Thought experiments are frequently vague and obscure hypothetical scenarios that are difficult to assess. The paper proposes a simple model of thought experiments. In the first part, I introduce two contemporary frameworks for thought experiment analysis: an experimentalist approach that relies on similarities between real and thought experiment, and a reasonist approach focusing on the answers provided by thought experimenting. Further, I articulate a minimalist approach in which thought experiment is considered strictly as doxastic mechanism based on imagination. I introduce (...) the basic analytical tool that allows us to differentiate an experimental core from an attached argumentation. The last section is reserved for discussion. I address several possible questions concerning adequacy of minimalistic definition and analysis. (shrink)

The paper is a contribution to the debate on the epistemological status of thought experiments. I deal with the epistemological uniqueness of experiments in the sense of their irreducibility to other sources of justification. In particular, I criticize an influential argument for the irreducibility of thought experiments to general arguments. First, I introduce the radical empiricist theory of eliminativism, which considers thought experiments to be rhetorically modified arguments, uninteresting from the epistemological point of view. Second, I present objections to the (...) theory, focusing on the critique of eliminativism by Tamar Szabó Gendler based on the reconstruction of famous Galileo's Pisa experiment. I show that her reconstruction is simplistic and that more elaborate reconstruction is needed for an appropriate assessment of the epistemic power of general argument. I propose such a reconstruction and demonstrate that general version of Pisa experiment is epistemically equal to the particular one. Thus, from an epistemological perspective, Galileo's thought experiment is reducible to a straightforward argument without particular premises. (shrink)

Clinical Ethics Consultations are an important tool for physicians in solving difficult cases. They are extremely common in North America and to a lesser extent also present in Europe. However, there is little data on this practice in Poland. We present results of a survey of 521 physicians practising in Poland concerning their opinion on CECs and related practices. We analysed the data looking at such issues as CECs’ perceived availability, use of CECs, and perceived usefulness of such support. Physicians (...) in our study generally encounter hard ethics cases, even—surprisingly—those who do not work in hospitals. Most physicians have no CEC access, and those that do still do not employ CECs. However, physicians perceive this form of support as useful—even more so among actual users of CECs. We compared these findings with similar studies from other European countries and the North America. We point out peculiarities of our results as compared to those in other countries, with some possible explanations. We hope the results may encourage regulatory debate on the need to formally introduce CECs into the Polish healthcare system. (shrink)

The Issues of God’s Omnipotence – Things New and Old -/- The purpose of this paper is to shortly introduce into the philosophical issues of omnipotence in the history of philosophy and philosophically oriented theology, and to show how the articles included in the special issue on God’s power fits with it. There are three main subjects of debate on the power of God (gods). First, how to precisely define omnipotence, in philosophically as well as theologically adequate way, by using (...) correct terms. This task has two sides, semiotic and the corresponding metaphysical one – how should we correctly understand the very nature of God’s power. The second topic, or rather set of topics is to map the scope of omnipotence up and delineate its limits. And the last, third subject concerning omnipotence is to establish the relation of omnipotence to others attributes as well as to the God’s nature as such. All the issues are placed in the context of historical and actual debates. The paper distinguish with some detail different subtopics connected with each main issues. The problem of correct, adequate main term used in definiens of God’s power definition and task to detect paradoxes of omnipotence, to find it’s sources, and remove them, if it is possible are connected with first. It includes the task of distinguishing of different kinds of God’s power. In the second group of topics the paper lists nine different questions concerning the scope and limits of power of God, for example some connected with the ways of acting of God in the world, the relations between power of God and human freedom, God’s omnipotence and evil, with possibility of creating of different world or world with different value status or even with different moral laws. One of this paper task is to show the importance and actuality of issues of omnipotence of God, so the topics of nineteen of papers included in this special issue of “Filo-Sofija” are presented in their proper, historical and actual, context. The paper presents some historical (Plato, Aristotle, Plotin, Augustine, Boethius, Aquinas) and main contemporary topics about different accounts of goodness of God understood as ontological goodness, perfection and as ethical goodness - impeccability and benevolence. The arguments for goodness of God are presented, mainly from stance of Thomas Aquinas classical theism as well as arguments against compatibility of essential goodness and omnipotence (N. Pike) and being an moral agent. The article draws perspective of different philosophical issues connected with goodness of (...) God, like a problem of evil, the Euthyphro dilemma, divine command ethics and divine motivation theory. (shrink)

This study aims to identify various meanings of the expression (name) “dignity”, with particular emphasis on the meanings of this expression as it appears in the text of the Constitution of the Republic of Poland. The meaning of the name “dignity” is the concept of dignity; in turn, the different concepts of dignity encompass dignity of particular types. Twelve different meanings of the expression “dignity” are indicated – twelve different concepts of dignity, and thus twelve types of dignity. Half of (...) them are meanings (concepts) that recognize dignity as something belonging to a human being as a subject of law. They were considered in the essay Godność jako właściwość osoby. Typy godności – propozycja systematyzacji [Dignity as a Quality of Person – a Proposed Systematisation]. This group of meanings includes three concepts of dignity which recognize dignity as something constitutive of being a person: (1) inherent dignity of the person, (2) dignity established by qualities specific to a thinking being, and (3) dignity as a historically emergent social status of all human beings. The second group of meanings, treating dignity as something with which the human being (the person) is endowed, includes concepts which encompass (4) personal dignity (honour and good reputation), (5) dignity as moral excellence, and (6) dignity as appropriateness of attitude or behaviour. -/- Dignity as an attribute of collective entities and dignity as an institutionally grounded attribute are a subject of this paper. The Constitution of the Republic of Poland speaks of (1) the dignity of the Nation, (2) the dignity of office or function, and (3) public dignity. The expression “the dignity of the Nation” can be understood in four different ways: (i) analogously to the understanding of dignity of the person, (ii) of personal dignity, (iii) of dignity as moral excellence, and (iv) of dignity as appropriateness of attitude or behaviour. The expression “dignity” when designating something institutionally grounded can designate (4) the dignity of social roles, (5) the dignity of a profession, and – specifically to the Polish language – (6) dignity meaning a surname. -/- The author argues that it is unacceptable to ascribe different concepts of dignity to the expression “dignity” appearing in a specific legal provision. In the article I discuss functionalist interpretations of Husserlian phenomenology. The first one was coined in the discussion between Hubert Dreyfus and Ronald McIntyre. They argue that Husserl’s phenomenology shares similarities with computational functionalism, and the key similarity is between the concept of noema and the concept of mental representation. I show the weaknesses of that reading and argue that there is another available functionalist reading of Husserlian phenomenology. I propose to shift perspective and approach the relation between phenomenology and (...) functionalism from a methodological perspective, specifically taking into account the functionalist explanatory strategy called functional analysis. I discuss the notion of function in Husserl’s works and Husserl’s idea of functional phenomenology. The key argument I develop is that in functional phenomenology we can find an explanatory strategy which is analogous to the strategy of functional decomposition used in functional analysis. I conclude that the proposed functionalist reading of phenomenology opens a new approach to the integration of phenomenology with cognitive sciences. (shrink)

According to The Consensus Gentium Argument from the premise: “Everyone believes that God exists” one can conclude that God does exist. In my paper I analyze two ways of defending the claim that somebody’s belief in God is a prima facie reason to believe. Kelly takes the fact of the commonness of the belief in God as a datum to explain and argues that the best explanation has to indicate the truthfulness of the theistic belief. Trinkaus Zagzebski grounds her defence (...) on rationality of epistemic trust in others. In the paper I argue that the second line of reasoning is more promising and I propose its improved version. The aim of this article is to introduce the work of Leopold Blaustein — philosopher and psychologist, who studied under Kazimierz Twardowski in Lvov and under Husserl in Freiburg im Breisgau. In his short academic career Blaustein developed an original philosophy that drew upon both phenomenology and Twardowski’s analytical approach. One of his main publications concerns Husserl’s early theory of intentional act and object, introduced in Logische Untersuchungen. In the first part of the article I briefly present Blaustein’s biography and (...) some general features of his philosophy. The second part provides an overview of Blaustein’s dissertation concerning Husserl’s early phenomenology. In the third and final part I summarize Blaustein’s research, including the critical remarks of Roman Ingarden. (shrink)

Epistemological optimists about thought experiments hold that imagination could be under certain conditions source of epistemic justification. Their claim is usually based on one of three dominant conceptions about epistemic value of thought experiments. Apriorism states that imagination may serve as unique a priori source of new synthetic knowledge about the actual world. I argue against this view and show that apriorism is either too weak, or too strong or too vague. Psychologism is viable, yet not fully clear conception about (...) new meta-knowledge obtained by thought experimenting. I compare some interpretations of this position and present reasons for favorizing one of them. Conceptualism considers thought experiments as instruments for cleaning our conceptual systems. I argue that this position is in fact not about epistemic value of thought experiments, but about one specific usage of experimental result. (shrink)

Does God suffer? Some critical remarks on Dariusz Łukasiewicz’s paper ‘The suffering of God and the evil’ (Czy Bóg cierpi? Uwagi polemiczne do artykułu Dariusza Łukasiewicza 'Cierpienie Boga za zło') Author of article argues that Dariusz Łukasiewicz's criticism of Thomas G. Weinandy's book Czy Bóg cierpi?, directed towards three arguments for impassibility of God doesn't defeat Weinandy's theses. There are three reasons of that. First, Łukasiewicz criticism doesn't take into account metaphysical nature of Weinandy's arguments concerning nature of suffering and (...) God. Second, some of assumptions are attributed by Łukasiewicz to author of Does God suffer? mistakenly. Third, Łukasiewicz criticism that Weinandy's thought is too optimistic doesn't realize that philosophy cannot justify or disprove all theological theses, because many of them are beyond the reach of human reason. Article ends with some suggestions about proper use of analogy in attribution of properties to God. (shrink)

Descriptions of bodies within the literature of the enactive approach to cognitive science exhibit an interesting dialectical tension. On the one hand, a body is considered to be a unity which instantiates an identity, forming an intrinsic basis for value. On the other, a living body is in a reciprocally defining relationship with the environment, and is therefore immersed and entangled with, rather than distinct from, its environment. In this paper I examine this tension, and its implications for the enactive (...) approach, particularly the enactive conceptions of life and bodies. Following the lead of others, I argue that enactive cognitive science can benefit from a deeper reading and integration with extant work on the complexity and multiplicity of the living body within feminist philosophy and feminist science studies. The aim of this paper is to present and analyse legal acts cited in the European Parliament resolution of 20 January 2011 on the situation of Christians in the context of freedom of religion. The author presents the substance of the right to religious freedom and the position of religious freedom among other human rights. The paper also shows the formation of European law on religious freedom and grasps the development trends in this area. Because of the discrepancies that arise (...) when translating the same foreign terms into the Polish language, in order to better explain the content of the cited documents, the texts are also given in English language. The article is the summary of basic legal regulations relevant to reflect on religious freedom at EU level. Compiled materials may be useful to continue the reflection on religious freedom. (shrink)

In the last two decades, major cities in Malaysia have witnessed a spate of urban redevelopment including commercial and retail complexes, and residential estates. The current urban transformations taking place in Malaysian cities are mainly market-driven and characterized by fast-track development with a strong priority on the road infrastructure. This is a typical example of an intensive property-led development that is becoming a central driver of the national economy. This article provides a deeper understanding of the complexity of urban development (...) in Malaysia. Here, the major aim is to understand the Malaysian cities' transitions in the trajectory of their colonial past, national identity, multi-cultural community, culture, and religion. Focusing on South East Asian urbanism, this article determines how internal and external forces and global trends such as neoliberalism and property-led development affect the transformation of urban landscapes and expansions in Malaysia. The outcomes of this paper will indicate how much property-led development and globalisation have affected the traditional and tropical climate-responsive urban environment in Malaysia. It will also identify sustainable design and planning measures that should be implemented in the cities of Malaysia to combat the ill-effects of globalisation. (shrink)

Práce se zaměřuje na metodologicko-historické aspekty vývoje neurologie. V roce 2001 přišel Marcus Raichle s překvapujícím objevem, který je nyní obecně známý jako teorie Default Mode Network. DMN s sebou kromě nových poznatků o mozkové aktivitě přináší i kompletní přehodnocení dosavadních přesvědčení o mozku. Vědecká komunita předpokládala, že mozek je „reflexivním" nástrojem k vnějšímu prostředí a od tohoto přesvědčení odvíjela neurologický výzkum. DMN však přichází s pojetím neurální aktivity, jež není závislá na aktivní stimulaci mozku, což je v přímém protikladu (...) s předchozí výzkumnou tradicí. Současné výzkumy DMN vedou ke zcela novým poznatkům, které nebyly dosažitelné v rámci předchozího paradigmatu. Radikální proměna pojetí aktivity mozku s sebou přináší i nutnost přehodnocení neurologického výzkumu z hlediska metodologie. Stať se zabývá otázkou, zda lze považovat DMN za vědeckou revoluci a nové paradigma neurovědy v kontextu analýzy historických událostí, jež formovaly předchozí a stávající neurovědecký výzkum. Pierwszorzędnym przedmiotem badań są przyjęte w Karcie, wprost lub domyślnie, rozstrzygnięcia typu aksjologicznego. Przez „aksjologiczne podstawy” rozumiane są rozstrzygnięcia dotyczące uznania takich, a nie innych, wartości czy dóbr za przedmiot ochrony; a ponieważ chodzi o „podstawy”, przedmiotem zainteresowania są rozstrzygnięcia fundamentalne w takim sensie, że stanowią one uzasadnienie dla bardziej szczegółowych rozstrzygnięć aksjologicznych i normatywnych. Pozwala to m.in. na formułowanie wniosków co do spójności rozstrzygnięć szczegółowych. Zagadnienie aksjologicznych podstaw obejmuje także problematykę relacji między wartościami a prawami podstawowymi oraz zagadnienie ontologicznego (...) statusu wartości i chronionych praw. Artykuł zawiera także wyniki badań nad wprowadzeniem do preambuły Karty w wersji niemieckojęzycznej zapisu o religijnym dziedzictwie, odbiegającego od brzmienia w innych językach mówiącego o dziedzictwie duchowym. Tato studie se snaží o filosofickou analýzu problematických aspektů neurogeneze. V první řadě se zaměřuje na moderní historii neurogeneze, která je obecně považována za historii dogmatického přesvědčení, které předpokládalo, že v mozku dospělého savce nemohou vzniknout nové neurony. Tato konvence přežívala v neurovědě po několik desítek let a její kořeny sahají až do dob Ramóna y Cajala. Důležitá část této filosofické analýzy se zaměřuje na aspekt tzv. zaštiťování dogmatu pomocí ad hoc hypotéz. Analýza se dále věnuje implicitním definicím, které hrají (...) roli axiomů neurovědy, a problematice falsifikace potenciálních falsifikátorů. Na konci této filosofické analýzy jsou prezentovány argumenty, které dospívají k tomu, že historie neurogeneze není historií dogmatického uvažování, jak většina autorů předpokládá, ale že jde o historii vědeckého pragmatismu. The article deals with relations between the individual and human rights on the one hand, and the State on the other, in the context of the Constitution of the Republic of Poland. The author poses the question whether the idea of subordination of the State to the individual is really a central idea of that constitution. He puts forward many arguments against such suggestion. These arguments relate, above all, to the arrangement of the constitution: a chapter concerning human rights is (...) chapter II, while chapter I deals with foundation of the State; the goals of the State are specified in the preamble including the following initial phrase “the existence and future of Poland as our Homeland” and in Article 5 where human rights are as subject of protection by the State is mentioned after independence and integrity of [its] territory; a general concept of human rights protection adopted in the constitution is dominated by the structures typical of law in its objective sense; the way of regulation admissible limitations on human rights differs from international standards; possibility of claiming human rights is constitutionally guaranteed, mostly by constitutional complaint which is above all aimed at correction of legal system, rather than claiming of rights by the individual; Article 1 (“The Republic of Poland shall be the common good of all its citizens”) interpreted as referring to Article 1 paragraph 1 of the April Constitution of 1935, one of the main ideas of which was precedence of the State over the individual. He also analyses the arguments in favour of the recognition of the idea of subordination of the State. Nevertheless, they cannot be accepted as resolving the question of whether it is a central idea of the constitution. These arguments include in particular: the principle of subsidiarity contained in the preamble, even if it has not been appropriately emphasized there; recognition of inherent and inalienable dignity of the person, but it was not until Article 30 that this provision has been contained and it does not determine the relations between the human dignity and rights and the State. The author suggests that the only conclusive way to justify the subordination of the State in relation to the individual as a central idea of the constitution is by means of Article 1. Taking into account, above all, preparatory work, we should reject the interpretation of that article referring to the April (1935) Constitution. Essential interpretative context may be found in preparatory work and social teachings of the Catholic Church, referred to therein. In that case, the common good means the entirety of the conditions of social life which favour the human development. These conditions include above all the respect for human dignity. Such interpretation of Article 1 gives priority to proposals on what the State should be to serve the individual rather than to safeguard obligations of citizens in relation to the State. (shrink)

Is Divine Knowledge Incompatible with Human Freedom? An Analysis of Some Arguments The problem that divine omniscience or divine foreknowledge makes free will impossible belongs to notoriously difficult to solve. In XX century one of the most important interpretation of this difficulty was provided by Nelson Pike. If God believes infallibly and in advance how Smith will act, this fact about the past excludes out all alternatives for Smith. But libertarian account of free will requires alternatives possibilities, so, it could (...) be argue that God’s foreknowledge is incompatible with our free will. This paper carefully criticizes Pike’s argumentation and suggests that because God’s foreknowledge doesn’t eliminate future alternatives through causal means, it is compatible with free will and that Pike’s argument and two briefly analyzed standard arguments for fatalism presented by Zagzebski failed. Eric Olson and David Shoemaker argue that our numerical identity over time is irrelevant to such practical issues as moral responsibility or self-concern. Being the same individual at different moments in time may, in our case, can be seen as the preservation of the relevant biological processes (e.g., according to Olson), while psychological continuity, independent of these processes, may be crucial for such issues. I will defend the view that, contrary to the above authors, any conception of our diachronic identity (...) has ethical implications, at least with regard to the aforementioned issues. My argument has two basic assumptions. (1) The dispute over identity of persons is a dispute over the conditions of our persistence in time as the same individuals, whether we consider being a person as our essential property or not (e.g., Olson maintains the latter). The question is under what conditions I am the same as a particular earlier or later individual. (2) The pronoun “I,” on the other hand, is an essential component of practical reasoning, so also of ethical one. Thus, the debate on the persistence of persons concerns the identity conditions of the individuals to whom/which we refer when planning our future actions, formulating our intentions. My rational self-concern or my moral responsibility for past actions regards the individual to whom the pronoun refers. An additional result of my argument is to undermine the influential strategy of defending positions on our diachronic identity against the charge of controversial ethical implications. It cannot be argued in the case of every such controversy that a given ethical issue only apparently involves our identity, while in fact what is relevant to it is a different relation binding persons at different moments in time. Celem opracowania jest dookreślenie tego, czym jest prywatność. Interesuje mnie prywatność w aspekcie nor¬matywnym, jako coś, co uważamy za nasze dobro; coś, czego się domagamy, co jest naszym prawem, i to nie tylko w sensie moralnym, ale także chronionym prawem pozytywnym. Prywatność jest czymś relacyjnym, i to przynajmniej w dwojakim znaczeniu. Po pierwsze, konstytuowana jest poprzez relację oddzielenia od czegoś - państwa, zakładu pracy (pracodawcy), rozmaitych instytucji. Po drugie, to, co prywatne z punktu widzenia jednych relacji - np. relacji jednostki (...) do państwa, do sprawowanych urzędów - nie musi być prywatne z punktu widzenia pracy zawodowej. Prywatność nie jest oparta na prostej opozycji pomiędzy tym, co społeczne, grupowe, a tym, co osobiste, indywidualne; podmiotem prywatności może być podmiot zbiorowy i nie wobec każdej grupy społecznej można się sensownie domagać prywatności. Prywatność pozwala w pełni dysponować tym, co „moje”. Sfera prywatna daje szczególne możliwości realizacji moich własnych celów, uzyskuję przestrzeń indywidualizacji, realizacji siebie jako niepowtarzalnej jednostki, której też sam jestem autorem. W sferze prywatnej podmioty stają się też podmiotami tworzącymi przestrzeń normatywną, uznając reguły rozpoznawane jako wyraz tego, co naturalne, zastane, i tworząc lub współtworząc z innymi uczestnikami tej sfery własne reguły, realizując przez to istotny wymiar autonomii osoby. Prywatność daje wreszcie przestrzeń dla rozwoju relacji ściśle osobowych, opartych na wyłączności tego, co między osobami się rozgrywa. Mając na uwadze zbieżność dążenia do ograniczania prywatności z wprowadzaniem elementów totalitarnych, można także zauważyć, że ochrona prywatności nie tylko chroni jednostki, ale i potrzebna jest sferze publicznej jako jeden ze środków przeciwko wadom rozwiązań totalitarnych. Two competing models of metaaxiological justification of politics are analyzed. Politics is understood broadly, as actions which aim at organizing social life. I will be, first of all, interested in law making activities. When I talk about metaaxiological justification I think not so much about determinations of what is good, but about determinations refering to the way the good is founded, in short: determinations which answer the question why something is good. In the first model, which is described here as (...) objectivistic, it is assumed that determining that which is good is a matter of cognition; in the second model, which could be described here as voluntaristic or excedingly liberal, it is assumed that determining good is not a matter of cognition but of will – something is good because it is wanted. In the latter model, the cognoscibility of good is rejected and therefore the objective criteria for evaluation of which ‘will’ is better and which is worse are rejected. As a consequence, negative freedom becomes the fundamental value of social order and the basic requirement is that of maximizing the sphere of individual’s free actions, the sphere which is free from interference of other individuals or institutions. I am going to argue that none of these models is acceptable as a basis of oragnizing social life, and at least because of one reason. Each of them leads to a certain version of totalitarianism. In the conclusion I am going to present a mixed model, which, in my opinion, reflexes well the practice of democratic states. Analysis of these three models allows, first of all, to identify more clearly some of the problems appearing in making law, including procedural questions. By pointing at the interdependence of the foundations of good and law making procedures it is argued that the choice of the concept of good (a metaaxiological choice) is primary to the choice of law making procedures. Perceptual modalities have been traditionally considered the product of dedicated biological systems producing information for higher cognitive processing. Psychological and neuropsychological evidence is offered which undermines this point of view and an alternative account of modality from the enactive approach to understanding cognition is suggested. Under this view, a perceptual modality is a stable form of perception which is structured not just by the biological sensitivities of the agent, but by their goals and the set of skills or expertise which (...) they are deploying at a given time. Such a view suggests that there is no such thing as an experience that is purely visual, auditory, or otherwise modal and that our attempts to understand consciousness and the mind must be conducted within a framework that provides an account of embodied, goal-directed adaptive coping with the world. Philosophizing and the True Knowledge of Human Being -/- Abstract -/- The article presents the principles and method of classical philosophy. This kind of philosophy, developed mainly in ancient and medieval times, is still viable and interesting today. What is more important, it can be used as grounds for academic philosophy. Doing so provides a philosopher with resources for autonomy in her philosophical inquiry as well as the usefulness and application of its results for various cultural, social, and political tasks. The last part of the article explains the manner in which the principles of philosophy may be connected with different ways of classical philosopher’s concern the with knowledge of the human being understood as a special, unique being, with her transcendence behind her biological nature and human society. In the conclusion, several tasks for philosophical reflection are given. This paper concerns an important and exciting book by Marek Dobrzeniecki Ukrytość i Wcielenie. Teistyczna odpowiedź na argument Johna L. Schellenberga za nieistnieniem Boga [Hiddenness and the Incarnation: A Theistic Response to John L. Schellenberg’s Argument for Divine Nonexistence]. After a brief discussion of the content of the book’s chapters, critical remarks are presented. They concern the adopted method and approach to Schellenberg’s philosophy in general and the argument from hiddenness in particular. The conceptual framework serving as a typologization (...) of the propositional dimension of the phenomenon of theistic belief/faith is dubious and requires in-depth research. It is worth considering the possibility of asymmetry of the attitudes of belief/faith and unbelief, which requires consideration in the reasoning whose legitimacy would assume the transfer of features from one to the other and the negation functor. Regarding the voluntarism of belief in God, the paper suggests that extreme, purely intellectual, and purely volitional positions should be considered, as well as moderate and mixed ones. It is argued extensively that Dobrzeniecki’s criticism against the arguments of Rea and Mourad is not conclusive. Just the possibility of voluntariness of disbelief undermines the validity of Schellenberg’s argument and should therefore be ruled out as much as possible. The paper suggests supplementing Dobrzeniecki’s approach with a ‘trans-paradigmatic’ approach consisting of external criticism, which, in the light of Schellenberg’s arguments being probably incompatible with the described phenomenon of religious belief in God, leads to a modification of the theoretical apparatus of Schellenberg’s paradigm. Such a modification deprives the latter’s argument of justification. --- Niniejszy artykuł dotyczy ważnej i interesującej książki Marka Dobrzenieckiego Ukrytość i Wcielenie. Teistyczna odpowiedź na argument Johna L. Schellenberga za nieistnieniem Boga. Po krótkim omówieniu zawartości poszczególnych rozdziałów książki prezentuję swoje uwagi krytyczne. Dotyczą one przyjętej metody i podejścia do filozofii Schellenberga w ogólności, a argumentu z ukrytości w szczególności. Wątpliwa i wymagająca pogłębionego badania jest siatka pojęciowa pełniąca funkcję typologizacji propozycjonalnego wymiaru fenomenu wiary teistycznej. Warta rozważania jest możliwość niesymetryczności postaw wiary i niewiary, co wymaga uwzględnienia w rozumowaniach, których zasadność zakładałaby przenoszenie cech z jednej na drugą oraz funktora negacji. W sprawie woluntaryzmu wiary w Boga sugeruję, że należy rozpatrywać nie tylko stanowiska skrajne, czysto intelektualistyczne i czysto wolicjonalne, ale także u miarkowane i mieszane. Argumentuję szeroko, że krytyka Dobrzenieckiego skierowana przeciwko argumentom Rea i Mourada nie jest konkluzywna. Argumentuję, że samo możliwość woluntarności niewiary podważa zasadność argumentu Schellenberga i dlatego powinna ona być wykluczona w sposób maksymalnie możliwie uzasadniony. Sugeruję uzupełnienie podejścia Dobrzenieckiego o podejście ‘transparadygmatyczne’ polegające na rodzaju krytyki zewnętrznej, która w świetle nieprzystawania argumentacji Schellenberga do opisywanego fenomenu prowadzi do modyfikacji aparatu teoretycznego paradygmatu Schellenberga. Taka modyfikacja odbiera argumentowi tego ostatniego moc uzasadniającą. (shrink)

The paper links higher education reforms and welfare states reforms in postcommunist Central European countries. It links current higher education debates (and reform pressures) and public sector debates (and reform pressures), stressing the importance of communist-era legacies in both areas. It refers to existing typologies of both higher education governance and welfare state regimes and concludes that the lack of the inclusion of Central Europe in any of them is a serious theoretical drawback in comparative social research. The region should (...) still, after more than two decades of transition and heavy international policy advising, be viewed as a “laboratory of social experimentation”. It is still too risky to suggest generalizations about how Central European higher education and welfare systems fit existing typologies. Consequently, the “transition” period is by no means over: it is over in terms of politics and economics but not in terms of social arrangements. Both higher education and welfare states should be viewed as “work in progress”: permanently under reform pressures, and with unclear future. (shrink)

In the article I discuss the conceptual problem of other minds and different approaches to mental concepts. Firstly, I introduce the conceptual problem and argue that solutions proposed by theory-theory and direct perception approach are inadequate. I claim that mental concepts are neither theoretical terms nor observational terms. Then, I consider third option which states that mental concepts are dispositional terms, i.e. they concern particular patterns (stereotypes) of behavior. Finally, I argue that dispositional approach is to some extent coherent with (...) phenomenological account and that phenomenological concept of embodiment can improve this position. (shrink)

This essay is an introduction to a lecture course "Elements of Descriptive Psychology" delivered by Anton Marty in around 1903/04. Marty offered courses on descriptive psychology at regular intervals in the course of his career at the University of Prague. The content of these courses follows closely the ideas of Marty’s teacher Franz Brentano, though with some interesting divergences and extrapolations. The present work is a historical and systematic introduction to an extract from notes taken of Marty’s lecture, with some (...) discussion of the work of Dilthey on similar topics, and of Marty’s influence on Franz Kafka and on the Gestalt psychologist Max Wertheimer. Problem of Axiological Legitimization of the Universal System of the Protection of Human Rights Summary In this paper it is argued that legitimization of the universal system (UN-system) of the protection of human rights depends primary not from the content of values recognised as fundamental but rather from metaaxiological solutions related to the way of existence and to the possibility of cognition of these values. Legitimisation is based on the recognition of an objective nature and of cognoscibility of basic values. (...) Realisation of the primary aim of this paper is linked to the problem of different meanings of the notion of universality, used in the context of the universal system of the protection of human rights. First, descriptive and normative (prescriptive) meanings have to be distinguished. In the case of normative sense, there are moral and legal meanings of “universality”. An axiological justification of the universality of human rights in the legal sense leads to the legitimisation of the universal system. It is shown that modifications of – broadly accepted in the Polish theory of law – definitions of an axiological justification of legal norms are needed. These definitions base such a justification on the valuations made by particular groups of subjects. It is argued that it is much more convenient to refer to valuations understood as meanings of sentences of certain kind. -/- Streszczenie W artykule zmierza się do uzasadnienia tezy, że legitymizacja uniwersalnego systemu ochrony praw człowieka jest oparta nie tyle na treści wartości uznawanych w tym systemie, ale na uznanych w nich rozstrzygnięciach metaaksjologicznych, dotyczących tego, jak istnieją wartości podstawowe dla tego systemu i czy są one poznawalne. Walor legitymizacyjny posiada przede wszystkim uznanie obiektywnego charakteru tych wartości i ich poznawalności (uznanie kognitywizmu aksjologicznego). Realizacja zasadniczego celu zakłada uporządkowanie podstawowych pojęć dotyczących problematyki powszechności praw człowieka – termin „powszechność” stosowany w odniesieniu do praw człowieka w kontekście uniwersalnego systemu ochrony ma wiele znaczeń. Przede wszystkim odróżnić trzeba powszechność w aspekcie opisowym i w aspekcie normatywnym. W przypadku powszechności w aspekcie normatywnym w grę może wchodzić powszechność w sensie ideowym (moralnym) i powszechność w sensie pozytywnoprawnym. Uzasadnienie tej ostatniej jest też uzasadnieniem poszukiwanej tu legitymizacji uniwersalnego systemu ochrony praw człowieka. Prowadzone analizy prowadza także do sformułowania postulatów dotyczących sposobu definiowania uzasadnienia aksjologicznego norm prawnych. Modyfikacji wymagają powszechnie przyjmowane w polskiej teorii prawa definicje relatywizujące takie uzasadnienie do ocen przyjmowanych przez konkretne podmioty oceniające lub ich grupy. (shrink)

In contemporary positive law there are legal institutions, such as conscientious objection in the context of military service or “conscience clauses” in medical law, which for the sake of respect for judgments of conscience aim at restricting legal obligations. Such restrictions are postulated to protect human freedom in general. On the basis of Thomas Aquinas’ philosophy, it shall be argued that human dignity, understood as the existential perfection of a human being based on special unity, provides a foundation for imposing (...) limitations on the scope of legal obligations in general. Human freedom plays a crucial role in understanding dignity as perfection based on the special individuality of a personal being, which in turn is based on the free choice to pursue a unique way of life. Therefore, Aquinas’ argumentation is, at its core, liberal – the perfection rather than the imperfection of a human being underlies the requirement to limit legal obligations. Dignity understood as the special unity of a person also provides the basis for limiting obligations in the case of conscientious objection; however, in that case, such limitations aim at safeguarding internal integrity rather than the individualisation of a given way of life. _This project was financed with funds from the National Science Centre allocated on the basis of the decision number DEC-2013/09/B/HS5/04232._. Tato studie se věnuje komentářům a glosám k první kapitole druhé knihy Boethiova Úvodu do aritmetiky, jejímiž autory v poslední čtvrtině 10. století byli Gerbert z Aurillacu, Abbo z Fleury, Notker z Lutychu a anonymní autor textu De arithmetica Boetii. Studie sleduje dva hlavní cíle: nejprve upozorňuje na to, že Boethiův text o převodu číselných posloupností na stejnost lze interpretovat dvěma rozdílnými způsoby, následně se zaměřuje na využití této problematiky v dalších svobodných uměních a při hraní deskové hry rithmomachie.

Studie se věnuje čtyřem astronomickým pomůckám, které vytvořil a užíval Gerbert z Aurillacu, remešský a ravennský arcibiskup, opat v Bobbiu a v letech 999–1003 papež. Gerbert vyučoval quadrivium především v Remeši a od jeho žáka Richera z Remeše a z Gerbertových dopisů víme o čtyřech jeho přístrojích, které poskytovaly srozumitelný a názorný úvod do geocentrického výkladu veškerenstva: 1. glóbus světové sféry s nastavitelným horizontem; 2. pozorovací hemisféra s pěti rovnoběžnými kruhy světové sféry ; 3. armilární sféra s vnitřním umístěním ekliptiky (...) a oběžných drah planet; 4. armilární sféra s vnějším umístěním hvězd a souhvězdí. Jest to dla jego twórczości fakt o fundamentalnym znaczeniu. Poeta przejmuje od Chasydów centralną kategorię, jaką jest "samotność". Wokół tego pojęcia rozwija się jego poetyka.

This book is the first comprehensive study of Plato’s conception of justice. The universality of human rights and the universality of human dignity, which is recognised as their source, are among the crucial philosophical problems in modern-day legal orders and in contemporary culture in general. If dignity is genuinely universal, then human beings also possessed it in ancient times. Plato not only perceived human dignity, but a recognition of dignity is also visible in his conception of justice, which forms the (...) core of his philosophy. Plato’s Republic is consistently interpreted here as a treatise on justice, relating to an individual and not to the state. The famous myth of the cave is a story about education taking place in the world here and now. The best activity is not contemplation, but acting for the benefit of others. Not ideas, but individuals are the proper objects of love. Plato’s philosophy may provide foundations for modern-day human rights protection rather than for totalitarian orders. (shrink)

The aim of the paper is to provide a philosophical and historical background to current discussions about the changing relationships between the university and the state through revisiting the classical “Humboldtian” model of the university as discussed in classical German philosophy. This historical detour is intended to highlight the cultural rootedness of the modern idea of the university, and its close links to the idea of the modern national state. The paper discusses the idea of the university as it emerges (...) from the philosophy of Wilhelm von Humbold, Johann Gottlieb Fichte and Friedrich Schleiermacher, as well as - in the 20th century - Karl Jaspers and Jürgen Habermas. More detailed questions discussed include the historical pact between the modern university and the modern nation-state, the main principles of the Humboldtian university, the process of the nationalization of European universities, the national aspect of the German idea of culture (Bildung), and the tension between the pursuit of truth and public responsibilities of the modern university. In discussing current and future missions and roles of the institution of the university today, it can be useful to revisit its foundational (modern) German idea. In thinking about its future, it can be constructive to reflect on the evident current tensions between traditional modern expectations of the university and the new expectations intensified by the emergence of knowledge-based societies and market-driven economies. From the perspective of the tensions between old and new tasks of the university, it is useful to look back at the turning point in its history. (shrink)
