint is lifted; the starting point of the critique need not be the perspective being criticized, but may (...) be that of someone who already suspects the latter to be untenable. According to a common objection to ‘external critique’ interpretations, the limited-scope objection, since an external critique to a value-system could only work on an audience whose members were predisposed to abandon that system of values, ‘external critique’ interpretations impose a severe limitation on the transformative potential of Nietzsche’s project. ‘Internal critique’ interpretations, by contrast, can seem hard to reconcile with the polemical character of On the Genealogy of Morality (which lends the book its subtitle, Eine Streitschrift) and with Nietzsche’s frequent remarks to the effect his works were addressing a particular, ‘higher,’ kind of individual. -/- The overarching goal in this paper is to call into question the usefulness of the ‘internal-external’ or ‘immanent-transcendent’ dichotomy for understanding Nietzsche’s genealogical critique. I argue that the apparent usefulness of the distinction between external and internal critiques when approaching Nietzsche’s works rests on the assumption that any critique of values must itself be grounded on values that function as evaluative-critical standards. If the assumption is right, then one of two things, either the values that are deployed as standards coincide with those that are the target of critique, in which case the critique is internal, or they are not (etc.). Thus the assumption is liable to render us forgetful of a third possibility, that of a critical strategy that does not work by deploying (internal or external) values as standards of critical assessment, but by revealing something about the nature of value, and more precisely about the origin of any individual’s commitments to their values. -/- On the view that I defend, one of the crucial steps of Nietzsche’s genealogical method is to bring his reader to realize that any individual’s commitment to their values is expressive of and rooted in their commitment to preserve their way of life. Realizing this does not require that the reader abandon their own values. But it does require that they acknowledge that were they committed to a relevantly different way of life, they would subscribe to different values. And this, in turn, suffices to bring about a transformation in their understanding of and relationship to those commitments through the further realization that it is ultimately always up to them to undertake the project of taking distance from and ‘re-evaluating’ those values. This article will address the considerations that must be examined in the design of public policies and government programs to achieve an intercultural approach to the health of the Pu Mapuce Zomo (Mapuce women). In this sense, the proposed objective is to formulate three essential aspects that serve as a basis to promote adequate frameworks for public health policies oriented towards an intercultural approach. For this, methodologically, from a qualitative approach, the ethical, gender(s) and epistemic aspects that must be considered (...) in the configuration of health programs that favor the health care of indigenous women will be investigated. With this purpose, it begins by delimiting the unavoidable ethical-normative and gender approach to highlight the basic needs of Mapuce women. This approach seeks to establish a parameter about the obligations that States have in relation to the development of human capabilities. Finally, three aspects will be presented that the State must replicate in its health proposals to guarantee the construction of an intercultural approach to health, appropriate to the basic needs of Mapuce women in Argentina. This work deals with the particular nature of consciousness in comparison to matter, as well as with the question of how conscious subjective experience can be possible at all. Based on a step-by-step derivation, a new approach is introduced and a theory for a possible explanation is proposed, named C-Pattern Theory. The statements and implications resulting from C-Pattern Theory reveal new perspectives on elementary aspects of reality and open up new possibilities with regard to fundamental questions.

In this book chapter, we study the preventive rule, raised in Ley 1333 de 2009, and the way that environmental law has been building its own rules; escaping from the administrative law and creating their own dogmatic, necessary to achieve its independence as a legal autonomous area. We also see that is possible to see how the preventive rule was designed out of the general theory of administrative act, because it has characteristics that make it unique in the Colombian legal (...) system. -/- En este capítulo se estudia la figura de la 'facultad a prevención' contenida en la Ley 1333 de 2009, para analizar la forma en la que el derecho ambiental ha venido construyendo una dogmática y reglas propias, escapando de la tradición del derecho administrativo, así como creando la dogmática propia necesaria para lograr su independencia y consolidación como un área autónoma de la disciplina jurídica. Al respecto, en este ejercicio de reflexión es posible ver cómo la figura aparte de estar diseñada por fuera de la teoría general del acto administrativo, también posee particularidades que la hacen única dentro del ordenamiento jurídico colombiano. In this paper, I will explore a concept of person in Kant based on two features: the unity of consciousness and the consciousness of the numerical identity of one’s body in time. The reason for choosing these features is that I take as my starting point the notion of personhood from rational psychology that appears in the major premise of the third paralogism (A361). I will focus on the second feature in order to show that since Kant it is possible (...) to think of the body not merely as an object, but as a subject, i.e., that bodily awareness is self-awareness. I will explain this on the basis of what I will denominate the thesis of corporeality. To develop this thesis, I will draw on passages from Kant’s work and contemporary considerations of bodily awareness, specifically the immunity to error through misidentification. (shrink)

In this paper I present what I call the 'Metaphysical Problem of Truth', which consists in explaining in virtue of what all true sentences are true, and argue that a version of the Correspondence Theory of Truth is the most plausible solution to this problem.

The Razor says: do not multiply entities without necessity! The Laser says: do not multiply fundamental entities without necessity! Behind the Laser lies a deep insight. This is a distinction between the costs and the commitments of a theory. According to the Razor, every commitment is a cost. Not so according to the Laser. According to the Laser, derivative entities are an ontological free lunch: that is, they are a commitment without a cost. Jonathan Schaffer (2015) has argued that the (...) Laser should replace the Razor. In Sections 2-4 we shall discuss and argue against Schaffer’s arguments for replacing the Razor with the Laser. Schaffer considers several objections to his views, and in Sections 5-7 we shall argue that Schaffer does not deal successfully with two of them. In Section 8 we shall present a probabilistic argument for the Laser. However, the argument has a limitation and does not support the replacement of the Razor with the Laser. Indeed, it supports only the claim that, given certain assumptions, the multiplication of explanatorily relevant derivative entities does not matter; but, as we argue in the same section, there is an argument that multiplying explanatorily superfluous derivative entities does makes a theory less rationally acceptable. Our conclusion is that the Laser cannot replace the Razor and that derivative entities are not an ontological free lunch. (shrink)
