The paper is a contribution to the debate on the epistemological status of thought experiments. I deal with the epistemological uniqueness of experiments in the sense of their irreducibility to other sources of justification. In particular, I criticize an influential argument for the irreducibility of thought experiments to general arguments. First, I introduce the radical empiricist theory of eliminativism, which considers thought experiments to be rhetorically modified arguments, uninteresting from the epistemological point of view. Second, I present objections to the (...) theory, focusing on the critique of eliminativism by Tamar Szabó Gendler based on the reconstruction of famous Galileo's Pisa experiment. I show that her reconstruction is simplistic and that more elaborate reconstruction is needed for an appropriate assessment of the epistemic power of general argument. I propose such a reconstruction and demonstrate that general version of Pisa experiment is epistemically equal to the particular one. Thus, from an epistemological perspective, Galileo's thought experiment is reducible to a straightforward argument without particular premises. (shrink)

Descriptions of bodies within the literature of the enactive approach to cognitive science exhibit an interesting dialectical tension. On the one hand, a body is considered to be a unity which instantiates an identity, forming an intrinsic basis for value. On the other, a living body is in a reciprocally defining relationship with the environment, and is therefore immersed and entangled with, rather than distinct from, its environment. In this paper I examine this tension, and its implications for the enactive (...) approach, particularly the enactive conceptions of life and bodies. Following the lead of others, I argue that enactive cognitive science can benefit from a deeper reading and integration with extant work on the complexity and multiplicity of the living body within feminist philosophy and feminist science studies. Perceptual modalities have been traditionally considered the product of dedicated biological systems producing information for higher cognitive processing. Psychological and neuropsychological evidence is offered which undermines this point of view and an alternative account of modality from the enactive approach to understanding cognition is suggested. Under this view, a perceptual modality is a stable form of perception which is structured not just by the biological sensitivities of the agent, but by their goals and the set of skills or expertise which (...) they are deploying at a given time. Such a view suggests that there is no such thing as an experience that is purely visual, auditory, or otherwise modal and that our attempts to understand consciousness and the mind must be conducted within a framework that provides an account of embodied, goal-directed adaptive coping with the world. Sprawiedliwość jako cecha działającego podmiotu jest w swej istocie doskonałością całości, doskonałością jego istnienia. Taka doskonałość („dzielność”) całości zakłada sprawność każdego zasadniczego elementu naszego wnętrza – intelektu, woli i uczuć, choć nie jest po prostu sumą doskonałości tych elementów, jest czymś jakościowo różnym. Niemniej jednak Platona ujęcie doskonalenia elementów „wnętrza” człowieka prowadzi do refleksji nad powiązaniem sprawiedliwości z pozostałymi uniwersalnymi wartościami konstytucyjnymi – prawdą, dobrem i pięknem. Dzielnością (cnotą) właściwą intelektowi, symbolizowanemu przez władców Platońskiego państwa, jest mądrość, a ta nie (...) może się obyć bez prawdy. Dzielnością woli, symbolizowanej przez żołnierzy i policjantów, jest odwaga pojmowana przez Platona jako postępowanie zgodne z własnymi, rozumnymi przekonaniami, a takie postępowanie jest fundamentem dobra (moralnego). Uczucia – symbolizowane przez wytwórców – ukierunkowywane, „pociągane” są przez piękno. Krótko, wiedza – ma być prawdziwa, działanie – dobre, a to, co wytwarzane – piękne. To przesłanie Platona dotyczące naszych uniwersalnych wartości konstytucyjnych. To też przesłanie dotyczące celów, których realizacji powinna służyć kultura duchowa – nauka zmierza do prawdy, moralność do dobra, sztuka do piękna. Platon każe przy tym pamiętać, że rozwój kultury nie jest celem samym w sobie, ale służyć powinien tworzeniu warunków rozwoju konkretnego człowieka, w tym tworzeniu warunków do bycia sprawiedliwym. The aim of the paper is to provide a philosophical and historical background to current discussions about the changing relationships between the university and the state through revisiting the classical “Humboldtian” model of the university as discussed in classical German philosophy. This historical detour is intended to highlight the cultural rootedness of the modern idea of the university, and its close links to the idea of the modern national state. The paper discusses the idea of the university as it emerges (...) from the philosophy of Wilhelm von Humbold, Johann Gottlieb Fichte and Friedrich Schleiermacher, as well as - in the 20th century - Karl Jaspers and Jürgen Habermas. More detailed questions discussed include the historical pact between the modern university and the modern nation-state, the main principles of the Humboldtian university, the process of the nationalization of European universities, the national aspect of the German idea of culture (Bildung), and the tension between the pursuit of truth and public responsibilities of the modern university. In discussing current and future missions and roles of the institution of the university today, it can be useful to revisit its foundational (modern) German idea. In thinking about its future, it can be constructive to reflect on the evident current tensions between traditional modern expectations of the university and the new expectations intensified by the emergence of knowledge-based societies and market-driven economies. From the perspective of the tensions between old and new tasks of the university, it is useful to look back at the turning point in its history. (shrink)

The article provides an analysis of the European Court of Human Rights judgments in the case of Lautsi v. Italy (application no. 30814/06), also known as the Italian crucifix case. The applicant claimed that displaying crucifixes in the Italian State-school classrooms attended by her children was contrary to the principle of secularism, by which she wished to bring up her children, and therefore infringed her right to ensure their education and teaching in conformity with her religious and philosophical convictions, and (...) also breached her freedom of conviction and religion, as protected by Article 9 of the Convention. In its judgment of November 3, 2009, the seven-judge Chamber declared that there had been a violation of Article 2 (right to education) of Protocol No. 1 of the European Convention on Human Rights taken together with Article 9 (freedom of thought, conscience, and religion) of the Convention. The judgment was given unanimously and none of the judges appended a separate opinion. The Italian Government asked for the case to be referred to the Grand Chamber by virtue of Article 43 of the Convention. In the judgment of the Grand Chamber, delivered on March 18, 2011, the Court held, by fifteen votes to two (and with separate opinions of six judges), that there had been no violation of Protocol No. 1 and no violation of the Convention itself. The analysis in the article is focused on selected principal factors determining the Court's decision. It shows that the proposal for the Court to recognize secular convictions as those protected by Article 2 of Protocol No. 1 or Article 9 of the Convention has no sufficient basis in the Convention itself and in earlier Court's case-law and, even, may be considered as promotion of religious intolerance, threatening the freedom to publicly manifest a religion or belief, as guaranteed by Article 9 of the Convention. -/- Opracowanie zawiera analizę wyroków Europejskiego Trybunału, które zapadły w sprawie Soile Lautsi (app. 30814/06), zwaną „włoska sprawa krzyża” (Italian Crucifix Case). W sprawie tej skarżąca zarzucała, że okazywanie znaku krzyża w klasach włoskich szkół państwowych, do których uczęszczały jej dzieci, jest sprzeczne z zasadą sekularyzmu, zgodnie z którą chciała ona wychować swoje dzieci i dlatego stanowi naruszenie jej prawa do wychowania i nauczania zgodnego z jej religijnymi i filozoficznymi (moralnymi) przekonaniami, oraz stanowi naruszenie wolności religijnej, gwarantowanej art. 9 Konwencji. W wyroku siedmioosobowej izby ogłoszonym 3 listopada 2009 r. izba uznała naruszenie art. 2 (Prawo do nauki) Protokołu dodatkowego nr 1 do Konwencji o ochronie praw człowieka i podstawowych wolności w powiązaniu z art. 9 (Wolność myśli, sumienia i wyznania) Konwencji. Wyrok zapadł jednomyślnie i żaden z sędziów nie dołączył do wyroku swoich uwag. Rząd Włoch złożył wniosek w trybie przewidzianym art. 43 Konwencji o przekazanie sprawy do Wielkiej Izby. W wyroku Wielkiej Izby ogłoszonym 18 marca 2011 r. Trybunał uznał zdecydowaną większością głosów – 15 za wobec 2 przeciw (sześciu sędziów dołączyło swoje uwagi), że nie doszło do naruszenia ani Protokołu nr 1, ani samej Konwencji. Analizy koncentrują się na wybranych zagadnieniach, kluczowych dla argumentacji Trybunału. Analizy te pokazują, że postulowanie przez izbę uznania za prawo podmiotowe radykalnie pojętej negatywnej wolności religijnej, oraz postulowanie - tak przez izbę, jak i przez Wielką Izbę - ochrony przekonań sekularystycznych jako przekonań chronionych art. 2 Protokołu dodatkowego nr 1 lub art. 9 Konwencji, nie posiada należytego uzasadnienia ani w samej Konwencji, ani w dotychczasowym orzecznictwie Trybunału, a co więcej – może być uznane za propagowanie nietolerancji religijnej, godzącej przede wszystkim chronioną art. 9 Konwencji wolność publicznego uzewnętrzniania przekonań religijnych i filozoficznych. This paper concerns an important and exciting book by Marek Dobrzeniecki Ukrytość i Wcielenie. Teistyczna odpowiedź na argument Johna L. Schellenberga za nieistnieniem Boga [Hiddenness and the Incarnation: A Theistic Response to John L. Schellenberg’s Argument for Divine Nonexistence]. After a brief discussion of the content of the book’s chapters, critical remarks are presented. They concern the adopted method and approach to Schellenberg’s philosophy in general and the argument from hiddenness in particular. The conceptual framework serving as a typologization (...) of the propositional dimension of the phenomenon of theistic belief/faith is dubious and requires in-depth research. It is worth considering the possibility of asymmetry of the attitudes of belief/faith and unbelief, which requires consideration in the reasoning whose legitimacy would assume the transfer of features from one to the other and the negation functor. Regarding the voluntarism of belief in God, the paper suggests that extreme, purely intellectual, and purely volitional positions should be considered, as well as moderate and mixed ones. It is argued extensively that Dobrzeniecki’s criticism against the arguments of Rea and Mourad is not conclusive. Just the possibility of voluntariness of disbelief undermines the validity of Schellenberg’s argument and should therefore be ruled out as much as possible. The paper suggests supplementing Dobrzeniecki’s approach with a ‘trans-paradigmatic’ approach consisting of external criticism, which, in the light of Schellenberg’s arguments being probably incompatible with the described phenomenon of religious belief in God, leads to a modification of the theoretical apparatus of Schellenberg’s paradigm. Such a modification deprives the latter’s argument of justification. --- Niniejszy artykuł dotyczy ważnej i interesującej książki Marka Dobrzenieckiego Ukrytość i Wcielenie. Teistyczna odpowiedź na argument Johna L. Schellenberga za nieistnieniem Boga. Po krótkim omówieniu zawartości poszczególnych rozdziałów książki prezentuję swoje uwagi krytyczne. Dotyczą one przyjętej metody i podejścia do filozofii Schellenberga w ogólności, a argumentu z ukrytości w szczególności. Wątpliwa i wymagająca pogłębionego badania jest siatka pojęciowa pełniąca funkcję typologizacji propozycjonalnego wymiaru fenomenu wiary teistycznej. Warta rozważania jest możliwość niesymetryczności postaw wiary i niewiary, co wymaga uwzględnienia w rozumowaniach, których zasadność zakładałaby przenoszenie cech z jednej na drugą oraz funktora negacji. W sprawie woluntaryzmu wiary w Boga sugeruję, że należy rozpatrywać nie tylko stanowiska skrajne, czysto intelektualistyczne i czysto wolicjonalne, ale także u miarkowane i mieszane. Argumentuję szeroko, że krytyka Dobrzenieckiego skierowana przeciwko argumentom Rea i Mourada nie jest konkluzywna. Argumentuję, że samo możliwość woluntarności niewiary podważa zasadność argumentu Schellenberga i dlatego powinna ona być wykluczona w sposób maksymalnie możliwie uzasadniony. Sugeruję uzupełnienie podejścia Dobrzenieckiego o podejście ‘transparadygmatyczne’ polegające na rodzaju krytyki zewnętrznej, która w świetle nieprzystawania argumentacji Schellenberga do opisywanego fenomenu prowadzi do modyfikacji aparatu teoretycznego paradygmatu Schellenberga. Taka modyfikacja odbiera argumentowi tego ostatniego moc uzasadniającą. (shrink)

Clinical Ethics Consultations are an important tool for physicians in solving difficult cases. They are extremely common in North America and to a lesser extent also present in Europe. However, there is little data on this practice in Poland. We present results of a survey of 521 physicians practising in Poland concerning their opinion on CECs and related practices. We analysed the data looking at such issues as CECs’ perceived availability, use of CECs, and perceived usefulness of such support. Physicians (...) in our study generally encounter hard ethics cases, even—surprisingly—those who do not work in hospitals. Most physicians have no CEC access, and those that do still do not employ CECs. However, physicians perceive this form of support as useful—even more so among actual users of CECs. We compared these findings with similar studies from other European countries and the North America. We point out peculiarities of our results as compared to those in other countries, with some possible explanations. We hope the results may encourage regulatory debate on the need to formally introduce CECs into the Polish healthcare system. (shrink)

The Issues of God’s Omnipotence – Things New and Old -/- The purpose of this paper is to shortly introduce into the philosophical issues of omnipotence in the history of philosophy and philosophically oriented theology, and to show how the articles included in the special issue on God’s power fits with it. There are three main subjects of debate on the power of God (gods). First, how to precisely define omnipotence, in philosophically as well as theologically adequate way, by using (...) correct terms. This task has two sides, semiotic and the corresponding metaphysical one – how should we correctly understand the very nature of God’s power. The second topic, or rather set of topics is to map the scope of omnipotence up and delineate its limits. And the last, third subject concerning omnipotence is to establish the relation of omnipotence to others attributes as well as to the God’s nature as such. All the issues are placed in the context of historical and actual debates. The paper distinguish with some detail different subtopics connected with each main issues. The problem of correct, adequate main term used in definiens of God’s power definition and task to detect paradoxes of omnipotence, to find it’s sources, and remove them, if it is possible are connected with first. It includes the task of distinguishing of different kinds of God’s power. In the second group of topics the paper lists nine different questions concerning the scope and limits of power of God, for example some connected with the ways of acting of God in the world, the relations between power of God and human freedom, God’s omnipotence and evil, with possibility of creating of different world or world with different value status or even with different moral laws. One of this paper task is to show the importance and actuality of issues of omnipotence of God, so the topics of nineteen of papers included in this special issue of “Filo-Sofija” are presented in their proper, historical and actual, context. In the article I discuss functionalist interpretations of Husserlian phenomenology. The first one was coined in the discussion between Hubert Dreyfus and Ronald McIntyre. They argue that Husserl’s phenomenology shares similarities with computational functionalism, and the key similarity is between the concept of noema and the concept of mental representation. I show the weaknesses of that reading and argue that there is another available functionalist reading of Husserlian phenomenology. I propose to shift perspective and approach the relation between phenomenology and (...) functionalism from a methodological perspective, specifically taking into account the functionalist explanatory strategy called functional analysis. I discuss the notion of function in Husserl’s works and Husserl’s idea of functional phenomenology. The key argument I develop is that in functional phenomenology we can find an explanatory strategy which is analogous to the strategy of functional decomposition used in functional analysis. I conclude that the proposed functionalist reading of phenomenology opens a new approach to the integration of phenomenology with cognitive sciences. (shrink)

W niniejszym opracowaniu zamierzam zwrócić uwagę na powiązanie roszczenia uniwersalności z potrzebą dostosowywania formułowanych standardów do odmiennych i zmiennych warunków życia, a następnie zidentyfikować rozstrzygnięcia filozoficzne skorelowane z uznaniem takiego powiązania. Akcent zamierzam przy tym położyć na problematykę metaaksjologiczną, dotyczącą nie tyle tego, jakie wartości zostały uznane, ale tego, jak uznane wartości są ugruntowane, co nie jest bez znaczenia dla określenia sposobów ich poznawania i ustalania. Rozstrzygnięcia te, jako zawarte m. in. w artykule 1, okazują się jednocześnie należeć do przyjętych (...) w Deklaracji fundamentalnych rozstrzygnięć filozoficznych w ogóle. (shrink)

An important argument in favour of recognising the cultural relativism and against universality of dignity and human rights, is the claim that the concept of dignity is a genuinely modern one. An analysis of a passage from the Demiurge’s speech in Timaeus reveals that Plato devoted time to reflecting on the question of what determines the qualitative difference between certain beings (gods and human being) and the world of things, and what forms the basis for the special treatment of these (...) beings – issues that using the language of today can be described reasonably as dignity. The attributes of this form of dignity seem to overlap with the nature of dignity as we know it today. Moreover, Plato proposes a response both to the question of what dignity is like, as well as the question of what dignity is. It is existential perfection, rooted in a perfect manner of existence, based on a specific internal unity of being. Dignity is therefore primordial in regard to particular features and independent of their acquisition or loss. Plato’s approach allows him to postulate that people be treated as ends in themselves; an approach therefore that prohibits the treatment of people as objects. Both the state and law are ultimately subordinated to the good of the individual, rather than the individual to the good of the state. -/- Istotny argument na rzecz relatywizmu kulturowego i przeciwko powszechności godności i wynikających z niej praw człowieka, oparty jest na poglądzie, że godność uznana została dopiero w czasach nowożytnych. Analiza fragmentu mowy Demiurga z Platońskiego dialogu Timajos ujawnia, że Platon rozwinął refleksję nad czymś, co stanowi o jakościowej różnicy między pewnymi istotami (bogami i ludźmi) a światem rzeczy, i co jest podstawą szczególnego traktowania tych istot, a co językiem współczesnym zasadnie można określić jako godność. Zbieżna jest charakterystyka tej godności z charakterystyką przyjmowaną współcześnie. Co więcej, Platon daje propozycję odpowiedzi nie tylko na pytanie, jaka jest godność, ale także na pytanie, czym jest godność. Jest ona doskonałością egzystencjalną, ugruntowanym w szczególnie doskonałym sposobie istnienia, opartym na szczególnej wewnętrznej jedności bytu. Jako doskonałość istnienia ogarnia ona cały byt, wszystkie jego cechy; jest nieoddzielalna od bytu (jest przyrodzona i niezbywalna). Jako pierwotna wobec partykularnych cech, jest niezależna od ich nabywania lub utraty. Platońskie ujęcie pozwala w oparciu o ujęcie godności formułować postulaty zbieżne z formułowanymi dziś dyrektywami nakazującymi traktować osoby jako cele same w sobie i zakazującymi traktowania osób w sposób czysto instrumentalny, przedmiotowy. Okazuje się, że – zdaniem Platona – jednostki nie wolno traktować czysto instrumentalnie dla dobra państwa; zarówno państwo, jak i prawo są podporządkowane dobru jednostki. (shrink)

Eric Olson and David Shoemaker argue that our numerical identity over time is irrelevant to such practical issues as moral responsibility or self-concern. Being the same individual at different moments in time may, in our case, can be seen as the preservation of the relevant biological processes (e.g., according to Olson), while psychological continuity, independent of these processes, may be crucial for such issues. I will defend the view that, contrary to the above authors, any conception of our diachronic identity (...) has ethical implications, at least with regard to the aforementioned issues. My argument has two basic assumptions. (1) The dispute over identity of persons is a dispute over the conditions of our persistence in time as the same individuals, whether we consider being a person as our essential property or not (e.g., Olson maintains the latter). The question is under what conditions I am the same as a particular earlier or later individual. (2) The pronoun “I,” on the other hand, is an essential component of practical reasoning, so also of ethical one. Thus, the debate on the persistence of persons concerns the identity conditions of the individuals to whom/which we refer when planning our future actions, formulating our intentions. My rational self-concern or my moral responsibility for past actions regards the individual to whom the pronoun refers. An additional result of my argument is to undermine the influential strategy of defending positions on our diachronic identity against the charge of controversial ethical implications. It cannot be argued in the case of every such controversy that a given ethical issue only apparently involves our identity, while in fact what is relevant to it is a different relation binding persons at different moments in time. According to The Consensus Gentium Argument from the premise: “Everyone believes that God exists” one can conclude that God does exist. In my paper I analyze two ways of defending the claim that somebody’s belief in God is a prima facie reason to believe. Kelly takes the fact of the commonness of the belief in God as a datum to explain and argues that the best explanation has to indicate the truthfulness of the theistic belief. Trinkaus Zagzebski grounds her defence (...) on rationality of epistemic trust in others. In the paper I argue that the second line of reasoning is more promising and I propose its improved version. This chapter outlines an embodied conception of noise. From an enactive and ecological perspective noise is an inevitable complement to the richness of bodily sensitivities and complex actions. The world around us, the universe, is replete, full of inexhaustible texture available to be explored at every scale at which we are capable, or can become capable, of making distinctions. Drawing on work in ecological psychology I suggest that noise is our experience of that encompassing fullness, and can be encountered in (...) a number of different ways depending on the organisation of our bodies and activities at different scales across a given period. While that fullness can be overwhelming, and create challenges for us to distinguish and coordinate effectively with the particular aspects of the world most relevant to our present concerns - noise can be intrusive and disruptive - I argue that there are significant positive aspects to the phenomenon. Noise is an inherent part of the rich messiness of the world as discussed in recent enactive work, which provides both robustness to developmental processes as well as opportunities for action that support adaptive agency. In a noisy, messy world there are always more options available to explore. (shrink)

Tekst dotyczy zaproponowanej przez Arthura Kaufmanna koncepcji prawa do sprzeciwu (wobec władzy - wobec niesprawiedliwych ustaw) "w drobnej monecie". Koncepcja ta stanowi punkt wyjścia do refleksji nad formułą Radbrucha (nad czymś, co określam mianem "ciemnej strony" formuły Radbrucha), nad możliwością modyfikacji tej formuły i nad rozproszoną kontrolą konstytucyjności jako sposobem realizacji prawa do sprzeciwu "w drobnej monecie".

Choć samo zjawisko wykluczenia społecznego nie jest nowe, to jego waga, zwłaszcza w perspektywie praw człowieka, została doceniona stosunkowo niedawno. „Wykluczenie społeczne” nie jest kategorią konstytucyjną. Celem opracowania jest ogólne usytuowanie problematyki wykluczenia w kontekście zagadnień konstytucyjnych. Zmierza się do dookreślenia, czym jest wykluczenie społeczne oraz do wskazania zasadniczych konstytucyjnych punktów odniesienia, pozwalających na podjęcie tego problemu. Właściwe wykluczeniu społecznemu jest złożoność przyczyn - sam brak środków finansowych nie musi prowadzić do wykluczenia, choć proces wykluczania może być zainicjowany jednym wydarzeniem. (...) Jednak wykluczenia nie można adekwatnie scharakteryzować jedynie poprzez jego przyczyny. Wielowymiarowość dotyczy także przejawów wykluczenia. O wykluczeniu społecznym w sensie właściwym mówi się wówczas, gdy ograniczenia dotyczą jednocześnie wielu sfer życia społecznego. Chodzi przy tym o sfery fundamentalne, istotne . Charakterystyczne dla wykluczenia jest dłuższe trwanie w czasie. Często ma wymiar przestrzenny – procesy wykluczania prowadzą do wyodrębnienia obszarów, enklaw zamieszkanych przez wykluczanych, co jeszcze bardziej utrwala stan wykluczenia. Procesy wykluczania prowadzą niekiedy do zjawiska zwanego dziedziczeniem biedy czy wykluczenia. Ochrona przed wykluczeniem, wolność od niego, została uznana za prawo człowieka; prawo niesprowadzalne do tradycyjnie formułowanych praw gospodarczych, socjalnych i kulturalnych; mimo że wykluczenie społeczne dotyczy przede wszystkim udziału w życiu gospodarczym, społecznym i kulturalnym. Wykluczenie jest powiązane z naruszeniem zasady równości, jednak nie daje się ująć jedynie w perspektywie tej zasady, przy czym w szeregu istotnych punktów różni się od dyskryminacji w korzystaniu z praw człowieka. Poszukując w Konstytucji RP, w której brak jest kategorii „wykluczenia społecznego” zasadniczych punktów odniesienia należy poszukiwać w zasadzie godności z art. 30 oraz – w stosunku do obywateli – w art. 1. Jako pomocnicze punkty odniesienia można wskazać zasady sprawiedliwości społecznej, solidarności oraz równości, a także konstytucyjny katalog wolności i praw, przede wszystkim wolności i praw ekonomicznych, socjalnych i kulturalnych. This book is the first comprehensive study of Plato’s conception of justice. The universality of human rights and the universality of human dignity, which is recognised as their source, are among the crucial philosophical problems in modern-day legal orders and in contemporary culture in general. If dignity is genuinely universal, then human beings also possessed it in ancient times. Plato not only perceived human dignity, but a recognition of dignity is also visible in his conception of justice, which forms the (...) core of his philosophy. Plato’s Republic is consistently interpreted here as a treatise on justice, relating to an individual and not to the state. The abstract Everyone who gets to know deeper with the Nietzsche philosophy is forced to think about a mutual relationship of a culture and a biology. The main problem to correct show of above relationships is the understanding of the meaning of a language with reference to the culture and the biology. Considerations which are represented here are inspired by the Nietzsche philosophy. They are split by three parts. In the first part there is shown the meaning of the language (...) to create the herd in the Nietzsche philosophy. The second part develops his qualification of the language as a shortening of communication. The final part tries to refer the functioning of the language to the sphere of a biological human being. As I think, only the biological perspective permits to overstep the rhetoric of the individualism expressed in the Nietzsche philosophy by the opposition among weak and strong, or else among a priest and a superman. Thanks to drawn consequence from accepted by Nietzsche of the reduction my to the animal sort we are forced to the reversal of the perspective of his thought. The herd is not a centre to create the superman as the aim of the all mankind, but the sense of the exceptionality of an each subject is a centre to a fixation of the reproduction of the genetic definite population. In the last two decades, major cities in Malaysia have witnessed a spate of urban redevelopment including commercial and retail complexes, and residential estates. The current urban transformations taking place in Malaysian cities are mainly market-driven and characterized by fast-track development with a strong priority on the road infrastructure. This is a typical example of an intensive property-led development that is becoming a central driver of the national economy. This article provides a deeper understanding of the complexity of urban development (...) in Malaysia. Here, the major aim is to understand the Malaysian cities' transitions in the trajectory of their colonial past, national identity, multi-cultural community, culture, and religion. Focusing on South East Asian urbanism, this article determines how internal and external forces and global trends such as neoliberalism and property-led development affect the transformation of urban landscapes and expansions in Malaysia. The outcomes of this paper will indicate how much property-led development and globalisation have affected the traditional and tropical climate-responsive urban environment in Malaysia. It will also identify sustainable design and planning measures that should be implemented in the cities of Malaysia to combat the ill-effects of globalisation. (shrink)

"Philosophical Foundations of Understanding of the Common Good". The central question is whether recognizing the common good as the central value in the new Polish Constitution of 1997, means accepting the primacy of the state over an individual. The answer is negative. The preparatory work to the constitution is analyzed and the philosophical perspective is outlined which corresponds to the intentions of the authors of the constitution. The analyses concentrate on the philosophical tradition reaching from Plato to Aristotle and Thomas (...) Aquinas. /////////////////// W nowej Konstytucji Rzeczypospolitej Polskiej przyjętej w 1997 roku, dobro wspólne jest jedną z fundamentalnych wartości. Centralne pytanie brzmi, czy uznanie dobra wspólnego za wartość fundamentalną, nie jest uznaniem prymatu państwa wobec jednostki, czy nie wprowadza do porządku konstytucyjnego idei totalitarystycznych. Odpowiedź na to pytanie jest negatywna. Argumentując, autor dokonuje analizy prac przygotowawczych do Konstytucji, oraz zmierza do zarysowania filozoficznej perspektywy rozumienia dobra wspólnego, perspektywy odpowiadającej intencjom twórców Konstytucji. W analizach położony jest akcent na filozoficzną tradycję refleksji nad dobrem wspólnym sięgającą od Platona poprzez Arystotelesa do Tomasza z Akwinu. -/- . (shrink)

Jest to dla jego twórczości fakt o fundamentalnym znaczeniu. Poeta przejmuje od Chasydów centralną kategorię, jaką jest "samotność". Wokół tego pojęcia rozwija się jego poetyka.

The aim of this article is to introduce the work of Leopold Blaustein — philosopher and psychologist, who studied under Kazimierz Twardowski in Lvov and under Husserl in Freiburg im Breisgau. In his short academic career Blaustein developed an original philosophy that drew upon both phenomenology and Twardowski’s analytical approach. One of his main publications concerns Husserl’s early theory of intentional act and object, introduced in Logische Untersuchungen. In the first part of the article I briefly present Blaustein’s biography and (...) some general features of his philosophy. The second part provides an overview of Blaustein’s dissertation concerning Husserl’s early phenomenology. In the third and final part I summarize Blaustein’s research, including the critical remarks of Roman Ingarden. (shrink)

The paper links higher education reforms and welfare states reforms in postcommunist Central European countries. It links current higher education debates (and reform pressures) and public sector debates (and reform pressures), stressing the importance of communist-era legacies in both areas. It refers to existing typologies of both higher education governance and welfare state regimes and concludes that the lack of the inclusion of Central Europe in any of them is a serious theoretical drawback in comparative social research. The region should (...) still, after more than two decades of transition and heavy international policy advising, be viewed as a “laboratory of social experimentation”. It is still too risky to suggest generalizations about how Central European higher education and welfare systems fit existing typologies. Consequently, the “transition” period is by no means over: it is over in terms of politics and economics but not in terms of social arrangements. Both higher education and welfare states should be viewed as “work in progress”: permanently under reform pressures, and with unclear future. (shrink)

This study aims to identify various meanings of the expression (name) “dignity”, with particular emphasis on the meanings of this expression as it appears in the text of the Constitution of the Republic of Poland. The meaning of the name “dignity” is the concept of dignity; in turn, the different concepts of dignity encompass dignity of particular types. Twelve different meanings of the expression “dignity” are indicated – twelve different concepts of dignity, and thus twelve types of dignity. Half of (...) them are meanings (concepts) that recognize dignity as something belonging to a human being as a subject of law. They were considered in the essay Godność jako właściwość osoby. Typy godności – propozycja systematyzacji [Dignity as a Quality of Person – a Proposed Systematisation]. This group of meanings includes three concepts of dignity which recognize dignity as something constitutive of being a person: (1) inherent dignity of the person, (2) dignity established by qualities specific to a thinking being, and (3) dignity as a historically emergent social status of all human beings. The second group of meanings, treating dignity as something with which the human being (the person) is endowed, includes concepts which encompass (4) personal dignity (honour and good reputation), (5) dignity as moral excellence, and (6) dignity as appropriateness of attitude or behaviour. -/- Dignity as an attribute of collective entities and dignity as an institutionally grounded attribute are a subject of this paper. The Constitution of the Republic of Poland speaks of (1) the dignity of the Nation, (2) the dignity of office or function, and (3) public dignity. The expression “the dignity of the Nation” can be understood in four different ways: (i) analogously to the understanding of dignity of the person, (ii) of personal dignity, (iii) of dignity as moral excellence, and (iv) of dignity as appropriateness of attitude or behaviour. The expression “dignity” when designating something institutionally grounded can designate (4) the dignity of social roles, (5) the dignity of a profession, and – specifically to the Polish language – (6) dignity meaning a surname. -/- The author argues that it is unacceptable to ascribe different concepts of dignity to the expression “dignity” appearing in a specific legal provision. The study aims at making explicit the three spheres or planes, essential from the point of view of semiotics, on which the discourse regarding dignity takes place, and at clarifying the relations between these planes. The analysis uses the conception of Kazimierz Ajdukiewicz. There are three principal areas in which the discourse on dignity is conducted – the plane of linguistic expressions on which the name “dignity” is used; the plane of meanings on which the notion of dignity is placed; (...) and the plane of objects on which there is dignity itself. There is a relationship of meaning between the different concepts of dignity and the expression “dignity”, a relationship of signification between expression “dignity” and dignity as its referent, and a relationship of apprehension between the concepts of dignity and their referents. Der Artikel bildet eine Übersicht der Artikelfragmente über das ‚Litzmannstadt-Getto‘ aus ausgewählten Zeitschriften des Dritten Reiches, wie Litzmannstädter Zeitung, Dresdener Nachrichten oder Schlesische Tageszeitung. Charakteristische Sprache dieser Texte stammt aus dem Feder solcher Journalisten wie Wolfgang Bergemann oder Otto Heike.

In contemporary positive law there are legal institutions, such as conscientious objection in the context of military service or “conscience clauses” in medical law, which for the sake of respect for judgments of conscience aim at restricting legal obligations. Such restrictions are postulated to protect human freedom in general. On the basis of Thomas Aquinas’ philosophy, it shall be argued that human dignity, understood as the existential perfection of a human being based on special unity, provides a foundation for imposing (...) limitations on the scope of legal obligations in general. Human freedom plays a crucial role in understanding dignity as perfection based on the special individuality of a personal being, which in turn is based on the free choice to pursue a unique way of life. Therefore, Aquinas’ argumentation is, at its core, liberal – the perfection rather than the imperfection of a human being underlies the requirement to limit legal obligations. Dignity understood as the special unity of a person also provides the basis for limiting obligations in the case of conscientious objection; however, in that case, such limitations aim at safeguarding internal integrity rather than the individualisation of a given way of life. _This project was financed with funds from the National Science Centre allocated on the basis of the decision number DEC-2013/09/B/HS5/04232._. Thought experiments are frequently vague and obscure hypothetical scenarios that are difficult to assess. The paper proposes a simple model of thought experiments. In the first part, I introduce two contemporary frameworks for thought experiment analysis: an experimentalist approach that relies on similarities between real and thought experiment, and a reasonist approach focusing on the answers provided by thought experimenting. Further, I articulate a minimalist approach in which thought experiment is considered strictly as doxastic mechanism based on imagination. I introduce (...) the basic analytical tool that allows us to differentiate an experimental core from an attached argumentation. The last section is reserved for discussion. I address several possible questions concerning adequacy of minimalistic definition and analysis. (shrink)

Za „ojca” filozoficznej kategorii „godności”, która legła u podstaw kategorii prawnej, uznawany jest powszechnie Immanuel Kant. Przypomnieć jednak trzeba, że w bardzo podobny sposób, choć w zasadniczo odmiennym kontekście systemowym, charakteryzował godność Tomasz z Akwinu, pół tysiąca lat wcześniej, uznając ją za fundament bycia osobą. Stąd najistotniejszym i centralnym elementem, tytułowej, klasycznej koncepcji człowieka jest koncepcja godności. Akwinata jest autorem bodaj najbardziej rozbudowanej koncepcji osoby w tradycji filozofii klasycznej. Co więcej zmierzać będę do wykazania, że jego koncepcja lepiej nadaje się (...) do teoretycznego ugruntowania praw człowieka niż koncepcja Kanta. Rekonstruując propozycję Kanta ograniczam się, zasadniczo rzecz biorąc, do analizy Uzasadnienia metafizyki moralności. Interesować będą mnie zagadnienia podstawowe, przede wszystkim – wynikające z różnicy kontekstów systemowych – różnice w pojmowaniu bycia celem samym w sobie. W perspektywie ontologicznej koncentrować się będę na powiązaniu godności z indywidualnością; w perspektywie antropologicznej – na tym, jakiego typu działania stanowią o doskonałości człowieka, jakie działania (czym określone) realizują człowieka jako cel sam w sobie. W szczególności interesować się będę miejscem rozumu i woli w określaniu treści działań (w perspektywie kantowskiej będzie to pytanie o określenie treści powinności; w perspektywie Tomasza – pytanie o treść realizowanego dobra). Zasadnicze pytanie, które leży u podłoża podjętej problematyki antropologicznej, jest pytaniem o to, na ile dla pojmowania godności istotne jest uznanie woli jako w sposób wolny współokreślającej treść powinności (Kant) lub dobra (Akwinata), a na ile woli jedynie podążającej za poznaną powinnością lub poznanym dobrem. Zmierzać będę do uzasadnienia tezy, że koncepcja Akwinaty w ugruntowaniu godności akcentuje wprost indywidualność opartą na wyborze czegoś, co nie jest jednoznacznie treściowo obiektywnie zdeterminowane i co wykracza poza to, co powszechne, poza to, co gatunkowe; natomiast koncepcja Kanta godność wiąże przede wszystkim z tym, co powszechne, gatunkowe i zapoznaje doniosłość indywidualności dla pojmowania godności. Problem of Axiological Legitimization of the Universal System of the Protection of Human Rights Summary In this paper it is argued that legitimization of the universal system (UN-system) of the protection of human rights depends primary not from the content of values recognised as fundamental but rather from metaaxiological solutions related to the way of existence and to the possibility of cognition of these values. Legitimisation is based on the recognition of an objective nature and of cognoscibility of basic values. (...) Realisation of the primary aim of this paper is linked to the problem of different meanings of the notion of universality, used in the context of the universal system of the protection of human rights. First, descriptive and normative (prescriptive) meanings have to be distinguished. In the case of normative sense, there are moral and legal meanings of “universality”. An axiological justification of the universality of human rights in the legal sense leads to the legitimisation of the universal system. It is shown that modifications of – broadly accepted in the Polish theory of law – definitions of an axiological justification of legal norms are needed. These definitions base such a justification on the valuations made by particular groups of subjects. It is argued that it is much more convenient to refer to valuations understood as meanings of sentences of certain kind. -/- Streszczenie W artykule zmierza się do uzasadnienia tezy, że legitymizacja uniwersalnego systemu ochrony praw człowieka jest oparta nie tyle na treści wartości uznawanych w tym systemie, ale na uznanych w nich rozstrzygnięciach metaaksjologicznych, dotyczących tego, jak istnieją wartości podstawowe dla tego systemu i czy są one poznawalne. Walor legitymizacyjny posiada przede wszystkim uznanie obiektywnego charakteru tych wartości i ich poznawalności (uznanie kognitywizmu aksjologicznego). Realizacja zasadniczego celu zakłada uporządkowanie podstawowych pojęć dotyczących problematyki powszechności praw człowieka – termin „powszechność” stosowany w odniesieniu do praw człowieka w kontekście uniwersalnego systemu ochrony ma wiele znaczeń. Przede wszystkim odróżnić trzeba powszechność w aspekcie opisowym i w aspekcie normatywnym. W przypadku powszechności w aspekcie normatywnym w grę może wchodzić powszechność w sensie ideowym (moralnym) i powszechność w sensie pozytywnoprawnym. Uzasadnienie tej ostatniej jest też uzasadnieniem poszukiwanej tu legitymizacji uniwersalnego systemu ochrony praw człowieka. Prowadzone analizy prowadza także do sformułowania postulatów dotyczących sposobu definiowania uzasadnienia aksjologicznego norm prawnych. Modyfikacji wymagają powszechnie przyjmowane w polskiej teorii prawa definicje relatywizujące takie uzasadnienie do ocen przyjmowanych przez konkretne podmioty oceniające lub ich grupy. (shrink)

Philosophizing and the True Knowledge of Human Being -/- The article presents the principles and method of classical philosophy. This kind of philosophy, developed mainly in ancient and medieval times, is still viable and interesting today. What is more important, it can be used as grounds for academic philosophy. Doing so provides a philosopher with resources for autonomy in her philosophical inquiry as well as the usefulness and application of its results for various cultural, social, and political tasks. The last (...) part of the article explains the manner in which the principles of philosophy may be connected with different ways of classical philosopher’s concern the with knowledge of the human being understood as a special, unique being, with her transcendence behind her biological nature and human society. In the conclusion, several tasks for philosophical reflection are given. In all its parts, the article emphasizes the importance of the concept of philosophizing person for the understanding of philosophy. (shrink)

Opracowanie dotyczy relacji konstytucyjnego pojęcia „dobro wspólne” z art. 1 Konstytucji RP, do pozaprawnych pojęć dobra wspólnego. Bezpośredni asumpt do jego przygotowania dało zdanie odrębne sędziego Trybunału Konstytucyjnego Zbigniewa Cieślaka do wyroku TK z dnia 20 kwietnia 2011 r. w sprawie Kp 7/09, dotyczącej zmian w prawie budowlanym. Jest to w ogóle najobszerniejsza wypowiedź w całym dotychczasowym orzecznictwie TK poświęcona wprost problematyce dobra wspólnego. Sędzia Z. Cieślak wyraźnie odróżnił prawne pojęcie dobra wspólnego – jego zdaniem właściwe dla interpretacji klauzuli dobra (...) wspólnego z art. 1 Konstytucji RP z 1997 r. – od pojęć pozaprawnych, uznając te ostatnie za źródło nieporozumień w prawniczych dyskusjach na temat rozumienia wyrażenia „dobro wspólne” w prawie i jako kategorii konstytucyjnej. Argumentować będę, że zrekonstruowane przez Z. Cieślaka prawne pojęcie dobra wspólnego nie nadaje się do interpretacji klauzuli dobra wspólnego z art. 1 konstytucji z 1997 r., i że pojęcia pozaprawne powinny być postrzegane nie jako źródło nieporozumień, ale jako nieodzowna pomoc w ustalaniu treści konstytucyjnego pojęcia dobra wspólnego. Problematyka ta prowadzi do podjęcia pewnego – kluczowego dla stosowania art. 1 – zagadnienia relacji między dobrem wspólnym a prawami człowieka (wolnościami i prawami człowieka), zagadnienia, które ostro zarysowało się w orzecznictwie trybunalskim po raz pierwszy właśnie w tym zdaniu odrębnym. Chodzi mianowicie o związki zachodzące między dwoma zasadniczymi tradycjami pojmowania dobra wspólnego i odpowiadającymi tym tradycjom dwoma typami pojęć dobra wspólnego – tradycji klasycznej, znajdującej swój wyraz w Konstytucji 3 maja z 1791 r., i tradycji, w której dobro wspólne pojmowane jest przede wszystkim jako dobro państwa i która znalazła wyraz w konstytucji kwietniowej z 1935 r. Dla pierwszej tradycji charakterystyczne jest uznanie praw człowieka za zasadniczy element dobra wspólnego – i tę tezę Z. Cieślak akceptuje. Analiza jego propozycji pokazuje jednak, że należy ona do tradycji konstytucji kwietniowej, a przyjęcie pojęcia dobra wspólnego należącego do tej tradycji prowadziłoby do niespójności z niektórymi fundamentalnymi rozstrzygnięciami ustrojodawcy, dotyczącymi tak interpretacji art. 1 konstytucji i przyjętej w nim koncepcji dobra wspólnego, jak i konstytucyjnej koncepcji wolności i praw człowieka. Idea powszechności legła u samych podstaw współczesnej ochrony praw człowieka i nadal jest często podkreślana w dyskursie typu praktycznego, na różnych płaszczyznach: politycznej, moralnej czy religijnej. Jednakże trudno o koncepcję praw człowieka pozwalającą pogodzić powszechność z właściwościami prawa, z postulatami respektu dla pluralizmu ugruntowanego tak w odmienności kulturowej, jak i wolności poszczególnych jednostek ludzkich. Wziąwszy pod uwagę, że powszechność jest fundamentalnym przy¬miotem praw człowieka, kłopoty z powszechnością są kłopotami ze zbudowaniem filozoficznej koncepcji praw człowieka w ogóle. Odrzucenie powszechności jest równoznaczne (...) z odrzuceniem podstaw współczesnej koncepcji tych praw. Opracowanie zmierza do identyfikacji rozmaitych aspektów powszechności praw człowieka i do uporządkowania argumentów przytaczanych w dyskusji nad powszechnością. (shrink)

En la Constitución de la República de Polonia del 2 de abril de 19971 se reconocía el carácter objetivo de ciertos valores y un cognoscitivismo axiológico. Si tomamos las disposiciones constitucionales en serio tenemos que aceptar que algunas valoraciones morales o que algunas proferencias [utterances] valorativas pueden ser verdaderas o falsas y que nos informan acerca de una realidad objetiva. Por otro lado, en la teoría del derecho polaca y en los cursos universitarios de lógica para abogados se encuentran definiciones (...) de la justificación axiológica de las normas y de normas axiológicas (normas que poseen una justificación axiológica) que presuponen que ningún valor es objetivo y que no pueden ser conocidos — se presupone un no-cognoscitivismo axiológico. De acuerdo con el no-cognoscitivismo, ninguna valoración y ninguna proferencia valorativa puede ser verdadera o falsa, ni puede informar acerca de la realidad. This essay is an introduction to a lecture course "Elements of Descriptive Psychology" delivered by Anton Marty in around 1903/04. Marty offered courses on descriptive psychology at regular intervals in the course of his career at the University of Prague. The content of these courses follows closely the ideas of Marty’s teacher Franz Brentano, though with some interesting divergences and extrapolations. The present work is a historical and systematic introduction to an extract from notes taken of Marty’s lecture, with some (...) discussion of the work of Dilthey on similar topics, and of Marty’s influence on Franz Kafka and on the Gestalt psychologist Max Wertheimer.
