A set of parameters for classifying composition operations is introduced. These parameters determine whether a composition operation is 1) universal, 2) determinate, 3) whether there is a difference between possible and actual compositions, 4) whether there can be singleton compositions, 5) whether they give rise to a hierarchy, and 6) whether components of compositions can be repeated. Philosophical implications of these parameters (in particular in relation to set theory) and mereology are discussed.

This is my contribution to a symposium on Berit Brogaard's book "Transient Truths" in which I criticize her treatment of various linguistic phenomena related to tense.

The Operator Argument against eternalism holds that having non-vacuous tense operators in the language is incompatible with the claim that every proposition has its truth-value eternally. Assuming that (1) there are non-vacuous tense operators, (2) tense operators operate on propositions and (3) tense operators which operate on eternal entities are vacuous, it may be argued that eternalism is false. In this paper, I examine the Operator Argument. The goal is threefold. First, I want to present some (...) aspects of the debate in a more elaborate way, especially those concerning formal matters. Secondly, I will argue that eternalism can escape the Operator Argument. There are two main strategies for handling the Operator Argument. The first one is based on replacing temporal operators with object-language quantifiers. The second rejects the identification of compositional semantic value with assertoric content. My third goal is to show that none of them is as good as the strategy that adopts Timestamp Semantics (Fritz in Philosl Stud 176:2933–2959, 2019). I am going to argue that the quantificational treatment of tenses is compatible with temporalism and that the arguments for rejecting the identification of compositional semantic value with assertoric content provide, in fact, a motivation for the temporalist position. At the end, I will develop Timestamp Semantics by providing a novel formalization of it, and defend it against three potential counter-arguments. (shrink)

Certain passages in Kaplan’s ‘Demonstratives’ are often taken to show that non-vacuous sentential operators associated with a certain parameter of sentential truth require a corresponding relativism concerning assertoric contents: namely, their truth values also must vary with that parameter. Thus, for example, the non-vacuity of a temporal sentential operator ‘always’ would require some of its operands to have contents that have different truth values at different times. While making no claims about Kaplan’s intentions, we provide several reconstructions of how (...) such an argument might go, focusing on the case of time and temporal operators as an illustration. What we regard as the most plausible reconstruction of the argument establishes a conclusion similar enough to that attributed to Kaplan. However, the argument overgenerates, leading to absurd consequences. We conclude that we must distinguish assertoric contents from compositional semantic values, and argue that once they are distinguished, the argument fails to establish any substantial conclusions. We also briefly discuss a related argument commonly attributed to Lewis, and a recent variant due to Weber. (shrink)

Philosophical problems about the part-whole relation have been discussed throughout the history of philosophy, at least since Plato and Aristotle. In contemporary philosophy, the understanding of these issues has benefited from the formal tools of Classical Extensional Mereology. This paper aims is to defend mereological restrictivism against some constraints imposed by the vagueness argument. To achieve this, the paper is divided into three parts. In the first, I introduce the special composition question (hereafter SCQ) as formulated by [Van Inwagen, (...) 1990] and briefly present the three sets of theories that proffer answers to it. In the second part, I focus on the vagueness argument, that was presented by [Lewis, 1986, ] and [Sider, 2007, ] to defend mereological universalism. In the third section, I introduce the theory of natural properties by David Lewis. From this theory, I propose a new mereological operation labeled as natural fusion. The purpose of this operation is to falsify one of the premises of the vagueness argument. Then, I discuss some examples and counter-examples to natural fusion. (shrink)

In quantum theory every state can be diagonalized, i.e. decomposed as a convex combination of perfectly distinguishable pure states. This elementary structure plays an ubiquitous role in quantum mechanics, quantum information theory, and quantum statistical mechanics, where it provides the foundation for the notions of majorization and entropy. A natural question then arises: can we reconstruct these notions from purely operational axioms? We address this question in the framework of general probabilistic theories, presenting a set of axioms that guarantee that (...) every state can be diagonalized. The first axiom is Causality, which ensures that the marginal of a bipartite state is well defined. Then, Purity Preservation states that the set of pure transformations is closed under composition. The third axiom is Purification, which allows to assign a pure state to the composition of a system with its environment. Finally, we introduce the axiom of Pure Sharpness, stating that for every system there exists at least one pure effect occurring with unit probability on some state. For theories satisfying our four axioms, we show a constructive algorithm for diagonalizing every given state. The diagonalization result allows us to formulate a majorization criterion that captures the convertibility of states in the operational resource theory of purity, where random reversible transformations are regarded as free operations. A recent evolution of computer simulations has led to the emergence of complex computer simulations. In particular, the need to formalize composite objects (those objects that are composed of other objects) has led to what the author suggests calling pluriformalizations, i.e. formalizations that are based on distinct sub-models which are expressed in a variety of heterogeneous symbolic languages. With the help of four case-studies, he shows that such pluriformalizations enable to formalize distinctly but simultaneously either different aspects or different parts (...) or different scales of the same object or system. From an epistemological standpoint, he suggests that this kind of computer-aided complex formalization of composite objects renew the traditional relations between computer simulations, theoretical models and operational models. It is a widely held view in philosophy that propositions perform a plethora of different theoretical roles. Amongst other things, they are believed to be the semantic values of sentences in contexts, the objects of attitudes, the contents of illocutionary acts, and the referents of that-clauses. This assumption is often combined with the claim that propositions have their truth-values eternally. In this paper I aim to show that these two assumptions are incompatible: propositions cannot both fulfill the mentioned roles and (...) be eternally true or false. Following Kaplan and Lewis’s Operator Argument, I argue that compositional semantic values of sentences in contexts do not correspond to eternal propositions. Thus, either we regard the non-eternal entities that in fact realize the semantic role of propositions as also fulfilling the remaining propositional roles, or we abandon the assumption that there is a unique realizer of all the roles. The Operator Argument has recently come under attack, mainly for its tense-logical assumptions. However, rejecting these assumptions is not a sufficient defense of the compatibility of the two claims, since the extensional alternative to the tense-logical framework does not allow us to universally retain eternal propositions as compositional semantic values of sentences either. The meaning that expressions take on particular occasions often depends on the context in ways which seem to transcend its direct effect on context-sensitive parameters. ‘Truth-conditional pragmatics’ is the project of trying to model such semantic flexibility within a compositional truth-conditional framework. Most proposals proceed by radically ‘freeing up’ the compositional operations of language. I argue, however, that the resulting theories are too unconstrained, and predict flexibility in cases where it is not observed. These accounts fall into this position because (...) they rarely, if ever, take advantage of the rich information made available by lexical items. I hold, instead, that lexical items encode both extension and non-extension determining information. Under certain conditions, the non-extension determining information of an expression e can enter into the compositional processes that determine the meaning of more complex expressions which contain e. This paper presents and motivates a set of type-driven compositional operations that can access non-extension determining information and introduce bits of it into the meaning of complex expressions. The resulting multidimensional semantics has the tools to deal with key cases of semantic flexibility in appropriately constrained ways, making it a promising framework to pursue the project of truth-conditional pragmatics. This paper introduces a framework for direct surface composition by online update. The surface string is interpreted as is, with each morpheme in turn updating the input state of information and attention. A formal representation language, Logic of Centering, is defined and some crosslinguistic constraints on lexical meanings and compositional operations are formulated.

This articles explores the mereological foundation of truthmaker semantics. Building upon Kit Fine’s abstract theory of part in [16], we engage in an exploration of the mereological assumptions that determine the construction of truthmaker semantics. Our approach yields semantics for a diverse range of logics, including substructural logics such as the associative Lambek calculus, as well as the logics of analytic containment. Furthermore, we elucidate the philosophical implications that arise from this pioneering approach.

This paper motivates and develops a novel semantic framework for deontic modals. The framework is designed to shed light on two things: the relationship between deontic modals and substantive theories of practical rationality and the interaction of deontic modals with conditionals, epistemic modals and probability operators. I argue that, in order to model inferential connections between deontic modals and probability operators, we need more structure than is provided by classical intensional theories. In particular, we need probabilistic structure that (...) interacts directly with the compositional semantics of deontic modals. However, I reject theories that provide this probabilistic structure by claiming that the semantics of deontic modals is linked to the Bayesian notion of expectation. I offer a probabilistic premise semantics that explains all the data that create trouble for the rival theories. (shrink)

We advocate and develop a states-based semantics for both nominal and adjectival confidence reports, as in "Ann is confident/has confidence that it's raining", and their comparatives "Ann is more confident/has more confidence that it's raining than that it's snowing". Other examples of adjectives that can report confidence include "sure" and "certain". Our account adapts Wellwood's account of adjectival comparatives in which the adjectives denote properties of states, and measure functions are introduced compositionally. We further explore the prospects of applying these (...) tools to the semantics of probability operators. We emphasize three desirable and novel features of our semantics: (i) probability claims only exploit qualitative resources unless there is explicit compositional pressure for quantitative resources; (ii) the semantics applies to both probabilistic adjectives (e.g., "likely") and probabilistic nouns (e.g., "probability"); (iii) the semantics can be combined with an account of belief reports that allows thinkers to have incoherent probabilistic beliefs (e.g. thinking that A & B is more likely than A) even while validating the relevant purely probabilistic claims (e.g. validating the claim that A & B is never more likely than A). Finally, we explore the interaction between confidence-reporting discourse (e.g., "I am confident that...") and belief-reports about probabilistic discourse (e.g.,"I think it's likely that.."). This paper examines distinctive discourse properties of preposed negative 'yes/no' questions (NPQs), such as 'Isn’t Jane coming too?'. Unlike with other 'yes/no' questions, using an NPQ '∼p?' invariably conveys a bias toward a particular answer, where the polarity of the bias is opposite of the polarity of the question: using the negative question '∼p?' invariably expresses that the speaker previously expected the positive answer p to be correct. A prominent approach—what I call the context-management approach, developed most extensively by Romero (...) and Han (2004)—attempts to capture speaker expectation biases by treating NPQs fundamentally as epistemic questions about the proper discourse status of a proposition. I raise challenges for existing context-managing accounts to provide more adequate formalizations of the posited context-managing content, its implementation in the compositional semantics and discourse dynamics, and its role in generating the observed biases. New data regarding discourse differences between NPQs and associated epistemic modal questions are introduced. I argue that we can capture the roles of NPQs in expressing speakers’ states of mind and managing the discourse common ground without positing special context-managing operators or treating NPQs as questions directly about the context. I suggest that we treat the operator introduced with preposed negation as having an ordinary semantics of epistemic necessity, though lexically associated with a general kind of endorsing use observed with modal expressions. The expressive and context-managing roles of NPQs are explained in terms of a general kind of discourse-oriented use of context-sensitive language. The distinctive expectation biases and discourse properties observed with NPQs are derived from the proposed semantics and a general principle of Discourse Relevance. (shrink)

Human language, hominin tool production modes, and multimodal communications systems of primates and other animals are currently well-studied for how they display compositionality or combinatoriality. In all cases, the former is defined as a kind of hierarchical nesting and the latter as a lack thereof. In this article, I extend research on combinatoriality and compositionality further to investigations of everyday primate skills. Daily locomotion modes as well as behaviors associated with subsistence practices, hygiene, or body modification rely on the hierarchical (...) nesting of different behavioral and cognitive actions into complex skills. I introduce a scheme which uses hierarchical organization to differentiate combinatorial from compositional skills. Combinatorial skills are defined either as aggregational or linearly hierarchical depending on whether the skill occurs momentarily in space or unfolds sequentially over time. Compositional skills are defined either as nested or interactionally hierarchical depending on whether the skill results in new constructs or in new interactions between existing constructs. The methodology I propose combines epistemological hierarchy theory with data from primatological field research and experimental and comparative psychological research and provides a means to integrate current constructionist and extended views on cognition and action with older research on behavioral logics in psychology and operational chain thinking in anthropology. The approach furthermore synchronizes with ongoing research on teleonomy, intentionality, and creativity. -/- . (shrink)

It is shown how an intensional interpretation of physics object languages can be formalised, and how a syntactic compositional time reversal operator can subsequently be defined. In this thesis I argue against unrestricted mereological hybridism, the view that there are absolutely no constraints on wholes having parts from many different logical or ontological categories, an exemplar of which I take to be ‘mixed fusions’. These are composite entities which have parts from at least two different categories – the membered (as in classes) and the non-membered (as in individuals). As a result, mixed fusions can also be understood to represent a variety of cross-category summation such as (...) the abstract with the concrete, the physical with the non-physical, and the possible with the impossible, just to name a few. -/- Proposed by David Lewis (1991) alongside his defence of classical mereology (the major theory of parthood which permits such transcategorial composites through its principle of unrestricted composition) it is my contention that mixed fusions are an under-examined consequence of indiscriminate mereological fusion which harbour a multitude of complications. In my attempt to discern their substantive character, throughout this thesis I make a case study of mixed fusions and uncover several problematic consequences which I think follow from their most plausible assessment. -/- These include: (1) that mixed fusions’ probable membership relations may lead to dubious foundational loops in the mereological Universe, or (2) otherwise that mixed fusions oblige an implausible ontological priority of the mereological Universe as a whole; (3) that mixed fusions contradict the reductive account of set theory they are proposed within, by plausibly being seen to have the same members as their class parts, and (4) that mixed fusions therefore confound a mereological thesis of Composition as Identity, which some (including Lewis) use to support classical mereology – a consequence which is potentially self-defeating; (5) that mixed fusions as sums of abstract and concrete entities both subvert Lewis’s (1986) system of modal realism, while (6) also undermining less expansive theories of possible worlds; and finally, (7) that even where some of the foregoing is resisted, it remains implausible that mixed fusions are ontologically innocent, because their supposed distinction from their parts in this case ensures that they need to be counted as additional entities in one’s ontology. -/- To be clear, I do not advance a theory of mereological hybrid nihilism in the sense of denying all cases of transcategorial composition. (I only cover a few select instances of mereological hybridism via mixed fusions after all.) Rather, I deny that mereological hybridism is plausible in full generality, by demonstrating that any cases of it are at least limited by the constraints that I identify. This in turn vindicates a call for a restriction on parthood theories and composition principles which allow certain types of categorially mixed entities – including restricting classical mereology with its principle of unrestricted composition. -/- Although theories of parthood like the standard classical mereology are not ordinarily developed for the sake of mereological hybrids like mixed fusions, these and other transcategorial composites are still among the logical consequences of such parthood systems operating with sufficient generality. The significance of my thesis, then, comes from showcasing how some of these kinds of entities do not conform to the systems in which they are included as required, and hence I argue for the rejection of unrestricted mereological hybridism as well as any mereological principles which support it. The article aims to define the management mechanism of complex, open dynamic systems with human participation. The following parts of the system life-cycle were identified and unified in the theoretical scope: general and specific compositional elements of repeating changes, marginal index boundaries, the dynamics of the compositional elements of the lifecycle, the key points of the change in the character of the index dynamics. In the practical scope, two common trends of socio-economical system life-cycle management are considered. The first trend (...) is the regulation of the comprising element ratio, which provides the increase in the duration of the maximally effective performance of a functioning system. The second trend is the regulation of the reproduction time of a new system. The systems life cycle aspects are investigated in almost all sciences and studied within many disciplines in the field of higher education. Therefore, deepening the mastery of scientific and methodological foundations of the life cycle of a complex open dynamic system is useful for any subject in everyday and practical activities. A human being – in the formation of own human capital. Families – when it is formed, the birth of children, the distribution of income and expenses. Companies – for efficient business activities. As well as local communities, local self-government bodies, public authorities and global entities within their profile activities. The results of the research provide the possibility of the development of applicable mechanisms for effectiveness and stability enhancement of managerial and entrepreneurial operation in business projects. A holobiont is a composite organism consisting of a host together with its microbiome, such as a coral with its zooxanthellae. To explain the often intimate integration between hosts and their microbiomes, some investigators contend that selection operates on holobionts as a unit and view the microbiome’s genes as extending the host’s nuclear genome to jointly comprise a hologenome. Because vertical transmission of microbiomes is uncommon, other investigators contend that holobiont selection cannot be effective because a holobiont’s microbiome is an (...) acquired condition rather than an inherited trait. This disagreement invites a simple mathematical model to see how holobiont selection might operate and to assess its plausibility as an evolutionary force. This paper presents two variants of such a model. In one variant, juvenile hosts obtain microbiomes from their parents (vertical transmission). In the other variant, microbiomes of juvenile hosts are assembled from source pools containing the combined microbiomes of all parents (horizontal transmission). According to both variants, holobiont selection indeed causes evolutionary change in holobiont traits. Therefore, holobiont selection is plausibly an effective evolutionary force with either mode of microbiome transmission. The modeling employs two distinct concepts of inheritance, depending on the mode of microbiome transmission: collective inheritance whereby juveniles inherit a sample of the collected genomes from all parents, as contrasted with lineal inheritance whereby juveniles inherit the genomes from only their own parents. A distinction between collective and lineal inheritance also features in theories of multilevel selection. (shrink)

This study deals primarily with the effectiveness of the Land Bank of Philippines as a Depository Bank of Makati Branch in specific organization and bank operations management. This paper provides baseline data in aid of policy formulation to enhance the bank operations management that offers new motivation towards a policy that effectively addresses and solves the bank operations management. This study used the quantitative descriptive method. Thirteen (13) bank personnel and 64 barangays elected chairman, including the appointed treasurer with direct (...) access to the bank transaction regarding the funds of the barangays in Makati City, were purposely taken as research respondents. It was found that no significant difference exists in the assessment of the respondents in organization and bank operations management when grouped according to age, gender, and educational attainment. The mean evaluation of the respondents in the organization and bank operations management with the variables mentioned revealed effectiveness, and the grand mean and the composite mean are within the mean range of 3.50-4.49, interpreted as effective. This implies that the variables mentioned are directly performed to the standard of the bank. It is recommended that the bank look into the deposits of the barangay funds as it is mandated by law to secure the funds of the barangay in the form of deposits and withdrawals. (shrink)

Mental representations remain the central posits of psychology after many decades of scrutiny. However, there is no consensus about the representational format(s) of biological cognition. This paper provides a survey of evidence from computational cognitive psychology, perceptual psychology, developmental psychology, comparative psychology, and social psychology, and concludes that one type of format that routinely crops up is the language-of-thought (LoT). We outline six core properties of LoTs: (i) discrete constituents; (ii) role-filler independence; (iii) predicate–argument structure; (iv) logical operators; (v) (...) inferential promiscuity; and (vi) abstract content. These properties cluster together throughout cognitive science. Bayesian computational modeling, compositional features of object perception, complex infant and animal reasoning, and automatic, intuitive cognition in adults all implicate LoT-like structures. Instead of regarding LoT as a relic of the previous century, researchers in cognitive science and philosophy-of-mind must take seriously the explanatory breadth of LoT-based architectures. We grant that the mind may harbor many formats and architectures, including iconic and associative structures as well as deep-neural-network-like architectures. However, as computational/representational approaches to the mind continue to advance, classical compositional symbolic structures – that is, LoTs – only prove more flexible and well-supported over time. Fictionalists maintain that possible worlds, numbers or composite objects exist only according to theories which are useful but false. Hale, Divers and Woodward have provided arguments which threaten to show that fictionalists must be prepared to regard the theories in question as contingently, rather than necessarily, false. If warranted, this conclusion would significantly limit the appeal of the fictionalist strategy rendering it unavailable to anyone antecedently convinced that mathematics and metaphysics concern non-contingent matters. I try to show that their arguments (...) can be resisted by developing and defending a strategy suggested by Rosen, Nolan and Dorr, according to which the fiction-operator is to be analysed in terms of a counterfactual that admits of non-trival truth-values even when the antecedent is impossible. High grade chromite ore has been decreased constantly due to the importance of chromium element in industrial uses such as metallurgical, chemical, and refractory industries. Therefore, beneficiation of low grade has been more significant .Response Surface Methodology (RSM) is combination of statistical and mathematical methods used for modeling and analyzing problems. In this study, the Central Composite Design (CCD) was applied by using Design-Expert (version 6.0.5) for modeling and optimizing the effect of operating variables on the performance of gravity separation (...) via pilot plant shaking table for chromite ore. Three operating variables were studied, namely feed rate, tilt angle, and flow rate during the tests. The sample under study is low grade chromite ore, containing (30.21%, Cr2O3). The mathematical model equations of ANOVA model revealed that the grade of concentrate is more sensetive for feed rate (g/min) compered to water flow rate (l/min).whereas , recovery of concentrate is more sensetive for tilt angle compered to water flow rate (l/min) and feed rate (g/min). Optimized responses for the beneficiation process were found at concentrate with 48.52% Cr2O3 in with 83.09% recovery and it was achieved at water flow rate 15.33 l/min, tilt angle 2.16 ≈ 2.00 degree, and feed rate of 195.38 g/min. Most of the free will debate operates under the assumption that classic determinism and indeterminism are the only metaphysical options available. Through an analysis of Dennett’s view of free will as gradually evolving this article attempts to point to emergentist, interactivist and temporal metaphysical options, which have been left largely unexplored by contemporary theorists. Whereas, Dennett himself holds that “the kind of free will worth wanting” is compatible with classic determinism, I propose that his models of determinism fit poorly with (...) his evolutionary theory and naturalist commitments. In particular, his so-called “intuition pumps” seem to rely on the assumption that reality will have a compositional bottom layer where appearance and reality coincide. I argue that instead of positing this and other “unexplained explainers” we should allow for the heretical possibility that there might not be any absolute bottom, smallest substances or universal laws, but relational interactions all the way down. Through the details of Dennett’s own account of the importance of horizontal transmission in evolution and the causal efficacy of epistemically limited but complex layered “selves,” it is argued that our autonomy is linked to the ability to affect reality by controlling appearances. Many philosophers insist that the revisionary metaphysician—i.e., the metaphysician who offers a metaphysical theory which conflicts with folk intuitions—bears a special burden to explain why certain folk intuitions are mistaken. I show how evidence from cognitive science can help revisionist discharge this explanatory burden. Focusing on composition and persistence, I argue that empirical evidence indicates that the folk operate with a promiscuous teleomentalist view of composition and persistence. The folk view, I argue, deserves to be debunked. In this (...) way, I take myself to have illustrated one key role cognitive science can play in metaphysics; namely by helping the revisionary metaphysician discharge the explanatory burden of providing a plausible explanation of how the folk have gone wrong. When Adam Smith published his celebrated writings on economics and moral philosophy he famously referred to the operation of an invisible hand. Adam Smith's Political Philosophy makes visible the invisible hand by examining its significance in Smith's political philosophy and relating it to similar concepts used by other philosophers, revealing a distinctive approach to social theory that stresses the significance of the unintended consequences of human action. This book introduces greater conceptual clarity to the discussion of the invisible hand and (...) the related concept of unintended order in the work of Smith and in political theory more generally. By examining the application of spontaneous order ideas in the work of Smith, Hume, Hayek and Popper, Adam Smith's Political Philosophy traces similarities in approach and from these builds a conceptual, composite model of an invisible hand argument. While setting out a clear model of the idea of spontaneous order the book also builds the case for using the idea of spontaneous order as an explanatory social theory, with chapters on its application in the fields of science, moral philosophy, law and government. Natural language contains simple lexical items for some but not all Boolean operators. English, for example, contains conjunction and, disjunction or, negated disjunction nor, but no word to express negated conjunction *nand nor any other Boolean connective. Natural language grammar can be described by a logic that expresses what the lexicon can express by its primitives, and the rest compositionally. Such logic for propositional connectives is described here as a bilateral extension of update semantics. The basic intuition is that (...) a context can be updated by assertion or by rejection, and by one or multiple propositions at once. The brain is composed of electrically excitable neuronal networks regulated by the activity of voltage-gated ion channels. Further portraying the molecular composition of the brain, however, will not reveal anything remotely reminiscent of a feeling, a sensation or a conscious experience. In classical physics, addressing the mind–brain problem is a formidable task because no physical mechanism is able to explain how the brain generates the unobservable, inner psychological world of conscious experiences and how in turn those conscious experiences steer (...) the underlying brain processes toward desired behavior. Yet, this setback does not establish that consciousness is non-physical. Modern quantum physics affirms the interplay between two types of physical entities in Hilbert space: unobservable quantum states, which are vectors describing what exists in the physical world, and quantum observables, which are operators describing what can be observed in quantum measurements. Quantum no-go theorems further provide a framework for studying quantum brain dynamics, which has to be governed by a physically admissible Hamiltonian. Comprising consciousness of unobservable quantum information integrated in quantum brain states explains the origin of the inner privacy of conscious experiences and revisits the dynamic timescale of conscious processes to picosecond conformational transitions of neural biomolecules. The observable brain is then an objective construction created from classical bits of information, which are bound by Holevo’s theorem, and obtained through the measurement of quantum brain observables. Thus, quantum information theory clarifies the distinction between the unobservable mind and the observable brain, and supports a solid physical foundation for consciousness research. (shrink)

This article contains the results of a theoretical analysis of the phenomenon of natural language understanding (NLU), as a methodological problem. The combination of structural-ontological and informational-psychological approaches provided an opportunity to describe the subject matter field of NLU, as a composite function of the mind, which systemically combines the verbal and discursive structural layers. In particular, the idea of NLU is presented, on the one hand, as the relation between the discourse of a specific speech message and the meta-discourse (...) of a language, in turn, activated by the need-motivational factors. On the other hand, it is conceptualized as a process with a specific structure of information metabolism, the study of which implies the necessity to differentiate the affective (emotional) and need-motivational influences on the NLU, as well as to take into account their interaction. At the same time, the hypothesis about the influence of needs on NLU under the scenario similar to the pattern of Yerkes-Dodson is argued. And the theoretical conclusion that emotions fulfill the function of the operator of the structural features of the information metabolism of NLU is substantiated. Thus, depending on the modality of emotions in the process of NLU, it was proposed to distinguish two scenarios for the implementation of information metabolism - reduction and synthetic. The argument in favor of the conclusion about the productive and constitutive role of emotions in the process of NLU is also given. (shrink)

One of the insights of dynamic semantics in its various guises (Kamp 1981, Heim 1982, Groenendijk & Stokhof 1991, Kamp & Reyle 1993 among many others) is that interpretation is sensitive to left-to-right order. Is order sensitivity, particularly the default left-to-right order of evaluation, a property of particular meanings of certain lexical items (e.g., dynamically interpreted conjunction) or is it a more general feature of meaning composition? If it is a more general feature of meaning composition, is it (...) a processing ‘preference’ or should it be captured as a ‘harder’ constraint on the type of meanings and operations over meanings involved in natural language interpretation? This squib draws attention to the symmetrical A-too B-too construction (found in a variety of languages, e.g., Hungarian, Japanese, Romanian, Russian) in this context. It argues that any semantic analysis of its main ‘symmetrical-meaning’ characteristic should also allow for subtler interactions between this construction and items that are clearly sensitive to evaluation-order effects, e.g., anaphoric adjectives like next and other. We suggest that the notion of postsupposition embedded in a broader dynamic framework is better able to account for both the symmetric nature of this construction, its non-symmetric variant A-too, and its interaction with items that are evaluation-order sensitive. We briefly compare this proposal with a couple of possible alternative accounts. (shrink)

Starting from a philosophical perspective, which states that the living structures are actually a combination between matter and information, this article presents the results on an analysis of the bipolar information-matter structure of the human organism, distinguishing three fundamental circuits for its survival, which demonstrates and supports this statement, as a base for further development of the informational model of consciousness to a general informational model of the human organism. For this, it was examined the Informational System of the Human (...) Body and its components from the perspective of the physics/information/neurosciences concepts, showing specific functions of each of them, highlighting the correspondence of these centers with brain support areas and with their projections in consciousness, which are: Center of Acquisition and Storing of Information (CASI) reflected in consciousness as memory, Center of Decision and Command (CDC) (decision), Info-Emotional Center (IES) (emotions), Maintenance Informational System (MIS) (personal status), Genetic Transmission System (GTS) (associativity/genetic transmission) and Info Genetic Generator (IGG) related by the body development and inherited behaviors. The Info Connection (IC), detected in consciousness as trust and confidence can explain the Near-Death Experiences (NDEs) and associated phenomena. This connection is antientropic and informational, because from the multitude of uncertain possibilities is selected a certain one, helping/supporting the survival and life. The human body appears therefore as a bipolar structure, connected to two poles: information and matter. It is argued that the survival, which is the main objective of the organism, is complied in three main ways, by means of: (i) the reactive operation for adaptation by attitude; (ii) the info-genetic integration of information by epigenetic processes and genetic transmission of information for species survival, both circuits (i) and (ii) being associated to the information pole; (iii) maintenance of the material body (defined as informed matter) and its functions, associated to the matter pole of the organism. It results therefore that the informational system of the human body is supported by seven informational circuits formed by the neuro-connections between the specific zones of the brain corresponding to the informational subsystems, the cognitive centers, the sensors, transducers and execution (motor/mobile) elements. The fundamental informational circuits assuring the survival are the reactive circuit, expressible by attitude, the epigenetic/genetic circuit, absorbing and codifying information to be transmitted to the next generations, and the metabolic circuit, connected to matter (matter pole). The presented analysis allows to extend the informational modeling of consciousness to an Informational Model of Consciousness and Organism, fully describing the composition/functions of the organism in terms of information/matter and neurosciences concept. The aim of this paper is to present the copy principle from execution of the principle of separability for the purpose of elucidating the discussions conducted by Hume in understanding the composition of space and its implications for the sciences that operate with spatial constructions. The particular epistemic gain here is to do this within a model of empiricism. Given that there are several irregularities in the manner of analyzing a complex and extracting simple elements from it, as will (...) be demonstrated here, we seek to show that separating a complex considering its simple qualities and decomposing a complex to determine its simple quantities is completely different. Thus, we seek to show how Hume needed to recreate his own cognitive model, strongly based on noting our perceptions, to be able to use it to conceive the composition of space and the operations of geometry that must make reference to it. In “Proof-Theoretic Justification of Logic”, building on work by Dummett and Prawitz, I show how to construct use-based meaning-theories for the logical constants. The assertability-conditional meaning-theory takes the meaning of the logical constants to be given by their introduction rules; the consequence-conditional meaning-theory takes the meaning of the logical constants to be given by their elimination rules. I then consider the question: given a set of introduction rules \, what are the strongest elimination rules that are validated by an assertability (...) conditional meaning-theory based on \? I prove that the intuitionistic introduction rules are the strongest rules that are validated by the intuitionistic elimination rules. I then prove that intuitionistic logic is the strongest logic that can be given either an assertability-conditional or consequence-conditional meaning-theory. In “Grounding Grounding” I discuss the notion of grounding. My discussion revolves around the problem of iterated grounding-claims. Suppose that \ grounds \; what grounds that \ grounds that \? I argue that unless we can get a satisfactory answer to this question the notion of grounding will be useless. I discuss and reject some proposed accounts of iterated grounding claims. I then develop a new way of expressing grounding, propose an account of iterated grounding-claims and show how we can develop logics for grounding. In “Is the Vagueness Argument Valid?” I argue that the Vagueness Argument in favor of unrestricted composition isn’t valid. However, if the premisses of the argument are true and the conclusion false, mereological facts fail to supervene on non-mereological facts. I argue that this failure of supervenience is an artifact of the interplay between the necessity and determinacy operators and that it does not mean that mereological facts fail to depend on non-mereological facts. Any effort to specify identity conditions for corporations faces significant challenges. Corporations are amorphous. Nature draws no hard lines defining where they start or stop, whether in space or time. Corporations are also frustratingly dynamic. They often change the most basic aspects of their composition by exchanging parts, splitting and merging, changing ownership, and reworking fundamental internal operations. -/- Even so, we apply corporate identity conditions all the time. Both law and common intuition recognize that corporations do things—like pollute (...) environments or mislabel addictive medications—that call for judgment. Imposing judgment on corporations presupposes some implicit view of corporate identity that allows us to say, “This corporation that we now judge is the same one that misbehaved.” -/- This chapter draws on evidence from court decisions and experimental philosophy to unpack the fundamentally different visions of corporate identity implicitly encoded in law and in common intuition. The discrepancies suggest important lessons for lawmakers and corporate managers. (shrink)

I argue in this dissertation that natural properties play a central role in David Lewis' modal realism. To argue in favor of this thesis I present: a bottom-up explanation of a top-down possible world metaphysics; a new definition of natural properties and natural fusion, a new mereological operation. To achieve these aims, in the first chapter, I contextualize the discussion, in the second I resume the discussion about universals in contemporary philosophy and argue that, considering the distinct formulations of the (...) problem, class nominalism combined with modal realism might be the best solution. Furthermore, I discuss Devitt's solution in which he defends that the problem about universals is, in fact, a pseudo problem. In the third chapter, I introduce a minimal ontology of properties, regarding natural properties, I discuss the existing definitions, present a new one and discuss some theories of similarity, a notion that is in the core of the definition I propose. Besides, I present how natural properties benefit the definition of terms of nomological package, linked to its fundamentality role. I also present some applications related to the rationality role that encompass some well-known philosophical problems of the second half of 20th century. In the fourth chapter, I present some varieties of philosophical realism, I consider the theoretical advantages of taking scientific realism as background and I discuss one more utility of natural properties, the solution to the problem of eligibility of reference or, the Putnam's paradox. In the fifth chapter, I discuss how mereology is important to link several aspects of Lewis' modal realism. For such, I discuss the relation between composition as identity and ontological innocence of mereology and I present the natural fusion mereology, a new mereological operation that aims to minimize the problems of unrestricted composition. In this paper, we discuss some rather puzzling facts concerning the semantics of Warlpiri expressions of cardinality, i.e. the Warlpiri counterparts of English expressions like one,two, many, how many. The morphosyntactic evidence, discussed in section 1, suggests that the corresponding expressions in Warlpiri are nominal, just like the Warlpiri counterparts of prototypical nouns, eg. child. We also argue that Warlpiri has no articles or any other items of the syntactic category D(eterminer). In section 2, we describe three types of readings— (...) "definite", "indefinite" and "predicative"—which are generally found with Warlpiri nouns, including those which correspond to English common nouns and cardinality expressions. A partial analysis of these readings is sketched i n section 3. Since Warlpiri has no determiner system, we hypothesize that the source of (in)definiteness in this language is semantic. More specifically, we suggest that Warlpiri nominals are basically interpreted as individual terms or predicates of individuals and that their three readings arise as a consequence of the interaction of their basic meanings, which are specific to Warlpiri, with certain semantic operations, such as type shifting (Rooth and Partee 1982, Partee and Rooth 1983, Partee 1986, 1987), which universally can or must apply in the process of compositional semantic interpretation. Can sensibility, as our capacity to be sensibly presented with objects, be understood independently of the understanding, as the capacity to form judgments about those objects? It is a truism that for judgments to be empirical knowledge they must agree with what sensibility presents. Moreover, it is a familiar thought that objectivity involves absolute independence from intellectual acts. The author argues that together these thoughts motivate a common reading of Kant on which operations of sensibility are conceived as intelligible independently (...) of acts of the understanding, so that their supposed objectivity can validate judgments as empirical knowledge. He contends that there are two reasons why this epistemic compositionalism is implausible both as a reading of Kant and in itself. First, read compositionally, Kant’s Transcendental Deduction is unable to fulfill its stated aim of showing that the categories are objectively valid, that is, exemplified by the objects that sensibility presents. Second, Kant sees that sensibility by itself cannot be understood to even purport to present objects, thus undermining the very intelligibility of compositionalism. The author argues that, given these challenges, Kant’s Deduction develops an alternative account, on which operations of sensibility and acts of the understanding can be understood only together. He contends that this epistemic hylomorphism transforms the familiar thought underlying compositionalism: objectivity simultaneously involves formal agreement with intellectual acts in general and material independence from any specific such act. He thus shows how Kant reconceives our conception of objectivity by overcoming compositionalism in favor of hylomorphism. (shrink)

Sentences about logic are often used to show that certain embedding expressions, including attitude verbs, conditionals, and epistemic modals, are hyperintensional. Yet it not clear how to regiment “logic talk” in the object language so that it can be compositionally embedded under such expressions. This paper does two things. First, it argues against a standard account of logic talk, viz., the impossible worlds semantics. It is shown that this semantics does not easily extend to a language with propositional quantifiers, which (...) are necessary for regimenting some logic talk. Second, it develops an alternative framework based on logical expressivism, which explains logic talk using shifting conventions. When combined with the standard S5π+ semantics for propositional quantifiers, this framework results in a well-behaved system that does not face the problems of the impossible worlds semantics. It can also be naturally extended with hybrid operators to regiment a broader range of logic talk, e.g., claims about what laws hold according to other logics. The resulting system, called hyperlogic, is therefore a better framework for modeling logic talk than previous accounts. (shrink)

The central topic of this essay consists into establishing a relation between two dimensions of formation: the conceptual process of creating philo- sophical toys - that is of reelaborating existing philosophical concepts, mainly deriving from the thought of Gilles Deleuze and Félix Guattari, in terms of their potential as ‘operative constructs' - and their parallel redeployment towards the specific problem of analyz- ing a recent transdisciplinary artwork. By means of this strategical shift, theory looses its character of explanation and illustration. (...) Philosophy as toy becomes rather the matter of evaluating the com- plexity of a specific artistic composition in terms of its aesthetic potential. We examine the Doubly Inflected Construction of Sicilian (DIC; Cardinaletti and Giusti 2001, 2003, Cruschina 2013), in which a motion verb V1 from a restricted set is followed by an event verb V2 and both verbs are inflected for the same person and tense features. The interpretation of DIC involves a complex event which behaves as a single, integrated event by linguistic tests. Based on data drawn from different sources, we argue that DIC is an asymmetrical serial verb construction (Aikhenvald (...) 2006). We propose an analysis of DIC in which V1 and V2 enter the semantic composition as lexical verbs, with V1 contributing a motion event and projecting a theme and a goal argument which are identified, respectively, with an agent and a location argument projected by V2. A morphosyntactic mechanism of feature-spread requires that the person and tense features be realized both on V1 and on V2, while, semantically, these features are interpreted only once, in a position from which they take scope over the complex predicate resulting from the combination of V1 and V2. The semantic analysis is based on an operation of event concatenation, defined over spatio-temporally contiguous events which share specific participants, and is implemented in a neo-Davidsonian framework (Parsons 1990). The traditional soft set is a mapping from a parameter set to family of all crisp subsets of a universe. Molodtsov introduced the soft set as a generalized tool for modelling complex systems involving uncertain or not clearly defined objects. In this paper, the notion of neutrosophic soft set is reanalysed. The novel theory is a combination of neutrosophic set theory and soft set theory. The complement, “and”, “or”, intersection and union operations are defined on the neutrosophic soft sets. The (...) neutrosophic soft relations accompanied with their compositions are also defined. This thesis argues for two main points concerning the philosophy of natural language semantics. Firstly, that the objects of assertion are distinct from the entities appealed to in the compositional rules of natural language semantics. Secondly, natural languages contain context-shifting operators known as "monsters". In fact, it will be shown that these theses are simply two sides of the same coin.

This chapter will explore the dynamics of power underpinning ethical issues within smart cities via a new paradigm derived from Systems Theory. The smart city is an expression of technology as a socio-technical system. The vision of the smart city contains a deep fusion of many different technical systems into a single integrated “ambient intelligence”. ETICA Project, 2010, p. 102). Citizens of the smart city will not experience a succession of different technologies, but a single intelligent and responsive environment through (...) which they move. Analysis of such an environment requires a framework which transcends traditional ontologically-based models in order to accommodate this deep fusion. This chapter will outline a framework based on Latour’s Actor-Network Theory and Luhmann’s treatment of society as an autopoetic system. We shall use this framework to map the influence of relevant factors on ethical issues, irrespective of their composition or type. For example, under this treatment, both human praxis and technical design can be viewed as comparable tools of domination. This chapter will provide a framework for the analysis of relations between any elements of the smart city, ranging from top-level urban management processes down to individual device operations. While we will illustrate the use of this schema through examination of ethical issues arising from power dynamics within the smart city, it is intended that this example will demonstrate the wider utility of the model in general. Different anesthetics are known to modulate different types of membrane-bound receptors. Their common mechanism of action is expected to alter the mechanism for consciousness. Consciousness is hypothesized as the integral of all the units of internal sensations induced by reactivation of inter-postsynaptic membrane functional LINKs during mechanisms that lead to oscillating potentials. The thermodynamics of the spontaneous lateral curvature of lipid membranes induced by lipophilic anesthetics can lead to the formation of non-specific inter-postsynaptic membrane functional LINKs by different mechanisms. These (...) include direct membrane contact by excluding the inter-membrane hydrophilic region and readily reversible partial membrane hemifusion. The constant reorganization of the lipid membranes at the lateral edges of the postsynaptic terminals (dendritic spines) resulting from AMPA receptor-subunit vesicle exocytosis and endocytosis can favor the effect of anesthetic molecules on lipid membranes at this location. Induction of a large number of non-specific LINKs can alter the conformation of the integral of the units of internal sensations that maintain consciousness. Anesthetic requirement is reduced in the presence of dopamine that causes enlargement of dendritic spines. Externally applied pressure can transduce from the middle ear through the perilymph, cerebrospinal fluid, and the recently discovered glymphatic pathway to the extracellular matrix space, and finally to the paravenular space. The pressure gradient reduce solubility and displace anesthetic molecules from the membranes into the paravenular space, explaining the pressure reversal of anesthesia. Changes in membrane composition and the conversion of membrane hemifusion to fusion due to defects in the checkpoint mechanisms can lead to cytoplasmic content mixing between neurons and cause neurodegenerative changes. The common mechanism of anesthetics presented here can operate along with the known specific actions of different anesthetics. (shrink)

We may call this the problem of thought and being, where thought represents the subjective and being the objective component in this interactive event. In order to resolve this problem we have to look more carefully at the situation to make sure we understand what is going on more clearly. Let us take the example of "seeing" as something that may be easier to understand. Between (1) "seeing" and the (2) "thing seen" we may at first think we have two (...) independent things. I have my subjective seeing capacity and there are objects in the world which are subject to my seeing capacity. Are these two really independent? Does it make any sense to speak of "things seen" unless the "seeing" capacity is already operating on them? Can we talk of an experience in such a way that what was experienced is different from the experience of it? We mean them to be different, their difference is not being denied. But are they independent or separable from one another? Whether we consider knowing, thinking, or whatever subjective activity we may come up with, it cannot be separated from the objective element that it is operating on. This interdependence of subjective and objective elements is crucial. Basically it is a situation where we have distinct elements inseparably connected to one another. This is not an extraordinary situation. It is rather most commonplace when we think about it. The sunshine is different from the Sun. No one would argue that when the Sun is shining in your room that the Sun is in your room. Distinct they are, but it would not be possible to separate the sunshine from the Sun and still have it be what we call the Sun. The point we are making is that Reality is not simply a matter of sensuous experience. Thought or conception is intimately tied up with our perception of Reality. As Kant explained, intuitions (perceptions) without conceptions are blind (indeterminate) and conceptions without intuitions are empty. Reality is a composite unity of both. (shrink)

This paper begins the last instalment of a six-part project correlating the key aspects of Kant’s architectonic conception of philosophy with a special version of the Chinese Book of Changes that I call the “Compound Yijing”, which arranges the 64 hexagrams (gua) into both fourfold and threefold sets. I begin by briefly summarizing the foregoing articles: although Kant and the Yijing employ different types of architectonic reasoning, the two systems can both be described in terms of three “levels” of elements. (...) Starting at an unnumbered level devoid of any element (the tao or thing in itself), the system proceeds by elaborating a key fourfold distinction (or “quaternity”) on the first level, a twelvefold distinction on the second level, and twelve quaternities (grouped in four quadrants, each with a set of three quaternities) on the third level. Each set of three quaternities (i.e., each quadrant) on the third level corresponds to one of the four “faculties” of the university, as elaborated in Kant’s book, The Conflict of the Faculties. Previous papers have examined the correlations between three key quaternities that Kant defends in relation to each of three faculties (philosophy, theology, and law) and the 12 gua that correspond to that faculty in the Compound Yijing. The final step is to explore the fourth quaternity on the third level, the 12 gua corresponding to the medical faculty. The “idea of reason” in Kant’s metaphysics that guides this wing of the comparative analysis is freedom, and the ultimate purpose of this faculty of the university is to train doctors to care for people’s physical well-being, as free agents imbedded in nature. But this paper will focus only on the four gua that correspond to four basic concepts in Kant’s theory of medicine. The two quaternities in the “yin-yang” (medical) quadrant of the Compound Yijing that will be skipped here are as follows. First, Kant’s account of the idea of freedom itself, which gives rise to the area of traditional metaphysics known as rational cosmology, comes in the first Critique’s Dialectic, in the section on the Antinomy of Reason (CPR A405-567/B432- 595). There he examines four irresolvable issues: whether the world has a beginning in time; whether composite substances consist of simple parts; whether a causality of freedom operates in the natural world; and whether an absolutely necessary being exists. Later I will argue that these correspond to the quaternity consisting of gua 15, 22, 36, and 52. (shrink)

Buridan holds that the proper subject of psychology (i.e., the science undertaken in Aristotle’s De Anima) is the soul, its powers, and characteristic functions. But, on his view, the science of psychology should not be understood as including the body nor even the soul-body composite as its proper subject. Rather its subject is just “the soul in itself and its powers and functions insofar as they stand on the side of the soul". Buridan takes it as obvious that, even thus (...) narrowly construed, such a science is possible. To the extent that this science includes the human or intellective soul, however, Buridan’s claim regarding its possibility is far from obvious. After all, like most of his contemporaries, Buridan takes the human soul to be immaterial. Thus, he readily admits that “the intellect cannot be sensed” and its operations are likewise inaccessible to the senses. Yet, on Buridan's broadly empiricist theory of knowledge, all (human) knowledge, including knowledge of the intellect or intellective soul, takes its start in the senses. How, then, is a science of the human soul possible? What is the nature or source of our knowledge of the intellect? In this paper, I reconstruct Buridan's answer to these questions. -/- My discussion divides roughly into two parts. In the first, I set out the main elements of Buridan’s account of how we come to cognize the intellect, focusing on what he says about the genesis of our concept of the intellect. I then consider his account of our cognition of our own intellective states. As the discussion in part one make clear, Buridan holds that our concepts of intellect and of intellective states are both derived (inferentially) from subjective “experience” of our own states and rational activities. In part two, therefore, I try to elucidate Buridan’s notion of experience. Ultimately, I argue that it is a non-conceptual, non-discursive mode of self-awareness. I suggest, moreover, that it might best be understood in terms of our own notion of phenomenal consciousness. On the interpretation I advance, then, it turns out that, for Buridan, our concept of the intellect itself and, hence, the science of (human) psychology in general, is ultimately grounded in phenomenal experience of our own intellective states. Arthur Kaufmann is one of the most prominent figures among the contemporary philosophers of law in German speaking countries. For many years he was a director of the Institute of Philosophy of Law and Computer Sciences for Law at the University in Munich. Presently, he is a retired professor of this university. Rare in the contemporary legal thought, Arthur Kaufmann's philosophy of law is one with the highest ambitions — it aspires to pinpoint the ultimate foundations of law by explicitly (...) proposing an ontology, a general theory of knowledge and concept of a person. Kaufmann's work derives, first of all, from the thinking of Gustav Radburch, his teacher, and then from ideas of Karl Engish and Hans-Georg Gadamer. The philosophy undertakes to pursue the ultimate foundation of law, law which is understood by Kaufmann, first of all, as a "concrete judgement" that is, what is right in a concrete situation. Justice belongs to the essence of law and "unjust law" is contradictio in adiectio. Kaufmann opposes all those theories, which as the only foundation for establishing just law (Recht) adopt legal norms (Gesetz). In Kaufmann's opinion , such theories are powerless in the face of all types of distortions of law rendered by political forces. He suggests that the basic phenomenon which needs to be explained and which cannot be disregarded by a philosopher of law is so-called "legal lawlessness" ("Gestzliches Unrecht"). "Legal lawlessness" which forms a part of life experience for the people of twentieth century totalitarian states. It proved "with the accuracy of scientific experiment" that the reality of law consists of something more than bare conformity with legal norms. The existence of lex corrupta indicates that law contains something "non-dispositive" which requires acknowledgment of both law-maker and judge. Kaufmann, accepting the convergent concept of truth and cognition, assumes that "non-dispositive" content, emerging as the conformity of a number of cognitive acts of different subjects (inter-subjective communicativeness and verifiability), indicates the presence of being in this cognition. The questions "What is law?" and "What are the principles of a just solution?" lead straight to the ontology of law, to the question about the ontological foundations of law. Kaufmann discerns the ontological foundations of law in the specifically understood "nature of things" and, ultimately, in a "person". He proposes a procedural theory of justice, founded on a "person". In my work, I undertake to reconstruct the train of thought which led Kaufmann to the recognition of a "person" as the ontological foundation of law. In the first part, the conception of philosophy adopted by Kaufmann, initial characteristics of law — of reality which is the subject of analysis, as well as, the requirements for proper philosophical explanation of law posed by Kaufmann are introduced. In the second, Kaufmann's reconstruction of the process of the realisation of law is presented. Next, the conception of analogy which Kaufmann uses when explaining law is analyzed. In the fourth part, Kaufmann's conception of ontological foundations of law is discussed. A critical analysis is carried out in which I demonstrate that the theory of the ontological foundation of law proposed by Kaufmann and the concept of a person included in it do not allow a satisfac¬tory explanation of the phenomenon of "legal lawlessness" and lead to a number of difficulties in the philosophical explanation of law. Finally, the perspectives of a proper formulation of the issue of the ontological foundations of law are drafted in the context of the analyzed theory. My interest is centered on the conception of philosophy adopted by Kaufmann, according to which the existence of the reality is inferred on the basis of a certain configuration of the content of consciousness, whereas at the point of departure of philosophy of law, the data to be explained is a certain process, which is, basically, a process of cognition, while the reality appears only as a condition for the possibility of the occurrence of the process. I wish to argue that the difficulties which appear in the explanation of law are a consequence of the assumed fundamental philosophical solu¬tions, which seem to be characteristic, though usually not assumed explicitly, in philoso¬phy and theory of law dominant at present in continental Europe. Thereby, I wish to show the significance of ontological and epistemological solutions to the possibility of a proper formulation of the problems posed by philosophy and theory of law. Kaufmann proclaims himself in favour of a philosophy which poses questions about the ultimate foundations of understanding of the reality. In epistemology, he assumes that answers to the questions "What is reality like?" and ultimately "What is real?" are inferred on the basis of uniformity of a cognitive acts of different subjects. Cognition of the reality is accomplished exclusively through the content of conceptual material. The two fundamental questions posed by philosophy of law are "What is just law?" and "How is the just law enacted?" The latter is a question about the process of achieving a solution to a concrete case. Since, in Kaufmann's opinion, law does not exist apart from the process of its realisation, an answer to the question about the manner of realisation of law is of fundamental significance to answering the question: "What is law?" and to the explanation of the question about the ontological grounding of law, which is, as well, the foundation of justice. The proper solution has to take into account the moment of "non-dispositive" content of law; its positiveness understood as the reality and, at the same time, it has to point to the principles of the historical transformation of the content. Law, in the primary meaning of the word, always pertains, in Kaufmann's opinion, to a concrete case. A legal norm is solely the "possibility" of law and the entirely real law is ipsa res iusta, that which is just in a given situation. Determination of what is just takes place in a certain type of process performed by a judge (or by man confronted with a choice). Kaufmann aims to reconstruct this process. A question about the ontological foundation of law is a question about the ontological foundations of this process. In the analyzed theory it is formulated as a question about the transcendental conditions, necessary for the possibility of the occurrence of the process: how the reality should be thought to make possible the reconstructed process of the realisation of law. Kaufmann rejects the model for finding a concrete solution based on simple subsump¬tion and proposes a model in which concrete law ensues, based on inference by analogy, through the process of "bringing to conformity" that which is normative with that which is factual. Kaufmann distinguishes three levels in the process of the realisation of law. On the highest level, there are the fundamental legal principles, on the second legal norms, on the third — concrete solutions. The fundamental principles of law are general inasmuch as they cannot be "applied" directly to concrete conditions of life, however, they play an important part in establishing norms. A judge encounters a concrete situation and a system of legal norms. A life situation and norms are situated on inherently different levels of factuality and normativeness. In order to acquire a definite law both a norm (system of norms) and a life situation (Lebenssachverhalt) should undergo a kind of "treatment" which would allow a mutual conformity to be brought to them. Legal norms and definite conditions of life come together in the process of analogical inference in which the "factual state" ("Tatbestand") — which represents a norm, and in the "state of things" ("Sachverhalt") — which represents a specific situation are constructed. A "factual state" is a sense interpreted from a norm with respect to specific conditions of life. The "state of things" is a sense constructed on the basis of concrete conditions of life with respect to norms (system of norms). Legal norms and concrete conditions of life meet in one common sense established during the process of realisation of law. Mutatis mutandis the same refers to the process of composition of legal norms: as the acquisition of concrete law consists in a mutual "synchronization" of norms and concrete conditions of life, so acquisition of legal norms consists of bringing to conformity fundamental principles and possible conditions of life. According to Kaufmann, both of these processes are based on inference through analogy. As this inference is the heart of these processes it is simultaneously a foundation finding just law and justice. How does Kaufmann understand such an inference? As the basis for all justice he assumes a specifically interpreted distributive justice grounded on proportionality. Equality of relations is required between life conditions and their normative qualification. Concrete conditions of life are ascribed normative qualification not through simple application of a general norm. More likely, when we look for a solution we go from one concrete normative qualified case to another, through already known "applications" of norms to a new "application". The relation between life conditions and their normative qualifica¬tion has to be proportional to other, earlier or possible (thought of) assignments of that which is factual to that which is normative. Law as a whole does not consist of a set of norms, but only of a unity of relations. Since law is a, based on proportion, relative unity of a norm and conditions of life, in order to explain law in philosophical manner, the question about ontological base of this unity has to be asked. What is it that makes the relation between a norm and conditions of life "non-dispositive"? What is the basis for such an interpretation of a norm and case which makes it possible to bring a norm and conditions of life into mutual "conformity"? This is a question about a third thing (next to norms and conditions of life), with respect to which the relative identity between a norm and conditions of life occurs, about the intermediary between that which is normative and that which is factual and which provides for the process of establishing of norms, as well as, finding solutions. It is the "sense" in which the idea of law or legal norm and conditions of life have to be identical to be brought to mutual "conformity". In Kaufmann's opinion such a sense is nothing else but the "nature of things" which determines the normative qualification of the reality. Since establishment of this "sense" appears to be "non-dispositive" and controlled inter-subjectively (namely, other subjects will reach a similar result) so, in conformity with the convergent concept of truth, the "nature of things" must be assigned a certain ontological status. According to Kaufmann this is a real relation which occurs between being and obligation, between the conditions of life and normative quality. However, it should be underlined that from the point of view of the analyzed system the "nature of things" is a correlate of constructed sense, a result of a construction which is based on the principle of consistent understanding of senses ("non-normative" and "normative") and is not a reality which is transcendent against the arrangement of senses. In Kaufmann's theory, inference from analogy appears to be a process of reshaping the concepts (senses) governed by tendency to understand the contents appearing in relations between that which is factual and that which is normative in a consistent way. The analogical structure of language (concepts) and recognition of being as composed of an essence and existence is an indispensable requirement for the possibility of the realisation of law, based on specifically understood inference from analogy. It is necessary to assume a moment of existence without content which ensures unity of cognition. Existence emerges thus as a condition of the possibility of cognition. According to Kaufmann, the "nature of things" is the heart of inference through analogy and the basis for establishment of finding of law. Inference from the "state of things" to a norm or from a norm to the "state of things" always means inference through the "nature of things". The "nature of things" is the proper medium of objective legal sense sought in every cognition of law. In Kaufmann's view, the question whether the "nature of things" is ultima ratio of interpretation of law or is only a means of supplement gaps in law or whether it is one of the sources of law, is posed wrongly. The "nature of things" serves neither to supplement the gaps nor is it a source of law as, for example, a legal norm may be. It is a certain kind of "catalyst" necessary in every act of making law and solving a concrete case. Owing to "nature of things" it is possible to bring to a mutual conformity the idea of law and possible conditions of life or legal norms and concrete conditions of life. In Kaufmann's conception the "nature of things" is not yet the ultimate basis for understanding the "non-dispositiveness" of law. The relation between obligation and being is determined in the process of the realisation of law. Both the process itself and that which is transformed in this process are given. A question about the ontological bases of "material" contents undergoing "treatment" in the process of the realisation of law and about being which is the basis of regularity of the occurrence of the process arises. Only this will allow an explanation that the result of the process is not optional. Thus, a question about reality to which law refers and about the subject realising the law has to be formed. To this, Kaufmann gives the following answer: that which is missing is man but not "empirical man" but man as a "person". A "person" understood as a set of relations between man and other people and things. A "person" is the intermediary between those things which are different — norm and case are brought to conformity. A "person" is that which is given and permanent in the process of the realisation of law. It determines the content of law, is "subject" of law; this aspect is described by Kaufmann as the "what" of the process of realisation of law. A "person" consists of precisely just these relations which undergo "treatment" in the process. On the other hand, a "person" is "a place" in which the processes of realisation of law occur, it is the "how" of normative discourse, a "person" is that which determines the procedure of the process, being "outside" of it. This aspect of a "person" is connected with the formal moment of law. A "person" being, at the same time, the "how" and the "what" of the process of the realisation of law, is also, to put it differently, a structural unity of relation and that which constitutes this relation (unity of relatio and relata). According to this approach a "person" is neither an object nor a subject. It exists only "in between". It is not substance. Law is the relation between being and obligation. That which is obligatory is connected with that which is general. That which is general does not exist on its own, it is not completely real. Accordingly, a "person" as such is also not real. It is relational, dynamic and historical. A "person" is not a state but an event. In Kaufmann's opinion, such a concept of a "person" helps to avoid the difficulties connected with the fungibility of law in classical legal positivism. A "person" is that which is given, which is not at free disposal and secures the moment of "non-dispositiveness" of law. Kaufmann concludes: "The idea (»nature«) of law is either the idea of a personal man or is nothing". Theory points at the structure of realising law and explains the process of adoption of general legal norms for a concrete situation. The analysis has shown however, that in this theory a satisfactory answer to the question about the ultimate foundations of law is not given. It seems that in the analyzed theory the understanding of human being takes place through understanding of law. What is good for man as a "person", what is just, what a "person" deserves may be determined only against the existing system of law. A "per¬son" adopted as a basis of law is the reality postulated in the analysis of the process of the realisation of law. It is a condition of possibility of this process ( explaining, on one hand, its unity and, on the other hand, the non-dispositive moments stated in this process). A "person" in the discussed theory is entirely defined by the structure of law, it can be nothing more than that which is given in law, what law refers to, what law is about. Being, which is a "person", is constituted by relations between people and objects, the relations which are based on fundamental links between norms and conditions of life established in a process of bringing them to conformity. It has to be assumed that man as a "person" is a subject of law only as far as realising law "treats" given senses according to their current configuration. The system of law is a starting point and it describes in content what man is as a "person". Moreover, being a "person" is the condition for entering legal relations. Consistently, Kaufmann writes that "empirical man" is not the subject of law, man is not "out of nature" a "person". People become "persons" due to the fact that they acknowledge each other as "persons" — acknowledging, at the same time, law. This acknowledgement is a con¬dition of existence, of the possibility of the occurrence of process of realisation of law and of constituting legal relations which ultimately constitute a "person". Kaufmann assumes, that law tends towards a moral aim: it may and must create an external freedom, without which the internal freedom to fulfil moral obligations cannot develop. However, this postulate is not based on the necessary structure of human being. From the point of view of his system, it is nothing more than only a condition for the possibility of the occurrence of the process of the realisation of law — lack of freedom would destroy the "how" of this process. Thus, the postulate to protect the freedom of personal acts has to be interpreted, in accordance with the analyzed theory, as a postulate, the fulfilment of which aims ultimately at the accomplishment of the very same process of realisation of law itself and not the realisation of a given man. Kaufmann considers a "person" to be an element which unites the system of law as a whole. Law is a structure of relations, which are interdependent and inter-contingent. Consequently, a "person" which is to form the ontological basis of law has to be entity consisting of all relations. Being also the "how" of the process of realisation of law, if a "person" is to warrant its unity, it has to be a common source for all procedures. Hence, a single "person" would constitute a subject of law. Man appears to be only a moment of a certain entirety, realisation of which should be an aim of his actions. Law, creating a "person" as an object and subject of law becomes a primary entity. In the analyzed theory, the basis for determination of aims which law sets to man is not the allocation of man-subject to something which improves him but rather, such relation is only just constituted by law. A question appears, why should aims set in law also be the aims of "empirical man"? Why is this "empirical man" to be punished in the name of a "person" understood in such a way? If, however, it is assumed that what is man is determined by a system which is superior to him, then man has to be understood only as a part of a whole and there are no grounds to prohibit istrumental treatment of man and so the road to all aspects of totalitarianism might be opened. A problem of the application of created theory to the reality arises, the reality which the theory pretends to explain. Ultimately in his theory Kaufmann does not give any systemic grounds for a radical questioning of the validity of any legal norms. Every new norm becomes an equal part of system of norms. It is only its interpretation and application to given conditions of life that may be disputable, however, this refers to all norms without exception. Cohesive inter-pretation of norms and applications is necessary and sufficient for the acquisition of just law. New norms have to be interpreted in the light of others, correspondingly, the other norms require reinterpretation in the light of the new ones. Contradiction in interpretation of a norm does not form a basis for questioning norms but may serve only to question the manner of their interpretation (understanding). Therefore, no grounds exist to assume any legal norm as criminal or unjust, and in consequence, to question any consistently realised system based on formally, properly established norms, as "legal lawlessness". As law and a "person" do not exist without the process of realisation of law, the role of legal safety becomes crucial as the condition for the possibility of the occurrence of the process of realisation of law. Denying legal safety would be tantamount to negation of law in general (also of moral law) as negation of safety takes away, at the same time, the basis for occurrence of the process of realisation of law. Moreover, any lack of legal safety would also mean lack of a basis for the existence of man as a "person". Kaufmann's thesis, that civil disobedience is legalized only when it has a chance to lead to success, consistent with his concept of the foundations of law, seems to point directly to conclusions which deny the facts taken under consideration and doubtlessly Kaufmann's own intentions, since it would have to be assumed that accordingly there are no grounds to question a legal system in force based on violence which secures its operation. Force finally seems to determine which one of the mutually irreconcilable normative systems constitute law and which does not. A legitimate position is one which leads to success, it is the weaker system which is negated. If so, then basically violent imposition of law is not an act directed against the law in force but, to the contrary, realisation of law. In the context of the new system the former system of law may be talked about as unjust solely in the sense of being incapable of being consistently united with the new. However, at the base, ultimately, lies force which reaffirms differences and excludes from the process of realisation of law certain norms and their interpretations. Kaufmann was aiming at grounding of that which is "non-dispositive" in a certain given framework of interpretation. Nevertheless, he does not provide foundations for the understanding of phenomena, which he undertakes to explain at a point of departure. Instead of explaining them the theory negates the possibility of their existence. The reality postulated in regard to "non-dispositive" moments of the reconstructed process of acquiring law consist of a specifically understood "person", which appears in Kaufmann's conceptions as a condition of the possibility of the realisation of law. According to this approach understanding of a "person" may be only a function of law. To understand "legal lawlessness" and foundations of justice it is necessary to look for such theory of law in which understanding of man as a "person" and being is not a function of understanding of law (in which a "person" is not only a condition for possibility of reconstructed process of realisation of law; for possibility of cognition processes). It seems necessary to start from theory of being and a "person" based on broader experience than the one assumed by Kaufmann and reconstruct the ontological foundations of the process of realisation of law only in such perspective. Kaufmann points out that that to which law refers is ipsa res iusta a concrete relation of man to other people and things. This relation, in his theory, appears to be basically only just constituted by law (normative senses "applied" to conditions of life). Therefore, understanding the relation between a given man and other people and things which constitute the aim of his actions, that is understanding of good, is enacted against the background of constitution of senses; constitution which is a result of a process aiming towards consistent understanding of particular contents (of nor¬mative and non-normative senses). "Being" is secondary towards constructed senses it is only their correlate. The primary relation consists of relation of a man to law (system of norms), while the secondary relation is one of man to something which is the aim of his action (relation between man and good). Considering such approach it is difficult to envision a satisfying answer to the fundamental question: why does law put concrete man under any obligation to obey it? The source of this problem can be seen in reduction of the base for understanding good to content of obligation formulated in auto-reflection. Such reduction seems to be a consequence of Kaufmann's adoption of "convergent concept of truth" and in con¬sequence his recognition of indirect, essentialistic grasp of reality formulated in concepts as the basic and only foundation of theory of being and of law. In view of such an approach, analogy of law, concepts and being is the condition for the possibility of the process of transformation of senses which aims at consistent interpretation of all law. Existence is postulated with respect to the possibility of unity of experience and cognition. However, also a different approach to understanding of the problem of being and good is possible. In spontaneous cognition being is affirmed, first of all, not as a certain, non-contradictory, determined content, but as something existing. Together with a cer¬tain content (passed indirectly through notions) existence of being is co-given. The basis for unity of being is not formed by the consistence of content, as it is in the case of the theories departing from the analysis of cognition processes, but by an act of existence realising content (essence). Such an approach makes it also possible to go beyond the convergent concept of truth. It is worth mentioning that allocation of an agent to good is realised not only by the content of duty. A statement that something is good is primary with respect to determination of this good in content. The recognised good always bears some content, however, there are no reasons to base the concept of good exclusively on indirect, formulated in concepts cognition. As primary, can be adopted the relation of man to good and not of man to law. Determination in content appears to be only an articulation of aspectual cognition of being, as an object of action. In such a case the basis for relative unity of norm and conditions of life is not the "nature of things" understood as correlate of sense but it is relation to good based on internal constitution of man as potential, not self-sufficient being. It does not mean, that the moments of the process of realisation of law singled out by Kaufmann are not important to determination of what is just. He, quite rightly, points to significant role played by norms in the evaluation of concrete situations, in man's search for closer specification in content of good innate to him. The structure of process of determining law for a concrete situation, to a great degree corresponds to the processes of determining law which take place not only in the legal sciences. Kaufmann's analyses of the process of realisation of law show the complexity of the structure of these processes and point towards important moments allowing a better understanding of law and man. Nevertheless, these analyses cannot be a basis for construction of philosophical theory of law, theory which hopes to point out the ultimate, ontological foundations for understanding law. Kaufmann's results may become fully valid only in a more general perspective including broader experience at the point of departure. (shrink)

This dissertation articulates our human capacity to judge as a capacity for knowledge, specifically for empirical knowledge, and for knowledge of itself as such. I interpret and draw on the account of such knowledge presented by Kant’s Critique of Pure Reason, situate this account historically, and relate it to relevant contemporary debates. The first chapter motivates my project by assessing the insights and shortcomings of Cartesian epistemology. I argue that while Descartes draws on the essential self-consciousness of judgement to show (...) that the cogito is knowledge, he fails, by his own standards, to secure this status for any judgement beyond the cogito. I conclude that self-consciousness alone is empty, but that, since we can judge beyond the cogito, judgement can be given content from elsewhere. The next chapter evaluates the empiricist doctrine that operations of the senses by themselves give content to judgement and can vindicate it as empirical knowledge. I contend that Kant deepens Hume’s finding, that empiricism fails to enable us to explain empirical knowledge, into the more radical insight that empiricism fails to enable us to understand the senses as providing any content. I conclude that the senses alone are blind and that our account of empirical knowledge must privilege neither sensory givenness nor intellectual self-consciousness. The third chapter contrasts two readings of Kant on the cooperation between sensibility and understanding in empirical knowledge. I argue, against many Kantians, that the Transcendental Deduction shows that instead of understanding this cooperation compositionally – so that operations of sensibility are intelligible independently of acts of the understanding – we must conceive of it hylomorphically – so that the operations of sensibility and understanding constitute the mutually dependent matter and form of empirical knowing respectively. The final chapter substantiates this hylomorphism by explicating the form of knowledge as synthesis. Following Kant, I argue that inference is a species of synthesis and provide a synthetic explanation of inference. The resulting account simultaneously illustrates synthesis, addresses a prominent contemporary problem regarding the nature of inference, and explains how our capacity to know provides not just isolated glimpses of empirical reality, but a unified conception of it.
