O artigo analisa a leitura crítica de Hans Kelsen acerca da concepção jurídico-política de Thomas Hobbes, considerando críticas posteriores à própria interpretação de Kelsen. Para tanto, investigou-se primeiramente a posição de Kelsen sobre o jusnaturalismo buscando esclarecer conceitos centrais como os do ser e dever-ser e como o autor os associa a Hobbes. Nesse sentido, observouse a limitação da leitura de Kelsen em relação à filosofia jurídica do autor – uma doutrina jusnaturalista metafísica, tendo na regra de ouro o fundamento (...) natural para o direito positivo. Em contraposição, procurou-se apresentar uma postura crítica, que contesta a posição jusnaturalista atribuída a Hobbes e sustenta a tese de que o autor inglês é um precursor do positivismo jurídico. The inflation of Type I error rates is thought to be one of the causes of the replication crisis. Questionable research practices such as p-hacking are thought to inflate Type I error rates above their nominal level, leading to unexpectedly high levels of false positives in the literature and, consequently, unexpectedly low replication rates. In this article, I offer an alternative view. I argue that questionable and other research practices do not usually inflate relevant Type I error rates. I begin (...) by introducing the concept of Type I error rates and distinguishing between statistical errors and theoretical errors. I then illustrate my argument with respect to model misspecification, multiple testing, selective inference, forking paths, exploratory analyses, p-hacking, optional stopping, double dipping, and HARKing. In each case, I demonstrate that relevant Type I error rates are not usually inflated above their nominal level, and in the rare cases that they are, the inflation is easily identified and resolved. I conclude that the replication crisis may be explained, at least in part, by researchers’ misinterpretation of statistical errors and their underestimation of theoretical errors. (shrink)

During multiple testing, researchers often adjust their alpha level to control the familywise error rate for a statistical inference about a joint union alternative hypothesis (e.g., “H1,1 or H1,2”). However, in some cases, they do not make this inference. Instead, they make separate inferences about each of the individual hypotheses that comprise the joint hypothesis (e.g., H1,1 and H1,2). For example, a researcher might use a Bonferroni correction to adjust their alpha level from the conventional level of 0.050 to 0.025 (...) when testing H1,1 and H1,2, find a significant result for H1,1 (p < 0.025) and not for H1,2 (p > .0.025), and so claim support for H1,1 and not for H1,2. However, these separate individual inferences do not require an alpha adjustment. Only a statistical inference about the union alternative hypothesis “H1,1 or H1,2” requires an alpha adjustment because it is based on “at least one” significant result among the two tests, and so it refers to the familywise error rate. Hence, an inconsistent correction occurs when a researcher corrects their alpha level during multiple testing but does not make an inference about a union alternative hypothesis. In the present article, I discuss this inconsistent correction problem, including its reduction in statistical power for tests of individual hypotheses and its potential causes vis-à-vis error rate confusions and the alpha adjustment ritual. I also provide three illustrations of inconsistent corrections from recent psychology studies. I conclude that inconsistent corrections represent a symptom of statisticism, and I call for a more nuanced inference-based approach to multiple testing corrections. (shrink)

Several researchers have recently argued that p values lose their meaning in exploratory analyses due to an unknown inflation of the alpha level (e.g., Nosek & Lakens, 2014; Wagenmakers, 2016). For this argument to be tenable, the familywise error rate must be defined in relation to the number of hypotheses that are tested in the same study or article. Under this conceptualization, the familywise error rate is usually unknowable in exploratory analyses because it is usually unclear how many hypotheses have (...) been tested on a spontaneous basis and then omitted from the final research report. In the present article, I argue that it is inappropriate to conceptualize the familywise error rate in relation to the number of hypotheses that are tested. Instead, it is more appropriate to conceptualize familywise error in relation to the number of different tests that are conducted on the same null hypothesis in the same study. Under this conceptualization, alpha level adjustments in exploratory analyses are (a) less necessary and (b) objectively verifiable. As a result, p values do not lose their meaning in exploratory analyses. (shrink)

Popper’s (1983, 2002) philosophy of science has enjoyed something of a renaissance in the wake of the replication crisis, offering a philosophical basis for the ensuing science reform movement. However, adherence to Popper’s approach may also be at least partly responsible for the sense of “crisis” that has developed following multiple unexpected replication failures. In this article, I contrast Popper’s approach with Lakatos’ (1978) approach and a related approach called naïve methodological falsificationism (NMF; Lakatos, 1978). The Popperian approach is powerful (...) because it is based on logical refutation, but its theories are noncausal and, therefore, lacking in scientific value. In contrast, the Lakatosian approach considers causal theories, but it concedes that these theories are not logically refutable. Finally, the NMF approach subjects Lakatosian causal theories to Popperian logical refutations. However, its approach of temporarily accepting a ceteris paribus clause during theory testing may be viewed as scientifically inappropriate, epistemically inconsistent, and “completely redundant” (Lakatos, 1978, p. 40). I conclude that the replication “crisis” makes the most sense in the context of the Popperian and NMF approaches because it is only in these two approaches that replication failures represent logical refutations of theories. In contrast, replication failures are less problematic in the Lakatosian approach because they do not logically refute theories. Indeed, in the Lakatosian approach, replication failures can be legitimately ignored or used to motivate theory development. (shrink)

Hypothesizing after the results are known, or HARKing, occurs when researchers check their research results and then add or remove hypotheses on the basis of those results without acknowledging this process in their research report (Kerr, 1998). In the present article, I discuss three forms of HARKing: (1) using current results to construct post hoc hypotheses that are then reported as if they were a priori hypotheses; (2) retrieving hypotheses from a post hoc literature search and reporting them as a (...) priori hypotheses; and (3) failing to report a priori hypotheses that are unsupported by the current results. These three types of HARKing are often characterized as being bad for science and a potential cause of the current replication crisis. In the present article, I use insights from the philosophy of science to present a more nuanced view. Specifically, I identify the conditions under which each of these three types of HARKing is most and least likely to be bad for science. I conclude with a brief discussion about the ethics of each type of HARKing. (shrink)

One justification for preregistering research hypotheses, methods, and analyses is that it improves the transparent evaluation of the severity of hypothesis tests. In this article, I consider two cases in which preregistration does not improve this evaluation. First, I argue that, although preregistration can facilitate the transparent evaluation of severity in Mayo’s error statistical philosophy of science, it does not facilitate this evaluation in Popper’s theory-centric approach. To illustrate, I show that associated concerns about Type I error rate inflation are (...) only relevant in the error statistical approach and not in a theory-centric approach. Second, I argue that a preregistered test procedure that allows deviations in its implementation does not provide a more transparent evaluation of Mayoian severity than a non-preregistered procedure. In particular, I argue that sample-based validity-enhancing deviations cause an unknown inflation of the test procedure’s Type I (familywise) error rate and, consequently, an unknown reduction in its capability to license inferences severely. I conclude that preregistration does not improve the transparent evaluation of severity in Popper’s philosophy of science or when deviations are allowed. (shrink)

Contrariamente ao moral sense da Filosofia empirista inglesa, a moralidade kantiana baseia-se completamente a priori, abdicando de uma antropologia em sua exposição e formulando-se como pura metafísica, a partir de conhecimentos abstratos. Coaduna à concepção de moralidade kantiana o seu conceito de Direito, que também não possui, portanto, qualquer fundamento na experiência. Pretendeu-se dissertar sobre a segunda conferênciada obra O Liberalismo Político de John Rawls. A exposição trata dométodo de justificação do autor, concentrada nos termos racionalidade(concepção de bem) e razoabilidade (senso de justiça);subsequentemente aborda as variáveis – cooperação, voluntariedade,autonomia, limites do juízo, discordância, pluralismo, reciprocidade,imparcialidade, publicidade, justificação, democracia e tolerância. Nessesentido, parte-se da obra supracitada para a sistematização da teoria eresolução de problemas: uma referência histórica em Kant; uma respostaàs hipóteses comunitaristas; a convergência de modelos de justificação,sobretudo uma deontologia com uma (...) concepção substancial de justiça; eos argumentos epistemológicos fundacionistas e coerentistas. Conclui-se,além da unidade da obra, a tipificação contratualista na história daFilosofia, um compatibilismo ético e o caráter epistemológico coerentista. (shrink)

How do we know what we know and how do we derive meaning and value is one of my basic questions.

O objetivo do artigofoi especular sobre a epistemologia proposta por David Hume (1711-1776), especificamente a perspectiva empirista e cética. Procurou-se, assim, expor os principais conceitos da sua filosofia, especialmente acrítica à concepção de causalidade, o problema da probabilidade e os conceitos de percepções, imagens e ideias. Finalmente buscou-se expor uma interpretação que entende haver um ceticismo mitigado no autor e a superação de uma teoria do conhecimento exclusivamente psicológica.

O objetivo do trabalho é auxiliar o jurista desocupado responsável pelo ensino da cadeira de filosofia do direito. A situação mais frequente nas faculdades de direito são as aulas de filosofia e de outras cadeiras do eixo fundamental serem tapeadas por qualquer bacharel sem nada melhor para fazer. Ocorre que tais ociosos juristas muitas vezes se veem receosos quando instituídos nos seus cargos, isso porque não possuem qualquer conhecimento na matéria em que lecionam, ao mesmo tempo em que são lançados (...) em sala de aula expostos às dúvidas e críticas dos alunos. Nesse sentido apresento a esses professores, juristas desocupados, uma técnica pedagógica resumida e de fácil compreensão para ministrarem sem maiores sobressaltos a cadeira de filosofia do direito. Seguindo os passos propostos, o jurista desocupado não terá riscos de ser questionado pelos alunos ou pela instituição, mantendo seu complemento de renda garantido. (shrink)

Metascientists have studied questionable research practices in science. The present article considers the parallel concept of questionable metascience practices (QMPs). A QMP is a research practice, assumption, or perspective that has been questioned by several commentators as being potentially problematic for metascience and/or the science reform movement. The present article reviews ten QMPs that relate to criticism, replication, bias, generalization, and the characterization of science. Specifically, the following QMPs are considered: (1) rejecting or ignoring self-criticism; (2) a fast ‘n’ bropen (...) scientific criticism style; (3) overplaying the role of replication in science; (4) assuming a replication rate is “too low” without specifying an “acceptable” rate; (5) an unacknowledged metabias towards explaining the replication crisis in terms of researcher bias; (6) assuming that researcher bias can be reduced; (7) devaluing exploratory results as being more “tentative” than confirmatory results; (8) presuming that questionable research practices are problematic research practices; (9) focusing on knowledge accumulation; and (10) focusing on specific scientific methods. It is stressed that only some metascientists engage in some QMPs some of the time, and that these QMPs may not always be problematic. Research is required to estimate the prevalence and impact of QMPs. In the meantime, QMPs should be viewed as invitations to ask questions about how we go about doing better metascience. (shrink)

A teoria do Direito internacional de Kelsen é monista, ou seja, o autor reúne a legislação nacional e internacional em um único sistema normativo. Com isso, descarta o dualismo e promove uma tese fundada no princípio lógico da não-contradição, traduzido juridicamente para o princípio da imputação. Por essa afirmação, o Direito internacional, considerando o primado estadual, existe a partir do reconhecimento interno da validade da legislação externa; mais, a recepção dos acordos internacionais na legislação nacional acopla internamente o Direito internacional, (...) com seus tratados bi/multilaterais, pactos, instituições, costumes e tribunais. A teoria de Kelsen torna-se complexa, porém, quando, indagando o inverso dessa premissa, o Direito internacional posto e eficaz, já inserido internamente, não reconhece a validade normativa de eventual interpretação ou norma interna e atua como agente determinante da ordem jurídica nacional. Com isso, o Direito externo torna-se decisivo desse mesmo sistema jurídico interno, não necessariamente por uma ação coercitiva, mas por intermédio do seu reconhecimento da validade da legislação interna. Vimos esse fenômeno materializar-se no caso dos dois presidentes simultâneos da Venezuela: tanto o presidente Nicolás Maduro, quando o presidente Juan Guaidó, foram formalmente designados, por países e instituições distintas, como governantes válidos. Sendo assim, o objetivo do livro consiste em compreender esse fenômeno de reconhecimento externo dos sistemas normativos nacionais através da segunda edição da Teoria de pura do Direito como marco teórico. Igualmente, utiliza-se do estudo de caso sobre a determinação do presidente válido da Venezuela como elemento empírico e de falseabilidade. Com isso, defende a hipótese da necessidade do reconhecimento normativo-objetivo do Estado a partir da formação do Direito internacional, independentemente de seu primitivismo. Os quatro primeiros capítulos, na primeira seção, estabelecem uma interpretação sobre a obra de Kelsen, focada em seu aspecto internacionalista. Nos quatro últimos, na seção II, submeto as conclusões teóricas ao caso concreto, falseando-as ou não conforme seu teste empírico. (shrink)

In the science of consciousness, it’s oftentimes assumed that some creatures (or mental states) are more conscious than others. But in recent years, a number of philosophers have argued that the notion of degrees of consciousness is conceptually confused. This paper (1) argues that the most prominent objections to degrees of consciousness are unsustainable, (2) examines the semantics of ‘more conscious than’ expressions, (3) develops an analysis of what it is for a degreed property to count as degrees of consciousness, (...) and (4) applies the analysis to various theories of consciousness. I argue that whether consciousness comes in degrees ultimately depends on which theory of consciousness turns out to be correct. But I also argue that most theories of consciousness entail that consciousness comes in degrees. (shrink)

Gelman and Loken (2013, 2014) proposed that when researchers base their statistical analyses on the idiosyncratic characteristics of a specific sample (e.g., a nonlinear transformation of a variable because it is skewed), they open up alternative analysis paths in potential replications of their study that are based on different samples (i.e., no transformation of the variable because it is not skewed). These alternative analysis paths count as additional (multiple) tests and, consequently, they increase the probability of making a Type I (...) error during hypothesis testing. The present article considers this forking paths problem and evaluates four potential solutions that might be used in psychology and other fields: (a) adjusting the prespecified alpha level, (b) preregistration, (c) sensitivity analyses, and (d) abandoning the Neyman-Pearson approach. It is concluded that although preregistration and sensitivity analyses are effective solutions to p-hacking, they are ineffective against result-neutral forking paths, such as those caused by transforming data. Conversely, although adjusting the alpha level cannot address p-hacking, it can be effective for result-neutral forking paths. Finally, abandoning the Neyman-Pearson approach represents a further solution to the forking paths problem. (shrink)

Habermas frequentemente adota o termo Estado de direito na sua obra Direito e democracia: entre facticidade e validade. O objetivo deste artigo, então, consiste na investigação da possibilidade desse conceito, no seu fundamento e na apresentação dos problemas dele decorrentes, contrapondo-o especificamente a sua antítese, isto é, ao monismo entre Estado e direito de Kelsen. Ocorre que a filosofia habermasiana, conforme entendimento do artigo, implica a adoção de uma teoria dualista entre os conceitos de Estado e de direito. Pretendeu-se estudar a aquisição da virtude em Aristóteles a partir da interpretação de M. F. Burnyeat. Para esse, a virtude aristotélica exige dimensões cognitivas e emocionais, sendo que ao aprendiz não basta conhecer os princípios e as regras gerais da ação, mas deve ter internalizado, através do hábito, uma vontade de praticar ações nobres e justas. Compete ao sujeito virtuoso, portanto, ter o conhecimento do que é correto (the that), assim como, subsidiariamente, a justificativa do porquê é apropriada determinada ação (...) (the because). Da análise dessas variáveis, o autor procura esclarecer a figura conflituosa do akratic (incontinente) e do akalastos (perverso) e elucidar a hipótese do desenvolvimento moral. Concomitantemente este artigo pretende introduzir o problema criminológico da ideia de ressocialização ou da pena capital, entendendo ser o argumento aristotélico ainda influente para a filosofia da virtude e jurídica hodierna e necessário quando se discutem novos paradigmas éticos e jurídicos. In a new study, Ben-Haim et al. use subliminal stimuli to separate conscious and unconscious perception in macaques. A programme of this type, using a range of cognitive tasks, is a promising way to look for conscious perception in more controversial cases.

Kant’s third question (“What may I hope?”) is underdiscussed in comparison to the other two, even though he himself took it to be the question that united his efforts in theoretical and practical philosophy. This is largely his own fault: in his discussion of the question he moves quickly from talking about rational hope to discussing the kind of Belief or faith (Glaube) that grounds it. Moreover, the canonical statements of his own moral proof do not seem to give hope (...) any essential role to play. In this chapter I first consider the ways in which pre-Kantian authors muddied the distinction between what we would call “hope” and “expectation.” I then look at how Kant’s views about hope evolve to the point where, by the time of the “End of All Things” essay of 1794, he seems to endorse a kind of hopeful pessimism about our this-worldly situation, at least. I then examine a version of Kant’s moral proof that succeeds in locating a role for hope that is distinct from that of Belief, expectation, optimism, and so on. Finally, I turn to some contemporary work in two very different arenas – Anthropocene scholarship and Christian eschatology – in order to look at how the concepts of hope and optimism are deployed in those contexts. We will see that although some of the recent discourses about the “Good Anthropocene” slip beyond hope into full-blown optimism, most authors working on ecological and environmental topics are careful to keep the attitudes distinct. By contrast, there is a tendency among contemporary theologians to follow earlier Christian authors in slipping beyond mere hope to optimistic faith, and even to full-blown certainty. (shrink)

O presente artigo aborda o problema da soberania para Hans Kelsen. Tem como objetivo analisar a posição do autor sobre o tema (especialmente através do texto Sovereignty), traçando paralelamente algumas considerações. Ocorre que para Kelsen o conceito de soberania mostra-se impreciso a partir da doutrina tradicional. Ainda, mesmo superando essa doutrina e a teoria dualista, também o conteúdo do direito nacional e internacional permanece inalterado. Portanto, prova-se a irrelevância de tal para a teoria jurídica.

O artigo tem como objetivo apresentar o problema da determinação do sentido das normas para o Kelsen considerando a flexibilidade do quadro de interpretações. Expõe, primeiramente, a suposta transição do conceito de interpretação normativa, passando de um formalismo-normativismo restritivo para um realismo jurídico a partir das suas últimas obras; em um segundo momento apresenta o decorrente conflito ainda atual constituído por essas reformulações. Finalmente, defende a hipótese de superação da dicotomia formalismo-normativismo versus realismo jurídico através de uma leitura realista normativista.

O trabalho busca esclarecer dois pontos centrais da Filosofia política de Maquiavel – as figuras da Virtù e da Fortuna. A virtú deve ser vista como uma forma do livre-arbítrio do governante, sendo a principal variável na condução do principado.Destaca-se, também, a utilização da variável nacontestação aos valorestradicionais. Já a Fortuna constitui-se na indeterminabilidade de parte dos resultadosdo governo: ela deve ser dominada, conquistada para o benefício do príncipe.

A separação entre o ser, isto é, o ato, e o dever-ser, ou seja, o sentido de comando, permissão etc.. do ato é parte fundamental para o entendimento da epistemologia proposta por Hans Kelsen. Dessa discriminação entre o ser e o dever-ser há o principal argumento do autor para a separação do direito das ciências causais e, principalmente, a superação da falácia naturalista no âmbito teórico e moral. Nesse sentido, também o artigo se propôs a analisar a refutação de Kelsen (...) a doutrinas morais e jurídicas negadoras de tal distinção e, consequentemente o reflexo de tal posicionamento na perspectiva da responsabilidade. O artigo investigou o método para uma filosofia intercultural a partir da Ibero-América, de Raul Fornet-Betancourt. Partiu-se especificamente do texto do autor para posteriormente fornecer considerações críticas aos seus posicionamentos. Nesse sentido, analisou-se a originalidade do tema, a filosofia da libertação como modelo de diálogo intercultural, seus pressupostos hermenêuticos e epistemológicos e, por fim, o pensamento ibero-americano como base para uma filosofia intercultural. No final do trabalho apresentou-se seis críticas ao texto estudado – o problema da arrogância e dissimulação filosófica, (...) a adoção tácita de um platonismo e a não originalidade filosófica, o problema da falácia naturalista e do falsificacionismo e, finalmente, a não razoabilidade política das propostas. Com este artigo procura-se introduzir a questão da origem social das normas morais e jurídicas a partir da obra de Hans Kelsen e solucionar, de forma breve, o problema da conciliação do método lógico-transcendental da Teoria pura com a filosofia positivista e empirista do autor.

Some philosophers think that life is worth living not merely because of the goods and the bads within it, but also because life itself is good. I explain how this idea can be formalized by associating each version of such of a view with a function from length of life to the value generated by life itself. Then I argue that every version of the view that life itself is good faces some version of the following dilemma: either (1) good (...) human lives are worse than very long lives wholly devoid of pleasure, desire-satisfaction, knowledge, or any other goods, or (2) very short lives containing nothing but suffering are worth living. Since neither result is plausible, we ought to reject the view that life itself is good. On the view I favor, any given life may be worth living because of the goods that it contains, but life itself is neutral. (shrink)

This paper examines the idea of "objective phenomenology," or a way of understanding the phenomenal character of conscious experiences that doesn’t require one to have had the kinds of experiences under consideration. My central thesis is that structural facts about experience—facts that characterize purely how conscious experiences are structured—are objective phenomenal facts. I begin by precisifying the idea of objective phenomenology and diagnosing what makes any given phenomenal fact subjective. Then I defend the view that structural facts about experience are (...) objective. I also argue that structural facts about experience, despite being objective, nevertheless still give rise to an explanatory gap. (shrink)

Contemporary philosophical debates surrounding toleration have revolved around three issues: What is toleration? Should we tolerate and, if so, why? What should be tolerated? These questions are of central importance to social and political thought.

A presente dissertação tem como tema central a proposta da abordagem hermenêutica da decisão judicial em Hans Kelsen considerando seu relativismo filosófico. No primeiro momento expõe a concepção de decisão judicial no autor e as suas reformulações conceituais no decorrer das suas obras – as passagens do formalismo normativista das primeiras obras até o ceticismo de regras na Teoria geral das normas. Também propõe a dissolução entre as leituras formalistas e realistas através da possibilidade de uma leitura realista moderada. Após (...) expõe a filosofia relativista do autor e seu resultado na exclusão dos elementos da moralidade do conceito de direito. Finalmente deduz regras de interpretação a partir de uma visão abrangente das obras do autor. O objetivo da dissertação, nesse sentido, é analisar a dinâmica da criação normativa pelo judiciário, a discricionariedade daí resultante e a possibilidade de interpretar os vários sentidos das normas sem recorrer a qualquer moralismo para tal. This three-part chapter explores a higher-order logic we call ‘Classicism’, which extends a minimal classical higher-order logic with further axioms which guarantee that provable coextensiveness is sufficient for identity. The first part presents several different ways of axiomatizing this theory and makes the case for its naturalness. The second part discusses two kinds of extensions of Classicism: some which take the view in the direction of coarseness of grain (whose endpoint is the maximally coarse-grained view that coextensiveness is sufficient for (...) identity), and some which take the view in the direction of fineness of grain (whose endpoint is the maximally fine-grained theory containing all distinctness claims compatible with Classicism). The third part introduces some techniques for constructing models of Classicism, and uses them to prove the consistency of many of the extensions of Classicism introduced in the second part. We consider the relationship between neural and behavioural evidence for animal consciousness. We critically examine two recent studies: one neural and one behavioural. The first, on crows, finds different neural activity depending on whether a stimulus is reported as seen or unseen. However, to implicate this neural activity in consciousness, we must assume that a specific conditioned behaviour is a report of conscious experience. The second study, on macaques, records behaviours strikingly similar to patterns of conscious and unconscious perception in (...) humans. However, confounds are only ruled out in human subjects, presupposing substantial neural similarity between humans and macaques. Taken together, the two studies reveal a sense in which neural and behavioural research rely on each other. Looking ahead, these two types of evidence could prove to be either mutually reinforcing or mutually undermining. The science of animal consciousness needs both neural and behavioural evidence, ideally obtained as part of a single coordinated programme. (shrink)

Many philosophers accept both of the following claims: (1) consciousness matters morally, and (2) species membership doesn’t matter morally. In other words, many reject speciesism but accept what we might call 'sentientism'. But do the reasons against speciesism yield analogous reasons against sentientism, just as the reasons against racism and sexism are thought to yield analogous reasons against speciesism? This paper argues that speciesism is disanalogous to sentientism (as well as racism and sexism). I make a case for the following (...) asymmetry: (a) some non-humans clearly have interests, but (b) no non-conscious entities clearly have interests. This asymmetry, I argue, renders sentientism resistant to the standard argument against speciesism. (shrink)

What makes a certain consideration an aesthetic reason rather than a reason of some other kind? Is it a solely a matter of the kind of attitude or activity that the reason supports? How fundamental or structural are such reasons? Do they contrast in a natural way with epistemic or practical reasons? Is skilled aesthetic achievement, whether interpretative or creative, a matter of recognizing the aesthetic reasons we have for a given response, and correctly according with such reasons? In this (...) paper, I offer a preliminary discussion of these topics. I argue that our account of aesthetic reasons should respect the fact that they play an important regulative role, over and above directly supporting aesthetic response. Such a role allows aesthetic reasons to moderate a wide range of practical and epistemic activities, but not by adding or substituting distinctively aesthetic ends or purposes for such activities. I then go on to argue against the view that skilled aesthetic achievement consists in correct recognition of and accord with aesthetic reasons, adapting a recent argument of Timothy Williamson’s. Higher-order logic augments first-order logic with devices that let us generalize into grammatical positions other than that of a singular term. Some recent metaphysicians have advocated for using these devices to raise and answer questions that bear on many traditional issues in philosophy. In contrast to these 'higher-order metaphysicians', traditional metaphysics has often focused on parallel, but importantly different, questions concerning special sorts of abstract objects: propositions, properties and relations. The answers to the higher-order and the property-theoretic questions may coincide (...) sometimes but will often come apart. I argue that when they do, the higher-order questions are closer to the metaphysical action and so it would be better for these debates to proceed in higher-order terms. (shrink)

Conscious experiences are characterized by mental qualities, such as those involved in seeing red, feeling pain, or smelling cinnamon. The standard framework for modeling mental qualities represents them via points in geometrical spaces, where distances between points inversely correspond to degrees of phenomenal similarity. This paper argues that the standard framework is structurally inadequate and develops a new framework that is more powerful and flexible. The core problem for the standard framework is that it cannot capture precision structure: for example, (...) consider the phenomenal contrast between seeing an object as crimson in foveal vision versus merely as red in peripheral vision. The solution I favor is to model mental qualities using regions, rather than points. I explain how this seemingly simple formal innovation not only provides a natural way of modeling precision, but also yields a variety of further theoretical fruits: it enables us to formulate novel hypotheses about the space and structures of mental qualities, formally differentiate two dimensions of phenomenal similarity, generate a quantitative model of the phenomenal sorites, and define a measure of discriminatory grain. A noteworthy consequence is that the structure of the mental qualities of conscious experiences is fundamentally different from the structure of the perceptible qualities of external objects. Comparative psychology, the multidisciplinary study of animal behavior and psychology, confronts the challenge of how to study animals we find cute and easy to anthropomorphize, and animals we find odd and easy to objectify, without letting these biases negatively impact the science. In this Element, Kristin Andrews identifies and critically examines the principles of comparative psychology and shows how they can introduce other biases by objectifying animal subjects and encouraging scientists to remain detached. Andrews outlines the scientific benefits of treating (...) animals as sentient research participants who come from their own social contexts and with whom we will be in relationship. With discussions of science's quest for objectivity, worries about romantic and killjoy theories, and debates about chimpanzee cognition between primatologists who work in the field and those in the lab, Andrews shows how scientists can address the different biases through greater integration of the subdisciplines of comparative psychology. An important advance in normativity research over the last decade is an increased understanding of the distinction, and difference, between normativity and rationality. Normativity concerns or picks out a broad set of concepts that have in common that they are, put loosely, guiding. For example, consider two commonly used normative concepts: that of a normative reason and that of ought. To have a normative reason to perform some action is for there to be something that counts in favour of performing (...) that action. Likewise with ought, when there is sufficient evidence for something, one ought to believe it (at least under normal circumstances). Not all guidance need be directed towards a specific state or a specific action. Subject to the requirements of normativity, too, are relations. It is commonly believed, for example, that we ought not to hold contradictory beliefs.1 At least some of the requirements that concern relations amongst an agent’s mental states are, or seem, distinctive. Agents who fail to satisfy these requirements are considered, at least to some degree, irrational. On many current views, being irrational is distinct in some way from not being how one ought to be; rationality is a concept distinct from normativity. Much of the literature on this topic over the last decade stems from attempts to capture the characteristic features of the requirements of rationality. Two influential views in particular did much to set the agenda. The first of these two was put forward John Broome.2 His view, the particulars of which I shall discuss in more detail below, is that the requirements of rationality could be expressed using a normative relation, which he calls a ‘normative requirement’. Normative requirements are conditionals governed by an all-thingsconsidered ought. In the case of rationality, the conditional is made up entirely of mental states.. (shrink)

This chapter explores global debunking arguments, debunking arguments that aim to give one a global defeater. I defend Alvin Plantinga’s view that global defeaters are possible and, once gained, are impossible to escape by reasoning. They thereby must be extinguished by other means: epistemically propitious actions, luck, or grace. I then distinguish between three types of global defeater—pure-undercutters, undercutters-because-rebutters, and undercutters-while-rebutters—and systematically consider how one can deflect such defeaters. Lastly, since I draw insights from the literature on perhaps the most (...) widely discussed global debunking argument in the literature, Plantinga’s evolutionary argument against naturalism, I end up responding to many potential problems for it. This includes the so-called conditionalization problem, as well as those raised by Bergmann (2002), Law (2012), Deem (2018), Hendricks and Anderson (2020), and Wielenberg (in Craig and Wielenberg (2021)). In tradition linked to Aristotle and Kant, many contemporary philosophers treat practical and theoretical normativity as two genuinely distinct domains of normativity. In this paper I consider the question of what it is for normative domains to be distinct. I suggest that there are two different ways that the distinctness thesis might be understood and consider the different implications of the two different distinctness theses.

Recent research (Latham, Miller and Norton, forthcoming) reveals that a majority of people represent actual time as dynamical. But do they, as suggested by McTaggart and Gödel, represent time as essentially dynamical? This paper distinguishes three interrelated questions. We ask (a) whether the folk representation of time is sensitive or insensitive: i.e., does what satisfies the folk representation of time in counterfactual worlds depend on what satisfies it actually—sensitive—or does is not depend on what satisfies it actually—insensitive, and (b) do (...) those who represent actual time as dynamical, represent time in all possible worlds as dynamical—what we call insensitive dynamism—or do they represent time in all possible worlds as dynamical only conditional on the actual world in fact being dynamical—what we call sensitive dynamism and (c) do dynamists and non-dynamists deploy two different representations of time, or deploy the same representation, but disagree about what actually satisfies that representation? We found no evidence that the folk representation of time is sensitive, or that the folk representation of time is essentially dynamical in either sense, though we did find evidence of a shared representation, on which dynamical features are sufficient, but not necessary, for time. This entry discusses the notion of a unit of normativity. This notion may be understood in two distinct ways. One way to understand a unit of normativity is as some particular type of assignment of normative status, e.g., a requirement, an ought, a reason, or a permission. A second way to understand a unit of normativity is as a measure of a quantity of normativity, perhaps associated with the numerical assignment given to the strength of reasons. This entry outlines some (...) basic differences among units of normativity in the first sense, noting that they vary slightly depending on whether one is talking about normativity in a more general or more robust sense.
