This paper argues that there is a class of terms, or uses of terms, that are best accounted for by an expressivist account. We put forward two sets of criteria to distinguish between expressive and factual terms. The first set relies on the action-guiding nature of expressive language. The second set relies on the difference between one's evidence for making an expressive vs. factual statement. We then put those criteria to work to show, first, that the basic evaluative adjectives such (...) as ‘good’ have expressive as well as factual uses and, second, that many adjectives whose primary meanings are factual, such as ‘powerful’, also have expressive uses. It has been argued that moral assertions involve the possession, on the part of the speaker, of appropriate non-cognitive attitudes. Thus, uttering ‘murder is wrong’ invites an inference that the speaker disapproves of murder. In this paper, we present the result of 4 empirical studies concerning this phenomenon. We assess the acceptability of constructions in which that inference is explicitly canceled, such as ‘murder is wrong but I don’t disapprove of it’; and we compare them to similar constructions involving ‘think’ (...) instead of ‘disapprove’—that is, Moore paradoxes (‘murder is wrong but I don’t think that it is wrong’). Our results indicate that the former type of constructions are largely infelicitous, although not as infelicitous as their Moorean counterparts. (shrink)

This paper continues a dialogue that began with an article by Jeffrey Koperski entitled “Two Bad Ways to Attack Intelligent Design and Two Good Ones,” published in the June 2008 issue of Zygon: Journal of Religion and Science. In a response article, Christopher Pynes argues that ad hominem arguments are sometimes legitimate, especially when critiquing Intelligent Design (2012). We show that Pynes’s examples only apply to matters of testimony, not the kinds of arguments found in the best defenses of ID.

This work, in English "Struggle for power, organic crisis and judicial independence", has its origin in research academics of the IAEN carried out to provide expert advise to the Inter American Court of Human Rights in the case Quintana and others (Supreme Court of Justice) vs the State of Ecuador. The research is about the nature of the evolution of the ecuadorian state, the dynamics of its institutions, its players, parties, laws, its factors of instability, the way rights have been (...) deployed since the return to democracy in 1979, those who have benefited from neoliberal democracy and those who have paid the costs, and where in all this was the Supreme Court of Justice. The Introduction takes a look at this origin of the work and its intellectual import, provides a brief characterization of the Inter American Sistem of Human Rights Protection, how the Quintana Case fits within it, and an overview of the chapters and their logic. The first chapter analyzes the institutional and sociological factors that have contributed to Ecuador's historically unstable state, based primarily in an antagonistic struggle for power between the Executive and Legislative branches. The second chapter analyzes the economic and political factors that provoked an organic crisis, or crisis of hegemony, between 1997 and 2007 in Ecuador. The third chapter analyzes the evolution of the way in which judges are selected in Europe, the outcomes they have generated, and how they compare with the ecuadorian systems of judge selection in terms of securing judicial independence. The fourth chapter develops a theory of judicial independence in democracy and analyzes how Ecuador measures up to that standard, from when it became a neoliberal minimal democracy in 1981, to when it became a neoliberal false democracy as a consequence of instalation of a system evidently lacking in the people's support under the guise of the 1998 Constitution and its system of judge selection, and the new democratic horizons set by the 2008 Constitution, and the judicial system that springs from it. Is the societal-level of analysis sufficient today to understand the values of those in the global workforce? Or are individual-level analyses more appropriate for assessing the influence of values on ethical behaviors across country workforces? Using multi-level analyses for a 48-society sample, we test the utility of both the societal-level and individual-level dimensions of collectivism and individualism values for predicting ethical behaviors of business professionals. Our values-based behavioral analysis indicates that values at the individual-level make a more significant contribution to (...) explaining variance in ethical behaviors than do values at the societal-level. Implicitly, our findings question the soundness of using societal-level values measures. Implications for international business research are discussed. (shrink)

This essay frames systemic patterns of mental abuse against women of color and Indigenous women on Turtle Island (North America) in terms of larger design-of-distribution strategies in settler colonial societies, as these societies use various forms of social power to distribute, reproduce, and automate social inequalities (including public health precarities and mortality disadvantages) that skew socio-economic gain continuously toward white settler populations and their descendants. It departs from traditional studies in gender-based violence research that frame mental abuses such as gaslighting--commonly (...) understood as mental manipulation through lying or deceit--stochastically, as chance-driven interpersonal phenomena. Building on structural analyses of knowledge in political epistemology (Dotson 2012, Berenstain 2016), political theory (Davis and Ernst 2017), and Indigenous social theory (Tuck and Yang 2012), I develop the notion of cultural gaslighting to refer to the social and historical infrastructural support mechanisms that disproportionately produce abusive mental ambients in settler colonial cultures in order to further the ends of cultural genocide and dispossession. I conclude by proposing a social epidemiological account of gaslighting that a) highlights the public health harms of abusive ambients for minority populations, b) illuminates the hidden rules of social structure in settler colonial societies, and c) amplifies the corresponding need for structural reparations. A credible fear test is an in-depth interview process given to undocumented people of any age arriving at a U.S. port of entry to determine qualification for asylum-seeking. Credible fear tests as a typical immigration procedure demonstrate not only what structural epistemic violence looks like but also how this violence lives in and through the design of asylum policy. Key terms of credible fear tests such as “significant possibility,” “evidence,” “consistency,” and “credibility” can never be neutral in the context of (...) colonial administrative violence. We argue that these terms function as mechanisms of exclusion and demonstrate that the capacity to be violent (i.e. to be an instrument of violence) is built into these tests, ready to be deployed when an administration wants to stop certain people from certain places from entering without regard to their own ongoing occupation of Indigenous lands. Not only are such practices instruments of violence, but the concept of ‘violence’ continues to be organized, defined, and conceived within settler colonial epistemologies so as to exclude these administrative forms of violence deployed against Indigenous peoples and people of color from recognition and nameability. We argue that this is an intentional strategy of colonial power preservation that is functionalized through social processes that remain structurally stable and self-regenerating across historical and political changes. In this paper I argue that the search for explainable models and interpretable decisions in AI must be reformulated in terms of the broader project of offering a pragmatic and naturalistic account of understanding in AI. Intuitively, the purpose of providing an explanation of a model or a decision is to make it understandable to its stakeholders. But without a previous grasp of what it means to say that an agent understands a model or a decision, the explanatory strategies will (...) lack a well-defined goal. Aside from providing a clearer objective for XAI, focusing on understanding also allows us to relax the factivity condition on explanation, which is impossible to fulfill in many machine learning models, and to focus instead on the pragmatic conditions that determine the best fit between a model and the methods and devices deployed to understand it. After an examination of the different types of understanding discussed in the philosophical and psychological literature, I conclude that interpretative or approximation models not only provide the best way to achieve the objectual understanding of a machine learning model, but are also a necessary condition to achieve post hoc interpretability. This conclusion is partly based on the shortcomings of the purely functionalist approach to post hoc interpretability that seems to be predominant in most recent literature. (shrink)

El testimonio es nuestra mayor fuente de creencias. La gran mayoría de nuestras creencias han sido adquiridas a partir de las palabras de otros y no a través de la observación directa del mundo. Una de las peculiaridades de la mayor parte de las creencias testimoniales es que son aceptadas sin ninguna deliberación consciente. Mientras el testimonio sea consistente con nuestras creencias y la fuente sea confiable, la reacción más corriente es la aceptación automática de la información (Thagard 2004, 2005). (...) Nuestra confianza en el testimonio de los demás es un requisito no sólo para la construcción colectiva del conocimiento (Hardwig 1985, 1991), sino también para la interacción social en general. Sin embargo existen contextos en los que la aceptación apresurada de un testimonio falso puede tener consecuencias nefastas. En contextos científicos, legales, políticos y financieros, entre otros, se toman decisiones importantes y se implementan políticas cruciales a partir de las afirmaciones de otros. En estos contextos la aceptación de un testimonio debe ser el resultado de un proceso de decisión basado en criterios objetivos de justificación. Sin embargo, existen dos objeciones al intento de justificar la aceptación de un testimonio (Coady 1973, 1992). La primera es que cualquier justificación será irremediablemente circular puesto que la inmensa mayoría de testimonios obtienen su justificación, al menos en parte, de evidencia de tipo testimonial. La segunda es que nuestras inferencias acerca de la confiabilidad de ciertos tipos de testimonio nunca tendrán un apoyo inductivo lo suficientemente fuerte debido a que los casos en los que un tipo de testimonio puede ser verificado directamente en la experiencia nunca serán lo suficientemente numerosos. En este ensayo presento una solución al problema de cómo decidir racionalmente si un testimonio puede ser aceptado como evidencia probatoria en una investigación. Mi propuesta, que está basada en la teoría de revisión de creencias desarrollada por Levi (1984, 1991), muestra que la aceptación justificada de un testimonio está basada en exactamente los mismos mecanismos de adquisición de creencias que operan en el caso de evidencias no testimoniales; al mismo tiempo, la propuesta da cuenta de las particularidades que se presentan en el proceso de evaluación de una evidencia testimonial. Mi tesis es que la decisión de aceptar un testimonio es un proceso que se cumple en dos etapas. En la primera se busca una justificación pare el testimonio buscando todos los hechos que aumenten la probabilidad de que el testimonio sea verdadero, es decir, de que el testigo o declarante esté reportando verídicamente un hecho. La aceptación de estos hechos y de su relación probabilística positiva con respecto al testimonio está basada en la búsqueda de un equilibrio entre su credibilidad y su valor informativo. En la segunda etapa, se determina si la justificación obtenida en la primera es suficiente para la aceptación del testimonio, de nuevo buscando encontrar un equilibrio entre su credibilidad y la utilidad de la información que contiene en promover los intereses y metas cognitivas del investigador. ¿Existe alguna diferencia filosóficamente significativa entre una explicación científica y las explicaciones que se ofrecen en el curso de la vida diaria? Dado que la mayor parte de las discusiones en la filosofía de la ciencia se refieren al primer tipo de explicaciones, debemos considerar si existe un concepto específico que corresponda al término “explicación científica”, y que sea discontinuo de su contraparte cotidiana. El ensayo tiene cuatro secciones. En cada una de ellas considero diferentes criterios que podrían ser utilizados (...) para establecer una distinción de clase entre las explicaciones científicas y las cotidianas. En la primera sección exploro la posibilidad de establecer un criterio puramente sociológico: el estatus científico de una explicación dependería del estatus institucional de las personas que dan origen a la explicación. El segundo criterio estudiado fue propuesto por Hempel: las explicaciones científicas deben hacer uso explícito de leyes naturales, y la ausencia de leyes invalida cualquier intento de ofrecer una explicación científica. Un tercer criterio se basa en la naturaleza del explanandum. Algunos filósofos han defendido la idea de que la única diferencia filosóficamente significativa entre las explicaciones científicas y las no científicas reside en el tipo de explanandum del que se ocupa cada una de ellas. En la vida diaria explicamos eventos individuales, mientras que en la ciencia se pretende explicar regularidades. Finalmente, examino el criterio propuesto por Wesley Salmon según el cual la diferencia entre los dos tipos de explicación está determinada por el tipo de comprensión que proporciona cada uno de ellos. Al final concluyo que ninguno de estos criterios es adecuado y que la aparente diferencia entre los dos tipos de explicaciones es una diferencia de grado y no de clase. Las explicaciones científicas ciertamente tienen un mayor grado de precisión, detalle y complejidad que sus contrapartes en la vida cotidiana. Normalmente involucran el uso de las matemáticas y de lenguajes altamente regimentados. Pero a pesar de estas diferencias, concluyo que los elementos que hacen que algo sea una explicación son esencialmente los mismos en ambos casos. (shrink)

Unlike other classical arguments for the existence of God, Pascal’s Wager provides a pragmatic rationale for theistic belief. Its most popular version says that it is rationally mandatory to choose a way of life that seeks to cultivate belief in God because this is the option of maximum expected utility. Despite its initial attractiveness, this long-standing argument has been subject to various criticisms by many philosophers. What is less discussed, however, is the rationality of this choice in situations where the (...) decision-makers are confronted with greater uncertainty. In this paper, I examine the imprecise version of Pascal’s Wager: those scenarios where an agent’s credence that God exists is imprecise or vague rather than precise. After introducing some technical background on imprecise probabilities, I apply five different principles for decision-making to two cases of state uncertainty. In the final part of the paper, I argue that it is not rationally permitted to include zero as the lower probability of God’s existence. Although the conditions for what makes an act uniquely optimal vary significantly across those principles, I also show how the option of wagering for God can defeat any mixed strategy under two distinct interpretations of salvation. Intersectionality is a term that arose within the black feminist intellectual tradition for the purposes of identifying interlocking systems of oppression. As a descriptive term, it refers to the ways human identity is shaped by multiple social vectors and overlapping identity categories (such as sex, race, class) that may not be readily visible in single-axis formulations of identity, but which are taken to be integral to robustly capture the multifaceted nature of human experience. As a diagnostic term, it captures the (...) confluence of power and domination on the social construction of identity in order to remedy concrete harms that result from this convergence. It is not a prescriptive methodology or closed system of analysis, but rather an open-ended hermeneutic lens through which interconnected systems of oppression can come into focus in the fight for social justice. Esta ponencia ofrece un marco probabilístico para establecer estándares de prueba múltiples en cualquier disciplina. La tesis principal es que la evidencia es un concepto umbral con respecto a la probabilidad. Múltiples umbrales pueden ser establecidos en un marco de intervalos (...) de probabilidad para la hipótesis que está siendo puesta a prueba, los cuales reflejan los diferentes grados de apoyo que la evidencia le provee a la hipótesis. Examinando los mecanismos utilizados para establecer los umbrales en medicina, sugiero una manera para establecer umbrales múltiples de prueba en derecho de una manera no arbitraria. (shrink)

Many word forms in natural language are polysemous, but only some of them allow for co-predication, that is, they allow for simultaneous predications selecting for two different meanings or senses of a nominal in a sentence. In this paper, we try to explain (i) why some groups of senses allow co-predication and others do not, and (ii) how we interpret co-predicative sentences. The paper focuses on those groups of senses that allow co-predication in an especially robust and stable way. We (...) argue, using these cases, but focusing particularly on the multiply polysemous word ‘school’, that the senses involved in co-predication form especially robust activation packages, which allow hearers and readers to access all the different senses in interpretation. In the natural and social sciences, it is common to use toy models—extremely simple and highly idealized representations—to understand complex phenomena. Some of the simple surrogate models used to understand opaque machine learning (ML) models, such as rule lists and sparse decision trees, bear some resemblance to scientific toy models. They allow non-experts to understand how an opaque ML model works globally via a much simpler model that highlights the most relevant features of the input space and their effect on (...) the output. The obvious difference is that the common target of a toy and a full-scale model in the sciences is some phenomenon in the world, while the target of a surrogate model is another model. This essential difference makes toy surrogate models (TSMs) a new object of study for theories of understanding, one that is not easily accommodated under current analyses. This paper provides an account of what it means to understand an opaque ML model globally with the aid of such simple models. (shrink)

Los sesgos cognitivos afectan negativamente la toma de decisiones en todas las esferas de la vida, incluyendo las decisiones de los jueces. La imposibilidad de eliminarlos por completo de la práctica del derecho, o incluso de controlar sus efectos, contrasta con el anhelo de que las decisiones judiciales sean el resultado exclusivo de un razonamiento lógico-jurídico correcto. Frente el efecto sistemático, recalcitrante y porfiado de los sesgos cognitivos, una posible estrategia para disminuir su efecto es enfocarse, no en modificar el (...) comportamiento de los agentes judiciales, sino en moldear su entorno para que los sesgos tengan menos oportunidades de aparecer. En particular, es más provechoso concentrar los esfuerzos en identificar aquellas reglas procesales que faciliten o limiten el efecto de los sesgos. En este ensayo propongo un diálogo fructífero entre el derecho y la psicología que puede llevar a mejorar la calidad de los sistemas judiciales. La propuesta está basada en la creación de guías de práctica judicial que puedan servir de base para la creación de protocolos procesales que limiten en la medida de lo razonable sus efectos negativos y conduzcan a mejores decisiones judiciales. Aunque el derecho probatorio y el derecho procesal se han dedicado desde siempre al estudio de los problemas relacionados con las pruebas y el establecimiento de los hechos en los procesos judiciales, el énfasis ha estado siempre en el aspecto formal, doctrinal y procedimental en detrimento de los fundamentos filosóficos y teóricos. Durante los últimos años ha habido un intento sostenido de explorar estos fundamentos combinando no sólo las herramientas tradicionales proporcionadas por la lógica, la gramática y la retórica, sino (...) también los avances hechos en ciencias como la estadística y la probabilidad, la medicina y la psicología forenses, la psicología de la percepción, la epistemología y la filosofía de la ciencia. El presente libro reúne las contribuciones de destacados juristas y filósofos latinoamericanos a esta nueva perspectiva interdisciplinaria, conocida como epistemología jurídica. El libro está dividido en tres grandes temas: la primera parte explora los problemas epistemológicos del conocimiento de los hechos en los procesos judiciales; la segunda se enfoca en el problema de los estándares de prueba; y la sección final discute el testimonio de los expertos. The fact that names refer to individuals is a basic assumption of referentialist theories of proper names, but the notion of individual is systematically taken for granted in those theories. The present paper follows that basic assumption, but proposes to analyze the notion of individual prior to the development of any semantic theory of proper names. It will be argued that a particular perdurantist conception of individual should be adopted, which distinguishes the notions of individual occurrence, and individual simpliciter. A (...) new theory of proper names (called the cluster-occurrence theory) is presented, according to which names refer to individual occurrences, and the intension associated with a name is an individual simpliciter. The merits of the new theory are then assessed in confrontation with its standard rival accounts. (shrink)

En este capítulo se estudia la facultad a prevención contenida en la Ley 1333 de 2009, para analizar la forma en la que el derecho ambiental ha venido construyendo una dogmática y reglas propias, escapando de la tradición del derecho administrativo, así como creando la dogmática propia necesaria para lograr su independencia y consolidación como un área autónoma de la disciplina jurídica. Al respecto, en este ejercicio de reflexión es posible ver cómo la figura aparte de estar diseñada por fuera (...) de la teoría general del acto administrativo, también posee particularidades que la hacen única dentro del ordenamiento jurídico colombiano. El desarrollo de las artes visuales durante el siglo XX desdibujó la frontera entre aquellos objetos y artefactos que llamamos obras de arte, y aquéllos que no son merecedores de ese título. Arthur Danto ha propuesto una teoría estética a la luz de la cual sería posible volver a definir los límites del arte. En este ensayo examino dos de los aspectos más problemáticos de la teoría: la importancia excesiva que Danto le otorga al concepto de mímesis y su concepción (...) teleológica de la historia del arte. Si atenuamos el papel de estos dos elementos, la teoría pierde gran parte de su poder explicativo. En las últimas dos secciones del ensayo arguyo que el mundo del arte al que Danto atribuye un papel central en el problema de la demarcación debe él mismo ser considerado un subproducto de las condiciones que determinan la naturaleza del arte en general. This paper is an attempt to clarify, from a Thomistic point of view, the nature and method of metaphysics. I argue that metaphysics' object is created being, not God, even if God enters metaphysics as efficient cause of metaphysic's object. Also, that metaphysics is a science, insofar as a particular kind of coherent reasoning process, going from the many to understand a certain oneness, and then from that oneness to reinterpret the many. Moreover, that, in this particular process of reasoning, (...) doctrinal topics must follow a certain order. Thus, in particular, I argue that the distinction between essence and act of being in every creature cannot be argued before arguing the existence of God. I touch upon the notion of separation in metaphysics and I compare Aquinas' notion of resolution with Fabro's notion. (shrink)

El ensayo presenta el esbozo de una teoría de la explicación basada en el modelo duda-creencia de investigación propuesto por Peirce y desarrollado por Isaac Levi. Inicialmente se caracteriza una noción de explicación que hace referencia a las creencias y fines epistémicos de los miembros de una comunidad científica. Posteriormente se demuestra que la inclusión de los aspectos pragmáticos de la explicación en la teoría no sólo no conduce al relativismo, sino que es necesaria para poder dar cuenta de la (...) relación entre las nociones de explicación y comprensión. In the discourse on International Justice, traditional frameworks are deeply rooted in 'embodied metaphysics'—a perspective embedded in the tangible experiences of human existence. By contrasting the physical with the digital realms, I suggest that our current global justice systems are ill-equipped to address the complexities of the digital age. Utilizing the metaphor of water to highlight the often-unseen environment shaping justice theories and practices, I argue that International Justice, as conventionally understood, reflects the constraints akin to fish oblivious to the (...) water surrounding them. In digital spaces, individuals are no longer bound by principles of singularity and locality, and instead operate by principles of multiplicity and nonlocality. These metaphysical differences disrupt many theories of global justice assuming singularity and nonlocality. My aim is to encourage scholars and practitioners to 'see water'—to acknowledge and critically reassess the foundational assumptions underlying their theories and practices in an era of digital transformation. Abstract In The Descent of Man (1879), Charles Darwin proposed a speculative evolutionary explanation of extended benevolence—a human sympathetic capacity that extends to all nations, races, and even to all sentient beings. This essay draws on twenty-first century social science to show that Darwin’s explanation is correct in its broad outlines. Extended benevolence is manifested in institutions such as legal human rights and democracy, in behaviors such as social movements for human rights and the protection of nonhuman animals, and in (...) normative attitudes such as emancipative values and a commitment to promote the rights or welfare of animals. These phenomena can be substantially explained by cultural evolutionary forces that trace back to three components of what Darwin called the human “moral sense”: (1) sympathy, (2) our disposition to follow community rules or norms, and (3) our capacity to make normative judgments. Extended benevolence likely emerged with “workarounds,” including political ideologies, that established an inclusive sympathetic concern for sentient life. It likely became as widespread as it is now due to recently arisen socio-economic conditions that have created more opportunities for people to have contact with and take the perspective of a broader cross-section of humanity, as well as other species. The use of machine learning algorithms has become ubiquitous in hiring decisions. Recent studies have shown that many of these algorithms generate unlawful discriminatory effects in every step of the process. The training phase of the machine learning models used in these decisions has been identified as the main source of bias. For a long time, discrimination cases have been analyzed under the banner of disparate treatment and disparate impact, but these concepts have been shown to be ineffective in the (...) context of AI. This paper examines the possibility of studying algorithmic discrimination from the perspective of negligence law. Negligent selection and validation of datasets and classifiers is a salient cause of improper training in machine learning. It is a breach of an employer’s duty to protect others, a failure of its exercise of due care in the manner of choosing employees. Adopting negligence to algorithmic discrimination requires a reformulation of what is foreseeable and reasonable within the context of black box algorithms, and a shift in the burden of proof to the employer, who must present evidence of its efforts to avoid bias. El uso de sistemas de machine learning en los procesos de selección laboral ha sido de gran utilidad para agilizarlos y volverlos más eficientes, pero al mismo tiempo ha generado problemas en términos de equidad, confiabilidad y transparencia. En este artículo comenzamos explicando los diferentes usos de la Inteligencia Artificial en los procesos de selección laboral en Estados Unidos. Presentamos los sesgos sexuales y raciales que han sido detectados en algunos de ellos y explicamos los obstáculos jurídicos y prácticos para (...) su detección y análisis. Un posible remedio jurídico a la discriminación algorítmica es el régimen de impacto diferencial sistémico utilizado en Estados Unidos. Usamos algunas características de este régimen para señalar los vacíos jurídicos frente a la discriminación en el acceso al empleo en el ámbito del derecho laboral colombiano, y ofrecemos algunas características generales que podría tener un régimen de esa naturaleza. In studying in depth Nietzsche’s description of Greek tragedy and Dionysian art, as well as flamenco art –both phenomenologically and hermeneutically–, enormous similarities appear. Especially between the characteristics of the fundamental aesthetic category of flamenco, lo jondo –the deep–, and the features of Dionysian art. What shows that, just as those of the beautiful and the sublime are the aesthetic categories of the Apollonian, the aesthetic category of Dionysian art is the deep.

Current work in language models (LMs) helps us speed up or even skip thinking by accelerating and automating cognitive work. But can LMs help us with critical thinking -- thinking in deeper, more reflective ways which challenge assumptions, clarify ideas, and engineer new concepts? We treat philosophy as a case study in critical thinking, and interview 21 professional philosophers about how they engage in critical thinking and on their experiences with LMs. We find that philosophers do not find LMs to (...) be useful because they lack a sense of selfhood (memory, beliefs, consistency) and initiative (curiosity, proactivity). We propose the selfhood-initiative model for critical thinking tools to characterize this gap. Using the model, we formulate three roles LMs could play as critical thinking tools: the Interlocutor, the Monitor, and the Respondent. We hope that our work inspires LM researchers to further develop LMs as critical thinking tools and philosophers and other 'critical thinkers' to imagine intellectually substantive uses of LMs. (shrink)

This paper raises three questions regarding the attribution of beliefs, desires, and intentions to robots. The first one is whether humans in fact engage in robot mindreading. If they do, this raises a second question: does robot mindreading foster trust towards robots? Both of these questions are empirical, and I show that the available evidence is insufficient to answer them. Now, if we assume that the answer to both questions is affirmative, a third and more important question arises: should developers (...) and engineers promote robot mindreading in view of their stated goal of enhancing transparency? My worry here is that by attempting to make robots more mind-readable, they are abandoning the project of understanding automatic decision processes. Features that enhance mind-readability are prone to make the factors that determine automatic decisions even more opaque than they already are. And current strategies to eliminate opacity do not enhance mind-readability. The last part of the paper discusses different ways to analyze this apparent trade-off and suggests that a possible solution must adopt tolerable degrees of opacity that depend on pragmatic factors connected to the level of trust required for the intended uses of the robot. We also see that is possible to see how the preventive rule was designed out of the general theory of administrative act, because it has characteristics that make it unique in the Colombian legal (...) system. -/- En este capítulo se estudia la figura de la 'facultad a prevención' contenida en la Ley 1333 de 2009, para analizar la forma en la que el derecho ambiental ha venido construyendo una dogmática y reglas propias, escapando de la tradición del derecho administrativo, así como creando la dogmática propia necesaria para lograr su independencia y consolidación como un área autónoma de la disciplina jurídica. In this paper I defend the idea that there is a sense in which it is meaningful and useful to talk about objective understanding, and that to characterize that notion it is necessary to formulate an account of explanation that makes reference to the beliefs and epistemic goals of the participants in a cognitive enterprise. Using the framework for belief revision developed by Isaac Levi, I analyze the conditions that information must fulfill to be both potentially explanatory and epistemically valuable (...) to an inquiring agent and to a scientific community. To be potentially explanatory, the information must state the relations of probabilistic relevance that the explanans bares to the explanandum. But a potential explanation con only be a bona fide explanation if it becomes part of inquiry, that is, if an agent or a group of agents can see any value in it for their cognitive purposes. I provide a way to evaluate the epistemic value of a potential explanation as a function of its credibility and its informational content. (shrink)

There is a growing awareness that there are many subtle forms of exclusion and partiality that affect the correct workings of a judicial system. The concept of epistemic injustice, introduced by the philosopher Miranda Fricker, is a useful conceptual tool to understand forms of judicial partiality that often go undetected. In this paper, we present Fricker’s original theory and some of the applications of the concept of epistemic injustice in legal processes. In particular, we want to show that the seed (...) planted by Fricker has flourished into a rich field of study in which the concept is used to analyze many different phenomena in law, not always following the original characterization provided by her. This has led to a distinction between what we will call the narrow version of the concept, which is closer to Fricker’s original account, and the wider version of epistemic injustice, which is a more controversial notion because it is always on the verge of morphing into other well-known concepts like sexism, racial discrimination, oppression, silencing, and gaslighting. We will show that the value of the narrow version is mostly theoretical, and that in order to use the concept of epistemic injustice one must adopt a more liberal understanding of it. (shrink)

In this paper, I examine Pascal's Wager as a decision problem where the uncertainty is massive, that is, as a decision under ignorance. I first present several reasons to support this interpretation. Then, I argue that wagering for God is the optimal act in a broad range of cases, according to two well-known criteria for decision-making: the Minimax Regret rule and the Hurwicz criterion. Given a Pascalian standard matrix, I also show that a tie between wagering for God and wagering (...) against God is only possible under very narrow conditions when applying the Hurwicz criterion. Finally, I discuss three objections to these two versions of the Wager. The most pressing challenge comes from the Many-Gods objection. I conclude that this objection is even more challenging whenever one faces a situation of massive uncertainty about God's existence. I argue that addressing it requires a more detailed examination of the benefits of adopting a religious life compared to those of choosing non-theism, or an additional criterion that can break the tie between these options. There is a growing trend across North America of women being criminalized for their pregnancy outcomes. Rather than being a series of aberrations resulting from institutional failures, we argue that this trend is part of a colonial strategy of administrative violence aimed at women of color and Native women across Turtle Island. We consider a range of medical and legal practices constituting gender-based administrative violence, and we argue that they are the result of non-accidental and systematic production of population-level harms (...) that cannot be disentangled from the goals of ongoing settler occupation and dispossession of Indigenous lands. While white feminist narratives of gender-based administrative violence in Latin America function to distance the places where such violence occurs from the ‘liberal democratic’ settler nation-states of the U.S. and Canada, we hold that administrative forms of reproductive violence against Latin American women are structurally connected to efforts in the U.S. and Canada to criminalize women of color and Indigenous women for their reproductive outcomes. The purpose of these systemically produced harms is to sustain cultures of gender-based violence in support of settler colonial configurations of power. (shrink)

Why I thought it useful to offer an explanation of Hegel’s doctrine on the Incarnation was so that the reader may be empowered to identify Hegel’s influence in modern accounts of this mystery. Even if, in my view, Hegel’s interpretation of revealed religion differs greatly from Catholic Doctrine, it is not surprising to find the presence of some of his concepts in modern theology. In truth, what matters is not the theologian’s self-identification as Hegelian or as non-Hegelian, but whether or (...) not the theologian adopts Hegel’s concepts. This paper offers an explanation of the internal dynamism of Hegelian concepts and their relation to Christian doctrine in Hegel’s Phenomenology of Spirit. This research may help to show in what way it is possible to explain Christian religious doctrine with a philosophy other than the Thomistic one and how, at least in Hegel’s case, religious doctrine is changed and reduced to an erroneous philosophical content. Also, an attempt is made to show the internal “coherence” of this Hegelian re-reading of Christianity so that theologians may become more cautious about accepting an explanation of Christian doctrine simply because the Christian language is preserved in that explanation. : New genetic technologies continue to emerge that allow us to control the genetic endowment of future children. Increasingly the claim is made that it is morally "irresponsible" for parents to fail to use such technologies when they know their possible children are at risk for a serious genetic disorder. We believe such charges are often unwarranted. Our goal in this article is to offer a careful conceptual analysis of the language of irresponsibility in an effort to encourage more care (...) in its use. Two of our more important sub-claims are: A fair judgment of genetic irresponsibility necessarily requires a thick background description of the specific reproductive choice; and there is no necessary connection between an act's being morally wrong and its being irresponsible. Uno de los principios éticos mencionados más frecuentemente en los lineamientos para el desarrollo de la inteligencia artificial (IA) es la transparencia algorítmica. Sin embargo, no existe una definición estándar de qué es un algoritmo transparente ni tampoco es evidente por qué la opacidad algorítmica representa un reto para el desarrollo ético de la IA. También se afirma a menudo que la transparencia algorítmica fomenta la confianza en la IA, pero esta aseveración es más una suposición a priori que una (...) tesis basada en evidencia empírica. Tampoco se discute mucho hasta qué punto es técnicamente posible volver transparente la caja negra de la IA a través de los métodos de explicabilidad. En este capítulo haré un análisis de la interrelación entre los conceptos de transparencia, explicabilidad y confianza. Inicialmente, analizaré los diferentes tipos de opacidad algorítmica para entender mejor cuál es el problema al que nos enfrentamos. En las secciones subsiguientes trazaré la relación entre explicabilidad y transparencia, y presentaré los límites de los métodos actuales de explicabilidad. En la sección final, examinaré la evidencia empírica acerca de la relación entre transparencia y confianza en las decisiones automatizadas basadas en sistemas de IA. (shrink)

Moore’s Paradox is a test case for any formal theory of belief. In Knowledge and Belief, Hintikka developed a multimodal logic for statements that express sentences containing the epistemic notions of knowledge and belief. His account purports to offer an explanation of the paradox. In this paper I argue that Hintikka’s interpretation of one of the doxastic operators is philosophically problematic and leads to an unnecessarily strong logical system. I offer a weaker alternative that captures in a more accurate way (...) our logical intuitions about the notion of belief without sacrificing the possibility of providing an explanation for problematic cases such as Moore’s Paradox. In the twenty-fifth chapter of the second book of Etymologies, epitome of the Isagoge of Profirius, the sevillian philosopher Isidore of Seville, taking the example of the tyrian thinker, takes up the anthropo-philosophical theory of homo risv capax, that is, the human being defined as the only living being, mortal or immortal, irrational or rational, capable of laughing. Or, in others words, laughter understood as what is (most) proper -in the sense of exclusive- to the human being. A theory that (...) has a long trajectory in the history of ancient Western philosophy up to the approach of the philosopher from Seville (and also after him). This article presents the Isidorean proposal by showing the background, both general and specific, to the question of laughter as a singular and distinctive human property, as well as a delimitation of the sense exposed in the thought and work of Isidore of Seville, together with the existing differences between those of the Sevillian thinker and his philosophical precedents, that is, his specific contributions. This article aims to indicate another possible comprehension of war and its relations in the Yugoslavian region. Focused on the construction of national identity, this paper uses the post-structuralist theoretical argumentative movement to invert the common logic of interpretation – to which Foucault and Deleuze are used as reference. Knowing this, the problem is how war, interpreted in another way, can build not only national integration, but also a subjective identity through Football.

This paper is my best attempt to confute (Kantian) Modern Philosophy at its very core. This implies, of course, that in my view the principles of Critical Realism are Kantian. The basic arguments supporting Critical Realism are powerful: I have tried to show clearly their power, but also to expose clearly their putrid root.
