This article discusses the triage response to the COVID-19 delta variant surge of 2021. One issue that distinguishes the delta wave from earlier surges is that by the time it became the predominant strain in the USA in July 2021, safe and effective vaccines against COVID-19 had been available for all US adults for several months. We consider whether healthcare professionals and triage committees would have been justified in prioritising patients with COVID-19 who are vaccinated above those who are unvaccinated (...) in first-order or second-order triage. Given that lack of evidence for a correlation between short-term survival and vaccination, we argue that using vaccination status during first-order triage would be inconsistent with accepted triage standards. We then turn to notions of procedural fairness, equity and desert to argue that that there is also a lack of justification for using vaccination status in second-order triage. In planning for future surges, we recommend that medical institutions base their triage decisions on principles meant to save the most lives, minimise inequity and protect the public’s trust, which for the time being would not be served by the inclusion of vaccination status. According to the sceptic Saul Kripke envisages in his celebrated book on Wittgenstein on rules and private language, there are no facts about an individual that determine what she means by any given expression. If there are no such facts, the question then is, what justifies the claim that she does use expressions meaningfully? Kripke’s answer, in a nutshell, is that she by and large uses her expressions in conformity with the linguistic standards of the community she belongs to. While (...) Kripke’s sceptical problem has gripped philosophers for over three decades, few, if any, have been satisfied by his proposed solution, and many have struggled to come up with one of their own. The purpose of this paper is to show that a more satisfactory answer to Kripke’s challenge can be developed on the basis of Donald Davidson’s writings on triangulation, the idea of two individuals interacting simultaneously with each other and the world they share. It follows from the triangulation argument that the facts that can be regarded as determining meaning are irreducible. Yet, contra Kripke, they are not mysterious, for the argument does spell out what is needed for an individual’s expressions to be meaningful. (shrink)

Staff reported paranormal experiences in connection with the outpatient Medical Assistance in Dying room at the hospital. This case study reports on staff experiences and illustrates how the Ethics team’s role expanded to deal with this novel situation by facilitating an interdisciplinary response.

This chapter weighs a challenge to the attractive notion that by enabling empathy, fiction affords wide-ranging knowledge of what others’ experiences are like. It is commonly held that ‘seeing the world through others’ eyes’ often requires the empathizer to undergo an imaginative shift in sensibility, and we might naturally think that fiction helps us to effect that shift. However, some recent work on empathy and imagination encourages the conclusion that we are actually rigidly restricted to our own sensibilities even in (...) the wildest flights of imagination great literature can inspire. Drawing on the work of the novelist Zadie Smith, the chapter argues that while our imaginative capacities are not entirely unconstrained by our sensibilities, fiction can still help us to learn about a wide range of human experiences, including the experiences of people whose sensibilities substantially diverge from our own. Notably, fiction can work on our patterns of attention in such a way that we become temporarily ‘not ourselves.’. (shrink)

The ethics of technology has primarily focused on what values are and how they can be embedded in technologies through design. In this context, some work has been done to show the efficacy of a number of design approaches. However, existing studies have not clearly pointed out the ways in which design-for-values approaches can be used by design team managers to properly organize and use technologies in practice. This chapter attempts to fill this gap by discussing the value sensitive design (...) (VSD) approach as a useful means of co-designing technologies as a toolkit for existing workflow management, in this case, Agile. It will be demonstrated that VSD shows promise as a way of democratically designing technologies as well as fostering democratic technology policy innovation. (shrink)

Randomization is an integral part of well-designed statistical trials, and is also a required procedure in legal systems. Implementation of honest, unbiased, understandable, secure, traceable, auditable and collusion resistant randomization procedures is a mater of great legal, social and political importance. Given the juridical and social importance of randomization, it is important to develop procedures in full compliance with the following desiderata: (a) Statistical soundness and computational efficiency; (b) Procedural, cryptographical and computational security; (c) Complete auditability and traceability; (d) Any (...) attempt by participating parties or coalitions to spuriously influence the procedure should be either unsuccessful or be detected; (e) Open-source programming; (f) Multiple hardware platform and operating system implementation; (g) User friendliness and transparency; (h) Flexibility and adaptability for the needs and requirements of multiple application areas (like, for example, clinical trials, selection of jury or judges in legal proceedings, and draft lotteries). This paper presents a simple and easy to implement randomization protocol that assures, in a formal mathematical setting, full compliance to the aforementioned desiderata for randomization procedures. Since the early 1990's the value sensitive design (VSD) approach has been a continually burgeoning design methodology for technological innovation. VSD is commonly described as a "principled approach" to technology design, given that it is explicitly orientated towards designing technologies for human values, rather than sidelining them to ad hoc and/or ex post facto design. However, in much of its near three-decades-long development, the VSD approach has mostly been adopted as a conceptual framework to assess existing technologies and to explore (...) how the consequences of the technology's development could have been influenced positively if VSD was adopted early on and throughout the design process (Friedman et al. 2002). Similarly, VSD has been adopted as a conceptual framework for analysing how future speculative technologies like molecular manufacturing (Umbrello 2019) and advanced artificial intelligence systems can be directed towards positive futures (Umbrello and van de Poel 2021). Yet, despite the benefits of these endeavours and VSD being an approach that can be adapted to any given design domain, it has yet to be widely appropriated in existing design spaces as a primary design approach. In this short paper, we aim to fill this lacuna by framing VSD as a toolkit that can be adopted by existing design teams rather than a wholesale approach. In particular, we describe how VSD maps seamlessly onto agile workflows, an approach to project management that is widely adopted globally. By doing so, we hope that the VSD approach will likewise be more attractive and thus adopted more broadly. As a consequence, a more explicit orientation towards designing technologies for human values will follow. (shrink)

This chapter lays out what we take to be the main types of justice and ethical challenges concerning those adverse effects of climate change leading to climate-related Loss and Damage (L&D). We argue that it is essential to clearly differentiate between the challenges concerning mitigation and adaptation and those ethical issues exclusively relevant for L&D in order to address the ethical aspects pertaining to L&D in international climate policy. First, we show that depending on how mitigation and adaptation are distinguished (...) from L&D, the primary focus of policy measures and their ethical implications will vary. Second, we distinguish between a distributive justice framework and a compensatory justice scheme for delivering L&D measures. Third, in order to understand the differentiated remedial responsibilities concerning L&D, we categorise the measures and policy approaches available. It is used frequently on social media platforms about topics from medical science to financial investing to conspiracy theories. Using conceptual and empirical resources drawn from philosophy and psychology, we examine key questions about the slogan’s operation in human cognition and epistemic culture.

Monoclonal antibodies are essential biomedical research and clinical reagents that are produced by companies and research laboratories. The NIAID ImmPort (Immunology Database and Analysis Portal) resource provides a long-term, sustainable data warehouse for immunological data generated by NIAID, DAIT and DMID funded investigators for data archiving and re-use. A variety of immunological data is generated using techniques that rely upon monoclonal antibody reagents, including flow cytometry, immunofluorescence, and ELISA. In order to facilitate querying, integration, and reuse of data, standardized terminology (...) for describing monoclonal antibody reagents and their targets needs to be used for annotating data submitted to ImmPort. Despite the frequency of stillbirths, the subsequent implications are overlooked and underappreciated. We present findings from comprehensive, systematic literature reviews, and new analyses of published and unpublished data, to establish the effect of stillbirth on parents, families, health-care providers, and societies worldwide. Data for direct costs of this event are sparse but suggest that a stillbirth needs more resources than a livebirth, both in the perinatal period and in additional surveillance during subsequent pregnancies. Indirect and intangible costs of stillbirth are (...) extensive and are usually met by families alone. This issue is particularly onerous for those with few resources. Negative effects, particularly on parental mental health, might be moderated by empathic attitudes of care providers and tailored interventions. The value of the baby, as well as the associated costs for parents, families, care providers, communities, and society, should be considered to prevent stillbirths and reduce associated morbidity. Different sort of people are interested in personal identity. Philosophers frequently ask what it takes to remain oneself. Caregivers imagine their patients’ experience. But both philosophers and caregivers think from the armchair: they can only make assumptions about what it would be like to wake up with massive bodily changes. Patients with a locked-in syndrome (LIS) suffer a full body paralysis without cognitive impairment. They can tell us what it is like. Forty-four chronic LIS patients and 20 age-matched healthy medical (...) professionals answered a 15-items questionnaire targeting: (A) global evaluation of identity, (B) body representation and (C) experienced meaning in life. In patients, selfreported identity was correlated with B and C. Patients differed with controls in C. These results suggest that the paralyzed body remains a strong component of patients’ experienced identity, that patients can adjust to objectives changes perceived as meaningful and that caregivers fail in predicting patients’ experience. The Protein Ontology (PRO; http://proconsortium.org) formally defines protein entities and explicitly represents their major forms and interrelations. Protein entities represented in PRO corresponding to single amino acid chains are categorized by level of specificity into family, gene, sequence and modification metaclasses, and there is a separate metaclass for protein complexes. All metaclasses also have organism-specific derivatives. PRO complements established sequence databases such as UniProtKB, and interoperates with other biomedical and biological ontologies such as the Gene Ontology (GO). PRO relates to (...) UniProtKB in that PRO’s organism-specific classes of proteins encoded by a specific gene correspond to entities documented in UniProtKB entries. PRO relates to the GO in that PRO’s representations of organism-specific protein complexes are subclasses of the organism-agnostic protein complex terms in the GO Cellular Component Ontology. The past few years have seen growth and changes to the PRO, as well as new points of access to the data and new applications of PRO in immunology and proteomics. This paper is a study about Philadelphia’s comprehensive user engagement sites (CUESs) as the authors address and examine issues related to the upcoming implementation of a CUES while seeking solutions for its disputed questions and plans. Beginning with the federal drug schedules, the authors visit some of the medical and public health issues vis-à-vis safe injection facilities (SIFs). Insite, a successful Canadian SIF, has been thoroughly researched as it represents a paradigm for which a Philadelphia CUES can expand upon. Also, (...) the existing criticisms against SIFs are revisited while critically unpackaged and responded to in favor of the establishment. In the main section, the authors propose the layout and services of the upcoming CUES, much of which would be in congruent to Vancouver’s Insite. On the other hand, the CUES would be distinct from Insite, as the authors emphasize, in that it will offer an information center run by individuals in recovery and place additional emphasis on early education for young healthcare professionals by providing them a platform to work at the site. The paper will also briefly investigate the implementation of a CUES site under an ethical scope of the Harm Reduction Theory. Lastly, the authors recommend some strategic plans that the Philadelphia City government may consider employing at this crucial stage. (shrink)

The paper deals with the question of the development of Duns Scotus’ thought on the causes of the will: is the intellect a contributory cause of the choice (as claimed in the writings of the Oxford period), or is it only an occasion for it (as stated in the last works, written in Paris)? The collatio 6, probably discussed in 1301, immediately after the arrival of the Scottish theologian in Paris, still defends the doctrine of the intellect as a contributory (...) cause of the will, and therefore represents the last text preceding the turn of Scotus towards the theory that assigns to the intellect the role of mere causa sine qua non. This theory was widespread in Paris and supported by the Master of Scotus, Gonsalvus of Spain, who probably heavily influenced the doctrinal change of Scotus. (shrink)

This study will examine the ontological dependency between the thinking act of the intellect and the intelligibility of the objects of thought. Whereas the intellectual tradition prior to Duns Scotus grounds the formation of the objects of thought and our ability to understand them with certainty in different forms of participation in the divine intellect, Scotus shows that the intelligibility of the objects of thought is internal to them alone and is not dependent on participation.

This paper presents Duns Scotus’s theory of mixture in the context of medieval discussions over Aristotle’s theory of mixed bodies. It revisits the accounts of mixture given by Avicenna, Averroes, and Thomas Aquinas, before presenting Scotus’s account as a reaction to Averroes. It argues that Duns Scotus rejected the Aristotelian theory of mixture altogether and that his account went contrary to the entire Latin tradition. Scotus denies that mixts arise out of the four classical elements and he maintains that both (...) the elemental forms and the elemental qualities are lost in the mixture. Consequently, he denies the distinction between the process of mixture and that of substantial change through generation and corruption. Gignac and Zajenkowski (2020) find that “the degree to which people mispredicted their objectively measured intelligence was equal across the whole spectrum of objectively measured intelligence”. This Comment shows that Gignac and Zajenkowski’s (2020) finding of homoscedasticity is likely the result of a recoding choice by the experimenters and does not in fact indicate that the Dunning-Kruger Effect is a mere statistical artifact. Specifically, Gignac and Zajenkowski (2020) recoded test subjects’ responses to a question regarding self-assessed comparative IQ onto a (...) linear IQ scale when a normal IQ scale would likely have been more appropriate. More generally, researchers studying self-assessed intelligence should be aware of potential measurement problems that may arise when transforming an ordinal scale onto an interval scale. (shrink)

In order to make sense of Scotus’s claim that rationality is perfected only by the will, a Scotistic doctrine of truth is developed in a speculative way. It is claimed that synthetic a priori truths are truths of the will, which are existential truths. This insight holds profound theological implications and is used on the one hand to criticize Kant's conception of existence, and on the other hand, to offer another explanation of the sense according to which the existence of (...) things is grasped. There are two general routes that Augustine suggests in De Trinitate, XV, 14-16, 23-25, for a psychological account of the Father's intellectual generation of the Word. Thomas Aquinas and Henry of Ghent, in their own ways, follow the first route; John Duns Scotus follows the second. Aquinas, Henry, and Scotus's psychological accounts entail different theological opinions. For example, Aquinas (but neither Henry nor Scotus) thinks that the Father needs the Word to know the divine essence. If we compare the theological (...) views entailed by their psychologies we find a trajectory from Aquinas, through Henry, and ending with Scotus. This theological trajectory falsifies a judgment that every Augustinian psychology of the divine persons amounts to a pre-Nicene functional Trinitarianism. This study makes clear how one's awareness of the theological views entailed by these psychologies enables one to assess more thoroughly psychological accounts of the identity and distinction of the divine persons. The aim of this article is to examine Duns Scotus’ account of divine omnipotence. I shall firstly consider his doctrine of the objective possible and the distinction between logical potency and metaphysical potency. Secondly, by drawing on Scotus’ main texts on divine omnipotence (especially the Quodlibet VII), I will argue that, in his view, God’s omnipotence is not demonstrable, but at the same time is not an irrational concept, as Aristotle and many Medieval philosophi claimed. The paper is about the relationship between Scotus’s notion of ‘natura communis,’ for an examination of the main features that Scotus ascribes to ‘common natures’ can shed substantial light on the nature of metaphysics in itself. Some preliminary observations on historiography are also deemed to be in order.

The problem of divine impassibility, i.e., of whether the divine nature in Christ could suffer, stands at the center of a debate regarding the nature of God and his relation to us. Whereas philosophical reasoning regarding the divine nature maintains that the divine is immutable and perfect in every respect, theological needs generated an ever-growing demand for a passionate God truly able to participate in the suffering of his creatures. Correlating with the different approaches of Thomas Aquinas and John Duns (...) Scotus, the paper develops an incarnation model that aims, on the one hand, to solve the dualistic problem between the divine and human natures, and on the other hand to make room for both impassible and passible elements in God, and so to make room within the patristic impassible model for genuine suffering in God. The discussion, though centered around Christ's im/passibility and passions, can easily be modified to approach the body-mind problem since the essence of the problems is the same. (shrink)

The aim of this paper is to apply the metaphysics of John Duns Scotus in constructing a new conception of matter which does not stand in opposition to the mental realm, but is rather composed of both physical and mental elements. The paper is divided into four parts. Section one addresses Scotus’ claim that matter is intelligible and actual in itself. Section two aims to show that matter can be seen as a deprived thinking being. Section three analyzes Scotus’ conception (...) of place. The final section brings together the conclusions of the three preceding parts to confront the Cartesian psycho-physical problem anew and to suggest a viable solution. (shrink)

The paper will explore a key tension between eternity and temporality that comes to the fore in the seeming contradiction between freedom of the human will and divine foreknowledge of future contingents. It will be claimed that Duns Scotus’s adaptation of Thomas Aquinas’s view reduces the tension between a human being’s freedom and divine foreknowledge of future contingents to the question of how to conflate the now of eternity and our experience of the instantaneous now. Scotus’s account of the matter (...) is unfortunately not satisfying and it is the purpose of this paper to develop this insight further in a speculative manner. In order to make such co-nowness possible, it will be asked how the eternal and the temporal can co-cause together. This problem will be tackled through a development of Scotus’s doctrine of the will taken elsewhere, in order to examine how the divine and the human wills can occur together. It will be claimed that such co-willing produces a co-nowness of the eternal and the instantaneous ‘nows’ which generates a logical temporal movement. (shrink)

Both in Polish and international literature Duns Scotus’ ethical thought has had a number of conflicting interpretations. The article presents the main elements of Duns Scotus’ ethical thought. The quaestions it tries to answer are the following: a) is Scotus’ ethics voluntaristic; b) if so, what type of voluntarism can one attribute to Scotus. Finding Scotus’ ethics moderately voluntaristic I distinguish and characterize three types of voluntarism that could be attributed to Scotus: psychological voluntarism (Duns finds the will more perfect (...) than the intellect as its acts are more perfect); theological voluntarism (Duns takes the Commandments of the first table to be obligatory in a stronger way than the Commandments of the second table), causal voluntarism (the will is taken to be the primary cause of free action, non determined even by the most perfect good). Pantheists are often accused of lacking a sufficient account of the unity of the cosmos and its supposed priority over its many parts. I argue that complex theists, those who think that God has ontologically distinct parts or attributes, face the same problems. Current proposals for the metaphysics of complex theism do not offer any greater unity or ontological independence than pantheism, since they are modeled on priority monism. I then discuss whether the formal distinction of John Duns Scotus offers (...) a way forward for complex theists. I show that only those classical theists who affirm divine simplicity are better off with respect to aseity and unity than pantheists. Only proponents of divine simplicity can fairly claim to have found a fully independent ultimate being. (shrink)

Following an Open conception of Divine Foreknowledge, that holds that man is endowed with genuine freedom and so the future is not definitely determined, it will be claimed that human freedom does not limit the divine power, but rather enhances it and presents us with a barrier against arbitrary use of that power. This reading will be implemented to reconcile a well-known quarrel between two important interpreters of Duns Scotus, Allan B. The relation-theory of mental acts proposes that a mental act is a kind of relative entity founded upon the mind and directed at the object of perception or thought. While most medieval philosophers recognized that there is something importantly relational about thought, they nevertheless rejected the view that mental acts are wholly relations. Rather, the dominant view was that a mental act is either in whole or part an Aristotelian quality added to the mind upon which such a relation to (...) the object can be founded. The paper presents John Duns Scotus’ view on the relationship between the notions of person, individual being and incommunicability. Scotus’ opinions on this matter are presented in the context of the approaches taken by Boethius and Richard of St Victor. The main conclusions of the article are as follows. According to Scotus, although individual, the nature of God is communicable. Its individuality is not the effect of a causal relation, however God is an individual being per se. Due to the (...) communicability of God’s nature, each Person of God possesses divinity in full sense. Each God’s Person, as a person, has got two kinds of independence: actual and dispositional, hence one could say that each Person of God is necessarily independent. Individuality of a contingent being is an effect of a process of individuation, in which a neutral nature is contracted into the individual nature by the causal factor, i.e. the haecceitas. Nature as nature is communicable; however, nature which is individual is not communicable due to its individuality. Rational, created, and individual nature is the foundation of the realization of personality. A created person is independent, both in actual and dispositional sense, however, it is not necessarily independent as it has an obediental potentiality to be personified by another personhood. Separated soul (anima separata), in turn, is individual because of its haecceitas, which is the ultimate reality of the form. Because of this kind of individuality, this soul is incommunicable and it has actual independency, although it is not dispositionally independent. Thus, due to its dispositional dependency, the separated soul is not the person. (shrink)

In this essay I focus on the idea of the univocity of being, championed by Duns Scotus and given prominence more recently by Deleuze. Although I am interested in how this idea can be established, my primary concern is with something more basic: how the idea can even be properly thought. During the century following the Council of Trent, two trends within Catholic religious orders matured: the first consisted in unifying and strengthening the Order’s culture by focussing on one author of reference; the other in elaborating a new way of presenting that author’s doctrines. In the case of the Friars Minor Conventuals, these trends were fostered in the second decade of the seventeenth century by the minister general of the Order, Giacomo Montanari, who promoted the idea that providing the Order (...) with new works featuring innovative didactic characteristics and a renewed defence of the doctrines of John Duns Scotus was a prime way to lead an authentic religious life. Bartolomeo Mastri and Bonaventura Belluto’s “philosophiae cursus ad mentem Scoti” was probably the major result of this impulse. According to authoritative Christian teaching, Jesus Christ is a single person existing in two natures, divinity and humanity. In attempting to understand this claim, the high-scholastic theologians often asked whether there was more than one existence in Christ. John Duns Scotus answers the question with a clear and strongly-formulated yes, and Thomists have sometimes suspected that his answer leads in a heretical direction. But before we can ask whether Scotus‘s answer is acceptable or not, we have to come to a (...) clear understanding of what his answer is. And before we can ask what his answer is, we have to come to a clear understanding of what question or questions he is trying to answer. In this paper I begin by explaining that the question about Christ‘s existence is ambiguous, i.e., that there are actually two questions hidden behind one formulation. Next I look at Scotus‘s writings on the topic in order to determine which question he is really trying to answer, and I argue that he is trying to answer both of them, even though he does not make this clear. Third, I provide an initial look at the answers that he gives. Fourth, I explain why these answers might seem problematic, especially from a Thomistic perspective. Fifth, I explain Scotus‘s answers in more detail and show that they are not problematic in the way that some Thomists have held. Indeed, at least some of Scotus‘s ideas are the very same ideas that Thomas spells out in one of his works. (shrink)

God’s Knowledge of Future Contingents. John Duns Scotus’ Explanation The article concerns John Duns Scotus’ views on the problem of God’s knowledge of future contingents, presented by Scotus in his Lectura in librum primum Sententiarumd. 39, n. 1-93. He begins his analysis of the notion of God’s knowledge concerning the future events by criticizing two theories: first, the claim that the content of the idea of a thing, possessed by God, can include contingency of this thing; second, the claim that (...) eternity of God is simultaneous with the flowing time as a whole, and therefore His knowledge of future contingents is the knowledge of present contingents. Duns Scotus presents his own conception in the form of the following claims: (1) there is contingency in the reality, however, we are not able to prove it; (2) the proximate second causes are not the causes of contingency in things; (3) the main cause of contingency in reality is God, precisely His will. Thus, contingency is not an imperfection because it is produced immediately by God. The article also presents Scotus’ theory of synchronic contingency. The paper presents Suárez’s view on the individuation of beings, which he developed in his Disputatio V, De unitate individuali eiusque principio. The aim, apart from simply presenting Doctor Eximius’s thought, is also to compare his views with his scholastic predecessors. When considering the question of individuation, Suárez remained under a considerable influence of the medieval tradition, which, however, he transformed in his writings according to his own convictions. He used the language of Duns Scotus when speaking of individuation and (...) determining it in terms of indivisibility, but rejected the idea of individuation by matter, classically attributed to the Thomistic School. Postulating the individuation principle, identified with the entity, and not with the act of existence nor the being of haecceitas, Suárez departed from non-classical interpretations of the thought of Thomas Aquinas as well as from the Scotistic solutions, and postulated a view that to some extent resembled that of Ockham and Bonaventure, although Suárez does not explicitly refer to the latter.
