In this article I present the phenomenological tradition as a new grounding for human rights as universal rights. The hypothesis defended is to conciliate Husserl’s phenomenological method and Reinach’s a priori law in order to offer a new grounding to human rights. In order to combine Husserl and Reinach’s ideas, I propose to expand the comprehension of a priori. It would be present as eidos of each object and I name it as material a priori; it also be present in (...) the eidetic relations and I name it as formal a priori. Yet the object would have an essence, a necessary content, a material a priori, and necessary states of affairs, necessary relations and connections, a formal a priori. Reinach, in The A priori Foundations of the Civil Law, describes eidetic relations, such as, the relation between promise, claim and obligation. I propose three eidetic universalities to ground law, these are what I will call human rights. I also face a few difficulties presented by DuBois and De Vecchi derived from the amoral approach of a priori laws. Then, I highlight the difference between this proposition and Albert’s. Finally, I defend the proposition that a priori laws are beyond natural and positive laws. (shrink)

El uso de sistemas de machine learning en los procesos de selección laboral ha sido de gran utilidad para agilizarlos y volverlos más eficientes, pero al mismo tiempo ha generado problemas en términos de equidad, confiabilidad y transparencia. En este artículo comenzamos explicando los diferentes usos de la Inteligencia Artificial en los procesos de selección laboral en Estados Unidos. Presentamos los sesgos sexuales y raciales que han sido detectados en algunos de ellos y explicamos los obstáculos jurídicos y prácticos para (...) su detección y análisis. Un posible remedio jurídico a la discriminación algorítmica es el régimen de impacto diferencial sistémico utilizado en Estados Unidos. Usamos algunas características de este régimen para señalar los vacíos jurídicos frente a la discriminación en el acceso al empleo en el ámbito del derecho laboral colombiano, y ofrecemos algunas características generales que podría tener un régimen de esa naturaleza. Anne Finch Conway es una de las filósofas del siglo XVII que discutió con los filósofos destacados de su época. La única obra con la que contamos de esta autora es Principia Philosophiae Anticissimae et Recentissimae o The Principle of the Most Ancient and Modern Philosophy. En este artículo me propongo dar cuenta del rol que la naturaleza humana tiene en su metafísica, de modo de encontrar un lugar más específico para el dolor y el sufrimiento en un mundo que (...) parece ante todo gobernado por el amor recíproco y la simpatía. El concepto de hombre microcosmos y la relación de este con Cristo tiene una importancia poco destacada por la bibliografía sobre nuestra filósofa. Con esta meta, presentaré su metafísica prestando especial atención a la sustancia creada y su relación con la sustancia media, Cristo, y la sustancia primera, Dios. De este modo, además, daré cuenta de la responsabilidad que la naturaleza humana tiene con el mundo de la creación, por lo cual me permito mencionar también lo “ecológico” en el pensamiento de Conway, ya que el perfeccionamiento de la naturaleza humana es el perfeccionamiento de toda la naturaleza. This article examines the special features of the atmosphere in Habsburg’s Vienna, which led to the formation of such a direction in philosophical thought as a critique of language (Sprachkritik) and the influence its representatives such as Karl Kraus and Fritz Mauthner on the later Ludwig Wittgenstein’s views on language. I argue that Sprachkritik was inextricably connected with Sprachkrise (crisis of language), Sprachkrise was a strongly Austrian phenomenon due to special socio-cultural-political reasons and which led to the consideration of the (...) very phenomenon of language from a new point of view. Here I claim that Ludwig Wittgenstein, a ‘product’ of Habsburg’s Vienna, was strongly influenced by the intellectual atmosphere of the critique of language reigning in it. In Roberto Poli’s (1997: 16), scholar in sociology and philosophy, words, the “language-world relationship was a central element of the intellectual debate of those years: suffice it to mention Rainer Maria Rilke and Hugo von Hofmannsthal among writers, and Fritz Mauthner and Ludwig Wittgenstein among philosophers.” . Discussion of modeling within philosophy of science has focused in how models, understood as finished products, represent the world. This approach has some issues accounting for the value of modeling in situations where there are controversies as to which should be the object of representation. In this work I show that a historical analysis of modeling complements the aforementioned representational program, since it allows us to examine processes of integration of analogies that play a role in the generation of criteria (...) of relevance, which are important for the configuration of the object of research. This, in turn, shows that there are norms in modeling practices whose historical reconstruction is relevant for their philosophical analysis. (shrink)

In this article I consider Eugen Fink’s critique of Husserlean approach to language in phenomenology, first of all in the ‘middle’ and ‘late’ periods of Husserlean works since Ideas I. Fink was Husserl’s student and assistant and, also, he was influenced by Heidegger’s ideas. In his works he criticized insufficient attention and unworked position to language in Husserl’s works. He believed that language is very important to the whole theory of phenomenology, that we cannot carry out true phenomenological reduction without (...) clarifying what language is, how it is related to our thinking, is it possible to think without language and is it possible to carry out a complete phenomenological reduction. Tennemann y el romántico T. Rixner son representantes del periodo de gestación de la historia de la filosofía como disciplina, y sus obras son fuentes para destacados filósofos, como por ejemplo Hegel. Se muestra hasta qué punto las líneas interpretativas que iniciaron estos autores se continúan hasta (...) la actualidad. The article explores the philosophical filiations of Johannes Scotus Eriugena (9th century) established by three historians of philosophy (from the 18th and 19th centuries). J. Brucker, an Enlightenment thinker, W. Tennemann, a Kantian, and T. Rixner, a Romantic, are representatives of the period in which the history of philosophy becomes a discipline, and their works are sources for famous philosophers such as Hegel. The paper shows the extent to which the interpretive lines initiated by these authors are continued up to the contemporary period. We aim to develop a take on the meaning of works of art that builds on Dennett’s view on the nature of intentionality, namely, that the intentionality exhibited by mental phenomena is not original, but derived. Regarding the meaning of works of art, theories that hold that the meaning is determined by the intentions of the author when creating the work are considered intentionalist. Adopting the view of derived intentionality implies that it is no longer possible to maintain that the (...) semantic content of a work of art is closely linked to the creative act that gave rise to it; accordingly, intentionalist theories should be, broadly speaking, abandoned. However, we claim that one aspect of intentionalist theories is accurate and, moreover, compatible with the perspective on intentionality we adopt: The fact that part of the meaning of a work of art is given by the interpretations that arise when it is assumed that the work was produced by an agent with the purpose of transmitting something. We call this interpretative strategy the work-of-art stance and argue that it should be understood as a subtype of the intentional stance. According to our proposal, this interpretive strategy is part of a view that tries to explain the meaning of works of art as partially indeterminate, relative to a history (and not to a foundational origin) and dependent on interpretive attribution. En este artículo elaboramos una propuesta sobre el significado de las obras de arte que se apoya en la perspectiva de Dennett acerca de la naturaleza de la intencionalidad de los fenómenos mentales. De acuerdo a ella, la intencionalidad que estos exhiben no es original, sino derivada. Adoptar la perspectiva de la intencionalidad derivada implica que ya no será posible sostener que el significado de una obra de arte esté vinculado al acto creativo que le dio origen o que esté determinado por las intenciones que tuvo su autor al crearlas, como han sostenido las teorías intencionalistas. Ahora bien, creemos que hay un aspecto de estas que no es incompatible con la perspectiva de intencionalidad derivada. Se trata del hecho de que parte del significado de la obra de arte está dado por las interpretaciones que surgen sólo cuando se asume que la misma fue producida por un agente con el propósito de transmitir algo. Llamaremos a esta estrategia interpretativa actitud de la obra de arte y defenderemos que debe ser entendida como un subtipo de la actitud intencional. Esta estrategia interpretativa forma parte de una propuesta que intenta explicar el significado de las obras de arte como siendo parcialmente indeterminado, relativo a una historia y dependiente de la atribución interpretativa. This paper analyses the arguments for and against what we have called automatic organ procurement model in relation to the organs of the deceased. For this purpose, this work provides empirical evidence to assess the potential impact of this model on donation rates and on public opinion. Specifically, we examine first the reasons supporting this model, with special reference to utilitarian and justice arguments. On the other hand, we analyse both the approaches based on the violation of pre mortem and (...) post mortem interests opposing this theoretical model and the rejection the model would generate in the population. Finally, we point out the aspects that, in our opinion, should be exhaustively regulated if this model were implemented. In particular, we refer to the legal status of the human body, the treatments for end-of-life patients, the incentives for health professionals and the recognition of the right to conscientious objection. Vol. II in English is available separately from this website. -/- The principal objective of the work is to construct an analytically precise methodology which can serve to identify, eliminate, and avoid a certain widespread conceptual fault or misconstruction, called a "projective misconstruction" or "projection" by the author. -/- It is argued that this variety of error in our thinking (i) infects a great number of our everyday, scientific, and philosophical concepts, claims, and theories, (...) (ii) has largely been undetected, and (iii), when remedied, leads to a less controversial and more rigorous elucidation of the transcendental preconditions of human knowledge than has traditionally been possible. -/- The dissertation identifies, perhaps for the first time, a projective variety of self-referential inconsistency, and proposes an innovative, self-reflexive approach to transcendental argument in a logical and phenomenological context. The strength of the approach lies, it is claimed, in the fact that a rejection of the approach is possible only on pain of self-referential inconsistency. The argument is developed in the following stages: -/- A general introduction identifies the central theme of the work, defines the scope of applicability of the results reached, and sketches the direction of the studies that follow. The preliminary discussion culminates in a recognition of the need for a critique of impure reason. -/- The body of the work is divided into two parts: Section I seeks to develop a methodology, on a purely formal basis, which is, on the one hand, capable of being used to study the transcendental foundations of the special sciences, including its own proper transcendental foundation. On the other hand, the methodology proposed is intended as a diagnostic and therapeutic tool for dealing with projective uses of concepts. -/- The approach initiates an analysis of concepts from a perspective which views knowledge as coordination. Section I describes formal structures that possess the status of preconditions in such a coordinative account of knowledge. Special attention is given to the preconditions of identifying reference to logical particulars. The first section attempts, then, to provide a self-referential, transcendental methodology which is essentially revisionary in that it is motivated by a concern for conceptual error-elimination. -/- Phenomenology, considered in its unique capacity as a self-referential, transcendental discipline, is of special relevance to the study. Section II accordingly examines a group of concepts which come into question in connection with the central theme of phenomenological constitution. The "de-projective methodology" developed in Section I is applied to these concepts that have a foundational importance in transcendental phenomenology. A translation is, in effect, proposed from the language of consciousness to a language in which preconditions of referring are investigated. The result achieved is the elimination of self-defeating, projective concepts from a rigorous, phenomenological study of the constitutive foundations of science. -/- The dissertation was presented in a two volume, double-language format for the convenience of French and English researchers. Em primeiro lugar procuro desenvolver a demarcação con- ceitual do que chamo de “ontologia da singularidade”, pressuposto a partir do qual coube a Feuerbach (...) empreender uma rearticulação da filosofia com a realidade material concreta, e as implicações desta questão para o tema do conhecimento. Em segundo, proponho que estes problemas parecem vir de algum modo relacionados a uma discussão sobre a linguagem, concebida como meio de expressão do pensamento. -/- This text deals with the possibility of defending “ontology of singularity” and its reflexes on the problem of knowl- edge, as well as offering an introduction to the question of language, all these problems understood as elements of interest in Ludwig Feuerbach’s thought (1804-1872), what bounds the investigation to the limits of Zur Kritir der Hegelschen Philosophie (1839). It seeks, firstly, to develop the conceptual demarcation of what is called here in this work “ontology of singularity”, on the basis of which it was up to Feuerbach to come up with the reartic- ulating of philosophy with concrete material reality, including the implications of this question for the theme of knowledge. This paper proposes to reconstruct Boaventura de Sousa Santos' conception of "epistemologies of the south" both (a) as a critical theory aiming at denouncing the impoverishment of the epistemic field entailed by the normative imposition of a certain model of knowledge (what we call "the monoculture of reason"), and (b) as a long-term political project of a harmonic coexistence of different epistemologies ("an ecology of knowledges").

In his book On the Nature of Marx’s Things Jacques Lezra inherits another Marx and another materialism. It is an aleatory materialism: a materialism of the dynamic contingency of Marx and his “things”. This “subterranean current” of aleatory materialism is excavated by Lezra in his swerve through the letters, notebooks, and “private notes” of a young Marx working on his doctorate thesis. Following Lezra’s necrophilological thread –which encounters Lucretius and his “things”– we find that, in a parallel fashion, Marx is (...) also searching for a concept of science in his dissertation. This is what here is tentatively called a science of contingency. This science – though not in the usual disciplinary sense– opens the possibility of an alliance with Karen Barad’s performative materialism that displaces the humanism of the “new materialisms” by thinking alongside another science of contingency, also of a certain Lucretian inheritance, and which Marx did not get to think: quantum mechanics. -/- -- -/- En su libro On the Nature of Marx’s Things Jacques Lezra hereda otro Marx, y otro materialismo. Un materialismo aleatorio, un materialismo de la contingencia dinámica de Marx y sus “cosas”. Tal “corriente subterránea” del materialismo aleatorio es excavada por Lezra en su desvío por las cartas, cuadernos y notas “privadas” de un joven Marx que trabajaba en su tesis de doctorado. Siguiendo el hilo necrofilológico de Lezra, que se topa con Lucrecio y sus “cosas,” encontramos que, paralelamente, Marx también busca un concepto de ciencia en su tesis: lo que tentativamente nombramos ciencia de la contingencia. Ciencia, no ya disciplinaria, que abre la posibilidad de una alianza con el materialismo performativo de Karen Barad que desplaza el humanismo de los “nuevos materialismos” desde una reflexión critica que piensa a la par de otra ciencia de la contingencia, también de cierta herencia lucreciana, con la cual Marx no llegó a pensar: la mecánica cuántica. En "Elementos esenciales de una hermenéutica analógica", Mauricio Beuchot trata de ubicar su hermenéutica analógica como una posición intermedia entre lo que él llama el univocismo y la hermenéutica alegórica. En este comentario busco mostrar, tomando como punto de partida que los objetivos teóricos de la hermenéutica no se encuentran muy distantes de los de las teorías analíticas de la interpretación, que el debate sobre el papel de los elementos extralingüísticos en la interpretación es mucho más complejo de lo que (...) el trilema de Beuchot sugiere. In "Essential Elements for an Analogical Hermeneutics", Mauricio Beuchot seeks to place his analogical hermeneutics in a position between what he calls univocism and allegorical hermeneutics. In this commentary I intend to show, taking into account that the theoretical goals of hermeneutics are not so different from those of analytical theories of interpretation, that the debate over the role played by extralinguistic elements in interpretation is much more complex than what Beuchot's trilemma suggests. The most obvious varieties of mental phenomena directed to non- existent objects occur in our experiences of works of art. The task of applying the Meinongian ontology of the non-existent to the working out of a theory of aesthetic phenomena was however carried out not by Meinong by his disciple Stephan Witasek in his Grundzüge der allgemeinen Ästhetik of 1904. Witasek shows in detail how our feelings undergo certain sorts of structural modifications when they are directed towards what does not (...) exist. He draws a distinction between genuine mental phenomena and what he calls `phantasy-material', asserting that `the job of the aesthetic object, whether it is a work of art or a product of nature, is to excite and support the actualisation of phantasy-material in the experiencing subject'. We might think of such phantasy-material as a matter of Ersatz-emotions or emotional `slop'. We could then see Witasek's aesthetics as an elaborate taxonomy of the various different sorts of Ersatz-emotions which the subject allows to be stimulated within himself in his intercourse with works of art, and see works of art themselves as machines for the production of ever more subtle varieties of such phantasy-material in the perceiving subject. ⦿ In my dissertation I introduce, motivate and take the first steps in the implementation of, the project of naturalising modal metaphysics: the transformation of the field into a chapter of the philosophy of science rather than speculative, autonomous metaphysics. -/- ⦿ In the introduction, I explain the concept of naturalisation that I apply throughout the dissertation, which I argue to be an improvement on Ladyman and Ross' proposal for naturalised metaphysics. I also object to Williamson's proposal that modal metaphysics (...) --- or some view in the area --- is already a quasi-scientific discipline. -/- ⦿ Recently, some philosophers have argued that the notion of metaphysical modality is as ill defined as to be of little theoretical utility. In the second chapter I intend to contribute to such skepticism. First, I observe that each of the proposed marks of the concept, except for factivity, is highly controversial; thus, its logical structure is deeply obscure. With the failure of the "first principles" approach, I examine the paradigmatic intended applications of the concept, and argue that each makes it a device for a very specific and controversial project: a device, therefore, for which a naturalist will find no use for. I conclude that there is no well-defined or theoretically useful notion of objective necessity other than logical or physical necessity, and I suggest that naturalising modal metaphysics can provide more stable methodological foundations. -/- ⦿ In the third chapter I answer a possible objection against the in-principle viability of the project: that the concept of metaphysical modality cannot be understood through the philosophical analysis of any scientific theory, since metaphysical necessity "transcends'' natural necessity, and science only deals with the latter. I argue that the most important arguments for this transcendence thesis fail or face problems that, as of today, remain unsolved. -/- ⦿ Call the idea that science doesn't need modality, "demodalism''. Demodalism is a first step in a naturalistic argument for modal antirealism. In the fourth chapter I examine six versions of demodalism to explain why a family of formalisms, that I call "spaces of possibility'', are (i) used in a quasi-ubiquitous way in mathematised sciences (I provide examples from theoretical computer science to microeconomics), (ii) scientifically interpreted in modal terms, and (iii) used for at least six important tasks: (1) defining laws and theories; (2) defining important concepts from different sciences (I give several examples); (3) making essential classifications; (4) providing different types of explanations; (5) providing the connection between theory and statistics, and (6) understanding the transition between a theory and its successor (as is the case with quantisation). -/- ⦿ In fifth chapter I propose and defend a naturalised modal ontology. This is a realism about modal structure: my realism about constraints. The modal structure of a system are the relationships between its possible states and between its possible states and those of other systems. It is given by the plurality of restrictions to which said system is subject. A constraint is a factor that explains the impossibility of a class of states; I explain this concept further. First, I defend my point of view by rejecting some of its main rivals: constructive empiricism, Humean conventionalism, and wave function realism, as they fail to make sense of quantum chaos. This is because the field requires the notion of objective modal structure, and the mentioned views have trouble explaining the modal facts of quantum dynamics. Then, I argue that constraint realism supersedes these views in the context of Bohm's standard theory and mechanics, and underpins the study of quantum chaos. Finally, I consider and reject two possible problems for my point of view. -/- ⦿ A central concern of modal metaphysicians has been to understand the logical system that best characterises necessity. In the sixth chapter I intend to recover the logical project applied to my naturalistic modal metaphysics. Scientists and philosophers of science accept different degrees of physical necessity, ranging from purely mathematically necessary facts that restrict physical behaviour, to kinetic principles, to particular dynamical constraints. I argue that this motivates a multimodal approach to modal logic, and that the time dependence of dynamics motivates a logic of historical necessity. I propose multimodal propositional (classical) logics for Bohmian mechanics and the Everettian theory of many divergent worlds, and I close with a criticism of Williamson's approach to the logic of state spaces of dynamic systems. En este segundo documento nos ocupamos del aborto realizado por motivos terapéuticos o, dicho más brevemente, del aborto terapéutico. En la Argentina, el aborto plantea serios desafíos para la salud pública, ya que, pese a estar prohibido, se practica de forma clandestina y, muchas veces, insegura, poniendo en riesgo la vida y la salud de las mujeres. Por esta razón, creemos que la sociedad y el Estado deben debatir este problema y encontrar soluciones que resguarden los derechos de las mujeres. (...) El artículo 86, inciso 1, del Código Penal argentino expresamente despenaliza el aborto cuando corre peligro la vida o la salud de la mujer. En estos casos, se habla de aborto terapéutico. Esta disposición legal no suele aplicarse ni por los médicos ni por los profesionales que trabajan en la justicia, ya sea por desconocimiento o por razones ideológicas. Más aún, en muchos casos, las interpretaciones del Código Penal se apartan de su letra y restringen arbitrariamente su aplicación. Por estas razones, nos parece importante analizar este problema y proveer información sobre los aspectos legales y éticos involucrados en el aborto terapéutico en la Argentina. Este documento comienza con el relato de un caso hipotético, elaborado a partir de experiencias reales, con el objetivo de acercar al público a una situación concreta. Intercaladas en el cuerpo del relato, se desarrollan algunas reflexiones acerca de las implicaciones médicas, éticas y legales del caso. A continuación, se presenta un apartado referido al marco legal en el que se deben encuadrar los casos de aborto no punible. El documento sigue con una serie de breves recomendaciones destinadas tanto a los profesionales que trabajan en el sistema judicial como a los profesionales de la salud. Por último, se incluye un apéndice que contiene los principios que rigen la interpretación en materia penal y el glosario médico y legal, donde se pueden buscar las palabras resaltadas a lo largo del documento. Algunos presupuestos teológicos de la crisis de Occidente Some theological presuppositions of the crisis of the West -/- Manuel Ocampo Ponce Universidad Panamericana Departamento de Humanidades -/- Resumen. Muchos hablan de una crisis en occidente y de los distintos factores que han contribuido a la misma. Sin embargo, no son tantos los que involucran los factores teológicos que han influido en dicha crisis. De aquí que el presente estudio sea un intento por presentar algunos de los presupuestos teológicos de lo (...) que se ha llamado “la crisis de occidente”. Se trata de presentar ciertas ideas filosóficas que han repercutido en las propuestas de algunos teólogos y pensadores del siglo XX y lo que va del XXI, y de demostrar que dichas ideas han producido cambios significativos en la concepción de Dios, en la concepción de las dimensiones personal y social del hombre, y con estas en la organización del mundo contribuyendo, en distintos niveles, lo que se ha denominado la crisis de Occidente. -/- Palabras clave: Dios, Cristianismo, ser, Teología, Metafísica, crisis, agnosticismo, relativismo, secularismo. -/- Abstract. Many speak of a crisis in the West and of the various factors that have contributed to it. However, few mention the theological factors that have influenced this crisis. Hence, the present study is an attempt to present some of the theological presuppositions of what has been called "the crisis of the West". The study presents certain philosophical ideas that have had repercussions on the proposals of some representative theologians of the twentieth and twenty-first centuries. It seeks to demonstrate that these ideas have produced some changes in the conception of God, in the conception of personal and social dimensions and in the organization of the world. These have favored, at different levels, what has been called the crisis of the West. -/- Key words: God, Christianism, being, Theology, Methaphisics, crisis, agnosticism, relativism, secularism. -/- En las últimas décadas se ha hablado mucho de que el mundo occidental se encuentra en crisis. Crisis de pensamiento, crisis de valores, crisis moral, crisis en los ámbitos científicos, artísticos, humanos, ambientales, etc. Sin embargo, es necesario aclarar que, para comprender Occidente y su crisis, es imprescindible considerar el papel del cristianismo como elemento fundamental de la cultura occidental. No podemos dejar de lado que, si el cristianismo tiene un peso en el desarrollo de Occidente, también debe tener un peso en sus logros y en sus decadencias y fracasos. En efecto, así como no podemos entender el mundo árabe si no conocemos el Islam, o Asia si no conocemos el budismo, tampoco podemos comprender Occidente si no conocemos el cristianismo. Esa es la razón por la que pensamos que cualquier análisis serio de la cultura de Occidente, ha de considerar el cristianismo como elemento clave para su comprensión. Pero hay que ser conscientes de que el cristianismo abarca muchos ámbitos especulativos y prácticos que, en una investigación de esta naturaleza, son imposibles de abarcar. Por lo mismo, el presente estudio se limita a mostrar de manera muy panorámica sólo algunos de los elementos teológicos de la crisis de Occidente que muchas veces son pasados por alto en distintos ámbitos, considerando que la Teología cristiana está conformada por una fuerte base filosófica. Como corolario de este estudio se deduce una solución que deviene de los mismos factores que han sido causas de la crisis. Se ha realizado una selección de algunos autores que he considerado como representativos de movimientos de pensamiento que han dado lugar a ciertos cambios importantes, y presentarlos demostrando el papel que ha tenido la modificación de la Teología cristiana en la crisis de Occidente. Alex Byrne and Jordi Fernández propose two different versions of a transparency theory of self-knowledge. According to Byrne, we self-attribute beliefs by an inference from what we take to be facts about the world (following a rule he calls BEL). According to Fernández, we self-attribute the belief that p on the basis of a prior mental state, a state which constitutes our grounds for the belief that p (thereby realizing a procedure he calls Bypass). In this paper, I present the (...) two theories in outline and discuss various objections concerning their normative (Can the procedure give us knowledge?) and metaphysical aspects (Is the procedure functional?). I conclude that especially the metaphysical objections against Bypass are somewhat more difficult to counter than those against BEL and that the modifications required of Fernández’s theory make it very similar to Byrne’s. -/- Alex Byrne y Jordi Fernández proponen dos diferentes versiones de la teoría de la transparencia del autoconocimiento. Según Byrne, para autoatribuir creencias inferimos qué es lo que creemos a partir lo que tomamos como hechos sobre el mundo (siguiendo una regla que Byrne llama BEL). Según Fernández, autoatribuimos la creencia de que p con base en un estado anterior a esta creencia, un estado que fundamenta la creencia de que p (realizando un procedimiento que él llama Bypass). En este artículo expongo las dos teorías y discuto objeciones que conciernen su aspecto normativo (¿puede el procedimiento darnos conocimiento?) y metafísico (¿es funcional el procedimiento?). Concluyo que en especial las objeciones metafísicas son más graves en el caso de Bypass que en el de BEL y que las modificaciones requeridas de la teoría de Fernández la asemejan mucho a la de Byrne. The knowledge of truth, in Plato, is an experience that calls for conversion of the soul (μεταστροφή, περιστροφή). The basic feature of this experience consists in some sort of connection, which is constantly at work, between rational arguments and their non-rational conditions, briefly, lógos and páthos. How does this connection show up in Plato? Its crucial importance emerges many times at both narrative (récit) and theoretical level. In the three parts of my contribution, I show how logos-pathos intertwines with Plato's (...) notion of conversion considered as a double-sided phenomenon, as both "process" of moral education and "noetic event". This article is an attempt to approach what is currently called human trafficking among legal circles and journalistic discourses, from an aesthetic-technological perspective, as a technology that seeks to produce an experience of the obliteration of bodies. Firstly, we make a characterization of the way these discourses operate, as well as of their effects in order to indicate just how incapable of pondering aesthetic-technological functioning they are, as far as the technology experience postulated herein. In the final part the article, (...) a series of elements and mechanisms of what would constitute that technology of experience is enumerated. In conclusion, a conceptual supplement is offered that seeks to characterize a mechanism of non-recognition at the center of this technology of experience. (shrink)

A Crítica de Hume ao Argumento do Desígnio José Oscar de Almeida Marques Dep. de Filosofia – UNICAMP -/- RESUMO: É comum considerar que o chamado “argumento do desígnio” (o argumento a posteriori para provar a existência de Deus a partir da ordem e funcionalidade do mundo) teria sido refutado ou seriamente abalado por Hume. Mas a natureza e o alcance dessa alegada refutação são problemáticos, pois Hume muitas vezes expressou suas críticas através de seus personagens e evitou assumi-las diretamente (...) enquanto autor. Em vez de supor que Hume procedeu dessa forma apenas para disfarçar suas verdadeiras convicções e evitar um conflito com as autoridades eclesiásticas, proponho que sua posição nesse assunto não é tão categórica como às vezes se supõe, e que os famosos argumentos de Filo nos Diálogos mostram apenas que é possível que a ordem e funcionalidade do mundo tenham surgido sem a intervenção de um desígnio consciente, mas não podem por si sós dar a essa hipótese o mínimo grau de plausibilidade necessário para torná-la digna de uma séria consideração. De fato, antes da revolução explicativa operada por Darwin um século depois, ninguém estava realmente em condições de vislumbrar uma alternativa plausível à atuação de algum tipo de inteligência na geração da ordem e funcionalidade do mundo. ------------ Some Remarks on Hume’s Critique of the Argument from Design José Oscar of Almeida Marques Dep. of Philosophy - UNICAMP -/- ABSTRACT: The so-called “argument from design” (the a posteriori argument to prove the existence of God from the order and functionality of the world) is commonly considered to have been refuted or seriously impaired by Hume. But the nature and scope of this alleged refutation is problematic because Hume often expressed his critics through other characters’ mouth and avoided to assume them directly as author. Contrarily to the supposition that Hume proceeded in this way only to disguise his true convictions and to avoid a confrontation with the ecclesiastical authorities, I propose that his stance on the matter is not, in fact, as clear-cut as it is sometimes supposed, and that Philo’s famous arguments in the Dialogues show only that it is possible for the order and functionality of the world to have arisen without the intervention of an intelligent design, but cannot by themselves lend to this hypothesis the least degree of plausibility needed to make it worthy of serious consideration. In fact, before the explanatory revolution inaugurated by Darwin a century later, nobody was in position to envisage a plausible alternative to the operation of some sort or other of intelligence in the generation of the order and functionality of the world. In this paper I first present Dan Korman’s (2015) recent defence of a conservative view as regards the existence and composition of material objects, and then go on to criticize some of his arguments. I will focus on two related issues: on the one hand, I argue that his defense of that kind of view by making use of what he calls “arguments from counterexamples” has some metaontological presuppositions that are indeed unacceptable for someone defending the revisionist views he opposes; (...) on the other hand, I also claim that his defence of the epistemic authority of the singular intuitions allegedly backing some key premisses in those arguments is also flawed, as it seems to be in tension with his realist commitments. In this paper I present what I call the 'Metaphysical Problem of Truth', which consists in explaining in virtue of what all true sentences are true, and argue that a version of the Correspondence Theory of Truth is the most plausible solution to this problem.

What are and where are the ethical limits of neuroeducation? The article reflects on a necessary question for the evolution of cognitive processes through critical deliberation, the delimitation of boundaries and the estimation of progress. On the one hand, it argues that the experimental turn could call into question the ethical and humanistic goal of education; on the other hand, it argues that a systematic renunciation of neuroscientific advances would also mean abandoning the quest for human flourishing. The humanities alone (...) do not provide the biopsychosocial approach from which we must understand our self-realisation. Thus, the first of the limits that is the origin of all the others arises from a scientific-humanist dilemma. The new boundaries to be delimited are the neuroscientific implications in themselves and how these are translated into educational, if they were to be valid in this field. Here neuromyths play an important role. It is precisely neuroethics as an applied ethics or branch of bioethics that takes up these aspects through neuroeducational ethics and educational neuroethics. In its fundamental branch, this discipline opens up the debate on moral neuroeducation. But the possibility of reducing morality and all that we are to our neural bases leads to new limits. To overcome them, he highlights the potential of a sociocultural and biological symbiosis with the notions of 'neuroculture' and 'proactive epigenesis'. Finally, the essay deliberates on the more speculative boundaries between what we are and our possibilities for understanding it on the basis of transhumanism. ____________________________________________________________________________________________________ ______________________________________________________________________________________________¿Cuále s son y dónde están los límites éticos de la neuroeducación? El artículo reflexiona sobre una cuestión necesaria para el devenir de los procesos cognitivos mediante la deliberación crítica, la delimitación de fronteras y la estimación del progreso. Su hilo argumental proyecta, por un lado, que el giro experimental podría poner en entredicho el objetivo ético y humanista de la educación; por otro lado, que una renuncia sistemática a los avances de las neurociencias supondría, igualmente, abandonar la búsqueda del florecimiento humano. Las humanidades solo no brindan el enfoque biopsicosocial desde el que hemos de entender nuestra autorrealización. Por ende, el primero de los límites que es origen de todos los demás surge dada una disyuntiva científico-humanista. Los nuevos confines a delimitar subyacen de las implicaciones neurocientíficas en sí mismas y de cómo estas se trasladan a la praxis escolar, si es que tuviesen validez en este campo. Aquí los neuromitos juegan un papel importante. Precisamente, la neuroética como ética aplicada o rama de la bioética recoge estos aspectos mediante la ética neuroeducativa y la neuroética educativa. This chapter introduces and discusses the concepts that are in-depth articulated in the volume. International migration is presented here as a test bench where the normative limits of institutional order, its contradictions and internal tensions are examined. Migrations allows to call into question classical political categories and models. Pointing at walls and fences as tools that reproduce enormous inequalities within the globalized neo-liberal system, this chapter presents the conceptual tensions and contradictions between migration policies and global justice. We challenge the (...) conceptualization of justice as a relationship between citizens of the same country and the State and argue that, in our globalized world, nation-state cannot constitute the basic unit of the theories of justice. We argue that an integral approach that includes the complex and interconnected forms of structural inequalities and transcends the borders of national sovereign states is required. Avoiding the methodological nationalism and the exclusionary biases that inform current migration and border control policies, this chapter finally places attention on the most marginalized subjects of the migration chain: migrant women workers. We point out the importance of addressing transnational structural inequalities and bringing social reproduction to the center of global justice theories. (shrink)

The general aim of this article is to carry out a reconstruction of the theory of Population Dynamics (DP) in Ecology, according to Castle’s (2001) general stance with regard to the semantic view of theories, but doing it within the framework of metatheoretical structuralism. Thus, we will first identify Population Dynamics’ basic theory-element: its core K(DP) – with the class of potential models, the class of models (through the identification of its fundamental law) and the class of partial potential models (...) (though leaving aside the identification of its constraints and its intertheoretical links) –, and its domain of intended applications I(DP). Then, we will establish the general guiding lines of its theory-net, developing in some detail one of its main lines of specialization – namely, that related to the so-called “continuous growing” of the considered populations –, with DP’s principal “models”, and leave developing of the other of its main lines of specialization – namely, that related to the so-called “discrete growing” of the considered populations – for a further publication. This work deals with the discussion about the characterization of the emotions that maintain the so called "cognitive current" and "perceptive current". These have been canonically conceived as incompatible ways of accounting for the same phenomenon: the basic emotions. In this paper I intend to examine the disagreement between these opposing approaches, seeking to clarify the scope of this disagreement, and to elucidate the key concepts on this discussion. The article reviews the structure that is detailed below. Each of the (...) positions in question is presented first. To this end, both philosophy and psychology have been considered: R. Solomon and R. Lazarus (cognitive perspective) and W. James and R. Zajonc (perceptive perspective). In this section (The approaches in dispute) I will try to offer a conceptual reconstruction of each of the positions, establishing the fundamental theses of each of them, to be examined in depth in the next section (Cognition and perception) in order to show that the disagreement itself and the difficulties that emerge from it, to provide an adequate characterization of the phenomenon, that can be overcome or at least, must be reconceptualized. In this sense, I will offer two ways in which this reconceptualization can be given: in a dissolute sense, by showing that the discrepancy between the two perspectives are based on false dichotomies, turning the discussion into a terminological disagreement. La fuerza del movimiento español se debe bastante a su constitución como tecnopolítica. La capacidad demostrada de construir dispositivos que transitan entre la calle y la red torna el movimiento potente en ambos los espacios y tiene ayudado en la movilización de la sociedad española. Ese uso táctico de las nuevas tecnologías de comunicación y de la internet permiten que el #15M forme una especie de consciencia de red, o mejor, la subjetividad de red hace parte de la actuación (...) dentro de él. De cierta forma, la visualización del #25S en Twitter nos revela éso. A pesar de ser solo una parte de toda la red del movimiento, que es constituida también por blogs, sites, perfiles individuales y colectivos en el Facebook, etc., la configuración de esa red presenta un poco como es la actuación colectiva de los sujetos. La narrativa colaborativa construida por medio de hashtags es también un de los mecanismos del movimiento usado para aprovechar una parte de su inteligencia colectiva. (shrink)

Beyond the eras a dialogue seems to have been established between Bruegel the Elder (1525-1569) and Antonin Artaud (1896-1948). The poet’s wonder at the « painting of the North », both realistic and emblematic, reveals his deepest ideal as an artist : painting, a « magical » operation, deploys a power of expression based on signs and no longer on words, which the theatre is also called upon to seize. The juxtaposition of Bruegel’s Triumph of Death and a famous drawing (...) by Artaud, Le Théâtre de la cruauté [The Theatre of Cruelty], highlights the striking convergences between the two artists. Through their pictorial works, both of them renew over the centuries the funerary and mythical symbolism of death, inherited from the macabre scenes of medieval paintings, but also from ancient times. Studying the references to theatrical iconography in Bruegel’s painting, where carnival and crudity of death reinforce each other, allows us to deepen the meaning of these resonances. For the two artists, form and poetic momentum meet so that representation, as a structure common to painting and theatre, fixes a moment of the world, while animating that moment to infinity, thanks to signs conceived as « true hieroglyphs » (Artaud), a problem that Michel Foucault associated with the strongest truth that the experience of madness carries. The purpose of this paper is to show how the phenomenology of the body developed in his late writings by the Czech philosopher Jan Patočka can be seen as the final stage of the archaeology of the Lebenswelt developed by Edmund Husserl and reshaped by Martin Heidegger. According to this exegetical and philosophical hypothesis, only a phenomenology of the body can be a serious attempt to resolve the conflict between the so-called “manifest” and “scientific” images of the world, in which (...) the concept of Lebenswelt is rooted. The peculiarity of Jan Patočka’s phenomenology of the body is to stress the strong connection between the notion of sense, the affective dimension of human experience and the necessity of taking into consideration a “bodily” point of view on the experience. This article covers the different stages of the constitution of the person that goes beyond selfishness and self-affirmation and is formed as the inseparable unity of the metaphysical subject that is expressed in the "Other-in-the same" and "Being-for-the-other". This leads one to say that the person is intrinsically relation and exteriority that is realized in the language that transcends the inner self. This relationship, considered internally as a footprint, and in the exterior as visage, invokes a third party that establishes (...) and holds it. Postmodern thought has focused itself on the critique of modern epistemology that was founded on a clear distinction between the knowing subject and the object of knowledge. For postmodern thought such a distinction is non-existent or dubious at best. Postmodernism has carried to its logical conclusion the postulates of structuralism; therefore, for postmodern thought there is no general intrinsic meaning in a fact of thing, but there are only particular ways for attributing meaning to such facts and things. Hereunder, we (...) attempt to trace the genealogy of postmodern thought on the history and philosophy of science, because science, traditionally regarded as the summit of knowledge and rationality by modern epistemology, has not been immune to the wholesale critique practiced by this new school of philosophical cynicism that we call postmodernism. Wittgenstein's work is often read as a criticism of subjectivity. A very strong attack (...) is indeed to be found in his thought against the metaphysical illusion of subjectivity . This still leaves room for accounting for Wittgenstein's positive contribution to what may be called a concrete phenomenology of subjectivity, that is, of the subject as it manifests itself within language. En 1968 ocurrieron dos hechos sobre los cuales cabe hacer una reflexión orientada por la bioética: la llamada Revolución del 68 y la aparición de la Carta encíclica Humanae Vitae. El Concilio Vaticano II, que fue presentado como una actualización de la Iglesia católica al mundo moderno, fue el escenario de los estudios previos a la redacción del documento pontificio, donde Pablo VI dejó clara la postura del Magisterio de la Iglesia sobre la moral sexual y anticipa los errores prácticos (...) que se seguirían a planteamientos conceptuales antropológicos erróneos o equivocados sobre esa temática. Hay necesidad de rehabilitar la Humanae vitae para volver a percibir el acto conyugal en su “verdad inalterable”, donde no se puede separar el bien y la belleza de la donación mutua de los cónyuges, que redunda en el bien común de la sociedad para defender su célula básica y nuclear que es la familia. In 1968, two events occurred on which it is worth reflecting on bioethics: the so-called Revolution of 1968 and the appearance of the Encyclical Letter Humanae Vitae. The Second Vatican Council, which was presented as an update of the Catholic Church to the modern world, was the scene of the studies prior to the drafting of the pontifical document, where Paul VI made clear the position of the Magisterium of the Church on sexual morality and it anticipates the practical errors that would follow erroneous or mistaken anthropological conceptual approaches on this subject. There is a need to rehabilitate Humanae vitae in order to re-perceive the conjugal act in its "unalterable truth", where good and beauty cannot be separated from the mutual donation of the spouses, which results in the common good of society to defend its basic and nuclear cell which is the family. In the field of Evidence Law the relation between truth and law has been a somewhat non- debated topic in the past years. It is a given that such a connection exists and, it is understood as the notion of the ascertainment of the truth of disputed questions of fact through legal evidence. The thesis that I have reconstructed in this paper has been presented by Prof. Jordi Ferrer who grounds the connection between truth and law in the role of (...) the legal system as a tool for guiding the behavior of the governed. I call this thesis the theory of the structural clause of truth. In this paper I shall present a possible reconstruction of this theory, I shall raise two objections against it and I shall present five possible interpretations of the relation between truth and law. Part 1 of this exchange consists in a critique by Smith of Searle’s The Construction of Social Reality focusing on Searle’s use of the formula ‘X counts as Y in context C’. Smith argues that this formula works well for social objects such as dollar bills and presidents where the corresponding X terms (pieces of paper, human beings) are easy to identify. In cases such as debts and prices and money in a banks computers, however, the formula fails, because these (...) are cases of what he calls ‘free-standing Y terms’, since there is here no X which can count as the corresponding Y. In his response in Part 2, Searle argues that Smith’s critique rests on three misunderstandings: 1. in wrongly presupposing that Searle is trying to analyze the nature of what he calls “social objects”, rather than of social facts; 2. in thinking that the counts as formula is intended as a definition, rather than as a mere mnemonic; and 3. in neglecting the naturalism of Searle’s account. Comme de nombreux penseurs antiques avant et après eux et contrairement à Socrate, Calliclès et Diogène ont déclaré avoir fondé leur éthique sur l’observation de la nature. Et pourtant, les deux discours normatifs qui sont tirés d’une nature que l’on pourrait a priori croire être la même sont on ne peut plus opposés. Calliclès croit que l’homme est appelé à dominer autrui ; Diogène pense plutôt qu’il doit se dominer lui-même ; le premier est un hédoniste débridé, le second croit (...) que le bonheur ne s’achète qu’au prix du sacrifice des désirs artificiels. Comment expliquer cette dichotomie ? Nous empruntons deux routes explicatives. D’abord, nous montrons que pour Calliclès et Diogène, la notion de nature non seulement diffère, mais est observée sous un angle différent. La première est celle des tyrans et de dieux anthropomorphes, la seconde, celle de petits animaux et de dieux autarciques. La première concerne la relation des hommes entre eux ; la seconde, celle de l’homme avec lui-même. Ensuite, nous exposons la différence des présupposés normatifs qui précèdent ou accompagnent l’observation de la nature ; nous contrastons, pour ce faire, les formes d’anticonventionnalisme et d’anti-intellectualisme défendues par Calliclès et Diogène. -/- SUMMARY. Like many ancient thinkers before and after them and contra Socrates, Callicles and Diogenes said they based their ethics on the observation of nature. And yet, the two normative discourses that are derived from nature that we might a priori believe to be the same could not be more opposed. Callicles believes that people are called to dominate others, Diogenes rather thinks people must dominate themselves. The first is an unbridled hedonist, the second believes that happiness can be bought only at the price of sacrificing artificial desires. How to explain this dichotomy? We take two explanatory routes. First, we show that for Callicles and Diogenes, the notion of nature not only differs but is observed from a different angle. The first one is the nature of tyrants and anthropomorphic gods, the second that of small animals and autarkic gods. The first focuses on the relationship between people, the second focuses on the relationship of a person with themselves. Secondly, we expose the difference in normative assumptions that precede or accompany the observation of nature; in order to do so, we contrast anticonventionalism and anti-intellectualism forms proper to both Callicles and Diogenes. From the comparison of the Grundrisse (1857-58) manuscripts with Marx's subsequent writings, it is clear that the so-called « deduction » of fundamental economic categories follows two distinctive patterns, one of which is close to ordinary logical analysis, the other being inspired by Hegel's dialectics of essence. This duality is reflected in the double meaning of the concept of « presupposition » (Voraussetzung) and, finally, in the simultaneous endorsement by the Grundrisse of two labour-value theories, one of which is Smithian-like, (...) the other is Ricardian. Marx's reinterpretation of economic value as an « immanent measure », i.e., his claim that commodities are measured by each other when exchange takes place, should help to bridge the gap between the two theories. However, such reinterpretation is shown to be inadequate ; as a result, Marx's account of value should be seen as internally inconsistent. (shrink)

Our purpose is to describe the application of legitimate defense in so-called non-confrontational situations. To do this, we will conceptualize gender violence as that which against women, due to their condition as such, and we will describe the absence by the courts in the identification of this problem. Second, we will analyze the reception of Argentine and international legislation on the treatment of gender violence and the recommendations and criteria to take into account when interpreting and applying criminal law. Finally, (...) we will present the treatment of legitimate defense in contexts of gender violence, analyzing each of its elements. Our conclusions will focus on the need to address situations of gender violence based on international regulations for the application of legitimate defense in non-confrontational situations. El trabajo desarrollado por las kellys o camareras de piso se caracteriza por encontrarse dentro de lo que se podría denominar como «trabajo de cuidados», aunque se inscribe de lleno en el campo productivo y es una parte vital del sector turístico. Su caso es un claro ejemplo de la intersección entre la precariedad y la invisibilidad de unas tareas que han sido histórica y culturalmente asignadas a las mujeres y condenadas al menosprecio social. En un contexto como el actual, (...) cabe preguntarse sobre las condiciones sociales que subyacen a este colectivo y las implicaciones que se derivan de su situación de invisibilidad en un sector tan precario como el turístico dentro del Estado español, así como sobre el papel de Las Kellys –como asociación– en la reivindicación de los derechos laborales de las trabajadoras. Analizaremos su caso como una muestra de movimiento político y social que lucha por la visibilización de las tareas de cuidados y que contribuye a la repolitización de dichos trabajos en el ámbito público. The work done by the Kellys, or apartment waitresses/cleaners, is characterised by it lying in what could be called “care work”, despite being completely undertaken in the production field and forming a vital part of the tourism sector. Their case is a clear example of the intersection between precarious work and the invisibility of some tasks that have been historically and culturally appointed to women and condemned to social scorn. In today’s context, it is worth considering the social conditions underlying this group of workers and the implications that stem from their situation of invisibility in such a precarious sector as the tourism one in the Spanish State, and the role played by the Kellys, as an association, to claim these female workers’ employment rights. We will analyse their particular case as a clear example of the socio-political movement that struggles to make their care work visible and contributes to the repoliticisation of their work in the public domain. The History of scepticism from Erasmus to Spinoza is often called upon to support three theses: first, that Descartes had a dogmatic notion of systematic knowledge, and therefore of physics; second, that the hypothetical epistemology of physics which spread during the xviith century was the result of a general sceptical crisis; third, that this epistemology was more successful in England than in France. I reject these three theses: I point first to the tension in Descartes’ works between the ideal of (...) a completely certain science and a physics replete with hypotheses; further, I argue that the use of hypotheses by mechanical philosophers cannot be separated from their conception of physics; finally I show that, at the end of the xviith century, physicists in France as well as in England spoke through hypotheses and I examine different ways of explaining this shared practice. Richard H. Popkin’s book serves therefore as a starting point for insights into the general problem: to what extent and for what reasons some propositions in physics have been presented as hypotheses in the xviith century? After the collapse of the Hegelian philosophy, many thinkers returned to the main principles of Kantian transcendentalism. In this way, they initiated the neo-kantian movement. Wilhelm Dilthey was among them. Nevertheless, only in spirit can his “Critique of the Historical Reason” be called neo-kantian. In fact, the core of Dilthey’s project, the “Categories of Life”, is a completely new gnoseological proposal, that mediates between transcendental philosophy and empiricism.

El 27 de septiembre de 1943, Hans-Georg Gadamer publicó un breve pero significativo ensayo en el periódico conservador Leipziger Neueste Nachrichten und Handels-Zeitung, titulado “Wissenschaft als Beruf. Über den Ruf und Beruf der Wissenschaft in unserer Zeit”. El artículo, que recuperaba en medio de la Segunda Guerra Mundial el problema del valor y posición de la ciencia y la filosofía, nunca fue reimpreso en su obra completa, ni en los diez tomos editados por la editorial Mohr Siebeck ni tampoco por (...) separado en libros o revistas. Debido a su relevancia filosófica, política e histórica, se ofrece aquí, en primer lugar, una introducción crítica al contexto y principales contenidos de este texto, especialmente por medio del análisis de su confrontación con la actualidad a través de referencias explícitas e implícitas a la conferencia Wissenschaft als Beruf de Max Weber de 1917. En segundo lugar, se ofrece aquí su primera traducción del alemán al castellano.// This article introduces the first Spanish translation of Hans-Georg Gadamer’s overlooked 1943 essay Wissenschaft als Beruf. Über den Ruf und Beruf der Wissenschaft in unserer Zeit. Engaging Max Weber’s seminal 1917 lecture Wissenschaft als Beruf, Gadamer criticizes the bureaucratization and instrumentalization of modern science, recovering the question of research’s value amidst World War II’s catastrophes and National Socialism’s totalitarian rule. Never reprinted in Gadamer’s complete works, the text articulates an early critique of technocratic rationalization, affirming science’s need to reclaim its originary mission. By analyzing Gadamer’s confrontation with the present through overt and covert references to Weber, the introduction situates the essay’s historical and intellectual backdrop, develops its core arguments and traces echoes in Gadamer’s later works addressing contemporary challenges. This first Spanish translation unveils a forgotten text where Gadamer confronts modern science’s distortion, calling for the recovery of its existential and cultural meaning. (shrink)

This article advances the hypothesis that the Fichtean enterprise of grounding all possible experience in a fundamental principle has to fail in order to succeed one of its most important tasks: reformulating the very idea of subjectivity. In order to ground this hypothesis, the paper will be divided in four parts: (i) the first one will analyze the starting point of the work where Fichte lays the foundations of his philosophical project (Grundlage der gesamten Wissenschaftslehre) so as to show that (...) its first principle contains a fundamental ambiguity. We will then (ii) suggest that this very ambiguity reveals itself in the Anstoß, the conceptual tool through which Fichte intends to get rid of the Kantian notion of thing-in- itself. In a third moment (iii), we will explore the effects of this abandonment of the thing-in-itself on the relation between the finite and the infinite, what will bring us to the notion of failure. Finally (iv), we will propose to interpret this failure as a positive driving force of a permanent calling into question of the subject and its language. (shrink)

Après cette date, rattachée à l'Empire Russe, elle a dû rentrer, sous le nom de Bessarabie dans un tout autre giron culturel, à la frontière des civilisations. Aujourd'hui, le discours relatif à la culture et à l'identité est-il double ou dédoublé ? Certains Moldaves plaident pour leur identité roumaine, d'autres pour leur identité moldave et ceci sur un fond (...) à nombreuses touches multiculturelles. Un représentant du quartier général d'une organisation internationale a demandé à un collaborateur moldave son avis quant à la nationalité qu'il faudrait indiquer sur la liste des employés. Puisqu'au moment où, pour les ressortissants de la République de Moldavie, il a été écrit «moldave», le représentant roumain a objecté que cette nationalité n'existe pas. Si vous étiez le représentant moldave, que répondriez-vous?Before 1812, the current Republic of Moldova, then a territory of the Rumanian region called Moldova, chose France as a cultural model and outlet. After this date, the territory became part of the Russian Empire under the name of Basarabia and thus entered a completely different cultural space at the border of civilizations. Nowadays, is the discourse related to culture and identity doubled or divided? Some Moldavans opt for a Rumanian identity and others a Moldovan one in a context with many multicultural aspects. A representative of the headquarters of an international organization asked a Moldavian colleague under which nationality he should be put down on a list of employees. “Moldavian” was chosen for citizens of the Republique of Moldova only for the Rumanian representative to object that this nationality did not in fact exist. This paper elaborates some of the conceptual implications of Derrida’s call for “another thinking of life” in Voyous: Deux essais sur la raison. The paper first argues that Derrida’s deconstruction of the opposition between metaphorical and literal uses of the discourse of life in La vie la mort is radicalized in Voyous when he argues that democracy’s “autoimmunitary suicide” should be the point of departure for rethinking life in general. To understand further these autoimmune-suicidal tendencies, the paper turns to Derrida’s (...) engagement with Aristotle’s conceptual figure of the prime mover in Voyous. The paper argues that Derrida turns to Aristotle because the prime mover illustrates the ways in which the concept of life remains historically and structurally informed by the philosophical value of ipseitocratic sovereignty, which is allergic to the disseminatory, proliferating, and improper qualities that the philosophical tradition has always ascribed to democracy. Autoimmunity thus provides a way for thinking of a democratic life that is not entirely determined by the teleological power of any divinely good life. (shrink)

John Rawls shows a deep influence of David Hume’s thought, mainly at his Theory of Justice, though also at the rest of his works. This influence is well-known in the field of political philosophy, much less in the field of moral philosophy. Rawls reads Hume’s thought with a sceptic and naturalistic key, attributing him what he calls a “nature fideism”. Besides this, attributes to Hume an ethical and political position linked with the classical utilitarianism. Nevertheless, his skeptical epistemology will move (...) away, paradoxically, to Hume from the utilitarian positions. Hume’s ethics and politics will finish, according to Rawls, showing a purely descriptive character and a lack of normative purposes. Hume does not have in the strict sense a theory of practical reason. This article examines and puts in question this interpretation of Hume proposed by John Rawls. The philosophy of Hume is not aporetically skeptical, articulates the moral roles of reason and the passions; and finally, is not only connected with utilitarianism; his defense of the role of utility frees to his theory of some of the main contradictions of classical utilitarianism. Besides this, the theory of the “judicious spectator” can be considered a form of a theory of practical rationality. (shrink)

En la filosofía de Aristóteles y en la filosofía escolástica de cuño aristotélico, la abstracción constituía un acto fundamental del proceso cognitivo: marcaba el salto o ascenso de la sensibilidad a la inteligibilidad, del conocimiento del individuo al conocimiento de su esencia. En la teoría del conocimiento de Hegel, por el contrario, el concepto abstracto o, como Hegel prefiere llamarlo, la “representación abstracta” o “representación universal” es tan sólo un momento intermedio en el proceso fluido que va del conocimiento del (...) objeto como algo sensible -en la forma de la intuición y la subforma de la imagen- al conocimiento de su naturaleza intrínseca -en la forma del pensar. Sobre la base, por un lado, de los escasos textos en los que Hegel se ocupa expresamente del tema, y, por el otro, de la contextualización de estos textos en un análisis general de la filosofía del espíritu subjetivo teórico, el presente trabajo busca reconstruir las tesis fundamentales de Hegel sobre la abstracción y esclarecer con ello el sentido y función que la misma tiene en su teoría del conocimiento. The concept of abstraction in Hegel's theory of knowledgeIn both Aristotelian philosophy and the scholastic philosophy that bears its stamp, the concept of abstraction constitutes a fundamental act in the cognitive process; it signaled the leap or ascent from the realm of the senses to the realm of intellection, from knowledge of the individual to knowledge of his essence. By way of contrast, in Hegel's theory of knowledge, the abstract concept -or, as Hegel himself preferred to call it, “abstract representation” or “universal representation”­- is nothing but an intermediate moment in the fluid process of going from knowing the object as something given to the senses -in the form of intuition and the subform of image- to knowing its intrinsic nature -in the form of thought. Based on the scant writings by Hegel wherein he expressly addresses the matter, and by subsequently placing these texts into the broader context of an analysis of Hegel's philosophy of theoretical subjective spirit, this paper attempts to reconstruct Hegel's most significant ideas on abstraction. Hopefully, this will serve to clarify both the meaning and the role of that notion in Hegelian theory of knowledge. (shrink)
