Book review of Mark Anderson's 'Plato and Nietzsche: Their Philosophical Art' for Pli, the Warwick Journal of Philosophy.

This paper establishes a Kantian duty against screen overexposure. After defining screen exposure, I adopt a Kantian approach to its morality on the ground that Kant’s notion of duties to oneself easily captures wrongdoing in absence of harm or wrong to others. Then, I draw specifically on Kant’s ‘duties to oneself as an animal being’ to introduce a duty of self-government. This duty is based on the negative causal impact of the activities it regulates on a human being’s mental and (...) physical powers, and, ultimately, on the moral employment of these powers. After doing so, I argue that the duty against screen overexposure is an instance of the duty of self-government. Finally, I consider some objections. (shrink)

Authoritarian parenting has long been associated with Western individualism and improved child development. This study examined the relationship between cultural values, parenting styles, and children’s perceived competence in Hong Kong. A total of 48 parents from local Chinese families, 49 parents from South Asian families, and 105 children (24 local Chinese and 81 South Asian) aged 5–6 years participated in the study. Self-report questionnaires on adherence to Asian cultural values and parenting style were administered to parents. The Pictorial Survey on (...) Children’s Perceived Competence was administered to children by trained research assistants. The results contradicted two long-standing assumptions on Asian cultural values and parenting styles. In a recent work, Walter Carnielli and Abilio Rodrigues present an epistemically motivated interpretation of paraconsistent logic. In their view, when there is conflicting evidence with regard to a proposition A (i.e. when there is both evidence in favor of A and evidence in favor of ￢A) both A and ￢A should be accepted without thereby accepting any proposition B whatsoever. Hence, reasoning within their system intends to mirror, and thus, should be constrained by, the way in which we reason (...) about evidence. In this article we will thoroughly discuss their position and suggest some ways in which this project can be further developed. The aim of the paper is twofold. On the one hand, we will present some philosophical critiques to the specific epistemic interpretation of paraconsistent logic proposed by Carnielli & Rodrigues. First, we will contend that Carnielli & Rodrigues’s interpretation implies a thesis about what evidence rationally justifies to accept or believe, called Extreme Permissivism, which is controversial among epistemologists. Second, we will argue that what agents should do, from an epistemic point of view, when faced with conflicting evidence, is to suspend judgment. On the other hand, despite these criticisms we do not believe that the epistemological motivation put forward by Carnielli & Rodrigues is entirely wrong. In the last section, we offer an alternative way in which one might account for the epistemic rationality of accepting contradictions and, thus, for an epistemic understanding of paraconsistency, which leads us to discuss the notion of diachronic epistemic rationality. This article analyses how child victims of abuse may be subjected to hermeneutical injustice. I start by explaining how child victims are hermeneutically marginalised by adults’ social and epistemic authority, and the stigma around child abuse. In understanding their abuse, I highlight two epistemic obstacles child victims may face: (i) lack of access to concepts of child abuse, thereby causing victims not to know what abuse is; and (ii) myths of child abuse causing misunderstandings of abuse. When these epistemic obstacles (...) cause the child victims to fail to see themselves as being abused and/or to get adults to recognise that they are being abused, I argue that this constitutes hermeneutical injustice. While some may justify obstructing epistemic access to concepts of abuse on the grounds of parental rights and protection of children’s innocence, I reply that both grounds are unjust in light of children’s basic rights and the fact that children can easily be taught such concepts in a child-appropriate manner. The case of child abuse prompts important reflections on existing epistemic injustice literature, particularly on the ways in which hermeneutical injustice materialises, the epistemic responsibilities of institutional bodies and individuals, and the interrelationship between testimonial and hermeneutical injustice. In Religion within the Bounds of Bare Reason Kant speaks of an ethical state of nature and of an ethico-civil condition, with explicit reference to the juridical state of nature and the juridico-civil condition he discusses at length in his legal-political writings. Given that the Religion is the only work where Kant introduces a parallel between these concepts, one might think that this is only a loose analogy, serving a merely illustrative function. The paper provides a first outline of the (...) similarities and the differences between the state of nature and the civil condition in Right and in ethics. The comparison points to a deeper, structural relation between the two pairs of concepts. By doing so, it makes room for developing a unitary conception of the state of nature and of the civil condition, which would underlie both the ethical and the juridical version. (shrink)

Gary Bartlett (2022) provides critical reflections on my account of hermeneutical injustice experienced by child victims of abuse (Lo 2022). He argues that professionals cannot be said to have all the relevant concepts of abuse as child victims have unique access to the emotional and subjective aspects of that experience. He thus cautions against remedying the hermeneutical injustice by having institutions replace folk concepts with institutional concepts. Bartlett further reflects on the hermeneutical marginalisation of children and questions to what extent (...) does that constitute hermeneutical injustice against children generally. The paper lays the foundations for a duty of sustainable property use based on Kant’s Doctrine of Right. In doing so, it contributes to the project of extending the application of Kant’s philosophy to environmental issues so as to include his legal-political philosophy. After providing some context, focusing in particular on Kant’s property argument, I present and critically evaluate a recent argument for a duty of sustainable property use, put forward by Attila Ataner. Then, I draw on Reinhard Brandt’s and (...) Katrin Flikschuh’s interpretation of Kant’s permissive law in order to develop my own argument. According to my account, the duty of sustainable property use is rooted in Kant’s property argument, it is best construed in terms of interpersonal freedom, and it has a structure resembling that of duties of distributive justice. Unlike Ataner’s, my argument proceeds entirely within the domain of interpersonal freedom; it focuses clearly on the normative sense of usability; it does not overgenerate obligations; and it categorises the duty of sustainable property use within Kant’s taxonomy of duties. It thus constitutes a promising starting point to further investigate the connection between sustainability, Kant’s property argument and its use of a permissive law, and the Universal Principle of Right. У статті описано підходи до написання словників у перші десятиліття ХХ ст. Розглянуто концепцію і принципи укладання російсько-українського академічного словника. Проаналізовано реалізацію концепції російсько-українського академічного словника як лексикографічної праці, що поєднує риси перекладного, тлумачного, синонімічного та фразеологічного словників.

У статті описано джерела реєстру російсько-українського академічного словника за редакцією А. Кримського та С. Єфремова, а також інших російсько-українських словників 20-х рр. ХХ ст. Реєстри тогочасних перекладних словників базувалися переважно на реєстрах перекладних словників, виданих раніше, частково залучалися словники інших типів, зокрема термінологічні, а також матеріали преси.

Статтю присвячено аналізові церковно-музичних книг василіянських монастирів Руської провінції другої половини XVIII — початку ХІХ ст. На підставі монастирських інвентарів висвітлюється діяльність друкарні Почаївського василіянського монастиря, яка, серед іншого, спеціалізувалася на виданні музичних книг, зокрема Ірмолоїв— поліжанрових збірників, що властиві українському типові церковно-співочої книги. У статті наголошено також на ролі Василіянського Чину в поширенні західно-християнських культурних впливів упродовж другої половини XVIII cт.

Open science is the movement to make scientific research (including publications, data, physical samples, and software) and its dissemination accessible to all levels of society, amateur or professional.

In this essay, I reflect on the implications of intellectual virtues in scientific endeavor. To this end, I first offer a depiction of scientific endeavor by resorting to the notion of academic attitude, which involves aspects concerning the generation and possession of knowledge. Although there are differences between these activities, they have in common the engagement of diverse intellectual agents (scientists). In this sense, I analyze how intellectual virtues are linked to 1) scientific research tasks, such as theory appraisal, and (...) 2) those tasks of vigilance and intervention in the uses of scientific knowledge. I conclude that intellectual virtues play a leading role in achieving higher quality scientific research and adequate foresight on the uses and impacts of scientific findings. In this order of ideas, I propose an agenda for further inquiries on these matters, highlighting the relevance of reflecting and empirically researching the relationship between intellectual virtues and science, as well as cultivating intellectual virtues in various stages of scientific training. Non-state peoples cannot be subjects of Kant’s international law, which accordingly affords them no protection against external interference. They might also lack the dynamic of private law at the basis of the duty of state entrance. Prima facie, this compels Kant to allow that their lands be appropriated and that they be forced out of the state of nature. But this conclusion is at odds with his cosmopolitanism, particularly its anti-imperialistic commitments: non-state peoples are protected against annexation, under Kant’s cosmopolitan (...) law. The paper makes three contributions to the debate on this tension. Firstly, it disambiguates scope, ground, and relata of the duty to exit the state of nature. Secondly, it argues that non-state peoples have an inter-group duty to exit the state of nature; and that this holds for a non-state people regardless of whether it also has an intra-group duty of state entrance, which remains unenforceable by outside parties. Finally, it offers a construal of the former duty as a cosmopolitan duty to interact peacefully even in the absence of a shared culture. (shrink)

The paper discusses two ways to understand political liberalism. On the one hand, political liberalism may rely on the existence of an overlapping consensus among all reasonable comprehensive views present in our society. On the other hand, we may ground political liberalism on the moral value of equal respect for everyone. The dilemma between a factual identification of an overlapping consensus and a normative appeal to moral values arises at two levels. First, when we fill the content of our political (...) conception of justice. And second, when we require impartiality to fill that content. In the former case, we may argue for a particular conception of justice through normative argument with moral premises, or our political conception of justice might be the area where all reasona-ble comprehensive views overlap. Similarly, we require that citizens offer impartial public reasons because this is what people holding different comprehensive views do think ap-propriate, or because they should consider it so. The author argues that we should define our political conception of justice through impartial normative argument, and that we should ground the demand of impartiality on the moral value of equal respect. Blumenbergs Paradigmen zu einer Metaphorologie sind bekannt für die Entdeckung absoluter Metaphern. Zahlreiche systematische Fragen mögen dabei offen geblieben sein, etwa die nach verschiedenen Typen1 von Metaphern oder den Methoden ihrer Interpretation, so dass schon bezweifelt wurde, ob es sich überhaupt um eine Metapherntheorie handle.2 Immerhin: Dass es absolute Metaphern gibt, was diese sind und woran sie erkannt werden können, wird von Blumenberg in großer Prägnanz und anhand zahlreicher Beispiele dargestellt. Wenn es eine unangetastete Gewissheit in der Blumenbergrezeption gibt, so (...) scheint sie hierin zu finden zu sein. Dennoch möchte ich erneut die Frage an Blumenbergs Text stellen: In welchem Sinn ist eine Metapher absolut? Auf den ersten Blick mag diese Frage überraschen, da sie einen der offensichtlichsten Gedanken Blumenbergs berührt: Eine absolute Metapher ist nach Blumenberg eine solche, die sich nicht in Begriffe rückübersetzen lässt. In diesem Sinne wird sie von ihm als absolut charakterisiert. Warum halte ich dennoch diese Frage für berechtigt? Das wird am besten anhand einer Alternative verdeutlicht: Ist die absolute Metapher ein Ausdruck in einem fremden Kontext, wie Blumenbergs zahlreiche Exempel nahelegen (die Kraft der Wahrheit, die nackte Wahrheit), oder ist die absolute Metapher gleichsam die jeweilige ganze Theorie, bündelt sich in ihr der gesamte Text? Auf den ersten Blick mag diese Alternative paradox erscheinen. Vorgreifend sei der ihr zugrundeliegende Gedanke erläutert: Blumenbergs Darstellung der Fundstellen legt zunächst die erste Lesart nahe. Demnach wäre die absolute Metapher das Vorkommen eines Ausdrucks (wie »Kraft« oder »nackt«) in einem Kontext, in den sie zunächst nicht passt (Wahrheit). Die Metapher wäre dann zwar nicht ein Ausdruck allein, sondern ein Ausdruck in einem ihm fremden Kontext; sie wiese jedoch Grenzen auf. Wie unbestimmt diese auch verliefen, ob sie weiter oder enger anzusetzen wäre, sie wäre lokalisier- und daher identifizierbar. Die zweite Lesart motiviert sich zunächst dadurch, dass Blumenberg vorführt, dass eine absolute Metapher gegeben sein kann, ohne dass sie als Ausdruck in einem Text vorkommt. Sie bildet dann dessen »implikatives Modell«; das heißt, sie stellt den Hintergrund der Begriffsbildung dar und entwirft das Verhältnis von Selbst und Welt. Was zunächst einen Sonderfall darstellt (Metapher ohne Ausdruck), verweist jedoch auf eine allgemeine Eigenschaft absoluter Metaphern bei Blumenberg: Diese sind Modelle für das Verhältnis von Ich und Welt und erfüllen dadurch theoretische und pragmatische Funktionen. Als solche ist die absolute Metapher nicht auf ein lokales Vorkommen begrenzt, sondern durchdringt den Text als solchen. Beide Möglichkeiten stehen in einem Gegensatz zueinander. Gleichwohl gibt es einen ver- mittelnden Gedanken: Die absolute Metapher (als Strukturzusammenhang des gesamten Textes verstanden) kann sich gleichsam in einem Ausdruck manifestieren, verdichten und selbst bezeichnen. Aber das Vorkommen von absoluten Metaphern wäre an das Vorkommen von Ausdrücken in einem fremden Kontext nicht gebunden. Die Diskussion dieser Frage steht im Zentrum des Beitrags (Abschnitte 1–2), sie hat Konsequenzen für zwei Gedanken (Abschnitte 3–4), die in ihrem Licht vielleicht klarer hervortreten. (shrink)

One of the most important thinkers of the twentieth century, Heidegger’s phenomenological investigation of existence, had a notable influence on the world of thought. In this work, two planes that fold over each other and present a holistic structure in Heidegger’s thought have been wended at the same time. The first of these is the investigation of the social possibility of Dasein's aspects, Heidegger's main problematic, through spatial conceptualizations such as space, place, closeness and distance; the second plane is the (...) reframing of Dasein's social aspects in the context of the concepts of 'dwelling' and 'construction'. This discussion also reveals the possibility of interaction between philosophy (ontic/ontological being, metaphysics, Dasein) and sociology (society, coexistence, social) in Heidegger's thought through the concepts of architectural discipline such as space, place, dwelling and building. All in all, it seems that the dwelling Heidegger built for Dasein offers a remarkable proposition to the social aspect of architecture; this points, above all, to the potential of “being with”, of human community, of a new relationship with the world. What does it mean to be conservative? What could it mean in the arts? Whoever merely conserves works of art may be a collector but is not an artist. Brahms’s trio op. 40 conserves the hand horn idiom. Yet its aesthetics will not be captured by the opposition of ‘conservative’ versus ‘progressive’. What is superior in terms of technology, Brahms maintained, need not be superior in terms of art.

This paper aims to assess knowledge management maturity at HEI to determine the most effecting variables on knowledge management that enhance the total performance of the organization. This study was applied on Al-Azhar University in Gaza strip, Palestine. This paper depends on Asian productivity organization model that used to assess KM maturity. Second dimension assess high performance was developed by the authors. The controlled sample was (364). Several statistical tools were used for data analysis and hypotheses testing, including reliability Correlation (...) using Cronbach’s alpha, “ANOVA”, Simple Linear Regression and Step Wise Regression. The overall findings of the current study suggest that KMM is suitable for measuring and lead to enhance high performance. KMM assessment shows that the university maturity level is in level three. Findings also support the main hypothesis and it is subhypotheses. The most important factors effecting high performance are: Processes, KM leadership, People, KM Outcomes, Knowledge Process. Furthermore the current study is unique by the virtue of its nature, scope and way of implied investigation, as it is the first study at HEI in Palestine explores the status of KMM using the Asian productivity model. Los sesgos cognitivos afectan negativamente la toma de decisiones en todas las esferas de la vida, incluyendo las decisiones de los jueces. La imposibilidad de eliminarlos por completo de la práctica del derecho, o incluso de controlar sus efectos, contrasta con el anhelo de que las decisiones judiciales sean el resultado exclusivo de un razonamiento lógico-jurídico correcto. Frente el efecto sistemático, recalcitrante y porfiado de los sesgos cognitivos, una posible estrategia para disminuir su efecto es enfocarse, no en modificar el (...) comportamiento de los agentes judiciales, sino en moldear su entorno para que los sesgos tengan menos oportunidades de aparecer. En particular, es más provechoso concentrar los esfuerzos en identificar aquellas reglas procesales que faciliten o limiten el efecto de los sesgos. En este ensayo propongo un diálogo fructífero entre el derecho y la psicología que puede llevar a mejorar la calidad de los sistemas judiciales. La propuesta está basada en la creación de guías de práctica judicial que puedan servir de base para la creación de protocolos procesales que limiten en la medida de lo razonable sus efectos negativos y conduzcan a mejores decisiones judiciales. This descriptive-correlational study determines the teaching efficacy among public Higher Education Institutions during the Academic Year 2021-2022. With 200 teacher-respondents, and with the use of weighted mean, standard deviation, t-test for independent samples, One-way ANOVA, and Pearson’s r, the findings are. 1) There is a significant difference in the extent of teaching efficacy of college instructors of HEIs in Sulu when data are categorized according to age, civil status, and educational attainment. But there is no significant difference in terms of (...) gender, length of service, and appointment status. Teachers who are 30 years old & above, separated, and with MA/MS degrees have better ways of assessing the level of confidence college instructors of HEIs in Sulu in their ability to guide students to success which includes helping students learn, building effective programs for students, and effectively changing student learning. 2) There is a very high correlation among the sub-categories subsumed under the extent of teaching efficacy of college instructors of HEIs in Sulu. En el marco del Realismo Mínimo se explicitará qué es el RCA y se presentará el Realismo Posible de los modelos económicos en su versión MISS. Se diferenciará el Realismo Mínimo del Realismo Científico Standard. Se desarrollarán las dificultades en torno al RCA.

The purpose of this study is to explore, gauge and identify the criterion of selecting qualified applicants in Hotel and Tourism Industry amongst graduates from selected SUC’s and HEI’S: Basis for Employability. The data are collected from different hotel and tourism companies who are also considered partners of some SUC’S and HEI’s on On-the- Job Training where students are deployed to undergo trainings in different areas of hotel and tourism sector specifically asked 10 (ten) Five Star Hotels, 10 (ten) Travel (...) Agencies, 10 (ten) Restaurants, 5 (five) Airline and Aviation company and 5 (five) from Resort Operations as the respondents of this study. The study used descriptive survey research design and data collection was administered through Google Forms. Initially, participants were also invited to a Focus Group Discussion where their inputs were asked regarding their opinions about the resumption of face-to-face on-the-job training. Since they are already attended the Focus Group Discussion, they were also invited to answer the survey questionnaire related to this study. Questionnaire and documentary analysis were the data gathering tools employed in the study. There is a significant factors and criterions in selecting qualified applicants in Hotel and Tourism Industry as basis for employability. The challenges met by the researcher was respondents has different set of criterions in selecting qualified applicants thus, study may also recommend and suggest standardized or uniform criterion in selecting qualified applicants in hotel and tourism industry. This descriptive-correlational study determines the emotional intelligence of faculty of public higher education institutions (HEIs) in Sulu during the academic year 2021–2022. The study adapted a purposeful sampling method in which there were two hundred samples. The data were analyzed using the weighted mean, standard deviation, t-test for independent samples, one-way ANOVA, and Pearson’s r. The following findings are drawn from this study: 1) The majority of the respondents are female, between the ages of 32 and 40, married, with 10 (...) years or fewer of experience teaching, permanent status, and a master's degree with some coursework toward a doctorate. 2) Teachers who participated in the survey agreed that Sulu's faculty members have higher levels of emotional intelligence than the national average. Thus, these educators possess a strong capacity to apply knowledge to various situations, specifically in relation to social, personal, emotional, and cognitive abilities that determine how someone responds to various clamor and tensions. On average, there is no significant difference in the extent of emotional intelligence among faculty of public HEIs in Sulu when data are categorized according to gender, civil status, length of service, and educational attainment. However, there are substantial age and employment status disparities, with teacher responders who are 51 years of age or older and who are employed on a temporary basis having greater abilities to gauge the level of emotional intelligence. La frecuencia con la que los personajes ejecutan estas acciones, en un determinado lugar, acentuará el proceso de la conformación de su identidad violenta, como cuando los cadetes pelean entre ellos; únicamente, en lugares apartados donde las autoridades militares del Leoncio Prado no pueden verlos ni controlarlos. El personaje Ricardo Arana (...) practica la no violencia, pero ni aun así puede librarse de las perversidades de sus otros compañeros; la resistencia que ejerce tan solo provoca que los demás muchachos lo envidien y terminen abusando de él, más que de cualquier otro estudiante. Los conocimientos tradicionales están dirigidos a una protección integral de las prácticas ancestrales de los pueblos indígenas. Estos conocimientos han estado usualmente unidos a intensos debates sin soluciones efectivas, en el actual sistema de propiedad intelectual. La razón es que este sistema de protección no ha sido abordado debidamente atendiendo a las necesidades de los pueblos indígenas. De hecho, hasta el día de hoy la única política pública que puede considerarse como un caso de éxito es el Protocolo de Swakopmund, (...) que es un "hito" de una triangulación entre conocimientos tradicionales, comercio y ambiente. En este capítulo, analizamos esta triple óptica, como temas individuales que impulsan la protección de los conocimentos tradicionales, en escenarios internacionales como la OMC y la OMPI. (shrink)

El capítulo expone el lugar dialéctico-sistemático de la escultura clásica en las Lecciones de estética de Hegel, poniendo de relieve su afinidad con las descripciones de Winckelmann, como interpretación moderna, del arte griego de los siglos IV y V.

Los vocablos auctoritas y potestas, provienen del Derecho Romano y constituyeron la piedra angular sobre la que se asentaba el funcionamiento de la civitas. La transmisión y proyección hacia el porvenir de este aspecto de la tradición romana dará lugar a la conformación de una serie de hábitos de diversa índole denominados inores maiorum. Tradición en la que la potestas se define como una fuerza que emana de la legitimidad otorgada por la sociedad civil y la auctoritas como la distinción (...) de determinadas personas basada en una serie de características morales e intelectuales que las destacan del resto. Este constructo arquetípico parece desmoronarse con la llegada de la época moderna, debido a que la misma parece romper con la tradición y los prejuicios. (shrink)

Lo primero que debemos tener en cuenta es que cuando decimos que China dice esto o China hace eso, no estamos hablando del pueblo chino, sino de los sociópatas que controlan el PCC -- Partido Comunista Chino, es decir, los Siete Asesinos En Serie Seniláticos (SSSSK) de th e Comité Permanente del PCC o de los 25 miembros del Politburó, etc. -/- Los planes del PCC para la Tercera Guerra Mundial y la dominación total están muy claro en las publicaciones (...) y discursos del gobierno chino y este es el "sueño de China" de Xi Jinping. Es un sueño sólo para la pequeña minoría (tal vez unas pocas docenas a unos pocos cientos) que gobiernan China y una pesadilla para todos los demás (incluyendo 1.400 millones de chinos). Los 10 mil millones de dólares anuales les permiten a ellos o a sus marionetas poseer o controlar periódicos, revistas, canales de televisión y radio y colocar noticias falsas en la mayoría de los principales medios de comunicación de todo el día. Además, tienen un ejército (tal vez millones de personas) que troll todos los medios de comunicación colocando más propaganda y ahogando comentarios legítimos (el ejército de 50 centavos). -/- Además de despojar al tercer mundo de recursos, un gran impulso de la Iniciativa de Cinturón y Carretera sin peaje es la construcción de bases militares en todo el mundo. Están forzando al mundo libre a una carrera armamentista masiva de alta tecnología que hace que la guerra fría con la Unión Soviética parezca un picnic. -/- Aunque el SSSSK, y el resto de los militares del mundo, están gastando enormes sumas en hardware avanzado, es muy probable que WW3 (o los compromisos más pequeños que conducen a él) esté dominado por software. No está fuera de cuestión que el SSSSK, con probablemente más hackers (codificadores) trabajando para ellos entonces todo el resto del mundo combinado, ganará futuras guerras con un conflicto físico mínimo, sólo por paralizar a sus enemigos a través de la red. Sin satélites, sin teléfonos, sin comunicaciones, sin transacciones financieras, sin red eléctrica, sin internet, sin armas avanzadas, sin vehículos, trenes, barcos o aviones. -/- Sólo hay dos caminos principales para eliminar el PCC, liberar a 1.400 millones de prisioneros chinos y poner fin a la marcha lunática a la Segunda Guerra Mundial. Sobre los robots como mejores médicos que los humanos.

El trabajo consiste en una elucidación de los elementos que conforman el concepto de pena natural (poena naturalis) en el Derecho penal. Se puede caracterizar la pena natural como el daño o sufrimiento que recae sobre el autor de un delito, producto de la comisión del mismo, que debe ser descontado de la pena legal que ha de aplicársele. Si bien existe un mínimo acuerdo sobre esto, tanto en la jurisprudencia como en la doctrina penal se observan serios desacuerdos acerca (...) de los requisitos que se deben cumplir para reconocer que se está frente a una pena natural. Para elucidar los elementos, se utilizará el constructivismo conceptual de Ronald Dworkin, a fin de describir el desacuerdo y sus implicancias, reconocer los elementos principales de la pena natural y justificarlos bajo su mejor luz moral. ABSTRACT This study focuses on the clarification of the conceptual elements of poena naturalis in criminal law settings. The poena naturalis is the damage or suffering that falls on the convict for its commission. This damage must be deducted from the poena forensis to be applied. Although there is a minimum agreement about the concept of poena naturalis, in the jurisprudence and among legal scholars, there are serious disagreements about the elements of poena naturalis. To elucidate the elements, I will adopt Ronald Dworkin’s conceptual constructivism to describe the disagreement and its implications. El discurso sobre los nuevos derechos humanos se ha asentado como un elemento característico de la práctica política y jurídica contemporánea. Son muy diversos los colectivos que presentan sus reivindicaciones políticas con el lenguaje de los derechos humanos con la finalidad de incrementar el apoyo a dichas reivindicaciones y de dotar a dichas reivindicaciones de la protección privilegiada de los derechos humanos. Pese a ello, las constantes referencias a nuevos derechos no han venido acompañadas de una reflexión teórica adecuada. ¿Cómo (...) se relacionan los nuevos derechos con los derechos clásicos?, ¿ponen en entredicho los nuevos derechos el paradigma de derechos humanos dominante en la actualidad?, ¿cómo afectaría su reconocimiento a la configuración de los sistemas jurídicos contemporáneos?, ¿qué reivindicaciones de nuevos derechos están verdaderamente justificadas? Los nuevos derechos humanos: teoría jurídica y praxis política reúne a una serie de trabajos que tratan de dar respuesta a estos interrogantes, tanto a partir de la discusión general de la teoría de los derechos humanos como a partir de la discusión de derechos específicos, como los neuroderechos, los derechos digitales, derechos relacionados con el inicio o final de la vida, los derechos de la naturaleza, el derecho al deporte o los derechos de asistencia sexual. El concepto de desarrollo humano del Programa de las Naciones Unidas para el Desarrollo (PNUD) surge en 1990 como una crítica a la consideración de la economía como el fin último de los esfuerzos del desarrollo. En la visión del PNUD, la economía es considerada un fin relativo, es decir, un fin y un medio para el desarrollo humano. Al considerar, por su parte, el fin del desarrollo humano, este es identificado con el ensanchamiento de las opciones y libertades de (...) que gozan los individuos. En este sentido, este concepto de desarrollo humano hace alusión a una práctica política más que a un entendimiento ético-ontológico del ser humano, evitando referirse a desarrollo humano entendido como un desarrollo del ser humano. Este artículo explora los antecedentes del concepto del desarrollo humano del PNUD y los fines que consideran estos enfoques previos. Se observa que la consideración subjetivista del PNUD proviene de la teoría de Amartya Sen, quien queda sujeto a la crítica objetivista de Martha Nussbaum al no considera un fin objetivo para los asuntos humanos, crítica que puede de igual manera aplicarse al concepto de desarrollo humano del PNUD. (English:) This contribution attempts a first non-normative approach to the problem of the classic, its definition and its meaning in an age of globalization. It reviews a series of common representations of the classic (and other analogous or contrary terms), stressing the programmatic-ideological aspect that generally characterizes them. Classic, actually, tends to be a foundational category, and therefore rests on delimitations that determine its exclusiveness as opposed to something else. This paper, in particular, criticizes the last boundary of the exclusivity (...) of the classic, that is, its normative opposition to fashion and actuality. On the contrary, it is argued that there is a substantial link between classic, actuality and fashion. On the basis of this connection, two deflationary definitions of the classic are proposed: the first regards it as part of the broader process of construction of historical identity by concrete individuals. The second, on the other hand, conceives it as a product of art, and, therefore, of a formative process of abilities, skills, taste, by which the classic becomes the object of technical, aesthetic and teleological judgments. -/- (Spanish:) En esta contribución se intenta una primera aproximación no normativa al problema del clásico, su definición y su significado en una era de globalización. Se revisa una serie de representaciones comunes sobre lo clásico (y otros términos análogos o contrarios), se destaca el aspecto programático-ideológico que por lo general las caracteriza. Clásico, en efecto, tiende a ser una categoría fundacional, por lo cual se apoya en delimitaciones que determinan su exclusividad por oposición a otra cosa. En este trabajo, en particular, se critica la última frontera de la exclusividad de lo clásico, es decir, su oposición normativa a la moda y la actualidad. Por el contrario, se argumenta que existe un vínculo sustancial entre el clásico, la actualidad y la moda. A partir de esta conexión, se proponen dos definiciones deflacionarias del clásico: la primera lo considera parte del proceso más amplio de construcción de la identidad histórica por parte de individuos concretos. El segundo, en cambio, lo concibe como un producto del arte, y, por tanto, de un proceso de formación de competencias, habilidades, gusto, por el cual el clásico se convierte en objeto de juicios técnicos, estéticos y teleológicos. En este artículo se toma en consideración la noción de providencia en Alejandro de Afrodisias, como hito principal de los esfuerzos del aristotelismo para responder a la noción estoica de “destino” o “hado”. Se tienen en cuenta los precedentes aristotélicos sobre este tema, sobre todo el tratado _De mundo_. El aristotelismo siempre ha recalcado la mayor sujeción al poder divino de los cielos respecto del mundo sublunar, pero será Alejandro quien convierta esta providencia primariamente concentrada en el cielo en una (...) “providencia general” en sentido estricto. Ahora bien, si los dioses sólo conocen las especies y no los particulares, entonces es preciso rechazar la interpretación de Sharples. Según él, la concepción de providencia sostenida por Alejandro pretendía responder a una línea de crítica como la de Ático; pero, de acuerdo con Alejandro, los dioses seguirían sin saber la calidad de la conducta humana, luego no se daría satisfacción a las objeciones de Ático. Se finaliza atendiendo al parentesco de la concepción de Alejandro con el medioplatonismo, una semejanza que podría justificar este viraje adoptado por el filósofo peripatético. (shrink)

Abstract - The aim of the study is to identify the degree of administrative transparency in the Palestinian higher educational institutions in the Gaza Strip. In the study, the researchers adopted a descriptive and analytical method. The research population consisted of administrative staff, whether academic or administrative, except for those in senior management or the university council. The study population reached 392 employees. A random sample was selected (197). The number of questionnaires recovered was (160) with a recovery rate of (...) (81.2%). The researchers used a questionnaire for the data collection and were treated using SPSS to obtain the results. The results show that there is no significant difference between male responses and female responses due to gender variable. The results also confirm that there is no significant difference between respondents' responses due to the age variable. The results also showed a significant difference between respondents' responses attributed to the university variable. There is a fundamental difference between respondents' responses attributed to the scientifically qualified variable. The results also confirmed a significant difference between respondents' responses attributed to the management level variable. The results also confirmed a significant difference between respondents' responses due to variable years of service. The research reached a number of recommendations, the most important of which is: The necessity of Palestinian universities to adhere to the application of transparency standards in all university activities. The need to benefit from regional and international experience in the application of transparency systems within universities and to examine the possibility of applying these systems in our universities. As well as the need to engage in the program of teaching transparency in universities, as it is confirmed that only five universities participated in this experiment. The importance of raising awareness among the employees of Palestinian universities to clarify the foundations of building transparency and its dimensions to represent the active supporter through workshops and seminars. Se trata de tesis elaboradas a partir de un diálogo se subsunción crítica con los libros Las ideas estéticas de Marx e Invitación a la Estética, de Adolfo Sánchez Vázquez. Buscan realizar una lectura axiológica de estos libros, lo cual no siempre fue la intención explícita de su autor al escribirlos.

¿Cómo puede la lógica representar expresiones indéxicas como “yo”, “aquí” y “ahora”? ¿Cómo no debe representarlas? Examino estas dos preguntas a partir de la Lógica de los Demostrativos (LD) de Kaplan y su impopular prohibición de operadores monstruosos. A pesar de algunos defectos de formulación, sostengo que dicha prohibición está guiada por una poderosa visión de las relaciones lógicas de validez entre oraciones con indéxicos que desafía la concepción tradicional de consecuencia lógica como preservación de la verdad y resalta el (...) papel fundamental de la información semántica en la construcción de sistemas formales concebidos como modelos de las lenguas naturales. Resumen: La investigación analiza el concepto de justicia en el contexto de la justicia premial consagrada en la legislación colombiana. El presente artículo, que hace parte de una investigación de mayor alcance, realiza primeramente un análisis del concepto de justicia en sentido filosófico, para luego analizar el concepto de justicia premial. Finalmente, se intercepta el concepto de justicia premial con el concepto más general de justicia, a partir de las nociones de paranomos y pleonektès de Aristóteles. Se concluye que el (...) concepto de justicia premial se cataloga como una institución justa tal como la define este filósofo, por lo que no le es dado al intérprete desde esta perspectiva atribuir criterios de injusto a las decisiones que ponen fin a las controversias por intermedio de la justicia premial. En el trabajo se hace un recorrido por los principales autores latinoamericanos que trabajan el tema de los valores en el siglo XX. Se trata de apresar algunas regularidades generales en el itinerario del pensamiento axiológico en América Latina durante la pasada centuria.

El concepto de trastorno mental permite justificar intervenciones médicas, psicológicas y judiciales. Además, facilita a la/el consultante acceder a tratamientos mediante reembolsos o programas de salud pública, y por otro lado, podría conllevar estereotipos sociales. No obstante, el significado de dicho concepto no ha dejado de suscitar debate. En el presente artículo argumentaré que los trastornos de personalidad, tal como son definidos en el DSM-5, no cumplen con los criterios de patología de las propuestas principales (i.e. teoría bio-estadística de la (...) salud, disfunción dañina, o entidad patológica) debido a tres razones independientes: (i) no se han propuesto dis/funciones a la base de cada trastorno y, dado el estado del arte de la psicología evolucionista, es poco probable que se pueda llevar a cabo ese programa en el futuro; (ii) el concepto de daño (distrés, perjuicio) aplicable a los trastornos de personalidad es constitutivamente social (aunque no exclusivamente social), por lo que resulta más adecuado hablar de grados de discapacidad que de trastornos del individuo; y (iii) que la ausencia de condiciones patognomónicas para cada trastorno, junto a la elevada comorbilidad y multimorbilidad entre trastornos de personalidad, horada la validez de la nosología actual y de los diagnósticos diferenciales. Propondré como solución la eliminación de los trastornos de personalidad de la nosología psiquiátrica. Eliminar los trastornos de personalidad no equivale a desconocer el sufrimiento de las personas diagnosticadas, ni a ignorar que dicho sufrimiento precede a, –y no acaba con la disolución de– la etiqueta diagnóstica. Por ello, se propondrá una reconceptualización de dicho sufrimiento en términos de discapacidad, entendida desde el modelo social, y que no presupone patología. (shrink)

El estudio acerca de la influencia de las pasiones en el voluntario libre ha sido recurrente en la tradición tomista. Sin embargo, las causas de los dos efectos psicológicos de la intentio volitiva mencionados por Tomás de Aquino, la redundantia y la distractio, pasaron desapercibidas, y podrían aclarar algunos comportamientos consecuencia de la dinámica de las pasiones del hombre. La acción de la intentio volitiva originada por los afectos, al alcanzar cierto grado de intensidad, puede llegar a sobrepasar el control (...) de la voluntad y la inteligencia. Además, otro punto original de esta temática es que, a la par que el influjo de “abajo hacia arriba” (pasiones hacia la voluntad) —algo ya mencionado por Aristóteles cuando habla de la intemperancia y por los medievales en el estudio de la voluntad—, también puede detectarse otro de “arriba hacia abajo” (influjos afectivos superiores que influyen en la inteligencia —conocimiento afectivo⎯ y ésta sobre la voluntad), de tal manera que cierto tipo de concentraciones psicológicas hacen que la persona deje de tener sensaciones somáticas hasta producirse en él evasiones temporales, trances inconscientes y efectos extremos similares. Finalmente, desde el punto de vista de la Historia de la Filosofía, este trabajo también muestra que ha habido un olvido en el estudio de esta faceta volitiva de la intentio, ya que se ha estudiado sobre todo su aspecto ético, pero sin relación con la intentio cognoscitiva (“intencionalidad”). En cualquier caso, las tesis sobre la intentio y sus efectos muestran cómo es preciso rebasar el estudio del ámbito natural-biológico para completarlo con el ámbito personal-cultural. (shrink)
