In a recent paper, Francis Y. Lin proposes a “memory-challenge” to two main interpretations of Wittgenstein’s private language argument: the “no-criterion-of-correctness” interpretation and the “no-stage-setting” interpretation. According to Lin, both camps of interpretation fail to explain why a private language is impossible within a short time period. To answer the “memory-challenge”, Lin motivates a grammatical interpretation of the private language argument. In this paper, I provide a critical discussion of Lin’s objection to these interpretations and argue that Lin’s objection fails. (...) In the case of the “no-stage-setting” interpretation, Lin suggests that the private language user can establish a stage within a short time period. However, I show that this stage is insufficient for a private language to be used correctly. In the case of the “no-criterion-of-correctness” interpretation, Lin believes that since memory is reliable within a short period, no criterion is needed for the correct use of a private language. However, I argue that his objection attacks a strawman, since the interpretation concerns the structure of justification, rather than the weakness of memory itself. I conclude with a critical discussion on memory and primitive expressions, the latter of which are crucial to Wittgenstein’s approach to public language. This discussion will help to draw a sharp line between private language and public language, and cast some doubt on Lin’s grammatical interpretation. (shrink)

We often feel survivor guilt when the very circumstances that harm others leave us unscathed. Although survivor guilt is both commonplace and intelligible, it raises a puzzle for the standard philosophical account of guilt, according to which people feel guilt only when they take themselves to be morally blameworthy. The standard account implies that survivor guilt is uniformly unfitting, as people are not blameworthy simply for having fared better than others. In this paper, we offer a rival account of guilt, (...) the relational account of guilt, which makes sense of survivor guilt and other forms of guilt without self-blame while preserving the intelligibility of guilt about culpable wrongdoing. According to this account, guilt involves the feeling of being unable to justify ourselves to others, and we lack self-justification when we (however blamelessly) stand on the positive side of an undesirable asymmetry with them. When someone survives something that those around her do not, the disparity in outcome constitutes an asymmetry that is often undesirable, because it arises from luck or violates a requirement of solidarity. Rationale and objectives: Medical humanities are becoming increasingly recognized as positively impacting medical education and medical practice. However, the extent of medical humanities teaching in medical schools is largely unknown. We reviewed medical school curricula in Canada, the UK and the US. We also explored the relationship between medical school ranking and the inclusion of medical humanities in the curricula. -/- Methods: We searched the curriculum websites of all accredited medical schools in Canada, the UK and the US to check (...) which medical humanities topics were taught, and whether they were mandatory or optional. We then noted rankings both by Times Higher Education and U.S. News and World Report and calculated the average rank. We formally explored whether there was an association between average medical school ranking and medical humanities offerings using Spearman's correlation and inverse variance weighting meta-analysis. -/- Results: We identified 18 accredited medical school programmes in Canada, 41 in the UK, and 154 in the US. Of these, nine (56%) in Canada, 34 (73%) in the UK and 124 (80%) in the US offered at least one medical humanity that was not ethics. The most common medical humanities were medical humanities (unspecified), history, and literature (Canada); sociology and social medicine, medical humanities (unspecified), and art (UK); and medical humanities (unspecified), literature and history (US). Higher ranked medical schools appeared less likely to offer medical humanities. -/- Conclusions: The extent and content of medical humanities offerings at accredited medical schools in Canada, the UK and the US varies, and there appears to be an inverse relationship between medical school quality and medical humanities offerings. Our analysis was limited by the data provided on the Universities' websites. Given the potential for medical humanities to improve medical education and medical practice, opportunities to reduce this variation should be exploited. (shrink)

The dominant way to define physical entities is by appeal to ideal physics (as opposed to current physics). However, it has been worried that physicalism understood in terms of ideal physics would be too liberal to rule out “psychism”, the view that mentality exists at the fundamental metaphysical level. In this article, I argue that whereas physicalism is incompatible with some psychist cases, such as the case of “phenomenalism” in which ideal physics adopts mental concepts to denote fundamental entities, physicalism (...) should accommodate a certain type of psychist case in which fundamental mental entities are denoted by non-mental concepts in ideal physics. In so doing, I propose a distinctive account of physical entities, which asserts that physical entities are entities denoted by non-mental natural concepts in ideal physics. Policies that require male-female sex comparisons in all areas of biomedical research conflict with the goal of improving health outcomes through context-sensitive individualization of medical care. Sex, like race, requires a rigorous, contextual approach in precision medicine. A “sex contextualist” approach to gender-inclusive medicine better aligns with this aim.

This study systematically examined people’s protective behaviors against COVID-19 in China, and particular attention was given to people’s perceived threat and information-processing strategies. This study constructed a conceptual model and used structural equation modeling to explore this issue, and a questionnaire survey was conducted to collect data involving 4,605 participants during the early stage of the COVID-19 pandemic in China. The results showed that people’s initial information acquisition played an essential role in their behavioral responses; acquiring more initial information about (...) COVID-19 would make them perceive a higher threat and present a higher demand for information, then making them more likely to seek and process information, and subsequently motivating their protective behaviors. The safety condition is supposed to be a necessary condition on knowledge which helps to eliminate epistemic luck. It has been argued that the condition should be globalized to a set of propositions rather than the target proposition believed to account for why not all beliefs in necessary truths are safe. A remaining issue is which propositions are relevant when evaluating whether the target belief is safe or not. In the literature, solutions have been proposed to determine the relevance of (...) propositions. This paper examines a case of luckily true belief—thus a case of ignorance—and a case of knowledge. It argues that no solution in the literature offers a correct verdict in either case. Therefore, the strategy to globalize safety remains unsatisfactory. (shrink)

It has been argued that an advantage of the safety account over the sensitivity account is that the safety account preserves epistemic closure, while the sensitivity account implies epistemic closure failure. However, the argument fails to take the method-relativity of the modal conditions on knowledge, viz., sensitivity and safety, into account. In this paper, I argue that the sensitivity account and the safety account are on a par with respect to epistemic closure once the method-relativity of the modal conditions is (...) taken into account. According to the sensitivity account of knowledge, S knows that p only if S’s belief in p is sensitive in the sense that S would not believe that p if p were false. The sensitivity condition is usually relativized to belief-formation methods to avoid putative counterexamples. A remaining issue for the account is where methods should be mentioned in the sensitivity subjunctives. In this paper, I argue that if methods are mentioned in the antecedent, then the account is too strong (...) to accommodate inductive knowledge; if methods are mentioned in the consequent, then the account is too weak to eliminate some luckily true beliefs from the realm of knowledge. Therefore, the strategy to relativize the sensitivity condition is undermined by inductive knowledge and some luckily true beliefs. (shrink)

According to the received account of guilt in the philosophical literature, one cannot feel guilt unless one takes oneself to have done something morally wrong. But ordinary people feel guilt in many cases in which they do not take themselves to have done anything morally wrong. In this paper, I focus on one kind of guilt without perceived wrongdoing, guilt about being merely causally responsible for a bad state-of-affairs. I go on to present a novel account of guilt that explains (...) guilt about mere causal responsibility, according to which guilt represents part of the self as bound up with what is bad. (shrink)

This paper examines the role existence plays in measurement validity. I argue that existing popular theories of measurement and of validity follow a correspondence framework, which starts by assuming that an entity exists in the real world with certain properties that allow it to be measurable. Drawing on literature from the sociology of measurement, I show that the correspondence framework faces several theoretical and practical challenges. I suggested the validity-first framework of measurement, which starts with a practice-based validation process as (...) the basis for a measurement theory, and only posits objective existence when it is scientifically useful to do so. The social sciences face a problem of sample non-representation, where the majority of samples consist of undergraduate students from Euro-American institutions. The problem has been identified for decades with little trend of improvement. In this paper, I trace the history of sampling theory. The dominant framework, called the design-based approach, takes random sampling as the gold standard. The idea is that a sampling procedure that is maximally uninformative prevents samplers from introducing arbitrary bias, thus preserving sample representation. I show how (...) this framework, while good in theory, faces many challenges in application. Instead, I advocate for an alternative framework, called the model-based approach to sampling, where representative samples are those balanced in composition, however they were drawn. I argue that the model-based framework is more appropriate in the social sciences because it allows for systematic assessment of imperfect samples and methodical improvement in resource-limited scientific contexts. I end with practical proposals of improving sample quality in the social sciences. (shrink)

According to the safety account of knowledge, one knows that p only if one’s belief could not easily have been false. An important issue for the account is whether we should only examine the target belief when evaluating whether a belief is safe or not. In this paper, it is argued that, if we should only examine the target belief, then the account fails to account for ignorance of necessary truths. But, if we should also examine beliefs in other relevant (...) propositions, then the account fails to account for knowledge from falsehood. Therefore, the safety account of knowledge is undermined by knowledge from falsehood and ignorance of necessary truths. (shrink)

Many philosophers assume that, when making moral decisions under uncertainty, we should choose the option that has the greatest expected moral value, regardless of how risky it is. But their arguments for maximizing expected moral value do not support it over rival, risk-averse approaches. In this paper, I present a novel argument for maximizing expected value: when we think about larger series of decisions that each decision is a part of, all but the most risk-averse agents would prefer that we (...) consistently choose the option with the highest expected value. To the extent that what we choose on a given occasion should be guided by the entire series of choices we prefer, then on each occasion, we should choose the option with the highest expected moral value. Solidarity is a widespread but under-explored phenomenon. In this paper, I give a philosophical account of solidarity, answering three salient questions: What motivates acts of solidarity? What unifies different acts into tokens of a single type of act, one of solidarity? And what values do acts of solidarity exhibit? The answer to all three, I argue, involves a certain way of relating to others: identifying with them on the basis of shared features, and identifying with the larger group that one (...) and the others both belong to. Call "radical moral theorizing" the project of developing a moral theory that not only tries to conform to our existing moral intuitions, but also manifests various theoretical virtues: consistency, simplicity, explanatory depth, and so on. Many moral philosophers assume that radical moral theorizing does not require any particular metaethical commitments. In this paper, I argue against this assumption. The most natural justification for radical moral theorizing presupposes moral realism, broadly construed; in contrast, there may be no justification for radical moral (...) theorizing if moral anti-realism is true. Many philosophers have suspected that the normative importance of morality depends on moral realism. In this paper, I defend a version of this suspicion: I argue that if teleological forms of moral realism, those that posit an objective purpose to human life, are true, then we gain a distinctive kind of reason to do what is morally required. I argue for this by showing that if these forms of realism are true, then doing what is morally required can provide a (...) life with meaning, which is a widespread human need. I also argue that rival meta-ethical views, like anti-realism or non-naturalist realism, cannot make morality meaning-conferring in this way. (shrink)

It is a commonplace in economics that we should disregard sunk costs. The sunk cost effect might be widespread, goes the conventional wisdom, but we would be better off if we could rid ourselves of it. In this paper, I argue against the orthodoxy by showing that the sunk cost effect is often beneficial. Drawing on discussions of related topics in dynamic choice theory, I show that, in a range of cases, being disposed to honor sunk costs allows an agent (...) to mimic a resolute chooser, someone who adopts the best plan at the outset of a decision problem and sticks with it, even when resoluteness is unfeasible. I discuss several kinds of cases in which honoring sunk costs coincides with resolute choice. (shrink)

Depending on whether we are somewhat tolerant of nearby error-possibilities or not, the safety condition on knowledge is open to a strong reading and a weak reading. In this paper, it is argued that induction and conjunction introduction constitute two horns of a dilemma for the safety account of knowledge. If we opt for the strong reading, then the safety account fails to account for inductive knowledge. A few purported counterexamples to the Adams thesis have cropped up in the literature in the last few decades. I propose a theory that accounts for them, in a way that makes the connections between indicative conditionals and counterfactuals clearer.

A scarcity mindset is considered to impact consumer behaviors. Our research aimed to examine the moderating effect of the scarcity mindset on the relationship between mental accounting and hedonic (vs. utilitarian) consumption. We conducted an online experimental design (mental accounting: windfall gains vs. hard-earning gains; consumption: hedonic products vs. utilitarian products) and verified our hypotheses in two distinct samples: a student sample and an adult sample. Our results showed that consumers who received windfall gains tended to use it for hedonic (...) consumption rather than utilitarian consumption. Intriguingly, such an effect was insignificant under a high level of a scarcity mindset but significant under a low level of the scarcity mindset. Moreover, consumers who received hard-earning gains tended to spend the money on utilitarian (vs. hedonic) consumption. However, we did not detect the impact of the scarcity mindset on such effects. Our research suggested an asymmetric effect of the scarcity mindset on hedonic (vs. utilitarian) consumption under two different mental accounts. It highlights the important role of the scarcity mindset in consumer behaviors, which leaves avenues for future research to understand marketing promotion strategies for distinct products. (shrink)

Kant is regarded as the spokesman of the contemporary declaration of human rights and the forerunner of global citizenship theory. However, this noble image has been questioned by critics for his comment of empirical racial hierarchy stated in the pre-critical period: Kant’s moral law applies only to the white race with the “full personality”. Around the question of whether Kant’s pure moral philosophy was impregnated by his racist view, the defenders of Kant either adopt the negative defense strategy of affirming (...) the transcendental moral philosophy and negating the racial thought, or try to justify the consistency of Kant’s theory from the perspective of his later philosophy of right. The deficiency of these two justifications is that they do not directly deal with the relationship between moral philosophy and race theory. When Kant developed a mature moral theory in the mid-1780s, he also constructed a systemically mature race theory under the guidance of teleology principles to defend the unity of mankind in a different world. This theory can be used as the explanatory basis to prove the universality of Kant’s moral philosophy, which reflects the deep correlation between moral philosophy and race theory. From this perspective, it can not only make up for the lack of defenders and respond to the critics’ doubts, but also portray a consistent egalitarian image of Kant. (shrink)

This paper examines two objections to the infinitist theory of epistemic justification, namely “the finite mind objection” and “the distinction objection.” It criticizes Peter Klein’s response to the distinction objection and offers a more plausible response. It is then argued that this response is incompatible with Klein’s response to the finite mind objection. Infinitists, it would seem, cannot handle both objections when taken together.

At its strongest, Hume's problem of induction denies the existence of any well justified assumptionless inductive inference rule. At the weakest, it challenges our ability to articulate and apply good inductive inference rules. This paper examines an analysis that is closer to the latter camp. It reviews one answer to this problem drawn from the VC theorem in statistical learning theory and argues for its inadequacy. It is essential to analyze the state, significance, and issues of the Metaverse as a possible world from an ontological perspective. The Metaverse is an on going ontological event. Despite its status as a possible world beyond the real world, its actors are still human beings from the real world. It is thus impossible for the Metaverse to transcend the fundamental problems of human life, as the issues of politics, capital, and ideology still take place in a recursive manner. Therefore, (...) the Metaverse does not have its own independent ontology, but shares the ontology of the real world. To conclude, the Metaverse may change people's lives, but not ontology. (shrink)

Among various views concerning the nature of womanhood, one kind of divergence between the materialist and the pluralist account centres on whether a woman should be defined or identified based on her typical female biological features. The former treats “woman” as the social meaning of the biological female, while the latter insists that one can be a woman in virtue of their internal identity without also having the normatively associated biological features. In this paper, I argue against the latter view (...) that the inclusion or demarginalization of transwomen requires more than self-identification and that it demands the recognition of the role of “misogyny”. This paper inquires into literariness, a much neglected problem in translation, from a cognitive poetic perspective; it tries to show the nature of proxy as concerns translation through various illustrations, hence what is termed by Bausse-Beier the proxy principle, and in passing answer the philosophical problem of translatability or untranslatability. Literariness, not limited to literature, may exist in all texts. It can be defined as the form of a text that is suggestive of something, different from that of a text (...) that is not. Any text that is literary is a literary text. Literariness may be realized through the use of metaphors, personifications, imagery, hyperbole and so on, and through the employment of pattern such as alliteration, paranomasia, meter, rhyme and so on. In translating a literary text, a translator should capture the literariness, otherwise the translation fails. However, in the process of translation, some of these features that contribute to the form, such as phonological or prosodic ones, will be definitely lost. If literariness is to be maintained, there should be a way for compensation. Analogy comes to the fore, though translation is by nature analogical; it is employed to reveal the iconicity between signifier and signified through some means of representation. In such an endeavor, optimum relevance should be aimed at so that a good proxy can be ensured: what is in the mind of an original reader should be that in the mind of a translation reader. (shrink)

With the rapid development of information technology, the electricity consumption of Internet Data Centers (IDCs) increases drastically, resulting in considerable carbon emissions that need to be reduced urgently. In addition to the introduction of Renewable Energy Sources (RES), the joint use of the spatial migration capacity of IDC workload and the temporal flexibility of the demand of Electric Vehicle Charging Stations (EVCSs) provides an important means to change the carbon footprint of the IDC. In this paper, a sustainability improvement strategy (...) for the IDC carbon emission reduction was developed by coordinating the spatial-temporal dispatch flexibilities of the IDC workload and the EVCS demand. Based on the Minkowski sum algorithm, a generalized flexible load model of the EVCSs, considering traffic flow and Road Impedance (RI) was formulated. The case studies show that the proposed method can effectively increase the renewable energy consumption, reduce the overall carbon emissions of multi-IDCs, reduce the energy cost of the DCO, and utilize the EV dispatching potential. Discussions are also provided on the relationship between workload processing time delay and the renewable energy consumption rate. (shrink)

Saturated free fatty acids-induced hepatocyte lipoapoptosis plays a pivotal role in non-alcoholic steatohepatitis. Theactivation of endoplasmic reticulum (ER) stress isinvolved in hepatocyte lipoapoptosis induced by thesaturated free fatty acidpalmitate (PA). However, the underlying mechanismsof the role of ER stress in hepatocyte lipoapoptosis remain largely unclear.In this study, we showed that PA and tunicamycin (Tun), a classic ER stress inducer, resulted in differential activation of ERstress pathways. Our data revealed that PA inducedchronic and persistent ER stress response, but Tuninduced acute and (...) transientER stress response. Compared with Tun treatment, PAinduced much lower glucose-regulated protein 78 (GRP78), a centralregulator of ER homeostasis, accumulation. It is noteworthy that GRP78 over-expression not only inhibited PA-induced ERstress but also decreased PA-induced apoptosis. Taken together, our data suggest that the differentialactivation of ER stresssignal plays an important role in PA-induced hepatocyte lipoapoptosis. More detailed studies on the mechanisms of PA inrepressing the accumulation of GRP78 will contribute to the understanding of molecular mechanisms of lipoapoptosis. (shrink)

This book examines some possible ethical principles to resolve moral dilemmas involving water. Existing problems in current water management practices are discussed in light of these principles. Transformation of human water ethics has the potential to be far more effective, cheaper and acceptable than some existing means of “regulation”, but transformation of personal and societal ethics need time because the changes to ethical values are slow.

Este artigo tem quatro objetivos. O primeiro deles é mostrar que dois debates contemporâneos de grande importância para a filosofia política aristotélica – a saber, o debate acerca do laço que liga ou deve ligar os cidadãos de uma comunidade política e o debate acerca da importância da participação política no que diz respeito ao alcance da felicidade – devem ser compreendidos em conjunto com o mo- vimento hermenêutico que chamamos hoje de biological turn. Como veremos, a maneira como respondemos (...) a essas duas questões influencia ainda uma terceira, a saber, a questão acerca da importância e da função da lei para a comunidade política tal como pensada por Aristóteles. O segundo objetivo é resumir os principais argumentos apresentados nos ditos debates apontando sua pertinência e as suas falhas. O terceiro objetivo é ressaltar um ponto de considerável importância para ambos os debates que não recebeu a devida atenção por parte dos comentadores. Sendo impossível alcançar uma resposta definitiva a respeito das duas questões no espaço que temos aqui, o último objetivo do presente artigo é indicar um possível caminho para futuras investigações. Além disso, este artigo mostra como tais complexos conceituais podem ser definidos com o uso de leis interativas, ligando noções de diferentes naturezas e esclarecendo a estrutura lógica dos sistemas filosóficos. Este artigo contém ainda comparações entre a presente abordagem e a recente desenvolvida por Puntel.

Para responder a esta questão, focarei minha atenção sobre um período específico do pensamento ocidental, a saber, o que vai de Feuerbach (ou, da publicação da Crítica da razão pura de Kant em 1781) a Sartre e Camus, passando particularmente por Dostoievski e Nietzsche. RESUMO:O objetivo deste artigo é discutir sobre os conceitos de obrigação e lei natural, tendo como referência o polêmico debate moderno envolvendo intelectualismo e voluntarismo. Em um primeiro momento, destacaremos a rejeição de Wolff ao voluntarismo de Pufendorf e sua orientação em direção ao intelectualismo de Leibniz. Conforme essa nova orientação, uma teoria da lei natural não deve basear seu conceito de obrigação na autoridade das leis e em seu poder coercitivo, mas, por outro lado, unicamente na ideia de necessidade (...) moral, interpretada como expressão da ligação natural universal dos seres racionais com o dever. Em um segundo momento, apresentaremos os efeitos dessa discussão no pensamento inicial de Kant, que, se posicionando diante mesmo de Wolff e Baumgarten, vai empreender a superação de seus predecessores, através de uma revisão conceitual do problema, a qual culminará nos pressupostos de sua doutrina ética madura. -/- ABSTRACT:This paper highlights the debate around the concepts of obligationand natural law, with reference to the controversial modern discussion involving intellectualism and voluntarism. This book deals with an internal theme of metaphysics, which is the metaphysics of the laws of nature. The author presents traditional contemporary theories, as well as his own original theory, and evaluates each one at a time. He also addresses the problem of the modality of the laws of nature and makes some criticism of the standard view of necessity as truth in all possible worlds, and shows an application of his discussion to the metaphysics of physics. / Este (...) livro trata de um tema interno à metafísica, que é a metafísica das leis da natureza. O autor apresenta as teorias tradicionais contemporâneas, tal como também a sua própria teoria original, e avalia cada uma delas por vez. Ele também aborda o problema da modalidade das leis da natureza e apresenta uma certa crítica à visão padrão da necessidade como verdade em todos os mundos possíveis, e mostra uma aplicação da sua discussão à metafísica da Física. In this paper, we intend to explore the possible influences of legislative prose in the Anaximander’s cosmological prose construction, who would have been, according to Themistius, “the first Greek who dared to expose a written discourse about nature” (ἐθάρρησε πρῶτος ὧν ἴσμεν Ἑλλήνων λόγον ἐξενεγκεῖν περὶ φύσεως συγγεγραμμένον, Or. 26 p. 383 = DK12A7). Our aim is to clarify which notions of nature and justice are assumed in its emergent cosmology, considering that, at least from the lexical point of view, (...) it seems strongly suggestive to be undefined the barriers between the legal and cosmic order, between the Human and the Natural. Indeed, this is what the peripatetic tradition seems to suggest by judging Anaximander’s language extremely poetic (ποιητικωτέροις οὕτως ὀνόμασιν αὐτὰ λέγων), since he would use legal terms (διδόναι αὐτὰ δίκην καὶ τίσιν ἀλλήλοις τῆς ἀδικίας) to explain the natural processes of generation and corruption (ἡ γένεσίς ἐστι τοῖς οὖσι, καὶ τὴν φθορὰν εἰς ταῦτα γίνεσθαι, Simpl. in Phys. 24. 13–25 = DK12B1). ——— Objetivamos neste artigo explorar as possíveis influências da prosa legislativa na constituição da prosa cosmológica de Anaximandro de Mileto, que teria sido, segundo Temístio, “o primeiro grego que ousou expor um discurso escrito sobre a natureza” (ἐθάρρησε πρῶτος ὧν ἴσμεν Ἑλλήνων λόγον ἐξενεγκεῖν περὶ φύσεως συγγεγραμμένον, Or. 26 p.383 = DK12A7). Visamos aclarar que noções de natureza e de justiça estão sendo pressupostas nessa cosmologia então emergente, considerando que, ao menos do ponto de vista lexical, parece fortemente sugestivo serem indefinidas as barreiras entre a ordem jurídica e a cósmica, entre o âmbito humano e o natural. Com efeito, é o que parece já sugerir a tradição peripatética ao julgar o linguajar de Anaximandro extremamente poético (ποιητικωτέροις οὕτως ὀνόμασιν αὐτὰ λέγων) por o milésio empregar termos considerados do âmbito jurídico (διδόναι αὐτὰ δίκην καὶ τίσιν ἀλλήλοις τῆς ἀδικίας) para explicar os processos ditos naturais de geração e corrupção (ἡ γένεσίς ἐστι τοῖς οὖσι, καὶ τὴν φθορὰν εἰς ταῦτα γίνεσθαι, Simpl. in Phys. 24.13–25 = DK12B1). We intend at this article to show some reasons to think the laws of nature as metaphysically necessary: to distinguish the metaphysical modality from the epistemical modality, and to have an absolute modality to face the relative physical and logical modalities. Lately, we indicate what does it mean to talk about metaphysically necessary laws, distinguishing two kinds of metaphysical modalities, and we account for the question about if the laws of nature are metaphysically necessary. In this paper, I intend to argue against Alexander Bird‟s thesis (2001) that the law salt dissolves in water is metaphysically necessary. I briefly indicate Bird‟s argument for the necessity of such law, and then I provide a counter-argument to his thesis. In a general way, Bird wants to show that the existence of certain substances depends on the truth of certain laws, and that because of this the existence of such substances implies the existence of such laws. That would (...) make the laws existing at least while the substance it rules exists; what, for Bird, makes such laws metaphysically necessary. My counter-argument to Bird is that such conception apprehends just what we call “weak necessity”, and not the strong necessity we would like a metaphysically necessary law to have. (shrink)

The purposes of this paper are: (1) to present four theories of the nature of natural laws, (2) to show that only one of them is capable of adequately answering to Tooley’s Cases, and (3) indicate why these cases are relevant for our ontology. These purposes are important since the concept of “natural law” is used in many (if not all) realms of natural science and in many branches of philosophy; if Tooley’s cases are possible, they represent situations that must (...) be adequately described. If there is only one theory that can adequately describe such cases, there are strong reasons to prefer this theory over the other ones. (shrink)

RESUMO Versa o presente artigo sobre a regulação do linchamento no Direito Romano do período antigo, em especial sobre o artigo 9º da Tábua III das Leis das XII Tábuas. A partir de uma metodologia de análise qualitativa, revisão bibliográfica e interpretação textual, os autores objetivam ampliar a visão tradicional sobre o linchamento, compreendendo a institucionalização de sua prática no Direito Romano e sua função no contexto de formação da cultura jurídica do período antigo. A hipótese de trabalho é a (...) de que o artigo 9º da Tábua III das Leis das XII Tábuas apresenta, historicamente, uma forma de punição intermediária entre a linchamento popular extralegal e a pena criminal prevista em lei. Do ponto de vista jurídico-antropológico, a comprovação da hipótese permitiria concluir a ideia de que a pena praticada na antiguidade é uma evolução do controle social informal da violência. ABSTRACT The following paper is about the lynching regulation in Roman law in Ancient Era, especially in what comes about the article 9 of Table Three from Twelve Tables. Making use of a methodology based in qualitative analisys, literature review and interpretation, the auctor aim to expande the traditional view about lynching, understanding the institutionalization of their practice in Roman Law and it’s function in the legal culture in Ancient Era. The working hipothesis is that the article 9 of Table Three of Twelve Tables presents, in a historical context, a intermediate form of punishment between extralegal collective lynching and criminal penalty provided by law. From a legal-anthropological point of view, the proof of the hypothesis would allow us to conclude the idea that the penalty practiced in antiquity is an evolution of informal social control of violence. Philosophy undergraduate course completion work published in 2015. This work examines Frege's concept of logical law and its relationship to other normative and descriptive approaches in the history of philosophy, as well as epistemological conceptions of the a priori aspects of mathematical knowledge.

The main intent of this thesis is to defend that the laws of nature are better thought as transcendent universals, such as platonic governism suggests, and that they are metaphysically necessary in a strong way, such as the heterodox version of such platonism defends. With this intention, we sustain that physical symmetries are essential consequences of the laws of nature – what solves the challenge of symmetries – thus being metaphysically necessary, without being governist's necessitation laws. First, we will show (...) what laws of nature are and the reasons to reject other metaphysical theories and to accept platonic governism. Soon after, we will present the challenge of symmetries and the reasons to prefer the platonic governist answer over dispositionalist, regularist, aristotelic (governism), counterfatualist and primitivist ones. At last, we will define what is the metaphysical necessity, argue for the strong metaphysical necessity of laws and their consequences, and show why the reasons for the contingency or weak necessity of laws are bad theoretical paths. The goal of this thesis to defend the philosophical view of the new ante rem substantivism against its supposed alternatives. To achieve such goal, we will present four views about the nature of laws, two kinds of realism and two kinds of anti-realism, and evaluate them critically. The disadvantages from those theories are going to be presented for us to show that they are insufficient to provide a metaphysics that is able to explain the world's counterfactuality, universality, and regularity, and (...) that just one form of realism, the new ante rem substantivism, can. This goal is important because the concept of laws of nature is widely used in many areas of science and philosophy, and because according to the view we accept, the laws may fulfill some theoretical roles, and not others. We intent to show that the new ante rem substantivism's laws are able to fulfill the roles that scientists would hope the natural laws to fulfill. (shrink)
