Multilingualism as a (sub)-discipline of linguistics with special interest in language acquisition and didactics was established in the 1990s. As time moved on, the discipline of multilingualism evolved into an interdisciplinary field of research, but not yet including a philosophy of multilingualism. In this record of a conversation between linguist Britta Hufeisen and philosopher Alfred Nordmann, the concept of multilingualism is explored as well as its differences to monolingualism. This implies differences also between the philosophy of language and a philosophy (...) of multilingualism. Upon closer scrutiny it becomes clear that multilingualism is not only about language acquisition anymore but about the ways in which individuals can make themselves understood and orient themselves in a multilingual environment which includes artificial languages. In this way, the notion of affordances comes to the fore as individuals are afforded by their environment the use different language skills in different situations. The same applies to technology: Technology always affords us to do something in a specific way, but at the same time, while using it, we discover other possible uses and thus assign new meanings to it. This is where the linguist and the philosophic view diverge: The former puts an emphasis on the use of language and the actual semantic meaning of words, whereas the latter analyzes language and technology primarily in terms of its use, therefore meaning becomes a product of use. The current COVID-19 pandemic and the previous SARS/MERS outbreaks of 2003 and 2012 have resulted in a series of major global public health crises. We argue that in the interest of developing effective and safe vaccines and drugs and to better understand coronaviruses and associated disease mechenisms it is necessary to integrate the large and exponentially growing body of heterogeneous coronavirus data. Ontologies play an important role in standard-based knowledge and data representation, integration, sharing, and analysis. Accordingly, we initiated the (...) development of the community-based Coronavirus Infectious Disease Ontology in early 2020. -/- As an Open Biomedical Ontology (OBO) library ontology, CIDO is open source and interoperable with other existing OBO ontologies. CIDO is aligned with the Basic Formal Ontology and Viral Infectious Disease Ontology. CIDO has imported terms from over 30 OBO ontologies. For example, CIDO imports all SARS-CoV-2 protein terms from the Protein Ontology, COVID-19-related phenotype terms from the Human Phenotype Ontology, and over 100 COVID-19 terms for vaccines (both authorized and in clinical trial) from the Vaccine Ontology. CIDO systematically represents variants of SARS-CoV-2 viruses and over 300 amino acid substitutions therein, along with over 300 diagnostic kits and methods. CIDO also describes hundreds of host-coronavirus protein-protein interactions (PPIs) and the drugs that target proteins in these PPIs. CIDO has been used to model COVID-19 related phenomena in areas such as epidemiology. The scope of CIDO was evaluated by visual analysis supported by a summarization network method. CIDO has been used in various applications such as term standardization, inference, natural language processing (NLP) and clinical data integration. We have applied the amino acid variant knowledge present in CIDO to analyze differences between SARS-CoV-2 Delta and Omicron variants. CIDO's integrative host-coronavirus PPIs and drug-target knowledge has also been used to support drug repurposing for COVID-19 treatment. -/- CIDO represents entities and relations in the domain of coronavirus diseases with a special focus on COVID-19. Abstract: Background: Coronary artery disease remains the leading cause of morbidity and mortality Worldwide. Previous reviews pointed that nursing interventions are beneficial for coronary artery patients. However, most interventions focused on education and counselling, but not consistent with the outcome set; still did not consider patient’s coronary artery disease risky characteristics. Related studies in China also difficult to find. Therefore this study was conducted to investigate kinds of nursing interventions delivered to coronary artery patients and match them with patient’s risk (...) factors of coronary artery disease. Results of this study were expected to add new knowledge that will alert nurses to consider coronary artery risk factors which in turn might enable the development of appropriate approaches to improve patient’s wellbeing hence reduce frequent coronary artery morbidity and mortality. Methods: A descriptive, cross-sectional, retrospective design using clinical case notes was employed. Study was undertaken in coronary care wards at the teaching hospital in China from November 2017 to September 2018. Structured-literature supported self-designed questionnaire was utilized for data collection. Chi square (χ2) test and multivariate logistic regression for adjusted odds ratio with 95% confidence interval were used to compare the relationship among independent (patient’s risk coronary artery disease factors) and dependent (nursing interventions) categorical variables. Ethical permission was granted accordingly. Results: A total of 300 coronary artery patients’ case notes were audited with mean age 63±11.2 years. Of these 175 (58.3%) were males. 126(42%) were smoking and 224(74.7%) were hypertensive. More evidence based nursing interventions than education and counselling were found to be delivered to these patients. “Administer coronary artery disease medication and their instructions” was mostly delivered to many patients 291(97%) while “counsel to cope with stress” was the least one 60 (20.0%). Three of eight nursing interventions delivered significantly matched with three or all of these patient’s coronary artery risk variables (age, smoking, hypertension and diabetes) (p < 0.05 and/or < 0.01) with Adjusted odds ratio (95% CI) within their significant ranges. Conclusion: This study delivers valuable insight that, nurses in the studied teaching hospital delivered beneficial evidence based nursing interventions to patients with coronary artery disease which significantly matched with their risk factors of coronary artery illness. However, care for stress was low hence needs improvement. Furthermore, research is needed to get consistency of nursing interventions with patient’s end point clinical outcomes for further appraisal of nursing efforts in caring CAD patients . (shrink)

Empirical evidence suggests that perceptual‐motor simulations are often constitutively involved in language comprehension. Call this “the simulation view of language comprehension”. This article applies the simulation view to illuminate the much‐discussed phenomenon of copredication, where a noun permits multiple predications which seem to select different senses of the noun simultaneously. On the proposed account, the (in)felicitousness of a copredicational sentence is closely associated with the perceptual simulations that the language user deploys in comprehending the sentence.

Griefbots are chatbots modeled on the personalities of deceased individuals, designed to assist with the grieving process and, according to some, to continue relationships with loved ones after their physical passing. The essay examines the promises and perils of griefbots from a Daoist perspective. According to the Daoist philosopher Zhuangzi, death is a natural and inevitable phenomenon, a manifestation of the constant changes and transformations in the world. This approach emphasizes adaptability, flexibility, and openness to alternative ways of relating to (...) the deceased after they are gone. Drawing on the Daoist ideas, this essay distinguishes between two importantly different ways to continue a relationship with the deceased, and correspondingly, two kinds of griefbot designs: preservational griefbots and transformational griefbots. A preservational griefbot, which aims to preserve the user’s relationship with the deceased, presents itself as the deceased individual by replicating the deceased’s personality as closely and for as long as possible. By contrast, a transformational griefbot aligns more with Zhuangist ideals and aims to facilitate the transformation of our relationship with the deceased. It helps the bereaved come to terms with their loss and move on with their lives, without abandoning their relationship with the deceased. Specifically, it facilitates this transformation in two ways: first, by helping the bereaved release themselves from their habitual ways of relating to the loved one, thereby bringing closure to their relationship in its previous form; and second, by enabling the bereaved to continue interacting with the ideas and legacies of the deceased in a new and digitally mediated way, which, in turn, reshapes and enriches the content and significance of their relationship. E. Husserl’s reflections in Logical Investigations on “intentional feelings” and “non-intentional feelings” are significant in both his later ethical explorations and M. Scheler’s thought on ethics. Through the incorporation of the views of Husserl and Scheler, we find that the phenomenology of the intentional feeling-acts is not only the foundation of the non-formal ethics of values in Scheler’s phenomenology, but also at least the constitutive foundation of the ethics of Husserl’s first orientation.

Zeugmatic oddness is a linguistic intuition of oddness with respect to an instance of zeugma, i.e. a sentence containing an instance of a homonymous or polysemous word being used in different meanings or senses simultaneously. Zeugmatic oddness is important for philosophical debates as philosophers often use it to argue that a particular philosophically interesting expression is ambiguous and that the phenomenon referred to by the expression is disunified. This paper takes a closer look at zeugmatic oddness. Focusing on relevant psycholinguistic (...) literature on homonymy and polysemy processing and representation, I argue that there are two different ways in which zeugmatic oddness can arise. Kant's emphasis on the aesthetic idea permeates the judgment of beauty and the creation of beauty. This paper argues that both natural and artistic beauty are concrete expressions of aesthetic ideas. Regarding natural beauty, the subject appreciates the natural object through a dual grasp of the aesthetic normal idea and the rational idea. Regarding artistic beauty, the aesthetic idea can make the rational idea sensible, allowing the subject to derive aesthetic pleasure by reflecting on the aesthetic representations of rational ideas. (...) Moreover, genius as a natural gift is capable of giving rules for creating artistic beauty, in which the spirit realizes the universal expression of the aesthetic idea. In Kant's framework, the combination of taste and genius provides a context for reflective judgment, which can thus be reconciled with the “free play of the imagination and the understanding.” In this way, the aesthetic idea embodies the dual perspective of subject and object, thereby furnishing a normative dimension to Kant's aesthetics. This essay develops an inferential account of model explanation, based on Mauricio Suárez’s inferential conception of scientific representation and Alisa Bokulich’s counterfactual account of model explanation. It is suggested that the fact that a scientific model can explain is essentially linked to how a modeler uses an established model to make various inferences about the target system on the basis of results derived from the model. The inference practice is understood as a two-step activity, with the first step involving making (...) counterfactual statements about the model itself and the second step involving making hypothetical statements transferring over claims derived from the model onto the target. According to some formulations of the thesis of revelation, knowledge about the essences of phenomenal properties is available through introspection. But this claim may seem doubtful given relevant limits of introspection. This paper articulates the worry and sketches responses to address it.

Michael Weisberg’s account of scientific models concentrates on the ways in which models are similar to their targets. He intends not merely to explain what similarity consists in, but also to capture similarity judgments made by scientists. In order to scrutinize whether his account fulfills this goal, I outline one common way in which scientists judge whether a model is similar enough to its target, namely maximum likelihood estimation method. Then I consider whether Weisberg’s account could capture the judgments involved (...) in this practice. I argue that his account fails for three reasons. First, his account is simply too abstract to capture what is going on in MLE. Second, it implies an atomistic conception of similarity, while MLE operates in a holistic manner. Third, Weisberg’s atomistic conception of similarity can be traced back to a problematic set-theoretic approach to the structure of models. Finally, I tentatively suggest how these problems might be solved by a holistic approach in which models and targets are compared in a non-set-theoretic fashion. (shrink)

Since the late 20th century, the gender gap in philosophy has received widespread attention from the academic community. Although research on this issue has made some initial progress in certain countries and has contributed to the implementation of relevant policies, gender gap in philosophy remains a global issue, particularly in East Asian countries. Therefore, further exploration of this topic remains necessary. This paper aims to establish a research agenda based on an analysis of existing studies to address the challenges and (...) consequences of gender gap in philosophy. From a feminist perspective, I seek to explore the manifestations, roots, and impacts of gender gap, as well as various solutions, with a particular focus on ethics of care and intersectionality. By identifying the limitations of current research, I will also provide feasible suggestions for future studies to advance the in-depth exploration of gender equality in philosophy. (shrink)

Polger and Shapiro argue that their official recipe, a criterion for judging when the phenomenon of multiple realization exists, renders MR less widespread than its proponents have assumed. I argue that, although Polger and Shapiro’s criterion is a useful contribution, they arrive at their conclusion too hastily. Contrary to Polger and Shapiro, I claim that the phenomenon of multiple realization in the biological world, judged by their criterion, is not as scarce as they suggest. To show this, an updated official (...) recipe, namely a multiple mechanistic realization thesis, integrating Polger and Shapiro’s criterion with a compositional conception of realization, is developed. Then, three examples of varied kinds are examined, showing that cases of MR are not so hard to find in the biological world. (shrink)

In this paper, the author will explore the relationship between agency and intentionality of the artificial agent in the following seven ways.

I propose a dynamic causal approach to characterizing the notion of a mechanism. Levy and Bechtel, among others, have pointed out several critical limitations of the new mechanical philosophy, and pointed in a new direction to extend this philosophy. Nevertheless, they have not fully fleshed out what that extended philosophy would look like. Based on a closer look at neuroscientific practice, I propose that a mechanism is a dynamic causal system that involves various components interacting, typically nonlinearly, with one another (...) to produce a phenomenon of interest. The term realism has multiple meanings in the study of pictures. Roughly speaking, it concerns both what pictures depict—that is, “realism-what”—and how pictures depict, or “realism-how.” Realism-what reflects a particular interest in the selection of a picture’s subject matter, which is self-consciously championed by the 19th-century Realist school of painting but can also be found throughout the history of art. Realism-how, on the other hand, deals with a special way of depiction that is characterized by the accuracy and informativeness of (...) pictures. Although both of these aspects of realism are of historical and theoretical interest, but it is realism-how that has received more attention in the philosophical discussion and is considered a central topic in the philosophy of pictorial representation within the analytic tradition. There are three widely accepted features of pictorial realism, as I shall call it. First, pictorial realism is a property that can be attributed to individual pictures, pictorial systems, styles, genres, and techniques. It makes perfect sense to say that the Mona Lisa is a realistic picture and color photography is a pictorial system that is realistic. Second, realism is comparative and a matter of degree. For example, arguably, Picasso’s last self-portrait (1972) is less realistic than his first (1896). Third, realism can be relative in the sense that the judgment of realism can vary due to different factors, such as cultural conventions, contexts of use, etc. In the contemporary literatures, there are at least three kinds of theories of pictorial realism: resemblance theories, information theories, and habituation theories. Both resemblance theories and information theories spell out pictorial realism in terms of the depiction of properties. The difference is that resemblance theories appeal to the concept of resemblance, or the sharing of properties between pictures and their subjects, whereas information theories focus on how the properties a picture depicts its subject as having can convey information about its subject. Nelson Goodman rejects both kinds of theories and proposes instead the habituation theory, which claims that realism is just a matter of familiarity or habituation. There are also accounts of pictorial realism that are hard to categorize which appeal to perception and make-believe theories but are closely related to one or other of these kinds of theories in various ways. Emotion terms such as “sad”, “happy”, and “joyful” apply to a wide range of entities. We use them to refer to mental states of sentient beings, and also to describe features of non‐mental things such as comportment, nature, events, artworks and so on. Drawing on the literature on polysemy, this article provides an in‐depth analysis of emotion descriptions. It argues that emotion terms are polysemous and distinguishes seven related senses. Les questions les plus fondamentales de la phénoménologie du sentir de Max Scheler concernent la place de l’intentionnalité dans la phénoménologie du sentir et la structuration de la sphère émotionnelle. Dans la première section, nous nous focaliserons avant tout sur la différence entre les sentiments non intentionnels et le sentir intentionnel, en comparant sur ce point les positions de Scheler et de Husserl. En effet, Scheler critique ces deux thèses fondamentales de Husserl: 1) les actes affectifs et leurs corrélats (« (...) valeurs ») doivent être associés aux représentations et à leurs corrélats (« choses », Sachen ); 2) les actes affectifs, en tant qu’actes non objectivants, sont fondés dans les actes objectivants. D’une part, pour Scheler, la valeur est un objet unique en son genre du sentir des valeurs, et le sentir intentionnel est donc un acte indépendant. D’autre part, Scheler a d’abord entrepris de dépasser la séparation entre acte objectivant et acte non objectivant. Dans ce contexte, la recherche actuelle consacrée à Scheler se heurte à de nombreuses difficultés relatives à la structuration de la sphère émotionnelle en rapport avec la hiérarchie des modalités axiologiques et avec l’a priori corrélationnel. Dans la deuxième section, nous expliquerons d’abord les idées de Scheler, puis en discuterons les difficultés. C’est par le « commerce vivant » avec le monde dans le sentir intentionnel et dans les actes émotionnels intentionnels, par les corrélats intentionnels (valeurs matérielles), que Scheler se sépare du formalisme en éthique. On the one hand, Scheler's critique of Kant's concept of a priori benefits from Husserl to a large extent, and it complements and deepens Husserl's. On the other hand, Scheler also critiques Husserl's definition of a priori. Husserl's material a priori as ideal object primarily thanks to his so-called "Bolzano- turn". In this connection, Scheler grabs hold of the relation of Husserl to Bolzano from the very beginning. For Scheler, Husserl thinks in a "platonic" way, and still falls in a (...) new type of "Platonism", or rather, logical Platonism, although he correctly refuses the ordinary Platonism. In Scheler's view, Husserl's phenomenological reduction is "not purely" executed, and therefore his phenomenological experience is problematic, or more precisely, the relation between categorial intuition and sensuous intuition is problematic. The final aim of Scheler's critique of Husserl's phenomenological understanding of "objective a priori" is to win the primary position of categorial intuition and its content , ethical insight and its correlate , and ultimately of phenomenological ethics of material value.Einerseits nimmt Schelers Kritik an Kant bezüglich des Begriffs des Apriori die Einsichten Husserls in großem Umfang auf. Schelers Kritik an Kant ergänzt und vertieft die Husserlsche Kant-Kritik. Andererseits kritisiert er aber auch Husserls Bestimmung des Apriori. Vor allem verdankt sich das materiale Apriori als idealer Gegenstand bei Husserl der sogenannten “Bolzano’schen Wendung”. Von Anfang an kritisiert Scheler Husserl in diesem Punkt, indem er dem Verhältnis zwischen Bolzano und Husserl immer präziser nachging. Für Scheler unterliegt Husserl mit Recht keinem platten Platonismus. Aber dennoch verfahre Husserl immerhin “platonistisch”, er unterliege einem “Neoplatonismus”, bzw. einem logischen Platonismus. Weil die phänomenologische Reduktion bei Husserl nach Schelers Meinung “nicht reinlich” durchgeführt wird, ist die phänomenologische Erfahrung bei Husserl problematisch, genauer gesagt ist das Verhältnis zwischen der kategorialen Anschauung und der sinnlichen Anschauung problematisch. Der Endzweck von Schelers Kritik an der phänomenologischen Auffassung des gegenständlichen Apriori bei Husserl besteht darin, die primäre Stelle der kategorialen Anschauung und ihrer Gehalte , sowie der sittlichen Einsicht und ihrer Korrelate und zuletzt der phänomenologisch materialen Wertethik zu gewinnen.S jedne strane, Schelerova kritika Kantova pojma a priori u velikoj mjeri duguje Husserlu, te dopunjuje i produbljuje Husserlovu. Prema Scheleru, Husserl razmišlja na "platonski" način te upada u novi tip "platonizma" ili, točnije, logičkog platonizma, iako s pravom odbacuje obični platonizam. Scheler smatra da Husserlova fenomenološka redukcija nije izvedena "čisto" te da je stoga njegovo fenomenološko iskustvo proble- matično ili, točnije, problematičan je odnos između kategorijalnog zora i osjetilnog zora. Krajnji cilj Schelerove kritike Husserlova fenomenološkog shvaćanja "objektivnog a priori" jest zadobivanje primarne pozicije kategorijalnog zora i njegova sadržaja , etičkog uvida i njegova korelata te, na koncu, fenomenološke etike materijalne vrijednosti. This study aims to provide a coherent new interpretation of the notorious anti-hedonism of Speusippus, Plato’s nephew and the second scholarch of the Academy, by reconsidering all the relevant sources concerning his attitude toward pleasure—sources that seem to be in tension or even incompatible with each other. By reassessing Speusippus’ anti-hedonism and Aristotle’s response, it also sheds new light on the Academic debate over pleasure in which he and Aristotle participated: This debate is not merely concerned with the truth and (...) credibility of the arguments for or against hedonism; there are also notable differences among the participants in their understanding of the practical significance of evaluating hedonic experiences. This new interpretation allows us to better understand Aristotle’s selective representation of the intra-school debate and some neglected features of his responses to different interlocutors. Philosophers debate over the truth of the Doctrine of Doing and Allowing, the thesis that there is a morally significant difference between doing harm and merely allowing harm to happen. Deontologists tend to accept this doctrine, whereas consequentialists tend to reject it. A robust defence of this doctrine would require a conceptual distinction between doing and allowing that both matches our ordinary use of the concepts in a wide range of cases and enables a justification for the alleged moral difference. Nearly thirty years ago, Robert Alexy in his book The Concept and Validity of Law as well as in other early articles raised non-positivistic arguments in the Continental European tradition against legal positivism in general, which was assumed to be held by, among others, John Austin, Hans Kelsen and H.L.A. Hart. The core thesis of legal positivism that was being discussed among contemporary German jurists, just as with their Anglo- American counterparts, is the claim that there is no necessary connection (...) between law and morality. Robert Alexy has argued, however, that the law, besides consisting conceptually of elements of authoritative issuance and social efficacy, necessarily lays a claim to substantial correctness, which is derived from analytical arguments. Furthermore, if this claim to substantial correctness necessarily requires the incorporation of moral elements into law, then the ‘necessary connection thesis’, as defended by non-positivism, can be justified. Some of the most significant objections to this sort of claim, stemming from the Anglo-American world, are those introduced by Joseph Raz. In his ‘Reply’ to Robert Alexy, Raz raises at least three interesting criticisms, including, first, the ambiguity of ‘legal theory in the positivistic tradition’, second, the indeterminate formulations of the ‘separation thesis’, and, third, the necessary claim of law to legitimate authority as a moral claim. As a point of departure, I will argue that Raz’s three criticisms are misleading. For they do not enhance our understanding of the genuine compatibility or incompatibility between legal positivism and non-positivism. Despite the frequently reformulated theses of legal positivism and the various kinds of opponents responding thereto, the essential divergence between legal positivism and non-positivism was and remains the answer to the question of the relation between law and morality. Furthermore, I will clarify that in the strictest sense there can be three and only three logically possible positions concerning the relation between law and morality: the connection between them is either necessary, or impossible (i. e. they are necessarily separate), or contingent (i. e. they are neither necessarily connected nor necessarily separate). The first position is non-positivistic, while the latter two positions are, indeed, both positivistic, but in different forms: one may be called ‘exclusive’ legal positivism, the other ‘inclusive’ legal positivism. I will continue by showing that these three positions stand to one another in the relation of contraries, not contradictories, and that, taken together, they exhaust the logically possible positions concerning the relation between law and morality, never mind the tradition or authority from which these positions are derived. Raz mentions, however, many changeable formulations of the separation thesis, which even leads him to acknowledge ‘necessary connections between law and morality’. One who is trying to understand legal positivism would no doubt be puzzled by this claim. Nevertheless, I will argue that this is an alternative strategy of legal positivism, and it points to naturalistically oriented view. Although this necessary separation between law and morality, understood naturalistically, strikes one as strengthening the separation, in the end it leads to a weakened notion of necessity. This weakened necessary separation thesis, however, cannot be justified through the so-called claim of the law to legitimate authority, defended by Raz, for it is difficult to answer the question of whether a normally justified but factual authority can gain legitimate authority. Finally, the necessary connection between law and morality in a strong sense can still be justified by the claim of law to correctness, as per Alexy’s argument. (shrink)

The concept of human dignity has been criticized as either too thick or too thin. However, according to the non-positivistic standpoint, the legal normativity of human dignity can be justified and thus strengthened by means of its moral correctness. From the individual perspective, Mencius’ understanding of human dignity as an intrinsic value and Kant’s formula of ‘man as an end in itself’ can be adequately understood based on the differentiation of, as well as the connection between, principium diiudicationis and principium (...) executionis, between will and choice, and between homo phaenomenon and homo noumenon (that is, ‘humanity in the personality’). From the social perspective, since the dual dimensions of the individual and the social person are both fictive constructions, even Radbruch, once as a supporter of social law, has not replaced the concept of ‘legal person’ and, in the post-War period, acknowledges individualistic human dignity as the criterion for applying the famous ‘disavowal formula’. On the one hand, human dignity shows at least a weak normative character, which requires, firstly, balancing between the exercise of state powers and the constitutional review under the guidance of the dual dimensions of man and, secondly, optimization of the principle of human dignity in individual cases. On the other hand, through the necessary connection between the concept of dignity and that of personality, human dignity can exhibit a strong normative character, which unavoidably requires a metaphysical justification. The debate over the value of pleasure among Eudoxus, Speusippus, and Aristotle is dramatically documented by the Nicomachean Ethics, particularly in the dialectical pros-and-cons concerning the so-called argument from contraries. Two similar versions of this argument are preserved at EN VII. 13, 1153b1–4, and X. 2, 1172b18–20. Many scholars believe that the argument at EN VII is either a report or an appropriation of the Eudoxean argument in EN X. This essay aims to revise this received view. It will explain (...) why these two arguments differ in premises, contents and purposes, and why these distinctions matter for a proper assessment of Aristotle’s understanding of pleasure and pain in general and his dialectical art in particular. El concepto de dignidad humana ha sido considerado o demasiado denso o demasiado delgado. Sin embargo, desde el punto de vista del no-positivismo, la normatividad jurídica de la dignidad humana puede ser justificada y reforzada por medio de su corrección moral. Desde una perspectiva individual, la comprensión de Mencio sobre la dignidad humana como un valor intrínseco y el imperativo categórico de Kant (el ser humano como un fin en sí mismo) podrían ser adecuadamente comprendidos con base en la diferencia (...) (así como la conexión) entre el principium diiudicationis y el principium executionis, entre voluntad y “elección”; así como entre homo phaenomenon y homo noumenon (es decir, humanidad en la persona de los seres humanos). Desde una perspectiva social, las dimensiones del individuo y la persona social son construcciones ficticias; inclusive Radbruch -alguna vez defensor del derecho social- no remplazó el concepto de “persona jurídica” y, en el periodo de posguerra, reconoció la dignidad humana individual como el criterio para aplicar su famosa “fórmula de Radbruch". Por una parte, la dignidad humana muestra cuando menos un carácter normativo débil, el cual requiere, primero, ponderar entre el ejercicio de los poderes estatales y el control de constitucionalidad bajo la guía de la dimensión dual del ser humano y, segundo, la optimización del principio de la dignidad humana en casos particulares. Die Disziplin, die als „Juristische Methodenlehre“ bezeichnet wird, ist gegenwärtig chinesischen Juristen nicht fremd, sie stammt aber ursprünglich aus dem deutschen Sprachraum. In der Literatur finden sich auch verwandte Ausdrücke wie „Juristische Methodologie“, „Juristische Methodik“ bzw.„Methodenlehre der Rechtswissenschaft“. Seit Anfang des 21. Jahrhunderts wurde ihre Rezeption in China durch zwei Übersetzungen gekennzeichnet, nämlich die „rechtswissenschaftliche Methodenlehre“ (faxue fangfalun) und die „rechtliche Methodenlehre“ (falü fangfalun). Neben der herkömmlichen Methodenlehre entwickelte sich auch eine jüngere Theorie der juristischen Argumentation, die die weltweite Aufmerksamkeit (...) sogar außerhalb Deutschlands auf sich lenken konnte und deren Bestand in China einen ganz selbständigen Abschnitt verdient. Als Hintergrund dafür soll von vornherein ein Blick auf die Entwicklungen der chinesischen Rechtstheorie und Rechtsphilosophie nach 1978 und demzufolge auf die Entstehung der Methodenfrage in der chinesischen Rechtswissenschaft geworfen werden. Based on the dispute between Protagoras and Socrates on the origin of ethics, one can ask the question of whether the principle of ethics is reason orfeeling/emotion, or whether ethics is grounded on reason or feeling/emotion. The development of Kant’s thoughts on ethics shows the tension between reason and feeling/emotion. In Kant’s final critical ethics, he held to a principle of “rational a priori.” On the one hand, this is presented as the rational a priori principle being the binding principle (...) of judgment. On the other hand, it is presented as the doctrine of “rational fact” as the ultimate argument of his ethics. Husserl believed that Kant’s doctrine of a rational a priori totally disregarded the a priori essential laws of feeling. Like Husserl, Scheler criticized Kant’s doctrine of a rational a priori, and therefore developed his own theory of an “emotional a priori”. Both of them focused their critiques on the grounding level of ethics. Scheler, however, did not follow Husserl all the way, but criticized him and reflected on his thoughts. At last, he revealed the primary status of a phenomenological material ethics of value. (shrink)

This article argues for the explanatory autonomy of psychology drawing on cases from the multilevel modeling practice. This is done by considering a multilevel linear model in personality and social psychology, and discussing its philosophical implications for the reductionism debate in philosophy of psychology. I argue that this practice challenges the reductionist position in philosophy of psychology, and supports the explanatory autonomy of psychology.

In this paper I argue against a deflationist view that as representational vehicles symbols and models do their jobs in essentially the same way. I argue that symbols are conventional vehicles whose chief function is denotation while models are epistemic vehicles whose chief function is showing what their targets are like in the relevant aspects. It is further pointed out that models usually do not rely on similarity or some such relations to relate to their targets. For that referential relation (...) they reply instead on symbols (names and labels) given to them and their parts. And a Goodmanian view on pictures of fictional characters reveals the distinction between symbolic and model representations. (shrink)

The rigor and precision of Leibniz's "possible world" evolved into the concept of Turing machine, and with the birth of the first computer and the physical realization of Turing machine, human cognitive and intelligent activities were optimistically considered by cognitive scientists to be convertible into computational programs for simulation by machines. Cognitive science then formed the research agenda of "cognitive computationalism", and our Chinese scholars have responded to this general view that "the essence of cognition is computation" and that the (...) human brain and computers are merely formal systems for manipulating and processing symbols in their respective fields. Professor Hong Dingguo used the concepts of "manifest order" and "hidden order", Professor Jin Gulun used the philosophical categories of "constitutive theory" and "generative theory", and Liu Yuesheng used the concept of "cognition". Professor Hong Dingguo reinterpreted the relationship between the "real world" and the "possible world" by using the concepts of "manifest sequence" and "hidden sequence", Professor Jin Wulun used the philosophical categories of "composition theory" and "generation theory", and Professor Liu Yuesheng used the generalized information paradigm of "structural information" and "exchange information". "This provides a profound elucidation of the nature of cognitive logic and the process of human cognitive activities becoming symbols through coding and puts forward theoretical limits. The current theoretical dilemma and practical difficulty of cognitive science lies in the fact that it has developed algorithmic concepts in the Turing sense that can only model the explicitly sequential part of cognitive and intellectual activity, forming a constitutive atomic abstraction, or in our terms, classical "structural information", which cannot fully explain the inner mechanisms of human mental activity and its embodied flexibility, selectivity and self-emergence. Wu Xuemou's pan-system theory does not simply rely on logic and Turing machine algorithms, but models human intelligence by treating structural information as a complex large system composed of a collection of elements and a collection of relations (exchange information: five mutual eight chips), in order to break through the narrow path of seeking only the local consistency of the system as currently done; while Wang Dekui's exploration of the three-spin biological and physical path and Huang Zhanji's abandonment of the artificial means of logic to seek the large logical natural mechanisms and Mr. Zhou Liquan's proposal of a schema for successful communication using natural language on the basis of concepts such as context and implicit connotation ("Logic — A Theory of Correct Thinking and Successful Communication"), all reflect the milestones of Chinese scholars who seek to address the deeper issues of cognitive science. We believe that along this series of explorations, combined with new results in recent years in the fields of artificial life and evolutionary computation, a new research agenda in cognitive science will emerge. This paper reexamines Theophrastus’ Metaphysics 11a18–26, an obscure testimony about Speusippus, the second head of the Platonic Academy. As opposed to the traditional interpretation, which takes this passage as Theophrastus’ polemic against Speusippus’ doctrine of value, I argue that he here dialectically takes advantage of, rather than launches an attack on, the Platonist. Based on this new reading, I further propose a revision and a reassessment of the ‘gloomy metaphysics’ of Speusippus which will shed new light on his ethics.

This paper begins with Thomas Nagel's (1970) investigation of the possibility of altruism to further examine how to motivate altruism. When the pursuit of the gratification of one's own desires generally has an immediate causal efficacy, how can one also be motivated to care for others and to act towards the well-being of others? A successful motivational theory of altruism must explain how altruism is possible under all these motivational interferences. The paper will begin with an exposition of Nagel's proposal, (...) and see where it is insufficient with regard to this further issue. It will then introduce the views of Zhang Zai and Wang Fuzhi, and see which one could offer a better motivational theory of altruism. All three philosophers offer different insights on the role of human reason/reflection and human sentiments in moral motivation. The paper will end with a proposal for a socioethical moral program that incorporates both moral reason and moral sentiments as motivation. (shrink)

This book examines some possible ethical principles to resolve moral dilemmas involving water. Existing problems in current water management practices are discussed in light of these principles. Transformation of human water ethics has the potential to be far more effective, cheaper and acceptable than some existing means of “regulation”, but transformation of personal and societal ethics need time because the changes to ethical values are slow.

Most theories of slurs fall into one of two families: those which understand slurring terms to involve special descriptive/informational content (however conveyed), and those which understand them to encode special emotive/expressive content. Our view is that both offer essential insights, but that part of what sets slurs apart is use-theoretic content. In particular, we urge that slurring words belong at the intersection of a number of categories in a sociolinguistic register taxonomy, one that usually includes [+slang] and [+vulgar] and always (...) includes [-polite] and [+derogatory]. Thus, e.g., what distinguishes ‘Chinese’ from ‘chink’ is neither a peculiar sort of descriptive nor emotional content, but rather the fact that ‘chink’ is lexically marked as belonging to different registers than ‘Chinese’. It is, moreover, partly such facts which makes slurring ethically unacceptable. (shrink)

This paper proposes a unifying naturalistic framework that examines the fundamental nature and purpose of life—not limited to human life but encompassing all living systems. It challenges the traditional separation between living and non-living entities, proposing instead that life is not as uniquely distinct as traditionally perceived, but rather a complex form of dissipative structure—a thermodynamic concept introduced by physical chemist Ilya Prigogine. Building upon this understanding of life's essence and its existential necessity, this study argues that the primary imperative (...) of life is to counteract the natural tendency toward disorder, as dictated by the second law of thermodynamics. This perspective further provides a novel approach to David Hume’s famous is-ought problem by demonstrating that the imperative to sustain order arises as an existential necessity rather than a moral construct. The paper applies this unifying framework to various domains, including biology, ethics, and human culture, to validate its coherence and examine its implications for the future evolution of life. Ultimately, this study presents a new foundation for understanding life’s nature and purpose within a broader cosmic context. (shrink)

The paradox of pain refers to the idea that the folk concept of pain is paradoxical, treating pains as simultaneously mental states and bodily states. By taking a close look at our pain terms, this paper argues that there is no paradox of pain. The air of paradox dissolves once we recognize that pain terms are polysemous and that there are two separate but related concepts of pain rather than one.

Plato’s nephew Speusippus has been widely accepted as the historical person behind the mask of the anti-hedonists in Phlb. 42b–44c. This hypothesis is supported by, inter alia, the link between Socrates’ char- acterization of them as δυσχερεῖς and the frequent references of δυσχέρεια as ἀπορία to Speusippus in Aristotle’s Metaphysics MN. This study argues against assigning any privileged status to Speusippus in the assimilation of δυσχέρεια with ἀπορία. Instead, based on a comprehensive survey of how δυσχερ- words were used in (...) classical antiquity, the semantic shift of δυσχέρεια can be explained in an alternative way. (shrink)

Ad hoc concepts feature prominently in lexical pragmatics. A speaker can use a word or phrase to communicate an ad hoc concept that is different from the lexically encoded concept and the hearer can construct the intended ad hoc concept pragmatically during utterance comprehension. I argue that some philosophical concepts have origins as ad hoc concepts, and such concepts pose a challenge for experimental philosophy regarding these concepts. To illustrate this, I consider philosophers’ ‘what-it’s-like’-concepts and experimental philosophy of consciousness.

Philosophers disagree about what the folk concept of pain is. This paper criticises existing theories of the folk concept of pain, i.e. the mental view, the bodily view, and the recently proposed polyeidic view. It puts forward an alternative proposal – the polysemy view – according to which pain terms like “sore,” “ache” and “hurt” are polysemous, where one sense refers to a mental state and another a bodily state, and the type of polysemy at issue reflects two distinct but (...) related concepts of pain. Implications with respect to issues in philosophy of pain are also drawn. (shrink)

In recent literature on the metaphysics of consciousness, and in particular on the prospects of physicalism, there are two interesting strands of discussion. One strand concerns the so-called ‘thesis of revelation’, the claim that the essences of phenomenal properties are revealed in experience. The other strand concerns the intuition of dualism, the intuition that consciousness is nonphysical. With a particular focus on the former, this paper advances two main arguments. First, it argues that the thesis of revelation is intuitive; it (...) is part of our ordinary, implicit conception of experience. Second, it brings the two strands of discussion together and puts forward a rational explanation of the intuition of dualism in terms of the intuitiveness of the thesis of revelation. (shrink)

It is often said that there is no appearance/reality distinction with respect to consciousness. Call this claim ‘NARD’. In contemporary discussions, NARD is closely connected to the thesis of revelation, the claim that the essences of phenomenal properties are revealed in experience, though the connection between the two requires clarification. This paper distinguishes different versions of NARD and homes in on a particular version that is closely connected to revelation. It shows how revelation and the related version of NARD pose (...) a threat to physicalism. Responses from physicalism and their limitations are also considered. (shrink)

Husserl's Absolute-Flow-Model (AFM) represents an approach to a coherent phenomenological description of time-consciousness. Within the AFM framework the streaming of every real moment in the flow of time-consciousness is necessarily concomitant with some retentional or protentional modifications of time-consciousness modes. These modifications of consciousness, i.e. all retentions and protentions, are characterized here as "temporal apprehension." By means of this distinctive function of time-consciousness, all constituents of one and the same consciousness phase are assigned an intentional sense as their temporal index, (...) so that all these constituents can be temporally represented and distinguished by time-consciousness. In this way, the AFM can overcome some of the difficulties in describing the flow of consciousness. (shrink)

Can an agent deliberating about an action A hold a meaningful credence that she will do A? 'No', say some authors, for 'Deliberation Crowds Out Prediction' (DCOP). Others disagree, but we argue here that such disagreements are often terminological. We explain why DCOP holds in a Ramseyian operationalist model of credence, but show that it is trivial to extend this model so that DCOP fails. We then discuss a model due to Joyce, and show that Joyce's rejection of DCOP rests (...) on terminological choices about terms such as 'intention', 'prediction', and 'belief'. Once these choices are in view, they reveal underlying agreement between Joyce and the DCOP-favouring tradition that descends from Ramsey. Joyce's Evidential Autonomy Thesis (EAT) is effectively DCOP, in different terminological clothing. Both principles rest on the so-called 'transparency' of first-person present-tensed reflection on one's own mental states. (shrink)

This paper aims to clarify Plato’s notions of the natural and the neutral state in relation to hedonic properties. Contra two extreme trends among scholars—people either conflate one state with the other, or keep them apart as to establish an unsurmount- able gap between both states, I argue that neither view accurately reflects Plato’s position because the natural state is real and can coincide with the neutral state in part, whereas the latter, as an umbrella term, can also be realized (...) in a non-natural condition. The clarification of the relation between the two states will shed light on the degree to which Plato admits and constrains the hedonic value for a good human life; further, this will call attention to some (not well explored) parallel thoughts in the medical tradition to which Plato is indebted.
