In this short article, my aim is to introduce readers to some debates about religious freedom and constitutional law in the United States. I highlight a few of the enduring questions debated by political philosophers and legal scholars. For example, does the Constitution require special religious exemptions for citizens whose religious convictions put them at odds with otherwise neutral and legitimate state pol- icy? Should the Constitution be interpreted as supporting a strict secularism or a multicultural egalitarian liberal position? What (...) are the limits to religious freedom? To illustrate how these and related questions are debated I consider some recent work on religious freedom jurisprudence in the United States. (shrink)

Scientists often adjust their significance threshold during null hypothesis significance testing in order to take into account multiple testing and multiple comparisons. This alpha adjustment has become particularly relevant in the context of the replication crisis in science. The present article considers the conditions in which this alpha adjustment is appropriate and the conditions in which it is inappropriate. A distinction is drawn between three types of multiple testing: disjunction testing, conjunction testing, and individual testing. It is argued that alpha (...) adjustment is only appropriate in the case of disjunction testing, in which at least one test result must be significant in order to reject the associated joint null hypothesis. Alpha adjustment is inappropriate in the case of conjunction testing, in which all relevant results must be significant in order to reject the joint null hypothesis. Alpha adjustment is also inappropriate in the case of individual testing, in which each individual result must be significant in order to reject each associated individual null hypothesis. The conditions under which each of these three types of multiple testing is warranted are examined. It is concluded that researchers should not automatically assume that alpha adjustment is necessary during multiple testing. Illustrations are provided in relation to joint studywise hypotheses and joint multiway ANOVAwise hypotheses. (shrink)

Fisher criticised the Neyman-Pearson approach to hypothesis testing by arguing that it relies on the assumption of “repeated sampling from the same population.” The present article considers the responses to this criticism provided by Pearson and Neyman. Pearson interpreted alpha levels in relation to imaginary replications of the original test. This interpretation is appropriate when test users are sure that their replications will be equivalent to one another. However, by definition, scientific researchers do not possess sufficient knowledge about the relevant (...) and irrelevant aspects of their tests and populations to be sure that their replications will be equivalent to one another. Pearson also interpreted the alpha level as a personal rule that guides researchers’ behavior during hypothesis testing. However, this interpretation fails to acknowledge that the same researcher may use different alpha levels in different testing situations. Addressing this problem, Neyman proposed that the average alpha level adopted by a particular researcher can be viewed as an indicator of that researcher’s typical Type I error rate. Researchers’ average alpha levels may be informative from a metascientific perspective. However, they are not useful from a scientific perspective. Scientists are more concerned with the error rates of specific tests of specific hypotheses, rather than the error rates of their colleagues. It is concluded that neither Neyman nor Pearson adequately rebutted Fisher’s “repeated sampling” criticism. Fisher’s significance testing approach is briefly considered as an alternative to the Neyman-Pearson approach. (shrink)

The inflation of Type I error rates is thought to be one of the causes of the replication crisis. Questionable research practices such as p-hacking are thought to inflate Type I error rates above their nominal level, leading to unexpectedly high levels of false positives in the literature and, consequently, unexpectedly low replication rates. In this article, I offer an alternative view. I argue that questionable and other research practices do not usually inflate relevant Type I error rates. I begin (...) with an introduction to Type I error rates that distinguishes them from theoretical errors. I then illustrate my argument with respect to model misspecification, multiple testing, selective inference, forking paths, exploratory analyses, p-hacking, optional stopping, double dipping, and HARKing. In each case, I demonstrate that relevant Type I error rates are not usually inflated above their nominal level, and in the rare cases that they are, the inflation is easily identified and resolved. I conclude that the replication crisis may be explained, at least in part, by researchers’ misinterpretation of statistical errors and their underestimation of theoretical errors. (shrink)

The replication crisis has caused researchers to distinguish between exact replications, which duplicate all aspects of a study that could potentially affect the results, and direct replications, which duplicate only those aspects of the study that are thought to be theoretically essential to reproduce the original effect. The replication crisis has also prompted researchers to think more carefully about the possibility of making Type I errors when rejecting null hypotheses. In this context, the present article considers the utility of two (...) types of Type I error probability: the Neyman–Pearson long run Type I error rate and the Fisherian sample-specific Type I error probability. It is argued that the Neyman–Pearson Type I error rate is inapplicable in social science because it refers to a long run of exact replications, and social science deals with irreversible units that make exact replications impossible. Instead, the Fisherian sample-specific Type I error probability is recommended as a more meaningful way to conceptualize false positive results in social science because it can be applied to each sample-specific decision about rejecting the same substantive null hypothesis in a series of direct replications. It is concluded that the replication crisis may be partly due to researchers’ unrealistic expectations about replicability based on their consideration of the Neyman–Pearson Type I error rate across a long run of exact replications. Kerr coined the term ‘HARKing’ to refer to the practice of ‘hypothesizing after the results are known’. This questionable research practice has received increased attention in recent years because it is thought to have contributed to low replication rates in science. The present article discusses the concept of HARKing from a philosophical standpoint and then undertakes a critical review of Kerr’s twelve potential costs of HARKing. It is argued that these potential costs are either misconceived, misattributed to HARKing, lacking evidence, (...) or that they do not take into account pre- and post-publication peer review and public availability to research materials and data. It is concluded that it is premature to conclude that HARKing has led to low replication rates. (shrink)

Several researchers have recently argued that p values lose their meaning in exploratory analyses due to an unknown inflation of the alpha level (e.g., Nosek & Lakens, 2014; Wagenmakers, 2016). For this argument to be tenable, the familywise error rate must be defined in relation to the number of hypotheses that are tested in the same study or article. Under this conceptualization, the familywise error rate is usually unknowable in exploratory analyses because it is usually unclear how many hypotheses have (...) been tested on a spontaneous basis and then omitted from the final research report. In the present article, I argue that it is inappropriate to conceptualize the familywise error rate in relation to the number of hypotheses that are tested. Instead, it is more appropriate to conceptualize familywise error in relation to the number of different tests that are conducted on the same null hypothesis in the same study. Under this conceptualization, alpha level adjustments in exploratory analyses are (a) less necessary and (b) objectively verifiable. As a result, p values do not lose their meaning in exploratory analyses. (shrink)

The Problem of Iterated Ground is to explain what grounds truths about ground: if Γ grounds φ, what grounds that Γ grounds φ? This paper develops a novel solution to this problem. The basic idea is to connect ground to explanatory arguments. By developing a rigorous account of explanatory arguments we can equip operators for factive and non-factive ground with natural introduction and elimination rules. A satisfactory account of iterated ground falls directly out of the resulting logic: non- factive grounding (...) claims, if true, are zero-grounded in the sense of Fine. (shrink)

Hypothesizing after the results are known, or HARKing, occurs when researchers check their research results and then add or remove hypotheses on the basis of those results without acknowledging this process in their research report (Kerr, 1998). In the present article, I discuss three forms of HARKing: (1) using current results to construct post hoc hypotheses that are then reported as if they were a priori hypotheses; (2) retrieving hypotheses from a post hoc literature search and reporting them as a (...) priori hypotheses; and (3) failing to report a priori hypotheses that are unsupported by the current results. These three types of HARKing are often characterized as being bad for science and a potential cause of the current replication crisis. In the present article, I use insights from the philosophy of science to present a more nuanced view. Specifically, I identify the conditions under which each of these three types of HARKing is most and least likely to be bad for science. I conclude with a brief discussion about the ethics of each type of HARKing. (shrink)

During multiple testing, researchers often adjust their alpha level to control the familywise error rate for a statistical inference about a joint union alternative hypothesis (e.g., “H1,1 or H1,2”). However, in some cases, they do not make this inference. Instead, they make separate inferences about each of the individual hypotheses that comprise the joint hypothesis (e.g., H1,1 and H1,2). For example, a researcher might use a Bonferroni correction to adjust their alpha level from the conventional level of 0.050 to 0.025 (...) when testing H1,1 and H1,2, find a significant result for H1,1 (p < 0.025) and not for H1,2 (p > .0.025), and so claim support for H1,1 and not for H1,2. However, these separate individual inferences do not require an alpha adjustment. Only a statistical inference about the union alternative hypothesis “H1,1 or H1,2” requires an alpha adjustment because it is based on “at least one” significant result among the two tests, and so it refers to the familywise error rate. Hence, an inconsistent correction occurs when a researcher corrects their alpha level during multiple testing but does not make an inference about a union alternative hypothesis. In the present article, I discuss this inconsistent correction problem, including its reduction in statistical power for tests of individual hypotheses and its potential causes vis-à-vis error rate confusions and the alpha adjustment ritual. I also provide three illustrations of inconsistent corrections from recent psychology studies. I conclude that inconsistent corrections represent a symptom of statisticism, and I call for a more nuanced inference-based approach to multiple testing corrections. (shrink)

Gelman and Loken (2013, 2014) proposed that when researchers base their statistical analyses on the idiosyncratic characteristics of a specific sample (e.g., a nonlinear transformation of a variable because it is skewed), they open up alternative analysis paths in potential replications of their study that are based on different samples (i.e., no transformation of the variable because it is not skewed). These alternative analysis paths count as additional (multiple) tests and, consequently, they increase the probability of making a Type I (...) error during hypothesis testing. The present article considers this forking paths problem and evaluates four potential solutions that might be used in psychology and other fields: (a) adjusting the prespecified alpha level, (b) preregistration, (c) sensitivity analyses, and (d) abandoning the Neyman-Pearson approach. It is concluded that although preregistration and sensitivity analyses are effective solutions to p-hacking, they are ineffective against result-neutral forking paths, such as those caused by transforming data. Conversely, although adjusting the alpha level cannot address p-hacking, it can be effective for result-neutral forking paths. Finally, abandoning the Neyman-Pearson approach represents a further solution to the forking paths problem. (shrink)

The history of humankind is full of examples that indicate a constant desire to make human beings more moral. Nowadays, technological breakthroughs might have a significant impact on our moral character and abilities. This is the case of Virtual Reality (VR) technologies. The aim of this paper is to consider the ethical aspects of the use of VR in enhancing empathy. First, we will offer an introduction to VR, explaining its fundamental features, devices and concepts. Then, we will approach the (...) characterization of VR as an “empathy machine,” showing why this medium has aroused so much interest and why, nevertheless, we do not believe it is the ideal way to enhance empathy. As an alternative, we will consider fostering empathy-related abilities through virtual embodiment in avatars. In the conclusion, however, we will, we will examine some of the serious concerns related to the ethical relevance of empathy and will defend the philosophical case for a reason-guided empathy, also suggesting specific guidelines for possible future developments of empathy enhancement projects through VR embodied experiences. The chapter explores whether, or to what extent, recent work in experimental philosophy puts pressure on the idea that the concept of causation is ‘egalitarian’. Causal selection – where experimental subjects tend to rate the causal strength of (for example) a norm-violator more strongly than a non-norm-violator – is a well established phenomenon, and is in prima facie tension with an egalitarian conception of causation; it also, indirectly, puts prima facie pressure on the idea that causation is a worldly phenomenon (...) whose obtaining is independent of facts about norms. The chapter explores both the various psychological mechanisms and the broadly pragmatic approaches to explaining causal selection. It argues that the answer to the question whether or not the concept of causation is egalitarian is currently significantly empirically underdetermined, and suggests some avenues for further investigation. Wilhelm has recently shown that widely accepted principles about immediate ground are inconsistent with some principles of propositional identity. This note responds to this inconsistency by developing two ground-theoretic accounts of propositional individuation. On one account some of the grounding principles are incorrect; on the other account, the principles of propositional individuation are incorrect.

The National Center for Biomedical Ontology is a consortium that comprises leading informaticians, biologists, clinicians, and ontologists, funded by the National Institutes of Health (NIH) Roadmap, to develop innovative technology and methods that allow scientists to record, manage, and disseminate biomedical information and knowledge in machine-processable form. The goals of the Center are (1) to help unify the divergent and isolated efforts in ontology development by promoting high quality open-source, standards-based tools to create, manage, and use ontologies, (2) to create (...) new software tools so that scientists can use ontologies to annotate and analyze biomedical data, (3) to provide a national resource for the ongoing evaluation, integration, and evolution of biomedical ontologies and associated tools and theories in the context of driving biomedical projects (DBPs), and (4) to disseminate the tools and resources of the Center and to identify, evaluate, and communicate best practices of ontology development to the biomedical community. Through the research activities within the Center, collaborations with the DBPs, and interactions with the biomedical community, our goal is to help scientists to work more effectively in the e-science paradigm, enhancing experiment design, experiment execution, data analysis, information synthesis, hypothesis generation and testing, and understand human disease. William Alston’s argument against epistemological deontologism rests upon two key premises: first, that we lack a suitable amount of voluntary control with respect to our beliefs, and, second, the principle that “ought” implies “can.” While several responses to Alston have concerned rejecting either of these two premises, I argue that even on the assumption that both premises are true, there is room to be made for deontologism in epistemology. I begin by offering a criticism of Richard Feldman’s invaluable work on (...) ‘role-oughts’, whereupon I development my own positive view in light of Feldman’s shortcomings. The upshot is that while we as epistemic agents are not responsible for the beliefs we form, we are nonetheless responsible for the various bodily or mental activities that typically bear a causal influence on belief formation. Tackling climate change is one of the most demanding challenges of humanity in the 21st century. Still, the efforts to mitigate the current environmental crisis do not seem enough to deal with the increased existential risks for the human and other species. Persson and Savulescu have proposed that our evolutionarily forged moral psychology is one of the impediments to facing as enormous a problem as global warming. They suggested that if we want to address properly some of the most pressing (...) problems that cause catastrophic harm to our existence, we should enhance our moral behavior by biomedical means. The objective of this paper is, precisely, to reflect on whether a Moral Bio-Enhancement (henceforth MBE) program would be a viable option to confront the climate emergency. To meet this goal, I will propose the Ultimate Mostropic (hereafter UM) thought experiment, a hypothetical situation where we have already discovered the UM, an available, safe (without any deleterious secondary effects), extremely cheap and effective pill to enhance our cognitive, affective and motivational abilities related to morality. After briefly presenting the main argument of Persson and Savulescu regarding MBE and climate change, I will point out some of the difficulties that make MBE a daunting but exciting philosophical and scientific debate. In order to overcome these complications, I will describe the UM thought experiment, which involves two scenarios of the MBE program: (a) the state-driven, compulsory and universal enterprise, and (b) the initiative of voluntary individuals. I will show that the shortcomings of MBE programs through the UM in both scenarios make Persson and Savulescu’s proposal a not appealing pathway to mitigate climate change. In the final section, I will suggest that an inaccurate attribution of responsibilities underlies their proposal and that the collective inaction problem should be redirected primarily through a reinforcement of the political nature of the solutions. The neuroscience of ethics is allegedly having a double impact. First, it is transforming the view of human morality through the discovery of the neurobiological underpinnings that influence moral behavior. Secondly, some neuroscientific findings are radically challenging traditional views on normative ethics. Both claims have some truth but are also overstated. In this article, the author shows that they can be understood together, although with different caveats, under the label of ‘neurofoundationalism’. Whereas the neuroscientific picture of human morality is undoubtedly (...) valuable if we avoid neuroessentialistic portraits, the empirical disruption of normative ethics seems less plausible. The neuroscience of morality, however, is providing relevant evidence that any empirically-informed ethical theory needs to critically consider. Although neuroethics is not going to bridge the is-ought divide, it may establish certain facts that require us to rethink the way we achieve our ethical aspirations. (shrink)

Peirce is best known as the founder of pragmatism, but his dissatisfaction with how others understood and appropriated it prompted him to rename his own doctrine “pragmaticism” and to compose several variants of his original maxim defining it, as well as numerous restatements and elaborations. This paper presents an extensive selection of such formulations, followed by analysis and commentary demonstrating that for Peirce the ultimate meaning of an intellectual concept is properly expressed as a conditional proposition about the deliberate, self-controlled (...) conduct of its interpreters, not the law-governed behavior of its object. The semeiotic of Charles Sanders Peirce is irreducibly triadic, positing that a sign mediates between the object that determines it and the interpretant that it determines. He eventually holds that each sign has two objects and three interpretants, standardizing quickly on immediate and dynamical for the objects but experimenting with a variety of names for the interpretants. The two most prominent terminologies are immediate/dynamical/final and emotional/energetic/logical, and scholars have long debated how they are related to each other. This paper seeks (...) to shed new light on the matter by reviewing the numerous manuscript drafts where Peirce develops the latter nomenclature while attempting to introduce his pragmatism to a general audience. It then goes on to examine an additional set of interpretants, intentional/effectual/communicational, and shows that the three different trichotomies can be understood as complementary, rather than redundant or conflicting. Grounding is bicollective if it is possible for some truths δ,δ,... to be grounded in the some truths γ,γ,... without its being the case that each δi is grounded in some subcollection of γ,γ,.... In this paper I show how to do develop a hypergraph-theoretic account of bicollective ground, taking the notion of immediate ground as basic. I also indicate how bicollective ground helps with formulating mathematical structuralism.

Der Erfolg von Maßnahmen zur Eindämmung der COVID-19-Pandemie ist abhängig vom Vertrauen der Öffentlichkeit in wissenschaftliche Experten. Zwar ist Vertrauen als Einstellung gegenüber Experten im Zusammenhang mit der Pandemie bereits viel Aufmerksamkeit zuteilgeworden, allerdings meist in Bezug auf das Vertrauen, das Laien Äußerungen wie Behauptungen und Mitteilungen entgegenbringen, die ihnen das Wissen der Experten zugänglich machen sollen. Dieser Aufsatz stellt dagegen eine andere Art der Äußerung in den Mittelpunkt: die Empfehlung. Im Zusammenhang mit der Pandemie haben Forderungen gegenüber der Politik (...) wissenschaftsbasiert zu verfahren zugenommen. Gleichzeitig sind Politikerinnen und Politiker aber nicht das Sprachrohr der Wissenschaft, sondern übernehmen Verantwortung für eine wissenschaftsbasierte Gesundheitspolitik, unter anderem indem sie Bürgerinnen und Bürgern bestimmte Handlungen empfehlen. Damit erhebt die Politik allerdings den Anspruch, dass Bürgerinnen nicht nur glauben sollten, was ihnen von den Experten gesagt wird, sondern auch, dass sie tun sollten, was von ihnen im Rahmen der Maßnahmen verlangt wird. Ziel dieses Aufsatzes ist es daher zu zeigen, dass Empfehlungen eine Konzeption von Vertrauen erfordert, die sich vom Vertrauen im Kontext von Mitteilungen und Behauptungen stark unterscheidet. Es geht nicht nur darum, diese Art von Vertrauen genauer zu spezifizieren, sondern auch darum zu erklären, unter welchen Voraussetzungen es vernünftig ist, wissenschaftsbasierten Empfehlungen der Politik mit Vertrauen zu begegnen. Dazu gehe ich folgendermaßen vor: In Abschnitt 1 analysiere ich zunächst den Sprechakt des Empfehlens. Das dadurch gewonnene Grundverständnis von empfehlenden Sprechakten untersuche ich dann im Kontext von Empfehlungen wissenschaftlicher Experten während der Covid-19-Pandemie (Abschnitt 2) und plädiere dann dafür, dass eine Analyse der an eine breite Öffentlichkeit gerichteten Empfehlungen am besten bei Äußerungen von Politikern ansetzen muss, die sich auf das kompetente Urteil wissenschaftlicher Expertinnen und Experten beziehen (Abschnitt 3). In Abschnitt 4 diskutiere ich dann die Gründe, die ein Hörer haben könnte, eine solche Empfehlung anzunehmen, bevor ich in den Abschnitten 5 und 6 die für Empfehlungen relevante Form des Vertrauens herausarbeite. Abschnitt 7 diskutiert die Auffassung, dass Vertrauen in wissenschaftsbasierte Empfehlungen nur durch die Anerkennung der Sprecherin im Sinne einer guten Ratgeberin als rationale Einstellung ausgewiesen werden kann, bevor ich abschließend argumentiere, dass diese Rationalitätsbedingungen im Kontext der COVID-19-Pandemie nur schwer einzulösen waren. The increasing application of artificial intelligence (AI) to healthcare raises both hope and ethical concerns. Some advanced machine learning methods provide accurate clinical predictions at the expense of a significant lack of explainability. Alex John London has defended that accuracy is a more important value than explainability in AI medicine. In this article, we locate the trade-off between accurate performance and explainable algorithms in the context of distributive justice. We acknowledge that accuracy is cardinal from outcome-oriented justice because it helps (...) to maximize patients’ benefits and optimizes limited resources. However, we claim that the opaqueness of the algorithmic black box and its absence of explainability threatens core commitments of procedural fairness such as accountability, avoidance of bias, and transparency. To illustrate this, we discuss liver transplantation as a case of critical medical resources in which the lack of explainability in AI-based allocation algorithms is procedurally unfair. Finally, we provide a number of ethical recommendations for when considering the use of unexplainable algorithms in the distribution of health-related resources. (shrink)

This article explores the nature and theoretical import of a hitherto neglected class of fictions which we term ‘self-involving interactive fictions’. SIIFs are interactive fictions, but they differ from standard examples of interactive fictions by being, in some important sense, about those who consume them. In order to better understand the nature of SIIFs, and the ways in which they differ from other fictions, we focus primarily on the most prominent example of the category: video-game fictions. We argue that appreciating (...) the self-involving nature of video-game fictions is key to understanding various otherwise puzzling phenomena concerning the ways in which consumers respond to them. Video-game fictions are, however, far from being the only extant example of this class; and we suggest that the recent philosophical interest in video games would be better focused on the wider class of self-involving interactive fictions. Although the impact of so-called “sponsorship bias” has been the subject of increased attention in the philosophy of science, what exactly constitutes its epistemic wrongness is still debated. In this paper, I will argue that neither evidential accounts nor social–epistemological accounts can fully account for the epistemic wrongness of sponsorship bias, but there are good reasons to prefer social–epistemological to evidential accounts. I will defend this claim by examining how both accounts deal with a paradigm case from medical epistemology, recently (...) discussed in a paper by Bennett Holman. I will argue that evidential accounts cannot adequately capture cases of sponsorship bias that involve the manufacturing of certainty because of their neutrality with respect to the role of non-epistemic values in scientific practice. If my argument holds, it further highlights the importance of integrating social and ethical concerns into epistemological analysis, especially in applied contexts. One can only properly grasp sponsorship bias as an epistemological problem if one resists the methodological tendency to analyze social, ethical, and epistemological issues in isolation from each other. The cumulative impact of enhancement technologies may alter the human species in the very long-term future. In this article, I will start showing how radical genetic enhancements may accelerate the conversion into a novel species. I will also clarify the concepts of ‘biological species’, ‘transhuman’ and ‘posthuman’. Then, I will summarize some ethical arguments for creating a transhuman or posthuman species with a substantially higher level of well-being than the human one. In particular, I will present what I shall call (...) the Principle of the Best Interests of Posthumanity, which states that the enhancement of the human and transhuman species must be directed towards the creation of a posthuman existence that is substantially more valuable than its predecessors. I suggest that human extinction may be considered, within that principle, as one of the best interests of posthumanity. Finally, I will develop three objections that make that principle unattractive and that show that pursuing a full-blown programme of posthuman evolution is ethically flawed. (shrink)

O objetivo deste artigo, então, consiste na investigação da possibilidade desse conceito, no seu fundamento e na apresentação dos problemas dele decorrentes, contrapondo-o especificamente a sua antítese, isto é, ao monismo entre Estado e direito de Kelsen. Ocorre que a filosofia habermasiana, conforme entendimento do artigo, implica a adoção de uma teoria dualista entre os conceitos de Estado e de direito. La pandemia de la COVID-19 ha levantado sospechas de edadismo y gerontofobia en diversas prácticas de racionamiento sanitario. La edad es un criterio de triaje controvertido. En este artículo se esclarece la relevancia ética de la edad dentro de los sistemas de triaje, analizando particularmente su rol dentro de los principios de equidad y de eficiencia. La equidad requiere dar más oportunidades a aquellos que han cumplido menos ciclos vitales. La eficiencia tiene en cuenta la edad de manera subrepticia al (...) tratar de maximizar los beneficios a corto plazo (salvar vidas) y a largo plazo (salvar años de vida). Finalmente, la edad no debe ser la última ratio de las decisiones de triaje, aunque es una variable a tener en cuenta debido a su presencia implícita en principios fundamentales de priorización. The COVID-19 pandemic has raised suspicions of ageism and gerontophobia in various health rationing practices. Age is a controversial triage criterion. This article clarifies the ethical relevance of age within triage systems, particularly its role within the principles of fairness and efficiency. Fairness requires giving more opportunities to those who have completed fewer life cycles. Efficiency takes age into account surreptitiously when trying to maximize short-term (saving lives) and long-term (saving years of life) benefits. Finally, age should not be the final rationale in triage decisions, although it is a variable to be taken into account because of its implicit presence in fundamental principles of prioritization. The trolley problem is one of the liveliest research frameworks in experimental ethics. In the last decade, social neuroscience and experimental moral psychology have gone beyond the studies with mere text-based hypothetical moral dilemmas. In this article, I present the rationale behind testing the actual behaviour in more realistic scenarios through Virtual Reality and summarize the body of evidence raised by the experiments with virtual trolley scenarios. Then, I approach the argument of Ramirez and LaBarge (2020), who claim that the (...) virtual simulation of the Footbridge version of the trolley dilemma is an unethical research practice, and I raise some objections to it. Finally, I provide some reflections about the means and ends of trolley-like scenarios and other sacrificial dilemmas in experimental ethics. (shrink)

Emerging reprogenetic technologies may radically change how humans reproduce in the not-so-distant future. One foreseeable consequence of disruptive innovations in the procreative domain is an increase in the reproductive autonomy of intended parents. Regarding the prospective parental liberty of enhancing non-health–related traits of the offspring, one controversy has particularly dominated the literature. Does parents' choice of genetically enhancing the traits of their descendants compromise children's future personal autonomy? In this article, I will analyse the main arguments which posit that reprogenetic (...) enhancement could be at odds with the child's future autonomy. I will argue that these objections are ill-founded. Moreover, I will present other arguments that show that reprogenetic technologies can enhance the autonomy of future children. Autonomy enhancement is a plausible and pro tanto desirable application of emerging reprogenetic technologies. (shrink)

Pretendeu-se estudar a aquisição da virtude em Aristóteles a partir da interpretação de M. F. Burnyeat. Para esse, a virtude aristotélica exige dimensões cognitivas e emocionais, sendo que ao aprendiz não basta conhecer os princípios e as regras gerais da ação, mas deve ter internalizado, através do hábito, uma vontade de praticar ações nobres e justas. Compete ao sujeito virtuoso, portanto, ter o conhecimento do que é correto (the that), assim como, subsidiariamente, a justificativa do porquê é apropriada determinada ação (...) (the because). Da análise dessas variáveis, o autor procura esclarecer a figura conflituosa do akratic (incontinente) e do akalastos (perverso) e elucidar a hipótese do desenvolvimento moral. Concomitantemente este artigo pretende introduzir o problema criminológico da ideia de ressocialização ou da pena capital, entendendo ser o argumento aristotélico ainda influente para a filosofia da virtude e jurídica hodierna e necessário quando se discutem novos paradigmas éticos e jurídicos. O artigo analisa a leitura crítica de Hans Kelsen acerca da concepção jurídico-política de Thomas Hobbes, considerando críticas posteriores à própria interpretação de Kelsen. Para tanto, investigou-se primeiramente a posição de Kelsen sobre o jusnaturalismo buscando esclarecer conceitos centrais como os do ser e dever-ser e como o autor os associa a Hobbes. Nesse sentido, observouse a limitação da leitura de Kelsen em relação à filosofia jurídica do autor – uma doutrina jusnaturalista metafísica, tendo na regra de ouro o fundamento (...) natural para o direito positivo. Em contraposição, procurou-se apresentar uma postura crítica, que contesta a posição jusnaturalista atribuída a Hobbes e sustenta a tese de que o autor inglês é um precursor do positivismo jurídico. According to the Disjunction Problem, teleological theories of perceptual content are unable to explain why it is that a subject represents an F when an F causes the perception and not the disjunction F v G, given that the subject has mistaken G’s for F’s in the past. Without an adequate explanation these theories are stuck without an account of how non-veridical representation is possible, which would be an unsettling result. In this paper I defend Burge’s teleological theory of perception (...) against the Disjunction Problem, arguing that a perceptual state’s representing what I call an error-prohibiting disjunctive property is incompatible with the truth of perceptual anti-individualism. And because perceptual anti-individualism is at the heart of Burge’s theory, I conclude that Burgeans need not be concerned with the Disjunction Problem. (shrink)

O artigo tem como objetivo apresentar o problema da determinação do sentido das normas para o Kelsen considerando a flexibilidade do quadro de interpretações. Expõe, primeiramente, a suposta transição do conceito de interpretação normativa, passando de um formalismo-normativismo restritivo para um realismo jurídico a partir das suas últimas obras; em um segundo momento apresenta o decorrente conflito ainda atual constituído por essas reformulações. Finalmente, defende a hipótese de superação da dicotomia formalismo-normativismo versus realismo jurídico através de uma leitura realista normativista.

O presente artigo aborda o problema da soberania para Hans Kelsen. Tem como objetivo analisar a posição do autor sobre o tema (especialmente através do texto Sovereignty), traçando paralelamente algumas considerações. Ocorre que para Kelsen o conceito de soberania mostra-se impreciso a partir da doutrina tradicional. Ainda, mesmo superando essa doutrina e a teoria dualista, também o conteúdo do direito nacional e internacional permanece inalterado. Portanto, prova-se a irrelevância de tal para a teoria jurídica.

O trabalho busca esclarecer dois pontos centrais da Filosofia política de Maquiavel – as figuras da Virtù e da Fortuna. A virtú deve ser vista como uma forma do livre-arbítrio do governante, sendo a principal variável na condução do principado.Destaca-se, também, a utilização da variável nacontestação aos valorestradicionais. Já a Fortuna constitui-se na indeterminabilidade de parte dos resultadosdo governo: ela deve ser dominada, conquistada para o benefício do príncipe.

O objetivo do artigofoi especular sobre a epistemologia proposta por David Hume (1711-1776), especificamente a perspectiva empirista e cética. Procurou-se, assim, expor os principais conceitos da sua filosofia, especialmente acrítica à concepção de causalidade, o problema da probabilidade e os conceitos de percepções, imagens e ideias. Finalmente buscou-se expor uma interpretação que entende haver um ceticismo mitigado no autor e a superação de uma teoria do conhecimento exclusivamente psicológica.

Modern philosophy recognizes two major ethical theories: deontology, which encourages adherence to rules and fulfillment of duties or obligations; and consequentialism, which evaluates morally significant actions strictly on the basis of their actual or anticipated outcomes. Both involve the systematic application of universal abstract principles, reflecting the culturally dominant paradigm of technical rationality. Professional societies promulgate codes of ethics with which engineers are expected to comply, while courts and the public generally assign liability to engineers primarily in accordance with the (...) results of their work, whether intended or unintended. A third option, prominent in ancient philosophy, has reemerged recently: virtue ethics, which recognizes that sensitivity to context and practical judgment are indispensable in particular concrete situations, and therefore rightly focuses on the person who acts, rather than the action itself. Beneficial character traits—i.e., virtues—are identified within a specific social practice in light of the internal goods that are unique to it. Two different versions of the ending of the first additament to C. S. Peirce's 1908 article, "A Neglected Argument for the Reality of God," appear in the Collected Papers but were omitted from The Essential Peirce. In one, he linked the hypothesis of God's Reality to his entire theory of logic as semeiotic, claiming that proving the latter would also prove the former. In the other, he offered a final outline of his cosmology, in which the Reality of God as (...) Ens necessarium is indispensable to both the origin and order of our existing universe of Signs. Exploring these passages, as well as the unpublished manuscript drafts of the article, provides important insights into the key concepts of instinct and continuity within Peirce's comprehensive system of thought. O artigo investigou o método para uma filosofia intercultural a partir da Ibero-América, de Raul Fornet-Betancourt. Partiu-se especificamente do texto do autor para posteriormente fornecer considerações críticas aos seus posicionamentos. Nesse sentido, analisou-se a originalidade do tema, a filosofia da libertação como modelo de diálogo intercultural, seus pressupostos hermenêuticos e epistemológicos e, por fim, o pensamento ibero-americano como base para uma filosofia intercultural. No final do trabalho apresentou-se seis críticas ao texto estudado – o problema da arrogância e dissimulação filosófica, (...) a adoção tácita de um platonismo e a não originalidade filosófica, o problema da falácia naturalista e do falsificacionismo e, finalmente, a não razoabilidade política das propostas. O objetivo do trabalho é auxiliar o jurista desocupado responsável pelo ensino da cadeira de filosofia do direito. A situação mais frequente nas faculdades de direito são as aulas de filosofia e de outras cadeiras do eixo fundamental serem tapeadas por qualquer bacharel sem nada melhor para fazer. Ocorre que tais ociosos juristas muitas vezes se veem receosos quando instituídos nos seus cargos, isso porque não possuem qualquer conhecimento na matéria em que lecionam, ao mesmo tempo em que são lançados (...) em sala de aula expostos às dúvidas e críticas dos alunos. Nesse sentido apresento a esses professores, juristas desocupados, uma técnica pedagógica resumida e de fácil compreensão para ministrarem sem maiores sobressaltos a cadeira de filosofia do direito. Seguindo os passos propostos, o jurista desocupado não terá riscos de ser questionado pelos alunos ou pela instituição, mantendo seu complemento de renda garantido. (shrink)

Com este artigo procura-se introduzir a questão da origem social das normas morais e jurídicas a partir da obra de Hans Kelsen e solucionar, de forma breve, o problema da conciliação do método lógico-transcendental da Teoria pura com a filosofia positivista e empirista do autor.

Pretendeu-se dissertar acerca do conceito kantiano do Direito a partir da gênese da sua fundamentação moral, ressaltando a aprioricidade da mesma e seu reflexo na doutrina jurídica. Contrariamente ao moral sense da Filosofia empirista inglesa, a moralidade kantiana baseia-se completamente a priori, abdicando de uma antropologia em sua exposição e formulando-se como pura metafísica, a partir de conhecimentos abstratos. Coaduna à concepção de moralidade kantiana o seu conceito de Direito, que também não possui, portanto, qualquer fundamento na experiência. Desta forma, (...) pretende-se fornecer uma interpretação sistemática em relação aos problemas da doutrina do direito, especificamente sobre a sua exterioridade, a função da coerção e a formação do Estado. O presente artigo apresentou a interpretação de Paul Guyer acerca da filosofia jurídica de Kant, delimitando seu objeto no oitavo capítulo da obra “Kant”. Procurou-se, por estratégia argumentativa, fixar-se no texto de Guyer, apresentado claramente o problema envolvido, a sua hipótese a e análise das variáveis. Concomitantemente procurou-se inserir uma breve apreciação crítica na forma de notas numéricas. Buscou-se, dessa forma, privilegiar o texto do autor, focando especificamente nos problemas por ele apresentado, sem, contudo, deixar de apresentar uma crítica aos (...) pontos mais cruciais do artigo. Guyer sistematizou a filosofia jurídica de Kant, requerendo à interpretação uma visão mais abrangente da obra do filósofo prussiano, isto é, Guyer procurou correlacionar o conceito de direito kantiano com a filosofia prática, fornecendo, assim, uma ótica em que direito apresenta-se como uma autorização e uma obrigação da razão prática. Nessa sequência, o direito de propriedade, os direitos de família, direitos contratuais, direito público e direito internacional segue uma fundamentação sistemática da obra kantiana. (shrink)

Pretendeu-se dissertar sobre a segunda conferênciada obra O Liberalismo Político de John Rawls. A exposição trata dométodo de justificação do autor, concentrada nos termos racionalidade(concepção de bem) e razoabilidade (senso de justiça);subsequentemente aborda as variáveis – cooperação, voluntariedade,autonomia, limites do juízo, discordância, pluralismo, reciprocidade,imparcialidade, publicidade, justificação, democracia e tolerância. Nessesentido, parte-se da obra supracitada para a sistematização da teoria eresolução de problemas: uma referência histórica em Kant; uma respostaàs hipóteses comunitaristas; a convergência de modelos de justificação,sobretudo uma deontologia com uma (...) concepção substancial de justiça; eos argumentos epistemológicos fundacionistas e coerentistas. Conclui-se,além da unidade da obra, a tipificação contratualista na história daFilosofia, um compatibilismo ético e o caráter epistemológico coerentista. (shrink)
