I develop a theory of counterfactuals about relative computability, i.e. counterfactuals such as 'If the validity problem were algorithmically decidable, then the halting problem would also be algorithmically decidable,' which is true, and 'If the validity problem were algorithmically decidable, then arithmetical truth would also be algorithmically decidable,' which is false. These counterfactuals are counterpossibles, i.e. they have metaphysically impossible antecedents. They thus pose a challenge to the orthodoxy about counterfactuals, which would treat them as uniformly true. What’s more, I (...) argue that these counterpossibles don’t just appear in the periphery of relative computability theory but instead they play an ineliminable role in the development of the theory. Finally, I present and discuss a model theory for these counterfactuals that is a straightforward extension of the familiar comparative similarity models. (shrink)

This article argues that understanding any space or site relies on a knowledge of its fourth dimension - the timescape. It will explore this by situating the investigation in the museum - a place of heightened contrivance which could easily be shallowly interpreted as "mere style". It will defend a new method of investigating museum temporality which combines both phenomenology and literary theory, and will replace the idea of geo-epistemology with geochronic epistemology: an understanding of context and situation which takes (...) on time as well as spatial location. In so doing, it moves on from notions of the museum as a place out of time, situating it in the networks of meaning, power and politics in which we have lived and are living. Thus, "the whole space of the exhibition" as Lyotard said, "becomes the remains of all time": the Museum on the Edge of Forever. (shrink)

David Stove's essay “The intellectual capacity of women” was first published in 1990, in the Proceedings of a Sydney philosophical society. It has been re-published twice since his death. It seems though that during his lifetime Stove himself refused to agree to its being re-printed. This raises two questions: Did Stove believe his essay on women contains mistakes? And: does it contain mistakes? The main flaws in the essay stem from a rash adoption of simplistic ideas about probability coupled with (...) a question-begging definition of capacity. The work also contains contradictions and exaggerations and some unwise forays into social history. Stove was an intelligent man so it seems likely that he would have recognised those flaws. Machine learning algorithms may radically improve our ability to diagnose and treat disease. For moral, legal, and scientific reasons, it is essential that doctors and patients be able to understand and explain the predictions of these models. Scalable, customisable, and ethical solutions can be achieved by working together with relevant stakeholders, including patients, data scientists, and policy makers.

One famous debate in contemporary epistemology considers whether there is always one unique, epistemically rational way to respond to a given body of evidence. Generally speaking, answering “yes” to this question makes one a proponent of the Uniqueness thesis, while those who answer “no” are called “permissivists”. Another influential recent debate concerns whether non-truth-related factors can be the basis of epistemic justification, knowledge, or rational belief. Traditional theories answer “no”, and are therefore considered “purists”. However, more recently many theorists have (...) argued to the contrary, claiming that impurist factors, such as practical stakes, can sometimes encroach or even override truth-related considerations. This paper bridges the two debates by presenting and defending what I call “Impurist Permissivism”. I support Impurist Permissivism by showing how it can resist Roger White’s famous Argument from Arbitrariness (2005). (shrink)

Braun explores the use of digital twin technology in medicine with a particular emphasis on the question of how such simulations can represent a person.1 In defining some first conditions for ethically justifiable forms of representation of digital twins, he argues that digital twins do not threaten an embodied person, as long as that person retains control over their simulated representation via dynamic consent, and ideally with the option to choose both form and usage of the simulation. His thoughtful elaboration (...) provides insight into the challenges inherent in interactions between a person and their digital twin, emphasising the modes of control required to respect personal modes of freedom. This individual-centric approach to the question of representation leaves out the important ethical consideration of ensuring that all, not merely some, can be represented. Braun describes dynamic consent as a necessary mode of control, arguing that where a person is unable to give consent, ‘such simulations threaten to become illegitimate representations. They would then shift the kind of interaction from representation to illegitimate forms of prediction or surveillance and thereby could lead to infringements to individual modes of freedom.’ Consequently, the implementation of digital twin technology in healthcare would seem to exclude the most vulnerable members of society from participation in and benefiting from medical innovation, …. This article argues that personal medical data should be made available for scientific research, by enabling and encouraging individuals to donate their medical records once deceased, similar to the way in which they can already donate organs or bodies. This research is part of a project on posthumous medical data donation developed by the Digital Ethics Lab at the Oxford Internet Institute at the University of Oxford. Ten arguments are provided to support the need to foster posthumous medical data donation. (...) Two major risks are also identified—harm to others, and lack of control over the use of data—which could follow from unregulated donation of medical data. The argument that record-based medical research should proceed without the need to secure informed consent is rejected, and instead a voluntary and participatory approach to using personal medical data should be followed. The analysis concludes by stressing the need to develop an ethical code for data donation to minimise the risks, and offers five foundational principles for ethical medical data donation suggested as a draft code. Jizang (549–623) is regarded as a prominent figure in Sanlun Buddhism (三論宗) and a revitalizer of Nāgārjuna’s Mādhyamaka tradition in China. In this essay, I argue that Jizang’s concept of non-empty Buddha-nature is compatible with the idea of universal emptiness. My argument unfolds in three steps. First, I argue that, for Jizang, Buddha-nature is the Middle Way (zhongdao 中道), which signifies a spiritual state that avoids the extremes of both emptiness and non-emptiness. Next, I explore how and why Jizang believes (...) that Buddha-nature is eternal. I examine Jizang’s notions of intrinsic eternality (dingxing chang 定性常) and conditional eternality (yinyuan chang 因緣常), aiming to demonstrate that his understanding of Buddha-nature as eternal can be framed within the concept of conditional eternality, where Buddha-nature is seen as the objective manifestation of the dharma body. Since this type of eternality aligns with the principle of universal emptiness, Jizang’s assertion that Buddha-nature is eternal is thus compatible with the notion of universal emptiness. Furthermore, I illustrate that Jizang’s theory of eternal Buddha-nature carries practical implications, suggesting that this assertion serves as encouragement rather than being merely an ontological claim. Almost every facet of the experience of musical listening—from pitch, to rhythm, to the experience of emotion—is thought to be shaped by the meeting and thwarting of expectations. But it is unclear what kind of mental states these expectations are, what their format is, and whether they are conscious or unconscious. Here, we distinguish between different modes of musical listening, arguing that expectations play different roles in each, and we point to the need for increased collaboration between music psychologists and (...) philosophers in order to arrive at a more detailed characterisation of conscious musical experience and the role of expectations therein. While the substantiation of “best interests” has received much attention, the question of how “the child” is conceptualised to ensure any action taken or decision made is in the particular child’s best interests has been largely neglected. In this paper, I argue that the lack of robust understanding of who “the child” is means that we continue to make many generalisations and category-based assumptions in determining the child’s best interests. In addressing the challenge of doing right by the individual child, (...) I propose a three-step approach based on a theoretical model of the child that avoids presumptions about child-typical needs and insists on an assessment of the child’s individual characteristics, needs, qualities, and circumstances, making it the only conceptualisation fully meeting the child centrism criterion required by children’s rights as determined by the United Nations Convention on the Rights of the Child. Adoption may be defined as ‘the legal process through which the state establishes a parental relationship, with all its attendant rights and duties, between a child and a (set of) parent(s) where there exists no previous procreative relationship’ . In adoptions from care, state intervention effectively converts an established, or nascent, adult– child relationship into ‘family’ in the legal sense. From the state’s perspective, adoption thus entails the transfer of parental responsibilities for a child in public care to a private (...) family unit, enabling the state to permanently delegate its duties towards a child to this new unit. This seemingly straightforward legal act raises deeper philosophical questions relating to such state ‘family creation’, particularly when the child’s perspective is taken. Such a child- centric approach normatively regards children as equal moral beings, who ought to be included in actions concerning them, regardless of their capacity to form and express an opinion. Accordingly, adoption from care can be described as a moral decision, aimed at doing what is in the child’s best interests. The purpose of this chapter is to explore a suspicion of a lack of child- centrism in adoption from care practice, and to illustrate how adopted children’s rights are inferior to those of their non- adopted peers. This will shed light on a practice currently lacking transparency and accountability and will increase our understanding of how we fail to treat children as equal moral individuals in decision- making that severely impacts children’s lives. A significant proportion of child protection cases involve care-experienced mothers, which reveals a continuous cycle of mothers who lose their children to social services after having been in state care themselves as children. While the importance of protecting children requires little explanation and forms the justificatory basis for child protection interventions, it is important to remember that care-experienced mothers were once children entrusted to the state’s care, and who arguably have been failed by the state in that their parenting opportunities (...) are significantly reduced. This paper aims to address this underexplored dilemma between protecting children and safeguarding mothering opportunities for care-experienced mothers. Appealing to the concept of solidarity, I argue that the state has an obligation to increase its compensatory efforts to secure the right of care-experienced women to not only become parents but to be able to be parents, with the aim of breaking the cycle of care experience. It is commonly held that the ascription of truth to a sentence is intersubstitutable with that very sentence. However, the simplest subclassical logics available to proponents of this view, namely K3 and LP, are hopelessly weak for many purposes. In this article, I argue that this is much more of a problem for proponents of LP than for proponents of K3. The strategies for recapturing classicality offered by proponents of LP are far less promising than those available to proponents of (...) K3. This undermines the ability of proponents LP to engage in public reasoning in classical domains. (shrink)

In recent years, New Mechanism has become one of the most popular and widely discussed philosophical accounts of scientific explanation. Some of its proponents see it as a successor to traditional deductive nomological and statistical approaches to the philosophy of explanation. New Mechanists thus argue for the generality of their approach as a model of scientific explanation. Here we will show that the generality of NME as an account of scientific explanation is restricted. Most significantly, NME is widely recognized to (...) have trouble in accounting for explanation in traditional physics. Yet, in the face of obstacles to NME in the physical sciences, New Mechanists have yet to provide a convincing defense of the generality of their view. In this paper, I (1) summarize when and how NME works, (2) describe briefly what NME is not and can’t be, (3) outline some areas of contemporary scientific explanation where New Mechanism misses the mark; and (4) demonstrate that New Mechanism does not constitute a general theory of scientific explanation but rather covers a restricted scope of explanations. In this dissertation I achieve the following: (1) I present motivating criteria for a general comprehensive theory of scientific explanation. I review historical approaches to modeling explanation in light of these criteria. (2) I present New Mechanist Explanation ("NME") as the leading candidate for a contemporary, complete theory of scientific explanation. (3) I present constraints on the applicability of New Mechanism in modeling biology, chemistry, and physics. I argue for the unsuitability of NME as a candidate for a general theory (...) of explanation due to its significant omissions of explanatory content and subsequent incompleteness. (4) I present arguments for the indispensable explanatory power of mathematics in science, noting that much of NME's failures are owed to its poor integration of mathematical explanation as applied to science. (5) I propose a Rational-Relational theory of explanation(“RRE”). I present RRE in detail and demonstrate it as a true working general theory of explanation which best meets the motivating criteria presented in (1). I disambiguate RRE from structural explanation ("SE"). I show that historical models of explanation, including the deductive nomological (DNE) model, statistical relevance ("SRE") model, structural model (SE) and unification model ("UE") may be successfully treated as sub-classes of explanation within the scope of RRE. I provide a rubric for selecting amongst sub-theories of explanation under RRE in the purpose of highlighting particular features of relational explanations. (6) In conclusion, I argue that philosophers of science should move forward using RRE as a general model of scientific explanation as a working alternative to the incomplete model of NME. (shrink)

Dissertation Prospectus. Exploring the limits of New Mechanism as a general theory of scientific explanation, limiting its scope and proposing constraints.

While science is often presented as a body of knowledge or collection of passively accumulated facts, science should be examined and experienced as a performed process, a human endeavor connected to the ways we access the world. In this white paper, I briefly introduce the practice of science from the perspective of performance theory. By examining science in the context of performance, we may approach certain key questions about science directly. How do scientists perform experiments and practice the scientific method (...) (or, more accurately, scientific methodologies)? How does science rely on particular performer(s) and the particular contexts of those performances? What distinguishes the activity of science from other kinds of human performances? By reframing science as a human performance in the context of human practices and rituals, we more closely approach an accurate and communicable explanation of what the process of “doing science” actually is as something that humans do. Based on a critical interpretative review of existing qualitative research investigating accounts of ‘lived experience’ of surrogates and intended parents from a relational perspective, this article proposes a typology of surrogacy arrangements. The review is based on the analysis of 39 articles, which belong to a range of different disciplines (mostly sociology, social psychology, anthropology, ethnology, and gender studies). The number of interviews in each study range from as few as seven to over one hundred. Countries covered include Australia, Canada, (...) Greece, India, Iran, Israel, Italy, Mexico, Norway, Russia, Sweden, UK, Ukraine, and the USA. Most studies focus only on surrogacy practices in one country (although often with intended parents from other countries), and some include several countries (e.g. interviewees from several countries or fieldwork in different field-sites). The proposed typology goes beyond the division between altruistic versus commercial, and traditional versus gestational surrogacy, in order to inform further research and to contribute to bioethical and policy debates on surrogacy in a transnational context. Four types of relations are identifiable: open, restricted, structured, and enmeshed. The criteria which influence these relationships are: the frequency and character of contact pre- and post-birth; expectations of both parties; the type of exchange involved in surrogacy arrangements; and cultural, legal, and economic contexts. The theoretical contribution of the article is to further the development of a relational justice approach to surrogacy. (shrink)

Cognitive bias (Stroop interference and implicit memory bias) for masked and unmasked threat words (illness words and negative emotion words) was investigated for its associations with emotion (anxiety, anger/aggression, and positive affect) and somatic complaints in a randomly selected community sample of 138 individuals. Because measures of cognitive bias are inherently bipolar, the data were tested for both linear and curvilinear trends. Cross-sectional analysis showed that the associations between somatic anxiety and Stroop interference for unmasked threat words were better described (...) in terms of curvilinear than linear models, and that degree of somatic complaints was associated with Stroop facilitation for masked threat words. Longitudinal analysis showed that Stroop interference for masked threat words predicted lack of positive affect during an ensuing eight weeks daily recording period. Implicit memory bias was found to be negatively associated with measures of anger/aggression,both in the cross-sectionaland longitudinal analyses. We suggest that: (a) cognitive bias should be treated as a bipolar construct in future research; (b) the phenomenon of Stroop facilitation for threat words deserves further exploration; and (c) more research should address the question about the relationship between cognitive bias and other emotions than anxiety (e.g., positive affect and anger). This study investigated how learner support services at the University of Calabar predict business education students' preparation for online learning. Two specific objectives were established, two research questions were posed, and two null hypotheses were developed and tested at a significant level of .05. Pertinent literature was reviewed. The population consisted of 147 University of Calabar 400-level business education students. This population also formed the sample using a census process. Data were gathered using a structured questionnaire with 40 items that (...) were validated by five specialists from the University of Calabar. Cronbach Alpha statistics were used to establish the questionnaire's reliability, yielding reliability coefficients of 0.88 and 0.85 for the independent sub-variables and dependent variable, respectively. Following the administration of the questionnaire, the data collected was analyzed using linear regression analysis to test the hypotheses. The results show that academic and technological support services strongly predict business education students' preparation for online instruction at the University of Calabar. Based on these findings, the study recommends that lecturers, counsellors, and academic technicians should encourage students to participate in digital education by offering intellectual, emotional, and other support services. Emotion processing is known to be impaired in psychopathy, but less is known about the cognitive mechanisms that drive this. Our study examined experiencing and suppression of emotion processing in psychopathy. Participants, violent offenders with varying levels of psychopathy, viewed positive and negative images under conditions of passive viewing, experiencing and suppressing. Higher scoring psychopathics were more cardiovascularly responsive when processing negative information than positive, possibly reflecting an anomalously rewarding aspect of processing normally unpleasant material. When required to experience emotional (...) response, by ‘getting into the feeling’ of the emotion conveyed by a negative image, higher factor 1 psychopathic individuals showed reduced responsiveness, suggesting that they were less able to do this. These data, together with the absence of corresponding differences in subjective self-report might be used to inform clinical strategies for normalising emotion processing in psychopathic offenders to improve treatment outcome, and reduce risk amongst this client group. Successful teamwork doesn't work overnight, what makes teamwork potent is team building. (Plagiarism) According to Abdullah, et. al., (2022) team building training can improve group cohesiveness or the quality of sticking together or unity teamwork more likely to be higher with a significant score difference. This study used mixed methods both qualitative and quantitative data collection, and an analysis method to answer the research method, random sampling is named as such because the data set is chosen via random selection, where (...) every member of the population has an equal probability of being selected (Tao, 2023). The respondents were 100 restaurant employees and 10 managers from the chosen restaurant in Malolos City in Bulacan. The subcategories of team building, including activities, communication, skills, personality, problem-solving, and values, have all received a consensus of strong agreement, with weighted averages falling within the range of 3.26 to 3.44. This level of agreement aligns with the scores for motivation at 3.43 and productivity at 3.38. These values have been calculated by determining the mean, which spans from 3.25 to 4.00. The advantages of team building that is being observed by the managers is to create familiarity and teamwork among the employees, to improve the quality of service and the quality of the food especially the respondents are in the food service sector, development, and training for the employees to achieve the establishments’ goal and lastly rebuilding and build a relationship with one employee to another. However, for the disadvantages, it costs a lot of money to conduct team building in the management. Therefore, the null hypothesis is rejected. Despite the fact that there is a low correlation between teambuilding activities and motivation and employee productivity, there is still a significant relationship between the variables. (shrink)

Jenny Saville is a leading contemporary painter of female nudes. This paper explores her work in light of theories of gender and embodied agency. Recent work on the phenomenology of embodiment draws a distinction between the body image and the body schema. The body image is your representation of your own body, including your visual image of it and your emotional attitudes towards it. The body schema is comprised of your proprioceptive knowledge, your corporeally encoded memories, and your corporeal (...) proficiency with respect to various environments and activities. Saville is concerned with body image issues, and I discuss how she reconfigures representational practices with respect to feminine body images. However, the most exciting potential for feminist analysis of the state of the female nude derives from the concept of the body schema, for this concept endows the human body with subjectivity and agency. My key question, then, is by what pictorial means and to what extent Saville succeeds in representing agentic womanhood. I argue that interpreting Saville’s paintings from the standpoint of the body schema demonstrates the radicality of her remaking of the female nude and the rapport between her imagery and feminist values. The logic of soku-hi is presented as an articulation of a post-Kantian view of reality that embraces the truths of science with the assumption of the transcendental subject. As such, soku-hi represents the philosophical posture of both the secular Zen of the Kyoto School and the new materialists of contemporary continental philosophy. It describes how material reality is not all even though there is nothing else.

This paper addresses two related topics: 1. The disanalogies between elective cosmetic practices and sex reassignment surgery. Why does it seem necessary for me – an aging professional woman – to ignore the blandishments of hairdressers wielding dyes and dermatologists wielding acids and scalpels? Why does it not seem equally necessary for a transgendered person to repudiate sex reassignment procedures? 2. The role of the body in identity and agency. How do phenomenological insights regarding the constitution of selfhood in relation (...) to the interplay between the body image and corporeal know-how contribute to an account of the agency of transgendered individuals? Studying several paintings by contemporary feminist artist Jenny Saville has advanced my thinking on these topics. Saville’s imagery is an invaluable aid to reflection on these issues because she uses her painterly technique, which critics often dub “virtuoso,” to represent lived human bodies. In her work, viewers encounter representations of subjectivized, agentic corporeity, as distinct from inert, objectified flesh. Moreover, her sympathetic engagement with nonconformist, devalued bodies helps to reconfigure the standard gestalts of the human body that viewers typically carry with them and thus to convert fear and/or disgust into appreciation and understanding. In this paper, I consider three of Saville’s paintings. Plan, Saville’s self-portrait as a nude female whose body has been prepped for liposuction, conveys the pathos of this procedure. Matrix is a nude portrait of self-described “gender variant visual artist” Del LaGrace Volcano. In the words of one critic Saville’s depiction of Volcano’s nude intersexed body “restores beauty to the primitive [female] genital organ.” Passage, another nude portrait of an intersexed individual, is an image of vibrant sexuality despite the presumptively jarring juxtaposition of breasts and a penis. I argue that conceiving the agentic subject as a rational deliberative capability that uses a conjoined body as the instrument of its will makes it impossible to theorize the agency of transgendered people. In contrast, when agentic subjects are understood as embodied subjects and embodiment is understood as a dimension of practical intelligence, the agency of transgendered individuals is intelligible. In this paper, I show where Adolf Reinach comes down on the question of conflicts of obligation. The aim is to look at whether Reinach’s phenomenological realism of obligation holds its own against positions developed by Bernard Williams concerning the nature and import of obligations, and their capacity or incapacity to impinge upon each other and other moral and non-moral concerns. It is shown that even if Reinach turns out to succumb to pitfalls Williams identifies, he nonetheless verges upon agreement (...) with Williams in more ways than one might expect. This result is significant because it shows that Reinach’s phenomenological realism, in contrast to certain forms of moral realism, lays the foundations for what can be considered a heterontology of obligation and ethical concerns, which is presupposed by the experience of (moral) conflict in the first place. This paper concerns two topics which, I hope to show, are vitally connected. One is the distinctive importance of appellate adjudication in the legal system of United States. The other is the workings of entangled concepts in the law. That appellate adjudication is important in some sense may seem obvious to everybody (to a few it will seem obvious that appellate adjudication is unimportant). My point will be that via appellate adjudication courts engineer entangled legal concepts, and it is this (...) aspect of appellate adjudication that is both crucial and unique to it, at least in the U.S. legal system. Entangled concepts intertwine description and evaluation; entangled legal concepts facilitate and constrain legal reasoning and legal judgments, in ways that distinguish legal adjudication from pure politics or the implementation of public policy. In the paper itself, I demonstrate more fully what it is for a legal concept to be an entangled one and how entanglement supplies guidance in adjudication. I also broach how entanglement in legal concepts and engineered entanglement have significance for legal pedagogy; appellate adjudication; the respective roles of the judiciary, the legislature, and administrative agencies; the erosion of the distinction between so-called public law and so-called private law; and our understanding of the fact/value distinction. -/- Understanding more specifically the nature of the entanglement at work in appellate adjudication requires much closer scrutiny of appellate opinions than we usually give. I examine carefully the background to MacPherson v. Buick and Justice Benjamin Cardozo’s particular re-engineering of ‘negligence’ and ‘duty,’ entangled concepts belonging to the same legal taxonomy. Via this scrutiny, I demonstrate the flaws in the engineering of some concepts in the buildup to MacPherson, and how these flaws led to those concepts’ collapse and ultimately to Cardozo’s re-engineering of ‘negligence’ and ‘duty.’ I also explain why careful understanding of the engineering of entangled legal concepts can make us appreciate that even the most successful of such concepts have within in them the grounds for their own obsolescence. -/- To show that conceptual engineering of entangled concepts occurs outside the context of state common law, I also examine how the U.S. Supreme Court has engineered ‘commerce’, itself an entangled concept. The recent decision regarding the individual mandate in the Affordable Care Act makes this example particularly timely. This secondary example also clarifies the nature of entanglement and engineering it. -/- This article concerns appellate adjudication in any area of law. I maintain that whether we are dealing with private law or public law, common law or statutory law or Constitutional law, the defining feature of appellate adjudication is its continuous engineering and reengineering of entangled legal concepts. The merger of fact and value in these concepts explains both the fertility of appellate adjudication and the constraints judges work with when they work with legal concepts that entangle fact and value. Comment penser la possibilité pour une conscience de faire le mal, de commettre une faute qu’elle sait répréhensible ? Reconnaissant à la fois la longue tradition qui avant lui s’est intéressée à ce problème éternel pour la philosophie et la théologie, Ricœur ressent le besoin de revenir sur cette question en même temps qu’il juge nécessaire de donner à sa démarche phénoménologique un tournant herméneutique. Afin de comprendre ce choix, nous proposons ici une synthèse critique de La symbolique du Mal, (...) second tome du cycle de la Philosophie de la volonté de Ricœur ; y seront exposées les principales composantes de sa démarche ainsi que les grands moments de ses conclusions. Nous espérons par notre travail montrer pourquoi le problème du mal, plus particulièrement l’expérience de la faute, empêche de penser une subjectivité pleine, maîtrisée et transparente à elle-même. Pour cette raison, l’herméneutique semble s’imposer comme démarche pour appréhender le sujet brisé par la faute, et pour comprendre la juste valeur des symboles par lesquels cette expérience a été exprimée. With the establishment of the World Trade Organization in 1995, the dispute settlement mechanism for international trade was greatly prepared unlike the old GATT system. It has a very different pattern from that of original GATT system. In our case, international trade is a matter of the future of nations, and in reality of the intense world economic competition, this system change may well be of concern to our government or legal experts. In this context, this paper examines the nature (...) and problems of the WTO appeal system under the premise of the rule of law, judicial prowess, and the role of a judge. The WTO dispute settlement mechanism is based on the domestic judicial system or other international judicial systems. In contrast to this, the comparative history is only short indeed, but according to the accumulation of future precedents, it is highly possible to provide a model for the achievement of the rule of law ideals in the international community. However, due to the inherent limitations of international agreement system, the reality of appellate body is not easy. In terms of the international trade and rule of law, the role of appellate body and judges is very broad. However, in this paper, we first look at the significance and nature of the launch of WTO and furthermore; 1) the rule of law and judicial system, 2) several issues related to the nature of WTO dispute settlement mechanism, 3) the importance of judge-made law and the scope and limitations of appellate jurisdiction, 4) issues of reference materials submitted by procedures outside the process, 5) the relationship between the appellate body and political authorities. Over the review, the penetrating thoughts will be focused on judicial activism. Those points of consideration will be discussed through the approach and method on the comparative legal studies and several significant WTO precedents. (shrink)

I argue against Appel's recent proposal – in this JOURNAL – that there is a fundamental human right to sexual pleasure, and that therefore the sexual pleasure of severely disabled people should be publicly funded – by thereby partially legalizing prostitution. I propose an alternative that does not need to pose a new positive human right; does not need public funding; does not need the legalization of prostitution; and that would offer a better experience to the severely disabled: charitable (...) non-profit organizations whose members would voluntarily and freely provide sexual pleasure to the severely disabled. Some responses to analogies between abortion and infanticide appeal to Judith Jarvis Thomson's argument for the permissibility of abortion. I argue that these responses fail because a parallel argument can be constructed for the permissibility of infanticide. However, an argument on the grounds of a right to choose to become a parent can maintain that abortion is permissible but infanticide is not by recognizing the normative significance and nature of parenthood. -/- Certaines réponses aux analogies entre l'avortement et l'infanticide font (...) appel à l'argument de Judith Jarvis Thomson en faveur de la licéité morale de l'avortement pour désamorcer ces analogies. Je soutiens que ces réponses échouent parce qu'un argument parallèle peut être construit en faveur de la licéité de l'infanticide. Cependant, un argument reposant sur le droit de choisir de devenir parent permet de soutenir que l'avortement est autorisé mais que l'infanticide ne l'est pas en reconnaissant le sens et la nature normatifs de la parentalité. Body dysmorphic disorder (BDD) poses a significant challenge to an individual’s mental well-being. The obsessive preoccupation with perceived defects in one’s appearance affects individuals’ daily functioning and can result in serious risks, including suicidal ideation and self-surgery. While treatments such as cognitive behavioural therapy and serotonin reuptake inhibitors can provide relief, they do not achieve complete remission. It has been suggested that therapy should not only interrupt the harmful behaviour, but should also address their sense of self, and that after (...) addressing their internalised values, individuals with BDD will be able to incorporate their perceived defect in a manner similar to how individuals with real deformities often do. Phenomenology of psychopathology analyses subjectivity in cases of pathology, and analyses of BDD show that the perceived defect has become a locus of shame. This implies that individuals with BDD have permanently incorporated the gaze of the Other and constantly experience their body as a body-for-others. This paper further explores the sense of self in individuals with BDD through Jenny Slatman’s interpretation of bodily integrity: bodily integrity as a never-ending process of identification. By comparing the experiences of individuals with BDD to those with real deformities and to those who have undergone cosmetic surgery, I will show that re-identification does not occur in individuals with BDD. This suggests that their bodily integrity is fundamentally disturbed and that addressing their internalised values alone will probably not be sufficient for the disorder to go into remission. Partout des appels formels invoquant la démocratie sont lancés : la démocratie comme première condition requise pour une gouvernance politique respectueuse des intérêts des citoyens et des équilibres de l’environnement. En même temps, une multitude d’indices convergents configurent une gestion de la res publica par une caste oligarchique politico-économique dont la propension à gérer les ressources environnementales se caractérise par l’absence de prise en compte du bien commun sur la base d’intérêts particuliers sans tenir compte des équilibres biosphériques (Bergandi, 2014 (...) : 63-81). Quel est le rôle des sciences et des scientifiques dans un tel contexte? Ou plus précisément, quel est le rôle des sciences et des scientifiques dans des questions à l’interface entre science et société, générant des controverses socio-scientifiques? Jusqu’à quel point les sciences peuvent-elles encore effectivement incarner l’idéal de la neutralité axiologique, durablement implanté par le positivisme à partir du XIXe siècle à la fois dans l’éthique scientifique et dans l’inconscient des scientifiques, telle une constante, apparemment inéliminable, de la science? Est-il possible de trouver un juste équilibre (épistémique et éthique) entre objectivité scientifique d’un côté, engagement moral et politique de l’autre? L’idée de « sciences impliquées » est-elle une forme de pensée oxymorique cachant un non-sens épistémologique? Ou bien, exprime-t-elle un besoin, une nécessité à la fois épistémique, éthique et politique qui nous permettrait de mieux cerner les innombrables et complexes enchevêtrements entre les sciences contemporaines et la société?[. This article is concerned not so much with school improvement issues per se as with the messages about school improvement provided by academic texts. School im­provement texts are important because they can be expected to reflect the current state of play of intellectual thinking about school improvement and because they also clearly have some impact on policy and practice, that is, to some extent they frame up school improvement issues for practitioners and policymakers. Yet academics holding socially critical perspectives have (...) sometimes been dismissive of school improvement and other education management texts because of their per­ception of a 'problem-solving' tendency which is socially and politically decon­ textualised. Thus when Jenny Ozga provided a review of education management texts in the British Journal of Sociology of Education in 1992 she didn't actually review any books because she didn't think they were worth it (Ozga, 1992). The Four-Colour Theorem (4CT) proof, presented to the mathematical community in a pair of papers by Appel and Haken in the late 1970's, provoked a series of philosophical debates. Many conceptual points of these disputes still require some elucidation. After a brief presentation of the main ideas of Appel and Haken’s procedure for the proof and a reconstruction of Thomas Tymoczko’s argument for the novelty of 4CT’s proof, we shall formulate some questions regarding the connections between the points (...) raised by Tymoczko and some Wittgensteinian topics in the philosophy of mathematics such as the importance of the surveyability as a criterion for distinguishing mathematical proofs from empirical experiments. Our aim is to show that the “characteristic Wittgensteinian invention” (Mühlhölzer 2006) – the strong distinction between proofs and experiments – can shed some light in the conceptual confusions surrounding the Four-Colour Theorem. In this enquiry I establish Universal Desire Theory as the nominal designation of my active ethical framework, a system heavily influenced by the natural essentialists Philippa Foot and Jenny Teichman, wherein the comparative amalgamation of all subjectively experienced biological harm and benefit is the foundation of objective normativity. Highlights of this paper include the sections where I discuss the moral life of the cell, as well as the moral fallibility of hallucinating persons under this system which combines biological observation (...) with conscious awareness of action. This article criticizes what I call "Raunchy" feminist art by employing discussions of pornography and objectification from Eaton and Nussbaum. Artists considered include Carolee Schneeman, Cindy Sherman, Lisa Yuskavage, and Jenny Saville. The article includes by citing examples of feminist art dealing with erotic material in a more productive manner: Eija-Liisa Ahtila, Kiki Smith, and Marlene Dumas.

Résumé : Les domaines de la philosophie et de la théorie politique ont connu un certain nombre de changements au cours des quarante dernières années. L'un attire notre attention tout particulièrement ; le basculement d'un point de vue national, cristallisé par le contrat social rawlsien, vers un point de vue non-national. En effet, plusieurs penseurs abordent un ensemble de phénomènes considérés comme nouveaux, tels que les traités de libre commerce et l'économie globale, les entreprises et les institutions supra et transnationales, (...) l'immigration et les contrôles frontaliers etc. Ces changements sont intéressants puisqu'ils obéissent, principalement, à une évolution majeure du terrain politique et social que l'on appelle mondialisation. Les théoriciens travaillant dans le domaine de la justice globale semblent s'adresser à deux questions différentes mais reliées. La première concerne la justice globale : dans quelle mesure et pourquoi l'ordre mondial est-il juste ou injuste ? Qu'est-ce qu'un ordre global juste ? La deuxième est dans un sens corollaire à la première, et concerne la responsabilité : qui devrait être blâmé ou digne d'éloge pour l'ordre mondial ? Est-ce que les citoyens sont responsables de l'ordre mondial ? Qui devrait redresser ses éventuelles conséquences injustes ? Face à l'économie mondialisée et aux institutions politiques et économiques internationales et trans-nationales, cette interrogation devient légitime et nécessaire : suis-je responsable à l'égard des travailleurs des sweat shop lorsque j'achète des habits à Auchan ou bien à l'égard des caféiculteurs très mal payés lorsque je prends un capuccino dans un café Starbucks ? Est-ce que les citoyens sont responsables des traités de libre commerce que leurs gouvernements signent ? Ces questions sur la responsabilité des individus dans le contexte de la mondialisation seront l'enjeu de ce travail de recherche. Nous interrogerons plus exactement la responsabilité d'un agent lorsqu'il fait partie d'un chaîne causale complexe, lorsqu'il participe d'une injustice structurelle. Ainsi, il ne s'agit pas seulement d'une chaîne causale, mais de connexions qui sont l'issue d'un changement des modes de productions, de consommation et de la concurrence dans un marché mondialisé. Plus important encore, il ne s'agit pas simplement de la responsabilité individuelle mais plutôt de la responsabilité individuelle en tant que citoyen, et donc d'une responsabilité politique. Elle peut certes être individuelle, mais nous devons tenir compte du fait qu'elle doit être pensée en tant que responsabilité politique, et pas uniquement morale, puisque l'individu et ses actions sont déterminés par des communautés politiques dans lesquelles il participe, ou dans lesquelles il est représenté. Ainsi, la mondialisation nous invite à repenser la responsabilité individuelle pour pouvoir rendre compte des intuitions morales et politiques qui guident une bonne partie du champ de la justice globale. Pour cela, nous verrons dans un premier temps la manière dont les théories de la justice globale essaient de répondre à ce défit. Grâce à cela nous dégagerons l'hypothèse qui nous guidera, l'idée que dans la mondialisation, un agent peut être responsable, avec d'autres, des raisons pour lesquelles il n'est pas considéré comme responsable. C'est-à-dire qu'il sera méta-responsable. Dans un second temps, nous essaierons de déterminer un model de responsabilité individuelle, et de comprendre comment la responsabilité est attribuée. Ensuite, nous essaierons de formuler une manière de concevoir la responsabilité politique. Grâce à ces deux éléments, la responsabilité individuelle et la responsabilité politique, nous pourrons parvenir à formuler une conception de la méta-responsabilité comme forme de penser l'agentivité traversée par la mondialisation. In this paper, I develop a quasi-transcendental argument to justify Kant’s infamous claim “man is evil by nature.” The cornerstone of my reconstruction lies in drawing a systematic distinction between the seemingly identical concepts of “evil disposition” (böseGesinnung) and “propensity to evil” (Hang zumBösen). The former, I argue, Kant reserves to describe the fundamental moral outlook of a single individual; the latter, the moral orientation of the whole species. Moreover, the appellative “evil” ranges over two different types of moral failure: (...) while an “evil disposition” is a failure to realize the good (i.e., to adopt the motive of duty as limiting condition for all one’s desires), an “evil propensity” is a failure to realize the highest good (i.e., to engage in the collective project of transforming the legal order into an ethical community). This correlation between units of moral analysis and types of obligation suggests a way to offer a deduction of the universal propensity on behalf of Kant. It consists in tracing the source of radical evil to the same subjective necessity that gives rise to the doctrine of the highest good. For, at the basis of Kant’s two doctrines lies the same natural dialectic between happiness and morality. While the highest good brings about the critically acceptable resolution of this dialectic, the propensity to evil perpetuates and aggravates it. Instead of connecting happiness and morality in an objective relation, the human will subordinatesmorality to the pursuit of happiness according to the subjective order of association. If this reading is correct, it would explain why prior attempts at a transcendental deduction have failed: interpreters have looked for the key to the deduction in the body of Kant’s text, where it is not to be found, for it is tucked, instead, in the Preface to the first edition. The attitudes P. F. Strawson dubs reactive are felt toward another (or oneself). They are thus at least in part affective reactions to what Strawson describes as qualities of will that people manifest toward others and themselves. The reactive attitudes are also interpersonal, relating persons to persons. But how do they relate persons? On the deontic, imperative view, they relate persons in second-personal authority and accountability relations. After addressing how best to understand the reactive attitudes as sentiments, I evaluate the (...) deontic imperative view. I argue that the modality of reactive attitudes is not invariably deontic nor is their mood invariably imperative. Certain reactive attitudes are aretaic, appellative sentiments that prescribe non-jural ideals of conduct or character. Although expansive, my resulting conception of the reactive attitudes escapes the charge of failing to distinguish reactive sentiments from “disengaged aesthetic reactions” to the beautiful and ugly in human action and character.
