Foucault's theory of power and subjectification challenges common concepts of freedom in social philosophy and expands them through the concept of 'freedom as critique': Freedom can be defined as the capability to critically reflect one's own subjectification, and the conditions of possibility for this critical capacity lie in political and social institutions. The article develops this concept through a critical discussion of the standard response by Foucault interpreters to the standard objection that Foucault's thinking obscures freedom. The standard response interprets (...) Fou-cault's later works, especially The Subject and Power, as a solution to the problem of freedom. It is mistaken, because it conflates different concepts of freedom that are present in Foucault's work. By differentiating these concepts, this paper proposes a new institutionalist approach to solve the problem of freedom that breaks with the partly anarchist underpinnings of Foucault scholarship: As freedom as critique is not given, but itself a result of subjectification, it entails a demand for 'modal robustness' and must therefore be institutionalized. This approach helps to draw out the consequences of Foucault's thinking on freedom for postfoundationalist democratic theory and the general social-philosophical discussion on freedom. (shrink)

He demonstrated that blood circulates into heart from veins and from the heart to arteries, paving the way to Harvey’s complete description of blood circulation. Moreover, he was the founder of botany as a systematic discipline, which he based, rather than on the observation of accidental similarities of plants, on the discovery of their vegetative-generative principle. In philosophy, he attempted to conciliate the immortality of the soul (i.e., the form (...) of the body) with the existence of a unique immaterial intellect, which is individuated and multiplied in the singular souls that participate to it. According to what may be called the Debt Model, blameworthiness is defined in terms of deserved suffering. The Debt Model has a significant implication: one is less blameworthy if one has experienced some of the suffering one deserves, and no longer blameworthy once one has experienced the full amount of suffering one deserves. Blameworthiness, according to the Debt Model, is not forever. In recent papers, Clarke (2022) and Howard (2022) independently criticize the Debt Model and argue for the opposite conclusion: (...) if one is blameworthy, one will remain blameworthy forever. In this paper, I respond to this criticism as well as a recent argument against the Debt Model from Tierney (2022). I then present a prima facie case for the Debt Model. I argue that Clarke’s attempt to accommodate the intuitions elicited by this and similar cases has unwelcome implications. I will end the paper with some remarks about what roles we want our conceptions of blameworthiness to play. If Clarke’s account were right, the fact that an agent is blameworthy would play a far less significant role in our moral life than we often tend to assume. The Debt Model, I will suggest, makes better sense of our blaming practices. (shrink)

In den aktuellen Kulturkämpfen kritisieren Konservative Identitätspolitik und “Cancel Culture” als Einschränkungen von individueller Freiheit. Der Artikel untersucht die dabei zugrundeliegenden Freiheitsbegriffe. Die konservative Kritik stützt sich in der Regel auf einen negativen Begriff von Freiheit als Nichteinmischung im Sinne der liberalen Tradition. In der politischen Theorie wird ein solcher negativer Freiheitsbegriff als Gegensatz zur Auffassung von sozialer Freiheit gesehen, die Freiheit in hegelianischer und kommunitaristischer Tradition als ein gemeinschaftliches Unternehmen begreift. Der Artikel zeigt, dass beide Konzepte – trotz ihrer (...) philosophischen Gegensätze – in der zeitgenössischen konservativen Kritik an Identitätspolitik übereinstimmen und daher politisch kompatibel sind. Beide Freiheitsbegriffe kranken an einem falschen Universalismus. Im Gegensatz dazu hilft die radikaldemokratische Tradition, Freiheit partikularistisch zu verstehen. Dabei wird verständlich, dass Identitätspolitik nicht in erster Linie eine Einschränkung individueller Freiheit ist, sondern als Demokratisierung der Demokratie ein Beitrag zur Freiheit aller ist. Die Debatte um die politische Differenz stellt Kontingenz und Konfliktualität als fundamentale Eigenschaften des Politischen heraus. Dies birgt ein Problem für die postfundamentalistische Demokratietheorie, die auf Augenhöhe mit dieser Debatte argumentieren will: Durch die Kontingentsetzung aller normativen Begründungen ist zunächst unklar, welche Art von demokratischen Institutionen wie begründet werden kann, und sogar, ob es überhaupt eine von der postfundamentalistischen Sozialontologie ausgehend argumentierende normative Begründung für demokratische Institutionen geben kann. Meine These ist, dass Freiheit, verstanden als kontinuierliche selbstreflexive Kritik, derjenige normative (...) Begriff ist, der sich aus der Sozialontologie von Konflikt und Kontingenz herleiten lässt. Anders gesagt: Freiheit als Kritik ist derjenige Universalismus, der sich aus der Ontologie des Partikularismus ableitet. Freiheit als Kritik kann dabei einerseits das Operieren einiger Institutionen in liberal-pluralistischen Demokratien beschreiben, und andererseits als radikaldemokratisch-normativer Kritikbegriff für die Analyse ihrer Dysfunktionalität dienen. Um diese These zu begründen, gehe ich zurück zu einem Theoretiker, der eine Grundlage der aktuellen Debatte um das Politische bildet: Foucault, dessen Machttheorie als Ansatz einer Sozialontologie der Kontingenz und Konfliktualität gelten kann. Gleichzeitig hat Foucault den Begriff der Freiheit als den zu dieser Ontologie passenden normativen Begriff herausgestellt. (shrink)

Identity politics is subject to similar critiques in contemporary public debate and political theory. A central topos of this critique is that identity politics is essentializing: it fixes subjects to their social position and resorts to a politics of particularity that leads to divisions in national citizenship and democratic discourse (the communitarian and liberal position) and to divisions within social movements (the critical position). Contrary to this one-sided critique, we propose a different interpretation with the concept of “constructivist identity politics.” (...) We show that political identities are not essentialistically given, but emerge from processes of social and political construction; that they are actively produced, learned, and practiced by political (sub)cultures and movements. In these processes of construction, political articulation and agency are produced, enabling subjects to critique relations of domination and discrimination. Following radical democratic theory, we argue that the particular political perspectives of identity politics thus enabled do not endanger democracy or solidarity in social movements, but contribute to their further democratization by actualizing the universal principles of democracy in particular disputes. While the construction processes of identity politics tend to essentialize and produce exclusions, critical reflection on such tendencies is also inherent to identity politics. This understanding also enables a critique of such identity politics that is not oriented towards the democratic values of equality and freedom and blocks critical self-reflection. After an overview of contemporary identity politics critique, we elaborate this constructivist understanding following debates in feminist and postcolonial theory since the 1980s. Building on this, we systematically develop the notion of constructivist identity politics by differentiating three aspects of it: subjectification, articulation, and representation. We refer to approaches by Foucault, Rancière, Laclau/Mouffe, and Hall and illustrate the respective aspects through examples of migrant self-organizations as well as gay culture and queer critique. Gay men have been severely affected by the AIDS crisis, and gay subjectivity, sexual ethics, and politics continue to be deeply influenced by HIV to this day. PrEP (Pre-Exposure Prophylaxis) is a new, drug-based HIV prevention technique, that allows disentangling gay sex from its widespread, 40 yearlong association with illness and death. This article explores PrEP's fundamental impact on gay subjectivity, sexual ethics, and politics. It traces the genealogy of gay politics regarding homophobia and HIV stigma, suggesting a new biopolitical (...) and body political framework that accounts for the agency of activists as well as pharmapower, and proposing that PrEP is an example of democratic biopolitics. Highlighting the entanglement of medical technology, sexual ethics, and politics, the article shows how conservative and homonormative gay politics developed as a reaction to HIV stigma and how, by overcoming this stigma, PrEP enables a new era of intersectional queer politics and solidarities. It thereby develops a Foucauldian account of sexual liberation beyond the repression hypothesis that accounts for the ambivalence of sexual subjectification and the political potential of sexuality. Wie Herrschaft kritisieren, wenn Kategorien wie Staat, Souveränität und Demokratie nicht mehr funktionieren? Der Regimebegriff verspricht einen Ausweg aus diesem praktischen wie theoretischen Dilemma. Er soll nicht nur helfen, Macht und Herrschaft besser zu verstehen, sondern auch eine neue Grundlage für tiefere und radikalere Gesellschaftskritik bieten: Das Denken in Regimen bezieht Denk- und Wahrnehmungsmuster in die Analyse und Kritik von gesellschaftlichen Strukturen, (politischer) Macht und alltäglichen Normen und Praxen ein. Kurz: Regimeanalysen helfen uns zu sehen, was sonst unsichtbar bliebe, wie (...) etwa die rassistische Regulierung von Migration, die Normierung von Geschlechterverhältnissen oder die Neoliberalisierung von Universitäten. Es wundert nicht, dass ein Begriff, mit dem solch verschiedene Phänomene beschrieben werden können, »sehr weitläufig und oft ungenau und spekulativ« ist. Die AutorInnen aus dem Umfeld der Wiener Akademie der Künste führen deshalb in ihren Buchbeiträgen zunächst in die unterschiedlichen Regimebegriffe ein und möchten untersuchen, »welchen diskursiven und politischen Gewinn er verspricht und tatsächlich bringt.«. While ‘cancel culture’ is commonly regarded as limiting freedom of speech and artistic freedom, this article proposes a new understanding of ‘cancel culture’ as emancipatory norm-setting that is key for democratization. On a non-governmental level of the self-regulation of the art world, the argument for artistic freedom ignores the fact that art is permeated by power. The introduction of ‘politically correct’ norms leads to a justified redistribution of such power. On a parastatal level of public broadcasting and state cultural funding, (...) neutrality is necessary but should be understood materially to include marginalized voices. Restrictions of freedom of speech and artistic freedom do occur on the state-level of hate-speech regulation. Here, the danger of a potential shift from emancipatory regulation to a harmful restriction is particularly virulent, as a discussion of the German BDS ban shows. (shrink)

The challenge of developing humane migration and refugee politics in Western states is far from resolved. This ongoing failure is typically attributed to the increased influence of right-wing populism and neo-fascism in Western migration politics. In this article I discuss a more radical explanation: Christoph Menke argues that political liberalism and its framing of migration as an issue of subjective human rights is the deeper root of the problem. While the merit of Menke’s approach is its criticism of subjectification through (...) individual rights that blocks politics, I show that his Critique of Rights may lead to an anti-pluralist and paternalistic ‘radical republicanism’. To react to this problem, I propose a ‘reflective liberalism’ that allows to criticise subjectification without abandoning the form of individual rights. This position, which I develop through a discussion of Foucault’s concept of ‘freedom as critique’, shows that in addition to protecting minorities such as migrants, individual rights turn out to be part of a regime of critical subjectification that constitutes critical subjects. Such critical subjectification by law can help to break through the blockade of politics that prevent the development of humane migration and refugee politics. (shrink)

Der Artikel argumentiert für die gegenteilige These: Epistemische Schließungen durch digitale Kommunikation sind förderlich für die Konstruktion von identitätspolitischen Gegenöffentlichkeiten, von denen ausgehend hegemoniale Diskurse kritisiert werden können, um die Demokratie zu demokratisieren. Digitale Kommunikation ist identitätspolitischer Demokratisierung zuträglich, weil sie Gegenöffentlichkeiten sowohl epistemische Schließungen als auch diskursive Offenheit ermöglicht, durch die ein identitätspolitischer Standpunkt gebildet und effektiv in (...) die hegemoniale Öffentlichkeit eingebracht werden kann. Eine Kritik des "Verflüssigungsprimats" - Antinormativität und Antiinstitutionalismus - der poststrukturalitischen politischen Theorie.

"Biopolitics" has become a popular concept for interpreting the COVID-19 pandemic, yet the term is often used vaguely, as a buzzword, and therefore loses its specificity and relevance. This article systematically explains what the biopolitical lens offers for analyzing and normatively criticizing the politics of the coronavirus. I argue that biopolitics are politics of differentiated vulnerability that are intrinsic to capitalist modernity. The situation resulting from the COVID-19 pandemic is, therefore, less of a state of exception than it might appear; (...) COVID-19 is a continuation and intensification of the capitalist biopolitics of differentiated vulnerability. In order to critically evaluate this situation, the article proposes the concept of "democratic biopolitics" and shows how it can be used, among others, for a queer critique of the differentiated vulnerabilities that are produced by the coronavirus and its capitalist governance. In contrast to widespread interpretations of democratic biopolitics that focus on collective care in communities, this article highlights the role of the state and of the redistribution of political power and economic resources as key for biopolitical democratization. Der Bund-Länder-Beschluss zu Weihnachten erlaubt „Treffen mit 4 über den eigenen Hausstand hinausgehenden Personen“, aber nur bezüglich Mitglieder des „engsten Familienkreis[es], also Ehegatten, Lebenspartnern und Partnern einer nichtehelichen Lebensgemeinschaft sowie Verwandten in gerader Linie, Geschwistern, Geschwisterkindern und deren jeweiligen Haushaltsangehörigen.“ Obwohl es bei diesen Regelungen gar nicht um die sexuelle Orientierung oder Geschlechtsidentität der Personen geht, sind sie dennoch heteronormativ, bevorteilen also solche Lebensformen, die nach den Normen klassischer heterosexueller Beziehungsmodelle funktionieren. Oder andersherum gesagt: Sie benachteiligen zwar Singles und Menschen (...) ohne klassische Familie unabhänging davon, ob sie hetero, schwul, lesbisch, trans* oder non-binary sind, aber sie werten darüber hinaus queere Lebensformen ab. Die Veröffentlichung von Foucaults viertem Band der Geschichte der Sexualität, Die Geständnisse des Fleisches, wurde von der Foucault-Community und der interessierten Öffentlichkeit gespannt erwartet. Vom lange unter Verschluss gehaltenen Band erhofft sich die Leser_innenschaft neue Erkenntnisse nicht nur zum Thema des Buches – die Reflexionen der Kirchenväter bis Augustinus zu Sexualität und Lebensführung –, sondern zu Foucaults Werk im Allgemeinen und den großen Fragen nach Macht, Freiheit und Kritik, die dessen Rezeption bestimmen. Und tatsächlich bietet der Band überraschend neue Einsichten, (...) in deren Lichte sich die herrschende Meinung zu Foucaults Freiheits- und Kritikbegriff als falsch herausstellt. Heute ist die These verbreitet, dass Foucaults Arbeiten zur antiken Ethik und parrhesia als Beitrag zu einem normativen Freiheitsbegriff gewertet werden können. Dagegen zeigt Die Geständnisse des Fleisches, dass die für Foucault und unsere Gegenwart relevante Freiheit, die Fähigkeit zur reflexiven Selbst- und Machtkritik, ihren Ursprung in den Subjektivierungen des frühen Christentums hat, das Subjektivität zum ersten Mal an kritische Machtreflexion koppelt. This article constitutes a theoretical reflection from an educational perspective that places emphasis on the notion of inhabiting in the present technological society. The discussion is based on John Dewey's pragmatism, particularly on the idea of technology resulting from the fundamental tenets of his conception of experience and aesthetics. A key element is the notion of habit, through which we manage our relationship with reality or inhabit it. Starting from an examination of technology in relation tothe Deweyan notion of experience, (...) the discussion moves towards the importance of the aesthetic dimension to come, finally, to some considerations on the meaning of habits in education and human existence. Diese zentrale Frage der Interpretation von Foucaults vielschichtigem Werk wurde breit diskutiert und dennoch nicht befriedigend beantwortet. Dass bis heute kaum Klarheit über den Status von Freiheit in Foucaults Werk erreicht werden konnte, liegt auch daran, dass die gängigen Interpretationen die verschiedenen Freiheitsbegriffe, die in Foucaults Werk zu finden sind, vermischen. Der Artikel bringt deshalb Ordnung in diese unübersichtliche Lage, indem er die verschiedenen Freiheitsbegriffe und (...) Freiheitsprobleme in Foucaults Werk differenziert. Dies ermöglicht ein besseres Verständnis von Foucaults Freiheitsdenken und Machttheorie und führt zu einem neuen Freiheitsbegriff: Freiheit als die Fähigkeit zur kritischen Reflexion der eigenen Subjektivierung. Weil diese "Freiheit als Kritik" nur durch politische Institutionen ermöglicht werden kann, produziert dieser Freiheitsbegriff neue Anschlüsse von Foucaults Denken an die normative politische Theorie und postfundamentalistische Demokratietheorie. How can freedom and resistance be conceived within Foucault's theory of power and subjectivation? This central question of the interpretation of Foucault's multi-layered work has been widely discussed and yet not satisfactorily answered. The fact that until today there has been little clarity about the status of freedom in Foucault's work is also due to the fact that the current interpretations confuse the various concepts of freedom which can be found in Foucault's work. The article therefore brings order to this confusing situation by differentiating the various concepts and problems of freedom in Foucault's work. This enables a better understanding of Foucault's thinking of freedom and his theory of power and leads to a new concept of freedom: freedom as the capability to critically reflect on one's own subjectivation. Because this "freedom as critique" can only be made possible by political institutions, this concept of freedom produces new connections from Foucault's thinking to normative political theory and post-fundamentalist democratic theory. In this paper, we propose a regularity theory of causation. The theory aims to be reductive and to align with our pre‐theoretic understanding of the causal relation. We show that our theory can account for a wide range of causal scenarios, including isomorphic scenarios, omissions, and scenarios which suggest that causation is not transitive.

Identity politics is commonly criticized as endangering democracy by undermining community, rational communication, and solidarity. Drawing on both radical democratic theory and standpoint theory, this article posits the opposite thesis: identity politics is pivotal for the democratization of democracy. Democratization through identity politics is achieved by disrupting hegemonic discourse and is, therefore, a matter of power, while such forms of power politics are reasonable when following minority standpoints generated through identity politics. The article develops this approach by connecting radical democratic (...) theories with standpoint theories and highlighting their commonalities and potential for mutual enhancement. Standpoint theory allows us to substantiate and reconcile two initially contradictory claims: particular minority standpoints are necessary to criticize the prevailing discursive and institutional orders, and these standpoints stem from intersubjective reason and embody ‘strong objectivity.’ This discussion presents a new perspective on the tension between particularity and universality, as well as the relationship between power and reason in democracy. Democratization is an oscillation between these polarities, and political theory should not aim to resolve this tension but to recognize and articulate it. Such recognition might involve elevating knowledge emerging from oppressed groups and exercising epistemic modesty when assessing specific forms of identity politics. (shrink)

People often discriminate based on negative or positive stereotypes about others. Important examples of this are highlighted by the theory of ambivalent sexism. This theory distinguishes sexist stereotypes that are negative (hostile sexism) from those that are positive (benevolent sexism). While both forms of sexism are considered wrong towards women, hostile sexism seems intuitively worse than benevolent sexism. In this article, we ask whether the difference between discriminating based on positive vs. negative stereotypes in itself makes a morally relevant difference. (...) We suggest that it does not. By examining a number of prominent accounts of what makes discrimination wrong, we defend the Moral Irrelevance View according to which stereotype valence is irrelevant to the moral evaluation of discrimination, all else equal. Ein Grundprinzip der Demokratie ist die Gleichheit der Bürger_innen. Das Prinzip der Gleichheit ist zentral für demokratische Repräsentation. Es bedeutet, dass die Stimmen der Bürger_innen gleich viel zählen und dass ihre Interessen durch Repräsentant_innen möglichst gut abgebildet und vertreten werden. Es gilt sowohl für formale Repräsentation in den poli- tischen Institutionen, insbesondere bei Wahlen, als auch für sogenannte informelle Repräsentationsverhältnisse in der Öffentlichkeit, Kultur und Wissenschaft. Doch die real existierende Demokratie ist vom Ideal der Gleichheit weit entfernt. Sie ist asymmetrisch (...) und exkludierend. Die Stim- men privilegierter Menschen sind überrepräsentiert, während die Stimmen von diskriminierten Menschen unterrepräsentiert oder sogar ganz ausge- schlossen sind. (shrink)

This paper articulates in formal terms a crucial distinction concerning future contingents, the distinction between what is true about the future and what is reasonable to believe about the future. Its key idea is that the branching structures that have been used so far to model truth can be employed to define an epistemic property, credibility, which we take to be closely related to knowledge and assertibility, and which is ultimately reducible to probability. As a result, two kinds of claims (...) about future contingents—one concerning truth, the other concerning credibility—can be smoothly handled within a single semantic framework. (shrink)

While COVID-19 vaccines provide light at the end of the tunnel in a difficult time, they also bring forth the complex ethical issue of global vaccine distribution. The current unequal global distribution of vaccines is unjust towards the vulnerable living in low-income countries. A vaccine tax should be introduced to remedy this. Under such a scheme, a small fraction of the money spent by a country on vaccines for its own population would go into a fund, such as COVAX, dedicated (...) to buying vaccines and distributing them to the world’s poorest. A vaccine tax would provide a much-needed injection of funds to remedy the unequal distribution of vaccines. The tax allows for a distribution that, to a lesser degree, reflects the ability to pay and is superior to a donation-based model because it minimises the opportunity for free-riding. (shrink)

Research on the ethics of algorithms has grown substantially over the past decade. Alongside the exponential development and application of machine learning algorithms, new ethical problems and solutions relating to their ubiquitous use in society have been proposed. This article builds on a review of the ethics of algorithms published in 2016, 2016). The goals are to contribute to the debate on the identification and analysis of the ethical implications of algorithms, to provide an updated analysis of epistemic and normative (...) concerns, and to offer actionable guidance for the governance of the design, development and deployment of algorithms. Several attempts have been made to apply the choice-sensitive theory of distributive justice, luck egalitarianism, in the context of health and healthcare. This article presents a framework for this discussion by highlighting different normative decisions to be made in such an application, some of the objections to which luck egalitarians must provide answers and some of the practical implications associated with applying such an approach in the real world. It is argued that luck egalitarians should address distributions of health rather (...) than healthcare, endorse an integrationist theory that combines health concerns with general distributive concerns and be pluralist in their approach. It further suggests that choice-sensitive policies need not be the result of applying luck egalitarianism in this context. (shrink)

According to luck egalitarianism, it is unjust if some are worse off than others through no fault or choice of their own. The most common criticism of luck egalitarianism is the ‘harshness objection’, which states that luck egalitarianism allows for too harsh consequences, as it fails to provide justification for why those responsible for their bad fate can be entitled to society's assistance. It has largely gone unnoticed that the harshness objection is open to a number of very different interpretations. (...) We present four different interpretations of the harshness objection in which the problem pertains to counterintuitive implications, badness of outcome, disproportionality, or inconsistency, respectively. We analyse and discuss appropriate luck egalitarian replies. Disentangling these different versions clarifies what is at the heart of this dispute and reveals the point of the harshness objection. We conclude that only the inconsistency version involves a durable problem for luck egalitarianism. (shrink)

Hassoun argues that the poor in the world have a right to health and that the Global Health Impact Index provides consumers in well-off countries with the opportunity to ensure that more people have access to essential medicines. Because of this, these consumers would be ethically obliged to purchase Global Health Impact Index-labeled products in the face of existing global inequalities. In presenting her argument, Hassoun rejects the so-called democratic account of ethical consumption in favor of the positive change account. (...) Two versions of the democratic change account are relevant. One underscores the importance of democratic procedures and institutions, while the other stresses our fundamental moral equality. While at least one prominent institutionalist account has problems, revised versions would be less vulnerable to Hassoun’s counterexamples. Furthermore, institutionalist accounts come with the epistemological gains from democratic procedures and deliberations, which may be especially important under uncertainty. Finally, and perhaps more challenging for the Global Health Impact index project, this measure may place the burden unfairly on those who need to buy medicines. This is a pivotal insight from the non-institutionalist version of the democratic account of ethical consumption. (shrink)

Die Debatte um die politische Differenz stellt Kontingenz und Konfliktualität als fundamentale Eigenschaften des Politischen heraus. Dies stellt die postfundamentalistische Demokratietheorie, die auf Augenhöhe mit dieser Debatte argumentieren will, vor ein Problem: Durch die Kontingentsetzung aller normativen Begründungen ist zunächst unklar, welche Art von demokratischen Institutionen wie begründet werden kann, und sogar, ob es überhaupt eine von der postfundamentalistischen Sozialontologie ausgehend argumentierende normative Begründung für demokratische Institutionen geben kann. Meine These ist, dass Freiheit, verstanden als kontinuierliche selbstreflexive Kritik, derjenige normative (...) Begriff ist, der sich aus der Sozialontologie von Konflikt und Kontingenz herleiten lässt. Anders gesagt: Freiheit als Kritik ist derjenige Universalismus, der sich aus der Ontologie des Partikularismus ableitet. Freiheit als Kritik kann dabei einerseits das Operieren einiger Institutionen in liberal-pluralistischen Demokratien beschreiben, und andererseits als normativer Kritikbegriff für die Analyse ihrer Dysfunktionalität dienen. Um diese These zu begründen, gehe ich zurück zu einem Theoretiker, der eine Grundlage der aktuellen Debatte um das Politische bildet: Foucault, dessen Machttheorie als Ansatz einer Sozialontologie der Kontingenz und Konfliktualität gelten kann. Gleichzeitig hat Foucault den Begriff der Freiheit als den zu dieser Ontologie passenden normativen Begriff herausgestellt. Durch eine Rekonstruktion und Kritik der sozialphilosophischen Debatte um Freiheit in Foucaults Werk lässt sich der Begriff der Freiheit als Kritik systematisch bestimmen. So kann – mit Foucault gegen Foucault – gezeigt werden, dass er nur innerhalb einer pluralistischen und liberalen Demokratietheorie gedacht werden kann. (shrink)

According to relational egalitarianism, justice requires equal relations. The theory applies to those who stand in the relevant social relations. In this paper, I distinguish four different accounts of what it means to be socially related and argue that in all of them, self-relations—how a person relates to themselves—fall within the scope of relational egalitarianism. I also point to how this constrains what a person is allowed to do to themselves.

Due to the shortage of organs, it has been proposed that the ban on organ sales is lifted and a market-based procurement system introduced. This paper assesses four prominent proposals for how such a market could be arranged: unregulated current market, regulated current market, payment-for-consent futures market, and the family-reward futures market. These are assessed in terms of how applicable prominent concerns with organ sales are for each model. The concerns evaluated are that organ markets will crowd out altruistic donation, (...) that consent to sell organs is invalid, that sellers will be harmed, and that commodification of organs will affect human relationships in a negative way. The paper concludes that the family-reward futures market fares best in this comparison but also that it provides the weakest incentive to potential buyers. There is an inverse relationship between how applicable prominent critiques are to organ market models and the increase in available organs they can be expected to provide. (shrink)

This paper addresses the question whether future contingents are knowable, that is, whether one can know that things will go a certain way even though it is possible that things will not go that way. First I will consider a long-established view that implies a negative answer, and draw attention to some endemic problems that affect its credibility. Then I will sketch an alternative line of thought that prompts a positive answer: future contingents are knowable, although our epistemic access of (...) them is limited in some important respects. The well-known formal semantics of conditionals due to Stalnaker Studies in logical theory, Blackwell, Oxford, 1968), Lewis, and Gärdenfors The logic and 1140 epistemology of scientific change, North-Holland, Amsterdam, 1978, Knowledge in flux, MIT Press, Cambridge, 1988) all fail to distinguish between trivially and nontrivially true indicative conditionals. This problem has been addressed by Rott :345–370, 1986) in terms of a strengthened Ramsey Test. In this paper, we refine Rott’s strengthened Ramsey Test and the corresponding analysis of explanatory relations. We (...) show that our final analysis captures the presumed asymmetry between explanans and explanandum much better than Rott’s original analysis. (shrink)

The aim of this paper is to show that the nascent field of ethics of collegiality may considerably benefit from a symbiosis with virtue and vice epistemology. We start by bringing the epistemic virtue and vice perspective to the table by showing that competence, deemed as an essential characteristic of a good colleague (Betzler & Löschke 2021), should be construed broadly to encompass epistemic competence. By endorsing the anti-individualistic stance in epistemology as well as context-specificity of epistemic traits, we show (...) how the individual vice of a colleague can have a positive epistemic outcome for the team while individual virtue can be damaging if all team members share it, thereby contributing to the negative epistemic outcome. We argue that the evaluation and analysis of collegial relationships should be done through one’s contribution to the team dynamics: without this collectivist perspective, the ethics of collegiality cannot aspire to become encompassing normative theory. The wishes of registered organ donors are regularly set aside when family members object to donation. This genuine overruling of the wishes of the deceased raises difficult ethical questions. A successful argument for providing the family with a veto must (a) provide reason to disregard the wishes of the dead, and (b) establish why the family should be allowed to decide. One branch of justification seeks to reconcile the family veto with important ideas about respecting property rights, preserving autonomy, and (...) preventing harm. These arguments are ultimately unsuccessful. Another branch of arguments is consequentialist, pointing out the negative consequences of removing the veto. Whether construed as concerning family distress or as a potential drop in the organs available, these arguments are unsuccessful; the first fails to recognize the tremendous distress associated with waiting for an organ, while the second has little supporting evidence. A final section considers and rejects whether combining some of the arguments just examined could justify the family veto. We should thus remove the family veto in organ donation. (shrink)

Importation in fictional discourse is the phenomenon by which audiences include information in the story over and above what is explicitly stated by the narrator. This paper argues that importation is distinct from generation, the phenomenon by which truth in fiction may outstrip what is made explicit, and draws a distinction between fictional truth and fictional records. The latter comprises the audience’s picture of what is true according to the narrator. The paper argues that importation into fictional records operates according (...) to principles that also govern ordinary conversation. An account of fictional records as a species of common ground information is proposed. Two sources of importation are described in detail, presupposition accommodation and conversational implicatures. It is shown that presuppositions are both mandatorily imported and mandatorily generated. By contrast, conversational implicatures are neither mandatorily imported nor mandatorily generated. The paper distinguishes conversational implicatures from contextual inferences. Both rely on background assumptions, yet conversational implicatures moreover depend on assumptions concerning Gricean cooperation. (shrink)

Finally published 34 years after his death, Foucault's book Confessions of the Flesh sheds new light on the debate about freedom and power that shaped the reception of his works. Many contributors to this debate argue that Foucault's theory of power did not allow for freedom in the 'genealogical phase,' but that he corrected himself and presented a solution to the problem of freedom in his later works, especially through his reflection on ancient ethics and technologies of the self in (...) volumes two and three of History of Sexuality, as well as the concept of parrhesia. In contrast to this view, I argue that Confessions of the Flesh shows that a concept of freedom as self-critical hermeneutics that aims at identifying a foreign power within the subject was only developed in Foucault's analysis of Christian practices of penance and confession. This interpretation of Confessions of the Flesh opens a new field of inquiry into the genealogy of critique and both the repressive and emancipative effects of truth-telling and juridification. Hussain claims that ethical consumers are subject to democratic requirements of morality, whereas ordinary price/quality consumers are exempt from these requirements. In this paper, we demonstrate that Hussain’s position is incoherent, does not follow from the arguments he offers for it, and entails a number of counterintuitive consequences.

We take the potentialities that are studied in the biological sciences (e.g., totipotency) to be an important subtype of biological dispositions. The goal of this paper is twofold: first, we want to provide a detailed understanding of what biological dispositions are. We claim that two features are essential for dispositions in biology: the importance of the manifestation process and the diversity of conditions that need to be satisfied for the disposition to be manifest. Second, we demonstrate that the concept of (...) a disposition (or potentiality) is a very useful tool for the analysis of the explanatory practice in the biological sciences. On the one hand it allows an in-depth analysis of the nature and diversity of the conditions under which biological systems display specific behaviors. On the other hand the concept of a disposition may serve a unificatory role in the philosophy of the natural sciences since it captures not only the explanatory practice of biology, but of all natural sciences. Towards the end we will briefly come back to the notion of a potentiality in biology. (shrink)

Affirmative action is standardly pursued in relation to admissions to prestigious universities, in hiring for prestigious jobs, and when it comes to being elected to parliament. Central to these forms of affirmative action is that they have to do with competitive goods. A good is competitive when, if we improve A’s chances of getting the good, we reduce B’s chances of obtaining the good. I call this Competitive Affirmative Action. I distinguish this from Non-competitive Affirmative Action. The latter has to (...) do with non-competitive goods, e.g., being granted early parole or freedom from arbitrary arrest. I argue that some of the most prominent objections against affirmative action—in particular, the reverse discrimination objection and the merit objection—speak less against Non-competitive Affirmative Action. And that some of the most prominent arguments in favor of affirmative action, insofar as they justify Competitive Affirmative Action, also justify Non-competitive Affirmative Action. (shrink)

Rousseau argues that holding the talented in high public esteem leads the less talented to esteem their natural virtues less highly and therefore to neglect the cultivation of these virtues. D’Holbach’s response to Rousseau indicates a sense in which esteeming talent can avoid these detrimental consequences. The starting point of d’Holbach’s defense of the sciences and arts is an analysis of the impact that despotic regimes have on esteeming talent. He argues that there is not only a problem of over-valuing (...) talent but also a problem of under-valuing talent. These considerations form the background for his conception of valuing talent in the right way. The phenomenon of political deception in despotic regimes indicates a sense in which talent can be regarded as a tool for solving a pressing political problem: Genuinely estimable uses of talent are those that oppose despotism and support republican virtues. Esteeming such talent does not lead to a loss of esteem and self-esteem for ordinary people because republican virtues themselves are a source of esteem and self-esteem. Comparison with some aspects of the response of d’Holbach’s friend, Claude-Adrien Helvétius, to Rousseau will accentuate the specific strengths of d’Holbach’s argument. (shrink)

What is the relation between metaphysical necessity and essence? This paper defends the view that the relation is one of identity: metaphysical necessity is a special case of essence. My argument consists in showing that the best joint theory of essence and metaphysical necessity is one in which metaphysical necessity is just a special case of essence. The argument is made against the backdrop of a novel, higher-order logic of essence, whose core features are introduced in the first part of (...) the paper. The second part investigates the relation between metaphysical necessity and essence in the context of HLE. Reductive hypotheses are among the most natural hypotheses to be explored in the context of HLE. But they also have to be weighed against their non-reductive rivals. I investigate three different reductive hypotheses and argue that two of them fare better than their non-reductive rivals: they are simpler, more natural, and more systematic. Specifically, I argue that one candidate reduction, according to which metaphysical necessity is truth in virtue of the nature of all propositions, is superior to the others, including one proposed by Kit Fine, according to which metaphysical necessity is truth in virtue of the nature of all objects. The paper concludes by offering some reasons to think that the best joint theory of essence and metaphysical necessity is one in which the logic of metaphysical necessity includes S4, but not S5.
