This essay is an examination of the relationship between phenomenology and analytic method in the philosophy of law. It proceeds by way of a case study, the requirement of compliance in Raz’s theory of mandatory norms. Proceeding in this way provides a degree of specificity that is otherwise neglected in the relevant literature on method. Drawing on insights from the philosophy of art and cognitive neuroscience, it is argued that the requirement of compliance is beset by a range of epistemological (...) difficulties. The implications of these difficulties are then reviewed for method and normativity in practical reason. A topology of normativity emerges nearer the end of the paper, followed by a brief examination of how certain normative categories must satisfy distinct burdens of proof. (shrink)

A key objective of the law in the assessment of decision-making capacity in clinical settings is to allow clinicians and judges to avoid making value judgements about the reasons that patients use to refuse treatment. This paper advances two lines of argument in respect of this objective. The first is that authorities cannot rationally avoid significant evaluative judgements in the assessment of a patient’s own assessment of the facts of their case. Assessing reasoning is unavoidably value-laden. Yet the underlying motivation (...) behind clinicians’ and the law’s value-neutral aims, ie, the avoidance of undue paternalism, is worth preserving. That being so, the second line of argument will try to show that that underlying motivation is better served in a limited range of cases by embedding a ‘reversibility standard’ in the assessment process so that the patient can, if they wish, and in due course, bring about the consequences that they were prevented from realising as a result of a determination of incapacity. This article advances two views on the role of evaluative judgment in clinical assessments of decision-making capacity. The first is that it is rationally impossible for such assessments to exclude judgments of the values a patient uses to motivate their decision-making. Predictably, and second, attempting to exclude such judgments sometimes yields outcomes that contain intractable dilemmas that harm patients. These arguments count against the prevailing model of assessment in common law countries—the four abilities model—which is often incorrectly advertised as being (...) value-neutral in respect of patient decision-making both by its proponents and in statute. A straightforward evaluative model of capacity assessment which wears its values on its sleeves and is biased against what are called ‘serious prudential mistakes’ avoids these rational and practical problems. This paper examines a looming reproducibility crisis in the core of the hard sciences. Namely, it concentrates on molecular modeling and simulation (MMS), a family of methods that predict properties of substances through computing interactions on a molecular level and that is widely popular in physics, chemistry, materials science, and engineering. The paper argues that in order to make quantitative predictions, sophisticated models are needed which have to be evaluated with complex simulation procedures that amalgamate theoretical, technological, and social factors (...) – leading to problems with reproducibility. In my paper, I defend an interpretation according to which Aristotle thinks in Nicomachean Ethics (EN) that the rational aspect of soul is needed in discerning which ends of desire would be good. Many interpreters have traditionally supported this, ‘rationalist’ line of interpreting Aristotle’s theory of value cognition. The rationalist interpretation has, however, recently come under a novel challenge from Jessica Moss (2011, 2012), but has not yet received a defence. Moss attempts to resurrect now virtually abandoned ‘anti-rationalist’ interpretation, which (...) claims, in a contrast to the rationalist one, that discerning good ends may require no activity from the rational aspect, but only well-habituated non-rational desire. Moss’ interpretation appeals to certain Aristotle’s claims in De Anima (DA) 3, which, she thinks, show that non-rational phantasia suffices for discerning good ends if only accompanied with the habituated desire. Although her interpretation can successfully avoid some problems that earlier anti-rationalist interpretations faced with certain passages of EN, I also argue, however that it introduces some new problems, and attributes philosophically incoherent views about moral responsibility to Aristotle. Therefore I conclude that even after Moss’ improvements to the anti-rationalist interpretation, the rationalist interpretation remains overall more plausible. (shrink)

There are mathematical structures with elements that cannot be distinguished by the properties they have within that structure. For instance within the field of complex numbers the two square roots of −1, i and −i, have the same algebraic properties in that field. So how do we distinguish between them? Imbedding the complex numbers in a bigger structure, the quaternions, allows us to algebraically tell them apart. But a similar problem appears for this larger structure. There seems to be always (...) a background and a context that we rely upon. Thus mathematicians naturally make use of Kantian intuition and references fixed by names and denotations. I present a solution to the epistemological or characterisation problem of induction. In part I, Bayesian Confirmation Theory (BCT) is discussed as a good contender for such a solution but with a fundamental explanatory gap (along with other well discussed problems); useful assigned probabilities like priors require substantive degrees of belief about the world. I assert that one does not have such substantive information about the world. Consequently, an explanation is needed for how one can be licensed to act as (...) if one has substantive information about the world when one does not. I sketch the outlines of a solution in part I, showing how it differs from others, with full details to follow in subsequent parts. The solution is pragmatic in sentiment (though differs in specifics to arguments from, for example, William James); the conceptions we use to guide our actions are and should be at least partly determined by preferences. This is cashed out in a reformulation of decision theory motivated by a non-reductive formulation of hypotheses and logic. A distinction emerges between initial assumptions--that can be non-dogmatic--and effective assumptions that can simultaneously be substantive. An explanation is provided for the plausibility arguments used to explain assigned probabilities in BCT. -/- In subsequent parts, logic is constructed from principles independent of language and mind. In particular, propositions are defined to not have form. Probabilities are logical and uniquely determined by assumptions. The problems considered fatal to logical probabilities--Goodman's `grue' problem and the uniqueness of priors problem are dissolved due to the particular formulation of logic used. Other problems such as the zero-prior problem are also solved. -/- A universal theory of (non-linguistic) meaning is developed. Problems with counterfactual conditionals are solved by developing concepts of abstractions and corresponding pictures that make up hypotheses. Spaces of hypotheses and the version of Bayes' theorem that utilises them emerge from first principles. -/- Theoretical virtues for hypotheses emerge from the theory. Explanatory force is explicated. The significance of effective assumptions is partly determined by combinatoric factors relating to the structure of hypotheses. I conjecture that this is the origin of simplicity. (shrink)

This article takes up the question of whether legal rules are reasons for action. They are commonly regarded in this way, yet are legal rules reasons for action themselves (the reflexivity thesis) or are they instead merely statements of other reasons that we may already have (the paraphrastic thesis)? I argue for a version of the paraphrastic thesis. In doing so, considerable attention is given to the neglected but important puzzle of the opaqueness of rules, which arises out of what (...) some regard as the gap between the evaluative grounds of legal rules and what makes them into reasons for action. After examining an important articulation of the puzzle in the work of Joseph Raz, I argue that the reflexivity thesis is (i) undermined by certain features of rule making and (ii) defeated by the principle of presumptive sufficiency. The result is that it is possible for legal rules to be paraphrastic statements of reasons but, conversely, impossible for them to be reasons in themselves. (shrink)

It is not uncommon for people to hold bizarre views. Sometimes, these views appear before the courts in mental capacity cases. Judges must then decide if the views are so bizarre that they constitute evidence of incapacity or, instead, if those views are the everyday sort that do not constitute such evidence. The idea behind the distinction is that the everyday sort can be false but, in some important sense, not that unreasonable. But what should tip the balance of reasons (...) for a view to count as severely unreasonable rather than merely so? It turns out that capacity law is unable to provide a principled answer to this question because it lacks a standard to parse beliefs. This paper offers such a standard, focussing on the ability to reason, or the ‘use and weigh’ criterion, which features in most capacity statutes. The standard takes the form of a threshold with four necessary conditions. The main idea is that when a person's belief satisfies those conditions, it counts as evidence of an inability to reason. The standard's objective is to displace the various unarticulated conceptions of reasonableness which judges are currently compelled to use to determine questions of reasoning ability. (shrink)

The principle of least action, which has so successfully been applied to diverse fields of physics looks back at three centuries of philosophical and mathematical discussions and controversies. They could not explain why nature is applying the principle and why scalar energy quantities succeed in describing dynamic motion. When the least action integral is subdivided into infinitesimal small sections each one has to maintain the ability to minimise. This however has the mathematical consequence that the Lagrange function at a given (...) point of the trajectory, the dynamic, available energy generating motion, must itself have a fundamental property to minimize. Since a scalar quantity, a pure number, cannot do that, energy must fundamentally be dynamic and time oriented for a consistent understanding. It must have vectorial properties in aiming at a decrease of free energy per state (which would also allow derivation of the second law of thermodynamics). Present physics is ignoring that and applying variation calculus as a formal mathematical tool to impose a minimisation of scalar assumed energy quantities for obtaining dynamic motion. When, however, the dynamic property of energy is taken seriously it is fundamental and has also to be applied to quantum processes. A consequence is that particle and wave are not equivalent, but the wave (distributed energy) follows from the first (concentrated energy). Information, provided from the beginning, an information self-image of matter, is additionally needed to recreate the particle from the wave, shaping a “dynamic” particle-wave duality. It is shown that this new concept of a “dynamic” quantum state rationally explains quantization, the double slit experiment and quantum correlation, which has not been possible before. Some more general considerations on the link between quantum processes, gravitation and cosmological phenomena are also advanced. (shrink)

In the last few years, a remarkable convergence of interests and results has emerged between scholars interested in the arts and aesthetics from a variety of perspectives and cognitive scientists studying the mind and brain within the predictive processing (PP) framework. This convergence has so far proven fruitful for both sides: while PP is increasingly adopted as a framework for understanding aesthetic phenomena, the arts and aesthetics, examined under the lens of PP, are starting to be seen as important windows (...) into our mental functioning. The result is a vast and fast-growing research programme that promises to deliver important insights into our aesthetic encounters as well as a wide range of psychological phenomena of general interest. Here, we present this developing research programme, describing its grounds and highlighting its prospects. We start by clarifying how the study of the arts and aesthetics encounters the PP picture of mental functioning (§1). We then go on to outline the prospects of this encounter for the fields involved: philosophy and history of art (§2), psychology of aesthetics and neuroaesthetics (§3) and psychology and neuroscience more generally (§4). Morphological Computation is based on the observation that biological systems seem to carry out relevant computations with their morphology (physical body) in order to successfully interact with their environments. This can be observed in a whole range of systems and at many different scales. It has been studied in animals – e.g., while running, the functionality of coping with impact and slight unevenness in the ground is "delivered" by the shape of the legs and the damped elasticity of the muscle-tendon (...) system – and plants, but it has also been observed at the cellular and even at the molecular level – as seen, for example, in spontaneous self-assembly. The concept of morphological computation has served as an inspirational resource to build bio-inspired robots, design novel approaches for support systems in health care, implement computation with natural systems, but also in art and architecture. As a consequence, the field is highly interdisciplinary, which is also nicely reflected in the wide range of authors that are featured in this e-book. This essay is about Wittgenstein, first about his views on ethics, second about his conception of language games. Third, it combines the two and shows how problems arise from this. Wittgenstein rejects theories of ethics and emphasises the variety of language games. Such language games are marked by what I call “inner relativity”. Wittgenstein himself was not a relativist, but it seems to me his views easily lead to what I call “outer relativism”. In matters of ethics this is particularly (...) problematic. (shrink)

In this essay I point out parallels between Kant’s theory of aesthetics and Wittgenstein’s discussion of rule following. Although Wittgenstein did not write an aesthetics and Kant did not discuss Wittgensteinian rule-following problems, and although both Kant and Wittgenstein begin at very different starting points and use different methods, they end up dealing with similar issues, namely issues about rules, particularity, exemplarity, objectivity, practice, and as-if statements.

There has been recent dispute between Putnam and Searle over whether meanings are “in the head”. Putnam makes use of Twin-Earth thought experiments to show that our mental states alone cannot determine what we refer to (and thus “mean”) and that we rely also on external factors, which are not “in the head”. This suggests to me that we in some way mean more than we actually know. Searle on the other hand makes use of what he calls “Intentional contents”, (...) “conditions of satisfaction”, and “self-referentiality”, to show that meanings can be said to be in the head. It seems to me that an internalist account as we find it in Husserl or Searle is closer to what is going on when we mean something. (shrink)

What is the nature of thought? Is thought linguistic and some kind of silent speech? Or is it pre-linguistic and some kind of association of ideas and images in the mind? Does it happen in the brain? I will focus on the last question, but also say something about the other two. I will present a simple thought experiment to show that thought must somehow happen in the brain. But then I will soften the impression this might give by pointing (...) out what is needed to read those thoughts. Simply put, ontologically thought is in the brain, epistemologically it is not. According to the so-called Sapir-Whorf hypothesis, a language influences the mind of its user. This is more or less trivial, but the problems are in the details. It is difficult to make precise what those influences are, be it in general philosophical or in particular empirical-cultural terms. I will give an account of what I take to be basic aesthetic and grammatical features of the Chinese language compared with what we find in Western languages such as Latin or greek. Then (...) I will indicate what I take to be cultural differences and discuss whether these might be the result of differences in language structure. (shrink)

It has often been said that the Chinese script is pictorial or ideographic, and that this is one of the reasons why Chinese tend to think more analogically than logically, and why in the past the natural sciences developed to a lesser degree in China than in the West. These are strong claims. They have often been oversimplified and exaggerated, but I think there is something to be said for them. Here I will focus on the first question. I will (...) argue that Chinese characters still have semantic features that create image-like qualities in a wider sense: not mere resemblances between sign and object, but family resemblances in semantic fields. The fact that Chinese is an isolating and monosyllabic language is essential in this. (shrink)

This paper has two parts. In the first I give a brief historical account of the a priori and point out the central and problematic role of 'Erfahrung überhaupt' in Kant’s transcendental philosophy. In the second and main part I offer a criticism of Kripke’s arguments for the contingent a priori and I thereby question his radical separation of metaphysics and epistemology.

This book is a PhD dissertation and a very personal book at the same time. It asks the question whether society can and should be a point of orientation ("Bezugspunkt") for the human individual. Please note, that this cannot be a scientific book: If sociology is defined as society observed by society (or by sociologists, who are the agents of society), society observed by a single person (and for the aim of this single person) cannot be scientific. This is also (...) true if the researcher adheres to reason and scientific methodology: observations and understanding created by the human individual for its own private purposes simply are not scientific because they lack universality. "Bezugspunkt Gesellschaft" studies a number of different strains of sociology (and their scientific representatives, e.g. Pierre Bourdieu, Niklas Luhmann, Ralf Dahrendorf, Norbert Elias, Berger/Luckmann) in order to find out what it is that sociology studies? Is sociology the study of a society of human beings? Or is it true that society does not consist of human beings, but, as Luhmann claims, of acts of communication? Or is it true, as Bourdieu claims, that society consists of the instances of freedom abandoned half willingly, half out of habitude, by human individuals like in the case of a coffeehouse waiter who over time has just given up the idea that he could be anything else than a coffeehouse waiter. This book was inspired by a deconstructivist method of analysis in the field of literary theory where researchers state that it is of no interest what the author of a book wanted to say. Instead we should treat the work of literature as if the society of the author's epoch had written it. This theoretical "murder" of the human being in the form of the authors of works of literature in literary theory might have its analogy in sociology: Maybe sociology is also, like literary theory, not about people? However, if sociology is not about people - what can sociology teach us, us people? The book looks at different concepts of society throughout history, starting from the ancient concept that society is community, or that it is a circle of friendships, to more modern and dystopian concepts like that society is some kind of unhuman society. The book ends with the "Balzac machine", representing the incredibly talented and prolific French author Honoré de Balzac as a person who was an expert in the study of society and entirely blind to the phenomenon of society at the same time. The paradox of Balzac manifested itself in the fact that he literally worked himself to death in an attempt to gain society's recognition. (shrink)

In the framework of his transcendental philosophy, Kant strictly separates morality from aesthetics. The pleasure in the good and the pleasure in the beautiful are two different kinds of pleasure (Arten des Wohlgefallens). As a consequence, a moral act as such cannot be beautiful. It is only in a second step that Kant indicates possible connections, in his comments on aesthetic ideas, symbolism, the sensus communis, and education in general. In Confucius on the other hand we do not find such (...) a radical separation between beauty and morality. Ritual is a source of both. Moral acts can be beautiful. One might wonder whether Confucius missed a point, or whether Kant overdid the separation. Or is it that their conceptions are so fundamentally different that they cannot easily be translated and identified across different philosophical traditions? (shrink)

In the preface to On Certainty Anscombe and von Wright say that in 1949 Malcolm suggested to Wittgenstein to think again about Moore’s “Defense of Common Sense” (1925) and “Proof of an External World” (1939). Malcolm himself had written on the issue in “Defending Common Sense” (1949). In the preface to the Philosophical Investigations Wittgenstein quotes Nestroy saying that there is usually very little progress in philosophy. But I think some progress has been made from Moore and Malcolm to Wittgenstein (...) regarding skepticism. There is more awareness of practice and perspective and this opens the discussion in novel ways. But it also gives rise to new problems, in particular of morality and relativity. (shrink)

The notion of “representation” is central to Kant’s transcendental philosophy. But naturalism and mind-body reductionism tend to reduce talk of (first-person) representation to stories of (third-person) causality and evolution. How does Kant fare in this context?

This essay is about the inner and the outer in Wittgenstein, in particular his notion of “meaning experience”. Wittgenstein reminds us that we should not think of the inner, psychological the way we think about the outer, physical world. Again and again he keeps returning to certain views about the soul and our mental states. I think that it is not only therapy he has in mind. I will contrast certain aesthetic and ethical aspects of his thoughts with views from (...) Kant. (shrink)

In a preceding publication a fundamentally oriented and irreversible world was shown to be de- rivable from the important principle of least action. A consequence of such a paradigm change is avoidance of paradoxes within a “dynamic” quantum physics. This becomes essentially possible because fundamental irreversibility allows consideration of the “entropy” concept in elementary processes. For this reason, and for a compensation of entropy in the spread out energy of the wave, the duality of particle and wave has to be (...) mediated via an information self-image of matter. In this publication considerations are extended to irreversible thermodynamics, to gravitation and cos- mology with its dependence on quantum interpretations. The information self-image of matter around particles could be identified with gravitation. Because information can also impose an al- ways constant light velocity there is no need any more to attribute such a property to empty space, as done in relativity theory. In addition, the possibility is recognized to consider entropy genera- tion by expanding photon fields in the universe. Via a continuous activation of information on matter photons can generate entropy and release small energy packages without interacting with matter. This facilitates a new interpretation of galactic redshift, emphasizes an information link between quantum- and cosmological phenomena, and evidences an information-triggered origin of the universe. Self-organized processes approach maximum entropy production within their constraints. In a far from equilibrium world also information, with its energy content, can self- organize to a higher hierarchy of computation. It is here identified with consciousness. This ap- pears to explain evolution of spirit and intelligence on a materialistic basis. Also gravitation, here identified as information on matter, could, under special conditions, self-organize to act as a su- per-gravitation, offering an alternative to dark matter. Time is not an illusion, but has to be understood as flux of action, which is the ultimate reality of change. The concept of an irreversible physical world opens a route towards a rational understanding of complex contexts in nature. (shrink)

Ein Philosoph wollte Helmholtz nicht sein, aber er legte der philosophischen Reflexion wissenschaftlicher Erkenntnis und wissenschaftlichen Handelns große Bedeutung bei. Vor allem bezog er, in der Regel ausgehend von seinen (...) fachwissenschaftlichen Forschungen, in den verschiedensten Kontexten zu erkenntnistheoretischen und methodologischen Problemen der Wissenschaften Stellung. Bereits »Ueber die Erhaltung der Kraft« (1847) lässt erkennen, wie verwoben naturwissenschaftliche Grundlagenforschung und philosophische Grundlagenreflexion in seinem Werk sind. Die aus den frühen sinnesphysiologischen Forschungen hervorgegangene empiristische Wahrnehmungslehre trug ihm den Ruf ein, ein maßgeblicher Vertreter des Neukantianismus zu sein. Spätere Arbeiten v.a. zur Geometrie und Arithmetik – das zeigt die vorliegende Ausgabe – stellen jedoch eine radikale Absage an den konstitutiven Kern des Kantianismus (nämlich die Existenz synthetischer Urteile a priori) dar. In recent decades, interest in the history and philosophy of the natural sciences has increased significantly. This interest has made scholars aware of the existing knowledge gap in these areas and has brought a kind of 'pressure' for more articles and books on the subject. Indeed, it also motivates academics to start new projects related to these disciplines. Volumes like this are much needed for scholars in the field, given the high amount of information they contain. This rich volume aims (...) at stimulating the field by presenting current research papers on Avicenna's influence on the fields of physics and cosmology. In order to achieve this goal, this work contains thirteen articles related to the reception of the Persian philosopher's thought in these areas in the Middle Ages. The book revolves around the three different languages and cultures which were crucial for the reception of Avicenna's thought. Hence, the volume is arranged in three main sections focusing on the Arabic, Hebrew and Latin traditions. It also contains an Index of Avicenna's Works with Passages Cited and an Index of Names. The introduction is rather short compared to other sections of the book. It covers the general topics presented in the volume. The first six chapters deal with the Arabic tradition ; the next two have to do with the Hebrew reception of Avicenna, and the last five analyse the Latin reception of Avicenna's physics and cosmology. In diesem Fall handelt es sich um Platons berühmten Dialog Phaidon. Nun handelt dieser Dialog bekanntlich von der Frage nach der Unsterblichkeit der menschlichen Seele. Dennoch verweist Sokrates an einer bestimmten Stelle des Dialoges auf die für den Menschen drohenden Gefahren der Misologie und der Misanthropie hin, dem Hass auf die Vernunft und den Hass auf den Menschen, (...) die seiner Auffassung nach zusammenhängen. Die sokratische Warnung vor der Misologie und Misanthropie ist um so eindringlicher, als sie auf dem Hintergrund des existenziellen Problems des Todes und der religiösen Frage nach einem Jenseits des Todes diskutiert wird. Die im Reader versammelten Beiträge verstehen sich als Versuche zu einer Soziologie des Visuellen. Sie untersuchen am Beispiel des Mediums Stadtfilm, welche Rolle die dorterzeugten Bilder großer Städte bei der Produktion urbanistischer Repräsentanten spielen. Aus diesem Grund werden insbesondere Übergänge analysiert, die Spielfilme einerseits und urbanistische Diskurse andererseits miteinander verknüpfen. Gemeinsamer Ausgangspunkt ist die These, daß es vor allem Bilder sind, die solche Verknüpfungen gewährleisten. Es wird unterstellt, daß es das Medium Film erlaubt, gerade über den Einsatz von Bildern "näher" (...) an soziale Wirklichkeiten heranzukommen, als dies textzentrierter Praxis empirischer Sozialforschung möglich ist. Stadtfilme erzeugen wirkmächtige Bilder, auf die dann unter bestimmten Bedingungen in urbanistischen Kontexten zurückgegriffen wird. Die Autoren präsentieren konzeptionelle Überlegungen und Filminterpretationen zu Moebius (1991, Regie: Matti Geschonneck), Der Himmel über Berlin (1987, Regie: Wim Wenders), In weiter Ferne, so nah! (1993, Regie: Wim Wenders), Der Bauch des Architekten (1987, Regie: Peter Greenaway) und Hass (1995, Regie: Mathieu Kassovitz). Sie bedienen sich dabei sehr unterschiedlicher Verfahren. Gemeinsam sind ihnen allerdings die Anliegen, die größere Nähe der Filme zu sozialen Welten hervorzuheben und die Übergänge zwischen Stadtfilmen und Urbanistik herauszuarbeiten. -/- City and Film. Attempts at a 'Visual Sociology' Summary The contributions collected in this reader present attempts at a Visual sociology'. Based on a study on the medium 'city film' the author s determine which role the images of big cities evoked in such films can play for urbanistic representations. Therefore the analysis is, in particular, focussed on points of transition marking a connection of movies, on the one hand, and urbanistic discourse, on the othe r. The common point of departure is the hypothesis that images, more than anything else, do guarantee such connections. The authors assume that the medium film may lead 'closer' to social realities than the text- centered practices of empirical social research. City films produce powerful images which, under certain cond itions, can be utilized in urbanistic contexts. The authors present conceptual considerations and interpretations of the following films: Moebius (1991, director: Matti Geschonneck); Der Himmel über Berlin (1987, director: Wim Wenders); In weiter Ferne, so nah! (1993, director: Wim Wenders); The Belly of the Architect (1987, director: Peter Greenaway); and quite different methods they aim at the same goals: emphasizing the greater closeness of films to social worlds and bringing out the points of transition between city films and urbanistics. Art as Festival Art has been a privileged sphere in the sense that it appeales to art-receivers because of its power of taking them outside the sphere of everyday life (commonplaceness) and practicality. For the first time the philosophers of ancient Greece propagated this view. In this paper the Pythagorean and Aristotle’s views are considered; however they have different metaphysical bases, there is some aspect common to theirs aesthetics. In 20th century it is Helmut Kuhn, Hans-Georg Gadamer and Władysław (...) Stróżewski who express similar ideas and convictions about an exceptionality of the meeting between art and man. In the first part of the article (the ancient) notion of “leisure” (scholé) is presented, while in the second one the case of “festival”, Festlichkeit and Eigenzeit is taken into account. (shrink)

Wenn ausgerechnet Pazifisten bei der Verfechtung ihrer Position aggressiv werden, so finden wir das besonders verstörend – jedenfalls verstörender als bei anderen Spannungen zwischen Theorie und Praxis. Woran liegt das? Meiner Ansicht nach kommen in diesem Fall drei Elemente zusammen, deren Mischung die pazifistische Position von innen bedroht: Während sich der hasserfüllte Pazifist schon beim Diskutieren schnell von negativen Emotionen fortreißen lässt, also alles andere als Willensstärke dokumentiert, verlangt er in seiner Theorie ein Höchstmaß an Willensstärke, und zwar gerade im (...) Umgang mit Emotionen. Dass er das nicht schafft, wirft nicht nur ein negatives Licht auf seine Person, sondern liefert Gründe gegen seine Theorie. Lektion: Der Pazifist ist gut beraten, vorbildlich mit seinen Emotionen umzugehen. (shrink)

Idea integracji europejskiej nie jest wymysłem naszych czasów. Jest to proces złożony, który dojrzewał na przestrzeni kilku wieków i który w naszym stuleciu zaczął nabierać wyrazistych kształtów. Społeczeństwa europejskie znużone bezsensem wzajemnie wyniszczających wojen, zaczęły poszukiwać takiej formy koegzystencji, która umożliwiłaby im wspólne decydowanie o polityce, gospodarce czy kulturze. W roku 1950 francuski minister spraw zagranicznych Robert Schuman zadeklarował gotowość rządu francuskiego do współpracy z rządem niemieckim w sektorze węgla i stali, w celu zagwarantowania pokoju na kontynencie. Plan Schumana urzeczywistnił (...) się z chwilą podpisania w Paryżu 18 kwietnia 1951 r. przez sześć państw zachodnioeuropejskich: Niemcy, Francję, Włochy, Luksemburg, Belgię i Holandię, układu o Europejskiej Wspólnocie Węgla i Stali (EWWiS). Kolejne dwa traktaty o utworzeniu Europejskiej Wspólnoty Gospodarczej (EWG) oraz Europejskiej Wspólnoty Energii Atomowej (Euratom) podpisane w Rzymie 25 marca 1957 r. miały na celu rozszerzenie współpracy gospodarczej na inne sektory, takie jak rolnictwo, rybołówstwo, komunikacja, handel zagraniczny oraz utworzenie wspólnego rynku gospodarczego. Aby cel ten został osiągnięty, państwa członkowskie zdecydowały się na kolejne kroki integracyjne, jakimi były unia gospodarcza i walutowa. Drogę do tego procesu otworzył podpisany 7 lutego 1992 r. w Maastricht Traktat o Unii Europejskiej. Ratyfikacja Układu z Maastricht stała się okazją dokonania pewnych zmian w niemieckiej konstytucji, do której wprowadzono nowy zapis w art. 23 o Unii Europejskiej. Unia stała się celem nadrzędnym państwa niemieckiego, a Bundestag i Bundesrat otrzymały jasne cele i zadania w sprawach dotyczących Unii Europejskiej. Fakt ten świadczy o ogromnym znaczeniu Unii dla Niemiec. Niemcy są jednym z najbogatszych państw piętnastki. Ich PKB przekracza 20 tys. ECU i jest jednym z najwyższych w Unii. Motorem niemieckiej gospodarki jest przemysł, a zwłaszcza prężnie rozwijający się przemysł samochodowy. Unia Europejska jest dla Niemiec ważnym rynkiem zbytu - 60% eksportu w ramach Unii Europejskiej zajmuje eksport niemiecki. Poziom, który Niemcy osiągnęli w przeciągu 50 lat od zakończenia drugiej wojny światowej, nie byłby możliwy bez ścisłej współpracy pozostałych państw europejskich. Zniesienie ceł oraz wszelkich barier gospodarczych stworzyło ogromne możliwości handlowe i nie tylko. Ważnym krokiem w intensyfikacji wzajemnych stosunków było utworzenie unii gospodarczej i monetarnej, mającej na celu wprowadzenie do 2002 wspólnej waluty EURO. Wraz z postępującą integracją wewnątrz Unii Europejskiej pod koniec lat osiemdziesiątych dokonały się w Europie ważne zmiany historyczne. Europa Środkowa i Wschodnia uwalnia się, w wyniku reform przeprowadzanych w Związku Radzieckim przez Michaiła Gorbaczowa, spod totalitarnych rządów komunistycznych. W roku 1991 wybucha w Moskwie pucz, który wykorzystują republiki radzieckie, ogłaszając swoją niepodległość. W Polsce i na Węgrzech odbywają się obrady okrągłego stołu, w wyniku których komuniści oddają władzę opozycji. Do ostrych konfliktów dochodzi natomiast w Czechosłowacji i Rumunii, gdzie oddanie władzy nie odbywa się bez przelewu krwi. Zmiany polityczne nie ominęły również NRD. W nocy z 9 na 10 listopada 1989 r. runął mur berliński, a 3 października 1990 r. dokonuje się zjednoczenie obu państw niemieckich. Wraz ze zjednoczeniem NRD staje się członkiem Unii Europejskiej. Proces ten odbywa się jednak na innych zasadach, niż przewidują to unijne procedury mówiące o przyjęciu nowych członków w swoje szeregi. W dniu zjednoczenia Wschodnie Niemcy przejmują prawo pierwotne oraz 80% prawa wtórnego Unii. Poza tym otrzymują znaczną pomoc w ramach funduszy strukturalnych. Wiele państw Europy Środkowo- Wschodniej chętnie podzieliłoby los NRD i szybko zintegrowałoby się z zachodnioeuropejskimi strukturami. Dlatego też od początku lat dziewięćdziesiątych zauważamy intensywne starania tych państw o przyjęcie w struktury Unii Europejskiej. W roku 1991 Polska i Węgry podpisały jako pierwsze państwa byłego Bloku Wschodniego Układy Europejskie. W ślad za nimi poszły Bułgaria, Litwa, Łotwa, Estonia, Rumunia, Słowenia, Słowacja i Czechy. Od 1994 r. kraje te wystąpiły oficjalnie o członkostwo w Unii Europejskiej. Przystąpienie do Unii spotyka się w społeczeństwie z wieloma negatywnymi reakcjami. Polacy coraz bardziej sceptycznie odnoszą się do spraw Unii Europejskiej i do przyszłego w niej członkostwa, choć z pewnością można by liczyć na wiele. Chociażby na ustabilizowanie gospodarki, młodej demokracji oraz stosunków polsko-niemieckich. Przeszkodą i problemem na drodze do integracji jest sytuacja polskiego rolnictwa, kwestia wykupu ziem polskich przez Niemców oraz utraty tożsamości narodowej. Również Niemcy obawiają się rozszerzenia. Politycy natomiast wydają się być motorem integracji europejskiej. Helmut Kohl, były kanclerz Niemiec, postawił sobie nawet za cel zintegrowanie krajów środkowoeuropejskich ze strukturami zachodnimi do 2002 r., podając za powód swej decyzji utrzymanie stabilności gospodarki i pokoju w tym regionie. Jego następca Gerhard Schröder nie jest już takim optymistą. Podczas niemieckiego przewodnictwa w Radzie Unii Europejskiej ma zamiar zająć się w pierwszej kolejności interesami niemieckimi oraz sprawami dotyczącymi wewnętrznych problemów Unii Europejskiej. Kwestia rozszerzenia zeszła na plan dalszy. Czy jest to słuszna koncepcja - pokaże czas. (shrink)
