This book examines the legal and moral theory behind the law of evidence and proof, arguing that only by exploring the nature of responsibility in fact-finding can the role and purpose of much of the law be fully understood. Ho argues that the court must not only find the truth to do justice, it must do justice in finding the truth.

Aryeh Goldberg compellingly argues for a Narrative Coherence Standard (NCS) to bolster existing methods of assessing patients' mental capacity. But his account fails to distinguish between the cognitive abilities of children and adults; consequently, worries may be raised about the scope of the NCS, in particular when we consider child patients. In this article, I argue the NCS cannot plausibly apply to children. Since children's self-conception does not arrive fully formed — but rather is a product of both incomplete cognitive (...) development and socializing factors — I claim children may not possess a sufficiently intimate knowledge of self, and therefore a sufficiently coherent sense of self, as Goldberg demands. Therefore, we should either revise the NCS to accommodate children, adopt an incremental view of consent, or revert to the relevant form of the MacArthur competence criteria to establish children’s capacity to consent. This article synthesizes the current theoretical attempts to understand human-machine interactions and introduces seven premises to understand our emerging dynamics with increasingly competent, pervasive, and instantly accessible algorithms. The hope that these seven premises can build toward a social theory of human-AI cocreation. The focus on human-AI cocreation is intended to emphasize two factors. First, is the fact that our machine learning systems are socialized. Second, is the coevolving nature of human mind and AI systems as smart devices form an (...) indispensable part of our cognitive scaffolds, thus, shaping how we perceive the world and ourselves. The seven premises include: primacy of social structures; human’s desire for freedom and autonomy; AI systems will form inseparable parts of our cognitive/affective scaffolds and can change our self-understanding; philosophy and humanistic foundations on human flourishing as a guide to human-AI interaction; mindsponge information-filtering process; acculturative process of how values change and emerge from human-AI interaction; overlapping Venn diagram of the human-human, human-nature, and human-machine interactions. This article concludes with a discussion on human agency in our entanglements with socialized machines and the illusoriness of the Cartesian agent view of the mind. (shrink)

The hypergrowth and hyperconnectivity of networks of artificial intelligence (AI) systems and algorithms increasingly cause our interactions with the world, socially and environmentally, more technologically mediated. AI systems start interfering with our choices or making decisions on our behalf: what we see, what we buy, which contents or foods we consume, where we travel to, who we hire, etc. It is imperative to understand the dynamics of human-computer interaction in the age of progressively more competent AI. In recent decades, the intertwining ideas of self-determination and well-being have received tremendous support in bioethics. Discussions regarding self-determination, or autonomy, often focus on two dimensions—the capacity of the patient and the freedom from external coercion. The practice of obtaining informed consent, for example, has become a standard procedure in therapeutic and research medicine. On the surface, it appears that patients now have more opportunities to exercise their self-determination than ever. Nonetheless, discussions of patient autonomy in the bioethics literature, which (...) focus on individual patients making particular decisions, neglect the social structure within which health-care decisions are made. Looking through the lens of disability and informed by the feminist conception of relational autonomy, this essay argues that the issue of autonomy is much more complex than the individualist model suggests. The social system and the ableist ideology impose various forms of pressure or oppressive power that can affect people’s ability to choose according to their value system. Even if such powers are not directly coercive, they influence potential parents’ decisions indirectly—they structure their alternatives in such a way that certain options are never considered as viable and other decisions must be made. This paper argues that, instead of only focusing on the individual act of decision-making, we need to pay attention to the social structure that frames people’s decision. (shrink)

Nhật Bản thường được biết đến là một cường quốc khoa học không chỉ ở Châu Á mà trên toàn thế giới với rất nhiều giải thưởng khoa học cao quý và sản lượng khoa học ổn định ở mức cao nhiều thập niên qua. Tuy nhiên, trong khoảng 10 năm trở lại đây, thế giới đã thường xuyên ghi nhận những vụ bê bối về đạo đức nghiên cứu tại Nhật Bản. Xem xét kĩ lưỡng nội dung chi tiết (...) các vụ bê bối có thể thấy Nhật Bản đang gặp phải những thách thức nan giải trong việc ngăn chặn và kiểm soát vi phạm đạo đức nghiên cứu. Một phần quan trọng của thách thức này là sự xung đột giữa một bên là những yếu tố có tính lịch sử và văn hóa, và bên kia là sự phát triển của công nghệ thông tin và xu hướng hợp tác quốc tế mở rộng. Nghiên cứu trường hợp của Nhật Bản có thể mang lại những bài học quan trọng trong việc xây dựng khả năng đào tạo và quản lí đạo đức nghiên cứu tại một nền khoa học mới hội nhập như Việt Nam. Satirical cartooning in Vietnam is subject to a complex dynamic: an increasingly liberalised and internationalised economy, and the rise of social media in a one-party state. This article examines what state-sanctioned satirical cartoons can reveal about the representation and management of political criticism in such a context. We find a growing trend of depicting corruption as a systemic problem, which is present in 45 per cent of the sample and in 70 per cent of the 20 most-viral cartoons in one (...) of Vietnam’s most popular magazines, Tuoi Tre Cuoi (Youth Humour). This trend can be interpreted as a change in the sensibility of audiences and a shift toward a more tolerant media landscape. The trend, however, may also be a worrying sign of the dual dangers of cynicism in Vietnamese politics: the development of apathy among audiences and the cynical use of art by authorities. Despite these concerns, we argue, political cartoons in Vietnam provide an important public avenue for collective political reflection and everyday social solidarity. (shrink)

For Bhartrhari, a fifth-century Indian grammarian-philosopher, all conscious beings—beasts, birds and humans—are capable of what he called pratibha, a flash of indescribable intuitive understanding such that one knows what the present object “means” and what to do with it. Such an understanding, if correct, amounts to a mode of knowing that may best be termed knowing-what, to distinguish it from both knowing-that and knowing-how. This paper attempts to expound Bhartrhari’s conception of pratibha in relation to the notions of meaning, understanding, (...) and knowing. First, I touch briefly on Bhartrhari’s views of consciousness and language, and examine at some length his indescribability thesis concerning the intuitive meaning of a sentence. Then, I delineate the general features of pratibha as intuitive understanding and discuss its probable range in relation to expert intuition and sense perception. Thereafter, I relate pratibha to the notion of knowing-what and show why these two notions are to be differentiated from knowing-that and knowing-how. The paper concludes with some remarks on the contemporary relevance of Bhartrhari’s conception of pratibha. (shrink)

This paper endeavors to understand the research landscape of finance research in Vietnam during the period 2008 to 2020 and predict the key defining future research directions. Using the comprehensive database of Vietnam’s international publications in social sciences and humanities, we extract a dataset of 314 papers on finance topics in Vietnam from 2008 to 2020. Then, we apply a systematic approach to analyze four important themes: Structural issues, Banking system, Firm issues, and Financial psychology and behavior. Overall, there have (...) been three noticeable trends within finance research in Vietnam: (1) assessment of financial policies or financial regulation, (2) deciphering the correlates of firms’ financial performances, and (3) opportunities and challenges in adopting innovations and ideas from foreign financial market systems. Our analysis identifies several fertile areas for future research, including financial market analysis in the post-COVID-19 eras, fintech, and green finance. (shrink)

Not much attention has been paid to Malebranche’s philosophy of time. Scholars who have written on it have typically written about it only in passing, and by and large discuss it only in relation to his philosophy of religion. This is appropriate insofar as Malebranche doesn’t discuss his views of time in isolation from his religious metaphysics. I argue that Malebranche’s conception of how created beings have their properties commits him to saying that God is omnitemporal rather than atemporal. For (...) just as bodies get their spatiality by participating in God’s omnipresence, so all creatures get their temporality by participating in God’s omnitemporality. Moreover, Malebranche is a substantivalist about space and time: infinite space and time are one and the same divinely simple substance, God (partially considered), who contains the world. My exploration of Malebranche’s metaphysics sheds light on his views of eminent containment, participation, and causation. (shrink)

We grant that anthropic reasoning yields the result that we should not expect to be in a small civilization. However, regardless of what civilization one finds oneself in, one can use anthropic reasoning to get the result that one should not expect to be in that sort of civilization. Hence, contra Ken Olum, anthropic reasoning does not conflict with observation.

Especially over the past twenty years, a number of analytic philosophers have embraced the idea that the world itself is vague or indeterminate in one or more respects. The issue then arises as to whether it can be the case that the world itself is indeterminate in all respects. Using as a basis Chinese Madhyamaka Buddhist thought, I offer two reasons for the coherence and intelligibility of the thesis that all concrete things are themselves indeterminate with respect to the ways (...) they are. The first reason draws on a notion reminiscent of the picture of reality as an amorphous lump, while the second reason makes use of the relativity of conceptual perspectives and determinations. Assuming that the world is the mere totality of all concrete things, I show that there is a genuine metaphysical possibility of the world’s being indeterminate in all respects. (shrink)

Traditionally, phenomenal consciousness has been restricted to the realm of perceptual and otherwise sensory experiences. If there is a kind of phenomenology altogether unlike sensory phenomenology, then this was a mistake, and requires an accounting. I argue such cognitive phenomenology exists by appealing to a phenomenal contrast case that relies on meaningful and relatively meaningless dialogue. I explain why previous phenomenal contrast arguments are less likely to be effective on even neutral parties to the debate: these arguments rely on a (...) ‘hard-to understand’ sentence, which may elicit sensory crutches that one focuses on, thereby obscuring cognitive phenomenology. I also argue for a positive characterization of the phenomenal contrast in terms of seeming to be aware of abstract relations that obtain between different contributions in a dialogue. This paves the way for arguing that what it’s like to entertain a cognitive content that p differs from that of q in their cognitive phenomenology. (shrink)

The menu-dependent nature of regret-minimization creates subtleties when it is applied to dynamic decision problems. It is not clear whether forgone opportunities should be included in the menu. We explain commonly observed behavioral patterns as minimizing regret when forgone opportunities are present. If forgone opportunities are included, we can characterize when a form of dynamic consistency is guaranteed.

This paper defends the strong thesis of ethical egoism, the view that self-interest is the exclusive standard of morally right action. The method of defense is that of reflective equilibrium, viz., back and forth reflection on intuitive judgments in particular cases and the principles that seem to explain our judgments, with the goal of aligning the two. The defense proceeds in three steps. First, I define what selfishness is and characterize what selfishness looks like in real life; an accurate depiction (...) of selfishness will show that selfishness, at least generally, is morally attractive. Second, I defend the view that helping others and not helping others is morally right when and because doing so serves one’s self-interest. A new AI system, called AlphaGeometry, trained under synthetic data has demonstrated the ability to solve geometric problems at the International Olympiad level. This essay considers the fact that human abilities to learn and do math as well as many other tasks are increasingly augmented with AI. Clearly, smart technologies like AlphaGeometry are redefining a number of concepts and institutions such as learning, schools, education, teacher-student relationships, creativity, etc, which are so fundamental for what we’ve thought of as modern society, (...) economy, and culture. What are we preparing for in mathematics education in the face of the possibility of the continued emergence of disruptive technologies, signaling the beginning of the end, if a new reality of mathematics is not taken into account? The discourse on emotional A.I., i.e., technologies that read, classify, identify human emotions, is currently dominated by Western ideas1. Yet, even A.I. researchers in the West acknowledge there are cultural differences if neglected could magnify and affect A.I.'s accuracy.

Selim Berker argues that epistemic consequentialism is pervasive in epistemology and that epistemic consequentialism is structurally flawed. is incorrect, however. I distinguish between epistemic consequentialism and epistemic instrumentalism and argue that most putative consequentialists should be considered instrumentalists. I also identify the structural problem of epistemic consequentialism Berker attempts to pinpoint and show that epistemic instrumentalism does not have the consequentialist problem.

This essay analyzes the rise of Large Language Models (LLMs) such as GPT-4 or Gemini, which are now incorporated in a wide range of products and services in everyday life. Importantly, it considers some of their hidden human costs. First, is the question of who is left behind by the further infusion of LLMs in society. Second, is the issue of social inequalities between lingua franca and those which are not. Third, LLMs will help disseminate scientific concepts, but their meanings' (...) dissemination is at risk. Fourth, is the issue of information security and how nations and individuals might adapt. Fifth, is the issue of the environmental cost of LLMs for future generations. At the dawn of the conversational AI era, it would be wise to ponder what inequalities and empowerments will be co-created with LLMs. (shrink)

Every year, the Vietnamese people reportedly burned about 50,000 tons of joss papers, which took the form of not only bank notes, but iPhones, cars, clothes, even housekeepers, in hope of pleasing the dead. The practice was mistakenly attributed to traditional Buddhist teachings but originated in fact from China, which most Vietnamese were not aware of. In other aspects of life, there were many similar examples of Vietnamese so ready and comfortable with adding new norms, values, and beliefs, even contradictory (...) ones, to their culture. This phenomenon, dubbed “cultural additivity”, prompted us to study the co-existence, interaction, and influences among core values and norms of the Three Teachings –Confucianism, Buddhism, and Taoism–as shown through Vietnamese folktales. By applying Bayesian logistic regression, we evaluated the possibility of whether the key message of a story was dominated by a religion (dependent variables), as affected by the appearance of values and anti-values pertaining to the Three Teachings in the story (independent variables). Our main findings included the existence of the cultural additivity of Confucian and Taoist values. More specifically, empirical results showed that the interaction or addition of the values of Taoism and Confucianism in folktales together helped predict whether the key message of a story was about Confucianism, β{VT ⋅ VC} = 0.86. Meanwhile, there was no such statistical tendency for Buddhism. The results lead to a number of important implications. First, this showed the dominance of Confucianism because the fact that Confucian and Taoist values appeared together in a story led to the story’s key message dominated by Confucianism. Thus, it presented the evidence of Confucian dominance and against liberal interpretations of the concept of the Common Roots of Three Religions (“tam giáo đồng nguyên”) as religious unification or unicity. Second, the concept of “cultural additivity” could help explain many interesting socio-cultural phenomena, namely the absence of religious intolerance and extremism in the Vietnamese society, outrageous cases of sophistry in education, the low productivity in creative endeavors like science and technology, the misleading branding strategy in business. We are aware that our results are only preliminary and more studies, both theoretical and empirical, must be carried out to give a full account of the explanatory reach of “cultural additivity”. This essay briefly summarizes the key characteristics and social philosophies in Japan’s vision of Society 5.0. Then it discusses why Vietnam, as a developing country, can learn from the experiences of Japan in establishing its vision for an AI-powered human-centric society. A number of traditional philosophers and religious thinkers advocated an ineffability thesis to the effect that the ultimate reality cannot be expressed as it truly is by human concepts and words. However, if X is ineffable, the question arises as to how words can be used to gesture toward it. We can't even say that X is unsayable, because in doing so, we would have made it sayable. In this article, I examine the solution offered by the fifth-century Indian grammarian-philosopher (...) Bhartrhari and develop it into a linguistic strategy based on the imposition-cum-negation method. The purpose is to show how we can non-contradictorily say, or rather indicate, the unsayable. According to the neo-Aristotelian moral tradition, every living thing has an ultimate end: To flourish as a member of its species. This view of the ultimate end shapes inquiry into what is the ultimate end of human living things. In this paper, I develop an alternative view of the ultimate end of a living thing: The ultimate end is only to survive, not as a member of a species, but as a living thing. There are four steps to my development. (...) First, I criticize the prevailing species-based view of the ultimate end. Second, I argue that other-regarding behavior is not normative for living things; only survival is. Third, I elucidate a new and what I take to be correcting understanding of survival. Fourth, I programmatically develop the idea that inquiry into human well-being and into morality (for human beings) should be understood as aspects of inquiry into human survival. (shrink)

This paper defends the view that intrinsic benefit to a human being consists exclusively in survival. It takes as its point of departure the neo-Aristotelian view that inquiry into intrinsic benefit to a human being should take place within a wider theory of intrinsic benefit to living things, generally. The paper first argues that the neo-Aristotelian view that intrinsic benefit to a living thing consists in flourishing as a member of its species, is mistaken. Rather, intrinsic benefit to a living (...) thing consists in survival, and not survival as a member of its species, but survival simpliciter. A refined understanding of survival is developed in the paper. The paper then applies this Survivalist account of intrinsic benefit to human beings: The things we take to be good for human beings—e.g., pleasure, desire-fulfillment, etc.—are good to the extent and because they promote the one intrinsic benefit of survival. The essay advocates for diverse approaches in presenting a researcher's scientific contributions in a project. Taking inspiration from sports journalism and its visualization of football players' data, the essay suggests that a radar plot, incorporating CRediT contributor role data, enables multiple authors of a scientific paper to illustrate their contributions in a more specific manner. The suggested method, though subject to bias reporting, pays credit to different aspects of a research project, from conceptualization, analysis, administration, to writing and revising. 如果機器人的發展要能如科幻想像一般，在沒有人類監督下自動地工作，就必須確定機器人不會做出道德上錯誤的行為。 根據行為主義式的道德主體觀，若就外顯行為來看，機器人在道德上的表現跟人類一般，機器人就可被視為道德主體。從這很自然地引伸出機器人的道德擬人主義：凡適用於人類的道德規則就適用於機器人。我反對道德擬人主義 ，藉由史特勞森對於人際關係與反應態度的洞見，並以家長主義行為為例，我論述由於機器人缺乏人格性，無法參與人際關係，因此在關於家長主義行為上，機器人應該比人類受到更嚴格的限制。.

A number of analytical philosophers have recently endorsed the view that the world itself is indeterminate in some respect. Intriguingly, ideas similar to the view are expressed by thinkers from Chinese Madhyamaka Buddhism, which may shed light on the current discussion of worldly indeterminacy. Using as a basis Chinese Madhyamaka thought, together with Jessica Wilson’s account of indeterminacy, I develop an ontological conception of indeterminacy, termed ontic indeterminacy, which centres on two complementary ideas—conclusive indeterminability and provisional determinability. My overarching aim is to present a viable and sustainable perspective on the subject of indeterminacy to enrich analytical philosophers’ insights into the intricate nature of reality. (shrink)

In recent years, with the advances in machine learning and neuroscience, the abundances of sensors and emotion data, computer engineers have started to endow machines with ability to detect, classify, and interact with human emotions. Emotional artificial intelligence (AI), also known as a more technical term in affective computing, is increasingly more prevalent in our daily life as it is embedded in many applications in our mobile devices as well as in physical spaces. Critically, emotional AI systems have not only (...) the ability to not passively read and classify emotions, but most also have an ability to predict and ‘nudge’ users to certain desired emotional states. Drawing from Piredda (2020)’s account, we've examined various emerging emotion-sensing technologies such as recommender algorithms, personal AI assistants, work-related emotion trackers, and emotional AI toys and robots through the lens of affective artifacts. We show how these technologies fulfill the criteria of being affective artifacts: they can influence the affective states of the users (e.g., help regulate emotions of ourselves and others), some emotion-sensing algorithms and importantly, our manipulation of these algorithms, can intersect with the maintenance and construction of our sense of self and identity. This research employs the Bayesian network modeling approach, and the Markov chain Monte Carlo technique, to learn about the role of lies and violence in teachings of major religions, using a unique dataset extracted from long-standing Vietnamese folktales. The results indicate that, although lying and violent acts augur negative consequences for those who commit them, their associations with core religious values diverge in the final outcome for the folktale characters. Lying that serves a religious mission of either Confucianism or Taoism (...) (but not Buddhism) brings a positive outcome to a character (βT_and_Lie_O= 2.23; βC_and_Lie_O= 1.47; βT_and_Lie_O= 2.23). A violent act committed to serving Buddhist missions results in a happy ending for the committer (βB_and_Viol_O= 2.55). What is highlighted here is a glaring double standard in the interpretation and practice of the three teachings: the very virtuous outcomes being preached, whether that be compassion and meditation in Buddhism, societal order in Confucianism, or natural harmony in Taoism, appear to accommodate two universal vices—violence in Buddhism and lying in the latter two. These findings contribute to a host of studies aimed at making sense of contradictory human behaviors, adding the role of religious teachings in addition to cognition in belief maintenance and motivated reasoning in discounting counterargument. Folklore has a critical role as a cultural transmitter, all the while being a socially accepted medium for the expressions of culturally contradicting wishes and conducts. In this study of Vietnamese folktales, through the use of Bayesian multilevel modeling and the Markov chain Monte Carlo technique, we offer empirical evidence for how the interplay between religious teachings (Confucianism, Buddhism, and Taoism) and deviant behaviors (lying and violence) could affect a folktale’s outcome. The findings indicate that characters who lie and/or commit (...) violent acts tend to have bad endings, as intuition would dictate, but when they are associated with any of the above Three Teachings, the final endings may vary. Positive outcomes are seen in cases where characters associated with Confucianism lie and characters associated with Buddhism act violently. The results supplement the worldwide literature on discrepancies between folklore and real-life conduct, as well as on the contradictory human behaviors vis-à-vis religious teachings. Overall, the study highlights the complexity of human decision-making, especially beyond the folklore realm. (shrink)

Therefore, one of the greatest contributions of Kinh tế Việt Nam: Thăng trầm và đột phá (2009) is how the book focuses on the fundamentals: a good story, with strong support from statistics, economic foundations, and sensibility.

Decision-making regarding healthcare expenditure hinges heavily on an individual's health status and the certainty about the future. This study uses data on propensity of general health exam (GHE) spending to show that despite the debate on the necessity of GHE, its objective is clear—to obtain more information and certainty about one’s health so as to minimise future risks. Most studies on this topic, however, focus only on factors associated with GHE uptake and overlook the shifts in behaviours and attitudes regarding (...) different levels of cost. To fill the gap, this study analyses a dataset of 2068 subjects collected from Hanoi (Vietnam) and its vicinities using the baseline-category logit method. We evaluate the sensitivity of Vietnamese healthcare consumers against two groups of factors (demographic and socioeconomic-cognitive) regarding payment for periodic GHE, which is not covered by insurance. Our study shows that uninsured, married and employed individuals are less sensitive to cost than their counterparts because they value the information in reducing future health uncertainty. The empirical results challenge the objections to periodic health screening by highlighting its utility. The relevance of behavioural economics is further highlighted through a look at the bounded rationality of healthcare consumers and private insurance companies in using and providing the service, respectively. A work of Vietnamese art crossed a million-dollar mark in the international art market in early 2017. The event was reluctantly seen as a sign of maturity from the Vietnamese art amidst the many existing problems. Even though the Vietnamese media has discussed the issues enthusiastically, there is a lack of literature from the Vietnamese academics examining the subject, and even rarer in from the market perspective. This paper aims to contribute an insightful perspective on the Vietnamese art market, and (...) hesitantly the Vietnamese art as well, through the lens of fake, forgery and copy artworks. 35 cases of fake, forgery and copy paintings were found on the news and from the experts' wisdom. Through the examples, we argue that the Vietnamese art market is a temporary reaction to the immaturely rising of the Vietnamese art and the economy. Therefore, the art market is unable to function healthily unless the Vietnamese art and the economy developed. (shrink)

My belief that Socrates was wise, and your belief that Socrates was mortal can be said to have a common focus, insofar as both these thoughts are about Socrates. In Peter Geach’s terminology, the objects of our beliefs bear the feature of intentional identity, because our beliefs share the same putative target. But what if it turned out that Socrates never existed? Can a pair of thoughts share a common focus if the object both thoughts are about, does not actually, (...) really exist? Object-centric accounts of intentionality which explain the aboutness or directedness of thought in terms of the intentional object the thought in question is about, contend that thoughts which share a common focus do so in virtue of both thoughts simply being about the same intentional object. However, Alexander Sandgren contends that such theories face difficulties in explaining a puzzle of intentional identity put forward by Walter Edelberg, in which a pair of sentences seem to differ in truth value but are purportedly logically equivalent on the object-centric theory. If this is right, then it seems that any account which explains intentionality with reference to an intentional object is threatened by this result, whether this object be abstract, merely possible, Meinongian, or otherwise. In this paper, I argue that Edelberg’s Puzzle is analogous to Frege’s Puzzle and the same tools conventionally used to solve Frege’s Puzzle can be used to solve Edelberg’s Puzzle. I then propose a new object-centric solution to Edelberg’s Puzzle which takes into account modes of presentation and which is able to accommodate all the relevant linguistic data. (shrink)
