Recent studies demonstrate a moral self effect: continuity in moral values is crucial to ascriptions of identity in and over time. Since Locke, personal identity has been referred to as a ‘forensic’ concept, meaning that it plays a role in attributions of moral responsibility. If moral values are crucial to identity over time, then perceived changes in a person’s set of values may reduce responsibility for past deeds. To test this, we examined the moral self effect in parole contexts. (...) In this empirical article, we conducted two experiments, in which participants were significantly more likely to grant parole to agents who underwent a moral change as opposed to mere behavioral change. [In French] This paper outlines Merleau-Ponty’s interpretation of higher-order cognition as a fundamentally embodied process that is enacted by motor subject situated in natural and cultural environment. More specifically, I exemplify Merleau-Ponty’s interdisciplinary approach to cognition on his interpretations of motor intentionality, operative speech, and mathematical reasoning, which are based on neuropathology, linguistics, and gestalt psychology, respectively. In this analysis, I aim to show that the body is involved in cognition as an operator of the phenomenal structuration of the environment (...) even at the level of linguistic, rational, and abstract experience. Allowing prisoners of war (POW) to be released on parole ceased to be practiced in early XX century, although for centuries it was quite common in European warfare. In this article I argue there are several powerful moral reasons to reinstate POW parole: the well- being of POW and their families, but also a chance to address the previously intractable problem of surrender to aircraft and autonomous weapons. I also argue that there are no good moral reasons not (...) to allow POW to accept parole, and that the reasons commonly put forward against the practice of parole are usually informed by antiquated and flawed ethical attitudes. I subsequently offer solutions for overcoming the practical obstacles to reinstating the practice of parole utilizing commonly available technology and self-enforcing diplomatic arrangements. I provide a detailed outline of such arrangements, addressing a number of possible objections and testing the model against several hypothetical scenarios. (shrink)

Driving licenses, identity cards, passports, boarding passes, credit cards, ATM cards – all of these are examples of credentials. Credentials are documents that play a fundamental role in all modern societies. However, philosophers and social ontologists have not yet addressed the analysis of their nature and function. This paper aims to fill this gap through a review of the essential characteristics of credentials, as documents whose primary purpose is to certify the identity and institutional status of the bearer, for example (...) as being the bearer of specific rights. However, credentials also allow their holders the concrete exercise of their rights, as when exercising a right concretely (e.g., crossing a border) requires the possession of a particular credential. Nell’arco di pochi mesi ha dovuto vendere il proprio appartamento; benché avesse un ottimo stipendio, Carlo ha infatti accumulato vari debiti, perché l’eroina e le prostitute costano cari. La sua lunga serie di fidanzate, rimpiazzabili al massimo dopo un paio di mesi, si è così rapidamente dileguata. The logos question, one of the most important among the subjects that traverse the Plato's Sophist, has in fact some different aspects: the criticism of father Parmenides' logos, that is unable to speak about the not-being, but also about the being; the relations between logos and its cognates, phantasia, doxa and dianoia; the logos’ complex structure, that is a compound with onoma and rema; the difference between naming and saying, two distinct but inseparable actions; the logical and ontological conditions that (...) make possible to say the truth, or to lie or simply to joke; the necessity of a most flexible logos that allows us to speak about the not-being, and about the being, but at the same time is a logos dangerously similar to the sophist’ one; finally, the identity between the power to produce “spoken images” and the very power to speak. The spread of the reform found one of its protagonists in the hermit and Cardinal Bishop of Ostia, Peter Damian. An example worthy of case-study is the Gallic mission as apostolic legate in 1063. The most complete report of this journey was written by an anonymous disciple. This perspective allows to observe Damian’s communication strategies and the different methods used referring to the various interlocutors. The cause of the apostolic legation was the help request from Hugh, abbot of Cluny, for (...) the pressures suffered by the Bishop of Macon. The occasion was propitious from the point of view of the cardinal bishop to expand his network of personal and institutional relationships and to legitimize the papal supremacy. He proceeded to France, summoned a council at Chalon-sur-Saône and proved the justice of the contentions of Cluny. Despite the lack of historiographical success, this work remains an extremely useful source for studying a man who made his ars rethorica a powerful weapon in the service of the reform. (shrink)

In this article I present the conception of syntax emerging from the “dynamic approach” to syntax and semantics, developed in the last few decades, moving from the critic to the static theories of language, either those developed in the Chomskian framework or those based on Montague’s grammar. I will suggest that this view can be fruitfully compared with Saussure’s position on syntax.

I show that the Pinkerton rule in conspiracy law is doctrinally and morally flawed. Unlike past critics of the rule, I propose a statutory fix that preserves and reforms it rather than abolishing it entirely. As I will show, this accommodates authors like Neil Katyal who have defended the rule as an important crime fighting tool while also fixing most of the traditional problems with it identified by critics like Wayne LaFave. Pinkerton is a vicarious liability rule that makes conspirators (...) criminally responsible for the foreseeable crimes of their coconspirators committed in furtherance of the conspiracy. It has two big problems: (1) Doctrinally, it breaks the logic of the many state criminal codes that are based on the Model Penal Code. (2) Ethically, it infringes the culpability constraint on the criminal law by imposing excessive punishments on defendants who did not even consciously suspect that their coconspirators would commit additional crimes that were not the object of the conspiracy. These problems are most acute in Texas, where Pinkerton can be combined with capital murder charges to produce automatic life without parole sentences. The Texas example is an extreme illustration of the problem of unintended consequences when state legislators tinker with the carefully drafted, interlocking provisions of a model code. The new statute I propose would put the penal code back in order and respect the culpability constraint. In the latter aspect, it is informed by leading work in philosophical ethics on blameworthiness and culpability. (shrink)

Affirmative action is standardly pursued in relation to admissions to prestigious universities, in hiring for prestigious jobs, and when it comes to being elected to parliament. Central to these forms of affirmative action is that they have to do with competitive goods. A good is competitive when, if we improve A’s chances of getting the good, we reduce B’s chances of obtaining the good. I call this Competitive Affirmative Action. I distinguish this from Non-competitive Affirmative Action. The latter has to (...) do with non-competitive goods, e.g., being granted early parole or freedom from arbitrary arrest. I argue that some of the most prominent objections against affirmative action—in particular, the reverse discrimination objection and the merit objection—speak less against Non-competitive Affirmative Action. And that some of the most prominent arguments in favor of affirmative action, insofar as they justify Competitive Affirmative Action, also justify Non-competitive Affirmative Action. (shrink)

Tim Crane maintains that beliefs cannot be conscious because they persist in the absence of consciousness. Conscious judgments can share their contents with beliefs, and their occurrence can be evidence for what one believes; but they cannot be beliefs, because they don’t persist. I challenge Crane’s premise that belief attributions to the temporarily unconscious are literally true. To say of an unconscious agent that she believes that p is like saying that she sings well. To say she sings well is (...) to say that when she sings, her singing is good. To say that she believes that p is to say that when she consciously considers the content that p she consciously affirms it. I also argue that the phenomenal view of intentional content Crane appears to endorse prima facie commits him to the view, at least controversial, perhaps incoherent, that there is unconscious phenomenology. The ongoing explosion of interest in artificial intelligence is fueled in part by recently developed techniques in machine learning. Those techniques allow automated systems to process huge amounts of data, utilizing mathematical methods that depart from traditional statistical approaches, and resulting in impressive advancements in our ability to make predictions and uncover correlations across a host of interesting domains. But as is now widely discussed, the way that those systems arrive at their outputs is often opaque, even to the experts (...) who design and deploy them. Is it morally problematic to make use of opaque automated methods when making high-stakes decisions, like whether to issue a loan to an applicant, or whether to approve a parole request? Many scholars answer in the affirmative. However, there is no widely accepted explanation for why transparent systems are morally preferable to opaque systems. We argue that the use of automated decision-making systems sometimes violates duties of consideration that are owed by decision-makers to decision-subjects, duties that are both epistemic and practical in character. Violations of that kind generate a weighty consideration against the use of opaque decision systems. In the course of defending our approach, we show that it is able to address three major challenges sometimes leveled against attempts to defend the moral import of transparency in automated decision-making. : I focus on Uriah Kriegel’s account of conative phenomenology. I agree with Kriegel’s argument that some conative phenomenology is primitive in that some conative phenomenal properties cannot be reduced to another kind of property. I disagree, however, with Kriegel’s specific characterization of the properties in question. Kriegel argues that the experience of deciding-and-then-trying is the core of conative phenomenology. I argue, however, that the experiences of trying and acting better occupy this place. Further, I suggest that the attitudinal component (...) of the experiences of trying and acting is not, as Kriegel suggests, best characterized in terms of commitment to the rightness or goodness of the objects of experience. Rather, I argue that the attitudinal component is best characterized in imperatival terms. Mentre condivido la tesi di Kriegel, secondo cui parte della fenomenologia conativa è primitiva, nel senso che parte delle proprietà fenomeniche conative non possono essere ridotte ad altri tipi di proprietà, debbo tuttavia dissentire riguardo la specifica caratterizzazione data da Kriegel delle proprietà in questione. Kriegel ritiene che l’esperienza del decidere-e-poi-sforzarsi sia il nucleo della fenomenologia conativa. Io direi tuttavia che le esperienze dello sforzo e dell’azione occupano meglio questa posizione. Inoltre, suggerirei che la componente relativa all’atteggiamento delle esperienze dello sforzo e dell’azione non sia descrivibile al meglio, come suggerisce Kriegel, in termini di impegno legato all’adeguatezza o all’integrità dell’oggetto d’esperienza. According to a number of influential views in penal theory, 1 one of the primary goals of the criminal justice system is to rehabilitate offenders. Rehabilitativemeasures are commonly included as a part of a criminal sentence. For example, in some jurisdictions judges may order violent offenders to attend anger management classes or to undergo cognitive behavioural therapy as a part of their sentences. In a limited number of cases, neurointerventions — interventions that exert a direct biological effect on the brain (...) — have been used as aids to rehabilitation, typically being imposed as part of criminal sentences, separate treatment orders, or conditions of parole. Examples of such interventions include medications intended to attenuate addictive desires in substance-abusing offenders and agents intended to suppress libido in sex offenders.This chapter reviews some of the ethical issues raised by the use of neurointerventions as aids to rehabilitation. In this paper I argue that his neutrality notwithstanding, Kriegel assumes a form of realism that leaves unresolved many of the conundrums that characterize the debate on consciousness. La pensée de Heidegger sur le dieu cherche à trouver, retrouver ou découvrir pour celui-ci et dans son histoire une dimension originaire et inaugurale et en même temps non-métaphysique, une voix qui parle dans un autre langage à venir et qui soit celle du monde et des mortels. Cette considération du dieu se rencontre aussi dans les tentaives mystiques d'Orient, en particulier dans le soufisme de la voie (tarika, طريقة) d'Ibn 'Arabi, qui retrouve son dieu autrement que dans sa dimension (...) de créateur. Ce dieu se révèle comme intrinsèque au monde - il n'est jamais sans monde, et surtout il s'avère avoir l'homme pour gardien, pour berger de sa parole et de ce même monde. Le points de convergence des deux pensées sont multiples. Nous offrons ici l'ébauche d'un dialogue qui s'avérera certainement très fructueux pour la pensée du dieu, surtout compte tenu des recherches actuelles concernant le sens du spirituel et du religieux. Le recueillement, l'intériorité qui dépasse la volonté et le défi qu'ils posent à la subjectivité sont au cœur des articlations que nous établissons das ce texte. (shrink)

È una credenza diffusa che i marchi di origine (DOCG, DOC, DOP, IGT, IGP e PAT, rispettivamente: di origine controllata e garantita; di origine controllata; di origine protetta; indicazione geografica tipica; indicazione geografica protetta; prodotti agroalimentari tradizionali) siano di grande utilità sia per i consumatori che per i produttori: certificando l’origine e il metodo di produzione di un prodotto, essi ne garantiscono una certa qualità di fronte al consumatore. Ma è proprio così? Che cosa giustifica l’introduzione di un marchio di (...) origine? Quanto sostengo qui di seguito è che, sebbene non credo si possa negare che i marchi di origine segnalino anche una certa qualità di un prodotto, forse non sono il modo migliore per farlo. Di fatto, per il consumatore, i marchi non garantiscono niente che vada oltre alla qualità richiesta affinché la certificazione venga rilasciata; ma, al contempo, in quanto forme di protezionismo, favoriscono certi produttori, prevenendo l’utilizzo della denominazione a chi offre un prodotto di qualità analoga o superiore, ma provienente da una zona priva di tradizioni. In altre parole: se vi sono prodotti equiparabili per qualità e gusto ad un dato prodotto di origine, e possibilmente più economicamente vantaggiosi, il consumatore non avrà modo di accorgersene dalla sola nomenclatura. Quindi: i marchi di origine sono (talvolta) un ostacolo all’acquisto e al godimento dei prodotti migliori al miglior prezzo. Talvolta: questo deve essere ben sottolineato, poiché in certi casi (per esempio quello dei PAT) il prodotto certificato dal marchio ha un mercato talmente di nicchia da costituire un tuttuno tra qualità e origine. (Si potrebbe aggiungere che le certificazioni dei marchi non sono sempre ottenute attraverso procedure affidabili. In questo lavoro distinguo tra due versioni della tesi del carattere incarnato della mente: “debole” e “forte”. Secondo la versione debole, il possesso di stati mentali presuppone l’esistenza di un corpo che si muove ed agisce nell’ambiente, ossia un corpo funzionale. Secondo la versione forte, invece, il possesso di stati mentali presuppone l’esistenza di un corpo non solo funzionale ma anche senziente, ossia: il corpo come sede della sensibilità o coscienza fenomenica. Sostengo che alcuni approcci all’interno della “scienza cognitiva incarnata” (...) implicano la forma debole di embodiment : la robotica di Brooks, l’enattivismo sensomotorio di Noë e O’Regan e l’enattivismo radicale di Hutto e Myin. In contrapposizione a queste prospettive, e basandomi sull’analisi fenomenologica della corporeità vivente e vissuta, difendo la forma forte di embodiment, secondo cui la mente si fonda essenzialmente sul corpo funzionale e senziente. The strong view on the embodied mind in phenomenology: In this paper, I draw a distinction between weak and strong versions of the “embodiment thesis”. The weak version claims that mental states are grounded in a body that moves and acts in the environment, i.e., a functional body. The strong version claims that mental states are grounded in a body that is not only functional but also sentient, i.e., a body that is the locus of sensibility or phenomenal consciousness. I argue that some approaches within the “new embodied cognitive science” – Brooks’ robotics, Noë’s and O’Regan’s sensorimotor enactivism, Hutto’s and Myin’s radical enactivism – imply a weak version of the embodiment thesis. In contrast, by drawing on a phenomenological analysis of living and lived corporeality, I argue for the strong version, which claims that the mind is essentially grounded in the functional and sentient body. Twitter is an instrument used not only for sharing public or personal information, but also for persuading the audience. While specific platforms and software have been developed for analyzing macro-analytical data, and specific studies have focused on the linguistic dimension of the tweets, the argumentative dimension of the latter is unexplored to this date. This paper intends to propose a method grounded on the tools advanced in argumentation theory for capturing, coding, and assessing the different argumentative dimensions of the messages (...) posted on Twitter, focusing on the types of argument communicated, the quality of their premises, and the fallacies committed – including the use of unshared presuppositions and emotive words. This method is applied to a corpus of 843 tweets published by the Italian Minister of the Interior, Mr. Matteo Salvini, from the date of his appointment to the beginning of his campaign for the European elections. The quantitative data provide general indications for detecting the strategies that characterize the argumentative profile of Salvini, which are then analyzed qualitatively. (shrink)

Stawarska considers the ambiguities surrounding the antagonism between the phenomenological and the structuralist traditions by pointing out that the supposed foundation of structuralism, the Course in General Linguistics, was ghostwritten posthumously by two editors who projected a dogmatic doctrine onto Saussure’s lectures, while the authentic materials related to Saussure’s linguistics are teeming with phenomenological references. She then narrows the focus to Merleau-Ponty’s engagement with Saussure’s linguistics and argues that it offers an unusual, if not an uncanny, reading of the Course, (...) in that it identifies a phenomenological dimension within the text, against the grain of the dominant structuralist claim. This phenomenological dimension is corroborated by the authentic sources of Saussure’s linguistics, even though the latter were beyond the philosopher’s own power to know. Merleau-Ponty’s unorthodox reading of the Course as being broadly compatible with the tradition of Husserlian phenomenology has been dismissed as an error and a contresens , but Stawarska proposes that such deviant appropriations of foundational texts are the ones to cherish the most, since they effectively dismantle the received dogmas and official doctrines stuffing the cabinets of canonical philosophy. She argues specifically that Merleau-Ponty’s contested distinction between “a synchronic linguistics of speech ” and “a diachronic linguistics of language ” , which gives primacy to la parole over la langue, and raises the possibility of a systematic study of la parole, contains a more faithful response to Saussure’s own project than the received structuralist view that la langue alone constitutes the proper object of linguistic study. Mais le génie littéraire de Platon lui fait une place, et la mise en scène des dialogues, comme les interactions des personnages, mettent en jeu différentes figures du silence par lesquelles se dévoilent d’autres aspects des réflexions socratico-platoniciennes sur le langage. Les silences du philosophe s’opposent, en effet, à ceux de ses interlocuteurs, autant que la pratique philosophique du dialogue aux discours sophistiques. Car le silence véritable (...) n’est pas que l’absence de voix, ni même simplement l’attente d’une parole à venir, mais, en dernière analyse, un retour à la source du logos : la pensée et l’être même. ABSTRACT (ENG) The recent evolution of the most advanced societies is characterized by the increasing use of hypertext. The latter is an electronic text with hyperlinks to other text that a user can immediately access. The World Wide Web itself is a sort of global hypertext that can be viewed as a network of nodes, represented by individual elements connected through the so-called links. In this paper, I ask myself in what sense reading with new technologies is a different cognitive (...) experience from reading a printed text. In the first part, I examine the conditions that made the emergence of hypertext possible by examining some mutations in human thought. In the second part, I argue that the emergence of hypertext has not only made the reading experience different but has also reshaped the figure of the reader. -/- ABSTRACT (ITA) L’evoluzione recente delle società più avanzate è caratterizzata dall’uso crescente dell’ipertesto. Quest’ultimo è un testo elettronico con riferimenti ad altri documenti, accessibili cliccando su parole chiave. Lo stesso World Wide Web una sorta di ipertesto globale che si può immaginare come una rete di nodi, rappresentati da singoli elementi connessi attraverso i cosiddetti link. In questo articolo ci chiediamo in che senso leggere con le nuove tecnologie sia un’esperienza cognitiva differente rispetto a quella di leggere un testo stampato. Nella prima parte esaminiamo le condizioni che hanno reso possibile l’emergere dell’ipertesto considerando alcune mutazioni in seno al pensiero umano. Nella seconda parte argomentiamo che con l’ipertesto è nata una nuova forma di lettura che ha a sua volta costituito una nuova figura di lettore. (shrink)

This paper addresses the scarcely scrutinized topic in the consumer culture literature regarding how a social actor consumes himself through speech acts. More specifically, by introducing a new type of speech act, viz. the taboo speech act, and by effectively differentiating it from expletives, slang, and swearing words and expressions, I outline how subjectivity appropriates and individuates its systemic underpinning as other or linguistic system (Saussure) and wall of language (Lacan) in linguistic acts of transgression. Taboo speech acts do not (...) merely express emotions, such as anger and frustration. They also seek to contain a linguistic system as an ideational totality of acts of parole in a primus affectivus that is incumbent on the inverse sublimation of epithets and cultural symbols standing synecdochically in a pars pro toto relationship for the limits of what is culturally/linguistically sanctioned. The subject consumes/annihilates and institutes itself at the same time in taboo speech acts whose mission may not be fully accounted for through conversational pragmatics, insofar as they perform at a more foundational level a social ontological function. The offered analysis aims at contributing to the extant literature in consumer cultural theory, applied linguistics, and social theory. (shrink)

Nel suo intento di rinnovare il nostro modo di comprendere l’esistenza e questa stessa comprensione, Morin spiega una retorica affatto singolare che si contraddistingue per il ricorso ‘disinvolto’ a concetti filosofici e scientifici già consolidati, ma reinterpretati nel suo quadro concettuale, ed a termini da egli stesso coniati. Per tali ragioni, oltre che per le parole non italiane e quando è specificato altrimenti, mi servirò del corsivo tutte le volte che riferisco un concetto originale del filosofo francese. Ciò non (...) solo per mantenermi il più possibile fedele alla lettera dei suoi scritti ma anche e soprattutto per rendere l’intenzione locutoria, ovvero l’enfasi e a tratti la ‘drammaticità’ del suo discorso. Per tutte le citazioni, non solo di Morin, uso le virgolette doppie e tra parentesi quadre inserisco eventuali miei interventi. Le virgolette singole intendono il senso lato di un termine. Quando invece impiego concetti scientifici o filosofici nel significato tecnico che hanno acquisito all’interno del loro orizzonte disciplinare (quindi non nell’interpretazione di Morin, per intenderci), mi servo dei caporali. Una precisazione ulteriore merita il concetto di complessità organizzazionale che rientra tra quelli che hanno guadagnato a Morin la critica di abusare di neologismi. Tale concetto si propone di mettere in rilievo il carattere attivo e creativo della complessità. In francese questa differenza emerge chiaramente perché egli cambia organisation con organisaction. In italiano essa può rendersi per iscritto con organizz-azione ma nel parlato si può apprezzare meglio nell’attributo appunto organizzazionale. La messe di note a corredo del testo si propone, oltre che fornire ulteriori approfondimenti, confronti e una puntuale fonte bibliografica, di mettere in rilievo la coerenza che au fonde il «sistema» di idee elaborato da Morin mantiene al suo interno e, forse a dispetto delle sue stesse intenzioni, con il pensiero filosofico occidentale (fin dalla sua denominazione come metodo). After noting the absence of a mutual confrontation, the aim of this research has been redefined in reconstructing the influence of Habermas’ writings on the work of Zygmunt Bauman – an aspect known to scholars of the Polish sociologist but not very well recognized in the international sociological community. Il problema di determinare quali siano i fondamenti dell’etica si riflette direttamente sul dibattito tra le principali etiche normative che si è arricchito, in tempi molto recenti, della teoria morale detta “esemplarista”, proposta da Linda Zagzebski, voce illustre nel panorama della filosofia morale, della conoscenza e della religione analitiche. L’esemplarismo, come ogni altra teoria morale fondazionalista, ha a cuore la questione del fondamento, ma si distingue dalle classiche teorie fondazionaliste sfidando l’idea che tale fondamento possa essere un concetto. Infatti, Zagzebski (...) non fonda la sua teoria su uno dei concetti morali fondamentali (bene, virtù, atto giusto), bensì fa derivare la definizione di tali concetti dall’individuazione di un esemplare morale in “questa o quella” persona. In altre parole, l’esemplarismo trova la sua fondazione non-concettuale in quei soggetti che ammiriamo per la loro eccezionalità morale. Questo contributo intende fornire una breve analisi della proposta esemplarista suddivisa in due parti: nella prima parte, ricostruirò i lineamenti essenziali dell’esemplarismo tentando di definire chi sia l’esemplare e quale sia la struttura portante della teoria esemplarista; la seconda parte, invece, includerà una breve critica della proposta di Zagzebski e alcune riflessioni sui vantaggi e le prospettive di ricerca che essa apre. Data-driven predictive algorithms are widely used to automate and guide high-stake decision making such as bail and parole recommendation, medical resource distribution, and mortgage allocation. Nevertheless, harmful outcomes biased against vulnerable groups have been reported. The growing research field known as 'algorithmic fairness' aims to mitigate these harmful biases. Its primary methodology consists in proposing mathematical metrics to address the social harms resulting from an algorithm's biased outputs. The metrics are typically motivated by -- or substantively rooted in -- (...) ideals of distributive justice, as formulated by political and legal philosophers. The perspectives of feminist political philosophers on social justice, by contrast, have been largely neglected. Some feminist philosophers have criticized the local scope of the paradigm of distributive justice and have proposed corrective amendments to surmount its limitations. The present paper brings some key insights of feminist political philosophy to algorithmic fairness. The paper has three goals. First, I show that algorithmic fairness does not accommodate structural injustices in its current scope. Second, I defend the relevance of structural injustices -- as pioneered in the contemporary philosophical literature by Iris Marion Young -- to algorithmic fairness. Third, I take some steps in developing the paradigm of 'responsible algorithmic fairness' to correct for errors in the current scope and implementation of algorithmic fairness. Le discours psychiatrique s’établit au XIXe siècle par un corps médical qui reproduit des relations de pouvoir : dans le cas de l’hystérie, le corps médical (majoritairement masculin) impose un discours de vérité sur un corps féminin qui est celui de la patiente. C’est la dimension genrée de ce phénomène que nous chercherons à clarifier en ce qui a trait aux relations de pouvoir, en avançant la thèse que les hystériques se dressent comme figure de résistance devant le pouvoir psychiatrique (...) – cette résistance étant rendue possible par la réappropriation d’une parole dérobée dans la production d’un discours de vérité. Pour ce faire, nous présenterons en premier lieu les démarches de Charcot, puis de Freud et Breuer dans les études sur l’hystérie. Nous emprunterons ensuite le cadre conceptuel foucaldien pour analyser les relations de pouvoir qui se trouvent au cœur de ces deux exemples, et nous tenterons finalement de montrer comment les hystériques peuvent être vues comme « militantes », à partir d’une perspective critique et féministe. Sentencing outcomes turn on moral and evaluative determinations. For example, a finding of “irreparable corruption” is generally a precondition for juvenile life without parole. A finding that the “aggravating factors outweigh the mitigating factors” determines whether a defendant receives the death penalty. Should such moral determinations that expose defendants to extraordinary penalties be subject to a standard of proof? A broad range of federal and state courts have purported to decide this issue “in the abstract and without reference to (...) our sentencing case law,” as the Supreme Court recently put it. Kansas v. Carr, 577 U.S. 108, 119 (2016). According to these courts, “it would mean nothing” to ask whether the defendant “deserves mercy beyond a reasonable doubt” or “more-likely-than-not deserves it” because moral questions are not “factual.” Instead, moral determinations are highly subjective “value calls” to which concepts of doubt and certainty do not intelligibly apply. -/- Implicit in these rulings is a controversial view of the nature of moral judgment. This Article traces the contours of the view and argues that it is out of step with the way the broader public thinks about morality and fails to address the issues defendants have raised. Courts should avoid wading into such controversial waters for two reasons. First, the judiciary has historically maintained neutrality on issues of significant public concern. Second, even if moral determinations are not factual, applying a standard of proof to at least some moral decisions at sentencing would change the outcome of the sentencer’s deliberations, and improve the legitimacy of the legal system. For the reasonableness of doubt depends on context; and moral questions—"are you certain the defendant deserves death?”—make salient the stakes relative to which a person should decide what to believe about ordinary empirical matters. On the resulting view, reasonable doubt in the final moral analysis is not just intelligible, but essential for correcting a bias in the structure of the bifurcated criminal trial that systematically disadvantages defendants: the tendency for de-contextualized "factual findings” in the guilt phase to control outcomes at sentencing. Poiché i miei interessi di ricerca si concentrano sul rapporto tra spazio e rappresentazione, nel presente articolo commenterò un lavoro di Achille C. Varzi pubblicato nel 2008 e intitolato, nella sua versione italiana, «Configurazioni, regole e inferenze». Accennerò anche a un secondo articolo scritto da Varzi e Massimo Warglien e pubblicato nel 2003, intitolato «The Geometry of Negation». Mi rivolgerò poi alla psicologia sperimentale, collegando alcuni aspetti delle osservazioni di Varzi a un articolo di Johnson- Laird del 2005 intitolato «The (...) Shape of Problems». Nelle conclusioni, farò un ultimo riferimento a un articolo di Varzi pubblicato nel 2000, scritto con Philip Kitcher e intitolato «Some Pictures Are Worth 2 אo Sentences». Le parole configurazioni, geometry, shape e picture nei titoli degli articoli di cui mi occuperò sono dei buoni indizi per capire quale sia il filo rosso che lega a mio avviso tutti questi lavori. Testimony about the future dangerousness of a person has become a central staple of many judicial processes. In settings such as bail, sentencing, and parole decisions, in rulings about the civil confinement of the mentally ill, and in custody decisions in a context of domestic violence, the assessment of a person’s propensity towards physical or sexual violence is regarded as a deciding factor. These assessments can be based on two forms of expert testimony: actuarial or clinical. The purpose of (...) this paper is to examine the scientific and epistemological basis of both methods of prediction or risk assessment. My analysis will reveal that this kind of expert testimony is scientifically baseless. The problems I will discuss will generate a dilemma for factfinders: on the one hand, given the weak predictive abilities of the branches of science involved, they should not admit expert clinical or actuarial testimony as evidence; on the other hand, there is a very strong tradition and a vast jurisprudence that supports the continued use of this kind of expert testimony. It is a clear case of the not so uncommon conflict between science and legal tradition. (shrink)

Il pensiero di Hans Jonas, specie per quel che riguarda la cosiddetta “biologia filosofica”, tratta indirettamente del rapporto tra essere umano e animale. A questo riguardo, Jonas rifiuta sia l’approccio dualistico, sia quello monistico-riduzionistico e propende al contrario per una complessiva reinterpretazione del fenomeno della vita nei termini di quel che egli definisce una “rivoluzione ontologica”. In virtù di ciò, il pensatore rintraccia lo specifico del fenomeno della vita e individua nelle forme viventi una scala naturae di complessità, auto-trascendimento e (...) libertà via via crescenti, le cui tappe significative sono la vita organica, quella animale e quella umana. Per quel che concerne la forma animale, varie specie presentano “potenzialità trans-animali”, che evidenziano un ponte biologico e ontologico verso l’essere umano. In altre parole, l’animale è in qualche modo in grado di prefigurare la forma di vita specificamente umana. Tuttavia, sostiene Jonas, non appena quest’ultima fa la propria comparsa, essa è tale per cui se ne evidenzia al tempo stesso anche lo “iato metafisico” rispetto alla vita animale. La specificità umana si manifesta nella propria capacità di essere responsabile e di preservare le condizioni basilari per una vita autentica sul pianeta. (shrink)

In this paper I argue for a theory of punishment I call Multilateral Retributivism. Typically retributive notions of justice are unilateral: focused on one person’s desert. I argue that our notions of desert are multilateral: multiple people are owed when a moral crime is committed. I argue that the purpose of punishment is communication with the end-goal of reconciling the offender to society. This leads me to conclude that the death penalty and life without parole are unjustified because they (...) necessarily cut communication short. (shrink)

Conversare è un'attività spontanea e apparentemente elementare, ma che coinvolge meccanismi estremamente complessi e sofisticati. Tramite numerosi esempi e illustrando le teorie linguistiche e filosofiche più recenti, questo libro vuole fornire al lettore una "cassetta degli attrezzi" utile per comprendere e (...) analizzare il funzionamento di quel particolare tipo di azione che è l'agire linguistico. E se la nostra verità fosse proprio lì, in quell’imperfezione che ci portiamo dentro e che cerchiamo a tutti i costi di negare? E se fosse solo nel momento in cui rinunciamo alla perfezione che possiamo poi vivere pienamente? -/- Autenticità come verità Quello di autenticità è un concetto che tutti crediamo intuitivamente di capire, ma che poi troviamo difficile definire a parole. È successo anche a me, tanto che ho preferito affrontare la questione rivolgendomi ai moderni depositari del (...) sapere. Secondo Wikipedia, l’autenticità coincide in sintesi con la verità. Autentico è – leggo - ciò che si riferisce alla nostra vera interiorità, al di là di quello che vogliamo apparire o crediamo di essere. Nel concreto, però, di fronte al problema di spiegare il significato di vera interiorità, Wikipedia finisce per limitarsi a definire autentico ciò «che non è falso o falsificato e che può dimostrarsi o imporsi come vero». Insomma, per ora dell’autenticità sappiamo solo ciò che essa non è: francamente, non è un segnale incoraggiante. (shrink)

Notre étude sur le temps grec précédant la pensée d Aristote commencera d'abord par un commentaire de son premier texte, le Protreptique. Nous verrons se dégager deux temps distincts : l'un initiatique, circulaire et d'inspiration platonicienne, et l'autre diamétralement opposé dont Aristote serait le défenseur. Afin d'interroger cette dichotomie, nous retournerons aux conceptions poétiques. Les Tragiques nous permettront d'offrir une première esquisse de cette notion dans l'univers grec (Du destin...). Ensuite, l'oeuvre épique d'Homère sera l'occasion de mieux saisir le nouage (...) existant entre le temps et la sphère religieuse (Des héros...). Le travail du grand théologue Hésiode viendra confirmer cette vision initiatique, comme l'avait déjà remarquablement exposée F. Nietzsche (Des mythes...). C'est alors que nous plongerons au sein du pythagorisme afin de parachever cette vision (Des mystères...). Notre compréhension de ce courant, traversé par la théogonie iranienne, nous permettra, ensuite, de bien le distinguer de celui dit «ionien» et ainsi de s'éloigner de la parole platonicienne (De l'idéologie...). À l'aube de la troisième décennie du XXIe siècle, l'existence de l'humanité est devenue hautement périlleuse. Nous abattons nos forêts, épuisons nos aquifères d'eau douce et perdons nos sols vitaux. Nous enlevons la vie de nos océans et la remplaçons par des centaines de millions de tonnes de déchets plastiques. Nous inondons notre environnement de produits chimiques industriels toxiques. Notre pollution est à l'origine du changement climatique qui provoque des vagues de chaleur, des sécheresses et des incendies de forêt qui (...) déchirent le tissu de la vie sur les continents. Et nous mettons au monde de nouvelles générations, des millions qui ont besoin d'accéder aux ressources d'une existence digne. La portée et l'ampleur des menaces à la vie augmentent jour après jour. Ce n'est pas un mode de développement durable. La cause profonde de nos maux provient d'une façon de penser erronée. Qu'est-ce que cela signifie exactement? cela signifie que nous nous considérons principalement comme des êtres matériels, tout en niant notre nature spirituelle. Parce quenous pensons que nous existons en tant qu'êtres matériels et rien de plus, nous accordons la importance à la protection de notre corps contre les dommages et à la prolongation de notre existence matérielle. Notre nature spirituelle, si elle est considérée du tout, est traitée comme un aspect secondaire de notre être physique, quelque chose à ne pas prendre au sérieux. Pour nous, les seules choses qui comptent sont les phénomènes qui apparaissent dans le monde matériel - des choses qui peuvent être vues, ou entendues, ou touchées, ou mesurées, mais nous savons que nos sens nous trompent, les sens sont une construction du cerveau . Ce que nous considérons comme un monde réel est une illusion. La domination de la pensée positiviste et matérialiste conduit à l'irrationalité et à la destruction. Mais où cette approche nous a-t-elle menés ? Cela nous a-t-il apporté un sentiment de bonheur et d'épanouissement ? Plutôt que de vivre chaque jour dans un esprit de coopération joyeuse, avec nos cœurs remplis d'espoir brillant et d'anticipation heureuse, nous avons isolé la -/- TRADUCTION 1 prépublication des Lettres académiques. nous démarquer des autres et les considérait comme des rivaux ou des ennemis. Nos pensées sont inondées de suspicion, de peur et de cupidité, conduisant à un cycle sans fin de guerre, de pauvreté, de famine et de destruction de l'environnement. À moins que nous ne nous réveillions bientôt et que nous ne prêtions attention à notre nature spirituelle, il n'y aura pas d'avenir pour l'humanité sur Terre. Les mots sont la vie. Les mots sont légers. Les mots sont le pouvoir. Les mots sont énergie. Les mots sont la vérité. Les mots peuvent animer et les mots peuvent aussi tuer. Les mots peuvent donner de l'espoir ou nous plonger dans le désespoir. Les gens utilisent des mots pour construire la paix et utilisent des mots pour faire la guerre. Les mots peuvent créer des murs entre les cultures, les religions et les nations. Et les mots peuvent aussi construire des ponts. L'existence d'un individu, d'une famille, d'une communauté, d'un pays et de notre planète est conduite au bien ou au mal par le pouvoir des mots que nous prononçons. Les mots que nous prononçons sont responsables de tout ce qui se passe dans ce monde. Nous devons donc être responsables des paroles que nous prononçons. Au nom des générations futures, j'espère que chacun de nous fera tout ce qui est en son pouvoir pour ne dire que des mots clairs et lumineux, afin qu'un jour, nos descendants naissent dans un monde rempli de lumière. Il n'y a pas de temps à perdre. À partir de ce moment précis, j'espère que nous examinerons tous de près les mots que nous avons utilisés et que nous ferons des efforts constants pour les remplir de luminosité. Personne ne changera nos vies à notre place. Personne ne changera le monde à notre place. Il est temps pour chacun de nous de reconnaître le pouvoir créatif prodigieux qui se dégage de chaque mot que nous prononçons et de ne prononcer consciemment que des mots remplis de gratitude, d'encouragement et de bonnes intentions. À partir de ce moment, choisissons des mots qui résonnent d'amour et de pardon pour nous-mêmes et pour les autres. Nous pouvons certainement le faire si nous ne faisons qu'un pas en avant. Un pas à la fois, un mot à la fois, nous pouvons déraciner les germes de la tragédie et de l'isolement dans notre conscience et les convertir en vagues de bonheur et de réconciliation. Pour nousmêmes, pour la Terre Mère et pour les générations futures, utilisons des mots qui contribuent à l'évolution positive de l'humanité sur Terre. (shrink)

Il principale obiettivo teoretico di questo lavoro consiste nel tentativo di verificare, attraverso un’indagine storico-genealogica e concettuale, come nella filosofia di Gilles Deleuze si assista ad un radicale mutamento del paradigma relativo alla nozione di trascendentale. Si tratta, in altre parole, di ripercorrere alcune delle tappe fondamentali che conducono il filosofo parigino a “purificare” il trascendentale da ogni riferimento ad una coscienza soggettiva egologica che si fondi in quanto principio genetico del mondo. Si riterrà utile procedere analizzando, in primo (...) luogo, il rapporto che Deleuze intrattiene con le istanze originarie del soggettivismo trascendentale kantiano, ove il trascendentale stesso, nel pensiero del filosofo tedesco, è strettamente connesso all’Io penso in quanto facoltà appercettiva dell’intelletto che incarnerebbe le condizioni di possibilità dell’esperienza. In secondo luogo, si tratterà di orientarsi nel dibattito critico che Deleuze intrattiene con la fenomenologia di Edmund Husserl, ed in particolar modo con la lettura husserliana della Critica della Ragion Pura di Kant, ove il padre fondatore dell’indirizzo fenomenologico novecentesco è colui che fa leva sullo stretto rapporto che sussiste tra il trascendentale e la coscienza. Nonostante il percorso storico, tracciato dal concetto di trascendentale, abbia inizio con l’opera di Kant, ritengo non sia possibile evitare un pur breve confronto con il ruolo che l’ego ha avuto nella formulazione cartesiana del cogito; si dovrà, per ciò stesso, considerare la particolare lettura deleuziana che riconosce nel cogito cartesiano il “luogo” in cui confluiscono tutte le facoltà del soggetto, permettendo di identificare il cogito stesso con una forma embrionale di piano di immanenza, seppur non adeguatamente radicalizzata nella misura in cui il cogito cartesiano resta saldamente ancorato al soggetto. Ritengo, tuttavia, che il più considerevole obiettivo di questa proposta d’indagine non si risolva in una ricostruzione meramente storico-genealogica. Si tratterà, al contrario, di verificare come l’importanza degli esiti raggiunti da Deleuze mediante l’opera di purificazione della nozione di trascendentale sia da individuare su due fronti: 1. La teorizzazione del concetto di campo trascendentale permette a Deleuze di disegnare una forma di temporalità non psicologica e non cronologica fondata sul paradosso secondo cui il tempo costituirebbe un’interiorità non psicologica, o per meglio dire, una dimensione autenticamente trascendentale nella quale il soggetto vive e diviene. 2. In antitesi ai proponimenti della fenomenologia husserliana, l’esito autentico del progetto di purificazione del trascendentale da ogni istanza egologica consiste nell’interruzione della correlazione a priori tra il soggetto e il mondo, nella destituzione della filosofia da ogni pregiudizio antropocentrico, e nella rideterminazione dell’umano niente più che come un effetto, o un caso, del mondo. Nous postulons trois étapes cognitives : le psychon, produit par la perception ; le construit, produit par intellection; et l’acte de parole, produit par la communication. La vérité se trouve à la seconde étape; seuls les construits sont aléthiques. La vérité est une qualité qui vient en degrés. La certitude est le point d’aboutissement parfait et inaccessible de cette gradation ; il s’agit donc d’un concept idéal. Une thèse (...) est réputée vraie si son degré aléthique est acceptablement efficace, sinon la thèse est considérée comme fausse. En d’autres termes, nous jugeons vraie toute thèse n’ayant pas assez d’échecs pour qu’elle soit considérée fausse. (shrink)

In questo articolo viene affrontata la questione della sovranità politica in rapporto alla crisi climatica e ai dispositivi di governance sorti per la sua mitigazione e adattamento. Vengono esposti in estrema sintesi i risultati di un più ampio progetto di ricerca sul nesso tra cambiamento climatico, globalizzazione e ristrutturazione neoliberista della sovranità, fornendo risposte preliminari ad alcuni quesiti. In primo luogo, vengono esposte le ragioni per le quali è opportuno tornare sul concetto e sulle pratiche della sovranità, per come essa (...) emerge dalla tradizione filosofico-politica moderna, in rapporto a problemi globali che concernono il pubblico interesse. È presentato un quadro sintetico delle trasformazioni subite dalla sovranità e dallo Stato a seguito dei processi di globalizzazione degli ultimi quattro decenni, e di come tali trasformazioni abbiano influenzato la risposta collettiva al cambiamento climatico. Vengono inoltre presentati alcuni casi studio per rafforzare la tesi che il modello «neoliberista» di globalizzazione, con le strutture di governance ambientale che ne fanno parte, presenta numerose criticità che impediscono un’efficace presa in carico della questione ambientale. In conclusione, viene tratteggiato un argomento normativo per un recupero di determinati elementi della tradizione concettuale della sovranità politica moderna come parziale rimedio alle esternalizzazioni socio-ambientali dell’attuale modello di globalizzazione.
