Concebir los derechos como una protección no-paternalista de los intereses de sus titulares supone aceptar que su aspecto más relevante consiste en la provisión de una competencia para renunciar o consentir su inobservancia por terceros, lo cual no tiene por qué coincidir con la mejor estimación de sus intereses, aun cuando estos últimos juegan un papel importante en la justificación de las posiciones jurídicas implicadas. A partir de la tesis de la correlatividad, los conceptos jurídicos fundamentales de W.N. Hohfeld y (...) una tesis de la combinación que armoniza los elementos de la voluntad e interés en la explicación de los derechos, en el presente artículo se tratará de mostrar por qué afirmar el carácter inalienable de los derechos contradice la función que estos desempeñan en los ordenamientos jurídicos modernos. // The understanding of rights as non-paternalistic protections of its holder’s concerns entails that the most important aspect of them is the provision of a power either to waive or to consent their encroachment by others, which does not necessarily coincide with the best appraisal of his/her interests, even when they play an important role in the justification of the subjective legal positions. From the correlativity thesis, the fundamental legal conceptions devised by W.N. Hohfeld and a combination thesis that merges the elements of will and interest in the explanation of rights, I will try to show why to stand up for the inalienable character of rights contradicts the function they perform in modern legal systems. It has been argued that moral assertions involve the possession, on the part of the speaker, of appropriate non-cognitive attitudes. Thus, uttering ‘murder is wrong’ invites an inference that the speaker disapproves of murder. In this paper, we present the result of 4 empirical studies concerning this phenomenon. We assess the acceptability of constructions in which that inference is explicitly canceled, such as ‘murder is wrong but I don’t disapprove of it’; and we compare them to similar constructions involving ‘think’ (...) instead of ‘disapprove’—that is, Moore paradoxes (‘murder is wrong but I don’t think that it is wrong’). Our results indicate that the former type of constructions are largely infelicitous, although not as infelicitous as their Moorean counterparts. (shrink)

Ideal theory in social and political philosophy generally works to hide philosophical theories’ complicity in sustaining the structural violence and maintenance of white supremacy that are foundational to settler colonial societies. While non-ideal theory can provide a corrective to some of ideal theory’s intended omissions, it can also work to conceal the same systems of violence that ideal theory does, especially when framed primarily as a response to ideal theory. This article takes a decolonial approach to exploring the limitations of (...) non-ideal theory in its ability to respond to and redress the continuing harms done to Indigenous peoples by settler colonialism, including by outlining non-ideal theory’s relationship to a colonial politics of recognition. Subjective rights enjoy limited import in Kelsenian theory for whereas the concept of duty underlies every legal norm, that of rights is merely possible and only emerges when the imposition of the sanction attached to the breach of the duty is made dependent upon a subject's will to bring legal action. The presence of secondary norms establishing certain duties of medical professionals on informed consent displays the existence of correlative reflex rights of patients. Yet, together with secondary norms, Western legal (...) systems typically institute norms of competence enabling patients to take legal action when those duties correlative to their reflex right to informed consent have been infringed. Thus, informed consent constitutes a set of subjective legal positions of patients and medical professionals. Despite its excessive formalism and questionable neutrality, the Kelsenian approach permits to define and clearly distinguish patients' genuine rights from mere aspirations devoid of legal basis. Diversas fuentes culturales explican los orígenes del marcado individualismo imperante en nuestras sociedades actuales. Posiblemente, una de las manifestaciones más aclamadas de este individualismo sea la primacía de la autonomía individual, elemento clave en la articulación y fundamentación de las posiciones jurídicas subjetivas presentes en la práctica totalidad de los ordenamientos jurídicos contemporáneos, y como resultado de la expansión de la cultura occidental. Sin embargo, en ocasiones, el peso otorgado a la autonomía se antoja desproporcionado, especialmente cuando conduce a la (...) inobservancia, ya sea total o parcial, del bien común o alguna de sus manifestaciones, presupuesto de toda relación social y exigencia del principio de justicia. Junto a la autonomía, en tanto que elemento necesario para el florecimiento individual, la búsqueda del bien común debe asimismo servir a la configuración de los diversos instrumentos de decisión política y jurídica que regulan la vida en común, lo que requiere el justo equilibrio de los intereses en juego, tal y como aconseja el principio de proporcionalidad. El paradigma de las enfermedades contagiosas proporciona un claro ejemplo de lo anterior, pues la protección de la salud pública, entendida como una manifestación del bien común, no solo justifica, sino que incluso exige la restricción de ciertas posiciones jurídicas subjetivas que sirven a la especificación de la autonomía individual de sus titulares. Gender-based forms of administrative violence, such as reproductive violence, are the result of systems designed to enact population-level harms through the production and forcible imposition of colonial systems of gender. Settler statecraft has long relied on the strategic promotion of sexual and reproductive violence. Patterns of reproductive violence adapt and change to align with the enduring goals and evolving needs of settler colonial occupation, dispossession, and containment. The U.S. Supreme Court’s recent decision to end the constitutional right to abortion in (...) Dobbs v Jackson is but one instance of this larger pattern. We analyze reproductive and obstetric violence and the structural trauma they produce through the lenses of i) historical continuity and ii) the global architectures of neoliberal settler capitalism in order to connect reproductive rights rollbacks in the U.S. with the expansion of reproductive violence across a world connected by colonial globalization. Aunque presenta un sustrato corporal, este aparece combinado con elementos de índole moral que presuponen una noción concreta de persona como libre y autónoma. Tanto de las definiciones doctrinales como del material normativo se desprende que se trata de una posición jurídica subjetiva del paciente, alternativamente calificada como una “pretensión” o “derecho subjetivo en sentido estricto”, en términos hohfeldianos; un “derecho negativo de defensa”, o una “inmunidad”. En España, el Tribunal Constitucional ha vinculado el consentimiento informado del paciente al derecho fundamental a la integridad física y moral (15 CE), lo cual permite plantear el análisis en clave iusfundamental. Con todo, se advierten dudas e incompatibilidades entre la explicación habitual del consentimiento informado, su fundamento constitucional y su regulación jurídica. El objetivo del presente libro consiste en proporcionar una definición integral del consentimiento informado como derecho subjetivo del paciente y como manifestación de un derecho fundamental, a partir de una óptica poliédrica que aporta certeza en la práctica asistencial y jurídica. // The patient's right to informed consent is inserted within the scope of his decisional autonomy. Although it has a bodily background, it is combined with features of moral nature, which presupposes a concrete notion of the person as free and autonomous. Both, doctrinal approaches and normative legal material show that it is a subjective legal position of the patient, being alternatively qualified as a Hohfeldian “claim” or a “subjective right in a strict sense”; a "negative right" or an "immunity." The Spanish Constitutional Court has linked the informed consent of the patient to the fundamental right to physical and moral integrity (15 CE), which allows us to propose a fundamental rights-based analysis. Nonetheless, doubts and inconsistencies are perceived between the customary explanation of informed consent, its constitutional foundation and its legal regulation. The aim of this book is to provide a comprehensive definition of informed consent as subjective right of the patient and expression of a fundamental right, from a multi-fold perspective that provides certainty in both legal and health care practice. We cannot simply observe that Emile Durkheim, Claude Lévi-Strauss, and Pierre Bourdieu all received philosophical training and subsequently asserted, in surprisingly similar terms, that escaping from philosophy or breaking away from philosophical modes of thought was a necessary condition for any research in the human and social sciences, without considering whether there might be a direct relationship between the sociological ethos and a particular attitude towards philosophy. The "rupture" with philosophyis never complete: the sociologists' conception of sociology is, on the (...) contrary, heavily influenced by the negative image they have of philosophy, which they always invoke as something to be avoided or a specter that must be exorcised. The sociological perception of philosophy thus constitutes a system of oppositions, a set of likes and dislikes deeply ingrained in the minds of practitioners in the human and social sciences, and which, so to speak, form the very foundation of the discipline and its definition of its identity. By reconstructing it, this article proposes a sociological analysis of the genesis, structure, and function of the sociological unconscious. (shrink)

A partir de los postulados de una concepción semántica de norma y su clasificación en reglas y principios, Robert Alexy ha enunciado una tesis fuerte de la separación, al concebir que entre ambos tipos de normas no solo existe una diferencia gradual, sino también cualitativa. This essay frames systemic patterns of mental abuse against women of color and Indigenous women on Turtle Island (North America) in terms of larger design-of-distribution strategies in settler colonial societies, as these societies use various forms of social power to distribute, reproduce, and automate social inequalities (including public health precarities and mortality disadvantages) that skew socio-economic gain continuously toward white settler populations and their descendants. It departs from traditional studies in gender-based violence research that frame mental abuses such as gaslighting--commonly (...) understood as mental manipulation through lying or deceit--stochastically, as chance-driven interpersonal phenomena. Building on structural analyses of knowledge in political epistemology (Dotson 2012, Berenstain 2016), political theory (Davis and Ernst 2017), and Indigenous social theory (Tuck and Yang 2012), I develop the notion of cultural gaslighting to refer to the social and historical infrastructural support mechanisms that disproportionately produce abusive mental ambients in settler colonial cultures in order to further the ends of cultural genocide and dispossession. I conclude by proposing a social epidemiological account of gaslighting that a) highlights the public health harms of abusive ambients for minority populations, b) illuminates the hidden rules of social structure in settler colonial societies, and c) amplifies the corresponding need for structural reparations. This paper aims to perform a possible heuristic analysis of the film "The Exterminating Angel" (El Angel Exterminador) – produced in 1962 by the Hispanic Mexican director Luís Buñuel – through the platonic thought present in the books: "The Symposium" (Συμπόσιον), and "Republic" (Πολιτεία). It also presents an argument on the film's scriptural, artistic, and historical characteristics, such as some /intersections of its aesthetic movement, the Surrealism – specific correlations with Breton and Benjamin will also be made. Jellinek define “estatus” como la “relación con el Estado que califica al individuo”. Su teoría distingue cuatro tipos: pasivo o subiectionis, negativo o libertatis, positivo o civitatis y activo o de la ciudadanía activa. Al margen de las polémicas sobre su vigencia, se pretende relacionar la aportación de Jellinek con la concepción del consentimiento informado del Tribunal Constitucional español, quien lo ha definido como deber de abstención de los profesionales sanitarios (STC 37/2011, de 28 de marzo, entre otras), es decir, (...) como una negación de su competencia en la terminología de Hohfeld, o como un derecho de defensa. Debido a la adecuación de su estructura al contenido del consentimiento informado, el análisis se centrará en los estatus negativo y positivo. In the present essay, we are going to develop a concept of contemplative walking in light as an aesthetic attitude that can be linked to somaesthetics. My understanding of this type of aesthetic activity is underpinned by the broader framework developed in my PhD thesis, which is based on the poetics of light, to explain how the spectator experiences light installations. So, we are going to analyse what we understand by contemplative walking in light and how it is made possible (...) through a perception based on corporeality and movement. To do this, we are going to analyse two installations – Your Rainbow Panorama (2011) by Olafur Eliasson and YellowBluePink (2015) by Ann Veronica Janssens- to see how they instantiate this type of aesthetic attitude and how it can be related to somaesthetics. O Tribunal Constitucional configura o consentimento informado como un deber de abstención do profesional sanitario, é dicir, como unha negación da competencia do profesional sanitario na terminoloxía de Hohfeld. Así pois, o consentimento informado queda conformado como un dereito negativo ou de defensa, polo que concibilo como liberdade xurídica ou facultade de (...) autodeterminación positiva esixiría a revisión do seu fundamento constitucional. Intersectionality is a term that arose within the black feminist intellectual tradition for the purposes of identifying interlocking systems of oppression. As a descriptive term, it refers to the ways human identity is shaped by multiple social vectors and overlapping identity categories (such as sex, race, class) that may not be readily visible in single-axis formulations of identity, but which are taken to be integral to robustly capture the multifaceted nature of human experience. As a diagnostic term, it captures the (...) confluence of power and domination on the social construction of identity in order to remedy concrete harms that result from this convergence. It is not a prescriptive methodology or closed system of analysis, but rather an open-ended hermeneutic lens through which interconnected systems of oppression can come into focus in the fight for social justice. This paper argues that there is a class of terms, or uses of terms, that are best accounted for by an expressivist account. We put forward two sets of criteria to distinguish between expressive and factual terms. The first set relies on the action-guiding nature of expressive language. The second set relies on the difference between one's evidence for making an expressive vs. factual statement. We then put those criteria to work to show, first, that the basic evaluative adjectives such (...) as ‘good’ have expressive as well as factual uses and, second, that many adjectives whose primary meanings are factual, such as ‘powerful’, also have expressive uses. This paper examines the film "Cloud Atlas" (2012), directed by Lana Wachowski, Tom Tykwer, and Lilly Wachowski, through a philosophical lens. It explores the narrative structure and creative choices of the film, comparing it to the original book by David Mitchell. The analysis focuses on the film's editing and its impact on the portrayal of time, while drawing on Gilles Deleuze's concept of “the fold” and Pierre Klossowski's notion of “vicious circle”. By investigating these philosophical ideas, the paper offers a (...) deeper understanding of the suppression of time in the film and the persistence of essential gestures. This paper investigates the cultural significance of black holes and suns as metaphors in continental European literature and art, drawing on theoretical insights from French continental authors such as Jean-François Lyotard and Ray Brassier. Lyotard suggests that black holes signify the ultimate form of the sublime, representing the displacement of humanity and our unease with our place in the cosmos. On the other hand, Brassier views black holes as a consequence of the entropic dissolution of matter, reflecting physical reality's indifference (...) to subjective or teleological significance. The study also presents a curated collection of literary works and artworks that employ black holes and suns as metaphors, examining the emergence of these metaphorical objects and identifying discursive and epistemological shifts in society. Furthermore, this collaborative research project, involving the Pontifical Catholic University of São Paulo and the Federal Fluminense University in Brazil, and the Charles University in Prague in the Czech Republic, aims to provide a valuable resource for further academic inquiry. This article seeks to correlate some topics from Hobbes (especially the sovereignty problem) to reconstruct, in Foucault, the resistance problem. To this end, working with the state of nature example and with several commentators from both authors, an analysis will be carried out whose intersection point is the command­obedience pair, more specifically concerning the voice issue, such as referenced by Veyne. Merging two theoretical approaches, as far as Hobbes is concerned, a structural perspective was chosen, respecting the author's geometric methodology; (...) regarding Foucault, it is operated from a heuristic aspect, aiming to approach his experimentalism. This “essay” aims to think with Klossowski and Foucault the notions of “parody” and “fiction” based on the elegiac gesture presented by Veyne. From this, the “relational” possibility, and the “authors” quotation (notions reframed in the course of the text) will think and open up new possibilities for how to make philosophical historiography. Thus, postulated the death of God and the author's death, how would it break the Identity relations, leading to the end of the A = A relationship between (...) the textually constructed persons and the extra-textual historical ones? This paper examines the philosophical relationship between Maurice Merleau-Ponty and Michel Foucault, exploring the apparent opposition between their phenomenological and archaeological approaches. Initially, the paper highlights Merleau-Ponty's perspective on the Phenomenology of Perception and contrasts it with Foucault's archaeological discourse, examining his rejection of an analysis grounded in an originating subject. Foucault criticizes phenomenology, underscoring his refusal to adopt a view that anchors history in the subject. Moreover, the paper explores the phenomenological analysis, demonstrating the extent to which Foucault distanced (...) himself from this conception. Reflecting on a possible reconciliation, the paper argues that certain foundations of Foucault's archaeological description, suggesting a potential convergence, can be found in Merleau-Ponty's proposals for phenomenology. The investigation extends to revisit Foucault's allusions to Merleau-Ponty, emphasizing nuances in the intellectual interactions between the two thinkers. Going beyond a historical narrative, the essay seeks to elucidate philosophical convergences and divergences, meticulously analyzing the modulations of their approaches concerning the issues of the subject, object, and subjectivity. A credible fear test is an in-depth interview process given to undocumented people of any age arriving at a U.S. port of entry to determine qualification for asylum-seeking. Credible fear tests as a typical immigration procedure demonstrate not only what structural epistemic violence looks like but also how this violence lives in and through the design of asylum policy. Key terms of credible fear tests such as “significant possibility,” “evidence,” “consistency,” and “credibility” can never be neutral in the context of (...) colonial administrative violence. We argue that these terms function as mechanisms of exclusion and demonstrate that the capacity to be violent (i.e. to be an instrument of violence) is built into these tests, ready to be deployed when an administration wants to stop certain people from certain places from entering without regard to their own ongoing occupation of Indigenous lands. Not only are such practices instruments of violence, but the concept of ‘violence’ continues to be organized, defined, and conceived within settler colonial epistemologies so as to exclude these administrative forms of violence deployed against Indigenous peoples and people of color from recognition and nameability. We argue that this is an intentional strategy of colonial power preservation that is functionalized through social processes that remain structurally stable and self-regenerating across historical and political changes. This article aims to indicate another possible comprehension of war and its relations in the Yugoslavian region. Focused on the construction of national identity, this paper uses the post-structuralist theoretical argumentative movement to invert the common logic of interpretation – to which Foucault and Deleuze are used as reference. Knowing this, the problem is how war, interpreted in another way, can build not only national integration, but also a subjective identity through Football.

Epistemologies have power. They have the power not only to transform worlds, but to create them. And the worlds that they create can be better or worse. For many people, the worlds they create are predictably and reliably deadly. Epistemologies can turn sacred land into ‘resources’ to be bought, sold, exploited, and exhausted. They can turn people into ‘labor’ in much the same way. They can not only disappear acts of violence but render them unnamable and unrecognizable within their conceptual (...) architectures. Settler systems of epistemic and conceptual resources and the relations among them are constructed to preclude certain forms of knowledge. This is not an accident; it is a central goal of colonial violence. Colonization and land dispossession would not be possible without the violent disruption of Indigenous knowledge systems and ongoing organized attempts to disrupt their survival. Violently disrupting the relationships of people to land is as much an epistemic project as it is a material one, and these two projects are inherently linked. The task of theorizing epistemic oppression is not only about epistemic oppression. Epistemic oppression is a story that gives language to a phenomenon in order to get past it, to carry on with the maintaining and reviving the forms of Indigenous and diasporic knowledge that colonialism has worked tirelessly to corrupt and silence. A lo largo de la tradición psicopatológica, incluso de la pre-fenomenológica, se encuentra la categorización del delirio como creencia. Jaspers asumió ese uso y lo fundó fenomenológico-existencialmente, definiendo su carácter de convicción. El concepto de creencia ha tenido un largo recorrido dentro de la historia del pensamiento, aunque recientemente se ha intensificado el debate acerca de la visión doxástica del delirio. En virtud de lo ya mencionado, en el presente artículo presentamos un análisis conceptual de la creencia, con el objetivo (...) de identificar de manera precisa los aspectos esenciales que permiten al delirio definirse según ella. De esta manera, se discutirán algunas de las principales incursiones realizadas en el concepto desde la antigüedad periplatónica hasta José Ortega y Gasset, remarcando en cada pensador las directrices esenciales de su aproximación a la creencia. A su vez, introducir al filósofo español al debate psicopatológico permitirá incluir en la discusión dos aspectos importantes que creemos pueden ser fructíferos para la discusión filosófica sobre el delirio: la diferencia entre ideas y creencias, y la vitalidad de estas últimas. Finalmente, hacemos referencia al actual debate pro- y antidoxástico, haciendo hincapié en la necesidad de considerar la amplitud del concepto de creencia en su genealogía histórica. There is a growing trend across North America of women being criminalized for their pregnancy outcomes. Rather than being a series of aberrations resulting from institutional failures, we argue that this trend is part of a colonial strategy of administrative violence aimed at women of color and Native women across Turtle Island. We consider a range of medical and legal practices constituting gender-based administrative violence, and we argue that they are the result of non-accidental and systematic production of population-level harms (...) that cannot be disentangled from the goals of ongoing settler occupation and dispossession of Indigenous lands. While white feminist narratives of gender-based administrative violence in Latin America function to distance the places where such violence occurs from the ‘liberal democratic’ settler nation-states of the U.S. and Canada, we hold that administrative forms of reproductive violence against Latin American women are structurally connected to efforts in the U.S. and Canada to criminalize women of color and Indigenous women for their reproductive outcomes. The purpose of these systemically produced harms is to sustain cultures of gender-based violence in support of settler colonial configurations of power. (shrink)

Keeping with the principles defended by the interlocutor, Elisabeth of Bohemia develops her philosophical position in the epistles exchanged with Descartes and argues that the soul should be conceived materially. Conversely, this communication between soul and body is argued differently from the perspective of Leibniz, who pursues a spiritualistic solution to the problem by making the body aggregated with inferior substances (...) instead of making the soul material. A evidência textual primária confirma que Schopenhauer estava ciente da adoção generalizada do confinamento solitário no sistema penitenciário americano e alguns de seus efeitos prejudiciais. Ele entende sua perniciosidade no que diz respeito ao tédio, fenômeno pelo qual é conhecido por ter nele pensado e analisado extensivamente. Neste artigo, eu interpreto o relato de Schopenhauer sobre o tédio e sua relação com o confinamento solitário. Defendo Schopenhauer contra a objeção de que os casos de confinamento servem apenas para ilustrar a (...) inadequação geral de sua explicação do tédio como a falta de coisas para se querer. Esta defesa chega à conclusão de que, ao contrário, alguém pode muito bem sofrer da falta de coisas para querer como resultado direto de estar confinado; e que o tédio, entendido como a privação de vontade — fenômeno que sugiro poder ser chamado de privação conativa — faz uma contribuição esclarecedora para a nossa compreensão teórica da nocividade do confinamento solitário. Ethical leaders can influence followers’ ethical behaviors by establishing an ethical climate. However, followers’ responses to an ethical climate may also differ according to the amount of attention they devote to moral questions. This study analyzes whether moral attentiveness augments the positive effect of an ethical climate on employees’ ethical behaviors, as well as the indirect effect of ethical leadership on employee ethical behavior through an ethical climate. Data from 270 employees in the Malaysian manufacturing industry indicate that the positive (...) impact of an ethical climate on ethical behavior is greater among employees who exhibit high rather than low moral attentiveness; this moderating role also applies to the relationship between ethical leadership and employee ethical behavior through the ethical climate. This paper examines entrepreneurship. We present insights from a highly influential paper. Here are the highlights from this paper: This paper introduces new results obtained from a statistical investigation into a 3071-observation data set collected from a Vietnamese nationwide entrepreneurship survey. From established relationships, such factors as preparedness, financial resources, and participation in social networks are confirmed to have significant effects on entrepreneurial decisions. Entrepreneurs, both financially constrained and unconstrained, who have a business plan tend to start their entrepreneurial ventures (...) earlier. Also, financial constraints have a profound impact on entrepreneurial decisions. When perceiving the likelihood of success to be high, an entrepreneur shows the tendency for prompt action on business ideas. But when seeing the risk of prolonging the waiting time to first revenue, a prospective entrepreneur would be more likely to wait for more favorable conditions despite the vagueness of “favorable.” Additionally, empirical computations indicate that there is a 41.3 % probability that an extant entrepreneur who is generating revenue sees a high chance of success. Past work and entrepreneurial experiences also have positive impacts on both the entrepreneurial decisions and perceived chance of success. This paper aims to develop an understanding of how the culture industry still operates in the postcolonial era. To this end, the first part of this paper will look at Adorno and Horkheimer’s reading of modernity, touching on how instrumental reasoning can lend itself to barbarism, along with an exposition of Adorno’s analysis of the culture industry. The second part will present decolonial theory, its critique of European modernity and, particularly, its focus on neo-imperialism. This theory will then be put (...) alongside critical theory, analyzing their differences concerning racial issues and how their critique of capitalism may represent a meeting point between the two theories. Finally, the conclusion will consider all previous elements to explain the connection between the Culture industry and its current strategy in former colonial areas. (shrink)

In Mexico, the Productive Organization Program for Indigenous Women (POPMI) seeks the empowerment of productive capacities in indigenous women. Our study analyzes POPMI outreach, focusing our attention on women beneficiaries who present a high degree of social exclusion and multidimensional poverty in the State of Veracruz. In the study area, the 542 indigenous women benefited in POPMI, presented a condition of multidimensional poverty and a degree of social exclusion: very high, high and medium, they represent only 22.19% of the total (...) beneficiaries of this program In 2010, since at the state level a total of 2,243 indigenous women were cared for. The results show that the localities where the condition of multidimensional poverty and very high, medium and high levels of social exclusion have been excluded in the coverage of POPMI. (shrink)

O presente artigo tratará, no pensamento de Nietzsche, do cotejo entre a concepção de expressão musical e a noção de esquecimento de si. O filósofo, assim, a elabora a partir de uma interpretação peculiar da tragédia grega, da qual absorve as alegorias de Apolo e Dionísio, e finda por relacionar a música com sua concepção mais ampla de arte. Além disso, o artigo tece relações entre a mencionada formulação de Nietzsche, as concepções de Gênio Criador em Schopenhauer e de Obra (...) de Arte Total em Wagner. (shrink)

Este artigo propõe pensar o método arqueológico de Michel Foucault, exposto em “As Palavras e as Coisas” e em “Arqueologia do Saber”, e como este se catalisa a partir da obra de Borges, relacionando-se intimamente com a Literatura. Para tal, analisar-se-á, primeiramente, algumas marcas epistemológicas e metodológicas de Foucault, tais com o estruturalismo e a hermenêutica, para, então, se retomar as passagens de Borges na obra do filósofo e se estabelecer as possíveis reverberações e impactos do autor argentino no método (...) arqueológico –marcando-se, assim, a importância dos operadores estético-literários no pensamento de Michel Foucault. This article intends to navigate through three distinctive paths. The first of them being Ancient Greece, through Artemidorus, especially from his absorption by Foucault; The second being Ancient Rome, as worked by Paul Veyne in the Constantine’s analyses; and the third path is constituted from a series of ethnographic reports about the South American Amerindian communities. This theoretical trail will be taken to show other analytical possibilities for what is understoodas oneiromancy, that is, the analysis of dreams, that was not (...) framed by the occidental modernity. Is the societal-level of analysis sufficient today to understand the values of those in the global workforce? Or are individual-level analyses more appropriate for assessing the influence of values on ethical behaviors across country workforces? Using multi-level analyses for a 48-society sample, we test the utility of both the societal-level and individual-level dimensions of collectivism and individualism values for predicting ethical behaviors of business professionals. Our values-based behavioral analysis indicates that values at the individual-level make a more significant contribution to (...) explaining variance in ethical behaviors than do values at the societal-level. Implicitly, our findings question the soundness of using societal-level values measures. Implications for international business research are discussed. (shrink)

Este artigo pretende fazer uma leitura possível do filme Call me by your name (2017), dirigido por Luca Guadagnino. O que se levanta como hipótese é que as relações entre Elio consigo mesmo, com seu ambiente e aqueles a sua volta não expressam o tempo lá representado, mas são um mascaramento de um momento em que as possibilidades eram outras. Para tal, apresentar-se-á uma breve introdução ao roteiro do filme, a fim de se entender quais são as problemáticas que o (...) envolvem. Depois disso, será apresentado como eram as práticas sexuais (em especial as homoeróticas) na antiguidade clássica. Por fim, relacionar-se-á os signos dispostos no filme no intuito de se suplantar a hipótese supracitada: a de que que a história, apesar se se passar nos anos 80, reproduz um conjunto de relações inter e intrapessoais aos moldes da formação sócio-histórica da Grécia antiga. The article intends to demonstrate that, when building his science, Claude Lévi- Strauss abandons the categories used by the traditional studies of the myth and creates singular epistemological tools, suggested by the music, by the natural science and by the plastic arts. These tools, which we can denominate aesthetic operators, light up, in an exemplary way, the dissolution process that suffers the mythical matter when transforming in the time and in the space. When establishing that new form of thinking, the (...) myth, that reconciles the sensitive experience with the intelligible, Lévi-Strauss proposes to overcome the permanent dichotomy between knowing archaic and modern, between magical and scientific thought, between magic and Science. Este artículo de reflexión problematiza la didáctica de las lenguas extranjeras desde una inquietud filosófica-intercultural para contextos mayoritaria e históricamente monolingües como el latinoamericano. Inicialmente, se describen los rasgos de colonialidad latentes en el enfoque que el Marco Común Europeo de Referencia asume para tratar la interculturalidad. Seguidamente, se realiza un análisis crítico-filosófico de los desafíos que la interculturalidad enfrenta en América Latina en el contexto anteriormente mencionado, y se revisan las relaciones que existen entre interculturalidad y glotopolítica, asumiendo que (...) el latinoamericanismo de Mendieta, la resemantización del orientalismo de Said, el mimetismo y la hibridación bhabhiana, así como la filosofía intercultural, son quizá los desafíos filosóficos más grandes. Finalmente, se presenta un exordio para una interculturalidad crítica en lenguas-culturas extranjeras, en el que se tienen en cuenta algunas contribuciones del Grupo Modernidad/Colonialidad, concretamente de Dussel, Walsh, Castro-Gómez y Fornet-Betancourt, reconociendo que la didáctización de la interculturalidad en las licenciaturas de lenguas modernas de Colombia está por construirse. Este artigo afirma que as interpretações de Deleuze acerca de Nietzsche e Espinosa são influenciadas cada uma por sua leitura do outro filósofo. Essa afirmação é explorada por meio das principais questões do corpo e da vontade de potência. Embora a respeito do corpo, a leitura de Espinosa de Deleuze seja matizada por Nietzsche em sua leitura da vontade de potência, é antes Espinosa que filtra sua leitura de Nietzsche. Em última análise, pode-se dizer que a maneira de Deleuze de (...) ler Nietzsche em diálogo com Espinosa obedece a uma ontologia da potência. (shrink)
