Recent discussions among lawyers, philosophers, policy researchers and athletes have focused on the potential threat to privacy posed by the World Anti-Doping Agency’s (WADA) whereabouts requirements. These requirements demand, among other things, that all elite athletes file their whereabouts information for the subsequent quarter on a quarterly basis and comprise data for one hour of each day when the athlete will be available and accessible for no advance notice testing at a specified location of their choosing. Failure to file one’s (...) whereabouts, or the non-availability for testing at said location on three occasions within any 18-month period constitutes an anti-doping rule violation that is equivalent to testing positive to a banned substance, and may lead to a suspension of the athlete for a time period of between one and two years. We critically explore the extent to which WADA’s whereabouts requirements are in tension with existing legislation on privacy, with respect to UK athletes, who are simultaneously protected by UK domestic and EU law. Both UK domestic and EU law are subject to the European Convention on Human Rights (ECHR) Article 8, which establishes a right to “respect for private and family life, home and correspondence”. We critically discuss the centrality of the whereabouts requirements in relation to WADA’s aims, and the adoption and implementation of its whereabouts rules. We conclude that as WADA’s whereabouts requirements appear to be in breach of an elite athlete’s rights under European workers’ rights, health & safety and data protection law they are also, therefore, in conflict with Article 8 of the ECHR and the UK Human Rights Act 1998. We call for specific amendments that cater for the exceptional case of elite sports labour if the WADA requirements are to be considered legitimate. (shrink)

One determining characteristic of contemporary sociopolitical systems is their power over increasingly large and diverse populations. This raises questions about power relations between heterogeneous individuals and increasingly dominant and homogenizing system objectives. This article crosses epistemic boundaries by integrating computer engineering and a historicalphilosophical approach making the general organization of individuals within large-scale systems and corresponding individual homogenization intelligible. From a versatile archeological-genealogical perspective, an analysis of computer and social architectures is conducted that reinterprets Foucault’s disciplines and political anatomy to (...) establish the notion of politics for a purely technical system. This permits an understanding of system organization as modern technology with application to technical and social systems alike. Connecting to Heidegger’s notions of the enframing (Gestell) and a more primal truth (anfänglicheren Wahrheit), the recognition of politics in differently developing systems then challenges the immutability of contemporary organization. Following this critique of modernity and within the conceptualization of system organization, Derrida’s democracy to come (à venir) is then reformulated more abstractly as organizations to come. Through the integration of the discussed concepts, the framework of Large-Scale Systems Composed of Homogeneous Individuals (LSSCHI) is proposed, problematizing the relationships between individuals, structure, activity, and power within large-scale systems. The LSSCHI framework highlights the conflict of homogenizing system-level objectives and individual heterogeneity, and outlines power relations and mechanisms of control shared across different social and technical systems. Worker well-being is a hot topic in organizations, consultancy and academia. However, too often, the buzz about worker well-being, enthusiasm for new programs to promote it and interest to research it, have not been accompanied by universal enthusiasm for scientific measurement. Aim to bridge this gap, we address three questions. To address the question ‘What is worker well-being?’, we explain that worker well-being is a multi-facetted concept and that it can be operationalized in a variety of constructs. We propose a (...) four-dimensional taxonomy of worker well-being constructs to illustrate the concept’s complexity and classify ten constructs within this taxonomy. To answer the question ‘How can worker well-being constructs be measured?’, we present two aspects of measures: measure obtrusiveness (i.e., the extent to which obtaining a measure interferes with workers’ experiences) and measure type (i.e., closed question survey, word, behavioral and physiological). We illustrate the diversity of measures across our taxonomy and uncover some hitherto under-appreciated avenues for measuring worker well-being. Finally, we address the question ‘How should a worker well-being measure be selected?’ by discussing conceptual, methodological, practical and ethical considerations when selecting a measure. We summarize these considerations in a short checklist. It is our hope that with this study researchers – working in organizations, in academia or both – will feel more competent to find effective strategies for the measurement worker well-being and eventually make policies and choices with a better understanding of what drives worker well-being. Some years ago, Hidding et al. suggest that the emergence of intricate and pervasive weblike structure of the Universe on Megaparsec scales can be approximated by a well-known equation from fluid mechanics, the Burgers’ equation. The solution to this equation can be obtained from a geometrical formalism. The resulting Adhesion formalism provides deep insight into the dynamics and topology of the Cosmic Web. It uncovers a direct connection between the conditions in the very early Universe and the complex spatial patterns (...) that emerged out of these under the influence of gravity. In the present paper, we describe a cellular automaton model of the Burgers’ equation, which can be investigated via a fast computer simulation. At first glance, one might wonder how a philosopher such as Aristotle, born in 384 BCE, could—as the title of Burger’s book puts it—have a dialogue with Socrates, who died in 399 BCE. Not only did Aristotle never see or hear Socrates in person, but since Socrates—according to his contemporaries—never wrote anything, Aristotle also never encountered the thoughts or opinions of Socrates at first hand. Of course, Aristotle encountered Plato’s depiction of Socrates and it is Plato’s Socrates whom (...) class='Hi'>Burger presents as Aristotle’s central “interlocutor” in his Nicomachean Ethics [EN]. Burger presents a rich and challenging reading of the Ethics based on the interpretative principle that “Aristotle constructs the figure of Socrates as a perfect foil against which to develop a different account of virtue of character” (5). Burger’s claim is not an empirical or historical one about whom Aristotle had in mind when writing the Ethics, but rather a philosophical claim about how Aristotle’s Ethics begins in, wrestles with, and modifies a set of theses espoused by the Platonic Socrates. 1848 is a watershed in Dutch political and intellectual history. In the wake of liberalism positivism and empiricism dominated Dutch philosophy. In this paper it is argued that Spinoza’s philosophy played an important part in developing a liberal Weltanschauung. Dutch Spinozism started with the theological dissertation of Johannes van Vloten, who from the 1860s onwards became the great pamphleteer of Spinozism. However due to his break with Christianity he remained an exception in Dutch intellectual life. The Utrecht professor of philosophy (...) Cornelis Willem Opzoomer and his friend the classical scholar D. Burger jr., for example, propagated a liberal Christianity purged from its mythical elements. Adopting Schleiermacher’s example Opzoomer developed a morality inspired by Ethics V. In 1850 he turned to J. S. Mill and A. Comte. From that year onwards he justified the methodological unity of the natural and ‘moral’ sciences in Spinoza’s doctrine of the passions. According to Burger the Ethics contains an obsolete metaphysics, but due to its morality consistent with science the book deserves a large 19th-century readership. In a new paper in recent issue of this journal (PSTJ), Prof. M. Pitkanen describes a solar system model inspired by spiral galaxies. While we appreciate his new approach, we find it lacks substantial discussion on the nature of vortices and chirality in galaxy. Therefore we submit a viewpoint that Gross-Pitaevskii model can be a more complete description of both solar system and also spiral galaxies, especially taking into account the nature of chirality and vortices in galaxies. In this article, (...) we also hope to bring out some correspondence among existing models, so we discuss shortly: the topological vortice approach, Burgers equation in the light of KAM theory, and the Cantorian Navier-Stokes approach. Of course, this short article is far from being complete. We hope further investigation can be done around this line of approach. Aim of this paper: With this article, we hope to begin a healthy dialogue with Prof. M. Pitkanen, especially on his solar system model, since we also believe that he also support “evidence-based physics.” Limitation: In this paper we only discuss Pitkanen’s solar system model, we don’t discuss his other papers in a recent issue of PSTJ. Theodor Adorno's Aesthetic Theory is a vast labyrinth that anyone interested in modern aesthetic theory must at some time enter. Because of his immense difficulty of the same order as Derrida - Adorno's reception has been slowed by the lack of a comprehensive and comprehensible account of the intentions of his aesthetics. This is the first book to put Aesthetic Theory into context and outline the main ideas and relevant debates, offering readers a valuable guide through this huge, difficult, but (...) revelatory work. Its extended argument is that, despite Adorno's assumptions of autonomism, cognitivism, and aesthetic modernism, his idea of artistic truth content offers crucial insights for contemporary philosophical aesthetics.The eleven chapters are divided into three parts: Context, Content, and Critique. The first part offers a brief biography, describes Adorno's debates with Benjamin, Brecht, and Lukács, and outlines his philosophical program. I argue that prioritarianism cannot be assessed in abstraction from an account of the measure of utility. Rather, the soundness of this view crucially depends on what counts as a greater, lesser, or equal increase in a person’s utility. In particular, prioritarianism cannot accommodate a normatively compelling measure of utility that is captured by the axioms of John von Neumann and Oskar Morgenstern’s expected utility theory. Nor can it accommodate a plausible and elegant generalization of this theory that has (...) been offered in response to challenges to von Neumann and Morgenstern. This is, I think, a theoretically interesting and unexpected source of difficulty for prioritarianism, which I explore in this article. (shrink)

In this paper, we examine how a research institution’s social structure and academic opinion leaders’ presence shaped the early adoption of a scientific innovation. Our case considers the early engagement of mathematical economists at the Cowles Commission with John von Neumann and Oskar Morgenstern’s Theory of Games and Economic Behavior. We argue that scholars with administrative leadership functions who were not only scientifically but also organizationally central – in our case the director of research Jacob Marschak – played a (...) crucial role in promoting the adoption of the Theory of Games. We support our argument with a scientometric analysis of all acknowledgments made in 488 papers published from 1944 to 1955 in the two main paper series at Cowles. We apply blockmodeling techniques to the acknowledgments network to reconstruct the formal and informal social structure at Cowles at the time. Our findings suggest that studies of the early adoption of scientific theories benefit from complementary perspectives on the role of academic leaders and scientists. Our study reveals the importance of formal and informal social structures and the agenda of administrative leaders in these structures to explain their adoption. (shrink)

In its etymology and in popular discourse, the term ‘avant-garde’ is commonly associated with a future temporality, while in art-historical discourse, it represents a tradition of modernist innovation, periodised as ‘historical avant-garde’ and ‘neo-avant-garde’. Since this historical periodisation was first established in the 1950s, the avant-garde’s futurity has been repeatedly disputed, bringing the very notion of an avant-garde into question. This thesis takes as its starting point the predicament of ‘an avant-garde after the avant-garde’ as a means to investigate the (...) philosophico-political implications of a historical temporality marked by ‘afterness’. Writing in critical dialogue with scholarship that has articulated the avant-garde as a notion of historical time, the thesis modifies the parameters of this scholarship by foregrounding the category of historicism, and by reformulating the avant-garde as a notion that both resists and inhabits historical periodisation. As a study at the disciplinary intersection of comparative literature and critical theory, 'Ahead of its Time' proceeds via close readings of selected theories of the avant-garde (German literary scholar Peter Bürger’s foundational Theory of the Avant-Garde in the 1970s; British art theorist John Roberts’ formulation of a ‘suspensive avant-garde’ in the twenty-first century; and the intellectual debates of the Italian circle Neoavanguardia in the 1960s), while also mobilising the critical resources available in the thought of Walter Benjamin. Through a non-linear, comparativist critical analysis that discusses these theories in, and as, a Benjaminian constellation, the thesis proposes the avant-garde as a relational, indexical category that is constitutively split between historical continuity and historical rupture. In this manner, 'Ahead of its Time' revisits the broader question of mediation between universality and particularity, and by recasting it in temporal terms, it advocates a chronopolitics of singularity, whereby the avant-garde’s split between continuity and rupture also reveals the ethically-necessary relationship between self-determination and contingency. ‘Judgment’ is Brentano’s terms for any mental state liable to be true or false. This includes not only the products of conceptual thought, such as belief, but also perceptual experiences, such as seeing that the window was left open. ‘Every perception counts as a judgment,’ writes Brentano (1874: II, 50/1973a: 209). Accordingly, his theory of judgment is not exactly a theory of the same phenomenon we call today ‘judgment,’ but of a larger class of phenomena one (perhaps the main) species (...) of which is what we call judgment. Even if we keep this in mind, though, the profound heterodoxy of Brentano’s theory of judgment is still striking. Brentano develops this heterodox theory in some detail already in the Psychology from Empirical Standpoint (Brentano 1874/1973a). But he continued to work out its details, and various aspects of it, until his death. Many of the relevant articles, notes, and fragments of relevance have been collected by Oskar Kraus in 1930 and published under the title Truth and Evidence (Brentano 1930/1966b). Kraus prefaces this volume with an elaborate reconstruction, of dubious plausibility, according to which Brentano’s accounts of judgment and truth have gone through four distinct stages. In reality, there is a unified underlying conviction underwriting Brentano’s work both on judgment and on truth (see CHAP. 20 on the latter). Here I present this unified core of this highly original theory of judgment, which can be captured in terms of three main theses. The first is that contrary to appearances, all judgments are existential judgments (§1). The second is that the existential force of judgment is indeed a force, or mode, or attitude – it does not come from the judgment’s content (§2). The third is that judgment is not a propositional attitude but an ‘objectual’ attitude (§3). (shrink)

Drawing from Bakhtin and Habermas, I will show how the different voices in Gordimer's novel seem to be enacting a democratic public sphere in which no voice is granted authority over others – a public sphere which carries the promise of countering the social and political hierarchies established by the racist South African regime. The promise, however, turns out to be an illusion. As I will demonstrate, the possibility of an Enlightenment bourgeois public sphere which the novel seems to be (...) gesturing at is being irreparably undermined by racism. In a country where the Enlightenment aspiration to universalism and equality before the law are glaringly contravened by racism, Rosa Burger is painfully aware of her inability to fully access the predicament of the blacks. As such, Burger’s daughter remains only Burger’s daughter, and the children of Soweto the children of Soweto; at no point in the novel do they truly intermingle. Despite the fact that both are fighting racism – and the novel is devoted to the “coming-of-age” of both kinds of children – Rosa Burger remains only the daughter of a Bürger at the end of the novel, not the daughter of South Africa, much less to say the daughter of Black South Africa. She has finally “come into her own,” but the “self” she manages to realize is at best that of a disillusioned bourgeois individual (that of a disillusioned Bürger, so to speak) – a “self” that recalls Hegel’s “beautiful soul.” To appropriate György Lukács’s language, Bürger’s Daughter could be described as “modern bourgeois literature bear[ing] witness against bourgeois society.”. Mówiąc o historii frazeologii języka niemieckiego, należy wyróżnić dwie zasadnicze fazy. Pierwsza z nich to odległy okres sięgający jeszcze XVII w., kiedy to w centrum zainteresowania badaczy stały paremia. Na tym etapie określanie zainteresowania frazeologizmami terminem dyscyplina byłoby nieco na wyrost. Autorzy tego okresu ograniczali się bowiem do inwentaryzacji funkcjonujących w języku przysłów. W tym miejscu należy wspomnieć takie nazwiska, jak Peters czy Schottel, których prace ze względu na jakość zasługują na szczególne uznanie. Do wieku XIX nie doszło do przełomu (...) w badaniach nad frazeologizmami. Jedynym godnym uwagi jest fakt, że pojawia się termin idiomatyczność, jedna z głównych cech związków frazeologicznych, wprowadzony przez Paula. Zaowocowało to pracami, których autorzy starali się w oparciu o to kryterium dokonywać podziału zespołów wyrazowych Jednak ich zainteresowanie dalekie było jeszcze od szczegółowej analizy, a skupiało się wyłącznie na inwentaryzacji. Dopiero wiek XX za sprawą pracy Traité de stilistique franęaise Bally’ego przyniósł przełom w badaniach frazeologizmów i stworzył fundamenty, na których powstała nowa dziedzina językoznawstwa. Choć początkowo praca nie spotkała się z większym zainteresowaniem, to w latach trzydziestych i czterdziestych minionego wieku znalazła uznanie radzieckich badaczy. To dzięki takim językoznawcom, jak Vinogradov czy Černyševa nastąpił istny renesans badań związków frazeologicznych, który ostatecznie doprowadził tam do wykrystalizowania się w latach czterdziestych XX w. frazeologii jako uznanej dyscypliny językoznawstwa. Osiągnięcia radzieckiej frazeologii przeniosła na grunt niemieckiej lingwistyki Ruth Klappenbach pod koniec lat sześćdziesiątych XX w. W roku 1970 Irina Černyševa opublikowała szczegółową pracę, poświęconą niemieckiej frazeologii. Powstałe później publikacje takich autorów, jak Koller, Pilz, Burger czy Fleischer, stały się żelaznym kanonem frazeologii języka niemieckiego i na stałe ugruntowały pozycję nowej dyscypliny. Kolejne publikacje autorów z całego świata, mające często charakter interdyscyplinarny, ukazują wciąż nowe kierunki badań frazeologizmów. Tym samym stanowią one nieoceniony wkład w dalszy rozwój niemieckiej frazeologii. (shrink)

Dieser Aufsatz untersucht das Verhältnis zwischen Föderalismus und individueller Freiheit. Es wird gezeigt, dass eine vollständige Analyse des Verhältnisses zwischen Föderalismus und individueller Freiheit zwei entgegengesetzte Effekte mitberücksichtigen muss. Auf der einen Seite verstärken föderalistische Strukturen die individuelle Freiheit indem sie die Auswahlmöglichkeiten der Bürger erweitern. Auf der anderen Seite führt jedoch ein föderalistisches System zur institutionellen Vielfalt, ein Faktum, das per se zu höheren Abwanderungskosten führt, die ein Bürger tragen muss, wenn er oder sie entscheidet, die Jurisdiktion zu wechseln. (...) Dieser Effekt auf die individuelle Freiheit ist ein negativer, da jede Erhöhung der Abwanderungskosten die Minderung der individuellen Freiheit zur Konsequenz hat. In this essay, we consider the formal and ontological implications of one specific and intensely contested dialectical context from which Deleuze’s thinking about structural ideal genesis visibly arises. Sayre, we argue that the duality of the One (...) and the Indefinite Dyad provides, in the later Plato, a unitary theoretical formalism accounting, by means of an iterated mixing without synthesis, for the structural origin and genesis of both supersensible Ideas and the sensible particulars which participate in them. As these commentators also argue, this duality furthermore provides a maximally general answer to the problem of temporal becoming that runs through Plato’s corpus: that of the relationship of the flux of sensory experiences to the fixity and order of what is thinkable in itself. Additionally, it provides a basis for understanding some of the famously puzzling claims about forms, numbers, and the principled genesis of both attributed to Plato by Aristotle in the Metaphysics, and plausibly underlies the late Plato’s deep considerations of the structural paradoxes of temporal change and becoming in the Parmenides, the Sophist, and the Philebus. After extracting this structure of duality and developing some of its formal, ontological, and metalogical features, we consider some of its specific implications for a thinking of time and ideality that follows Deleuze in a formally unitary genetic understanding of structural difference. These implications of Plato’s duality include not only those of the constitution of specific theoretical domains and problematics, but also implicate the reflexive problematic of the ideal determinants of the form of a unitary theory as such. We argue that the consequences of the underlying duality on the level of content are ultimately such as to raise, on the level of form, the broader reflexive problem of the basis for its own formal or meta-theoretical employment. We conclude by arguing for the decisive and substantive presence of a proper “Platonism” of the Idea in Deleuze, and weighing the potential for a substantive recuperation of Plato’s duality in the context of a dialectical affirmation of what Deleuze recognizes as the “only” ontological proposition that has ever been uttered. This is the proposition of the univocity of Being, whereby “being is said in the same sense, everywhere and always,” but is said (both problematically and decisively) of difference itself. (shrink)

Der Aufsatz beschäftigt sich am Beispiel des deutschen "Kopftuchstreits" mit der rechtlich-politischen Auseinandersetzung um subjektive Rechte innerhalb des liberalen Rechtsstaats. Wie Christoph Menke in seiner Deutung der für den politischen Liberalismus wesentlichen politischen Konflikte gezeigt hat, bezieht sich diese Auseinandersetzung vorrangig auf zwei Fragen: Wer sollte Anspruch darauf genießen, ein politisches Subjekt zu sein, das heißt, als Gleiche oder Gleicher berücksichtigt zu werden? Welche Ansprüche politischer Subjekte könneen als schützenswerte Verwirklichung subjektiver Rechte gelten? Der vorliegende Beitrag beschäftigt sich vorwiegend mit (...) der Frage, wie die politischen Konflikte des letztgenannten Typs auf die rechtliche Auseinandersetzung um Grundrechte abfärben. Damit wende ich mich gegen ein Verständnis der Grundrechte, das diese als Garant der ethischen Neutralität eines liberalen Gemeinwesens ansieht. Ich möchte zeigen, dass der Sinn subjektiver Rechte in der liberalen Demokratie zwar unter anderem genau darin besteht, dass sie partikulare ethische Wertvorstellungen neutralisieren und die Bürgerinnen und Bürger innerhalb eines vernünftigen Rahmens vor Unterdrückung schützen. Wie eine Analyse der Entscheidungen des Bundesverfassungsgerichts (BVerfG) zum "Kopftuchstreit" zeigt, wird diese Funktion aber stets zugleich durch die partikulare Interpretation gleicher Rechte unterminiert. Dies bezeichne ich als die Dekonstruktion der Neutralität, die sich im Recht vollzieht. (shrink)

Das Ziel, die Lernenden zu befähigen, als selbstbestimmte und -ermächtigte Bürger*innen am Politischen teilzuhaben, verlangt in einer Mediengesellschaft unter anderem danach, jene Systeme verstehen, kritisieren und gestalten zu können, die politische Information kreieren und verbreiten. Um der Komplexität und den Interdependenzen dieser Systeme gerecht zu werden, ist auf verschiedenste Fachbereiche und deren Zugänge zurückzugreifen. Diese bilden die Grundlage, um Lernende zu befähigen, sich selbstbestimmt und emanzipiert mit den gesellschaftspolitischen Fragen des 21. Jahrhunderts auseinanderzusetzen. Basierend auf den Beiträgen dieses Sammelbandes skizzieren (...) wir grundlegende Aspekte einer Politischen Bildung für die digitale Öffentlichkeit. (shrink)

n diesem Beitrag zum Scherpunkt "Politische Theorie in der Krise" untersuche ich das von liberalen Theorien produzierte Wissen. Der Beitrag folgt dazu drei Selbstbeschreibungen des politischen Liberalismus, der sich erstens selbst als dominierendes Zentrum der gegenwärtigen Politischen Theorie sieht, der zweitens Anspruch darauf erhebt, mit seinem Wissen die politischen Selbstverständnisse von Bürger_innen anleiten und verändern zu können, und der schließlich drittens seine eigene Wirksamkeit in der Wirklichkeit im Rahmen der Diskussion um ideale und nicht-ideale Theorie verhandelt. Im affirmativen Nachvollzug dieser (...) drei Selbstbeschreibungen zeigt der Artikel, wie das Wissen des politischen Liberalismus eine von politischen Konflikten befreite Wirklichkeit erzeugt und zugleich die politischen Selbstverständnisse der Bürger_innen mithilfe dieser Wirklichkeitskonstruktion lenkt. Damit zielt das Wissen des politischen Liberalismus darauf ab, eine Subjektivität zu formen, die sich zugunsten einer rechtsförmigen Verwaltung von Politik verabschiedet. (shrink)

En este artículo hago una reconstrucción de la teoría de la justicia global del filósofo Thomas Pogge, basándome fundamentalmente en su artículo “Severe poverty as a violation of negative duties” [Pobreza severa como una violación de deberes negativos]. En la sección 1, expongo la concepción de la justicia sostenida por este autor, que él mismo caracteriza como “mínima”. En la sección 2, explico a qué se refiere Pogge con el deber negativo de no cooperar en la imposición de un orden (...) institucional injusto sin compensar. En la sección 3, explico cuáles son las dos formas de compensación en caso de cooperación. En la sección 4, hago algunas aclaraciones más acerca del deber de no contribuir con la injusticia, tomando como ejemplo el caso de Oskar Schindler. Finalmente, en la sección 5, pretendo responder a la crítica según la cual la concepción de la justicia global de Pogge exige demasiado de nosotros. A Confederacy of Dunces (Confederacy) by John Kennedy Toole portrays an interplay between competing definitions of humanism. The one school of humanism—called by some the Modernist Paradigm—saw the Italian Renaissance as the origin of nineteenth- and twentieth-century modernist views that celebrated science, technology, and individual human freedom. The other school, led by Paul Oskar Kristeller, sought to historicize humanism by establishing that Renaissance writers and thinkers were generally conservative and preserved the philosophical ideas of the medieval era. Kristeller was (...) the President of the Renaissance Society of America and was at the height of his influence at Columbia University during the late 1950s, when Toole studied for his Master’s degree there. The main character in Confederacy, Ignatius J. Reilly, presents a parody of Kristeller’s position, which he uses to critique modern society. Ignatius also plays the part of a child of the planetary god Saturn, both by acting out the ancient astrological tradition of associating Saturn with misfortune and disorder and by being a parody of the Renaissance concept of the Genius as a Child of Saturn begun by the Renaissance philosopher whom Kristeller studied most, Marsilio Ficino. Ignatius’s worldview is an antithesis of the Modernist Paradigm. Confederacy is critical of both Modernist humanism with its attendant materialism and its antithesis—Ignatius’s dysfunctional version of Kristeller’s Renaissance philosophy. When the community expels Ignatius as a scapegoat, Toole appears to gesture toward a dialectical synthesis of the two concepts of humanism in the novel’s happy ending. (shrink)

The bi-polar confrontation between the Soviet Union and the USA involved many leading game theorists from both sides of the Iron Curtain: Oskar Morgenstern, John von Neumann, Michael Intriligator, John Nash, Thomas Schelling and Steven Brams from the United States and Nikolay Vorob’ev, Leon A. Petrosyan, Elena B. Yanovskaya and Olga N. Bondareva from the Soviet Union. The formalization of game theory took place prior to the Cold War but the geopolitical confrontation hastened and shaped its evolution. In our (...) article we outline four similarities and differences between Western GT and Soviet GT: 1) the Iron Curtain resulted in a lagged evolution of GT in the Soviet Union; 2) Soviet GT focused more on operations research and issues of centralized planning; 3) the contemporary Western view on Soviet GT was biased and Soviet contributions, including works on dynamic stability, non-emptiness of the core and many refinements, suggest that Soviet GT was able to catch up to the Western level relatively fast; 4) international conferences, including Vilnius, 1971, fostered interaction between Soviet game theorists and their Western colleagues. In general, we consider the Cold War to be a positive environment for GT in the West and in the Soviet Union. (shrink)

The historical period of the avant-garde art movements coincided with two phenomena which can be interpreted as the failure of the rationalism characteristic for the modern, capitalist system. One of these is Taylorism, which dehumanized and robotized the person involved in the work process, and the other is the First World War. Several movements of the avant-garde related critically to reason and conscience (expressionism, surrealism), but the most radical was Dada. The manifestos and Dadaist activities reveal that the Dada wants (...) to do away not only with the heritage of the past, but also with the linguistic and logical structures which form the texture of society. Bruitist poems, meaningless words and sentences, simultaneous poems, and the various uses of sound are all aimed at tearing apart language itself. The refusal of logic is most evident in the manifesto of Tristan Tzara, in which the series of mutually contradictory affirmations is concluded with an exceptionally clear statement: “I hate common sense.” Logic, argumentation, and dialectics are all dismissed in the name of freedom and life, which are characterized by Tzara in the following way: “the interweaving of contraries and all contradictions, freaks and irrelevancies: LIFE” (Tzara 1918). In my paper, I supplement the thesis of Peter Burger on the failure of the avant-garde (which is explained by him through its artistic success) by calling attention to the failure of its fight against reason, which is most evident in the search for meaning as an essential part of artistic reception. Thus, Dada is only interesting as long as the meaningless phenomenon is associated with some kind of meaning during the artistic reception. (shrink)

Dies ist kein perfektes Buch, aber es ist einzigartig, und wenn Sie die ersten 400 oder so Seiten überspringen, sind die letzten 300 (von etwa 700) ein ziemlich guter Versuch, das, was über Verhalten bekannt ist, auf soziale Veränderungen in Gewalt und Manieren im Laufe der Zeit anzuwenden. Das Grundthema ist: Wie kontrolliert und begrenzt unsere Genetik den gesellschaftlichen Wandel? Überraschenderweise versäumt er es, die Natur der Verwandtseinsauswahl (inklusive Fitness) zu beschreiben, die einen Großteil des tierischen und menschlichen gesellschaftlichen Lebens (...) erklärt. Ihm fehlt (wie fast jeder) ein klarer Rahmen für die Beschreibung der logischen Struktur der Rationalität (LSR – John Searles bevorzugter Begriff), den ich lieber die Deskriptive Psychologie des Höheren Ordnungsdenkens (DPHOT) nenne. Er hätte etwas über die vielen anderen Arten des Missbrauchs und der Ausbeutung von Menschen und dem Planeten sagen sollen, da diese jetzt so viel schwerwiegender sind, dass andere Formen der Gewalt fast irrelevant werden. Die Ausweitung des Konzepts der Gewalt auf die globalen langfristigen-Folgen der Replikationvon Genen von jemandem und ein Verständnis dafür, wie Evolution funktioniert (d. h. die Auswahl von Verwandten), wird eine ganz andere Perspektive auf die Geschichte, die aktuellen Ereignisse und die Wahrscheinlichkeit bieten, wie die Dinge in den nächsten paar hundert Jahren ablaufen werden. Man könnte zunächst feststellen, dass der Rückgang der körperlichen Gewalt in der Geschichte durch die ständig wachsende gnadenlose Vergewaltigung des Planeten (d.h. durch die Zerstörung der Zukunft des eigenen Nachkommen) durch die Menschen ausgeglichen (und ermöglicht) wurde.’ Pinker (wie die meisten Menschen die meiste Zeit) wird oft durch die Oberflächlichkeiten der Kultur abgelenkt, wenn es auf die Biologie ankommt. Dies ist die klassische Natur/Pflege-Frage und Die Natur übertrumpft die Pflege - unendlich. Was wirklich zählt, ist die Gewalt, die der Erde durch die unerbittliche Zunahme der Bevölkerungs- und Ressourcenvernichtung (aufgrund von Medizin und Technologie und Konfliktunterdrückung durch Polizei und Militär) zugefügt wird. Etwa 200.000 mehr Menschen pro Tag (ein anderes Las Vegas alle 10 Tage, ein anderes Los Angeles jeden Monat), die etwa 6 Tonnen Oberboden, die ins Meer/Person/Jahr gehen – etwa 1% der gesamten jährlichen Verschwinden der Welt, etc. bedeuten, dass, wenn nicht irgendein Wunder geschieht, die Biosphäre und Zivilisation in den nächsten zwei Jahrhunderten, weitgehend zusammenbrechen werden, und es wird Hunger, Elend und Gewalt jeder Art in einem schwindelerregenden Ausmaß geben. Die Manieren, Meinungen und Tendenzen der Menschen, Gewalttaten zu begehen, sind ohne ihre Möglichkeit, etwas zu tun, um diese Katastrophe zu vermeiden, von Bedeutung, und ich sehe nicht, wie das geschehen wird. Es gibt keinen Raum für Argumente, und auch keinen Sinn (ja, ich bin ein Fatalist), also werde ich nur ein paar Kommentare machen, als ob es Fakten wären. Stellen Sie sich nicht vor, dass ich ein persönliches Interesse daran habe, eine Gruppe auf Kosten anderer zu fördern. Ich bin 78, habe keine Nachkommen und keine nahen Verwandtenund identifiziere mich nicht mit einer politischen, nationalen oder religiösen Gruppe und betrachte die, zu der ich standardmäßig gehöre, als ebenso abstoßend wie alle anderen. Eltern sind die schlimmsten Feinde des Lebens auf der Erde, und wenn man den weiten Blick auf die Dinge nimmt, sind Frauen so gewalttätig wie Männer, wenn man bedenkt, dass die Gewalt von Frauen (wie die meisten von Männern) weitgehend in Zeitlupe, in zeitlicher und raumweiseer Entfernung erfolgt und meist durch Stellvertreter - von ihren Nachkommen und von Männern - ausgeübt wird. In zunehmendem Maße tragen Frauen Kinder, unabhängig davon, ob sie einen Partner haben, und die Wirkung, eine Frau von der Zucht abzuhalten, ist im Durchschnitt viel größer als das Stoppen eines Mannes, da sie der Fortpflanzungsengpass sind. Man kann der Ansicht sein, dass die Menschen und ihre Nachkommen das Elend, das ihnen zukommt, verdienen und (mit seltenen Ausnahmen) die Reichen und Berühmten die schlimmsten Übeltäter sind. Meryl Streep oder Bill Gates oder J.K Rowling und jedes ihrer Kinder kann 50 Tonnen Topsoil jedes Jahr für Generationen in die Zukunft zerstören, während ein indischer Bauer und seine 1 Tonne zerstören können. Wenn jemand das leugnet, ist das in Ordnung, und zu seinen Nachkommen sage ich "Willkommen in der Hölle auf Erden" (WTHOE). Heute liegt der Schwerpunkt immer auf den Menschenrechten, aber es ist klar, dass die menschliche Verantwortung die Menschenrechte ersetzen muss, wenn die Zivilisation eine Chance haben soll. Niemand bekommt Rechte, ohne ein verantwortungsvoller Bürger zu sein, und das erste, was dies bedeutet, istdie minmale Umweltzerstörung. Die grundlegendste Verantwortung sind keine Kinder, es sei denn, eure Gesellschaft bittet euch, sie zu produzieren. Eine Gesellschaft oder eine Welt, die Menschen nach dem Zufallsprinzip züchten lässt, wird immer von egoistischen Genen ausgebeutet, bis sie zusammenbricht (oder einen Punkt erreicht, an dem das Leben so schrecklich ist, dass es nicht lebenswert ist). Wenn, die Gesellschaft weiterhin die Menschenrechte als primäre, zu ihren Nachkommen, kann man mit Zuversicht sagen "WTHOE". Wer aus der modernen zweisystems-Sichteinen umfassenden, aktuellen Rahmen für menschliches Verhalten wünscht, kann mein Buch "The Logical Structure of Philosophy, Psychology, Mindand Language in Ludwig Wittgenstein and John Searle' 2nd ed (2019) konsultieren. Das Problem, wie der Völkermord an den Juden in der Nazizeit in der SBZ/ DDR behandelt wurde, war Gegenstand zahlreicher wissenschaftlicher Abhandlungen von Philologen und Historiken. In den Jahren 1990-2000 wurden die Arbeiten von u.a. Mario Kessler, Michael Wolffsohn, Angelika Timm, Thomas Jung und Ulrike Offenberg veröffentlicht. Die dort formulierten Thesen bilden die Grundlage für diesen Artikel. Er schildert die Lage der jüdischen DDR-Bewohner, die sich nach Kriegsende für das Leben in Deutschland entschieden haben. Es wurde versucht, die Kluft zu (...) veranschaulichen, die zwischen der von der Regierung betriebenen Propaganda und dem ostdeutschen Alltag bestand. Die im Artikel dargestellten politischen und ideologischen Grundlagen des ostdeutschen Staates, wie auch die Realität, in welcher die jüdischen DDR-Bürger gelebt haben, bilden wichtige Kontexte für das Schaffen von Jurek Becker. Die angedeuteten Probleme, die die jüdische Bevölkerung zu bewältigen hatte, wie etwa die Unmöglichkeit der Identitätsfindung in der scheinbar homogenen, in Wirklichkeit jedoch deutlich geteilten ostdeutschen Gesellschaft, kommen hier zur Sprache. Da Becker selbst von diesem Problem betroffen war, inspirierte ihn dies bei der Arbeit an seinen Romanen, Erzählungen und anderen literarischen Texten, die oft autobiographische Züge aufweisen. Dies wurde am Beispiel von Bronsteins Kinder dargestellt. Die existenziellen Probleme der jüdischen Bevölkerung wurden hier in Verbindung mit der Kritik der ostdeutschen Gesellschaft geschildert. Der normative Gehalt des Subsidiaritätsprinzips und seine Bedeutung für die Politische und Soziale Union Europas (S. 201-203) 1. Die Entwicklung des Maßstabs normativer Subsidiarität im ersten Kapitel beruht auf der Erkenntnis, dass dem Subsidiaritätsprinzip insbesondere von seinen protestantischen Wurzeln und seiner Ausprägung in der katholischen Soziallehre her ein spezifisch normativer Kerngehalt innewohnt, der als Idee auch dem Grundgesetzt als zwar weltanschaulich neutraler, aber nicht wertneutraler politischer Ordnung zugrunde liegt. Ausgehend von einem Menschenbild, das christliche Personalität und gesellschaftliche Solidarität umfasst, setzt (...) der materiale Gehalt des Subsidiaritätsprinzip insofern Grenzen, "als die Legitimation einer politischen Gemeinschaft nur von der Einzelperson im Sinne des individualistischen Liberalismus erfolgen kann und als die Anwendung des Subsidiaritätspinzips der Solidarität sozialer Einheiten bedarf. 2. Das ursprünglich von den deutschen Ländern anvisierte Ziel einer Verankerung des Strukturprinzips des Föderalismus im Vorfeld des Maastrichter Vertrages, ergänzt um das Subsidiaritätsprinzip als Prinzip der Kompetenzausübung, scheiterte am Widerstand Großbritanniens. Die Briten setzten das föderative Prinzip mit einem zentralistischen Bundesstaat gleich, den sie auf jeden Fall verhindern wollten. Fortan verbanden die Deutschen, insbesondere die deutschen Länder und Bundesregierung mit Unterstützung der beiden großen Kirchen einschließlich der kirchlichen Wohlfahrtsverbände, mit dem Subsidiaritätsprinzip neben einer Föderalisierung der Europäischen Union auch das Ziel, die Gesundheits- und Sozialpolitik auf europäischer Ebene auszubauen. Wenig später, schon im Verlauf der der Ratifikation des Vertrages, wird das Subsidiaritätsprinzip seitens der Bundesregierung und der deutschen Länder auf den Vorrang der der unteren Ebene umgemünzt. 3. Parallel zum Subsidiaritätsstreit in den 60er Jahren wird die Nähe zur Person bzw. zum Bürger instrumentalisiert, um dem Subsidiaritätsbegriff den Inhalt zu geben, der aus machtpolitischen Interessen opportun erscheint. Im innerdeutschen Subsidiaritätssstreit der 60er Jahre wurde die funktionale Dimension des Prinzips in den Vordergrund gedrängt, wohingegen seit 1993 seitens der Bundesregierung und der deutschen Länder im europäischen Kontext die territoriale Dimension des Prinzips, die sich gegen europäische Institutionen als Inbegriff bürgerferner, nicht demokratisch legitimierter Politik richtet, hervorgehoben wird. In beiden Fällen geht die aus Gründen normativer Subsidiarität gebotene Balance zwischen Identität und Funktion, zwischen Demokratie und Effizienz, verloren. 4. In den 60er Jahren haben die Verbände der freien Wohlfahrtspflege ihre Freiheit gegen Staatsnähe eingetauscht. Daraus entstanden neo-korporatistische Strukturen, die die Verbände zu mächtigen Trägern sozialer Dienstleistungen werden ließen. Die Rolle der Verbände als intermediäres Bindeglied zwischen Bürger und Staat wurde vernachlässigt. 5. In den 90er Jahren im europäischen Kontext die funktionale Dimension des Subsidiaritätsprinzip auf den territorialen Rahmen der Mitgliedstaaten zurecht gestutzt. Im Vordergrund steht nicht die bestmögliche Lösung eines Problems. Man gibt sich mit der vermeintlich "ausreichenden" Lösung auf mitgliedsstaatlicher Ebene zufrieden. Die systematische Auslegung, die im Hinblick auf die Sicherung der Funktionsfähigkeit der Gemeinschaft von besonderer Bedeutung ist, ergibt hingegen, "dass das Subsidiaritätspinzip als Kompetenzausübungsprinzip verfasst ist und zweitens, dass eine Entscheidung sowohl auf der Ebene der Gemeinschaft als auch auf Ebene der Mitgliedstaaten bürgernah sein kann." Deutlich tritt hier die Kluft zwischen rechtlicher Konzeption, die Ausdruck universeller Geltung des Prinzips ist, und verfolgten politischen Eigeninteressen der Akteure hervor. 6. Wenngleich bei den Verbänden der freien Wohlfahrtspflege, insbesondere den kirchlichen, der Territorialaspekt des Subsidiaritätsprinzips dominiert, gibt es Anzeichen dafür, dass die Überzeugung wächst, dass ohne eine sachbezogene, auf weitere Integration gerichtete Europapolitik auch die drei Wohlfahrtspflege in Deutschland nicht aufrechtzuerhalten ist. So vertreten die kirchlichen Verbände im Rahmen einer von der Kommission initiierten Konsultation zu Armut und Ausgrenzung in Europa die Ansicht, dass eine Lösung auf mitgliedsstaatlicher Ebene nicht ausreichend sei. In welcher Form die sozialpolitische Verantwortung auf europäischer Ebene wahrgenommen werden soll, bleibt offen. 7. Weder das Hervorheben der Nation als die maßgebliche territoriale Größe, die ihren Bürgern Schutz und Sicherheit bieten kann, noch die Vorstellung, Europas Vielfalt durch die Mobilisierung der Selbstregulierungskräfte der Gesellschaft erhalten zu können, bieten Perspektiven, das Demokratie-Effizienz-Dilemma zu überwinden. 8. Der Erhalt europäischer Demokratien ist ohne das Herausbilden transnationaler Formen von Demokratie nicht denkbar. Denn der Nationalstaat allein kann die Substanz der Demokratie nicht gewährleisten. Der nationale Wohlfahrtsstaat wird ausgehöhlt. Übrig bleibt die leere Hülle nationaler Souveränität. 9. Aussicht bietet eine zivilgesellschaftliche Verschränkung von Politik und Gesellschaft. Repräsentative nationale Akteure kooperieren zur Erfüllung einer europäischen Aufgabe und entwickeln daraus eine europäische Identität. Aufgrund ihrer assoziativen Funktion sind hier vor allem zivilgesellschaftliche Akteure gefragt. Hier eröffnet sich den Wohlfahrtsverbänden die Chance, sich auf ihre Wurzeln zu besinnen und verstärkt ihre Rolle in der Gesellschaft wahrzunehmen, um sich so die Position der Repräsentativität nachhaltig zu sichern. 10. Eine gleichgewichtige funktionale Repräsentation wirtschaftlicher, sozialer und kultureller Interessen einschließlich Repräsentationsmonopol und Mitverantwortung für die ausgehandelten Ergebnisse kann einen Beitrag zur Behebung des europäischen Demokratiedefizit leisten. Dies setzt voraus, dass die Europäische Union staatsähnliche Eigenschaften ausbildet, die sie dazu befähigt, Verhandlungsgleichgewichte zwischen den Repräsentanten der verschiedenen Interessen herzustellen und autonom über Umverteilungsfragen zu entscheiden und eine entsprechende Politik auch durchzusetzen. Konservatismus und Liberalismus verfolgen dasselbe politische Ziel: eine „Verfassung der Freiheit“ mit repräsentativen Institutionen, Rechtsstaatlichkeit, Gewaltenteilung und einem Grundrechtekatalog für alle Bürgerinnen und Bürger.

Die Aufgabe der Philosophie besteht nicht darin, den moralischen Zeigefinger zu erheben und vorzugeben, was man tun soll und was nicht. Vielmehr zeigt die Philosophie unterschiedliche Argumente auf, weshalb die eine oder andere Haltung vertretbar oder aus gewissen Gründen gegebenenfalls vertretbarer ist als eine andere. Insofern eine Gesellschaft an Klugheit interessiert ist und sich einer zukünftigen Entwicklung verantwortungsvoll stellt, kann die Philosophie eine wertvolle Aufgabe übernehmen: Die Methode, analytisch das Für und Wider abzuwiegen, bedeutet nicht zuletzt viel Arbeit und Aufmerksamkeit (...) für das Detail. Wie beispielsweise das Kapitel zur Grünen Gentechnik (Seite 6) zeigt, sind die Diskussionen um die zu fällenden moralischen Urteile nicht an ein externes Gremium zu delegieren. Im Gegenteil: Die Diskussion sollte innerhalb der Gesellschaft stattfinden, einerseits um den unterschiedlichen Haltungen Platz zu geben, andererseits aber, weil nur auf diese Weise ein echter Konsens zu Stande kommen kann. Die Rolle der Philosophie zeigt sich ähnlich auch, wenn es um die für die pluralistische Gesellschaft zentrale Toleranz geht. Die wertenden Einstellungen der Bürgerinnen und Bürger verdienen es, ernst genommen zu werden und offen diskutiert zu werden. Nur durch eine tiefgreifende Auseinandersetzung lässt sich verhindern, dass populistische Wortführer mit eigennützigen, aber aufmerksamkeitsstarken Argumenten von den Themen ablenken, die ernsthaft angegangen werden möchten: Die Vision einer friedlichen und freiheitlichen Gesellschaft, das demokratische Ideal, wird nicht mit dem Verweis auf die „Krise“ aufgegeben. Verantwortung interessiert die Bürgerinnen und Bürger schliesslich eben doch mehr, als Donald Trumps neuste Lüge. Das philosophische Themendossier zeigt, dass die akademische Philosophie viel leis-tet, um eine oberflächliche Auseinandersetzung mit gesellschaftlich und zukunftsrelevanten Themen zu verhindern. Auch wenn das auf den ersten Blick nach viel Anstrengung klingt, so zeigt der zweite Blick, dass darin viel Wohlwollen zugunsten der Gesellschaft steckt. Es lohnt sich, den Mut aufzubringen, sich intensiv mit den eigenen Werturteilen auseinanderzusetzen und das Auge vom eigenen Wohl auch auf das Wohle aller schweifen zu lassen. Philosophie kann „ansteckend“ sein und viel Freude hervorrufen: Gerade dann, wenn man neue Ideen mit dazu gewinnt oder andere Argumente für bereits gefasste Entscheidungen kennenlernt. Die Philosophie entwickelt sich fortlaufend weiter und bleibt somit mehr denn je: stets aktuell. (shrink)

Kafka's work provoked more than three decades of interpretations before Wagenbach provided information showing that Kafka was quite familiar with the work of Brentano and his Prague followers, including their unique conceptions of natural law, ethical concepts, and human acquaintance with them. Kafka took a lively interest in discussions in this Prague circle, and The Trial may without violence be read as a deliberate illustration for issues in philosophy of law as they would have been understood within this circle. This (...) does not require that it be read as a reflection of Kafka's personality, nor does it require that he accepted Brentano's views. Wagenbach demonstrated Kafka's familiarity with unique conceptions, in the work of Brentano and his Prague followers, of natural law and ethics. Issues involved in these conceptions are cogently illustrated in The Trial. K. is tried for violating a law which is no positive law but a necessary condition for all positive law since all positive laws imply that they ought to be obeyed. Brentano adamantly rejected all forms of nativism. The opposite of 'natural' in the phrase 'natural law' is not 'acquired' but 'conventional.' Acquaintance with natural norms is entirely acquired: persons having no such acquaintance can exist; K. is such a person. Natural norms, have a cognizable inherent correctness; any other norms oblige only through being authoritatively decreed. Conventional guilt or innocence is subject to influence. K.'s quest for a person to exert such influence on his behalf is evidence of his guilt. K. is unaware that absolute guilt is possible. In the Prometheus myth related by Plato's Protagoras, a sense of justice and right is necessary for politically organized society. Without insight into the natural sanction for correct positive laws, citizens cannot fulfill the duty rationally to choose positive laws: citizens will wrong one another, cities perish, humankind will be threatened. The myth gives important clues to the imagery of the parable "Before the Law." Every authentic act of willing requires that something be desired for its own sake. Since there is a plurality of intrinsic goods, authentic action requires recognizing the chosen action to be better than its alternatives. Acquaintance with good, evil, better, and worse is acquired, Brentano insisted, only by perceiving certain affects to be correct. Like judgments, affects are either blind or evident. Basic moral concepts arise like all others from perception. K. could become innocent by acquiring the lacking concepts. Then, actual acquittal would be just despite his guilt when arrested. His trial tests whether he is likely to experience intrinsically correct emotions. Guilt would be objective, independent of any finding by the Court. K.'s guilt entails his lacking any such concept of absolute guilt. He is convinced that guilt depends entirely on the Court, is altogether a matter of authority.
