In this paper, we argue that computer simulations can provide valuable insights into the performance of voting methods on different collective decision problems. This could improve institutional design, even when there is no general theoretical result to support the optimality of a voting method. To support our claim, we first describe a decision problem that has not received much theoretical attention in the literature. We outline different voting methods to address that collective decision problem. Under certain criteria of assessment akin (...) to extensions of the Condorcet Jury Theorem, we run simulations for the methods using MATLAB, in order to compare their performance under various conditions. Astrobiocentrism is a vision that places us in a scenario of confirmation of life in the universe, either as a second genesis or as an expansion of humanity in space. It manages to raise consistent arguments in relation to questions such as what would happen to knowledge if life were confirmed in the universe, how would this change the way we understand our place in the cosmos? Astrobiocentrism raises a series of reflections in the context of confirmed discovery, and it (...) develops concepts that work directly with what would happen after irrefutable evidence has been obtained that we are not alone in space. Unlike biocentrism or ecocentrism, the astrobiocentric view is not limited to the Earth-centric perspective, and for it incorporates a multi-, inter- and transdisciplinary understanding. Therefore, the aim of this paper is to make a reflection on the astrobiocentric issues related to the challenges and problems of the discovery of life in the universe and the expansion of mankind into space. Here we explore some aspects of the transition from biogeocentrism to astrobiocentrism, astrobiosemiotics, homo mensura, moral community, planetary sustainability and astrotheology. (shrink)

Abstract: Introspection reveals that one is frequently conscious of some form of inner speech, which may appear either in a condensed or expanded form. It has been claimed that this speech reflects the way in which language is involved in conscious thought, fulfilling a number of cognitive functions. We criticize three theories that address this issue: Bermúdez’s view of language as a generator of second-order thoughts, Prinz’s development of Jackendoff’s intermediate-level theory of consciousness, and Carruthers’s theory of inner speech as (...) a rehearsal of action-schemata. We contend they have problems to account for those cases in which inner speech is fragmentary, and for the difference with those instances in which it appears as more sentence-like. In addition, we present verbal overshadowing as a phenomenon that neither of them can easily explain. Finally, we propose an account in which inner speech is fundamentally silent outer speech and argue that it is more explanatory than the alternatives. (shrink)

I defend impact-based accounts of institutional racism against the criticism that they are over-inclusive. If having a negative impact on non-whites suffices to make an institution racist, too many institutions (including institutions whose affirmative action policies inadvertently harm its intended beneficiaries) would count as racist. To address this challenge, I consider a further necessary condition for these institutions to count as racist—they must stand in a particular relation to racist ideology. I argue that, on the impact-based model, institutions are racist (...) if they have a negative racial impact AND this impact is legitimized by racist ideology. Racist ideologies limit social criticism of and collective action against institutions that have a negative racial impact, and in so doing, lend stability to systems of racial domination. (shrink)

The highly successful project of European integration, the EU, faces today (like it did 10, 20, 30 years ago) big challenges. Yet Brussels is, often, a very useful tool to face them is.

Naturalism, construed as the idea that philosophy should be continuous with science, is a highly influential view. Its consequences for epistemology, however, are rather odd. Many believe that naturalized epistemology allows eschewing traditional skeptical challenges. This is often seen as an advantage; but it also calls into question its claim of belonging to the philosophical inquiry into knowledge. This paper argues that skeptical challenges can be stated to defy epistemic optimism within naturalized epistemology, and that there are distinctively naturalistic forms (...) of skepticism. To that end, it outlines some assumptions underlying many attempts to naturalize epistemology. It contrasts these approaches to traditional epistemology and identifies the reasons offered by naturalistic epistemologists to dismiss traditional skeptical challenges. Next, it argues that the problem of skepticism can be sensibly stated within a naturalistic setting. Finally, it contends that there are distinctively naturalistic strategies to argue for skepticism and diagnoses the prospects of naturalism vis-à-vis these kinds of skeptical challenges. (shrink)

Internal coherence is of great importance for how we think about appreciating objects of aesthetic worth. A disagreement between what we judge to be worthy and what we affectively favor can prevent us from properly grasping its value. However, it is also assumed in the aesthetic domain that our taste changes over time, jeopardising such coherence constraint. These changes can lead to a mismatch between new aesthetic judgments and old aesthetic preferences. This chapter explores a number of issues that emerge (...) from this tension. Using Taylor Swift’s re-recording as a case study, I will explore the relation between fan loyalty and personal authenticity, as well as the role of biographical taste in the reception of these newly recorded albums among Swift’s long-time fanbase. There is a dimension of rationality, known as structural rationality, according to which a paradigmatic example of what it means to be rational is not to be akratic. Although some philosophers claim that aesthetics falls within the scope of rationality, a non-akrasia constraint prohibiting certain combinations of attitudes is yet to be developed in this domain. This essay is concerned with the question of whether such a requirement is plausible and, if so, whether it is an actual requirement of aesthetic (...) rationality. Ultimately, this paper defends the view that aesthetics is no different from other domains in that it requires coherence between a subject’s mental states (in the aesthetic case, between what is judged and what is aesthetically liked). A través de su historia, la práctica de la medicina ha estado imbuida de diversas concepciones sobre la naturaleza humana, así como sobre los elementos, estados o procesos (tanto internos como externos) que dan origen a la enfermedad y aquellos que propician la salud. Si se consideran seriamente, tales concepciones se pronuncian sobre cuestiones ontológicas y metafísicas. En la medida en que sean dignas de crédito, sus pronunciamientos ontológicos y metafísicos resultan relevantes para múltiples facetas de la práctica médica, como (...) el diagnóstico, el tratamiento, la investigación, la prevención y el control de enfermedades, pero también para el cuidado y la promoción de la salud. En este capítulo se exploran cuestiones metafísicas generales en torno a la concepción de la práctica médica más influyente en el mundo actual: la biomedicina. Sostengo que, a pesar de que el asombroso éxito de las ciencias biomédicas nos ofrece razones para creer en la verdad (aproximada) de las representaciones que toman como base, esa confianza no debería estar asociada selectivamente a pronunciamientos específicos sobre qué cosas existen y cómo se conectan; además, nuestro grado de convicción en los resultados de la investigación biomédica debería estar calibrado al tomar en cuenta vulnerabilidades ampliamente reconocidas de este ámbito de indagación. Comienzo caracterizando la biomedicina como la aplicación de los resultados de la investigación científica a la práctica médica. Examino razones generales para creer en la verdad de las representaciones con las que opera este modelo de la práctica médica, recapitulando de manera panorámica el debate en torno al realismo científico. Luego consideraro aspectos relevantes para este debate que conciernen específicamente a las ciencias biomédicas, así como algunas consecuencias para el ámbito de la biomedicina que se desprenden de adoptar varias posiciones en torno al realismo científico. Concluyo ofreciendo una defensa del realismo carte blanche como la posición más sensata que puede adoptarse en este ámbito. (shrink)

This paper argues that racism should not only be conceived as a moral concept whose main aim is to condemn severe wrongs in the domain of race. The paper advances a complementary interpretation of racism as an explanatory concept--one that plays a key role in explaining race-based social problems afflicting members of subordinate racialized groups. As an explanatory concept, the term 'racism' is used to diagnose and highlight the causes of race-related social problems. The project of diagnosing race-based social problems (...) contributes to the pragmatic anti-racist end of developing better political and policy strategies for solving these social problems. The paper defends this interpretation of racism as an explanatory concept through a critical engagement with Urquidez's moral-philosophical account of racism. (shrink)

Este trabajo analiza los patrones de desambiguación de presuposiciones que se pueden considerar anafóricas y son generadas por partículas indexicales. En contraste con teorías recientes sobre la presuposición que privilegian la información lexical proponemos un análisis perspectivo de la presuposición según el cual la inferencia por defecto sobre este tipo de información hace uso de la perspectiva de los hablantes. En dos estudios exploramos el patrón de desambiguación de oraciones que contienen la palabra ‘también’ en contextos donde se usa el (...) indéxico ‘yo’. Los resultados confirman nuestra hipótesis y se discuten a la luz las principales ideas sobre presuposición y anáfora. A partir de estos resultados sugerimos algunas direcciones futuras de investigación. (shrink)

Al ceñirse al contexto de la acción y a los rasgos necesarios para la agencia intencional, dicha explicación proporciona un fundamento basado en la autonomía y libertad de los agentes intencionales prospectivos, tan solo limitadas por aquellas exigencias racionales derivadas de la igual consideración del status moral de todos los demás agentes (...) intencionales prospectivos quienes, en última instancia, se identifican con la humanidad en su conjunto mediante las ideas implícitas de reciprocidad y responsabilidad moral por los actos propios. En definitiva, el argumento de Gewirth desemboca en el PCG para proporcionar un fundamento racional de los derechos humanos limitado a la estructura normativa de la acción, la agencia intencional prospectiva potencial o actual de todos los seres humanos y los bienes necesarios para la acción intencional: la libertad y el bienestar. Recorre los principales ejes temáticos del autor acerca de su idea de mujer, de la necesidad de liberar a la mujer e igualarla al varón en los terrenos de la familia, laboral, educativo y político.

Intentionalism is the view that perceptual phenomenology depends on perceptual content. The aim of this paper is to make explicit an ambiguity in usual formulations of intentionalism, and to argue in favor of one way to disambiguate it. It concerns whether perceptual phenomenology depends on the content of one and only one representation (often construed as being identical to a certain perceptual experience), or instead depends on a collection of many different representations throughout the perceptual system. We argue in favor (...) of the latter option. Intentionalism so conceived can make better sense of contemporary neuroscience of perception, and is better equipped to confront several influential objections to traditional intentionalism. The work presented has the following approach: starting from the Pope's reflection on the planet and ecological problems, it is intended to show the philosophical influences that underlie Francisco's exposition. These influences make it possible to describe a philosophical profile present in the encyclical Laudato si’. In addition, since philosophy claims to know, it is not exhausted only in knowledge, but tries to know in order to act; therefore, the presence of an ethical proposal follows; and since all ethics leads (...) to action, it follows that action cannot be without some indicators, without an axiology on which human action on the planet revolves. The result is that Francisco offers an ethic of otherness that feels the other as an authentic neighbor, even those who are in the future. It is an ethic of common benefit and caring for the other whose fundamental axis is the person and for this reason he reflects the phenomenon of human life within life on Earth, with which its philosophical approach seems personalist, from a point of Christian view. Recent work on signaling has mostly focused on communication between organisms. The Lewis–Skyrms framework should be equally applicable to intra-organismic signaling. We present a Lewis–Skyrms signaling-game model of painful signaling, and use it to argue that the content of pain is predominantly imperative. We address several objections to the account, concluding that our model gives a productive framework within which to consider internal signaling.

I address the objection that the concept of racism has become overly inflated. Critics of the conceptual inflation of “racism” argue that theories of institutional racism engage in untoward conceptual inflation insofar as they undermine our moral understanding of racial phenomena, hinder our ability to explain the causes of racial inequality, and even undercut struggles for racial justice. I develop an original account of institutional racism and show that it is immune to all three versions of the conceptual inflation challenge.

There are various proposals for a general characterization of holism1. In this paper I propose the following: a variety of holism is the view that every X of an appropriate kind, which is part of a relevant whole W, cannot be legitimately separated or taken in isolation from W. Then, I distinguish two general kinds of holism, depending on two different reasons which can debar us from taking X in isolation from W. One reason can be that separating X from (...) W always amounts to transforming X into something else. Correspondingly, a strong holism is the view that if the whole W is modified anywhere, X ceases to be X and becomes something else. Another reason why it may be illegitimate to consider X in isolation from W can be that if we separate X from W, nothing that we know entitles us to exclude that X might be transformed into something else. Correspondingly, virtual holism is the view that if the whole W is modified anywhere, we can never rule out that X ceases to be X and becomes something else. (shrink)

Our philosophical understanding of mental illness is being shaped by neuroscience. However, it has the paradoxical effect of igniting two radically opposed groups of philosophical views. On one side, skepticism and denialism assume that, lacking clear biological mechanisms and etiologies for most mental illnesses, we should infer they are constructions best explained by means of social factors. This is strongly associated with medical nihilism: it considers psychiatry more harmful than benign. On the other side of the divide, naturalism and reductionism (...) are on the look for failures in the biological functioning of the organism whenever a genuine mental illness occurs. Psychiatry as currently practiced, accordingly, exhibits the gaps of an ongoing research programme; a yet to be completed neuroscience would link mental illnesses with identifiable biological mechanisms. Both sides of this divide claim to be fostered by scientific discoveries and advances in neuroscience, when taken at face value. Against this background, we argue instead for a modest view. To that end, we draw attention to some nuances in the scientific realism debate. While contending that neuroscientific theories and models aim to provide true representations of their target systems, and can justifiably claim to have attained some, we argue that our confidence should not be placed beforehand in specific features of these scientific representations. Hence, it would be unwarranted to extract morals for psychiatry from posits (or their absence) in neuroscientific explanations of mental illnesses. To illustrate our position, we examine some recent discoveries in neuroscience concerning bipolar disorder. We conclude by linking our topic to a broader issue in the philosophy of medicine: insofar as psychiatry is a biomedical specialty, its classifications of health and disease are guided by pragmatic concerns, as well as by scientific discoveries. Linguistics of saying studies language in its birth. Language is the mental activity executed by speaking subjects. Linguistics of saying consists in analyzing speech acts as the result of an act of knowing. Speaking subjects speak because they have something to say. Tthey say because they define themselves before the circumstance they are in. And this is possible because they are able to know. Speaking, then, is speaking, saying and knowing. In this sense there is a progressive determination. Knowing makes (...) possible saying, and saying determines speaking, or, in other words: speaking involves saying and knowing, and saying involves knowing. The problem thus is to determine the meaningful intentional purpose of the individual speaker to say something in every speech act. (shrink)

This article analyses the epistemic status of law and its presumption of being a science in relation with the so-called demarcation criterion proposed by different philosophers of science. Such criteria are the main analytical elements to differentiate scientific discourses from those who are not and the ones who pretend to be. In relation to those, pseudoscience and law are treated, to finally conclude with the exposition of the case of Daubert v. Merrill Dow Pharmaceuticals, in which a judicial process defined (...) demarcation criteria. This paper shows how the demarcation criteria of science and the concept of pseudoscience cannot be applied to law science given its own rationality. (shrink)

Chi ha l'abitudine di sfogliare le riviste filosofiche sa che "metafisica" non è più una parola che scotta. I maestri dell'inizio del secolo (gli empiristi logici sono l'esempio più tipico) identificarono la metafisica con il non-senso e usarono la parola come un marchio di infamia. Non mancavano precedenti nella storia della filosofia. Ma oggi gli allievi di quei maestri preferiscono rifarsi ad un uso diverso, meno fazioso, del termine per indicare con esso un'indagine filosofica, che non solo non deve essere (...) trascurata, ma concerne i fondamenti di molte altre ricerche, ed è quindi per molti versi centrale. El estudio actual de la argumentación se encuentra distanciado de la lógica. En este artículo sostengo que restaurar el vínculo del estudio de la argumentación con esta disciplina podría resultar benéfico para la metas descriptivas y normativas de este campo de investigación. Tras destacar algunos aspectos del surgimiento la teoría de la argumentación contemporánea, enfatizando la idea de "perspectivas", explico cómo el reconocimiento de sus objetivos y tareas volvió problemática la coexistencia de varios enfoques o aproximaciones para el estudio de (...) la realidad argumentativa. Sugiero algunas hipótesis explicativas sobre el abandono del enfoque lógico en favor de otras alternativas y, a continuación, ofrezco razones para encauzar el estudio sistemático de la argumentación desde este enfoque. Además de las consideraciones normativas y las herramientas descriptivas que pueden aducirse en su favor, sostengo que el enfoque lógico puede proporcionar una clase de integración a este campo investigación de maneras que no están disponibles para otras aproximaciones. Frente a problemas de decisión colectiva de cierta complejidad, distintos métodos de votación pueden considerarse igualmente democráticos. Ante esta situación, argumento que es posible investigar cuáles de esos métodos producen mejores resultados epistémicos sobre asuntos fácticos. Comienzo ilustrando la relación entre democracia y métodos de votación con un sencillo ejemplo. Muestro cómo el uso de modelos idealizados permite descubrir algunas propiedades de los métodos de votación; varios de estos descubrimientos muestran que, frente a problemas de cierta complejidad, no hay una (...) respuesta clara acerca de cuál es el resultado de una elección democrática. Frente a esto, sugiero que deberíamos tomar en cuenta un rasgo epistémico instrumental de varios métodos de votación: su capacidad para generar respuestas correctas ante varias situaciones. Esta intuición ofrece lecciones importantes para el diseño de instituciones electorales. (shrink)

Se subraya el aspecto de la educación como elemento fundamental en el pensamiento del filósofo inglés John Stuart Mill, en el sentido (...) de mostrar la educación como aquello que permite sacar al exterior las capacidades, talentos, destrezas que la persona posee. Al mismo tiempo es la educación, en el marco de la cultura, la que afina y refina a la persona, ayudándola a construirse como una persona que se incorpore a la ciudadanía con derechos y deberes y que ejerza esa ciudadanía responsablemente en aras del bien común. La educación hace al ser humano más libre, y la libertad es la esencia de la persona en el pensamiento de Stuart Mill. (shrink)

The concept of autonomy is central to many debates in aesthetics. However, exactly what it means to be autonomous in our aesthetic engagements is somewhat unclear in the philosophical literature. The normative significance of autonomy is also unclear and hotly debated. In this essay, I propose a method for clarifying this elusive concept by distinguishing three distinct senses or varieties of aesthetic autonomy: experiential autonomy, competence-based autonomy, and personal autonomy. On this taxonomy autonomy is a context-sensitive concept and autonomy applies (...) to several different moments or stages of aesthetic appreciation. Alberto Coffa used the phrase "the Copernican turn in semantics" to denote a revolutionary transformation of philosophical views about the connection between the meanings of words and the acceptability of sentences and arguments containing those words. According to the new conception resulting from the Copernican turn, here called "the Copernican view", rules of use are constitutive of the meanings of words. This view has been linked with two doctrines: (A) the instances of meaning-constitutive rules are analytically and a priori true (...) or valid; (B) to grasp a meaning is to accept its rules. The pros and cons of different versions of the Copernican view, ascribable to Wittgenstein, Carnap, Gentzen, Dummett, Prawitz, Boghossian and other authors, will be weighed. En el presente artículo, el autor se ocupa de esbozar una caracterización general del autoengaño desde algunas de las principales perspectivas en la materia, señalando los problemas centrales que involucra y haciendo énfasis en la línea intencionalista. Luego analiza la relación que el autoengaño guarda con la autoridad de la primera persona y qué imagen resulta de una conjunción teórica de ambos problemas.

The focus of Australia-US relations is most often on mutual security and economic ties. But it is also important to acknowledge the significant role that educational linkages and exchanges have played in furthering the bond between the two countries.

Brexit has been widely covered in the news. Much of the attention of the press in English has gone to the British perspective. This piece seeks to present a holistic view of this event, including the European perspective. It argues that, notwithstanding this break-up and the problems it highlights (especially the tiredness of citizens with traditional party politics), the European project can survive this crisis and forge ahead into the future.

El artículo trata de mostrar las influencias de los ideales de la Ilustración en el pensamiento de John Stuart Mill. Así, puede comprobarse como en esos ideales de libertad, igualdad, tolerancia, respeto a la diferencia que propugna la Ilustración están presentes en el pensamiento de Mill y vertebran su filosofía.

Both Franz Brentano and Edmund Husserl addressed sound while trying to explain the inner consciousness of time and gave to it the status of a supporting example. Although their inquiries were not aimed at clarifying in detail the nature of the auditory experience or sounds themselves, they made some interesting observations that can contribute to the current philosophical discussion on sounds. On the other hand, in analytic philosophy, while inquiring the nature of sounds, their location, auditory experience or the audible (...) qualities and so on, the representatives of that trend of thought have remained silent about the depiction of sound and the auditory phenomena in the phenomenological tradition. The paper’s intention is to relate both endeavours, yet the perspective carried out is that of analytic philosophy and, thus, I pay special attention to conceptual analysis as a methodological framework. In this sense, I first explain what sound ontology is in the context of analytic philosophy and the views that it encompasses— namely, the Property View (PV), the Wave View (WV) and the Event View (EV)—. Secondly, I address the problems it entails, emphasising that of sound individuation. In a third section, I propose the possibly controversial conjunction of a “Brentano-Husserl Analysis of the Consciousness of Time” (for short “Brentano-Husserl analysis”) and outline the commonalities of both authors, without ignoring its discrepancies. My main focus is Husserl’s 1905 Vorlesungen zur Phänomenologie des Inneren Zeitbewusstseins. While addressing the Brentano-Husserl analysis, I elaborate on the problem of temporal and spatial extension (Raumlichkeit and Zeitlichkeit, respectively) of both consciousness and sound. Such comparison is a key one, since after these two developments, one can notice some theoretical movements concerning the shift of attention from sounds to the unity of consciousness, and how they mirror each other. After examining the controversial claims concerning the temporal and spatial extension of both consciousness and sound, I argue in the concluding paragraphs that while considering the accounts of sound ontology, the Brentano-Husserl analysis would probably endorse a Property View and that this could have interesting consequences for the issue of Sound Individuation. El trabajo que se presenta intenta mostrar, por un lado y siguiendo a Ortega y Gasset, la complejidad del fenómeno de la política; y por otro lado, a partir de la constatación anterior, la necesidad de una ética que haga de la política una actividad presidida por el diálogo, la integración y la búsqueda de soluciones a las complejidades de la sociedad actual. Son relevantes en este aspecto Apel y Habermas.

We aim to map out the points of confluence between phronesis and emotion, as well as the nature of this confluence. We do so based on philosophical and psychological explanations of emotions and phronesis. Making sound decisions, which requires phronesis, is an important matter, but its relationship with emotions has only just begun to be studied. We propose that the interplay between phronesis and emotion is possible (rather than inevitable) because both have a cognitive-behavioural structure and because emotions are hierarchical. (...) In the case of emotion, there are no gaps between the cognitive and behavioural dimensions, while phronetic acts can only manifest if cognitive and behavioural aspects are activated simultaneously. The confluence we identify is bidirectional and involves mutual enrichment in this dual dimension. On the one hand, phronesis enriches emotion because it involves extra subjective knowledge and allows emotion to be directed towards higher goals. On the other hand, emotions enrich phronesis because phronesis makes decisions based on sensitive preferences and because emotions confirm correctness in the context of moral decision making. Methodologically, this study is theoretical and interdisciplinary, as our approach is both philosophical and psychological. Philosophy helps us to improve the conceptual foundation of the construct, while psychology provides an analysis of the emotional process, allowing philosophy to understand how emotional evaluation-assessment and motivation lead to decision making. Introduction: Traditionally, empathy has been studied from two main perspectives: the theory-theory approach and the simulation theory approach. These theories claim that social emotions are fundamentally constituted by mind states in the brain. In contrast, classical phenomenology and recent research based on enactive theories consider empathy as the basic process of contacting others’ emotional experiences through direct bodily perception and sensation. Objective: This study aims to enrich knowledge of the empathic experience of pain by using an experimental phenomenological method. Method: (...) Implementing an experimental paradigm used in affective neuroscience, we exposed 28 healthy adults to a video of sportspersons suffering physical accidents while practicing extreme sports. Immediately after watching the video, each participant underwent a phenomenological interview to gather data on embodied, multi-layered dimensions (bodily sensations, emotions, and motivations) and temporal aspects of empathic experience. We also performed quantitative analyses of the phenomenological categories. Results: Experiential access to the other person’s painful experience involves four main-themes. Bodily resonance: participants felt a multiplicity of bodily, affective, and kinesthetic sensations. Attentional focus: some participants centered their attention more on their own personal discomfort and sensations of rejection, while others on the pain and suffering experienced by the sportspersons. Kinesthetic motivation: some participants experienced the feeling in their bodies to avoid or escape from watching the video, while others experienced the need to help the sportspersons avoid suffering any injury while practicing extreme sports. Temporality of experience: participants witnessed temporal fluctuations in their experiences, bringing intensity changes in their bodily resonance, attentional focus, and kinesthetic motivation. Finally, two experiential structures were found: one structure is self-centered empathic experience, characterized by bodily resonance, attentional focus centered on the participant’s own experience of seeing the sportsperson suffering, and self-protective kinesthetic motivation; the other structure is other-centered empathic experience, characterized by bodily resonance, attentional focus centered on the sportsperson, and prosocial kinesthetic motivation to help them. Discussion: We show how phenomenological data may contribute to comprehending empathy for pain in social neuroscience. In addition, we address the phenomenological aspect of the enactive approach to the three dimensions of embodiment of human consciousness, especially the intersubjective dimension. Also, based on our results, we suggest an extension of the enactive theory for non-interactive social experience. (shrink)

Legal theorists seek to persuade other jurists of certain theories: Textualism or purposivism; formalism or realism; natural law theory or positivism; prison reform or abolition; universal or particular human rights? Despite voluminous literature about these debates, tremendous uncertainty remains about which views experts endorse. This Article presents the first-ever empirical study of American law professors about legal theory questions. A novel dataset of over six hundred law professors reveals expert consensus and dissensus about dozens of longstanding legal theory debates. -/- (...) Law professors also debate questions about the nature of the legal academy. Descriptively, which subjects (e.g. constitutional law) and methods (e.g. law & economics) are most central within the legal academy today? And prescriptively, should today’s legal academy prioritize additional areas (e.g. legislation) or methods (e.g. critical race theory)? There is great interest in these questions but no empirical dataset of experts’ views; this results in uncertainty about which views experts endorse. This Article’s empirical study also clarifies these questions, documenting law professors’ evaluation of over one-hundred areas of law. -/- The legal theory and legal academy findings support implications for legal scholarship, education, and practice. Clearly, debates about law and the legal academy’s evolution should not be settled by a survey. Nevertheless, insofar as law professors are experts about these issues, it is instructive to discover and carefully examine what views those experts hold, so as to help determine which views are most likely to be true and how the legal academy ought to develop. Language is nothing but human subjects in as much as they speak, say and know. Language is something coming from the inside of the speaking subject manifest in the intentional meaningful purpose of the individual speaker. A language, on the contrary, is something coming from the outside, from the speech community, something offered to the speaking subject from the tradition in the technique of speaking. The speech act is the performance of an intuition by the subject, both individual and social.

Can an epistemic conception of truth and an endorsement of the excluded middle (together with other principles of classical logic abandoned by the intuitionists) cohabit in a plausible philosophical view? In PART I I describe the general problem concerning the relation between the epistemic conception of truth and the principle of excluded middle. In PART II I give a historical overview of different attitudes regarding the problem. In PART III I sketch a possible holistic solution.

In this thesis, I elaborate and defend Donald Davidson's account of knowing one's own mental states that exhibit first-person authority. To that end, I place Davidson's account among others in the philosophical landscape concerning self-knowledge. Next, I examine his response to philosophical challenges that arise from mental content externalism and self-deception. Finally, I draw some insights froms Davidson's account to the broader aims of epsitemology.

A widespread Western conception about the sanctity of the human body and its parts prevents from any morally acceptable disposition of these objects. However, this entails nothing but a dualistic conception of the human being as a composite of detachable parts — namely, body and mind. Understood as the antechamber of legal rights, moral rights perform an important — yet frequently overlooked — justifying function that permeates the political discourse. Although the connection among moral, political and legal discourses should be (...) properly acknowledged, certain boundaries are to mediate among each scope for the sake of certainty and accuracy. Intermediate realities, as the so-called human rights, serve to connect the moral and legal domains, still they also blur the lines along which the discourse is deployed. Moral entities are essentially inalienable, to the extent that they demarcate the moral status of the subject. By contrast, legal rights are essentially negotiable and, thus, alienable. The controversial instance of bodily rights will serve to test the assertions above. (shrink)

This study presents and develops in detail (a new version of) the argumental conception of meaning. The two basic principles of the argumental conception of meaning are: i) To know (implicitly) the sense of a word is to know (implicitly) all the argumentation rules concerning that word; ii) To know the sense of a sentence is to know the syntactic structure of that sentence and to know the senses of the words occurring in it. The sense of a sentence is (...) called immediate argumental role of that sentence. According to the argumental conception of meaning a theory of meaning for a particular language yields a systematic specification of the understanding of every sentence of the language which consists in a specification of the immediate argumental role of the sentence. The immediate argumental role is a particular aspect of the use of a sentence in arguments. But it is not the whole use in arguments, nor is the whole use in arguments reducible to the immediate argumental role. That is why, by accepting the argumental conception of meaning, we can have epistemological holism without linguistic holism. The argumental conception distinguishes between the understanding and the correctness of a language. Such a distinction makes it possible to account for our understanding of paradoxical languages. Redundancy theory of truth, realistic conceptions of truth or epistemic conceptions of truth are all compatible with an argumental conception of sense. But here it is argued that an epistemic conception of truth is preferrable. Acceptance of the argumental conception of meaning and of an epistemic conception of truth leads to a rejection of the idea of analytic truth. The argumental conception is pluralistic with respect to the understandability of different logics, and neutral with respect to their correctness. (shrink)

One of the many proposals put forth recently in the revival of bioethics concerns solidarity, which is part of the agenda for the discipline in the twenty-first century. In this article, solidarity is proposed as a bioethical value, inasmuch as it cannot be achieved without considering the person towards whom one shows solidarity and without taking into account his or her environment. It is not possible to make bioethical judgments or to accomplish in-depth biological thinking when forgetting the person who (...) is at the source or heart of the matter. Based on a study of the experience of a group of health volunteers in Medellin (Colombia), this research found evidence of the existence of three elements that, together, serve as a hinge between solidarity and bioethics. -/- Entre las muchas propuestas que se han hecho recientemente en ese resurgir de la bioética se encuentra la solidaridad, consti­tuyéndose parte de la agenda del siglo XXI sobre esta disciplina. Proponemos la solidaridad como un valor bioético puesto que así como no se puede ser solidario sin tener en cuenta a la persona con quien soy solidario y su entorno, no se pueden emitir juicios bioéticos o hacer una reflexión bioética de fondo olvidando a quien se tiene en frente. A partir de un estudio de la expe­riencia de una población de voluntarios del sector salud en Medellín, Colombia, se logró evidenciar que existen tres elementos que, en conjunto, sirven de bisagra entre la solidaridad y la bioética.
