Nhãn hiệu (NH) và tên thương mại (NH&TTM) là hai đối tượng quyền sở hữu trí tuệ (SHTT) phổ biến được các doanh nghiệp sử dụng trong hoạt động sản xuất, kinh doanh. Tuy nhiên, giữa hai đối tượng này lại thường xảy ra xung đột do một dấu hiệu có thể đồng thời được đăng ký/sử dụng với hai vai trò/chức năng khác nhau bởi hai chủ thể khác nhau. Trong những năm gần đây các vụ việc tranh (...) chấp giữa NH&TTM cũng trở nên thường xuyên hơn và có thể được giải quyết theo các cơ chế khác nhau (hành chính, dân sự hay hình sự). Bài viết giới thiệu một số tình huống tranh chấp giữa NH&TTM đã được giải quyết tại tòa án và đề xuất một số khuyến nghị về chính sách, pháp luật. (shrink)

Để đạt được các mục tiêu giảm biến đổi khí hậu, bảo vệ môi trường và môi sinh, đồng thời đảm bảo sự phát triển bền vững, cũng như là công lý cho cả con người và thiên nhiên, chính quyền và hệ thống tư pháp cần hiểu rõ bản chất bản chất của các mâu thuẫn dẫn đến cuộc chiến pháp lý về môi trường. Bài viết này có mục đích tìm hiểu bối cảnh phức tạp của các cuộc chiến pháp lý về môi trường, làm sáng tỏ tầm quan trọng và kết quả tiềm tàng của chúng, từ đó chỉ ra một số lỗ hổng pháp lý và khiếu kiện môi trường tại Việt Nam. The indeterminacy problem is one of the most prominent objections against naturalistic theories of content. In this essay I present this difficulty and argue that extant accounts are unable to solve it. Then, I develop a particular version of teleosemantics, which I call ’explanation-based teleosemantics’, and show how this outstanding problem can be addressed within the framework of a powerful naturalistic theory.

The normative phenomenon is ubiquitous in human interactions, emerging in a wide range of fields studied by social science and considered as one of the essential traits of human’s way of life. The modern subjectivist tradition of social science has been based on a model in which elements like self, freedom and reason play the most relevant roles in explaining normativity by connecting beliefs to behaviors by means of motives that are non-reducible to preferences, desires or impulses. In this paper (...) I will discuss normativity in general in order to turn into normativity as it is conceived in social science and then with a focus on normativity based on reasons. I will argue in favor of a naturalistic approach to normativity by means of a defense of a concept of will, which can provide a bridge between social and natural science, rather than giving further reason to sustain a dualistic approach to them. Moreover, I will claim that mental qualities usually alleged to be essential for assigning personality, agency, and moral responsibility, such as rationality, self-consciousness, and freedom, are neither sufficient nor necessary for a naturalistic characterization of moral agents, or for explaining normativity in human evaluative practices. In recent years, there has been a heated debate about how to interpret findings that seem to show that humans rapidly and automatically calculate the visual perspectives of others. In the current study, we investigated the question of whether automatic interference effects found in the dot-perspective task (Samson, Apperly, Braithwaite, Andrews, & Bodley Scott, 2010) are the product of domain-specific perspective-taking processes or of domain-general “submentalizing” processes (Heyes, 2014). Previous attempts to address this question have done so by implementing inanimate (...) controls, such as arrows, as stimuli. The rationale for this is that submentalizing processes that respond to directionality should be engaged by such stimuli, whereas domain-specific perspective-taking mechanisms, if they exist, should not. These previous attempts have been limited, however, by the implied intentionality of the stimuli they have used (e.g. arrows), which may have invited participants to imbue them with perspectival agency. Drawing inspiration from “novel entity” paradigms from infant gaze-following research, we designed a version of the dot-perspective task that allowed us to precisely control whether a central stimulus was viewed as animate or inanimate. Across four experiments, we found no evidence that automatic “perspective-taking” effects in the dot-perspective task are modulated by beliefs about the animacy of the central stimulus. Our results also suggest that these effects may be due to the task-switching elements of the dot-perspective paradigm, rather than automatic directional orienting. Together, these results indicate that neither the perspective-taking nor the standard submentalizing interpretations of the dot-perspective task are fully correct. (shrink)

Our Universe is dotted with over 100 billion galaxies, and each one contains roughly 100 billion stars. It is unclear how many planets are orbiting these stars, but it is certain that at least one of them has evolved life. In particular, there is a life form that has had the capacity and audacity to speculate about the origin of this vast universe2. Very fortunate is the person who knows this. (Gauree, Kabir Ji, SGGS, p 329) Gurbani offers an elegant explanation of the origin and creation of the universe, making it one of the greatest achievements of human intuition, intellect and spirit. It is the consequence of an insatiable curiosity, a fabulous imagination, keen observation and logical thinking. Guru Nanak, the first Sikh Guru, in his hymns of Jap(u), Aasa di Var, Sidh Gosht and Maru Sohilé, and Guru Arjan Dev, the fifth Sikh guru, in his hymns of Gauree Sukhmani have enunciated incredible understanding of the mystery of creation. It is fascinating to note that some of the concepts/ideas expressed in these hymns were not known to modern science until the eighteenth century. In this way, one can safely observe that the Sikh Gurus’ ideas were the forerunner of the modern scientific tradition. The ideas about the physical world (Creation), as presented in these hymns and discussed hereafter, might help us to confirm the above premise. (shrink)

Một trong số này thuộc về các học thuyết bảo vệ môi trường lạ đời (đôi khi mang sắc thái cực đoan), thể hiện sự tận tụy và độc đáo trong việc bảo vệ môi trường với mọi biện pháp. Vì họ đặt môi trường lên hàng đầu, nên những quan điểm này thường phản ánh quan điểm (...) cấp tiến và đôi khi khá khác biệt về quan hệ giữa con người và môi trường. Vì vậy, chúng thường không được chấp nhận rộng rãi hoặc không thực tế. Tuy nhiên, dưới góc nhìn tập trung vào bảo vệ môi trường, những học thuyết này cũng đem đến cho chúng ta nhận thức về những xung đột lợi ích mà nhiều nhà hoạt động môi trường thường bỏ qua. Chúng cũng làm nổi bật mục tiêu quan trọng của việc hài hòa lợi ích của con người và thiên nhiên. This paper offers an original argument for a Humean thesis about promising that generalises to the domain of normative powers. The Humean ‘natural unintelligibility’ thesis – prominently endorsed by Rawls, Hart, and Anscombe, and roundly rejected or forgotten by contemporary writers (conventionalists and non – conventionalists alike) – holds that a rational, suitably informed agent cannot so much as make a promise (much less a morally-binding promise) without exploiting conventional norms that confer promissory significance on act types (e.g., signing on (...) the dotted line) that would not otherwise have such significance. The argument (like Hume’s) is action-theoretic in character; its central premise is the Contribution Condition on acting with an aim: roughly, that doing X in order to (bring about) Y requires that the agent believe that their having X-ed on the occasion might come to fully or partly account for Y’s coming to pass. The argument generalises to the broader domain of exercises of normative powers, i.e., to acts that modify normative properties by ‘fiat’ or ‘stipulation’. This stipulative act has been characterised in three different ways, each of which is given due consideration. Finally, two different ways of accommodating the ‘natural unintelligibility’ thesis are considered, as is the thesis’s normative significance. (shrink)

Năm 2023 là năm cực kỳ khó khăn đối với kinh tế toàn cầu, khi mà các nước áp dụng các chính sách thắt chặt tiền tệ, các bất ổn thương mại do ảnh hưởng từ cuộc chiến kéo dài ở Ukraine và cuộc xung đột Israel-Hamas, và áp lực do biến đổi khí hậu. Khởi đầu 2023 đầy khó khăn, kinh tế Việt Nam tăng trưởng với tốc độ 3,41% vào Quý I, sau đó tăng trưởng tích cực (...) ở các Quý tiếp theo. Đến Quý IV, tốc độ tăng trưởng ước tính tăng lên mức 6,72%, khiến cho tốc độ tăng trưởng cả năm 2023 ước tính đạt 5,05%. Mặc dù không đạt mục tiêu 6,5% đề ra tại Kế hoạch phát triển kinh tế – xã hội năm 2023 và Nghị quyết 01/NQ-CP của Chính phủ, nhưng đây là một thành tích rất đáng khích lệ cho một năm đầy biến động khó lường trên trường quốc tế. Dựa trên tóm lược tình hình kinh tế – xã hội được cung cấp trên Cổng Thông tin Điện tử Chính phủ, tôi cho rằng các điểm sau là các yếu tố quan trọng góp phần vào sự tăng trưởng ổn định và vững vàng trong năm 2023 của Việt Nam. Quản lý lưu vực sông đóng một vai trò quan trọng trong việc bảo tồn và tăng cường nguồn tài nguyên nước, phục hồi chức năng của đất, duy trì nguồn thức ăn và bảo vệ môi trường xung quanh. Tuy nhiên, sự tăng trưởng kinh tế và công nghiệp gần đây, cùng với việc mở rộng các khu đô thị, đã khiến các nguồn tài nguyên thiên nhiên, bao gồm cả tài nguyên nước, gặp nhiều ảnh hưởng tiêu (...) cực và gây tổn hại cho các dịch vụ hệ sinh thái quan trọng. Metaphysical explanations, unlike many other kinds of explanation, are standardly thought to be insensitive to our epistemic situation and so are not evaluable by cognitive values such as salience. I consider a case study that challenges this view. Some properties are distributed over an extension. For example, the property of being polka-dotted red on white, when instantiated, is distributed over a surface. Similar properties have been put to work in a variety of explanatory tasks in recent metaphysics, including: providing an (...) analysis of change, giving to presentists truthmakers for past claims; giving to priority monists an account of basic heterogeneous entities; and giving to friends of extended simples an explanation of how an extended simple can enjoy qualitative variation. I argue that such explanations exhibit salience failure. How ought we represent the semantics of salience? Differences in linguistic stress induce semantic differences similar to the semantic differences induced in explanations by differences in salience, and I will draw an analogy with linguistic theories of focus sensitivity to sketch how one might model the role of salience in these kinds of explanations. I end with a few tentative conclusions about the role of cognitive values in metaphysical explanations. Some theorists view the citation of a ground as a sufficient explanation. If certain explanations appealing to distributed properties exhibit attenuated salience, then arguably the mere citation of a ground does not always provide an adequate explanation. (shrink)

What is the relationship between complexity in the world and complexity in the mind? Intuitively, increasingly complex objects and events should give rise to increasingly complex mental representations (or perhaps a plateau in complexity after a certain point). However, a counterintuitive possibility with roots in information theory is an inverted U-shaped relationship between the “objective” complexity of some stimulus and the complexity of its mental representation, because excessively complex patterns might be characterized by surprisingly short computational descriptions (e.g., if they (...) are represented as having been generated “randomly”). Here, we demonstrate that this is the case, using a novel approach that takes the notion of “description” literally. Subjects saw static and dynamic visual stimuli whose objective complexity could be carefully manipulated, and they described these stimuli in their own words by giving freeform spoken descriptions of them. Across three experiments totaling over 10,000 speech clips, spoken descriptions of shapes (Experiment 1), dot-arrays (Experiment 2), and dynamic motion-paths (Experiment 3) revealed a striking quadratic relationship between the raw complexity of these stimuli and the length of their spoken descriptions. In other words, the simplest and most complex stimuli received the shortest descriptions, while those stimuli with a “medium” degree of complexity received the longest descriptions. Follow-up analyses explored the particular words used by subjects, allowing us to further explore how such stimuli were represented. We suggest that the mind engages in a kind of lossy compression for overly complex stimuli, and we discuss the utility of such freeform responses for exploring foundational questions about mental representation. This is a rough translation of Michael Frede's "La théorie aristotélicienne de l'intellect agent" published in 1996. This insightful paper contains an important interpretation of Aristotle's notoriously difficult theory of the active intellect from De Anima III, 5. I worked up a translation during some research and thought others might benefit from having an English translation available (I couldn't find one after a cursory internet search). It's not perfect, but it should give one a sense for Frede's argument that the (...) agent intellect is the same as the divine intellect of Metaphysics Lambda. The perception of brightness differences in Ehrenstein figures and of illusory contours in phase-shifted line gratings was investigated as a function of the contrast polarity of the inducing elements. We presented either continuous lines or line-like arrangements composed of aligned dashes or dots whose spacing was varied. A yes/no procedure was used in which naive observers had to decide whether or not they perceived a brightness difference in a given Ehrenstein figure or an illusory contour in a phase-shifted line grating. The results show that brightness differences are perceived to some extent in Ehrenstein figures with inducers of opposite polarity of contrast; however, the percentage of yes response was systematically lower and response times were longer than for figures with inducers of the same polarity. Phase-shifted line gratings with lines of opposite polarity of contrast yielded stronger illusory contours and shorter response times than those with lines of the same polarity. When the sign of contrast was not the same within a given line of induction, neither differences in brightness nor illusory contours were perceived. The results suggest that the mechanisms that lead to apparent differences in brightness are more sensitive to input of the same contrast polarity, the mechanisms generating illusory contours more sensitive to input of opposite polarity. The data are discussed in the light of a multistage approach to illusory form perception and some implications for cortical models of illusory contour integration are discussed. (shrink)

This is a chapter of the planned monograph "Out of Nowhere: The Emergence of Spacetime in Quantum Theories of Gravity", co-authored by Nick Huggett and Christian Wüthrich and under contract with Oxford University Press. (More information at www<dot>beyondspacetime<dot>net.) This chapter introduces causal set theory and identifies and articulates a 'problem of space' in this theory.

For scatterplots with gaussian distributions of dots, the perception of Pearson correlation r can be described by two simple laws: a linear one for discrimination, and a logarithmic one for perceived magnitude (Rensink & Baldridge, 2010). The underlying perceptual mechanisms, however, remain poorly understood. To cast light on these, four different distributions of datapoints were examined. The first had 100 points with equal variance in both dimensions. Consistent with earlier results, just noticeable difference (JND) was a linear function of the (...) distance away from r = 1, and the magnitude of perceived correlation a logarithmic function of this quantity. In addition, these laws were linked, with the intercept of the JND line being the inverse of the bias in perceived magnitude. Three other conditions were also examined: a dot cloud with 25 points, a horizontal compression of the cloud, and a cloud with a uniform distribution of dots. Performance was found to be similar in all conditions. The generality and form of these laws suggest that what underlies correlation perception is not a geometric structure such as the shape of the dot cloud, but the shape of the probability distribution of the dots, likely inferred via a form of ensemble coding. It is suggested that this reflects the ability of observers to perceive the information entropy in an image, with this quantity used as a proxy for Pearson correlation. (shrink)

We have a striking ability to alter our psychological access to past experiences. Consider the following case. Andrew “Nicky” Barr, OBE, MC, DFC, (1915 – 2006) was one of Australia’s most decorated World War II fighter pilots. He was the top ace of the Western Desert’s 3 Squadron, the pre-eminent fighter squadron in the Middle East, flying P-40 Kittyhawks over Africa. From October 1941, when Nicky Barr’s war began, he flew 22 missions and shot down eight enemy planes in his (...) first 35 operational hours. He was shot down three times, once 25 miles behind enemy lines while trying to rescue a downed pilot. He escaped from prisoner of war camps four times, once jumping out of a train as it travelled from Italy into Austria. His wife Dot, who he married only weeks before the war, waited for him at home. She was told on at least three occasions that he was missing in action or dead. For 50 years, Nicky Barr never spoke publicly, and rarely privately, of his war-time experiences. He was very much a forgotten and forgetting hero (for further details, see Dornan, 2002). Investigators increasingly need high quality face photographs that they can use in service of their scholarly pursuits—whether serving as experimental stimuli or to benchmark face recognition algorithms. Up to now, an index of known face databases, their features, and how to access them has not been available. This absence has had at least two negative repercussions: First, without alternatives, some researchers may have used face databases that are widely known but not optimal for their research. Second, a reliance on databases (...) comprised only of young white faces will lead to science that isn't representative of all the people whose tax contributions, in many cases, make that research possible. The “Face Image Meta-Database” (fIMDb) provides researchers with the tools to find the face images best suited to their research, with filters to locate databases with people of a varied racial and ethnic backgrounds and ages. Problems of representation in face databases are not restricted to race and ethnicity or age – there is a dearth of databases with faces that have visible differences (e.g., scars, port wine stains, and cleft lip and palate). A well-characterized database is needed to support programmatic research into perceivers' attitudes, behaviors, and neural responses to anomalous faces. The “ChatLab Facial Anomaly Database” (CFAD) was constructed to fill this gap, with photographs of faces with visible differences of various types, etiologies, sizes, locations, and that depict individuals from various ethnic backgrounds and age groups.
