The foundation of Economic failures to solve the economic problems is in the epistemological contradiction and failures of Economic Theories. This paper shows the most important contradictions in the Big Paradigms of the las centuries (Marx, Walras, Keynes).

Background: Transgender health care is a subject of much debate among clinicians, political commentators, and policy-makers. While the World Professional Association of Transgender Health (WPATH) Standards of Care (SOC) establish clinical standards, these standards contain implied ethics but lack explicit focused discussion of ethical considerations in providing care. An ethics chapter in the SOC would enhance clinical guidelines. Aims: We aim to provide a valuable guide for healthcare professionals, and anyone interested in the ethical aspects of clinical support for gender (...) diverse and transgender people of all ages. Recognizing that the WPATH is a global association, we address broad challenges. We offer a reflection on general ethical principles, providing conceptual tools for healthcare providers, patients, and families to navigate the specific challenges they might encounter in transgender health care, in line with WPATH’s worldwide mission and scope. Method: This article employs a descriptive analysis, and our framework of reference is the four principles of biomedical ethics: respect for autonomy, beneficence, nonmaleficence, and justice. Results: The article presents a discussion on the four ethical principles as applied to transgender health care. We address issues such as respect for patient autonomy in decision-making, the role of beneficence and nonmaleficence in clinical interventions, and the importance of justice in equitable treatment and access to care. Some of the ethical concerns we address in this article pertain to the current sociopolitical climate, where there has been increasing legal interference, internationally, for transgender and nonbinary people, particularly youth, seeking medical care. Discussion: We highlight the interplay between ethical principles and clinical practice, underscoring the need for ethical guidance in addressing the diverse challenges faced by healthcare providers and patients in transgender health care. We advocate for continuous refinement of ethical thinking to ensure that transgender health care is not only medically effective but also ethically sound. (shrink)

The logic of soku-hi is presented as an articulation of a post-Kantian view of reality that embraces the truths of science with the assumption of the transcendental subject. As such, soku-hi represents the philosophical posture of both the secular Zen of the Kyoto School and the new materialists of contemporary continental philosophy. It describes how material reality is not all even though there is nothing else.

In this paper, I show where Adolf Reinach comes down on the question of conflicts of obligation. The aim is to look at whether Reinach’s phenomenological realism of obligation holds its own against positions developed by Bernard Williams concerning the nature and import of obligations, and their capacity or incapacity to impinge upon each other and other moral and non-moral concerns. It is shown that even if Reinach turns out to succumb to pitfalls Williams identifies, he nonetheless verges upon agreement (...) with Williams in more ways than one might expect. This result is significant because it shows that Reinach’s phenomenological realism, in contrast to certain forms of moral realism, lays the foundations for what can be considered a heterontology of obligation and ethical concerns, which is presupposed by the experience of (moral) conflict in the first place. This paper concerns two topics which, I hope to show, are vitally connected. One is the distinctive importance of appellate adjudication in the legal system of United States. The other is the workings of entangled concepts in the law. That appellate adjudication is important in some sense may seem obvious to everybody (to a few it will seem obvious that appellate adjudication is unimportant). My point will be that via appellate adjudication courts engineer entangled legal concepts, and it is this (...) aspect of appellate adjudication that is both crucial and unique to it, at least in the U.S. legal system. Entangled concepts intertwine description and evaluation; entangled legal concepts facilitate and constrain legal reasoning and legal judgments, in ways that distinguish legal adjudication from pure politics or the implementation of public policy. In the paper itself, I demonstrate more fully what it is for a legal concept to be an entangled one and how entanglement supplies guidance in adjudication. I also broach how entanglement in legal concepts and engineered entanglement have significance for legal pedagogy; appellate adjudication; the respective roles of the judiciary, the legislature, and administrative agencies; the erosion of the distinction between so-called public law and so-called private law; and our understanding of the fact/value distinction. -/- Understanding more specifically the nature of the entanglement at work in appellate adjudication requires much closer scrutiny of appellate opinions than we usually give. I examine carefully the background to MacPherson v. Buick and Justice Benjamin Cardozo’s particular re-engineering of ‘negligence’ and ‘duty,’ entangled concepts belonging to the same legal taxonomy. Via this scrutiny, I demonstrate the flaws in the engineering of some concepts in the buildup to MacPherson, and how these flaws led to those concepts’ collapse and ultimately to Cardozo’s re-engineering of ‘negligence’ and ‘duty.’ I also explain why careful understanding of the engineering of entangled legal concepts can make us appreciate that even the most successful of such concepts have within in them the grounds for their own obsolescence. -/- To show that conceptual engineering of entangled concepts occurs outside the context of state common law, I also examine how the U.S. Supreme Court has engineered ‘commerce’, itself an entangled concept. The recent decision regarding the individual mandate in the Affordable Care Act makes this example particularly timely. This secondary example also clarifies the nature of entanglement and engineering it. -/- This article concerns appellate adjudication in any area of law. I maintain that whether we are dealing with private law or public law, common law or statutory law or Constitutional law, the defining feature of appellate adjudication is its continuous engineering and reengineering of entangled legal concepts. The merger of fact and value in these concepts explains both the fertility of appellate adjudication and the constraints judges work with when they work with legal concepts that entangle fact and value. Cet ouvrage, bien qu’il témoigne d’une attention scolaire, ne veut pas être un commentaire destiné aux seuls spécialistes, mais constitue l’effort, à partir d’une certaine autonomie philosophique, de présenter la pensée heideggérienne à ceux qu’elle devrait intéresser, de l’arracher aux préjugés dans lesquels elle est souvent emprisonnée et d’en défendre le meilleur. Comment penser la possibilité pour une conscience de faire le mal, de commettre une faute qu’elle sait répréhensible ? Reconnaissant à la fois la longue tradition qui avant lui s’est intéressée à ce problème éternel pour la philosophie et la théologie, Ricœur ressent le besoin de revenir sur cette question en même temps qu’il juge nécessaire de donner à sa démarche phénoménologique un tournant herméneutique. Afin de comprendre ce choix, nous proposons ici une synthèse critique de La symbolique du Mal, (...) second tome du cycle de la Philosophie de la volonté de Ricœur ; y seront exposées les principales composantes de sa démarche ainsi que les grands moments de ses conclusions. Nous espérons par notre travail montrer pourquoi le problème du mal, plus particulièrement l’expérience de la faute, empêche de penser une subjectivité pleine, maîtrisée et transparente à elle-même. Pour cette raison, l’herméneutique semble s’imposer comme démarche pour appréhender le sujet brisé par la faute, et pour comprendre la juste valeur des symboles par lesquels cette expérience a été exprimée. With the establishment of the World Trade Organization in 1995, the dispute settlement mechanism for international trade was greatly prepared unlike the old GATT system. It has a very different pattern from that of original GATT system. In our case, international trade is a matter of the future of nations, and in reality of the intense world economic competition, this system change may well be of concern to our government or legal experts. In this context, this paper examines the nature (...) and problems of the WTO appeal system under the premise of the rule of law, judicial prowess, and the role of a judge. The WTO dispute settlement mechanism is based on the domestic judicial system or other international judicial systems. In contrast to this, the comparative history is only short indeed, but according to the accumulation of future precedents, it is highly possible to provide a model for the achievement of the rule of law ideals in the international community. However, due to the inherent limitations of international agreement system, the reality of appellate body is not easy. In terms of the international trade and rule of law, the role of appellate body and judges is very broad. However, in this paper, we first look at the significance and nature of the launch of WTO and furthermore; 1) the rule of law and judicial system, 2) several issues related to the nature of WTO dispute settlement mechanism, 3) the importance of judge-made law and the scope and limitations of appellate jurisdiction, 4) issues of reference materials submitted by procedures outside the process, 5) the relationship between the appellate body and political authorities. Over the review, the penetrating thoughts will be focused on judicial activism. Those points of consideration will be discussed through the approach and method on the comparative legal studies and several significant WTO precedents. (shrink)

The Reception of the Union Synods from Lyon (1274) and Ferrara-Florence (1438-1439) in Mount Athos. This historical article explores two important events from the life of the Orthodox and Catholic Churches. After a brief introduction into the topic, I will give a clear map of what meant the Synod of Lyon from a historical and theological perspective and the consequences in Mount Athos of this union. In the second part, I will present, in a critical way, the palamite movement (...) in connection with the Synod from Ferrara and Florence and also the reaction of the monks of Mount Athos. Florence Ashley has argued that requiring patients with gender dysphoria to undergo an assessment and referral from a mental health professional before undergoing hormone replacement therapy is unethical and may represent an unconscious hostility towards transgender people. We respond, first, by showing that Ashley has conflated the self-reporting of symptoms with self-diagnosis, and that this is not consistent with the standard model of informed consent to medical treatment. Second, we note that the model of informed consent involved in cosmetic (...) surgery resembles the model Ashley defends, and that psychological assessment and referral is recognised as an important aspect of such a model. Third, we suggest that the increased prevalence of psychiatric morbidity in the transgender population arguably supports the requirement of assessment and referral from a mental health professional prior to undergoing HRT. Florence Ashley has responded to our response to ‘Gatekeeping hormone replacement therapy for transgender patients is dehumanising.’ Ashley criticises some of our objections to their view that patients seeking hormone replacement therapy (HRT) for gender dysphoria should not have to undergo a prior psychological assessment. Here we clarify our objections, most importantly that concerning the parity between cosmetic surgery and the sort of intervention Ashley has in mind. Firstly, we show Ashley’s criticism of our comparison is insubstantial. We then (...) examine their comments regarding the analogy between abortion and HRT, and the language of informed consent. We also scrutinize the data upon which Ashley relies to defend the claim that informed consent without assessment always yields positive outcomes, finding this conclusion to be overstated. Finally, even if Ashley’s arguments were vindicated, the claim that the gatekeeping of HRT is motivated by hostility towards transgender people remains unsupported. (shrink)

I argue against Appel's recent proposal – in this JOURNAL – that there is a fundamental human right to sexual pleasure, and that therefore the sexual pleasure of severely disabled people should be publicly funded – by thereby partially legalizing prostitution. I propose an alternative that does not need to pose a new positive human right; does not need public funding; does not need the legalization of prostitution; and that would offer a better experience to the severely disabled: charitable (...) non-profit organizations whose members would voluntarily and freely provide sexual pleasure to the severely disabled. In this paper, I develop a quasi-transcendental argument to justify Kant’s infamous claim “man is evil by nature.” The cornerstone of my reconstruction lies in drawing a systematic distinction between the seemingly identical concepts of “evil disposition” (böseGesinnung) and “propensity to evil” (Hang zumBösen). The former, I argue, Kant reserves to describe the fundamental moral outlook of a single individual; the latter, the moral orientation of the whole species. Moreover, the appellative “evil” ranges over two different types of moral failure: (...) while an “evil disposition” is a failure to realize the good (i.e., to adopt the motive of duty as limiting condition for all one’s desires), an “evil propensity” is a failure to realize the highest good (i.e., to engage in the collective project of transforming the legal order into an ethical community). This correlation between units of moral analysis and types of obligation suggests a way to offer a deduction of the universal propensity on behalf of Kant. It consists in tracing the source of radical evil to the same subjective necessity that gives rise to the doctrine of the highest good. For, at the basis of Kant’s two doctrines lies the same natural dialectic between happiness and morality. While the highest good brings about the critically acceptable resolution of this dialectic, the propensity to evil perpetuates and aggravates it. Instead of connecting happiness and morality in an objective relation, the human will subordinatesmorality to the pursuit of happiness according to the subjective order of association. If this reading is correct, it would explain why prior attempts at a transcendental deduction have failed: interpreters have looked for the key to the deduction in the body of Kant’s text, where it is not to be found, for it is tucked, instead, in the Preface to the first edition. Contrary to popular opinion, non-natural realism can explain both why normative properties supervene on descriptive properties, and why this pattern is analytic. The explanation proceeds by positing a subtle polysemy in normative predicates like “good”. Such predicates express slightly different senses when they are applied to particulars (like Florence Nightingale) and to kinds (like altruism). The former sense, “goodPAR”, can be defined in terms of the latter, “goodKIN”, as follows: x is goodPAR iff there is a kind K such (...) that x is a token of K, and K is goodKIN. Now if x and y are descriptively exactly similar, then they are tokens of exactly the same kinds, so x is a token of a goodKIN kind if and only if y is. Therefore, by the definition, x is goodPAR if and only if y is. Supervenience just falls out of the definition of “goodPAR”. (shrink)

Partout des appels formels invoquant la démocratie sont lancés : la démocratie comme première condition requise pour une gouvernance politique respectueuse des intérêts des citoyens et des équilibres de l’environnement. En même temps, une multitude d’indices convergents configurent une gestion de la res publica par une caste oligarchique politico-économique dont la propension à gérer les ressources environnementales se caractérise par l’absence de prise en compte du bien commun sur la base d’intérêts particuliers sans tenir compte des équilibres biosphériques (Bergandi, 2014 (...) : 63-81). Quel est le rôle des sciences et des scientifiques dans un tel contexte? Ou plus précisément, quel est le rôle des sciences et des scientifiques dans des questions à l’interface entre science et société, générant des controverses socio-scientifiques? Jusqu’à quel point les sciences peuvent-elles encore effectivement incarner l’idéal de la neutralité axiologique, durablement implanté par le positivisme à partir du XIXe siècle à la fois dans l’éthique scientifique et dans l’inconscient des scientifiques, telle une constante, apparemment inéliminable, de la science? Est-il possible de trouver un juste équilibre (épistémique et éthique) entre objectivité scientifique d’un côté, engagement moral et politique de l’autre? L’idée de « sciences impliquées » est-elle une forme de pensée oxymorique cachant un non-sens épistémologique? Ou bien, exprime-t-elle un besoin, une nécessité à la fois épistémique, éthique et politique qui nous permettrait de mieux cerner les innombrables et complexes enchevêtrements entre les sciences contemporaines et la société?[. Some responses to analogies between abortion and infanticide appeal to Judith Jarvis Thomson's argument for the permissibility of abortion. I argue that these responses fail because a parallel argument can be constructed for the permissibility of infanticide. However, an argument on the grounds of a right to choose to become a parent can maintain that abortion is permissible but infanticide is not by recognizing the normative significance and nature of parenthood. -/- Certaines réponses aux analogies entre l'avortement et l'infanticide font (...) appel à l'argument de Judith Jarvis Thomson en faveur de la licéité morale de l'avortement pour désamorcer ces analogies. Je soutiens que ces réponses échouent parce qu'un argument parallèle peut être construit en faveur de la licéité de l'infanticide. Cependant, un argument reposant sur le droit de choisir de devenir parent permet de soutenir que l'avortement est autorisé mais que l'infanticide ne l'est pas en reconnaissant le sens et la nature normatifs de la parentalité. Qu’est-ce qui justifie des normes comme « Tu ne tueras point » ou «Nul ne peut être soumis à la torture »? -/- C’est autour de cette question fondamentale que se sont constituées les trois grandes théories morales : l’éthique des vertus (inspirée d’Aristote), l’éthique des devoirs (mise en forme par Kant) et l’éthique des conséquences (matrice de l’utilitarisme). Qu’est-ce qui distingue ces trois approches ? Y a-t-il des raisons décisives d’en préférer une ? -/- Dans ce livre, Ruwen Ogien (...) et Christine Tappolet montrent que, pour trancher ce débat, il faut clarifier les deux concepts-clés de l’éthique et analyser leurs relations : les normes (qui posent des obligations, des interdictions, des permissions) et les valeurs (qui disent ce qui est bien ou désirable). -/- Ils proposent une hypothèse simple, mais iconoclaste : si pour justifier les normes, il faut nécessairement faire appel à des valeurs, c’est que, contre Kant et Aristote, il faut être conséquentialiste. The philosopher and historian of Italian philosophy, Eugenio Garin, and Jacob Leib Teicher, the Polish Jewish student of Arabic and Jewish philosophy, met as students at the University of Florence, Italy, in the 1920s. They developed a life-long friendship based on their shared scholarly interests, and Garin credited Teicher with introducing him to medieval Arabic and Jewish philosophy. Teicher was forced to leave Florence as a result of the Italian racial legislation in 1938, settling in the UK where (...) from 1946 he taught post-biblical Hebrew at the University of Cambridge. A selection of the correspondence between the two friends and also Garin’s wife, Maria, is presented here focusing particularly on the decade covering Teicher’s arrival as a refugee scholar in the UK. La théorie démocratique contemporaine entretient une relation ambivalente avec les élections. Alors que les points de vue agrégatifs et minimalistes les considèrent comme une institution centrale de la démocratie représentative , les conceptions plus riches de la démocratie n’ont pas nécessairement de penchant pour elles. Les théories délibératives ont tendance à négliger les élections pour se concentrer sur la délibération publique, c’est-à-dire sur le processus continu de formation de l’opinion et d’échange de raisons qui se produit entre les élections . (...) Les théories participatives ont également tendance à les écarter en faveur d’une vision moins agonistique et plus coopérative de l’action politique . Par conséquent, peu d’attention normative a été accordée dans la littérature récente à ce moment très distinctif de la vie démocratique, à quelques notables exceptions près . Une conséquence naturelle est que la plupart des théoriciens font appel à des expériences délibératives telles que les jurys de citoyens et les mini-publics comme réponse efficace aux préoccupations démocratiques actuelles . Le tirage au sort peut ainsi être présenté comme une alternative préférable à l’élection, car il garantit une représentation descriptive, évite la capture de l’État par des élites puissantes et promet des résultats substantiellement meilleurs. Alors que de nombreux théoriciens s’intéressent aux moyens de compléter les institutions électorales par des organes délibératifs non électoraux , certains chercheurs se débarrasseraient volontiers des élections . Le moment est-il venu de les abandonner ? Cet article se concentre sur une affirmation spécifique que beaucoup de partisans du tirage au sort ont avancée, à savoir que celui-ci serait plus égalitaire que les élections, et vise à la rejeter. D’autres chercheurs ont déjà critiqué le tirage au sort pour diverses raisons. Landa et Pevnick , ainsi qu’Umbers objectent qu’il ne permet pas d’obtenir les améliorations instrumentales du gouvernement promises par ses promoteurs ; Ceva et Ottonelli , ainsi que Lafont nient que les critiques lotocratiques des élections reflètent une compréhension adéquate de l’autorité démocratique en tant que forme d’autonomie collective ; et Umbers soutient également que la lotocratie est en contradiction avec les principes de justice distributive et d’égalité sociale . En complément à ces critiques récentes, nous soutenons que la vision de l’égalité politique qui sous-tend le tirage au sort est problématique et peu convaincante. (shrink)

Around the middle of XVI th century, in the Florence of Grand Duke Cosimo I de’ Medici, Bernardo Segni (Firenze, 1504–1558) translated and commented some Aristotelian works in the Florentine vernacular. His works represents a very important innovation in the panorama of Italian Aristotelianism, because they are the product of circles outside the university world and are the first attempt to translate in Italian the works of the great Greek philosopher. The seventeenth century was an important period in the conceptual development of the notion of the infinite. In 1643, Evangelista Torricelli (1608-1647)—Galileo’s successor in the chair of mathematics in Florence—communicated his proof of a solid of infinite length but finite volume. Many of the leading metaphysicians of the time, notably Spinoza and Leibniz, came out in defense of actual infinity, rejecting the Aristotelian ban on it, which had been almost universally accepted for two millennia. Though it would be another (...) two centuries before the notion of the actually infinite was rehabilitated in mathematics by Dedekind and Cantor (Cauchy and Weierstrass still considered it mere paradox), their impenitent advocacy of the concept had significant reverberations in both philosophy and mathematics. In this essay, I will attempt to clarify one thread in the development of the notion of the infinite. In the first part, I study Spinoza’s discussion and endorsement, in the Letter on the Infinite (Ep. 12), of Hasdai Crescas’ (c. 1340-1410/11) crucial amendment to a traditional proof of the existence of God (“the cosmological proof” ), in which he insightfully points out that the proof does not require the Aristotelian ban on actual infinity. In the second and last part, I examine the claim, advanced by Crescas and Spinoza, that God has infinitely many attributes, and explore the reasoning that motivated both philosophers to make such a claim. Similarities between Spinoza and Crescas, which suggest the latter’s influence on the former, can be discerned in several other important issues, such as necessitarianism, the view that we are compelled to assert or reject a belief by its representational content, the enigmatic notion of amor Dei intellectualis, and the view of punishment as a natural consequent of sin. ABSTRACT: In his A Conceptual Investigation of Justice, Kyle Johannsen suggests a theory of disability that holds that to have a disability just is to be worse off, sometimes referred to as the ‘medical’ or ‘individual’ model of disability. I argue that Johannsen’s understanding of disability might force some of his key claims into an uncomfortable position. In particular, for his theory to avoid the thrust of Elizabeth Anderson’s criticisms of luck egalitarianism, the assumption of the medical model of disability (...) must be dropped, but this comes at the cost of his criticism of John Rawls’ difference principle. -/- RÉSUMÉ : Dans son livre, A Conceptual Investigation of Justice, Kyle Johannsen semble invoquer une théorie du handicap selon laquelle le fait d’avoir un handicap, c’est être pire qu’une autre personne, un modèle parfois appelé le modèle de handicap «médical» ou «individuel». Je soutiens que la compréhension de Johannsen en matière d’invalidité peut mettre sa theorie dans une position difficile. En particulier, pour que sa théorie évite les critiques d’Elizabeth Anderson sur l’égalitarisme de la chance, l’hypothèse du modèle médical du handicap doit être abandonnée. In response to three papers about sex and disability published in this journal, I offer a critique of existing arguments and a suggestion about how the debate should be reframed going forward. Jacob M. Appel argues that disabled individuals have a right to sex and should receive a special exemption to the general prohibition of prostitution. Ezio Di Nucci and Frej Klem Thomsen separately argue contra Appel that an appeal to sex rights cannot justify such an exemption. I (...) argue that Appel’s argument fails, but not for the reasons Di Nucci and Thomsen propose, as they have missed the most pressing objection to Appel’s argument: Appel falsely presumes that we never have good reasons to restrict someone’s sexual liberty rights. More importantly, there is a major flaw in the way that all three authors frame their positive accounts. They focus on disability as a proxy for sexual exclusion, when these categories should be pulled apart: some are sexually excluded who are not disabled, while some who are disabled are not sexually excluded. I conclude that it would be less socially harmful and more productive to focus directly on sexual exclusion per se rather than on disability as a proxy for sexual exclusion. (shrink)

The Four-Colour Theorem (4CT) proof, presented to the mathematical community in a pair of papers by Appel and Haken in the late 1970's, provoked a series of philosophical debates. Many conceptual points of these disputes still require some elucidation. After a brief presentation of the main ideas of Appel and Haken’s procedure for the proof and a reconstruction of Thomas Tymoczko’s argument for the novelty of 4CT’s proof, we shall formulate some questions regarding the connections between the points (...) raised by Tymoczko and some Wittgensteinian topics in the philosophy of mathematics such as the importance of the surveyability as a criterion for distinguishing mathematical proofs from empirical experiments. Our aim is to show that the “characteristic Wittgensteinian invention” (Mühlhölzer 2006) – the strong distinction between proofs and experiments – can shed some light in the conceptual confusions surrounding the Four-Colour Theorem. Qu’est-ce que l’indignation ? Cette émotion est souvent conçue comme une émotion morale qu’une tierce-partie éprouve vis-à-vis des injustices qu’un agent inflige à un patient. L’indignation aurait ainsi trait aux injustices et serait éprouvée par des individus qui n’en seraient eux-mêmes pas victimes. Cette émotion motiverait la tierce-partie indignée à tenter de réguler l’injustice en l’annulant et en punissant son auteur. Cet article entreprend de montrer que cette conception de l’indignation n’est que partielle. En effet, l’indignation ne porte pas que (...) sur les injustices, mais plus généralement sur les torts injustifiés. Ce faisant, l’indignation peut être une émotion morale, mais aussi une émotion conventionnelle ou esthétique. De plus, elle peut être éprouvée par les individus victime des torts : elle n’est pas uniquement éprouvée par des tierces-parties. De la sorte, les individus indignés qui subissent les torts peuvent eux-mêmes chercher à les annuler et à punir leurs auteurs. Puisqu’elle peut être éprouvée tant par des spectateurs que par les personnes qui subissent les torts et qu’elle incline ceux qui l’éprouvent à faire appel à d’autres personnes pour réguler ces torts, l’indignation vécue individuellement est partageable : elle peut devenir une émotion collective jouant un rôle fondamental dans la régulation sociale en contribuant au renforcement de normes sociales existantes ou à l’émergence de nouvelles normes sociales associées aux idées du juste prévalant dans la société considérée. The attitudes P. F. Strawson dubs reactive are felt toward another (or oneself). They are thus at least in part affective reactions to what Strawson describes as qualities of will that people manifest toward others and themselves. The reactive attitudes are also interpersonal, relating persons to persons. But how do they relate persons? On the deontic, imperative view, they relate persons in second-personal authority and accountability relations. After addressing how best to understand the reactive attitudes as sentiments, I evaluate the (...) deontic imperative view. I argue that the modality of reactive attitudes is not invariably deontic nor is their mood invariably imperative. Certain reactive attitudes are aretaic, appellative sentiments that prescribe non-jural ideals of conduct or character. Although expansive, my resulting conception of the reactive attitudes escapes the charge of failing to distinguish reactive sentiments from “disengaged aesthetic reactions” to the beautiful and ugly in human action and character. In the post-World War II world, when the democratic system of governance spread as a universally accepted system of governance, the question of demand for political rights of multiculturalist groups and adjustment with the existing system arose. There was a massive increase in migration for various reasons, which also gave rise to many other political problems. Multiculturalism and migration got adequate space in Modood's political literature. He presented its socio-political analysis. In discussing the interrelationships between Multiculturalism and liberalism, the question of adjustment of many cultures in relatively less liberal systems provides an alternative perspective to understanding Multiculturalism through migration. -/- . Moral subjectivism is commonly associated with out-of-favour theories like, e.g., Alfred Ayer’s emotivism or John Mackie’s error theory. This paper approaches the field against the background of the attitudinal character of morality and religion. The possibility of a brand of moral subjectivism is established which is common to Ayer’s and Mackie’s theories in name only yet still has significant merits. The perspective from action theory and the philosophy of mind suggests that the problem of moral obligation, central to moral philosophy, (...) is more convincingly dealt with by subjectivism than by its rivals: In contrast to realism or even relativism (with which subjectivism is often confused), subjectivism can help to explain the peculiarities of obligation without forcing us to disregard the parallel problem in the field of religion. This finding calls into question the rationale for, as well as the success of, central assumptions in ontology and semantics which the realist so freely hands out in order to make his point: If religious facts and the truth-aptness of religious judgements will not explain religious obligation, moral facts and the truth-aptness of moral judgements will not help the moral realist either. So unless we do not wish to simply cast the problem of moral obligation aside, in future, moral subjectivism must be seriously considered as a worthwhile position in its own right. Die handlungstheoretische Betrachtung von Moral und Religion mit Hilfe der Philosophie des Geistes legt nahe, dass dieser moralische Subjektivismus mit dem für die Moralphilosophie zentralen Problem des moralischen Sollens besser umgehen kann als seine Rivalen: Anders als der Realismus oder gar der Relativismus (mit dem der Subjektivismus oft verwechselt wird), kann der hier ausgeleuchtete Subjektivismus mit der besonderen Verbindlichkeit moralischer Forderungen umgehen, ohne die Parallele zur besonderen Verbindlichkeit religiöser Forderungen in Abrede stellen zu müssen. Die Rolle und Durchschlagkraft der vom Realisten so freigiebig gespendeten ontologischen oder semantischen Zusatzannahmen er- scheint vor diesem Hintergrund fragwürdig. Dem religiösen Realisten wird man vergleichbare Annahmen nicht zugeben wollen und muss es auch nicht. Dann aber können wir die Erklärung besonderer Verbindlichkeit generell nicht auf Ontologie oder Semantik gründen. Der verbreitete Appell an sogenannte moralische Tatsachen oder die behauptete Wahrheitsfähigkeit moralischer Sätze erweist sich so als wirkungslos. Élie HALÉVY (1870-1937), philosophe et historien des idées, fut professeur à l'École libre des sciences politiques, l'ancêtre de l'actuel Sciences Po. Comme son autre grand ouvrage, l'Histoire du peuple anglais au XIXe siècle, paru en six tomes de 1913 à 1932, les trois tomes de La formation du radicalisme philosophique, parus en 1901 pour les deux premiers et en 1904 pour le troisième, reflètent pour partie ses enseignements de l'Ecole libre consacrés à l'histoire britannique. Le premier tome, La jeunesse de (...) Bentham 1776-1789, étudie la doctrine utilitariste non seulement chez celui qu'on regarde comme son fondateur principal, Jeremy Bentham, mais aussi chez les nombreux auteurs qui, en Grande-Bretagne et sur le continent, en dessinèrent avant lui les contours. Le deuxième tome, L’évolution de la doctrine utilitaire de 1789 à 1815, montre comment l'utilitarisme revêtit la forme non seulement d'une école de pensée, mais aussi d'un mouvement pour la réforme économique, sociale et politique. Le rôle coordonnateur nouveau de James Mill, ainsi qu'une convergence de vues avec les économistes, qui poussaient dans le sens des réformes, marquèrent notamment cette évolution. Le troisième tome, Le radicalisme philosophique, continue d'étudier la transformation de l'école en mouvement après la fin des guerres napoléoniennes, lorsque celle-ci commence à engranger ses premiers grands succès réformistes. Bentham, James Mill et les autres penseurs utilitaires sont alors réunis sous l'appellation de philosophic radicals. Le terme temporel de l'ouvrage est le Reform Act de 1832, première étape vers la modernisation du système électoral, que la propagande de ce groupe ne contribua pas peu à faire aboutir. Quoique l'ouvrage d'Halévy vaille en premier lieu par l'immense savoir qu'il déploie, et le nombre et l'excellence des citations qu'il propose, il comporte aussi des thèses historiques et philosophiques originales. On peut citer parmi les premières la thèse, qui relie les trois tomes, voulant que l'utilitarisme britannique trouve sa forme achevée dans l'intervention sur la société, lorsqu'il se mue en radicalisme philosophique, et parmi les secondes, la thèse, énoncée au début du premier tome, voulant qu'il existe trois modèles dominants de jonction des intérêts individuels (la fusion sympathique, l'identification naturelle et l'identification artificielle). Une autre grande thèse, à la fois historique et philosophique, affirme en substance que l'économie politique classique serait un département spécialisé de la pensée utilitaire. La question de savoir jusqu'à quel point Smith, Ricardo et Malthus ont pu adhérer au "principe d'utilité" de Bentham est toujours débattue. En même temps que les élucidations apportées à ce principe, elle contribue à expliquer l'intérêt que les historiens de la pensée économique continuent de porter à l'ouvrage. L'auteur a participé à la réédition de La formation du radicalisme philosophique en 1995 par les Presses Universitaires de France (P.U.F.), suivant un projet collectif lancé par Monique Canto-Sperber. Dans le présent article, antérieur à cette réédition, l'auteur tentait de résumer brièvement un livre qui demeure irremplaçable en dépit d'une conception et d'un style quelque peu datés. (shrink)

This paper argues that, according to a specific conception of the ideals of constitutional democracy - deliberative democratic constitutionalism - the proper function of constitutional review is to ensure that constitutional procedures are protected and followed in the ordinary democratic production of law, since the ultimate warrant for the legitimacy of democratic decisions can only be that they have been produced according to procedures that warrant the expectation of increased rationality and reasonability. It also contends that three desiderata for the (...) institutionalization of the function of constitutional review follow from this conception: structural independence, democratic sensitivity and the maintenance of legal integrity. Finally, evaluating three broadly different ways of institutionalizing constitutional review - solely in appellate courts, in deliberative constitutional juries of ordinary citizens and in a combined system of constitutional courts and civic constitutional amendment fora - it argues that the third arrangement would perform best at collectively fulfilling the sometimes antithetical desiderata. À travers ce mot, en effet, s’exprime, selon nous, cet « instant » précis qui semble survenir « soudainement », mais qui, en réalité, a besoin d'une longue période d'incubation, au terme de laquelle, « soudainement », surgit un problème qui émergeait auparavant dans une optique totalement différente. En d’autres termes, Platon semble décrire un phénomène que le langage commun appelle habituellement « illumination », et qui, selon nous, a de nombreux points communs avec le phénomène que les psychologues nomment insight. Smith proposes an account of how languages developed. He did so not as historian, but as a philosopher with a special concern about how a nominalist could account for general terms. Names for individuals are taken as fairly unproblematic – say ‘Thames’ and ‘Avon’ for each of the respective rivers. But whence the word ‘river,’ applicable to more than one, if all that exist are particular objects? Smith’s view is not the usual one, according to which people deploy a powerful (...) ability to abstract mentally, and subsequently affix a label to a general concept. He resisted this because he granted that such robust mental processes themselves presuppose the use of words. Rather, what holds the class together is the word itself, a “single appellation.”. Many philosophers have pointed out that statistical evidence, or at least some forms of it, lack desirable epistemic or non-epistemic properties, and that this should make us wary of litigations in which the case against the defendant rests in whole or in part on statistical evidence. Others have responded that such broad reservations about statistical evidence are overly restrictive since appellate courts have expressed nuanced views about statistical evidence. In an effort to clarify and reconcile, I put forward an interpretive (...) analysis of why statistical evidence should raise concerns in some cases but not others. I argue that when there is a mismatch between the specificity of the evidence and the expected specificity of the accusation, statistical evidence—as any other kind of evidence—should be considered insufficient to sustain a conviction. I rely on different stylized court cases to illustrate the explanatory power of this analysis. (shrink)

Conference paper presented at the 10th International Congress of Logic, Methodology, and Philosophy of Science, Florence, Italy (19-25 August 1995). Extrapolation here refers to the act of inferring more widely from a limited range of known facts. This notion of extrapolation, especially when applied to past events, has recently been used to formulate a pragmatic definition of truth. This paper shows that this definition has serious problems. The pragmatic definition of truth has been formulated in discussions on internal realism. (...) In this paper, the basic internal realist starting point, as expounded in the works of H. Putnam and N. Jardine, will be taken to be the claim that the distinction between judgements that are true from judgements that are false is explainable from within our judgement-forming faculty — no recourse to the external world is necessary. The paper first shows how the pragmatic definition of truth involves a counterfactual statement. It then describes how the counterfactual definition is apparently justified by an inductive argument. In the final step, this justification is shown to be unsuccessful. (shrink)

A mesure qu'ils avancent dans leur œuvre de prospection, les sémioticiens s'aperçoivent que tout est communication, la langue bien sûr, mais aussi les images, les sons, les objets, les gestes, et que tous ces phénomènes constituent des systèmes de signes qui doivent être étudiés en ramenant chaque message aux codes qui en régissent l'émission et la compréhension. Comprendre les systèmes de signes impose toutefois d'envisager les codes comme des structures, puis de recouvrir à des structures toujours plus vastes, dans un (...) mouvement de régression vers la matrice originelle de toute communication possible, vers un prétendu Code des Codes qui devrait représenter la détermination " naturelle " précédant toute culture. Mais si la sémiotique s'engageait dans cette voie, elle ne pourrait qu'aboutir à la " source " de toute structure possible, forcément non structurée, à ce qu'Umberto Ecco appelle la structure absente. Son livre, tout en refusant ce Code des Codes, essaie de montrer que tout acte communicatif est dominé par la présence massive de codes socialement et historiquement déterminés. La sémiotique découvre ainsi dans la dialectique entre code et message les rapports entre l'univers de signes et l'univers des idéologies, qui se reflètent dans les modes communicatifs préconstitués, et elle relie le monde des choses au monde de la culture, qui formalise les choses non pas pour les reconnaître comme elles sont mais afin de les transformer. Après avoir étudié dans L'œuvre ouverte (1965) les structures des langages expérimentaux de l'art contemporain, Umberto Ecco traite ici l'ensemble des problèmes sémiotiques et ce livre constitue à la fois sa contribution à la recherche en cours et le panorama actuellement le plus vaste et le plus complet sur les préalables constitutifs à toute sémiotique et sur l'état présent du structuralisme. Computation is central to contemporary mathematics. Many accept that we can acquire genuine mathematical knowledge of the Four Color Theorem from Appel and Haken's program insofar as it is simply a repetitive application of human forms of mathematical reasoning. Modern LLMs / DNNs are, by contrast, opaque to us in significant ways, and this creates obstacles in obtaining mathematical knowledge from them. We argue, however, that if a proof-checker automating human forms of proof-checking is attached to such machines, then (...) we can obtain apriori mathematical knowledge from them, even though the original machines are entirely opaque to us and the proofs they output are not human-surveyable. On entend par survenance moral la thèse selon laquelle, nécessairement, si deux entités sont parfaitement similaires en ce qui concerne toutes leurs propriétés non-morales, elles sont parfaitement similaires en ce qui concerne leurs propriétés morales. En dépit de son apparente simplicité, cette définition pose de nombreux problèmes. Ainsi, alors que la survenance morale est souvent présentée comme l’une des rares thèses faisant consensus en philosophie, il s’avère à y regarder de près que son interprétation varie grandement selon les philosophes. Trois (...) questions, en particulier, demandent à être éclaircies, sur lesquelles nous nous concentrerons ici : 1. On fait souvent appel à la survenance dans le but d’expliquer les propriétés morales. Mais à strictement parler, la survenance ne revêt par elle-même aucun caractère explicatif : quelle relation la survenance morale entretient-elle avec la relation de fondation ou d’explication morale ? 2. On tient la survenance morale pour une thèse consensuelle, mais on s’accorde peu sur la base de survenance des valeurs morales6. D’aucuns la restreignent à des propriétés naturelles ; d’autres y incluent des propriétés non-naturelles, pour peu qu’elles ne soient pas normatives ; d’autres encore y incluent des propriétés normatives, pour peu qu’elles ne soient pas morales ; d’autres enfin y incluent les principes moraux eux-mêmes. Que recouvre exactement la base de survenance des propriétés morales ? La survenance est une thèse modale (« nécessairement... »). Mais quelle modalité entre-t-elle ici en jeu ? La nécessité qui sous-tend la survenance morale est-elle métaphysique, conceptuelle, normative...? (shrink)

This text publishes the proceedings of the presentation of the book of Maurizio Torrini Galileo nel tempo, 2021), which took place on 19 November 2021 at the Museo Galileo in Florence. The presentation, chaired by Massimo Bucciantini, featured interventions by Paolo Galluzzi, Carlo Borghero, Stefano Caroti and Oreste Trabucco.

Orazio Ricasoli Rucellai is one of the leading eruditi of the second half of 17th-century Florence; he tried to keep alive Galileo’s contribution to science. Most of his Dialoghi filosofici have been published at the end of 19th century; among the unpublished dialogues dedicated to Timaeus we find a partial defence of Descartes’ metaphysics, which is edited in the Appendix. In particular, the topics at stake are the demonstration of God’s existence and of the immateriality of the soul in (...) Descartes’s Meditationes. The opponent of Descartes’s doctrine relies on Gassendi’s Obiectiones. Descartes’s doctrine of ideas completely detached from sense perception is dismissed as useless on a cognitive basis, and only a generic innatism is maintained, only as far as it can provide a proof of God’s imprint on human soul. “Critical thinking in higher education” is a phrase that means many things to many people. It is a broad church. Does it mean a propensity for finding fault? Does it refer to an analytical method? Does it mean an ethical attitude or a disposition? Does it mean all of the above? Educating to develop critical intellectuals and the Marxist concept of critical consciousness are very different from the logician’s toolkit of finding fallacies in passages of text, or the practice of (...) identifying and distinguishing valid from invalid syllogisms. Critical thinking in higher education can also encompass debates about critical pedagogy, i.e., political critiques of the role and function of education in society, critical feminist approaches to curriculum, issues related to what has become known as critical citizenship, or any other education-related topic that uses the appellation “critical”. Equally, it can, and usually does, refer to the importance and centrality of developing general skills in reasoning—skills that we hope all graduates possess. Yet, despite more than four decades of dedicated scholarly work “critical thinking” remains as elusive as ever. As a concept, it is, as Raymond Williams has noted, a ‘most difficult one’ (Williams, 1976, p. 74). (shrink)

Today, there is a family of celebrated police strategies that teach the importance of cracking down on petty crime and urban nuisance as the key to effective crime control. Under the “broken windows” appellation, this strategy is linked in the public mind with New York City and the alleged successes of its police department in reducing the rate of crime over the past two decades. This paper is critical of such order maintenance approaches to policing: I argue that infringements of (...) civil liberty by such departments could be reduced if the departments looked at law more as a good to be served for its own sake and less as an instrument for the promotion of order. In other words, a shot of legalism is the correct medicine to reduce police misconduct that pierces the law’s protections of citizen freedom. -/- This Article contributes to the critical literature on broken windows policing by reassessing the work of the famous Harvard scholar (James Q. Wilson) who fathered it. The Article takes Wilson’s work and turns it on its head, drawing very different prescriptive conclusions than he did himself. (shrink)

Jakob Ohlhorst | : This paper introduces the concept of tragic self-deception. Taking the basic notion that self-deception is motivated belief against better evidence, I argue that there are extreme cases of self-deception even when the contrary evidence is compelling. These I call cases of tragic self-deception. Such strong evidence could be argued to exclude the possibility of self-deception; it would be a delusion instead. To sidestep this conclusion, I introduce the Wittgensteinian concept of certainties or hinges: acceptances that are (...) beyond evidential justification. One particular type of certainties—iHinges, which are adopted for motivational reasons—explain the phenomenon of tragic self-deception: they warrant the subject’s dismissal of the evidence without loss of rationality from the subject’s point of view. Subsequently, I deal with some objections that can be raised against this account of self-deception. | : Cet article présente le concept d’auto-illusion tragique. En prenant la notion de base selon laquelle l’auto-illusion consiste en une croyance motivée à l’encontre de meilleures preuves, je soutiens qu’il existe des cas extrêmes d’auto-illusion qui persistent même face à des preuves contradictoires incontestables. J’appelle ces cas : auto-illusion tragique. On pourrait soutenir que des preuves d’une telle force excluent la possibilité d’auto-illusion et qu’il s’agirait plutôt de délire. Afin d’éviter cette conclusion, j’introduis le concept wittgensteinien de certitudes ou de propositions charnières : des admissions qui se situent au-delà d’une justification de nature probante. Un type de certitudes en particulier – iHinges, qui sont adoptées pour des raisons d’ordre motivationnel – rend compte du phénomène d’auto-illusion tragique. Ces certitudes justifient que le sujet rejette la preuve sans que cela implique, de son propre point de vue, une perte de rationalité. I argue that law is not best considered an essentially contested concept. After first explaining the notion of essential contestability and disaggregating the concept of law into several related concepts, I show that the most basic and general concept of law does not fit within the criteria generally offered for essential contestation. I then buttress this claim with the additional explanation that essential contestation is itself a framework for understanding complex concepts and therefore should only be applied when it is (...) useful to gain a greater understanding of uses of the concept to which it is applied (adducing criteria for making such judgments of usefulness). With that in mind, I then show that applying the appellation of essential contestation to the concept of law does not helpfully illuminate the most general concept of law (usually of most interest to legal philosophers) and therefore it should not be used, while allowing that it might be more useful for the related concept of the rule of law.
