O objetivo deste trabalho é desafiar as correntes tradicionais da bioética, que fundamentam ideais abstratos de imparcialidade, cidadania universal e autonomia absoluta; confrontá-los a partir do conhecimento situado e do reconhecimento da matriz de dominação interseccional vigente na América Latina. Procura investigar como transformar múltiplas desigualdades, repolitizando a justiça interseccional, a agência política em momentos críticos de progresso e colonização dos nossos bens comuns. 1. The Bundle Theory I shall discuss is a theory about the nature of substances or concrete particulars, like apples, chairs, atoms, stars and people. The point of the Bundle Theory is to avoid undesirable entities like substrata that allegedly constitute particulars. The version of the Bundle Theory I shall discuss takes particulars to be entirely constituted by the universals they instantiate.' Thus particulars are said to be just bundles of universals. Together with the claim that it is necessary that (...) particulars have constituents, the fundamental claim of the Bundle Theory is: (BT) Necessarily, for every particular x and every entity y, y constitutes x if and only ify is a universal and x instantiates y. 2 The standard and supposedly devastating objection to the Bundle Theory is that it entails or is committed to a false version of the Principle of Identity of Indiscernibles (Armstrong 1978: 91, Loux 1998: 107), namely: (Pll) Necessarily, for all particulars x and y and every universal z, if z is instantiated by x if and only if z is instantiated byy, then x is numerically identical with y. The most famous counterexample to the Identity of Indiscernibles is that put forward by Max Black, consisting of a world where there are only two iron spheres two miles apart from each other, having the same diameter, temperature, colour, shape, size, etc (Black 1952: 156). Let us from now on think of the properties of the spheres in this world as universals. The possibility of this world, which I shall hereafter refer to as 'Black's world', makes (Pll) false.' The Parmenides has been unduly overlooked in discussions of hypothesis in Plato. It contains a unique method for testing first principles, a method I call ‘exploring both sides’. The dialogue recommends exploring the consequences of both a hypothesis and its contradictory and thematizes this structure throughout. I challenge the view of Plato’s so-called ‘method of hypothesis’ as an isolated stage in Plato’s development; instead, the evidence of the Parmenides suggests a family of distinct hypothetical methods, each with its own peculiar (...) aim. Exploring both sides is unique both in its structure and in its aim of testing candidate principles. (shrink)

Background Consent policies for post-mortem organ procurement (OP) vary throughout Europe, and yet no studies have empirically evaluated the ethical implications of contrasting consent models. To fill this gap, we introduce a novel indicator of governance quality based on the ideal of informed support, and examine national differences on this measure through a quantitative survey of OP policy informedness and preferences in seven European countries. -/- Methods Between 2017–2019, we conducted a convenience sample survey of students (n = 2006) in (...) Austria (AT), Belgium (BE), Denmark (DK), Germany (DE), Greece (GR), Slovenia (SI) and Spain (ES), asking participants about their donation preferences, as well as their beliefs and views about the policy in place. From these measures, we computed indices of informedness, policy support, and fulfilment of unexpressed preferences, which we compared across countries and consent systems. -/- Results Our study introduces a tool for analyzing policy governance in the context of OP. Wide variation in policy awareness was observed: Most respondents in DK, DE, AT and BE correctly identified the policy in place, while those in SI, GR and ES did not. Respondents in opt-out countries (AT, BE, ES and GR) tended to support the policy in place (with one exception, i.e., SI), whereas those in opt-in countries (DE and DK) overwhelmingly opposed it. These results reveal stark differences in governance quality across countries and consent policies: We found a preponderance of informed opposition in opt-in countries and a general tendency towards support–either informed or uninformed–in opt-out countries. We also found informed divergence in opt-in countries and a tendency for convergence–either informed or uninformed–among opt-out countries. -/- Conclusion Our study offers a novel tool for analyzing governance quality and illustrates, in the context of OP, how the strengths and weaknesses of different policy implementations can be estimated and compared using quantitative survey data. The paper clarifies the sense of remark 202 of Wittgenstein's *Philosophical Investigations* with respect to its relation to the private language argument. It argues, against what some have maintained, that remark 202 is not meant to reject the possibility of a private language as this is defined in remark 243.

According to one of Leibniz's theories of contingency a proposition is contingent if and only if it cannot be proved in a finite number of steps. It has been argued that this faces the Problem of Lucky Proof , namely that we could begin by analysing the concept ‘Peter’ by saying that ‘Peter is a denier of Christ and …’, thereby having proved the proposition ‘Peter denies Christ’ in a finite number of steps. It also faces a more general but (...) related problem that we dub the Problem of Guaranteed Proof . We argue that Leibniz has an answer to these problems since for him one has not proved that ‘Peter denies Christ’ unless one has also proved that ‘Peter’ is a consistent concept, an impossible task since it requires the full decomposition of the infinite concept ‘Peter’. We defend this view from objections found in the literature and maintain that for Leibniz all truths about created individual beings are contingent. (shrink)

En el presente artículo se abordarán los aportes realizados por Gramsci en la construcción de la figura del intelectual. Para ello, se caracterizarán los rasgos distintivos del determinismo histórico marxista, para luego enfocarnos en el pensamiento gramsciano. A partir de allí nos centraremos de manera expresa en los argumentos desplegados por Gramsci al procurarle una función activa a la figura del intelectual, en tanto intelectual colectivo que se va conformando encarnado en el partido revolucionario de la clase obrera. De esta (...) manera, plantearemos que esta disposición del intelectual colectivo se enlaza con los problemas de la vida social en la búsqueda de unificar teoría y praxis, y pretende crear así una nueva hegemonía, puesto que admite la indeterminabilidad de la historia según leyes. The goal of this piece is to put some pressure on Brian O’Shaughnessy’s claim that perceptual experiences are necessarily mental processes. The author targets two motivations behind the development of that view. First, O’Shaughnessy resorts to pure conceptual analysis to argue that perceptual experiences are processes. The author argues that this line of reasoning is inconclusive. Secondly, he repeatedly invokes a thought experiment concerning the total freeze of a subject’s experiential life. Este artículo trata de una inscripción constructiva omeya andalusí del año 387 / 4 enero 997-2 enero 998, hoy perdida, pero transmitida a través de un resumen castellano incluido en una lápida de 1259 "reparada" en 1575. Se intenta la restitución del texto árabe original y se estudian los hechos y los personajes documentados.

Aunque no es posible ofrecer aquí un análisis detallado de las diferentes cues tionesimplicadas en la teoría de las representaciones en la Modernidad, sí pode mos atender auno de sus aspectos más relevantes, presente en la exposición de Leibniz, Wolff,Baumgarten y Kant, a saber: el reconocimiento progresivo y la vin dicación de unconocimiento específicamente sensible como un tipo específico de conocimiento en lafilosofía escolar alemana del siglo XVIII. A pesar de que Leibniz atribuye al conocimiento claro y confuso el grado (...) más bajo en su esquema de los niveles del conocimiento, tambiénes cierto que su exposición apunta ya a la irre ductibilidad de este ámbito en unconocimiento finito como el humano. Por lo demás, lo confuso aquí adquiere sentido en elsistema del saber en la medida en que Leibniz considera que todos los conocimientos obre cuestiones de hecho, si bien falibles, se encuentran en conexión con la verdad en lamedida en que parti cipan de la misma, al expresar el fundamento último de lo real y sersusceptibles de perfectibilidad en el seno de una subjetividad dinámica que comienza aser entendida como unidad vital. En Wolff y Baumgarten se profundiza en la vía que esabierta ya por Leibniz: la exposición de los niveles de conocimiento en el marco de unaimbricación de la lógica de la representación con una psicología vitalista, en la que sereconocerá la experiencia del sentimiento como expresión subjetiva de la perfectibilidaddel conocimiento humano. Aunque la filosofía de Kant supondrá una ruptura con laexposición escolar de esta teoría de los niveles de conocimiento o los tipos derepresentación, lo cierto es que el nacimiento de su teoría de la sensi bilidad tiene lugar enel marco histórico de esta concepción tradicional. Una primera línea se puede percibir en el trabajo de Žižek sobre una política del goce cuya trayectoria circula desde el deseo a la pulsión. Desde una investigación muy orientada en el problema del sujeto, en el carácter sintomático del mismo, Žižek se ha desplazado hacia un análisis de la relación entre el objeto a y la pulsión en el marco del capitalismo actual. En conexión con esta problemática se encuentra una segunda línea que tiene como punto central el trabajo crítico sobre las relaciones entre economía y política; frente al desafío que supone hoy en día la circulación espontánea del capital y el abandono del ámbito económico por parte de la teoría política. Por un lado nos encontramos con los dos sentidos del término escatología, el económico y el teológico-político, que convergen en la noción de exceso, sea de la pulsión o sea del objeto a. Al mismo tiempo, Žižek considera que no es posible traducir la atención sobre el exceso capitalista y su propia revolución inmanente en términos de dominación política.Ambas secuencias se encuentran, en definitiva, íntimamente vinculadas en la crítica de la economía política del discurso que Žižek lleva a cabo. La introducción del término paralaje puede servir como alternativa para entender la oscilación permanente que se produce en su obra entre síntoma y escatología. Throughout the biological and biomedical sciences there is a growing need for, prescriptive ‘minimum information’ (MI) checklists specifying the key information to include when reporting experimental results are beginning to find favor with experimentalists, analysts, publishers and funders alike. Such checklists aim to ensure that methods, data, analyses and results are described to a level sufficient to support the unambiguous interpretation, sophisticated search, reanalysis and experimental corroboration and reuse of data sets, facilitating the extraction of maximum value from data sets (...) them. However, such ‘minimum information’ MI checklists are usually developed independently by groups working within representatives of particular biologically- or technologically-delineated domains. Consequently, an overview of the full range of checklists can be difficult to establish without intensive searching, and even tracking thetheir individual evolution of single checklists may be a non-trivial exercise. Checklists are also inevitably partially redundant when measured one against another, and where they overlap is far from straightforward. Furthermore, conflicts in scope and arbitrary decisions on wording and sub-structuring make integration difficult. This presents inhibit their use in combination. Overall, these issues present significant difficulties for the users of checklists, especially those in areas such as systems biology, who routinely combine information from multiple biological domains and technology platforms. To address all of the above, we present MIBBI (Minimum Information for Biological and Biomedical Investigations); a web-based communal resource for such checklists, designed to act as a ‘one-stop shop’ for those exploring the range of extant checklist projects, and to foster collaborative, integrative development and ultimately promote gradual integration of checklists. Since 1968, the irreversible loss of functioning of the whole brain, called brain death, is assimilated to individual’s death. The almost universal acceptance of this neurological criterion of death had decisive consequences for the contemporary medicine, such as the withdrawal of mechanical ventilation in these patients and organ retrieval for transplantation. The new criterion was successfully accepted in part because the assimilation of brain death state to death was presented by medicine --and acritically assumed by most of societies-- as a (...) scientific and objective fact. Nevertheless, many people do not think that the patients suffering brain death are actually dead. We show here that those people are not necessarily wrong. It can be argued that, in fact, the justification of the neurological criterion is not scientific but moral. We outline the thesis that the problem surrounding the vital status of brain dead patients is due to a confusion between factual and normative questions. Furthermore, we claim that the donation of organs and the withdrawal of life-support could be ethically acceptable even if the patients suffering brain death are considered as alive. As an alternative to the dead donor rule, we propose a justification for organ donation of brain-dead patients based on the (moral) concepts of harm and consent : what truly justifies the procurement of organs on those patients is not that they are dead, but that they wish to donate their organs and that, since they have irreversibly lost their brain, they cannot be harmed. Insofar as they clarify one, he maintains, they will equally clarify the other. But what justifies the Visitor’s seemingly oracular prediction? A new interpretation explains how the Visitor’s hope is in fact warranted by the peculiar aporia they find themselves in. In this issue of the Report, James L. Bernat proposes an innovative and sophisticated distinction to justify the introduction of permanent cessation as a valid substitute standard for irreversible cessation in death determination. He differentiates two approaches to conceptualizing and determining death: the biological concept and the prevailing medical practice standard. While irreversibility is required by the biological concept, the weaker criterion of permanence, he claims, has always sufficed in the accepted standard medical practice to declare death. Bernat argues that (...) the medical practice standard may be acceptable on the ground that proving circulatory or brain permanence is sufficient to assure complete accuracy for death diagnosis. -/- The topic requires public deliberation: processes to survey people's opinions and mechanisms to channel their opinions into policy-making. Whether Nietzsche’s genealogical critique of morality is best understood as an internal or as an external critique remains a matter of controversy. On the internalist interpretation (Ridley, Owen, Merrick ), the genealogical enterprise takes as its starting point the perspective being criticized, gradually revealing it to be untenable ‘from within.’ On the externalist interpretation (Leiter, and arguably Geuss, Williams, and Janaway ), this constraint is lifted; the starting point of the critique need not be the perspective being criticized, but may (...) be that of someone who already suspects the latter to be untenable. According to a common objection to ‘external critique’ interpretations, the limited-scope objection, since an external critique to a value-system could only work on an audience whose members were predisposed to abandon that system of values, ‘external critique’ interpretations impose a severe limitation on the transformative potential of Nietzsche’s project. ‘Internal critique’ interpretations, by contrast, can seem hard to reconcile with the polemical character of On the Genealogy of Morality (which lends the book its subtitle, Eine Streitschrift) and with Nietzsche’s frequent remarks to the effect his works were addressing a particular, ‘higher,’ kind of individual. -/- The overarching goal in this paper is to call into question the usefulness of the ‘internal-external’ or ‘immanent-transcendent’ dichotomy for understanding Nietzsche’s genealogical critique. I argue that the apparent usefulness of the distinction between external and internal critiques when approaching Nietzsche’s works rests on the assumption that any critique of values must itself be grounded on values that function as evaluative-critical standards. If the assumption is right, then one of two things, either the values that are deployed as standards coincide with those that are the target of critique, in which case the critique is internal, or they are not (etc.). Thus the assumption is liable to render us forgetful of a third possibility, that of a critical strategy that does not work by deploying (internal or external) values as standards of critical assessment, but by revealing something about the nature of value, and more precisely about the origin of any individual’s commitments to their values. -/- On the view that I defend, one of the crucial steps of Nietzsche’s genealogical method is to bring his reader to realize that any individual’s commitment to their values is expressive of and rooted in their commitment to preserve their way of life. Realizing this does not require that the reader abandon their own values. But it does require that they acknowledge that were they committed to a relevantly different way of life, they would subscribe to different values. And this, in turn, suffices to bring about a transformation in their understanding of and relationship to those commitments through the further realization that it is ultimately always up to them to undertake the project of taking distance from and ‘re-evaluating’ those values. Background: Several countries have recently changed their model of consent for organ donation from opt-in to opt-out. We undertook a systematic review to determine public knowledge and attitudes towards these models in Europe. Methods: Six databases were explored between 1 January 2008 and 15 December 2017. We selected empirical studies addressing either knowledge or attitudes towards the systems of consent for deceased organ donation by lay people in Europe, including students. Study selection, data extraction, and quality assessment were conducted by (...) two or more reviewers independently. Findings: Awareness of the consent model was lower in opt-out countries than in opt-in countries. A majority of the public agrees with opt-in, regardless of the law in their own country. There are ambivalent attitudes regarding the opt-out system. The public tend to prefer opt-in and mandatory choice over opt-out when several options are offered. Interpretation: The assumption that people in opt-out countries are aware of the legal requirements to be excluded from the pool of potential donors is not supported by the results of this review. This is a concern, since ignorance hinders people's autonomy regarding organ donation decision-making. Higher awareness of consent model in opt-in countries may reflect greater efforts to inform the public through campaigns to motivate donation. Legal moves towards opt-out are at odds with people's expressed preferences. Main limitations of this review are the lack of data from some countries, study population heterogeneity, and methodological shortcomings. (shrink)

What makes it true is how the rose is, and how (...) the rose is is not an entity over and above the rose. It is against this view that I shall argue in this paper. I shall argue that a significant class of true propositions, including inessential predications like the proposition that the rose is red, are made true by entities. "No truthmaking without truthmakers" is my slogan. Although I have my view about what kinds of entities are truthmakers, I shall not argue for or presuppose that view here. All I shall argue for here is that if a proposition is made true by something, it is made true by some thing, but my argument will leave it open what kind of thing that thing is: it could be a fact or state of affairs, a trope, or any other sort of entity. Plato’s Parmenides and Lysis have a surprising amount in common from a methodological standpoint. Both systematically employ a method that I call ‘exploring both sides’, a philosophical method for encouraging further inquiry and comprehensively understanding the truth. Both have also been held in suspicion by interpreters for containing what looks uncomfortably similar to sophistic methodology. I argue that the methodological connections across these and other dialogues relieve those suspicions and push back against a standard developmentalist story about Plato’s method. This (...) allows for a better understanding of why exploring both sides is explicitly recommended in the Parmenides and its role within Plato’s broader methodological repertoire. (shrink)

In this book chapter, we study the preventive rule, raised in Ley 1333 de 2009, and the way that environmental law has been building its own rules; escaping from the administrative law and creating their own dogmatic, necessary to achieve its independence as a legal autonomous area. We also see that is possible to see how the preventive rule was designed out of the general theory of administrative act, because it has characteristics that make it unique in the Colombian legal (...) system. -/- En este capítulo se estudia la figura de la 'facultad a prevención' contenida en la Ley 1333 de 2009, para analizar la forma en la que el derecho ambiental ha venido construyendo una dogmática y reglas propias, escapando de la tradición del derecho administrativo, así como creando la dogmática propia necesaria para lograr su independencia y consolidación como un área autónoma de la disciplina jurídica. Al respecto, en este ejercicio de reflexión es posible ver cómo la figura aparte de estar diseñada por fuera de la teoría general del acto administrativo, también posee particularidades que la hacen única dentro del ordenamiento jurídico colombiano. El artículo analiza el papel del resentimiento en la Teoría de los sentimientos morales de Adam Smith y su conexión con el proceso de la simpatía mutua por medio del cual el “espectador imparcial” asume plenamente el resentimiento de la víctima, al considerar que su pasión se rige por los principios de la propiedad y la justicia. Se sostiene que el resentimiento no solo cumple un rol central en la teoría del castigo de Adam Smith, en la medida en que (...) permite retribuir, disuadir y rehabilitar al victimario sino que, además, aporta a la discusión contemporánea sobre el perdón y la reconciliación, pues convoca la posibilidad de superar el resentimiento y restablecer las relaciones sociales entre el agresor y la víctima. This paper analyses the arguments for and against what we have called automatic organ procurement model in relation to the organs of the deceased. For this purpose, this work provides empirical evidence to assess the potential impact of this model on donation rates and on public opinion. Specifically, we examine first the reasons supporting this model, with special reference to utilitarian and justice arguments. On the other hand, we analyse both the approaches based on the violation of pre mortem and (...) post mortem interests opposing this theoretical model and the rejection the model would generate in the population. Finally, we point out the aspects that, in our opinion, should be exhaustively regulated if this model were implemented. In particular, we refer to the legal status of the human body, the treatments for end-of-life patients, the incentives for health professionals and the recognition of the right to conscientious objection. The Razor says: do not multiply entities without necessity! The Laser says: do not multiply fundamental entities without necessity! Behind the Laser lies a deep insight. This is a distinction between the costs and the commitments of a theory. According to the Razor, every commitment is a cost. Not so according to the Laser. According to the Laser, derivative entities are an ontological free lunch: that is, they are a commitment without a cost. Jonathan Schaffer (2015) has argued that the (...) Laser should replace the Razor. In Sections 2-4 we shall discuss and argue against Schaffer’s arguments for replacing the Razor with the Laser. Schaffer considers several objections to his views, and in Sections 5-7 we shall argue that Schaffer does not deal successfully with two of them. In Section 8 we shall present a probabilistic argument for the Laser. However, the argument has a limitation and does not support the replacement of the Razor with the Laser. Indeed, it supports only the claim that, given certain assumptions, the multiplication of explanatorily relevant derivative entities does not matter; but, as we argue in the same section, there is an argument that multiplying explanatorily superfluous derivative entities does makes a theory less rationally acceptable. Our conclusion is that the Laser cannot replace the Razor and that derivative entities are not an ontological free lunch. (shrink)

Interpretando a Nietzsche, podríamos afirmar que la embriaguez dionisíaca le posibilita al humano dirigirse afectivamente hacia lo externo, borrando incluso y paradójicamente ese límite que determinaría dónde empieza su ser y dónde aquello a lo que su ser es empujado. Trías recoge esta determinación en un concepto clave de su filosofía al denominarnos “ser del límite”. En ambos filósofos somos radicalmente pasión creadora; somos un animal límite y caótico, sufriente por queriente, y potencialmente feliz por el mismo motivo. Raymond Geuss asserts that there are fragmented views on what human rights are and that there is no unifying principle underlying such notion. I think that this view has its merits. It conveys the particularity of our perspectives, attitudes, desires and selfunderstandings. It rejects abstractness and is committed to a thick, perspectivist, historical understanding of personhood. To understand who we are, is to understand how we arrive at being who we are. By contrast, the notion of human rights deploys abstractness, (...) unification of agency, necessity and a thin view of personhood. In this paper, I attempt to bring into focus these two aspects of the notion of human rights. I will first analyse the genealogical method advocated by Geuss and argue that it has the merit of elucidating our historical contingencies; however, it is argued that any view in favour of the genealogical method relies on the idea that evaluative or normative concepts cannot be defined in terms of a common denominator. We reconstruct the Aristotelian idea of ‘focal meaning’ as core-resemblance and show that there is a unifying concept of human rights. We conclude that the perspectivist spirit of genealogy is not far from the Aristotelian tradition. Aristotle’s inquiry into a concept that could grasp different perspectives and contingencies as opposed to a Platonic understanding of abstract and universal forms shows that genealogical worries are germane to the tradition. His answer is: Because there being nothing is as improbable as anything can be: it has probability 0. Here I shall examine his argument for this answer and I shall argue that it does not work because no good reasons have been given for two of the argument’s premises and that the conclusion of the argument does not constitute an answer to the question (...) van Inwagen wanted to answer. The subtraction argument, originally put forward by Thomas Baldwin (1996), is intended to establish Metaphysical Nihilism, the thesis that there could have been no concrete objects. Some modified versions of the argument have been proposed in order to avoid some difficulties faced by the original argument. In this paper I shall concentrate on two of those versions, the so-called subtraction argument* (presented and defended in Rodriguez-Pereyra 1997, 2000, 2002), and Efird and Stoneham’s recent version of the argument (Efird and (...) Stoneham 2005). I shall defend the subtraction argument* from Alexander Paseau’s (2006) objection that because a crucial premise of the subtraction argument* may have no plausibility independent from Metaphysical Nihilism, the subtraction argument* is not suasive. Although Paseau focuses on the subtraction argument*, I shall point out that Efird and Stoneham could reply to Paseau’s objection in the same way. Thus there are (at least) two suasive versions of the subtraction argument that establish Metaphysical Nihilism. But are those two arguments equally good? I shall argue that the subtraction argument* is preferable to Efird and Stoneham’s argument. (shrink)

Emancipatory social movement solidarities are prefigurative associations. While pursuing broad-based social transformations, solidaristic agents attempt to model—in an incomplete and provisional way—the social relations they wish to bring into existence. Existing structures of domination, deep-set and overlapping as they are, pose an abiding challenge to the prefiguration of just relations, however. This article considers the challenge of prefiguration by developing a diachronic, goal-oriented, and epistemic account of solidarity. The author argues that solidarity is a collaborative process whereby agents prefigure relationships (...) of nondomination while working together to reach shared understandings about the political task at hand. The author examines two epistemologies that have not been traditionally connected to philosophical discussions of solidarity, philosophical hermeneutics and creolization, to elaborate the account. While both frameworks enable an understanding of solidarity as a properly transformative relation, creolization illuminates the possibilities and difficulties of collaborating under conditions of domination. In this paper we present a new framework of idealization in biology. We characterize idealizations as a network of counterfactual and hypothetical conditionals that can exhibit different “degrees of contingency”. We use this idea to say that, in departing more or less from the actual world, idealizations can serve numerous epistemic, methodological or heuristic purposes within scientific research. We defend that, in part, this structure explains why idealizations, despite being deformations of reality, are so successful in scientific practice. Objectives To increase postmortem organ donation rates, several countries are adopting an opt-out (presumed consent) policy, meaning that individuals are deemed donors unless they expressly refused so. Although opt-out countries tend to have higher donation rates, there is no conclusive evidence that this is caused by the policy itself. The main objective of this study is to better assess the direct impact of consent policy defaults per se on deceased organ recovery rates when considering the role of the family in (...) the decision-making process. This study does not take into account any indirect effects of defaults, such as potential psychological and behavioural effects on individuals and their relatives. -/- Design Based on previous work regarding consent policies, we created a conceptual model of the decision-making process for deceased organ recovery that included any scenario that could be directly influenced by opt-in or opt-out policies. We then applied this model to internationally published data of the consent process to determine how frequently policy defaults could apply. -/- Main outcome measures We measure the direct impact that opt-in and opt-out policies have per se on deceased organ recovery. -/- Results Our analysis shows that opt-in and opt-out have strictly identical outcomes in eight out of nine situations. They only differ when neither the deceased nor the family have expressed a preference and defaults therefore apply. The direct impact of consent policy defaults is typically circumscribed to a range of 0%–5% of all opportunities for organ recovery. Our study also shows that the intervention of the family improves organ retrieval under opt-in but hinders it under opt-out. -/- Conclusions This study may warn policy makers that, by emphasising the need to introduce presumed consent to increase organ recovery rates, they might be overestimating the influence of the default and underestimating the power granted to families. En este artículo se plantean las bases del marco ético-normativo que intervienen en la atención sanitaria de las mujeres en general, y de las mujeres mapuce, en particular. Posteriormente, se realiza un abordaje de las mujeres indígenas analizando su situación concreta, a partir de considerar de manera crítica la confluencia intersectorial de distintos sistemas opresivos que articulan las relaciones de género, clase y etnia. Para ello, el planteo se centrará en el estudio de esta problemática desde la perspectiva feminista latinoamericana, (...) que será, seguidamente, retomada y contrastada desde la voz propia de mujeres que se autoidentifican como mapuce. El objetivo del artículo se centra en poner de manifiesto las múltiples dificultades que presentan las mujeres indígenas en el acceso a la salud, con el propósito de justificar la necesidad de articular políticas públicas que promuevan la democratización del acceso sanitario, en tanto derecho humano. Para ello, realizaremos un abordaje teórico-normativo que ponga en evidencia las responsabilidades éticas y políticas del Estado, como ente garante del acceso a la salud de sus ciudadanos, en particular de los más vulnerados, como lo son las mujeres de comunidades indígenas en nuestro país. La Inteligencia Artificial (IA) ha supuesto un gran avance para la humanidad en diversos campos; sin embargo, eso no implica que su actividad esté exenta de reflexión ética. La humanidad está enfrentado, y va a enfrentar en el futuro, numerosos desafíos que van a obligar a elaborar nuevas ideas para poder vivir a la altura de los tiempos. Entre esos desafíos encontramos el laboral y económico, el de mejoramiento humano, el militar y de seguridad y el político y jurídico, entre (...) otros. Así pues, una vez considerados los desafíos en el terreno de la IA, una referencia ética que puede servir para enfrentar dichos desafíos, puede ser el principio de responsabilidad de Hans Jonas. La lectura de este aporte ético puede facilitarnos unas primeras coordenadas para la orientación en medio de un horizonte de posibilidades nuevo para la humanidad y, adicionalmente, servir como punto de partida en el compromiso que deben asumir los diferentes saberes implicados en este novedoso campo. The “received view” on Kantian ethics holds that perfect duties enjoy absolute priority over imperfect duties. More recently, several Kantian scholars have reassessed this situation, arguing that imperfect duties may remain binding even if they imply breaching a perfect duty. In this article, I argue that both positions rely on a misunderstanding of the bindingness of Kantian duties. Genuine Kantian duties, I claim, remain binding even when they cannot be fulfilled. We must always strive for a total completion of our (...) duties; what it means for us to strive for it, however, will vary depending on our peculiar situation. (shrink)

En este capítulo se analiza la figura de la obtención vegetal: su alcance, dimensión, requisitos y caracterización frente a otros derechos de propiedad intelectual, para así abordar su ámbito de protección y su tratamiento en el ámbito internacional. Se pretende en este sentido plantear que la tendencia regulatoria en materia de obtenciones vegetales en Colombia no sólo va en contravía de los intereses de los pueblos indígenas, sino además de su patrimonio colectivo que les ha garantizado una gran diversidad que (...) hoy por hoy es sustento de su alimentación. Con lo anterior se lleva a cabo un singular esfuerzo para tratar de forma comprensiva este asunto, buscando la primacía del consentimiento libre, previo e informado de las comunidades potencialmente afectadas. En el presente trabajo reflexionamos en torno a una serie de textos en los que Michel Foucault se pregunta por estatuto de la crítica. La cuestión nos parece volverse reflexivamente sobre el propio Foucualt y por ello intentaremos evaluar de qué manera, con sus propios recursos conceptuales, se puede determinar el estatuto de su propio discurso. Para ello recorreremos dos caminos: (i) su rechazo de la noción de ideología que lo pone en tensión con algunas de las tradiciones mayores del (...) pensamiento crítico. La cuestión es aquí: ¿cómo es posible la crítica sin la ideología y sin la verdad?; (ii) la recuperación foucaultiana de la actitud crítica (en los textos sobre Kant y la pregunta Was ist Aufklärung?). A partir de allí Foucault recupera la problemática de la modernidad en términos de una “ontología histórica del presente”. Ambos caminos se cruzan, ya que las observaciones sobre una “política de la verdad” (lo otro de la crítica de la ideología comprometida con una verdad aséptica) se refuerzan con las de la cuestión del gobierno en términos de una “inservidumbre voluntaria”. En ambos casos, la práctica de la crítica, que subjetiviza desujetando, plantea la cuestión de la libertad. -/- We analyze Michel Foucault’s question for the status of critique and its reflexive return over Foucault himself: How Foucault’s discourse, qua critique, should be understood? We will drive two paths: (i) the refusal of the notion of ideology, where the question is: How to think of critique without ideology and truth?; (ii) the Foucauldian recovery of the “critical attitude” (in the texts on Kant’s answer to the question Was ist Aufklärung?) and of the problem of modernity, along the lines of a “historical ontology of the present”. There is a crossroad of (i) and (ii), since the remarks on a “politics of truth” (as opposite to an “ideology critique” committed with an aseptic truth) reinforces mutually with the problem of the government, faced along the lines of an art of the “voluntary inservitude”. In both cases, practice of criticism that subjectifies desubjugating, poses the question of liberty. (shrink)

Los intereses contrapuestos en relación con el manejo, uso, utilización y aprovechamiento de los recursos naturales de los territorios indígenas, generan conflictos ambientales en donde uno de los escenarios privilegiados de expresión de los mismos es el de la consulta previa: cuando se adelanta o por el contrario, cuando aunque sea obligatoria, no se impulsa o se hace de manera inadecuada, es decir, sin el cumplimiento de los requisitos mínimos establecidos.

El documento expone los antecedentes sugeridos por Paul Ricoeur sobre lo que podría denominarse “la polémica epistemológica en ciencias sociales”, referidos a la formulación de un método legítimo para la investigación en dichas ciencias que responda a las particularidades propias de su objeto de estudio. En este sentido, se rastrea la cuestión en la tradición hermenéutica romántica, concretamente en el pensamiento de Wilhelm Dilthey, pasando por la teoría estructural de estudio del texto escrito y la formulación de una teoría de (...) la acción anglosajona, para finalmente terminar en la ricoeurtiana consideración hermenéutica de la acción significativa, que asume al texto como paradigma y propuesta de superación de los escollos en torno a la referida polémica. En "Sobre un presunto derecho a mentir por filantropía", Kant expone el deber incondicionado de veracidad, que ha sido problemático para la filosofía kantiana porque parece obligar a las personas a ser veraces en todas sus declaraciones, sin importar si son comunicaciones públicas o privadas. Llamaré extensiva a la interpretación que sostiene la obligación de ser veraces en todas las declaraciones y mostraré que es causa de inconsistencias con la Doctrina del Derecho. Las inconsistencias se resuelven con una interpretación restrictiva (...) de este deber: la obligación de veracidad es aplicable solo a las comunicaciones públicas. Si mi interpretación es correcta, todas las comunicaciones públicas, ya sean hechas por ciudadanos o funcionarios, tienen la obligación de ser veraces, pero no en las privadas. Mi interpretación es consistente con el resto de los textos donde Kant habla de la comunicación pública. (shrink)

Peter Milne has tried to refure Truthmaker Maximalism. the thesis that every truth has a truthmaker, by producing a simple and direct counterexample to it, the sentence M: This sentence has no truthmaker. I argue that, contrary to what Milne argues, on Truthmaker Maximalism M is equivalent to the Liar, which gives the truthmaker maximalist a way to defend his position from Milne's counterexample: to argue that M expresses no proposition.

This paper is a response to replies by Dan López de Sa and Mark Jago to my ‘Truthmaking, Entailment, and the Conjuction Thesis’. In that paper, my main aim was to argue against the Entailment Principle by arguing against the Conjunction Thesis, which is entailed by the Entailment Principle. In the course of so doing, although not essential for my project in that paper, I defended the Disjunction Thesis. López de Sa has objected both to my defence of the Disjunction (...) Thesis and my case against the Conjunction Thesis. I shall show that his objections are unfounded and based on serious misunderstandings of my position, what the relevant debate is, and some fundamental notions of Truthmaker Theory. Jago argues that accepting the Disjunction Thesis and rejecting the Conjunction Thesis is hard to maintain. But I show that Jago has not shown that accepting the Disjunction Thesis while rejecting the Conjunction Thesis is impossible or even hard to maintain. Jago believes that, to accept the Disjunction Thesis while rejecting the Conjunction Thesis, one needs to reject his axiom (T3), which says that all the truthmakers for <P&P> are truthmakers for <P>. I argue that there are reasons to reject such a principle, and the version of it that says that what makes <P&P> true makes <P> true. (shrink)

En la primera parte realizo una reconstrucción de la postura infinitista de Peirce a partir de los argumentos formulados en sus textos de juventud. En la segunda parte formulo rápidamente el problema del regreso epistémico de la justificación y reconstruyo tres objeciones clásicas: la objeción de las mentes finitas, la objeción del origen inexplicado, y la objeción de la descripción errada. En la tercera parte muestro cómo en sus textos de juventud Peirce consideró todas estas objeciones y cómo trató de (...) enfrentarlas. En la cuarta parte me adentraré en el periodo de madurez de Peirce para mostrar cómo, con los conceptos de duda y creencia, es posible formular una respuesta más robusta a las objeciones. Finalmente, en la última parte, iré un poco más allá de Peirce, pero sin abandonar el espíritu peircea- no, para mostrar cómo es posible explicar el carácter finito de nuestro ejercicio habitual de dar razones, sin que esto vaya en contravía de la postura infinitista doxástica peirceana sobre la estructura de la justificación. -/- .
