Loneliness in medicine is a serious problem not just for patients, for whom illness is intrinsically isolating, but also for physicians in the contemporary condition of medicine. We explore this problem by investigating the ideal physician-patient relationship, whose analogy with friendship has held enduring normative appeal. Drawing from Talbot Brewer and Nir Ben-Moshe, we argue that this appeal lies in a dynamic form of companionship incompatible with static models of friendship-like physician-patient relationships: a mutual refinement of embodied virtue that draws (...) both persons together. The ideal physician-patient relationship has a dialectical character that fosters each member's improvement of phenomenologically recognizing and embodying moral virtues. A key component of this dynamic is a commitment to the common goal of the patient's health, realized through joint interactivities and conversations over time. The physician's presence to the patient's suffering—understood best as an alienating phenomenological condition for the patient—orients and discloses possibilities for virtuous caregiving by structuring the meanings of the goals, conversations, and joint narrative constitutive of their relationship. Presence to suffering, paradoxically, is perhaps an important prerequisite for this dynamic partnership. These activities dialectically build an interpretive horizon of understanding through which moral goods and character refinement—in and for the other—may become revealed for both persons in their shared being-in-the-world. This analysis of suffering, mood, and revealing of (possible) moral goods has implications for addressing the modern problem of loneliness for patients and physicians, who are increasingly inhibited from building flourishing relationships with each other. The hole argument purportedly shows that spacetime substantivalism implies a pernicious form of indeterminism. We show that the argument is seductive only because it mistakes a trivial claim (viz. there are isomorphic models) for a significant claim (viz. there are hole isomorphisms). We prove that the latter claim is false -- thereby closing the debate about whether substantivalism implies indeterminism.

John Abercrombie (1780–1844) was considered the most eminent Scottish physician of his time. In his Pathological and Practical Researches on the Diseases of the Brain and Spinal Cord (1836. Edinburgh: John Carfrae and Son, 3rd ed.) he described the cases of 140 patients with cerebral disorders, 48 of whom suffered from language disturbances. Despite the overwhelming clinical and neuropathological evidence of a close association between language disorder and right-sided hemiparesis or diseases of the left hemisphere, and in spite (...) of his great interest in language disorders, he made no attempt to localize the aphasic syndrome to a specific brain area. The edition was made by Michiel Streijger, Paul Bakker and Hans Thijssen. Although Henry Lee is often recognized to be an important early critic of Locke's 'way of ideas', his Anti-Scepticism (1702) has hardly received the scholarly attention it deserves. This paper seeks to fill that lacuna. It argues that Lee's criticism of Locke's alleged representationalism was original, and that it was quite different from the more familiar kind of criticism that was launched against Locke's theory of ideas by such thinkers as John Sergeant and Thomas Reid. In addition, the paper (...) offers an interpretation of Lee’s claim that, pace Locke, attempts to prove the veridicality of our cognitive apparatus are fundamentally misguided. (shrink)

This paper addresses what is arguably ?? one of the most fundamental questions in the debate on depiction, What is a Picture? It offers a critical discussion of traditional theories of pictorial representation, such as the Resemblance Theory, Conventionalism, and the Illusion Theory; it introduces and analyses the crucial notions of ‘seeing as’ and ‘seeing in’, and concludes by presenting some of the most recent accounts of depiction defended by Kendall Walton, Dominic Lopes, Robert Hopkins, and John Hyman.

This paper is concerned with the problem of speaking past one another due to an asymmetry of the interlocutors' backgrounds. When individuals with different levels of relative privilege interact, the party with relative privilege may fail to engage with what is being communicated. I take up critical Gadamerian hermeneutics to ask how we, as individuals with relative privilege, can 'unstop' our ears so that the burden of explanation does not (unfairly) remain on those we hurt by our mishearing/non-hearing. I offer (...) two methods to achieve this 'unstopping': 'critical self-knowledge' through Quassim Cassam's 'Vice Epistemology' framework and 'critical world-knowledge' through the Frankfurt School of Critical Theory (Max Horkheimer and Jürgen Habermas, specifically). I then take up contemporary critical hermeneutics (Lorenzo Simpson) to show how, through the application of the critical methods, one might be able to achieve a useful, cross-cultural dialogue. This is imperative given our inexorably multi-cultural world today. (shrink)

Stanislaw Lesniewski’s interests were, for the most part, more philosophical than mathematical. Prior to taking his doctorate at Jan Kazimierz University in Lvov, Lesniewski had spent time at several continental universities, apparently becoming relatively attached to the philosophy of one of his teachers, Hans Comelius, to the chapters of John Stuart Mill’s System of Logic that dealt specifically with semantics, and, in general, to studies of general grammar and philosophy of language. In these several early interests are already to (...) be found the roots of the work that was to occupy Lesniewski’s life: a search for a definitive doctrine of what sorts of things there are in the world, or better, of what language must be like if it is adequately and efficiently to represent the world. The issue of the relation of the sacred to the secular has become paramount in virtually every country in the world. From church-state relations in the US, with the debates around abortion and same-sex marriage, to the vitriolic discussions in France over the veil (hijab) sacred-secular, faith-reason, transcendence-imminence -- impacts every aspect of personal, social, and political life. Indeed, the questions often asked are whether Huntington s, Clash of Civilizations is today s reality? Is clash and conflict inevitable? This volume (...) collects papers from scholars from all around the globe and digs into that question. Do the sacred and the secular necessarily end in conflict? Building on scholars such as Charles Taylor, Hans-Georg Gadamer, Jurgen Habermaus, and John Rawls, as well as the world s great religious traditions, the authors assembled here respond with a nuanced, but resounding, NO. A deeper read demands the possibility, indeed, necessity, of complementarity. It has become ever more urgent to discover the proper and complementary relation between the two so that both can be promoted through mutual collaboration. The deeper implications of the discussion can be perceived in many current global problems: cultural identity, multiculturalism, pluralism, nationalism, economic inequality, race, terrorism, migration, public education, and climate change. The volume unfolds in seven sections: Foundations; Sacred and Secular; Complement or Conflict; Hermeneutics; African traditions; South Asian Traditions; Chinese Traditions; and Islamic Traditions. It is fascinating to observe how the various authors grapple with unfolding the relation of sacred/secular, faith/reason, church-mosque/state, transcendence/imminence. The section on Islam illustrates this. These chapters deal with the thorny, usually misunderstood debate between the scholars and those, westerners refer to as fundamentalists or radicals. In the latter, there is no space left to reason, interpretation, or historical criticism. This ugly divide usually emerges in the hot-button issues like the treatment of women and religion-related terrorism. However, these oversimplifications betray the intellectual roots of Islamic tradition. Here the argument is advanced that there are common and multiple meanings of rationality in the Islamic primary sources and that doctrine, the Qur an, and the Sunnah, open considerable space for the rational and the secular in Islamic teachings. Unknown to most in the West, the grappling within Islam goes on. Moreover, the grappling seems to be heating up in all traditions. We are all called to the discussion. Our globe needs it! (shrink)

Nuestro interés en el contenido mental no-conceptual es, principalmente, la articulación de una versión sustantiva (no-trivial) de esta clase de contenido en la experiencia perceptual. El debate acerca del contenido no-conceptual ha girado, en su mayor parte, alrededor de su existencia; y los argumentos que se han ofrecido en su favor abogan por una versión no sustantiva según la cual el contenido no-conceptual es aquel que no satisface ciertos requisitos conceptuales. Así, para desarrollar una versión sustantiva del contenido mental no-conceptual (...) hemos apelado a la versión de la experiencia perceptual de propiedades espaciales ofrecida por Evans (1982 cap. 6). A partir de esto desarrollamos un nuevo argumento a favor del contenido no-conceptual de la experiencia perceptual que lo vincula a la actividad característica de la experiencia perceptual. Por último, exponemos uno de los ataques de McDowell (1996) a la noción de contenido no-conceptual y presentamos nuestras réplicas a este ataque, mostrando su insuficiencia. The aim of the 17 original papers here is to summarize and analyze Wittgenstein's thought. At the time these were being written, the Oxford/Intelex CDROM ($2040 on Amazon but available thru interlibrary loan and steeply discounted on the net) with 20,000 some pages of W's nachlass was not yet available, and only those fluent in German and willing to find and slog thru the incomplete Cornell microfilm were able to examine it. To this day it much of it remains untranslated (...) from the German typescripts and handwritten manuscripts. I note this at the outset as W's untranslated or unpublished writings often shed crucial light on his thought and few to this day have made substantial use of them. In addition there are huge problems with translation of his early 20 th century Viennese German into modern English. One must be a master of English, German, and Wittgenstein in order to do this and very few are up to it. Several of the current authors note unfortunate translation errors in the only available English editions and I have seen similar comments countless times. As is well known, W's thought changed dramatically between the publication of the Tractatus (TLP) in 1922 and the Philosophical Investigations(1953). The continuity or lack thereof between his early and late work is the subject of a vast literature and is taken up here by several authors. Ishiguro on the picture theory and Mounce on the logical system in TLP are good, but for me the endless discussions of exactly how he was mistaken in his early work is of as little interest as the mistakes in most previous philosophy. Ammereller on Intentionality is a good, if prosaic, summary of (mostly) the early and middle W on belief and interpretation which, like virtually everyone, totally fails to give an adequate overview of W's pioneering work. In giving the general outline of our innate evolutionary psychology (ie, roughly our personality) and showing how this describes behavior, W represents a major milestone in human thought. There are unmistakeable indications of this even in his early writings (eg, see p 40, 49-58 here) and it has been documented by Hacker (eg, see his paper in The New Wittgenstein) and others but without any comprehensive account to date.Overall an exceptional book for introducing W to a general philosophical audience. -/- Those wishing a comprehensive up to date framework for human behavior from the modern two systems view may consult my book ‘The Logical Structure of Philosophy, Psychology, Mind and Language in Ludwig Wittgenstein and John Searle’ 2nd ed (2019). Antes de comentar sobre el libro, ofrezco comentarios sobre Wittgenstein y Searle y la estructura lógica de la racionalidad. Ernest Nagel played a key role in bridging the gap between American philosophy and logical empiricism. He introduced European philosophy of science to the American philosophical community but also remained faithful to the naturalism of his teachers. This paper aims to shed new light on Nagel’s intermediating endeavors by reconstructing his philosophical development in the late 1920s and 1930s. This is a decisive period in Nagel’s career because it is the phase in which he first formulated the principles of his (...) naturalism and spent a year in Europe to visit the key centers of logical empiricism. Building on a range of published and unpublished papers, notes, and correspondence—including hundreds of pages of letters to his close friend Sidney Hook—I reconstruct Nagel’s philosophical development, focusing especially on the philosophical influence of John Dewey, Morris R. Cohen, Rudolf Carnap, and Hans Reichenbach. (shrink)

The Paper then addresses the more difficult legal theories in this context: those of HLA Hart, Ronald Dworkin and Hans Kelsen. The clue to the latter as well as the earlier theorists is a (...) presupposed inaccessible author or ghost. The presupposed ghost of the law is crucial to the binding character of a law. (shrink)

During the second decade of the 20th century Hans Kleinpeter, an Austrian scholar devoted to the development of the modern science, published some brief papers on Nietzsche’s thought. Kleinpeter has been one of the main upholders of Mach’s epistemology and probably the first who connected his ideas with the philosophy of Nietzsche. In his book on Der Phänomenalismus (1913) he described a new world view that arose in the 19th century, a perspective that ‒ according to him ‒ completely contrasted (...) the mechanistic and metaphysical world view of the old school of scientific inquiry. The main outcome of the scientists whose name was related with this perspective (e.g. Clifford, Maxwell, Kirchoff and, obviously, Mach himself) has been the refusal of the absolute value of any “truth”. Kleinpeter’s statements on this topic are a good example of the rising of a Scientific Philosophy, whose development involved many scientists and thinkers that later set up the Verein Ernst Mach and the Wiener Kreis. On the other hand, his interest on Nietzsche is a relevant case of reception of the latter’s thought, that Kleinpeter puts into the context of the contemporary epistemology. In fact, he considers Nietzsche as one of the main upholders of the phenomenalistic world view, and states that he «took part at the same renewal of philosophical investigation that arose from the latest results of scientific inquiry» during the 19th century. A renewal whose main outcomes has been presented by John Stallo in his book on The Concepts and Theories of Modern Physics (1881), which Kleinpeter translated in German and published in 1901. According to Kleinpeter, in Nietzsche’s writings (mostly unpublished) one can find a theory of knowledge quite close to the one presented by both Mach and the new born Pragmatism, i.e. the complete refusal of an absolute truth and, therefore, the development of an antimetaphysical world view. In my paper I’ll discuss the main statements presented by Kleinpeter on this topic and show which of Nietzsche’s ideas has actually been in compliance with the main outcomes of late 19th century science. Thus, I’ll carry out a reconstruction of an unfamiliar side of the first period of reception of the philosophy of Nietzsche and its relevance to the development of a new (scientific) world view. Siihen nähden on yllättävän vaikeaa selvittää, mitä hän tästä kielellisestä perustasta tarkkaan ottaen ajattelee ja miten sosiaalisen maailman pitäisi sen päällä maata. Searlen perusajatus puheteoille rakentuvasta institutionaalisesta todellisuudesta tuntuu johtavan umpikujaan.

Remarkably, the theological discourse surrounding Hans Frei and postliberal theology has continued for nearly thirty years since Frei's death. This is due not only to the complex and provocative character of Frei's work, nor only to his influence upon an array of thinkers who went on to shape the theological field in their own right. It is just as indebted to the critical responses that his thinking continues to inspire. One recurrent point of criticism takes aim at Frei's use of (...) Ludwig Wittgenstein's later work for theological ends. In his recent book Liberalism versus Postliberalism: The Great Divide in Twentieth Century Theology, John Allan Knight challenges what he sees as Frei's dependence on problematic Wittgensteinian assumptions. This article raises a few concerns about Knight's charges against Frei. Specifically, I argue that Knight's account tends to conflate the work of Wittgenstein and Frei. It does this by undervaluing two determinative features of Frei's work: (1) its basic Christological orientation; and (2) its Christologically motivated use of ad hoc apologetics. I argue that the Wittgensteinian view that Knight attributes to Frei is not Frei's view at all, and is, moreover, a problematic account of Wittgenstein on its own terms. Finally, Knight's claim that Frei's work “depends upon” and “is suffused” with the understanding of Wittgenstein that Knight attributes to him is based upon an account of Frei's treatment of the sensus literalis that is not entirely accurate. Without question, Knight does remarkable service to Frei's legacy by keeping important debates over his work alive. In what follows, I propose several points where I think Knight's account might be further enriched. The result, I hope, will be a more nuanced understanding of the ways that Frei actually appropriated and deployed Wittgenstein's thought. I will contextualize my account of Frei with reference both to Wittgenstein's writings and the literature surrounding his writings. Setting forth these accounts in tandem should help make further available Wittgenstein's work for subsequent work by postliberal theologians. (shrink)

This study investigated the effects of internal and demographic variables on civic development in late adolescence using the construct civic purpose. We conducted surveys on civic engagement with 480 high school seniors, and surveyed them again two years later. Using multivariate regression and linear mixed models, we tested the main effects of civic purpose dimensions (beyond-the-self motivation, future civic intention), ethnicity, and education on civic development from Time 1 to Time 2. Results showed that while there is an overall decrease (...) in civic engagement in the transition out of high school, both internal and social factors protected participants from steep civic decline. Interaction effects varied. Ethnicity and education interacted in different ways with the dimensions of civic purpose to predict change in traditional and expressive political engagement, and community service engagement. Conciliationism faces a challenge that has not been satisfactorily addressed. There are clear cases of epistemically significant merely possible disagreement, but there are also clear cases where merely possible disagreement is epistemically irrelevant. Conciliationists have not yet accounted for this asymmetry. In this paper, we propose that the asymmetry can be explained by positing a selection constraint on all cases of peer disagreement—whether actual or merely possible. If a peer’s opinion was not selected in accordance with the proposed constraint, then (...) it lacks epistemic significance. This allows us to distinguish the epistemically significant cases of merely possible disagreement from the insignificant ones. (shrink)

Posthumous judgment about the value of these threads has varied wildly. Christian Wolff thought him a metaphysical rustic, as did Hans (...) Reichenbach some two centuries later ("Die Bewegungslehre bei Newton, Leibniz und Huygens," Kant-Studien 29 [1924]: 416–38). In the 1960s, the tide would turn, as Howard Stein and James Edward McGuire separately began to show that Newton's metaphysics was not just sophisticated, but often more compelling than its early modern alternatives (see respectively "Newtonian Spacetime," Texas Quarterly 10 [1967]: 174–200; and Tradition and Innovation: Newton's Metaphysics of Nature [Dordrecht: Kluwer Academic Publishers, 1995]). Eric Schliesser's book unfolds in that same register of appreciative, high scholarship, and it attests to the enduring attraction of its subject.The book grew out of previous discrete papers, to which he added a few more for this occasion. Accordingly, it does not come with a master argument. Rather, it is an in-depth exploration of some key metaphysical themes in Newton. As such, it befits its subject figure, who reflected on themes and concepts while stopping short of working out systems.The first major theme is Newton and Spinozism. The latter does not denote Spinoza's metaphysics. In fact, Schliesser explains, Newton shared with Spinoza some weighty commitments, for example, to space being actually infinite, and to substance monism: "for Newton, there is strictly speaking only one genuine substance," namely, God (33). Rather, "Spinozism" is an interpreter's category for a bundle of three theses: identifying God and nature; denying final causation in the physical world; and the assumption of "blind" metaphysical necessity. Some counted Hobbes and John Toland as Spinozist in this sense, and even Epicurus, avant la lettre. Newton and his followers argued vehemently against this package, as Schliesser shows in chapters 4, 5, and 8. Their chief complaint was that Spinozism is unable to account for the "origin of motion," for a certain type of order, and for the stability of cosmological structure—and to do so in a way that "meets the standards of Newtonian mechanics" (122). This interpretive lens allows Schliesser to draw Kant in, by reading his youthful Theory of Heaven as a possible Spinozist reply to their objections (chapter 3). [End Page 157]A second theme is the metaphysics of mechanics, where Schliesser weaves together several strands. One is the ontology of gravity, for which he offers a novel construal: for Newton, gravity counts as real, but in a qualified sense. Namely, it is not essential and not intrinsic: "even after creation, a lonely partless particle of matter in the universe would not be said to gravitate." And gravity is relational: a "shared quality" of two or more bits of matter, which obtains in virtue of their sharing a nature (19). Another strand is Newton's ontology of time—really, a subtle, difficult topic long neglected. Famously, Newton in Principia defends absolute, true, and mathematical time. The question is what these three qualifiers denote, and whether Newton thought they were synonymous. Schliesser in chapter 7 argues for the provocative view that "absolute" and "true" time are not identical concepts; rather, they pick out different entities. These entities share a common structure, namely, metric and topological. That makes them species of "mathematical" time (179). But, Schliesser contends, Newton has unequal warrant for his two concepts of time.Yet another theme is formal causation. It comes to the fore in chapter 5, which grapples with Newton's opaque idea that space is an "emanative effect." Schliesser explains that here, "emanation picks out a species of formal causation" (147), but in a novel, early modern sense that comes from Bacon, not Aristotle. If space has a formal cause, then so has its twin brother, time, the topic of chapter 7. God is their common formal cause. The received view has it that analytic philosophy emerged as a rebellion against the German Idealists (above all Hegel) and their British epigones (the British neo-Hegelians). This at least was Russell’s story: the German Idealism failed to achieve solid results in philosophy. Of course, Frege too sought after solid results. He, however, had a different story to tell. Frege never spoke against Hegel, or Fichte. Similarly to the German Idealists, his sworn enemy was the empiricism (in his case, John (...) Stuart Mill). Genealogically, this stance is not difficult to explain. Frege grew up as a philosopher in the context of the German Idealists. He was a member of Karl Snell’s “Sunday Circle” of university teachers in Jena. The group was influenced with Schelling and the German romanticists. The first Anglophone scholar to point out what Frege's thought owes to nineteenth-century Germany philosophy, Hans Sluga, argued that Frege followed the philosophical-logical tradition originating with Leibniz and Kant which Trendelenburg and Lotze developed significantly. About the same time, a philosophical historian writing in German, Gottfried Gabriel, did much to bring this tradition to light, casting Frege as neo-Kantian. Advancing beyond Sluga and Gabriel, the present paper reveals that through the mediation of Trendelenburg and especially of Lotze many elements of German idealism found their way into Frege's logic and philosophy. In this study, we want to analyze the relation between two Romanian internationally-renowned men of culture: Mircea Eliade (often considered one of the greatest historians of religion of all times) and Nicolae Steinhardt (whose name and memory have been mentioned by Pope John the Second in his visit in Romania). Though they had about the same age (a difference of 5 years), they had little connections in the interwar period (a few meetings and, later, Steinhardt’s volume The Way of… (...) the Young [În genul… tinerilor] from 1934, where he parodies Eliade, among others). A strong influence (which changed destinies) occurred during 1958-1960, when Steinhardt was imprisoned for having read and spread writings of Romanians found in exile, including the novel Midsummer Night (The Forbidden Forest) [Noaptea de Sânziene (Pădurea interzisă)] by Eliade. After the release in 1964, Steinhardt was continuously watched by the communist Securitate and reports have been written about him, where his main guilt was his friendship with Mircea Eliade, Emil Cioran, Eugen Ionescu, Virgil Ierunca, Monica Lovinescu, et al. Beyond these biographical intersections between Eliade and Steinhardt, there are also connections with regard to the Romanian culture, literary ideas, and visions on religious life. Steinhardt brings appreciations to the scholar in Chicago for the fact that he presents the beauty of the Romanian culture in the Western desecrated world and considers Eliade – and he’s one of the few who does this – influenced in his thinking by Christian ideals (in this direction, memorable are Steinhardt’s appreciations of the role played by Eliade in the Western culture, especially with his volume From Zamolxis to Genghis-Kahn [De la Zalmoxis la Genghis-Han], but also with his fiction, marking a direct reference to the novella A Fourteen Year Old Photograph [O fotografie veche de 14 ani]). Although the Chunqiu fanlu traditionally ascribed to Han dynasty scholar Dong Zhongshu (c. 195 − 115 BCE) is considered to be an extremely important book for the development of Chinese ethical and philosophical thought, it has been long neglected and has lacked proper non-Chinese scholarly attention. Up to the 2016 translation by Sarah A. Queen and John S. Major, only partial translations of the Chunqiu fanlu had been published in English. Part of the reason for the neglect of the (...) study of the Chunqiu fanlu and consequently its late translation lies in the complexity of the text, connected to a number of obscurities about its origin, authorship and nature. Sarah Queen and John Major have made an important step forward in redressing this neglect. They produced a complete English translation and study of the Chunqiu fanlu. Besides focusing on the first complete English translation of the Chunqiu fanlu, this article reviews central questions and problems regarding that text and attempts to summarize the current state of research on it. Nearly thirty years ago, Robert Alexy in his book The Concept and Validity of Law as well as in other early articles raised non-positivistic arguments in the Continental European tradition against legal positivism in general, which was assumed to be held by, among others, John Austin, Hans Kelsen and H.L.A. Hart. The core thesis of legal positivism that was being discussed among contemporary German jurists, just as with their Anglo- American counterparts, is the claim that there is no necessary (...) connection between law and morality. Robert Alexy has argued, however, that the law, besides consisting conceptually of elements of authoritative issuance and social efficacy, necessarily lays a claim to substantial correctness, which is derived from analytical arguments. Furthermore, if this claim to substantial correctness necessarily requires the incorporation of moral elements into law, then the ‘necessary connection thesis’, as defended by non-positivism, can be justified. Some of the most significant objections to this sort of claim, stemming from the Anglo-American world, are those introduced by Joseph Raz. In his ‘Reply’ to Robert Alexy, Raz raises at least three interesting criticisms, including, first, the ambiguity of ‘legal theory in the positivistic tradition’, second, the indeterminate formulations of the ‘separation thesis’, and, third, the necessary claim of law to legitimate authority as a moral claim. As a point of departure, I will argue that Raz’s three criticisms are misleading. For they do not enhance our understanding of the genuine compatibility or incompatibility between legal positivism and non-positivism. Despite the frequently reformulated theses of legal positivism and the various kinds of opponents responding thereto, the essential divergence between legal positivism and non-positivism was and remains the answer to the question of the relation between law and morality. Furthermore, I will clarify that in the strictest sense there can be three and only three logically possible positions concerning the relation between law and morality: the connection between them is either necessary, or impossible (i. e. they are necessarily separate), or contingent (i. e. they are neither necessarily connected nor necessarily separate). The first position is non-positivistic, while the latter two positions are, indeed, both positivistic, but in different forms: one may be called ‘exclusive’ legal positivism, the other ‘inclusive’ legal positivism. I will continue by showing that these three positions stand to one another in the relation of contraries, not contradictories, and that, taken together, they exhaust the logically possible positions concerning the relation between law and morality, never mind the tradition or authority from which these positions are derived. Raz mentions, however, many changeable formulations of the separation thesis, which even leads him to acknowledge ‘necessary connections between law and morality’. One who is trying to understand legal positivism would no doubt be puzzled by this claim. Nevertheless, I will argue that this is an alternative strategy of legal positivism, and it points to naturalistically oriented view. Although this necessary separation between law and morality, understood naturalistically, strikes one as strengthening the separation, in the end it leads to a weakened notion of necessity. This weakened necessary separation thesis, however, cannot be justified through the so-called claim of the law to legitimate authority, defended by Raz, for it is difficult to answer the question of whether a normally justified but factual authority can gain legitimate authority. Finally, the necessary connection between law and morality in a strong sense can still be justified by the claim of law to correctness, as per Alexy’s argument. (shrink)

The paper begins by reviewing two problems for fallibilism: the lottery problem, or the problem of explaining why fallible evidence, though otherwise excellent, is not enough to know that one will lose the lottery, and Gettier problems. It is then argued that both problems can be resolved if we note an important illocutionary force of knowledge attributions: namely, that when we attribute knowledge to someone we mean to give the person credit for getting things right. Alternatively, to say that a (...) person knows is to say that she got things right due to her own abilities, efforts and actions, rather than due to dumb luck, or blind chance, or something else. Phenomenological reflection on the essence of art goes towards the revelation of its ultimate Source, which is also the Source of spirituality of a man and, finally, of artistic works. Art occupies a prominent place in the works of Martin Heidegger, Hans Urs von Balthasar and Michel Henry, and what they have in common is pointing out the ability of transcending artistic work towards beyond-aesthetic and over-aesthetic dimensions. For those philosophers the work of art is a ‘way’ which may lead (...) human spirit towards Transcendence (the Absolute, God), but also towards the inner self. In this article the reflection over a religious dimension of the essence of art is extended by the analysis of St John Passion, BWV 245 by Johann Sebastian Bach, as a particular example of an artistic realization of phenomenologically rooted philosophical and theological reflection. This Handbook contains forty essays by an international team of experts on the antecedents, the content, and the reception of the Dionysian corpus, a body of writings falsely ascribed to Dionysius the Areopagite, a convert of St Paul, but actually written about 500 AD. The first section contains discussions of the genesis of the corpus, its Christian antecedents, and its Neoplatonic influences. In the second section, studies on the Syriac reception, the relation of the Syriac to the original Greek, and (...) the editing of the Greek by John of Scythopolis are followed by contributions on the use of the corpus in such Byzantine authors as Maximus the Confessor, John of Damascus, Theodore the Studite, Niketas Stethatos, Gregory Palamas, and Gemistus Pletho. In the third section attention turns to the Western tradition, represented first by the translators John Scotus Eriugena, John Sarracenus, and Robert Grosseteste and then by such readers as the Victorines, the early Franciscans, Albert the Great, Aquinas, Bonaventure, Dante, the English mystics, Nicholas of Cusa, and Marsilio Ficino. The contributors to the final section survey the effect on Western readers of Lorenzo Valla's proof of the inauthenticity of the corpus and the subsequent exposure of its dependence on Proclus by Koch and Stiglmayr. The authors studied in this section include Erasmus, Luther and his followers, Vladimir Lossky, Hans Urs von Balthasar, and Jacques Derrida, as well as modern thinkers of the Greek Church. Lying is one of the characteristic features of psychopathy, and has been recognized in clinical and diagnostic descriptions of the disorder, yet individuals with psychopathic traits have been found to have reduced neural activity in many of the brain regions that are important for lying. In this study, we examine brain activity in sixteen individuals with varying degrees of psychopathic traits during a task in which they are instructed to falsify information or tell the truth about autobiographical and non-autobiographical facts, (...) some of which was related to criminal behavior. We found that psychopathic traits were primarily associated with increased activity in the anterior cingulate, various regions of the prefrontal cortex, insula, angular gyrus, and the inferior parietal lobe when participants falsified information of any type. Associations tended to be stronger when participants falsified information about criminal behaviors. Although this study was conducted in a small sample of individuals and the task used has limited ecological validity, these findings support a growing body of literature suggesting that in some contexts, individuals with higher levels of psychopathic traits may demonstrate heightened levels of brain activity. I argue against the orthodox view of the relationship between propositional and doxastic justification. The view under criticism is: if p is propositionally justified for S in virtue of S's having reason R, and S believes p on the basis of R, then S's belief that p is doxastically justified. I then propose and evaluate alternative accounts of the relationship between propositional and doxastic justification, and conclude that we should explain propositional justification in terms of doxastic justification. If correct, this (...) proposal would constitute a significant advance in our understanding of the sources of epistemic justification. (shrink)

Nearly all success is due to some mix of ability and luck. But some successes we attribute to the agent’s ability, whereas others we attribute to luck. To better understand the criteria distinguishing credit from luck, we conducted a series of four studies on knowledge attributions. Knowledge is an achievement that involves reaching the truth. But many factors affecting the truth are beyond our control and reaching the truth is often partly due to luck. Which sorts of luck are compatible (...) with knowledge? We find that knowledge attributions are highly sensitive to lucky events that change the explanation for why a belief is true. By contrast, knowledge attributions are surprisingly insensitive to lucky events that threaten but ultimately fail to change the explanation for why a belief is true. These results shed light on our concept of knowledge, help explain apparent inconsistencies in prior work on knowledge attributions, and constitute progress toward a general understanding of the relation between success and luck. This paper provides a principled and elegant solution to the Gettier problem. The key move is to draw a general metaphysical distinction and conscript it for epistemological purposes. Section 1 introduces the Gettier problem. Sections 2–5 discuss instructively wrong or incomplete previous proposals. Section 6 presents my solution and explains its virtues. Section 7 answers the most common objection.

Can judging that an agent blamelessly broke a rule lead us to claim, paradoxically, that no rule was broken at all? Surprisingly, it can. Across seven experiments, we document and explain the phenomenon of excuse validation. We found when an agent blamelessly breaks a rule, it significantly distorts people’s description of the agent’s conduct. Roughly half of people deny that a rule was broken. The results suggest that people engage in excuse validation in order to avoid indirectly blaming others for (...) blameless transgressions. Excuse validation has implications for recent debates in normative ethics, epistemology and the philosophy of language. These debates have featured thought experiments perfectly designed to trigger excuse validation, inhibiting progress in these areas. (shrink)

A standard view in contemporary philosophy is that belief is involuntary, either as a matter of conceptual necessity or as a contingent fact of human psychology. We present seven experiments on patterns in ordinary folk-psychological judgments about belief. The results provide strong evidence that voluntary belief is conceptually possible and, granted minimal charitable assumptions about folk-psychological competence, provide some evidence that voluntary belief is psychologically possible. We also consider two hypotheses in an attempt to understand why many philosophers have been (...) tempted to view belief as involuntary: that belief is a prototype concept and that belief is a dual character concept. Altogether, our findings contribute to longstanding philosophical debates about the relationship between the will and the intellect, while also advancing scientific understanding of important social judgments. In this paper Sullins argues that in certain circumstances robots can be seen as real moral agents. A distinction is made between persons and moral agents such that, it is not necessary for a robot to have personhood in order to be a moral agent. I detail three requirements for a robot to be seen as a moral agent. The first is achieved when the robot is significantly autonomous from any programmers or operators of the machine. The second is when (...) one can analyze or explain the robot's behavior only by ascribing to it some predisposition or 'intention' to do good or harm. And finally, robot moral agency requires the robot to behave in a way that shows and understanding of responsibility to some other moral agent. Robots with all of these criteria will have moral rights as well as responsibilities regardless of their status as persons. (shrink)

Many philosophers favour the simple knowledge account of assertion, which says you may assert something only if you know it. The simple account is true but importantly incomplete. I defend a more informative thesis, namely, that you may assert something only if your assertion expresses knowledge. I call this 'the express knowledge account of assertion', which I argue better handles a wider range of cases while at the same time explaining the simple knowledge account's appeal. §1 introduces some new data (...) that a knowledge account of assertion well explains. §2 explains the simple knowledge account's advantage over two of its main competitors. §3 presents a problem for the simple account and offers a solution, which is to adopt the express knowledge account. §4 encapsulates the case for the express knowledge account, and offers a unifying vision for the epistemology of belief and assertion. §5 answers an objection. §6 briefly sums up. Even those who ultimately reject my conclusion can still benefit from the new data presented in §1, and learn an important lesson from the problem discussed in §3, which demonstrates a general constraint on an acceptable account of the norm of assertion. ‘There is no place in the phenomenology of fully absorbed coping’, writes Hubert Dreyfus, ‘for mindfulness. In flow, as Sartre sees, there are only attractive and repulsive forces drawing appropriate activity out of an active body’1. Among the many ways in which history animates dynamical systems at a range of distinctive timescales, the phenomena of embodied human habit, skilful movement, and absorbed coping are among the most pervasive and mundane, and the most philosophically puzzling. In this essay we examine both (...) habitual and skilled movement, sketching the outlines of a multidimensional framework within which the many differences across distinctive cases and domains might be fruitfully understood. Both the range of movement phenomena which can plausibly be seen as instances of habit or skill, and the space of possible theories of such phenomena are richer and more disparate than philosophy easily encompasses. We seek to bring phenomenology into contact with relevant movements in psychological theories of skilful action, in the belief that phenomenological philosophy and cognitive science can be allies rather than antagonists. De acordo com eles, a ideia de que a deliberação democrática possa funcionar como uma troca de argumentos racionais que visa à verdade é incompatível com o reconhecimento do conflito como um componente basilar da política. Tudo se passa, pois, como se a abordagem epistêmica estivesse fadada a obliterar a dimensão agonística da política. (...) A fim de problematizar semelhante entendimento, este artigo reconstrói a associação entre democracia e compromisso feita por John Stuart Mill, John Morley e Hans Kelsen e conclui que a conceitualização da democracia como compromisso oferece uma alternativa à dicotomia democracia epistêmica vs. democracia agonística. The growth of self-tracking and personal surveillance has given rise to the Quantified Self movement. Members of this movement seek to enhance their personal well-being, productivity, and self-actualization through the tracking and gamification of personal data. The technologies that make this possible can also track and gamify aspects of our interpersonal, romantic relationships. Several authors have begun to challenge the ethical and normative implications of this development. In this article, we build upon this work to provide a detailed ethical analysis (...) of the Quantified Relationship. We identify eight core objections to the QR and subject them to critical scrutiny. We argue that although critics raise legitimate concerns, there are ways in which tracking technologies can be used to support and facilitate good relationships. We thus adopt a stance of cautious openness toward this technology and advocate the development of a research agenda for the positive use of QR technologies. (shrink)

Political liberals ask citizens not to appeal to certain considerations, including religious and philosophical convictions, in political deliberation. We argue that political liberals must include a demanding requirement of intellectual modesty in their ideal of citizenship in order to motivate this deliberative restraint. The requirement calls on each citizen to believe that the best reasoners disagree about the considerations that she is barred from appealing to. Along the way, we clarify how requirements of intellectual modesty relate to moral reasons for (...) deliberative restraint. And we argue against attempts to weaken our requirement of intellectual modesty by emphasizing those moral reasons. (shrink)

Ich fürchte, sie ist nicht eitel genug, um sich an den Menschen als einen Spiegel zu klammern, in dem allein sie ihre eigene Schönheit sehen kann", schreibt der (...) Physiker Hans-Peter Dürr heute. Diesen beiden Stellungnahmen liegen sehr unterschiedliche Vorstellungen vom Verhältnis Mensch - Natur zugrunde. Wie überhaupt die Naturphilosophie von den Vorsokratikern bis in die Gegenwart die unterschiedlichsten Varianten dieser Beziehung durchgespielt hat. Dass der Mensch sich jedoch in einem weit über die alttestamentarische Vorstellungskraft hinausgehenden Maße die Natur "untertan" gemacht und dabei großräumig zerstört hat, steht außer Zweifel. Im Rahmen der ökologischen Krise muss das Verhältnis zur Natur neu überdacht werden. Das vorliegende Lesebuch, das sich auch als Studientext und Diskussionsgrundlage für Schulen und Hochschulen bestens eignet, bietet den Blick in die Geschichte der Naturphilosophie, der dafür unerlässlich ist: Die Schwierigkeiten, die heute im Umgang mit der Natur auftreten, sind vielfach auf immer noch wirksame traditionelle Naturvorstellungen zurückzuführen.
