Öz -/- Antikçağ’dan modern dönemlere değin kadınların mevcut durumlarının iyileştirilmesine dair çalışmaların sayısının oldukça yetersiz kaldığını söylemek yanlış olmayacaktır. Bu bağlamda siyaset felsefesinin kurucu metinlerinden olan Devlet’in hem yazıldığı dönem hem de takip eden iki milenyuma yakın süre hesaba katıldığında kadınların toplumdaki rolü ve konumu üzerine oldukça radikal ve yenilikçi fikirleri barındırdığı açıktır. Bu çalışmada Platon’un diğer çalışmaları da hesaba katılmakla birlikte özellikle Devlet adlı eseri nezdinde nasıl olup da kimi düşünürlerce hem bir mizojinist hem de bir kadın hakları savunucusu (...) sayıldığı; hem bir kadın düşmanı hem de proto-feminist olarak görülebildiği incelenecek ve Platon bu bağlamda yeniden ele alınacaktır. In this context, it seems that the Republic by Plato, which is one of the founding texts of political philosophy, has provided quite radical and innovative ideas about the role and position of women in society, considering into account both its production period and the next two millenniums. Kapitalist Toplum, Politika, Rasyonalite. -/- Rationality, Experience and Knowledge in the Age of Technology: Problems & Criticisms -/- Abstract -/- The question of how human potential is imprisoned in contemporary capitalism is one of the central topics of the analysis on social reality by every social theory which claims to be critical. This question which can be concretized as a systematic occupation with the cultural-technical forms which caused by contemporary capitalism and as an analysis of new types of social subjectivity which emerge as a result of these forms, essentially includes the effort to specify at what level and by using what kind of tools the current system grabs the individual by the throat. Frankfurt School tradition as one of the foremost traditions which conducts such an investigation, discusses the analysis of society over fragility of the bourgeois individual. -/- According to Frankfurt School, the individual in contemporary capitalism is extorted from bourgeois ideals and is out of breath as a result of blockade of overgrown structures in social context in which s/he lives. In other words, the bourgeois individual has been erased. In the late capitalist society where personal histories are melted away, technological progress is one of the processes that led to the deletion of the individual. The clearest expression of this emphasis finds correspondence in the introduction of Herbert Marcuse's One Dimensional Man. Marcuse proposes two opposite theses in this work which he examines advanced industrial societies: 1) Advanced industrial society have a structure that it can control the qualitative changes in predictable future, 2) However, trends and forces which can reverse this situation (which can break this limitation and destroy capitalist society) also exist. First one claims that relations of domination in the social structures are sustainable in the future; and the other thesis emphasizes that the opportunity of emancipation of people by getting free of these power relations is still possible. However, Marcuse does not dwell on too much on the latter (which is the claim about possibility of powers and trends that can change the current situation). Moreover it could be argued that his arguments relating to technological rationality and one-dimensionality draws us into the impossibility of attaining any moment of a positive social transformation. -/- The book is dominated by an atmosphere of immense feeling of being encircled and hopelessness, thus it follows from the work of Marcuse that in the system that we live in it is even impossible to breathe freely. Although in follow-up studies after the One Dimensional Man (especially in writings in which vitality of 68 movement and the axis of New Left), it can be observed that there is an attempt to convert despair into hope, it is clear that Marcuse’s designations regarding technological life mechanisms should be discussed again given the technological advancements of our times. Within this context, in the study, how the technology affects and furthermore determines the individuals and society as a whole in the modern industrial societies has been investigated. This investigation has been carried out through Herbert Marcuse's views on technology which are presented in his work One-Dimensional Man. The relationship between rationality, knowledge and experience has been examined on the basis of technology, and then Marcuse's concept of ‘technological rationality’ has been analysed in the context of Claus Offe's criticisms. -/- Finally, Marcuse's critique of technology has been assessed by considering the emerging social practices in this day and time. Herbert Marcuse refers to the rationality which is created by technology and is directly based on submissive efficiency, as ‘technological rationality’. Thinker argues that what is considered to be rational in a society is subject to change with technological developments, and social rationality is directly connected to the technological advancements. There are three different projections of technological rationality approach which are in turn ontological, epistemological and ethicalpolitical approaches. Claus Offe claims that it is possible to group these different dimensions under three theses. According to the first one; scientific rationality has become the organizational principle of domination. -/- According to Offe, in his second thesis Marcuse mentions the emergence of technology sui generis i.e. as a distinctive autonomous technological rationality. And the third thesis proceeds on the line of the argument that socialist societies are under the impact of technological rationality as well as capitalist societies. According to Offe, even though these three theses are consistent with each other, Marcuse has been violated the most fundamental principle of the Critical Theory by not offering any possibility of social transformation which are aimed at the problems of extensive manipulation and pacified existence that brought about by technological rationality. Hence although Marcuse's work is of utmost importance with regard to his analysis and the issues that he has covered, it would not be wrong to say that a problematic argument from the point of the tradition of Critical Theory has been proposed. The main reason for this is the argument which asserts that the technology turned into a mechanism of domination which is almost irreversible and unchangeable. Therefore, such mechanism does not offer any resistance point where human can take a breath. As a result of this, emancipation which is the main political purpose of the Critical Theory has been invalidated. What could be the problems which are created by the negative situation that results from Marcuse's thesis on technology? For instance, how could the basis for the existence of opposing movements which are organized over the internet or the foundations of anti-capitalist radical critique be explained on the axis of Marcuse’s thesis? -/- There is a fundamental problem that has to be solved: if we declare only the validity of oppressive, central and ideological functions of technological devices, then the idea which is referred by authoritarian governments that current opposing movements or rebel groups organized over internet might be organized from a centre which is defined as imperialist power or external power becomes an affirmable argument. In other words, does Marcuse's technological determinist approach serves to legitimize the discourses such as "foreign powers or imperialist enemies," and so on which authoritarian powers frequently resort to. Is it possible to think of another alternative with regard to the problems produced by this rationality apart from the negative comments that revealed by the concept of technological rationality. This study attempts to understand whether there were changes over time in Hegel’s opinions on the idea of recognition, which were the basis of Axel Honneth’s theory of recognition, and how later philosophers writing on recognition and intersubjectivity have comprehended Hegel’s intellectual heritage, together with their criticism of peculiar aspects of Hegel’s point of view. In this regard, in order to be able to understand Honneth’s theory of recognition, it is necessary to inquire into the relation between Honneth’s and Hegel’s (...) theories in a philosophical context. The current inquiry is both related to the aspects of how Honneth was affected by Hegel, and is also particularly focused on Hegel’s Jena period. The point of emphasis in this study is whether or not Hegel abandoned the theories of intersubjectivity and recognition after his Jena period. Therefore, the discussion focuses on Hegel’s Jena period and the aspects which distinguished this period from others. Abstract in English, German, French and Croatian -/- In the paper “The ‘Bubbling Up’ of Subterranean Politics in Europe”, which was published in 2013 in the Journal of Civil Society, Mary Kaldor and Sabine Selchow attempted to reveal the specific qualities of the uprisings which emerged after the year 2010 in some European countries, such as Germany, Spain, Italy, England etc. According to the authors, the mode of organization which forms the main body of these emancipatory movements obtains its basic (...) logic from the world of the Internet. The use of the Internet requires a re-evaluation of negative philosophical commentary regarding technology. In the context of twentieth-century philosophy, Martin Heidegger and Herbert Marcuse are the most influential philosophers who studied the negative aspects of technology. Heidegger portrayed the destructive effects of scientific reasoning and technology on the Western culture through the criticism of the traditional Western metaphysics on a phenomenological-ontological level. Marcuse, belonging to the tradition of Western Marxism, formed his critique of technology in the context of the concept of instrumental rationality and the critique of advanced industrial society and capitalism. Although the starting points of their perspectives on technology and the underlying purposes of their critiques of technology were different, it may be asserted that both have a rather negative and almost entirely pessimistic disposition towards technology. Heidegger’s and Marcuse’s criticisms of technology will be discussed in this context and the differences and similarities between these criticisms will be shown. Finally, the paper will emphasise the question of the possibility of a positive role of technology. Technology can serve as an alternative to negative uses by shedding light on the relation between the current uprisings and the Internet. Zusammenfassung In dem Artikel „The ‘Bubbling Up’ of Subterranean Politics in Europe”, veröffentlicht im Jahre 2013 im Journal of Civil Society, versuchten Mary Kaldor und Sabine Selchow die spezifischen Qualitäten der Aufstände zum Ausdruck zu bringen, die nach 2010 in den europäischen Ländern ausbrachen – Deutschland, Spanien, Italien, England usw. Nach Ansicht der Autoren erhält der Modus der Organisation, der den Hauptkörper dieser emanzipatorischen Bewegungen bildet, seine grundlegende Logik aus der Welt des Internets. Die Analogie mit dem Internet erfor- dert eine Neubewertung der negativen Kommentare über die Technologie aus philosophischer Perspektive. Martin Heidegger und Herbert Marcuse sind die einflussreichsten Philosophen, die sich mit den negativen Aspekten der Technologie in der Philosophie des 20. Jahrhunderts befasst haben. Heidegger schilderte die zerstörerischen Auswirkungen der wissenschaftlichen Vernunft und Technologie auf die westliche Kultur durch die Kritik an der traditionellen abend- ländischen Metaphysik auf der phänomenologisch-ontologischen Ebene, während Marcuse, ein Mitglied des westlichen Marxismus, seine Kritik an der Technologie im Rahmen des Konzepts der instrumentellen Rationalität und der Kritik der fortgeschrittenen Industriegesellschaft und Kapitalismus geformt hat. Obgleich die Ansatzpunkte ihrer Perspektiven über die Technologie und die zugrunde liegenden Zwecke ihrer Kritik an der Technologie unterschiedlich waren, kann behauptet werden, dass beide eine eher negative und fast völlig pessimistische Einstellung zur Technologie hatten. In diesem Zusammenhang werden Heideggers und Marcuses Kritiken an der Technologie diskutiert sowie Unterschiede und Ähnlichkeiten zwischen den beiden Kri- tiken aufgezeigt. Abschließend unterstreicht das Paper die Frage nach der Möglichkeit einer positiven Rolle für die Technologie, die als Alternative zur negativen Perspektive dienen kann, indem sie Licht in das Verhältnis zwischen aktuellen Aufständen und Internet bringt. Cette analogie avec l’internet requiert une réévaluation, à partir d’un point de vue philosophique, des commentaires négatifs sur la technologie. Martin Heidegger et Herbert Marcuse sont les philosophes les plus influents ayant travaillé sur les aspects négatifs de la technologie au sein de la philosophie du XXe siècle. Heidegger a dépeint les effets destructeurs de la raison scientifique et de la technologie de notre culture occidentale à travers son criticisme de la métaphysique traditionnelle occidentale à un niveau phénoménologico-ontologique, tandis que Marcuse, membre du « communisme occidentale », a formé une critique de la technologie au sein du concept de rationalité instrumentale et une critique de la société industrielle avancée et du capitalisme. Bien que le point de départ de leur perspective sur la technologie et que le but sous-jacent de leur critique diffèrent, il est possible d’affirmer que leur point commun est d’avoir posé un regard négatif et presque entièrement pessimiste sur la technologie. À cet égard, le criticisme d’Heidegger et de Marcuse vont être abordés afin d’en soulever les différences et les similarités. Analogija s Internetom zahtijeva ponovnu evaluaciju negativnih komentara o tehnici iz filozofske perspektive. Martin Heidegger i Herbert Marcuse najutjecajniji su filozofi 20. stoljeća koji su se bavili negativnim aspektima tehnike. Heidegger je prikazao destruktivne učinke znanstvene racionalnosti i tehnike na zapadnu kulturu kroz kritiku tradicionalne zapadne metafizike na fenomenološko-ontološkoj razini, dok je Marcuse, kao predstavnik zapadnoga marksizma, oblikovao svoju kritiku tehnike u kontekstu pojma instrumentalne racionalnosti te kritike razvijenog industrijskog društva i kapitalizma. Iako su polazišne točke njihovih pogleda na tehniku, kao i osnovne svrhe kritike tehnike, različite, može se reći da obojica imaju poprilično negativno i gotovo u potpunosti pesimističko shvaćanje tehnologije. U tom će se kontekstu razmotriti Heideggerova i Marcuseova kritika tehnike kao i razlike i sličnosti između tih dvaju pristupa. Zaključno će rad naglasiti mogućnost pozitivne uloge tehnike, koja može služiti kao alternativa negativnoj perspektivi osvjetljavajući odnos između nedavnih pobuna i interneta. This study sheds light on Gadamer’s hermeneutical thought by means of an analysis of the fundamental concept “image” (Bild). The central hypothesis of this study consists in regarding Gadamer’s philosophy as a defense of an holistic model for human sciences, which can be regarded in opposition to an atomistic model. Whereas atomism states that social phenomena should be reduced to singular actions, holism claims that there are substantial or ontological differences between individual and social phenomena or facts. Thus, the concept (...) of aesthetic image enables us to understand the way how the meaning of human experience is constituted holistically. Introdução: Hans Kelsen (1881-1973), juspositivista austríaco, e Herman Dooyeweerd (1894-1977), jusfilósofo neerlandês, foram pensadores contemporâneos que presenciaram o avanço do poder totalitário do Estado expresso por meio de normas jurídicas. Ambos se preocuparam em discutir sobre a relação entre Estado e direito, mas se afastaram na formulação de suas jusfilosofias: Kelsen defendeu uma concepção em que o Estado se tornou a personificação da ordem jurídica, Dooyeweerd distinguiu o direito da estrutura do Estado. Objetivo: analisar os comprometimentos teóricos e os problemas (...) político-jurídicos do pensamento de Hans Kelsen a partir da filosofia de Herman Dooyeweerd. Problemáticas: 1) A relação entre Estado e direito em Hans Kelsen é incapaz de proteger a sociedade civil e os indivíduos do poder do Estado, como afirmam os jusnaturalistas?; 2) Toda filosofia que postula princípios normativos limitadores à produção do direito é uma metafísica atemporal que resulta em uma concepção política antipluralista, como defende Hans Kelsen?. Hipóteses: 1) Jusnaturalistas estão corretos ao afirmarem que a Teoria Pura do Direito de Kelsen possibilita um ilimitado poder ao ente estatal face à sociedade civil, sendo incapaz de oferecer-lhe subsídios teóricos para sua proteção; 2) Kelsen não está certo ao entender que toda filosofia que postula princípios normativos limitadores à produção do direito é uma metafísica atemporal que resulta em uma concepção política antipluralista. Justificativas da pesquisa: 1) Analisa, a partir da crítica transcendental dooyeweerdiana, se os compromissos assumidos por Kelsen acerca da realidade o levaram a uma teoria reducionista capaz de tornar a sociedade desprotegida diante do poder do Estado; 2) Investiga se a teoria dooyeweerdiana tem capacidade de superar a tópica jusnaturalismo e juspositivismo. Resultados: 1) Como alegam os jusnaturalistas, a perspectiva política e jurídica de Kelsen, que reduz o direito ao aspecto lógico e delega as discussões de justiça ao âmbito político, não possibilita à sociedade uma proteção jurídica ao poder normativo do Estado; 2) A concepção político-jurídica dooyeweerdiana demonstra ser possível uma filosofia que encontra princípios limitadores à produção do direito na ordem da realidade e reconhece a pluralidadesocial devido à abertura da experiência histórica. Conclusão: sociedades democráticas profundamente polarizadas precisam descobrir normas objetivamente dispostas na realidade capazes de gerar consenso político e positivação legitimada, não por uma metafísica atemporal ou pela vontade impositiva de uma elite, mas pelo reconhecimento de que há uma ordem capaz de gerar mais benefícios para o bem comum. Studie pojednává o analýze a navrhovaném řešení problému „hodnotové neutrality" vědy německým kritickým racionalistou Hansem Albertem. Především Albert odmítá dvě vyhrocené pozice: novopozitivistickou ignoraci hodnotících soudů i jejich existencialistickou adoraci. Naopak se prostřednictvím takzvaných přemosťovacích principů snaží překlenout propast mezi poznáním na jedné straně a rozhodnutím na straně druhé. V návaznosti na Maxe Webera uznává princip hodnotové neutrality ve vědě, ovšem pouze v oblasti jejího objektového jazyka, neboť věda jako technologický systém výpovědí má pouze informativní, nikoli normativní charakter. To však (...) nevylučuje hodnocení v rovině předmětů věd a v rovině hodnotové báze věd. Dále se tato studie věnuje otázce hodnoty vědy o sobě a nakonec krátkému seznámení s Albertovým pojetím kritického racionalismu jako návrhu „způsobu života". (shrink)

A teoria do Direito internacional de Kelsen é monista, ou seja, o autor reúne a legislação nacional e internacional em um único sistema normativo. Com isso, descarta o dualismo e promove uma tese fundada no princípio lógico da não-contradição, traduzido juridicamente para o princípio da imputação. Por essa afirmação, o Direito internacional, considerando o primado estadual, existe a partir do reconhecimento interno da validade da legislação externa; mais, a recepção dos acordos internacionais na legislação nacional acopla internamente o Direito internacional, (...) com seus tratados bi/multilaterais, pactos, instituições, costumes e tribunais. A teoria de Kelsen torna-se complexa, porém, quando, indagando o inverso dessa premissa, o Direito internacional posto e eficaz, já inserido internamente, não reconhece a validade normativa de eventual interpretação ou norma interna e atua como agente determinante da ordem jurídica nacional. Com isso, o Direito externo torna-se decisivo desse mesmo sistema jurídico interno, não necessariamente por uma ação coercitiva, mas por intermédio do seu reconhecimento da validade da legislação interna. Vimos esse fenômeno materializar-se no caso dos dois presidentes simultâneos da Venezuela: tanto o presidente Nicolás Maduro, quando o presidente Juan Guaidó, foram formalmente designados, por países e instituições distintas, como governantes válidos. Sendo assim, o objetivo do livro consiste em compreender esse fenômeno de reconhecimento externo dos sistemas normativos nacionais através da segunda edição da Teoria de pura do Direito como marco teórico. Igualmente, utiliza-se do estudo de caso sobre a determinação do presidente válido da Venezuela como elemento empírico e de falseabilidade. Com isso, defende a hipótese da necessidade do reconhecimento normativo-objetivo do Estado a partir da formação do Direito internacional, independentemente de seu primitivismo. Os quatro primeiros capítulos, na primeira seção, estabelecem uma interpretação sobre a obra de Kelsen, focada em seu aspecto internacionalista. Nos quatro últimos, na seção II, submeto as conclusões teóricas ao caso concreto, falseando-as ou não conforme seu teste empírico. (shrink)

Pretende-se aqui apresentar as limitações que Jonas detectou nas éticas tradicionais (judaico-cristã, kantiana, por exemplo) e analisar as soluções por ele propostas (notadamente heurística do medo e futurologia comparada). Compreender também a fundamentação de tais soluções (...) (um dos maiores desafios da ética jonasiana). A pesquisa baseou-se em uma revisão bibliográfica que envolve a fonte primária, a obra de Jonas, e fontes secundárias. Constatou-se que a ética de Jonas surge da detecção de um niilismo tanto prático quanto teórico que permitiu um avanço desenfreado da técnica. É necessário então submeter a atividade humana à ética novamente. Para tanto foi utilizada uma ontologia que atribui relevância ética ao metabolismo (e não à razão). Deste modo, a ética da responsabilidade objetiva combater o niilismo e o ceticismo moral e supervisionar o progresso técnico, garantindo assim a existência de uma vida humana autêntica e de uma natureza que tem a si própria como fim. O artigo analisa a leitura crítica de Hans Kelsen acerca da concepção jurídico-política de Thomas Hobbes, considerando críticas posteriores à própria interpretação de Kelsen. Para tanto, investigou-se primeiramente a posição de Kelsen sobre o jusnaturalismo buscando esclarecer conceitos centrais como os do ser e dever-ser e como o autor os associa a Hobbes. Nesse sentido, observouse a limitação da leitura de Kelsen em relação à filosofia jurídica do autor – uma doutrina jusnaturalista metafísica, tendo na regra de ouro o fundamento (...) natural para o direito positivo. Em contraposição, procurou-se apresentar uma postura crítica, que contesta a posição jusnaturalista atribuída a Hobbes e sustenta a tese de que o autor inglês é um precursor do positivismo jurídico. A presente dissertação tem como tema central a proposta da abordagem hermenêutica da decisão judicial em Hans Kelsen considerando seu relativismo filosófico. No primeiro momento expõe a concepção de decisão judicial no autor e as suas reformulações conceituais no decorrer das suas obras – as passagens do formalismo normativista das primeiras obras até o ceticismo de regras na Teoria geral das normas. Também propõe a dissolução entre as leituras formalistas e realistas através da possibilidade de uma leitura realista moderada. Após (...) expõe a filosofia relativista do autor e seu resultado na exclusão dos elementos da moralidade do conceito de direito. Finalmente deduz regras de interpretação a partir de uma visão abrangente das obras do autor. O objetivo da dissertação, nesse sentido, é analisar a dinâmica da criação normativa pelo judiciário, a discricionariedade daí resultante e a possibilidade de interpretar os vários sentidos das normas sem recorrer a qualquer moralismo para tal. A separação entre o ser, isto é, o ato, e o dever-ser, ou seja, o sentido de comando, permissão etc.. do ato é parte fundamental para o entendimento da epistemologia proposta por Hans Kelsen. Dessa discriminação entre o ser e o dever-ser há o principal argumento do autor para a separação do direito das ciências causais e, principalmente, a superação da falácia naturalista no âmbito teórico e moral. Nesse sentido, também o artigo se propôs a analisar a refutação de Kelsen (...) a doutrinas morais e jurídicas negadoras de tal distinção e, consequentemente o reflexo de tal posicionamento na perspectiva da responsabilidade. Hans-Georg Gadamer é reconhecido como um dos mais importantes filósofos do famoso linguistic turn. Malgrado a aparente recepção de seus debates filosóficos no campo da hermenêutica jurídica e, mais recentemente, da ética do direito, o seu conceito de direito ou, mais precisamente, os fundamentos de uma possível filosofia do direito gadameriana nunca foram submetidos a uma investigação jusfilosófica mais detalhada. Em parte porque a maioria dos comentadores da obra de Gadamer continua a ler seus escritos com uma forte referência às (...) categorias ontológicas da sua obra magna, Verdade e Método. Neste ensaio, entretanto, propõe-se o estudo de alguns conceitos fundamentais da obra de Gadamer, em especial, os desenvolvidos em seus escritos posteriores, a fim de proporcionar uma visão mais adequada acerca dos fins, estrutura e fundamentos da sua ideia de direito. A tese principal deste estudo consiste em apresentar uma das possíveis interpretações do conceito aristotélico de phronesis como a principal fonte da contribuição de Gadamer para a filosofia prática e, por conseguinte, para o direito. Como consequência, será possível esclarecer, de forma não ontológica, os pontos básicos do projeto ético proposto por Gadamer e a fricção praxis-theoria presente no seu conceito de direito. (shrink)

WhatsApp: (82)9.8143-8399. -/- PREMISSA -/- Na Alemanha, a Sociologia foi profundamente influenciada pela discussão filosófica, histórica e metodológica que se desenvolveu entre o final do século XIX e o início do século XX. Em seus fundamentos encontra-se (...) o pensamento de vários filósofos, como Johann Gottlieb Fichte (1762 -1814), Friedrich Wilhelm Joseph von Schelling (1775 -1854), Friedrich Daniel Ernst Schleiermacher (1768 -1834), Georg Wilhelm Friedrich Hegel (1770 -1831) e Friedrich W. Nietzsche (1844-1900). -/- O representante mais expressivo da Sociologia alemã é Max Weber (1864-1920). Outros pensadores, entretanto, contribuíram significativamente para a formação e o desenvolvimento da Sociologia na Alemanha, entre os quais Ferdinand Tönnies (1855 -1936), Werner Sombart (1863-1941), Georg Simmel (1858-1918) e os estudiosos que a partir da década de 1920 constituíram a chamada Escola de Frankfurt. -/- A obra desses autores liga-se fortemente ao processo de unificação alemã, promovido somente após o triunfo de Otto von Bismarck na Guerra Franco-Prussiana (1871), e à aceleração da industrialização alemã. Esses dois fatores conferiram à Alemanha uma situação muito diferente da de outros países europeus. -/- A alteração nas estruturas de poder, na Alemanha, não ocorreu por meio de uma revolução, como na França, mas por um acordo entre a bur-guesia industrial e os grandes proprietários de terra, tendo em vista uma transição mais adequada aos seus interesses. -/- Vale salientar, em nota, que após a Guerra Franco-Prussiana (1870-71), os príncipes alemães se reuniram no palácio de Versalhes (França), onde aclamaram Guilherme I, da Prússia, como o imperador alemão. Assim surgia o Império da Alemanha, em 1871. -/- A burguesia industrial não estava preocupada em alterar de modo significativo a estrutura fundiária, e os grandes proprietários, que se encastelaram na burocracia estatal, não permitiram a formulação de uma legislação trabalhista que prejudicasse os interesses da burguesia. Assim se fez uma mudança “por cima”, sem levar em conta os interesses dos trabalhadores urbanos ou rurais. Destacam-se aqui dois importantes soció-logos alemães: Georg Simmel e Max Weber, pela presença no Brasil. Depois, brevemente, falar-se-á aqui da famosa Escola de Frankfurt. -/- 1. Georg Simmel (1858-1918) -/- Nascido em Berlim, Georg Simmel é um pensador difícil de enquadrar em alguma tendência ou campo específico do conhecimento. Vamos ler um trecho do que escreveu sobre ele o sociólogo brasileiro Leopoldo Waizbort: -/- Quem tentar esboçar a fisionomia de Georg Simmel (1858-1918), logo se encontra em meio a dificuldades que são características próprias daquilo que se quer apreender. Simmel sempre postulou para seu próprio pensamento uma mobilidade e uma plasticidade para se adaptar ao seu objeto – uma multiplicidade de direções, uma defesa do fragmento –, que se opõem a toda tentativa de fixação e acabamento, a toda pretensão de sistema. Por isso todos os rótulos que lhe são atribuídos, apesar de possuírem seu teor de verdade, sempre soam tão falsos: vitalismo, relativismo, esteticismo, formalismo, irracionalismo, psicologismo, impressionismo e tantos mais. Disto também é exemplo o fato de Simmel, hoje considerado, ao lado de Max Weber e Ferdinand Tönnies, um dos “pais” da sociologia alemã, não poder ser classificado sem mais como “sociólogo”, sob pena de se perderem várias outras dimensões que são essenciais ao seu pensamento (WAIZBORT, 2000. p. 11). -/- G. Simmel foi o último dos sete filhos de um próspero comerciante judeu convertido ao cristianismo. Com a morte do pai, herdou uma fortuna considerável que lhe permitiu independência para desenvolver a vida acadêmica. Estudou História e Filosofia na Universidade de Berlim, onde foi aluno das mais importantes figuras acadêmicas da época. Em 1881, defendeu uma tese sobre Immanuel Kant e recebeu o título de doutor em Filosofia. Entre 1885 e 1914, lecionou Filosofia, Ética e Sociologia na Universidade de Berlim, mas nunca foi incorporado formalmente à universidade. -/- Ocupou o cargo de professor titular de Filosofia somente em 1914, em Estrasburgo, cidade onde permaneceu até a morte, em 1918. -/- Na virada do século XIX para o século XX na Alemanha, houve uma intensa efervescência filosófica, cultural e artística, cenário em que se desenvolveram a psicanálise, a teoria da relatividade, o positivismo lógico e a música atonal. Nesse cenário, Simmel tornou-se um conferencista muito aclamado e escreveu artigos e ensaios sobre os mais variados temas da Filosofia, como lógica, teoria do conhecimento, ética, estética ou metafísica, além de temas da Psicologia, da Sociologia, da História e da religião. -/- Escreveu também muitas biografias (de Johann Wolfgang von Goethe, de Friedrich Nietzsche, de Immanuel Kant e de Rembrandt, entre outros). -/- Suas obras sociológicas mais importantes são: Da diferenciação social (1890), A filosofia do dinheiro (1907), Sociologia (1908) e Questões fundamentais da Sociologia (1917). Georg Simmel teve influência marcante no desenvolvimento da Sociologia na Alemanha, nos Estados Unidos (em especial na Escola de Chicago) e na França (em Durkheim e seus colaboradores diretos). Suas obras foram traduzidas para o francês e o inglês, muitas vezes antes de ser publicadas em alemão. -/- 2. Max Weber (1864-1920) -/- Max Weber nasceu em 21 de abril de 1864, em Erfurt, e morreu em Munique, em 1920. De família abastada, teve uma educação formal de boa qualidade, o que lhe permitiu uma erudição notável. Com 18 anos, ingressou na Universidade de Heidelberg, onde escolheu como área de concentração o Direito e como correlatas a História, a Filosofia e a Economia. Nessa universidade, teve o primeiro contato com os escritos de Immanuel Kant e com neokantianos, os quais nunca deixou de lado em seus estudos. -/- Em 1889, concluiu o doutorado em Direito Comercial com uma tese sobre a história das sociedades comerciais da Idade Média. Em 1891, defendeu outra tese: A importância da história agrária romana para o direito público e privado. Em 1894, tornou-se professor de Economia na Universidade de Freiburg e, dois anos depois, transferiu-se para a Universidade de Heidelberg. -/- A partir de 1897, acometido de uma depressão profunda, não conseguiu desenvolver as atividades acadêmicas. Entre 1902 e 1903, retomou as atividades intelectuais, mas fora da universidade, pois não tinha condições psicológicas para ministrar aulas. No ano seguinte, tornou-se coeditor do Arquivo de Ciências Sociais, publicação muito importante para o desenvolvimento dos estudos sociológicos na Alemanha. -/- Entre agosto e dezembro de 1904, viajou, com Ferdinand Tönnies e Werner Sombart, aos Estados Unidos, por ocasião da Exposição Universal de Saint-Louis, onde entrou em contato com as igrejas e seitas protestantes daquele país e também com vários escritos de Benjamin Franklin (1706-1790), o que foi fundamental para suas pesquisas sobre a relação entre a ética protestante e o capitalismo. -/- Em 1907, recebeu uma herança significativa. A partir de então, dedicou-se exclusivamente à investigação histórica e sociológica. Em 1909, colaborou na fundação da Sociedade Alemã de Sociologia. Ao ser deflagrada a Primeira Guerra Mundial, em 1914, Weber foi convocado como oficial da reserva para dirigir um hospital militar. Entre as atividades no hospital encontrou tempo para continuar a escrever partes do livro que foi publicado postumamente por sua esposa, com o título Economia e sociedade. Além disso, desenvolveu estudos sobre ética econômica e as religiões universais e escreveu uma série de artigos para os grandes jornais da Alemanha. Nesses artigos, criticou a estrutura partidária do país e a burocratização das esferas políticas na Alemanha, afirmando que aquela situação ainda era a herança de Otto von Bismarck. -/- Em 1917, pronunciou uma conferência – A ciência como vocação – e produziu um escrito, no qual explicitou seu método – Ensaio sobre neutralidade axiológica nas ciências sociológicas e econômicas. -/- Pelas ideias expostas em debates e nos jornais e por sua erudição, Max Weber, após a derrota alemã na Primeira Guerra Mundial, fez parte da comissão que redigiu, em 1919, a nova constituição política alemã, conhecida como a Constituição de Weimar. -/- Pode-se afirmar que a vida de Max Weber foi dedicada aos estudos, à pesquisa e à participação ativa na política alemã de seu tempo, por meio de conferências e artigos para jornais e revistas. -/- Weber não media esforços para analisar e com-preender mais profundamente os temas que elegia. Aprendeu grego e hebraico para ler a Bíblia no original, espanhol para ler os documentos sobre as companhias de navegação e comércio espanhol, russo para ler os jornais sobre os acontecimentos na Rússia de 1905 até a revolução de 1917, inglês para ler os textos estadunidenses sobre a vida religiosa e a ética dos protestantes. -/- Para Max Weber, o indivíduo é o núcleo de análise por ser o único que pode definir intenções e finalidades para seus atos. Desse modo, o ponto de partida da Sociologia é a compreensão da ação dos indivíduos, atuando e vivenciando situações sociais com determinadas motivações e intenções. Instituições como Estado e família só ganham sentido quando vistas da perspectiva das relações sociais. Assim, Max Weber não concebe a sociedade como um bloco, uma estrutura una, mas como uma teia de relações capazes de produzir sentido. -/- A obra de Max Weber é vasta e engloba história, direito e economia, passando pelas questões religiosas, pelos processos burocráticos, pela análise da cidade, da música e, enfim, pela discussão metodológica das ciências humanas e dos conceitos sociológicos. -/- Entre os seus escritos, podemos destacar: A ética protestante e o “espírito” do capitalismo (1904-1905/1920), A ciência como vocação (1917), A política como vocação (1919), Economia e sociedade (1920), História geral da economia (1923) e Ensaios reunidos de sociologia da religião (1917/1920). -/- Outros sociólogos alemães mantiveram-se em atividade após a Primeira Guerra Mundial, como Ferdinand Tönnies, Leopold von Wiese (1876 -1969), Hans Freyer (1887-1969) e Franz Oppenheimer (1864 -1943), que fundou, em 1919, a primeira cátedra de Sociologia na Alemanha, em Frankfurt. -/- 3. A Escola de Frankfurt -/- Logo após a morte de Max Weber, abriu-se um novo horizonte para a Sociologia alemã com a fundação do Instituto de Pesquisa Social, vinculado à Universidade Johann Wolfgang Goethe de Frankfurt, que ficou conhecido como Escola de Frankfurt. Em 1923, um grupo de intelectuais – entre eles Friedrich Pollok (1894-1970), Leo Löwenthal (1900-1993), Karl August Wittfogel (1896-1988), Max Horkheimer (1895-1973) e Theodor Adorno (1903-1969) – desenvolveu uma análise da sociedade contemporânea com base em concepções filosóficas de Immanuel Kant, Friedrich Hegel e Friedrich Nietzsche, em visões sociológicas de Karl Marx e de Max Weber e no pensamento de Sigmund Freud. -/- Os integrantes do grupo de Frankfurt pretendiam desenvolver uma teoria crítica da sociedade capitalista e buscavam explicar fenômenos que iam da análise da personalidade autoritária à indústria cultural. Mantiveram a crítica ao positivismo e ao pragmatismo, procurando demonstrar a necessida-de de refletir sobre as condições que permitiram a emergência do nazismo e sobre o significado dessa ideologia. As reflexões desses intelectuais culminaram com uma crítica à razão instrumental e às formas de controle sobre a sociedade contemporânea. -/- Além dos estudiosos citados, são representantes desse pensamento Walter Benjamin (1892-1940), Erich Fromm (1900-1980) e Herbert Marcuse (1898-1979), entre outros. Todos os integrantes da Escola de Frankfurt precisaram sair da Alema-nha por causa da perseguição nazista. Adorno e Horkheimer voltaram ao país depois do fim da Segunda Guerra Mundial. Este artigo constitui uma reflexão acerca desta central e controversa afirmação contida na terceira parte de Verdade e Método segundo a qual "ser que pode ser compreendido é linguagem". Depois de apresentar uma tríplice leitura dessa mesma afirmação, concretamente na sua dimensão platónica, kantiana, e hegeliana, o artigo procura sobretudo desenvolver uma leitura ontológica da mesma. É assim que, partindo dessa tríplice leitura, o presente trabalho intenta justificar e fundamentar a Ontologia hermenêutica de Gadamer, a qual considera ser, para além (...) de diferente, mais autêntica que a Onto-teologia aristotélica e a Ontologia fundamental heideggeriana. Dessa forma, o artigo intenta fazer, a partir da obra de Hans-Georg Gadamer, uma descrição da Hermenêutica filosófica a partir da afirmação segundo a qual "ser que pode ser compreendido é linguagem". /// Aim of the present article is to reflect upon this central and controversial statement, taken from the third part of Truth and Method, according to which "being that can be unterstood is language". After presenting three possible readings of the above mentioned statement, namely the Platonic, the Kantian, and the Hegelian, the article proceeds to develop an onto logical reading of the same passage. Thus, on the basis of these readings, the article both justifies and grounds the gadamerian hermeneutical ontology, which it considers as being different from and more authentic than both the Aristotelian onto-theology and the Heideggerian fundamental ontology. The paper, finally, describes how the notion of philosophical Hermeneutics, as it is found in the work of Hans-Georg Gadamer, is summarized in the affirmation according to which "being that can be unterstood is language". Gottlob Frege abandoned his logicist program after Bertrand Russell had discovered that some assumptions of Frege’s system lead to contradiction (so called Russell’s paradox). Nevertheless, he proposed a new attempt for the foundations of mathematics in two last years of his life. According to this new program, the whole of mathematics is based on the geometrical source of knowledge. By the geometrical source of cognition Frege meant intuition which is the source of an infinite number of objects in arithmetic. In (...) this article, I describe this final attempt of Frege to provide the foundations of mathematics. Furthermore, I compare Frege’s views of intuition from The Foundations of Arithmetic (and his later views) with the Kantian conception of pure intuition as the source of geometrical axioms. In the conclusion of the essay, I examine some implications for the debate between Hans Sluga and Michael Dummett concerning the realistic and idealistic interpretations of Frege’s philosophy. 1.Summary The key terms. 1. Key term: ‘Sunyata’. Nagarjuna is known in the history of Buddhism mainly by his keyword ‘sunyata’. This word is translated into English by the word ‘emptiness’. The translation and the traditional interpretations create the impression that Nagarjuna declares the objects as empty or illusionary or not real or not existing. What is the assertion and concrete statement made by this interpretation? That nothing can be found, that there is nothing, that nothing exists? Was Nagarjuna denying (...) the external world? Did he wish to refute that which evidently is? Did he want to call into question the world in which we live? Did he wish to deny the presence of things that somehow arise? My first point is the refutation of this traditional translation and interpretation. 2. Key terms: ‘Dependence’ or ‘relational view’. My second point consists in a transcription of the keyword of ‘sunyata’ by the word ‘dependence’. This is something that Nagarjuna himself has done. Now Nagarjuna’s central view can be named ‘dependence of things’. Nagarjuna is not looking for a material or immaterial object which can be declared as a fundamental reality of this world. His fundamental reality is not an object. It is a relation between objects. This is a relational view of reality. This is the heart of Nagarjuna’s ideas. In the 19th century a more or less unknown Italian philosopher, Vincenzo Goberti, spoke about relations as the mean and as bonds between things. Later, in quantum physics and in the philosophy of Alfred North Whitehead we are talking about interactions and entanglements. These ideas of relatedness or connections or entanglements in Eastern and Western modes of thought are the main idea of this essay. Not all entanglements are known. Just two examples: the nature of quantum entanglements is not known. Quantum entanglements should be faster than light. That's why Albert Einstein had some doubts. A second example: the completely unknown connections between the mind and the brain. Other examples are mysterious like the connections between birds in a flock. Some are a little known like gravitational forces. 3. Key terms: ‘Arm in arm’. But Nagarjuna did not stop there. He was not content to repeat this discovery of relational reality. He went on one step further indicating that what is happening between two things. He gave indications to the space between two things. He realized that not the behaviour of bodies, but the behaviour of something between them may be essential for understanding the reality. This open space is not at all empty. It is full of energy. The open space is the middle between things. Things are going arm in arm. The middle might be considered as a force that bounds men to the world and it might be seen as well as a force of liberation. It might be seen as a bondage to the infinite space. 4. Key term: Philosophy. Nagarjuna, we are told, was a Buddhist philosopher. This statement is not wrong when we take the notion ‘philosophy’ in a deep sense as a love to wisdom, not as wisdom itself. Philosophy is a way to wisdom. Where this way has an end wisdom begins and philosophy is no more necessary. A.N. Whitehead gives philosophy the commission of descriptive generalization. We do not need necessarily a philosophical building of universal dimensions. Some steps of descriptive generalization might be enough in order to see and understand reality. There is another criterion of Nagarjuna’s philosophy. Not his keywords ‘sunyata’ and ‘pratityasamutpada’ but his 25 philosophical examples are the heart of his philosophy. His examples are images. They do not speak to rational and conceptual understanding. They speak to our eyes. Images, metaphors, allegories or symbolic examples have a freshness which rational ideas do not possess. Buddhist dharma and philosophy is a philosophy of allegories. This kind of philosophy is not completely new and unknown to European philosophy. Since Plato’s allegory of the cave it is already a little known. (Plato 424 – 348 Befor Current Era) The German philosopher Hans Blumenberg has underlined the importance of metaphors in European philosophy. 5. Key terms: Quantum Physics. Why quantum physics? European modes of thought had no idea of the space between two this. They were bound to the ideas of substance or subject, two main metaphysical traditions of European philosophical history, two main principles. These substances and these subjects are two immaterial bodies which were considered by traditional European metaphysics as lying, as a sort of core, inside the objects or underlying the empirical reality of our world. The first European scientist who saw with his inner eye the forces between two things had been Michael Faraday (1791-1867). Faraday was an English scientist who contributed to the fields of electromagnetism. Later physicists like Albert Einstein, Niels Bohr, Erwin Schrödinger, Werner Heisenberg and others followed his view in modern physics. This is a fifth point of my work. I compare Nagarjuna with European scientific modes of thought for a better understanding of Asia. I do not compare Nagarjuna with European philosophers like Hegel, Heidegger, Wittgenstein. The principles and metaphysical foundations of physical sciences are more representative for European modes of thought than the ideas of Hegel, Heidegger and Wittgenstein and they are more precise. And slowly we are beginning to understand these principles. Let me take as an example the interpretation of quantum entanglement by the British mathematician Roger Penrose. Penrose discusses in the year of 2000 the experiences of quantum entanglement where light is separated over a distance of 100 kilometers and still remains connected in an unknown way. These are well known experiments in the last 30 years. Very strange for European modes of thought. The light should be either separated or connected. That is the expectation most European modes of thought tell us. Aristotle had been the first. Aristotle (384 - 322 Before Current Era) was a Greek philosopher, a student of Plato and a teacher of Alexander the Great. He told us the following principle as a metaphysical foundation: Either a situation exists or not. There is not a third possibility. Now listen to Roger Penrose: “Quantum entanglement is a very strange type of thing. It is somewhere between objects being separate and being in communication with each other” (Roger Penrose, The Large, the Small and the Human Mind, Cambridge University Press. 2000 page 66). This sentence of Roger Penrose is a first step of a philosophical generalization in a Whiteheadian sense. 6. Relativamente difundida na teoria democrática contemporânea, a dicotomia entre democracia epistêmica e democracia agonística é endossada por autores como Luis Felipe Miguel, Chantal Mouffe e Nadia Urbinati. De acordo com eles, a ideia de que a deliberação democrática possa funcionar como uma troca de argumentos racionais que visa à verdade é incompatível com o reconhecimento do conflito como um componente basilar da política. Tudo se passa, pois, como se a abordagem epistêmica estivesse fadada a obliterar a dimensão agonística da política. (...) A fim de problematizar semelhante entendimento, este artigo reconstrói a associação entre democracia e compromisso feita por John Stuart Mill, John Morley e Hans Kelsen e conclui que a conceitualização da democracia como compromisso oferece uma alternativa à dicotomia democracia epistêmica vs. democracia agonística. Ugledni mislitelji hermeneutičke filozofije Wilhelm Dilthey i Hans-Georg Gadamer okarakterizirali su Matiju Vlačića Ilirika kao klasika hermeneutičkog pristupa filozofiji. Taj sud dodatno dobiva na snazi jer su Dilthey i Gadamer okarakterizirani kao pristaše relativističke hermeneutike, dok je Vlačić inzistirao na adekvatnom razumijevanju i interpretiranju teksta. Uzevši u obzir da je za Vlačića ključno pravilo bilo da tekst treba tumačiti sukladno njegovu imanentnom smislu, razradio je dvije interpretacijske maksime, skop i hermeneutički krug, presudne za daljnji razvoj i konstituiranje hermeneutike kao metode (...) razumijevanja, dok ga se po našemu sudu istodobno može smatrati i anticipatorom načela blagonaklonosti. Za objašnjenje složenog hermeneutičkog odnosa cjeline i dijelova teksta, Vlačić je kombinirao induktivno-sintetičku i deduktivnu metodu. Taj odnos predstavlja zahtjevan proces provedbe hermeneutičkog kruga u kojem je na djelu primjena modela koherentnosti istine u heurističkom postupku razumijevanja. Drugim riječima, radi se o postupnoj rekonstrukciji smisla teksta. Tijekom tog eksplanativnoga procesa postaje razvidno da je značenje pojedinih dijelova i manjih tematskih cjelina razumljivo tek iz strukture i kompozicije cjeline teksta i da postupna induktivno-sintetička rekonstrukcija smisla teksta pretpostavlja primjenu deduktivne analize. Nadalje, u heurističkom procesu iščitavanja teksta nužno je provjeriti kako se konzistentnost pojedinih odlomaka i cjelina teksta koherentno uklapa u širu cjelinu, a interpretacijske maksime, skop i hermeneutički krug, pritom se ispostavljaju kao pouzdan organon u heurističkom procesu razumijevanja i objašnjenja teksta. U tom kontekstu je Vlačićev hermeneutički zahtjev za adekvatnom rekonstrukcijom smisla usporediv s načelom blagonaklonosti kako ga razumijeva Donald Davidson, postavljajući ga kao jedan od osnovnih pojmova svoje filozofije. Naime, Vlačić polazi od pretpostavke razložnosti govora i argumentacije, što podrazumijeva mogućnost hermeneutičke rekonstrukcije teksta i njegovog adekvatnog razumijevanja. Davidson je također, pomoću teorije triangulacije, pokušao pokazati kako objektivni svijet u jeziku komunikacije postaje intersubjektivni svijet razumijevanja i uvažavanja, čime zapravo želi pokazati da je naše razumijevanje izvanjskog svijeta uvjetovano zajedničkim sustavom znanja i modelom komuniciranja koji nikada ne može imati individualistička obilježja jer, jednostavno, participiramo u zajedničkom svijetu. Davidsonov koncept triangulacije na novi način je obilježio model hermeneutičke čestitosti koji je već zagovarao predstavnik prosvjetiteljske hermeneutike Georg Friedrich Meier. S obzirom na to da se problem antirealističkog pristupa ne može riješiti pozivanjem na kruti hermeneutički realizam ili objektivizam, ono što tekstom želimo pokazati jest da bi hermeneutiku, za razliku od npr. Rortyja, trebalo shvatiti kao interpretacijski konsenzus struke koji je uspostavljen u okvirima akademske zajednice. To je u skladu sa stavovima Paula Lorenzena, koje je u, pogledu akademskog konsenzusa s obzirom na interpretativnost, slijedio i Jürgen Habermas u izradi svoje teorije komunikativnog djelovanja. A tese defende o antiplatonismo presente na obra do jusfilósofo Hans Kelsen como núcleo argumentativo da sua teoria do direito. Sustenta que a melhor definição da sua filosofia não é como neokantiana, mas como antiplatônica. Isso porque há significativas inconsistências na sua interpretação de Kant, o que a impossibilita de ser classificada como tal. Além, encontra-se na sua leitura sobre Platão referências mais sólidas e conceitos mais claros. Nesse sentido, advoga a hipótese de que a obra de Kelsen tem como (...) constante e como chave de entendimento a sua objeção e contestação às teses de Platão, sobretudo a questão da separação entre alma e corpo, isto é, forma e matéria. O primeiro e segundo capítulos defendem a hipótese da inconsistência das teses de Kelsen sobre Kant. Entende que a sua pressuposição de contradição entre a razão pura e a razão prática, assim como a ideia de uma contradição entre ser e dever-ser, não se sustenta considerando as próprias obras de Kant e a literatura especializada sobre o autor. No segundo capítulo apresenta a sua leitura sobre Platão, concentrada na obra A Ilusão da justiça (Dei Illusion der Gerechtigkeit). O quarto capítulo expõe, sopesando seu antiplatonismo, as duas principais referências teóricas para Kelsen a par de Kant, isto é, as teorias de David Hume e Sigmund Freud. O quinto capítulo demonstra como o antiplatonismo de Kelsen articula com os principais conceitos de suas teses, isto é, mostra que mesmo refutando a classificação do autor como neokantiano, conceitos como norma fundamental, liberdade, o monismo entre direito e Estado, monismo entre direito internacional e nacional e o problema da decisão judicial possuem justificativa e base filosófica coerente. Finalmente, conclui com a possiblidade da ideia de uma teoria kelseniana do direito desvinculada do neokantismo e fundada sobre os pressupostos céticos humeanos e freudianos, tanto moral, quanto teórico, ou seja, reconhece a unidade das obras do autor, desde que condicionada a sua interpretação como antiplatônica. I min artikel ”Att förstå – betraktelser utifrån en ny teori” (FT 31:4 Nov 2010) vill jag visa att det finns anledning att förtydliga förståelsebegreppet. Avsevärd möda har, historiskt sett, lagts ned på att definiera och bringa klarhet i begreppen kunskap och förklaring men förståelse, som når längre än vanlig kunskap, har förblivit ett otydligt begrepp. Teorin jag lägger fram i artikeln har som sin kärna en definition av förståelse. Denna utkristalliseras dels naturligt från vår vardagliga användning, dels från behovet (...) av att tydligt visa på vilket sätt förståelse är den djupaste formen av kunskap, av medveten insikt. Först när förståelsebegreppet utgör ett väl format verktyg kan kunskapsteorin nå sin fulla potential. Jag är tacksam gentemot Anders Tolland för att ha kritiskt granskat artikeln och för att han ger mig möjlighet att uttrycka teorin klarare. Tollands kritik berör främst oklarheter avseende innehållet i de abstraktioner som, tillsammans med jämförelser, är centrala element i teorin. Tolland bidrar också till förtydliganden, för vilka jag är mycket tacksam. Särskilt vill jag nämna påpekandena att förståelse dels kan relatera till vad något är, dels till varför det är på det sättet och att förståelse dels är en process, dels ett uppnått tillstånd. I det följande bemöter jag Tollands kritik och anser mig verkligen kunna visa att den framlagda teorin för förståelse är sammanhållen, tydlig och alls icke ”kontra-intuitiv” samt att den utgör ett viktigt, nytt kunskapsteoretiskt verktyg. El objetivo de este artículo es analizar un modelo de algoritmo de intervención en fisioterapia como estrategia educativa, conocer sus efectos y beneficios al ser aplicado a los alumnos en la Licenciatura de Fisioterapia de la UAMP, ya que consideramos que se ha dejado de lado el Modelo de Intervención en Fisioterapia como ciencia fundamental. Esta aplicación de un algoritmo, entendido como un conjunto ordenado de operaciones sistemáticas que permite hacer un cálculo y hallar la solución de un tipo de (...) problema, es algo que ya está establecido, sin embargo, no se le ha dado la importancia como estrategia didáctica para que los alumnos puedan realizar correctamente su intervención en fisioterapia en la vida laboral y profesional. Este artículo destaca que es u na de las herramientas fundamentales de las que parte un fisioterapeuta para poder ejercer su carrera, la aplicación de un buen tratamiento y conseguir el objetivo principal de la fisioterapia, que consiste en la rehabilitación del paciente. Al investigar las diversas teorías plasmadas por diversos autores y sus estrategias, encontramos que cada uno tiene una teoría de aplicación diferente y una perspectiva disímil, y no todas esas teorías han funcionado como se esperaba, sin embargo, es por ello la aplicación del algoritmo como estrategia didáctica. Por isso é importante o conhecimento da anatomia funcional do aparelho reprodutor, já que sua análise permite fixar sólidas bases para o estudo do fenômeno pelo qual se perpetuam as espécies: a reprodução. Nos subtemas compreendidos referentes ao macho e a fêmea, descreve-se cada um dos (...) órgãos que formam o aparelho reprodutor e as suas diferenças entre espécies, assinalando-se em cada um deles a sua função. Obviamente, a parte que trata do funcionamento não é abordada de uma forma muito ampla. Para facilitar o estudo do aparelho reprodutor do macho, seus órgãos podem ser classificados de acordo com sua localização anatômica, em órgãos genitais internos (que compreendem os ductos deferentes, as glândulas acessórias e a uretra pélvica) e órgãos genitais externos (testículos com seu epidídimo). O testículo também foi considerado como órgão sexual primário, enquanto os ductos excretores, glândulas acessórias, pênis e prepúcio são considerados órgãos sexuais secundários. O aparelho reprodutor da fêmea é dividido em ovários e órgãos tubulares (útero, oviduto, cérvix, vagina e vulva). 2.2 APARELHO REPRODUTOR DO MACHO Para avaliar a capacidade reprodutiva dos machos, é primordial conhecer a anatomia e a fisiologia do aparelho reprodutor. Os órgãos genitais incluem testículos, epidídimos, canais deferentes, ampolas deferentes, uretra, glândulas acessórias (próstata, glândulas seminais e glândulas bulbouretrais), pênis e prepúcio, que apresentam diferenças entre as espécies domésticas (tabela 1). Sabe-se que o sistema genital masculino compreende os órgãos envolvidos no desenvolvimento, no amadurecimento, no transporte e no armazenamento dos gametas masculinos (espermatozoides). Ele consiste em um par de testículos, o ducto contorcido do epidídimo, o ducto deferente, a uretra e as glândulas genitais acessórias. Os testículos produzem esperma e hormônios. O epidídimo armazena espermatozoides durante seu amadurecimento antes de passarem para o ducto deferente e pela uretra. As glândulas acessórias também liberam suas secreções na uretra e contribuem para o volume do sêmen. A parte distal da uretra forma o caminho combinado para a passagem tanto da urina como do sêmen. O pênis é o órgão copulador masculino e deposita sêmen no trato reprodutor feminino. As figuras 1-5 apresentam as diferenciações quanto ao sistema genital das espécies domésticas. Conhecer a anatomia dos órgãos reprodutivos é essencial para poder identificar as patologias que possam afetar a capacidade reprodutiva, bem como para entender as diferenças de manejo ao empregar algumas biotecnologias reprodutivas aplicadas aos animais domésticos. Ao longo do texto, a espécie bovina será utilizada como modelo e serão feitas as observações correspondentes às diferenças com as outras espécies. Os órgãos genitais da fêmea incluem os órgãos genitais internos (ovários, ovidutos, útero, cérvix, vestíbulo e vagina) e os órgãos genitais externos (lábios vulvares e clitóris) (tabela 3). Narrations have been able to influence medicine, giving rise to a new approach call " narrative medicine ". In this paper we consider the patient as a text, such is, an open book that the physician intervenes, but also from which the physician may and need to learn a lot. To deepen a little in the narrative perspective of patient understanding and his/her situation helps us to discover how the patient is object of compassion by physicians, but also how he/she (...) turns into subject of compassion. We conclude that it is important for physicians to dedicate time in their initial medical training, as well as in their permanent training, to explore and exploit the value of narrations, that help them to categorize their living experiences and that of the patients. -/- As narrativas estão chegando a influenciar na medicina, dando origem a uma nova abordagem chamada " medi-cina narrativa ". Neste trabalho consideramos o paciente como um texto, em outras palavras, um livro aberto que o médico intervém, mas também, que deve aprender muito. Aprofundar-se um pouco na perspectiva narrativa da compreensão do paciente e de sua situação ajuda a descobrir como o paciente é objeto da compaixão dos médicos, embora também como se converte em sujeito desta compaixão. Concluímos que é importante que os médicos dediquem mais tempo em sua formação médica inicial, bem como em sua formação permanente, para explorar o valor das narrativas que ajudam a categorizar suas experiências e a dos pacientes. -/- Las narraciones han llegado a influir en la medicina, dando lugar a un nuevo enfoque llamado " medicina narrativa ". En este trabajo consideramos al paciente como un texto, es decir, un libro abierto que el médico interviene, pero también del que el médico puede y necesita mucho aprender. Ahondar un poco en la perspectiva narrativa de la comprensión del paciente y de su situación nos ayuda a descubrir cómo el paciente es objeto de la compasión de los médicos, pero también cómo se convierte en sujeto de esa compasión. Concluimos que es importante que los médicos dediquen tiempo en su formación médica inicial, así como en su formación permanente, a explorar y explotar el valor de las narraciones, que les ayuden a categorizar sus experiencias vividas y las de los pacientes. Esta investigação tem por objetivo geral promover uma exposição do estado da arte do conceito de dolo eventual na dogmática penal, e, como objetivo específico, estabelecer bases metodológicas de como esse conceito pode ser construído, sistematizado e delimitado em relação à culpa consciente. A delimitação dos conceitos jurídico-penais é um importante instrumento para o estabelecimento de limites ao exercício do poder punitivo estatal. O conceito de dolo, na medida em que autoriza a aplicação de penas mais rigorosas em comparação à (...) culpa, demanda que a dogmática estabeleça claramente seus limites. Tarefa necessária não apenas para o conceito geral de dolo, mas também para o controverso “dolo eventual”, figura jurídica cuja conceituação e aplicação tem propiciado intensos debates na doutrina especializada, que, há pelo menos 200 anos, discute o problema de sua distinção com relação à outra figura não menos debatida, a da culpa (consciente). Devido à dificuldade de sua resolução, o pai do finalismo, Hans Welzel, considerou a distinção entre dolo eventual e culpa consciente uma das questões mais tormentosas do direito penal. Visando contribuir para o esclarecimento do tema, esta investigação apresenta dialeticamente os principais critérios e argumentos formulados na resolução desse intrincado problema jurídico, abrangendo, para este fim, tanto a discussão do período clássico da dogmática alemã (que legou vários conceitos até hoje debatidos e usados nesta matéria) quanto da moderna dogmática jurídico-penal, que tenta, a partir de novas abordagens, resolver a “tormentosa” questão. Bu kitap, Carl Schmitt'in demokrasi ve diktatörlük üzerine düşüncelerini politik felsefenin sorgu sahasında ele almayı amaçlayarak Schmitt'i kendi döneminin polemikleri arasında konumlandırmaktadır. Bu amaçla Weimar dönemi hukukçuları üzerinde önemli etkisi olan Carl Friedrich Wilhelm von Gerber ve Paul Laband'ın anayasa düşünceleri ekseninde Alman İmparatorluğu'nun hukuk mirası incelenmiştir. Weimar Cumhuriyeti'nin krizlerle şekillenen politik atmosferi, politik felsefe açısından verimli tartışmaların ortaya çıkmasını sağlamıştır. Bu tartışmaların izi; dönemin hukukçularından Gerhard Anschütz, Richard Thoma, Georg Jellinek, Hans Kelsen ve Hermann Heller'ın demokrasi ve diktatörlük tartışmasına (...) kaynaklık eden düşünceleri üzerinden sürülmüştür. Schmitt, çoğunluğu 1920'li yıllara denk gelen anayasa hukuku çalışmaları ile Weimar dönemi hukuk tartışmaları arasında belirleyici bir yerde durmaktadır. Schmitt ile anayasanın koruyuculuğu ve parlamentarizm hakkında polemiğe giren düşünürler, kitabın ayrı bir bölümünün konusunu oluşturmaktadır. Politik felsefenin güncel bir uğrağı olmayı sürdüren Schmitt'in demokrasi ve diktatörlük üzerine düşünceleri, çağdaş dünyanın karşı karşıya kaldığı demokrasi sorunlarının derinleştirilmesinde verimli bir kaynaktır. Bu kitabın amaçları arasında, kendi tarihsel bağlamı içerisinde Schmitt'in devlet düşüncesinin spesifik bir incelemesini yapmanın yanında, kendisini diktatörlüğün karşısında konumlandıran liberal demokrasi anlayışını tartışmaya açmak da bulunmaktadır. The author argues that this account does not fit well with Levinson’s own intentional-historical definition of art and his Wollheimian account of depiction.

Hans Kelsen's thorough critique of Eric Voegelin's "New Science of Politcs" is - in my oppinion - the best commentary on Voegelin that has been written so far.

In this paper, we aim to show that there is a particular kind of bullshit that is not dealt with in Harry Frankfurt’s and G.A. Cohen’s critiques of bullshit. We also point out the evaluative complexity of bullshit. Frankfurt and Cohen both stress its negative and possibly destructive aspects, but one might wonder whether bullshit need always and necessarily be reprehensible. We will argue that there are positive or at least neutral aspects to some kinds of bullshit.

Paisley Livingston claims that an artist’s intentions are successfully realized and hence determinate of the meaning of a work if and only if they are compatible and “mesh” with the linguistic and conventional meanings of the text or artefact taken in its target or intended context. I argue that this specific standard of success is not without its difficulties. First, I show how an artist’s intention can sometimes be constitutive of a work’s meaning even if there is no significant meshing (...) between the artist’s intention and his work. Second, I argue against the claim that the artist’s intentions need to be compatible with the linguistic and conventional meanings of a text. Third, I discuss a case that creates a particular puzzle for Livingston since the intentions of the artist concerned are clearly not successfully realized, though they are compatible and mesh with all the relevant data. I conclude my paper by suggesting a solution to this puzzle. (shrink)

A classical probabilistics explanation for a typical quantum effect in Hardy's paradox is demonstrated.

Herman Philipse considers “religious beliefs, faith and religion [to be] incompatible with science or reason”; he defines religion scientifically and specifically rejects religious doctrine. He describes reason “… as the whole of methods of empirical scientific research and critical discursive thinking as they have evolved in the scientific tradition and will continue to develop in the future” and he defines “… the phenomenon of conscience as a mental organ that can be scientifically explained and that makes the religious explanation superfluous (...) …”. Herman Philipse classifies science as the highest in rank, discards religion and sees philosophy, a rational view of the world, as based solely on the sciences. For his subject, Hans Achterhuis “… primarily cites biologists, ethologists and evolutionary psychologists with a philosophical interest” because “they presently have more to offer [him] than do his immediate colleagues”. Furthermore, “… it will be clear that ethologists and sociobiologists are of the opinion that the violent behaviour of human beings must be understood in part from the point of view of the evolutionary history of the sort ….. most philosophers and anthropologists are not aware of this. Their considerations suggest that violence only entered our world together with humankind”. Achterhuis’s choice is a “historic concept of violence”. (shrink)

The work of Thomas White represents a systematic attempt to combine the best of the new science of the seventeenth century with the best of Aristotelian tradition. This attempt earned him the criticism of Hobbes and the praise of Leibniz, but today, most of his attempts to navigate between traditions remain to be explored in detail. This paper does so for his ontology of accidents. It argues that his criticism of accidents in the category of location as entities over and (...) above substances was likely aimed at Francisco Suárez, and shows how White’s worries about the analysis of location were linked with his broader cosmological views. White rejects real qualities, but holds that the quantity of a substance is somehow distinct from its bearer. This reveals a common ground with some of his scholastic interlocutors, but lays bare a deep disagreement with thinkers like Descartes on the nature of matter. (shrink)

This paper looks at the critical reception of two central claims of Peter Auriol’s theory of cognition: the claim that the objects of cognition have an apparent or objective being that resists reduction to the real being of objects, and the claim that there may be natural intuitive cognitions of nonexistent objects. These claims earned Auriol the criticism of his fellow Franciscans, Walter Chatton and Adam Wodeham. According to them, the theory of apparent being was what had led Auriol to (...) allow for intuitive cognitions of nonexistents, but the intuitive cognition of nonexistents, at its turn, led to scepticism. Modern commentators have offered similar readings of Auriol, but this paper argues, first, that the apparent being provides no special reason to think there could be intuitions of nonexistent objects, and second, that despite his idiosyncratic account of intuition, Auriol was no more vulnerable to scepticism than his critics. This paper reconsiders Ockham's critique of the species theory of cognition. As Ockham understands this theory, it says that the direct objects of cognition are mental representations, or species. According to many commentators, one of Ockham's main objections to this theory was that, if the direct objects of cognition are species rather than external objects, we will never be able to establish whether or not a given species is a veridical representation of the world. In this paper I argue that (...) this line of interpretation sits uneasily with Ockham's epistemology, and offer a new interpretation of Ockham's critique of species. (shrink)

Radical democratic thinking is becoming intrigued by the material situatedness of its political agents and by the role of nonhuman participants in political interaction. At stake here is the displacement of narrow anthropocentrism that currently guides democratic theory and practice, and its repositioning into what we call ‘the nonhuman condition’. This Critical Exchange explores the nonhuman condition. It asks: What are the implications of decentering the human subject via a new materialist reading of radical democracy? Does this reading dilute political (...) agency? Or should this be seen, on the contrary, as an invitation for new voices and demands to enter into democratic assemblages? How might engagement with the more-than-human disrupt or extend theories of radical democracy? Hans Asenbaum and Amanda Machin discuss the human democratic subject both through radical democratic and new materialist lenses. They suggest that a new materialist decentred subject does not lose agency but further gains political responsibility in radical democracy. Jean-Paul Gagnon highlights the possibility of becoming through loss. In losing our anthropocentric arrogance—our understanding of being other and better than animal—we become more connected and discover our place in human-nonhuman assemblages. Melissa Orlie agrees that something can be gained through renouncing dominant human fantasies and presents a ‘radical democratic naturalism’. By renouncing land violence and acknowledging nature’s subjectivity, we can further nonexploitative radical democratic politics. This is where the notion of ‘tidalectic’ processes introduced by James L. Smith is helpful. Focusing on water and the Indigenous knowledges around rivers, he considers how democracy and community can be reimagined as plural, cyclical and attentive to the nonhuman with which the human is inevitably entangled. Diana Leong offers a different approach. Considering the nonhuman from the perspective of Black Studies demands an awareness to how blackness has long been constituted as non- or partially human. The present study aimed to develop effective moral educational interventions based on social psychology by using stories of moral exemplars. We tested whether motivation to engage in voluntary service as a form of moral behavior was better promoted by attainable and relevant exemplars or by unattainable and irrelevant exemplars. First, experiment 1, conducted in a lab, showed that stories of attainable exemplars more effectively promoted voluntary service activity engagement among undergraduate students compared with stories of unattainable exemplars and non-moral stories. Second, experiment 2, a middle school classroom-level experiment with a quasi-experimental design, demonstrated that peer exemplars, who are perceived to be attainable and relevant to students, better promoted service engagement compared with historic figures in moral education classes. The paper argues against a widely held synchronic view of emotional rationality. I begin by considering recent philosophical literature on various backward‐looking emotions, such as regret, grief, resentment, and anger. I articulate the general problem these accounts grapple with: a certain diminution in backward‐looking emotions seems fitting while the reasons for these emotions seem to persist. The problem, I argue, rests on the assumption that if the facts that give reason for an emotion remain unchanged, the emotion remains fitting. However, (...) I argue there are rationally self‐consuming attitudes: affective attitudes that become less fitting the longer they endure while the facts that give reason for them persist. A widely held synchronic view of fitting affective attitudes denies that fittingness at a time depends on the agent's attitudes at different times and therefore denies that the fittingness of an affective attitude can depend on its duration. Once we reject the synchronic view, we may see that affective attitudes are often fitting due to the fitting processes of which they are part. These fitting processes explain the fitting diminution of backward‐looking emotions as well as other diachronic aspects of the fittingness of emotions. -/- . (shrink)

Current radical democratic politics is characterized by new participatory spaces for citizens’ engagement, which aim at facilitating the democratic ideals of freedom and equality. These spaces are, however, situated in the context of deep societal inequalities. Modes of discrimination are carried over into participatory interaction. The democratic subject is judged by its physically embodied appearance, which replicates external hierarchies and impedes the freedom of self-expression. To tackle this problem, this article seeks to identify ways to increase the freedom of the (...) subject to explore its multiple self. Understanding the self as inherently fugitive, the article investigates participatory, deliberative and agonistic concepts of self-transformation. As all of them appear limited, it introduces a transformative perspective in democratic thought. Enriching the transformative perspective with queer and gender theory, the article generates the concept of a politics of becoming, which, through radical democratic practices of disidentification, advances the freedom of the subject to change. In this paper, findings from research in neuroscience of morality will be reviewed to consider the purposes of moral education. Particularly, I will focus on two main themes in neuroscience, novel neuroimaging and experimental investigations, and Bayesian learning mechanism. First, I will examine how neuroimaging and experimental studies contributed to our understanding of psychological mechanisms associated with moral functioning while addressing methodological concerns. Second, Bayesian learning mechanism will be introduced to acquire insights about how moral learning occurs in human brains. (...) Based on the reviewed neuroscientific research on morality, I will examine how evidence can support the model of moral education proposed by virtue ethics, Neo-Aristotelian moral philosophy in particular. Particularly, two main aims of virtue ethics-based moral education, the habituation of virtues and the cultivation of phronesis, will be discussed as the important purposes of moral education based on neuroscientific evidence. Is it possible for an individual that has gone out of being to come back into being again? The English Aristotelian, Thomas White, argued that it is not. Thomas Hobbes disagreed, and used the case of the Ship of Theseus to argue that individuals that have gone out of being may come back into being again. This paper provides the first systematic account of their arguments. It is doubtful that Hobbes has a consistent case against White. Still his criticism may (...) have prompted White to clarify his views on identity over time in his later work. (shrink)

Plakias has recently argued that there is nothing wrong with publishing defences of philosophical claims which we don't believe and also nothing wrong with concealing our lack of belief, because an author's lack of belief is irrelevant to the merit of a published work. Fleisher has refined this account by limiting the permissibility of publishing without belief to what he calls ‘advocacy role cases’. I argue that such lack of belief is irrelevant only if it is the result of an (...) inexplicable incredulity or the result of a metaphilosophical or epistemic stance that is unrelated to the specific claim. However, in many real-life cases, including Fleisher's advocacy role cases, our doubts regarding the claims we defend arise from reasons that have something to do with the insufficiency of the philosophical evidence supporting the claim, and publishing an unconditional defence of a claim without revealing our doubts is impermissible as it involves withholding philosophically relevant reasons. Plakias has also argued that discouraging philosophers from publishing claims they don't believe would be unfair to junior philosophers with unsettled views. I propose that we should change our academic practices that pressure philosophers to publish articles that pretend to be defences of settled views. (shrink)

The present study aims to examine the relationship between the cortical midline structures (CMS), which have been regarded to be associated with selfhood, and moral decision making processes at the neural level. Traditional moral psychological studies have suggested the role of moral self as the moderator of moral cognition, so activity of moral self would present at the neural level. The present study examined the interaction between the CMS and other moral-related regions by conducting psycho-physiological interaction analysis of functional images (...) acquired while 16 subjects were solving moral dilemmas. Furthermore, we performed Granger causality analysis to demonstrate the direction of influences between activities in the regions in moral decision-making. We first demonstrate there are significant positive interactions between two central CMS seed regions—i.e., the medial prefrontal cortex (MPFC) and posterior cingulate cortex (PCC)—and brain regions associated with moral functioning including the cerebellum, brainstem, midbrain, dorsolateral prefrontal cortex, orbitofrontal cortex and anterior insula (AI); on the other hand, the posterior insula (PI) showed significant negative interaction with the seed regions. Second, several significant Granger causality was found from CMS to insula regions particularly under the moral-personal condition. Furthermore, significant dominant influence from the AI to PI was reported. Moral psychological implications of these findings are discussed. The present study demonstrated the significant interaction and influence between the CMS and morality-related regions while subject were solving moral dilemmas. Given that, activity in the CMS is significantly involved in human moral functioning. (shrink)

Some stories of moral exemplars motivate us to emulate their admirable attitudes and behaviors, but why do some exemplars motivate us more than others? We systematically studied how motivation to emulate is influenced by the similarity between a reader and an exemplar in social or cultural background (Relatability) and how personally costly or demanding the exemplar’s actions are (Attainability). Study 1 found that university students reported more inspiration and related feelings after reading true stories about the good deeds of a (...) recent fellow alum, compared to a famous moral exemplar from decades past. Study 2A developed a battery of short moral exemplar stories that more systematically varied Relatability and Attainability, along with a set of non-moral exemplar stories for comparison. Studies 2B and 2C examined the path from the story type to relatively low stakes altruism (donating to charity and intentions to volunteer) through perceived attainability and relatability, as well as elevation and pleasantness. Together, our studies suggest that it is primarily the relatability of the moral exemplars, not the attainability of their actions, that inspires more prosocial motivation, at least regarding acts that help others at a relatively low cost to oneself. ABSTRACT In the present study, we examined how the perceived attainability and relatability of moral exemplars predicted moral elevation and pleasantness among both adult and college student participants. Data collected from two experiments were analyzed with Bayesian multilevel modeling to explore which factors significantly predicted outcome variables at the story level. The analysis results demonstrated that the main effect of perceived relatability and the interaction effect between attainability and relatability shall be included in the best prediction model, and thus, were (...) deemed to predict the outcome variables significantly. The main effect of relatability as well as its interaction with attainability positively predicted elevation and pleasantness. We discussed educational implications of the findings in terms of how relatability may be the first point of emphasis for moral educators to focus on and attainability can then bolster the effectiveness. These relatable and attainable moral exemplars can be sources for moral elevation and pleasantness, which promote motivation to emulate moral behavior presented by the exemplars. (shrink)
